[0:28] >> Absolutely. Thank you for um steering the meeting. Appreciate that [0:32] very much. [0:33] >> Thank you. Thank you so much. We miss [0:35] you. Um and uh City Clerk, may we please [0:38] have the roll call? [0:40] >> Thank you, Vice Mayor. Adams? [0:42] >> Present. [0:43] >> Truong? [0:43] >> Present. [0:44] >> Krolik is absent. Ragsdale? [0:47] >> Present. [0:48] >> Cole? [0:49] >> Present. [0:50] >> Thank you. And Mayor Cole is [0:53] participating in the meeting by [0:54] teleconference under a just cause [0:56] provision of the Brown Act for the [0:58] caregiving need of a parent. Mayor Cole, [1:00] for for the Brown Act, can you please [1:02] disclose whether any other individuals [1:04] 18 years of age or older are present in [1:07] the room with you at your remote [1:08] location? [1:09] >> No, there are no other individuals [1:11] present with me in in this remote [1:13] location. [1:14] >> Thank you very much. [1:16] >> All right, thank you. Now we will stand [1:19] for the Pledge of Allegiance. Please [1:20] stand if you are able. [1:26] » Pledge allegiance to the flag [1:29] United States of America [1:31] and to the Republic for which it stands [1:34] one nation [1:36] under God indivisible with liberty and [1:38] justice for all. [1:42] » Thank you. [1:43] And now we will have a town update from [1:45] Assistant City Manager Mandy Brown. [1:55] » Good evening. [1:57] Mayor, Vice Mayor, and council members, [1:58] have a very brief town update since [2:00] there's not a ton to report on since a [2:02] couple weeks ago. [2:03] Um, I did want to plug the 70th annual [2:06] Concours d'Elegance, which will be [2:07] taking place on June 28th, and tickets [2:10] are available at the website below. [2:14] Oh, and then it's the 100th anniversary [2:16] of the Mercedes-Benz Corporation, so [2:18] that's what they'll be highlighting this [2:19] year. [2:22] Thank you to everyone who attended the [2:23] town pride event on June 9th, couple [2:26] pictures from the day. Huge thank you to [2:28] our youth commission for organizing the [2:30] event and taking care of all the [2:32] details, as well as staff from our city [2:34] manager's office, and of course public [2:36] works for the setup and takedown. It was [2:38] well attended and a beautiful day, great [2:40] speakers. [2:43] Rethink waste summer swap. Um, this is a [2:46] great event that they put on to um, [2:49] discourage waste and throwing things [2:51] away, trying to find another life for [2:53] things, and there is [2:54] um, [2:55] requirements of they must be donated in [2:57] good or fair condition, and then the [2:59] link is available so you can see what [3:00] items are available to swap, and that's [3:02] on June 20th. [3:06] Reminder about fireworks, uh, even [3:08] though some other jurisdictions do [3:10] permit fireworks, uh, Burlingame, [3:12] Hillsborough, and Millbrae do not. They [3:14] are all prohibited and illegal, um, and [3:16] make sure to call and report if you [3:18] think that somebody is setting off [3:20] fireworks either leading up to the 4th [3:22] of July or on the holiday. [3:24] Um, on a similar note, uh, town offices, [3:27] uh, will be closed on Friday, July 3rd [3:29] in observance of Independence Day. [3:34] This is long, so I'm not going to read [3:35] all of it, and we will also plug it in [3:37] our weekly bulletin, but just a reminder [3:39] that the November City Council is upon [3:41] us, um, and so our city clerk has put [3:43] together, uh, some [3:45] helpful resources and information on the [3:48] nomination period and nomination papers [3:50] and all of the logistics, and she's also [3:52] happy to meet with anyone if there are [3:53] any specific questions. [3:57] And then looking forward to July, we do [4:00] have quite a few items on that agenda, [4:01] so it should be pretty full. [4:04] These are just a couple highlights. [4:05] We'll be amending the license agreement [4:07] for the CCFD use at 1640 Floribunda, [4:11] flock agreement amendment, continuing [4:13] the discussion from July about the mayor [4:16] and vice mayor appointment and rotation, [4:18] as well as [4:20] informational update on the town hall [4:21] complex and the long-range financial [4:23] funding plan. [4:25] So, we will be looking forward to that. [4:28] And then here is our regular slide with [4:30] our emergency resources. Thanks. [4:34] >> Excellent. Thank you, Mandy. Um so, now [4:37] it's time for public comment on items [4:39] not on the agenda, and I do have a [4:42] formal script here for that, but there [4:44] is no one [4:47] I think online that has public comment [4:49] and no one in the room. [4:51] So, [4:52] I will do a a briefer version. [4:54] But, this is a time for people to give [4:57] comment for up to 3 minutes on items [5:00] that are not being covered tonight on [5:03] our agenda, and I will now open public [5:06] comment, and city clerk, do we have any [5:08] public comments on non-agenda items? [5:11] >> We do not. Thank you, vice mayor. [5:12] >> Thank you. [5:14] I will now close public comment, and the [5:17] next item on the agenda is an [5:19] announcement of conflict of interest. Do [5:21] any council members here or online have [5:24] a conflict of interest that they need to [5:25] disclose related to any item on the [5:27] agenda tonight? [5:30] >> None. [5:31] >> Thank you. [5:32] All right. So, now we are off to one of [5:36] our main events, a public hearing. This [5:39] is a um [5:41] a resolution authorizing the 5-year rate [5:43] series for water rate charges [5:45] the 5-year period from July 1st, 2026, [5:49] and a resolution making findings and [5:51] determinations regarding legal [5:52] objections, and this hearing is being [5:55] continued from June 8th of this year. [5:59] So, I'm officially welcoming you to the [6:01] town of Hillsborough's public hearing on [6:03] proposed increases to the water rates. [6:06] This public hearing has been continued [6:07] from June 8th, as I said. Before [6:10] reopening the public hearing, I would [6:11] like to ask staff to inform the city [6:14] council as to whether all valid legal [6:16] objections have been responded to and [6:18] presented to the council. [6:21] >> Uh yes, Vice Mayor. All valid legal [6:23] objections have been responded to, and [6:25] all objections and staff and responses [6:27] have been presented to the city council. [6:29] Thank you. [6:30] >> Thank you, and thank you for all those [6:32] um detailed uh uh [6:34] responses. I know you guys worked hard [6:36] on those, and we appreciate it. [6:38] In light of this information, I would [6:40] like to ask that the city council adopt [6:42] the resolution making findings and [6:43] determinations regarding objections to [6:46] the proposed [6:48] water rates. Before doing so, is there [6:51] any public comment on this item? [6:54] Please note that this resolution does [6:56] not adopt the rates. [6:58] If you have a public comment on the [7:00] proposed rate increases, you will have [7:02] an opportunity to be heard once I open [7:04] the public hearing. [7:05] Are there any public comments on this [7:07] item? [7:09] >> No, Vice Mayor. No public comment. Thank [7:11] you. [7:12] >> Thank you. [7:13] Um I will now close public comment on [7:14] this item. [7:16] Is there a motion to adopt the [7:17] resolution findings and determinations [7:20] related to the presentment of objections [7:22] to the proposed water rates? [7:24] >> I'll move. [7:25] >> Second. [7:28] >> I think we have a I think I think that [7:30] uh Council Member Adams beat you that [7:32] time for the second. It moved by Council [7:34] Member Shawng, seconded by Council [7:36] Member Adams. [7:37] Um and uh City Clerk, may I have a roll [7:40] call vote, please? [7:41] >> Thank you. Adams? [7:43] >> Yes. [7:44] >> Thank you. Swan? [7:46] >> Yes. [7:46] >> Kralik is absent. Rackstell? [7:49] >> Yes. [7:49] >> Cole? [7:50] >> Yes. [7:51] >> Thank you. [7:53] The resolution making [7:54] findings and determinations relating to [7:56] the proposed presentation of objections [7:58] to the proposed water rates has passed. [8:01] Before I open the public hearing, I [8:03] would like to ask our city attorney, [8:04] Christopher Diaz, to explain the [8:06] requirements of Proposition 218 [8:09] governing this public hearing and the [8:11] proposed rate adoption. [8:17] » Thank you, Vice Mayor Rackstell. Um so, [8:19] yes, um as we noted last um council [8:22] meeting and we'll note here today as [8:24] well, this public hearing was set in [8:26] compliance with Proposition 218. [8:28] The town mailed the notice of the June [8:30] 8th public hearing to the record [8:31] property owners subject to the [8:32] imposition of the proposed water rates [8:34] and tenants directly liable for the [8:36] payment of such rates. For example, the [8:39] customers of record who are not property [8:40] owners were sent notices more than 45 [8:43] days prior to the date of this public [8:44] hearing. [8:47] At the June 8th public hearing, the city [8:48] council continued the hearing to today's [8:50] date and that's why we're here this [8:51] evening. [8:52] The purpose of the public hearing is to [8:54] is for the city council to hear all oral [8:55] testimony and consider all written [8:57] protests concerning the proposed rate [8:59] increases. [9:00] It is also held to determine whether [9:02] there is a majority protest to the [9:03] proposed rates and whether to proceed [9:05] with the adoption of the proposed rates. [9:07] Members of the public who do not who did [9:09] not provide testimony on June 8th are [9:11] invited to provide oral testimony during [9:12] tonight's public hearing. [9:14] In addition, property owners and tenants [9:16] may submit a written protest by hand [9:17] delivering it to the city clerk prior to [9:19] the close of the public hearing. [9:21] Property owners and tenants are not [9:22] required to provide oral testimony at [9:24] today's hearing in order to in order for [9:26] your written protest to be counted [9:28] toward determining whether a majority [9:29] protest exists. [9:31] However, oral testimony without a [9:32] written protest will not be counted when [9:34] determining whether a majority protest [9:36] exists. [9:37] The public hearing will be closed after [9:39] the City Council has heard and [9:40] considered all oral testimony on these [9:42] items. [9:43] So, in order to be counted, protests [9:45] must be in writing, state that you are [9:46] protesting the proposed water rate [9:48] increases, include the name of the [9:49] property owner or tenant, the assessor's [9:51] parcel number or service address, and [9:53] signature of the person submitting the [9:55] written protest. Any protest submitted [9:57] by email or other electronic means will [9:59] not be accepted as a formal written [10:01] protest. [10:02] All valid protests submitted to the town [10:04] by mail or hand-delivered prior to [10:06] today's public hearing and received by [10:07] the City Clerk since the notice of the [10:09] public hearing was mailed will be [10:10] counted. [10:12] If written protests against the proposed [10:13] rate increases are presented by owners [10:15] or tenants of a majority of the [10:17] identified parcels upon which the [10:19] proposed uh water rates are to be [10:21] imposed, the City Council may not impose [10:23] the rate increases. Conversely, if there [10:26] is no majority protest, the City Council [10:27] may impose the rate increases. Pursuant [10:30] to state law governing Proposition 218 [10:32] in determining whether a majority [10:33] protest exists, only one written protest [10:36] per parcel may be counted. Thank you. [10:39] >> Thank you, Christopher. Um I will now [10:41] open the public hearing. [10:43] Speakers will be given a maximum of 3 [10:45] minutes to speak. A timer will be on the [10:47] screen. If you spoke during the June 8th [10:50] meeting on this item, your comments have [10:52] already been including included in the [10:54] record. We ask only that those who did [10:57] not already provide oral testimony on [10:59] June 8th speak at tonight's hearing. [11:02] After all oral testimony has been heard, [11:05] I will close the public hearing and the [11:06] City Clerk will tabulate the written [11:08] protest to determine whether a majority [11:10] protest exists. [11:12] Please note that questions from the [11:14] speakers will not be answered during the [11:16] public hearing, but if necessary, staff [11:19] will address questions after the close [11:21] of the public hearing. [11:23] We will now hear from anyone who wishes [11:25] to speak. If you would like to speak in [11:27] person, please complete a yellow speaker [11:30] card and provide it to the City Clerk. [11:32] And if you're on Zoom, please use the [11:34] raise hand feature. [11:38] City clerk, do we have any public [11:40] comments? [11:41] >> Thank you, Vice Mayor. We do not have [11:44] any public comments. [11:46] Thank you. [11:47] >> Thank you. [11:48] I'm prepared to close the public [11:50] hearing. Before I do that, I would like [11:52] to provide anyone who would like to [11:54] submit or withdraw written protest the [11:56] opportunity to do so. [11:59] I don't see anyone here wanting to do [12:01] that or anyone online trying to get our [12:03] attention. Uh once the public hearing is [12:05] closed, the city council may no longer [12:07] accept any written protests on the [12:09] proposed rate increases. [12:12] Are there any remaining written protest [12:14] to be delivered to the city clerk? [12:17] I don't see anyone here to do that. [12:20] Um [12:21] All right, the public hearing is now [12:23] closed. [12:24] I now ask the city clerk to provide the [12:26] city council with the tabulation results [12:28] for all valid written protest submitted [12:30] prior to the close of the public [12:32] hearing. [12:34] >> Thank you. Uh we received a total of 23 [12:37] valid written protest letters regarding [12:38] the rates for the water service charges. [12:41] A majority of the owners of the [12:42] identified parcels or tenants directly [12:44] liable for the charges would equal [12:46] 2,067. [12:48] A majority protest does not exist to the [12:51] proposed rates. [12:53] >> Thank you for that information. [12:55] The city clerk has advised that based on [12:57] the number of valid written protest [12:59] submitted prior to the close of the [13:00] public hearing, a majority protest does [13:02] not exist for the adoption of the [13:04] proposed rates for water rates. [13:07] The city council may now proceed to [13:08] consider the proposed resolution [13:10] adopting maximum rates for water service [13:12] charges and authorizing the [13:14] implementation of revenue stabilization [13:16] factors to the volume charge rates as [13:18] necessary and taking other actions [13:21] relating thereto. [13:23] Do any members of the city council wish [13:25] to speak or call on staff for any [13:27] clarification with respect to the [13:29] proposed rate increases. [13:33] » Through the chair. [13:34] >> Yes. [13:35] >> Um I I just want to say that uh [13:38] you know, the council have done quite a [13:40] bit of a studies on the water rates. And [13:43] um and the even though tonight we will [13:47] be adopting the resolutions uh [13:50] authorizing the 5-year rate series for [13:53] water rate changes charges. Um [13:57] every year we are subject to uh [14:01] evaluate. And we will have an [14:03] opportunity to discuss the rate to see [14:05] if the revenue is sustainable uh in [14:08] terms of supporting our operations. So, [14:11] I just want to make that clear to the um [14:14] our [14:15] uh to our town residents that every year [14:18] we will be reviewing this operations and [14:21] the revenues to see if uh there is [14:24] probable cause to continue to have the [14:27] prop 218 um [14:30] rate increases. [14:32] >> Thank you for that. [14:35] Councilmember Radem. [14:36] >> Thank you. [14:37] Uh Vice Mayor Ringstale, I I want to uh [14:41] emphasize how important uh what uh [14:44] Councilmember Schwang just said. And I [14:47] want to remind people that these are [14:48] maximum rates. So, they're not [14:51] necessarily the rate, but they are the [14:54] maximum that can be charged. So, I think [14:57] your council will do its level best to [15:00] make sure that everything as [15:03] Councilmember Schwang said, it meets our [15:05] financial goals, but also is fair and [15:09] transparent for the public. [15:12] >> Thank you. And Mayor Cole? [15:14] >> Yes, and I would just like to thank my [15:16] colleagues on the dais this afternoon [15:18] for clarifying those two important [15:20] issues. [15:21] And also further emphasizing [15:24] that [15:25] it's it's revenue stabilization effort [15:29] on the way because there are other [15:31] parameters that are changing [15:33] which includes the cost of purchase of [15:35] water [15:37] as well as [15:38] replacing aging infrastructures [15:41] as well as addressing um [15:45] recent rulings that are conflicted in [15:47] terms of where we should be which [15:49] direction we should be moving and I I [15:51] think I'm Councilmember Truong [15:53] um hit the nail on the head. [15:56] This is something that will be assessed [15:58] on an annual basis going forward. [16:01] And I know some residents have reached [16:02] out to me personally and expressed [16:05] concern that they are making tremendous [16:08] effort to conserve water and they were [16:10] concerned that the rates are going up. [16:13] Um unfortunately, you still need to [16:14] project out your revenue to make sure [16:17] you can fund your water system. So, as [16:20] the as people become really good at [16:22] conserving water and other parameters [16:24] are changing such as the cost of water [16:26] because of climate and [16:28] how much snow we have etc. etc. and [16:31] replacing aging infrastructure. [16:33] The shift in that cost continues and [16:35] it's beyond our control. So, those are [16:38] some of the parameters that's moving [16:40] this number. And I I think the the [16:42] bottom line is this is something that [16:44] will be reevaluated annually. [16:47] And the residents need to be reassured [16:49] that this is something that is critical [16:52] in terms of just [16:55] the basic um operation of the town and [16:58] the council and especially the staff the [17:01] finance staff keep a very close eye on [17:03] this. [17:04] So, thank you very much to the staff [17:06] that have worked on this for the past [17:08] several years. [17:10] I know it's been quite challenging at [17:11] times. [17:12] Much appreciated. [17:14] >> Thank you, Mayor Collins. Thanks to [17:15] Olive E you those clarifications. I [17:17] think it's very important to point out [17:19] these are maximum rates. A lot of study [17:22] went into them, but we're we're not done [17:24] and we do reevaluate every year. And um [17:28] uh [17:29] we we do our best. [17:31] Thank you. Um now, is there a motion to [17:34] adopt the resolution adopting maximum [17:37] rates for water service charges and [17:39] authorizing the implementation of [17:41] revenue stabilization factors to the [17:43] volume charge rates as necessary and [17:46] taking other actions relating thereto. [17:51] So moved, Councilmember Schwang. Does [17:53] the motion have a second? [18:00] » Yes. I'd like to second it. [18:02] >> I'm sorry. I was going to say something, [18:03] but I couldn't hear what Councilmember [18:05] Adams was [18:07] >> Yes. [18:07] >> going to say. I figured she'd second it, [18:09] but certainly. [18:10] >> Everyone was waiting to give someone [18:11] else a turn. You guys are so nice. Um I [18:14] second it by Councilmember Adams. [18:16] Um and any further discussion? [18:21] Seeing none, uh City Clerk, may have a [18:23] roll call vote, please. [18:24] >> Thank you. Adams? [18:27] >> Yes. [18:27] >> Schwang? [18:29] Kralik is absent. Ragsdale? [18:31] >> Yes. [18:31] >> Cole? [18:32] >> Yes. [18:34] >> Thank you. [18:36] And uh [18:37] thank you to everyone who put so much [18:39] work into um into these complicated [18:42] rates. [18:43] Our next item is new business, uh [18:46] resolution approving amendment number [18:48] three to the employment agreement for [18:50] our City Manager, Doug Davis, relating [18:52] to a compensation adjustment, and it [18:55] will be presented by City Attorney, [18:57] Christopher Diaz. [18:59] >> Thank you, Vice Mayor Ragsdale and City [19:00] Council. Christopher Diaz, your City [19:02] Attorney, here to present uh the agenda [19:04] item for the City Manager's compensation [19:06] adjustment. As you know, you've uh just [19:08] concluded a positive performance [19:10] evaluation for your City Manager. [19:12] Um at the conclusion of that, there was [19:14] a negotiation on a compensation [19:16] increase, and so that is reflected in [19:18] the amendment number three that's in [19:19] your packet this evening. [19:21] Uh for Brown Act purposes, do we need we [19:23] do need to disclose the new compensation [19:25] amount, and so just wanted to note that [19:27] for the record. The new compensation [19:29] amount included in amendment number [19:30] three is to bring uh the city manager [19:32] salary to $371,614.00. [19:37] Um and I'm happy to answer any questions [19:38] that the city council may have about the [19:40] amendment. [19:41] Thank you. [19:43] » Thank you for that presentation. [19:46] Uh do any of my colleagues have [19:47] questions on this item? [19:52] Seeing none, um I will now open public [19:54] comment. [19:55] Uh members of the public participating [19:58] in person are welcome to fill out the [19:59] other yellow speaker card. [20:02] And anyone who wants to make a public [20:04] comment on this item from Zoom may use [20:07] the raise hand feature. [20:09] I don't believe we have anyone on the [20:11] phone. If we did, star nine. [20:15] I don't see any public comment. Do you, [20:17] city clerk? [20:18] >> That's correct. I know public comment. [20:20] Thank you. [20:20] >> I will now close the public comment. Uh [20:23] may I have a motion to adopt the [20:24] resolution approving amendment number [20:26] three to the employment agreement for [20:28] city manager Doug Davis. [20:31] >> So moved. [21:12] Very and very important item to us as [21:14] city managers is very important [21:17] to the city council and the town. Thank [21:19] you. [21:20] Uh the next item on the agenda is [21:22] resolution adopting the 2026 salary [21:25] schedule for the town of Hillsborough, [21:27] which will be presented by [21:29] administrative services manager William [21:31] Lee. [21:33] >> Good evening, mayor, vice mayor, and [21:34] council members. This is just a [21:36] formalization item of the city manager [21:40] contract amount that you just uh [21:42] approved based on our CalPERS [21:45] obligations, contracts, and rules, we [21:47] need to um agendize the salary schedule [21:50] in a council meeting in order for it to [21:53] um [21:54] be approved and adopted and posted [21:56] online. [21:57] And with that, I can take any questions. [22:02] » Do my colleagues have any questions [22:05] on the salary schedule? [22:08] All right. Thank you. Uh I have no [22:10] questions also. Um [22:11] now I will open public comment, and city [22:14] clerk, do we have any public comments on [22:16] this item? [22:17] >> No, vice mayor. Thank you. [22:19] >> I will now close the public comment. Uh [22:21] may I have a motion to adopt the [22:23] resolution adopting the 2026 salary [22:26] schedule for the town of Hillsborough? [22:29] >> So moved. [22:31] >> Moved by the by Mayor Cole, and do I [22:34] have a second? [22:36] >> Second. [22:37] by [22:39] Council member Adams, and um do we have [22:42] any discussion? [22:45] All right. Uh city clerk, may I have a [22:46] roll call vote, please? [22:48] >> Thank you. Adams? [22:49] >> Yes. [22:50] >> Zhuang? [22:51] >> Yes. [22:51] >> Krolik is absent. Ragsdale? [22:53] >> Yes. [22:54] >> Cole? [22:55] >> Yes. [22:56] >> Thank you. [22:57] Unanimous vote. Um thank you [22:59] for presenting that to us, William. [23:02] Um the next item on the agenda is City [23:06] Council items. Does anybody have any uh [23:09] anything that they would like to report? [23:12] Council member Shaw? [23:13] >> Just really briefly, I came from uh One [23:16] Shoreline meeting uh this afternoon and [23:18] I want to report that the board adopted [23:22] the One Shoreline work plan, [23:25] flood zones budget, operating budget, [23:28] and capital [23:30] uh projects budget. Um one of the things [23:33] that I want to highlight is that um [23:35] we also adopted a resolution to accept a [23:39] grant of 9,620 [23:43] uh sorry, 962,500 [23:47] um [23:47] from the San Francisco Bay Restoration [23:51] Authority to for the planning and design [23:54] of the Brisbane Liv- Living Shoreline [23:57] project. And I the reason that I want to [24:00] highlight that is because we all drive [24:02] on 101. And if you see the freeway um on [24:06] the shores, you will see the roads are [24:09] uh the bank is uh eroding to the oceans. [24:13] So, this is why um [24:15] all these projects from the One [24:16] Shorelines are critical to all of us, [24:19] even though Hillsborough sits on the [24:21] hill. Um we all drive on 101, and so it [24:26] is critical that we have those repair [24:28] and um [24:30] uh it does impact all of us. So, I want [24:33] to thank Hillsborough, my council [24:35] colleague, who continue to support [24:37] membership uh to the One Shoreline, and [24:41] I continue to um [24:43] want to um applaud One Shoreline for [24:46] doing all these critical projects. Thank [24:48] you. [24:50] >> Thank you for that. Uh that is a is very [24:53] important. We are so interconnected here [24:55] in all of San Mateo County, and uh we [24:58] really appreciate your work on that on [25:00] that board. Thank you. And anyone else [25:02] have a an item to report? [25:06] I also don't, so if there's nothing [25:09] else, we are adjourned. [25:12] >> Great. [25:13] Thank you. [25:15] Excellent.
