Uh and they're [9:21] they have come back this evening. Uh I [9:25] you guys probably got the little memo [9:27] from me. I did discuss with um the um [9:31] town attorney about how we should go [9:34] about dispersing monies that we would um [9:38] approve and basically made it really [9:40] simple. Um he went through the statute [9:44] noted that there was no nothing new or [9:47] anything new that would affect our [9:49] ability to uh provide some monies to the [9:52] fire department for the requests. Uh he [9:55] noted that um [9:58] making uh donations to your volunteer [10:00] fire department is sort of a regular [10:02] course of business for most [10:03] municipalities. [10:05] Uh he thought that um we did not really [10:08] need to have a bidding process that um [10:14] if and he also noted that um if we were [10:17] to do a direct dispersement that would give the impression that [10:21] we're actually purchasing the equipment [10:23] and the fire department is purchasing [10:24] equipment. So he suggested to make this [10:27] really simple is let the fire department [10:30] do whatever their bidding process is [10:32] internally and whatever they decide to [10:35] purchase we we will agree to fund up to [10:37] a certain amount of whatever that [10:39] apparatus is they bring us a copy of the [10:42] sales order and we stroke them a check [10:45] I don't know gentlemen if it gets any [10:47] easier than that [10:49] so which made me very happy because [10:52] attorneys sometimes don't make things [10:53] any easier Uh so anyway, that being [10:57] said, I'll I'll uh hand the uh floor [11:00] over to uh Council Member Morave to [11:03] continue for the continued discussion. [11:06] >> Yes. So last month, we weren't 100% [11:09] certain how much money was in the speed [11:13] camera funds. Since then, we thought it [11:16] was around 400,000 or so. Since then, we [11:20] were able to get the number of 642,000 [11:24] that's currently in the fund. So, my [11:28] suggestion is that we fund the rescue [11:32] struts and the utility truck. Um that [11:39] with us funding those two items, the the [11:42] rescue struts are $30,000. [11:44] The um utility truck is $115,000. [11:50] With that, we are still at $497,000 [11:54] in the speed camera fund. I think we all [11:57] recognize that this is more than we [12:00] would obviously give yearly to the fire [12:03] department, but I think based on um how [12:07] it hasn't been easy for them to access [12:09] these funds um for the last few years [12:12] and they have not received any that we [12:16] can all kind of look at this as [12:18] cumulative over the past few years [12:20] knowing that it wouldn't be a yearly [12:22] thing that we would able to we'd be able [12:23] to do $145,000. [22:41] guys. [22:45] » Okay. Next item of business is the MDE [22:48] MS4 permit update and general asset [22:51] management update. And Manda Baker from [22:53] Will Centry Ballard is producing that [22:55] and she's with us virtually. [23:00] » Hear me just [23:03] so we're doing tonight is just an [23:06] informal briefing to give an update on [23:08] where their permit is. I know as [23:11] engineers I throw out a lot of acronyms. [23:13] So, let me try to really simplify what [23:16] this means. Um, [23:19] building on the briefing that I gave [23:21] about a year ago to to the new council, [23:23] it means that uh, as of 2024, March of [23:27] 2024, [23:29] the census results show the new market [23:31] was about 1500 residents over a [23:33] thousand, which means that that size, [23:36] New Market is classified as their own [23:38] urban entity, and needs to control their [23:42] runoff. uh anything that leaves the town [23:45] of New Market in Perious and enters [23:48] ditches and makes makes its way through [23:50] a stream or waters river. [23:53] >> Uh it's up to the town of New Market to [23:55] make sure that is clean storm water run [23:58] by mouth. Uh it's a triple down effect [24:01] from the EPA and parts of the clear [24:03] water clean water acts. The local [24:06] administration is the MDE, the Maryland [24:08] Department of the Environment. now [24:10] passed down which was previously under [24:13] Creger County's control is now passed [24:16] down to New Market because of its [24:17] population size. [24:19] Um [24:21] uh so there are several parts of what it [24:25] means to be put in control of their own [24:27] permit and their own runoff. Uh there's [24:30] some background work that we have [24:31] already done thanks to the grant that [24:33] the town won in the fall of 2024. We [24:37] were able to do a lot of the background [24:38] work that Amanda will [24:41] go through later when she shares her [24:43] screen and shows the database work and [24:45] all information that we've already [24:47] entered in. So that is the mapping [24:49] component. So the town needs to know [24:52] where all of its water runoff [24:55] infrastructure is, pipes, storm drains [24:57] or water management pods. So we've taken [25:00] the time, we've gone through all the [25:01] improvement plans for streetscape for [25:04] all the developments like Royal Oaks and [25:06] Brinkley Manor. We've entered in all [25:08] those drainage structures and we've [25:10] entered in store water management pond [25:12] footprints and the drainage areas and [25:14] those storm water management ponds. [25:16] That's a lot of the background that we [25:17] did with the grant money. [25:20] There's next steps that fall on the town [25:22] to implement and make sure they're doing [25:25] the best they can to inform citizens [25:27] about the clean water. There's aspects [25:30] of um community engagement, teaching the [25:34] community about pollution, about not [25:36] dumping the oil into the sewer, and [25:38] there's also aspects of sort of [25:41] community policing there. Another aspect [25:44] of this permit is that the community [25:46] needs to have availability and a way to [25:51] uh flag discharges that like if you see [25:53] your neighbor dumping his oil to the [25:55] stove drain or if you see your neighbor [25:58] is raiding his backyard to put a hole [25:59] in, there's a round water well coming [26:02] straight down into the screen. There [26:03] needs to be a way to uh report that so [26:07] that the so it can be noted. Uh there's [26:12] uh a governmental ordinance side of it, but the town [26:18] already has a lot of that covered. So [26:20] the town needs to be able to inspect and [26:22] look at all storm drains, whether [26:24] they're private, public property, and [26:26] storm water management facilities. [26:28] Luckily the way all your improvement [26:30] plans and agreements were written for [26:32] Franklin matter the order Royal Oaks the [26:36] HOAs themselves are responsible for this [26:38] and they take the responsibility and the [26:41] town has easements on all those storm [26:43] water management facilities. So we [26:45] already have that aspect where we can [26:47] access and inspect the storm water [26:49] management facilities in the [26:51] developments throughout town. And [26:54] another phase of it is the very last [26:56] phase. Once you get your permit, you do [26:59] yearly updates. You uh do a yearly [27:02] report with the NDE saying that you're [27:04] following everything that needs to be [27:06] done. You're keeping your uh pipe system [27:08] clean. You're keeping your ditches clean [27:11] and you are actively trying to treat [27:13] squirler run town. [27:17] Um there's also a lot uh an aspect of [27:20] training that belongs to town staff [27:24] which is the environment doesn't have to [27:25] worry about getting you don't have a [27:26] DPW, you don't have a maintenance yard, [27:29] you're not changing oil and watering [27:31] trucks and things like that. So being [27:33] how small you are so far, you don't have [27:35] to worry about that aspect of the permit [27:37] yet. [27:39] Um, so I'm going to turn it over to [27:41] Amanda to let you know what the progress [27:43] we made so far. And two items we're [27:46] presenting tonight are sort of [27:47] intertwined. The database she's going to [27:49] show has the storm water infrastructure, [27:52] but it also has some other town [27:54] attributes that you collected along the [27:57] way such as sidewalk ramps, lighting, [28:00] um, urban gutter condition and quality [28:03] throughout town. [29:33] So, Tim provided a little bit of an [29:35] introduction on what the permit is. Um, [29:39] tonight we'll go over an overview of the [29:42] anticipated permit. Uh my last [29:44] correspondence with MDE was um June 10th [29:49] in which they were providing um response [29:52] to comment on draft permit and they hope [29:55] to have revisions to the draft permit [29:58] sometime the end of this summer. [30:00] Sometimes that delays a little bit [30:02] because MD is underst staffed. Um but [30:04] they're doing a a good job getting [30:07] everything in order. [32:00] Well, the neighbors [32:02] involves they watch it all before they [32:06] movies and so they're in so now we are [32:09] watching and we keep going together [32:14] behind the scene. Um I'm not sure where you were [32:47] able to hear me or not, but um brief [32:51] overview of what we'll go over today is [32:54] um the anticipated permit overview. Um a [33:00] little bit of coordination that we've [33:01] had along the way in getting things set [33:03] up for the town. some live demos of the [33:07] database that we've developed and um a [33:10] high level demo of overall assets for [33:14] the town of New Market and an [33:16] opportunity for folks to ask questions. [33:33] So there are um six minimum control [33:36] measures that are anticipated for this [33:38] permit which is pretty typical for all [33:41] MPDS um MS4 permit requirements. One is [33:45] public outreach and education [33:48] um public involvement and participation. [33:50] So these two are fairly intertwined in [33:52] which um we'll provide educational [33:55] opportunities uh for citizens as well as [34:00] any um staff of the town. Granted, [34:03] there's not much in the way of staff [34:04] right now. Um, and ways for them to [34:07] participate. That can include um stream [34:10] cleanups, being part of the green team, [34:13] um, if there's any collaboration with [34:16] local schools. There's a lot of [34:17] opportunities for the the town to be [34:21] able to claim these first two uh, [34:23] minimum requirements. [34:25] The third is elicit discharge, [34:27] detection, and elimination. And [34:30] essentially what this is is they're [34:31] looking for hot spots where there's [34:34] illicit discharge. And what that means [34:35] is potential pollutants entering the [34:38] waterways. That can be um grease from [34:41] grease traps at restaurants. It can be [34:44] any residues coming off of maintenance [34:47] yards. So any potential contaminant that [34:50] could be entering um [34:52] entering into the storm drain. They're [34:54] looking for those hot spots. Uh a lot of [34:56] times you'll see those coming out of [34:58] storm drain outfalls and you'll be able [35:00] to trace those back. Um also the [35:04] construction of um storm water runoff [35:07] controls [35:09] uh which is going to be your storm water [35:10] management facilities post construction [35:13] storm water management. That's going to [35:15] be the inspection, typically a triannual [35:17] inspection of the facilities to ensure [35:19] that they're in good standing and [35:20] reporting any maintenance that's done [35:22] and pollution prevention and good [35:24] housekeeping. And that's looking at [35:27] overall town uh facilities and ensuring [35:30] that there's no um exposure of [35:33] contaminants to the local waterways, um [35:36] fueling stations, for example, any [35:39] maintenance yards. Obviously, these a [35:41] lot of these are going to be for larger [35:43] scale municipalities. So, it will be [35:46] scaled down um to follow in suit with the size of the town. Um and the [35:53] final very large uh component is the [35:56] impervious area restoration requirement. [35:59] And typically for the first year of a [36:03] new permittee, there will be a 20% [36:06] reduction in untreated impervious area. [36:11] And so we've started going through the [36:13] process of identifying all of the storm [36:17] drain um pipes, structures that can [36:19] include manholes, inlets, um different [36:24] um junction boxes, and so forth. as well [36:28] as identifying all of the storm water [36:29] management facilities and delineating [36:31] all the drainage areas for that. And [36:34] with that information, what we're able [36:35] to do is um quantify the amount of [36:39] imperous area that is currently draining [36:43] to a storm water management facility. [36:45] And once we have that that number, it's [36:48] called the baseline. And so, for [36:51] example, if we say we have a 100 square [36:54] miles of untreated impervious area, our [36:59] um permit requirement over the the [37:01] 5-year permit would typically be a 20% [37:05] reduction. And so, instead of 100, you [37:07] would want to see 80. And the ways that [37:10] you can meet this criteria is you can do [37:14] stream and outfall works or stream [37:16] restoration. If you have outfalls [37:19] um that are eroding um there's there's [37:22] various measures you can do to treat [37:24] those um tree plantings, sports [37:27] conservation and um septic connections. [37:31] So, tying current septic systems into uh [37:35] public [37:37] water and sewer. [37:40] So, out of the six minimum control [37:44] measures um that we know are going to be [37:47] in place, we're in very good shape for [37:50] the first three with not even have the [37:53] permit in place yet. Um you know, the [37:56] town already has the green team. We [37:59] already have educational [38:01] uh material and I'll go over that in a [38:04] little bit more detail in a moment. Um [38:06] we have training material to be able to [38:10] train any potential staff that will come [38:12] on or if you have a contractor that's [38:14] coming on if you want them to get [38:17] trained in it, you can also report that [38:19] to MDE. Um especially since the town [38:22] some of that some of those contractors [38:25] essentially act as the the town's [38:26] maintenance. um elicit discharge [38:29] detection elimination. I've gone through [38:32] and identified locations and [38:34] opportunities to um do sampling and the [38:38] appropriate documentation for that. The [38:41] last three, construction of storm water [38:43] facilities, um post construction of [38:46] storm water management facilities. [38:48] Obviously, we're not to a point where [38:52] we're designing new storm water [38:53] facilities or retrofitting existing [38:55] ones. So, those two, [38:58] we're just not there yet. The permit's [39:00] not mature enough really. It doesn't [39:02] even exist yet um for us to be able to [39:05] address these two. And the last one is [39:08] pollution prevention and good [39:09] housekeeping. Um the town doesn't have a [39:12] lot in the way of its own assets for [39:14] there to be a very large program for [39:16] this. So, I'm currently in coordination [39:18] with MDE to help better define what the [39:20] requirements are going to be for the [39:22] town. [39:24] Um, for the impervious restoration, I [39:26] mentioned that baseline. So, we've [39:28] gotten the impervious area inventory, [39:30] um, the storm water and drainage, um, [39:33] delineation, [39:34] our treatment calculations for all the [39:36] storm water management facilities, as [39:39] well as the, um, impervious area [39:41] baseline calculated. So essentially what [39:44] amount of imperous area within the town [39:46] is already being treated. [39:49] Um the agency coordination as I [39:52] mentioned we've been coordinating with [39:54] MDE as well as state highway [39:57] administration and the county. Um [39:59] they're going to be, you know, obviously [40:02] adjacent partners um going through Main [40:05] Street with the changes in right of way [40:08] um with the the project that occurred [40:11] several years ago. Um coordinating who's [40:13] going to be responsible for treatment [40:15] within that area. um and essentially [40:18] establishing a a relationship that's [40:20] going to demonstrate the town is going [40:22] to be good partners to those adjacent uh [40:25] entities. [40:28] And for the MPDS database, this is a [40:31] quick map um given just an overview of [40:35] what we have in place currently. And [40:37] what you can see is the green areas are [40:41] currently the areas that are treated by [40:42] storm water management facilities. The [40:45] yellow is untreated town impervious. [40:50] The purple is SHA impervious and blue is [40:55] um Frederick County. And if you'll [40:57] notice going through Main Street um that [41:01] showing is SHA and that is intentional. [41:04] I know that may flag question. Uh we've [41:07] been coordinating with State Highway on [41:09] defining who's going to have [41:10] responsibility for Main Street. And [41:13] currently the way that their permit is [41:14] set up, they already have jurisdiction [41:17] for that. So until their permit um [41:20] expires or they have to recalculate a [41:23] baseline, it's going to maintain under [41:25] them. And so that gives us a little bit [41:28] of leeway in terms of being able to get [41:30] the program established and focusing on [41:33] kind of more lowhanging fruits. As we [41:35] all know, Main Street's pretty well [41:37] developed, so it's going to be a lot [41:39] more difficult to provide treatment in [41:40] that area. [41:42] Um, another thing that we've done is [41:45] provided a story map. So, we went [41:47] through and developed [41:51] a outline of the town status [41:55] and this ties into um public engagement, [41:59] education, outreach. So, it gives an [42:02] overview of what the permit is. Um so we [42:06] go through kind of it ex it um runs [42:10] every five years you know provides links [42:13] to u get more information as well as an [42:16] interactive map showing the town's storm [42:19] water structures um and stormwater [42:22] management facilities [42:24] listing out what the town requirements [42:27] are and I'll provide a link to this so [42:28] that um folks can can kind of poke [42:32] through on their own time but it clearly [42:34] lays about what each of the minimum [42:36] control measures are. [42:39] We also have an outline of what our [42:41] currently efforts are current efforts [42:44] are um underway right now and a little [42:47] synopsis of what folks can do right now [42:50] in helping us get uh ramped up for this [42:52] permit. Um overall, we're in a very good [42:57] position. um we've been able to get a [42:59] lot done before the permit has even [43:01] fully been published and active. And so [43:04] a lot of what we're doing is very [43:06] proactive and making sure that we're [43:09] setting the the talent up for success. [43:11] So this isn't live yet. Um you know, [43:14] it's just something that we've been [43:15] working on internally, but again, I'm [43:17] happy to to share this link with folks. [43:20] And another part of the [43:26] permit is going to be the ability for [43:29] citizens to submit complaints. And what [43:32] that will entail is um providing some [43:35] minimum contact information, the type of [43:38] complaint, and this is going to tie [43:41] directly in with that elicit discharge I [43:43] was mentioning. So, um, illegal dumping, [43:46] if there's construction erosion that's, [43:48] um, not being treated and and making its [43:50] way off site, um, people dumping stuff [43:53] down storm drains. Um, they'll select [43:55] the type, the date, um, a description of [43:59] the issue, and they'll be able to go [44:01] through this interactive map and drop a [44:04] pinpoint on [44:06] where um, the issue is. They can submit [44:10] photos and that will all get pushed up [44:12] to us. will get notified and it is going [44:16] to provide the required documentation [44:18] that's going to be required for the [44:19] permit. So again, although this isn't [44:21] needed right now, we have everything set [44:24] up so that the town is ready [44:29] and [44:31] kind of uh associated with with that is [44:33] the town's overall asset management [44:35] database. So as time is allowed um you [44:40] know and and budget we've been working [44:42] on [44:44] developing a pretty robust repository [44:46] for the town's asset management program [44:50] and we've gone through and we've been [44:52] able to digitize items such as um [44:55] sidewalk curb and gutter um water sewer [45:00] electrical obviously the storm water uh [45:03] storm drain. We have all of the town [45:06] signs as well as inspection records and [45:09] photos for all of those signs and all of [45:11] the town's lighting posts and lights. [45:14] Um, and I'll exit out of this just for a [45:18] moment to show a little bit of an [45:20] overview of of what that looks like in a [45:22] little bit more detail. So, as I zoom in [45:24] here, um, you can see that the out uh [45:28] center lines for the sidewalks are [45:30] outlined. Um we have blue here for [45:33] water, yellow for gas, etc. And if we [45:36] were to go and um open up [45:41] one of the tables associated with it, [45:46] um we have the framework set up to where [45:49] the um size of the gas for example, the [45:54] structure type, any inspection [45:56] information, maintenance needs are all [45:58] going to be organized here um to make it [46:00] a lot easier, especially as the town [46:02] matures, to keep track of their assets. [46:04] That's um and I know this was a very [46:07] quick synopsis. I don't I don't want to [46:10] take up too much of everybody's time, [46:12] but if anybody has questions or would [46:14] like me to go over anything in more [46:15] detail, I'm more than happy to. But if there's [48:32] anything that anybody needs in more [48:34] detail, um you know, we can certainly [48:37] get that um you know, published for you. [48:40] the time frame on that, it's going to be [48:43] contingent on when the permit is [48:47] finalized and pushed out. Um, so [48:51] that's still kind of an unknown when [48:54] that permit's going to get pushed out. [48:56] Um, there's been a little bit of a lag [48:59] in when it originally was going to get [49:02] published versus [49:04] now. It it should have been published [49:06] already. It's it's there. Um, but with [53:58] the town being so small and not having [54:01] staff, not having a license, that's why [54:04] everything's being done essentially on my machine and then being pushed up [54:09] and stored on ARJS online. So all of the [54:12] data is under the town's account and [54:15] ownership. [54:17] So if if the town were to let's say hire [54:19] a GIS person, they would be able to log [54:22] directly into the account and access and [54:26] edit, manipulate, run analyses on the [54:29] data as as desired. [55:13] uh presenting is Pat Fox, town planner [55:16] and zoning administrator. As you might [55:17] remember, we were introduced to the [55:19] concept and had some background [55:21] discussion last month and this month [55:23] it's up for introduction. So Pat, if [55:26] you're with us and can take it from [55:28] here, [55:30] >> I'd be happy to. So the draft ordinance [55:33] that has been shared with council [55:36] members has been updated a bit from uh [55:39] the materials that we provided to you [55:42] earlier. Uh after consultation with the [55:45] town uh attorney on uh what the state is [55:49] requiring of us in the final um [55:53] legislation that they passed. Um, we had [55:57] come to the conclusion that the best way [55:59] to incorporate this requirement is to [56:01] add a new article to the LDO rather than [56:04] to try and modify our our current [56:07] accessory structure elements as I had [56:11] been proposing to do earlier. So, the [56:12] draft still has the same basic content. [56:16] It's just being added as a a new chapter [56:19] to the LDO. Uh the other change that you [56:23] see in the draft that we're recommending [56:25] for approval is that [56:28] uh we're proposing that there be a site [56:31] plan requirement for an ADU and that site plan uh would be approved [56:39] administratively by the zoning [56:41] administrator uh once confirmation [56:44] of a fairly long list of requirements [56:48] has been confirmed. [56:50] And that again is something that we've [56:52] concluded that the state is requiring of [56:55] us that we are not not able to do any [56:58] kind of a kind of discretionary review [57:02] of the use. We just need to um confirm [57:05] that we've met all the requirements that [57:08] the state has imposed on an accessory [57:10] dwelling unit. [57:12] The the list of requirements does [57:15] include that the property owner would [57:18] need to go to the county and get [57:20] confirmation that there is available [57:22] water and sewer and that that service [57:25] can be extended uh to the the new [57:29] proposed building. [57:32] The other uh variation uh is that in [57:36] order to [57:38] um be able to look at additional parking [57:42] for the accessory dwelling units, we've [57:44] included that the town would need to do [57:47] a very brief uh parking study of the [57:50] area in question. Um after reading what [57:54] the state is requiring of us, it's [57:56] something that Bill and I think could be [57:58] done by staff. It's not something that [58:01] would take a great deal of time, but we [58:03] will be able to look at, you know, how [58:06] many off-site parking spaces are there [58:08] around an applicant's property and how [58:12] heavy is the use of those for other [58:15] businesses and [58:17] uh tourist use and and general public [58:20] use before making a determination about [58:23] parking. [58:25] Um, so the this changed version was [58:29] presented to the planning commission at [58:30] their last meeting and they voted to uh [58:34] recommend approval to the town council. [58:37] And as we discussed last time, uh, this [58:40] ordinance needs to be approved by [58:42] October 1st in order to meet the state's [58:46] deadline. [58:47] One of the things we did talk about with [58:50] the planning commission is that as soon [58:52] as the master plan is done, we are um [58:56] scheduled to begin a overall review of [58:59] the land development ordinance as a [59:01] whole. So if we um were to adopt this [59:06] ordinance that has been presented uh to [59:08] you and there is some sort of [59:12] discovery of some glitch or bug in what [59:16] has been approved, we will have an [59:17] opportunity in fairly short order to [59:20] refine whatever it is that you choose to [59:23] adopt. Now the state has put [1:05:09] in language that says that accessory [1:05:11] dwelling units should not be counted [1:05:14] towards the development capacity. So [1:05:17] there may be some need to get an [1:05:19] interpretation on what they really mean [1:05:21] about that [1:05:25] » question. So uh the the ideas are to spend [1:14:23] this money which we ought to uh and the [1:14:27] trees must be added to eligible areas [1:14:30] that uh fall under the um forest [1:14:34] conservation act that can accept the [1:14:38] trees. So, um, [1:14:42] one of the ideas was, [1:14:44] um, add trees or set up a forest along [1:14:48] the property lines of, uh, Royal Logo [1:14:52] and, um, Lua and I'm looking at pictures [1:14:57] trying to figure out what that is. And I [1:14:59] think Nicole, can you explain where [1:15:02] those are along? Is it just where the [1:15:04] houses on that port? So there are [1:15:07] houses, but then there are also um the [1:15:10] backyard. There's $800 a tree for a large [1:19:12] tree. So that's not going to get you too [1:19:14] many trees out. Um, but they're nice [1:19:18] trees. They're beautiful maple, you [1:19:20] know, things. Um, so what I want to hear [1:19:24] is a little bit of discussion about what [1:19:27] kind of plants or trees that we could [1:19:31] use in these three areas that we talked [1:19:34] about that would serve or that we think [1:19:37] would be appropriate. I know that was [1:19:41] called bridge between on main street [1:19:44] there between the houses. Um, [1:19:48] and I mean here, you know, park part [1:19:51] like shade kind of trees would be nice, [1:19:54] but what about, you know, [1:19:56] part part of not mowing that one area [1:19:59] between the house would be what, you [1:20:02] know, bush type things too where the [1:20:05] bushes take over and you don't have to [1:20:07] mow the grass. And a [1:21:30] lady comes over and says, "Well, they [1:21:32] got to clean up over there. the grass [1:21:34] call and this that and the she called [1:21:36] DNR and all that stuff and the lady I [1:21:38] talked to the lady from DNR and she said [1:21:41] she had to tell the lady very politely [1:21:44] professionally that these are [1:21:46] forestation areas they're supposed to [1:21:47] look like these aren't golf course [1:21:50] manicured areas and I'm assuming that if [1:21:54] we plant something over there we're not [1:21:56] going to be doing a lot of mowing [1:21:58] assuming and maybe Tim will correct me [1:22:00] and that's fine if he does that we want [1:22:02] to make sure We DD and whoever the [1:22:05] neighbors are there understand that this [1:22:07] is a forest now. We'd have to do uh [1:25:34] special easements for that, but that is [1:25:37] an option uh in the ordinance, [1:25:39] particularly in the one that we've just [1:25:41] adopted. If you're doing a true forest [1:25:44] as the one that the mayor was [1:25:45] describing, I believe those areas have [1:25:48] to be a minimum of 35 feet wide so that [1:25:51] you're creating a forest environment. [1:25:54] But we do have an option to do urban [1:25:56] trees that are isolated. It just is a um [1:26:00] a little bit different in terms of how [1:26:02] you do the easements and the commitments [1:26:04] for maintenance, but that is an option [1:26:07] that we could explore if that's what the [1:26:09] council would prefer. Would those monies [1:26:12] that are that are set aside um [1:26:17] would they have would would they have to [1:26:19] be spent on on trees uh specifically or [1:26:23] could they go to the easements that may [1:26:25] have to be uh implemented for those? [1:26:33] I I believe it could be spent on the [1:26:37] entire package, both the trees and the [1:26:41] uh the legal work that it would take to create the easements and to record [1:26:45] it. But we can certainly ask that at the [1:26:49] meeting that uh we're scheduled to have [1:26:52] with DNR here um I believe on the 18th. [1:26:59] >> Okay. So I measured the [1:32:49] space because of the counter depth out [1:32:52] and then also the width because there [1:32:54] are heating elements and things against [1:32:56] the wall to for the space. So I did [1:32:59] measure all that. It is going to stick [1:33:01] out past the counter a few inches [1:33:03] because anything um this is like a 25 in [1:33:08] countertop. So anything smaller than [1:33:11] that is a really small like floor size [1:33:15] refrigerator. So, to get the commercial [1:33:17] size, it is going to stick out a little [1:33:19] bit. Um, it won't have a freezer because [1:33:22] to do a commercial with a freezer, it [1:33:23] has to be double and it won't fit in [1:33:26] that space, the width of it with the [1:33:27] elements on the other side. So, long [1:33:29] story short, it it would look pretty [1:33:32] standard size. It would have no [1:33:35] separator in the middle, glass door on [1:33:37] the front. It has to open to the right [1:33:39] because it can't open to the left [1:33:40] because it would hit the counter space. [1:33:42] Um it will be on wheels so we can move [1:33:45] it and clean behind it. Um and so for [1:33:48] delivery um installation and the [1:33:51] refrigerator it's $17813. So [1:39:53] the bathroom doors um we just got those [1:39:55] in last week. Um once I get the app set [1:39:58] up um on my phone and I can control it, [1:40:03] I will be opening the bathrooms. Um the [1:40:05] way that it's going to work is I can set [1:40:07] the bathroom doors to open at 8:00 in [1:40:11] the morning. They'll be open to the [1:40:12] public till 5 or 6:00 and they'll just [1:40:15] be open. And then at 6:00 they will [1:40:17] close again remotely um automatically. [1:40:21] So people won't have to need a code. [1:40:22] They'll just be open for use. um they [1:40:26] will be dead bolded on the inside, so [1:40:27] they won't be able to come into the [1:40:29] barn, but then when people do rent, [1:40:31] they're going to have to unlock to be [1:40:33] able to access from in here. The um [1:40:36] previous cleaning company was not very [1:40:39] good at communicating with Michelle and [1:40:41] I, and we had some issues with them, so [1:40:42] they've been let go. Um we have a new [1:40:45] cleaning company that starts Monday, and [1:40:47] they'll be cleaning once a week um to [1:40:49] start for us to see how often we need. [1:40:52] that will include bathroom cleaning and [1:40:54] a sweep of the event barn. Um there is [1:40:58] the alarm up and running, but it's not [1:41:00] on um currently. [1:41:03] Um [1:41:06] Kayla was hired as the event barn [1:41:08] coordinator on August 3rd. She came to [1:41:11] me yesterday and put in her uh [1:41:14] resignation. So I would be back um [1:41:17] looking for a new event barn coordinator [1:41:19] and interviewing again. she felt the job [1:41:22] was a lot than she expected. Um, getting [1:41:26] everything kind of off the ground. Um, [1:41:29] so if anybody has anybody that they know [1:41:31] that could be interested, um, we will be [1:41:34] looking for someone and reposting that [1:41:36] position. [1:41:38] Um, my K9 and cornhole event, I am [1:41:41] changing the date. I'm moving the [1:41:43] opening back um to the beginning of [1:41:46] October. I'm coordinating with Prospect [1:41:48] Pantry and the Lonely Hearts Rescue. [1:47:10] >> So, the uh planning and zoning uh [1:47:12] commission met on Thursday, August 6th, [1:47:16] and approved permit 2069B, the Calumet [1:47:19] improvement plans phase one, including [1:47:22] two variance reports for driveway size. [1:47:25] The commission also reviewed and [1:47:27] recommended forwarding to the town [1:47:28] council the draft ADU ordinance 202605, [1:47:33] which we considered earlier in this [1:47:35] meeting. In addition, the commission [1:47:37] authorized the town planner to schedule [1:47:39] a public hearing on the draft master [1:47:41] plan update formally issue the document [1:47:45] for further comment by the state and the [1:47:46] county. This initiates a com a comment [1:47:50] period of 60 days and we heard that from [1:47:53] Pat earlier uh this evening. Regarding [1:47:57] Glow Fiber, the final repairs to the [1:47:59] town's infrastructure and hardcapes were [1:48:02] delayed because of a contractor problem. [1:48:05] Glow Fiber now expects that these final [1:48:07] repairs will be complete by the end of [1:48:09] August. This has been posted on the [1:48:12] town's Facebook page to advise uh [1:48:15] residents. [1:48:17] The crosswalk sign at the northwest [1:48:18] corner of Maine and Prospect Streets has [1:48:21] been replaced. The sign was knocked down [1:48:23] by a tractor trailer on July 2nd, [1:48:25] shortly after it was installed. There [1:48:28] was at least one more incident of a [1:48:30] tractor trailer trying to navigate that [1:48:32] intersection and driving over the curb [1:48:34] in portions of the sidewalk and grassy [1:48:36] area prior to the placement of the sign. [1:48:39] Ironically, had the sign been placed at [1:48:41] that time, it would have been taken down [1:48:44] again. [1:48:46] >> On July 22nd, the sound the town sent a [1:48:49] letter to Frederick County requesting [1:48:51] that trucks be prohibited on Old New [1:48:53] Market Road. We received a response back [1:48:56] on August 10th saying the county traffic [1:49:00] and permit section will review our [1:49:02] request and provide a formal response by [1:49:05] August 21st. [1:49:08] The recently installed Ballard at the [1:49:10] north alley pedestri pedestrian [1:49:12] connection to William plumber has been [1:49:14] repositioned so the locking mechanism [1:49:16] can be engaged. I have since locked the [1:49:19] ballard with one of our padlocks. I will [1:49:22] provide a key to you, Nicole, to provide [1:49:24] it to the fire department for emergency [1:49:26] case. Um, and we will hold on to another [1:49:29] key at town hall. [1:49:32] And finally, uh, the Frederick County [1:49:34] Council is scheduled to hold a public [1:49:36] hearing on Tuesday, September 1st, 2026 [1:49:40] at 700 p.m. regarding the investing in [1:49:43] workers and workplaces IW2 plan and [1:49:47] associated resonings. This will take [1:49:50] place in the first floor hearing room of [1:49:52] Winchester Hall. This will likely be the [1:49:55] last time we as a town can influence the [1:49:58] county to not change their land use and [1:50:01] zoning maps to encourage further [1:50:04] development in the county and encourage [1:50:07] property owners to develop within the [1:50:09] town by instead seeking means of [1:50:13] annexation. [1:50:14] We are asking that proposed land use [1:50:17] designation and zoning changes for land [1:50:20] within the town of New Market growth [1:50:22] area be deleted from the draft IW2 plan [1:50:26] and that instead they recommend adoption [1:50:29] of a workers and workplaces plan that [1:50:32] supports town growth and economic [1:50:35] development and encourages town [1:50:37] annexation. [1:50:39] So, I'd like to encourage town council [1:50:41] and anyone in the town and surrounding [1:50:44] areas to attend the public hearing and [1:50:47] help convince the county to modify the [1:50:49] IW2 resoning plan to accommodate the [1:50:52] growth of the town instead of having the [1:50:54] county build up around us. Again, that [1:50:58] public hearing is Tuesday, September [1:51:00] 1st, 700 p.m. at Winchester Hall in [1:51:03] Frederick. And that's my report. [1:51:07] >> Okay. I plan on being there.
