So, we had a committee of [3:14] adjustment meeting dated July 15, 2026. [3:18] And we have draft minutes. [3:21] Um, there is a recommendation here that [3:23] the minutes of the Township of Mapleton [3:25] Committee of Adjustment meeting held on [3:27] July 15, 2026 be confirmed as circulated [3:31] in the agenda. [4:08] The location of this subject property is [4:10] legally described as part of lot 17 [4:13] concession 8P and is municipally known [4:16] as 73448 [4:18] line. Subject property is 40 hectares in [4:22] size and is occupied by a residence and [4:26] a dairy farm operation. [4:32] The purpose and effect of this variance [4:34] application is to provide relief from [4:36] the required minimum distance separation [4:39] to MDS2 from a type A use. The [4:43] applicants are proposing to construct a [4:45] dairy barn and manure tank and are [4:48] seeking an MDS2 setback of 171 m whereas [4:53] 220 m is required for the barn and 162 m [5:00] whereas 298 m is required for the manure [5:03] tank from the closest type A use. The [5:07] other variances other variances may be [5:09] considered where deemed appropriate. [5:13] Do we have uh any um notifications or [5:17] comments that have been received to date [5:19] by the secretary treasurer? [5:22] >> Thank you, sir. Staff can confirm that [5:25] property owners, Mapleton staff and [5:28] agencies were provided with the required [5:30] notice on or before July 22nd. [5:34] There is a comment summary included in [5:36] the planners report. Proper on-site [5:39] postings were completed July 23rd. [5:42] Source water comments from our risk [5:44] management inspector were received and [5:47] there was no concerns expressed. [5:49] County of Wellington comments from their [5:51] planner Jamie Barnes were received and [5:53] they're attached. [8:40] So at this point it's uh up to the to [8:44] the committee to uh either grant, [8:48] refuse, defer or reserve uh a decision [8:51] on this application and the four tests [8:54] that are required for us to consider are [8:57] is the variance minor in nature. Is the [9:00] variance requested desirable for the [9:02] appropriate development or use of the [9:04] lands, building or structure? [9:06] Does the variance maintain the general [9:08] intent and purpose of the official plan? [9:11] Does the variance maintain the general [9:13] purpose and intent of the zoning bylaw? [9:18] So based on on those those questions and [9:21] the the um analysis by staff, there is a [9:25] recommendation here that the minor [9:27] variance applied for in application A [9:29] 202614 [9:31] located at part of 7 part of lot 17 [9:34] concession 8 municipally known as 73448 [9:40] line to provide the following relief as [9:42] proposed. [9:44] a new livestock facility and manure [9:46] storage. [9:48] Um MDS2 set back to a type A use for a [9:53] livestock facility. The required [9:56] distance is 220 m proposed distance 171 [10:00] m difference of 49 m and MDS2 set back [10:05] to a type A use manure storage [10:09] requirement is 298 m. The proposal is [10:13] for 162 meters. There's a difference of [10:16] 136 meters. [10:19] So at this point, I ask for a motion or [10:23] a mover of the recommendation if we have [10:26] one.
