[0:47] No, I appreciate that. >> That's my that's the way it would have [0:51] happened. >> Okay. Um [0:54] unless unless anybody has any objection, I'll [0:58] get started. >> We [1:01] » Okay, good to go ahead. [1:23] Okay, we're ready. >> Okay. All right. Um, I will call to [1:29] well, we're back for just so that you know, we're um [1:34] call to order the meeting of the municipal authority August 17, 2026. [1:39] We're just back from an executive session of the board to discuss uh [1:44] privileged matters. Um, at this point, I'll do a roll call. Maria Kaine is [1:50] here. Steve Mel >> here. [1:53] » Walter Bennis >> here. Tim Kelly, he is not here. And [1:58] Kevin Moyer >> here. [2:00] » Our solicitor, Mike Madrin, is not present with us tonight. Um, our [2:04] engineer, um, in place of Dave Porter, we have Dominic [2:10] Scraano from McCome Engineering, operations manager, Steve Nie, is with [2:15] us as well. Okay. Um, at this point, let's stand for [2:20] the pledge of allegiance. I pledge allegiance to the flag of the United [2:24] States of America and to the republic for which it stands, one nation under [2:29] God, indivisible, with liberty and justice for all. [2:40] » Okay. Um, everybody's had a chance. Oh, members of the public, um, anybody need [2:47] to speak about agenda items? Is this an agenda item or [2:51] Okay, please step up and just give us your name and your address and let us [2:55] know what you're here for. >> Rest of us, [3:00] » save the battery. >> Uh John Butler, 102 Hunters run. Uh I [3:06] looked at the uh engineers report and I saw the flow and you have some real high [3:12] numbers and and that's my real concern because the Delorey will sir charge on [3:19] those things. Plus, we're all paying for it. Now, I know there was some comment [3:24] that the last meeting. Uh, do we have manhole manhole uh things to prevent [3:30] water going in? And are we looking at the the vent caps at the properties [3:37] at maybe below ground level? Uh, and you know, that's and are we checking to see [3:45] if people have some pumps because there's Camela has some real [3:51] high numbers. A couple others do too. And it's we're [3:57] all paying for that flow. Uh the other thing the the payment list [4:03] I know the supervisors after my request they've they put items in there [4:08] indicating what they're actually for rather than what gets who's getting [4:13] paid. And it's a lot of help if somebody looks at the payment list to see what's [4:18] going on. And apparently it it can be done with the software we have because [4:22] the supervisors have done that. Uh the the municipal authority financial [4:29] audits, are they going to be online? I'm interested in looking at the uh [4:34] especially the the the manager's report in there. I [4:41] but are they going to be aligned and the redemption of bonds? I asked the [4:48] supervisor in the meeting how much are we going to save? They told me I had to [4:52] come here to find out now and it's a variable rate loan. I'm I'm not so sure [4:58] I like that with the way interest rates are going up at this point, but there [5:03] should be you should be able to tell me how much when we refi how much we're [5:08] going to save and they didn't know. I'd like to know that number and you [5:15] know what what interest rate are we really starting out at? because I'm a [5:20] little I was a supervised commissioner in Marble and I don't particularly like [5:25] this kind of a deal that they're doing. I tend to like a fixed one. And what are [5:31] we paying right now on our current bonds? [5:35] So, and tax fees I am concerned because I know [5:41] New Town put a certain amount of capacity into the system when we put the [5:46] uh the line going down. uh I think on 25 20 252 it was a certain amount based on [5:56] the the flow in this town and we appear to be adding uh more projects and the [6:04] tap fee apparently was set at that time. So adding capacity at this point is [6:09] going to be more expensive. So the tap fee should be going up and I see you [6:14] have something on here talk about it. So, uh, [6:18] but okay, I gather you don't have a collapse. That's good. But, but, uh, I [6:24] think there should be more discussion on what won in executive session rather [6:30] than just privilege matters. I think you're really supposed to say more [6:35] general. I mean, if it's a lawsuit, you can say there's a lawsuit, but don't [6:40] think you can just get away. >> Well, it was a privilege. [6:43] » I'm just going to stop you at that point. I mean, we only talk about things [6:47] that we're entitled to talk about in the executive session, [6:51] » but generally is normally >> Yeah. There are items there are certain [6:56] there's a list of um certain number of items in the Sunshine [7:01] Act, >> right? [7:02] » Okay. And the reason I say privileged matters is sometimes if you're talking [7:07] about like a contract under negotiation is a privileged matter. Okay. but they [7:13] don't have contract under negotiation in the Sunshine Act. So, a lot of things [7:17] might fall under that. If we're um negotiating a settlement of a of a [7:23] dispute, that would be a priv privileged matter as well. Um but that might not be [7:29] named specifically in the Sunshine Act. Okay. [7:39] For instance, personnel matter is in there specifically. So I would say [7:43] personnel matter, but we didn't have a personnel matter to discuss. [7:47] » Okay. >> Okay. And thank you for all your [7:49] comments. We really appreciate it. >> You want to [7:53] » I mean we are going to be talking just so you know about um uh the audit and I [8:00] would uh that will be published. You will be able to look at that for sure. [8:04] Okay. It is finished. So, you'll be able to get to that. And the other thing was [8:08] the refinance. I think you mentioned um I think you'll have definitely some more [8:13] details um at our next meeting, but I think [8:17] generally tonight we could talk when we get to that point on the agenda, we can [8:21] talk about um overall savings >> comment on the flow [8:27] » and then the comment on the flow. Um >> it's seven inches of rain. [8:31] » Yeah. Yeah. This month, which is >> I think that's what he's concerned [8:34] about. >> The first time we had that much. [8:37] » It was a lot of rain this month. >> Yeah. And and I will comment just [8:42] further on your infiltration. We the board is really cognizant that we pay [8:46] for flow and we are aware that rain infiltration, which you brought up, is [8:51] an issue. I don't know if it's an issue for us as much as it is for other [8:55] authorities, but we're looking into it regardless. And you may be happy to hear [8:58] that we're currently undergoing a scoping project all throughout our sewer [9:03] system right now to try to identify infiltration points. Um, and I don't [9:07] know if that report's complete yet from MCMI, but it's very close to being [9:11] complete. And then we plan to surgically address those areas that may be [9:16] contributing to the infiltration to ensure that they're sealed up for [9:20] environmental and for rate paying reasons. So, we are we are currently [9:23] looking into that and dedicating resources to making sure that uh that's [9:27] tightened up. >> And I think Hunter's Run was not [9:30] originally on the five um what is it? The [9:36] » 537 plan. What >> 537 [9:38] » and then we added them later because your community really wanted to be [9:41] added. Was that correct, Steve? >> I don't know that. I know it was added [9:46] during the process. during the process, but I think the approved original plan, [9:51] Hunter's Run, was not in there. >> It may not have been. [9:54] » And we had a lot of, >> you know, interest in making sure that [9:59] we got got your whole community added. So, [10:05] but we appreciate we appreciate all of your comments. We really do. [10:10] Thank you. Okay. [10:14] Uh, all right. Moving on. [10:18] Everybody's had a chance to review the minutes from the July 20, 2026 meeting. [10:23] » We have to do the agenda first. >> Oh, I'm sorry. [10:26] » You want to amend it, right? >> Um, we are going to amend. Are we [10:31] amending it? The Fourth Avenue. >> Okay. All right. So, [10:36] » thank you, Walter, for keeping me straight. Um, first of all, I'd like to [10:43] ask for a motion to amend the agenda to include [10:49] um approve uh I guess it would be a required uh requirement to [10:57] or require the Fourth Avenue construction project to include a trap [11:03] outside of that newly constructed building consistent with the building [11:09] code. Do I have a motion to amend? >> Second. [11:14] » Okay, that motion has been made and seconded. All those in favor? [11:19] » I >> I [11:20] » I sorry for clarification. The move is to amend the agenda to require the [11:25] Fourth Avenue construction project to require a trap outside of construction [11:29] consistent with the code. >> Is that fair? [11:32] » The construction code. >> Consistent with the construction code. [11:35] Thank you. Yep. >> I think you want to say it's consistent [11:37] with the authorities requirements. I I think because the question is okay [11:42] because I think that they're saying it's not consistent with the construction [11:46] code. So I think there's the authorities requirements. [11:49] » Thank you, Steve. Amending that to state consistent with the authority the [11:54] authorities's practice and requirements to include a trap outside of the [12:01] residential facility or residential building. [12:07] Okay. Does the motion stand as as made and seconded? [12:11] » Okay. >> All right. And do we vote on that? All [12:15] those in favor I >> I All right. Um, and that will be at, [12:21] just so we know, let's make that at >> Yeah, I was assuming [12:25] » I'm gonna make it at new business 12. We'll make that at 12 [12:29] » five. >> Right. Uh, [12:32] so you're doing that now. You'll need to I know it's kind of confusing, but you [12:35] really should officially go back now and adopt your move your agenda. [12:39] » Right. Okay. >> I haven't done that yet. Yep. [12:41] » Okay. So now that the mot now that we have amended the agenda um do I have a [12:47] motion to approve the agenda as amended? >> So second [12:52] » moved by Walter, seconded by Steve. Okay. All those in favor? [12:58] » I >> I Okay, that motion passes. [13:03] Okay. Um, now everybody's had a chance to uh review the minutes from the July [13:10] 20, 2026 meeting. All right. Do I have a motion to approve? [13:16] » So moved. I second. >> Moved by Steve, seconded by Walter. All [13:20] those in favor? >> I [13:21] » I >> I. All right. Next is the treasures [13:25] report. I think we did get a >> Yeah, I I handed out a treasures report [13:30] to you earlier this evening. Um just for the public's notice. We'll be actually [13:36] publicizing the treasures report on the agenda tomorrow when we update the [13:40] agenda. Um and and do that. Uh my apologies. I was out of town last [13:46] weekend or over the weekend and I didn't get it done before I left to go out of [13:49] town. Um, so, uh, you do have in your report, uh, just so you know, we have [13:55] June's, uh, bank wreck because, uh, we did not get the, uh, July bank wreck [14:01] complete because we just got the latest, uh, um, bank statement on Friday [14:07] afternoon. Um, we were working on it today. uh we'll get it complete here and [14:12] we'll get you new uh new um bank wreck uh information and hopefully I can get [14:21] that before I post it tomorrow um or or earlier this week. Uh in addition to [14:26] that in your um in in addition to that in your packet was also the revenue and [14:33] expense. Uh just real quick, um you know, we're staying right about that [14:39] 90,000 negative in 72 and 105 positive in 73. Uh we're there. So, we're kind of [14:48] running right about where we would expect to be running. um regarding [14:53] revenue and expenses. Um and then um your capital, we haven't really done [14:59] much capital yet this year and so when we do those uh there'll be some change [15:03] in that, but that that's where that is. Um and your uh your escros are running [15:10] about on target. Uh also in your packet is the monies that are being reviewed by [15:15] Portnoff. Uh you had requested that I get Portoff in. I tend to do that for [15:20] the September meetings. Um, and that will be a good time. They just actually [15:26] um did a a mailing uh back in April and uh hopefully we'll have a you know [15:33] roughly about three or four months of that mailing and seeing whether or not [15:37] we can reduce the amount that they have uh on their list. And then finally, uh, [15:43] you have your aging report. Without port, uh, it just happens to be the way [15:48] it fell. Um, we end up having a tremendous number of accounts that are [15:53] on there. Um, it actually shows like some ridiculous number like a million [15:58] dollars. Uh, I don't want you to panic. The million dollars is actually all of [16:02] the July building or bill. So, not building, billing. I'll speak English [16:07] some point here. Billing. Um and uh what's outstanding there is about a [16:12] million three or million one roughly. Uh but if you look at what's outstanding at [16:18] the end of uh June and May and then in April uh your total uh there's about 106 [16:26] in April and then you add another uh roughly 10,000 to that. So about 116,000 [16:33] of old uh older than three months or older [16:38] than two months, I'm sorry. Uh in billings that are outstanding that [16:44] are not haven't been already turned over to Port. [16:51] » All right, >> that is your financial report. [16:53] » Thank you. Um next, the engineers report. [17:00] » Uh yeah, thank you. uh the executive summary. So just a brief summary of [17:04] engineering activities this month. Um our office coordinated with the [17:08] authority manager, solicitor and staff regarding the uh Camelap pump station [17:13] sanitary sewer overflow event. Our office will be circulating the sanitary [17:17] sewer overflow report that was prepared and filed to D by Delora. So be on the [17:23] lookout for that. Also, um, our office has reviewed [17:27] product submitts for the Westchester Pike sewer projects. [17:31] Um, the highway occupancy permit for Rner Drive has expired. We resubmitted [17:36] an application and it's under review by PENDOT. The HOP for the Dunoody area has [17:42] been extended extended until March 28th, 2027. [17:47] And we are also evaluating the impact to the pump stations uh with regard to 11, [17:53] 15, and 17 Campus Boulevard uh that potential development and the Hickory [17:58] Lane pump station decommissioning. Um also this month there was um a [18:05] complaint about trench settlement at 307 French Road. [18:10] Our office informed the contractor of the complaint. They met with the owner [18:15] and they will address um the issue when the project resumes. Uh the only caveat [18:21] to that, the owner asked that uh the contractor address the issue in the fall [18:25] so they can use their yard throughout the summer. [18:28] Um additionally, our office received the more construction video surveillance [18:34] files for review. Uh the videos are under review and a report with [18:38] recommendations will be prepared. We're about onethird of the way done through [18:42] that currently. So that's coming in the next few weeks. [18:46] Um [18:52] uh over the last month planning modules have been reviewed. Uh there was one for [18:55] the village of four seasons uh sewage facilities planning module and that's [19:00] currently ongoing coordination with the solicitor regarding the intermunicipal [19:05] agreement. [19:08] Um, >> I think that's been completed, hasn't [19:11] it? >> The intermunicipal agreement's been [19:14] completed, but I'm not sure how it ties in with Ds yet. So, I think that's what [19:19] they're working of how to get that make sure D [19:23] understands what we're trying to do. >> I apologize for inter [19:28] that that's what I I think they're working on. [19:31] » Okay. Um, also our office has reviewed uh four [19:35] public sewer connection permits. Uh, there was one at 113 Boot Road. [19:44] Uh, the second was 3111 Sawmill Road. Third was 3113 Sawmill Road and the [19:50] final was 147 Ridgefield Road. [19:55] Okay. And [19:57] » uh, yeah, that was the engineers report. Thank you. [20:00] » Thank you. Any questions for the engineers? Okay. Operation manager [20:06] report. That's >> Yeah, I actually somebody actually [20:10] already mentioned relating to the um flow uh that we had of rainwater and [20:18] what impact that had. Um and not surprisingly that there's an uptick when [20:24] we have those high uh rain things. I would just make clear that the overflow [20:30] that we had at Camelot related to the sewer piece uh was not additional flow [20:37] that went into the system. It was flow that didn't make it to the system. So [20:42] just that there's clarity on that. Um doesn't mean that there hasn't been an [20:47] increase in flow. I'm not saying there hasn't been on the rain days, but it's [20:50] that um that there was actually another issue that was going on there. And I [20:55] think that's why you see in that report where you see those zero days. Um that's [20:59] that's ties back to some of that. Um the other thing that I would make note uh [21:06] for you obviously if you hopefully you see the RHM flow as well that that that [21:12] stays pretty consistent. We stay around that 11 12% of the total. Um actually I [21:18] think we're down a little bit which tells me that our in inflow is not as [21:23] much as maybe the other surrounding municipalities. Um if that's the case [21:28] not 100% sure on that but our percentage seems to have dropped just a hair. Um [21:32] and so that may be the case. Other than that you look at the Delora report that [21:36] was sent in. Um couple minor things. You know there was a [21:41] at the Chrome Creek station there was a grinder contactor that had to be [21:45] replaced. Uh I believe there was a backup uh surge [21:51] uh arresttor that was replaced and then also uh that they came out and looked at [21:56] a primary uh power failure at Hunter at Hunt [22:02] Hunt New Town Hunt pump station. Uh other than that, everything was [22:06] standard. Pretty pretty quiet month. I like them that way. [laughter] [22:13] » Okay, we appreciate it. All right, moving on. Consider approving the bills [22:17] on check register dated August 17, 2026 totaling $38,995 [22:24] cents. >> So moved. [22:26] » Thank you, Walter. >> Second. [22:28] » Second by Steve. All those in favor? >> I [22:30] » I All right. Um, consider accepting the 2025 Municipal Authority financial [22:37] audits. Um, and I I think with some [22:41] understanding that we had a couple of questions and and but that wouldn't [22:44] impact our ability to accept the financial audits for 2025. [22:51] All those uh do I hear a motion? >> So moved. [22:55] » Second. >> Second from Walter. All those in favor? [22:59] » I >> I [23:02] » All right. Moving on. Um 12.2. Consider approving a refund to Donald and Wendy [23:08] Slwell for 3505 Mirwood Drive in the amount of $155.98 [23:16] for a sewer overpayment as they forgot to remove autopay when they moved. Do I [23:21] hear a motion? >> So moved. [23:23] » Second. >> Thank you. Any questions or comments on [23:26] this one? >> Do you recommend Are you recommending we [23:29] approve this, Steve? >> Absolutely. It's, you know, it's simple [23:32] that they just kept their auto pay on. >> Oh, so it was paying a balance didn't [23:37] exist. >> They were paying a balance that doesn't [23:38] even exist. Yes. Exactly. They moved and now the new property owner, but it went [23:43] to their account and we were looking at it going, why do we have an amount on a [23:48] account that we closed out that should be zero? And it's showing that there's a [23:51] credit and that's what happened. >> All right. All those in favor? [23:55] » I I >> I. [23:57] All right. Moving on. discussion and possible action item related to the [24:01] status of the pending redemption of sewer revenue bonds series 2018. [24:07] Um it's my understanding that um the board of supervisors are going to be [24:14] um voting on an ordinance related to this related to the redemption refunding [24:19] of the guaranteed sewer revenue bonds um to close. If I could just say that I [24:25] just just to add to that you're saying that that's actually tomorrow night. [24:29] » That's I'm sorry that's tomorrow. Yeah knows that. [24:32] » So that's yeah just just for the record. Um I don't think this is an action item [24:37] by any stretch but um you know it's my understanding that there is um an [24:42] ordinance u to be voted on with respect to that um guarantee the guaranteeing of [24:48] the sewer revenue bonds and the refinancing. [24:52] Um, so was there anything else I think uh [24:56] given the question that we had on the floor? You wanted to just speak just [24:59] generally to the savings or to the to the scheduling I think and then to the [25:04] savings. >> Okay. So originally we were looking at [25:07] the earliest redemption date was September 1st with the township meeting [25:12] tomorrow. We have a new schedule now that says that we will be able to uh [25:17] close and redeem the 2018 bonds on September 18th. It's a little bit later [25:22] than we expected. Um the your to the gentleman's question, uh the interest [25:27] rate is fixed. Uh currently we're looking at an interest rate fixed for [25:32] the whole period until uh 2048 at 4.329%. [25:37] Um our current interest rate is higher obviously and we're looking at um a [25:44] total of 1.277 277 million less interest expense uh over the term of the bond. Um [25:53] and that's I guess the reason that we're doing the refinancing is that we are [25:56] expecting that uh with that lower interest rate we'll be able to um [26:01] produce a savings of about 1.277 million at this point. [26:07] » All right. I really appreciate it. >> Sorry for notes. What's the new [26:11] anticipated redemption date? September 18th. [26:15] » September 18th. Thank you. And the anticipated savings [26:20] » 1,277. >> 1277. Thank you. [26:26] » Um and then the next item 12.4 um just uh possible um just discussion [26:35] item related to tap and fees. And I think we're going to table that for the [26:39] next time as our our um although Dominic very capable, we wanted to have our um [26:45] our engineer who has been dealing with um these issues for us uh more [26:51] regularly. So we will table that for next time. And moving on to the newly [26:57] added item 12.5. Um that was related to the 4th Avenue [27:03] item that um we're going to require that the um that a trap be installed outside [27:12] um consistent with municipal authority policies uh for the 4th Avenue property. [27:18] Do I hear a motion? >> So moved. Second. All right. Any [27:23] questions or comments? All those in favor? [27:26] » I >> I All right. Any old business or [27:31] anything else for the good of the order? Any additional public comment [27:37] based on any actions taken tonight? Okay. Hearing none, um I adjourn this [27:42] meeting. Thank you. >> Thank you. [27:59] I'm going to run upstairs and hit
