[0:00] forication tonight ladies and gentlemen I would like to have a moment of silence [0:04] for our people in West North Carolina and the people who are in the fir [0:09] [Music] [0:23] californ thank you Mr [0:33] United States of America [0:37] the stands [0:41] [Music] nais andice [0:56] all agenda ad options additions deletions correction Mr may we have one [1:01] item we like to add sing a new this [1:15] evening consent no we'll put [1:19] it item [1:26] 4 then you doent after that [1:36] is Emily Dale she's taken over Susan at the end of the month and [1:43] EM be our new town clerk and accounting manager for the [1:49] town and she's the resident town of crime [2:08] do solemnly swear do solemnly swear that I will support and defend that I will [2:12] support and defend the Constitution of the United States the Constitution of [2:16] the United States and the Constitution and laws of North Carolina and the [2:20] Constitution and laws of North Carolina not inconsistent there with not [2:23] inconsistent there with and I will Faithfully Faithfully perform and that I [2:29] will Faithfully per for the duties of the office the duties of the office of [2:33] accounting manager Town Clerk of accounting manager town clerk on which [2:36] I'm about to of which I am about to enter according to my best skill and [2:40] ability so help me God according to my best skill and ability so help me God [3:00] [Music] [3:17] motion fav likewise motion [3:23] carries consent any questions [Music] [3:27] clarifications hear none CH a motion to adop [3:32] agenda all fa I likewise motion carries item [3:40] six don't have a whole lot to update as of right now we've not received any [3:45] funds from FEA other towns either County I do want [3:50] to update fe's going to be in our office on Wednesday and Friday this week um one [3:57] thing I want to appreciate people going to do they're going to load all the data [4:01] of all the invoices we paid they'll do all the data entry to ensure that it's [4:05] loaded properly um I have received indications from them last week that [4:12] they they have money now they can start releasing money and we have to see some [4:17] shortly one thing they require they require a cancel check so we pay a bill [4:21] we got to wait till the check clears and submit the invoice and the cancel check [4:26] but that's going to be loaded tomorrow along with our equipment charges and [4:30] expenses being curred already one of the um things I want to share on Harmon [4:35] field a lot of people are saying why is it taking so [4:38] long um as you know we have a lot of mud and debris out there female wanted to s [4:45] be sample we have gotten that done it came back okay they also um the contract [4:52] we had selected last board meeting done project and so they're [4:58] going to be starting in I guess mid [5:02] no first that's good okay we get the mud out of there and so forth we also deal [5:09] with Poke County Poke County has now came out last week they want us to get [5:14] an appraisal of the cabin the two restrooms and the concession stand Poss [5:20] the open air gym that any repairs improvements we do to any those assets [5:26] if exceed 50% of that cost and requireed to tear it [5:31] down because the cabin is located in the immediate flood area but I also look at [5:39] if a negative happens it's also an opportunity one thing female wants to [5:43] work for this on that if we can't replace the [5:46] boardwalk they asked me to get a cost of the boardwalk which is [5:50] 162,000 about $100,000 higher than it was 20 years ago when I was here that [5:55] money can be transferred elsewhere into the park so one of the areas that Brad [6:01] and I are looking thday at um is at the empty Library building up there this may [6:08] be an opportunity to get that building restored I think that would be a great [6:12] Community Center for the town in har field but um like said him will be here [6:17] tomorrow we a lot of cost loaded um it is a slow process I originally [6:22] anticipated be open up the park by March 1st that dat's not going to be met but [6:27] grad of Staff done a great great job to open a portion on field and so that's [6:33] that's all plus but we like to get the rest of the park open as soon as we can [6:39] then once the mud's out of there we'll get an assessment of the playground [6:43] we'll have it inspected to make sure it's safe and didn't get anything underl [6:49] but on the cabin uh the county has asked us to retain the structural engineer [6:53] which should be out here next week to see if the foundation of the cabin was [6:57] under this so that's kind of my brief update for this month I'll keep it on [7:03] the agenda each month you stand any questions on the equestrian part of the [7:09] park those are the Stalls they damaged did damage IAD give an update on the [7:15] equestrian damage yes so the first two barns near har Road the first Barn is [7:20] very minor damage mostly debris but the secondy barn was hit pretty pretty hard [7:27] with debris no structural damage that we can find but a lot of debr damage so a [7:31] lot of those horse dos have been under we're to have those repacked with [7:36] screenings and then remat it the two barns on the river side beside the cabin [7:42] there's about three four foot mud in some of those stalls and there is some [7:48] Str one thing about the equestrian the equest community Del jum Association F [7:54] riding Hunt Club they already expressed interest they may want to up raise money [8:00] and volunteer time to get the question Park up and running sooner so that may [8:05] be opening up ahead of the other facilities have we lost any events [8:10] because yes we have cancellation har field board canel all the events C and [8:16] and so forth until we can but the question folks you want to get that part [8:21] opened up sooner which I think they'll [8:26] feel I want to say this for the record I get people that start me I get emails I [8:33] get text why can't we use har field why can't we use har field why can't we use [8:37] Harmon field and I guess I'm I'm preaching to the choir does it not occur [8:42] to you that if I could open Harmon field I [8:45] would I mean Common Sense would dictate that the first day somebody got mad and [8:50] I asked the question do you know where the River Bank Washed Out close to the [8:54] river no and I said we don't either do you know where all that wood that broke [8:59] off with 20 penny nails in under the sand do you know where that is no we [9:04] don't either do you know whether there's any [9:07] poison or anything like that in that sand at the time we didn't know either [9:12] that's why we closed it for your safety so if you're watching please be [9:18] patient how much money have we already spent out there to the town board is [9:23] already authorized up to $300,000 of general fund money to go to Feld and the [9:30] day I went out was so bad I said half a million is what it's going to cost and I [9:34] still think I'm right my goal is to when F money starts [9:40] coming into the confer we created a separate fund to restore har field it's [9:46] not out of har Bill bu it's separate fund so as the money comes back we'll [9:50] reinvest it into the next phase of destroying buildings and so forth U [9:55] because I I really don't I can't really recommend the town going [9:59] further in the fund balance beyond the $300,000 without shepardizing our [10:05] finances yes are we able to get any grant money [10:10] from uh North Carolina Department of Agriculture I know in the 2024 farm bill [10:16] they put in equestrian so would we be able to get in [10:20] grant money I'm not sure I guess you look at [10:25] that no we can definitely look at what culture yeah in their 2024 farm bill [10:32] they they put equestrian um more training facilities included in [10:46] Department anybody know anything we please tell [10:51] us thank you but I think once the cash starts [10:56] coming in I'll I'll send emails out to the council keep informed our first [11:01] money but I think it's promising I think there's direction from federal [11:05] government to start helping out nor [11:08] car you have any feel for when FEMA does release funds how long it's going to [11:14] take us to rec well [11:20] I question because initially the very first Mee they said it' be very prent [11:25] then the next meeting we met with them they said it might take two years [11:30] and then then I met with them recently and they said [11:35] it's um it's going to be quicker now part of the money was in the reoccurring [11:41] resolution passed by Congress few weeks ago fre up some money so I I keep asking [11:49] Susan let me know when the Ser Pro we have one invoice we [11:53] submitted just for for $78,000 with the canceled check on once [11:59] that money comes in it'll give us indication things are starting to work [12:02] now and I said when the reimbursements come in it's going to stay in that fund [12:07] we did receive a check for 31,000 from our insurance company for wind [12:13] damage F will take that off the top but um we got $170,000 just a SP the M Clean [12:22] Up which to Bill out part of the $300,000 you've already in for [12:28] us when the money comes in the first one of the El I know that things are now [12:33] working and I feel more confident one of the other things that [12:38] drives you crazy is that we work on a budget from 1 January to 31 December the [12:45] state works from 1 July to 32 the Fed works from 1 [12:50] October until 30 September so if they appropriate Congress right now is it [12:56] going to come in 2425 year the 25 26 year because we were give them a grant [13:03] that's being worked at at brav and we would told you got a grant but it was [13:07] for the next cycle any tell us that so there's some kind of hat tricks for some [13:14] of those people sometimes you're going to get it but have to be patient item [13:19] seven Road Clos for Super Saturday March 15 [13:25] 2025 can you tell us which the police [13:31] chief comment on how do you feel about that road [13:36] closure if they got proper in place like someone help support like law [13:42] enforcement or something of that sort I mean we've assisted with it in [13:47] the [13:50] past and you talk about M Roose yes okay yes I've been here a whole long time [13:59] we've always done that that's that's what we were it's it's something that's [14:03] this is the 47th year for Super Saturday something that you know by the way we [14:08] have to get this approved because that's one of the roads paved by the state and [14:11] technically it's in our town but the state owns it and paves it yes she had [14:16] said that we have to get approval from you but then it's by then so okay she on [14:22] a motion day is 15 March from until [14:27] um oh 8 until 3:0 [14:34] okay okay all favos likewise motion [14:39] carries item seven Bo [14:46] board um stepen is applied to be on that board I think they have I was told they [14:52] have one other opening and it can be anybody that's [15:00] ra your app works with us in fire department I [15:06] can for don't do that [15:13] sir CH a [15:19] motion [15:22] inse thank you welcome board sir thank you [15:27] sir item nine the town board approved recommendations [15:32] to establish additional committees that we done away with over the years I think [15:37] the Public Works utilities committee and finance committee Dior are going to be [15:41] two committees that offer great Insight recommendations to the town board [15:48] and mayor I think years ago we had citizens on the Public Works committee [15:55] we and so I just want to get feedback from the council members [15:59] um I guess the two minut I want to hear feedback on is the Public Works [16:04] committee um you think citizens would be helpful to a your committee as well as a [16:09] finance HR committee so I guess skip your chairman of the yeah I've reached [16:15] out to several citizens already with the would you be interested in and I've had [16:20] some really good feedback people want to know what's going on in the town want to [16:25] offer Insight from a citizen standpoint so [16:29] and I reached out to several residents in the east side Dr Fox and Dr Carson [16:36] are going to recommend some names for me and I've got one commitment from Dave [16:42] Lan some of you might know really sharp guy so a little crazy [16:48] but really sharp and he said he Lov it [16:53] [Music] so so on the finance committee [17:00] your so not reached out to anyone but I think that [17:06] it's I think we need CI it helps bring um confidence in the absolutely in the [17:13] town if you get others looking at the finances and so forth so I'm I I'm [17:20] supportive of it I'm very supportive of it so I think uh I think we should do [17:26] that we just need to figure out how many and then go and sort of look at who [17:34] would be interested in doing I'd like to add when you were here [17:39] before you came up with an idea of having a dinner with all committees and [17:44] volunteers of town to honor them we did we bought food everybody got together [17:48] and they talked and you had me stand up I think I spoke 35 seconds or something [17:54] like that and come to hear me and we want to hear what they had to say and I [17:57] would like to at Le consider being stating that next year about this time [18:02] assuming we can go to our place and cook out [18:05] there if I remember correctly I cook the stakes I think I cook the stakes when we [18:10] everybody a small steak well I guess we could nominate people Steve to [18:22] be well I'm saying I guess probably at least two citizens would be appropriate [18:27] I think we can always add later but I think um I guess I may a motion on a [18:34] council standpoint that you'd like to have up to two citizens be added to the [18:40] public works and the finance committees I would I would say three that odd [18:46] number alwayss well you're on the committee too I know but that's one two [18:51] three four third would [18:57] be oh but non voting typically or would they be non voting the alternate I think [19:02] the I only recommend alternate because in the [19:07] past it's been difficult to get council members to attend some of the functions [19:13] in Bard where I work before we had two members from the council attend all the [19:17] committee meetings um here maybe do a compromise an alternate but I encourage [19:24] the alternate to attend that up to speed on what's going on as well [19:29] so maybe up to three citizens per committee I would say that okay and one [19:34] and one counil whether primary Al only one [19:42] voting okay one of the things I thought because last week you'd asked I come to [19:47] the parts committee time conflict well I had [19:52] planned to but we had practice at school and I had a child didn't have a ride and [19:57] I just I couldn't walk by the time I got here was done but no I agree second [20:03] three need a motion [20:10] motion [20:20] car [20:24] upate which one of you going do this tonight I'm going to do it today try on [20:29] midnight was well attended we wanted to thank Andy Mard for providing music [20:32] throughout the evening Dean trus for doing a wonderful job with the ball I [20:36] don't know if any of you came to the ball drop and Kevin sprouls for the back [20:39] pipe accompaniment um we hosted a grand opening at the Trion Rejuvenation [20:44] Station over at 112 North Trade Street thank you for attending um we hosted in [20:49] conjunction with the Carolina Foothills Chamber Something That We're trying to [20:52] do is work a little more cohesively with the chamber so that we can bring the [20:57] biggest benefit to all of our business business down here um thank you to skip [21:01] Tracy and Julie for assisting us with their uh tdda will be hosting a grand [21:05] reopening for the nest they're remarketing their business um and [21:09] switching over from an artisan Market to a corner market um Tim and I got a [21:14] little sneak peek and so we were able they she's trying to do a lot of local [21:18] um cooking condiments oils teas spices it's going to be really cool once it's [21:23] done she'll still have some Artisan things in the back um and her her plan [21:28] in a couple of months is hopefully to have a cooler with local meats and [21:31] cheeses she's been talking to Looking Glass and so I think that'll be a good [21:36] asset for us to have here in town um and then uh tra uh TDA is requesting a [21:41] street closure for March 29th from 12: to 2 for April Fools Day on Trade Street [21:45] we've coordinated with the police chief for coverage already as well um and this [21:49] year it's going to be a parade uh ouse races and trash and show all on trade [21:54] stre okay a motion to approve close the street on 29 March 202 from noon to 2 [22:04] p.m. motion all faor I motion carries thank you I'm [22:15] notor chili cook off will be held just like [22:18] your chili cook off will be held on February 28th or February 4th Friday [22:22] that's how we're taking off for Fridays so if anyone wants to cook Jil let me [22:26] know um otherwise hopefully all come up to sample um it was a big hit last year [22:31] I think people were ready to get out right seemingly a little bit nicer but [22:35] still chilly but people didn't care and we were bombarded last year um and then [22:40] off of the tdda side and more onto the town side I handed each of you an [22:44] application uh for permission to use the logo uh in an effort to try to [22:49] streamline these things and I have people ask for permission to use the [22:52] moris image um a citizen has requested usage of that logo she's said over at [22:59] the trian antique shop um and in the logo act that we found we had to ask [23:04] permission from Council in order to approve [23:09] that yeah I mean I buy her stickers all the time [23:13] sorry Keeper in business I have the original so after the meeting I can have [23:18] one of you sign it if it's okay with you is loo copyrighted or trademark kind [23:24] of bar it is by the time yeah it's non enfor [23:33] state had it and we got it back from the state but if you go online you will find [23:40] that toy horse that backs all the way up to like [23:44] 1650 in Germany and all over the world people been making the toy wood the [23:49] looks just like they one spot here [23:55] there that's what we did to get it originally in [24:00] 1885 we B it from somebody yeah because it first came out in 28 had green wheels [24:05] on it and people will tell you that it had [24:11] never had been copyrighted before to the 1980s when that lady said she got up to [24:18] the state I have a set of glasses cerated in 1979 that's moris I may have [24:24] the on left but moris was copyrighted in 1979 [24:28] there was a barware and jewelry copyright but that was all it was [24:35] not Pap I think the copyright when I looked at it it's it's the likeness [24:41] right it it's very specific about what it is do you know off hand [24:46] or okay yeah are we charging for this or we just that would be up to [24:53] you we charge a nominal fee and that money go back to tvba or something [24:59] spend yeah I mean there's no fee attached to to the current application [25:03] as it is but I also know that this is sort of a new process [25:07] so it would be completely up to yeah this is the first time we've been asked [25:12] I [25:14] know I like that idea maybe not for the likeness but for every unit they sell is [25:22] italty yes is is it royalty based on sold and they simply report self report [25:28] every year you know yeah I don't have a problem either way with that but if we [25:33] own it we should capitalize that's right because any money we get obviously [25:39] goes back to this T okay you can say okay we're going to [25:44] do this and it'll be a flower fund or it'll be a parade fund whatever you [25:50] choose so do you all want to set in a mount [25:56] or I would make it a FL $50 or $25 annual fee or lifetime fee for 100 I [26:04] don't know I did I [26:08] me I look at it that Morris has been out there in the world for everybody to use [26:13] for as long as I've been around enforcing it is going to be [26:18] almost impossible um so keep it simple you know [26:24] she filled out the app charge her 25 bucks say thank you [26:29] next that the next question is going to be because you got plas you got glass [26:34] you got cloth you got is that for anything you want to do [26:38] and one of the reasons I like this is because you don't have 15 people doing [26:43] the same thing and then there five other things that nobody [26:46] does it can be registered as a design Mark opposed to a use Mark as a [26:52] representative kind of try and appliable across the board across different [26:56] trademarks for whatever you don't have have to lay it out in the actual [27:00] trademark application form um I have I have several trademarks and I I have one [27:08] two I [27:13] think with him see what he has make a recommendation I don't have a problem if [27:19] if Jim do that when yall deci side on yeah okay we can bring it to Jim okay [27:26] that would be fine yeah and on the chili how we doing judging this time well I'm [27:31] glad you asked we actually need a [27:36] judge any of you we as one person who's a [27:49] vegetarian we do we do Tracy mayor people skip if any of you would like to [27:54] be a formal judge so we're doing it the same way we're doing judges choice get [27:58] The Cauldron that Katie currently has and then we'll have a people's choice [28:01] but we are going to sell tickets instead of doing the dollar so you get A5 Che [28:06] get spone and the funds from it will go to [28:10] benefit the TR the nonprofit organization support emergency [28:21] respond 11 Town CL re reception community room 28th January from 4 to 6: [28:28] p.m. yeah we reserve the community room next Tuesday 4 to 6:00 p.m. the [28:37] town employees did off the work around 4:00 like to have [28:42] them try to [28:46] get I guess one thing too we'll build say more later on but um I sort of like [28:54] when you when I came here the first time you were up at the front window cashier [28:59] and became town clerk when I was here to Manch the first time now leaving me when [29:05] the other end [29:07] of I learn this there's a new grand girl grand lady no competition we [29:16] lose for the employees in the town board but the community stop by and thank [29:22] Susan for her years of service here thank you okay item 12 minimum [29:29] um 160 Cleveland Road um I have the hearing Set for February 17th um s you [29:37] know report or the the I can't think the order out um for [29:43] the owner that he gets his opportunity to come in and explain how he could [29:47] possibly rehab the house for more less than half of what it's worth but might [29:53] prove difficult um so that's all I got on that [29:59] 13 [Music] [30:01] you couple things we recently held our first L gr committee meeting um this is [30:08] a citizen group The Town board to start doing the brainstorming of what we need [30:14] to do to get ready for the C great Trail when it comes in and so we had our first [30:19] meeting and we gave an assignment out to the committee memb to come back with [30:23] many items they can think we should be addressing like public rest B racks [30:28] whatever um then I just want to update to as you know the town board is part of [30:34] the lawsuit that you may have read in the paper or saw on local television [30:40] stations um I got interviewed by WSPA Channel 7 [30:45] recently uh why is the town involved as you know I came to the town and [30:51] recommend to get involved because you're suing the federal government yes but [30:57] it's the Federal govern has got a program that they will compensate the [31:02] property owners along the trail based on appraisals and so the law [31:07] firm that retained um is doing all the appraisals [31:11] all the expense of that and the town owns four Parcels with a tax value [31:17] amount of a million dollar I'm not sure how much money we'll get back from that [31:22] but my thought is if it's 100,000 200,000 whatever that um my [31:28] recommendation that we take that money and reinvest it in these improvements [31:33] that we probably need for the trail but we we can talk about it later on but [31:37] that's why you know we're party to it we could choose not to be a party to it at [31:41] all but he wouldn't get any money so I did share this with the um city of [31:48] indland South Carolina I think they've done the same thing they decided to join [31:51] in because they own a lot of acreage along the track [31:58] then the other thing is the audit report was supposed to be here tonight and it's [32:03] not the audit firm's problem they've been waiting for our CPA firm to put the [32:08] financial statements together and they've had some stamp illnesses and [32:13] they helped have done in a couple weeks so my feedback want to get back from [32:17] this group here is I recommend that mayor that we call a special meeting [32:23] between now and the next meeting if it comes back [32:26] sooner but I think that especially with three new members in the [32:30] council we had a very good presentation last year by the audit firm and it would [32:36] take about 45 minutes to an hour and I think it would be well [32:41] worth the for that discussion this may be prettiest one we've had in [32:48] years has incl but is that I guess once I get the [32:55] the statements recommended me I'll get a you have [33:04] Works May Tracy then Julie then bill then [33:13] skip I don't really have anything except Susan thank you for your many years of [33:18] service and had fun with the [33:30] um I just want to uh thank everyone for coming out tonight it's a really cold [33:34] night so thank you for making that effort is there [33:38] sowman I thought Susan's party was a surprise so I'm [33:45] glad um and I want to thank uh Public Works they did a great job when we had [33:50] the snowstorm a couple weeks ago on the roads still clearing debr from people's [33:55] front yards from Hurricane thank you very [34:00] [Music] much uh yeah um I guess we we're [34:06] starting to to enforce the sidewalk coordinat all righty and we were going [34:13] to have a professional parking study done is that done we have a survey that [34:21] we just recently got the survey they uh constructed I will be sending I can send [34:25] that out to you next week for next couple days I should say um we're going [34:29] to probably like we did with the [34:32] comprehensive plan I'll probably make a website that says TR on parking [34:36] study.com and people can go online and take it there just to try to get and [34:39] we'll we'll hand them out um I see what the date range is we'll hand them out as [34:43] best we can um are they doing a [Music] [34:49] map it's just survey questions at this point they are going to talk so the [34:55] survey has not been done they had walked and said you well we did initially um [35:02] they the Regional Commission came out we had a bunch of people we walked around [35:06] kind of initial eyes on situation then they're going to do the survey and then [35:11] the more it progresses they'll I'm sure they'll have a map with opportunities [35:16] there it's still going and thank you for all your years [35:22] we appreciate staff for being here uh walk [35:28] Woodland Park the other day it's the next one [35:31] sh so yeah your whoever stay in care of wood doing it's your Parks [35:38] committee I've attended the parks committee that committee surprised me [35:43] because it's they have six members on maybe seven now they're actually a [35:49] working committee they go out there in the weekend and do work details and they [35:55] they work close I gave them Greg m cell phone [36:02] number so there's there's a much cooperation between the the city and the [36:08] parks committee and I try attend all their meetings I can and so they were [36:13] they very appreciative of what the town has been doing and but they do a lot of [36:19] work Greenway is all a lot of Labor they donated so it's a wonderful committee [36:26] and great Miner's the new chairman John Bonnie stepped down recently and then [36:32] Greg Miner's also your appointment to field board so it's a good continuity [36:38] there and then I want to thank Brad Gordon Brad's been attending the parks [36:41] committee meeting so there's they're really very happy with the support [36:47] they're getting from the town now another one quick question you know [36:52] the sewer line that came down from like near La thear [36:58] down to Woodland Park do we own a strip of that land or is that just a sewer [37:04] line [37:08] easement [37:13] property well the reason I'm asking is we walk it now I mean it's getting a [37:19] good trail the bear and deer I've really got a good trail going stay on it have [37:26] taken U St allow trails to go through and with vond Creek for example years [37:35] ago we had the sewer went through there then you have a sewer system overflow [37:42] now with it with the with the um Trail down through there it say a sewer leak [37:48] there we're getting a quick response from that walk that trail now which in [37:53] the old days we would never known about yeah so that helps us okay and that [37:59] trail down through there it start at Woodland Park the people who bought [38:05] hidden house and my neighbor and I if all said [38:10] the town would have EAS to ride away once to get walk through be great we [38:15] sneak got through that's we just need to get it all the way back up Mose Avenue [38:20] that's the last group that's there says they will do so it's a matter of time [38:25] cool cires want to thank Susan for her service to the town I'm sorry I didn't [38:31] get to know you better being a newbie but thank you best of luck in your [38:36] retirement also want to thank the public works and the Police Department fire [38:41] department for letting me hang around and see what's going on so I know I've [38:46] been probably a little pain but and I'll be back because and great thank you for [38:52] driving me around the I want the Cadillac tour next time [39:01] don't have a lot folks except I know what our people do I watch what they did [39:06] during I watch what they did during the snowstorm I watch what they do every day [39:10] so my hats off to you ladies and gentlemen Susan known you a long time [39:15] hate to see you go I don't blame you I go spoil that granddaughter too that [39:20] being said thank you [39:29] but Che off too fast are we going to go into um uh are we going to actually [39:35] reschedule another meeting for the audit report or we just G to put this when I [39:42] get the audit report comes in I imately contact the mayor to schedule a special [39:47] meeting okay I think all a meeting or three of youall can okay sorry citiz [39:54] comments [39:58] it's [40:01] cold J will
