So, we're going to start with the [0:49] approval of the minutes, which is a motion approving August 12th, 2026 [0:53] minutes of the regular meeting of the town board. Can I have a motion? [0:56] » So, moved. Thank you, Matt. And seconded. [0:59] » Seconded. >> Thank you, Glenn. Um, any discussion? [1:02] No. >> Okay. All in favor? I. [1:06] » Any opposed? >> Thank you. As carried. [1:12] » We don't have any bid openings, but we do have public hearings this evening. [1:16] So, we're going to start with a public hearing for consideration of the [1:18] issuance of a vehicle service station permit use special use per Okay. I don't [1:24] know cuz my we had a printer issue tonight. Do you have a a blank copy of [1:29] the >> Yeah, [1:32] » my printer doesn't print the side. So, I apologize. Let me read it again. So, the [1:37] public hearing for consideration of the issuance of vehicle service station [1:40] special use permit regarding the premises situated at 10 1016 Vestal [1:45] Parkway East in the town of Vestal, New York and being designated as Broom [1:50] County Tax Map number 157.19-3-3. [1:55] Okay. So, on this matter, um I'm going to read the public notice first. [2:03] So, a public notice was given um as follows. Notice is hereby given that a [2:08] public hearing will be held on August 26, 2026 at 6 p.m. for consideration of [2:13] the issuance of vehicle service station special use permit regarding the [2:17] premises situated at 1016 Vestal Parkway East in the town of Vestal, New York, [2:22] and being designated as Broom County Tax Map number 157.919-3-3. All interested persons will be heard and that was dated [2:54] August 7th, 2026. and it was issued by our town clerk Deborah Watts. [3:00] Okay. So, we are going to open the public section of the hearing. So, yes, [3:10] » presentation information before they [3:15] » Okay. So, um well, we'll we can um [3:26] include it as part of public hearing. >> What? [3:28] » Include it as part of the public hearing because we don't normally schedule them [3:31] and they weren't scheduled. >> Okay. So, um [3:35] » so we're going to open the public part of the hearing, but we do have um [3:40] somebody who's going to speak first and that is a representative of uh the [3:44] engine I'm sorry. [3:48] » Keystone engineering. Okay. >> So, Keystone Engineering. Thank you. So, [3:54] he is going to speak on with um details on the project and then that whole and [3:59] then if anybody who speaks after him wants to reference what he says or ask [4:03] him a question, you're welcome to do that. Okay. So, thank you. Please. So, [4:07] he has some diagrams, drawings, and everything. So, he's going to make a [4:10] short presentation um before we begin with the questions. Okay. So, yes. [4:18] » Um, so yeah, the last time they showed us [4:23] first and then kind of took or if you want to just hold it and try and just [4:26] show us and show the audience at the same time, that's good too. The camera, [4:30] we also do a video, so the camera is in that direction as well. [4:36] » Thank you. >> Hi, my name is Matt Row. I'm with [4:40] Keystone Associates. I'm representing Germit Singh. Um we have a gas service [4:47] station with a 6500 square foot convenience store. [4:54] Um it is located there. Um we have gas [5:00] tanks along the front northern side with two entrances off of the Vestal Parkway [5:06] East and one entrance out the back on Walter L Road. [5:11] Um, and there is also electric service vehicle stations right there with [5:20] a drive-thru on the east side. >> You want to show that? [5:26] » And then, um, the building is here with the gas pumps up front along Vestal [5:31] Parkway. Um, an entrance and an exit onto Vestal Parkway. [5:36] an entrance and exit onto Walter L Road and a drive-thru on this side. [5:44] » Thank you. [5:48] » Thanks. >> Okay. [5:54] » Okay. So, it's open to members of the audience, residents first. We do have [5:59] certain rules. So, I'm just going to read the rules first. Um, [6:10] I'm just going to make it short. So, basically, please just be respectful of [6:13] everybody in the room. Okay. Um, we do ask you to keep your comments to 3 [6:17] minutes. Um, and uh, we do ask you to speak in entirety and if we or somebody [6:24] else answers you, we're going to answer you at the end of that time period. [6:27] Okay? So if you have multiple questions, ask them and then we'll respond [6:31] afterwards. Okay. Would any any resident like to speak first? Yes, please. [6:42] Is it on? No. [6:46] And you can bend it down a little bit if you like to. Thank you. [6:53] Okay. [6:59] Thank you. Thank you. >> Hello. My name is Jennifer Monahan. I am [7:05] a resident of the Imperial Woods neighborhood and I am here today, it [7:09] looks like, but joined by a lot of my neighbors that ended up signing one of [7:13] our petitions uh specifically opposing a gas station at 1016 Vestal Parkway East. [7:18] Um the neighborhood and I submitted two notorized petitions to the town um [7:23] regarding this. Both were received on August 5th and one was updated and [7:27] received today showing unanimous opposition of all homeowners within [7:31] residences zoned within 100 ft. Um, so I wanted to speak today about the gas [7:38] station and how it's going to affect our neighborhood. From my research, I can't [7:41] find a single other incident in the entire town of Vestal where a gas [7:45] station is within 50 ft of residential homes, let alone 25 ft. And I'm saying [7:51] 25 ft because I went out and measured and from Walter Road to my property at [7:55] 10:05 Imperial Woods Drive, it's 21 feet. That's all. And we're talking [8:00] about a potentially 24hour 7-day a week business here that's servicing thousands [8:06] of customers, not hundreds, thousands, drawing them off of a very heavy [8:11] interstate parkway system in addition to the university. And just speaking to [8:15] this plan today that I'm seeing for the very first time, I noticed the [8:18] drive-thru is specifically facing the residences on Walter Road, which I find [8:22] to be very irresponsible. That canopy is going to have to be zoned at least 16 ft [8:27] off the ground and 247 lighting. Those lights are going to come directly in my [8:32] bedroom windows, my neighbors bedroom windows, illuminating our decks, our [8:36] entire properties all night, 365 days a year, 7 days a week, 24 hours a day. [8:43] Also, the drive-through traffic it looks like will be sweeping back there and [8:46] looping out onto Walter Road, which is massively disturbing because Walter Road [8:51] has no curbs, no drainage, and is 21 ft wide. There are not even sidewalks back [8:56] there. It's a popular place for people to walk their strollers and their dogs. [9:00] If we are now competing with gas station traffic, two cars coming at each other, [9:05] opposing directions, no sidewalks, no curbs, and it's 21 feet wide, and we [9:10] have a lady with a baby and a dog. I don't see how we're not going to have [9:14] incidencies back there. Um, I also wanted to speak to the fact [9:19] the Vestal Town Code 24-385, which governs vehicle service stations, [9:24] specifically prohibits vehicle service stations from being within 100 ft of a [9:29] resident's district unless twothirds of those uh homes approve it. I furnished [9:35] the town unanimous opposition from all homes within that 100 ft. It is signed [9:40] and notorized that it is completely opposed. Additionally, the town code [9:44] says people within 500 feet can get a vote if he gets 50% I have more than 50% [9:50] of the people within 500 ft on the maps I provided you. That's map two. um that [9:55] also are in opposition. And I just want to bring up again, I really hope you [10:00] will protect our neighborhood because we're talking about a 57 decel limit for [10:03] a commercial property versus crossing into a residential district that at [10:08] night we can only have 50 dB of noise. I'm also very concerned about water [10:12] runoff and drainage from the gas station touching our properties. That's flat [10:16] land. I called my homeowners insurance and if we had floods like in 2011 when [10:20] massive properties were flooded, if gas station runoff touches a wooden home, I [10:24] was told it would be condemned. So now we're worried about condemning things in [10:29] a time of climate change and we have wildly fluctuating weather. I had one [10:34] more big point to make today and that's that um of the 52 people that signed my [10:39] petition, we pay 2,900 $290,148 [10:44] to this town and school district per year. Just the 52 residents that signed [10:49] the petition and it is a known fact that gas stations can diminish home values by [10:54] up to 16% to people within 500 ft. This is documented and studied. It is online. [10:59] Our own DEEC and um I can't think of the exact person that published that, but it [11:06] is online if you literally Google governmental studies. [11:09] » Okay. I'm I'm just going to have to ask you to wrap it up. Okay. [11:12] » Yep. And the last thing I wanted to say is that um it's this is going to [11:17] completely change the neighborhood of the character the character of the [11:19] neighborhood. This is going to make it feel like we're on the Parkway. There is [11:22] no amount of barrier or anything that you could do to protect our properties [11:27] from this gas station noise, lighting, and contaminants of xylene, benzene, you [11:31] name it. So, I hope you vote to help us out and protect the neighborhood. Thank [11:35] you. >> Thank you very much. Does any other [11:39] resident wish to speak? [11:47] » Still on then? Uh, William Mitchell, Imperial Woods Drive. [11:52] Uh this is the first time seeing the map where there is where they're showing the [11:57] uh exit out onto Walter and also the first time I've heard that there's also [12:04] going to be a drive-thru there. Uh as mentioned before, this is a quiet [12:09] residential neighborhood. Uh there's no shortcuts to get to anywhere else. The [12:13] only people coming up into the neighborhood are the people who live [12:17] there. Uh this would completely change that. Walter is a narrow road uh fronted [12:24] or rather backed by uh several houses. It it the traffic would become [12:29] horrendous. You might as well put on the parkway. There's no need for a gas [12:34] station there. Uh we had one on that side of the parkway down by the Morabido [12:39] which went out of business uh for lack of customers. Uh the same thing could [12:44] happen here. Uh as far as the drive-thru part, I have no idea what they're going [12:48] to be doing with the drive-thru. you going to be selling alcohol through the [12:50] drive-thru or is that just going to be sandwiches also in addition to the [12:55] normal uh gas station stuff? Uh 24 hours worth of lighting is going to go right [13:02] into my front uh my front yard into my kids bedroom windows. [13:09] The whole idea uh is a farce. There's absolutely no reason to have a gas [13:15] station there. Uh, does the person who owns this property also own I believe [13:20] it's 917 Imperial Woods [13:25] » on Beachwood. >> Beachwood. [13:27] » Okay. Imperial Woods Drive. Yeah. Yeah. The [13:31] 97. [13:35] » Pardon? >> Uh, no. I I said I asked you could ask [13:39] questions but uh if it is the same person I have heard that it's the same [13:43] person who owns 917 Imperial which was diagonally across the street from me. Uh [13:47] if that's if the way he maintains his property is [13:51] any indication of how he would maintain that property if it is the same person [13:56] then the place would become an eyesore quickly. Uh [14:03] I ask you to vote against this. do not approve the waiver. It's not what the [14:09] people who moved in that neighborhood want. It's not why we bought houses in [14:13] that neighborhood. Uh they're finally getting a large number [14:18] of children back into that area after the boomers kind of moved out some. It's [14:24] not the kind of environment want the kids around. Um, and especially after [14:27] you brought up the concerns with the hotel there, we don't need part two [14:33] where now the residents are going to have quick, easy access to beer and [14:39] other kinds of spirits. Um, thank you. >> Thank you. Does Would any other resident [14:45] like to speak? thing. [14:49] » Um, so there's there's another woman who wants to speak first and then at the end [14:55] we can let you let wrap it up a little bit. Um, ma'am, did you want to speak? [15:02] » We can get the microphone to you. Glen, would you mind? [15:04] » That's not good. >> We we can get we can get the microphone [15:07] to you. Thank you. [15:13] » We have lived on Imperial Woods Drive for over 50 years. And when we moved in, [15:18] that was the place to live. I mean, you know, now there's other places and it's [15:24] not as desirable as it was, but I walk my dog every single day down Walter L [15:32] Road with a walker. And that road is not kept up. It is broken up. There's [15:39] potholes in it. And if you did this, who's going to be responsible for [15:44] keeping that road up? cuz it is a mess. Now, I don't know if any of you have [15:49] walked down it or driven down it, but it I mean I have no place else to walk. [15:54] Like you said, we have no no walk or uh sidewalks in our neighborhood. So, I [16:00] walk down there and I've done it for 50 years with baby strollers, dogs, and I'd [16:08] like to know who would keep up that road so it is in good condition. And I'm not [16:14] for that, but I just if it does go through, I'd like to know who's [16:19] responsible for the road. >> Okay. Thank you. Um, can I just ask you [16:23] one more thing? Um, and it was my fault because I didn't say it. Traditionally, [16:27] we just ask everybody to say their name and where they live. And you just want [16:30] to say best, it's fine to >> Okay. I'm Kathleen Wilcox. We live at [16:34] 1024 Imperial Woods Drive for 52 years. >> Thank you very much. I appreciate it. [16:42] » Okay. And sir, >> thank you. And sir, did you want to [16:46] talk? >> Okay. [16:49] » Yeah. I Okay, thank you. I think there's another [16:54] gentleman behind that, too. >> Richard Wilcox at 24 Imperial Woods [17:00] Drive. >> Thank you. [17:01] » And I can only second what everybody has said so far tonight. What is the name of [17:07] the gas station? What is Who is it going to be? Is that a secret or [17:13] » um Well, I we ask you to speak for three minutes and I'm going to see if I can [17:17] look in the paper. [17:22] » Okay. We just Is that Did you want to say more stuff because we traditionally [17:27] we ask you to speak until you're done and then we going to try to any then we [17:32] answer any questions or Okay. >> try to give an answer afterwards. [17:36] Another question is how many property owners are there in this 500 foot [17:43] radius? How many? [17:46] » 40. All right. >> Okay. Once again, please just speak to [17:49] the board. >> And are there plans for [17:55] fencing or what have you to kind of screen off this if it goes [18:02] through? I know that's a question. [18:08] » Okay. Can you repeat that last one, sir? >> Are the plans for screening to [18:14] » screen? >> Okay. Um, thank you. Let me just see if [18:18] I can answer them. And we don't have a name in a little bit. Do we? [18:23] » I mean, we can have discussion >> things after all hearing just to make [18:28] comments, make presentations. >> No, I know. But I don't have a problem [18:32] with it. >> I mean, the applicant's name is G. He's [18:35] president. >> Y [18:43] » question. >> Okay. [18:46] » I don't know. >> Okay. Um, so [18:52] we received a letter from a resident today. Um just before we get to to the [18:57] other comment, uh we received a letter from a resident today and in the answer [19:01] to the letter, I'll give you what the town engineer said is that the [19:04] particulars of the project, including screening, um will be decided by the [19:09] planning board. This is before it gets to the the full the final stages of the [19:13] planning board in which those particulars including entrances and exit [19:18] to to um to streets. All the particulars about what driveway is where and [19:24] screening and all those issues get decided and finalized at the planning [19:28] board. Uh and no project goes forward before it gets finalized at the planning [19:32] board to the satisfaction of the planning board members. So it would be [19:36] addressed at that point. So, um, we wouldn't have an answer for you in terms [19:40] of the name of of the thing at the end after the residents have pro spoken. If [19:47] anybody that represents the company or the owner wishes to speak and answer [19:51] some of those questions, we will ask them to if they want to. Okay. Does any [19:56] other resident wish to speak? [20:02] » Hello, my name is Jim Evanitzki. I lived with 1,000 Imperial Woods Drive and I've [20:09] been there 25 years and I remember when that car dealership went in next to the [20:16] California grill between the California grill and the motel. They came around [20:20] and we signed a waiver that they were going to maintain that fence on the back [20:25] side of their property to stop all that light from shining. Now there's no fence [20:30] at all. I'm surprised more of the residents on Walter haven't complained [20:36] about that because that was one of the reasons they got the waiver to open that [20:41] gas station and keep it lit up at night. Thank you very much for allowing me to [20:45] speak. >> Thank you. Thank you, Deborah. I [20:48] appreciate it. I think there's somebody else. Is there? [20:53] » Okay. [21:00] » Okay. Thank you. Does any other resident wish to speak? Okay, she's she's going [21:04] to come up. >> Yes. Thank you. Thank you, Deborah. [21:14] » Okay. All right. I am shaking like a leaf because this is [21:20] beyond wrong what they that proposal is going to do to our neighborhood. It's [21:25] that's my backyard. I don't know if any of you would like that in your backyard. [21:31] It's like it's just going to ruin the whole [21:35] neighborhood and it's going to depreciate every single one of our homes [21:38] along that way and it's going to gradually move up and more and more [21:42] everybody's home is going to be become less and less as valuable as it is now. [21:47] I'm getting all choked up because it's this is horrible. I mean, look at me. [21:53] It's not a good thing. and she made me do it the last two times and I'm doing [21:59] it on my own this time and um I just please please don't vote for this. It's [22:05] just going to ruin our neighborhood in every way imaginable. I mean somebody's [22:10] going to get hurt. I mean we're going to have people walking down from that [22:14] motel. You've got homeless people in the trail, the rail trail, that are going to [22:20] come over to get alcohol at night all times to get warm during the winter. [22:25] Somebody's going to get hurt. And then we've got people that we don't even know [22:29] that are going to come into our neighborhoods. And not that I I don't [22:32] care if there's a business coming into our neighborhood, but just not a gas [22:36] station, not a 24-hour gas station. That's just ridiculous. I mean, in every [22:41] way I can even think. And I don't that's all [22:45] I can say. And please guys, don't do it to us. Please, [22:50] » ma'am, can you tell us your name? >> Oh, my name's Antonet Kennedy. I live at [22:55] 1013 Imperial Ridge Drive, directly behind that monstrosity. [23:00] » Thank you. >> Thank you. [23:02] » Um, does any other member of the public wish to speak? Yes. [23:08] » I'll repeat everything. Peter, I know this guy. [23:14] » Peter Dwend on Magnolia Drive. Um, I guess I'd join everybody's uh opposition [23:20] to whether this fits within the nature and character of the neighborhood and [23:24] the effect that it would have upon the people that live there. Um, I was just [23:27] wondering if some of the predicate conditions have been met. Specifically, [23:32] there was supposed to be a sworn notorized statement provided today [23:36] would be 50% of the properties within uh what is it 500 ft and because it's [23:43] within 100 ft of residential properties, I think 2/3 of the eight properties that [23:47] are within 100 ft. So, I don't know if those were provided today to the board. [23:52] » Yeah. Yeah. I think Peter um on the second question, I don't know about the [23:56] first the second question about um whether there's a a predicate [24:02] requirement that um the uh uh that no service station shall be built within [24:09] 100 ft of a residential district. Um there's a there's two ways to interpret [24:16] that. What? >> Really? Okay. All right. Um can you hear [24:21] me better? Okay. So, so we have put that question um to the ZBA who provides um [24:29] interpretation uh for the benefit of the board because [24:33] as you probably know there's two ways to interpret that. Um, one way to interpret [24:38] that and it's elsewhere in the code about situating uh, a station um, [24:44] [clears throat] is to measure from the station the location of the station [24:50] itself, the building to the residential district. The map that has been provided [24:55] by Keystone Associates, I can't see it from here, but I looked at it briefly [25:00] like when you did when you came in here. Sure. And it look just to check that [25:04] measurement and it looks like it's about 115 feet uh away from if you do measure [25:09] from the building to the residential district it looks like it's about 115 ft [25:13] to the road and then I don't know how wide the road is the road might be 20 ft [25:17] or something so it's it's probably like 125 ft from the residential district. Um [25:22] the other way to measure these um it would be from [25:26] uh property line to property line which it's the same property line so it's zero [25:29] um and that definitely would be affected but um there's there's definitely uh um [25:36] there's definitely two schools of thought that have been presented. Um, [25:41] this board uh I I'm told intends to uh seek uh uh an opinion from uh the ZBA uh [25:50] who provides uh that kind of an opinion not only for ZBA uh matters but also [25:55] matters before the town board. Okay. I had the same thought earlier today and [26:00] did a little research to try to find the same thing. Elsewhere in that same [26:04] section of code, it does talk about it coming from the the property line [26:08] itself. And for this particular plan, there's really no differentiation [26:12] between the actual physical footprint of the structure and the business work [26:17] that's to be done, particularly because there's going to be a drive-through [26:19] window, an overhang, whatever business is going to happen behind it. Uh, but [26:25] » that's a that's a reasonable um uh point. If there's improvements behind [26:29] the uh building, that's another consideration. As far as elsewhere in [26:33] the code, um I mean the there is a measurement standard that's in that [26:39] section of the code. It pertains to um being within 250. You're not supposed to [26:44] be within a station is not supposed to be within 250 ft of a school or a [26:48] church. Um and the measurement standard that's put in there is from the building [26:53] itself to the so there's some precedent for that measurement uh because it's [26:57] contained elsewhere in the uh u and that's not to say I mean as you know [27:01] that doesn't mean that there's a special permit approval by this board. This [27:04] board has uh discretion but it's a it's a it's a very relevant factor how that [27:10] measurement takes place. But the must part that's in the code was that today a [27:15] notorized statement with 50% of the properties within 500 feet that they [27:20] have their ascension to or approval of the project. And it seems to me if that [27:24] wasn't provided today that they haven't met the predicate conditions under your [27:27] own terms and code. I don't know how you would approve it uh outside of the [27:31] finding or the necessary finding that it somehow meets the uh the well-being and [27:37] doesn't devalue the neighboring properties. [27:40] That's all. Thanks. [27:47] » Well, I mean, just to answer Peter's question, uh these these are before the [27:52] these are things that that are going to be uh um looked into before the board [27:56] votes, and it will probably not be tonight. It'll probably be um when uh [28:02] the board is an opportunity to uh listen to all of the comments that are made [28:07] tonight uh such as yours and uh hear from the ZBA, get their opinion [28:13] [clears throat] and um uh have an opportunity to review the maps and [28:16] whatnot. Um so that's what that's what tonight is for and um and then a [28:22] decision will be made and we'll make sure that um that your questions are [28:26] addressed. So I have a question. Can you hear me? [28:32] Sorry. Um so uh number one um [28:39] does it come back to the town board after the planning board after the [28:45] zoning board? Sorry. >> Yes. So um [28:49] so the procedure um the supervisor is asking specifically about the procedure. [28:54] Um there's kind of a dual track um to in order to get a service station uh [29:01] approved. Um the applicant [clears throat] would have to um have to [29:07] seek approval, seek a a special uh use permit from this board, from the town [29:14] board. Okay. Um and the applicant would also have to get uh through the planning [29:21] board. the planning board uh is more concerned with the site plan, the [29:26] buffering. Sometimes the planning board says, "No, we don't like that back exit [29:30] off of the uh onto Walter." You can maybe the planning board says, "Uh yeah, [29:36] if you're up, you know, if you're up against the parkway and you've got an [29:39] appropriate buffer uh behind the station, that's fine. Uh maybe they have [29:45] comments on drive-thru activity. maybe they have they have that those types of [29:49] mitigating um uh considerations when it's before the planning board. But um [29:57] so if it were to go to the planning board first, the planning board would be [30:00] able to approve a site plan. But in this particular case under the code, if it's [30:05] a if it's a vehicle service station, uh the planning the planning board doesn't [30:10] have the last word. The last word would be from the town board and the town [30:14] board has the authority to issue the special use permit. Also, under uh if [30:20] they if they deem it appropriate under conditions such as buffering conditions [30:25] and lighting conditions and hours of operation and all that stuff. So, [30:30] there's two boards that are relevant here. it's the town board um and the [30:34] special use permit has to be um obtained or it can't go forward. And the um the [30:40] planning board and the site plan has to be uh approved as well. And uh and and [30:46] both boards have the ability to impose uh conditions to protect the uh the [30:52] neighborhood conditions. Um and uh and the town board in particular has the [30:58] discretion to either approve with conditions or deny the application. [31:05] » Take the better one. [31:10] » Okay. In summary, um just to sum it up a little bit, [31:16] » ma'am, did Yes. Do you want to Oh, can we get her the [31:22] » Oh, I'm sorry, sir. >> It's quitter. [31:23] » I apologize. You know, right down the street next to [31:28] the where your proposed gas station in is a motel. And I read in the paper, as [31:35] any of you could have, in that motel, there was a guy with a motorcycle and a [31:40] gas can full of gasoline. And if there's a gas station right next to that motel, [31:47] who knows? And the Indicop Motel, if you any remember, was recently burned down [31:54] by an arsonist and several people were killed. And so that's another concern, [32:00] having a gas station right next to a motel and that houses homeless people [32:08] and that kind of parent uh clientele. Okay. Thank you, sir. I I apologize, [32:17] » please. >> My name is Kaspar Rodriguez. I actually [32:21] live on Walter Road 904. And um I've been there 40 years since I was a [32:26] teenager myself. And even even now, all the traffic that's been added to that [32:32] street, we often have semiis have to back up on the road because they can't [32:36] clear each other in the width. And a lot of the people speed down that road when [32:40] they come down again out of work or just cheat cheating the parkway around to get [32:45] coming out of California Grill. So, and my grandkids I like my grandkids were at [32:50] my house this weekend and I was like stay away from the road because there's [32:53] just a traffic so crazy nowadays even to add this to it. We we just want to [32:58] register our concerns and we are we are not interested in having that in that [33:02] facility there. Okay. >> Thank you very much. [33:04] » Thank you. >> Uh okay. We're gonna we're gonna have to [33:09] ask keep it to the one thing. >> Just one thing. Yeah. Okay. Go ahead. [33:12] » I just wanted to make one last comment. It's Jennifer Monahan at Imperial Woods [33:15] Drive. Again, um the lot is zoned as C1. That is resident. That is general [33:20] shopping. And when you are given examples online of what is considered a [33:25] C1 property, you are given examples. It has to seamlessly blend with the [33:29] neighborhood. That is what the law says. And the examples given are barber shops, [33:34] bodeas, small convenience stores that keep regular hours, and doctor's [33:38] offices. Nowhere does it ever mention a 24-hour gas station that can serve [33:43] thousands of customers. That's more along the lines of a C8 or a B2 zoning [33:48] from my understanding. Those are heavy industrial uses that New York State [33:52] usually gives to gas stations. So, a C1 property is an irresponsible and [33:57] inappropriate use in my opinion of that land. Thank you. And lastly, we would [34:02] love development there. Just a good neighbor that would not be 247 with [34:06] thousands of customers. Something that would seamlessly blend with the [34:09] neighborhood would be appreciated. >> Thank you. Okay, we're going to try to [34:12] limit to one one per person. Uh does any other member any other Yes, sir. [34:18] Absolutely. [34:26] Um good evening members of the board, members of the public. My name is Joe [34:29] Romani. I live at 593 Sequoia Lane in the Imperial Woods area. My wife and [34:34] family have lived there 30 some odd years. Um I just have to say that uh [34:38] listening to everyone who has both factually and indeed even emotionally [34:42] spoken here tonight, I concur. This is not the right fit for this neighborhood, [34:47] this is just going to change things and not for the better. There's been enough [34:52] change in that area right now. And this last gentleman who spoke, that's a very [34:56] good point. Cars come down Walter and they they're not stopping for that stop [35:00] sign. They're blowing out and it's a choice. When I come down uh airborne, [35:05] I've got to be careful. The folks on the left coming out of the former uh Joanne [35:08] Fabrics parking lot failed to stop at the stop sign and the other people do. [35:12] So, you increase the volume of traffic there, um it's going to be a disaster. I [35:18] just think that uh you folks ought to look at this very hard and very long and [35:22] very soularchingly. And uh I agree with the folks who have spoken here. This is [35:26] not right this neighborhood. But thank you all very much. [35:28] » Okay. Thank you. Does any other resident wish to speak? [35:35] » Does it does a representative for um the proposed business wish to speak? [35:50] » Good evening board members. Uh can you hear me? I can hear you. [35:56] » Okay. So, I am the applicant of 1016 West Parkway East. Uh our main concern [36:04] is for the neighbors and that's why we are here today to listen to them so we [36:08] can address the issues and [36:12] I would like um little more time before it gets voted on so we can address those [36:19] issues with our engineers and our attorneys. [36:23] » Okay. Thank you very much. >> Thank you. [36:25] Um, okay. If is there anybody else that wishes to speak? [36:31] Okay. Okay. I'm going to just give me one [36:35] second. So, yes. So, we're I'm I'm going to explain in a second. So, um we're [36:40] going to close the public hearing then the open section of the public hearing. [36:44] And I just want to address it. I want to summarize what um Dan Reynolds, our town [36:47] attorney, said. So, um, in number one, I appreciate everybody being here this [36:54] evening. Every member of the town board has heard [36:58] your opposition to the project, all of your concerns. We understand it. Um, and [37:04] and we and we appreciate you coming here. We have the petitions, both [37:10] versions of the petitions, um, in consultation with our town attorney, um, [37:15] and in discussions with the residents up until now. uh we were under the belief [37:20] that um that the that it was within the 100 ft. Um however, it isn't. Now, that [37:28] being said, um we need to take a look at it again [37:33] and it has to go back to uh the town board in a minute is going to referral [37:39] and Dan just referred to that. We're going to refer it to the zoning board. [37:43] They're going to go over the specifics of it and double check all of the [37:49] legalities. Then it's going to go to them. And there [37:52] were many there were a lot of concerns about the planning and things that are [37:56] involved particulars with the project. Um so it may or may not go to them. It [38:02] cannot get passed before it comes back to us. Okay? This project cannot be [38:08] approved fully before it comes back to us. So, nobody can approve it until it's [38:14] going to come back to us. But the legalities must be checked. Um, every [38:19] members of the town board, we represent you, okay? We understand that and but we [38:25] also have to follow all the regulations. So, we're sending it back for all those [38:30] considerations for everybody to take a look at it. When he referred to Gina, [38:34] that's the attorney for the planning for the zoning board. So they are going to [38:38] be talking about all of the legalities. It cannot be approved before coming back [38:44] to us and coming back here. Okay. Can't get the special permit without us. So [38:50] there is no way it can get approved in any other way. Um we are going to table [38:54] it I believe correct. We are going to table it for this evening so that those [39:00] legalities can be double checked and then eventually it will come back to the [39:05] town board for the final vote. Okay. So once again, it's not going to get [39:10] approved before we see it again. Okay. Uh but we have to do that. We can't do [39:16] it because what our understanding before is not what is correct. Now everybody [39:20] brought brought up particular issues too. Um which we all literally listed um [39:26] and Dan took note of as well and we're going to put those questions, issues and [39:31] concerns to both of our boards which is the planning and the zoning. Okay. So, [39:36] they're going to be talking about that and eventually it's going to come back [39:39] to us and again cannot get approved cannot get the special permit without [39:43] coming back here to us. Okay. Um [39:49] uh did well the public com Yes. >> So the the Yeah, the public comment [39:54] section is over and it's not it can't I >> just want to want to go. [40:01] » Okay. Yeah, you are out of order in the [40:05] question, but let me see if I can address it. So it would come back to us [40:09] after all of that is done. So it comes back to us at the end. Um, but that's [40:15] that's all I'm going to say for now. So hopefully everybody understands. Feel [40:19] free to wait until the end of the meeting. I'll be glad to talk to you [40:22] individually if need if you want. Okay. Um, so with that, we are going to um Is [40:27] there a motion to table? >> A motion to table. [40:32] » Thank you. >> I'll second. [40:33] » Thank you, Sue. So Matt motioned and Sue seconded. All in favor of tableabling. [40:38] » I. >> Any opposed? Thank you. Okay. So, um, [40:44] thank you. We have all your documents. We're going to move on to our next item, [40:48] which is another hearing. >> Oh, yes. Did anybody want to leave? [40:52] We'll take a short break. [40:57] » Thank you. [41:35] He actually called to He's talking first. He he [41:39] » but I just wanted Oh, okay. >> Yeah. So, it's going to go to both. [41:41] » I just wanted to make sure you had the right information. [41:43] » No, thank you. >> I know this is asking for the [41:49] clarification because he kept saying they're outside. I'm like, how are they [41:52] outside? [41:56] » Yes. [41:59] » My map my shitty map. >> It was better than what we had. [42:13] Can you turn your mic? [42:47] So folks, if you're going to leave, um, we'd like you to do that so that we can [42:52] finish the meeting. If you want to stay, please have a seat. [42:55] » So if you'd like to leave, can you please just step outside so we can [42:58] continue with the meeting, please? [43:03] » Well, you got it done. >> Okay. So if you are leaving, please step [43:08] outside. Just continue talking outside though. [43:14] » Jab one back in. [43:25] » Okay, we have to come to order because we have to continue with the meeting. [43:29] Please, we do ask for quiet either sit or um thank you very much. So, we're [43:35] going to continue on with the hearing. If you have more questions, please stay [43:38] for the end of the meeting. we'll be happy to talk to you. Um, so next we [43:43] have another public hearing and that is for the consideration of the issuance of [43:47] vehicle service station special use permit regarding the premises situated [43:51] at 2813 Vestal Road in the town of Vestal, New York and is being designated [43:56] as Broom County Tax Map number 158.10-1-4.1. [44:05] So in that matter, [44:09] we're start with the reading of the public notice. [44:18] So public notice was given and the notice read as such. Uh, notice is [44:23] hereby given that a public hearing will be held on August 26, 2026 at 6 p.m. for [44:27] the consideration of the issuance of vehicle service station use permit [44:32] regarding the premises situated at 2813 Vestal Road in the town of Vestal, New [44:38] York, and being designated as Broom County Tax Map number 158.10-1-4.1. [44:47] Please take further notice that the environmental significance of said [44:50] proposed permits will be reviewed by the Vestal town board of the town of Vestal [44:54] incident 2 and as a part of said public hearing. Therefore, pursuant to statute, [45:00] the town board of the town of Vestal will hold a public hearing in the town [45:03] boardroom, Vestal Town Hall, 605 Vestal Parkway West, Vestal, New York. At the [45:08] time of the hearing, all interested persons will be heard. and that was [45:12] issued um that was published August 7th, 2026 and issued by our town clerk [45:18] Deborah Wallace. So, we're going to open the public hearing um on um 2813 Veester [45:25] Road. So, does any member of the public wish to make a comment in regards to 28 [45:30] 2813 Veester Road? Yes. [45:40] » Okay. [45:43] Thank you. Is it on? Yeah. Show by Agnesar 87 Stone Hedge Drive. Uh, more [45:47] of a question. It's a vehicle service permit. Is that how you phrased it? I [45:52] don't have the agenda. That's why I'm asking. [45:55] » Yes. No, it's okay. Um, >> it's a vehicle [45:58] » vehicle service station special use permit. [46:01] » Vehicle service station. Can you define that, please? Is that a gas station? Is [46:05] that a car maintenance station? What what is the definition of a vehicle [46:09] service station? And I believe this is the old skate estate lot. Am I correct [46:15] or am I not correct? >> No. [46:16] » Okay. Can you can you >> So do you Yeah. Anything else? [46:21] » Nope. >> Okay. So Dan, do you want to speak to [46:23] it? [46:32] So [46:35] » um can you hear me? [laughter] [46:39] » It's not Skate Estate. That was Remember that was a Williams Auto. They were [46:42] given um they were given a special use permit um a couple months ago. It's the [46:48] Hillcrest Auto Hillrest collision. So I think it's it must fall under the [46:53] definition of a vehicle service station. if they're going to be working on cars. [46:56] It's not a gas station, but they will be working on uh uh vehicles, either body [47:01] work or something to that effect. Okay. >> Okay. Thank you. [47:08] Any me any other member of the public wish to speak on that special use [47:11] permit? [47:16] Okay. Um so with that, we're going to close the public hearing and mentions a [47:22] seeker. Do we need to do a secret on this one? [47:25] » Okay. >> We don't have the negative declaration. [47:28] Do you have the negative declaration? >> Yeah. [47:43] » Okay. Thank you. [47:47] » Oh, thank you. [48:09] No, I appreciate it. [48:17] » I guess. Okay. Thank you. [48:27] I put in Oh, you know what? Hold on. Let me try to find it. Sorry. There's [48:33] one thing we need to do and we have to do it properly. [48:56] Sorry, we're trying to locate a document. [49:13] Oh, I found it. [49:19] Here we go. I got it. Oh, this is the document I got. [49:25] Thank you. Because my laptop is dying. The battery doesn't stay for very long. [49:29] Thank you. Okay, so um sorry, we have to do the [49:34] secret first. So, this is in regards to 2018 Vessel Road. Um 2013 2018, sorry, [49:45] Vessel Road. So based upon a thorough review and examination of the known [49:49] facts relating to the action is careful review of all potentially adverse [49:53] environmental impacts and the entire record and proceedings relating to the [49:57] action as to the date of the adoption of this res resolution including but not [50:02] limited to information included on the project's environmental assessment form [50:08] information provided by the applicant involved and interested agency input and [50:13] public input. The board finds that the action will not have a significant [50:17] adverse impact on the environment and that a draft environmental impact [50:21] statement will not be prepared. So I need a motion approving a negative [50:26] declaration as to the seeker as there are no large or significant [50:30] environmental concerns identified with regard to the local law. [50:34] » So moved. >> Thank you Matt and seconded. [50:36] » Seconded. >> Thank you Glenn. And any discussion? [50:41] Okay. So all in favor of >> Thank you. I any opposed? [50:48] Thank you. And it's carried. So it's a negative declaration and then we're [50:51] moving on to the actual special use permit. [50:57] So, we have a resolution authorizing vehicle service station permit use [51:02] regarding the premises situated at 2813 Veester Road in the town of Vest, New [51:07] York and being designated as Broom County Tax Map number 158.10-1-4.1. [51:16] So, can I have a motion? >> So, moved. [51:19] » Thank you, Glenn, and seconded. >> Second. [51:21] » Thank you, Matt. Any discussion? So, all in favor? Hi. [51:27] » Any opposed? Thank you. And it's carried. [51:32] Okay. So, now we're going to move on to our [51:36] third hearing for this evening. This is an um this is a public hearing [51:41] on the approval of a cable television agreement between Spectrum Northeast LLC [51:46] and the town of Vestal. Um, [52:56] and it was issued by the town clerk, Deborah Wallace. [53:00] So, I'm going to open the public hearing in regards to the spectrum agreement. [53:05] Does anybody wish to speak? [53:10] Okay. So, I'm going to close the public hearing [53:14] and this does not need a seeker. So, one second. [53:22] Okay. So we have a resolution authorizing the supervisor to sign a [53:27] cable television agreement between Spectrum Northeast LLC and the town of [53:32] Vestle. That motion >> so moved. [53:34] » Thank you Sue and seconded. >> Seconded. [53:37] » Thank you Glenn. Any discussion? >> Okay. So all in favor. [53:43] » Any opposed? Thank you. And it's carried. [53:49] Okay. So we're going to move on. We're done with our public hearings for this [53:52] evening and we're going to move on to um my updates. [53:57] So, the movie night at Arnold Park, originally scheduled in July, has been [54:01] rescheduled for Thursday, September 3rd, 2026. Monsters Incorporated will be [54:07] shown at 8:30 p.m. There will be free popcorn. Please bring chairs, blankets, [54:12] family, and friends. Um also, brush pickup for 2026 will be September 7th. [54:19] Um they and the highway just reminded you please have your brush on the curb [54:23] or roadside on Sunday night before the first Monday of each current month to [54:27] ensure the brush is picked up. Um and it takes a few days to get them to get [54:32] through the town. So please have a little patience. [54:58] So, we're start with the privilege of the floor, but I'm just going to read [55:03] very quickly the full rules. So, we ask only uh we ask that people speak only [55:08] regarding town business. Be respectful of all elected officials, town [55:11] officials, members of the audience, and all other persons. We don't allow [55:15] personal attacks. We ask that you wait to be recognized. State your name and [55:18] address before speaking. Speak at the podium. Speak for no more than three [55:22] minutes. Be brief and to the point. Address the comments to the board only. [55:26] only speak during the designated public comment section. [55:30] Um, and then we always ask residents to speak before non-residents. Now, the [55:34] first section, this section, um, is for agenda items only, something that's [55:39] actually on the agenda for tonight. There's a second section later in the [55:42] meeting if you have other town business. So, um, does anybody, any member, any [55:49] resident first wish to speak on an agenda item this evening? [55:56] Okay. Does any non-resident wish to speak to an agenda item? [56:02] Okay. So, then we're going to go on and we don't have any resolutions or [56:06] motions. Uh public works. Uh we don't have anything this evening. Cl Matt. [56:12] » Uh no, nothing tonight. >> Thank you. And Sue, finance. [56:16] Okay. Resolution [56:57] 9.2 authorizing the business office to issue a refund to Matthews Auto Group in [57:02] the amount of $200. [57:14] » Thank you. Can I have a motion? >> So moved. [57:16] » Thank you, Glenn, and seconded. >> Second. [57:19] » Thank you, Matt. And any discussion? Okay. All in favor? [1:01:43] » So moved. >> Thank you, Glenn, and seconded. [1:01:48] » Second. I'm sorry. >> Thank you, Sue. And in the discussion [1:01:51] part, I just want to thank um our conservation committee uh because they [1:01:56] they wrote the grant, they um obtained it and they are going to make it happen. [1:02:03] So I really want to thank them for their work. They're all volunteers and they do [1:02:06] an amazing job. So with that, yes. >> So um we did give them some money up [1:02:13] front, right? This is for the Is this the butterfly garden or no in the wrong [1:02:18] place? >> That is the butterfly garden. [1:02:21] [clears throat] >> Did we forwarded them some money before [1:02:23] the grant came in? Right. >> We gave two $200 and something dollars [1:02:29] and that will be included in this, >> right? So that'll go back into our [1:02:33] general fund. [1:02:37] » So once again, I explained that the grants take a little bit to actually get [1:02:42] the check. So what? >> But I mean when it comes in when the [1:02:46] check comes in, >> it's going to be the $200 and some odd [1:02:49] dollars is going to be subtracted from the $1,900. Yes. They're only going to [1:02:52] get the 900 round about $900 difference. >> Right. Okay. [1:02:57] » So they're going to get the exact dollar amount of the grant award. [1:03:01] » Right. That I just wanted to clarify that. Thank you. [1:03:03] » Okay. >> So um so all in favor? I I Any opposed? [1:03:10] Thank you. inspired [1:03:18] » 11.3 resolution declaring the town board as lead agency on Arnold Park carousel [1:03:24] structure project and also to consider the action type as unlisted under [1:03:28] seeker. >> Thank you. So can I have a motion? [1:03:30] » So moved. Thank you Sue and seconded. >> Seconded. [1:03:34] » Uh thank you Glenn. And in the discussion part, um so since our Monday [1:03:39] discussions are not taped and not everybody reads our minutes, um I want [1:03:44] to make clear to um to everybody that the um the Arnold Park carousel project [1:03:53] is in process. So, he we have two different grants that we have awards of [1:04:00] um and they total $525,000. [1:04:05] The first and they are going to go towards the building of the structure [1:04:08] for the carousel. So, that is an inclusive project. Um the town personnel [1:04:15] are working on the whole project. Um so that is included as inind funds but is [1:04:20] actually no out-ofpocket expense for anybody. [1:04:24] Um that being said, um our town engineer notified us that there is that the costs [1:04:30] are going to be more than we thought. So the board discussed it on Monday and we [1:04:36] are trying to do this project without any tax money. So um we are going to [1:04:41] continue in process for the project. Um, however, because we've already been [1:04:45] awarded the grants, we are not going to spend any more money and I have already [1:04:50] begun to reach out to get more funding to make up that $152,000. [1:04:56] So, we will make the decision further along the road, but personally, I am [1:05:00] confident that we're going to be able to get more award money, but um, we just [1:05:05] want to make the public aware that we're doing our best. Um, and we're not going [1:05:09] to make any more expenditures until we assess, verify, and secure more funding. [1:05:15] Does any other board member wish to comment? [1:05:19] Okay. And then we'll discuss it again publicly as well. Um, so with that, um, [1:05:24] so can I have a motion? >> Oh, we're in discussion. So, is [1:05:29] everybody good for a vote? Okay. So, all in favor? Hi, [1:05:32] » I [1:05:36] » I >> sorry. Hi. [1:05:38] » Okay. Thank you. So, any opposed? >> Thank you, Miss Carrie. [1:05:45] » And next one. >> 11.4 resolution authorizing the town [1:05:49] supervisor to complete all necessary paperwork and furtherance for Crest [1:05:54] Grant and SAM grant regarding carousel project. [1:05:57] » Thank you. So, can I have a motion? >> So, moved. [1:06:01] » Thank you. and seconded. >> Second. [1:06:04] » Thank you, Sue. Any discussion? >> So again, this is just to complete the [1:06:09] paperwork. >> So this is this is Yeah. So this is an [1:06:12] additional action. It's not an expenditure of funds. To clarify, it is [1:06:16] in the grant process. I think we've submitted three different [1:06:21] things. You we got the initial application. Then we did um another set [1:06:27] of paperwork for the grant within the grant process and then we we now have to [1:06:32] go to a whole another set of things. So this is for the paperwork involved. It's [1:06:36] not an expenditure of funds. It's not a proceeding with the project. It is [1:06:40] simply we take care of the paperwork because if we and if we do not do that [1:06:45] we will not get the original grants. So we have to complete it. Um the board [1:06:49] will consider it again as we get the results for our outreach for more [1:06:53] funding. So >> second. [1:06:57] » Okay. >> Second. Yeah. [1:06:58] » So um so we're going to go to a vote. So all in favor [1:07:02] » I >> I Any opposed? [1:07:06] » So this is just to do the paperwork. No funding. [1:07:09] » I just said that. Yeah. >> I'm just clarifying that. Okay. [1:07:12] » Mhm. >> Okay. I'm willing to do the paperwork, [1:07:15] but I have serious reservations. This is just a vote and we just had the [1:07:19] discussion session. So, >> okay. So, [1:07:22] » so do you want to vote? >> Well, if I am not going to be able to if [1:07:26] I can't express my reservations, then I'll just vote no. But I was going to [1:07:30] say if it's just for the paperwork and not anything else, then I would move [1:07:36] forward. But if it's if anything other than paperwork is going to be done [1:07:40] because I want to know that there's going to be other assistance coming in. [1:07:44] » Okay. Just to clarify, this is past the discussion phase, but we just I just [1:07:48] clarified in the discussion phase. There will be no more expenditure of funds is [1:07:53] for the completion of the paperwork involved with the original grants. Um it [1:07:58] makes no more commitment than we had last week. But if we do not do this [1:08:02] paperwork, then we cannot proceed at all. Um, our situation as discussed on [1:08:07] Monday was very simply that um, if we decide not to move forward with the [1:08:12] project for some reason, it will be the same a month from now as it was last [1:08:17] week. So, um, and we discussed everything. If anybody wants to read the [1:08:21] minutes, the full discussion is in the minutes from the Monday meeting. So, are [1:08:26] you comfortable? >> Yes. I just wanted that clarification. [1:08:29] » Yeah. I I'm not asking for your vote one way or the other. I'm just simply saying [1:08:32] that's clear. So, Matt, would you like to vote? [1:08:35] » I >> Thank you. [1:08:38] Okay. So, um >> that was four, right? [1:08:42] » I already voted. >> That was for 11.4. [1:08:46] » What? >> I wanted to confirm yours was an I. I [1:08:48] couldn't hear. >> Yeah. I just wanted to clarify that one [1:08:51] point before I voted. >> Okay. So, um and that's Carrie as well. [1:08:56] Okay. 11.5 >> 11.5 resol excuse [clears throat] me [1:09:00] resolution authorizing the town supervisor to sign the verification [1:09:04] portion of the petition pursuant to New York State eminent domain procedure law [1:09:08] to acquire a portion of real property located at 257 Baker Hill Road Vessel [1:09:12] New York designated t tax map number 204.02 [1:09:18] hyphen 1 hyphen 10. >> Thank you. [1:18:22] Okay, we don't have any petitions or protests. We don't have any old [1:18:25] business, but we do have new business. [1:18:30] So, we have four resolutions that are related to each other. 16.1, 16.2, 16.3, [1:18:36] 16.4 or related to the hometown hero banners. [1:18:41] Um, we'll go into the discussion phase on the first one. I'll read it first. [1:18:45] We'll go with the discussion to explain a little bit more and then each board [1:18:49] member will vote on each of the four four resolutions um one at a time [1:18:54] obviously. So um the first resolution is 16.1 [1:19:00] which is a resolution authorizing the portrait of the honore on the hometown [1:19:05] heroes banners to be formatted exclusively within a circular shape. So [1:19:10] let's get into the discussion. So can I have a motion? [1:19:13] » So moved. >> Thank you. uh Glenn and seconded. [1:19:21] Okay. Do you not want to move forward on this? [1:19:24] » Not on 161. No. >> No, that's not what I'm asking. We're [1:19:28] just going to go into discussion phase and as I emailed everybody, you would [1:19:32] vote yay or nay on each of the four resolutions. [1:19:38] » Okay. So, you can vote if you wish. Um or you can vote yay to [1:19:44] some or you can vote, you know, yes to at least to two of them. [1:19:52] But we don't have a second for the motion. Are we not proceeding? [1:19:56] » We would move on to resolution 16.2. >> No, [1:20:00] » we cannot we cannot do >> that's how that's we're not proceeding. [1:20:05] Yeah, we're not we're going to table all of them then. So we'll go through the [1:20:09] motions if we are okay. Okay, we're going to have Yep. We're going Yep. [1:20:13] We're going to have a motion to table 16.1. [1:20:16] » Just the clarification though, the law reads that [1:20:19] » it's I Let me just Let me just uh step in quickly. Um these are separate [1:20:25] resolutions. If it doesn't, you need a motion, you [1:20:29] need a second, you don't have a second, and it fails. [1:20:34] And the next go to the next item. >> Okay. So, okay. So we stop with the [1:20:40] first one and um 16.2 then resolution authorizing the portrait of the honore [1:20:46] on the home hometown hero banners to be formatted exclusively within a square [1:20:50] sheet. So can I have a motion? >> So moved [1:20:54] » and seconded. >> Seconded. [1:20:56] » Okay. So we're going to pull this one. So um Glenn, can you vote? [1:21:01] » I vote I. >> Okay. I vote nay. [1:21:05] I >> I [1:21:09] » Okay. So, um 16.3 then is a resolution authorizing [1:21:16] the hometown. Right. 16.2 carries. [1:21:23] And 16.3 is a resolution authorizing the hometown [1:21:27] hero banners to display the honor specific dates of military service. And [1:21:32] so, can I have a motion? >> So moved. and seconded. [1:21:37] » Second >> and Sue and any discussion. [1:21:44] So all in favor >> I [1:21:47] » I >> I [1:21:49] » and nay. So the last one is 16.4 and it car and it carries and 16.4 [1:21:56] is a resolution authorizing the hometown bureau banners to display the honor [1:22:00] specific conflict affiliation. So can I have a motion? So moved [1:22:05] » and Glenn and seconded [1:22:09] » second. >> Okay. And Sue. So all in favor [1:22:15] um sorry we didn't start with discussion. So all in favor [1:22:20] » nay. >> Okay. I [1:22:22] » I Okay. >> And then nays because you can't do 16.3 [1:22:26] and you can't do >> all in favor. I [1:22:30] » 16.3 carry. >> 16.3 K. [1:22:33] » Right. Okay. So, >> you still have to vote on 16.4 because [1:22:36] it's on the agenda. >> Okay. I just didn't know what the [1:22:38] question was. >> All right. So, you to clarify, you can't [1:22:42] have both, right? >> But you can't have both on there, right? [1:22:44] » Yes. >> So, it would be an A. [1:22:46] » Yeah. Then I would be an A because you can't have both. Okay. [1:22:51] » And I was an [1:22:54] » Okay. Okay. So, with that, we have the final design of the Hometown Heroes [1:23:00] banner. So, we're going to move forward with that program. [1:23:04] Um just to I also want to say uh thank you to all our town employees who have [1:23:09] worked so hard on this project. Um if any members of the uh if any residents [1:23:14] do not know what the hometown banner program is, it is a program where you um [1:23:21] families sponsor banners um in honor of their veterans. So it might be um a [1:23:27] child, it might be a grandfather, it generally banners go back generations [1:23:34] and the town has facilitated the creation of a design and this was the [1:23:38] finalization of that design. So, with that, um, we want to I want to thank [1:23:44] everybody who was involved in the process. And um tonight I voted how the [1:23:50] town employees voted because I did a survey and I was able to get um 82 of [1:23:58] them because we have different schedules. But um and they put forward [1:24:03] uh the I double checked the last design to make sure there weren't any issues, [1:24:08] but I voted on their behalf tonight because um that's what they had wanted. [1:24:13] But um but they also said at the same time that they would be good with any [1:24:17] design. Um if you are not familiar with it, the town the hometown banners are [1:24:24] hosted um in a lot of towns in Endicott and everything. It does not cost the [1:24:30] town or municipality any money. Family sponsor the banners. The price that we [1:24:36] we're going to finalize the price, but the initial price, if we do it in blocks [1:24:41] of 40, will be $185. Our highway and parks department will be [1:24:46] putting up the BL banners every year and taking them down, so there's no out-of [1:24:50] pocket cost for the town. Um, and the banners will stay up for three years at [1:24:56] a time. So, it's $185 for three years. And at that point, it would have to be [1:25:01] renewed or not. and the family would get the banner back if they choose not to [1:25:05] renew. So there's really no loss to the family. So um we are going to continue [1:25:11] on and we will have put public notice out as soon as the last mockup is done [1:25:16] and we will I know that we've had a lot of inquiries on how to sponsor a banner. [1:25:22] Um so we will put the information out as quickly as the company gets back to us. [1:25:28] So, we're going to move on to the next new business, which is 16.5, [1:25:33] which is a resolution authorizing the town supervisor to execute the lease [1:25:36] agreement between the town and the Vestal Public Library regarding the town [1:25:41] owned property located at 320 Vestal Parkway East, Vestto, New York, County [1:25:46] of Broom. Um, so, um, can I have a motion? [1:25:50] » So, lift. >> Thank you, Sue, and seconded. [1:25:52] » Second. >> Thank you, Matt. So, any discussion? [1:25:56] So all >> you mind if I pipe in? [1:25:58] » Good. Yes. >> Um even though I don't get a vote. [1:26:03] » Um so this uh this is a lease that uh has been expired for some time. Um the [1:26:12] parties uh um meaning the library representatives and uh the town come to [1:26:19] uh an agreement and the only it's been it's been circulated to uh the town [1:26:25] board members um for all the particulars. Now the only particular all [1:26:30] the particulars are are agreed to and they have been agreed to as I understand [1:26:33] it from uh the library board as well. Um the date has changed just because it [1:26:39] took uh um from the time it was agreed to and now another month has passed. [1:26:44] We're going to make it effective uh September 1 then if that's uh if that's [1:26:48] agreeable to the town board. >> Effective September 1st. [1:26:53] » Yeah, it's just a couple days. >> Okay. Yeah, that makes more sense [1:26:56] because it's the beginning of a school year, too. [1:26:58] » Yeah. Is that Mr. Romani? Is that all right with [1:27:04] that make sense? Okay. >> All right. [1:27:07] Okay. Do you want to note it in the resolution? [1:27:10] » It'll be in the minutes. >> Okay. [1:27:14] Okay. So, um, any other discussion? Everybody got a copy of it? [1:27:20] » Okay. So, all in favor? >> Any opposed? [1:27:24] Thank you, Miss Carrie. [1:27:30] And 16.6 Six resolution authorizing the renewal of the multi-state multi-state [1:27:36] information sharing and analysis center membership at a cost of $3,495 [1:27:42] and authorizing the town supervisor to execute the renewal agreement if [1:27:46] required. So, um, can I have a motion? >> So moved. [1:27:51] » Thank you, Glenn, and seconded. >> Second. [1:27:53] » Thank you, Matt. And all in favor? >> I I [1:27:56] » Can I just I'm sorry. I'm sorry. I apologize. I almost skip discussion. Go [1:28:00] ahead. Okay. So, the $3,495 is a yearly cost, right? Not a monthly. [1:28:06] » So, that is a yearly cost. >> Yearly cost. Okay. I just want to make [1:28:09] sure. >> So, the details were in the email that [1:28:11] you received and that >> I'm just clarifying. [1:28:17] » Well, yeah, I'm just clarifying because people didn't get the email from the [1:28:20] public annual cost at a at an annual cost, [1:28:25] right? [1:28:30] at an annual. >> Somebody makes that motion. [1:28:32] » I'll make that motion that it read at an annual um so Deborah on 16.6 Six. I'm [1:28:38] making a motion that it read uh analysis center membership and annual cost of so [1:28:46] I'm adding the word annual in there just to clarify that it's for a year [1:28:51] but we need a second >> second. [1:29:00] » Okay. So, uh, I will free I will reread the the revised resolution resolution [1:29:06] authorizing the renewal of the multi-state information sharing and [1:29:10] analysis center membership at a cost of 3,400 [1:29:14] » annual cost >> an annual cost of $3,495 [1:29:18] and authorizing the town supervisor to execute the renewal agreement if [1:29:21] required. So, all in favor? >> I I [1:29:24] » Any opposed? Thank you as carried >> on the amendment. [1:29:30] » Yep. Yes, >> I did. I just read the amended [1:29:34] resolution. >> That was the amended. [1:29:38] » She made a motion. >> Okay. So, we we just amended the [1:29:43] resolution and now we're going to vote on the amended resolution. So, the [1:29:47] resolution. So, we are now voting on the amended resolution, which is a [1:29:50] resolution authorizing the renewal of the multi-state information share. You [1:29:53] just want me to say this five times. The resolution authorizing the renewal [1:29:58] of the multi-state information sharing and analysis center membership at a cost [1:30:02] of >> an annual cost [1:30:04] » at an annual cost of $3,495 and authorizing the town supervisor to [1:30:08] execute the renewal agreement if required. So, can I have a motion? [1:30:13] » So moved. >> Thank you, Matt. And seconded. [1:30:15] » Seconded. >> Thank you, Glenn. And any discussion? [1:30:19] » Okay. Thank you. So, all in favor? I. Any opposed? Thank you as car. [1:30:26] Okay. Um I said my announcements before. Uh committee chairs and comments. [1:30:35] Okay. Um I have committee chair comments and updates. Uh they poured a new 10-ft concrete pad and installed new [1:34:04] playground bedding at the Cricut Pitch Park. So, thank you to our parks [1:34:10] department and all of our public works. Uh as summer's winding down here, we're [1:34:14] going to be gearing up for snow before we know it. So, appreciate everything [1:34:17] they do for us. >> Thank you. So, um [1:34:22] with that, um we're going to move on to [1:34:31] Thank you. Public comment section. Now, I read the the rules, so we're going to [1:34:36] stick to the same rules. Please keep it to three minutes. Please respectful to [1:34:39] everybody. Does any member of the audience audience wish to speak on a [1:34:44] matter of town business? [1:34:48] » Just two clarification questions. Can you expand on the eminent domain and the [1:34:55] second one is the um court court wall whatever it was. My understanding was [1:35:03] that the courts are no longer using that room but maybe I I I wasn't here for the [1:35:07] Monday um meeting work session so I apologize. Can you expand on that as [1:35:11] well? >> For which one? I I'm just trying to [1:35:14] understand the second one. >> Seal the wall seal. Is that [1:35:18] » Oh, okay. Yeah, absolutely. So, um, no, I forgot what the first one is. [1:35:25] » No, no, I can just give. >> Oh, eminent domain. Thank you. [1:35:33] Sorry. Thank you. So, the first one is eminent domain. So, the resolution was [1:35:37] in regards to um a project in which a town is expanding a road. um numerous uh [1:35:44] numerous times the the the town has tried to contact them going all through [1:35:49] all the steps and they still have not be a been able to contact that person. So [1:35:53] then you go to procedure which is that there's a procedure where um you where [1:35:58] the town takes the property with compensation to the owner um but it has [1:36:03] to go to court basically to a judge and then they they have to show why they [1:36:07] need it. um all the particulars have to be established and then they can they [1:36:12] can do a legal document to move towards it but it's for the expansion of a road [1:36:17] um and the second one is the court seal is that um in the new location the court [1:36:23] does not have traditionally courts I think always have courts have a court [1:36:28] seal like behind them um and they they had originally when they moved they had [1:36:34] tried to have something it didn't work out So there is a grant um that is [1:36:40] available um in the court district. Um so they're applying for the grant to [1:36:46] fund a seal that so they can have a seal like they should. So that's it. So [1:36:51] they're asking for a grant for it. Um but they need permission of the town [1:36:54] because they're inclusive in the town. So um if you have any other questions [1:36:59] just wait a couple of minutes. >> If I could give details on the eminent [1:37:01] domain. >> So [1:37:03] » just more detail on it. So, the imminent domain, there's a bridge on Baker Hill [1:37:08] Road as it comes off of Tracy Creek Road. Tracy Creek runs under the bridge [1:37:12] and that bridge is in it needs to be replaced. But the new bridge is going to [1:37:17] need a little bit more space to do the building. So, that's where we're getting [1:37:22] imminent domain to take a piece of property. We tried to contact the owner. [1:37:28] They're having trouble with that. So, we're going to move it forward because [1:37:31] the bridge needs to be replaced. Okay, thank you. So, uh, any other [1:37:38] member of the P public have a question or comment? [1:37:44] » Hello, my name is Jennifer. I am a Vestal resident and and I just had a [1:37:48] question for you guys. But first, I wanted to thank you all for today for [1:37:51] the attention that you gave to everybody's concerns and to how you guys [1:37:54] really listened and just even going down the agenda. the amount of attention and [1:37:58] thought you guys put behind your decisions on most of all I would say all [1:38:02] of the agenda items. It was really heartening to see. So, thank you. And my [1:38:06] question is really just maybe after the meeting if someone could just clarify [1:38:10] for me the next steps that I should be on the lookout for regarding um agenda [1:38:14] item four with the public hearing uh the special permanent 1016 Vestal Parkway. [1:38:19] I'm specifically wondering um the timeline of how does it move through the [1:38:24] zoning board or the ZBN review? Like do we have a ballpark of how long that [1:38:28] takes or when I should be checking back for updates? [1:38:33] » Dan, can you comment? >> Um I don't know when the next the ZBA [1:38:38] meets monthly. Okay. Um once a month. So I don't know who when their next meeting [1:38:45] is. It is on their website. tomorrow. [1:38:50] » Is it tomorrow? >> Is it on the agenda for tomorrow though? [1:38:52] Because their agenda isn't normally set. >> I don't mean it's probably if it's [1:38:58] tomorrow, they won't have time to render a decision. So, it'll be the next [1:39:02] monthly meeting. >> Okay. [1:39:03] » And the ZBA will make their decision. They'll provide an uh some [1:39:09] [clears throat] advice and an opinion and then it'll come back to um this [1:39:14] board. As far as the uh how this project is is making its way through the [1:39:20] planning board, you can check the planning board also meets monthly. [1:39:24] They're the second Tuesday of every month and uh [clears throat] [1:39:30] you can check uh the progress there. Those are public meetings you can attend [1:39:34] and there's more uh at those meetings there's more uh detail about uh the site [1:39:39] plans and there's and there's discussion about uh uh like I'd mentioned earlier [1:39:45] whether um remediation is uh is going to be recommended by the planning board [1:39:50] that sort of thing. >> So like for this Z it's ZVA you said [1:39:54] it's called >> it's the zoning board of appeals the [1:39:57] shortand for zoning board of appeals is ZBA. [1:40:00] » Thank you very much. And so is do you know the public is allowed to attend [1:40:04] those meetings? Are they allowed to speak at them as well? Do you [1:40:06] » want to wait for two minutes? We're going to wrap it up. We can't do a back [1:40:08] and forth, but >> that'd be great. Thank you. [1:40:10] » Please wait for a minute or two and be glad to answer any more questions. [1:40:14] » Says, does any other member of the audience wish to uh make a statement or [1:40:18] ask a question on town business? Okay, with that we're going to go move [1:40:24] into executive session with a break for any questions [1:40:28] um on um so we need a motion to go into executive session uh on topic of the [1:40:35] foil officer and um with a break for a couple of minutes to answer questions. [1:40:40] So can I have a motion? >> So moved. [1:40:43] » Thank you um Len and seconded. >> Second. [1:40:47] » Thank you Matt. And uh any discussion? Okay. All in favor? [1:40:52] » I. >> Any opposed? [1:40:54] » Thank you. If you have more questions, come on. [1:41:19] » You know what? If If it had a swank We may [1:41:29] » there. [1:41:46] Should [1:41:55] I continue? [1:42:12] I only [1:42:15] » after
