They [2:44] may wish to uh say something. I also see [2:47] for judge. So, let me start. Would [2:49] anybody like to speak in the orange [2:51] attire this evening? [2:53] » Yeah, I would. Would you please [2:55] introduce yourself for the record? [2:56] » Yes. David Morad. I'm a a resident of [3:00] Morland Hills. I am also an educator in [3:03] higher education for 20 plus years and I [3:06] have two young children who will be [3:08] going to the Orange Public Schools uh [3:10] very shortly. Um, the school district is [3:13] here about a levy that will be on the [3:15] ballot in the fall. And as a resident, [3:18] educator, and parent, I fully support [3:21] it. The Orange School District has not [3:23] passed a general operating levy since [3:25] 2011. That levy, 5 mills, has been in [3:28] effect for roughly 14 years. And in that [3:30] time, property tax revenues for the [3:32] district have risen only modestly, less [3:35] than a million on average per year, or [3:38] roughly one and a half%. Meaning they [3:40] have also failed to keep up with [3:42] inflation which ran at over two and a [3:44] half% during that same time. And it's [3:47] that loss against inflation effect that [3:49] I try and show a table chart in one of [3:52] the handouts. [3:54] As I speak, the elephant in the room [3:55] with any levy discussion is property [3:58] taxes. And I recognize some commun [4:00] community members must be asking [4:02] themselves, how do schools need more [4:05] money? Property values have exploded [4:08] over the past 10-15 years. And since [4:10] levies come from property taxes on such [4:12] values, doesn't that mean that the [4:14] schools have seen a windfall of cash? [4:16] The short answer is no. Some small [4:19] gains, yes, but not enough to keep up [4:22] with inflation and certainly enough not [4:24] enough to match the skyroing [4:26] skyrocketing home valuation increases. [4:29] The more complicated answer lies with [4:30] Ohio's House Bill 920 enacted in 1976, [4:34] which generally holds that such school [4:36] levies collect a fixed or restricted [4:38] number of dollars rather than a fixed [4:40] rate. Thus, even if property values [4:44] rise, the amount collected can stay [4:47] roughly the same. For orange, this means [4:50] the skyrocketing home values do not [4:52] equate to similar gains in school [4:54] district revenues. The primary chance [4:56] for additional revenue growth comes from [4:58] new construction and then a relatively [5:00] small amount of unvoted millillage. To [5:03] see how this plays out, just take the [5:05] 2024 Kyoga County property reappraisal, [5:08] which recorded a 32% increase in county [5:11] home values. For Orange District, the [5:14] assessed value increase wasn't as high, [5:17] more around 20%. [5:19] From 1.26 26 billion to 1.51 billion, an [5:23] increase of roughly $250 million. Yet, [5:27] none of that money, or next to none of [5:30] it, is going to the schools. [5:34] Again, House Bill 920 reduces the rate [5:37] on voted levies to offset rising values, [5:40] leaving only the district's 5.2 mills of [5:43] unvoted millage to collect on that [5:45] increased value. That millage produced [5:48] roughly $1.3 million in additional [5:50] school revenue, about 1.5% of the [5:53] property value rise. In short, it's a [5:56] onetime step increase of roughly 2% [5:59] against a potential tax base increase of [6:01] 20%. I can give you my own personal [6:05] story. My property taxes rose in that [6:08] rep reappraisal by 20%. To almost [6:11] $1,000. [6:13] You would think Orangeville school [6:14] districts would see a lot of that. They [6:16] see roughly $160 of that. Why? How? How [6:20] can this be? Where does the rest of it [6:22] go? It's Ohio, so it's complicated. But [6:26] one answer is that it simply gets [6:28] shifted around, transferred among [6:30] neighbors rather than generating any new [6:32] tax revenue. Here's one example. how I [6:35] perused just out of curiosity a few [6:38] multi-million dollar properties in [6:40] Morland Hills Orange District area and [6:42] found several whose property taxes did [6:44] not shift much at all, much less than [6:47] the 20% rise that mine did. There was [6:49] also at least one multi-million dollar [6:52] property whose tax burden actually fell [6:55] during that period by nearly eight times [6:57] the amount that mine went up. [7:00] I am not calling out any properties and [7:03] I'm not naming names. I'm simply [7:05] explaining how the system works that [7:08] it's a shift between neighbors often [7:10] rather than any revenue uh generated. So [7:14] in conclusion, the reality is true. Ohio [7:17] has a very real property tax problem, [7:20] but one reason is a problem is because [7:22] it's almost by design that the schools [7:25] will be perennially lacking money. by [7:27] design that revenues cannot keep up with [7:30] costs. The cost of labor, materials that [7:33] always are rising in the econom economy, [7:35] but revenues are always always capped. [7:39] » Respectfully, I have to ask you to wrap [7:40] it up because we we usually [7:42] » None of this I got one small paragraph [7:43] and then I'm done. None of this is [7:46] orange school's fault. None of this is [7:48] the fault of Orange leaders and [7:49] absolutely none of it is the fault of [7:51] our children and of our students. the [7:54] people in this room, the people of [7:56] Morland Hills, we can't resolve the [7:58] state issues, but we can resolve [8:01] hopefully the school levy issue from our [8:03] own end. I I think we can do that and I [8:06] believe we should. I thank you for your [8:07] time. There are additional um uh tables [8:12] and slides that contain a lot more [8:14] factual information about what's [8:16] happening at the school district, where [8:18] levies have been over the past 20, 30, [8:21] 40 years, how it's been 15 years since [8:24] uh Orange went to the voters for a levy [8:26] and so on and so forth. I'm an [8:51] attorney in Cleveland. I live in Solen. [8:54] I'm running for the Bedford Municipal [8:55] Court Judge. It's an open seat in 2027. [8:58] I've been a trial attorney for 33 years. [9:01] I represent people on their very very [9:04] worst days when they're looking at their [9:06] wives, their children that they may not [9:08] be able to go home to their wives. They [9:10] going to lose their freedom. I love what [9:12] I do. Uh, as I said, I've been an [9:16] attorney for 33 years. I've been a [9:19] part-time pro municipal prosecutor. I've [9:21] been a special prosecutor. I practice in [9:24] federal court. I practice in all the [9:25] courts in the state of Ohio. I'm a [9:27] graduate of the Case Western Reserve [9:29] University. Uh, I'm been appointed to be [9:32] on the CGA panel to represent federal [9:34] criminal defendants. Uh, but at 58 years [9:38] old, I've determined that I can do more [9:41] help to people if in fact I'm a judge [9:43] rather than helping one person at a [9:45] time. So, I'm looking to be a judge at [9:48] the court where I think that too often [9:51] we just put prosecutors in or people [9:53] that are in the court. I think it's time [9:55] that we put someone that's actually done [9:57] in real practice that actually sees what [9:59] happens to people. I think the court [10:02] needs to use different alternatives, [10:05] programming, different whether it's [10:08] traffic, whether it's driver [10:09] suspensions. There's a lot of reasons as [10:11] why people go into municipal court. [10:12] Municipal court is the low-level court. [10:14] It's not felony court. It's not common [10:16] please. It's lowle. There's ways that we [10:18] can help these people. Uh we don't need [10:20] to put people in jail for any extended [10:22] period of time. Uh, I'll be here more uh [10:25] talking to you about what I intend to [10:27] do, but just a brief introduction of who [10:29] I am. Well, I thank you for coming. [10:38] Um, I I will move on then uh to uh [10:42] report some communications from the [10:44] mayor and other municipal officials. And [10:46] I will start. Uh I've got a few updates [10:49] for council here. The first is um you're [10:52] all probably wondering what's happening [10:54] with AT&T since this has been taking [10:56] quite a long time. So I I'm here to give [10:58] you an update. Uh Mr. Hannah and I have [11:01] been uh continuing to have conversations [11:05] with AT&T, [11:07] but we also are still getting hung up on [11:09] the same legal issues that we've been [11:10] talking about for several months. And um [11:14] we are at this point um going to step [11:19] back and and evaluate whether continuing [11:22] in the current phase or whether other [11:25] paths may be more sensible here to try [11:28] to move this thing forward. I get [11:30] questions from residents all the time [11:31] about this project. And um and uh I'm [11:35] I'm anxious to to make progress and [11:37] we're just not getting there. I don't [11:39] know Mr. Hannah, if you would like to [11:41] make a comment or two, feel free. [11:43] » Sure. Uh, Mayor, I I mean, I would uh [11:46] echo those comments. I think, you know, [11:48] we we've had a a long and uh relatively [11:52] uh comprehensive discussion with AT&T [11:56] um about, you know, the necessary [11:58] ingredients from the villages [11:59] perspective for a lawful agreement that [12:02] doesn't constitute an um an [12:05] inappropriate or unlawful subsidy using [12:08] public funds to a private corporation. [12:10] And you know it gets a little more [12:12] complicated than that of course but um [12:14] but we are continuing to find working [12:17] through those issues very challenging. [12:19] And so um one of the options um down the [12:23] road could be revisiting the RFP that [12:25] the village issued previously. Um and uh [12:29] you know thinking about the other [12:31] respondent I think there was just the [12:33] one correct [12:34] » To that and uh and and see you know if [12:38] we're not able to make this work with uh [12:40] with AT&T with whom the village has been [12:42] negotiating um you know it may be [12:45] possible to commence a different [12:47] discussion um or to revisit the RFP um [12:51] itself and and reissue a uh an RFP to [12:54] try to more carefully calibrate what the [12:58] village is seeking um visav people who [13:01] may be interested in providing it. Um, [14:02] [clears throat] I want to bring to [14:03] council's attention something that I had [14:05] a discussion with the Mr. Water and with [14:08] Sher, I think it was yesterday or the [14:10] day before um regarding the pavilion [14:13] rental process. Um, we continue to have [14:16] issues with the rental process up there [14:19] where people are not respecting our [14:22] rules like emptying their trash. They're [14:25] drawing um I don't know if it's chalk or [14:28] pens on the on the heartscape up there [14:31] that we can't seem to remove. Um they're [14:35] leaving the bathrooms a complete mess. [14:37] Um, and we're doing the best. The [14:40] service department is doing a great job [14:41] to try to get up there in between [14:43] rentals, uh, and and take care of [14:46] things, but I think, uh, I'm going to [14:48] make some changes to the rules. Uh, I [14:51] don't care to imple implement them until [14:54] next year because we've already kind of [14:56] set the rules for the season and we're [14:57] sort of getting toward the end of the [14:59] season. But, um, my proposal, nothing [15:02] final. I welcome input or call me or if [15:05] you have any input tonight. Um the [15:08] primary things that that we discussed [15:10] that I'd like to do is number one go to [15:12] full day rentals rather than trying to [15:14] do half and half because it creates and [15:16] most other communities are doing kind of [15:18] full days. So you rent it for the whole [15:20] day and you've got it the whole time and [15:22] we're not trying to um run up there for [15:25] an hour in between two groups and clean [15:28] everything. Second, I'm going to require [15:30] a deposit for all rentals. we only [15:33] require deposit for rentals when um [15:36] people are food truck [15:37] » And we're finding that um we're spending [15:41] extra cost going up there to clean up [15:42] things that they're supposed to be [15:44] doing. So I think if we have a a a [15:46] deposit that is forfeited if some of [15:50] these things happen, I think we'll be in [15:52] better shape. And then the third is to [15:54] raise the rate uh for non-residents. And [15:57] I don't know what the rate exactly is [15:58] going to be yet, but um it will be a [16:03] larger gap between residents and [16:05] non-residents because I think we have [16:07] more recourse on residents when they do [16:08] these things than non-residents and and [16:11] it's pretty common that other [16:13] communities either don't rent to [16:15] non-residents or they charge more. So [16:17] those are the things that are going on. [16:18] I welcome your feedback. We're not doing [16:19] anything till next season like I said, [16:21] but I think change some changes are in [16:23] order and I'm going to let you guys know [16:25] about that. And then the last thing I'll [16:27] say uh tonight is around power outages. [16:30] We continue to have them. Um I've been [16:34] all over I've written many letters. [16:36] You've seen maybe some of the social [16:38] media posts that Sherry's helping with. [16:40] We I've reached out to our elected [16:43] officials. Um I had our councilman reach [16:46] out to me again and I told him what [16:47] we're doing. He said he'll help whatever [16:49] we can. I think just making our story [16:52] known that we need more attention from [16:57] um from First Energy here to address [16:59] some of these problems. I know it's not [17:01] a short-term problem, but I'm just going [17:03] to stay on it. I just think it's it's [17:04] not acceptable level of service that [17:06] we're getting. Um and you know, [17:10] hopefully with the collective voice and [17:12] some of the other communities around [17:14] here that are doing similar things, [17:16] we'll get some action. So in in dollars we are [21:28] down about $527,000 [21:32] um year to date. Um again our budget was [21:38] conservatively estimated um at even less [21:40] than that. So we are fine as far as the [21:42] budget is concerned. Um but as far as [21:45] actual cash and revenue collections we [21:48] are down. So just a heads up. Um [22:30] but I am concerned about you know all [22:32] these other talk about property taxes [22:34] and all those things and if all this [22:37] comes together with u reduction in [22:39] income tax revenue which is our main [22:41] source of revenue and um property tax is [22:44] also u being discussed [22:47] um you know we'll have to look at it [22:49] keep an eye on it and I'm sure you may [22:52] um are familiar with all the things [22:53] going on statewide because uh as part of [22:56] your mayors and managers association [22:58] they do have discussions on [23:00] Uh, but I'm I'm certainly keeping my eye [23:02] on it and keep you informed as we go [23:04] along. Um, we [27:09] did have um an extensive discussion with [27:11] a resident um of Miles Road in the Scrap [27:15] Ball Morland Hills area. Um, she had [27:19] emailed me expressing concern about the [27:22] the speed in that area on Miles Road. [27:24] So, she attended the meeting um shared [27:27] her concerns, talked about how she had [27:30] um reached out to Shrint Hall's roads [27:32] and safety committee um as well and how [27:38] it may um they felt it may have to be a [27:41] combined effort to take a look at that [27:43] road if we were going to do anything [27:45] about it with with the village. Um, but [27:48] what she's saying is the stretch there [27:50] between Solen, where Solen Road starts [27:54] and intersects with Miles heading [27:56] westbound, um, is currently 35 miles per [27:59] hour, um, she feels it's it's too high [28:02] of a speed limit for that area being [28:04] very, uh, dense in residential um, [28:08] homes. So, she was coming to ask Beth if [28:11] we would take a look at it in the area. [28:14] Um, by the end of the conversation, uh, [28:17] Chief Diesel stated he'd be happy to [28:19] install a speed box in the area going [28:21] westbound, also eastbound to to do a [28:23] seven-day study to take a look at the [28:25] speeds. Um, that's currently in process [28:30] um because it takes some time to get all [28:31] that, make sure that we're not putting a [28:34] poll where their utilities are lying. [28:36] So, um, that's sort of our next steps to [28:40] evaluate that. Jeff uh Floreski shared [28:42] that there is a who you know this [28:46] process that you have to go [laughter] [28:48] through to change a speed limit of any [28:50] road. Um there are several factors [28:52] involved with that. So um at this point [28:56] we're just we're gathering information. [28:58] So I wanted to give you all an update on [29:00] that. Um, [29:03] I see that we have this later on the [29:06] agenda, but just briefly, Chief Diesel [29:09] reported that there is a recommendation [29:10] from planning to allow eight buses to [29:12] access the Hyram Trail three times per [29:15] day. And then uh finally, [29:19] Mr. Farski shared that um there's a [29:22] challenge of developing a storm water [29:25] drainage system around East and West [29:27] Juniper. [29:29] um and he discussed several different [29:31] options of how to address that. Um we're [29:36] still in discussions on or he's still in [29:38] discussions on trying to figure out the [29:40] best option is. So that's where we are. [29:43] » That's it. Uh this Saturday, [31:59] August 15th, from 10 to 2, uh the [32:03] commission will have a table at the [32:05] Orange Arts Center. I believe they'll be [32:08] um [32:10] sponsoring a uh drawing of faces of our [32:14] community uh uh craft at the DEIV table. [32:19] Uh it should be a great event. Um [32:24] [clears throat] the um joint book club [32:27] with uh green commission um regarding [32:31] the book grading sweetg grass has been [32:33] set for October 22nd at 6:30 uh p.m. Uh [32:40] the we are Morland Hills event. Um, I learned a lot um [34:12] about food waste and how much it's [34:14] contributing to the to the methane and [34:16] the in the atmosphere and um they will [34:20] be bringing they're they're still taking [34:22] a look at pricing and bringing some [34:23] options to the village as far as what [34:26] that might look like. Uh in this section, we do have [34:41] something we've put there, which is the [34:43] Hyram House camp uh conditional use [34:45] modification [34:47] uh to allow egress onto Hyum Trail for [34:50] up to eight regular buses and one [34:52] special education bus during specified [34:54] time periods. Uh so it [35:02] it's um you know a high room house camp [35:06] uh requested [35:08] informally in some preliminary hearings [35:11] uh and formally at the uh public hearing [35:15] at uh the the last planning commission [35:18] meeting uh requesting modification of [35:22] their conditional use. actually kind of [35:23] modification of the previous [35:25] modification of of their traditional [35:27] use. Uh specifically modifying you may [35:30] recall there were seven conditions in [35:33] 2023. The specific modification would be [35:36] condition number one uh that currently [35:40] only allows ingress of buses to the [35:44] access road. And the uh request [35:47] modification was uh egress for at three [35:52] periods of time. [35:55] um once in the morning for eight of [36:00] stu regular students and one bus for [36:03] special education students um uh for [36:06] egress on high trail in in the uh in in [36:12] the morning specifically at at present [36:14] time between the hours of 7:30 8 7:55 [36:19] and twice uh in the afternoon uh one [36:23] approximately typically uh 245 [36:26] uh for um Brady students and one [36:30] approximately 345 for uh Morland Hill [36:34] students and the uh Y is the school uh [36:38] and Hyram [clears throat] presented that [36:40] um [36:42] that we'll be able to um and the [36:45] transportation director um worked all [36:48] this out that they're expecting delay [36:50] time to be reduced by 15 [36:53] Um, and those 8 hour those eight buses [36:58] represent about 23 cars that would be [37:01] removed from the queue at um uh at at [37:05] Gail Allison. Um I I stated at the [37:09] planning commission that I I thought our [37:12] job was kind of really summarized kind [37:14] of by the one line in our conditional [37:16] use um ordinance and that is that uh the [37:21] conditional use regulations are quote [37:23] intended to ensure that conditional uses [37:25] are reviewed in a reasonable equitable [37:26] manner while safeguarding property [37:29] rights of all individuals and the [37:31] health, safety and welfare of the entire [37:32] community. In other words, a balancing [37:34] of property rights, if you will, of of [37:37] Hyram House uh with the um need to [37:42] overall um look at the interest of [37:45] Morland Hills um as a whole. And um in [37:49] order that for the planning commission [37:52] to uh to balance those uh we first have [37:56] really two or two things. Uh first our [37:59] our police department um and our [38:03] engineering uh department uh reviewed [38:06] the situation. Police department [38:08] actually went out uh and staged um and [38:12] and examined the uh traffic at those [38:15] times and also talked with the um [38:18] transportation director at Orange. And [38:22] um neither uh bottom line neither uh the [38:26] the chief nor our engineer felt that um [38:30] there would be any material traffic [38:33] delays at high trail uh due to the the [38:37] staggered nature of of this um uh bus [38:41] traffic of this egress and bus traffic. [38:43] Now on the flip side, I thought that it [38:46] would be helpful in reducing [38:49] uh the queue on Gail Allison Drive, [38:52] helpful in reducing traffic um backing [38:56] up at Sugarin and S and [clears throat] [39:00] helpful in reducing the possibility that [39:03] emergency vehicles might get stuck in [39:06] that queue without being able to get [39:08] through. Um and so we had a public [39:12] hearing. Um also there there were um [39:17] just uh basic besides the school board [39:20] um individuals who were um who were also [39:23] residents uh there was one um individual [39:27] who um who expressed support. There were [39:31] two individuals that indicated not not [39:34] so much opposition but that um they [39:38] didn't want [39:41] they didn't think more than hills um [39:43] should and and higher trail should be [39:46] responsible for what they they they [39:48] thought was a school issue. Um and the [39:51] planning commission uh we basically uh [39:55] and and and I as a council member [39:56] basically think uh you know this is not [39:59] just a school issue. Um higher house and [40:04] school are also institutional residents. [40:06] Many Mor Hills residents have um have uh [40:12] children that go to orange schools. But [40:14] most importantly, [40:16] um [40:17] the uh the requested modification is is [40:22] not expected to [40:24] hurt and affect Hyram Trail residents [40:28] based on our engineer and our uh police [40:31] departments. [40:33] Its intent is to help and expected to [40:36] help by again freeing up the queue by um [40:40] by lessing traffic at some degree and [40:42] reducing possibility of of hyum. Um and [40:49] the the other kind of solace uh the [40:52] other item to to recall is this is [40:55] really in effect a a two-year [40:59] modification because recall in two years [41:03] That will be the fiveyear mark uh where [41:07] the um hyram house has to come back to [41:10] us with a new traffic study showing all [41:14] the alternatives that uh alternative uh [41:17] to to using a hyum um to um and and how [41:23] those may or may not require still the [41:27] need for a hyum and they need uh uh to [41:30] do that two years from Now, so long [41:34] story short, um we recommended that [41:39] council approve um the requested [41:42] modification [41:43] to the conditional use, specifically the [41:45] request to modify condition one to also [41:49] allow egress on the Hyram Trail of up to [41:52] eight regular buses and one special [41:54] education bus in the morning during the [41:57] 7 to 9:00 a.m. time frame and twice in [42:01] the afternoon during the 2 to 4:00 time [42:03] frame. Provided that all other existing [42:08] conditions 2 through 7 from 2023 [42:13] um [42:14] be uh remain in full force in effect. [56:16] » I do not envision that. I think we could [56:19] do it on our own with Mr. Hannah, [56:20] honestly, because I think we have most [56:22] of what we got there. Uh and um after further [1:03:23] discussion uh realized that we have a [1:03:26] good foundation [1:03:28] um of those is it four there four or [1:03:30] five there's you know five categories [1:03:34] um we all agreed that what we would do [1:03:37] was look at them um you know see if [1:03:41] there's any modifications that might [1:03:43] need to be made and maybe identify uh [1:03:46] some short-term actions we could take to [1:03:49] advance toward the goals uh or even [1:03:52] something you know longer term uh not [1:03:56] not necessarily a a concrete goal but [1:03:59] something we're always you know working [1:04:00] toward. So just just yes would like to [1:04:05] uh you know remind people to take a look [1:04:07] at that hopefully come prepared at the [1:04:10] next briefing. [1:04:12] » Great. Thank you president.
