And [12:07] whereas the described in the full [12:08] environmental assessment form along with [12:10] the petition includes the text [12:12] amendments to the zoning code and the [12:14] redevelopment of the property as [12:16] described therein. [12:18] And whereas it's a proposed type one [12:20] action pursuant to seeker [12:22] and whereas on June 23rd, 2026 the board [12:25] referred the zoning petition and [12:26] applications to the planning board the [12:28] Rye Brook planning board for an advisory [12:30] report and recommendation and whereas on [12:33] June 26, 2026 notice of intent to [12:36] declare lead agency was also circulated [12:38] by the board of trustees to all known [12:40] involved and interested parties and 30 [12:42] days has passed without receiving any [12:44] objections. [12:45] And whereas on about June 26, 2026 [12:49] the zoning petition and applications [12:51] were referred to the county department [12:52] of planning pursuant to general [12:54] municipal law. And the next step in [14:55] the SEQR process is lead agency is to [14:57] declare in this case the Board is [14:59] declaring that there's a positive [15:00] declaration, which means it has one or [15:03] more potential uh environmental issues [15:05] that need further study. And there's a [15:07] draft, what they call a scoping [15:09] document, which outlines the issues that [15:11] have to be studied in the DEIS, or the [15:14] draft environmental impact statement. [15:16] So, the applicant has has prepared that [15:19] scoping document as a draft, and that's [15:22] being circulated to all the involved and [15:23] interested agencies, as well as the [15:25] village board and the public, to make [15:27] any comments on the scoping outline, [15:28] which is a very important document, cuz [15:30] that does define what issues might [15:33] potentially could potentially be an [15:35] issue that needs further review or study [15:38] by the applicant through the review [15:39] process. So, that's where this is. The [15:42] We're referring the scoping document. [15:44] We're also setting a public hearing for [15:46] any and a time frame for any comments on [15:49] those documents. So, this is not to [15:52] approve the application. Because if the [17:27] studies don't get done, it's going to be [17:29] very hard at the end to argue that, [17:32] "Hey, I was worried about this and I [17:34] didn't see a study about that." [17:36] If you If you have concerns or impacts [17:39] that you think are going to impact you [17:40] or the community, [17:41] raise them now and um it's a healthy [17:44] process. I think everybody does better [17:47] when stuff gets vetted thoroughly. Or if [17:50] even if something's covered, if you [17:52] don't think it's going to be studied [17:54] enough, you know, say why you think [17:56] something should be studied more or [17:57] less. So, by trying [40:32] to keep the traffic flowing in the [40:34] northbound lane, [40:36] the that keeps uh so the cars won't [40:38] continue to pass and create literally [40:41] uh they come up head-on. They may have to do things, for [41:28] instance, on campus. But it's not really good [48:45] concise information about the events or [48:47] at least not as good as it can be. So, [48:50] one of the things we've been doing is [48:51] saying, "Let's look at this Civic Link, [48:53] which really has an enhanced for a very [48:56] nominal cost." So, $3,500 a year, what [48:59] it does is it gives the community the [49:00] same look and feel for different type of [49:02] events. So, residents also don't while [49:05] it's a hard thing to do [49:06] administratively, residents have to go [49:09] to the Chamber website or they got to go [49:10] to the Library website or they got to go [49:12] to the Town of Rye website or they got [49:13] to go to the Village of Rye Brook [49:14] website to look for each one of those [49:16] types of events instead of opening up [49:18] the Westmore News or something and [49:19] seeing what's going on. So, what this is [49:22] doing is giving this the residents the [49:23] same look and feel and it allows we [49:26] they're able to go we brought in the [49:28] Chamber of Commerce, we brought in the [49:30] Library. We also showed it to the Town [49:32] of Rye, who is considering it. We showed [49:34] it to Port Chester as well, but they're [49:36] kind of going in another direction with [49:37] all the development. Town of Rye is [49:39] looking at this administratively and if [49:42] they do it, the price would drop to [49:43] 3,000 and we would get 500 back. But, [49:46] um, [49:47] what this would do would give access [49:49] where [49:50] say the Chamber or the say the Library [49:52] has a has a program or another community [49:54] group has a program, they go through our [49:57] We provide the link to them. They upload [49:59] the information. It goes into it in a [50:02] very standard format and it gets [50:03] uploaded on our calendar. It would have [50:06] to be approved by the village. It would [50:07] be approved by by myself or by Greg. We [50:10] would approve whatever it is so we know [50:12] what's going on our website. The other [50:14] thing and if you go to the links for [50:16] that calendar, it's all going to have [50:18] the same look. It's going to be provided [50:20] It's also going to be able to provide [50:21] directions to the site if there's a [50:23] payment required. It'll link to their [50:25] payment section on the other group's [50:27] website. So everything gets linked to [50:30] the group that's actually posting it on. First being that um [59:24] you know, we sent some messaging out to [59:26] the community about the EPA and New York [59:29] State DEC and the mercury uh follow-up [59:32] that their DEC is planning. And uh we [59:35] have been [59:37] urging uh to get more information from [59:39] the DEC and Department of Health. And uh [59:42] we Deputy Mayor Heiser and I [59:45] uh Michael Noak, Greg Rivera, and [59:47] myself, we all met with the DEC and [59:50] Department of Health today. And it was a [59:52] it was a very productive meeting. So, [59:54] there are two main reasons I'm going to [59:56] focus kind of going forward, but the two [59:58] main reasons for the additional [59:59] investigation that there's going to be [1:00:01] required testing of soil, groundwater, [1:00:03] and vapor is that the state has a higher [1:00:06] standard that of uh for cleaning up than [1:00:08] the EPA did when they did this work back [1:00:11] in 2000 [1:00:13] uh 4 to 7 and then again in '22 and uh [1:00:17] final report in 2019. [1:00:19] And also because the New York State DEC [1:00:22] uh had asked for EPA to do more testing [1:00:25] after the 2022 [1:00:27] uh after uh reports and testing that was [1:00:30] done, but the EPA did not agree to that, [1:00:32] so they wanted to do they want to do [1:00:33] some additional testing now. Um the site [1:00:36] was turned over to the DEC sometime [1:00:38] after the 2022 report uh and testing [1:00:42] that was done. [1:00:43] Uh funding was established by the state, [1:00:46] and now they're going to be proceeding [1:00:47] with doing the additional investigation [1:00:49] uh of the of the sites that they want to [1:00:51] have tested or retested. So, that's [1:01:16] something that we we would encourage [1:01:18] people to do. [1:01:19] Um they're going to be sending the DEC [1:01:21] is going to be sending us a full work [1:01:22] plan. Right now, it's our understanding [1:01:25] that at a minimum they're going to be [1:01:26] doing 10 soil samples and four 14 [1:01:28] subsurface water and sediment samples. [1:01:31] Uh and the the DEC is also going to be [1:01:34] setting up a project web page. They're [1:01:36] also be sending out an updated community [1:01:39] uh notice that will provide more [1:01:41] information to people. [1:01:42] And um [1:01:44] we asked the Department of Health, we [1:01:45] said, "Is there any immediate danger for [1:01:48] residents of any potential areas that [1:01:50] they're concerned about?" And they give [1:01:52] a kind of a careful answer as you'd [1:01:53] expect the Department of Health to say, [1:01:55] but at the same time they said they're [1:01:56] not aware of anything that's an [1:01:58] immediate concern or anything on the [1:02:00] surface that's an immediate health [1:02:02] concern. Um we said we'd like to see [1:02:04] that in writing and to put that out to [1:02:06] the community as well uh to alleviate [1:02:09] any concerns. So, that's we're just [1:02:10] sharing what was told to us by the [1:02:12] Department of Health. And that's [1:02:13] obviously based on what they know. If [1:02:15] there other testing comes out and [1:02:16] there's something that needs to be [1:02:18] addressed, then it'll be done at that [1:02:19] time. Um they are looking to come out in [1:02:23] sometime in August or August September [1:02:25] time period. I think it's about 45 days [1:02:27] of collection time frame. Several weeks [1:02:30] to do the uh the results of the soil of [1:02:32] the testing. And then they talked about [1:02:35] a year or two for the final report. [1:02:36] Obviously, we Once you get to that [1:02:38] point, we'd like to push that to be [1:02:40] quicker than what they've said cuz we [1:02:42] want to at least know the results and [1:02:44] what the what the report says. [1:05:13] They're starting to remove the three [1:05:14] houses on Brook Lane that the village [1:05:16] purchased through the National Resource [1:05:18] Conservation Service program. Uh they're [1:05:21] currently doing work on the asbestos [1:05:23] removal. And what else, Michael? Are [1:05:25] there issues inside? [1:05:27] Yeah. [1:05:28] Um and and they're doing the work there. [1:05:31] Um they provide the notice to the state [1:05:32] and any other agencies they had to. [1:05:35] We're also going to do [clears throat] a [1:05:36] communication out handing out something [1:05:37] out to the residents so they're aware of [1:05:39] it. And then once they finish, we also [1:05:41] have an inspection company on site that [1:05:43] the board approved to watch over the [1:05:45] whole all the removal to make sure [1:05:47] everything's done safely with no impact [1:05:50] on the neighboring properties. And once [1:05:52] that's complete, then they can remove [1:05:54] the homes. What residents should expect [1:05:56] is they're going to see fencing around [1:05:57] the exterior of the perimeter of the [1:05:58] properties. And then the homes will be [1:06:01] removed, regraded, planted with grass, [1:06:04] very minimal landscaping, and it'll be [1:06:06] forever with exist without any [1:06:08] structures on those properties. So after [1:06:11] Brook Lane, then they'll be going to [1:06:13] probably Wyman Wyman and then Rockledge. [1:06:17] >> I I just have two things. The first is [1:06:19] » I I just have two things.
