[0:00] Allegiance to the flag of the United States of America and to the republic [0:05] for which it stands. One nation under God, indivisible, with liberty and [0:11] justice for all. [0:16] » Have a roll call, please. [snorts] [0:20] » Taylor >> here. [0:22] » Owens here. >> Raybrook [0:24] » here. Carlstrom >> here. [0:26] » Peoples >> here. [0:27] » Whan >> here. [0:29] Thank you. >> You forgot somebody [0:38] » coming. >> I'm here. [0:43] » All right. Additions or corrections to the business consent agenda? [0:51] Hearing none. Entertain a motion to approve. [0:53] » So moved. >> Second. [0:55] » Motion by Carl. Support by Braybrook. All in favor? [0:58] » I. >> Those opposed? Motion passes 70. All [1:02] right. This time we'll open the floor for public comment for agenda items. [1:06] There's also public comment at the end of the meeting for any item you'd like [1:10] to bring to the council's attention. We will start right in the front row. [1:14] Bruce. >> No, thank you. [1:16] » Sue. [1:22] » Back rows. Anyone? All right. Close off public comment. Old [1:28] business or public hearing. We have none old business. None new business. [1:33] Resolution [clears throat] 2604 is a resolution to provide the designation of [1:37] September 18th, 2026 as PMIA recognition day. [1:46] Yep. Uh nothing really to add on this one. This is something the council [1:49] generally does uh annually and uh resolution's included in the packet but [1:53] uh no specific [clears throat] beyond that [2:00] entertain a motion to approve resolution 2604 [2:03] motion >> motion by Cummings support by [2:08] » any other discussion [2:12] I had one member ask me why we have to do it every year and for whatever reason [2:17] they They like to have the resolution yearly. [2:20] Um, this is something I've been doing many years as I can remember. So, all [2:26] right. All in favor? >> Those opposed? Motion passes. 70. [2:31] Resolution 2605 is a resolution to accept project grant agreement with [2:37] MNRTF for project TF25-07. [2:44] » Okay. So uh this one is the formal resolution accepting the grant funding [2:48] funding from the Michigan Natural Resources uh trust fund. Uh this is the [2:52] Rogue River Park South Kayak Landing. So this is uh designated for the property [2:57] uh near the airport uh that we generally use for keeping the approach path uh [3:01] clear of trees. Um not to be confused with the grant that we got the cycle [3:06] before this uh for the property uh inside the village. So uh just a [3:11] resolution. Um you guys already approved the dollar amount in the budget and also [3:15] applying for the grant last year. This is just the final step in terms of [3:19] accepting it uh now that it's been approved by the state. [3:26] » Entertain a motion to approve resolution 2605. [3:30] » Make that motion. >> Motion by people's [3:33] » support. Support by Carlstrom. Further discussion [3:40] hearing none. All in favor? >> I opposed. Motion passes 70. Bailey [3:46] Bridge bids contractor selection. Okay. As council will recall, we went out to [3:53] bid uh for the Baleat Bridge. This is uh in the easement area that we have near [3:58] uh Dance with Me and their new parking lot. It will connect uh to a public [4:02] sidewalk uh that will ultimately connect to the 13-mi road sidewalks and also the [4:08] uh Baleette parking lot. uh low bid for this project. We're very pleased. Uh 11 [4:13] total bids. So uh lot of interest uh in the project. We had the bid opening uh [4:18] in this room last week. And low bid bid was Miller Bridge Construction out of [4:22] Portland, Michigan for 175,503. um as you'll notice in the uh packet is [4:30] very very close to our estimates and uh with that taken together with the design [4:35] will be very close to that 200,000 overall project budget number we had. So [4:40] we're pretty excited about it. Uh [clears throat and cough] they're [4:42] looking to start uh likely in October. >> Anything that originally wasn't wood has [4:50] been changed out to composite. Correct. >> Uh composite and concrete deck. The deck [4:54] will be concrete and the yeah structures will be the composite. There's also [4:59] electrical outlets so we can have lighting on the bridge and so forth. And [5:04] and and to be clear, it's not just the bridge. The 175 is all the site work, [5:07] the uh pilings, uh the sidewalk connector pieces. So this is a you know [5:13] out the door out the door uh price for the whole whole project hooking up the [5:17] wiring too. We already have the permits. We've secured those uh with the state [5:21] and the county as well. any idea if they're going to beat the uh [5:25] drain commission down there for their work or [5:28] » we've worked with the drain commission pretty specifically on the permitting [5:32] for this because of course it's a county drain. Um so how that exact timing [5:37] meshes out I can't really answer that right now but they're they're working in [5:41] conjunction with the drain commission on it or at least our design team is. So [5:45] and then if if this is awarded then of course Miller Bridge will be as well. [5:50] Now, they're in the bridge building, right? Is there any way they could be [5:54] looking at that Martindale project? >> Uh, they didn't bid on that. Uh, they [6:00] didn't bid on the Martindale one. That that [6:02] » Were they asked or whatever? >> We've put the Martindale one out a [6:06] couple of different times. I didn't ask Miller, you know, specifically if that's [6:09] what you're asking. >> I mean, if that's their kind of uh what [6:12] they do. I mean, it wouldn't hurt to I mean, because there's only one bid on [6:16] the other one. >> Yeah. Happy to talk about that under [6:19] under that agenda item if you'd like to. >> Yeah. [6:22] » Okay. When we when we get to that, I'll we can talk about that. [6:27] » All right. >> So, if they if they start in October, [6:30] when would the estimated finish date be? >> Um, I'm not I'm not certain of that. [6:35] » Okay. Entertain [clears throat] [6:41] a motion to award the bid to Miller Bridge Construction in the amount of [6:45] 175,53. [6:49] » Take that motion. >> Motion by Cummings. [6:53] » I'll support by Braybrook. Further discussion [6:59] hearing none. All in favor? Those opposed? Motion passes 70. [7:09] Moving on, approval of USDA grant borrowing application. [7:14] » Okay. So, this is uh a process council may be familiar with from uh the [7:19] different uh borrowing uh and grant projects we've done over the years uh [7:23] with USDA and and other funders. [snorts] [7:26] Uh in 2020, the village uh completed its saw report and analysis. Uh the sewer [7:32] under Gardener Street uh was identified at that time as nearing its uh maximum [7:37] capacity. So as a reminder uh there's three separate sewer lines underneath [7:42] Gardener Street that all ultimately connect collect the village uh sewer and [7:47] convey it to the sewer plant. Um we did apply with uh Congressman Molinar's [7:52] office through the congressionally directed spending and uh did receive a [7:56] million dollars for uh this project. So that doesn't come close to covering all [8:00] of it, but we're pretty pretty excited about that. So there's really two [8:03] projects. We're going to use the CDS funding along with village sewer fund [8:08] savings to complete a portion of the project from Martindale to the sewer [8:12] plant. So that will happen uh either way. We would like to uh complete the [8:18] full project which would go from Martindale to the almost to the lift [8:21] station uh there on Gardener Street. So that component of the project is another [8:27] 6.27 27 million. Uh what we're applying for is two things. One is the EDA grant [8:33] request which has already been submitted in the amount of $5 million and then [8:37] there's a match associated with that uh which we're proposing to do a USDA loan [8:42] in the amount of $1,254,000. So uh the USDA process uh so it's it's [8:48] really twofold. It's it's you know basically applying for the million [8:52] dollars that's already been designated uh for the village uh under the [8:56] congressionally directed spending and then a separate application uh for the [9:00] loan to match the EDA grant if we get the EDA grant. So uh we're very hopeful. [9:05] We've been working on uh the EDA grant uh with the United States Department of [9:10] Economic Development uh for a number of months since the council approved the [9:14] bid with our design team. So we were able to get that all turned in. So this [9:18] is just a formal part in the process to uh keep it moving [9:22] » and there is no requirement to follow through with the loan if the grant's not [9:27] awarded. That correct? >> That's right. Exactly. We but we do have [9:30] to do this official step of the council approving us uh submitting the grant and [9:35] the loan application in order to keep uh the grant application active with with [9:39] the EDA. So, but yeah, if we're ultimately unsuccessful, then we don't [9:43] have to go through with the with the loan or we could look at other funding [9:47] options. But the good news is either way, we'll at least be able to do a [9:51] portion of the project. Uh this year there's um what I would call a unique [9:56] opportunity as far as the federal funding goes with the EDA. Normally [9:59] those funds are 6040. Uh this particular pot of money is 8020 uh under that. So [10:05] if uh at Kent County municipalities with projects like this are eligible. So [10:10] we're trying to take advantage of that especially considering uh this is [10:14] something that's been in our CIP, you know, and identified with the SAW [10:18] grant for or saw program for quite some time. So if we're successful in this [10:23] application, it'll be a big big deal for the village. will not only have gotten [10:26] the million dollars in congressionally directed spending, but we'll have gotten [10:30] uh 5 million in EDA funding, too, for something that will ultimately serve the [10:34] village for a long, long time. So, we're pretty excited about it. [10:40] Entertain a motion to approve the USDA grant loan application for Gardener [10:44] Street sewer collection system project. >> I'll make that motion. [10:49] » Motion by Carlstrom. >> Support. [10:52] » Support by Peebles. Any other discussion? [10:58] Hearing none. All in favor? >> I. [11:00] » Those opposed? Motion passes. 7. That's the only question that I had. [11:06] What happens if we didn't get >> I was curious of that, too. Uh Martinale [11:12] boardwalk repair bid. >> Okay. And I'll ask uh William Hunter, [11:16] our director of public works, to come to the D and uh help me present this one. [11:20] So, this has been a project that uh we identified [clears throat] in our budget [11:25] uh and have been having a little bit of difficulty with the bid process. So, um [11:29] I don't know if you overheard Councilman Taylor's questions, but if you could [11:32] kind of address those in your remarks, we'd certainly appreciate it. [11:35] » Yes, sir. >> Okay. Floor is yours, Bill. [11:38] » Okay. Thank you. Uh in front of uh village council today [11:44] is uh proposals actually from contractor the loan bidder from the last RFP we did [11:49] from Tucker Marine Construction. Uh earlier this year or sorry beginning of [11:55] last year we did put in a capital improvement plan uh repair to Martinale [11:59] Bridge. We identified like 40 linear feet that seem to be heaving. Um I did [12:04] at that time compare the plans to existing conditions. uh the existing [12:08] plan I mean the plans that we have in place showed concrete footings and looks [12:12] like they did just direct drive piling drive which is typical probably for that [12:17] area. I probably if I were looking at plans I probably would have went that [12:21] way too. Um but it does look like those pilings heaved which actually tells me [12:26] probably they weren't driven down far enough and which the frost actually took [12:30] it and heaved them. So we I put together an RFP identifying that and I did offer [12:35] the contractors that bid a copy of the plan. So first time we went out for bid. [12:40] I put an RFP together, released it June 29th, deadline of July 13th, I did get a [12:45] few calls on it. There was one contractor that said they would be way [12:49] too expensive. They were calling from the um Ohio, but they said call us if [12:54] you don't get any bids. I didn't like the way that sounded because they said [12:57] they would have to put their people up in a hotel. So I was like, "Well, I [13:00] don't think that would be." So the second time I went out for it, I thought [13:04] a little bit outside the box. I thought, "Well, this is basically kind of like a [13:08] dock. So why don't they get hold of some marine contractors, someone that puts in [13:13] docking?" So we did. And that's when we actually got some interest. And that's [13:16] where that's what actually Tucker does is they that's what they do. They they [13:20] put in marine docks. Um there is one change to the um to the uh the report in [13:27] front of you. At the time I put the report together, I didn't get a chance [13:30] to call them. However, after the report I did call them, they would be able to [13:34] get this completed by October 31st. They said they'd be able there and and kick [13:39] it out within like two weeks. Um the second time you can see actually we we [13:45] the same amount we we reached out to our people we know like Milbacher a couple [13:50] of the Marines Bisser Dan's Escavating JW Dirt Works JW dead work dirt Dirt [13:56] Works did respond back to me. Uh they regretted not being able to bid on it [14:00] because they wanted engineering plans on it and I understand that. They just [14:04] didn't feel comfortable at this time. So, so in front of the village council [14:09] today is um a a proposal from Tucker Marine for 44,500. [14:15] We did budget $50,000 in the CAP improvement plan, so [14:20] we're under it by 5,500. So, I'm here to answer any questions [14:24] that council may have on this proposal. >> So, will it be the exact same size? Is [14:32] there any ability to like make it just a little bit wider or No. Well, we I did [14:36] look into that um uh to make it a little wider. So, that would probably result in [14:42] a in a full con reconstruction. I put some cost together uh from what I could [14:47] find for linear feet in those. And you're looking at probably $800,000 to [14:52] do that to make it a 10-ft bridge. That's what I was thinking. Maybe [14:54] matching up with the bike path. So, make it a 10 foot through there and 10 foot [14:58] back around because right now it's six foot. But yeah, that's would be I mean [15:02] that's something that council could choose to do. I mean, that's something, [15:05] but that that's a large that's a large hit. And that 800,000 would be including [15:10] actually we'd have to go back out for bids. We'd have to have plans and [15:12] engineering. >> That's a huge number. [15:15] » That's a big number. And I look at some other scenarios, too. I looked at [15:19] actually just re building the exact same bridge in six foot and I've got cost [15:24] together about 600,000. If we wanted to build something even more robust, [15:28] something maybe like similar to what we're doing, Billy, you're probably [15:33] looking at and something that could maybe take some equipment over it, [15:37] you're looking at about 1.1 million. >> Why Why is it so expensive? [15:43] » Well, it for actually because you because you're looking at probably load [15:46] depending on what kind of equipment we choose to want it. If we wanted [15:49] something like say for example 15,000 lbs then we'd have to do a load rating [15:54] and probably steel more steel more concrete to take the load. I doubt if [15:58] that's something we want to consider because really it's this is a pedestrian [16:02] there's and we've never had equipment on it before six foot. When we do clear [16:07] snow on it uh we use actually a little paddle blower and that's what we use on [16:11] it to get it and that's been working just fine [16:15] I believe. So, [clears throat] [16:19] » we're going to use pressuret treated lumber though. [16:22] » Yes, sir. That was what we bid on. >> They thought of using composite. So, [16:28] » I can ask them to alternate it, sir. >> What's that? [16:31] » I can ask them to alternate that. Yes, >> it it'd be nice, I guess, to know what [16:35] the difference would be. Just comp I mean, you're one and you're done kind [16:39] of. [16:42] Did anybody consider a helical pure anchor for [clears throat] the support? [16:47] » Um, I didn't ask them actually of what kind of they would anchor in. They're [16:51] they're just going to drive it down. So, I didn't give that kind of detailed [16:54] other than the the proposal. I put the RFP was generic. I wanted it actually [16:58] them to come in and propose to me. So, >> might be an interesting option. [17:04] » Yep. [17:08] Well, the bridge def definitely gets a lot of use now with the [17:12] » the trail through the school like school. [17:15] » I mean, it's probably increased 90%. >> And with the heaving that's on there, [17:21] » I mean, it's definitely something that needs to be done. [17:24] » Yes. >> With the heaving on, if you're walking [17:26] around a bike, it's hard to avoid people. [17:29] » Yeah. [clears throat] this last year. Well, right when I was putting the [17:32] budget together, you could really tell when um 20 2024 when it started to eve. [17:38] So, [17:45] going back to the heel helical, I I would have to ask them, but it might be [17:49] a larger expense. I think they're planning on just driving. They told me [17:53] they were just going to drive until it stops. That was what they were saying. [17:57] You know, you know what you got though when you got when you get there too. [18:00] » Yeah. >> You get a different result. [18:09] » The council's pleasure. [18:16] How far out do you think it put it to to um [18:22] see what the up cost is going to be for composite bill? Um, how far it would [18:27] take or >> how long do you think it would take? I [18:29] mean, it shouldn't take him, but probably a phone call. [18:31] » Yeah, it wouldn't take more than a phone call, I would say, actually. Yeah. [18:36] » Yeah. Wouldn't take more than a phone call. [18:38] » Everything's already specked out and all they got to do is just [18:41] » Well, they gave me a lump lump sum bid. That's what I asked for. [18:44] » So, I asked for just to repair what was in place there. [18:50] » So, just too late to ask that Miller company to look at it. I mean, how Uh, [18:55] how much longer is this bridge going to last? I mean, I was across it the other [19:00] day. It needs work, but it's >> Well, I I I don't know if it's going to [19:04] get worse. I I have no idea. I mean, it could actually could get worse. [19:10] » I mean, right now it don't meet I mean I mean it it does it slopewise, cross [19:14] slopewise actually on the bridge. It it's beyond actually [19:18] » it's okay for the kids to go to school and everything walking there. I mean, we [19:23] could ask them, but actually right now it's a public meeting. We already kind [19:26] of divulge what the price would be. So, if I was a contractor, I just look on [19:30] the agenda and go, >> "Yep, [19:32] » I'll give you 44,400." >> It's been advertised a couple different [19:37] times. I mean, it's >> Yeah, it's just that they're going to be [19:41] in town and they might just uh they're in that business. So, I mean, [19:49] doesn't hurt to ask this. I don't know. This other company didn't know when they [19:53] were going to get to it. Is that correct? [19:55] » No. No. I I I just stated, sir, they'd be able to have it done actually by [19:58] October 31st. >> By when? [20:00] » October 31st. Halloween. >> October 31st. [20:03] » They said they would kick it out in two weeks. [20:06] » Yeah. I really don't think we want to lose this construction season. [20:10] » No. >> No. [20:11] » And we don't want to put some out for bid that a bid has already been [20:13] disclosed. I mean, that's that's improper bidding period. So, [20:21] all right. Entertain a motion to approve Tucker Marine Construction, which was [20:24] the loan bid for the lump sum of 44,500. I would like to add a contingency [20:32] to approve it up to 50,000 what we originally budgeted if they could do it [20:37] with composite. >> Yes, sir. [20:41] [clears throat] [20:44] » I'll make that motion. Motion by Braybrook. [20:48] » I'll support >> support by Peebles. Any other [20:51] discussion? >> I think it's a good idea to check [20:56] composite as well. >> I I like your idea, Bill, but you know, [21:00] with the fact that this has all been disclosed online already. I mean, it's [21:03] it's improper bidding at that point. So, all right. Any other discussion? [21:11] » All right. All in favor? >> I. [21:14] » Those opposed? Nay. >> Motion passes 61. [21:19] All right. At this time, we have an executive session. Um, council will [21:23] reconvene afterwards and we will Oh, we need a motion to go [21:29] into it. >> Oh, motion to enter executive session. I [21:33] haven't done one of these in so many years that [21:36] » Yep. So, we need a we need a motion and a second as depicted on the agenda and [21:40] it's a roll call. >> Make that motion. Motion by Cummings. [21:46] » A second. >> Support by Braybrook. All in favor? No. [21:49] Roll call. Roll call. Sorry. >> I couldn't tell you how many years the [21:53] village hasn't gone into an executive session. Bill, [21:57] » yes. >> Christina, [21:58] » yes. >> Dave, [21:59] » yes. >> Randa, [22:00] » yes. >> Tom, [22:01] » yes. Robert, >> yes. [22:03] » Yourself? Yes. >> Okay. And for the benefit of the public, [22:07] you can stay in this room. We're going to use the conference room and we will [22:09] come back. [22:25] We can't take notes. [24:41] one. >> But yeah, I'll I'll make that part of my [24:46] knowledge. [24:55] [laughter] >> Yeah, we did. too. So I can sing it. [25:13] » It's just an excuse. I know. I really [25:18] » I'm getting old. >> Everybody's gonna go out there and screw [25:21] this. [25:26] Wait [25:35] for it. I'm going to wait for it. Don't worry. [25:50] Maybe they can throw me some. [25:58] All right, small meeting back to order at 8:17. [26:08] This time I entertain a motion to approve what was discussed in executive [26:12] session. >> We'll make that motion. [26:14] » Motion by Brave Brook. >> Support. [26:17] » Support by Peeles. All in favor? [26:21] » I. >> Those opposed? I [26:24] » should passes by two. [26:28] Moving on. Village manager report. >> Uh nothing too much further to add. Just [26:33] uh reminding the council that uh we have the bids out for the Rogers Park [26:38] bathroom and those will be considered at the September meeting. So, we're pretty [26:42] excited about that, too. There's been uh quite a bit of interest uh in that [26:46] project. Um and yeah, happy that the the bridge project came together. I know [26:51] that was a a lot involved with that. So, happy to see that moving on and you [26:56] know, happy to take any questions uh on anything else. Anybody have any [27:00] questions for the village manager? >> Yeah. Are you going ahead with those uh [27:06] vouchers? >> Yep. Yep. Vouchers are going to go out [27:09] for uh they'll be good for the month of October. Uh last year we did them for [27:13] two weeks. This year we're going to do the whole the whole month of October. [27:16] So, that'll be put out. >> Why are we doing that? [27:19] » What's that? Well, I mean, the township does it in April, [27:23] » right? Last year, we did ours in the fall and we're kind of continuing. [27:27] » I mean, why don't we do uh why do we have to do it if the township has one? [27:31] » Well, I guess we don't necessarily have to if you guys would like not want to. [27:36] Um I was under the impression the board wanted to continue the voucher program. [27:42] » I don't I don't know that we need to. I mean, you said there wasn't very highly [27:47] utilized last year. No, it was I mean it was a decent amount of utilization. I [27:50] mean, we've already got the V. I mean, if you guys don't want to do it, that's [27:53] fine. >> Let's try it again to see what happens. [27:56] » It was in the budget and everything. I >> The cost of the village is only if [28:00] somebody uses it, >> right? So, let's try it. Let's [28:02] » not like you're out anything, right? >> It's a convenience.
