[12:57] Was that we need as much public participation as possible. [13:01] So that we can make the most informed decisions and capture the most perspectives that's necessary for informed decision making to [13:04] happen. [13:09] I am excited. [13:12] To let you guys know. [13:15] Well over the last 48 hours or so since our Tuesday evening meeting. [13:21] I want you guys to know. [13:22] I haven't slept. We have worked literally around the clock to build consensus as a council. [13:28] I want to give a special thank you to Ezra Nair for working with me over the course of the last couple days. [13:34] To get. [13:35] Immediate solution in place to help you right off the bat and I want to present that to you real quick. [13:42] We have. [13:45] A resolution that we. [13:54] And in short, the resolution is the Council directing the immediate towing. [13:59] Of vehicles that are parked illegally. [14:02] So if you're parked within 30 feet of a stop sign, if you're parked on a red curb or you're parked in front of a. [14:07] Fire hydrant. [14:08] You will get an immediate tow order. [14:11] The intent behind that is to create an immediate solution that bolsters the safety in your neighborhoods. [14:19] I hear your. [14:20] Concerns and complaints loud and clear when you come and you tell us about the low visibility and I drive those streets and I see [14:23] what you guys are experiencing and I'm. [14:27] I want that to be fixed because I want our kids to be safe. [14:32] So on Tuesday. [14:33] I expect that that will. [14:35] Passed as a consent item with flying colors and that will immediately go into effect and I think that that will solve. [14:41] A lot of the low hanging fruit when it comes to safety. [14:45] I know that this is really a root cause. [14:48] Stemming from. [14:51] Over occupancy. [14:53] We are still planning to move forward with Operation Neighborhood Shield and developing the city's code enforcement protocol to [14:57] actually help get that in check. [15:02] Long term, but this is something we can do immediately. [15:04] To make the streets safer. [15:07] I did also want to comment. [15:09] On some of the emotion in the conversations that I've observed and participated in in the last. [15:14] 48 hours. [15:16] And I want to make sure that. [15:18] You guys understand? [15:20] That we're trying to. [15:22] Not make decisions in a vacuum. [15:24] And that no one on this Council. [15:28] Is here to be your enemy or prevent. [15:31] Representing you. [15:33] I recognize that there are some heated opinions when it comes to. [15:38] Those perceptions. [15:40] And there's a large group of people that support. [15:43] Increased parking. [15:46] I don't know what the. [15:47] Parking policy. [15:48] And those parking passes? [15:50] That actively campaigned against many of us up here now. [15:54] And are frustrated at our involvement and so I want to comment on this that I. [15:59] 100% recognized. [16:01] You guys have been. [16:02] Working with Ezra not just over the last two months when it came to. [16:07] Parking policy. [16:09] But many of you were. [16:11] With him during the campaign. [16:13] And you support him, and you trust him, and you know him. [16:16] And I want you to know that this was not. [16:17] There was number intentional slight to him or to you. [16:21] When we appointed Jacob Wood to be over this. [16:25] The reason that we appointed that and I hope that you guys can. [16:28] Maybe look at this understand. [16:30] Was that Jacob was already very involved. [16:32] With trying to figure out parking and towing situations when it came to the lakefront neighborhood and those HOA's. [16:39] He was already very well versed with the contracts that were in place. [16:42] And so it seems. [16:44] To us as a natural extension. [16:46] To put him in charge of that process. [16:49] And at the time we were not aware, at least I wasn't, I don't think consciously aware that you guys had. [16:55] Your group that was already meeting with Ezra and that had a consensus there. [16:59] That wasn't information that I was. [17:01] Privy to I don't believe. [17:02] So. [17:04] I want to get to know we are not trying to work against you. [17:07] We genuinely want to make the streets safer. We want to help you out with this. [17:12] Some concerns that I want to bring up that I hope as you guys. [17:17] Share in your public comments and that as you break off into your. [17:21] Neighborhood sessions in a few minutes. [17:25] I would like you to consider these things. [17:29] I ran on. [17:32] Also tackling the taxes and balancing the city budget, making sure that we were operating from a fiscally responsible. [17:38] Position. [17:49] Is that over the course of the next three years we have an 8 figure deficit when it comes to our transportation budget? [17:55] To be very blunt, the city does not have a lot of excess funds to create programs. [18:02] I would like you to consider. [18:04] Your willingness to. [18:07] Adopt A fee that would support your parking passes if you choose to proceed with that. [18:14] 2nd. [18:16] Representation and real consensus and. [18:19] My concern here. [18:20] Is that? [18:22] We as a Council. [18:24] While we want to help you and we want to make the streets safer. [18:27] We have an obligation to protect the rights of. [18:30] Even minority groups. [18:32] And people that you may not agree with. [18:35] That kind of. [18:36] Builds into my. [18:38] Next thought if I were to tell you that I think taxation is theft. [18:42] Most of you would say, but who would pay for the roads? [18:45] And the conversation that we're having. [18:48] Just to be very blunt. [18:49] Is we're talking about limiting access? [18:52] To something that these people's tax dollars are paying for. [18:56] And I think that that needs to be very heavily scrutinized. [19:00] So I would like to share this thought as I. [19:03] Spoke. [19:05] For many hours with our city's legal advisor over the course of the last two days. [19:11] Something that he shared with me is a best practice in all governance. Is that a? [19:16] Council does not. [19:17] Act unless it has sufficient reason to do so. [19:22] So I want to ask you all to please continue to engage your neighbors. [19:26] And build as much community involvement in consensus in this as you can. [19:30] Make it undeniable for us to help you. [19:36] I think it's all my good point about it. That's good. [20:13] Went down that road. [20:14] And repealed it and didn't want it. [20:17] And so when that and you'll hear from them tonight about that and there are many different options. [20:24] In towing and you're going to be learning about those about and and all of your neighborhoods are very different. [20:31] But as as the code currently states, it states that there is. [20:36] By required by city code. [20:38] There needs to be a vote of the citizens of the neighborhood and it currently says it's 75% that a survey would go out. [20:46] So it's because that code is a little bit different and outdated. [20:50] We need to talk to the council as to what's going to happen so tonight. [20:54] After we're done educating you on. [20:56] A lot of various options. You guys are going to be broken up into four groups. [21:00] The code also states that a group of citizens. [21:03] Could put together that plan. Well, there isn't a plan yet in the four of your neighborhoods, so you guys need to put together a [21:06] plan. [21:10] In order to do that. [21:12] We need to have a leader of that. [21:13] Plan right And so. [21:16] So tonight you guys are going to be selecting a leader. [21:19] But also going through and we want you to know the different options so when you talk to that leader. [21:23] You're going through and saying. [21:25] Well, what, what options are you planning on if you're going to be my leader? [21:29] Even at the end of today, that leader isn't going to just be saying, hey, I'm the leader and we're doing this and we leave today [21:32] on the planet. [21:36] Because it has to come back to. [21:38] The code. [21:39] Between here. [21:41] And next Tuesday, because we have to follow sunshine laws and transparency laws. [21:46] We will be working with David Kyle. [21:48] And our legal counsel to make sure that we have a fair and equitable due process of how to vote. [21:55] Should we see? [21:56] Stay at the survey like we're handing out a QR code. [21:59] It says the residents. [22:01] What does that mean? Is that one per household? [22:04] Does that mean we're giving out QR codes? Does that mean they can come to the office and vote? [22:08] It's not a great code that's written through that. [22:11] So because this is spraying on us and we were challenged on a Tuesday to meet on a Thursday. [22:25] Your leaders after learning everything. [22:29] Might need more than two or three days to put together your plan. [22:48] But make sure you know as a group. [22:51] Does that mean that as you go and grow that consensus that you would be able to go and get that? [22:56] That percentage to vote to do. [22:59] To actually implement your plan. Does that make sense? [23:02] OK. And I also and so tonight, so that's the process a Tuesday we would vote on how we would collect that neighborhood vote. [24:30] So you're gonna have to decide the permit type. [24:33] So there's two different permit types. You have a digital. [24:35] Parking permit. [24:36] Usually that's linked to your license plate. [24:38] I mean it's managed online or by app. [24:40] Or you have a physical parking permit. [24:42] And that's physically displayed on your car. [24:45] And then usually they have a unique. [24:47] Barcode attached to that permit. [24:49] So you need to decide you want a physical parking permit or do you want a digital? [24:52] Parking permit. [24:56] When it comes to enforcement options, there's many options. So this company does ticketing. [25:01] Basically, uh. [25:03] Instead of towing or booting, just taking your car, you have to pay between 75 to $100. [25:07] And we have booting. [25:09] I'm Utah State, Max rebooting is $75. [25:11] The oranges have towing. [25:13] And use that ranges between 300 to $400. [25:16] So you can choose ticketing, you can choose booting, you can choose towing, or you can choose a combination of both. [25:21] Booting and towing. [25:22] Or you can choose a progressive style of enforcement. [25:25] First offensive ticketing, second offense is booting, and the third offensive towing. [25:29] So there's a company that offers that. [25:32] Version of enforcement as well. [25:40] So other things you guys need to decide is the enforcement style. [25:43] So there's two different types of enforcement. There's on call. Basically a person would call to a. [25:48] The toe on a car that's violating the parking permit rules. [25:52] Or there's patrol enforcement. You need a tow truck with patrol. [25:55] The road. And they would. [25:56] Total card. [25:58] On their own. [26:00] So you need to decide anymore on card you want patrol. [26:07] So. [26:08] Let's let's. [26:10] When we get through this, I was gonna ask the same thing. What's the cost is the cost is the. [26:14] So that can be decided via contract. I don't have a specific cost, I know that. [26:19] Couple neighborhoods that have a parking permit. [26:21] And might cause to speak to this letter. [26:34] So you have smarter company offers smart booting basically. [26:37] It's self release, you pay for it and then you can. [26:40] Detach it and then you have to go and drop it off. [26:43] Yourself. [26:44] And then you have standard building basically towing company would come. [26:47] The Buddha, and then you have to call them to come. [26:50] Take it off if that makes sense. [26:53] And then you have visitor parking as well. [26:55] Would you want to allow overnight visitor parking passes for a neighborhood? [26:58] Or not. [27:01] And then household permits so. [27:04] Would you guys want? [27:06] How many permits do you want per? [27:08] House you want one on street parking spot 2? Or do you want it to be tied to the number of drivers in that house? [27:14] What are the costs, Jacob, for the permits? Are they? [27:18] $20 a permit or what do they cost? That's the thing. So the president vary based off of what what you get so. [27:25] Depending on some of the options and. [27:28] We would strongly recommend that the neighborhood captains. [27:31] Do their research of which style. [27:34] And then research the price. [27:36] And as a council, this is one thing that we said was. [27:39] Should we demand that they know the price during the vote? [27:43] Or like on Tuesday when they put forth the plan that they. [27:48] That it sets the citizens know the price in the vote or is that these are the options we're doing? [27:53] And then after they vote, they find out what the permit fee is. [27:56] And I felt that as a transparency policy that. [28:00] Whatever option they choose. [28:02] And the leaders go through, they investigate that between here and Tuesday. [28:06] And we can help them do the best research they can so citizens know when they're voting. [28:11] The annual cost is $75 annually or. [28:14] We can you guys can talk about. [28:16] Something. [29:44] Where it would be reported. [29:46] And it would go to a. [29:48] Code Enforcement officer. [29:50] Meaning somebody from the city. [29:52] And they would look at it and say does this. [29:55] Reach the level of. [29:58] Of code. [29:59] And at which when that decision is made. [30:02] Then it would dispatch a. [30:04] A tow truck company. So it's really important you understand that because if your neighborhood chooses and this happened in two [30:08] instances. [30:12] Where they chose the just drive by. [30:15] And we are going to be removing the city on when they do the patrolling. [30:19] They remove us from. [30:21] The process, the code enforcement. Now there is an appeal thing. [30:25] After the fact. [30:26] But we are not the first adjudicating person that goes through that process. And so it's really important that you understand that [30:32] because people will call in and they're like, I don't, I didn't agree with the toe. I was only a couple feet off. [30:38] And we are giving that. [30:39] Sovereignty to that private company to do that in those two separate scenarios, OK, basically if you choose that, people need to [30:43] understand that option. [30:48] OK. The next one is duration. How long do you want this parking from in your neighborhood? Do you want it to be? [30:53] A temporary six months. [30:55] One year or do you want it to be until? [31:09] An individual who lives in a area of parking permit. [31:12] To better explain. [31:13] What it's like doing parking enforcement. [31:15] What worked? What didn't work? [31:29] We moved to Vineyard in June of 2019, so we've been here almost seven years. [31:34] We the majority of the time we've been here, we've had a multi generational household. My mom had lived with us. [31:41] For nine years before she passed away. [31:44] My son, daughter-in-law and their. [31:46] Almost 2 year old child lives with us as well we have. [31:49] Five vehicles. [31:50] Because we've had five drivers. [31:53] When Providence, I live in the Providence neighborhood. [31:57] When Providence instituted parking permits. [32:00] We were not given these choices. [32:02] So this is amazing and. [32:04] You should be grateful they're asking for your. [32:07] Opinion. [32:10] We were given one choice and that was to have one parking permit for the street. [32:15] Per households. [32:17] At a fee. I think at the time it was $30. [32:20] A year. [32:21] And it was a physical permit. [32:25] And like I say, we had five cars. [32:27] And five drivers. [32:29] And so that was not a good solution for us at all. [32:34] I felt like we were disproportionately impacted by the parking issues. The parking issues in my neighborhood are caused by a lack [32:38] of parking in the locks. [32:43] Probably due to over occupancy. [32:48] So when we were given these choices, I felt like we were disproportionately impacted due to the location of our home, because we [32:52] are. [32:56] Right inside our neighborhood, directly across the street from the locks. [33:00] However, because we are only given one choice. [33:04] And I felt like it was not the right choice. [36:38] The communication wasn't very well. It didn't go very well with UPA, so a lot of things we didn't want them to do or did want them [36:41] to do. [36:44] They just weren't, we weren't on the same page and so we decided to switch two different company, but. [36:50] What has helped us is switching to Lone Star. [36:54] They've been very communicative with us. [36:57] We have some very specific situations where we're like, hey, please don't tell me these situations. [37:02] With UPA we had. [37:04] Probably. [37:04] Two or three times a month. [37:06] Where someone was complaining to us they got towed when they left their car somewhere for like 1 minute. [37:11] Right, they were just constantly patrolling. [37:14] It's yeah, it's been like 8 months now and we've we've had one complaint. So it's been a significant difference. [37:22] The other thing with EPA was that, you know, we would ask them not to do something and then. [37:27] It was like 2 weeks later. [37:28] That after we had sent the e-mail. [37:30] I see a guy like patrolling, we'd ask them specifically not to patrol during that time, so. [37:34] I think that there's definitely some difference in. [37:37] Communication ability and quality control of that and. [37:41] And and. [37:43] The other thing is Edgewater's. [37:44] I think we also deal a lot with this over occupancy problem. [37:48] And and I hope that the solution that people are thinking of isn't. [37:52] Oh, if we like start towing all these people with these extra cars. [37:56] That will fix the overpopulation right? Or the over occupancy? [38:00] That's not a good way to do it. Most of these people getting towed are college students, right? Like they don't have. [38:05] So we just barely saw a receipt, $438. [38:09] To get there for a 20 minute, that right, it went to the tow yard, it was in there for 20 minutes and then they took it out. [38:15] $438. [38:16] That's that's pretty crazy for a college student, so. [38:20] I hope that that's. [38:21] You know not. [38:22] The strategy. [38:24] For some of these places, but. [38:52] These I guess. [38:54] Signs around the community where it's a visitor spot or maybe event parking. [38:58] And there's a barcode on there and you can just scan the barcode allows you. [39:01] To go to a portal and then there you can actually get a. [39:04] Digital parking pass where you can put the make and model of your car. How long you need to pass for. [39:08] And then lastly the actual. [39:10] License plate. [39:11] And we've seen that it's. [39:13] That with UPA is pretty difficult. [39:15] With loan, so it's been pretty easy to set up and do it. [39:18] The one thing we've seen on the Lone Star side though is it can get abused and so they do have parameters in place to where you [39:21] can. [39:25] Lock it up so it can be a certain amount. [39:27] But it from what we've seen, our experience with Lone Star has been. [39:31] A lot more like. [39:31] Chris has said communicative, for instance. I mean, I'm here to state facts, not feelings or anything like that, so. [39:37] Initially when I. [39:38] Became a part of the board. [39:40] My first thought was how do we help the members of the community? [39:44] Understand where to go, where to park without having to spend 3, four, $500. [39:49] We brought this up with UPA. [39:52] And what they said to what we asked, hey, do you guys boot? And they said no, they clearly said no. [39:57] And so we look for different solutions. We found a company that was willing to boot while UPA towed. And then they said, oh, [40:00] actually we do boot. [40:04] And then from there. [40:05] They tried to. We asked them for some kind of a deal for our community. [40:09] And they said, OK, well. [40:10] Pitch something out. They told us the original pricing was. They came back and still gave us the original pricing. [40:15] And so after a few things that just. [40:18] Seen inherently dishonest, we decided to move to a different. [40:21] Partner and Lone Star has been phenomenal. They do exactly what we need. They partner with us. [40:25] And for them, it's more about the relationship than it is about. [40:30] Earning a buck. [40:30] I mean, obviously revenue matters. [40:32] But they care about the relationship with our community. [40:35] And it's made it so that. [40:36] I mean I. [40:37] There are people that complain about parking enforcement. That's always going to be the case, but at the end of the day, they care [40:40] about making sure that we have what we need. [41:44] Whatever anyone called it seemed to be fine, but when people were trying to do it on their own? [41:48] They were getting so upset and so. [41:50] There's obviously some benefits, pros and cons to doing physical versus digital permits. [41:55] But. [41:56] You know, the physical ones can be abused. People can start, you know, trying to create copies and whatever, but the digital ones [42:00] also. [42:03] It's important to remember every time a towing company is asking you for. [43:32] And so, speaking for my HOA, we were able to absorb the cost. [43:36] Of producing the placard and distributing them to the. [43:39] To the community without any additional cost to them. [43:43] The downside that we have come to realize? [43:47] Over the last. [43:49] Over the course of the last four years. [43:51] Is the reality of. [43:53] Forged permits. [43:56] You can go on any website and order. [44:00] A dozen or more. [44:01] Of these placards for about $1.50 per. [44:06] Per cart in in essence. [44:08] And so. [44:09] We know for a fact not only that they're easy to reproduce and duplicate. [44:14] But we have had landlords. [44:17] In our community who have contacted. [44:20] Our management company and turned in. [44:23] Dozens. [44:24] Of duplicated permits. [44:26] From. [44:28] That were given to them by by previous renters, so the duplication is a concern. [44:35] And and it has created some headaches in our community. [44:38] We. [44:39] At the beginning of the year, just. [44:40] One final note. [44:42] We decided to move to a digital permit. [44:45] It was administered by UPA. [44:48] That permit was. [44:51] Very different from our from our. [44:53] Our physical parking permit where we. [44:56] We mandated a boot. [44:59] A warning? [47:48] And just excessive reports of vehicles, illegal street parking. [47:55] Of course, blocked emergency vehicles strain on neighborhood structure and. [47:59] Reduced quality of life. [48:00] Especially safety for kids. [48:03] And so the mayor and staff have been working on a. [48:07] Program called Operation Neighborhood Shield. [48:11] What it starts? [48:13] What what we're doing is we're reviewing. [48:15] All of. [48:16] Vineyard City Code with our city Attorney and with Deputy Holden. [48:21] To determine updates and clarifications. [48:24] Regarding maximum residential occupancy limits. [48:28] Illegal rental. [48:29] Definitions. Uh. [48:31] Parking enforcement authority and evidence. [48:34] Requirements for code enforcement One of the. [48:38] Issues that we have with enforcement is we don't have evidence we need to have. [48:42] 2 forms of evidence to do any kind of action in regards to over occupancy. [48:50] OK, we're almost there. [48:52] OK. [48:56] We have it on half the screens. [48:58] Just not on the main screen. So I think we're good to move forward. [49:01] OK, so. [49:04] We are currently in the process of making recommendations to city code. [49:11] That is we actually that's what phase one is our ordinance review which started March 16th and we'll end it. [49:18] On March 31st we're. [49:21] Trying to fast track this program. [49:23] Because of the. [49:25] Seriousness of the safety issues and neighborhoods, I'm just looking to jump to those. [49:30] Yeah, go ahead. [49:34] OK. All right. [49:35] OK, so we are. [49:38] We're looking at an awareness campaign with Phase 2. [49:44] Starting in late March, so. [49:46] Pretty much next week going into April. [49:49] We are going to be distributing door hangers and information Flyers. [49:53] We're going to be increasing patrols. [49:58] An increasing visibility and citations for illegal parking. [50:02] Public messaging will. [50:05] Be placed on all the door hangers and the informational Flyers and on Facebook and through e-mail informing residents that [50:09] enforcement will. [50:14] Will escalate beginning on May 1st. [50:19] Residents will also be encouraged to to report concerns through the city's See Something, Say Something reporting initiative that [50:23] will be part of that. [50:29] In the past, we have not been. The city has not been very direct. We are. [50:33] Going to be encouraging residents to be very direct. [50:37] If we're going to be asking, being very direct in our ask, you see something, you see over occupancy, you see illegal parking, [50:42] take a picture, report it to staff and we are going to be following up. [50:48] And we're actually. [50:49] Employing new. [50:51] Employees to make this happen. [50:54] So, and that's where. [50:57] Phase 3 is investigation and evidence collection will happen all throughout the month of April. [51:03] That's during the notice period. [51:05] The city will aggressively pursue documenting potential violations and will continue to. [51:11] Pursue enforcement action. [51:13] And staff. [51:15] Will be gathering evidence such as public rental listings, online rental advertisements, listing. [51:22] Offering rooms for rent. Neighbor complaints. Verified complaints submits to the city. [51:27] Property visits by officers and recorded statements. [51:32] Additional supporting evidence may include parking violations, code enforcement observations. [51:38] This phase will allow property owners an opportunity to help, correct. [51:42] Violations voluntarily and for students to find other housing options prior to enforcement. One of the reasons why we're moving so [51:48] quickly is because we know that graduation is going to be occurring. [51:55] At the end of this month. [51:57] We want to make sure that. [51:58] Students don't sign their contracts for the summer or for another year. [52:03] So we're giving kind of a heads up. We're going to be enforcing parking. [52:07] We're going to be enforcing over occupancy. [52:11] You know, and we're also working with Utah City. [52:15] To find them other places within Vineyard to live. [52:18] So thank you. With that, we've got phase four and that's when enforcement will begin on May 1st. [52:25] And of course, enforcement, administrative citations, parking citations, code enforcement actions. [52:31] And as mentioned before. [52:33] We are going to be increasing our enforcement staffing here at the city. If you go to the cities website, you'll see that we have [52:38] listings for a full time and two-part time. [52:44] Enforcement officers, if you know anybody that would like to submit their resume, we would be happy to consider them for [52:48] employment.
