[4:59] As first lady of the united [5:00] states she knew three had a [5:02] platform to impact the world and [5:04] she grabbed ahold of that [5:06] powerful platform and changed [5:09] countless lives in the process. [5:11] She traveled the world to some [5:13] of the most December late corn [5:15] hes December [5:20] he -- desolate corners [5:22] championing human rights. [5:25] She spoke out against racial [5:26] segregation. [5:27] Mrs. Bush is truly a trail [5:29] blazer for women. [5:32] As an outspoken champion for the [5:34] rights of all americans, barbara [5:35] bush spoke out even when [5:37] national discussions tried to [5:38] keep her quiet. [5:39] She was a constant pillar for [5:42] her husband's side during his [5:44] run for vice President And [5:45] President, becoming the first [5:47] wife of a candidate to speak out [5:50] in support of their husband at a [5:52] national nominating convention. [5:54] She also made regular radio [5:57] appearances on a program called [5:59] Mrs. Bush's story time which [6:01] championed the benefits of [6:03] parents reading aloud to their [6:04] children. [7:40] The term pandit is a sign of [7:43] respect much like rabbi would be [7:44] be. [7:45] The hindu faith was very [7:47] important to him growing up in [7:49] india as he was from a family of [7:49] priests. [7:52] Prior to coming to the community [7:54] he served in been [7:58] india and in [7:58] new york. [8:01] He holds a graduate degree in [8:02] commerce and speaks six [8:05] languages. [8:09] He is actively involved in the [8:10] interfaith organization. [8:12] He has been a guest speaker for [8:14] the county schools and stratford [8:17] university. [8:19] Approximately 80,000 virginians [8:22] identify as hindu and there are [8:24] over 1 billion hindus worldwide. [8:25] Roughly is a percent of the [8:26] population. [9:40] These gentlemen won the virginia [9:41] high school league class 3-a [9:44] state championship on March 16 [9:45] journal. [9:47] And Mr. Speaker, I have enjoyed [9:48] working with Chairman Landes on [9:51] the education committee, but [9:54] their aggressive style of play [9:56] overwhelmed the western [9:57] albermarle high school warriors [10:01] taking a 20 point halftime lead [10:05] which the warriors were unable [10:08] to overcome, leading them, the [10:16] justices to a final score of [10:17] 63-42. [10:19] They took it easy on them in the [10:19] second half. [10:21] They finished first in the [10:24] richmond times dispatch [10:24] 2017-2018 westbound [10:27] 2018 basketball ratings. [10:28] Head coach white received region [10:29] and state coach of the year [10:31] honors and sophomore isaiah todd [10:39] was named region player of the [10:39] year. [10:41] The successful season is a [10:43] testament to the skills and hard [10:45] work of all of these young men, [10:48] student athletes, the leadership [10:49] and guidance of the coaches and [10:51] staff and support of the entire [10:52] john marshall high school [10:53] community which is the pride of [10:54] north side. [10:57] We look forward to many [10:58] victorious seasons to come and [11:00] look forward to also these young [11:01] people making a significant [11:04] impact in our community and our [11:06] commonwealth and our country. [11:08] Please join me in giving the [11:11] pride of north side john [11:14] marshall justice's boys [11:16] basketball team a warm house [11:16] welcome. [11:23] [Applause] [11:30] >> the house would certainly [11:34] like to welcome the john [11:36] marshall boys basketball state [11:37] championship team. [11:38] Probably not a more difficult [11:39] sport to win a state [11:42] championship in. [11:45] Congratulations, great job. [11:52] >> the delegate from prince [11:54] williams, delegate avala. [11:56] >> I rise for purpose of [11:56] introduction. [11:57] >> the delegate has the floor. [11:58] >> yes, thank you. [12:01] today we have in the gallery the [12:03] 2018 stem contest award [12:04] recipients. [12:06] If they are in the gallery with [12:08] us now, we would ask that they [12:10] please rise. [12:12] Thank you. [12:14] In 2012, the council on women [12:18] launched the annual stem essay [12:18] contest. [12:21] The intention was to award [12:22] $5,000 scholarships provided [12:25] through the funding efforts of [12:27] the counsel to high school [12:29] junior and senior planning who [12:32] are planning to pursue a stem [12:34] career at an institution of [12:36] higher education. [12:38] Today, the contest continues and [12:41] the council has awarded more [12:43] than $150,000 in scholarships to [12:45] virginia students. [12:50] About the contestityself, each [12:53] student is a high school junior [12:53] or senior. [12:56] You will find the schools and [12:58] hometowns listed on the [13:00] governor's website. [13:02] On behalf of the former members [13:04] of the council of women, [13:06] delegate aird and price and [13:09] myself I wish to congratulate [13:11] each of these young people for [13:14] not only their accomplishments [13:16] but being awarded these [13:17] scholarships. [14:05] We have more food than ever [14:06] before. [14:07] Another goal to beat this year. [14:10] It was 229 pounds of food. [14:12] Not including a few umbrellas. [14:16] So, please give your 70s a [14:19] warm welcome and warm applause. [14:20] Thanks, everybody. [14:27] [Applause] [14:29] >> the delegate from [14:33] westmoreland county, delegate [14:33] ransone. [14:35] >> I rise for announcement. [14:36] >> the delegate has the floor. [14:38] >> Mr. Speaker, from April 21 to [14:39] April 28, virginia will be [14:40] celebrating [14:42] celebrating historic garden week [14:45] organized by the garden club of [14:46] virginia. [14:48] When colonists came from britain [14:49] they brought with them their [14:51] love of gardening. [14:53] This has been preserved [14:55] alongside the rest of virginia's [14:57] storied history. [14:59] The beautiful gardens of over [15:03] 250 of the most historic homes [15:07] will be available for public [15:07] tours. [15:09] This provides educational grants [15:12] to students studying landscape, [15:14] architecture and conservation. [15:15] It also provides grants to our [15:16] state parks. [15:20] None of this would be possible [15:21] without historic garden week [15:25] which is estimated to have a [15:25] added $42.5 million to [15:27] virginia's economy over the last [15:28] 45 years. [15:31] I will let the body know I'm a [15:32] little bit biased. [15:33] this year in the northern net [15:35] the garden club in my district [15:37] is going to be to [15:39] focused on [15:40] historic homes in warsaw all [15:44] from the 18th century including [15:46] saban hall built by landon [15:48] carter the fourth son of king [15:48] carter. [15:50] Grove mount constructed by [15:52] robert mitchell. [15:55] Menoken, the restored [15:57] restored ruins of [15:59] the residence of francis [16:01] lightfee plea. [16:44] Visit www.Virginiagardenweek.Org [16:45] for more information. [16:47] >> I rise for announcement. [16:48] >> the delegate has the floor. [16:49] >> Mr. Speaker and ladies and [16:49] gentlemen of the house I rise [16:51] today to recognize April as the [16:55] month of the military child. [16:57] Prince william and fauquier [16:58] counties are the home to many [17:00] active duty and retired members [17:02] of the armed forces and I would [17:04] like to take this opportunity to [17:05] thank them for their service to [17:09] this country and also to thank [17:12] their families who like wise [17:13] make sacrifices at home. [17:16] A time to applaud military [17:17] families and their children for [17:20] the daily sacrifices three make [17:22] and challenges they overcome. [17:24] Nearly 80% of military children [17:26] attend public schools throughout [17:29] the united states and an average [17:30] military family moves three [17:32] times more often than their [17:34] civilian counterparts. [17:35] Their ability to adapt to [17:39] present and future changes, [17:41] deserve our respect and [17:43] admiration and I believe it is [17:45] vital that we stress the [17:47] importance of providing children [17:48] with quality services and [17:50] support to help them succeed in [17:53] the mobile military lifestyle. [17:56] As legislators we must ensure we [17:58] give military families just as [17:59] much support as we give those [18:01] who actively work in defense of [18:03] our country. [18:06] And please remember, if you wear [18:08] purple in April you are [18:09] celebrating the military child. [18:11] Thank you, Mr. Speaker. [18:18] [Applause] [18:21] >> the journal shall reflect the [18:22] following members' wear [18:24] members away on [18:25] pressing personal business and [18:28] are granted leave. [18:29] Delegate thorn. [18:31] The clerk shall announce the [18:32] next order of business. [18:35] >> the second hour is not [18:37] applicable to today's calendar. [18:38] >> the third. [18:39] >> lidge salt lake [18:43] legislation to go by for the [18:43] day. [18:45] I'm aware of no such requests. [18:46] >> the next order of business. [18:49] >> the fourth and final portion [18:51] reserved for recognition by the [18:55] speaker of members for points of [18:58] personal privilege. [19:04] [Applause] [19:06] >> does any member have any [19:06] further announcements, [19:07] introductions or motions? [19:10] the purpose of the reconvened [19:11] session is to consider [19:14] governor's vetoes and [19:16] recommendations to bills passed [19:18] during the 2018 regular session. [19:23] The constitution prohibits [19:24] prohibits any [19:25] other business. [19:27] The clerk conveyed the [19:28] procedures how the house will [19:30] proceed contained in the [19:31] document on your desk. [19:33] The clerk will call the [19:33] calendar. [19:35] >> wednesday, April, 18, 2018 [19:44] for the 018 reconvened session. [19:47] The first category, house bills [19:54] vetoed by the governor. [19:57] First up, [19:58] relating to the status of a [19:59] franchisee and its employees as [20:00] employees of the franchisor. [20:01] The governor vetoed. [20:03] The veto is available online and [20:04] it is before the body. [20:06] >> if the clerk will call the [20:07] next item. [20:08] >> turning to page 2. [20:09] Continuing with the category. [20:14] Next up is house bill 158. [20:17] An act relating to technical [20:18] adjustments of legislative [20:20] district boundaries of house [20:22] delegates and senate districts. [20:27] The veto has been distributed [20:30] available online and before the [20:30] body. [20:33] >> the clerk will call the next [20:33] bill. [20:34] >> house bill 375. [20:42] An act to prohibit certain local [20:45] government practices. [20:46] It is distributed online and [20:52] before the body. [20:56] Page three of the calendar. [20:56] 1,167. [21:00] It is an act relating to jury [21:01] commissioners list of [21:03] unqualified persons provided to [21:06] general registrars. [21:07] distributed, available online [21:09] and it is before the body. [21:11] >> the delegate from loudoun, [21:14] delegate Larock. [21:15] >> thank you. [21:18] House bill 1167 is a bill to [21:19] allow greater efficiency. [21:22] The veto statement, however, [21:24] shows that he was either misled [21:25] as to the effect or is trying to [21:28] make it more difficult and time [21:30] consuming for local registrars [21:34] to clean up the rolls. [21:37] It was supported by the voter [21:39] registrar association of [21:39] virginia. [21:41] The legislation clarifies [21:43] existing practices and makes [21:44] them more efficient. [21:46] Every legitimate vote cancels [21:47] out a proper vote. [21:50] So we should allow our voter [21:54] registrars to efficiently update [21:55] voter roles when an individual [21:57] tells the clerk they are not [22:00] eligible to vote unfortunately, [22:02] partisan is undermining local [22:04] officials' efforts to [22:05] efficiently and accurately [22:07] conduct elections in the [22:08] commonwealth of virginia. [22:10] Is there a problem you might [22:10] ask? [22:13] A crosscheck of voter rolls down [22:15] in 2014 by the virginia voter [22:18] alliance turned up 44,000 people [22:20] registered in both virginia and [22:21] maryland. [22:22] Over the last five legislative [22:23] sessions, republicans have [22:25] attempted to preserve the [22:27] integrity of elections and to [22:28] improve processes and make [22:32] technical fixes in legislative [22:33] districts. [22:36] Governor northham's three see [22:37] toes of [22:42] vetoesfollow 24 similar by governor [22:48] Mcall legislative. [22:48] Mcauliffe. [22:52] i will include the law. [22:53] Which they do by sending [22:55] questionnaires to potential [22:56] jurors. [22:57] If an individual who is [22:59] registered to vote returns [23:00] claiming they are not eligible [23:02] to vote and seven on a jury that [23:04] information can and should be [23:06] made available for the voter [23:10] registrar and they then notify [23:12] and allow the individual to [23:14] confirm the eligibility to vote. [23:16] I will not contest this veto. [23:19] >> the clerk will call the next [23:19] veto. [23:22] >> house bill 1204. [23:24] It is an act relating to real [23:25] property tax special and [23:29] separate assessment of open [23:31] space in certain localities. [23:35] The governor's veto is available [23:37] online, distributed and before [23:38] the body. [23:39] >> the delegate from fairfax, [23:40] delegate hugo. [23:42] >> I did want to address the [23:42] issue. [23:44] I want to first thank the 65 [23:46] members who voted for it even [23:47] the one abstained vote. [23:49] I appreciate that, too. [23:50] And the 27 members of the [23:50] senate. [23:52] This bill was attempting to [23:55] address an unfair property tax [23:56] issue for certain golf courses [23:58] that were literally being billed [24:01] 10 times what others are. [24:02] I want to thank the governor, [24:05] even in the veto message he said [24:06] if we don't fix this we would [24:08] come back and work on it again [24:08] next year. [24:10] I'm pleased to say that because [24:11] of the members who voted for [24:12] this bill and how it passed the [24:14] house and the senate there has [24:18] been an equitable resolution [24:18] that I believe the golf courses [24:21] are now working on that will [24:21] take place. [24:23] I don't think this would have [24:24] happened if the people here [24:26] hadn't been able to work on [24:26] this. [24:32] So I appreciate that bipartisan [24:32] agreement. [24:33] That we worked on. [24:36] And for one course this fixes [24:38] 600 of my constituents who are [24:41] members but also 5,000 military [24:41] personnel. [24:42] I appreciate it. [24:44] Mr. Speaker, I do not wish to [24:45] contest the veto. [24:47] >> the clerk will proceed to the [24:49] next veto on page 4. [24:51] >> page 4. [24:55] Next up, house bill 1,257. [24:56] Act relating to sanctuary [24:57] policies. [25:00] The veto distributed, available [25:01] online and house bill 1257 is [25:02] before the body. [25:04] >> the delegate from rock [25:05] bridge, delegate cline. [25:06] >> I rice for a motion. [25:07] >> the delegate has the floor. [25:08] >> I would move that we override [25:10] the governor's veto and if I [25:11] might speak to the motion. [25:12] >> the delegate has the floor. [25:13] >> thank you, Mr. Speaker. [25:14] Ladies and gentlemen of the [25:15] house, this is an issue which [25:16] has been debated on this floor [25:18] many times. [25:21] And I have spoken often of the [25:22] simplicity of the bill which [25:24] simply says no locality shall [25:26] adopt any ordinance procedure or [25:28] policy that restriction the [25:29] enforcement of federal [25:33] immigration laws. [25:36] I read the veto message and it [25:37] didn't even seem like it was [25:39] written about this bill. [25:40] Because, the governor said that [25:42] this legislation could have [25:44] negative impacts on public [25:44] safety. [25:46] Well, you know what actually has [25:49] a negative impact on public [25:50] safety? [25:51] Not enforcing the law. [25:52] It is important to remember that [25:55] we are a nation of laws and not [25:57] of men as john adams said. [25:59] And it is important to remember [26:00] that when it comes to keeping [26:07] our communities safe, [26:09] enforcement of the law is key [26:12] and that is why we have law [26:13] enforcement officers. [26:14] It is frustrating when we hear [26:22] of incidents that are occurring [26:22] in the commonwealth why the laws [26:24] are not being enforced and [26:26] actual barrier is are being put [26:28] in place to enforcement of our [26:30] laws such as our federal [26:31] immigration laws. [26:34] I'm not talking about 287-g [26:35] programs which are optional for [26:37] each locality to participate in. [26:42] I'm talking about policies like [26:43] arlington's where the locality [26:47] will not honor an I.C.E. [26:48] Detainer without presentation of [26:51] a warrant issued by a judge. [26:53] Or, just two weeks buy [26:55] weeks ago in [27:01] fairfax where you had a [27:02] discussion going on about gang [27:06] violence in fairfax and [27:07] immigration and customs [27:10] enforcement officials disinvited [27:12] from the meeting not allowed to [27:14] speak at a public meeting and [27:16] then according to the washington [27:18] post several members of the [27:21] board of supervisors [27:22] congratulated the sheriff on her [27:25] decision to not participate in [27:26] 287-b [27:29] g and asked her and the [27:32] police chief to make sure that [27:37] I.C.E. Agents aren't easily able [27:40] to arrest anyone who is not the [27:43] target of a criminal [27:44] investigation. [27:45] That is actively interfere [27:46] ing [27:48] with the enforcement of [27:49] immigration law. [27:54] Those that say we don't have [27:55] sanctuary cities in the [27:56] commonwealth. [27:59] We have a problem of sanctuary [28:02] policies in the commonwealth. [28:08] Citizens like roanoke there are [28:10] petitions being circulated to [28:14] declare them to be sanctuary [28:15] cities. [28:16] Charlottesville is another one. [28:22] I would urge my colleagues to [28:23] consider overriding the veto. [28:26] We do have a problem and if we [28:28] ignore it, it will only continue [28:29] to grow. [28:30] I thank the body. [28:31] >> delegate lopez. [28:32] >> speaking to the motion. [28:33] >> the delegate has the floor. [28:35] >> thank you, Mr. Speaker. [28:37] The governor vetoed this bill to [28:39] ensure that local governments [28:40] retain the authority and [28:43] autonomy to make decisions [28:45] themselves about how to allocate [28:47] limited resource and protect [28:48] community police relations. [28:53] This imposes an unnecessary and [28:56] divisive requirement upon [28:56] localities. [28:59] Currently localities have the [29:00] discretion to determine whether [29:02] they will expend resources to [29:05] enter into a voluntary, let me [29:07] repeat that, voluntary agreement [29:08] with the united states [29:10] immigrations and customs [29:11] enforcement agent sill. [29:14] This would strip lowe [29:19] strip localities of a [29:19] autonomy. [29:21] This would send a clear message [29:22] to people across the [29:24] commonwealth that state and [29:25] local law enforcement officials [29:28] are to be feared and avoided [29:31] rather than trusted and engaged. [29:34] These policies encourage people [29:35] to report crimes to the police [29:36] that we have regardless of the [29:44] legal status. [29:46] They encourage people to report [29:48] crimes regardless of their legal [29:49] status. [29:52] This bill goes the opposite [29:53] direction. [29:54] A recent university of illinois [29:56] study found that 45% of [29:59] immigrants documented and [30:00] undocumented were less likely to [30:01] report a crime you as a result [30:03] of increased involvement of [30:06] local police in immigration [30:07] enforcements. [30:08] More alarming and I mentioned [30:09] this before in just the first [30:12] eight months of last year, in [30:14] arlington county, immigrant [30:16] communities have seen a drop of [30:19] 75% in reports of domestic [30:22] violence and 85% drop in reports [30:23] of sexual violence. [30:25] The fear in my community and [30:27] across the commonwealth is real. [30:28] Immigrants are avoiding police [30:30] for fear that their contact [30:32] might lead to deportation of a [30:33] loved one. [30:36] Not only will immigrants be [30:37] afraid to report crimes as [30:39] witnesses or victims or [30:40] coordinate with police and [30:42] prosecutors in helping to solve [30:45] crimes, their fear of doing so [30:47] will make them easy targets for [30:49] crime from gangs and bad actors [30:50] who prey on them. [30:52] In effect, this legislation [31:01] makes our communities less safe [31:04] by stoking irrational fears of [31:06] immigrants and stopping the [31:08] community policing that we value [31:09] for true public safety. [31:11] I hope it is the will of the [31:15] body to sustain the governor's [31:17] veto and vote no. [31:19] >> shall the house override the [31:26] governor's veto? [31:30] The clerk will close the roll. [31:36] >> ayes 51, nos 48. [31:37] >> ayes 51, nos 48. [31:40] The house fail foss [31:43] s to override the [31:43] veto. [31:46] >> next up, house bill 1270 [31:47] relating to the regional [31:51] greenhouse gas prohibition of [31:51] participation by the [31:52] commonwealth. [31:54] The veto is available online and [31:58] before the body. [31:59] >> delegate poindexter. [32:00] >> thank you. [32:02] You recall that house bill 1270 [32:03] is a whend [32:07] method to keep virginia [32:09] electricity rates from rising [32:09] unnecessarily. [32:15] I think of deerskin sometimes. [32:17] Folks up north hang them by the [32:19] head to skin and down south we [32:21] hang them by the feet but both [32:22] accomplishes the same thing. [32:24] Get the skin off and quarter the [32:26] deer and away you go. [32:30] According to article 1 [32:31] section 10 of the constitution [32:32] there are other ways for me to [32:34] proceed to stop this rising of [32:36] electricity rates on virginians [32:38] so I will not contest the [32:42] governor's veto, Mr. Chairman. [32:43] >> the clerk will report the [32:45] next veto. [32:47] >> finally, Mr. Speaker, on page [32:48] 5 of today's printed calendar, [32:51] the last bill vetoed by the [32:54] governor, house bill vetoed by [32:57] the governor 1568 an act [33:01] relating to the virginia [33:02] economic authority small [33:03] business authority. [33:05] It is vetoed [33:07] vetoed online and before [33:09] the body. [33:12] >> delegate from augusta, [33:14] delegate landes for an act to [33:14] follow. [33:15] [Applause] [33:16] >> addressing the governor's [33:18] veto and there is more than one [33:19] way to skin a cat. [33:23] >> oh! [33:24] >> and Mr. Speaker. [33:25] >> the delegate has the floor. [33:28] >> Mr. Speaker, this legislation [33:30] house bill 1568 was to address [33:33] concerns related to how the [33:34] department of small business and [33:36] supplier diversity has been [33:38] addressing and utilizing in many [33:40] cases their grant funds. [33:47] The compromise that we came up [33:50] with was in an attempt to work [33:52] with the administration and the [33:54] governor mentions having worked [33:55] with moo he [33:58] me and others on this. [34:01] I have talked to incoming [34:03] secretary of commerce and trade [34:04] brian balance who [34:07] ball who worked with me on [34:09] this and members across the [34:10] aisle that have been concerned [34:11] about the legislation and [34:13] Chairman Of the appropriations [34:15] committee and we hope to look at [34:16] the metrics that the [34:17] administration is going to come [34:18] forward with related to the [34:20] agency and making sure we are [34:21] measuring how they do and what [34:23] they do related to their [34:25] functions related to [34:27] certification and also the grant [34:30] funds that I have alluded to. [34:31] Mr. Speaker, I know we were [34:33] going to be doing that over the [34:35] next year and we hope to come up [34:37] with a solution related to the [34:40] concerns that I have raised and [34:40] others. [34:42] And, therefore, Mr. Speaker, I [34:44] will not be contesting the [34:46] governor's veto. [34:48] >> the clerk will proceed with [34:49] the calendar. [34:50] >> Mr. Speaker, turning to the [34:53] next category of business, [34:54] today's calendar. [34:56] House bills with recommendations [34:58] by the governor. [35:02] The first bill in the category, [35:04] house bill 83 an act to require [35:08] provision of feminine hygiene [35:10] products at no cost to fee [35:11] female [35:13] prisoners or inmates. [35:33] It passed both houses [35:34] unanimously. [35:37] This is just a technical change [35:39] of language from regulation to [35:40] standards. [35:41] You can't implement standards [35:42] but you can implement [35:43] regulations. [35:45] I ask all of you to support the [35:46] governor's amendment. [35:47] Thank you. [35:48] >> shall the governor's [35:55] recommendation be agreed to? [35:59] The clerk will close the roll. [36:03] >> ayes 96, nos 0. [36:04] >> ayes 96, nos 0. [36:44] A company has purchased the [36:46] henrico facility and is planning [36:47] to purchase the facility in [36:50] newport news and would be unable [36:51] to get a license without the [36:53] exemption so I move the adoption [36:55] of the governor's [36:56] recommendation. [37:32] >> house bill 192 which passed [37:33] 98-0 is legislation that would [37:35] among other things provide [37:37] opportunities to recognize rain [37:40] water as independent source of [37:40] freshwater. [37:41] The governor amended the [37:42] legislation so that the board of [37:45] health is the entity that adopts [37:46] regulation and make language [37:49] regarding water for human [37:50] consumption consistent [37:53] throughout the code of virginia. [37:57] I move to adopt the [37:58] recommendation. [38:00] >> shall the governor's [38:02] recommendation be agreed to. [38:03] >> the clerk will close the roll. [38:09] >> ayes the 7, nos 0. [39:36] >> Mr. Speaker, the bill the [39:38] underlying bill allows wineries [39:40] and farm breweries and [39:41] distilleries to allow dogs on [39:44] the premises if they so choose. [39:45] This amendment which I requested [39:47] the governor to add in was at [39:48] the request of the virginia [39:49] restaurant association after the [39:52] bill passed both chambers and [39:54] just makes the restaurant report [39:54] facility [39:58] or thefacility have a designation of [40:00] the area where the dogs are [40:00] allowed. [40:02] That can prevent problems and [40:04] can be done at no cost. [40:06] I recommend the adoption of [40:08] adoption of the [40:09] governor's recommendation. [40:45] >> the delegate has the floor. [40:47] >> house bill 297 as it passed [40:48] provides greater transparency in [40:54] the development of regulatory [40:57] guidelines providing a 30 day [40:58] comment period before they are [40:59] published. [41:02] One deals with an incorrect [41:05] citation and the other simply [41:06] clarifies the point when a [41:09] person can challenge a guidance [41:10] document and make the case to be [41:13] treated as a regulation. [41:15] The substantive change is the [41:18] delayed effective date, [41:19] January 1, 2019. [41:20] The pressure for that was the [41:25] department of planning and [41:26] budget requested time to get the [41:28] process up and running so it [41:29] works correctly. [41:31] With that, I move that we accept [41:32] the amendments. [41:33] >> shall the governor's [41:35] recommendation be agreed to? [41:39] The clerk will close the roll. [41:41] >> ayes 99, nos 0. [45:47] >> this bill specified that the [45:48] 501 c's dealing with things like [45:50] addiction recovery can lease [45:51] state property at cost. [45:54] The governor's recommendation [45:56] simply clarifies he wants to be [45:57] a part of the approval process [46:00] and so as much as it pains me, I [46:02] ask that we accept the [46:03] governor's recommendation. [46:04] >> shall the governor's [46:13] recommendation be agreed to? [46:16] The clerk will close the roll. [46:18] >> ayes 98, nos 0. [46:21] >> the governor's recommendation [46:22] agreed to. [46:34] The governor's recommendation [46:36] distributed, available online [46:38] and it is before the body. [46:40] >> the delegate, delegate [46:40] collins. [46:41] >> it is the hair, Mr. Speaker. [46:43] I would ask that we take the [46:48] amendments in two separate [46:48] blocks. [46:50] One and two in a block and three [46:51] and four into a block. [46:53] Vote on them separately. [46:54] >> we will sever these two. [46:55] Would you like to address one [46:57] and two? [46:58] >> thank you. [46:59] I have spoken to the governor [47:02] about the amendments they are in [47:04] support of the motion I am about [47:06] to make that bel [47:08] we will pass by [47:09] amendments one and two dealing [47:11] with the school board [47:12] administration wanting to have [47:13] their own legislation dealing [47:16] with drones and in conversations [47:17] with them because we will have [47:19] an enactment clause this will [47:21] not be enacted until November of [47:22] 2019 we will look at this [47:22] further. [47:27] I will ask that amendments one [47:30] and two pass by, Mr. Speaker. [47:30] >> delegate collins moves to [47:33] pass by amendments one and two. [47:34] All [47:37] all in favor of the motion, say aye. [47:38] Those opposed, no. [47:39] The motion carries and [47:41] amendments one and two are [47:42] passed by. [47:43] Delegate collins speaking to [47:44] amendments three and four. [47:46] >> speaking to amendments three [47:46] and four. [47:47] Amendment number three, ladies [47:49] and gentlemen simply clarifying [47:51] language to make sure that an [47:52] individual operating a drone is [47:54] in such a manner consistent with [47:55] federal regulations. [48:02] This is clarifying language. [48:04] Amendment four is an enactment [48:06] clause so that we can take a [48:07] look at this through the [48:09] technology and the innovative [48:10] technology commission and make [48:12] sure that we are into the doing [48:13] anything harmful and I would [48:15] accept the governor's [48:16] amendments. [48:17] >> shall the governor's [48:18] recommendation on amendments [48:25] three and four be agreed to? [48:29] The clerk will close the roll. [48:35] >> ayes 95, nos 0. [48:35] Abstentions 1. [48:36] Will [48:36] >> ayes 95, nos 0. [48:38] Abstentions 1. [48:42] Limits three and four agreed to. [48:45] >> house bill 665. [48:45] An act [48:47] an act [48:49] relating to coalfield employment [48:50] enhancement tax credit. [48:52] The governor's recommendation [48:57] distributed, available online [49:00] and it is before the body. [49:02] >> delegate kilgore. [49:03] >> speak to the governor's [49:04] recommendation. [49:05] >> I would ask that we reject [49:06] the governor's amendment and [49:09] give him a little more time to [49:14] think about this worthy project. [49:17] Thank you, Mr. Speaker. [49:18] >> delegate toscano. [49:19] >> speaking to the [49:20] recommendation. [49:21] >> the delegate has the floor. [49:22] >> thank you, Mr. Speaker. [49:22] Ladies and gentlemen of the [49:23] house. [49:24] I hope that you will accept the [49:25] governor's recommendation and [49:32] vote yes. [49:34] There is confusion not right now [49:36] in the coal industry and makes [49:38] sense to take time until things [49:39] settle down a bit. [49:40] The market has been in flux for [49:41] some time. [49:42] And the recent actions by the [49:44] trump administration regarding [49:47] the tariffs on steel from china [49:49] only exacerbated the issue. [49:50] There are several things that [49:54] are clearer about the coal tax [49:54] credit. [49:57] We have had a coal tax credit in [49:59] virginia until last year for [50:01] since the 1980s. [50:04] And, during that time, virginia [50:07] taxpayers have invested some [50:08] $750 million. [50:11] These are your tax dollars, that [50:14] have gone to the coal -- largely [50:16] coal companies but some [50:20] electricity companies. [50:21] And but have not brought the [50:22] results that the coal tax credit [50:27] was supposed to bring. [50:28] Y'all don't remember because you [50:30] weren't here in the 1980s but it [50:32] was sold as a vehicle to create [50:34] jobs and increase coal [50:36] production and $750 million [50:38] later what do we have? [50:40] We have an employment situation [50:44] where about 12,000 plus were [50:47] employed by coal industries in [50:49] the 1980's and now down to less [50:50] than 3,000 people. [50:56] Tonnage to the drop by 67% since [50:57] the 1980's. [50:58] We tonnage continuing to drop, [50:59] in. [51:01] >> fact, the most recent date [51:03] interest from the U.S. [51:04] government and now this is a [51:05] government controlled by [51:08] President Trump, shows the coal [51:09] production based on April [51:11] numbers of this year is down [51:13] almost 5% in virginia from what [51:22] it was last year. [51:26] It's not getting any better and [51:29] instead of saying we will invest [51:31] in virginia in a different way [51:33] we will double down and keep [51:38] sending tax dollars down for [51:38] this. [51:40] Two other things happened in the [51:41] industry and they have to do [51:42] with technology. [51:45] Coal is being challenged by the [51:46] market. [51:47] And by automation. [51:49] And if you take a look at what [51:52] is happening in coal production, [51:55] and what this is supposed to do, [51:56] this bill, you have to realize [51:59] that the technology is changing [52:00] around us. [52:01] The delegate from scott is going [52:05] to rise and say this is not met [52:08] coal, this is not about steam [52:08] coal. [52:09] >> that's right. [52:10] >> I don't have to now. [52:14] >> and met coal is effective [52:18] because it is the basic [52:19] ingredient of steel and we want [52:21] more steel and met coal helps [52:21] build steel. [52:24] The problem here is that that is [52:26] the -- that is an old paradigm. [52:29] It used to be that steel was [52:31] made in these blast furnaces, [52:33] these huge furnaces. [52:39] But over time, industry, [52:40] especially the american steel [52:42] industry has gone to a new [52:43] technology called electric air [52:46] furnaces which are fired by gas, [52:46] not coal. [52:51] You know who uses electric blast [52:52] furnaces? [52:53] China. [52:55] you know whose tariffs or who is [52:58] going to have tariffs on steel [53:00] from what country? [53:00] China. [53:02] So think about where this met [53:05] coal is going to go. [53:07] China and are we going to get [53:08] steel back? [53:08] No. [53:10] So they are not going to buy it. [53:13] So the coal industry is stilling [53:13] with [53:16] going tosuffer and we are going to [53:17] continue to double down. [53:19] I encourage you to take a little [53:21] time, take another year. [53:24] Put on this reenactment clause. [53:26] We can take a look at how things [53:27] are sorting out in the [53:28] international economy at that [53:30] time and if we decide that it [53:33] makes sense to invest our [53:35] hard-earned tax dollars of your [53:37] constituents by sending them to [53:45] coal companies, then we can put [53:48] in the met coal improved coal [53:48] tax credit. [53:48] You. [53:50] >> the delegate from shenandoah, [53:51] delegate gilbert. [53:52] >> thank you, Mr. Speaker. [53:53] Speaking to the amendment. [53:54] >> the delegate has the floor. [53:56] >> Mr. Speaker, I reluctantly [53:58] rise to simply avoid having to [54:01] do this a second time. [54:04] And just want to remind the body [54:07] that the minority leader wants [54:09] them to vote yes and delegate [54:10] kilgore asked them to vote no [54:13] and for those who May be doing [54:14] something else and need that [54:16] reminder I just centley offer [54:19] that so that we don't have -- [54:21] gently offer that so we don't [54:23] have to do this a second time. [54:25] >> shall the governor's [54:26] recommendation -- shall the [54:27] governor's recommendation be [54:33] agreed to? [54:38] the clerk will close the roll. [54:42] >> ayes 42, nos 55. [55:38] We the bill was being vetted, [55:39] there was no fiscal impact [55:41] statement and that is why he is [55:42] asking for another year. [1:03:53] The substitute as I see it from [1:03:56] the governor has removed all [1:03:57] such severenesses and now [1:04:02] and. [1:04:03] >> would the speaker rule [1:04:05] whether this is properly before [1:04:06] us as to whether it is germane [1:04:08] or not to the original measure. [1:04:10] >> I looked at this particular [1:04:11] measure and clearly the purpose [1:04:14] of house bill 1144 specifically [1:04:15] dealt with persons assistling [1:04:17] with the completion or [1:04:19] collection of completed voter [1:04:20] registration applications and [1:04:21] the requirement of certain [1:04:23] identifying information of the [1:04:26] person assisting the applicant. [1:04:28] The governor's substitute [1:04:30] transfers to the applicant and [1:04:31] requires the application to [1:04:32] require that the applicant [1:04:34] provide his telephone number and [1:04:36] e-mail address and further [1:04:38] expands the bill to prohibit any [1:04:40] application from being denied [1:04:42] for failure to provide such [1:04:42] information. [1:04:44] The substitute adds additional [1:04:45] provisions relevant to the [1:04:48] responsibilities from general [1:04:49] registrar. [1:04:50] The substitute goes beyond the [1:04:51] original purpose of the bill and [1:05:00] I will rule it not germane. [1:05:10] Next up is house bill 1163. [1:08:16] [Laughter] [1:08:18] >> Mr. Speaker, if you recall [1:08:20] house bill 1328 allows hunters [1:08:22] disabled to be exempted from any [1:08:24] local tree stand ordinance. [1:08:26] The governor clarifies only [1:08:27] those with physical disabilities [1:08:30] included in the exemptions and [1:08:31] not those mentally impaired. [1:08:33] I would ask that we accept the [1:08:35] governors if recommendations. [1:08:35] >> shall the governor's [1:08:43] recommendations be agreed to? [1:08:47] The clerk will close the roll. [1:09:19] >> the recommendations would be [1:09:20] a major policy decision related [1:09:22] to the application potentially [1:09:24] of federal immigration law by a [1:09:26] court and other opportunities [1:09:28] way more broad than initially [1:09:29] discussed in the bill. [1:09:31] While it May not be bad policy [1:09:32] it is felt that the needs this [1:09:39] needs to have a full discussion [1:09:40] next year so as not to do any [1:09:42] harm to the concept. [1:09:43] I would rather not ask that it [1:09:45] be rejected but just passed by [1:09:48] for the time being, Mr. Speaker. [1:09:49] >> delegate watts. [1:09:50] >> thank you, Mr. Speaker. [1:09:51] Speaking to the motion to pass [1:09:52] by. [1:09:54] >> the delegate has the floor. [1:09:55] >> thank you, Mr. Speaker. [1:09:57] We are dealing with benefits [1:09:59] going to children. [1:10:03] Benefits going to them in a very [1:10:05] important developmental point of [1:10:06] their life. [1:10:10] The reason for this bill is that [1:10:13] recently, the court of appeals [1:10:14] rejected -- excuse me, the [1:10:16] supreme court rejected hearing [1:10:20] the court of appeals' ruling on [1:10:30] a case coming out of northern [1:10:34] judges it done it consistently [1:10:36] for years and gone beyond the [1:10:38] wording in the code and finding [1:10:40] of fact as to what is in the [1:10:41] child's best interest. [1:10:42] The language in the governor's [1:10:46] amendment is' [1:10:47] is' essential. [1:10:49] Again underscoring in the [1:10:55] important developmental years of [1:11:02] a [1:11:09] child eligibility for free and [1:11:10] retuesdayed lunch, family [1:11:12] unification program and housing [1:11:16] vouchers, obtaining a passpart. [1:11:18] Supplemental social security [1:11:19] income. [1:11:22] Delaying this for a year while [1:11:25] we wait to look at this fully in [1:11:29] the next session as opposed to [1:11:31] allowing this application for [1:11:37] these important benefits to go [1:11:38] forward in the months to come [1:11:40] and come back in the 2019 [1:11:42] session and look further at the [1:11:44] language to see if there are [1:11:45] additional corrections and such [1:11:52] that might be made. [1:11:53] I urge you to vote on the [1:11:55] amendments to deal with the [1:11:57] needs of the children and carry [1:12:00] on as juvenile and domestic [1:12:01] relations courts judges have [1:12:02] done for years in their finding [1:12:04] of what is in the child's best [1:12:05] interests. [1:12:08] >> the delegate from caroline, [1:12:10] delegate orrock. [1:12:11] >> parliamentary inquiry. [1:12:12] >> the delegate May state it. [1:12:15] >> as I look at the language of [1:12:16] 1351 as it went to the governor, [1:12:21] it was very narrow in its [1:12:23] interpretation and only applied [1:12:31] to the actual custody and had no [1:12:38] reference to benefits that would [1:12:39] accrue. [1:12:42] Whether it was joint legal, or [1:12:43] sole custody there was no [1:12:45] presumption of any modification [1:12:46] as related to the child's [1:12:48] ability to receive state or [1:12:50] federal benefits thereby. [1:12:51] I would gentlemen the [1:12:54] germaneness of this amendment. [1:12:54] >> okay. [1:13:02] Let me take that look at it. [1:13:42] >> I think the gentleman is [1:13:44] correct in his analysis and I [1:13:52] would rule it not germane. [1:14:01] Public rights [1:14:03] of way use fees. [1:14:05] The governor's distributed [1:14:07] available online and before the [1:14:07] body. [1:14:09] >> the delegate from scott, [1:14:11] delegate kilgore. [1:14:12] >> speaking to the governor's [1:14:13] recommendation. [1:14:14] >> the delegate has the floor. [1:14:15] >> Mr. Speaker and ladies and [1:14:15] gentlemen of the house, the [1:14:16] governor amended this [1:14:17] legislation and removed [1:14:20] localities from the bill but [1:14:22] maintained the new streamlined [1:14:25] fee schedule for what vdot can [1:14:27] charge wireless providers and [1:14:29] maintains a flexibility of the [1:14:30] local governments to select a [1:14:32] fee that best fits with our [1:14:33] local land use and the value of [1:14:36] the public right-of-way. [1:14:37] I hope it would be the pleasure [1:14:41] of the body to accept the [1:14:42] governor's recommendations. [1:14:43] >> shall the governor's [1:14:44] recommendation be agreed to? [1:15:30] >> house bill 1441 removes the [1:15:31] sales and stackets from the sale [1:15:36] of atv a and motorcycles and [1:15:38] replaces it with a titling tax [1:15:39] so it is no tax increase. [1:15:41] The recommendation recognized [1:15:45] that as we were making this making this [1:15:48] totally neutral we omitted one [1:15:50] code and that puts that in so [1:15:52] that it is clear so there is no [1:15:53] change in the tax policy, just [1:15:55] where the taxes are collected [1:15:58] and I would ask that we would [1:15:59] adopt the governor's [1:16:00] recommendation. [1:16:01] >> shall the governor's [1:16:02] recommendation be agreed to? [1:16:11] The clerk will close the roll. [1:16:16] >> ayes 77, nos 21, aye 77, nos [1:16:16] 21. [1:16:38] Ladies and gentlemen of the [1:16:39] house, I stand before you in a [1:16:43] surreal state today. [1:16:43] >> ooh! [1:16:45] >> to think that a bill I [1:16:46] carried was so compelling to the [1:16:48] governor that he simply could [1:16:52] not wait until July 1 for it to [1:16:53] become law I am just thrilled [1:16:54] by. [1:16:56] Accordingly, I would ask the [1:16:58] body to oblige the governor and [1:16:59] accept his amendment. [1:17:01] [Laughter] [1:17:02] >> shall the governor's [1:17:04] recommendation be agreed to? [1:17:11] The clerk will close the roll. [1:17:13] >> ayes 98, nos 0. [1:17:14] >> ayes 98, nos 0. [1:18:48] >> okay. [1:18:49] Yes. [1:18:52] 22 is -- we can take 22 and I [1:18:55] will address it separately. [1:18:55] That's fine. [1:19:01] >> take it out. [1:19:03] >> Mr. Speaker, would you like [1:19:04] 22 in the block or out of the [1:19:04] block? [1:19:05] >> take it out. [1:19:07] >> out of the block. [1:19:11] 1-3, 5-6, 9-15. [1:19:13] 8-21 and 23? [1:19:14] >> all right. [1:19:16] The next one I will explain it [1:19:17] step rattly. [1:19:19] Separately. [1:19:21] That is fine. [1:19:22] >> Mr. Speaker? [1:19:24] >> it might be easeor adopt that [1:19:24] block. [1:19:25] >> let me explain. [1:19:27] Many are purely technical. [1:19:29] Some are name changes. [1:19:34] Some address how the moneys move [1:19:35] into the funds but literally [1:19:37] more technical in nature. [1:19:39] I think I spoke with my con [1:19:41] fearee on this and there is [1:19:42] agree on [1:19:47] agreement on that. [1:19:49] I would ask that the amendments [1:19:50] within the block be adopted. [1:19:52] >> shall the recommendations [1:19:57] 1-3, 5-6, 9-15, 18-21 and 23 be [1:19:58] agreed to? [1:20:15] >> Mr. Speaker, I would ask that [1:20:17] we create another block. [1:20:19] These would be not -- they are [1:20:20] not technical. [1:20:22] The next four amendments deal [1:20:23] with the tax increases that the [1:20:25] governor has proposed within [1:20:25] this bill. [1:20:29] And I would ask that we take [1:20:33] them en bloc. [1:20:35] 7, 8, 16 and 17. [1:20:38] >> delegate hugo wants to take [1:20:42] 7, 8, 16 and 17 the tax block. [1:20:43] >> Mr. Speaker. [1:21:35] The ayes have it and those four [1:21:36] recommendations are passed by. [1:21:44] Delegate hugo. [1:21:46] >> next I ask that we take [1:21:48] amendment four. [1:21:49] Speak to amendment four. [1:21:50] >> the delegate would like to [1:21:51] speak to amendment four? [1:21:53] >> I would ask that we reject [1:21:54] amendment four. [1:21:55] One of the things in the bill [1:21:57] that we attempted to do in [1:21:59] working with our colleagues on [1:22:01] both sides of the ail [1:22:03] aisle is [1:22:04] making sure that metro has [1:22:06] reforms. [1:22:08] When we had a press conference [1:22:10] we said we would fund metro and [1:22:11] rae form [1:22:14] reform metro and do it without [1:22:15] tax increase is. [1:22:16] One of the key reforms in there [1:22:18] was to make sure that these [1:22:27] costs overruns stop. [1:22:29] Metro sometimes had 7, 8, 9% [1:22:30] funding [1:22:33] increases. [1:22:36] We have a 3% percent cap on [1:22:36] funding. [1:22:38] This would take the ig outside [1:22:38] of the cap. [1:22:40] I would ask that we keep that in [1:22:42] there and keep the cost [1:22:43] restraints in there and keep the [1:22:45] pressure on and keep the 3% cap [1:22:45] firm. [1:22:48] Mr. Speaker, I would ask that we [1:22:50] reject the governor's [1:22:53] recommendation on amendment 4. [1:22:54] >> delegate from fairfax, [1:23:02] delegate simon. [1:23:04] >> the delegate from fairfax [1:23:05] delegate sullivan. [1:23:06] >> speaking to the amendment. [1:23:07] >> the delegate has the floor. [1:23:08] >> the delegate from fairfax is [1:23:08] correct. [1:23:11] We have included in this bill [1:23:17] sort of a break because everyone [1:23:21] is concerned with costs at [1:23:21] metro. [1:23:22] Amendment four creates one [1:23:24] exception to the 3% increase and [1:23:25] that is the office of the [1:23:26] inspector general. [1:23:29] No one has expressed any [1:23:30] concerns about metro spending [1:23:32] too much money on its internal [1:23:34] watch dog, if you will. [1:23:36] And it is, frankly, something we [1:23:38] want to make sure it well [1:23:38] funded. [1:23:40] Metro is about to get [1:23:41] $500 million a year in [1:23:42] additional funds. [1:23:44] The current office of the [1:23:48] inspector general is about [1:23:49] $5 million. [1:23:54] This is simply an exception to [1:23:55] that 3% notion so that metro -- [1:23:57] we don't create some incentive [1:23:59] to not increase funding to the [1:24:02] oig if they need additional [1:24:03] funding in the oig. [1:24:05] That is something we would all [1:24:07] want metro to be doing to make [1:24:08] sure that its internal [1:24:10] organization is being properly [1:24:13] monitored by the oig. [1:24:14] This I think is an excellent [1:24:16] amendment and I hope you will [1:24:16] vote for it. [1:24:17] >> Mr. Speaker. [1:24:19] >> the delegate from -- the [1:24:21] delegate from fairfax, delegate [1:24:22] hugo. [1:24:22] >> again, Mr. Speaker, we are [1:24:24] trying to keep the cost cap this [1:24:27] there and keep it firm. [1:24:27] Firm. [1:24:29] The first thing it appears we [1:24:31] are trying to do here is create [1:24:33] an exception. [1:24:35] Metro has had cost overrun after [1:24:37] overrun after overrun. [1:24:39] The body is attempting to fund [1:24:40] it, which is what they asked us [1:24:41] to do. [1:24:43] But we also said hand in hand [1:24:46] with the money must come [1:24:46] reforms. [1:24:49] And we did it with no tax [1:24:50] increase. [1:24:51] Again, why would we want to [1:24:53] having a reform why would the [1:24:55] first thing we do is to create [1:24:55] another exception? [1:24:57] i would ask us to vote no. [1:24:59] They can take the money for the [1:25:02] ig out of the moneys they have. [1:25:04] They will I'm sure. [1:25:06] Show have good new leadership [1:25:06] this. [1:25:07] I would ask that we vote no. [1:25:09] Keep the hard cap firm and keep [1:25:11] it in there and keep the [1:25:13] restraints on metra. [1:25:14] Vote no. [1:25:16] >> delegate toscano. [1:25:17] >> thank you, Mr. Speaker. [1:25:19] Will the delegate from fairfax, [1:25:21] delegate sullivan resume the [1:25:22] floor for a question? [1:25:23] >> delegate sullivan yield for a [1:25:24] yes? [1:25:24] >> I yield. [1:25:26] >> delegate yields. [1:25:26] >> thank you, Mr. Speaker. [1:25:28] I would ask the delegate we had [1:25:32] just a few minutes ago four [1:25:33] amendments that had to do with [1:25:34] tax issues. [1:25:36] For someone who lives downstate [1:25:38] who is not really affected as [1:25:41] much by metro but might be [1:25:50] worried about a tax increase [1:25:51] does it recommendation say [1:25:52] anything at all about tax [1:25:53] increases. [1:25:54] >> I would answer that amendment [1:25:55] four has nothing to do with [1:25:57] imposing any kind of tax [1:25:57] increase. [1:26:00] >> thank you. [1:26:04] >> shall the governor's [1:26:04] recommendation number 4 be [1:26:04] agreed to? [1:26:14] The clerk will close the roll. [1:26:18] >> ayes 48, nos 51. [1:26:20] >> ayes 48, nos 51. [1:26:22] Recommendation number four is [1:26:22] rejected. [1:26:24] The delegate from fairfax, [1:26:24] delegate hugo. [1:26:26] >> I would like to address now [1:26:27] amendment 22. [1:26:28] >> the delegate has the floor. [1:26:29] >> Mr. Speaker, with amendment [1:26:30] 22, and we could have said that [1:26:32] was clarify, but I think it is [1:26:33] probably more appropriate to [1:26:34] bring it out. [1:26:36] I'm going to ask that we support [1:26:38] the governor's amendment on it. [1:26:39] One of the things we were [1:26:41] talking about a minute ray [1:26:45] ago. [1:26:46] Trying to make sure that the [1:26:48] reforms go into the bill and [1:26:49] don't come back in a couple of [1:26:51] years and say we Miss This. [1:26:54] What this does and I applaud the [1:26:57] governor, it requires the ctb to [1:26:59] withhold 20% of the state funds [1:27:01] if they have not adopted buy [1:27:04] laws requiring all member [1:27:09] jurisdictions to require certain [1:27:10] journal [1:27:13] jurisdictional procedures. [1:27:14] This was something that was [1:27:14] recommended. [1:27:15] We had talked about with the [1:27:16] governor. [1:27:17] I think the secretary lahood [1:27:18] talked about this. [1:27:19] I appreciate the governor [1:27:21] including this amendment and I [1:27:23] would ask my colloquy leaks on [1:27:26] both sides of the aisle to vote [1:27:28] yes on amendment 22. [1:27:30] >> shall the governor's [1:27:32] recommendation number 22 be [1:27:33] agreed to? [1:27:40] The clerk will close the roll. [1:27:42] >> ayes 99 nos 0. [1:27:43] >> ayes 99, nos 0. [1:27:44] The delegate from fairfax, [1:27:45] delegate hugo. [1:27:49] >> and Mr. Speaker, addressing [1:27:50] amendment no. 24. [1:27:50] >> the delegate has the floor. [1:27:52] >> I would ask, Mr. Speaker that [1:27:54] that amendment be broken into [1:27:54] half. [1:27:55] What is it? [1:27:58] 14 -- I guess it would be 17 and [1:27:59] 24 -- 18. [1:28:01] >> so the delegate wants [1:28:06] wants to [1:28:07] address 24-17. [1:28:08] >> I think what the governor has [1:28:10] attempted to do is make sure [1:28:12] that nothing in the bill shall [1:28:14] trigger kill switches in other [1:28:15] legislation. [1:28:16] I just want to make sure we [1:28:16] brought that up. [1:28:18] I would think that we can adopt [1:28:18] this amendment. [1:28:20] I would ask that we support the [1:28:23] amendment. [1:28:25] This is something I just wanted [1:28:26] to break it out to make sure [1:28:27] that people understood what we [1:28:28] are doing on this. [1:28:31] Make sure that we don't impact [1:28:32] past legislation. [1:28:37] I ask the members to adopt [1:28:37] 24-17. [1:28:38] >> shall the recommendation [1:28:41] dealing with 24-17 be agreed to? [1:28:48] The clerk will close the roll. [1:28:50] >> ayes 99, nos 0. [1:28:53] >> ayes 99, nos 0. [1:28:57] That recommendation 24-17 is [1:28:58] adopted. [1:29:01] >> delegate hugo. [1:29:03] >> addressing the recommendation [1:29:04] and 24-18. [1:29:05] >> the delegate has the floor. [1:29:07] >> the revenue source in here is [1:29:09] currently subject to the [1:29:11] enactment clause and house bill [1:29:13] 1887 from 2015 which states [1:29:16] congress enacts the marketplace [1:29:17] fairness county as internet tax [1:29:20] that the revenue source shall be [1:29:22] deo positionitied in the fund [1:29:24] this would' lou it to be [1:29:26] dedicated to a moda capital fund [1:29:30] even if congress enacts the [1:29:31] market fairness act so I would [1:29:33] ask that we adopt this [1:29:35] amendment. [1:29:37] >> shall the governor's [1:29:39] recommendation on 24-18 be [1:29:40] agreed to? [1:29:47] the clerk will close the roll. [1:29:50] >> ayes 96, nos 1. [1:29:52] >> ayes 96, nos 1. [1:30:00] 24-18 is agreed to. [1:30:07] >> the clerk will proceed. [1:30:10] >> turning to page 22. [1:30:15] Of the printed calendar. [1:30:19] Next up, next-to-last bill 1595. [1:30:20] It is an act [1:30:21] relating to vested rights; [1:30:22] existing landscape cover [1:30:23] materials. [1:30:25] Governor's recommendation has [1:30:27] been available online, [1:30:29] distribute the and before the [1:30:29] body. [1:30:33] >> the delegate from [1:30:34] rockingham,. [1:30:35] >> thank you, Mr. Speaker. [1:30:36] Speaking to the governor's [1:30:37] recommendation. [1:30:37] >> the delegate has the floor. [1:30:40] >> thank you, Mr. Speaker. [1:30:41] Mr. Speaker, ladies and [1:30:47] gentlemen of the house, house [1:30:52] bill 1595 is the illustrious [1:30:53] mulch bill. [1:30:55] On its surface it seems kind of [1:30:57] funny that we would have all [1:31:02] this to-do over mulch but we all [1:31:03] well know that the issue at hand [1:31:06] is larger than just the issue of [1:31:06] mulch. [1:31:09] The governor's recommendations [1:31:11] on 1595 make numerous carveouts [1:31:14] as you can see in the language [1:31:17] and for all practical purposes [1:31:18] guts the bill. [1:31:20] After all of those carveouts and [1:31:22] those exemptions, it begs the [1:31:23] question who is left? [1:31:25] Just that would be just you and [1:31:27] I. [1:31:29] But alas, Mr. Speaker, ladies [1:31:30] and gentlemen of the house, if I [1:31:31] want everybody to take a close [1:31:34] lack at the lap -- close look at [1:31:41] the language down in letter d. [1:31:44] Building containing one or more [1:31:45] dwelling units. [1:31:47] i contend that includes single [1:31:48] family dwellings. [1:31:50] What started all this was the [1:31:52] ordinance in the city of [1:31:53] harrisonburg. [1:31:54] They didn't even include that. [1:31:56] They were kind enough, well, [1:31:58] they knew this they were going [1:32:00] to be in for a fight it they [1:32:06] included all of the citizens [1:32:06] half [1:32:08] citizenshalf [1:32:10] citizens'homes. [1:32:14] That is why they exempt them. [1:32:15] The governor doesn't take that [1:32:23] into consideration, Mr. Speaker. [1:32:24] The original bill allowed that [1:32:28] any -- the occupancies issued [1:32:30] prior to January 1 of this year [1:32:38] wasn't going to be affected but [1:32:40] going forward it would be. [1:32:45] That was a good compromise. [1:32:46] Felt like that was a good come [1:32:48] promaze that the lowe [1:32:50] localities [1:32:53] could regulate mulch going [1:32:53] forward. [1:32:55] If we believe that the locality [1:32:57] should not have the authority to [1:32:59] retroactively apply new rules [1:33:01] then we should reject the [1:33:03] amendments and again I want to [1:33:06] reiterate the whole issue of [1:33:06] retroactivity. [1:33:13] And there is always discussions [1:33:14] about the dillon rule. [1:33:16] Ecan oversee issues like this [1:33:18] and prevent because many of you [1:33:19] that supported the resolution [1:33:21] measure in the beginning you saw [1:33:23] the bigger pictures and there is [1:33:24] more than mulch. [1:33:26] It is about the whole notion of [1:33:28] the localities being able to go [1:33:31] in and retroactively enacting [1:33:34] all kinds of ordinance and [1:33:35] regulations on us and our [1:33:36] citizens. [1:33:37] And so with that, Mr. Speaker, I [1:33:40] ask that we reject the [1:33:42] governor's recommendations. [1:33:44] >> the delegate from fairfax, [1:33:45] delegate plum. [1:33:46] >> Mr. Speaker, speak to the [1:33:53] governor's recommendation. [1:34:00] >> the delegate has the [1:34:04] floor. [1:34:07] If we decided to get involved in [1:34:09] the matters of fire safety and [1:34:12] local government, do it in a [1:34:13] practical way. [1:34:15] They take the local fire [1:34:16] department people and say if you [1:34:17] create a situation like this of [1:34:20] where we disallow the mulch, [1:34:22] then we need to make -- take [1:34:25] into account things like the [1:34:27] multifamily dwellings and so on [1:34:29] that are -- that had the most [1:34:30] problems. [1:34:31] The fire services found that [1:34:35] there were 835 total mulch fires [1:34:36] during 2016 and 2017. [1:34:38] Now we are sitting as a local [1:34:39] government and we want to be [1:34:41] responsible for how we adopt the [1:34:42] fire services provisions for [1:34:46] health and safety let's then [1:34:47] accept the governor's [1:34:48] recommendation and take out the [1:34:50] areas where the greatest threat [1:34:51] and concern exists. [1:34:53] I would ask you, please tortion [1:34:54] support the governor's [1:34:59] recommendation. [1:35:00] >> shall the governor's [1:35:02] recommendation be agreed to? [1:35:14] The clerk will close the roll. [1:35:17] >> ayes 42, nos 51. [1:35:20] >> ayes 42, nos 51. [1:35:22] The governor's recommendation is [1:35:23] rejected. [1:35:26] >> the last house bill with [1:35:28] recommendations by the governor [1:35:29] is house bill 1598. [1:35:34] It is an act [1:35:35] relating to standards and [1:35:36] criteria for congressional and [1:35:37] state legislative districts. [1:35:38] The governor's recommendation's [1:35:39] available, distributed and [1:35:41] presently before the body. [1:35:45] >> the delegate from suffolk, [1:35:45] delegate jones. [1:35:45] >> speaking to the amendment. [1:35:45] >> the delegate has the floor. [1:35:46] >> I would like to take all of [1:35:48] the eight amendments in a block, [1:35:50] if we could. [1:35:51] >> the delegate has the floor. [1:35:51] We can do that. [1:35:56] >> I would ask that house bill [1:35:58] 1598 established criteria and [1:36:01] standards for the next cycle of [1:36:02] redistricting for the [1:36:02] congressional and state [1:36:04] legislative districts and the [1:36:06] governor has chose ton make [1:36:07] amendments to the bill. [1:36:09] Was not consulted, was informed [1:36:11] and I would ask that we would [1:36:13] defeat the governor's [1:36:14] amendments. [1:36:20] >> delegate from newport news. [1:36:21] >> speaking to the amendment. [1:36:23] >> the delegate has the floor. [1:36:24] >> H.B. 1598 establishes the [1:36:27] criteria required in drawing the [1:36:28] congressional state districts. [1:36:31] There are eight amendments. [1:36:33] One, four and five are technical [1:36:35] in nature. [1:36:37] Number it allows for political [1:36:38] boundaries to be considered. [1:36:40] It just says that political [1:36:43] boundaries can't be elevated [1:36:45] over the importance of other [1:36:46] criteria listed. [1:36:48] And then number six and number [1:36:54] seven are cleanup language. [1:36:55] Excuse me, five and six. [1:36:57] And number seven revises the sub [1:36:58] section on communities of [1:36:59] interest requiring communities [1:37:01] with similar social cultural and [1:37:08] economic interests be [1:37:08] considered. [1:37:10] And then number eight adds two [1:37:12] new criteria. [1:37:13] The first protect the voting [1:37:15] rights of minorities and the [1:37:17] second prohibits districts from [1:37:20] being drawn to favor or disfavor [1:37:22] political parties and incumbent. [1:37:24] And so, Mr. Speaker, I argue [1:37:26] that the amendments push the [1:37:27] redistricting process to be more [1:37:30] just and more clearly defined [1:37:32] and I offer that we do not have [1:37:35] to wait for a court decision or [1:37:38] wait for someone to tell us the [1:37:41] minimum required standards for [1:37:41] fairness. [1:37:43] Previous court decisions that [1:37:44] have already come down have set [1:37:46] the precedent and we now have an [1:37:48] opportunity today to approve [1:37:49] these amendments and help [1:37:52] protect our democracy and ensure [1:37:55] all virginians' votes matter [1:37:56] equally. [1:37:58] I urge us to support the [1:38:01] governor's amendments by voting [1:38:06] no to encourage trust in the [1:38:10] system and inspire more voter [1:38:11] participation and not less. [1:38:12] Thank you, Mr. Speaker. [1:38:15] >> the delegate from [1:38:16] charlottesville, delegate [1:38:16] toscano. [1:38:17] >> speaking to the [1:38:18] recommendations. [1:38:19] >> the delegate has the floor. [1:38:20] >> thank you, Mr. Speaker. [1:38:22] I think the -- for those people [1:38:23] who like the recommendations and [1:38:25] want to support the governor, [1:38:27] the vote on this is a green or a [1:38:27] yes. [1:38:29] For those who don't like them, [1:38:31] then you vote no. [1:38:33] >> shall the governor's [1:38:35] recommendation be agreed to? [1:38:45] The clerk will close the roll. [1:38:48] >> ayes 48, nos 51. [1:38:50] >> ayes 48, nos 51. [1:38:52] The governor's recommendation is [1:38:53] rejected. [1:38:56] >> Mr. Speaker that completes [1:38:58] this portion of the calendar. [1:38:59] we have done house bills with [1:39:01] vetoes, house bills with [1:39:03] governor's recommendations. [1:39:06] And the senate is still working [1:39:07] through its portion of the [1:39:09] calendar, so we present play [1:39:10] have no business before us but [1:39:11] we will. [1:39:12] >> two things. [1:39:14] I would like to recognize a [1:39:15] special guest in the back and [1:39:17] then we will go at ease. [1:39:19] Don if you will stand up. [1:39:22] He is former georgia state [1:39:25] senator and ncsl President And [1:39:28] also the ncsc President At the [1:39:32] same time as the famous sharyn, [1:39:34] the staff chair and that is the [1:39:35] important thing don as much as [1:39:35] we love you. [1:39:37] It is great to have you with us. [1:39:39] Thank you for visiting. [1:39:40] Let's give don a big hand of [1:39:41] applause. [1:39:48] [Applause] [1:39:52] >> and the house will be at [1:39:53] ease. [1:40:01] [House at ease] [2:52:55] [Gavel pounding] [2:52:59] >> the house will come to order. [2:53:00] The death [2:53:06] delegate from shenandoah, [2:53:07] delegate gilbert. [2:53:09] >> rice for a motion. [2:53:10] >> delegate has the floor. [2:53:12] >> I move the house stand in [2:53:14] recess until 3:25 P.M. [2:53:15] >> delegate gilbert moves the [2:53:18] house stand in recess until 3:25 P.M. [2:53:22] All in favor signify by saying [2:53:22] aye. [2:53:24] Those opposed no. [2:53:26] That motion carries. [2:53:29] The house stands in recess until [2:53:29] 3:25. [2:53:31] >> the house republican caucus [2:53:33] meeting in house room 1. [2:53:35] The democratic caucus in his [2:53:37] room 2 and the national has [2:53:38] communicated several but not all [2:53:42] of the bills before us so we [2:53:47] coming back up at 3:25 we will [2:53:54] be able to hopefully proceed. [2:55:54] [Gavel banging] [2:56:10] >> house will come to order. [2:56:16] We're now at the point of the [2:56:17] calendar where we're on senate [2:56:18] bills. [2:56:18] The senate bills will be handled [2:56:20] in the same manner as the house [2:56:21] bills. [2:56:23] However, the clerk will advise [2:56:25] the house if a senate bill is [2:56:27] not before the house or if only [2:56:28] certain amendments to a senate [2:56:29] bill are before the house. [2:56:31] The clerk will proceed with the [2:56:32] calendar. [2:56:33] >> continuing with today's [2:56:35] calendar, page 23 of the printed [2:56:37] version, next category, [2:56:38] supplemental information sent -- [2:56:39] I'm sorry, senate bills vetoed [2:56:41] by the governor. [2:56:43] Neither of those bills are [2:56:47] before us, so senate bill 521, [2:56:49] 926 are not before us. [2:56:50] Those are the only two senate [2:56:52] bills vetoed, so the next [2:56:54] category in today's calendar, [2:56:56] page 25, printed calendar, [2:56:58] senate bills with [2:56:59] recommendations by the governor. [2:57:02] On page 25, printed calendar for [2:57:05] the house, senate bill 106, that [2:57:07] is not communicated, so it is [2:57:08] not before us. [2:57:10] So accordingly, on page 26 of [2:57:12] today's house calendar, the [2:57:15] first bill communicated for [2:57:18] action by the senate is senate [2:57:20] bill 249. [2:57:23] It is an act related to taxation [2:57:26] of certain all-terrain vehicles, [2:57:29] mopeds and off-road motorcycles. [2:58:17] An act relating to sexually [2:58:21] violent predator assessment [2:58:21] protocol. [2:58:23] The governor's recommendation is [2:58:24] available online, been [2:58:25] communicated, shared with [2:58:25] everybody, and is before the [2:58:27] body. [2:58:35] >> delegate has the floor. [2:58:39] >> thank you, Mr. Speaker. [2:58:42] Sb 267 passed this house on [2:58:45] February 27th, 99-0 and the [2:58:47] porch's recommendations are -- [2:58:49] governor's recommendations are [2:58:50] recommendations from the [2:58:51] attorney general and are [2:58:51] technical in nature. [2:58:55] They changed prisoners, inserted [2:58:59] and defendants, subsection to [2:59:00] subsections, things like that, [2:59:01] so I will, therefore, ask the [2:59:04] body to adopt the governor's [2:59:05] recommendations. [2:59:07] >> shall the governor's [2:59:13] recommendations be agreed to. [2:59:16] The clerk will close the roll. [2:59:19] >> ayes 98, nos 0. [2:59:21] >> ayes 98, nos 0. [2:59:22] the governor's recommendations [2:59:25] are agreed to. [2:59:26] >> turning to page 27 of the [2:59:28] house printed calendar, next [2:59:32] category -- next bill in this [2:59:34] category, senate bill 278. [2:59:36] It is an act relating to eminent [2:59:39] domain proceeds, payments of [2:59:40] funds for attorney for owner. [2:59:42] The governor's recommendations [2:59:44] have been distributed, available [2:59:45] online and governor's [2:59:47] recommendations are before the [2:59:47] body. [2:59:50] >> the delegate from newport [2:59:52] news, delegate mullins. [2:59:53] >> speaking to the governor's [2:59:54] recommendation. [2:59:55] >> delegate has the floor. [2:59:57] >> sb 278 was a bill that passed [2:59:59] out of this house 100-0. [3:00:00] It's a bill to speed up and [3:00:01] improve the process in which [3:00:03] claimants are able to get paid [3:00:05] in an eminent domain matter. [3:00:07] The governor amended this [3:00:08] legislation to remove the [3:00:09] requirement that funds be [3:00:10] distributed to the owner's [3:00:11] attorney first unless the [3:00:13] property owner consents. [3:00:15] It also clarifies the attorney's [3:00:17] lien does not take priority over [3:00:19] anyone else's lien and also [3:00:20] clarifies the bill does not [3:00:22] change the priority of liens as [3:00:23] to property or funds. [3:00:24] Many of those are technical in [3:00:26] nature and I would ask that the [3:00:26] body accept the governor's [3:00:28] recommendation. [3:00:30] >> shall the governor's [3:00:36] recommendation be agreed to. [3:00:39] The clerk will close the roll. [3:00:41] >> ayes 97, nos 0. [3:00:43] >> ayes 97, nos 0. [3:00:56] Governor's recommendation has [3:00:57] been distributed, available [3:00:59] online and sb 343 is before the [3:01:00] body. [3:01:01] >> delegate from shenandoah, [3:01:02] delegate gilbert. [3:01:03] >> thank you, Mr. Speaker. [3:01:04] Mr. Speaker, members of the [3:01:05] house, this bill and the [3:01:07] governor's recommendation are [3:01:09] identical to house bill 1000 [3:01:10] that we approved the [3:01:11] recommendation for earlier and I [3:01:13] would move we approve the [3:01:14] governor's recommendation. [3:01:33] >> ayes 94, nos 3, the [3:01:34] governor's recommendation is [3:01:36] agreed to. [3:01:39] >> turning to page 28 of the [3:01:43] printed house calendar, sb 378 [3:01:44] has not been sense over, so it [3:01:46] is not before the body. [3:01:49] Next bill before us is on the [3:01:51] same page, senate bill 405. [3:01:54] It is an act relating to zoning [3:01:56] for wireless communication [3:01:56] infrastructure. [3:01:57] The governor's recommendation [3:01:59] has been distributed, is [3:02:01] available online, and sb 405 is [3:02:02] before the body. [3:03:00] It is an act relating to [3:03:03] trespass, unmanned aircraft [3:03:04] systems, penalty. [3:03:07] The governor had four [3:03:08] recommendations. [3:03:12] The senate rejected amendments [3:03:15] one and two, so the only two [3:03:16] amendments -- recommendations by [3:03:20] the governor are three and four. [3:03:22] Those have been distributed, [3:03:23] available online, and the [3:03:24] governor's recommendations three [3:03:27] and four to sb 526 are before [3:03:28] the body. [3:04:32] >> this is identical to house [3:04:34] bill 919, we heard a little [3:04:37] while ago, and this has [3:04:38] technical amendments. [3:04:39] Also moves back by one year the [3:04:41] passport program. [3:04:45] I would ask that we would [3:04:45] support the governor's [3:04:45] substitute. [3:05:49] It passed this body unanimously [3:05:52] and the governor had added an [3:05:53] emergency clause. [3:05:55] I would ask us to support the [3:05:56] governor's amendment. [3:08:58] >> Mr. Speaker, the original [3:09:00] bill was, the intent of it was [3:09:03] to have the department of [3:09:05] elections compare lists -- or [3:09:07] virginia voter lists with those [3:09:09] of other states and identify [3:09:11] people who are registered in [3:09:14] other states and then provide [3:09:15] that information to local [3:09:17] registrars so that they can [3:09:20] follow up on it. [3:09:25] The governor's amendments [3:09:30] basically gut the bill, we [3:09:31] mofrgt requirement -- removing [3:09:34] the requirement that the lists [3:09:36] be provided, those registered in [3:09:38] multiple states be, be provided [3:09:40] to the local registrars and I [3:09:42] hope we reject the governor's [3:09:42] amendment. [3:09:45] >> the delegate from fairfax, [3:09:46] delegate silks. [3:09:48] >> I rise to speak to the [3:09:48] governor's amendment. [3:09:49] >> delegate has the floor. [3:09:50] >> thank you, Mr. Speaker. [3:09:52] You might recall the photo [3:09:54] registration list is one thing [3:09:55] that the state does for our [3:09:57] registrars and for our elections [3:10:00] system that we pay for, and the [3:10:01] fact of the matter is, we [3:10:02] already do this. [3:10:04] There are several programs that [3:10:06] maintain our list and to provide [3:10:10] a list and assume that our -- [3:10:11] give another responsibility to [3:10:13] our registrars is something the [3:10:16] governor doesn't agree with and [3:10:19] I hope you will accept the [3:10:20] governor's amendment because [3:10:22] this is not necessary and the [3:10:25] department of elections already [3:10:27] tracks duplicate registrations [3:10:29] across jurisdictional boundaries [3:10:30] and provides all that [3:10:30] information for general [3:10:31] registrars for their purposes, [3:10:33] so I hope you will sment the [3:10:34] governor's recommendation. [3:10:38] Thank you. [3:10:38] >> shall the governor's [3:10:44] recommendation be agreed to. [3:10:48] Clerk will close the roll. [3:10:50] >> ayes 48, nos 49. [3:10:53] >> ayes 48, nos 49. [3:10:55] the governor's recommendation is [3:11:01] rejected. [3:11:05] >> Mr. Speaker, turning to page [3:11:09] 32 of the printed calendar, [3:11:11] senate bill 844 has not been [3:11:15] communicated from the senate, so [3:11:17] it is not before the body. [3:11:22] The next bill before us is [3:11:25] senate bill 856. [3:11:28] It is an act relating to mass [3:11:32] transit in the commonwealth. [3:11:33] Like the house bills a little [3:11:35] bit ago, the governor's [3:11:36] recommendations, there are a [3:11:39] number of them, they have been [3:11:40] distributed, available online [3:11:43] and the governor -- excuse me, [3:11:45] the senate adopted them all in [3:11:46] one block and communicated them [3:11:48] all, so all of those amendments [3:11:49] are before the body. [3:11:51] >> delegate from fairfax, [3:11:52] delegate hugo. [3:11:53] >> Mr. Speaker, I rise to speak [3:11:54] for the governor's [3:11:55] recommendations. [3:11:56] >> delegate has the floor. [3:11:58] >> Mr. Speaker, and the clerk [3:12:00] can -- I'd like to move that we [3:12:02] break this from the block like [3:12:04] we did with the house, so make [3:12:07] the recommendation for the first [3:12:12] block, 1, 2, 3, 56, 9, 10, 11, [3:12:17] 12, 13, 14, 15, 18, 19, 20, 21, [3:12:19] and 23. [3:12:21] >> okay, we're going to take [3:12:22] that first. [3:12:23] Delegate sullivan, if you want [3:12:26] to talk to the technical [3:12:28] amendment or are you waiting [3:12:28] for -- [3:12:30] >> speaking to those amendments? [3:12:31] >> yes, sir, delegate has the [3:12:32] floor. [3:12:33] >> maybe I'll address the [3:12:36] speaker, but ask the delegate [3:12:39] from fairfax, I was wondering [3:12:41] why we wouldn't include 24 and [3:12:43] 22 since ultimately while we [3:12:44] voted on them separately, we [3:12:45] ended up passing those [3:12:46] amendments. [3:12:47] >> will the delegate yield for a [3:12:48] question? [3:12:50] >> I'd be happy to yield for a [3:12:50] question. [3:12:51] >> delegate yields. [3:12:52] >> notify problem. [3:12:56] They were truly -- notify I have [3:12:57] no problem. [3:12:59] They truly weren't technical. [3:13:01] It's going to take 20 seconds to [3:13:02] explain them again, but they're [3:13:03] not technical. [3:13:04] >> I was looking to save time, [3:13:05] but I've already used too much. [3:13:07] However the delegate wants to do [3:13:07] it. [3:13:08] >> so we are going to do the [3:13:11] same thing we did last time and [3:13:13] that is one through three, 5 and [3:13:16] 6, 9 through 15, 18 through 21, [3:13:16] and 23. [3:13:19] Those were all technical. [3:13:21] So shall the governor's [3:13:23] recommendation of those [3:13:25] previously just mentioned block [3:13:32] of recommendations be agreed to. [3:13:36] The clerk will close the roll. [3:13:39] >> ayes 98, nos 0. [3:13:41] >> ayes 98, nos 0. [3:13:43] Those recommendations are [3:13:44] adopted. [3:13:46] The delegate from fairfax, [3:13:47] delegate hugo. [3:13:48] >> Mr. Speaker, also as we did [3:13:52] on the house bill, I would ask [3:13:55] that we include amendments 7, 8, [3:13:56] 16 and 17 in a block, and with [3:13:58] that, I make a motion that we [3:13:59] pass by those amendments. [3:14:02] >> the motion is to pass by 7 [3:14:06] and 8, 16 and 17. [3:14:07] Two minutes on each side if [3:14:09] anybody wants to discuss that. [3:14:10] The delegate from fairfax, [3:14:11] delegate sullivan. [3:14:12] >> thank you, Mr. Speaker. [3:14:13] Speaking to the motion. [3:14:14] >> delegate has the floor. [3:14:16] >> thank you, Mr. Speaker. [3:14:17] Ladies and gentlemen of the [3:14:20] house, I would urge you to vote [3:14:22] against passing by these [3:14:22] amendments. [3:14:25] Let's have a vote on these [3:14:25] amendments. [3:14:26] This has -- [3:14:27] >> Mr. Speaker. [3:14:29] >> delegate from shenandoah, [3:14:29] delegate gilbert. [3:14:31] >> will the delegate yield for a [3:14:31] question? [3:14:32] >> I yield. [3:14:34] >> Mr. Speaker, I'm certain that [3:14:36] I observed the gentleman earlier [3:14:38] join his colleague who made the [3:14:39] motion to pass by these [3:14:40] amendments in voting to do the [3:14:41] very thing he's asking us not to [3:14:43] do at this time. [3:14:46] I would ask him why he chose to [3:14:48] support the motion to pass by [3:14:49] earlier as well as the entirety [3:14:51] of his caucus and why he is now [3:14:53] asking us and in fact urging us [3:14:56] to do the opposite. [3:14:57] >> Mr. Speaker, I would answer [3:14:59] the delegate, this is a [3:15:00] different bill. [3:15:01] We now have different [3:15:02] information, different actions [3:15:03] from the other body down the [3:15:05] hall, and we ought to respond to [3:15:06] that body with a vote of our [3:15:07] own. [3:15:08] >> Mr. Speaker -- [3:15:10] >> delegate from shenandoah, [3:15:11] delegate gilbert. [3:15:12] >> will the delegate yield for [3:15:13] another question? [3:15:14] >> will the delegate yield for a [3:15:15] question. [3:15:15] >> I will. [3:15:17] >> I would ask the delegate to [3:15:18] tell the body even one word that [3:15:19] is different from the house [3:15:24] bill. [3:15:25] >> Mr. Speaker, I would answer [3:15:27] the amendments are the same, but [3:15:29] the bill number is different, [3:15:30] the sponsor is different, it's a [3:15:32] different bill. [3:15:34] And we need to vote on a [3:15:36] different bill than the one we [3:15:37] voted on just a couple hours [3:15:38] ago. [3:15:39] >> Mr. Speaker, will the [3:15:40] delegate yield for another [3:15:40] question. [3:15:42] >> I think we have time for one [3:15:42] more question. [3:15:44] Will the delegate yield for twon [3:15:45] more question. [3:15:45] >> I yield. [3:15:49] >> will the delegate give us any [3:15:51] reason of substance as to why we [3:15:52] should do the opposite of what [3:15:55] he encouraged us to do earlier? [3:15:57] >> Mr. Speaker, I would answer [3:15:58] that that's precisely what I [3:16:01] want to do is have a substantive [3:16:03] debate on this floor about these [3:16:06] amendments that the governor has [3:16:07] proposed, which I believe are [3:16:09] good amendments and this body [3:16:11] ought to consider. [3:16:14] >> okay, the two minutes is up, [3:16:18] so the motion is to pass by 7, [3:16:21] 8, and 16 and 17 -- [3:16:22] >> Mr. Speaker. [3:16:24] >> delegate toscano. [3:16:28] >> is it not -- parliamentary [3:16:28] inquiry. [3:16:29] >> delegate May state it. [3:16:31] >> is it not true that the two [3:16:33] minutes to each side is reserved [3:16:35] to each side and when one side [3:16:37] sucks up the entire two minutes [3:16:39] of the other side, it is not [3:16:40] really two minutes. [3:16:41] >> you're technically right. [3:16:42] I would say the delegate is [3:16:44] right, so if you would like to [3:16:45] speak for 49 seconds, it's all [3:16:46] yours. [3:16:49] >> thank you, Mr. Speaker. [3:16:50] >> delegate sullivan. [3:16:51] >> thank you, Mr. Speaker. [3:16:53] These particular amendments add [3:16:54] two taxes to the bill. [3:16:56] They come up with a new way of [3:16:58] funding over $35 million which [3:17:00] absent these amendments will [3:17:02] come out of the northern [3:17:03] virginia transportation [3:17:04] authority. [3:17:05] This bill has not been [3:17:06] controversial until we started [3:17:08] talking about the funding. [3:17:10] It has become very controversial [3:17:13] because it takes money out of [3:17:15] nvta and out of local road [3:17:16] projects and I don't understand [3:17:18] why any delegate in this [3:17:20] chamber, whether they are in the [3:17:22] metro jurisdictions or not, [3:17:24] would be against these metro [3:17:25] funding sources because what [3:17:28] it's going to do is drive [3:17:29] northern virginia transportation [3:17:31] projects into the smart scale [3:17:33] system, competing with other [3:17:36] projects around the state for [3:17:36] money. [3:17:38] This is a way to tax two small [3:17:40] taxes on northern virginians, [3:17:41] northern else in virginia. [3:17:43] This is a way to -- and by the [3:17:44] way, localities are all in favor [3:17:45] of this. [3:17:46] All of the localities are in [3:17:49] favor of this because what the [3:17:51] passed bill, the conference [3:17:52] committee report does is take [3:17:54] local money out of their system [3:17:56] and will require them to raise [3:17:58] taxes on their own citizens to [3:17:59] do local road projects. [3:18:02] And none of us want to do that. [3:18:03] So Mr. Speaker, we should not [3:18:04] pass this by. [3:18:08] We should have a substantive [3:18:09] debate on these amendments. [3:18:10] >> delegate from shenandoah, [3:18:11] delegate gilbert. [3:18:12] >> speaking to the motion, [3:18:13] Mr. Speaker. [3:18:14] >> delegate has the floor. [3:18:15] >> well, the gentleman said he [3:18:16] doesn't understand why. [3:18:18] I tell you what I continue to [3:18:19] not understand is why there's [3:18:20] been a sudden change of heart [3:18:22] from the entirety, apparently, [3:18:24] of our colleagues across the [3:18:26] aisle on this issue. [3:18:29] I mean, if the gentleman felt so [3:18:31] strongly about it, about having [3:18:32] this vote -- [3:18:34] >> Mr. Speaker. [3:18:36] >> I would say that time is up. [3:18:37] Let's go to the vote. [3:18:38] I think the delegate has made [3:18:39] his point. [3:18:43] >> thank you, Mr. Speaker. [3:18:48] >> is the motion once again, [3:18:50] don't forget if you're tracking [3:18:53] at home, we're doing 7 and 8 and [3:18:53] 16 and 17. [3:18:55] All those in favor of passing by [3:18:58] the recommendations 7, 8, and 16 [3:19:01] and 17, signify by saying aye. [3:19:01] [Ayes expressed] [3:19:04] >> those opposed no. [3:19:05] [Nos expressed] [3:19:09] >> the chair is in doubt. [3:19:10] Shall -- ayes and nays are [3:19:11] called for. [3:19:15] Shall the recommendation of the [3:19:17] governor on amendments 7 and 8 [3:19:20] and 16 and 17 be agreed to -- be [3:19:21] passed by, excuse me, be passed [3:19:30] by. [3:19:33] The clerk will close the roll. [3:19:35] >> ayes 50, nos 48. [3:19:37] >> ayes 50, nos 48. [3:19:39] Those four recommendations are [3:19:40] passed by. [3:19:41] Delegate from fairfax, delegate [3:19:44] hugo. [3:19:47] >> Mr. Speaker, going -- [3:19:47] addressing amendment 4. [3:19:48] >> delegate has the floor. [3:19:50] >> Mr. Speaker, I think we spoke [3:19:51] about this earlier. [3:19:52] Again, we've made an effort to [3:19:54] keep the operating costs under [3:19:55] that 3% cap. [3:19:56] We don't want to create an [3:19:57] exception to this cap. [3:20:00] I would urge our colleagues to [3:20:03] vote no on the exception to a 3% [3:20:06] cost cap that will keep the [3:20:07] money in there and keep the [3:20:09] costs from escalating out of [3:20:09] control. [3:20:11] Vote no. [3:20:13] >> Mr. Speaker. [3:20:15] >> yes, delegate sullivan. [3:20:16] Delegate from fairfax. [3:20:17] >> speaking to the amendment. [3:20:19] >> delegate has the floor. [3:20:22] >> apologize, Mr. Speaker. [3:20:23] Suddenly my speak button is for [3:20:24] the working. [3:20:26] We did talk about this a couple [3:20:26] hours ago. [3:20:28] One thing I didn't say and I [3:20:30] urge you to take into [3:20:31] consideration, there are already [3:20:33] several exceptions to this cap. [3:20:34] This is simply one additional [3:20:36] small exception that the [3:20:37] governor is suggesting because [3:20:39] of the importance of the office [3:20:41] of the inspector general, which [3:20:45] we should all want to be sure is [3:20:46] robustly funded to watch how [3:20:48] it's spending our money. [3:20:50] This is not one we should [3:20:51] reject. [3:20:55] We should pass this amendment. [3:20:56] >> all right. [3:20:58] The recommendation we're voting [3:20:59] on is number four. [3:21:00] Shall the governor's [3:21:01] recommendation number four be [3:21:08] agreed to. [3:21:12] The clerk will close the roll. [3:21:14] >> ayes 48, nos 50. [3:21:17] >> ayes 48, nos 50. [3:21:18] Recommendation number four is [3:21:19] rejected. [3:21:21] The delegate from fairfax, [3:21:25] delegate hugo. [3:21:25] >> Mr. Speaker, addressing -- [3:21:28] rise to address amend number 22. [3:21:29] -- amendment number 22. [3:21:31] >> delegate has the floor. [3:21:33] >> Mr. Speaker, amendment number [3:21:34] 22 is a strengthening amendment. [3:21:36] One of the things we talked [3:21:38] about is making it easier, [3:21:39] making sure that the reforms are [3:21:40] in this bill. [3:21:42] This is a recommendation from [3:21:43] the governor and just wanted to [3:21:44] explain it again. [3:21:45] It's not technical. [3:21:47] That's why we pulled it out of [3:21:48] the block, but I hope it would [3:21:50] be the will of the body to adopt [3:21:52] this recommendation from the [3:21:53] governor as we did in the [3:21:55] previous house bill. [3:21:56] >> okay. [3:21:59] All those in favor of the [3:22:00] governor's recommendation -- [3:22:01] shall the governor's [3:22:06] recommendation be agreed to. [3:22:11] The clerk will close the roll. [3:22:13] >> ayes 98, nos 0. [3:22:15] >> ayes 98, nos 0. [3:22:16] The recommendation is agreed to. [3:22:18] Delegate from fairfax, delegate [3:22:18] hugo. [3:22:21] >> Mr. Speaker, lastly, I rise [3:22:22] to address amendment number 24. [3:22:24] >> delegate has the floor on [3:22:26] amendment 24. [3:22:28] >> Mr. Speaker, in the house [3:22:29] version, we have split this. [3:22:30] I don't think we need to do this [3:22:34] at this point. [3:22:34] Both passed. [3:22:34] There was some questions about [3:22:35] whether we had -- how this would [3:22:36] be done. [3:22:38] I think those questions were [3:22:38] resolved. [3:22:39] I would ask the body, both [3:22:41] sides, to adopt the [3:22:42] recommendations from the [3:22:44] governor on amendment number 24. [3:22:49] >> shall the governor's [3:22:49] recommendation on amendment 24, [3:22:53] recommendation 24 be agreed to. [3:22:58] The clerk will close the roll. [3:23:01] >> ayes 97, nos one. [3:23:03] >> ayes 97, nos one. [3:23:04] The recommendation 24 is agreed [3:23:09] to. [3:23:13] >> Mr. Speaker, that takes care [3:23:19] of everything on senate bill [3:23:20] 856. [3:23:24] Therefore, turning ahead to page [3:23:27] 36 of the house printed [3:23:30] calendar, the next bill before [3:23:32] us is senate bill 902. [3:23:34] It is an act relating to [3:23:35] property tax, exemption for [3:23:37] solar energy equipment and [3:23:37] facilities. [3:23:39] The governor's recommendations [3:23:40] have been distributed, available [3:23:41] online and they are before the [3:23:42] body. [3:23:44] >> the delegate from fairfax, [3:23:45] delegate keen. [3:23:46] >> thank you, Mr. Speaker. [3:23:48] Speaking to the governor's [3:23:48] recommendation. [3:23:49] >> delegate has the floor. [3:23:50] >> thank you, Mr. Speaker. [3:23:52] Ladies and gentlemen of the [3:23:53] house, senate bill 902 [3:23:55] originally can't the 150 [3:23:56] megawatts the existing property [3:23:58] tax exemption already available [3:24:00] for projects that are five [3:24:00] megawatts. [3:24:03] The governor's amendment would [3:24:04] allow for certain large size [3:24:05] companies to continue to take [3:24:07] advantage of this existing law [3:24:08] up until July as long as they [3:24:09] file by July, and the reason [3:24:12] behind that is that there's some [3:24:13] companies that have already [3:24:14] announced they're going to be [3:24:16] investing here, but if they were [3:24:17] to be cut out from July, they [3:24:19] would not be able to invest. [3:24:22] I ask that the governor's [3:24:23] amendments be adopted. [3:24:24] >> delegate from spotsylvania, [3:24:25] delegate cole. [3:24:27] >> speaking to the governor's [3:24:27] amendment. [3:24:28] >> delegate has the floor. [3:24:29] >> I would hope that we would [3:24:31] not accept the governor's [3:24:32] amendment to this legislation. [3:24:35] The project that the gentleman [3:24:39] is speaking of is in [3:24:40] spotsylvania county and this [3:24:42] would basically -- the effect of [3:24:45] this amendment would exempt from [3:24:48] one project from the provisions [3:24:50] of the law and that's something [3:24:56] I think is a poor practice, plus [3:25:00] given the state of that project [3:25:01] and that application, the [3:25:03] applicants May actually wish [3:25:06] they had this as leverage as [3:25:08] they go forward. [3:25:10] Otherwise, you know, I'm [3:25:13] concerned that if you do adopt, [3:25:16] this it could have the opposite [3:25:19] effect that what the gentleman [3:25:20] is wanting to get. [3:25:22] So I hope that we would vote no [3:25:23] and reject the governor's [3:25:24] amendment. [3:25:25] >> the delegate from fairfax, [3:25:33] delegate sullivan. [3:25:35] >> Mr. Speaker. [3:25:39] >> delegate from fairfax, [3:25:40] delegate sickles. [3:25:41] >> would the delegate from solve [3:25:44] yield for a question many. [3:25:45] >> will the gentlemen yield for [3:25:46] a question? [3:25:47] >> I yield. [3:25:50] >> I'd ask the gentleman effect [3:25:52] tell us more detail about this [3:25:52] project in spotsylvania. [3:25:54] If it's something I've heard b [3:25:55] it's a major, major economic [3:25:56] development project in virginia. [3:25:58] Is that the project we're [3:25:59] talking about? [3:26:03] >> Mr. Speaker, I would answer [3:26:05] yes, the applicant has applied. [3:26:06] My understanding, it would be [3:26:08] the largest -- if it were [3:26:10] approved, it would be the [3:26:13] largest solar project on the [3:26:16] east coast and it has become [3:26:18] quite controversial in [3:26:19] spotsylvania, and to be honest [3:26:21] with you, I'm not -- the [3:26:23] application has just been made [3:26:25] and is under technical review, [3:26:28] has not even gone before the [3:26:29] planning commission or the board [3:26:31] of supervisors, so I think it's [3:26:32] premature to assume that this [3:26:33] project is going to get off the [3:26:37] ground. [3:26:40] >> thank you, Mr. Speaker. [3:26:41] >> shall the governor's [3:26:50] recommendation be agreed to. [3:26:54] Clerk will close the roll. [3:26:56] >> ayes 48, nos 50. [3:26:57] >> ayes 48, nos 50. [3:26:58] The governor's recommendation is [3:27:05] rejected. [3:27:07] >> Mr. Speaker, senate bill -- [3:27:10] page 37 on today's printed [3:27:11] calendar, senate bill 934 and [3:27:13] 935, those have not been [3:27:17] communicated, they are not [3:27:17] before the body. [3:27:18] So the final measure that has [3:27:21] been communicated before us will [3:27:25] be on page 38, senate bill 942. [3:27:29] It is an act relating to state [3:27:31] sales and use tax, historic [3:27:31] triangle. [3:27:33] The governor's recommendations [3:27:34] have been distributed, they're [3:27:35] available online, and they are [3:27:35] before the body. [3:27:37] >> the delegate from [3:27:38] charlottesville, delegate [3:27:38] toscano. [3:27:40] >> thank you, Mr. Speaker. [3:27:42] There are a number of -- [3:27:43] speaking to the recommendations. [3:27:47] >> delegate has the floor. [3:27:49] >> Mr. Speaker, ladies and [3:27:49] gentlemen of the house, there [3:27:51] are a number of recommendations [3:27:53] and I hope we can take them all [3:27:54] as a block. [3:27:56] >> delegate has the floor. [3:27:58] >> thank you, Mr. Speaker. [3:27:59] Ladies and gentlemen of the [3:28:01] house, this bill related to [3:28:03] imposing some taxes in the [3:28:04] historic triangle of virginia, [3:28:06] of williamsburg, directing half [3:28:08] the revenue to market tourism in [3:28:09] the area. [3:28:11] Along the way, the governor made [3:28:13] some recommendations, the [3:28:14] primary recommendations of which [3:28:16] are that substantive involve [3:28:20] taking -- removing the increase [3:28:21] in the sales tax on food that [3:28:25] was previously in the bill, and [3:28:27] removing the enrolled bill's [3:28:30] repeal of the existing $2 per [3:28:33] night transient occupancy tax in [3:28:35] the historic triangle. [3:28:37] And I believe the senate has [3:28:38] agreed with the recommendations, [3:28:40] the senate approved them, and I [3:28:41] hope it would be the pleasure of [3:28:42] the body to approve the [3:28:45] governor's recommendations. [3:28:47] >> shall the governor's [3:28:56] recommendations be agreed to. [3:29:00] The clerk will close the roll. [3:29:03] >> ayes 70, nos 26. [3:29:05] >> ayes 70, nos 26. [3:29:07] The governor's recommendations [3:29:15] are agreed to. [3:29:18] >> Mr. Speaker, senate bill 964 [3:29:21] on page 39 and on page 40, [3:29:24] senate bill 972 have not been [3:29:27] communicated from the senate. [3:29:31] So the last bill, senator [3:29:33] norment's senate bill 942 is the [3:29:34] last bill before the body on [3:29:50] today's calendar. [3:29:58] >> per house rule 51, the house [3:29:59] has returned to the morning [3:29:59] hour. [3:30:02] The delegate from shenandoah, [3:30:03] delegate gilbert, will notify [3:30:05] the senate that the house has [3:30:07] completed its business and is [3:30:10] ready to adjourn sine die. [3:30:26] The house will be at ease. [3:45:39] [Gavel banging] [3:45:42] House will come to order. [3:45:44] Delegate in powhatan, delegate [3:45:49] ware. [3:45:50] Delegate has the floor. [3:45:52] >> Mr. Speaker, I have a motion. [3:45:53] >> delegate has the floor. [3:45:56] >> having voted on the [3:45:57] prevailing side by which we [3:45:59] failed to adopt the governor's [3:46:01] amendments to senate bill 902, I [3:46:02] move that we reconsider that [3:46:04] vote. [3:46:05] >> delegate ware moves that [3:46:07] having voted on the prevailing [3:46:08] side by which the house defeated [3:46:11] the governor's recommendation on [3:46:13] sb 902, the house reconsider [3:46:13] that vote. [3:46:15] All those in favor of that [3:46:18] motion signify by saying aye. [3:46:21] Those opposed no. [3:46:23] That motion is reconsidered and [3:46:24] that recommendation is back in [3:46:25] front of us. [3:46:26] The delegate from fairfax, [3:46:27] delegate hugo. [3:46:29] >> Mr. Speaker, I rise to speak [3:46:30] to the motion. [3:46:31] >> delegate has the floor. [3:46:33] >> Mr. Speaker, senate bill 902 [3:46:36] has passed the house and senate, [3:46:38] limits the property tax [3:46:39] exemption for solar projects to [3:46:41] greater than 20 megawatts and [3:46:42] less than 150. [3:46:44] The governor's amendments to [3:46:46] senate bill 902 simply [3:46:48] grandfather in large-scale [3:46:51] projects that already have an [3:46:52] interconnection agreement with [3:46:56] pjm in place prior to June 30th, [3:46:56] 2018. [3:46:57] This amendment will preserve [3:47:00] over $1.5 billion in solar [3:47:02] investments that are in the [3:47:05] pipeline and that will be [3:47:05] deployed in the commonwealth. [3:47:05] 1.5 billion. [3:47:07] I ask that the house accept the [3:47:10] governor's amendment. [3:47:11] >> shall the governor's [3:47:18] recommendation be agreed to. [3:47:24] the clerk will close the roll. [3:47:27] >> ayes 83, nos 13, abstentions [3:47:27] one. [3:47:28] >> ayes 83, nos 13, abstentions [3:47:30] one. [3:47:31] The governor's recommendation is [3:47:34] agreed to. [3:47:36] And if delegate gilbert will [3:47:51] communicate to the senate. [3:51:32] [Gavel banging] [3:51:34] >> does the clerk have any [3:51:35] additional announcement many or [3:51:37] communications?
