My wife and I are [11:11] requesting approximately 4 acres [11:14] of our 83-acre property to be rezoned [11:16] from R1 [11:18] residential to A1. Our goal is simple. [11:21] We want to use a small portion of our [11:23] property as a hobby farm [11:25] for our family while preserving the [11:27] natural rural character of the land. The [11:30] Homeowners Association publicly claimed [11:33] that our property was subject to the HOA [11:34] restrictions and stated that its [11:36] attorney had prepared an opinion [11:38] supporting that position. [11:40] We respectfully requested a copy of that [11:43] opinion so that we could better [11:45] understand their position. [11:47] But our request was denied. [11:50] Because of the conflicting information, [11:51] we sought legal counsel [11:53] to better understand the issues [11:55] surrounding our property. My request this evening is [12:30] simply for the rezoning [12:32] of 4 acres based on the merits of the [12:33] application. [12:50] Much of the land surrounding is already [12:52] zoned A1, [12:54] making this request consistent with the [12:56] nearby land uses. [12:58] This is not a request for agricultural a [13:00] commercial agriculture, [13:02] a livestock operation, [13:05] or an intensive use of the property. [13:09] We simply want a small hobby farm [13:12] with a limited number of animals for our [13:14] families' enjoyment. [13:16] The animals will remain in a fenced area [13:20] on our property. The land where the [13:22] animals will graze [13:23] is simply approximately 200 ft from the [13:26] nearest neighboring property line. [13:28] We intentionally chose that location [13:31] because [13:33] it's closest to our residence, [13:36] minimizes additional land disturbance, [13:39] makes our daily care practical. [13:42] This request will not increase [13:44] residential density. [13:46] It will not create significant traffic. [13:50] It will not require additional public [13:53] infrastructure. [13:54] Instead, it will preserve open space [13:57] and maintain the rural character that [14:01] drew us to Walton County. [14:04] We've worked diligently to comply with [14:06] the county's requirements throughout [14:08] this process. [14:09] We've made every effort to be respectful [14:12] of both our neighbors [14:14] and the county. [14:16] I understand that change can sometimes [14:19] create concern. [14:21] I simply ask this application be [14:23] considered based on the facts before you [14:26] and the planning merits of the rezoning [14:28] request. [14:29] We believe this is an appropriate, [14:31] low-impact [14:33] agricultural use that is compatible with [14:36] the surrounding area and consistent with [14:38] Walton County's [14:40] rural heritage. [20:05] The reason says, quote, [20:08] "To allow appropriate tax classification [20:11] for the structure [20:13] and to permit raising farm animals on [20:15] the property." [20:16] End quote. [20:19] A little bit about that structure. [20:22] It's already built. [20:25] It's quite large and it's far out of [20:27] character in the neighborhood. [20:30] And it was built despite much opposition [20:33] from the neighbors. [20:39] If the owner didn't understand the tax [20:41] implications of building his structure, [20:43] that's on him. [20:46] And if he didn't understand the [20:47] livestock restrictions on his property, [20:50] that's on him, too. [20:53] So, now he's trying to turn his problems [20:56] into our problems. [20:59] So, even if he promises only to do [21:02] one, two, and three with the property [21:04] today, there's nothing to stop him or [21:07] the next owner in the future [21:10] from doing five, six, and seven, [21:12] eight, nine, and 10. [21:14] For example, [21:16] put a cell phone tower up. [21:20] Put some electrical lines through the [21:21] neighborhood. [21:24] Or open a Airbnb. [22:11] Um we as a community respectfully ask [22:14] that you deny this request to rezone [22:16] these four acres of the property from R1 [22:18] to A1. [22:20] Um this is not about opposing anyone's [22:22] desire to own farm animals or have a [22:24] hobby farm. We respect private property [22:27] rights. [22:28] Um [22:29] we also understand that the county has [22:31] the authority to approve this request if [22:32] it determines it is appropriate. [22:34] However, with that authority comes the [22:37] responsibility to consider whether the [22:38] proposed zoning is compatible with the [22:41] surrounding area, serves the public [22:43] interest, and will benefit not only the [22:45] applicant, but the surrounding [22:47] community. [22:48] Tonight's decision will affect far more [22:50] than one property owner. [22:52] So, I do have a picture here. Um it's an [22:55] aerial photograph from Google Maps. Um [22:57] and it shows why this request is [22:59] different. I probably should have given [23:00] it to you beforehand, but it shows that [23:02] there's only one entrance. There's only [23:04] one way to access this property. [23:07] And so while there are agricultural [23:08] properties, I know he said there are [23:10] many agricultural properties surrounding [23:12] the area, those are not accessed through [23:14] Alcove Bluffs. [23:15] Um they're accessed from outside roads. [23:19] So any future use of this property will [23:22] directly affect the families who live [23:23] there every day. [23:25] There are more than 160 families [23:27] invested in Alcove Bluffs because it is [23:29] an established residential community. [23:32] The application states that the purpose [23:34] of this rezoning is to allow a [23:35] residence, pasture, a barn with animal [23:37] stalls, and an orchard and garden for [23:39] personal use. It sounds harmless and we [23:42] respect those intentions. However, A1 [23:45] zoning stays with the land, not the [23:47] owner. [23:48] Today's proposal may be for personal [23:50] use, but your decision will affect every [23:52] future owner of this property. [23:55] So in the rezoning application, it also [23:57] says that um this property is not part [24:00] of a subdivision. [24:01] And we did have um a title search done. [24:04] I have that um certificate. I did submit [24:07] that to the county for y'all's um review [24:10] beforehand. [24:11] Um happy to give it to you also. Um and [24:15] and the entire community, but I did [24:18] send a message out to the community with [24:20] a summary of that that said exactly what [24:22] it was. So um [24:26] We've also been told by the county that [24:28] enforcing private covenants is [24:30] ultimately the responsibility of the HOA [24:32] and I completely understand that. Uh [24:34] we're not asking you to enforce our [24:36] covenants. [24:38] But we do not believe that lessens the [24:40] commission's responsibility to make its [24:42] recommendation based on complete and [24:44] accurate information. [24:46] So um [24:49] We simply ask that the commission [24:50] carefully consider all of the relevant [24:52] information before making a permanent [24:54] zoning recommendation. [24:56] While the Campbells did request approval [24:58] for the barndominium [25:00] from the HOA, they did not approach the [25:02] current board with their intentions [25:04] before requesting this rezoning. [25:06] We learned about it when you put the [25:08] signs up. [25:09] Um also, [25:12] many homeowners are concerned because of [25:14] what has already occurred on this [25:16] property. When the approval for the [25:17] barndominium was requested from the HOA [25:20] board, the written request stated that [25:21] the structure would be positioned so [25:23] that it would not be visible from the [25:25] street. [25:26] Today, the completed structure is [25:28] clearly visible from Brooks Trail. [25:31] Particularly during the winter months [25:33] when the trees have no leaves. [25:35] Because of that experience, many [25:36] homeowners are asking the commission to [25:38] carefully consider not only the [25:39] applicant's current intentions, but also [25:41] the long-term consequences of [25:43] permanently changing the zoning of this [25:44] property. [25:46] Through records obtained from Walton [25:47] County open records requests, [25:49] many open records requests, sorry. Uh [25:52] we were unable to identify another [25:54] barndominium approved on R-1 zoned [25:56] property. While every application should [25:59] be considered individually, this appears [26:01] to be an unusual situation that has [26:03] affected many homeowners in our [26:04] community. [26:06] Tonight's decision isn't about a [26:07] barndominium, but it's also not just [26:09] simply about 4 acres either. [26:12] It's about balancing the rights of one [26:13] property owner with the impact on an [26:15] established residential community. [26:18] We can't go back and change the [26:19] decisions that have already been made on [26:20] this property, [26:22] but the commission does have the [26:23] opportunity to shape what happens going [26:25] forward. We respectfully ask that you [26:27] preserve the residential character of [26:29] Alcove Bluffs by denying this rezoning [26:31] request. That means on 4 acres, [27:41] we can have up to eight of any one of [27:43] those. Also, multiple when it comes to [27:47] goats, sheep, etc., you can have up to [27:50] eight per acre. Now, what concerns us is [27:54] not necessarily what happens tomorrow, [27:56] but what happens next year because once [27:58] the zoning takes place, [28:01] these rules are in place forever. That [28:03] someone could take over this piece of [28:05] property and basically start not a hobby [28:08] farm, but a real farm. One thing to [28:10] note, if cattle's put on there, just [28:12] eight cows produce, [28:15] and I used Walton County Extension [28:18] Service University of Georgia to get [28:20] these numbers, but at 4,500 lb per [28:24] month, [28:25] four head of cattle produce 36,000 [28:28] lb of waste each and every month. [28:32] What's going to happen to that waste? [28:34] Where does it go? [28:35] Back through our neighborhood? [28:38] Or is Or is that property going to be [28:40] able to sustain that? [43:40] And obviously, if you guys are living in [43:41] houses there, the answer is yes because [43:44] you could never get title to a property [43:46] without a recorded plat. That's where [43:48] the final recorded plat [43:51] indicates every lot that's in that [43:53] neighborhood and has a ton of notes that [43:54] are required by the development [43:56] department. It also shows each and every [43:58] lot usually on a sidebar. [44:00] It will indicate each lot in that [44:01] neighborhood. [44:03] My second question to Christie was [44:07] was the partial or any portion of the [44:10] partial [44:11] that is the request has been made for [44:14] tonight. Was any of either of those [44:16] partials given a lot number? [44:19] And Christie's answer was no. [44:22] I actually have in front of me while [44:24] we're sitting here. [44:51] Neither of the partials, whether it be [44:53] the large partial they have or the [44:55] smaller partial which is being requested [44:57] tonight, neither of those pop up with a [44:59] subdivision name. [45:03] Um I just told you in what capacity I'm [45:06] viewing this. So the one I did not [45:07] mention and there's a fine lady sitting [45:09] out here with a blue dress on [45:11] uh [45:12] who would remind me quickly I'm not an [45:13] attorney. [45:15] Um [45:16] but after attending [45:19] hundreds and hundreds of closings [45:22] I will say there are certain things that [45:24] take place that we [45:26] adhere to and acknowledge. [45:29] And one of those is that as we have [45:32] clients who purchase in neighborhoods [45:34] that's tell us, "Hey, we would like to [45:36] have [45:37] a survey of our lot where we can install [45:41] a fence." Our reply is, "That's on a [45:44] final plat that's recorded for the [45:46] entirety of the neighborhood that shows [45:48] all of the lots and you can do so by [45:50] contacting a surveyor. [45:53] They will reference the final plat, find [45:55] your lot, find the dimensions, stake [45:57] your lot, build your fence, but you have [45:58] to go [46:00] and you have to find the final plat. It [46:01] shows every lot. If you're looking at a [46:04] 5-acre out parcel, obviously it's going [46:06] to only show that 5 acres. There's just [46:08] one parcel. But in subdivisions, they're [46:11] recorded as a [46:14] final plat recording. At that time, also [46:16] deemed necessary would be if there's [46:19] going to be HOA or covenants that those [46:21] HOA that that the covenants would be [46:23] recorded at the same time. [46:25] The covenants would be applicable only [46:28] to in most cases, the lots that are [46:31] referenced on the plat that's being [46:32] recorded. It would be frivolous for [46:36] someone to put a neighborhood next to my [46:37] house [46:39] and then the HOA of that neighborhood [46:42] want to impose [46:44] their covenants on me because I'm not [46:47] listed on the plat. [46:49] So, in asting asking Christie [46:53] if their lot or their property is shown [46:56] on the final recorded plat for the [46:57] neighborhood and the answer being no, [47:00] then the only assessment I can make, [47:03] not being an attorney, but just trying [47:05] to conceptually understand things, [47:08] is that there should not be any [47:09] adherence by them if they're not on that [47:12] final recorded plat. I mean, that's just [47:14] me trying to use common logic. [47:17] So, [47:18] I I take that and then I start looking [47:22] at other things. And some of those being [47:26] the question that I ask, [47:29] "Was your intent when you bought the [47:31] property to have animals?" [48:30] Uh about 4 years ago, there was a [48:31] request to rezone 142 acres at the [48:34] corner of 81 and Double Springs Road to [48:37] R1 for a neighborhood. How many of y'all [48:39] remember that by raising your hand? [48:42] How many of you were opposed to it? [48:46] One guy. Come on, y'all be honest with [48:47] me now. [48:58] I'm going to have people tonight who are [49:00] going to come to the podium as you guys [49:02] did, [49:03] and they're going to tell me why [49:07] I should really contemplate not allowing [49:09] the use of a subdivision on an [49:11] agricultural property [49:13] on the same night that I've got [49:15] someone who is wanting [49:18] to take a piece of property that's zoned [49:20] as a {quote} subdivision R1 and change [49:24] it to agricultural. [49:26] Secondly, the 142 acres after it was [49:29] zoned and it was zoned R1, [49:31] was then zoned back to A2. So, it [49:34] currently sits there as A2. [49:37] They can have the cattle. There's been [49:38] cattle there for years and some of you [49:40] guys was in support of the cattle and [49:41] not the houses. [49:43] The other thing I find most ironic [49:47] is with this property being zoned R1 [49:51] without anyone coming before us and [49:54] simply going before Christie and the [49:56] plan and the development department [49:59] that property can be further utilized [50:01] today [50:02] if deemed so [50:04] as a continuing portion of a [50:06] neighborhood with easily [50:08] at a minimum of 70 lots [50:11] which means you're going to have 70 more [50:13] families commuting through your [50:14] neighborhood. [50:16] Okay? You're going to have the traffic [50:18] from the development itself tracking mud [50:21] and concrete trucks. It's the only [50:23] access point. [50:24] And you're going to have all the [50:25] constructions of all the houses being [50:27] built for the next five or six years. [50:30] And for me to think that you had rather [50:32] be imposed by that [50:36] as opposed to four animals, eight [50:39] animals, whatever [50:41] on 84 [50:43] acres they own. I understand we're only [50:45] looking at four, but they have 84 acres [50:47] zoned R1. [50:49] Um [50:51] and if their future plans would be to to [50:53] alter that uh to A as well and I don't [50:56] know what their plans are, but I mean if [50:57] it was, it's much seems like it'd be [51:00] much less evasive [51:02] than 70 plus more families coming in out [51:04] of your neighborhood. That's just me. I [51:06] mean, that would be me. Doesn't mean it [51:08] coincides with everyone. [1:33:26] The property is just east of Fanny [1:33:28] Thompson Road and just west of Highway [1:33:30] 11 and has frontage on Nicholson [1:33:33] Nickelsville Road. [1:33:37] It is in the neighborhood residential [1:33:39] character area under the future land use [1:33:41] plan, which does allow for the requested [1:33:44] zoning of R1OSC. [1:33:48] Here's just the general stats of the [1:33:50] project. It's 103.56 [1:33:52] acres. We're proposing 57 homes, [1:33:56] uh 49.32 [1:33:58] acres of open space. Significant open [1:34:00] space on this property. [1:34:02] Uh we're proposing to combine this with [1:34:04] the Bison Landing development that was [1:34:06] approved last year. And so when we [1:34:08] combine those two together, they'll be [1:34:11] together 221.75 [1:34:13] acres. It'll be a total of 149 homes and [1:34:16] a total of 82 acres um of open space. [1:34:20] When you average all of that together, [1:34:22] it's about 1.5 acre um per home. [1:34:26] Here's the site plan with some some [1:34:28] notes made here. The thing that stands [1:34:30] out really from the site plan is all the [1:34:31] dark green, which is the open space. [1:34:34] Uh 49.3 acres. Um there's an amenity [1:34:36] lake within that, and we'll have a [1:34:39] pavilion and a walking trail um around [1:34:41] that lake. Uh we've got landscape strips [1:34:44] uh where the frontage is on Nickelsville [1:34:47] Road at the entrance and then at another [1:34:48] spot where where we um [1:34:50] um come back down to that road. Um and again, the R1OSC I favor [1:35:47] anyway because it allows the green space [1:35:49] to be um [1:35:51] contiguous together and then the lots to [1:35:53] be a more manageable size. [1:35:57] Um, the community design and amenities [1:35:58] again on this 103 acres, there's 48% [1:36:02] open space which is nearly two times the [1:36:04] requirement. Um, we'll have the two [1:36:06] entrances. It'll be governed by an HOA. [1:36:10] Um, and then again the amenities that I [1:36:11] mentioned before with the lake, the [1:36:12] walking trail, um, and um, the pavilion. [1:36:16] And then of course as standard in all of [1:36:17] our developments, um, sidewalks and [1:36:19] streetlights will be um, a part of this [1:36:22] as well. [1:36:23] The homes themselves, um, 1,800 square [1:36:26] feet is the ordinance requirement. We've had an actual engineer [1:47:05] look at this from a GDOT regulation [1:47:07] perspective and given us advice on the [1:47:10] things that we need to do to make those [1:47:11] improvements to make this a safe [1:47:13] development and we're going to do those. [1:47:15] Uh we've got the two entrances to help [1:47:17] the flow of traffic. [1:47:19] Um [1:47:21] and as far as GDOT, we can't control [1:47:23] what the state does, you can't control [1:47:24] what the state does. [1:47:25] We're happy to have a conversation with [1:47:27] GDOT about those two areas, but we're [1:47:29] doing all that we can do on our [1:47:30] development to make it as safe as [1:47:32] possible. [1:47:33] And when you look at the overall [1:47:34] traffic, you know, coming down Highway [1:47:36] 11, [1:47:37] um [1:47:38] our two developments combined are 149 [1:47:42] homes for both developments [1:47:45] would increase traffic less than 2% of [1:47:47] what's already coming there. So, we're [1:47:49] we're not [1:47:50] creating the problem here. We're doing [1:47:51] all we can on our side for what we can [1:47:54] control to make it as safe as possible.
