Virginia Supreme Court after that
[9:38] proposed agreement was submitted by Mr
con the court in fact
[9:46] Deni and resolve resolving the matter of
the time period fortition for rearing by
[9:54] the court is also expired
[9:59] if it hurt your ears

expired so so the matter of kic versus
[10:15] the town of Washington is in fact
resolved as a legal matter at this
[10:21] time um the agreement reing that that
was the matter in
[10:26] controversy um that
the proposed

compromise

[10:43] hear so my suggestion would be for
Council to consider just take some sort
[10:51] of action to get it off the agenda that
uh the Town Council declines
[10:59] take any action on proposed the settl
agreement proposed by Mr Con on the
[11:05] grounds that it's
[11:10] now any discussion it's my understanding
that all outstanding issues um time for
[11:17] appeal having passed without any um
subsequent notice to us the town
[11:23] of Courts picking up any of the appeals
the appeal time for the suprem cour
[11:29] having in my understanding pass um these
issues are now not only behind us but
[11:36] dead we go the time for appealing
decisions having run the decisions
[11:43] themselves haven't been entered so um
based on uh council's U report it would
[11:51] seem to be there's nothing to act on as
all outstanding litigation is now over
[11:56] so it would be nonsensical to entertain
any kind of a motion to accept a
[12:01] proposal to settle something that is no
longer alive so it all being mov I don't
[12:08] think any action this evening is
necessary and our minutes
[12:14] note report and I think we can simply
move on it's matter not behind
[12:22] us I don't believe do does anybody see
anything to the cont so
[12:30] he wanted us to settle and we he gave us
an offer and we responded and this would
[12:37] be
resp this is our
[12:43] response there's no
reason to settle anything it's my
[12:48] understanding because there's nothing to
settle is that
[12:51] correct is that okay there's nothing The
Settle so the proposed AG recites the
[12:59] the Supreme Court that would be
dismissed that's all behind everybody
[13:05] now because the Supreme Court fact
dismissed the appeal so well so at this
[13:11] point the town is going to take no
action no further no action
[13:16] on Mr con if there's no motion there's
no action so
[13:22] okay moving on to the next agenda item
[13:39] so the next agenda item is
a matter regarding potential zoning
[13:44] violations again
Mr um this is this is an issue that's
[13:51] been discussed in some
detail by Council after the last meeting
[14:00] took uh certain steps that uh in
relations to some of the matters that
[14:08] were
expressed those matters have not been
[14:12] resolved this time and
my feeling about the matter would be it
[14:18] would be appropriate for Council just to
pass over this and set over for the next
[14:24] meeting um to allow
[14:29] longer period of
time sufficient period of time
[14:33] for the current concerns of council to
be addressed in one fashion or another
[14:40] and you're addressing this in your
capacity as owning
[14:44] administrator I can
address statute that
[14:53] says okay so also on this one um
no action needs to be taken at this
[15:01] point no I think we would have to move
to hold it over to next month's
[15:05] agenda that correct this stay on the
agenda it's still on the
[15:13] agenda I would Town Council we table
this for this evening's discussion but
[15:18] it over to next month's
[15:25] agenda okay

right on to the uh public
