May be service district number five, the order, [0:13] 7 p.m. No, for [0:14] 9. Till 7.200, sat at 100 east, chairman of the town, Thursday, August 20th, 2026. [0:21] The story of business, roll call, chairman of the Lone Davis president, Robin. Here, Troy. [0:26] Here. Here. Yeah. Here. John. Here. Okay. This cave is going to be here. No. [0:31] You can be excused. [0:32] Yeah. [0:33] Okay. [0:34] Commissioner Yardley. [0:35] Here. [0:37] Okay. [0:38] We shall Secretary Kayleigh act in present. [0:40] Attorney Vaughn, Christianson, present. [0:42] Just to manage your might and else present. [0:46] Moving on, we'll go ahead to consent issues. [0:48] Finance reports. [0:48] Approval bill. [0:49] Be careful. [0:50] Approval minutes. [0:57] I'm moving. [0:57] We have approved those minutes. [1:03] I'll second. [1:08] Okay. [1:09] I had to approve that the city should present it. [1:11] Any other discussion? [1:13] Not all of the favor? [1:14] Aye. [1:15] Okay, a new business ratification is the award [1:20] of President Russell Ways Collection Contract [1:22] to elevate recycling and disposal services of Utah. [1:28] Draffler, the contract, should have gone up to you [1:31] in your packet. [1:32] If you can get a chance to review it [1:34] and you'll know it to the front of you as well. [1:37] The one I emailed to you guys did have some of the commercial stuff which you have taken [1:43] out. [1:44] Yeah, that's been where it was. [1:45] That's been where it was. [1:46] And so the copies you guys had in front of you will be the ones I gave you. [1:58] No franchise agreement. [2:02] They just promised to pick up the residential waste. [2:04] And we say, yeah, you're the ones to do. [2:09] Well, the ball is in their court, so we'll see how they do. [2:16] I haven't had a chance to read it, but this is a question. [2:20] Is this saying that we're in front of it? [2:22] He'll keep the cams in good condition and keep the lifts replaced. [2:28] That was in the RFP packet, and I think it's still in the contract. [2:36] There was one question that I had, and we talked to them guys that night. [2:41] They were still willing to go forward with the, you know, remember we did this out in the middle of all this we had a fire [2:48] Then we were at the contract and then we had a flood [2:51] And we lost accounts due to those and so I [2:56] Was curious as as if we needed something in that [3:01] contract [3:02] But laid that out that [3:05] Because it what it's not what they bid on is isn't what we have now [3:11] How big of a chip do you say no one knows if it's well Kaylee Kaylee got a [3:16] July's billing at $5,000 less for one month on our on our end over the rest of [3:23] I got you we figured it was probably close to 200 accounts right I mean I'm [3:29] thinking 300 there were 235 structures lost on the mountain but we lose all of the [3:38] But like my place is just a power meter and I get bailed on that, we lost all of those. [3:45] Yes. [3:46] We didn't know that. [3:47] Due to the power. [3:48] Agreed. [3:48] Even though nothing burnt down, we lost all the access and everything else, we lost all [3:55] that. [3:55] Is the contractor asking for an adjustment? [3:58] No. [3:58] He was aware of that during the, the, the, the night that we, the, we haven't been asking [4:05] that. [4:05] We didn't ask him that. [4:06] But he was I didn't know if something needed to be in the contract that [4:13] Well, I'm hate to hate to go ahead and adjust it all right, okay [4:19] And [4:22] I guess part of that is he he doesn't have a cost when he doesn't pick him up [4:27] Right, so [4:30] Now his total income changes, but his expense is expense also changes [4:43] And I guess he probably wants to know how long that's going to be. [4:48] There should be a balance. [4:50] You know what? [4:53] We talked to him. [4:54] We basically express that. [4:56] We don't know how long this is going to be. [4:58] These are going to be gone. [4:59] Some of these cannons may never come back. [5:03] But as soon as the power starts to come back on, [5:06] we'll start regaining it. [5:07] camels, like my place, the power will come back on, I just got aometer, I'll start paying [5:12] a 15 on the garbage being, yeah. [5:14] And anyone who has a cam or a service left will start paying a garbage being installed. [5:20] Yeah. [5:20] And come back. [5:21] But as soon as the package continues, there's going to be a bump. [5:25] So I just didn't know if there needed to be a long track, a baseline. [5:31] Reflecting a problem. [5:33] And I didn't know how to do it. [5:51] So Mr. Chairman, are we looking for an option at this time to go ahead and board the contract, [5:59] So I've got a few more questions to make sure I cover on my list because I've got a list [6:06] right here. [6:07] Oh. [6:08] The fuel surcharge, there was nothing in the contract for a fuel surcharge. [6:13] No. [6:14] To me, that's okay. [6:15] For us, that's good. [6:17] I just worry that he'll be back in two years asking for an adjustment on fuel surcharge or on the contract adjustment. [6:27] There's no, we get a color, we give a color raise to our employees, but they have the right to come in and use whatever means necessary, but we don't have to give it. [6:39] And I didn't know if we wanted to state that in the contract and say we don't even want you to ask for X amount of years on a fuel, on either a contract adjustment. [6:48] The fuel search, I don't know that we want it, but it isn't. [6:52] We know it on the residential. [6:53] I just worry that if we don't specifically state that we shouldn't have it, [6:59] we're not going to give it, then we are susceptible for them to come and ask for that. [7:07] But we didn't have it in our RFP. [7:10] Yeah, two years. [7:11] Just months. [7:13] Okay, why did that not make it? [7:15] They are locked in for years, right? [7:17] What was that? They're locked in for two years. Yeah. That's what our RFP is. [7:22] Well, if it's in the RFP, we probably out on the air then. I should say that in the contract. [7:27] Yeah, that was just nice. Not that I'm... Let's get it in. [7:30] Picking on here. Let's get it in. Oh, pick on. You're on a chance. [7:33] Yeah. [7:37] So [7:43] in the other question I have was on the 410. [7:52] So that video just says contract to do used to provide the district with three roll-offs [7:57] 4 times annually for the district to use the annual Milford might I drill and the Beaver [8:03] spring. [8:04] Clean up the project. [8:05] Similarly, similarly, contractor agrees to provide the district with three roll-offs, one [8:13] time annually and beaver, milk, or admiral for the Christmas season. [8:18] I just think it's important to state that they're going to do that free of charge. [8:24] What are these guys are new to this community? [8:28] I mean, I understand. [8:29] Yes. [8:31] Was that fair, Robin? [8:33] Because right now it's just as they will provide it, it doesn't say with or without [8:40] Spelled out so we've got anything out in front just so there's no question. Yeah, no question. Yeah, sure because the Christmas thing is really important [8:46] It is I agree and being part of a small community that's something they can do and I think they're happy to do it [8:52] I don't get me wrong. No, no, I understand what you're saying [8:57] And then the RFP packet, I guess, we missed stating that in black and white. [9:04] I mean, I guess we all just assumed that that was free, but then being new, they may not [9:12] have understood that. [9:14] Okay. [9:15] I think that's a simple fix. [9:16] I'm writing down right now. [9:17] This should be provided to no additional charge. [9:21] And that will, by the contract, that will take care of that. [9:25] Then the other one I had, and Kaylee took care of that question for me, so that was everything. [9:31] I read those things multiple times, and every time I read them, I found something different [9:36] than I had it quickly. [9:38] It's just stopped on that. [9:44] I guess the fuel surcharge, that's a question for the board of what do we need to do [9:51] the contract, or we just need to wait a bit, where they can ask for an increase for two [9:56] years. [9:57] They can't, and I would just strongly recommend that instead of a fuel surcharge we give [10:04] them with a rate increase. [10:05] Fuel surcharge is a massive amount. [10:08] I've talked to multiple agencies around, and there's a lot of garbage contractors, a lot [10:12] of people driving trucks that are doing that, or residential waste, they're not doing it [10:19] For the sheer fact that it's a pain in the butt for the billing entities to adjust that rate every single [10:26] I mean we'd have to call milk from city minor to the Rocky Mountain power everybody to reflect that each month [10:33] Of what that fuel surcharge would be and I I hate them prices [10:38] Actually, and then to get into the question of just milk or pay more of a fuel surcharge [10:42] The beaver does because they're not going as far and then it gets really [10:48] I think we probably should put in the contract on you, so if I'm wrong, fuel surcharges will [10:55] not be considered or something to that or maybe if fuel goes, I mean, 5 bucks to say [11:02] 5 bucks now, but if it goes to 10, how do we mitigate that? [11:09] But at that cost, I would be sympathetic to those guys to come and ask, but a rating [11:16] for a raise would be better than the fuel searchers. [11:21] But we can't do that for two years, so I guess anything's subject to change, right? [11:27] We can adjust. [11:29] The fuel went to $10 a gallon in the middle of next year. [11:34] I don't think there's anybody. [11:36] I mean it says in the contract they can't come into it but I don't know if anybody would say hell we're not gonna give you a raise [11:42] I mean if there lives money I mean anyone would be hard-pressed to keep [11:49] Can you give it a soul that they they retain the right to come here and eat with us [11:54] But they really can't for two years [11:58] RFP right [11:59] We have the legal right to just say no, but yeah, I mean they've been given notice that that's one of the terms of the contract [12:04] We got that in the contract. [12:06] We got that faith that the state of the heart [12:08] move for whatever it is is going to get all people's [12:11] going to go to three bucks, right? [12:13] Oh, boy, if I know this left homeless, [12:14] you'd be up today. [12:15] Do you hear it? [12:17] He's got it again. [12:18] And I guess I don't know. [12:20] It sounds like I'm arguing to protect the contractor here. [12:23] No, no, no, no. [12:24] No, no, no. [12:25] And we need to stick with the proposal. [12:26] Why he intentionally did it, a couple of dollars tired. [12:31] And maybe that was a self-preservation [12:33] I'm saying, could have been a million dollars a year. [12:38] So I'm like you, I like that. [12:40] You know, we just stay with us for two years. [12:46] How does that read? [12:49] Well, right now, I think we're talking about 19.4 payment [12:54] account, right? [12:55] Is that where you're at? [12:56] I'm Dr. Schoer, receive $7,000. [12:58] If I could first stamp you $95 for the second. [13:01] So I would add additional English. [13:02] It says, no price increase. [13:03] including fuel search areas shall be allowed for the first two years. But I would [13:10] mirror the language we used in RFP so it's consistent. Okay, so it was in the RFP [13:17] but it's not in the contract. It needs to be. It needs to be. Okay, we got to put it in. [13:22] That's I didn't see it in the contract so. Yeah, that was a good catch thank you [13:26] commissioner. Yeah, we got to have it in there. [13:30] Well, one was that 191. I see prices [13:34] This is discussed at 19.4. [13:35] No. [13:36] We're all on a thing now. [13:39] And before else. [13:40] Before else. [13:40] Is it a plan? [13:41] I just see 19.4. [13:42] I didn't. [13:43] We have to add that. [13:44] The two years. [13:46] That's increased for two years. [13:48] Right. [13:49] 19.4. [13:49] But it goes back to it. [13:50] But what you was saying, you know, [13:52] if we had that in there for three years, [13:55] and say next year, [13:57] it goes up to $10. [14:01] It says they can't come, [14:03] But we as a board, we can be sympathetic to say we better call them minutes if we can. [14:09] But, January, I mean, why do you, why do you bid too much for me if we're going to do that? [14:13] Like, here's what the RFP says. [14:16] So it's price adjustments. [14:18] The district may consider price adjustments to reflect changes in the contractor's operational [14:23] costs after a two-year period. [14:25] Any requested adjustments shall be based upon the consumer price index for all urban consumers [14:31] and or the US Energy Information Administration on highway diesel fuel price index. [14:38] The contractor may fully justify requested increases by substantiating actual increase in the cost of the business using inflationary [14:49] data such as wholesale price index, producer price index, consumer price index, diesel fuel price index. [14:57] The districts shall make the final determination. [15:00] Regarding any contract by the Senate. Second. [15:06] That's what I'm expecting. [15:07] The Senate has for whatever they want based off the criteria that we've laid out after two years, and we can say no, or we can negotiate with them whatever whatever ways of war feel like negotiating. Right. But within that first two, say things go crazy. And it does go south and it goes to 10, 12,000. And they come in after year. [15:31] and say, we've got to do some, or we're just going to have to hold this job and close [15:35] the door. [15:36] And that would be where I would, I guess, want to have some leeway, right? [15:41] That's where I'd want to be able to have some sort of conversations. [15:44] So either lose our provider, or we make a price adjustment. [15:51] And I don't even know that. [15:53] I understand what you're saying because they did it as a price and everybody was on the [15:58] same ballfield when they bid die, but I don't know that anybody expects $10 fuel, but [16:05] what any of us be surprised to expect them out here now, we did that, we lose all [16:09] those accounts. [16:10] Where's that going? [16:11] There's where things going on, and that would be the only time I would think we should [16:16] do something as if they're in jeopardy of closing doors, and we do that provider. [16:21] But you have to have some kind of a clause that you might contract now? [16:25] I don't think so. I don't. I wouldn't think of legal skill we can ask him. [16:31] Sir, I just look at it that one more time. [16:33] If we do want to give a price adjustment in those two years, voluntarily, I guess, as a board. [16:40] Instead of losing them as a provider of somebody picking a garbage, we don't need to have that in the contract. [16:47] Because it wasn't in the market. [16:58] I don't want to have an avenue to rectify the situation if it arises to where so like [17:10] said we don't lose what we have after start all over again. [17:13] District may consider price adjustments to reflect changes in the contractors operational costs after it to a year period, and then it gives instructions about how it is to be given. [17:24] You know, you just could check someplace else about a man. Well, I often put a man. I don't see as a new lady. I see a man. [17:31] I may have amended it here because I don't want to. [17:50] I can add a provision or a section that says, shall maybe amended upon the mutual agreement [17:59] of both parties. I just don't want to invite. We don't want to invite it, but like so. [18:06] In an emergency, yeah, we can do it in emergency. Does that have to be in there? What is an emergency? [18:13] I mean, I'm not part of the day time. I'm not going to put it in there. I'm just okay. That's [18:16] what we have to do. Yeah. And say we just go with it and go there and then if we don't [18:21] happen, then we'll go from there. That's their emergency. Yeah. But if something like that [18:25] That does happen. Why is he going to say, well, that's the reason I've been at $2 higher [18:30] and now I need the contract and now he's willing to bend for these days. That kind [18:37] of, it would have to be drastic for us to get sick and agree, agree, agree. And I don't [18:44] want to do it. I don't want it. So we're all used to drastic now anyway. They're good guys [18:48] that they want to bend. Right. That's the new normal. I don't want a person I can see here [18:52] It isn't involved with the whole system so they got to be with the contract because I won't go there [18:58] But I've been cut so many times over this contract that it's nice, but that don't matter [19:03] So so we better really this time I really want to get it to where we stick to it. Yeah, I think we can't I think we'll find out [19:09] You want to entertain a motion to do the contract with the [19:26] Yes, sir. I'll second that. Okay, motion by Robin. Second by Commissioner. Started to go ahead and set the contract with elevate recycling just both services to start at what date you want on that. [19:45] Let's states it will start on the 20th of March, so we'll contract in September 31st and this will start on October 1st. [19:52] Okay. [19:54] Make that part of the motion then. [19:56] Yep. [19:56] Okay. [19:57] Yep. [19:58] Any other discussion? [20:00] Not all in favor? [20:02] Aye. [20:02] Aye. [20:02] Most carry. [20:05] Okay, discussion of flood debris resolving from the flooding. [20:12] Consider whether that flood debris in no charge or just establish a supposed of fee. [20:19] You still got a lot coming into it, yeah. [20:22] Hi, I printed out a paper for you guys to show you. [20:27] That's what's on the back. [20:29] It's this one right here. [20:30] It says, Beaver County Council wants you to summary. [20:35] I have written on it as a yesterday's date. [20:41] There's been 10,000 in here in the 11th time that come in. [20:47] I'm part as a normal 500 baby. [20:53] Take the whistle. [20:54] Kelly, I'm going to get it. [20:55] It's on. [20:56] Oh. [20:57] Oh. [20:57] Look through all of your stuff. [20:58] It's there. [20:59] It's there. [21:04] It's okay. [21:05] I do have a question up because they asked me about this. [21:08] The total loads. [21:10] It shows 30 times. [21:13] This should be like 200. [21:15] Oh, no. [21:15] There's a couple of thousand of them. [21:18] Yeah. [21:20] Well, that's just, is that days? [21:23] Yes, that's days. [21:25] We're in 60 to 70 loads a day. [21:29] Yeah, that's a day. [21:31] Yeah, that's total loads is, that's total days. [21:36] That's surprising, total days. [21:38] Because what the guys are you on over in Newburgh, [21:41] is they're just keep a track of the loads that are coming down, [21:45] coming in and at the end of the day, [21:47] right you're right and down. There's so many of them coming in that we're not keeping track of [21:50] we're not able to weigh in. We're averaging out the the tiges and I'm very [21:56] conservatively estimating the tanges on a lot of those loads. We've got just a [22:01] small and a medium and large load is what we're doing. We're right down. We're [22:06] getting between 40 to 65, 70 notes a day. Yeah, there's plenty of two or three U.D. trucks [22:14] around and with the other guys. On various days you don't get on this all the [22:19] days but yard leases got three or four trucks running. We've got several [22:25] people from the grow running traders pick up traders with big dump [22:30] traders and then some new dollars. Okay. For their records we may have to [22:37] break that number down a little bit more to help them understand what we're [22:48] So right now we've got FEMA and emergency management that are trying to determine who's [22:56] going to pay that bill. [22:59] So we, Mike was great to just say bring us the debris because we had no options. [23:05] It was, the landfill takes it, we find some obscure pit, like the county has a pit out on [23:12] pass roads we could take it there. That's not the right place for it. And it would weigh length [23:18] in the loads going out there, the time to get the debris out there. So Michael's great to just [23:22] say bring it out here, we'll figure it out. The one load that they were springing from North [23:26] Creek was a 50 minute turnaround just from North Creek to the landfill. So going somewhere else would [23:31] be significantly longer. It really would have caused us problems. So we appreciate might just say [23:38] bring it in here, we'll figure it out. I kept after every meeting I was in I would say [23:42] the landfill is impacted here. They didn't understand because they said well the landfill as a [23:48] county entity that's an in-kind service. I said no it's a special service district. If we build a [23:54] county it's an impact to the to one of them right. The counties are going to have to pay the bill [24:00] or the special service district doesn't take the income. So I finally have them understanding what [24:07] or what we're dealing with. [24:10] It's just that when you, [24:11] the other county commissioners are doing... [24:13] No, but I have a FEMA. [24:14] Oh, okay. [24:15] FEMA, FEMA, and emergency management. [24:19] State guys are helping us. [24:22] When they saw how much material we have, [24:25] that you guys have taken out there, [24:27] it did panic them a little bit, [24:28] but I was okay with that. [24:30] I wanted them to understand what we've dealt with, [24:33] and now we found it's valuable to take people out. [24:36] I was out there yesterday with some people to look at the piles and say this is what we called out of the river so far [24:43] Since the 20th and this is what we don't put into a landfill, but yeah, we've got a mitigate [24:48] It has to have to it has to go somewhere. Yeah [24:52] Most of that has to go to the end of the landfill due to the dirt the dirtiness of the [24:57] Agree the material there's waste in it. I mean human waste. There's [25:03] There's asbestos. There's there's there's there's everything. Everything in that [25:08] way. So most of that what we want to try and do and just as I was up in the [25:13] maybe the site. No, we're going to try and separate the wood material, the [25:18] weak and burn and then bury the rock and the dirt material. Well, it was covered [25:23] back to what the commissioner said, you know, trying to get everybody to [25:26] understand, especially on the theme of sight, because I've been setting in these [25:30] meetings for the hazmat mitigation, the five year plan that we got to put in place so [25:34] that the county, then the cities, qualified for FEMA. I brought up, why don't we have [25:39] the landfill here? Why don't we have the hospital here? Well, they looked at me, why do you need [25:44] your land, but what does that have to do with it? So last meeting, I made my point. I said, [25:51] here, what is taking place? We never realized. Give that any thought. [25:56] Well, it happens that when we're up, you are open, because load after loads are going [26:01] around. [26:02] I've got a guy that has a lot of stuff sometimes from me and around, he's never quit. [26:06] He's going, I don't know, I don't want to be involved, but he's down, but it's in [26:10] language. [26:11] There's something. [26:12] Well, you know, it's really a service. [26:14] Load after load after. [26:15] Load after. [26:15] Load after. [26:15] Load after. [26:16] Load after. [26:16] Load after. [26:16] Load after. [26:17] Load after. [26:18] County, I mean the Forest Service, anything else, what else would we do with that stuff? [26:24] Yeah, anything that happens in this county, it affects this landfill. [26:28] It's just like any bad emergency affects your hospital. [26:32] And we've got, we need to take it, like Mike says, separate it out, burn what we can [26:38] and you'll have to bury the rest and push stuff on it. [26:41] But without this revenue, my court asking you guys to operate, to handle are really the [26:48] Forest Service garbage for no cost if they're not going to pay that bill. [26:55] And that's the point I've been having on those guys, but this isn't a resident waste. [27:00] This is national forest service waste that's now caused the problem. [27:06] We've got to have some help, and that's a big impact on our budget here in this meeting. [27:13] I think they're accepting what was the response like element of minor? [27:18] No, they've been okay, but they haven't written me one check, so I'm not going to jump [27:25] and I'll do the cartwheel. [27:26] So because this is the same thing that George argumented over there in Iron County had with [27:31] their floods. [27:32] All that stuff came out of the forest. [27:33] Yeah, and he said well four service ought to be involved in this and four service. So no, thank you. No, thank you [27:39] And they've been two years almost two and a half years before they take it back and dump it on their property then no [27:48] Making dump it better before we do it. Yeah, it's it's really headache right now. It is [27:53] We appreciate you working with this. I really feel will be paid. I [27:58] Don't know if we'll get the full amount before going to get some and I [28:02] Well, here's the thing, at the end of the day, I was talking to Kaylee about this earlier. [28:07] We've got an account that's got some money in it that's really equipment. [28:11] We've got to fund there. [28:14] And I've always said that some day something is going to come along and it may be water quality [28:19] wells or we may have to lie on landfill or we may have to do something, but I mean, maybe [28:24] now's a time to draw on some of that money because it benefits us all to not have to raise [28:32] everybody's rates, which we can talk about that in a little while anyway. But, you know, [28:40] and if you used to put a dollar value on that and say, okay, where's that going to come from? [28:44] And if the state or theme or doesn't pay for that, then who is going to pay for it? And I guess [28:50] if we need to rely on some of our own funds for that, I mean, maybe that's why we've got it. [28:55] How long can we survive? I mean, we're still all right right now, right? We're fine, yeah. [29:01] Yeah, please do survive and give us a little time to see what famous is going to be yeah, we'll [29:06] If we I wouldn't dip into those funds yet Mike. I think I think I don't think we need to know that and I think by the end of the year [29:12] We'll know a little more. Yeah [29:14] I'll just stating that there are options. There are options. Okay for revenue. I mean our revenue our our our revenues [29:23] Actually up a little bit this year, but [29:26] And we'll discuss this in a few minutes, but [29:31] I think we'll be fine. I mean even if we have to rent an excavator or borrow one from the county somehow some way [29:37] and I think that that even can be put off for a year, maybe until next year. [29:44] Okay, I'll give you an answer. [29:45] I'd rather get everything into the landfill and then start dealing with it with a piece of equipment rather than do a little bit now and a little bit later. [29:55] But I don't want to do that. [29:57] I think you need an excavator with the thumb. [29:58] Yeah, boy. [30:00] And the state has been really good to supply the equipment for the flood. I just have to ask for another estimator for it out there, and they won't be a problem. You just tell me when you're ready. I think let's give it another month of cleaning up before we start. [30:16] At least a lot for the next storm. [30:18] Yeah, that might be the night. [30:20] I mean, if we get the excavator, [30:22] I don't know if it's free of charge, [30:25] and we can get an excavator, maybe, [30:27] bring it in a couple of weeks, [30:28] and it might start on it. [30:30] I might make that request on Monday, [30:33] so it's worth still the top of it, [30:36] and I'm just, and we can get it. [30:38] So, and if it doesn't run every day, [30:40] it's not a big deal, okay? [30:41] In my mind, I'm thinking rental costs [30:44] and having it there and being able to just utilize it, [30:48] all that's there because you pay for it. [30:49] So every day, whether you use it or not, [30:52] so in my mind, I'm thinking if we're gonna rent something [30:55] or it's gonna cost, there's gonna be a cost there. [30:57] Let's get it there and use it and then get rid of it. [30:59] All right, put somebody on there. [31:02] But if there's no cost to it, we can have it [31:05] for a few months then, yeah, let's get it. [31:08] You might as well have a question for you. [31:10] I mean, you yourself, the operators, [31:12] and all this stuff coming in. [31:13] I mean, I've got to be causing somebody some stress. [31:16] I mean, how's all that getting covered by just the people? [31:19] Yeah, my hair is not great. [31:20] I know. [31:21] I know, but what? [31:23] That's the answer I'd like to know. [31:24] At first, I was as far as stress, or, [31:28] oh, you know, who's standing on all the punches I think [31:30] or it's all going to that same spot. [31:32] Well, I, you know, I'm, [31:34] first of all, while I was like, we can't do this, [31:38] but then it's like, who else is? [31:40] That's what we're here for. [31:41] It took me a few days to accept the facts and say, you know what, let's just duck our [31:47] heads and make this work. [31:49] I mean, they've done a good job handling it, they just pile over and he's got it in [31:53] a good spot. [31:54] Push it up a couple of times a day. [31:55] The people who work there and stuff, I mean, it's all okay, I mean everybody, no, we've got [32:01] that, you know, having another guy, we didn't quite have the money for it and we needed that [32:07] other guy I'm glad we got him. [32:09] But yeah, we got a new loader two weeks ago, we got 50 out of it already. [32:16] It's not going to go away. [32:18] I don't think so. [32:19] No, I can't because I believe in what you want. [32:21] But if they don't need you, that's what they say it's going to do. [32:24] We're going to deal with this for a few years. [32:26] Yes. [32:28] But we need to get everything in shape or something somewhere. [32:32] We'll just keep dealing with it the best way we can. [32:35] and I'll make a decision and if it's wrong [32:37] and I'll take the whooping stuff. [32:39] Okay, I'm going to separate it out, [32:41] Jack, and you're about to come and get the big stuff. [32:43] Oh yeah, we can burn it. [32:44] And put it in the pile, wait for a wind blowing north [32:46] and a lighter on fire. [32:48] Okay, I feel like it burned it. [32:52] I don't know. [32:53] We've had chipping things and I found out the guy [32:55] that come and chipped us out here. [32:56] And I like it. [32:57] Yeah. [32:58] Invite me out. [32:59] I want to be there. [33:00] We'll burn it. [33:01] We'll reduce it to ash and we'll be all right. [33:03] Okay. [33:04] No, I'm fine with that. I was just concerned about who's, you know, the extra work that's [33:10] involved there. [33:11] Got to be a lot. Well, of course a lot of people's done a lot of work. Everybody to help [33:14] back. That's that. We're still a business here. So, and I like what you said because people [33:21] really don't think trash, how did we get affected by it? Yeah. And we have a good justification [33:28] This was not a boost. This is the Forest Service stuff that came on to us. I think we're going to be fine. [33:35] I just need a couple more weeks to pound that nail home and get them to write the checks. [33:42] So I want to get some checks out of them before I get too many problems. [33:45] Yeah. [33:45] And one more point. [33:47] I think that people that are hollowing it out there, whether it's the art or the user they get. [33:51] I think they're doing a great job because I don't see a lot of stuff. [33:53] I don't see a lot of trash on the road. [33:56] I mean, I think they've had a great job doing that there with that cause a lot of problems, too. [34:01] So, thank you. We appreciate that. I'll pass that over. [34:03] Yeah, they've done a great job. [34:05] Even with the telegates down, I'm not covered. I still think it's our life. [34:08] Somebody, I think the new business here's the discussion is, do we continue taking this at [34:15] no charge? [34:16] Is there going to be a line that we say now we've got to start charging? [34:20] And at well point because I've had a couple of commercial guys that have went up there and started [34:26] term homes apartment like we was any impression you guys were taking us all for free and I'm like [34:30] what are you getting paid and and so there's some discussion right here and there's some discrepancy. [34:36] How do you how do you let this guy have his whole yard get cleaned up brought in for free and this guy [34:41] pulls some sighting out his house with a disaster company and we charging so I need some clarity on that. [34:49] that I think that if we're getting paid for, we should charge back. [34:52] But I also know that maybe some of the other stuff's getting paid for too, so who do you [34:58] get paid for? [34:59] Who's going to know what that is, or what? [35:02] It's hard for me to pick and understand that. [35:06] So do we just keep accepting it for free and put it down to slow matured right now, what [35:10] do I do? [35:11] I would ask you to keep taking a degree out of the yards. [35:15] I agree with you if somebody's doing some work on their house from the floods [35:21] But that contractor's getting paid by the insurance by the homeowner. We've got to charge them for that [35:26] Okay, but how we know it's gonna be mine's call. Well, we ask people and that's gonna be part of this other discussion [35:34] is we've got people say well this is my own stuff, you know [35:39] It comes back to that $15 charge [35:42] amount is how much of that $15 charge is going to see found in a system how much [35:49] should it cover? And it should just I mean by the time you you pay a [35:53] contractor this new elevate and then we take our cut and then you take all this [35:59] other ways that's personal ways or supposed to be free it there's there's no [36:03] money left. There's no revenue left to it now to for the out of that $15. And Jack [36:10] to your question. We've got the normal contractors that are hauling in right now. [36:15] If Mike sees a new one, he'll know that they're not hired onto the county. So I guess that's how you [36:21] would know to charge those guys. So right now it's just Skyler Yardley hauling. Yeah, Tonshire hasn't [36:28] hauled any. They've been loading, but I know they did. They did for the first little while. Okay, [36:34] But they donated, they first donated, there was two or three side dumps that I think was [36:43] donated. [36:44] Yep. [36:44] There was a significant amount of donation right at the beginning. [36:48] Yes. [36:48] Oh, there was a Saturday that all the orgs got together and my two or a certain area and [36:52] I don't know. [36:53] You probably got one part of that. [36:55] Yeah. [36:55] We got probably three or four hundred loads of stuff in one day. [36:58] Yep. [36:59] And there was just everybody donated, you know, we still got people donating their time. [37:03] They're taking their truck and trader up there and somebody's loading them up there and they're [37:08] And they're just running this to the lab field so we're keeping track of that also. There's a big pile still right there [37:13] But Bob Davidson's there's big pile of local. Oh, there's a lot [37:19] so [37:21] If we can keep doing it like you have been that would just kind of keep doing what we're doing [37:26] Yeah, okay, that was my question. Okay, okay, [37:34] he was been waiting patiently [37:42] I know it's a bit, you have a straw in the market, you can actually have it in the [37:48] place. [37:51] Let's see if this thing will start. [37:54] It's over. [37:55] It's gone. [37:59] Five minutes. [38:00] It's about the two minutes. [38:03] There we go. [38:04] Now we got it. [38:05] So if you hold up your fancy certificate, you'll see this thing. [38:08] this training comes to two parts. [38:09] We have, first of all, we require open public meetings. [38:13] And then also, we're gonna have professionalism [38:15] and public service. [38:16] It'll be familiar to you. [38:23] Who must have made the Open Public Meetings Act? [38:27] We have to. [38:28] What are we that makes this required to follow? [38:31] This is a service, this is a street public service. [38:32] Good. [38:33] And what is that? [38:35] It's a public body, I don't know the law. [38:37] We refer to public bodies, right? [38:39] So the commission's a public body. [38:41] We're a public body planning. [38:42] all the other service districts are public bodies. [38:47] What's a public body? Well, we're created by law. [38:50] We've got two or more people. We use tax dollars and we make decisions about the public's business. [38:55] That's a public body. [38:59] All right. Public notice of meetings. [39:01] It's got to be written. How far in advance? [39:04] 24 hours at least. That's somebody complaining to me [39:08] just to stay in my office. You guys just get away with the minimum that the law [39:12] requires. 24 hours a row. There's a reason for that, right? Sometimes we don't [39:17] know for sure what time the agenda's on the last minute. Sometimes stuff comes [39:20] up last minute. Sometimes 24 hours before feels like not enough, or it just, it's [39:29] what the law says so it's what we go. What does the notice include? [39:42] You're [39:42] You can do the paper, you can do the post office, you can do the city office, the county office. [39:46] So what's required by law? [39:47] So you can do a state-wide, let's do a state-wide, I don't know. [39:49] Replay a state-wide, I don't know. [39:51] Yeah, there we go. [39:53] So what's required by law is the principal place of business right here. [39:59] And then the Utah Public Notice website. [40:01] In addition, Beaver County also requires tritz ordinance [40:04] and it'll be posted somewhere in place in Beaver. [40:07] No further advice. [40:09] It's in public location. [40:10] Where do you post-starts? [40:12] The post office and then the public rose upside. [40:15] Three post offices. [40:17] Yes, so I'll post office here. [40:19] And then the public rose upside. [40:20] That is absolutely perfect. [40:23] I do it on Monday, the day of the week goes. [40:27] The yearly notice. [40:28] Thank you. [40:29] That's perfect. [40:30] All right, yearly notice. [40:31] In addition to the 24 hours in advance, [40:34] I also have to give the public notice [40:36] of what our yearly schedule is going to be. [40:41] and we do that once each year. All right, emergency meetings every once in a while despite [40:48] the sunshine laws that require us to hold our discussions and the open stuff comes along [40:52] where we have to close the meetings and here's some of the reasons why. The shout out to Matt, [40:57] what are some reasons that we have hold the close meeting? Good. There's one public go when you [41:07] It's probably the biggest one, that's the biggest one, yes, so cyber security, [41:16] oh yeah I'm [41:18] ahead of myself, sorry. When we're holding an emergency notice and we held one of those not so long ago, [41:23] did we commission? We give the best practicable notice of the time place and topics to be considered. [41:29] In other words, the law says, look, if it's an emergency, you do the best you can. You've got to [41:33] to notify all the board members and the majority of the board members have to approve of [41:38] having the emergency. [41:40] All right. [41:41] Here we go. [41:41] Close sessions. [41:42] We already talked about some of the reasons. [41:43] Personnel, that's the most common, threatening litigation. [41:47] That's another common one. [41:49] Real property negotiation. [41:50] That's another common one. [41:52] We don't see this one a whole lot. [41:54] Deployment of security personnel, but that's a reason to close the meeting. [41:58] Collecting bargaining, we don't see that a whole lot. [42:00] the government and then other specified issues. [42:05] All right, records of public meetings. What do we got to have? [42:09] Kaley keeps an audio recording, right? [42:13] What else does Kaley keep? [42:15] Minutes. [42:15] Minutes for sure. [42:17] And then what record do we keep of closed meetings? [42:22] Do we keep audio recordings of all closed meetings? [42:24] No. [42:25] No, what are the exceptions? [42:30] Of course, no. [42:31] Personnel? [42:31] There's one. [42:33] And then deployment of security personnel, that's the other way. [42:36] For one of those two reasons, we don't have to make a recording of it. [42:39] Instead, Katie will have the chair signed a little affidavit, just a testing. [42:43] Here's the reason we went into closed session of this group. [42:46] Does anybody have to say the closed session cannot talk to anybody about what took place in that closed session, unless they were flooded? [42:53] That's right. That's right. It's actually a criminal offense. [42:57] Yes. [42:57] No, I haven't prosecuted anybody for that yet, but you're right, it's against the law, I've got to keep it quiet. [43:04] Alright, so there you go, that was the open public meeting training. Let's jump now into professionalism and public service. [43:18] Alright, duties of the public board. [43:20] Everybody must be the princess bride. [43:23] You're right, report on it. [43:25] Alright, here we go, you'll see the tie-in in a minute. [43:27] Let's just kind of do this classroom style, right? [43:32] Mayor, you want to start with? [43:33] Public officials must ensure access to public reports and studies on an equal basis. [43:38] Public officials must ensure that reports and records of public body are open [43:42] equally to all members of public. [43:45] Everybody gets access to the public records. [43:48] So let's pose a hypothetical here. [43:50] So the bird squad comes in, they submit a grammar request to the board secretary, and [43:56] they are demanding a copy of a recent close meeting. [44:00] They insist that disclosures necessary to provide proof of inside dealing by the board. [44:04] They threaten to go to the media if the meeting contents are not surrendered. [44:08] Do we have to turn over the recording of the closed section? [44:11] No. [44:11] No. [44:12] That's right. [44:13] That's one of the things we don't turn over unless there's a court order or telling us [44:18] to. [44:21] Number two, Commissioner, [44:28] for all a diligent service. [44:30] The official must render for all a diligent service. [44:34] Should the official believe he or she can no longer render [44:37] such service in a thorough and diligent manner, [44:40] he or she should resign from the position. [44:43] If the official has not sufficiently been the other facts [44:47] and advice affecting a public decision, [44:50] the official must not participate in that decision. [44:54] All right, Robin, you want to give us our hypothetical board member, Indigo? [44:58] Yes? [45:00] There's always late to the meetings and never comes prepared. You're in my side and during the meetings, and I always vote the same way as a friend Fritz, who is also on the board. He likes being on the board, though, because it's really great because it was quite easy. [45:17] What's in the goal of being a high say that guy's name? Yeah, yeah close know and name is Indigo Montoya. You killed my father, but he was responsible for that. [45:29] Behind time. Participate. Yeah. Or you should reason come prepared, right? [45:40] We have a cross-section of the community. Everybody is supposed to contribute their own ideas to this, not just copycat in the videos. [45:48] Troy, you're up. [45:49] In short, full disclosure of public hearings, the public official must ensure that the presentation of information on behalf of any party to a public question that occurs only at the scheduled public hearing on the question. [46:01] Not in private, unofficially or with other interested parties absent. The official must make partisan information regarding questions received in the mail or by telephone or other communication part of the record. [46:13] And does this ever happen there, Davis? [46:16] Every day. [46:19] Every day or at the post office. [46:21] Yeah. [46:22] Yeah. [46:22] Okay. [46:23] So here's a hypothetical jack. [46:26] Are you presenting a CUP application? [46:29] The applicant? [46:31] What's that word? [46:32] The Zina. [46:32] The Zina Carnage Ball at the Chevron. [46:35] And gets him a very long sales pitch. [46:37] I should have found out. [46:38] Should they? [46:38] Should they? [46:38] The application. [46:40] to ensure the whole discontent disappears here. [46:44] Disclosure, watch it, and he goes there. [46:47] Yes, it's not Bob, it's in the go. [46:49] You should go somewhere else to buy his Coke. [46:52] Yeah, no, look, there's an easy answer, and there's a shot. [46:55] There's just a closure that you've had that coma solution [46:58] and disqualify yourself from that conversation. [47:01] And go. [47:02] I know, Mayor Davidson, past trainings, you've said, [47:07] when people approach you, you just invite them to the public meeting. [47:10] Yeah, come come in here all about it, right? I think I've heard somebody else do the same thing [47:15] Yeah, just come over here. Yeah, come to the meeting and find out [47:21] Respecting for that [47:23] All right, let's see John are we at you now? That's me [47:26] Board member must not seek favors from applicants. He or she must not directly or indirectly [47:33] Solicit any gift or accept or receive any gift whether in money service bones traveled [47:38] entertainment, hospitality, promises, or in some other form under circumstances in which [47:45] it would be, reasonably inferred that the gift was intended or could reasonably be expected [47:51] to influence him in the performance of his duties, or was intended as a reward for any [47:58] recommendation or decision on their part. [48:02] Okay, Mayor, you read this report? [48:05] The Cup Applicant, whatever we're calling V, [48:09] next approach board member Wesley mentioned [48:11] that he just got a hold of box seats at the next jazz game. [48:15] That's what Jack wants. [48:17] And the envelope to Wesley with the wink [48:19] and says, I really hope you enjoy them. [48:21] Wesley knows the C-char expensive, [48:23] probably worth several hundred dollars, [48:25] what should he do? [48:27] Don't take it. [48:29] And don't say, get more tickets for the rest. [48:31] It's like you don't have to hurry up and wait until the end of the day to get it. [48:35] This is the real one. [48:39] It is going, I want to go. [48:41] A lot of changes. [48:42] You used to say you can't accept a bribe of more than 50 dollars. [48:47] Yeah, you can take a bribe of 50 dollars. [48:51] But you can't be bribe above 50 dollars. [48:53] That's change now. [48:57] All right. [48:58] I think that's there. [49:02] Let me see if Mike can. [49:03] Okay, I'll read it. [49:06] I'll do it. [49:08] Avoid a conflict of interest. [49:10] Avoid a conflict of interest or even the appearance in propriety. [49:16] In propriety, a board member who may receive some private benefits from a public decision must not participate in decision making. [49:23] The public benefit may be direct or indirect. [49:26] Create immaterial, personal gain, or provide advantage to relations, friends, groups, or associations that hold the significant share of the officer's loyalty. [49:37] And official with a conflict of interest must make that interest public. [49:42] Staying from voting on the matter, not participate in any deliberations on the matter and leave the chamber in which such deliberations are taking place. [49:51] The official must not discuss the matter privately with any other official voting on the matter. [49:57] So what this is talking about is a good better best. [50:00] So good is to obey the state law. [50:03] Utah law says, hey, if you have a conflict of interest, you've got to declare. [50:08] So if you do that, you're obeying the law. [50:10] Better is to follow the Beaver County policies and procedures now, specifically dealing with [50:15] conflicts of interest, which says in addition to disclosing the conflict, you also abstain [50:20] to refrain from any conversation related to it and you refrain from voting. So that's better. [50:26] Best to follow your attorney's advice and just leave the room. Just don't even participate [50:32] in the conversation. And I hope that makes sense because if you stay there and they're talking about [50:38] something that relates to you have an interest in them and if they're getting it wrong, what are you [50:43] going to do? You're going to jump in and correct them. And now you're contributing to their decision. [50:50] right. So now we're on this last meeting. We just we just did this. Okay. Black [50:58] nerds were bidding on the contract. So he had to play abstained and then he left the room. [51:04] There we go. Okay, but I've said in I like leaving the room because I've said in [51:09] meetings where they've declared a conflict of interest, but the conversation went on. [51:19] Yeah, so you've seen it. I see, you know what we're talking about here. So it's best to [51:23] see. [51:23] What about if it's your banker, so where's that ticket? No, or this thing that we took place. [51:32] I will, excuse me, but I did tell him one thing. I'll give you information if you'll give [51:37] me 4% interest on my life. So I got out of the thing and I was happy because that was [51:43] This is smart and it wasn't a super friendly conversation. [51:47] Mike, let's say I need to have a magnified. [51:50] The board is reviewing the CNP application. [51:53] And it goes brother. [51:54] Ruben is the owner of the company submitting the application. [51:58] What is Indigos doing? [52:01] Leave the room. [52:03] Declare out. [52:04] Leave the room. [52:08] All right. [52:10] Commissioner? [52:12] Sir, the public interest. [52:13] The primary obligation of a public board member is to serve the public interest. [52:19] A board member has a fiduciary duty to act in the best interest of the public. [52:25] Not his or her own best interest or the best interest of any private person. [52:33] I'll read the hypothetical on this one. [52:35] The office supply salesman is on the board. [52:38] may Humberdeak sell off the supplies to the service district. There's an easy answer, and there's a very complicated answer. [52:45] The easy answer is, no, just don't do it, right? Because if he's going to be on the board, he should know that he really shouldn't be presenting the appearance of every variety [52:54] or do anything that's going to bring distrust or disfavor upon the board by making a look like they're favoring him and his wife. [53:01] So the easy answer is no. Now, if you want the technical legal answer, I suppose he could declare the conflict. [53:08] But the interest of skiing from voting leaves the room, [53:12] but even then, right, it becomes the problem. [53:26] OK. [53:28] Maintain public confidence. [53:30] The public fish must conduct himself or herself [53:33] public facilities to maintain public confidence [53:35] in the public body. [53:37] The fish is unit of government, and the fish of performance [53:40] are public trust. [53:41] OK, Jack, do you want to read or hide the fabric? [53:45] Explicit recording is published on social media [53:48] is showing, comforting, making inappropriate [53:51] advances toward you, Bradley. [53:54] The board chair investigates and confirms [53:56] that the recording's are real. [53:59] Do you help maintain public confidence in the board [54:02] of what should comforting did? [54:05] I'd say, not talk it off. [54:07] There's so a public apology for saying, just resign. [54:11] So the summary is, think before you act, [54:13] use common sense to the public servant [54:14] if you have a duty to act diligent. [54:16] You could thank the members about public service. [54:22] right. Congratulations, training complete for 2026. There's your certificates. [54:57] Yeah, that's fine. I do mind on that. I'll take whatever you've done. It's automatically ordered in the state. [55:07] Hold that. Hold it. I got one right here. [55:15] Yeah, [55:18] that's a lot of talking for me. [55:35] Okay, we're going to old business, discussing the proposed increase to commercial [55:39] There's a sewed waist reach, possible board action. [55:44] That's the paper down here, I'll color it in. [55:49] Okay, I think it's up on my graph. [55:54] This top part of this is because what we're currently [55:59] charging for MSW and CND. [56:05] And then I picked on Washington County, [56:07] county, to their county and motor county, in relation to the landfill fees that come around us. [56:20] We have got to come up with the current franchise fee, because it's going away. [56:31] What's in SW Stanford? [56:34] Municipal Solid Waste. That's just our household waste, okay. [56:37] and the C&D is construction and demolition cut and [56:43] so there's a lot of places [56:44] that are that are keeping the price the same on C&D and MSW is going into the same [56:50] hole a lot of places now there used to be a quite a big discrepancy between the [56:55] two and you'll see a lot of these are are charging the same Melored County is [57:06] around $32 to $48 a ton on their stuff. They do it by a TBR charge at their landfill. [57:19] And so if you go down, what we've got to come up with the difference is that the very [57:25] very bottom of the page down here, no revenue, shortfall. And this isn't including fuel maintenance [57:31] way there's anything that's going to just normally go up at the end of the year in a new budget [57:36] year. That loss of revenue from the from the mountain is going to be somewhere between 40 and [57:46] 60 thousand dollars and then the loss of the revenue from the franchise fee which is $84,000 that [57:53] using suns was paying us for the franchise, paying us the district for the year. [58:00] So right there in the center I had Kaylee pull up a schedule based off current, well actually [58:07] on current but actually last year's tonnages of our MSW on our CMD and the total tons [58:15] and she's just got a graph across there and I threw in some $22, $25 and $29 is tonn [58:23] Revenue fees and [58:28] This isn't including an anticipated which see like this year we budgeted $20,000 for the Milford landfill [58:37] Thinking that we was going to be getting some of this [58:40] Revenue office [58:42] All that's going on out here. We haven't been getting any of them. Well, it's a very low very very low [58:47] And so we're we're $10,000 short on our [58:52] on our revenues for C&D, the Milford Landfill, [58:55] so there's a little bit of a budget shortfall there. [58:59] But if we can increase our tonnages into the landfill, [59:04] that will also increase revenue into the landfill. [59:08] So I didn't take any of that into account. [59:10] I didn't take any of that. [59:11] I was a percentage of what I think we're gonna get. [59:14] And then also from the self haulers, [59:18] There's the trailers and the big loads that are coming in that I think should be charged. [59:23] I'm not taking any of that into account either. [59:25] This is just basically our two largest revenue generators, which is MSW and CNB, between [59:30] the two handfills. [59:35] And so we've [59:43] got to come up with what we want to look at to charge for our fees. [59:50] And I think those losses, right, this, the franchise fee replacement is going to be impacted [59:56] by the tipping fee of anybody that wants to dump. [1:00:00] Here, now, right, are we going to have a tipping fee on top of, because this is just for, is this just residents, because they bring it out, or is that for anybody? This is for anything commercial. This is, like I said, the two largest hollars right now are, are the contractors, Tusher, Rollins, and Hughes and such. Basically, the commercial end of things. [1:00:29] I think that there's going to be a percentage of what are overall tonnages. [1:00:34] This isn't our overall tonnage because there's almost 4,000 tons of MSW that comes in that's [1:00:46] not charged, that's personal waste. [1:00:50] So there's going to be a portion of that that we probably should start charging. [1:00:56] We've got to, in my opinion, we've got to quit bumping the residential race up to fixed [1:01:04] budget shortfalls. [1:01:04] We've got to quit hanging it all on just the commercial into Mike's food town or what [1:01:12] the haulers are picking up. [1:01:15] There's 4,000 tons of waste coming in the landfill, but we're not getting, we're including [1:01:20] including in that $15 fee, because it's personal weight, it's free. [1:01:26] And so how [1:01:31] far does that $15 a month fee get to go, because that's half of that is [1:01:38] elevating or using the suns picking up the garbage, $7 a month. [1:01:43] The other half of it is coming to us for operation, to make operational and take care of it. [1:01:49] And so to take another, there's nothing left to take another 4,000 tons of waste for free. [1:01:58] It's like, how do you pay for that? [1:02:03] And I think that the people that are bringing it in so we should be charging [1:02:08] and not spread that out over to somebody that's not even coming to the landfill. [1:02:15] I mean, we've got some of these people that are bringing in. [1:02:22] Traylor loads. Traylor loads. I mean, we're talking big Traylor loads. And so... [1:02:29] Traylor loads of treelings that are saying they're saying it's their residential, which [1:02:33] it might be but. People have learned that all they have to do is say, well this is personal [1:02:39] or I'm doing it for free. I have no way of knowing that. [1:02:45] So how do you go about making the change? [1:02:49] I think we're just going to have to just say anything, a lot of the landfills and speaking [1:02:54] with landfills managers, I mean, no county driving a pickup load, it doesn't matter [1:02:59] if you have two bags in the back of your truck or you have your whole pickup load, it's $47. [1:03:07] And I don't think we need to be that extreme, but I think most of the landfills have said [1:03:11] if you come in with a pickup load of household trash, you clean out your garage, you clean [1:03:16] down here. And you couldn't get it all in the dumpster or the curbside can. You come [1:03:24] in here and I think that should be included in $15. I think that the tear and your roof [1:03:30] off and remodel on your garage and build a shed out back the terrors. I think that that [1:03:37] extra waste needs to be paid for. I don't think it's better for me to continue to raise [1:03:44] all of our rates for the people who should be paying for it. We bring it in. And I [1:03:51] worry about it going out in other places, and I've just decided that we can't [1:03:56] worry about going out in other places. We have to worry about what's coming into [1:03:59] here and cover what we need to cover here, our fuel, our wages, our insurance, [1:04:05] land fill fees, state fees, back to your comment about the $15 and you can't get [1:04:14] everything in your two containers, one container, and you start bringing that [1:04:18] in your pickup, it should be covered by the $15. Well, would you just soon say, [1:04:24] hey, if you can't get it all in two cans, maybe you better have three cans in [1:04:28] mind for something like that. But maybe that will, maybe that will, [1:04:31] Well, instead of I, as people to bring it out more, I don't know, that's for you guys [1:04:39] to decide. [1:04:40] I think that [1:04:43] they trouble without turns for the bigger the ass. [1:04:46] You know, half a year or most of the time you only have one, but two or three times a year [1:04:55] you could use two and maybe even three, once or twice. [1:05:00] But a day with the wife to the landfill to bring four bags or a half a pick up load to [1:05:05] put in the dumpsters, I don't think that should, personally, I don't think that should [1:05:08] be charged. I think that should be included in them. I know if we do charge that, it's [1:05:13] going to end up in the dumpsters on the way to the landfill. We know that. We know that. [1:05:18] There's going to be 10% of them that make it to the landfill. Yeah, so I don't think we [1:05:22] can charge for those loads just for that simple reason. I agree. I think that that should [1:05:28] It could be included in the, you know, some of the moves, or in the shape of the circle. [1:05:34] Somebody that moves and they clean up all their stuff in their house and they move and bring [1:05:39] out a couple of couches and they maybe it is on a chip, household trash, you know, but rolls [1:05:46] a carpet and sheet rock and, and this stuff with, I think, we've just got to start charging. [1:05:52] We've just got to duck our head and I know we're going to get some fallout from it. [1:05:57] I know we're going to get some pushback from it, but we're just going to have to just [1:06:01] do it. [1:06:02] Otherwise, we raise that $15 fee, or we raise the cutting fee to the commercial again. [1:06:08] We put that burden on everyone, and I don't think that's fair. [1:06:13] So if I'm reading this right, I don't be explaining this, we're charging $14 right now for C&D, right? [1:06:19] C&D. [1:06:20] Okay. [1:06:21] And if we bump it to 25, [1:06:25] we're going to get an increase of around 88,8000 and if I put [1:06:32] a figure to it, the franchise free fee was 84,000 so that 88,000 is barely going to [1:06:41] cover the franchise fee. [1:06:52] That's not including any of that, this is just the big ticket, this is where multi-eurovy [1:07:00] is going to be. [1:07:00] Who is going to pick up all this other trash? [1:07:04] Whoever. [1:07:06] Who will you have? [1:07:08] Not being personal, but. [1:07:10] I don't know yet. [1:07:11] Be honest, I guess why at least reached out to the timber line just see if they're going to sign he has reached out to me [1:07:18] No boy Todd asked me when to come here tonight. I don't know for sure, but I'll [1:07:24] Read up so I don't think that that's and I hear what you're saying [1:07:29] But I don't think that's our business. I mean that's commercial now and we're kind of out of that [1:07:33] So I think that's just open. No, but I guess the answer is he can get anybody. They can get anyone he wants to [1:07:38] That's okay whoever's willing to earn that business and do it for whatever they'll do it for [1:07:45] So Mike my my tearing you're right if you think the 25 bucks that are gonna cover it the way it looks [1:07:51] Just because that's only eight thousand of the [1:07:56] Fancy yeah, it's all they have for what we need is there some other way if we raise it to 25 bucks [1:08:03] Well, do you see it's getting any place out? [1:08:06] Well, you've also got to realize that if we can start getting a few roll-offs a day of this other ways, [1:08:14] that will increase our tonnages and greatly increase our revenue. [1:08:20] Now, back to the dumpster thing. Troy said he's got three dumpsters out. [1:08:26] This suppose XYZ contracts with him to haul that out. [1:08:30] When that comes out across the scale, we'll get a charge if we do the 25 bucks, that's [1:08:37] going to be 25 bucks a ton to get across the scale. [1:08:42] Before today, if XYZ dumps that dumps your razor across the scales, we don't charge them. [1:08:50] No, we charge them. [1:08:51] I thought that was what the franchise did. [1:08:53] No, but there's still a commercial tip, HB, on the commercial end of things. [1:08:58] All right, what we did was we give how much is that? How much do we charge $17 a ton? [1:09:04] Okay, all right [1:09:06] $17 a ton plus plus the franchise plus the franchise fee. So [1:09:11] In theory the franchise fees already choice already paying for sure that franchise fee correct or any person who has a commercial [1:09:20] can is already paying part of that pay $4,000. He's already paying that to widely. And [1:09:31] then widely gives it to us. We're just going to take it from widely or a contractor now in [1:09:38] the form of a tipping fee instead of a franchise fee. We took the tipping fee before, but there [1:09:43] was the franchise fee added onto that. It's a little bit confusing and I'm probably not [1:09:55] I don't think 25 bucks is going to cut it. [1:10:00] But I do think there's going to be some new revenue that we're not seeing now. [1:10:06] With some of the business that I agree, [1:10:11] the other way to cover that shortfall is do we [1:10:14] charge in the tonnage plus a tippage fee for the commercial garbage, but that is your [1:10:22] tonnage is your tippage fee. Or I must understand. [1:10:27] No, no, that's, I [1:10:32] get like if I, if I are all in here with a dump trailer behind my pickup [1:10:37] and I'm tearing a house down, if I just pay the $25, but if a contractor rolls in, I guess [1:10:46] If a contractor comes in with a roll-off, you could charge even the $25 plus $100 to [1:10:55] double. [1:10:56] Well, it'd be $25 a ton. [1:10:59] Well, either we'd have the scales. [1:11:01] Down here we would have to say, you've got a half-trader or this a man, you've probably [1:11:07] got three times. [1:11:08] We're going to charge you 75 bucks. [1:11:10] We'd have to charge him that plus the $100. [1:11:13] You can't do that all. [1:11:14] Well, we can do it. [1:11:15] We can, some of these plays, because I don't know that we, we don't want to go to the [1:11:23] highest scale of the garbage, the 25 is enough for me, like that's all. [1:11:28] I was starting, I don't know, shortfall there to be, but the thing is, I've got two thought [1:11:35] processes on this, as one is we could charge 25 and start out, but if it isn't enough, [1:11:41] then we're going to take another raise in here, and we're going to, is that going to irritate [1:11:45] people more than one take raise now there's a and not another [1:11:49] year because I think that 29 would definitely cover it but you've got to [1:11:54] remember fuels still five bucks a gallon well if the other thing we got to [1:12:00] remember two if we go beyond the 25 you got to remember what's going to take [1:12:04] place in the county and especially in the beaver with the revenue they're [1:12:10] going to lose, because they're going to lose water, their water age are going to have to [1:12:15] go up, a lot of things are going to have to go up. Taxes are going to have to go up [1:12:20] at county and city to cover everything that's taken place, and so we have this large amount [1:12:27] on top of it. [1:12:28] Man, it's going to be pretty tough on a lot of people, so now our days are going on. [1:12:32] Yes, and we want to be very cautious on ground, but I don't want to go any higher, 25. [1:12:38] I'll try that and see where we go from there. [1:12:41] I started at 25, but that's not going to cover it. [1:12:44] The math doesn't work at all. [1:12:46] I'm going to work 25 and this will work for a while. [1:12:52] I'm hoping that an increase in construction material from down here. [1:13:00] If we could just get a couple of rolls a day or even five a week. [1:13:05] start to make it up pretty different that area. [1:13:09] A averaging 500 roll off, 5 times 25. [1:13:14] And what are we getting, maybe $4 to roll off now? [1:13:17] We get $125 to roll off. [1:13:19] And [1:13:23] increase, that would fill in. [1:13:32] So are you thinking that we need to take this home and digest it for a month? [1:13:37] And then come back with the first of the year? [1:13:40] We need to go by October 1st because the franchise goes away, that last quarter of the franchise [1:13:46] goes away, so we're just going to start. [1:13:49] So we've got to make a decision for our public decision and I'm meeting in September [1:13:53] what we're doing. [1:13:55] If we're going to have a meeting in September or if not, we probably ought to do something [1:13:58] tonight. [1:13:59] But that's, I think we can see more of the overtime. [1:14:01] We're just here at that time. [1:14:04] I mean, I think you said move something far away. [1:14:06] We still retain the right. [1:14:08] If there's not light time, you can change it. [1:14:10] You good at 25, yet? [1:14:12] Yeah, I do, but we got to move forward, [1:14:14] but don't work, we can still change it. [1:14:17] Times are really changing, there's some I don't understand. [1:14:20] Do we got to have a public hearing [1:14:21] of justify what we're raising the rates? [1:14:24] Right. [1:14:25] Not on commercial side, do we? [1:14:26] Not on commercial side. [1:14:28] Just on residential. [1:14:29] Residential. [1:14:30] We're not the grade for it yet. [1:14:32] So we got to get to get to it tonight. [1:14:33] We're going to use it in here, right? [1:14:36] I'm not going to raise the residential. [1:14:37] Well, we've also got a lot to talk about this, the residential is going with a 58 cents difference, so we're going to eat that, and we're going to raise it, and we've had to bring it away from that. [1:14:53] This is part of the reason why it hasn't been to raise the residential, so we've had one being raised. [1:15:02] And we're trying to fill budget shortfalls by people who aren't something easy. And these people [1:15:14] that never shut the lab, though, the rates just keep going up, and they're going, what's [1:15:18] going on? And we've just, we've got to build a people who bring it in here. [1:15:24] We've got [1:15:25] That's about $25.58 times, how many accounts do you cite, Kayleigh? [1:15:33] Well, a figure that's about $3,000. [1:15:35] $3,000 accounts times $5,000. [1:15:39] That's $1,700 general law. [1:15:41] Talk about it is good. [1:15:43] How about clock it if we don't take a raise? [1:15:47] So there's another on the residential side. [1:15:57] So the new contract is going up 58 cents, so we're going to lose 58 cents out of that [1:16:06] $15. [1:16:07] That $1,740 if I'm right on my mark, [1:16:14] that is that much more out of our pocket. [1:16:18] Okay, I thought it was 78 cents what I thought it was 78 cents now from three from 717 to [1:16:30] 775 [1:16:32] 795 [1:16:32] 795 I thought it was 775 [1:16:35] 795 [1:16:36] Pay it's more than that [1:16:38] So 78 cents [1:16:44] Yeah, my math thing math [1:16:52] That's $1,340, but if you raise your resident, have to have the public everything, right? [1:17:00] No. [1:17:02] So we just went from $600 to $2340. [1:17:07] So we have to do something. [1:17:08] So what's your shoulder trim? [1:17:09] That's $25,000. [1:17:11] That's $20,000. [1:17:12] That's $20,000. [1:17:12] That's $20,000. [1:17:13] That's $20,000. [1:17:14] That's $20,000. [1:17:15] So this is did we got raised on 78 stands on the residential right right now [1:17:24] Well [1:17:26] That's it you guys and I think we should really talk about that [1:17:30] But yes, he says so we don't have to have a public hearing to raise the right smell in the ordinance [1:17:35] We just we keep going up and up and up and up and I'm fighting that I'm fighting that that's what we're discussing around is not [1:17:46] I don't want to do the residence, we just get to the bus. [1:17:50] We keep going up on the residential. [1:17:53] We did, we went $2. [1:17:54] No, we got squad them. [1:17:57] Yeah, all that did was cover up a column. [1:18:02] I'd say go up $25 a ton right there in the middle and let's hope and pray that we increase [1:18:08] in revenue. [1:18:10] I'll keep trying to cut costs wherever I can. [1:18:12] and we'll, [1:18:16] I think we do the 25 if we need to dip into that fund to cover some costs. [1:18:23] We do that and make sure you get the build of the county and the 17 before the late [1:18:31] are 15. [1:18:32] What does 17% of the bill exist? [1:18:36] Can't be that clear. [1:18:39] You can't feel it. [1:18:40] Four service. [1:18:42] I know. [1:18:44] Yeah, let's do that. [1:18:45] It's going to take 25, but let's see what happens. [1:18:47] They can close the door. [1:18:48] I didn't see the door. [1:18:52] This is a great idea! [1:18:54] Today, we have the whole Christina's really died. [1:18:57] Under section 11, we have no one. [1:18:59] of our ordinance. It says the district should be responsible to set peace by [1:19:04] resolution for all aspects of solid waste management is necessary to pay for [1:19:08] services. So we can do it. We don't have to have a public hearing but it does [1:19:11] mean to be in the form of a resolution which we don't have today. So we're going [1:19:15] to have to do this next month. Okay. Good thing you were here. Just give me the [1:19:21] number and I'll prepare the resolution five. I just basically done you know what we [1:19:26] we do when we raise water raise stuff like we have to have a hearing to fill. [1:19:31] Is that on your commercial? [1:19:33] Yeah, 17 to 25. [1:19:35] So you do have to do the commercial? [1:19:37] We pick up some other commercial. [1:19:38] Some other revenue along the way. [1:19:40] Every time I take a price increase I get sick to my stomach because I feel like we should be going [1:19:46] something else. [1:19:47] But, simple fact is, I don't know what you do different. [1:19:50] aspect of our lives is increasing in every single thing that we buy and do and it's I don't [1:19:59] know how to fix it because our costs that we have to run this place is just in every time [1:20:06] you turn around it so there's just going to continue to go that way. [1:20:09] Well that's tough but if my translation is right is your job so right I sense that when you're [1:20:15] telling me that you're a wonderful guy you still got to make sure that we're in farm that you've got [1:20:20] and that's coming in, so you're covered. [1:20:22] So the three is residential. [1:20:24] I'm not above and beyond that, because it's still, [1:20:27] I residential, you get casted for that, [1:20:29] but we're still not in good heat with nobody else. [1:20:32] My people relate to realities in St. George. [1:20:36] It's two and a half minutes more. [1:20:38] I know, iron county is still building for 10 bucks [1:20:40] with the folks over there. [1:20:42] So they're raising for that. [1:20:43] The stealing of, basically, [1:20:45] all the volumes. [1:20:46] Oh, come on. [1:20:47] That's a lot of landfills, that's a lot of landfills, we have the same cost that the big [1:20:59] landfills do by the same type of compact or fuel, every wages, all these things tend to [1:21:05] play and yeah, we're not putting as much garbage away but they're just doing it on [1:21:11] I mean, I am County Lancel's getting 400 and 500 ton a day. [1:21:17] Hey, we're doing it. [1:21:19] We are too. [1:21:20] Thank you. [1:21:23] Let's go. [1:21:24] The 29 bucks see how she runs. [1:21:27] We're not collecting the limo and cans. [1:21:29] Let's see how it goes. [1:21:29] We have to dip into the sacred fund. [1:21:31] I have to. [1:21:32] I sold our metal again. [1:21:34] I pulled the trigger and we got another $5,000 or $10,000 off our metal. [1:21:38] So I'll just keep doing whatever I can do to save money and maybe we'll find a stack of gold bar. [1:21:45] Okay, so we'll have a resolution next meeting with increase on the conversion sum. [1:21:53] 17 to 10 to 25. [1:21:56] It's very across the board. [1:21:57] That's going to be a nice one. [1:21:58] Here you go. [1:21:59] Yeah. [1:22:00] Can you discuss the scope of the $15 residential [1:22:02] song away service fee in charges for larger residential [1:22:06] words, lords, loads? [1:22:09] Can you just give that piece for larger residential loads? [1:22:15] No. [1:22:16] Nope. [1:22:17] That's another one. [1:22:18] But I don't. [1:22:18] Well, we did cover this. [1:22:19] Let me talk about it. [1:22:21] And that's going to be a halftime. [1:22:23] I think residential loans are going to have to consist [1:22:26] of residential trackways. [1:22:27] outrather household waste, baggable box for your TV, if it's carpet and drywall, [1:22:35] if you can drywall it'd be on that. [1:22:40] Who used to the job that you sat in that, though? [1:22:43] Here, when you're working here, you're sat in the front. It'll just be us, it'll be. [1:22:50] But I mean we have people that have rental homes and these people like leave their [1:22:58] rentals and the owners come in and they clean out a whole house, but that's commercial and it would be commercial [1:23:04] That's commercial. That should be charged. Or even I there was another individual who he was moving and he brought [1:23:13] three or four dump truckloads of household garbage that was his residential [1:23:19] He put it in our dumpster and he put it in the roll-off [1:23:22] And it cost $150,000, doesn't have that $10,000. [1:23:25] To all of you. [1:23:26] And he got three. [1:23:28] No, but I know some people have done that in my life. [1:23:31] But that's the only thing I'm wondering. [1:23:33] It's going to make every decision. [1:23:37] Well, just have to do something. [1:23:39] But it's going to be an other system, too. [1:23:42] I mean, is it commercial? [1:23:45] Is this from your rental? [1:23:47] Well, they're here the best we can. [1:23:48] The best we can. [1:23:49] Yeah, they're the best we can. [1:23:51] I think I've got to build a house on $15 a month. [1:23:54] He wasn't even charged with $50, [1:23:56] because he didn't have a part of it. [1:23:58] That was great. [1:24:00] So, anything else on that? [1:24:03] We will, we will, we will start into revenue. [1:24:05] Okay, Resolution 2026-1-A. [1:24:11] Resolution Granny, Elevate Recycling, [1:24:13] Full Service in Utah. [1:24:15] Exclusive right to collect the transport [1:24:17] residential solid waste. [1:24:19] and just for your accounting, possible board action. [1:24:27] So in a nutshell, we've given up the franchise's [1:24:31] agreement on commercial. [1:24:32] It just didn't make sense it wasn't working. [1:24:35] But on the other hand, part of the agreement [1:24:38] we've made with in this, they're [1:24:39] going to have the excuse to be able to be the one [1:24:41] to collect the residential cash, which [1:24:43] it does make sense. [1:24:44] It does make sense to have a single collector [1:24:47] gathering the residential waste. [1:24:49] And so this just formally declares that they're the ones [1:24:52] who got the job and it's got to be them and I don't think there's going to be any fuss [1:24:57] or any competition of a residential it's the commercial that's going to be very safe [1:25:04] so [1:25:09] what's on business on what do we need to do? [1:25:13] Make a motion to adopt resolution 26-1 I'll make that motion we adopt the resolution [1:25:21] second it. Okay, I have motion by Troy, second by Jack to adopt resolution 2026-1. This will be a [1:25:29] road call vote. Robin. Hi. Troy. Jack. Hi. John. I can make sure you're hardly. Hi. [1:25:37] I'm going to pass on to ask me. [1:25:44] Mike, do you have anything else for the board? [1:25:46] You guys have heard enough from me tonight and I'm sweating. I'm feeling this. [1:25:50] Why is it driving me? [1:25:52] How about our attorney? [1:25:54] Do you have anything that you have? [1:25:58] Anything that I have anything? [1:25:59] No, I don't think so. [1:26:04] Anybody else on the board have anything? [1:26:06] I don't have anything I can say is my... [1:26:09] Young lady, we appreciate what you do for us. [1:26:12] We have quite a task now because everything changes so fast. [1:26:15] Nothing's like it used to be. [1:26:17] Katie puts this stuff all together. [1:26:19] We appreciate that. [1:26:21] We've got a letter for you to give me. [1:26:23] I made a huge incense sentence. [1:26:25] No, no, no, I made a choice about the glass of alcohol, [1:26:27] it's involved with Andrew DeCon. [1:26:29] Backtrade can not be a difficult work. [1:26:31] I just signed it. [1:26:32] I just signed it. [1:26:33] I'm there to the head, man. [1:26:34] There's a whole lot of mercy. [1:26:36] Hey, maybe in adjourned. [1:26:37] Thank you, then. [1:26:38] Thank you. [1:26:39] That price thing, David, you would have had I give. [1:26:42] I give that a call. [1:26:44] Maybe you make that. [1:26:46] I can tell who made it. [1:26:47] She wasn't going to make it nice.
