[12:09] But I would summarize the budget amendments into three basic changes, which is in the general fund. [12:18] We're proposing changing and essentially transferring money or expenses from one line item to the other. [12:27] and essentially what's happening here is we've been taking care of some of our [12:34] janitorial surfaces in-house and it's bringing proposed that we outsource those. [12:40] So it doesn't necessarily change the cost. In fact, I think it's going to end up [12:45] being less to outsource them and frankly we feel like right now with some of the [12:52] changes we've already implemented, we outsource the restrooms and that seems to [12:56] going well and it's been a positive step as far as keeping those clean and would like to [13:06] continue with that change by amending the budget to include a larger or an increase in service [13:17] by the contractor. The other changes are related to funding some [13:27] park improvements. On your agenda's night, there's the opportunity to consider awarding [13:33] some improvements for Polterpond. The original budget anticipated budgeting, only a portion [13:41] of those improvements. Under the council's direction we actually bidded the entire park improvements [13:48] minor minus the playground and maybe a few other amenities but more or less the park will be [13:57] completed and the landscaping and parking lot would be essentially completed to its final envisioned [14:06] and level of improvement and so that is one change. [14:12] We also forthcoming will be a bid for Windsor Park to finish that and some of the preliminary [14:20] costs that we've estimated now exceeds the amount of budget that was previously allocated [14:28] with the original budget. [14:30] So there's an amendment that would add some additional resources there so that we can [14:35] and consider essentially funding all the entire improvements. [14:39] Now, the actual amount won't be known until we go through the bidding process. [14:43] So this is just putting us in a position to be able to essentially award what we might be the final cost there. [14:54] I would tell you that what is being proposed here and the way that we're funding. [15:00] These amendments for the park improvements is one, we are using the, we refer to them as the [15:09] ARPA funds, but they're really a previous transfer from the general fund upwards of, I think [15:16] it's $1.7 million, and we put that in the capital projects fund on the balance sheet [15:24] with the restriction that the City Council would need to designate a special project to expend those funds on and this would be that project and we've talked about it before. There isn't a departure, but there was a disconnect between what we intended to do and what was actually shown in the budget document being the spreadsheet itself, so that would adjust and correct that issue. [15:50] And then the other funding source would be funding all the impact fees in the fund balance. [15:58] I do not anticipate that we would expend them all, but it just allocates all of them. [16:03] They are restricted for specific expenses. [16:07] So, you know, with these being, with these parks being the most significant. [16:45] But we do believe that it's a fundamental piece of equipment that is needed for the city not only in public works, but I think there's some value in parks as well to potentially use that and it just allows the city a safe platform to work on on any project at height. [17:05] And we you might recall we as an alternative we explored the concept of renting the bucket truck and to the degree that we've been without a bucket truck since those conversations. [17:20] John has reached out and tried to actually rent the bucket truck on a few projects that were, you know, that were at height greater than they felt comfortable using ladders. [17:33] the problem is that there's not a lot of bucket trucks available. [17:40] I think they reserve them for longer periods of time for rentals. [17:44] And John can go into more depth if there's questions about that option as an alternative. [17:49] But I think in short I would just say that it's not as accessible as we would hope to be able to access just for ongoing needs of the city. I have real-time experience without [34:03] understanding. When I decided I wanted to do a project and it ends up taking [34:07] a little longer versus having a contract to come in and whip it out in a [34:10] couple of days. It takes longer but I wanted to make sure we're just utilizing the funding. [34:15] With the understanding of what the budget might have been with the 2.2 that's [34:20] when we thought we should try to get an estimate. [34:22] So we asked a contractor from Salt Lake City [34:24] that's done a little bit of work. [34:25] He actually did Salt Point for Woodside. [34:28] We asked for an estimate of maybe what that would look like. [34:31] So we sent him the scope and he said it back with numbers [34:34] and it was about 2.4. [34:44] If we had some local contractors, [34:46] we were quite intrigued to see if maybe we could hit [34:48] the budget amount with the estimate shown, and I agreed that maybe we look at trying to [34:52] hit that 2.4 with the idea that maybe we do. We don't know what will come in at. We [34:57] don't know who will bid on it, and we don't know what their timeframes or, you know, some [35:00] people will bid for different purposes. They could come in really high just because they're [35:03] very busy, but they still want to bid on the project to see. So we really don't know what [35:07] will come in at. It couldn't answer that. It could come in higher than that, and then [35:10] we'd be looking at rejecting and saying, okay, how do we want to attack this differently? [35:14] Okay. I know that, you know, it's your [35:19] choices as council, but I'd like to just walk through that a little bit closer as we [35:24] get to that point to see where we're at because I think it is a lot of money as we want to [35:30] try and utilize it. I think I just need to understand where it lands [35:43] so that we can figure out, is it make more sense for the city to get involved with it more [35:49] as a general, or do we just get it fixed up? I think it was A and A and C and then the lowest bid for [40:16] schedule B was a different contractor. So there are going to need to be some [40:20] coordination efforts between the two contractors but we do think it's a [40:25] project that, you know, can still be coordinated and completed at the lowest possible rate. [40:33] Anyways, I was pretty excited to see the bids come in and essentially to make, you know, [40:41] significant progress on the completion of the park. And by awarding this bid with all pre-schedules, [40:48] and would accomplish more or less completing the park with the option to continue to evaluate the need for playground or the desire for playground in future years. [41:01] Yeah, because of the different bids on here, it's going to be a coordination effort for sure. [41:07] Trees and everything, other things that are being taken care of so is that part of something you guys will be managing and working with these groups? [41:25] We anticipate kind of a pre-construction meeting where we try to get both construction groups [41:30] there so we can kind of understand and work and some of that was talked about with all [41:34] the contractors that bid in our pre-bid meeting that we had on site kind of understanding [41:39] that depending on how this goes, you could win two different portions of the landscaping [41:43] specifically where the biggest concern will be and so we'll have a pre-construction meeting [41:49] to kind of go over that, and then it'll be something where we'll be monitoring it aggressively [41:54] as we go hitting timelines. That'll be one of the other challenges that we have is trying to [41:58] coordinate all the different contractors, or the two different contractors, I guess I should say, [42:03] with the weather. That plays an integral part at Polter just because the material that's there, [42:09] and it's going into fall, so depending on how wet the spring is and whatnot. [49:04] French, living trust, and James A. French, living trust, and the city of West [49:09] Haven. Mr. Nelson, did you want to take that one? Yeah, I can provide an [49:15] introduction and some background information. [49:19] So West Haven entered into a lease [49:21] agreement with the French family on September 4th of 2023 for a dedicated section of right [49:30] of way that ran adjacent to their property. The agreements terms were from 2023 to 2013 to 2023, [49:38] and then on a month-to-month basis after that, for at least payment of $1 per year. [49:45] A few years ago, I think it's important to note that a few years ago, the city had asked the [49:50] the property owner to vacate partial of that right away property, which they did comply [49:55] with at that time, and now are occupying about half of the current dedication that's adjacent [50:00] to their property. [50:03] So the thing that's triggering, so at this, the city has written up a resolution, [50:12] to authorize [50:12] the city manager to terminate this lease agreement according to the terms within it within [50:17] the agreement. The catalyst for this request is the development that is located just north of [50:25] their property and that this right-of-way stubs into is looking to amend their current subdivision [50:32] plot. Right now it's the I don't really know how to pronounce the name of this subdivision. [50:39] It's Kirchavali V. Subdivision currently connects into the Rosewood road with a private [50:48] roadway. That was and the subdivision was approved back in 2021. The developer and the [50:54] owner of the subdivision has came in and requested to access the RTU to a private roadway to [51:06] to do a full dedication of public roadway and to build a cul-de-sac, which complies [51:14] more further with our standards. [51:18] The main concern that the applicant has brought up is just the concerns about maintaining [51:23] a private road between the four lots. [51:26] So doing so, they would need access to a full right of way. [51:31] They have provided a, the, the, the, Kurtzavelli amended [51:36] plan. They've provided some updated construction [51:38] drawings and they're about ready for approval, which we go [51:43] to the planning commission. And so this time, we've brought [51:45] forth a termination, the resolution to terminate the [51:49] least agreement. So the developer could access that right [51:53] of way. So there are a couple terms that I think is important [51:58] to consider as we look at this lease agreement, these are highlighted within the staff report, [52:03] so I won't touch on all of them. And I've talked a little bit about it already, so I won't talk [52:10] about everyone that's listed in there. But generally speaking, as mentioned, the lease agreement was [52:16] from 2013 to 2023, then on a month-to-month basis after that. And lease payment was for $1 per year. [52:23] the LEC has made all the required annual payments. Under the terms of termination, there are two [52:29] sections of the agreement that I think are important. The first one is an item seven, which reads [52:34] LEC agrees to maintain the property in a clean and sanitary manner and not to make any alterations [52:41] to the property of us. These are in a consent. At the termination of the LEC, the LEC agrees to leave [52:47] the property in the same condition as or better condition than when it was received [52:53] except for a normal wear and tear and subject to proper authorization for any improvements [52:59] installed by the leaseee. [53:01] So essentially, once the lease is terminated, the property owner is required to remove [53:08] their stuff off the property and to return it to a like similar state as when it was released [53:16] to them. Then under section one, our section 21, which is the last section within the agreement, [53:24] it states that any other provisions in this lease to the contrary, notwithstanding the city [53:29] shall have the unilateral right to terminate this lease with not less than 30 days notice for any [53:34] valid government purpose, the city shall determine in their sole discretion what constitutes a valid [53:40] governmental purpose. [53:43] So to speak to that a little bit I've kind of indicated the why this is being [53:49] brought now and kind of the catalyst for this. So it's in staff's opinion that providing roadways [53:55] and access to homes for future government is a valid government purpose. Our subdivision code [54:00] itself requires that developers stub roadways into adjacent properties to provide that access. As I'm [54:09] seen in 156.055 subsection A, and then it also requires that that streets and alleys [54:20] and cul-de-sac season of that streets and subdivisions shall be dedicated and this [54:24] is under 156.056 subsection A requires that these roads within subdivisions are dedicated [54:32] it as public streets, except for within approved P-R-U-Ds. [54:40] And so with that being said, staff recommends that the Council can review the current, the [54:46] review of the lease agreement and the recommendations for why we would want to terminate the lease [54:55] and then would recommend making a motion on such.
