[0:05] Good evening everyone. Welcome to the [0:07] board of supervisors first meeting of [0:10] the year. Please rise. [0:15] » Aliance to the flag of the United States [0:18] of America and to the stand [0:24] indivisible. [0:36] Believe it or not, I don't think we had [0:37] any executive sessions, [laughter] [0:41] but a few few announcements. I did want [0:43] to start off with some good news. Uh we [0:46] just received the grant money uh which [0:49] which Jim Wendlegas was helpful in [0:52] requesting when he was manager for the [0:54] LSA grant. That's the local share grant [0:57] uh which comes from the gaming money and [0:59] we received $120,000 [1:02] for the compact track loader and $64,000 [1:06] for the police vehicle. So So that's [1:08] terrific. Um, this evening's meeting is [1:12] being recorded for rebroadcast [1:17] and also wanted to just wish everyone a [1:19] happy new year and remind you you're [1:22] want to dispose of your trees. We're [1:24] accepting them right out front here. [1:25] Just no tinsel. So, we're going to move [1:29] right on to public comment. Does anyone [1:31] have public comment on any of the uh [1:34] items that are coming up tonight? [1:42] Christina Casey, West Vincent resident. [1:44] I've got a couple. Um, [1:47] Open Space Review Board. There are two [1:49] new positions that are being added to [1:51] this committee. [1:52] Um, [1:54] both of the positions are spouses of uh [1:57] of current supervisors. Um, there's [2:00] quite a few that they're on. My question [2:02] is I saw that there's some vacancies. [2:04] Um, is was that intentional? because I [2:06] know I talked to somebody who was not [2:08] reappointed who was looking to get [2:09] reappointed on a committee and was not. [2:11] » Okay. Well, would you like me to explain [2:13] what [2:14] » Sure. [2:14] » Sure. So, uh, we actually have merged [2:18] the trails committee into the open space [2:22] committee. [2:24] So, it's not so much of an appointment [2:26] as they were moved there and eliminated [2:29] a committee entirely. [2:32] » Okay. Um, as for people that might have [2:34] applied for other positions on other [2:36] committees that didn't get filled but [2:37] have vacancies, [2:38] » I'm not aware of anyone but one person [2:40] who I did talk to about it already being [2:42] full at open space but to please come. [2:44] » It wasn't open space. It was a different [2:45] committee, but I can have them contact [2:46] you. I know I know Whitney had had was [2:48] kind of wondering why she didn't get [2:50] appointed back to traffic safety. [2:51] » Oh, I had heard that she wasn't [2:53] interested. [2:53] » Oh, no. She said she was she actually [2:54] heard from me today that said that uh [2:57] that I said, "Oh, she's not coming back. [2:59] » There's two openings." [3:00] » All right. Well, I will let her know. [3:02] » Also, there are other openings and we're [3:04] not completely done. [3:05] » I will let her know. [3:06] » Sure. [3:07] » Um, the appointments now show creation [3:10] of a new position. It's called the storm [3:11] water enforcement officer. Um, who [3:14] happens to be happens to be the same [3:15] company as the assistant CEO. Um, why is [3:18] this new position being added? [3:21] » I'll let you explain that one. [3:22] » The township engineer traditionally is [3:25] the storm water enforcement officer. uh [3:28] the township engineer takes the lead on [3:30] all the applications made under our [3:32] storm water ordinance. Uh so uh he is [3:35] appointed to that position. [3:37] » So so LTL will no longer be in that [3:39] position of doing storm water. [3:42] » No. [3:42] » Okay. [3:43] » We did replace them as our township [3:44] bench. [3:45] » Okay. Just checking. [3:45] » Said that at our last meeting. [3:46] » Yep. [3:48] » Um there's a new $75 BM registration fee [3:51] that's indicated in the fee schedule. uh [3:54] who's going to be contacting all the [3:55] B&Bs in the township to collect these [3:57] fees or is that going to be up to the [3:59] residents to identify and alert the [4:02] township [4:06] » The enforcement on that? [4:07] » Yeah, Jason's position. [4:09] » So, we should send all those uh leads to [4:11] Jason who will follow up on those. [4:13] » Jason is the director of [4:15] » I understand and I'm asking who do we [4:17] send them? So, we send them to Jason and [4:18] he will be following up and collecting [4:19] the fees. [4:20] » You can send information to Jason. [4:22] » Okay. So, we'll be policing that. Um, [4:28] okay. The increase in the manager's [4:31] compensation for no cause employment [4:32] separation from 2 to 4 months. Um, [4:36] curious behind the logic behind that. [4:39] » Below the industry standard even at four [4:40] months. [4:41] » Okay. [4:43] Uh, when the manager was [4:45] » Has up to a year. [4:47] » Yeah. The police police do a very hard [4:49] job out here. I totally agree with that. [4:51] When the manager was hired, it was noted [4:53] that he would be taking over as zoning [4:54] officer for the township. It was [4:55] something that the board had had [4:56] stressed. Um, now it appears that uh [4:59] that's now being slid over to the [5:01] previous permit clerk who he said is uh [5:03] the director now zoning. [snorts] Um but [5:05] now we have two assistants which are [5:07] going to be the township manager and [5:10] that other firm as a backup. So um how [5:14] did this come about when I thought that [5:15] the manager was going to be the zoning [5:18] officer? [5:20] Jason's position was promoted and it's [5:22] as part of his new [clears throat] job [5:23] description. [5:24] » So, you're having that portion taken [5:25] away and Jason's going to be doing that [5:26] part of the job. [5:27] » I'll be the deputy assistant. [5:28] » Deputy. Okay. So, [5:30] » All right. Deputy. [5:33] Okay. [5:37] » Okay. I'll be back up in a little bit. [5:40] » Okay. And by the way, you mentioned [5:42] something that I did want to talk about, [5:44] which was the the fees. There's a large [5:46] change in the fee schedule. if anyone uh [5:50] took the time to notice these have been [5:52] drastically reduced overall and that's [5:54] that's basically from an analysis to [5:56] find that we were overcharging our [5:58] residents. [6:00] » We can talk about that when we get to [6:01] it. Tommy will explain it. [6:05] Anyone else public comment? [6:09] Okay, seeing none, uh we're going to [6:12] move on and uh I would like to appoint a [6:16] temporary chair, right? I would like to [6:18] transfer [6:20] all in favor. [6:23] » All in favor? [6:24] » I [6:24] » I [6:32] Yes. Uh board of supervisors chair. A [6:35] motion to appoint the [6:39] uh I'll pick Dana as board supervisor [6:42] chair for 2026. [6:45] Second. [6:47] All in favor? I I [6:49] » Okay, good. You got it back. [6:51] » Okay, congratulations. And now, thank [6:53] you. [clears throat] Now, we're going to [6:54] appoint a vice chair. And I would like [6:58] to nominate Colon Cororus for vice [7:00] chair. [7:01] » Yes, sir. [7:03] » All in favor? [7:04] » I [7:04] » I Great. Okay, that business is done [7:07] with [7:09] uh [7:12] and now we move on to Dave. You're up [7:15] for public hearing. [7:18] » Yes. Thank you, madam chairwoman. On the [7:21] agenda is an ordinance [7:25] um 20 [7:28] 220-2025 [7:31] and it's an ordinance where we are [7:33] changing [7:35] some of the language relative to the [7:39] space board. [7:42] I'm going to get it in front of me here. [7:45] I can talk about it. [7:48] 220 [7:51] things there 224 [7:54] 20 I'm sorry 224 2026. Uh it's an [7:57] ordinance that basically we're changing [7:59] a few of the sections. Uh we're adding [8:02] members to the [8:05] open space board going from five to [8:07] seven. Um in doing that we're staggering [8:10] the terms of the two new people. Um [8:13] they'll be all be fiveyear terms, but [8:15] the two new people joining will have [8:17] staggered terms as they fit into the the [8:21] five that are there. Um and there's a [8:24] provision that the um [8:29] the board super shall appoint three [8:31] members of the space review board to [8:32] serve on the trail committee [8:33] implementation subcommittee. So the [8:36] trail committee as um madame chairperson [8:39] has said uh is being folded into the [8:42] open space review board and um the [8:45] supervisors will choose the members of [8:48] that uh subcommittee that are part of [8:50] the open space review board. [8:52] » It does look like there's maybe a [8:53] discrepancy in the numbers here. [8:55] » It's this one here. [8:58] » That's an error down there. [9:00] » Yeah. [9:01] It's 2024 [9:04] 224-20 [9:06] » 2026 [9:07] » 2026 is the correct number. [9:09] » So that's the explanation. Uh we're [9:11] having a public hearing. It's [9:12] opportunity for anyone who has any [9:14] question or comments about that [9:16] ordinance can come forward now and make [9:19] your public comments. [9:21] » And I'm going to make one comment too. I [9:23] had seen something that um I think needs [9:26] to be clarified about the you know every [9:30] year [9:31] uh that the liaison is chosen to [9:34] actually be a member of [9:37] open space from one from planning and [9:40] one from the EAC and I think it still [9:44] said that they were fiveyear terms which [9:46] doesn't make sense because they would [9:48] renew every year [9:52] [clears throat] [9:52] » That That would have to be addressed in [9:54] the Senate speaking by the people or [9:57] that's here. [9:57] » We'd have to fix that. [9:58] » We'll fix that. [9:59] » Okay. [10:01] » Any other Are there any other comments [10:04] or questions? [10:06] All right. Hearing none, I recommend you [10:08] close the hearing [10:11] a [10:22] Yes. [10:22] » Yeah. It's on there. [10:23] » And and if we know that it's obained, we [10:25] just have to do that after it's [10:27] approved. [10:28] » Public hearing. [10:29] » Okay. [10:31] » Go ahead. [10:33] » Entertain. [10:33] » All right. Uh can we get a motion then [10:35] for a public hearing? Ordinance 224-2026 [10:40] open space review board. [10:46] Second. Second. [10:47] » Okay. All in favor? I I [10:54] And next up is the very lengthy [10:57] volunteer appointment list. Um I I had [11:02] two changes to that. Um one is uh Jason [11:08] Cray is who was appointed to human [11:11] relations not trails a for Cray not [11:15] trail. And uh also Chip Farnum [11:20] has agreed to join uh the traffic safety [11:24] committee as well. So we want to add all [11:28] those in. Does anyone have any comments [11:30] about the volunteer appointments? [11:34] No. Seeing none and certainly there are [11:37] openings. Please just let us know if we [11:38] missed anyone. Um all favor. [11:44] » Oh, sorry. [11:45] So we [11:48] » Say it. Thank you. [11:49] » Yeah. [11:50] » Okay, it's approved. Thank you. [11:55] » And then [11:59] meeting schedules. [12:03] » Your board leazison is there. [12:06] » We have to do that separate. Okay. [12:07] Motion to appoint the board leaison as [12:10] listed in the township manager memo [12:12] dated December 26, 2025. [12:17] » Vote. [12:19] » All in favor? [12:20] » I [12:20] » I [12:25] for meeting schedules, there's a motion [12:27] to adopt the meeting schedules and other [12:29] establishments is listed in the township [12:31] manager memo dated 20 December 26, 2025. [12:35] And I believe that is adding the [12:37] workshops in there which is new. If [12:40] anyone has a question about that at all, [12:42] certainly happy to entertain that. [12:47] » I'd like to make a motion to adopt the [12:48] meeting schedules as established. [12:53] » Second. [12:55] » Second. [12:56] » All in favor? [12:57] » I. [13:02] And then we need a motion to approve the [13:04] December 15 meeting minutes as [13:06] presented. [13:07] » So move second. [13:09] » All in favor? [13:10] » I [13:11] » I [13:18] have a motion to approve resolution [13:21] 2025 or I'm sorry 2026 to adopt energy [13:26] service areas for 2026 is listed. [13:32] I'll make a motion [13:34] to adopt the emergency service series [13:36] 2026. [13:38] Second that. [13:39] » Any questions on that at all? [13:42] » All in favor? [13:43] » I [13:43] » I [13:49] resolution 2 2026. A motion to approve [13:52] resolution 226 to adopt the 2026 fee [13:56] schedule. And I would like Tommy if you [13:58] could bring up some of the the changes [14:01] to that to highlight what has occurred. [14:04] » Yeah. As uh is best management practice [14:06] for municipalities prior to adoption the [14:10] fee schedule. We take a look at the uh [14:13] proposed fees relative to uh the cost [14:16] that the township incurs uh to process [14:19] individual permits and other approvals [14:22] and make adjustments where necessary. As [14:26] the chair noted a few moments ago, [14:28] generally uh there has been a decrease [14:31] uh to several of the fees uh that are [14:35] proposed this year relative to the fee [14:37] that was charged in 2025. Uh there are a [14:41] couple of new fees added uh to the [14:43] schedule uh including uh underground [14:46] storage tanks um which was uh left off [14:50] uh the schedule in past years. Uh the [14:54] escros that are required to be posted [14:56] with land developments uh have uh have [14:59] been revised as well. Uh generally up uh [15:02] and in [snorts] several instances we [15:04] have consolidated [15:06] uh fees that are charged uh we had mult [15:09] multiple instances of multiple fees [15:11] charged for the same approval. Uh and [15:13] that has been streamlined so folks are [15:15] paying uh one fee instead of uh more [15:19] than one fee. Uh we can review uh any of [15:23] the uh [15:25] fees if folks want to discuss [15:29] but I believe all are self-explanatory [15:31] as to what permits uh require what fees [15:34] and escros as needed. [15:39] » Any comments, questions? [15:46] » Jamie McBicker. Um first of all, who's [15:48] the new guy? Oh my goodness. We didn't [15:51] introduce Sean. [15:55] » Sorry. This is Sean Clark. Welcome. [15:56] » Welcome Sean. [15:57] » Well, thank you for I'm happy to be here [15:59] tonight. [16:00] » God bless you. Why anybody wants to be a [16:01] supervisor and talk to me in another six [16:04] years, right? [16:05] » Uh [16:07] I just I hadn't looked at these before [16:09] and just looking at the fees it looks [16:10] like a lot of them have gone up. Um it [16:14] would have been helpful to see a side by [16:15] side of before and afters, but [16:17] » Again, most are going down. Most changes [16:19] are damp. [16:20] » Be that as it may, I'm saying there's a [16:23] lot of them that have gone up. [16:24] » Uh so I'm just [16:25] » I can identify the ones that are [16:26] increasing if that helps. [16:28] » Uh sure. [16:29] » Okay. Um well, do you want me to [16:32] identify the all the changes? [16:35] » I you know, I don't know. I guess it's [16:37] more up to people if there people here [16:38] who see something. [16:40] » We can go. So residential permits on [16:42] page one, new family, new single family [16:45] and single family additions. uh that [16:47] decreases [16:49] uh from 1.5% cost of construction to [16:52] 1.25. [16:53] Uh the second new accessory structures [16:56] also decreases from 1.5 to 1.25. [16:59] » Tommy, can I interrupt for a second? [17:00] Sure. [17:01] » So I just I just Googled West Vincent [17:04] Township fee schedule. It shows what I'm [17:06] looking at may be wrong, but the very [17:08] first thing new construction and [17:09] addition went from 500 to 1250. Am I [17:12] looking at [17:13] » Are you Are you looking at residential [17:15] permits? Yeah. [17:17] » What What's the year on top of what [17:18] you're looking at? [17:19] » 2025. [17:20] [clears throat] [17:20] » 2025. [17:23] I have the 2025 fee schedule here [17:28] » And it's $500 plus 1.5% cost of [17:32] construction, [17:33] you know. [17:34] » Right. But now it's $1250. [17:37] » Where are you getting 1250, Jay? [17:38] » From when you handed out. Am I looking [17:41] the wrong place? [17:41] » Yeah. New construction and additions. [17:44] I'm sorry. That's res non-residential. [17:46] » That's non-residential. [17:47] » I apologize. [17:48] » Okay. Let's start on page one. Okay. [17:50] » Start at the top. [17:51] » We're a little better to the residents. [17:53] » So, residential permits, the cost of [17:55] construction charge decreases from 1.5% [17:58] to 1.25%. [18:01] The new accessory structure decreases [18:04] from 1.5% to 1.25%. [18:08] Alterations decreases from 1.5% to [18:12] 1.25%. [18:14] Decks, patios, porches, pergolas [18:17] decreases from 1.5% to 1.25%. [18:22] Solar generator, mechanical HVAC per [18:25] unit decreases 1.5% to 1.25%. [18:30] Fire suppression systems and alarm [18:31] systems decreases from 1.5% [18:35] 1.25%. [18:37] On page three, electrical permit [18:39] decreases from 1.5% to 1.25%. [18:44] Bunning decreases 1.5% to 1.25%. [18:49] Swimming pools in ground [18:52] increases from 250 to 350. [18:57] » And Tommy just just stop you [18:59] [clears throat] for a second. [19:01] » So you're on page two now. [19:03] » Yep. Go ahead. [19:04] » Winning pool above ground increases from [19:07] 100 to 135. However, the cost of [19:11] construction decreases from 1.5 [19:15] to 1.25. So that's that's probably going [19:18] to be revenue neutral because two are [19:20] going up a little, one's going down. [19:24] » As I noted, accessory uses [19:28] um that increased from $100 to $125. [19:33] However, again, the cost of construction [19:35] fee, which is normally the bigger fee [19:37] that the resident pays, decreases from [19:41] 1.5 to 1.25. [19:44] Zoning permits increase from 300 to 310. [19:47] Driveway permits increase from 300 to [19:50] 310. And those are the only other [19:52] changes on page two. On page three, [19:56] non-residential fundaments decreases [19:59] from $1,500 [20:02] to $1,250. [20:04] New accessory structures, nonresidential [20:08] decreases because the township was [20:10] charging two fees, a $300 review fee and [20:13] a $100 two-hour administrative fee. Uh [20:18] that is the example of the combination [20:19] of fees. The new fee is 350. The old fee [20:22] was 4, the new fee is 350. The very same [20:25] thing with the next one, alterations. [20:28] The new fee is 550. The ch township was [20:31] charging two fees totaling 600 last [20:33] year. [20:34] » Solar generator, mechanical, HBAC per [20:37] unit. Same thing. We're going from $600 [20:40] to $550. Fire suppression systems, same [20:44] thing here. We're going from 500 to 450. [20:48] Electrical fee, same. were decreasing [20:51] from 400 to 350. [20:54] Um, under electrical 2 that adopted last [20:57] year had a permit issued for new service [21:01] at $0. [21:03] I think that was a typo. So, we [21:05] calculated the appropriate fee in that [21:06] $600. I can't tell you what the fee was [21:08] last year because the fee schedule [21:10] listed zero. Plumbing fee decreases from [21:14] $400 to $450 to [21:18] » 350. I'm sorry. [21:20] swimming pools, uh, accessory recreation [21:22] uses. These are for non-residential [21:24] properties decreases from 600 to 550. [21:27] » Can I just interrupt for a sec? Yeah. [21:29] » What's a nonresidential? [21:31] » If a if an HOA wants to put a swimming [21:34] pool in a clubhouse, if um, you know, if [21:37] if if a recreational use wants to do [21:39] something like that. So, not common, but [21:41] you want to make sure you have something [21:43] there in the event. Yeah. What if [21:45] somebody I mean not to get into this but [21:49] just off the top of my head thinking [21:50] about it. So we have a famous infamous [21:53] place happening up the road here [21:56] where a guy from California comes in and [21:58] develops a property. Is that considered [22:00] residential? [22:02] » That's considered accessory because the [22:04] bed and breakfast is accessory to the [22:05] residential use there. [22:06] » Okay. [22:07] » If there wasn't a residential use there, [22:08] if it was just a like a hotel, that's [22:10] certainly commercial and this would [22:12] attach. I guess my real question is if [22:13] somebody has two homes and they live in [22:15] Oklahoma but own a property here, are [22:17] they residential or non the house is [22:19] residential but they're not residential. [22:21] » Well, you talk about residency and [22:23] residential which are two different [22:25] not whether they have multiple homes. [22:27] » Yeah. [22:28] » Okay. [22:28] » If they're using it as a home, it's a [22:30] home. That's [22:31] » Even if they have multiple home. [22:32] » Okay. Uh zoning permit for [22:34] non-residential just like the one for [22:36] residential increasing from $300 to 310. [22:40] Driveway permits. That was really odd. [22:42] Uh the township last year uh was [22:44] charging $2,500 for a driveway permit. I [22:48] can't imagine why. The new fee is $310 [22:51] and we're requiring an escrow in the [22:53] event that something's needed from the [22:54] county traffic engineer. The person [22:56] applying for the permit will pay the [22:58] actual cost and not a penny more. Uh but [23:01] that $2,500 fee wasn't appropriate. A [23:04] reinspection fee uh increased from $200 [23:07] to $250. [23:09] And that's it for page four. [23:14] Page five, the bridge weight limit. We [23:16] had charged $1,000 [23:19] uh last year proposed 300 with that [23:21] escrow. Again, I don't know the thinking [23:24] behind last year's uh number, but it [23:26] just it doesn't make sense. uh [23:29] demolition permit uh increasing from [23:31] $200 to $300 for residential, [23:35] decreasing from $500 to uh $300 for [23:39] non-residential. There's really no [23:41] difference in the service we provide [23:43] with those two uses. And so they're the [23:45] uh they're the same. There is an [23:47] additional escrow there needed again to [23:49] pay any actual cost that we incur in uh [23:52] in doing that. Uh but that is just to [23:54] reimburse ourselves for our consultants [23:56] work if any. uh the balance of escros of [23:59] course are returned to folks in full. Uh [24:02] further down on page five you see the [24:04] two new additions above ground storage [24:05] tank and below ground storage tank. [24:08] Those are new uh as was noted earlier. [24:11] Uh two down from there the bed and [24:12] breakfast registration fee. Uh that was [24:15] omitted on past year's uh fee schedules. [24:18] We've made the correction here. Uh [24:20] special events fees uh for temporary uh [24:24] fee temporary special events up to seven [24:26] days. the same 100 uh for seasonal [24:28] events 8 days to 180 days it increased [24:32] to 150 from 100 [24:37] » Was special event on there before [24:40] » Yes [24:42] » Okay I don't see it [24:44] » I think it was listed under special [24:46] zoning [24:47] » Okay [24:48] » Uh storm water um management now these [24:51] are the permits that um the residents [24:54] apply for talk about the simplified that [24:56] plan. Uh last year we had a lot of [24:59] residents coming in here doing [25:00] simplified storm water management and [25:02] they apply for a permit. Uh if they're [25:04] doing a swimming pool or if they're [25:06] doing uh a deck uh that is considered uh [25:10] impervious or a patio or a very modest [25:12] addition, anything uh up to uh anything [25:15] between two 1,000 and 2,000 square feet. [25:18] And there are many folks that have to do [25:19] this. We're decreasing that fee from [25:21] $1,000 [25:23] to $450. [25:26] for the storm water management [25:28] application non-simplified the bigger [25:30] things we're decreasing that from $3500 [25:33] to $750 [25:38] subdivision and land development [25:39] approvals application fee base fees have [25:42] been consolidated so the numbers there [25:44] if we look at it kind of like apples to [25:46] oranges but uh generally they're going [25:49] down in fact I don't know any of the [25:52] small subdivision fees or land [25:54] development fees that we charged are [25:55] going up. We adjusted escros where [25:58] appropriate, but again, that's not a [25:59] fee. Those things are posted to [26:01] reimburse the township for actual [26:03] expenses. And what we don't get uh what [26:06] we get reimbursed for is the actual cost [26:09] to um for our consultants to provide [26:11] that service. [26:14] Uh we'll go now. No other changes until [26:16] you get down to page seven. [26:19] Zoning hearing board and other appeals. [26:22] Um [26:24] I don't know how much time the township [26:27] previous managers township secretary [26:29] spent uh looking at the zoning hearing [26:31] board fees, the UCCC fees, uh board of [26:34] appeal fees, conditional use fees. Um [26:37] but that we can charge is set by state [26:39] law in specific the municipalities [26:41] planning code. If you open up that state [26:43] law that says municipalities, you have [26:45] the right, sole right to write the laws, [26:49] but the cost if somebody wants to [26:52] challenge the laws, ask for a variance, [26:53] ask for a special exception to defend [26:56] that solicitor bills and so forth, [26:58] that's your burden, [clears throat] [26:59] » Right? In exchange for giving you the [27:01] right to write the rules, the cost to [27:04] defend the rules is yours. Uh, and the [27:07] board and the uh planning code is very [27:09] specific. uh we can include in the cost [27:12] that we charge to people that go to the [27:13] zoning hearing board to go to the UCCC [27:15] board of appeals to go to the board of [27:17] supervisors when it's in a quasi [27:19] judicial uh proceeding like a [27:21] conditional use application one half of [27:24] the court reporters appearance fee. we [27:26] can uh require somebody to pay us the [27:29] cost of the legal fee, the mailings that [27:31] are sent to neighbors, the physical [27:33] posting of the property, stipens that [27:35] are paid to the zoning hearing board, if [27:37] any, we do and certain administrative [27:39] expenses. So, uh when you take a look at [27:42] these uh filing fees, they're uh they're [27:45] decreasing um for uh residential and for [27:49] non-residential applications to the uh [27:51] to the zoning hearing board. Um and we [27:54] have added the fee to readvertise and [27:58] rightsize those in case uh the zoning [28:02] hearing board and board has to meet [28:03] again at a future meeting with public [28:06] notice required. [28:08] So for example uh the township fee [28:10] schedule if I'm recalling at $3,000 fee [28:13] for nonresidential [28:15] applications to the zoning hearing board [28:17] that goes down uh to uh to $1,600. [28:20] Actually, I understand correct the [28:21] residential goes up a 100 uh from six [28:24] from 1,500 to $1,600. [28:28] And again, that is taking a look at our [28:29] actual expenses permitted by law that [28:32] can be given to uh to a person to pay. [28:35] And those are uh those are good numbers. [28:38] Um at the bottom of page seven, an [28:40] application to amend the zoning [28:42] ordinance or zoning map. We didn't have [28:43] anything of the fee schedule last year, [28:46] so we had to make sure that that was [28:47] added. zoning officer determination [28:50] letter. Uh that is likewise uh new for [28:53] folks that want an official zoning [28:55] determination. Uh if they uh if they [28:58] request that the fee is $130. And then [29:02] lastly on page eight [29:05] um one new fee and one lower fee. Copy [29:10] fees uh decreased. We had a fee in there [29:13] for color copies which uh the law didn't [29:15] permit. Uh and frankly was much greater [29:18] than what we were charging. Uh so that [29:20] is now black or white or copy is 25 [29:23] cents uh a copy. We pay about one and a [29:27] half pennies for black and white and [29:28] about 5 12 pennies for um per color. Um [29:33] and then of course the the paper and the [29:35] and and the toner and so forth. Um the [29:38] finance department there is a uh new [29:40] charge there uh an escrow release fee of [29:43] 6750. [29:45] Uh the parks department community garden [29:48] this is one of those consolidations [29:51] uh for township residents uh last year [29:54] for the two plots 20x 10 and 20 by 20. [29:57] Um, [clears throat] the township, if you [29:59] include the $50 equipment fee that was [30:02] part of the fee schedule, is going from [30:04] $85 to $75 for a 20x10 plot and from $95 [30:10] to $85 for township residents for a 20x [30:13] 20 plot. Uh, similar decrease for [30:15] non-residents. Um, I'm sorry, it's an [30:18] increase for non-residents. uh those uh [30:21] those numbers are going from 105 to 115 [30:26] and uh 115 to 125. And just as a note, [30:30] we did some numbers uh took into [30:32] consideration our true cost to maintain [30:35] that facility. Uh and it averages about [30:38] $176 [30:39] a plot. So we we made that a little [30:42] adjustment to the non-residents. Um, and [30:44] we break that down residents and [30:45] non-residents because the residents of [30:47] our community are paying to us some [30:49] additional tax dollars. There should be [30:50] some consideration given to those folks [30:52] by way of a lower fee. [30:54] » You think the gardeners are going to get [30:55] more service this year as well as you're [30:58] changing? [30:59] » Yeah. So, we [31:00] » Which you think will help maintain the [31:02] garden better. [31:03] » Yeah. So, so, so public works department [31:04] will be maintaining the entire garden. [31:06] And when we met with the uh the group of [31:08] folks who oversee the community garden a [31:11] few weeks ago, they were they were [31:12] thrilled. Now they can just focus on [31:13] their plots. [31:14] » I think the neighbors will be thrilled [31:15] too. [31:16] » Yep. Uh the police department uh fees [31:19] that are on here haven't uh changed. The [31:21] chief thinks that they are sufficient as [31:24] adopted last year. Um page nine just [31:27] includes some fee schedule notes. Uh [31:29] some of which were on last year's uh fee [31:31] schedule, others are fairly common. What [31:34] we do is we ask the uh the permit uh [31:36] director to take a look and try to um [31:39] anticipate any questions that people may [31:40] ask. better be a little proactive in [31:43] giving people information instead of [31:45] having done that and say well what [31:46] happens when or if so those things are [31:49] included here. So looking over [31:51] everything uh there's just a handful [31:54] that have increased and that number is [31:55] modest. The majority of of fees that [31:58] have changed uh have been lowered. [32:00] » Well sorry to bug the meeting down first [32:03] of all. [laughter] Second, uh, [32:06] » Thank you for taking the time to have [32:08] gone through all this before the meeting [32:10] to change these prices. On balance, it [32:12] looks like it'll be maybe not a tax [32:15] decrease to us, but, uh, we can also say [32:18] a revenue decrease to the township [32:20] possibly. Um, my only other question is, [32:23] uh, where do we go for definitions of [32:25] these things? Like it just says [32:27] driveway. If somebody was redoing their [32:29] driveway or, you know, how do we know [32:31] what special events are? If if we're [32:34] having a wedding on our property and put [32:35] up a tent, [32:36] » Yeah, [32:36] » How do we know what qualifies? [32:38] » You call and ask. In fact, just today I [32:40] received a question about what's needed [32:42] if there is a wedding on my property. [32:44] It's it's family. It's no different than [32:46] a party and I noted. But if there is a [32:48] tent, we do have a permit required for [32:50] tent. So, if you need clarification, you [32:52] just call us. [32:53] » But but and that's fine. That's good. [32:55] But but there's no place that we could [32:57] look at right now. Like if we're [32:58] thinking about redoing our driveway, [33:01] yes, we can call you, but is there a [33:02] place where things are defined on on on [33:05] online? Okay. [33:06] » Yeah. [33:07] » Okay. I know what sometimes in the [33:09] township newsletter it has it's done [33:11] done that with driveways spec [33:13] specifically, but [33:14] » Okay. [33:18] » I just wanted to ask one more question [33:20] on that too. [33:21] » Did the change in engineer make any [33:23] difference in in the fee schedule? [33:25] » Well, that was one of the factors. Um [33:28] but um it's um it's not um [33:34] it's not something that's worked into [33:35] the building permits because the [33:37] engineer sees two things generally the [33:40] subdivision and land development side. [33:42] So our our building inspector hasn't [33:46] changed. It was error last year. [33:47] » These were actual [33:48] » Yeah. So, so, so these are these are [33:50] costs associated with uh when you take a [33:52] look at the building permits and zoning [33:54] permits, primarily your building [33:55] inspector and uh your uh your zoning [33:59] officer, permit director. [34:01] » Thank you. [34:02] » Good evening. Um storage tanks, does it [34:06] matter what's in them? [34:08] » Uh anything but propane because that's [34:09] covered under a separate state law. We [34:11] don't touch that. [34:12] » Okay. And uh water. people have water [34:16] storage things for rain garden or [34:19] something. [34:19] » I'd have to look at it. I can't recall [34:21] ever being asked about that. Like a [34:22] sistern, [34:23] » Something like that. [34:24] » Consider that this. [34:25] » Okay. [34:26] » Yeah. [34:26] » And I mean obviously petroleum you want [34:28] to know, but [34:29] » Yes. [34:29] » So propane is not covered. [34:31] » That's that's a separate uh part of [34:33] state law. Somebody else not deals with [34:35] propane. [34:35] » Okay. Thank you. [34:36] » Thank you. Any other questions on that? [34:38] Please schedule. [34:42] Just a quick question about the escrow [34:45] release [34:45] » I'm sorry could could you give us your [34:46] » It's my name is Victoria Baker um the [34:49] escro release fee just curious about why [34:52] that's being added [34:54] » Because the finance director spends [34:56] approximately an hour reconciling each [34:59] uh escrow account before it's released. [35:01] » So it's a it's it's a new charge just [35:03] brought about this year just because [35:06] that came to [35:07] » It's your attention. It's a cost that's [35:09] attributable to a specific project and [35:12] just like any other cost attributable to [35:13] a project that's drawn from an ASP. [35:15] » Okay. Thank you. [35:16] » You anyone else? [35:20] » Okay. Seeing none, I think we have a [35:21] motion on the table. We have a second. [35:26] » All in favor? [35:27] » I. [35:28] » Motion passes. [35:32] » Okay. Can we have a motion to approve [35:34] resolution 32026 to appoint Mali [35:37] Accountants Advisors to prepare the [35:40] township audit for fiscal year 2025 and [35:43] to provide other related services as may [35:45] be required? [35:46] » So moved. Second. [35:48] » All in favor? [35:50] » I. [35:53] A motion to approve resolution 42026 to [35:56] renew the term of the township manager [35:59] employment agreement and to revise [36:00] certain terms of this agreement. [36:03] » So move second. [36:06] » All in favor? [36:06] » I [36:07] » I [36:10] approved [36:13] Pennsylvania Labor Relations Board [36:15] petition. A motion to authorize Township [36:17] Labor Council to file a petition to the [36:20] Pennsylvania Labor Relations Board as to [36:22] the position of director of codes [36:24] permitting and zoning. [36:26] » So moved. Second. [36:29] » All in favor? [36:30] » I I [36:36] also Pennsylvania Labor Relations Board [36:39] petition a motion to the township [36:41] solicitor. Is that [36:43] » The heading is not correct? No. [36:44] [clears throat] [36:45] Okay. What's it's regarding the township [36:48] solicitor to post [36:49] » Estimated [36:50] » Correct? Mr. Heading is not right. Go [36:51] ahead. [36:52] » Reading the motion. [36:53] » Yeah. Okay. Forget that. [36:56] » A motion to authorize the township [36:58] solicitor to post estimated just [37:00] compensation for the acquisition of [37:02] rightaway and a temporary construction [37:05] easement for the Buttonwood Bridge [37:07] replacement project. [37:08] » So moved. [37:09] » Definitely not the same thing. All in [37:11] favor? I [37:12] » I motion passes. [37:18] » We're up to public comment. Does anyone [37:20] have public comment? [37:23] Come on. [37:28] This is for non-aggenda items. [37:31] » So, I have a question on right to knows. [37:34] uh your right to know form that's on the [37:36] website actually has a check box that [37:37] says please send your uh the response [37:39] via email and US mail. Um when the email [37:44] box is checked, why are we not receiving [37:46] it via email and we're only receiving it [37:48] via via USPS? [37:53] » I think that's for our right to know [37:54] officer. [37:55] » The form that's posted on our website is [37:57] the form that's approved by the office [37:59] of open records. when we receive any [38:02] request, we follow the right to know law [38:04] and the steps that the right to know law [38:06] enumerates be taken. [38:08] » So my question again is when you have [38:10] that check box on there that the person [38:13] that's filling it out says please send [38:15] response via email US mail and you can [38:19] check one. Why is it when email is [38:21] checked, we're getting it response USPS? [38:24] » Well, we send things by mail. Even if [38:27] they say they want a response by email, [38:29] you're going to go against what's on the [38:30] form. [38:30] » I do. Yes. [38:32] » Okay. [38:33] » There's no requirement under the right [38:34] to no law to send things by email. [38:36] » There is not unless they're requesting [38:38] uh documents that are digitally but not [38:41] responses. [38:42] » Yeah. I'm just saying. Okay. [38:46] » Does it make sense to take the check box [38:48] off? Well, that's not public. [38:49] » No, we use the state form. [38:51] » Okay. That is the form. Okay. Thank you. [38:55] You can shut this down because it was an [38:57] agenda item, but I'm just I'm still [38:59] confused about the definitions where [39:00] somebody where it says driveway. [39:03] I'm just thinking if there's somebody [39:04] who wants to do something or electrical [39:06] wants to do something minor, [39:09] if they call in, they might feel like [39:11] they're [39:13] opening themselves up to getting a fee [39:15] where if they had just gone ahead and [39:16] done it, they wouldn't have they would [39:19] try to get away with it. Can they and we [39:22] all know that happens. Is there a place [39:25] where we can come and see where the [39:26] definitions of these things are without [39:29] coming in and asking the question? [39:31] » Well, I defer to the council solicitor [39:33] on definitions of common words and [39:35] usages. And [39:36] » So talk just use electrical if somebody [39:39] wants to rewire something in their [39:42] house. [39:42] » Well, I I can tell you with electrical [39:44] um and that's governed by what the uh [39:46] the building code would require be [39:48] permitted. And if folks said, "Hey, I [39:50] have a question regarding doing this." [39:53] That would go to the building inspector [39:54] and the building inspector would take a [39:55] look at the building code and say, [39:56] "Under the building code, if you want to [39:58] make that sort of approvement." [40:00] » Okay. And there would be a fee because [40:02] they were called. [40:03] » It would be no a question like that. No. [40:05] » Okay. [40:06] » No, the fee is paid when the application [40:08] comes in. [40:08] » Okay. [40:09] » Okay. Driveway. [40:11] » Well, driveway is a common term, so I'm [40:14] not sure where the confusion would be. [40:17] Well, there's a lot of ways to patch [40:18] one's driveway as opposed to resealing [40:21] it, as opposed to repaving it, as [40:22] opposed to redirecting it. So, there's [40:25] four different examples of driveway. [40:27] » And I think the problem with that is [40:28] that to have definitions now that are [40:31] explain all of that gets to be [40:34] overburdensome [40:35] and overly complicated when a phone call [40:39] can answer the question. So can't [40:41] anticipate but you can't always [40:42] anticipate all of the questions someone [40:44] might have concerning all those kind of [40:48] things right there there are common [40:50] common terms then [40:53] » If you're deal coding it it's not a [40:54] problem if they're not changing [40:56] something about [40:56] » Well that's what I mean I don't not here [40:58] to argue each individual thing I just [41:00] I'm surprised to hear a lawyer say that [41:02] I don't mean this in a negative way it's [41:03] just like legal lawyers usually want [41:05] everything spelled out very carefully [41:06] and you're saying well we'll just sort [41:08] of take it on there's [41:09] » Practicality to [41:11] There really is. [41:13] » Okay. [41:15] Okay. Just seem well seems like from one [41:19] year to the next you could get a [41:20] different response if you talk to [41:22] especially a different township manager. [41:23] It just seems like we ought to there [41:25] ought to be a place where we can come [41:26] and look something up to see what what [41:28] what the definitions of these things [41:30] are. But whatever just an observation [41:32] » Could always call Jason and come sit [41:34] down, talk with him about some questions [41:35] because he's really very personable and [41:37] » Okay [41:38] » Knowledgeable. [41:39] » All right. And he's also not going to [41:41] write down Jamie might be doing this [41:43] work. [41:44] » Okay. [laughter] [41:44] All right. [41:45] » He's not like that. Thank you. [41:48] » Um I also want to echo my concern about [41:51] the right to know response form. Um just [41:55] as a courtesy to the residents, you it's [41:57] really minimal amount of extra work on [42:00] the township. The mail here is very [42:01] slow. It could take a week to get a post [42:04] postal delivery. [42:06] Um, I mean that's significant and it's [42:09] acknowledged by everyone. Everyone knows [42:10] that the mail is very slow lately. You [42:13] have the form. [42:16] » You could email it. You could email it [42:17] and post it. You can't say that posting [42:20] it gives you a confirmation that you did [42:22] it because it's not sent with any kind [42:23] of confirmation for delivery. So, the [42:27] email is no worse [42:29] than that. It seems like the only reason [42:32] to not do that would be to slow the [42:34] transfer of information, which I don't [42:36] think we want to do. [42:37] » To come pick it up. [42:39] » Is that an option? [42:40] » Sure. [42:41] » Could you speak into the microphone? We [42:43] can hardly hear you back here. [42:44] » There is always the option to come pick [42:46] it up if you're concerned about the [42:48] speed of delivery of your postal [42:50] service. But if you'd like to come pick [42:52] it up, indicated you'll pick it up. So, [42:55] » Can I ask you say I've never done a [42:57] right to know, so I don't know what it's [42:59] like. And we are not the board does not [43:01] get involved and we don't [43:02] » No, but the board sets policy. [43:04] » Well, I'm no policy. That's a state. [43:07] » Well, but as a courtesy, they could ask [43:10] you to email potentially. [43:12] » I just have a question. [43:13] » The board is not going to be in a [43:15] position to tell what the right the [43:16] right to know officer how he should [43:18] perform his duties. [43:20] » Well, state law will do that. not the [43:22] perview of work. [43:23] » Well, my my question would be um [43:27] when you when you do complete it, do you [43:30] email a person that it's completed and [43:32] something was sent? [43:32] » No, they get a mail. [43:33] » Okay. They just get it when they get it [43:35] in the mail. [43:36] » Okay. Is that something that could be [43:37] considered that to email them that I [43:40] have mailed it? [43:41] » Continue to mail. [43:44] » If you were to come and pick it up, how [43:47] would we notify you of that? [43:49] » I call you [43:51] But how would you know we wanted that [43:52] instead of it? [43:54] » Let me know. Write it on the form. [43:55] » On the form. Okay. So, but there's no [43:58] checkbox. Just added in as a verbal. [44:00] » Yeah, that's fine. [44:02] » Okay. Thank you. [44:06] » Do we have any other comments tonight? [44:16] » My name is Brian Hankis. I'm from [44:18] Remington Drive. Um my question is [44:22] regarding escros. [44:25] So you guys are taking escros for site [44:28] development, home improvements, whatever [44:30] it is. Who's managing and controlling [44:33] and overseeing the return of the escros [44:35] and the inspections that are required to [44:37] get escros returned? [44:41] » So for certain projects, not all, but [44:43] for certain projects, [44:45] » Let's say site development just [44:46] » Say a subdivision plan. So the uh the [44:50] property owner, the owner and equity [44:52] developer will post an escrow with the [44:54] township. Part of that agreement is uh [44:56] posting a certain amount and agreeing to [44:58] replenish the escrow when the balance [45:00] falls to a certain amount uh usually uh [45:03] 50%. Uh when the township receives uh an [45:06] invoice for uh charges uh for a project, [45:11] um those invoices are reviewed uh and [45:14] approved for payment by me. The township [45:16] pays the township's consultant. The [45:19] finance director then makes the entry [45:21] into the escrow account or the escrow uh [45:25] party and sends to the escrow party uh a [45:28] copy of the invoice for their review so [45:30] they know what was deducted from their [45:32] account. And if they have any questions, [45:34] that's the opportunity to ask, well, [45:35] what's this charge of that charge? Uh [45:37] the township charges the actual fee that [45:39] we pay. So we pay our consultants and we [45:42] reimburse ourselves. We don't ask our [45:43] consultants to go out and chase those [45:45] dollars. That's the purpose. [45:46] » Yeah, I actually understand all that, [45:48] but who oversees the inspections that [45:51] are done through the escrow. So, [45:53] » It it depends. It's um it could be the [45:55] township engineer. It could be the [45:56] township traffic engineer. With some [45:59] projects, there are there are documents [46:00] and agreements that are required to be [46:02] reviewed and that would fall to the [46:04] township solicitor. Um so, it's it's [46:06] going to be one of our consultants. Um [46:09] my time is not drawn from the escrow. my [46:12] time is built into the fee for whatever [46:14] application is being made. Um but uh [46:17] every everybody else is is the [46:19] consultant. [46:20] » Well, so we have a situation on our [46:22] street where it was the development plan [46:25] was by Tom Bentley. [46:26] » Yeah. [46:27] » Um everything in the agreement says it [46:30] the township states specifications for [46:35] uh the development plan, whether it be [46:37] storm water. I'm more particularly [46:40] um concerned about the street. So there [46:42] are specifications on what your [46:44] requirements are to meet for the [46:46] construction of the street, the [46:48] subgrade, the um material used, the [46:52] binder coat, the wear course on the [46:54] black top. Who inspects that before they [46:57] give the escrow money back? [46:58] » It' be generally the township engineer. [47:00] » So if that wasn't done and the money was [47:03] returned, whose responsibility does that [47:05] fall under? who was the negligent party [47:07] there that did not give the proper [47:09] inspection. [47:10] » So, I I I haven't spoken to you about [47:12] this, but I believe you've been in [47:13] contact with with Jason in our office. [47:15] » We have. [47:15] » Okay. So, this is this a private road? [47:18] » Uh it's a private road, but under the [47:20] agreement, uh the development agreement, [47:23] the the requirements for the township [47:26] requirements for the driveways and roads [47:30] are still supposed to be met. And [47:33] there's actually uh line items on the [47:35] escros for a wear course, a binder [47:40] course, a subgrade. So those things [47:43] should have all been inspected before [47:45] the money was returned. [47:46] » And again, refresh my memory. This this [47:48] goes back how many years? It's not it's [47:51] not a recent [47:52] » More than 10 years. Okay. [47:53] » But the development [47:54] » Well, development hasn't been done yet. [47:56] Yeah. The development's only been done [47:57] in the last two years. [47:59] » Okay. So the escrow would have been [48:00] posted. a certain type of escrow would [48:03] have been posted when the subdivision [48:04] was proposed. A different type of [48:06] security and improvement security would [48:08] have been posted in advance of uh the uh [48:11] the work on the road. Um Jason's [48:14] reviewed this and he spoke to me about [48:16] it briefly and all of those escrow [48:18] dollars have been released. I think he [48:20] told you there's there's nothing that we [48:22] have. [48:22] » The problem is is the require the [48:24] township requirements were never met. [48:26] So, who inspected that and signed off on [48:29] releasing the funds when it hasn't been [48:32] » Met? I understand the question. [48:33] » Now, to fix the street, it's going to be [48:35] over $200,000 and there's five houses on [48:38] the street. [48:39] » So, I mean, who pays for that? Like, [48:44] shouldn't the builder have paid it? He [48:45] was obligated to fulfill that uh [48:48] standard set forth by the township and [48:51] agreed upon. [48:54] Yeah, I understand the question. [48:57] » Okay. [48:58] » So, who's responsible for that? It's [49:00] » A hard hard question to answer without [49:02] all the facts in front of us. [49:04] » So, how long ago was it done? [49:07] » The last house was built two years ago. [49:09] » When was the work when was the work [49:11] done? [49:12] » The last house the work was completed [49:13] two years ago. [49:14] » When was the street paved? When it was [49:16] where [49:17] » It's never been top coated. [49:20] » It's falling apart. So, it had a wear it [49:23] had it didn't have a wear code. It had a [49:25] binder code put down. [49:26] » When did they get the rest code? [49:29] » Good question. It's not disclosed in the [49:31] information that we were given. [49:35] » We did file for our information, paid [49:37] the fees and did come and pick them up. [49:39] We did not wait to have them mailed to [49:42] us [49:44] or emailed which wouldn't have happened. [49:46] » Well, we'll have to get back to you. [49:48] That's the first I'm hearing about. I'll [49:49] have to talk to Tommy about it. Yeah, I [49:51] appreciate that. [49:52] » Right. [49:52] » Thank you. [49:53] » Thanks. [49:57] » Anyone else? [50:00] » Okay, our next meeting is going to be [50:03] Monday, January 19th at 6 PM at the [50:06] township building and it will start as a [50:08] work session at 6. Um, I believe we are [50:12] doing that, right? It says needed, but I [50:14] believe we are doing that. And then, uh, [50:17] at 7 o'clock will be the official [50:19] meeting. So hope to see you all there. [50:21] Thank you very much. [50:22] » To adjourn. [50:23] » You're adjourned.
