[0:02] Welcome to the planning board meeting for August 27th. Our next meeting is [0:06] September 10th. Please stand for the pledge. [0:10] I pledge allegiance to the flag of the United States of America and to the [0:15] republic for which it stands, one nation under God, indivisible, with liberty and [0:21] justice for all. [0:28] We have a decision for Lan Realy 11 Hazelwood Avenue. [0:34] Anybody here for the applicant? Um, wave the reading. We need a motion [0:40] to accept the resolution as written. So moved. [0:43] » Second. >> All in favor? [0:45] » I. >> Uh, we'll begin with the work session. [0:49] Sherman Properties LLC, 61 Sunset Avenue, [0:54] » you're right. [1:00] You guys can talk about it because it's a work session. Comments and [1:05] chang. [1:08] » Okay. >> Well, we've got the comments and there [1:10] aren't any real objections. I mean, this is really a defensive maneuver. Try to [1:16] keep the people in the 7-Eleven safe from the crazies. [1:23] propert. [1:46] Well, I I think that's an enforcement activity that we've really got to pay [1:50] attention to and insist this is the opportunity we have. [1:55] » Yeah. Having garbage on their >> right. [2:01] [snorts] From what I understand, they moved those [2:04] garbage pales inside because people were using them as their garbage pales for [2:08] from their cars. >> Because people were using them as [2:11] village garbage pales. [laughter] [2:15] » Well, I think we should ask that the uh site be restored to the approved site [2:20] plan that includes the shrubbery and the garbage cans. And if that can be [2:27] conditional, I think then we could move forward. [2:34] Yes, I agree. [2:48] You really don't want them coming in the store. [2:51] » More of a bash one. >> They're not Look, they're not good. [2:54] » So, will you wait make a recommendation? [3:01] » Okay. >> And I'd like to see them not be black. [3:04] » Okay. >> Do we want bright, bright yellow? [3:08] » No. >> No. So, what do we want [3:09] » then? [3:13] » So, what color? [3:19] maybe like a skin tone, >> you know, at park if you set if the [3:24] parking stalls are >> if the parking stalls are 10 foot, you [3:28] know, you have an opportunity to drive between them. So, I would split in the [3:31] middle and I would say six foot centers instead of 4 foot centers, [3:36] » you know, so you can't drive. So, it'll catch and even at six foot centers, it [3:40] doesn't catch every car. [3:45] Yeah, most of them. [4:05] If you when you go there late at night, there's not a lot of cars there. That's [4:10] the opportunity to drive in between them. That's I'm just looking at it [4:14] like, hey, tight them up. You know, not 10 foot on center, but maybe six [4:22] » about [4:26] Yeah, we'll you'll catch almost all of them at six foot. So, that's just my [4:31] thoughts. [4:34] » So, we'll give the applicants some suggestions and have them come back. [4:40] » No yellow balls. [4:55] Yeah. [5:03] » All right. That's I guess there's a bunch of little issues. [5:08] » Is that it? Anybody else? >> Done. [5:11] » No, I think it's covered. Yeah. I or I was going to say on the north and south [5:15] side of that building there's brick walls where you might be able to let up [5:19] on the distance between the b not have as many on each on each end [5:26] » where there's brick walls >> where one is probably going to aim for [5:29] the front door or the glass areas but you know [5:38] Yeah, [laughter] [5:42] » I six butt centers sounds good to me. >> Welcome. [5:49] » Yes, >> we heard from you. That's enough. [5:52] » That's enough from me. >> How about Dave? He hasn't been talking. [5:55] » I will defer to the collective. >> We'll leave it. That will allow the [6:01] experts to uh render opinions to the applicant and we'll revisit [6:07] 158 Mil Road, West Hampton Beach LLC. 162 Mil Road, West Hampton Beach, [6:14] » LLC. [6:21] » Okay. >> Hey, members of the board, thanks for [6:25] your time tonight. My name is Brian Teeman and I am representing um the [6:30] ownership of the uh the properties, the subject properties. Um in short, what [6:37] [clears throat] our tenants are looking to do is to um [6:42] basically operate the way Eerts used to operate um by putting some paint on [6:48] things and making things look a little bit better, so to speak. Um [6:52] so we're looking for um for site plan waiver. Um we have and you know there's [6:59] been a lot of talk as we know in our small village. Um down the road um our [7:06] tenants might have ideas of of other things at which time we will come to you [7:12] beforehand discuss um and see see what's uh see what everyone likes. But for the [7:18] time being, they'd like to just open um they have their uh permit application in [7:24] with the board of trustees for outdoor seating, which um includes some uh [7:30] outdoor lighting, seasonal. Um and that's really that's really all. Um we [7:35] got your comments today. Um so I'd be happy to go through them with you if you [7:41] would like to hear or if you'd like written response. uh just let you know [7:46] let me know how you want to handle that and um we're happy to accommodate. [7:50] » Well, I think um we were clear when you got those today that we wouldn't be [7:53] commenting or making the changes today. So, [7:57] » okay. [8:04] » Bren, do you want to start off [8:08] [laughter] >> How about Brad? [8:11] » Yeah. So, the comments were just It's really just [8:18] fence. [8:38] one big question. >> Yeah, I can I can address all those [8:43] things. One is uh Brad, we got the note about site plan versus survey marked up. [8:50] So, we'll get that taken care of. Um we'll get it formalized as a site plan [8:54] overlay, so to speak. >> [clears throat] [8:57] » Um the um handicap accessibility [9:03] question on that. Would Brad, you and I were at the site. Um would like a [9:08] concrete pad be the most logical thing for the first [9:13] parking spot area that can get directly to the front door. [9:17] » Concrete or asphalt. [9:22] Sure. [9:30] » From either side of the car, probably, right? Yeah. Okay. I mean, that makes [9:34] sense. So, with the board's permission, you know, we would want to uh rectify [9:39] that with a with a pad. We'll look into what material would be best for it. Um [9:45] » stop >> on the road. [9:50] That doesn't Yeah, that doesn't doesn't count for it. [9:57] » So, it's a it's a good question, Ron. Um, so the funny thing is [10:02] it's we call it we're calling it a parking lot, but it's really only a [10:07] cleared space on a vacant property that has been defaulted to a parking lot. So, [10:10] I'm not really sure how it should be handled. [10:13] » That was really bad. [laughter] >> Take notes, Jim. [10:20] Why do I see the picture of a duck and I hear the quacking of a duck? [laughter] [10:25] » So, I just I'm putting that out there because we want to handle it however the [10:29] village wants to handle it. So, [10:39] Sure. [10:48] » The curbs. Yeah. [10:56] » Yeah. [11:06] » One of the things you talked about [11:14] A lighting what? [11:37] » Straight it up. [11:43] spotlights or anything. >> You have to be real careful. [11:50] » Would that be under the >> perviewed one way or the other? It's got [11:53] to be defined. >> That's under the perview of the board of [11:56] trustees though, right? >> Yes. [12:03] They will enterain temporary [12:20] There's no permanent lighting on this. [12:26] » No, not permanent. No, not at this point. No. [12:33] » Dumpster detail. >> Sure. [12:38] Um, so the third thing that Brad had brought [12:42] up that I wanted to address is the shed. Um, the shed has been improved and fixed [12:47] up. It was fallen down, doors were missing, etc. Um, maybe down the road, [12:52] we'd love to talk to you about maybe some sort of use of it, but at this [12:57] point, we're not looking for any permission of use of it or use of it at [13:02] all. Um, we want to keep the outside the way [13:06] it was when Eerts was there. Um, I don't know how we need to handle the shed [13:11] going forward, but um, for all intents and purposes, it's [13:17] structurally sound now and not intended to be used. [13:26] » Yes. So, I would notate as such. >> Okay. [13:32] You didn't make any changes. [13:48] » Okay. >> Yeah. [13:52] » For storage only. Maybe >> something along those lines. [13:58] » Sure. Okay. [14:06] Okay. [14:10] » It is on that application already and noted about this application. [14:15] » Yeah. Okay. >> Okay. A little cleaning up and we'll see [14:21] you again, I guess. >> Yeah. I don't think Do we have to see [14:23] him again? [14:36] Well, I think we can rely on you to uh handle that. [14:42] » Mr. Chairman, I'd like to move forward. I think it's a good business. Um I see [14:48] I've been in the espion operation. It's outstanding. And um I did go by the site [14:53] today and I did see that shed, that nice looking shed you have in that that north [14:58] northwest corner of the property. >> I want to rent it for the summer. [15:02] » And and and in terms of the lighting, although it's not in our wheelhouse, [15:05] it's with the trustees, it's lighting that's not going to affect anyone [15:09] because there's no residential area. There's no [15:11] » to that to that point, Don. It's temporary. [15:15] » Unlike the seasonal seating on Main Street and closer to the downtown area, [15:21] you are abudding or getting reasonably close to the residential property. It's [15:25] not >> in front of the on the street. It's [15:28] behind the building and what some of us in this end of town have experienced [15:32] with the movie theaters morphing nightclub slashbar west [15:38] whatever it is. Um, you know, it's, you know, it's run pretty late at night. [15:43] there has been some, you know, concerns and some unhappiness. [15:48] » So, I'm not saying that's what you're going to do. I'm just saying to the [15:51] extent that that gets brought up with trustees with the lighting, hours of [15:55] operation, um noise abatement, music, that kind of thing. Just have those [16:00] concerns raised at least. >> Are you seven days a week or or five [16:05] days a week? >> Um I think we'll probably start at [16:08] seven. >> Okay. [16:15] And to your point, uh, Dave, um, additionally, I think one of the [16:20] comments in, uh, the report from you guys was, um, talking about optional [16:26] rear yard landscape buffer, >> which I think could be a good thing to [16:30] discuss >> uh, for the benefit of residential. [16:35] » You know, like I said, if you're going to be stringing those lights that you [16:38] get at Home Depot, that's one thing. I think it's more noise issue, amplified [16:43] music, you know, right? >> These things sudden do tend to happen. [16:47] You know, nobody's really thinking about it. It's just like, "Oh, let's do that. [16:50] That sounds like a good idea." >> This isn't going to be Scarlet's front [16:52] yard, though. >> What are the hours of operation? [16:56] » Hours of operation. >> I think it's it's it's not going to be [17:00] late. [17:03] Whether it's 9:00 or 10 o'clock [17:12] [laughter] [17:15] » have a working partner, huh? >> It's not going to be just a breakfast [17:18] place anymore. >> No. [17:21] » Okay. >> Good. [17:25] I'll still go I'll still go to your >> Spiancor. [17:29] [laughter] [17:31] » Hopefully there'll be some more seats now in [17:33] » Spianc Larry. Any input? [17:36] » Uh, no. Looking forward to seeing it all built. [17:41] » Dave, >> other than what I've said? No. [17:44] » My piece. >> Okay. [17:46] » Thank you all. >> All right. Thank you. [17:51] West Hampton Performing Arts Center, 76 Main Street. [18:03] » Good evening for the applicant, James N. Hume, 323 Mill Road, West Hampton Beach. [18:07] And we have the Julian, the executive director, and our architectural support. [18:12] Um, I've been to so many of these meetings about this, I've kind of [18:16] forgotten what we've told to who, but just real simply, uh, we're looking to [18:22] um remove some existing structures from the uh the plan from the the site and [18:29] provide an 8,900 square foot um addition to the back of the property and some [18:34] pretty extensive renovation internally, mainly with the goal of uh creating more [18:40] seating. uh so that at for the same tick price [18:44] we'll have more revenue so that we can afford to bring in bigger names and [18:49] larger groups of people u is really what we're about. We're just um this is on a [18:56] work session so we're not even public hearing stage yet. I think because of [18:59] the size of the building we well I know because of the size of the building [19:03] we've filed the special permit uh application to the trustees [19:08] um because it exceeds the uh the code limit for square footage and we met with [19:14] them last last week last week uh and had a brief discussion with them about this [19:19] project and we're here to uh get this project moving with you guys as well. Um [19:26] I think the big issue here is the initial issue here will be uh secret if [19:31] I'm not mistaken. Um so I don't know where you want to go [19:38] from here but we're to discuss any aspect. [19:42] » We we we given some thought to to seeker on this and uh the [19:49] the trustee the real big issue in this is going to be parking and the impact on [19:54] parking. That's that that's the big issue. And right now the trustees are [19:59] revamping, you know, there's a parking moratorum and the trustees are revamping [20:04] the parking code and what we're contemplating is that the [20:09] trustees will end up taking jurisdiction over [20:13] parking. We're not going to call them variances anymore. They're going to be [20:16] parking special permits. That's the what's being contemplated [20:21] um at least for the downtown area because that's the area where it's [20:27] municipal parking and the impacts are going to be on the municipality as a [20:30] whole as opposed to any individual site. So, um at least our initial [20:38] thought, you know, Brad and I talking about it is that the trustees really are [20:43] likely to be the lead agency on this. um because of all the work they're [20:48] working on as far as the the new parking plan for the downtown [20:54] area. So, and I don't think we've seen anything quite like this in terms of the [20:59] size of a like a variance application for parking, [21:04] but um they'll figure out how to handle it and the new code will contemplate how [21:09] to handle it. So most likely it it it's going to make more sense for them to be [21:16] lead agency on this. >> As much as I love seeing you guys and [21:21] we'll be able to see you anyway. >> Doesn't mean you won't. [21:23] » I agree. I agree with the council's analysis. I think the the over [21:28] overriding issue here is the parking and uh that's in the trustes hands both [21:34] because of the special permit and because of the change of the law. So I [21:38] think that makes a lot of sense to Put the lead agency there as opposed to [21:43] here. [21:49] » Don, >> Don, why don't you start? [21:52] » I just have a >> Let's get the experts. [21:54] » I need I just need [21:58] » Who'd like to go first? >> There we go. [laughter] [22:03] » Obviously broadstrokes. I would I don't like to see what that protected [22:10] » because you are proposing this sort of mass behind the facade which is my very [22:16] iconic east end of Long Island very important [22:19] » obviously [22:25] you know it's something of that magnitude [22:29] » um and then I just sort of said you know it's a very large 65% [22:36] So I think we should probably provide some data points that show [22:41] you 500 tickets or we have this you know year round demand or some sort of [22:47] operational number >> going to need the seats for the NBA [22:50] games. >> Yeah. Why the Knicks are going to repeat [22:54] again? [23:06] » We all think [23:15] » we could certainly provide the facade easement. Um there's several other [23:20] levels of protection for that. One is that because of that easement, we're [23:25] right now have an application pending before the um historic board, landmarks [23:29] board for the town uh and uh because they need to approve this project [23:33] because of the terms of the easement. And one of the conditions that they have [23:37] imposed is a letter from the CPF people who provided the funds pursuant to the [23:42] easement to confirm that uh what we're proposing is within the scope of what we [23:49] agreed to in that easement. But we'll be happy to provide a copy of the easement [23:53] itself. >> Approval, not just advisory. [23:58] » No, we need to get a certificate of um >> should they be an involved agency? [24:05] That's the first time I'm hearing that. So they should be an involved agency for [24:09] secret purposes. >> I agree. [24:13] » Landmarks and historic town Southampton. >> Southampton. [24:18] [clears throat] >> It's interesting. [24:22] » And then just you know as you evolve along the process more of a site [24:25] planning issue which is to say you know you're removing these twotory structures [24:30] that kind of have open space around them. I think we might want to [24:34] the north side of the property and how we can preserve some of that reserve [24:41] use. Um, but I think we may need to soften that mask if we have the [24:45] opportunity. [24:49] » Yeneral, >> Sure. Understood. [24:52] » Understood. [25:23] Even at night when lights are off. We can't do that. Sorry. [25:32] I'm not sure [25:35] it's probably [25:44] » major piece of this. Yes. [25:57] We could stick to conceptual for now. I mean, it makes the most sense for secret [26:02] purposes to stay conceptual and not get into the fine engineering stuff yet [26:08] until the real [26:12] broad strokes are worked out. >> Yeah, I agree. [26:15] » You don't have to spend money on >> that yet, right? [26:19] » Yeah, that's what I'm saying. >> Yeah. [26:27] Right. >> Yeah. [26:41] The trustes are going to be handled as we talked about. [26:51] covering. [27:13] » Understood. >> We'll talk about that. [27:19] redo the arithmetic at a minimum. >> Sure. [27:38] » Right now it is based on [27:46] like [27:49] something that >> Yeah, we can't rely on Rio Delben to run [27:54] into the back of the building anymore to provide contrasts, but [28:00] we will obviously take a look at that. Maybe a drive-in movie in that back lot. [28:04] [laughter] >> That's an idea. [28:07] » Requires a whole bunch more parking, but [laughter] [28:11] » Don, >> yeah, just just two minutes. First of [28:13] all, congratulations on the grant money. I know you probably worked hard on that. [28:17] Been involved with that with nonprofits and it's a lot of paperwork and it's [28:21] more of a problem getting paid as you go along. You you'll see that though. Um I [28:27] have two things I just want to ask you on your demolitions. Is this beautiful [28:31] home of Sunset being demolished >> where the gate is? [28:35] » Yes, >> it is. [28:36] » Yes. >> Okay. I just want to hand this to my [28:39] planning board members. Although it's out of our wheelhouse possibly. [28:42] » Um >> you have someplace to put it [28:45] » one for the record. >> Donated. [28:46] » No. Unless you want to move it. [laughter] [28:48] » We don't. >> We don't move houses anymore. [28:50] » No. Okay. >> Um my other question is I when this [28:53] first hit the papers, I think in March or April, we talked about profit margin [28:58] on tickets >> and um there's a big concern here. I [29:02] represent the village taxpayers of course on this board. [29:05] » Um and there's a um a major problem with tickets where we can go to the board the [29:12] the ticket booth Wednesday and Sunday but when you go online you get stuck [29:17] with all these brokers that charging 75% higher. [29:22] » How does the brokers work? Do you get a piece of that action? [29:25] » No, not at all. >> Can you avoid them? [29:26] » No, >> you can't avoid them. [29:28] » No, they can. anybody can purchase tickets from the theater. So we have a [29:32] lot of um safeguards in place to try to prevent against fraud because you know [29:36] there's third party um ticket sellers who just buy them up and resell them in [29:40] an unfortunately legal way but then there are some that um are selling uh [29:45] fraudulently and and it's it's a mess and uh you know New York State the [29:51] attorney general I know is trying to crack down across the country [29:54] everybody's trying to crack down on it but it's really [29:56] » just to make myself clear I represent the taxpayers of the village of [30:01] Westester Beach and I think you might want to [30:04] consider an idea where village residents could get a little more of a discount on [30:07] the tickets for some events. >> I think with increased capacity that's [30:11] very possible. >> Okay, very good. That's all I have. [30:15] Chairman. >> Yeah. Uh my only concern would be the [30:20] north and the west facade. Uh looking straight off in front, you got to get a [30:24] mile back to be able to see what we proposed up on the roof. [30:30] You know, that's my only concern. Um I I think the four square house that's in [30:36] the rear is a nice old house. U it's not an [30:41] architectural gym, I would say, but uh and the barber shop and uh historical [30:48] society's got the barber pole. I don't I don't know if that means [30:52] » you could have a nice building, [laughter] [30:54] » but the inside of that building has been >> grants for that. [30:58] » Yeah. [clears throat] >> renovated over time. So, it's it's an [31:02] office. It's not There's no remnants of the barber shop or uh Ria's presence [31:08] there in the house any longer. >> It's a nice house. [31:17] » They're pulling down nicer ones. They have [31:22] » bulldozing them every day. >> It's what we do in West Hampton. [31:27] » Well, hopefully in return we're providing a benefit. [31:30] » This would be the rare occasion. >> Yeah. Benefits the village. [31:35] » Mr. Roy, >> I just have to channel my inner Paul [31:39] Hulahan here. Um, >> no, it is what it is [31:43] » from. [laughter] I didn't believe you me. I know this is [31:46] three decades in the past, but >> my recollection of the whole [31:50] preservation movement >> was to preserve the small town feel of a [31:55] movie theater to just you know have that kind of venue [32:01] preserved and um [32:05] if we do this I think that defeats the purpose. [32:08] » You want the NBA there? >> It's just you know it's just that's what [32:12] it was designed. That's why it was preserved the way it was preserved. As [32:16] Julian knows, I've spent most of the last decade there. And, you know, I [32:21] enjoyed every time I was there because of the way it was laid out. And, you [32:26] know, I could show my kids what it was like when I used to go watch movies [32:29] there. And it's a it's a continuation thing. And I just think the the way it [32:33] is is is part of the community. And I I would just hate to lose that. [32:37] » Yeah, I understand. And I'm sorry to say this, but um and Dave, you know how much [32:41] I love this theater. I've been there for 18 years, but one thing I've learned in [32:45] 18 years and especially since CO is I I don't mean to sound doomsday about it, [32:50] but I don't think the theater will be able to sustain at 425 seats. And if I [32:54] thought it could, believe me, I I I believe in the intimate nature of the [32:59] auditorium. I love that it's a conversation between artists, but I know [33:02] John's going to speak to this in a second. We have done everything we can [33:05] in the design to uh retain the intimacy of the theater. That's so important, but [33:10] we need to have more seats. the cost of acts. We want to bring in high quality [33:14] worldclass. You know, in 2011, 12,13, you probably all remember we had [33:18] Blondie, the B-52s, uh Cindy Looper. I mean, these are huge names that are [33:23] completely out of our reach now. And even if we can get the marquee name [33:27] artists, the tickets are so wildly expensive and we just we're not going to [33:31] be able to sustain. We're facing ticket price resistance. um people don't want [33:36] to pay more than $150 per ticket, understandably so in the the economic [33:40] times we're in. And so I think again with community in mind, I think we have [33:45] to do everything we can to preserve um the history and the intimacy of the [33:49] room, but I think we really have to think in terms of how this theater is [33:52] going to exist for the next generations to come. [33:55] » John, do you want to speak to this? >> John Rose, architect. One of our [34:00] specialties is historic preservation work. Um we do a lot of landmark work [34:06] and as a kid I also attended that theater. I recognize how important it is [34:11] and the state and obviously will make us preserve it but it's really important [34:15] that when this is all done it's all put back together from the inside you really [34:20] won't feel much of a difference. Yeah, the stage is getting bigger but the [34:24] fabrics, the seating style, the general layout is remaining the same. The front [34:28] entrance will not be it'll be repaired where it's falling apart a little bit, [34:32] but it's going to stay exactly the same. You won't be able to see the lion share [34:36] of the work until you turn the corner. As you know, there's a building on the [34:40] corner that hides everything but the front of the building. That won't change [34:44] from Main Street. You won't be able to see what we're doing from Main Street. [34:48] You got to go around the back. So, I get it. You're right. It's a really special [34:53] place and it's going to stay that way. [34:59] Will we be able to get the circus back? [laughter] [35:06] » That's all it takes. >> Rock, you know, I I listen to what Dave [35:11] said and I'm just thinking about how much change we've seen in the village, [35:17] you know, in the last 10 years, how many different buildings have come in and [35:21] knock, you know, the structures have been knocked down. And I think [35:27] the expansion is pro, you know, also to keep it alive economically, I think the [35:31] expansion is justified, right? Um, I think in the process of [35:38] trying to figure it out, I think the elephant in the corner is part [35:42] » and and just my thoughts as a contractor, I'd want to figure that out [35:47] before I burn a lot of money moving forward. [35:50] » But that's that's my thoughts on that. >> Top of the list. [35:53] » Yeah. because I mean you can go all the way and then the parking falls apart [35:57] » all these issues and >> we're we're certainly aware [laughter] [36:02] » so that's >> working with the trustees and with [36:06] » yeah I'm I'm sure architecturally you'll bring it you you'll bring it in line [36:10] » you don't have a choice >> well well exactly don't have a choice [36:14] but so that that's my thoughts that's that's [36:18] what I'm thinking >> thank you [36:21] do you want to make some comments are you for this application. [36:26] » Spectator. [36:35] » Um, off the top of my head, no. But in my records, since I've been involved [36:40] since the very first shovel, I think I could find that out. [36:46] » It's just my curiosity. >> Yeah. No, we can we can find that out. [36:54] Well, I think this is really going to wind up in the lap of the trustees more [36:58] than the planning board for the immediate future. So, I don't know when [37:02] we'll be seeing you again. So, [37:06] and I think I don't think you have a direction that you need to go into at [37:10] this moment in order to proceed with the path you need to go down. So, I don't [37:15] really think this board has any more significant comments than other than I [37:21] think you need to say that you choose not to be lead agency. [37:24] » Well, we'll we'll get that start. We got to get the [37:27] » process started with the trustees and >> I'll probably do that at the next [37:32] meeting. So, it's a couple couple weeks, right? [37:36] » There's also and Britain would know there's a hold over on the property [37:40] north of the rear of the theater right now. Am I correct, Britain? [37:44] » There's a hold over right there because they want to do something there also. [37:48] There's a lot of development going on. >> You know about that or not, Jim, but [37:51] there's >> Yes. Oh, no. I'm fully aware. Yeah. [37:53] » Okay. >> I'm not representing them. [37:56] » Pardon me. >> What effect? [37:58] » What effect it has on you or them? I I'm not sure, but [38:17] Is that next week? >> First Thursday. Oh my god. [laughter] [38:22] » It's September. >> It's September already. [38:29] » Do we um need to do anything for that? Do we need to come? [38:32] » No, I don't. [38:44] first week of September. [38:48] » There's so many involved agencies that we have to send out. [38:52] » You know, we're not going to get like an individual waiver here and there and [38:55] speed up the process. So, we we just have to go through that process and [39:01] » Okay. Well, we will see you at some point and [39:04] we will look forward to it. Thank you for working with you on this. [39:07] » Nice seeing you, John. >> Just like to say I really do appreciate [39:11] and take all the comments to heart. >> Thank you. [39:18] » Okie dokie. Um, we're going to engage in a secret discussion regarding 220 Dune [39:25] Road. >> Yeah. So, I can report back. Um, we told [39:31] you we would address it with the zoning board. They have no problem deferring to [39:37] the planning board to be lead agency. So I I think with your [39:43] holding of the board last time, what we could probably use would be just [39:48] a resolution um [39:52] instructing staff to get that process started to to let the involved agency [39:57] know involved agencies know that you're electing to [40:03] uh or requesting to proceed as lead agency and identifying them as involved [40:10] agencies. So, if you want to do that resolution, we'll get the process [40:13] started. >> Well, I don't know. Do we want to do [40:16] that resolution tonight? Um, my thought was, [40:21] [clears throat] speaking for myself, the secret pool is a deep one. And, um, what [40:26] I did is I went to Nikon for the training material that they do for [40:35] planning boards and zoning boards. And, um, bought the training session and I [40:41] what I would like to do is give that to each member of the planning board and [40:46] anybody else who's interested so that we all have a better understanding of the [40:51] secret process and the steps involved um before we start a clock. You have to [40:57] start the clock. So when they file an application, there's a requirement that [41:02] you begin the process as early as possible. And so we can't just drag out [41:08] the beginning. Uh all you would be doing >> for two weeks. [41:12] » No, but it's already been several. They started [41:15] » an hour doing that was >> Yeah, it's it's I'm just telling you [41:18] that they're entitled to have it move along. All we would be doing today is [41:23] sending out notices that then it just starts a 30-day process for other [41:29] agencies to object or not to you being lead agency. That's all. It's as as [41:34] innocuous a step as there is. And there's really no I can't say there's [41:38] any reason not to do it unless you don't want it anymore. I mean, if you change [41:42] your mind about being lead agency, >> he's asking for a delay doesn't mean he [41:45] doesn't want it anymore. >> I'm not asking for a delay. I'm asking [41:48] for a period to gather information. >> So, we will have that. I promise you [41:54] there's going to be [clears throat] ample period to gather information. [41:59] » But we got to get we got to get you started as lead agency and and that's [42:03] going to take it takes 30 days just to get to that ability for you to even say [42:09] we are now lead agency. All you'd be saying is we want to be [42:13] lead agency. That's it. So, I I'm happy to, [42:19] you know, be involved and walk you through this process and we're going to [42:24] take our we're not going to rush this process. I I that I promise you, but we [42:29] at least have to give them a lead agency because they are entitled to that. [42:38] » Anybody want to make any comments? >> There is another referral later on. [42:56] What I'm hearing is [43:02] » I want the board members to understand the process [43:06] » because it's not a simple process. You know, this isn't like neg deck world, [43:10] you know, where you're just going a house, you know, down the block. This [43:16] has a little more gravity to it than you know our normal secret process here. [43:27] » Nothing can happen. Um [43:43] » I guarantee everyone [43:48] So if you want between like one of the meetings in September, [43:53] » um >> we could set aside to have a [43:58] » just training material in my hands tomorrow actually. [44:02] » No, but after you have that problem, >> you could distribute it and then we [44:05] could have a session just to talk about >> the process. That's all. I mean, we'll [44:11] doesn't even have to be specific to this application only, but just to [44:14] » Yes. >> kind of have a a primer and a and a [44:18] refresher on the process that you should expect. [44:21] » I'd like [snorts] to do that. >> So, we could do that. [44:23] » The other thing I want to tell you is that when when I had the discussion with [44:26] the zoning board about it, they all said they want to still be involved since [44:31] they have a very big decision to make. And one of the things that I told them [44:38] we could set up when the time comes, this is not next month and probably not [44:44] the next month, but at some point would be a joint work session where they can [44:50] come and since you're the lead agency, they can come as a board, not just as [44:55] one person or two people, but we can advertise it as a joint work session [45:00] where you can hear their concerns about things that they would want you as lead [45:05] agency to be looking at for their benefit because that's the [45:10] responsibility of the lead agency is to gather the information that all the [45:16] other agencies need to make their decision. And so [45:21] um I thought it would be a nice thing to have [45:24] » possibly a joint work session. We've done it once before with when the [45:28] trustees were involved in an application with you I think and we had the two [45:32] boards I can't remember what it was for. It [45:35] might have been the old CVS or >> something like that. But it was [45:39] something um where we we did that and advertised a meeting. And I think it's a [45:46] nice thing to do on a on an important application like this. [45:49] » We get pizza, too. >> We can do that. [laughter] [45:54] » Pepperoni. >> Roco, do you have any comments on this? [45:57] » Jim can even have some pizza while he's not yet. But I do want to see I do want [46:01] to review the secret. So, you said you would you would [46:03] » I'll distribute the information. >> Yeah, definitely. [46:07] » We've all been attending Nikon training events. I would assume this one goes [46:13] back to uh 2023. Wade, who teaches those courses, really does a phenomenal job. [46:20] And as I recall that training session, he did a phenomenal [46:26] job on it. So, I contacted Ncom today and hopefully I can have that um [46:33] » information distributed. They said 24 hours. [46:35] » This only like an online class like we've been doing [46:37] » it. It'll be a video. It'll be like a YouTube [46:40] » so we can go stop, start, look at action, just [46:43] » no interaction. Yeah. >> Yeah, I'd like to do that. [46:46] » Okay. >> And just keep in mind too that the DEC's [46:49] website, >> it actually has some really good [46:52] resources as well. They have like different levels of, you know, kind of [46:56] like an introductory level >> a little bit a handbook. They have [47:00] something called the secret handbook which is a Q&A style but in pretty good [47:04] detail and then they have the regulations and more technical stuff. [47:10] But you know after you've done the Nikon thing it's a great resource to you have [47:15] a question and I'm not available to answer it. [47:18] » Yeah. You'll typically be able to find that answer on the DC's website, [47:22] » especially that secret handbook, which is [47:25] » I still look at it sometimes when I >> um you know, they they've spent decades [47:32] working on it and refining. >> Fix that now and refining it. [47:36] » Fix that. [laughter] [47:39] » So, I'll make sure you have all the resources you need. [47:42] » Appreciate. Thank you. >> Thank you. [47:46] » It's up to you. hasn't changed. I don't think we should [47:51] be agency. >> I can't hear you, Dave. I'm sorry. [47:53] » I don't think we should be lead agency. My opinion hasn't changed. [47:59] » Larry Young comments. >> No. Ready to go. Let's have a look at [48:02] all your stuff. >> We've already voted to be lead. [48:06] » That ship sailed. >> Dave wasn't on the boat that day. [48:09] [laughter] >> Somebody let the air out of the tires. [48:15] » [laughter] >> All right, then. So, um I guess we'll [48:20] adopt I need a resolution then. >> Just just uh it's sort of informal just [48:26] to let the staff know that we can >> start the the process for you. So, [48:30] predicated on the polling that we did and the uh actions we taken this [48:35] evening, um the planning board of the village of West Hampton Beaches is [48:40] extending itself to be lead agency if we're so honored in the future. [48:45] [laughter] >> There you go. I like that. [48:48] » I respectfully deserve. [laughter] [48:50] » It is an honor. [48:56] » Okay. >> Tick tick tick. I need a motion for [48:59] that. >> No, we don't. We don't need a motion. [49:01] » I second a motion. [49:05] » We're done. >> It's not It's not even [49:12] » We just need instruction. That's all. It's not There's nothing formal about it [49:15] yet. It'll be formal at the at the meeting when [49:19] they actually adopt fleet agency status. So, [49:22] » it'll be at that meeting that we need for [49:26] » Thank you, Tony. on the vote now. >> All right. [49:31] Haven't been adjourned yet. >> I need a motion. [49:36] » Well, it was the way you presented that to the PCA. Nice. [49:39] » Oh, yeah. >> I have minutes from August 13th. I need [49:42] a resolution to accept the minutes as written. [49:45] » Go with it. >> I [49:48] » I [49:53] um that's it. [49:57] Need a motion to close. >> Make a motion. [50:00] » Okay. >> Anything you want to talk about for [50:02] [laughter] next meeting?
