[0:05] oh yeah [0:31] is [1:18] you know how you feel about that i don't know [1:22] it's up to us where it gets moved too it's the [1:25] isn't it it's not city property no it's been donated to the city by the library [1:30] okay it is ours we can [1:32] actually put it we'd have to pour a pad down there so there would be some cost [1:36] but i think it would be much more utilized [1:40] in that location if you can buy right now steve you could probably put it on [1:44] top where the tanks are [1:46] and then we can put in their staff with all the fills i know there's a [1:50] we don't fill a ton down there but it's [2:03] and i don't know if there would be any fire [2:06] marshall issues not not state fire marshal [2:10] because i think is it ag or state police that regulate [2:15] yeah somewhere between the billion and then [2:20] yeah so okay [2:23] with that um so it's council good relocated [2:28] i mean we don't like it it's not terribly hard to move [2:33] no it's a little top heavy [2:46] we're sure to take a section of paper yeah it has to be on a solid [2:53] bolted down yeah facing itself [2:56] there's not an open spot now that would really be appropriate [3:01] well not on top of the gas tanks yeah but [3:04] yeah it does have uh there was one common that one of the benches is [3:08] missing but that's actually for a wheelchair accessibility so there's just [3:12] punches on three sides wherever you feel running the cameras or [3:16] behind [3:21] okay so um thank you guys for your time this evening i appreciate it so i [3:26] contacted scott um because over the last year and a half [3:31] two years we have been working on a broadband [3:35] study for all of muskegon county long ago [3:39] two years ago it was started the initiative was started by mozart dick [3:44] they kind of said hey [3:49] let's put together this work group in this committee [3:52] and discuss it so we did and we all agreed yes it's a problem [3:57] and i said okay so we've convened all these people who wants to take it over [4:01] well we took it over um [4:04] so after [4:06] um quite a few meetings with our executive [4:11] team for the broadband committee and then the [4:15] broader team [4:17] we decided to put out proposals um a request for proposals for a broadband [4:23] study for all of muskegon county we received three proposals [4:27] back we discussed them [4:31] between the larger committee and then the executive committee [4:35] and came to the determination that none of the three proposals were what [4:39] we saw fit nor did they meet the needs of what we were seeking [4:44] um so we kind of then went back and forth okay can we work with our [4:48] providers to then get their information and sign mbas put our own gis map [4:56] together and then [4:59] we'll do all the work and go from there that became a problem because only one [5:06] provider would share their gis data with us um so then we kind of was the same as [5:13] we did with the other companies exact same outline [5:17] and they sent us their proposal back what is different about this is um all [5:25] the other three had [5:27] surveys that were attached to them so they were going to survey residents [5:32] please raise your hand if you know exactly which service you have your [5:36] download speed um [5:39] and [5:41] everything like that [5:45] okay one who would actually even fill a two [5:48] who would actually fill out a survey period if it was mailed to them [5:54] okay or one two three xyz street and went [5:57] home michigan um would love to sign up for service i'm [6:02] serious we don't have service in your area [6:05] well i know they do because they're two streets they're two doors down [6:08] that's what this study tells us is that they can provide that service and then [6:13] how much it will take and how much it will cost to provide that service [6:18] um so they'll take all of that data parcel by personal and then they'll put [6:22] it on a gis map for us and then we'll be able to take this data [6:28] which is what the providers and the state federal government want [6:34] from us to get those dollars to then extend broadband into [6:41] um every single community in the county um so [6:46] that's what we're looking at right now is we're looking at fundraising for [6:49] this study to be done so then we can show the return on investment not only [6:54] to the communities to invest [6:58] not only for the providers to invest but then letting us know what we have and [7:04] what our capabilities are and what we're missing because we're certainly missing [7:08] quite a bit it is putting it in front of their board for 25. [7:12] um we um agree with academic development [7:16] we're putting in 10 and then [7:19] have a few other presentations throughout [7:22] the community and the county for other [7:27] other funders we'll be asking every municipality [7:33] and we also have businesses that we're asking as well [7:37] just because it becomes so important not only for [7:41] remote workers but for telehealth for virtual learning baker college is almost [7:47] 100 percent online courses so if you don't have access to revenue [7:53] um if you're somebody who is elderly and have a doctor's [7:59] appointment will don't have transportation and you can do [8:02] telehealth but don't have access to internet well [8:06] you're kind of stuck in this situation um so that's really what the idea is to [8:11] really serve the underserved and make it so we have this [8:16] available in our county and then again for talent recruitment [8:20] and attraction so it's become [8:23] broadband has become a necessity just like water sewer [8:28] electricity um [8:30] if you want people coming to your community into your county you want [8:33] businesses to do the same thing and increase your tax base [8:46] so would this broadband be available to like [8:50] all of us for a dollar amount would it be free broadband what what's the what's [8:54] the end goal with this the end goal is to get the study so we have the data to [9:00] bring to the providers and to the state and federal officials [9:05] who are giving out these [9:09] spider on state dollars for ten thousand dollars [9:14] yeah so that's a good question i had the same thing from messi to our account [9:18] fair or share i would say 132 000 divided by 27 wouldn't be the way to go [9:23] yeah so not everybody's going to give um [9:27] and [Music] [9:29] we understand that so what we're doing right now is really [9:33] targeting the communities that are going to benefit [9:36] the most from [9:38] the services so [9:42] with the city of whitehall and [9:45] the city of muskegon and the city of northwest et cetera et [9:49] cetera et cetera that's where most of the residents live [9:53] um and that's [9:56] so that's that's the whole idea behind it we may it may seem like you are [10:01] served but you're not fully served to the capabilities and capacity that you [10:06] should be um we're still going after [10:09] lexier creek township and [10:14] yes sir is the basic ask for all the communities [10:18] the ten thousand yeah so all the city starting so all the [10:22] city for asking ten um [10:25] in the larger townships report and this vegan forest [10:30] and then once we get down to the smaller townships [10:34] were at five or like 25 and that's if they even [10:41] let us present in front of [10:44] their boards [10:48] because we understand you know i mean everybody has r for money [10:53] everybody does this everybody has that and that's [10:56] that's great but they have projects that they already have the money out [11:07] i guess what i'm confused about i'm not real tech savvy [11:12] so bear with me but is this going to i mean the city of [11:18] whitehall is serviced by they're not going to take their place on what they [11:22] currently have installed they're going to take their place with fiber [11:26] because that's what the end goal is for fiber is what's [11:32] i don't want to say it's new because it's not new it's the next step [11:36] in the long term um goal [11:40] for broadband connectivity because it's [11:44] higher speed normally it's underground [11:48] there's much more capability and capacity of fiber not only for business [11:52] not only for residential but also for businesses [11:56] so it can allow other providers to come in and have a more competitive market [12:01] and i know that's happening in one community [12:04] um right now where a fiber provider is coming in [12:09] that community and they will be [12:12] another option for those individuals in that community [12:17] so it becomes a competitive market rather than [12:20] you're stuck with one provider [12:26] all right thank you for that i think you've [12:30] given us enough to chew on it's not the place to [12:35] make that decision all right hope you guys have any [12:39] questions let me know [12:42] all right so give me a shout out [12:48] thanks morgan all right thank you guys appreciate it [12:53] so next uh let's let's move to the lakefront property i know that's a [12:59] timely concern yep then it'll be short [13:03] i think we talked about maybe having a realtor come out there and praise it or [13:07] you know give us some sort of value [13:12] and you know depends on what the real you know their opinions vary at least [13:17] here we've got some sort of assistancy and some decent number [13:21] because i my fear is if we actually send these [13:24] letters out we're going to get bids from 100 to 500 [13:28] because whenever municipalities are selling money [13:31] it's only worth 10 cents on a dollar when we're buying it we're 10 times [13:36] worth value [13:38] so that that's my request is if i can put a minimum 30 000 bid on it [13:43] what did we have down here one parcel or two [13:47] we have one parcel and it's point two six acres [13:50] a quarter of an acre a little more than a quarter acre is it a [13:54] maybe it was it was across the street from [13:57] two to property owners possibly yeah [14:01] yeah for the most part and then we've got proper numbers to the north and [14:04] south and then some that are kind of a little bit more angle [14:08] i think if the bids are where we would hope that they [14:12] would be council would give strongest [14:15] consideration to the ones that are immediately adjacent which is four and i [14:18] think there's six property owners that have expressed an interest [14:24] and that's that's not anything that's buildable right [14:27] um not unless the water drops [14:33] yeah there's not much shoreline at all um [14:36] but it would have not it would potentially allow for a dot [14:41] or some lawn chairs i don't think you can build anything on [14:46] it i just [14:50] would have a problem with selling it to somebody [14:54] thinking that we were selling it you know maybe that for the people to [15:00] access the lake because they had the adjacent property across the street [15:04] and somebody else came along and outfit them [15:09] and actually has the finances to maybe build a house [15:12] on still practices with uh food trucks and would like to see our [15:17] regulations tighten down i think that's uh certainly a worthy request that we [15:22] should maybe look at them and see if they do at least [15:26] make the effort to see are they where do we want them to be [15:32] i think that's a reasonable request and then [15:36] i would say any of the council that has strong opinions on that could express it [15:41] to scott the staff let them know i think that's the route to go with that [15:46] i think from just a safety point of looking at that i think one of the nails [15:50] i had would be make sure that the uh the egress or the way to get food [15:55] is not out you know what i mean [15:58] if they got a turn parker pose parker posing i know it's it's the day [16:02] the stone will be over that's a that's a good good problem i think some people on [16:06] and off the lake fisherman [16:10] you know what especially when you get around the [16:12] eastwork housing complex down there i mean [16:16] it makes sense [16:20] oh steph [16:33] they can use the path from the trestle bridge [16:39] down to the eagles and that keeps them off the street that's curved [16:43] and then once they get up if they're going south of eagles they're [16:48] the streets not curved so it's not really an issue [16:52] uh in that way i thought one of the concerns that i had was [16:58] coming off from the trail to get down to lake street we used to block that off [17:02] and i thought it was because of the angle the curve that [17:07] there was concern that they would crash into the rails that they climbed [17:12] the sidewalk brian brian says that that's not an [17:15] issue so i [17:28] okay i think there's any opposition to it we'll come back with an ordinance [17:33] amendment next uh skate park uh state park i i've [17:37] had numerous individuals talk to me about [17:41] wanting a skate park specifically at the world tennis courts here i've got the [17:47] professionals that design them and uh [17:52] i think it's a wonderful spot they're excited that it could be a real uh [17:56] destination it's something that [17:59] i certainly would [18:01] think would be a there's kids out there [18:06] and they're having fun [18:08] and kids will be kids one group will get old enough they won't [18:11] do it anymore then the next one will come [18:20] i'm not in favor of any more parks for the city we don't have the [18:24] resources or money to take care of the parks that we have right now but you [18:28] don't need anymore that's just my personal opinion [18:33] i realized it's flashband money-wise it's use [18:36] if you use it you're taking the risks yourself like [18:39] the sledding hill right we're not responsible for a kid going [18:43] down the hill breaking their arm unless we know that there's an [18:48] inherent danger and we don't address it then we're [18:51] liable yeah otherwise we're not [18:56] i think it's looking at this i think a committee or a group [19:00] including some high school kids or however i mean you were in contact with [19:04] somebody i mean get a group together and put their heads together presentation [19:12] saying we want it unless we see some sort of positive [19:16] input from the community i was just going to comment that we've [19:21] dealt with skateboarders in a lot because the downtown businesses were [19:25] always always complaining that the kids were using their curving or their flower [19:29] boxes or whatever for their skate stunts and so the city [19:35] went with a temporary part and we put it all the way out the far [19:40] corner of the city but the kids still made that trek all the way down there [19:44] and even though it was a temporary park it was they used just [19:49] pre-fab steel structures they still are in the same place they've never [19:54] done more than that and it's still being used [19:58] and gives you guys a place to push it hey [20:01] you can't you guys can be at ealier or wherever like you said we're at goodrich [20:06] wrecking our bench and we know that's happening and we'll replace matches [20:09] because guys go over here [20:20] i would say not as much but there's still crazy kids out there [20:26] yeah i used more than tennis courts in there [20:29] right the point of having parks is for public [20:33] access if they're not if we put some structure in there for them to use and [20:36] people use it this whole point of having a park system right [20:40] my intent is not to kick anybody out but when the when those properties are sold [20:45] i don't want them selling to make another [20:48] non-retail business [20:51] you know i want i want availability for mom and pop they want [20:54] to put a candle shop in what they want to put [20:57] whatever i mean i want the i want the downtown to be [21:03] open i want it to be vibrant and selling stuff you know what [21:08] i want that i don't want to see a corner lot taken up by an insurance [21:12] agency is there anything either ordinance or [21:18] uh through uh [21:22] complaining essentially i can't think of the word [21:28] zoning i mean is there anything we can do to to [21:31] make sure that that gets done i mean i don't know [21:34] yeah let me look at the ordinance that we have is that one of them [21:38] let me look at that and i'll bring that back next yeah [21:41] cause that's what that's i want [21:50] that's that's fine i don't have an issue with that but the main drag on tip when [21:54] you drive downtown [22:09] i guess the only the only drawback i'd see with that even [22:15] for the next budget to just watch it for some fencing down there [22:18] found out how big ryan griego pitkin drug i think most of you know me [22:23] a couple things came up coming out i agree with you on [22:27] retail and what dick said is also true if you have a building [22:31] i'd love to see retail on the first floor but if the building's sitting [22:34] empty for a year you can't get anybody in there you got to get what you got to [22:38] get you know um so i agree with you i'd love to see it but [22:41] unfortunately it's not always plausible yeah if we got one right now [22:46] in the old kobe place building across the street [22:48] from us that that's for rent right now i don't i think i don't know [22:52] we're scott geiger used to be [22:55] um secondly um secondly [23:04] all right anyone else got anything they want to [23:07] add to talk about [23:10] well let's adjourn for next week [24:42] b [25:01] that's the first time i've ever seen him lit up yeah [25:05] i didn't even know there was a light up there i did not yeah either i just saw [25:09] that give it to the tech guys yeah [25:14] and you're blinking dick yeah chica was blanking yeah [25:19] well i guess for the sake of everyone [25:23] when you talk speak up [25:37] okay [25:47] so is that something we want to do after the [25:51] adoption or prior to [25:56] that's part of okay [25:59] you just remove that okay number three it's four twenty seven hundred seventy [26:03] eight dollars for breaks ball joints and alignment [26:09] how old of a vehicle are we putting this kind of money into [26:12] i think that's actually a 2017 ford pickup from dpw [26:20] i thought it was listed under a police department [26:28] two to a six [26:38] they're accounted [26:41] because i will get [26:44] the stack of all the bills [26:50] i'll have to sign one or two ryerson's at forty six thousand nine seventeen [26:55] uh double l at fifty two thousand two sixty five actually we got the [26:59] impression that carmix didn't really wanna talk about it so [27:02] it's uh not to exceed at 46 917. good and i might have mentioned the council [27:08] my cousin just built a house uh on on a lake and he had one put in because he [27:13] had high water table issues in his basement [27:16] and i tell you that thing worked like a gem and it just it flowed real nice back [27:21] out the lake [27:24] good thank you [27:26] all right [27:29] for the comments there uh keith um [27:35] one quick thing the buffer strip on benson have you made any [27:39] contacts with any of those people yet i have not as yet but the ldfa board said [27:45] go ahead and make the offer can we hold on making those [27:50] contacts till jeff represents the finance session [27:57] well it is actually owned by the ldfa so it's really their property to dispose of [28:03] if there's good reason to go back to ldfa in october then we could do that [28:08] it's not something that it was still just solid it's still on [28:12] the same premise it would just be a different idea versus [28:16] um we can fold off on that because your [28:19] next work session is going to be in september ldap meets in october [28:24] i don't think any because there's one business that is [28:28] you know busking at the same so to speak but at this point in time they're not [28:33] going to be doing a lot as you know if we do move forward with the [28:37] sale finalize it [28:40] the winner is going to be on top of us [28:44] no because that's one of the uh temporary permanent outdoor seating [28:49] areas that you have authorized okay [28:55] sean oh i just want to [28:59] say i had a pretty good time a few days back with our um [29:04] albeit belated fireworks it was still a very good show [29:07] uh i had a good time with the um the pub pedal in in town two seemed to [29:13] be very well attended and was it was a great day for it [29:19] okay scott [29:23] oh here i go get to make some friends again [29:29] first thing is the slocum street zigzag [29:34] park whatever it is called [29:38] unless something's been done with it in the last day [29:41] is an embarrassment to the city [29:46] uh you can't even walk down it without ducking [29:50] i mean this stuff has grown from one side to the other side over top [29:56] and i mean it's just terrible [30:00] uh the next thing that relates to the same [30:04] thing is you know coming into our city on colby [30:08] you come down to the bottom of the hill and you're greeted by [30:13] weeds growing under and over the guard rails then you got [30:18] two houses there with very unkept lawns and then you got an empty strip mall [30:24] that's got three foot high weeds [30:26] growing in all their stones out by the road [30:31] and you probably have at least eight or ten election cut signs sitting there [30:34] that are uh ordinance violation as far as i'm concerned [30:39] and then you got a motel that used to be very well kept that isn't well kept [30:43] anymore i just [30:45] don't see where our city is very welcome looking when you [30:50] come into it and then [30:53] once you or somebody just said so i think i just got missed one picnic table [30:57] will probably suffice um i'm glad to see in the tifa notes [31:02] at ldfa that they're looking at clock [31:05] repairs or replacement also looking at the fire pit activation [31:09] button i think that's a great thing um definitely like i said lottington has [31:12] one on theirs um i took a picture of it just a button it says push here so i [31:18] tried to get a company name off that wasn't there [31:22] and i think that's it yeah that's it okay [31:28] last week i spent a couple of days in cadillac as far as the [31:32] the michigan association of mayor's [31:38] not a real conference but a workshop and it was [31:41] very enlightening and to listen to [31:45] the subjects that they brought up it was great talking with other mayors [31:51] and finding out you know what their problems are pretty much [31:55] their problems are the same as ours just bigger city bigger problems the same [31:59] nature but we're still [32:03] pretty uh well off compared to a lot of them i heard a lot of great comments [32:07] about whitehall and [32:10] i was very happy to be there and represent our [32:13] city [32:16] it was a a good time [32:19] sorry i missed it the community picnic i i was up there for that i always enjoyed [32:23] that community picnic because it is such a wonderful thing to see the community [32:27] out and the kids down at goodrich park having a great [32:30] time [32:32] all right with that we have a public comment next anyone wishing to speak [32:36] please come up to the podium give your name and address and you have three [32:40] minutes to comment [32:50] i see no one i [32:52] say we move on to old business scott do we have any old business [32:58] okay new business we have resolution [33:03] 2241 right-of-way easements [33:08] i'll move to accept [33:11] the resolution 22 80 22 41 right away [33:17] second consecutive any discussion questions [33:35] uh [33:43] yeah okay so what is the corner down here with the [33:47] lines in the corner that that's the area that we're looking [33:51] to obtain an official easement [33:56] jennifer grow owns the property at that corner [33:59] and basically [34:03] in order to make the curb radius adequate we need to get an easement for [34:08] that little 30 by [34:11] 40 foot strip of property so it's going to be curved [34:15] uh probably not that that just is going to [34:18] be within the road right away and it's actually [34:22] part of the asphalt's there now so we're going to [34:27] officially have it [34:35] pretty easy to figure out [34:42] anyone else [34:44] all right removing moving second roll call please [34:50] yes yes [34:53] yes yes [34:56] yes brown yes yes [35:00] resolution 2241 is approved next is resolution 2242 lot split request [35:09] i'll move to approve the lot split request [35:15] and moved in second any questions comments yeah [35:20] yes sir don't forget to get it on the board for you yeah [35:25] let's this one's about me totally [35:33] i can't figure this out [35:37] okay the the 4.5 the larger piece [35:41] um to the north is currently where brad and erica van bergen live [35:47] the maroon colored house [35:50] the property to the south is owned by 56 nash it's a rental [35:56] property that's got a pole barn on it what they would like to do is add a lean [36:01] tube to the north side of that pole barn but as you can see it's listed as a [36:04] garage in that small area [36:09] and they want to build the lean to to the north which would obviously be on [36:12] the van buren's property so they're looking to have a lot split and purchase [36:18] basically that 25 foot wide by 203 foot strip between the two [36:36] so that 56 nash can purchase it okay and i was looking at their address [36:42] and wanting to split and i thought that lots only 100 by 200 it's not big enough [36:48] correct that's the one with the garage on it [36:51] yeah it's but it's being added to so this uh from what i'm gathering [36:57] though this is another uh [37:01] we're looking for forgiveness forgiveness instead of uh [37:06] that was my question well yeah [37:10] yeah um because they actually came in and [37:13] brooke brought back the uh the title work [37:17] because we we sent that through equalization and i said wait a minute so [37:21] we got a hold of two of the parties that are owners of 56 nash [37:27] and what they had brought in to city hall back in june [37:33] was some of this paperwork but also the building permits [37:38] and they handed it to staff and staff saw that it was a building permit so [37:42] they put that in brian's box because that's where the building [37:44] permits go so it went south and they were working on the building [37:48] permit and also you know [37:51] kind of questioning whether or not they had a zoning approval [37:55] but we didn't catch us in time to put it on the august planning commission [37:59] meeting so [38:01] that's a more of an explanation it is not um [38:07] yeah the acquisition of the property is kind of an issue mainly for [38:11] the property owners but it is not [38:14] um really a violation of our ordinances because it's your responsibility [38:20] to do to approve lots please we [38:24] have the option we have the option to send it to planning commission for [38:27] review and recommendation our sop has always been just to start with playing [38:32] right right you still have the right to send it back to planning accept or [38:37] reject [38:40] do our ordinances say anything about what you can [38:45] put under a lien to uh [38:49] no is the lean too enclosed or is it open i [38:54] i think it's just uh it's just a roof coming off i haven't seen the site well [38:59] they gave me a site plan but no construction documents that was another [39:03] thing that threw us off with the building permit [39:06] but my understanding is it's just going to be a roof opened on three sides the [39:09] fourth side would be the edge the side of the garage that's my understanding [39:14] now this is the same [39:17] garage that's a pole building that we approved [39:22] in addition on to the front of it probably three years [39:26] ago and i specifically remember [39:32] that it was said at that time that the front [39:36] of the pole barn was supposed to be made to [39:39] look like the house which has never been done as far as i'm concerned [39:44] that was approved by the city manager [39:52] well i think we also [39:54] at that time required some sort of [39:59] pavement [40:03] and approach on the garage and this would actually [40:08] well i think the concern was um well part of it was that part of that [40:14] gravel driveway was encroaching on the property to the north [40:19] with this last split in the acquisition then that would kind of negate that but [40:24] i would have to go back and double check on [40:27] the apron requirement i thought there was some specific apron requirement that [40:32] hasn't been met but that [40:35] would be something for you to check on but yeah as if there's any outstanding [40:40] issues as part of the new site right this would be the time to to look at all [40:45] of it make sure everything complies [40:51] so what's the uh council's uh so once this i mean essentially we're [40:56] just doing the lot split now once we get to that point [40:59] the rest of it will go to planning right well not as a residential um if this is [41:05] approved they will have to come and get a site plan okay as a residential that's [41:09] approved by the zoning administrator okay once that's approved then they have [41:14] to go to building to get the building permits okay [41:17] so two more steps okay so as far as just the last split [41:25] i guess i don't see a problem with that now that i know [41:28] what we're looking at here [41:32] yeah sure anyone else like to weigh in on that [41:36] or just want to push it to the roll call [41:48] apparently not so we'll move forward with a roll call please [41:53] uh yes yes [41:57] yes yes [42:00] connell yes brown no sultan yes [42:06] resolution 2242 lot split request is approved [42:10] we next have public comment again anyone wishing to speak to the council [42:15] please step to the podium [42:22] obviously nothing okay next is a closed session to discuss [42:28] acquisition of real property i move we go into closed session to discuss the [42:32] acquisition of a real property [42:40] please yes [42:52] yes all right we're closed session we ask [42:55] all the none [42:58] requirement
