And whereas Wishi County [37:30] is a predominantly rural county where timely access to emergency medical care [37:35] is heavily dependent upon the availability, sustainability, and [37:39] coordination of the local emergency medical services agencies. [37:43] And whereas emergency medical services providers face increasing operational [37:50] challenges including workforce shortages, [37:54] rising costs of equipment and training, increased call complexity, and declining [37:59] volunteer participation. And whereas Iowa code chapter 422D [38:06] authorizes the county board of supervisors upon adoption of a [38:10] resolution declaring emergency medical services to be an essential county [38:14] service to submit to the voters the question of imposing an emergency [38:19] medical services tax including a borium property tax and [38:26] whereas Iowa code 422D.1 1 2 B requires counties adopting such a [38:35] resolution to coordinate with local emergency medical services agencies to [38:40] establish a county emergency medical services system advisory council to [38:45] assist in researching, assessing, and guiding EMS service delivery within the [38:50] county. And whereas the Wesy County EMS [38:56] Association is an established countywide organization representing emergency [39:02] medical services agencies within Wishik County and is governed by duly adopted [39:08] bylaws and regulations. And whereas the board of supervisors finds the Wesy [39:14] County EMS association is uniquely qualified to serve as the county EMS [39:20] system advisory council as contemplated under Iowa code chapter 422D. [39:28] Now therefore be it resolved by the board of supervisors of Wesia County [39:32] that section one declaration of essential service emergency medical [39:38] services are hereby declared to be an essential county service in Wesik County [39:44] Iowa pursuant to Iowa code 422D.1. Uh [47:53] I'm not sure how they come that conclusion because this this piece of [47:58] property is on Highway 52 South. Um about a mile south of the intersection [48:04] of 9 and 52. And yet down at the intersection 9 and [48:10] 52 is Windidge Implement, a car dealership. And you go up and top the [48:15] hill and there's this property. And if you go down the road a little bit [48:19] further, the DOT is down there. And right beside the DOT is the county sold [48:27] that property to March Loing and He C1 Highway commercial. You get under a [48:35] little bit further and it's JD Holland [48:40] and he's put up a shop down there and it's on a piece of land twice as large [48:46] as what I'm trying to sell Mr. Noach. [48:54] The other concern that they had was the traffic on Highway 52. [48:59] Well, I've lived in the Highway 53 years. I [49:03] know there's traffic on that road. Uh used to try to farm on that road because [49:09] they don't traffic doesn't always really care for me. But Mr. Nvac's [49:16] business now is on Locust Road north of town. And if you want to see traffic, [49:22] you go up there to Locust Road at the rush hour in the [49:27] morning with the school kids and everybody coming into town and the [49:31] traffic's back up the swimming pool. He's trying to move the business out [49:37] onto a highway that can handle the track. [49:43] Uh [49:47] in the zoning ordinance C1 highway commercial, the very first paragraph, [49:54] the second sentence says, "Commercial uses would generally require substantial [50:00] land area and access to a major traffic artery. [50:07] That's Highway 52 right from the get-go. They can handle that up that track. [50:14] And with the DOT right next to them, if you get a half inch of snow, you get [50:20] a half inch of salt about an hour later because there'll be six trucks go by and [50:26] they'll salt that road. They have a clear road policy and they do that. [50:34] Third issue was farmland. farmland. [50:39] I think they said that the average CSR of farmland in Wy County is 58.5. [50:47] This is the area at 61 or thereabouts [50:53] and that's because of the C and D slope sign. It's not it's not very level [50:58] property. And but I'm not going to say it's not good farmland because I farm it [51:03] forever and I've raised a good crop on it every year. But if you want prime [51:08] farmland, you would have to go north of this down in the valley down there where [51:13] I got some Huntsville with a 2% slope that has a CSR of 90. [51:19] And so this is good farmland. It's not pine farmland. [51:25] Uh, [51:28] one last thing I guess I saw in the paper recently where the auditor had [51:33] said something about the state the state uh not allowing you to raise [51:40] your property taxes only a certain amount in the future. [51:45] And I thought I had said something about having uh having uh new construction [51:53] pick up the balance of some of that which you're not going to be able allow [51:57] to do. And this is new construction right from the get-go out in the county [52:03] in the rural area between several other commercial [52:08] properties. Own Perry Novak Electric since acquiring from my father. Um, I'm [53:04] asking to reszone a chunk of land, uh, A1 to C1, uh, 17 acres on Highway 52. [53:12] Um, I'd like to discuss, um, the planning and zoning, uh, [53:17] advisory recommendation of denial. Um, that recommendation was based on several [53:23] factual misunderstandings that I would like to clear up with the board. [53:28] First one regarding spot zoning. PNZ stated that this parcel is one to two [53:34] miles from the nearest commercial district for their meeting minutes. The [53:38] fact uh for our GPS and beacon we are about 2/3 of a mile from the DOT office. [53:46] Um, we are extending an established logical commercial corridor along a [53:52] federal funded state mandated highway, not dropping an isolated island in the [53:59] middle of a farmland. Second was the regarding to highway [54:04] safety and traffic. The Iowa Department of Transportation has fully reviewed my [54:09] application that they didn't have completed at the time of PNC and has [54:13] officially approved our commercial entrance permit. The state traffic [54:18] engineers verified that came to the site um that our site lights and turning [54:23] approaches are completely safe. They can't issue me a certificate until the [54:28] property is zoned commercial. So, they can't issue a commercial application [54:32] based on it being zoned egg. Um [54:37] uh furthermore and the big piece here is the vast majority of our electrical work [54:42] is south of Decora. Um as as said previously um the amount of traffic that [54:48] we put through Perryova or put through Decor Iowa I project somewhere around [54:53] 100 cars a day between our uh between our technicians, our employees and our [55:01] um deliveries. Most of our work is south of town. The city has three corridors to [55:06] get into the city of Dora um to where we need to get to. Our deliveries can all [55:11] happen south of town and where we need to go. Um if we're going to Kelmer, [55:16] Wakan, Dora, any place we're we're much more centrally located. [55:22] Um third regarding egg preservation and that was one of the biggest pieces that [55:26] PNZ discussed. Um Wishik land averages 59 CSR to my understanding. This [55:33] includes bluffs, rock outcropping, timber and pastures. Um, true tillable [55:41] ground in our county I believe is closer to 80. But what actually is being farmed [55:46] a rating of 61 reflects moderate rolling ground. In fact, that current landowner [55:52] Gordon um will confirm he had to construct dedicated conservation [55:58] waterways BMS just to manage the runoff from these property. [56:03] Um PNZ discussed the 17 acres when initially the building is going to take [56:09] 8 to nine acres. Um that that open acreage is not being wasted. Um our goal [56:16] based on staying on budget is to install a geothermal system to heat and cool our [56:21] facility similar to our building north of town. And we basically open trenched [56:26] our geothermal. we uh covered it back up and now we actually rent out the farm [56:31] down north of town on Locust Grove. So our goal for the um five to six acres [56:36] which I would call to the to the left side driving into this property, we'll [56:41] be doing all of our geothermal work. So we we'll uncover that. We'll install our [56:45] geothermal loops. We'll lessen our carbon footprint. Um, and then when we [56:50] cover cover our geothermal back up, there's a good chance that Bordon's [56:55] going to be farming that ground again on the on the left side of the property. [56:59] Um, we will also be constructing a retention pond to control our storm [57:05] water. So, we'll be control we'll putting a what they call a wet storm [57:09] water pond um in the front of the property. And a wet storm water pond is [57:14] it's going to hold water and we'll actually have a fountain and make it [57:17] look nice. And that'll be built to um absorb our storm storm water um and [57:22] release at a slow pace to [57:28] and one of the biggest pieces basically to talk about is the uh impact of our [57:32] project to win county. Um the real dollars for Winnick County. [57:37] Right now this parcel is bringing in roughly $1,000 a year of property taxes. [57:42] By the time we um outfit our facility, we're going to spend in the neighborhood [57:46] of $6 million in private capital funding. [57:51] Um even with the initial revitalization abatement that we are asking for, this [57:57] will transition into paying approximately $70,000 [58:01] a year in commercial property taxes. a 70fold [58:07] increase supporting our county services, emergency response, and local schools. [58:14] We will generate substantial local sales tax right here on this $6 million [58:20] project. So, of the 6 million, 4 million will be material. Of that 4 million, [58:26] we'll be spending 7% in sales tax wherever we build the building, [58:30] hopefully in Luna County. Uh, our goal is also to add roughly 5 to [58:35] 10 new skilled traded positions in the range of 50 to $100,000 per year, [58:42] keeping hardworking families living and spending money in Winnick County. [58:49] Most important, we believe in being a good neighbor and investing where we [58:53] live. Over the last two years, my father and I have donated $85,000 [59:00] to our local hospital alongside regular support for numerous community [59:06] fundraisers, youth initiatives, including our bowling alley, and local [59:10] organizations across this area. We just don't do business here, we live here. We [59:16] give back. We care about the long-term health of county. [59:21] Finally, regarding the people who actually live next door, county zoning [59:25] mailed notices to all six adjoining land owners. Not a single neighbor filed an [59:30] objection. Sharon Vocodol, which is directly touching this property, written [59:36] approval to PNC and another adjacent owner verbally confirmed their support. [59:42] The people who share fences with this property know how we run our operation [59:47] and we want to see this project move forward. [59:50] We are a proven local business ready to invest private capital, clean up [59:57] downtown traffic, build high wage trade career right here in the county. And [1:00:46] unfortunately in this county there have been a lot of projects that have not [1:00:51] received support and a lot of business has gone elsewhere and we are seeing the [1:00:56] effects of that with declining populations, enrollments in schools, [1:01:00] funding and etc. So it'd be wise of you guys to approve this project and many [1:01:05] more that may become ahead of you guys. So, um I did take into effect that uh um we [1:04:46] probably are on the smaller side. Um plenty of room there to either um use [1:04:52] the correct angles to make that pond larger or generate a second pond. [1:04:57] » So, you're requesting to reszone 17 acres but only using eight or nine. [1:05:02] Correct? >> Well, basically my interpretation is [1:05:06] everything for the property needed to be zoned. So the everything we're doing [1:05:11] including the geothermal which is for our building my interpretation was that [1:05:16] land needed to be zoned with the building [1:05:19] and truly that could be you know if our business were to grow in time that that [1:05:24] build that building's designed to be added on on that side. So they call it [1:05:28] they call it a blade breakaway panel on the that side of the [1:05:33] building. Is that also your interpretation as some [1:05:38] administrator? >> The land is going to be used for [1:05:40] commercial has to be z commercial. >> All [1:05:44] the land being used for commercial has to be z [1:05:48] part part of the issue with why it is what it is. It's because of the contour [1:05:52] and not being able to get in and plant efficiently if there was odd pieces left [1:05:58] out of >> Yeah, that's part of it. Yes. Y and like [1:06:01] I said, we need a better chunk of that land on that side. We need a basically [1:06:05] roughly a 100 ton of geothermal. We'll have a 100 loops, but we're also from [1:06:11] the carbon footprint wise if we use geothermal. I mean, that's in my opinion [1:06:16] huge environmental impact savings that we're not running boilers and gas, you [1:06:21] know, heating electricity for cooling that uh will use, you know, as much [1:06:26] geothermal as some backup gas. >> Speaking of environmental, it's also [1:06:32] light considerations. smart [1:06:35] just to have wall packs on a building. >> So, our intent is not to have any light [1:06:40] poles. >> Basically, we'll have perimeter lighting [1:06:42] around the building. >> Um, [1:06:44] » where does that project? >> Just the parking lot [1:06:48] » down. >> Yes. [1:06:49] » Straight down. >> Straight down. [1:06:50] » Yep. Our biggest thing is when we get to middle of winter, um, our guys are going [1:06:55] to start between 6:00 and 7 in the morning and it's still pitch dark [1:06:59] outside. So, we need to um have lighting at least near the building. [1:07:04] » You need that just for safety. I mean, >> yeah, but the big thing is the intention [1:07:08] is not to have any poles. Um it'll just be perimeter lighting around the [1:07:12] building >> and really the side that's, [1:07:16] » you know, the front of the building I call it. That's not the showroom. You we [1:07:19] won't put any lighting. Um there's, you know, past projects that [1:07:23] said the same and now they're real bright and and pretty intrusive lighting [1:07:28] for our valley. >> That's not my intent. [1:07:32] » So I think a good example of good lighting is the Locust Road project we [1:07:36] did where >> we're straight down [1:07:38] » straight down and all those fixtures cut off. So they're 100% cut off. So it's [1:07:43] not if you look at what I call a traditional wall pack on the building, [1:07:46] it shoots light out. Do you see a reflector on the front? The lights will [1:07:50] shoot light all down. So, [1:07:53] » Russell, on the geothermal loops, will that occupy maybe a portion of that 8 [1:07:58] acres that still will be farmed? >> Yes. Yep. [1:08:01] » And >> and we'll push it basically up as close [1:08:03] to the property line as possible. You know, if we ever need to add onto our [1:08:08] building, we can't have the geothermal under our building. [1:08:11] » So, in other words, you can't have you can't build over the top of your [1:08:14] geothermal lines. And uh would that even allow for gravel parking above it or [1:08:19] would that be a compaction problem for the geoc? [1:08:21] » No, it would not be ideal. Um the big thing is the compaction and uh if the [1:08:27] ground's hard, it's going to transfer more heat. So that frost would actually [1:08:31] penetrate down quicker on compacted ground than it would not. So in this [1:08:36] case really that land is going to be preserved and will be needed as an [1:08:40] agricultural resource per se to preserve the integrity of your geothermal. [1:08:46] » Yep. But it's all in use for this building. So that's my interpretation [1:08:51] that anything used for this building has to be considered [1:08:56] the C1C because the loops basically just round [1:09:00] numbers and I don't have it 100% designed. The loops are 100 ft long. I [1:09:04] take a three-foot trench. They're 10 feet apart and I need a hundred of [1:09:09] those. So, it's gonna be a lot of work running [1:09:14] basically and then we'll farm over the top of it. But those loops will be the [1:09:18] integral part to our building and really a large I mean we're it's substantially [1:09:23] more expensive than just putting gas in and putting a big LP tank in. But it's [1:09:29] worked out well north of town that basically we have we have a 30,000 foot [1:09:34] warehouse north of town that we burn we're geothermal and we burn probably [1:09:38] 700 gallons of fuel instead of 15,000 gallons of fuel. So the geothermal has [1:09:44] worked well in other applications. >> The other thing you talked about would [1:09:49] be green screening like trees and vegetation [1:09:53] » the whole front isn't exposed so to speak. you know, been. So, we're going [1:09:57] to want some low grip vegetation. We can we can plant taller stuff on the [1:10:01] sidelines for I'm definitely willing to listen to what [1:10:07] recommendations are, but we want people to see our building from the you don't [1:10:10] want to block the view of your building so you can't see [1:10:14] trees. >> No, but both property lines on the [1:10:17] sides, no problem. Or no problem. >> Screening of the storage unit section. [1:10:24] Um, I mean that's part of marketing is to be able to see that from the road. [1:10:29] » So we're coming up on a bluff entering Dora and people will see a big storage [1:10:33] facility on the right >> and our commercial building. I I guess I [1:10:37] don't you know they come from the north and [1:10:40] they see a wind tower sitting on top of the hill. It don't work anymore. So [1:10:44] what's the argument? I mean >> I mean I don't disagree. I mean we're [1:10:47] Yeah. So the cheapest storage building I could buy [1:10:50] » Yeah. >> is a galvanized building. So you see a [1:10:53] ugly galvanized roof. I don't do that. So if you see the building I just built [1:10:57] in Kelmer, we use a colored roof. We use colored walls. We use two-tone corners [1:11:03] to make it as appealing as I can. Um, I guess I'm not saying I can't put a row [1:11:12] of trees to block the view, but that's also hurting the [1:11:16] » my marketing side of people that see the building that says, "Hey, I need space [1:11:21] to rent." [1:12:47] That's the traditional facility, but we're adding the RV [1:12:52] storage, which predominantly you're going to take vehicles and sit down in [1:12:56] front of people's houses and putting them in a facility where, [1:13:00] » like I said, what I built in Kelmer, I think turned out really nice. And uh we [1:13:04] just got done with one in Charles City, you know, where basically they can park [1:13:09] their campers inside with power um and lighting, which uh there isn't a [1:13:14] lot of those type of facilities out there currently. But the trend in the [1:13:18] storage industry is for the appearance being a major positive for the facility. [1:13:24] You've you could look at a lot of these places that have especially conditioned [1:13:28] storage. They're not the low-end uh like you say the galvanized roof. Uh we want [1:13:34] to make it look nice and that's where um even in this facility I could probably [1:13:39] save4 $50,000 to put a galvanized roof on and [1:13:44] it's not eye appealing whatsoever. And I'm not doing that. I've never done that [1:13:48] at any of the facilities ever. So, I I do want to make it look nice. And if we [1:13:53] look at, you know, I've built this type of um uh RV style storage in Charles [1:13:58] City a year ago and we're just finishing one in Kelmer. We're trying to blend it [1:14:04] in as much as we possibly can and we're also taking care of the storm water to [1:14:08] the best of our ability. So, you know, my concern on previous [1:14:13] projects and this one is coming into Decora is it's a beautiful [1:14:19] county. It's a beautiful entrance into our valley and I'm my hesitancy is [1:14:25] preserving that vista, but I'm also in favor of economic [1:14:30] growth. And I'm looking back at previous decisions by the planning and zoning [1:14:34] commission, and I wish they were here today so I could ask them questions. [1:14:38] They're not here today, but I I might be able to direct it to Tony. I know you [1:14:41] can't speak for them, but they approved the Voltmer Electric facility [1:14:46] unanimously and they approved the Holland facility 4 to3. Um, similar [1:14:52] situations. [1:15:01] I went back and looked at the meeting minutes and don't I think Wolver went [1:15:07] through twice basically I think he got comments from PNC and then kind of [1:15:13] corrected that and went back don't over that but I reached out after the PNC [1:15:17] meeting I felt it was a rough meeting like there were [1:15:22] they knew how they were going to vote before they started before I even talked [1:15:25] to be honest with you and uh I talked to I tried talking to DJ Priest after the [1:15:30] meeting the next day um he said I can't legally talk to you they gave me no [1:15:35] comments at the meeting to say hey if you can tweak this or do this it was [1:15:39] just basically no 60 done >> and if you see hesitation in me [1:15:45] » no I want to answer your question >> finish what I was going to say in in a [1:15:49] previous project you know we're going to plant trees and we're going to do this [1:15:52] we're going to do that wasn't done so I don't know where the [1:15:56] followup on that is or what we do as a community to make sure that people [1:16:00] follow through on what they say they're going to do. [1:16:32] We're making this project for the next generation. For my son that's with us to [1:16:39] the 100 employees that work under our brand. This isn't a oneanddone project [1:16:44] for us. We we got into storage facilities a few years ago um of using [1:16:50] extra space and it's it's put two people to busy all summer mowing. It's put a [1:16:56] handyman together fixing stuff. It's put, you know, we got two gals in the [1:17:00] office that got full-time jobs because of what we're building. So, [1:17:06] trying to come up with this happy medium that we can build something that looks [1:17:09] appropriate to the facility um and uh put people to work [1:17:14] » and it's a conversation for the wider community that we can't have here [1:17:17] unfortunately. Lind do we want Highway 52 to become storage facilities as we [1:17:22] lead into town? There's another storage facility representative who spoke in [1:17:26] favor of you today. What does this open it up for future? What do we want to [1:17:30] look like as a community in the future? And that's where my concern for [1:17:33] lighting, um, trees, retention ponds, the protection of the environment, the [1:17:38] vistas, the all of that. So, and then when I go back and look at the PNZ notes [1:17:44] for approval for both Boltmer and Holland facilities, Highway 9 and [1:17:48] Highway 52, respectively. Um, I'm having some trouble with that inconsistency on [1:17:53] this one. I'm not fully understanding why, and I wish they were here to answer [1:17:57] that question, but they're not >> and I can't talk to them before this [1:18:02] meeting. That would be exparte communication, just as I couldn't talk [1:18:04] to any of you before this meeting. So, I'm asking the questions here in the [1:18:09] public hearing. >> And I don't know, I don't see any [1:18:12] retention ponds, but I haven't physically drove on private property to [1:18:15] see them, but one of our features on the front of our building is to make a [1:18:19] pretty high appealing retention pond with some really nice river rock. Um, [1:18:24] and they call it a a wet pond where basically we'll keep about four feet of [1:18:28] water in the bottom of the pond. We want to put a fountain in there that looks [1:18:32] really nice. So, you know, I'm sure you've seen the bowling alley we've done [1:18:36] in several projects. I want this to look as nice as it possibly can. Our [1:18:40] fireplace showroom, I think, turned out awesome with the fireplaces on display. [1:18:44] So, we're working with a local contractor to have a nice overhang on [1:18:48] the front of the commercial building. We'll have fireplaces and our furniture, [1:18:51] Amish furniture that we sell outside um with pavers and uh um you know, we want [1:18:57] consumers to feel welcome to come to our facility. We don't want it to look like [1:19:00] an industrial facility that nobody wants to walk out the front door either. [1:19:07] » I think that the Novaks have have demonstrated over over the years quality [1:19:12] of the projects that they build would fit what I'm hearing Russell say [1:19:17] today. Uh, no, no offense, Matt, but I would [1:19:22] challenge between the current storage units and the uh the Novak storage units [1:19:29] a competition that would be which one is going to have a better looking building [1:19:34] as you go towards the future because I don't know if Mr. Kurt will stop [1:19:37] building storage either, but I'd like to see a little competition between the two [1:19:42] of them. Uh, the last thing that I want to see is I'd like to see us revisit as [1:19:48] a board our general plan because I think the overall focus with so much that is [1:19:54] just cut and dry the appearance of it's corn, [1:20:00] you can't get rid of it. I don't want to comprehensive plan. [1:20:03] » Yeah, the comprehensive plan. I think that the last thing this county needs is [1:20:09] to hang a shingle out there that says close for business. [1:20:12] » I I also want to reiterate the fact that when you do a redo of the con when you [1:20:17] review the comprehensive plan that took that was years in the making and it [1:20:22] includes a lot of community input. So if we look into that just for the [1:20:26] conversation that also has to be a huge community input again not to be [1:20:31] discussed today and decided today but it's a huge community input piece back [1:20:38] Tony I have a question for you spot zoning just so you can kind of educate [1:20:42] the room and the public BNC that was one of their reasons for [1:20:47] denial was spot zoning but we do have the DOT garage the Mirage Shack uh now [1:20:54] business on the same area and the JB Holland on the same highway. [1:21:00] Tell me why this would be spot zoning. >> So the definition of spot zoning is [1:21:05] excuse me an island of land that is zoned differently from the surrounding [1:21:10] area but it is an incompatible use. Okay. So to be spot zoning it has to be [1:21:17] different from the surrounding area. It has to be incompatible with the [1:21:20] surrounding area. What's what's the definition of surrounding area? There's still going to be sales tax the property tax is [1:25:40] still going to have to be paid on them buildings. I mean, we're it's a it's [1:25:44] just a win-winwin. Everything you look at is a win. There ain't no We ain't [1:25:48] losing property tax. You ain't tearing them buildings down. Ain't going on at [1:25:52] it. We we built this beautiful bowling alley renovation here [1:26:03] five years ago now. And I didn't have to make the outside look any different. Um so when an applicant submits a [1:27:23] site plan that is exactly what it is. It's a plan that is a non-binding [1:27:27] document. All right. Now if there are certain things I code allows a [1:27:33] conditional reasoning. All right. On a conditional reasoning [1:27:37] the supervisors can put on uh requirements that will specifically [1:27:44] alleviate a problem. Right now how do those get done? I am in charge of [1:27:50] keeping sure those go well. If they don't go well we file things with the [1:27:55] district court. Whatever we have to do. We've just seen where that comes back to [1:27:59] the board of supervisors and they change it. All right. So to answer your [1:28:05] question is site plan is non-binding. If you want binding things, it has to be [1:28:10] done as a conditional zoning. >> All right. [1:28:13] » In this meeting or pre or >> in this meeting conditional zoning has [1:28:17] to be agreed to by the applicant in writing before the adjourment of the [1:28:21] public hearing. So one of those conditional uses would be the [1:28:25] requirement of that retention pond. >> That could be if you can say that a [1:28:32] retention pond is required to alleviate a problem that that construction is [1:28:36] causing [1:28:40] um while we're thinking about that the comprehensive plan. So the comprehensive [1:28:44] plan says this is kind of in reply to what you were saying Mark the [1:28:48] comprehensive plan has a lot of goals. Okay. So, some of the goals are we want [1:28:55] development along major highways, right? Some of the goals are we want to [1:29:00] preserve farmland. It is the board of supervisors responsibility to prioritize [1:29:06] those goals for an individual request or individual location request. Right? [1:29:14] So, it is I I didn't like the way it sounded where one is all going with this [1:29:20] and one is all going with that. These are both goals we have, but it is the [1:29:26] board of supervisors responsibility to prioritize which goals are more [1:29:31] important for a specific development. [1:29:39] One more comment that I would like to make is if they would leave the county, [1:29:43] what you guys are going to lose >> and do you understand that and the [1:29:48] comprehensive pack package of that whole thing? Because you're not just going to [1:29:51] lose the business, you're going to lose taxes, you're going to lose employees, [1:29:54] you're going to lose families, and they're going to move. [1:31:19] » I That's the same. I mean, as we talk about things, my cheapest route, [1:31:23] galvanized fence that looks like a jail. That's not what we do. You can see [1:31:26] around every solar project we've done, it's a PVC coated bench. The cost is [1:31:30] double, but it looks very attractive to the customer going by. I mean, we want [1:31:36] both. We want the consumer to come in that feels comfortable coming to our [1:31:39] facility. Um, but there's a substantial cost. I mean, when I put this fence in, [1:31:46] uh, PVC coated, you know, gated access, my cost is going to be higher than TA's [1:31:52] facility that doesn't have it. So, you're going to have different customer [1:31:55] clientele when we put a security system in and have cameras at our site compared [1:32:00] to a facility that doesn't have cameras. We're at two different price points uh [1:32:05] of pleasing two different customers. You know, if you come to our facility, it's [1:32:09] gated, fenced, cameras, security lighting. um [1:32:12] » free coffee >> probably not coffee but uh but if you [1:32:17] come up to our shop there probably would be but [1:32:20] you could see a 15 or 20% price difference between the customer that [1:32:23] comes and rents and that consumer needs to decide you know can I afford and what [1:32:28] am I looking for so we're going to provide two different there's there's [1:32:33] services for everybody there's >> and you did that you did your homework [1:32:36] on that you know what's out there have them otherwise [1:32:39] » and that's the same thing we have facilities in the same town offer [1:32:43] different amenities. The new facility we just did in Charles City that has [1:32:47] cameras, lighting, um we charge a different price point than one that [1:32:52] doesn't have those amenities. This would be our first facility with a fence uh [1:32:57] gated access. And how the site plan typically most properties don't have [1:33:03] enough real estate to drive off the public road to get to a um a gate to [1:33:09] type a combination in with a a a 40ft campus. We're able to pair that driveway [1:33:16] sauce with this project of entering Perry Electric and entering the um [1:33:21] storage facility. Um, [1:33:25] so people are coming in and off the highway. Our driveway is roughly 200 [1:33:29] feet long to share that access to come in and off the highway. [1:33:35] » What >> I miss might have missed this in the [1:33:38] conversation today, but who did you work with or have you worked with anybody for [1:33:42] the the study for any new runoff created by the hard surfaces and [1:33:49] » all? you calculate it all in your [1:33:52] » basically I've used the internet to determine the uh the size of the [1:33:57] basically solid surface areas and they base it off the 100 year flood you got [1:34:01] to store it I have it all written down at home with the calculation but um you [1:34:05] got to store it for a period of time um you need to have so much volume uh your [1:34:10] retention pond has to be a certain slope um [1:34:13] » what is the volume runoff created by this [1:34:20] Well, in previous projects, there were studies done. Some That's why mask [1:34:25] » and I don't blame you. That's if if you were to put that in there, require me to [1:34:28] hire an engineer, that would be a burden. [1:34:31] » I would spend probably around $80,000 to give you a stamp drawing that says what [1:34:37] the runoff needs to be. [1:34:43] Um I'm a bit fixated on the runoff part of [1:34:47] the detention basins and tent for moment because I struggle with a neighbor [1:34:53] and the city has that problem and you put a detention basin in and it's silts [1:34:58] in over time but there's no requirement to maintain the calculated depth of that [1:35:05] so it really becomes ineffective. >> One thing is we want all the equipment [1:35:09] to do it all. We'll be doing all our own site work here. We'll be doing our own, [1:35:13] you know, I own Artsmith Electric. We'll be doing our own geothermal system with [1:35:16] our own staff. Um, we'll be doing our own excavation, [1:35:20] applying our rock compaction, and then subbing out the concrete in the building [1:35:24] portion. Um, uh, I know the previous owner basically has already spent a [1:35:31] substantial amount of money on retention water there along with the access [1:35:37] underneath the highway and pieces already. They're only going to be a huge [1:35:41] benefit for me as we collect that 100-year flood rain and then slowly [1:35:45] discharge it. So I know the city implemented plan [1:35:49] obviously that that has to be examined and maintain [1:35:53] » I can think of three projects in decor lost because basically what their [1:35:56] requirements are for storm water >> but I think you're putting the storm [1:36:02] water in the front of your main office and showroom and I think in your own [1:36:09] interest you did that on purpose putting it in the front and intend to use it as [1:36:13] a feature rather than a liability. It's 100% a feature. So, realistically, I'd [1:36:18] like it to be larger than needed, you know, to have a pond out. Um, and we [1:36:23] want to put a color changing uh some lights in the water to have a fountain. [1:36:27] Um, honestly, it's going to be one of our focal points. And just like, you [1:36:31] know, the the colors and stuff I use in front of the bowling alley of the wood [1:36:36] grain textured look to make it look vibrant. That's I'm going to use this [1:36:41] pond to do the same thing with. you know, we want this pond even to the [1:36:45] point potentially we might put a bridge across the pond as more of a a [1:36:49] decorative piece. >> So, you have no study saying you need [1:36:53] that retention pond? >> Uh, just my own logic knowing that we're [1:36:58] taking permable farm ground and turning into a solid surface [1:37:02] » with the various colored light feature. >> It would [1:37:08] I mean I I'd like it to look nice kind of like courthouse does here. So it is a fit for the C1 [1:38:41] number of acres requested for the zoning. go back to the top which [1:38:46] generally requires substantial land area that is out of point and the public [1:38:53] safety due to heavy traffic on Highway 52 potential driveway permit is going to [1:39:01] be allowed. The DOT looks at that and that also states that C1 should be on [1:39:06] the major traffic. So, [1:39:10] the only one that possibly goes in there is spot zoning and with the relationship [1:39:18] um distance to the other facilities that we listed. I don't believe spot zone. Um, given the fact that he is Dan Marx's son, I sent [1:53:21] you a copy of a resolution and also a policy concerning employment relatives [1:53:27] and a little bit of background in information last Friday. Um, happy to [1:53:33] answer whatever questions that you have. But [1:53:38] back up a little farther. Uh, two years ago, Civil Service Commission met and [1:53:44] they put their list together and Will is on it [1:53:49] with Dan and said, "Well, you know, we'll deal with this if we ever have to [1:53:53] deal with it." Here we are. [1:53:56] » Um, so we're down to three people on that list. [1:54:02] Um, one is an McKe County resident who is not willing to move to Wesake. um [1:54:08] that individual is ineligible. Uh another one withdrew their name and [1:54:13] decided they wanted to stay at the employment that they currently have and [1:54:17] uh will is still on the list. Will tested well. He was vetted by civil [1:54:24] service um and at the time of his potential appointment by you folks would [1:54:31] be about two and a half years in as a law enforcement officer. I've been [1:54:37] working with him on occasion on cases he's been involved in. Um, very positive [1:54:43] experience. He's uh he's learning. He's coming along. He's asking good [1:54:48] questions. I followed up talking to officers that he works with at the PD. [1:54:55] I've talked to sheriff's deputies. Um, same thing. You know, he's he's making [1:55:02] progress. He's doing the right things. He's asking right questions. and he'll [1:55:05] be he'll be a um a good law enforcement officer for Lynch County regardless of [1:55:11] where it's at down the road. Um next question we had to address is um [1:55:19] we have a common policy against hiring relatives and state code provision [1:55:24] limiting the ability to hire a relative. Um [1:55:29] and how did those two fit together? Um, in state code, you folks uh set the bond [1:55:37] for uh officers and deputies within the county. And the code says that as long [1:55:43] as you set the bond for this individual, that provision regarding um working for [1:55:49] a family member is waved. [1:55:53] You also um control the terms of the um employment handbook which restricts [1:56:01] hiring of family members. And you can wave that provision for good [1:56:07] cause and in this case I've tried to identify a number of factors within the [1:56:12] resolution that would constitute good cause. Not the least of which is um you [1:56:18] know if I go out and say my daughter wants a job in my office as a secretary [1:56:27] I'm the only person evaluating her abilities and hiring her would be [1:56:31] inappropriate. Here the deputy is vetted by the civil [1:56:36] service process um completely outside of the control of the sheriff. um sheriff [1:56:44] has input obviously in terms of what's happening in that process, but the [1:56:50] decision as to who goes on the list is done by the civil service commission. So [1:56:56] there's a there's a safeguard in place um safety [1:57:03] rail so to speak and I think with that in place um my thought was you [1:57:10] know legally this can happen meeting certain criteria [1:57:16] um in a belton suspenders move I called Lynch Dallas and said hey here's what [1:57:21] I'm seeing can you take a look at this uh this with Maddie for a while. She [1:57:26] said, "Yeah, I'm in agreement with you. You may want to do, you know, make sure [1:57:31] that, you know, there's written policy in place. Yeah, we're working on that [1:57:37] and you may want to include X, Y, and Z." And, yeah, so we implemented those [1:57:41] ideas. And long story short is in the resolution, I [1:57:48] lay out the steps that you would need to take if you choose to make this [1:57:52] appointment. a rationale for why you're making the appointment and why you're [1:57:58] suspending the county policy and why you're approving the hire um under the [1:58:04] state policy as well and uh ultimately making an appointment um that's [1:58:11] effective November 9th. The other piece of this that's attached [1:58:17] is the written policy itself. um basically putting this hire under the [1:58:22] supervision of the chief deputy. Um you know, it's one thing if Dan says, "Hey, [1:58:28] we're going to, you know, we're going to have an officewide meeting on Thursday." [1:58:34] Um probably not something that needs to go through the chief deputy to say, [1:58:38] "Well, you need to be here on Thursday, or you know, we're going to we're going [1:58:43] to fill our cars with gas at whatever station." [1:58:48] um that can apply to everybody. When it comes time to say, you know, we need to [1:58:55] uh review um potential disciplinary issues, we need to review um uh work [1:59:02] assignment um you know, or maybe patrol officer, investigator, you know, those [1:59:08] types of things. That becomes a chief deputy decision. [1:59:13] And rather than uh rather than leave that to kind of a whim [1:59:19] of any sort, we reduce that to writing policy and is uh safeguard and I visited [1:59:26] with uh Steve and also with Dan about this that you know if this policy if [1:59:32] they get working with it and say you know this isn't quite working the way we [1:59:37] anticipated it um come to me come back to the board of supervisors. [1:59:45] It needs to be changed with all of our approval. Um, not just, hey, [1:59:52] this isn't working. We're going to do it different. So, you guys stay engaged in [1:59:57] the process. And, and I think I think that's important also. [2:00:03] So, I don't think I've covered everything in here that that I've uh [2:00:07] sent out to you, but I think it's most of it. and I'm happy to field any [2:00:11] questions if you have them. >> So to be clear, main supervision would [2:00:15] be with >> Steve. I had a rare I had a rare opportunity [2:01:01] during the fair to run into officer Marks at the fair and in a rare [2:01:07] vignette of time where I got to be able to spend about 30 minutes with him in a [2:01:11] direct conversation and with my because I've spent a lot of years of [2:01:17] interviewing and recruiting. Uh I asked him a lot of very pointed questions [2:01:20] about his career path, what he planned on doing and things of that nature. And [2:01:24] you know, my my take away from the whole thing was a very squared away young man [2:01:29] who uh is a real credit to uh proper upraising and good work ethic. And I [2:01:35] think what he's demonstrated down at Decor PD has been excellent from what I [2:01:41] see just from the outside and few comments that I've heard. That was a uh [2:01:46] unusual not planned but had an opportunity there which I'm really glad [2:01:51] to see because he it gave me a really good feel for the strength of that young [2:01:54] man. >> I think it would be unfair to not give [2:01:59] him the opportunity just because of his relationship with Dale. I mean that's [2:02:03] just very unfair and he is right now the only [2:02:09] vet in Canada to the job. >> Um that's correct. Which also brings us [2:02:15] to the second part of this story if you want it now or [2:02:20] » and I alluded to that um city of Kmer city of Ashen are looking [2:02:26] for more hours for law enforcement. um [2:02:31] when Med is looking for hours. [2:02:36] Um next week I hope to have uh proposed 280 agreements for your review. But with [2:02:44] that, assuming that those all go forward in [2:02:48] the hours that are being proposed, you'd be looking at one additional [2:02:54] deputy being hired to cover not to cover those, but to provide enough support [2:03:02] within the office to provide the hours that are being sought. Um the I would [2:03:09] add that those hours and payment would my understanding wouldn't cover the cost [2:03:15] of another deputy. So there isn't an out of pocket coming with that. But the um [2:03:22] um the total hours the increase uh would take care of that cost. But if you [2:03:30] choose to do that, um it's going to kick off civil service [2:03:38] having to start a new list because well is the last one on this one. that [2:03:44] » that means that um when the 280s are implemented to keep the workforce up to [2:03:51] to be adequate to provide the coverage countywide that you're looking for. Um [2:03:58] they need to be vetting more candidates >> and those potential 28 days will go into [2:04:03] effect on January one. You'd have a little bit of time. So just to clarify [2:04:08] the increase in will cover all the salary and most of the benefits. It does [2:04:17] not include some of the other side things but Keelmer is providing a car [2:04:23] because they had a retired police person. So they're are providing a car. [2:04:28] So initial cost wouldn't be another patrol vehicle. you know, as you go [2:04:34] through the cycle, five years down the line, it might cost some more for a [2:04:38] patrol vehicle. Um, Dan has said that he would isn't seeking an increase in any [2:04:44] of the training and equipment and radios and vehicles, lines to cover this right [2:04:52] now, just this increase in revenue and increase in salary and benefits. [2:04:57] » Well, maybe Dan can speak on it too, but he'll come next week. that the uh the [2:05:04] cost given to Kell was a little reduced with being able to reuse their vehicle, [2:05:11] » right? >> So, I mean, the county is buying it, but [2:05:18] himself said that he would probably not be able to get another squad car fitted [2:05:22] and up and running by the first of the year. So, was a win for Kelmer and it's [2:05:27] a win for [2:05:31] a reason why we can't capture 100% of the additional costs. [2:05:36] » It's the negotiations between those three entities and Dan and they they [2:05:42] were targeting a number that would provide the costs of deputy salary and [2:05:47] benefits. And so that's where they ended up [2:05:50] » and this next week's agenda, >> but it isn't covering the entire cost. And whereas Will Marks, a [2:07:42] certified peace officer currently employed with the Decor Police [2:07:45] Department, is the remaining applicant of the civil service list. And whereas [2:07:51] Will Marks is the son of West County Sheriff Dan Marks. And whereas the way [2:07:56] she county sheriff desires to appoint will marks as a deputy sheriff to fill [2:08:00] an upcoming vacancy. And whereas the appointment of a relative as a sheriff's [2:08:05] deputy is prohibited by Iowa code 71.1 unless the appointment is approved by [2:08:11] the board of supervisors. And whereas section 2.11 of the county [2:08:18] employee handbook imposes restrictions on employment of relatives unless the [2:08:23] restriction is waved by the board of supervisors for good cause. And whereas [2:08:27] the board of supervisors for good cause desires to approve departments as a [2:08:32] deputy sheriff pursuant to the requirements of Iowa code 71.1 [2:08:39] and 331.903 based on the information provided as set [2:08:44] on the findings made below. Now therefore be it resolved by the [2:08:49] Mishi County Board of Supervisors. One, the Board of Supervisors is aware of the [2:08:55] following facts. There is one current opening for a sheriff's deputy. B. A [2:09:00] second opening may arise near the first of the year in 2027. [2:09:05] C. Wishik or excuse me. Sheriff's deputies are subject to review and [2:09:10] approval through the civil service process as described in Iowa code [2:09:14] chapter 341A. D. One eligible candidate candidate [2:09:19] remains on the current civil service list. [2:09:23] E. Will Marks will have apparent approximately two and a half years of [2:09:27] experience as a peace officer when he starts with the sheriff's office. L [2:09:32] through the civil service vetting process, the most qualified candidates [2:09:35] for a sheriff's deputy position are selected. The search for the most [2:09:39] qualified candidates is consistent with the provisions of section 2.11 of the [2:09:44] county employee handbook which provides in part it is the [2:09:49] county's policy to hire the best qualified person available for each [2:09:54] position. Relatives of current employees are eligible for [2:10:00] employment with the county subject to limitations of the state law governing [2:10:05] the employment of relatives of public office and employees and the terms of [2:10:10] this policy. G. The Wii County Sheriff's [2:10:16] Wii County Sheriff's will maintain a policy to establish procedures for [2:10:21] supervision of a relative of the sheriff employed at the sheriff's office, [2:10:26] including having the employees work performance, discipline, evaluation, [2:10:31] scheduling, promotion, or assignment under the sole supervision of the chief [2:10:35] deputy. H the proposed appointee is a certified peace officer and the county [2:10:40] will not be responsible for the cost of training an uncertified hider at the [2:10:45] academy. Two, attached hereto and incorporated [2:10:51] herein by reference is a policy concerning the employment of relatives [2:10:56] that will govern the wines county sheriff when employing a relative as a [2:11:00] deputy sheriff. The policy will not be amended unless the amendment is approved [2:11:05] by both the Wy County Attorney and the Wish County Board of Supervisors. Three, [2:11:12] pursuant to Iowa Code 71.1, the Wshi County Board of Supervisors have a duty [2:11:18] to approve the bond of the sheriff and his deputies. And pursuant to that [2:11:22] authority, it does approve the appointment of Will Marks as a sheriff's [2:11:26] deputy despite this being related to the sheriff by the first degree [2:11:33] consequenced [2:11:39] for that one. Four, for the reasons stated at paragraph one above, the board [2:11:44] of supervisors further suspend section 2.11 of the county employee handbook as [2:11:50] it relates to this appointment. Five. Pursuant to Iowa code 331.903, [2:11:56] the Wii County Board of Supervisors approves the appointment by the Wii [2:12:01] County Sheriff of Will Marks as a deputy. Six. Will Marks will begin [2:12:06] working for Wishy County on November 9th, 2026. [2:12:10] Seven. The Wii County Sheriff shall file a certificate of appointment with the [2:12:15] Wesi County Auditor passed and adopted this 14th day of September 20th 26.
