[0:35] to screw up okay [0:40] I'll call the meeting yeah we can go live Jody [0:55] good okay I'll call the regular meeting of council [0:59] to order six o'clock December 21st 2022. [1:06] be it resolved that the agenda for the December 21st 2022 regular meeting [1:11] accounts will be approved can I get a mover please [1:17] Castor Jarvis you get a secondary please count the [1:21] Gendron [1:23] all in favor carried [1:29] be it hereby resolve that the following minutes be approved as circulated [1:34] November 18 2022 special meeting November 24th 2022's regular meeting [1:40] December 7th 2022 special meeting December 9th 2022 special meeting [1:48] foreign can I get a mover please [1:52] Mr Kozlowski [1:57] a secondary please answer Gendron [2:01] Anybody Everybody had a chance to review the minutes [2:05] all in favor Gary [2:14] be it resolved that Council established the following portfolio on committee [2:18] appointments I need a mover please that's a Jervis [2:25] secondary please cool [2:31] okay this is just for discussion at this point we had [2:36] talked about changing the appointments once we had our fifth counselor on and [2:40] counselor Kozlowski has joined us it's great and we both have we have both [2:47] the internal committees the portfolios as well as the external committees [2:53] um and I know that there's a couple of [2:55] changes in the external committee's right now the East Interlake planning [3:01] district that I've been sitting on um has have asked for a second counselor [3:06] not [3:09] um not in case I can't make it but in fact [3:14] they want two counselors from each RM or municipality at the meeting [3:21] and so I've asked councilor General and if she wanted to be a part of that and [3:25] she agreed and there's also the [3:31] East Interlake Watershed District and counselor Jarvis was first assigned [3:37] to that committee and has expressed [3:43] that he's no longer interested in that committee and so I have agreed to go on [3:49] that and and actually attended the last East Interlake Watershed District [3:53] committee meeting I think it was last week [3:57] so those two changes already stand however [4:01] um [4:06] I would like to see counselor Kozlowski representing us on [4:12] some of the external committees and also on some of the portfolios so I wanted to [4:17] just open it up to discussion right now we're not going to make any final [4:21] decisions until the January meeting but I wanted to start having some [4:27] initial discussions now one of my thoughts in terms of the [4:31] portfolios was after our meeting with um [4:36] Dolores from the MSO she had talked about whether in fact we needed [4:41] portfolios or not and whether that was [4:47] a good use of staff and Council time if [4:52] our staff and managers are meeting with our CAO every week and keeping her up to [4:59] date on what's Happening does it make sense to ask counselors to also set [5:04] aside time for committee meetings to meet with each of their portfolios [5:09] um and so I'm opening that up for discussion as well whether we should [5:14] continue to have those portfolios or not and if we do then [5:20] um how we want to proceed forward [5:26] thoughts [5:31] do we have to meet that many times with the ca once a week [5:36] we're not maybe once or twice a month or bring them in here and run a council [5:42] um no it's the CAO who meets with her staff every week and that's important [5:46] because the CAO actually is is a week for the CIO yes [5:54] so it's it's been past practice um initially as I get caught up with a [5:59] lot of the files and and past outstanding items [6:05] um I I don't know if every week it will be required I think if it is at that [6:10] point it certainly won't take as long to to do the refresher as it will right now [6:17] so right now it is just getting a lot of the history so although they're saying [6:21] regarding whether it be well three or well two right there's a lot of history [6:26] behind a lot of what's Happening that I don't have so I appreciate that being [6:31] able to have those conversations of where where we were as to why we're at [6:36] where we are and what that plan is but going forward that weekly meeting [6:43] will be to be determined and if it is it's certainly I don't see it being as [6:50] in depth because with email communication a lot of the time uh it is [6:54] just a way of a good follow-up that I can ensure that there are certain things [6:59] on track and sometimes there is the cross-reference between departments so [7:03] if our works or utility was working with recreation in something or vice versa [7:08] the collaboration of having everyone at one time [7:13] feeds off feeds off that as part of not leaving something left [7:19] unturned right so so I it's a little bit too new so [7:24] um right now so I I don't know what that looks like going forward but that has [7:28] been what has happened past practice I'm finding it beneficial at this point like [7:33] I said but what that looks like going forward uh to be determined [7:40] so Mr clarify for concert Kozlowski we're not attending those meetings [7:44] that's not the meetings that's being referred to as US attending with our [7:47] portfolios and I'm I'm going to be honest I know that the expectation [7:53] um uh from Merrick Jackson when these committees were set was that we meet [7:57] monthly with our portfolio so that we have an opportunity and this was prior [8:01] to our discussions with the MSO was that we would be meeting monthly with our [8:05] portfolios um I won't speak for others but that has [8:09] not been happening with me um [8:12] okay they are meeting with the CAO weekly [8:17] met once just initially and have not had the opportunity so [8:23] I'm not sure about the whether it's necessary with what was said as the [8:29] expectation of those committees that we'd be meeting with the monthly [8:32] especially with the meeting with the CIO and sort of a better understanding from [8:37] a concept perspective of what is the cio's role and what is mine as a [8:41] counselor [8:44] all right no I just Oh I thought you had your [8:47] no you were just moving your hands around massaging my face massaging your [8:49] face um [8:52] counselor cool how many uh committee meetings are you having with Public [8:56] Works Recreation and protective environment and public health I'm [8:59] Council Jonas mine are particularly over the phone [9:02] so your U.N Council Jarvis aren't having committee meetings I work during the [9:05] week so I can't I have to do my via phone call [9:09] so then councilor Jarvis started any of those committee meetings then [9:13] no well they don't take place I was only the vice guy [9:19] okay so [9:27] so then I guess I would put to counsel whether it would make sense in fact to [9:32] not have the portfolios if we're not [9:37] I mean we're not meeting with them on a regular basis [9:41] we can't direct any of their work all the direction comes from the Cao [9:46] um the updates come from the CIO and so then I question what [9:51] usefulness it would be for us to have the portfolios besides taking up staff [9:55] time telling us stuff that that they're already telling [9:59] our CIO so I leave that for people to think [10:02] about and we can make a decision in January [10:06] unless people have some ideas some thoughts now in response [10:13] well right now we've had an awful lot of vehicles even as a council [10:17] two three yeah four or five a month so yeah [10:22] and then other things I know I don't have a problem with uh visiting [10:29] this again in the spring depending and with the flooding and so [10:34] on and so forth and all the other stuff that we had going on so [10:39] yeah an idea maybe to have a counselor present with the CEO and whatever [10:45] manager you know I know that might be a problem maybe night time or whatever [10:49] some of us are working in that just so that the council counselor knows [10:55] what's going on and where's these problems [10:58] what what the MSO said though is she said that some of the portfolios should [11:02] stay the bigger portfolios she wasn't she'd like to finance [11:05] she found those portfolios important Public Works [11:09] I think I think if we have a specific skill as well [11:13] um you know in in whatever portfolio we're [11:17] managing helps also uh sometimes the [11:21] communication sometimes the managers feel [11:26] less threatened to open up to council than they do the CEO and we bring [11:30] forward their questions too there's a lot said about having [11:34] portfolios so [11:37] I I and another thing I mean you know without portfolios it was it [11:43] was discussed with previous Council that we would all have to know a little bit [11:46] about everything as well and and that makes it tougher [11:52] well I mean part of part of the issue for me is [11:58] staff shouldn't be going to counselors staff should be going to their boss [12:02] which is a CEO yeah sometimes they don't though they're not comfortable right but [12:07] then that's but then that's between the CAO and the staff person to work out [12:10] because I'm just letting you know what happened yeah no I know you know I know [12:14] but I'm just saying that puts the counselor in a pretty awkward position [12:18] because the counselor can't direct we don't can't tell them what you do can't [12:22] do any of those kinds of things and so but we can bring that concern forward to [12:26] this year [12:29] I mean they're going to call us regardless but I'm just saying if they [12:33] feel comfortable with that particular portfolio [12:36] they meet very not question to council they make it has happened before [12:46] Council agenda um [12:50] I think in um [12:52] fairness to our new CIO that's a fine line we need to walk [12:58] um I understand that staff may have had [13:01] issues in the past but I just don't I think we need to work on moving [13:06] forward um and not be putting ourselves in [13:11] between our staff and our CIO um [13:16] staff are gonna we have managers that if it's a manager they need to learn to [13:21] have a level of comfort and if we are running interference we're not helping [13:26] with the fostering a healthy work environment [13:30] okay cancer cool I wasn't saying it was interference it was simply a form of [13:35] another form of communication for them sorry I I and by running interference I [13:40] just meant being in the middle of it sorry uh Council Hall I didn't mean [13:44] interfering it was I was using the term as an expression not specifically my [13:49] apologies it wasn't meant that way okay [13:53] I had a question but it's um because I'm and I don't know that I'm confused like [13:58] if staff people are funny even managers hypothetical Tim phones me at home which [14:02] is never happened um wouldn't I as a counselor though say [14:07] refer her like what sort of dialogue are we having do you know what [14:14] I mean like like it just seems if if there's an [14:17] emergency situation and you're going through phone numbers you know yeah you [14:22] might want to no I'm talking like seriously an emergency like if somebody [14:24] somebody says look we're on fire or something like that then you might want [14:27] to but under every other Condition it's like excuse me but we have somebody that [14:31] you speak to that's right and what I don't want to happen because you know [14:35] because I I mean I I walk a lot and I bump into Tim I bumped into Tyler the [14:39] other day and we talk Golf and things but like I don't want people to say that [14:43] they can't talk to me you know what I mean like if I go walking by Tyler that [14:46] I want people people say well you know because I always Tyler and I've talked [14:50] for years because I know yeah I mean I just I worry that maybe [14:55] that would take place yeah this isn't about not being able to talk I mean when [14:59] I got into Joe where I run into Tim I was like hey how are the kids how was [15:03] the wife you know those kinds of things this is about them calling us on Council [15:07] business and right I just wanted that character yeah that's why I want to make [15:10] sure because I've never received any of those calls right but I bump into people [15:14] all the time yeah but if I were to get a call from any of the managers for sure I [15:18] would say why are you calling me about this you need to talk to the school yeah [15:21] but back to the emergency thing I mean if somebody's phoning Me Maybe they've [15:24] tried sharing and they can't get a hold of her maybe they've tried unique and [15:27] they're just going through it because they've got a problem and they're [15:29] starting to go through a phone directory right but that's the extraordinary right [15:33] so we've got to make sure that we're being able to differentiate that okay so [15:37] be prepared for our January Cal meeting to make a decision on this and if in [15:44] fact um [15:46] we decide to um continue to have portfolios then I'll [15:53] spend some time thinking about who will be in charge of what portfolios and will [15:58] bring Council Kozlowski into the mix [16:03] do we need a resolution after the Eastern planning district that's where [16:06] we're going to move into now uh the external committees [16:12] um and so I guess the conversation needs to [16:16] be and the consideration needs to be for everybody here is anybody who is [16:20] currently on an external committee that is not working for them or isn't in a [16:27] time when you can attend whatever those kinds of things please let us know and [16:31] also Council kislovski if you have particular external committees that you [16:35] would be interested in sitting on like for example we have a Winnipeg Beach [16:39] Legion um [16:41] if not you is it what's up you weren't on the legion were you I think I was [16:55] uh if in fact you're interested in being the council liaison with the Winnipeg [17:00] Beach Legion that would make sense if there are other ones that also make [17:03] sense to you please come prepared to the genuine meeting to have that [17:07] conversation okay sure okay and other people whichever external committees [17:11] you're on if some are not working out not the right time whatever please [17:16] um come to our January meeting prepared to [17:20] talk about your involvement on external committees cancer Gendron we have a [17:26] jumping ahead a little bit into correspondence or something [17:30] 's Resource Council saying they're not aware of [17:33] is uh representing the town on the um [17:38] it was my understanding that contact information went up from the office [17:42] asked about that at the time I guess apparently it hasn't okay so [17:48] um if and I I my suggestion would be that not [17:53] just the changes be notified of who is but probably everybody be notified [17:58] that was going to be my next suggestion because yes because we also had a [18:01] comment from Interlake tourist associations [18:05] um without any representation here and so it sounds like they don't know who [18:08] who the rep is either counselor who you wanted to say that's what I was going to [18:12] say because again you know I'm on a couple of these committees and I've [18:16] heard nothing from them or about them okay and so that's telling me that maybe [18:21] they don't know that we're appointing people back in August okay okay [18:29] okay so in the interim we're not going to pass this resolution until the [18:34] January cow meeting after we've all had a chance to consider and think about [18:38] so can we bring this forward to the January meeting in the interim um I will [18:45] be doing the East until like Watershed district and the East Interlake planning [18:49] district until that happens [18:54] comments and we're not voting on this right no that's tabled okay [19:01] he had hereby resolve that Council approves the committee reports is [19:05] presented [19:20] um is there any reason why we haven't gotten to public works or utility or [19:24] fire chief report I just need to move her in a second oh [19:28] damn sorry can I get a mover please [19:33] oh my my counselor who will sorry secondary please counselor gendering [19:41] I the reason why there's no other reports is I was told that they were [19:44] requesting not requested not to put reports in for this month [19:48] I don't know if that's because I called my [19:52] my uh Public Works and utilities and they were told not to have a report in [19:57] for this month I'm not sure if that's uh what's my understanding that usually [20:03] the reports were for the cow meetings initially uh so that direction has not [20:10] been provided by myself so I'm not sure where that information was provided [20:18] so should there be any reports on this then if we're gonna [20:21] so I think so it was my understanding through the through the the managers [20:26] meeting that it was usually the first meeting of each month when the reports [20:29] were submitted yep [20:32] and so then for with the with the December [20:36] um looking at year-end clothes we did talk about having reports in place and [20:41] so Rec Department uh has provided that you'll see the buy law enforcement is [20:46] more just about November it's the previous month so that could be why [20:50] these reports aren't in place [20:54] I did receive an email today in reference to the public works report but [20:59] putting on us as an addition I didn't think of it was a value without being [21:03] able to actually review the report ahead of time [21:07] so the report that we do have is the bylaw enforcement report [21:12] the back rack and byline that's right everybody have a chance to review those [21:18] reports questions comments [21:23] all in favor okay [21:29] did hereby resolve that the correspondence be accepted as circuit as [21:34] presented [21:41] motor counselor Gendron secondary [21:56] foreign [22:04] did everybody get a chance to be the correspondence [22:14] yep any questions comments anything you want to highlights [22:26] okay why we are quiet today aren't we [22:33] correspondence [22:36] yeah 7.1 traffic pardon me traffic ticket [22:43] okay explanation [22:45] ticket mine was given to the town [22:50] there's a person driving not get any of the merits [22:55] it's a reptile registered vehicle so does the top is the town that gets [23:00] issued the the ticket as a result of that it was based on cameras that the [23:06] school buses have cameras installed um [23:11] and so it was a certified provincial ticket [23:16] officer here no it's by yeah [23:20] it's five years by the RC yeah by the RCP link it's a it's an actual traffic [23:26] ticket okay so why is the beach boys [23:33] because the vehicle's registered to the tone it's not to the individual [23:38] we've got fire trucks fire cars in the city [23:42] you're going over the speed limit or through a red light not on the top you [23:45] pay for the ticket to ensure that confidence with a lot of [23:49] the private companies as well you're driving attack [23:54] once again is there a while that says something that we pick up this ticket [23:58] does this driver get off scout free no good merits [24:02] so there is no bylaw or policy in place there's nothing in the collective [24:09] bargaining agreement that referenced this as far as having ownership coming [24:16] paying through the the ticket itself I have no authority to charge the employee [24:23] is is stating they are responsible for the ticket [24:31] um you know the series of this offenses are going to be any repercussions or any [24:34] further training or safety training or so I I have met with one of the [24:39] employees that I have not met with the employee who was driving at the time as [24:43] they are off on leave uh the circumstance I believe is clear in the [24:47] report it was at a time of an emergent sewer break and at the time of driving [24:54] albeit uh not appropriate behavior looking at the severity eyes were taken [25:00] off the road to be looking at the ditch area and it was just unnoticed so it's [25:06] clearly clearly not an excuse that is what happened it was under extraordinary [25:12] circumstances as the severity of the sewage in the close proximity to the [25:17] lake was a great concern foreign [25:30] 's gonna pay for it so that [25:36] so so that is a discussion to be had I I know that when we we look through that [25:42] looking at having some sort of policy um in place [25:48] being an a unionized work environment if we look at passing a policy where the [25:54] driver of a vehicle who's incurred a ticket the expectation is for that [25:58] driver to pay that expense I do expect there to be some level of Union [26:03] involvement unless it's clearly identified in the collective bargaining [26:07] unit agreement as well something that can be looked at I do not [26:12] have past history as to whether or not how many instances have occurred [26:18] so this is the first one I am aware of I did sit down with the individual at [26:23] length discussing the situation and as I stated upon the return of the other [26:30] employee we'll be doing similar to council General [26:35] um uh first off thank you very much for the [26:39] report as an explanation as to what was involved leading up to it and just for [26:45] clarification if an individual receives a ticket in their own names so if [26:49] they're pulled over for speeding that is not on us because it's in their name [26:52] correct that's correct okay it is only when [26:57] um like the cameras on the bus or red light cameras in the city or anything we [27:02] as a town have a responsibility to pay the ticket because it's in our name [27:06] correct okay and and we currently do not have a policy that allows us to take and [27:12] I and I do know um [27:15] some person experience a little bit of my discussion with you it it is you're [27:20] very strict on what you can deduct from an individual's payroll and what you [27:23] cannot correct so you do not have the authority to even be deductiveness off [27:29] the individual's page I do not and without a policy you didn't really have [27:32] any other choice but to pay the ticket so it's on Console to be making a policy [27:37] in order if we feel as a group that we do not want to be responsible for [27:42] tickets and individuals get correct okay that being said we can looking at [27:47] Council creating that policy because it is dealing with deductions from an [27:52] employee the collective bargaining unit would need to be notified of that policy [27:57] as well okay I just want to say you know [28:02] the the offense is significant you know driving by a school bus when they're not [28:07] supposed to be stopping um [28:10] it was good to see you know kids weren't being discharged nobody wasn't any kind [28:15] of media threat and I certainly understand that they're driving a lot of [28:18] money they just because they had a super break [28:22] um well it's unfortunate that occurred I also think that unless we continue to [28:28] get these kinds of tickets or complaints I'm not sure if something that we have [28:32] to add on this might be a one-time only and I I trust our CEO has had very [28:39] significant conversations with the people who were involved I think that if [28:43] we haven't have a second situation and [28:48] certainly we might be needing to have a very different discussion Council yeah I [28:52] agree with you I think I think it would be a different discussion though if a [28:54] kid was ran over so I think maybe if our employees were a little more [28:58] you know if there was a financial penalty to their your [29:03] to their driving or something you know maybe they would have been paying a [29:06] little more the kids could have been offloading and [29:09] if he's looking in the ditches and didn't see a school bus at the [29:13] lights kids could have just as well been in the Front Street so [29:16] I think it's important that we tackle this now and not wait for another [29:19] incident Council Jarvis I agree and I'll use the example what if it did the [29:24] school bus driver and there's been kids on the school bus and he just went [29:27] through a stop sign yeah I mean like right now we have a situation where he's [29:31] looking at a ditch and there's a school bus with the lights on and we drive past [29:35] the school bus and as you said luckily nobody was hurt [29:39] but the last time we're wrong you're supposed to be in complete control of [29:42] your vehicle at all times whether that bus could have been parked in the middle [29:44] of the road if he'd hit the bus he was at fault [29:48] where we have to look at and like Gary said we have to have some sort of a plan [29:52] if a child had been hit heaven forbid if you're having a different [29:57] conversation right now so what kind of plan are you suggesting counselors yeah [30:01] we I'm not sure what is involved so I think maybe in the future we should have [30:06] a look at it because we have employees that drive vehicles and if they're [30:10] heaven forbid but if you're running through stop signs and you're blown past [30:13] school buses with the lights on then maybe we need to look at a policy that [30:16] says hey [30:19] we have a situation even in the middle of the Summer where there's kids walking [30:23] everywhere around here and if you're looking at the ditch and [30:26] something all you need is a five-year-old and bolt that between two [30:29] cars and no problem okay well maybe it's just more of a having to [30:33] take a defensive driving course or something [30:37] because I don't know I agree but I'm not saying that we let the guy about Scott [30:42] free I'm just saying that you know there's something that maybe wouldn't [30:44] get a look at we have people driving vehicles [30:50] um [30:52] my understanding from reading the report as the discussion has happened and the [30:55] serious discussion has happened um [30:59] the CEO is responsible for the staff the CIO has policies regarding uh when if [31:08] and when the CIO feels there's a need for a written warning to be placed on an [31:12] employee's file the CAO has that ability to do so if the [31:18] CIO in discussions um feels that [31:22] I mean as she said she doesn't know if this is the first offense or not but if [31:27] this is the first offense and the Santa was dealing with a second offense in [31:31] three months I would assume that the CIA would be dealing with it appropriately [31:35] according to the situation that had as opposed to having to have a separate [31:39] policy councilor well I just want to say on [31:43] record that I think something should be done now because if we don't and this [31:45] event does happen I don't think our CEO wants to be [31:49] responsible for it either I think we need to like that's a that's if it was [31:53] just driving if it was a small offense like again like speeding or whatever [31:56] else but somebody blowing through a flashing lights on a school bus that's [32:00] that's as bad as it gets would you suggest that we do counselor [32:05] well I suggest that the person needs a little refresher course [32:09] or a defensive driving force or maybe if they if they can't follow the rules [32:14] and they're too distracted by a flashing lights on a school bus maybe they [32:17] shouldn't be driving our vehicles because it's our liability [32:21] yeah they're they're in charge of that vehicle all responsibility plays with [32:27] them they would have hit a child coming out [32:30] of that school bus or something set the feature fault we heard the [32:34] driver driver walks away once again there's no good merits to this driver [32:39] it goes on to the talent it's a very Hefty fine [32:43] and I think that each individual should be held accountable for their driving [32:47] schools so in what kind of way what what action do you think the town should be [32:51] taking that they pay responsible there in charge of that vehicle [32:55] okay now they pay for whatever happens if they hit a ticket they pay for it [33:02] just like most of the private cities and most private companies in the city [33:06] private companies don't pay for you we [33:12] we I work for a unionized company we have to sign up the vehicles event when [33:16] you sign up the vehicle you aren't responsible for that vehicle so so maybe [33:20] we need to adopt something where there's a signal policy in the vehicles you know [33:24] they're responsible for it during that time [33:26] I mean just something to look at some would consider I'm wondering if rcao can [33:30] take this back for consideration and come back with a recommendation to [33:34] cancer so just one question the counselors will [33:38] defensive driving course uh was it under the presumption that the town would be [33:44] paying for that defensive driving course or is the expectation for the employee [33:48] well that's something we can discuss I would just again based on the serious [33:51] seriousness of the offense uh I think something needs to be done [33:56] I mean we don't we don't have we don't have um the same rights the police or [34:01] the RCP or the fire department does you know [34:04] driving fast to a case or you're driving so fast you didn't know this or even I [34:09] mean if you're that focused on the ditch how long how long are you not looking [34:12] what's in front of you that's that's scary so it's just it's concerning and [34:16] so I I think some education is required something [34:22] councilor Jarvis um did the driver in question receive [34:26] demerits on their license no because it was based on very similar to uh red [34:31] light cameras so you just get this the license plate that's identified not the [34:36] driver so it's the it's under the vehicle [34:40] that's that Vehicles the name under the registration of that license plate if [34:46] I'm using your car and I get a red light camera you receive the ticket and so [34:50] that's that's what's happened in this case as well and I know as the counselor [34:54] genre explains it we've had a you've had a conversation with this person but so [34:59] then this person's not paying the fine and [35:02] there's no demand so there's really no other than the conversation that took [35:06] place so I've had the conversation with the passenger the driver is on leave [35:11] currently and I have not been able to have that conversation with the driver [35:15] at this time councilor Kozlowski and then counselor yeah um we just lost hope [35:20] a little bit to these people the drivers do they check their vehicles before they [35:24] do all the safer signals lights Etc [35:29] I believe pre-trips are required I can certainly confirm what the works [35:34] department that the pre-trips are being adhered to [35:37] councilman here too yeah like that it is I believe it is a requirement I would be [35:43] surprised if there wasn't a policy in place I don't even think [35:48] so it's just a question as to whether or not [35:51] um that it's be being adhered to as in several places of employment [35:58] um people get used to not doing a pre-trip right maybe this can come up to [36:04] the meetings that they have yeah and I will I will be discussing that yet okay [36:09] so anything further going forward I think we're pretty clear here [36:13] okay anything else under correspondence [36:18] Council service the human resources practices employment thing that would [36:23] just send for [36:26] pardon me no this is what Gene was talking about before like his name the [36:30] municipal relations bulletin it was sent to us yes uh that was just for us to [36:35] read and yeah okay so what the council May notice [36:40] as something different is whenever there's a bulletin put out by Municipal [36:44] relations as part of being um municipal government I will put that [36:50] information out just so everyone is aware what what the department is doing [36:54] as well as the other news releases that would pertain to our MLA or in this case [37:01] um Minister Horton as well as he lives within close proximity and so when [37:07] Council works with various ministers or mlas I think it's important for you just [37:12] to have some background as to what portfolio and what projects they are [37:17] working on um so that when you do meet with them [37:20] that that you've got some familiarity around uh yeah but this was the human [37:25] resources practices of employment the only reason I asked the question is [37:28] because in cancer genre I even alluded to it at the beginning of the meetings [37:33] that we've had this kind of I just is this the actual thing because we've [37:36] talked about this two or three times [37:46] yeah okay [37:48] it's not specific to the top yeah [37:52] thank you any other questions about correspondence [37:58] okay that's the resolution all in favor [38:03] Gary he is hereby resolve that Council [38:07] approves the accounts payable being checks numbered [38:12] 20220761 to number [38:18] 20220826 and electronic payments issued between December 1st 2022 and December [38:24] 31st 22 totaling 204 106.67 as circulated by the finance [38:33] officer and reviewed by the finance committee [38:36] mover please so Jervis [38:41] secondary please [38:44] conjendron [38:47] discussion [38:51] um yeah um I sorry sharing a phrases before [38:55] um prior to being here um the resolution reads approved by the [38:59] uh as reviewed by the finance committee and it's not it's not the committee it [39:04] is a member of the finance committee because uh Doug doesn't whoever comes in [39:10] to do the check signing so sometimes it may even be mayor [39:14] Jackson [39:16] thank you Council Jarvis and maybe I I missed the [39:21] opportunity here but the this I'm a little confused about the Cascade [39:24] recovery thing the the check that was issued for recycling what is Cascade [39:31] Cascades is where the recycling actually gets processed so we still have a [39:36] processing fee as well so that's the stuff that they pick up right so our [39:40] recycling gets picked up at a fee however to process that recycling [39:45] there's an additional fee on top of everything [39:49] yeah I wasn't sure what type of thing okay I wanted to checks on their cats [39:54] your comment if he's 735 what's that all there [39:59] uh I would have to pull the item a lot of these expenditures occurred prior to [40:03] me being here that that were approved through there so I can certainly follow [40:07] up with that and send you that information I can go pull the check [40:11] right now um I believe that when our Bible officer [40:17] is also doing animal control and when he's doing animal control and he picks [40:21] up Stray Cats there is a fee for the picking up of stray cats and then taking [40:27] them to a compound where they are taken care of and that's the fee Associated [40:32] and cancer Gendron and then counselor and and there are very strict rules that [40:37] he has to follow so he had they have to be held for so many days and so that's [40:43] why we're paying foreign [41:03] officer is the one that houses them so you can see why but it may Beach [41:10] would have to pay for that paperwork [41:17] Council agenda um it's it there's a whole animal [41:20] control issue not just us I believe it's uh standards within the province we've [41:27] addressed this before it's not anything we can do not do our [41:32] only other option is to not be picking up stray cats and and that's the only [41:37] other way to avoid it our CIO wanted to see some Productions after what I was [41:40] going to say it's a reference to that once once you have a service delivery [41:45] standard or something that identified out nearby law in reference to what you [41:49] will or will not do for animal control several municipalities [41:54] um have run into this situation where we [41:58] look at the costs of cats for enforcement purposes is cost prohibitive [42:03] and they have removed cats being from there so at that point [42:08] though those municipalities are at risk for the Stray Cats and and the abundance [42:13] of [42:16] Dr Jarvis it's uh with everybody so it's it's there's criteria [42:22] there's Health regulations all kinds of stuff and you can't get away from it [42:27] any further discussion on the finances [42:35] a favor Harry [42:40] the adhered by a result that Council approves the December 2022 employee [42:44] payroll is circulated by the finance officer [42:48] I get a mover please so Jarvis [42:52] second or please councilor Gendron [42:57] has everybody had a chance to review this resolution [43:03] any questions comments points of discussion [43:12] all in favor Terry [43:20] whereas in accordance with Section 163 of the municipal act the Council of the [43:25] town of Winnipeg Beach have made interim estimates of all operating expenditures [43:30] for the town for the periods of January 1st 2023 until the adoption of the [43:35] financial plan therefore be hereby resolved that the following provisional [43:40] estimates be hereby adoptive General government services 350 [43:45] 000 Protective Services 150 000 transportation services 450 [43:52] 000 environmental health 150 000 Public Health and Welfare 10 000 [43:58] environmental development 20 000 Economic Development 20 000 Recreation [44:04] and culture 150 000 fiscal Services fifty thousand [44:09] utility operating 150 000 total of [44:14] one million four hundred and eighty thousand can I get a mover please [44:19] that's a gender [44:22] second or please counselor Kozlowski [44:27] discussion [44:34] okay all in favor [44:39] Harry [44:44] the adhere by a result that Council approved counselor Gendron to attend the [44:48] Red River Basin annual conference being held at the Fort Gary hotel in Winnipeg [44:52] on January 17th to the 19th 2023 at a cost of 338 dollars plus applicable [44:59] applicable taxes out-of-pocket expenses and travel per diem [45:04] can I get a mover please [45:11] in a secondary place Mr Jarvis [45:16] discussion that's agenda I do have one question it says [45:22] expenses and travel Peruvian um we have [45:27] um [45:30] or that entitles um hourly reimbursement as well is that [45:36] really that's part of this correct that's that's what it's for free yeah [45:40] okay thank you [45:44] any further discussion [45:48] all in favor Terry [45:55] the adhere by resolve that the ca will be authorized to enter into a service [45:59] agreement between the town of Winnipeg Beach and the Canadian Corp of [46:03] Commissioners for disaster financial assistance Support Services [46:09] yeah I'll get a mover please Mr Jarvis [46:15] secondary Place some gender University can give us a bit more [46:21] information on this please um so the service agreement through the [46:25] disaster Financial uh assistance program the dollar figure amount uh is fairly [46:33] significant for what's happened at Winnipeg Beach throughout this past year [46:37] as a result those applications are rather time consuming and very detailed [46:42] the expense for the support services is also claimable against the disaster [46:49] financial assistance and so the way that that program works is once accepted [46:54] there's threshold tiered thresholds of where the municipality is responsible [46:58] for and after a certain period of a certain amount a hundred percent of the [47:04] costs are then covered through the DFA program once approved [47:07] and so in order to collect that data and ensure that nothing's been overlooked or [47:12] missed um [47:15] and working through that recognizing the scope of of what's [47:19] happened um it's it would be a it's since it's [47:24] playable expense I think it would and therefore reimbursable uh it uh it makes [47:28] the most sense to move forward with commissioners [47:33] any questions points of discussion Council Jarvis [47:37] um is this [47:40] does this compete with Don Eames and nothing no it's just separate it's just [47:46] this is to be able to make [47:50] this is to be able to make all our claims so like for example the super [47:53] sandbags we had to charge the provincial government for that to make all the [47:57] Financial claims yes to get the money I wasn't sure [48:01] is it more of just how to do the paperwork because I thought we had we [48:06] we've had this brought to us before previous Council [48:10] um the company that we deal with when there is an emergency measures I thought [48:13] they handled most of that and helped us with the [48:16] those areas so I'm not familiar with what may have happened in the past to [48:22] date there's been no movement on this DFA file and looking at the significant [48:27] amount of money that has been spent in reference [48:30] to This Disaster the sooner that this gets moved on the better so it is a bit [48:34] different it's an independent program it's not in relation to emergency it [48:39] measures its relation to disaster and so what might have come forward which I do [48:45] believe there was payment for was there is a mitigation and preparedness program [48:49] that counters with the DFA program and they are two separate programs but [48:56] correlate with each other so this is to make movement in reference to submitting [49:01] the claims and going through that process to have those expenditures [49:05] return back to eligible expenditures returned back to to the town cancer [49:10] gender yeah I just wanted to clarify for counselor Jarvis and then it sort of [49:13] fits into Professor Hall said as well um this was raised at our previous meeting [49:18] and there was some discussion it might have been just before and I had asked [49:22] the acting cereal if um Napier [49:27] could be hired to do this type of work and he had checked and they weren't they [49:33] were too busy they didn't have the time to do it [49:36] um but he did explain to us at the time that 100 of the cost of [49:40] hiring somebody to prepare the paperwork for the province is a DFA expense that [49:45] we can submit for so we really aren't going to be we've lost and said our [49:49] deductible we really aren't going to be out of pocket for us [49:53] so so would we is this just something that we we Source these guys out or [49:57] should we put something out for my understanding is he did he was check uh [50:03] the acting Stadium had been checking around and [50:07] um it was a matter of because of how much [50:11] how many areas were affected by disaster it was difficult to even find anybody [50:16] that was available by the time we were looking for somebody yeah I'm just yeah [50:19] so my concern is just for entering an agreement I'm just wondering if if we [50:23] should have you know sourced up more than one [50:28] in one company so previous calls have been made and looking for various other [50:33] options uh and as councilor Gendron had stated very few people are interested as [50:39] they are backlogged with various other claims [50:42] thank you [50:45] okay another discussion all in favor [50:51] opposed Carrie [50:59] be it hereby resolve that the CAO be authorized to renew the service contract [51:04] between the town of Winnipeg Beach and Muni site for the uniware momentum [51:08] License Services [51:12] oops [51:17] sorry my bad okay where is the request for donation has been received by the [51:22] town of Winnipeg Beach therefore be it resolved that Council for the town of [51:26] Winnipeg Beach authorized a donation in the amount of blank to Manitoba Crime [51:30] Stoppers let me get a mover please [51:34] answer cool second or please [51:40] [Music] [51:43] discussion [51:46] what do they do in the area they're here for us [51:51] did you have the opportunity to read their letter to us yeah [51:56] so it looks like they haven't been able to do a lot in the last couple of years [52:01] because of covet but they are putting a program together and going to schools [52:06] and local events with information they're also taking on [52:11] a signage project um [52:15] so all I know is what's in the letter I think we've had some other requests [52:20] for donations and we've we're kind of are we not strapped on this part right [52:23] now for donations or should we move this to next year so this is for 2023 item it [52:30] is my recommendation at this point it'd be tabled for Budget to determine [52:35] um what is what is being allocated there has been no past history of donating to [52:41] manageable Crime Stoppers that I'm that I'm aware of [52:46] so you're suggesting we table it for Budget yeah and we've had a number [52:51] of other requests for donations this past fall and so if we could put that [52:56] all in the same item for Budget discussions so that we [53:00] can look at all of the 2020 at the 2023 so it was 2023 requests okay well the [53:07] 2022 requests but they were coming in quite late in the year so if we can look [53:11] at them so we know what to anticipate okay [53:16] okay so this will be tabled correct thank you [53:28] either be it hereby resolve that the CEO will be authorized to renew the service [53:33] contract between the town of Winnipeg Beach and Muni site for the miniware [53:36] momentum License Services I get a mover please [53:42] counselor Jarvis in your secondary please counselorski [53:50] give us some information about this one please sure [53:53] so this is this is all of our programs that uh the that governs our municipal [53:59] activities so it includes our tax our utility our accounts payable it's our [54:04] payroll it's the ledger accounts so uh this is quite uh there was an account [54:10] conversion that occurred in uh 2021 and this is the software program that we use [54:17] they are looking to go into a three-year service agreement and [54:24] that's what this item is for is just authorizing the CEO to sign that [54:29] service agreement discussion [54:34] all in favor Gary [54:41] whereas section 365-2 of the municipal act provides that [54:47] Council May in any year designate the immediately preceding year or any [54:52] earlier year as the year for which properties the taxes and respect of [54:56] which are inner ears for the year must be offered for tax sale by auction to [55:01] recover the tax arrears and costs be it resolved that the designated year for [55:06] the properties in arrears be offered by sale of auction the 2022 [55:12] meaning all properties with outstanding taxes from the year 2021 or prior and be [55:18] it further resolved that in accordance with section 363-1 of the municipal act [55:24] cost shall be at the actual costs incurred by the municipalities for each [55:29] parcel listed for the tax sale plus an administration fee of fifty dollars per [55:34] roll as set forth in the Manitoba regulation 50-97 [55:39] if applicable and be it further resolve that the tax sale Bill tax sale be held [55:46] month day 2023 that should read and blank Am Pm at [55:55] our table at Chambers can I get a mover please [56:00] cancel Kozlowski [56:04] secondary please councilor Jarvis discussion I wonder if Sharon you could [56:10] uh so tell us what this is about um this is [56:15] always a standard resolution it's just in a way of [56:19] um having legal authority to move the back taxes forward so [56:24] um several municipalities will also use the Outsource of tax service that goes [56:29] through that tax sale process it's my understanding there has not been a tax [56:33] sale auction in Winnipeg Beach for quite some time and but what this does do is [56:40] give us the authority to move forward on any properties that do have outstanding [56:45] taxes of 2021 or prior and set those properties up for auction [56:51] discussion all in favor [56:56] Gary [57:01] whereas the request for refund has been given in regard to a Rec hockey program [57:06] and whereas no rep refund policy has been adopted therefore be a result that [57:11] Council approve slash do not approve a refund in the amount of [57:20] can I get a mover please councilor Hall secondary [57:25] that's a Gendron [57:28] everybody get a chance to um [57:32] review this discussion [57:39] counselor so uh from the information provided this individual attended the [57:45] program for a few weeks and then something else became available so they [57:48] did start the program they did start the program [57:54] was the program full of the time uh I believe with this kind of structure [58:00] there there is always room for additional users I think it was an [58:04] informal Rec hockey program councilor Jarvis [58:10] um um I I guess if we if we're gonna go out [58:15] I would say no one refund other questions or discussion Council [58:21] agenda yeah the program has started um you sign up for a yoga class and you [58:27] decide after three weeks you found something closer to home [58:30] and yoga instructor that you've paid for the classes isn't going to give you your [58:33] money back [58:36] for all of us at good kids through hockey and that I mean this stuff [58:39] happens and maybe lots of times it's a lot more money than this [58:43] further discussion okay call the question so we have to [58:49] therefore be it resolved that council do not approve a refund [58:56] period period yeah all in favor [59:01] to post I was I was hoping for a uh you know partial [59:07] oh did you want to speak to that I just [59:12] think you know you know like uh Council General and I said if uh you know if [59:16] they did attend some I would certainly think that maybe a partial refund would [59:19] be available but that was I also want to know if the class was full because if [59:22] somebody else lost an opportunity to join the class [59:26] you know that's another but if we're sure that it was just kind [59:30] of a drop in I could clarify that but I believe that there was still opportunity [59:35] for others to still enroll and it did not impact the program [59:44] again the argument if you sign up for a class in three or four classes and you [59:48] decide to take the class somewhere else doesn't necessarily be getting a refund [59:52] on that class yeah we're not dealing with for medical reasons the individual [59:56] had to stop coming or family relocated and it [1:00:01] wasn't you know they had to move to the city [1:00:05] and it wasn't convenient to come here okay [1:00:10] so we're ready to to um vote on the resolution be resolved [1:00:14] that council do not approve a refund all in favor [1:00:20] opposed Carrie [1:00:29] whereas the request has been presented to council to amend bylaw [1:00:34] 15-2015 to permit food cart vendors without owning slash operating and [1:00:39] additional Food Service establishment and where is sufficient data has not [1:00:43] been obtained to initiate changes to existing legislation and whereas the [1:00:48] recommendation is to partake in a pilot project for information slash impact [1:00:53] Gathering purposes therefore be it hereby resolve that Council authorized [1:00:58] the CEO to implement a pilot project allowing a food cart Bender for the 2023 [1:01:03] season at the farmers market location only [1:01:07] remover please councilman [1:01:13] secondary please agenda [1:01:17] discussion everybody had a chance to read the [1:01:23] history discussion options and recommendations [1:01:29] discussion yeah I was just curious you know how [1:01:34] come we wouldn't expand this are we just the food so that you're talking about at [1:01:40] that market that we have that no one in the rec center [1:01:44] okay yeah hold on Glory [1:01:48] that's fine [1:01:52] Council General um [1:01:54] just wondering if the ca over to give us a little bit of that and I might be a [1:01:59] little ahead of the game sort of what sort of things you're going to be [1:02:02] looking for as far as of being a pilot and what sort of things you're going to [1:02:05] want to be that you think might be relevant to report back to council or am [1:02:10] I a little early on this and you'll put that together and let us know closer to [1:02:14] so I think that so my understanding is um [1:02:19] the most sensitive piece of allowing food carts is within the downtown area [1:02:25] and the competition to existing establishments Food Service [1:02:29] establishments and so when when we look at what that pilot project looked like [1:02:34] there's there's a few issues is a is is there sufficient data to see that there [1:02:39] is there is an impact B it allows for Council and staff to take a look at the [1:02:45] other possible impacts that having a food cart in the vicinity [1:02:51] um can have that that we may not have [1:02:54] thought about right is when we look at that and then B take a look at some of [1:02:58] those impacts and bring that forward to discussion uh normally a food cart [1:03:03] vending uh is not lumped in with another bylaw it does have its own specific [1:03:08] bylaw and so my recommendation moving forward would be to be removing that out [1:03:13] of bylaw [1:03:16] 15-2015 if it was to be permitted as there's other things so that it also [1:03:22] gives Council the freedom to take a look at locations more time to digest does it [1:03:27] work doesn't it work what the feedback from the community is because ultimately [1:03:32] that's that's a huge driver in in making change in legislation [1:03:39] yeah this this expands on my first question about you know expanding it [1:03:43] Beyond where they are because um [1:03:46] I don't know if any of you have but we've got numerous emails requests over [1:03:49] the years you know if we have a bad note till 10 11 o'clock there's not a [1:03:53] restaurant site that can provide a service so we also talked about having [1:03:57] the food carts you know available within the downtown area [1:04:02] because again we can all know that after six o'clock [1:04:06] or seven o'clock sometimes there's nowhere to get a meal or a quick bite [1:04:11] during bands or with the exception of boardwalkings [1:04:17] maybe something we can sort of push out a little further on [1:04:21] Council charts I thought that we had discussed um designating like we enabled [1:04:26] this previously in designating an area for food carts because well I I think [1:04:30] we're going to get into a really bad situation if we allow food carts there [1:04:34] food carts here you know and I don't think the problem is having the food [1:04:39] cart or food vendors the problem is that and and they're [1:04:43] right if we need separate legislation for it is that as we discussed [1:04:47] previously that you know there has to be some sort of concern for sanitation from [1:04:50] washrooms for seating areas for garbage like you know I mean if we [1:04:56] we have to have criteria that these people have to [1:04:59] to adhere to and it's not so much that the other businesses aren't complacent [1:05:05] it's that we all have to fall under the same guidelines and right now we have [1:05:09] seem to have separate guidelines for food cars or vendors so what are you [1:05:14] suggesting in terms of this this particular resolution [1:05:17] I would say we need to look at I don't I'm opposed to [1:05:22] pop-up food carts because it just it it this doesn't pop up this is somebody [1:05:28] who's asking us permission to have a food right at the farmer's market [1:05:32] exactly but then you know do they have washing facilities [1:05:36] there do they have garbage receptacles do they have picnic tables you know what [1:05:40] I mean a we we get that already there are people just walking along in the [1:05:45] discs are in poutine containers and all kinds of stuff like I think from our [1:05:49] standpoint is that you know trying to solve maybe a concern that somebody [1:05:53] doesn't have a meal or they can't take a break and so on and so forth I mean we [1:05:59] create another problem so is your suggestion [1:06:05] like again having an expanded one or is your concern just with the farmer's [1:06:09] market so um well they just with the farm well [1:06:13] with the Farmers Market at person because we talked about putting a an [1:06:16] area where all the food carts and all the common food trucks or whatever would [1:06:20] go um my fear is and they had mentioned [1:06:24] about Winnipeg and and I'm familiar with Winnipeg is that you're given an area [1:06:28] right but you just can't just indiscriminately put a food cart [1:06:31] somewhere go ahead Council agenda [1:06:36] all of these my understanding is all these things that have been raised by [1:06:40] councilman Jarvis and Concert Hall are things that will be taken into [1:06:44] consideration right now we are looking at preventing a food cart at the Farmers [1:06:49] Market to as a pilot project to see how does it [1:06:55] go how is it receive what are the things we need to consider moving forward and [1:07:00] let's say based on it we decide that yes we're going to move forward and expand [1:07:05] the use of food carts what things have we learned and are [1:07:09] learning from the food cart at the farmers market as far as [1:07:14] things we need to consider as far as washrooms and receptacles this is the I [1:07:19] mean these are the individuals running the farmers market who are are making [1:07:25] this request for at their Farmers Market well we know they have I mean they [1:07:29] already have portable washrooms there and they have uh you know they have [1:07:34] little seating areas for people there so this is just authorizing [1:07:40] the CEO to implement the pilot project is what we're looking at here councilor [1:07:46] again I would rather than just seeing a pile of projects I'd like to see an [1:07:50] expanded uh throughout the town because we're not going to get a full [1:07:55] Taste of what's happening in the Farmers Market oh it's going to affect the rest [1:07:58] of town well it would it would seem to me that before we do that we might want [1:08:03] to do a bit more homework however that's more pointful [1:08:07] pardon me that's my point I think we need to look at this a little better [1:08:11] than just you know have a pilot project thrown out [1:08:14] there I think we need to sort of look at this a little better [1:08:18] okay isn't that the purpose of a pilot [1:08:21] project so that we can look at things and again I'm not I don't think we [1:08:25] should just have the pilot project at the farmer's market it's about the [1:08:29] talent I think we should look at it for the whole town not just the farmers [1:08:33] market okay so you're you're saying yes we we should do a pilot project but not [1:08:37] just at the farmer's market well I think it should be expanded okay [1:08:45] and just to clarify my position on it um we had [1:08:50] this I thought we had discussed a lot of this stuff with reference and and that's [1:08:53] maybe where I'm confused is it about having food trucks Etc and what I don't [1:08:58] want to get in you know every time I have a farmer's market or a special [1:09:02] event and even like a harvest fest where we have things that all of a sudden [1:09:06] there's a different set of rules for these where you're able to have food [1:09:10] carts in the Farmers Market I think we need to look at it as a talents if [1:09:14] you're going to let some of these people in [1:09:16] um they have to as I've mentioned before their criteria has to meet that there's [1:09:19] Health standards there's all kinds of things safety and so on and so forth [1:09:24] that these people out and I don't want to Forfeit [1:09:27] that um and I don't know if responsibilities right because they're [1:09:31] within we've given them permission to do that and I want to make sure that all of [1:09:36] the checkpoints are are looked after right and Council Jarvis we have had [1:09:40] this conversation before and I think that the conversation has sort of gone [1:09:43] in circles in this similar way that is happening tonight and I think that [1:09:48] um some discussion was had about the fact that every food cart would have to [1:09:52] be licensed and if they're licensed that means that they're insured and so that's [1:09:55] already taken care of in terms of health concerns and all those kinds of things [1:09:59] we've always gotten stuck on should we let one in and use as a pilot project [1:10:05] should we just open it up completely before we open it up completely should [1:10:08] we be sitting and talking to the other businesses in town what should we do [1:10:12] and we've gone in circles around that with no decision being made and so [1:10:20] um I think this was the opportunity when someone approached our CEO saying could [1:10:24] we have a food cart next year so not saying next weekend they're saying next [1:10:29] year could we have a food cart available at the farmer's market now we [1:10:34] might want to expand that to include other things [1:10:38] um at some point we're not creating policy here we're we're saying either [1:10:43] yes or no to this food cart at the food truck and at the at the Starbucks market [1:10:49] and if this Council thinks it's important that we look at food trucks [1:10:55] downtown Winnipeg Beach for 2023 before doing this pilot project we can [1:11:00] certainly put that on an agenda and have a full discussion about that and ask our [1:11:04] CEO to come up with policy and those kinds of things that doesn't prohibit us [1:11:09] voting on this right now um [1:11:13] those are my just my thoughts right now counselor who will and then councilor [1:11:16] General yeah I agree with your thoughts I think we need to but I I do think we [1:11:20] need to look at the town as a whole before we agree to this that's my [1:11:24] opinion so so just a point of clarification for [1:11:28] myself when we're looking at the town of a whole how will that inform this [1:11:32] decision about this food card well I I can't agree on this yet unless we do it [1:11:36] as a as a town thing I understand that this is for the farmer's market but this [1:11:40] opens up other doors I think we have to have further discussions Council General [1:11:45] um so um I don't know I I sorry I'm just a [1:11:50] little not clear on what was discussed about this with this Council and what [1:11:55] was discussed about this before this farmer's market request came to the [1:11:59] previous Council and they chose to table that didn't want to make a decision and [1:12:03] tabled it for the new Council so I'm not sure if this Council has seen this [1:12:07] farmer's market request but it was put in quite some time ago [1:12:12] um my question is if we go with this um pilot project for the farmers market [1:12:18] we're not limiting ourselves to that early if we have time for additional [1:12:23] discussion to to test it out in other areas can we do that as well or are we [1:12:29] limiting ourselves because I certainly Council holds making some really good [1:12:33] points about we've discussed this before about other areas are we limiting [1:12:37] ourselves to Justice or can we do other um testing or or whatever to determine [1:12:44] whether or not we can do it downtown as well so that that option is available [1:12:49] when we look at the way that this is reading now in reference to that [1:12:53] particular location and that location only at this time it prohibits it [1:12:58] prohibits from anyone else saying well you've allowed that this it's not as if [1:13:03] you're changing your legislation the current legislation still is intact [1:13:08] whereas food vendors are still authorized under bylaw [1:13:13] 15-2015 provide with you know with providing that the owner operating [1:13:18] additional Food Service establishment so that that existing legislation is in [1:13:24] existence this resolution does not amend that legislation this is just allowing [1:13:30] for a basically a one-year one this is not allowing that farmers market on a [1:13:37] continual basis to continue to operate this is just in order to a get the [1:13:44] resident feedback as to whether or not food cart vendors is something that they [1:13:50] want within the community if there is another opportunity to have [1:13:54] um so the ideal with this as a pilot project is it's consistent [1:13:59] so we know that that it's there every every weekend it's not sporadic so it's [1:14:05] easy to to monitor to some extent if there is [1:14:10] another option to be looking at after hours food cart if if a lot of [1:14:14] challenges do not surface and a lot of perceptions are debunked at that point [1:14:21] because there is some sensitivity with with this and if some of those concerns [1:14:27] are alleviated and it seems to be working really well expanding for a [1:14:32] downtown area what does that look like at any time Council can deliberate and [1:14:36] look at what can be permitted and what cannot be permitted and adjust [1:14:40] legislation accordingly if there is the opportunity for a downtown after hours [1:14:47] vendor as well as to further expand within this option before permanently [1:14:54] changing legislation 100 Council can enter into okay so we're not limiting [1:14:59] ourselves to just this correct could after further discussion decide okay and [1:15:04] maybe do we'd like to Pilot food vendors on handstand nights and see how that [1:15:08] goes before we change the legislation correct okay we had food vendors [1:15:14] knocking at our door yes we have had food vendors in the past yes as well as [1:15:20] as well as the public the questions um councilor Jarvis and I [1:15:26] it's not that we're I'm not against food carts and I'm not against food trucks [1:15:31] I'm not against any of those things but my concern is always being who controls [1:15:36] it now do we control it or do we by when I say as a pilot project do we give it [1:15:41] to the farmers market because there's a there's an awful lot of criteria there's [1:15:45] an awful lot of standards and rules and regulations and policies and procedures [1:15:49] that apply to these things um and are we going to be able to have [1:15:53] input into that it's one thing to have a pilot project and say okay you can go [1:15:56] ahead and do that but if we have if we stand back and then we watch things [1:15:59] happen and they shouldn't happen that way how do we how do we interact and do [1:16:03] that correct so so this resolution is just authorizing the CEO to move forward [1:16:08] to create that level of agreement with that organization and so when we look at [1:16:14] the looking at other past legislation and bylaws that other communities have [1:16:20] governed food cart vendors proof of insurance all of those things would be [1:16:24] part uh and parcel as to the agreement that must be provided and so at that [1:16:29] point it is it's not as simple as this resolution has passed and it's a done [1:16:34] deal so now it's then this is initiating it looking at what that agreement looks [1:16:38] like looking at the requirements that Council wants to have as part of the [1:16:43] provisions as part of this project that still needs to be determined at that [1:16:48] point Castle Hill so in here it doesn't [1:16:51] mention excuse me times of operation does that does this mean that they can [1:16:56] only operate while the farmer's market is open or they can can use those [1:16:59] grounds when there is no Farmers Market happening [1:17:02] so it was it was based on the assumption that when the farmer's market was [1:17:07] happening [1:17:10] So So currently I can look at changing as part of the project and that's where [1:17:15] again this is just initiating a pilot project it's not outlining the project [1:17:20] itself and so when we look at specifics such as requirements times of operation [1:17:27] that's outlined in the agreement this is just initiating the fact that [1:17:33] it's going forward on on saying yes we're going to allow this what does this [1:17:37] pilot project look like yeah I I would just like to see it as a [1:17:40] whole that's all [1:17:43] thank you I understand that you you would like this so that you could move [1:17:48] forward with starting to have some initial discussions uh it's not so much [1:17:52] I'm I would like this this is up to the council to decide if they would like [1:17:56] this uh this is an option for Council to look at having a food cart [1:18:03] um operating without the current provisions of bylaw 15-2015 without [1:18:09] permanently changing legislation Council General I promised my last [1:18:15] comments okay I think this is a nice controllable manner in which [1:18:20] um gives us an opportunity to um look at a what's important to us for [1:18:26] requirements b um testing them out testing the waters [1:18:32] on what we're looking for again in a controllable manner so that if at the [1:18:38] end of the pilot or even maybe part way through the pilot if it's very [1:18:42] successful we want to start looking at changing we have [1:18:47] um some good groundwork to help us change our legislation if that's the [1:18:51] road we're going in as opposed to spreading it all out and while these are [1:18:57] the issues here and those are the issues there and and then we're just I Envision [1:19:01] us having to look at so much and and and not being able to maintain our focus and [1:19:08] change that we may want to see happen not happening because we've not done an [1:19:14] in-depth look that's manageable initially well one of the things that [1:19:18] occurs to me that if if this happens um NFR CAO can figure out a policy with [1:19:26] them policies and procedures and what they would have to follow and what that [1:19:29] would look like then we would have a template with which we could be sitting [1:19:33] down with our local businesses and saying [1:19:36] we're thinking about getting food carts in here and these are the policies and [1:19:39] procedures they would have to follow so that we're not just going to that empty [1:19:42] hand and saying well we're not quite sure how they would run it but they [1:19:45] would run and and what the policies would be comfortable [1:19:51] again this is for the farmer's market we're not going to have a whole lot of [1:19:54] Leverage here once we agree with this too [1:19:57] because it's if we agree with food carts it's the farmer's market food carts have [1:20:01] nothing to do with the town [1:20:04] what kind of Leverage do we have if something's going selfish there's a [1:20:08] bunch of complaints from the from the local business owners like [1:20:14] we don't have a whole lot of uh rent here to sink our teeth to do if [1:20:18] something's not going right so that's where it would be when you're [1:20:22] looking for the grit that would be identified in the agreement that would [1:20:27] need to be signed by this as a pilot project the agreement [1:20:34] in order to say these are our expectations this is if if there is x [1:20:40] amount of uh or problematic let's say with litter you could have a provision [1:20:44] within that agreement that if there is a significant increase in litter uh that [1:20:50] the amendment can be terminated it will no longer be permitted for the rest of [1:20:53] the season that should have been put on the table before like you know included [1:20:58] in a resolution too early [1:21:02] um and I just wanted clarify what you're saying because it [1:21:06] and like Gene this would be the last thing I said I'd say um we are going to [1:21:11] establish the criteria for the farmers market for their food vendor like we're [1:21:17] going to say here is what our pilot project will include this you need to [1:21:20] have this this so we're going to establish that criteria that's correct [1:21:24] otherwise they don't get a food card correct okay but I just wanted I yeah [1:21:29] because and again that was my fear is that you know if we pass I don't like [1:21:34] the 2015 bylaw any more than anybody else and I think sometimes the badger [1:21:40] the local businesses they're not against food carts either [1:21:44] but we want to make sure that we're all played by the same rules if you're [1:21:47] allowed to you know take a penalty and I'm not allowed to take a penalty then [1:21:51] it's two different sets of rules correct and that's why that's why the food cart [1:21:56] vendors generally have their own bylaw itself that clearly outlines and it can [1:22:02] be as specific as each municipality chooses well they mentioned one thing [1:22:05] about the city of Winnipeg in a game I've mentioned before the city of [1:22:08] Winnipeg has a whole different ballgame including common laws and everything [1:22:12] your carts have to go where they tell you to go the criteria is crippling as [1:22:18] well as the costs so right now as part of through this the way that legislation [1:22:23] is written food cart vendor would be subject to the 75 Dollar [1:22:28] business license that that every other business is so in the city of Winnipeg [1:22:32] to operate a food cart at a specific location that the city has identified [1:22:37] those costs to have that through the season can range anywhere between 2500 [1:22:41] and 3 [1:22:44] but there's also things where you have to bring your cart to their [1:22:49] parking lot and they they store it for you and they check all that the city of [1:22:53] Winnipeg does that has nothing to do with the farmer's market okay correct [1:22:57] and so that's where when we look at how in-depth legislation goes without really [1:23:01] just stepping a little bit into to what what [1:23:07] is valuable we are not the city of Winnipeg and so those rules and [1:23:11] regulations may not fit here and so it's what is the fit here is the so when we [1:23:16] look at the downtown area is part of that bylaw saying you know what a food [1:23:21] cart is permitted after hours at do and then do those locations still need to [1:23:26] require um portable washrooms like and so [1:23:29] there's lots to think about before really actually sitting down and writing [1:23:33] formal legislation that's just going to be permitted and once it's permitted any [1:23:39] how many are permitted so there's lots of things for Council to consider when [1:23:43] looking at this and so this is a way to address from what I understand and [1:23:48] identified meat where there has been several requests being being made in a [1:23:52] controlled environment where we can monitor some of the problem areas [1:23:59] with minimal impact two legis legislation and therefore [1:24:06] minimizing any risk of well if they are allowed why can't I because it's [1:24:11] specifically outlined by a signed pot like agreement under a pilot Project [1:24:15] without change of legislation Council yeah I just want to report on this one [1:24:20] again [1:24:22] um [1:24:25] so is it possible then as a way of starting that [1:24:30] um our CAO could bring to us the outline of [1:24:37] an agreement that we would enter into or that we would present to the [1:24:42] Farmers Market I think you have people are getting hung [1:24:47] up so we can change the resolution for the therefore be resolved that Council [1:24:52] authorized the Cao to [1:25:04] present a pilot project allowing food cart to present [1:25:14] pilot project allowing a food cart vendor for the 2023 season at the [1:25:20] farmer's market law location only present a pilot project [1:25:29] foreign Council approval [1:25:39] for so therefore be it hereby resolve that [1:25:44] Council authorized the CEOs to present for Council approval a pilot project [1:25:51] allowing a food cart vendor at the 2023 season at the farmers market location [1:25:56] only so therefore this resolution will allow me to work within creating a bit [1:26:03] of a template agreement for Council review to see if there are amendments to [1:26:08] what's being proposed and have that in prior to then initiating the project [1:26:14] itself is there any plan to talk with other [1:26:17] businesses before we agree to something like this like in an open Forum Maybe [1:26:21] so so when we looked at at this particular things it's my understanding [1:26:26] that the businesses that were impacted were the downtown area and because this [1:26:30] location is not within that downtown area the intent is offering this locate [1:26:36] this pilot project one vendor only not in the downtown area to open those [1:26:42] discussions for changing permanently changing legislation and therefore [1:26:48] involving local businesses thank you [1:26:52] Kelsey Kozlowski if we don't make this resolution [1:26:57] for not only the farmers market but the [1:27:00] whole town would have picked each when are we going to revisit that again is [1:27:05] there going to be time to revisit in the summer to include the rest of the beach [1:27:10] area that's an example that's one of the things I was going to suggest is that [1:27:14] once we have a look at the recommendations in terms of this [1:27:20] pilot project whether we should be putting on our agenda for February [1:27:26] or March to have a full discussion about the process to look at Food vendors [1:27:33] downtown and that and part of that process I think would be meeting with [1:27:38] the with the local businesses um having some discussion with them [1:27:41] about some of the concerns about not having access to food and coffee and [1:27:45] stuff um did your evenings or Sunday [1:27:48] afternoons those kinds of things um [1:27:52] and having a full discussion about food vendors [1:27:57] councilor Jarvis is it possible to have this um [1:28:01] what you described with the resolution in within the next 30 to 60 days at the [1:28:06] next meeting or the second next meeting uh absolutely yeah so that we can yeah [1:28:13] the way you just read the resolution if example in January through week January [1:28:18] we have this ready to discuss it but I I and I think we can probably get a few [1:28:23] business people involved in it if you want to and heaven forbid that I've said [1:28:26] the word special meeting but um if you want to get some sort of a meeting [1:28:29] together with three or four people then and get them to establish criteria [1:28:36] well we're talking about two different things [1:28:41] yeah right but what I'm saying is that is this is about putting together policy [1:28:46] policies and plans for a food cart at the farmer's market where you know [1:28:52] and once we take a look at some of those [1:28:55] preliminary policies and procedures then having a fuller discussion about [1:29:01] what we want to do with downtown Winnipeg Beach and that would include [1:29:05] talking to restaurants and business owners down here no I understand okay so [1:29:10] my question is once we agree to this are we saying to the farmer's market they [1:29:14] can have we are saying our CEO can put together a policy and procedure that [1:29:21] you'll bring back to council we're going to establish correct here [1:29:27] and it's not actually a policy and a procedure it is an outline of the pilot [1:29:32] project and things that are going to be considered for the pilot project [1:29:38] and the whole idea behind a pilot project is you learn from it and you [1:29:43] learn things that you have in there maybe don't work or aren't necessary and [1:29:47] things that you might have missed need to be added so [1:29:50] I haven't seen this resolution as a start yeah to but a start in a [1:29:56] controlled manner that you know instead of [1:30:00] that we can learn from and grow from and and [1:30:06] from there then so let's just hypothetically say it all [1:30:12] gets put together everything's on there that Council agrees with and and then [1:30:16] it's a goal we have separate discussions [1:30:21] what I'm understanding from mayor Jackson is which would then lead to [1:30:24] separate discussions that could involve the business Community about and how can [1:30:29] we move forward downtown right so why don't we yes and that's my point with [1:30:34] any pilot project you usually have all your research before you you know you [1:30:38] might try something and then fall off the cliff and that's what I think just [1:30:43] what I think we need to do is again get the businesses involved before because [1:30:49] they might come up with some really good ideas as well that we can [1:30:53] put into this pilot project before we I'm just saying it's middle of winter [1:30:57] time nobody it might be the time to do it so it would seem to me that we are [1:31:01] going around the circles and sort of saying the same thing over and over [1:31:03] we're saying two different things yeah so I'm wondering whether we can simply [1:31:07] go to vote on this and either pass it or not or table or table [1:31:12] so this is to authorize the CAO to um [1:31:18] present for Council approval procedures around pilot project for a [1:31:25] food cart vendor in the farmers market location [1:31:29] and I understand the recorded vote was requested [1:31:32] okay so all in favor [1:31:39] and uh a post for the table [1:31:44] okay carried [1:31:53] be it hereby resolve that the ca'll be authorized to sign the service contract [1:31:57] between the town of Winnipeg Beach and steric cycle shred it for shredding [1:32:01] services [1:32:07] Council Jarvis second to please counselor Kozlowski [1:32:14] discussion [1:32:22] discussion anybody all in favor [1:32:27] Gary [1:32:31] so rental agreement use the facility uh just a CAO report and current rental [1:32:37] agreement there is no resolution at this time that I could think of for Council [1:32:42] however if uh after reviewing that Council would uh [1:32:47] want to set direction to the CEO [1:32:53] I think that we probably need to have a clearer understanding with the renter [1:33:01] in terms of the function and use of the facility [1:33:06] and I understand we probably can't change it now because we've signed it [1:33:09] into the 28th until October 2024 is that correct that's correct [1:33:13] however agreements can be amended if both parties are [1:33:21] this is not the first time that we've had some concerns [1:33:25] about having um [1:33:31] different functions happening on the on the main level of the rec center while [1:33:36] the canteen was open and so I think that we're going to need some [1:33:40] for the clarity to the agreement [1:33:44] what do other people think [1:33:48] Council Jarvis are we talking about to the letter that was sent to the CIO [1:33:52] about this because I think you know what it's the cost of doing business [1:33:58] you know what I mean like I don't want to complain but I mean [1:34:01] we're talking about things like parking and so on and so forth but [1:34:04] that happens all the time every time they close Main Street for a function [1:34:07] there's a dozen businesses down there that are affected you know what I mean I [1:34:11] just think it's it's craziness like even Boardwalk days shuts the place down for [1:34:15] five straight days you know like [1:34:19] the people in terms of this particular issue [1:34:22] to Jenna I have to heard of counselor Jarvis [1:34:26] um I also noticed that there were things included in that letter to the CIO [1:34:31] that aren't part of the agreement so I'm not sure where the expectation comes [1:34:35] from [1:34:39] and I know this is going to be like a humorous part but parking big deal I [1:34:45] talk about it all the time you know what I mean it's crazy [1:34:49] I was waiting I was wondering you know what I mean but and back like to back up [1:34:55] Gene who backed up me is that it's a cost of doing business you know what I [1:34:59] mean like Barry himself has said that you know he knows people that don't come [1:35:02] downtown in the middle of the summer it's a hot Saturday because they can't [1:35:04] they won't get into a business things happen okay [1:35:09] other other comments [1:35:14] comment clarify no further action by the CEO [1:35:26] be adhered by a result that Council move in camera at 7 35 pm to discuss matters [1:35:33] that are in the preliminary stages and further be it resolved that any matters [1:35:37] discussed while in camera are held confidential until such time is [1:35:40] discussed in open Council remover please master who [1:35:45] secondary please Council Jervis all in favor [1:35:50] Gary thank you [2:01:52] for dinner [2:01:55] foreign [2:02:03] moves out of camera at 9 40 pm and for 8 40 p.m and resumes the regular meeting [2:02:10] of council [2:02:14] can I get a mover please [2:02:17] secondary counselor Jarvis all in favor [2:02:24] carry be it hereby resolve that Council does [2:02:28] adjourn at 8 40 pm to meet again on January 11 2023 at 6 PM for the [2:02:34] committee of the whole meeting get a mover please [2:02:37] councilor Jarvis secondary please councilor jaslowski [2:02:44] all in favor Carrie
