Um and we are [2:52] going to start with the discussion of [2:54] proposed repairs to the exterior of the [2:57] city center. Um, just kind of recap. Uh, [3:01] last council meeting we you I was [3:03] authorized to spend what was in the [3:05] budget for this particular project, but [3:08] we did want to grab a few others uh bids [3:12] on that. So, I appreciate um John your [3:16] help with that. Um, and so I kind of [3:20] want to go over those for your guys' [3:22] information. Did I say it's it's Steve [3:25] John's. He has two first names. It's his [3:28] fault. [3:28] >> You can call me whatever you want. [3:32] >> Steve. [3:33] Okay. [3:44] >> Oh, I was thinking John. Huh. [3:45] >> Yeah. Yeah. Okay. So, the original bid [3:48] that that we received um was from an [3:51] organization called Home Innovations. Um [3:55] and that bid comes to a total of [3:57] $32,47.38. [4:02] Um the scope of this work um basically [4:05] is the side of the building completely [4:08] behind me uh completely ripping it off [4:10] because we have leaking windows. Um and [4:13] this is the primary issue that [4:15] propagated the the need for this type of [4:17] work. As we went around the building, [4:20] there's a few other broken panels. [4:22] There's trim pieces that are falling [4:24] off. [4:25] Um, now as I have gone through because [4:28] I've walked the property with all three [4:31] of these companies now and all three of [4:34] them have one thing in common and that [4:37] is they all say that how the sighting [4:40] was put on this building. [4:44] incorrect is the wrong word because it's [4:48] not necessarily incorrect, but it was [4:51] kind of a budget option that we're now [4:54] suffering from. So, for instance, [4:55] typically when [4:57] >> volunteers, [4:59] >> the sighting was not actually [5:00] >> really [5:01] >> correct. We had already farmed it out to [5:03] a general at that point [5:05] >> to finish it out. Um, and so typically [5:08] when you do a hardy sighting, um, you [5:12] trim out all the windows first, [5:14] >> right? [5:15] >> This actually did all of the siding, so [5:19] the the Hardy slat first and then they [5:22] took like [5:24] 38 inch trim and kind of tried to shoot [5:28] it on around and through the siding. [5:32] The problem is that creates gaps and [5:34] they didn't caulk in those gaps and so [5:36] they're full of hornets and water and [5:38] that's one of the reasons we're having [5:40] such issues. Um [5:43] so you'll see that the reason I give you [5:46] that context is you're going to see that [5:48] in the differences of these bids. I [5:51] tried to get as close to apples to [5:52] apples but that was impossible. Um, so [5:57] the home innovations bid is for this [6:00] side being completely ripped off, thrown [6:02] away, completely repaired, covered in [6:05] OSB because the foundation wall, if you [6:08] can see right behind me, [6:11] this is concrete all the way to the [6:14] ceiling. So, it's designed for the [6:17] highest R value you can get. It's [6:20] actually the same way Steve's house was [6:21] built, I believe. Right, Steve? Um, [6:24] however, that means the other side of [6:27] this wall is also concrete. So, they've [6:29] nailed on [6:31] these small slats to then be able to [6:34] nail the siding on too. So this bid [6:37] includes actually putting 7/16 OSB and [6:41] sheeting the whole thing. Furring out [6:44] the indent because this actual the gable [6:48] on this indents in so it creates a ledge [6:52] which is storing water creating helping [6:54] facilitate the leak. So that's [6:57] completely shearing this straight up. No [7:00] more ledge. All of that will be then [7:02] fixed. Uh, this also rips the dormers [7:06] off and repairs the dormers because they [7:08] also have a lot of water damage getting [7:10] new flashing underneath those. Um, [7:13] because the code actually helps require [7:16] that you have a 3 in gap above the roof [7:20] line of flashing and then it jumps [7:24] underneath the the the siding to help [7:28] with the waterproofing. And this does [7:29] not have that gap. Well, they change [7:31] they changed the code [7:33] >> pro [7:33] >> probably. [7:34] >> I know they did because I got the [7:36] insurance to deny a roof repair because [7:39] of it. [7:39] >> Oh joy. Sorry about that. Um and so [7:44] that's kind of what this is. This also [7:45] then fixes [7:48] a kind of more bandage on top of the [7:50] bandage of the broken pieces of trim [7:53] through windows and things like that. [7:55] Okay. So that's the home innovations [7:56] bit. I have a question on all before we [7:59] get to all of them then. Um they have [8:01] similar time frame on completion. [8:05] >> Uh that I actually don't know. I have [8:08] not spoken to them because that's of [8:10] less importance to me than than your [8:12] guys's decision for cost. They all can [8:15] get it done this before the snowflies. [8:18] >> Oh, this this is [8:19] >> which is [8:21] what I was wondering. [8:22] >> Yep. [8:23] Um, so Cascade, I was extremely [8:26] impressed with Cascade. It helps that [8:28] the owner's name is Ben, but very kind. [8:31] Um, this was a very thorough and as he [8:35] went around the building, and you'll see [8:37] because Cascad's bid is for 76,000. So, [8:41] they're down their half payment is [8:44] >> our budget [8:45] >> more than than Home Innovation's full [8:47] bid. They're saying you really just need [8:51] to do this project right. And this is [8:55] all exterior ripped off the building. [8:59] All both ends of the building having the [9:02] same fix because that dormer also sucks [9:05] in just like this one does. Um, and [9:08] they're going to put in on the very [9:10] bottom uh that rigid foam in between [9:14] each of those slats. Now, they're not [9:15] going to sheet it with OSB, but they're [9:17] going to put rigid foam behind those [9:19] slats so that it uh has more imp [9:24] protection because that's one of the [9:25] problems. If you've gone down this side [9:27] of this bay, a lot of those uh tiles [9:30] have been just broken out, the Hardy [9:32] board. Uh it's because there's no [9:34] backing on it. And so, it doesn't take [9:36] any impact at all. It just shatters. So, [9:40] that's what this one does. Hence, it is [9:43] quite a bit more. As you probably looked [9:45] through the bids, [9:47] this was a pretty bid package. They took [9:50] extensive pictures uh understanding, [9:54] articulating every single side of the [9:56] wall, labeling them. Very impressed. [9:59] Just also impressive price tag. [10:02] And the last bid um comes from a company [10:06] called uh Latmer Plastering LLC. [10:10] um also really enjoyed these guys. Uh [10:14] their bid actually is far more [10:17] comparable to uh the Home Innovations [10:20] bid than it is to Cascade. Um and this [10:24] one is for $55,000. [10:27] Uh this is repainting though also the [10:29] whole front of the building. [10:31] >> Painting [10:33] >> because we do have that we had an old [10:35] sign that used to be on the front. So, [10:36] we now have that big huge mark on the [10:38] front. And because there's a number of [10:41] panels they want to replace around those [10:44] front windows, they said there's no way [10:47] we can match this paint. We'll just need [10:49] to repaint that whole facade. [10:51] >> So, all three of them have kind of a [10:53] different um scope then. [10:55] >> Correct. Right. and and basically I told [11:01] them when they were here I told them [11:03] what this bid was the scope of it and [11:07] they said we'll we'll give you what we [11:09] feel is actually makes sense to do and [11:12] so you have Cascade saying you need to [11:15] do the whole building which I don't [11:17] disagree with [11:19] you have Latmer kind of in the middle [11:22] but they're but the amount of work we're [11:24] going to get is actually going to be [11:26] much closer to the home innovations bit [11:28] so [11:29] >> they just added on the front. So and then [11:37] everything else that we talked about [11:38] replacing the dormers and replacing this [11:40] wall. [11:40] >> Okay. So the reason I kind of pushed for [11:43] this is because a lot of these [11:46] contractors, sorry Steve, it's already [11:48] been a lot of contractors and you guys [11:51] are building mostly right now. You guys [11:53] aren't like this. um [11:57] have a tendency to make their money on [12:00] change orders. [12:02] >> So, they come in low on the bid, they [12:03] get the job, and then, oh, we need to we [12:07] need to paint the whole building because [12:08] of this, and all of a sudden, your your paint price has tripled um from [12:14] what you would have gotten from a bid. [12:16] So, I wanted to see what other people [12:19] were saying needed to be done so that we [12:21] could actually come back and if [12:24] necessary, which I was afraid it was [12:26] going to be, um, say, okay, [12:30] if if we think the we need to do the [12:32] whole if we need to do both ends and [12:34] then paint everything and whatever we've [12:36] got to do, right? Um, [12:39] and I don't disagree, the whole thing [12:41] needs to be done, but I don't know that [12:42] we can afford to do it right now. [12:43] >> That's my feeling. [12:45] Um, we say, "Okay, all we're going to do [12:49] is this end, say Cascade, what are you [12:51] going to do for us?" You know, um, and [12:54] if we pick a Sherwin Williams paint or [12:58] a, you know, I don't know what they [12:59] painted this with, but if we if we make [13:01] note of that, we can match that paint in [13:04] the future. Um, so we could do and and [13:07] it's not bad when you do a full side [13:10] because as you come to a corner whether [13:12] there's trim or not, you can't tell that [13:15] there's a slight difference in those um [13:18] >> if it fades from the sun. And I hate [14:02] saying that, but redo the bids. They [14:05] come together. You don't need to talk to [14:06] us after that unless it's over what [14:08] we've what we've budgeted for. Um, and [14:12] then you can make you and Ted and Jody [14:14] and Wayne can make the decision. Okay, [14:16] this is the one we're going to go for. [14:18] We feel best about this. Might not be [14:19] the cheapest one, [14:22] but it's the one we feel the most [14:23] comfortable with. But now you've got a [14:25] detailed scope of work with the three [14:27] different bids to pull from to say here [14:30] is now our our called a and I call it a [14:33] s scope of work. Um rebid you know re [14:37] readjust your bid for these particular [14:39] things. I like the fact of of backing [14:41] the the Hardy one way or the other, [14:43] whether it's OSB or whether it's hard um [14:47] foam, high density foam. Um because [14:50] that's what I mean, I'm looking at the [14:51] pictures and you can see the busted in [14:53] Hardy board, right? Um so, [14:57] you know, once once we you can do this, [15:00] I don't know that you need to come back [15:01] to us if it's within budget. [15:04] My my thoughts on it. Uh and then there's two big long [20:36] numbers. If you're interested, you can [20:38] read them. Including declaring the [20:40] property surplus and authorizing the [20:42] sale process. This platted [21:41] as city rightway. So it becomes our [21:43] property is our property. It's part of [21:45] the plat. It's property that uh does not [21:48] meet any requirements to be a lot. [24:08] there's still interest from this [24:09] developer on behalf of these two [24:11] property owners. Um really probably the [24:13] only other ones that would have any [24:15] anything to gain by purchasing this [24:17] would be the two adjoining ones on [24:19] either side. So we are going to [24:21] advertise it for 45 days. Um and then we [24:24] can receive [24:26] I don't know we call them bids but [24:30] >> offers for this property. All five [27:05] driveways right there in a row on that [27:06] busy road. So they built a private drive [27:09] behind the homes. So there's five homes [27:10] that access that private drive. Uh, the [39:39] discussion of the snowplow leases and an [39:41] update on the pickle court. [39:43] >> Um, so pavement management project [39:48] is underway. They started yesterday. Um, [39:51] it's really tearing up some roads. So, [39:54] uh, they've been trying to keep as much [39:56] as as as good as they can access for [39:59] people to get to their houses, their [40:00] driveways. There are some temporary [40:01] disruptions while they dig up the road. [40:03] What we found in digging it up is [40:05] there's less pavement or dirt than what [40:08] we had hoped. And so, when you look at [40:10] it, you don't see when you go watch them [40:12] grind it up, there's you don't see [40:14] hardly any asphalt. It's all dirt, [40:15] right? So, we probably didn't have a lot [40:16] of asphalt down, hence all the cracking. [40:19] Um, [40:21] so what they do is they go through and [40:23] they grind it all up. It goes 8 inches [40:25] deep. So it gets the asphalt plus all [40:27] the dirt down to 8 in, which is mostly [40:30] dirt. Grinds it all together. And it's [40:32] pretty good dirt. It actually is rope [40:33] based material. So it's pretty good dirt [40:35] in there. And then they kind of left [40:37] with this [40:39] 12 in just soft material. That's what [40:41] it's kind of hard to drive on. They got [40:43] a grater roller coming in behind it. [40:45] Raids it down and then rolls it. So it [40:48] makes it more drivable. So they're [40:49] trying to keep people's access as good [40:51] as they can while they're doing this. [40:52] But it is a little bit um I think we [40:55] were hoping it was more asphalt so it [40:56] just grind up asphalt grindings and it [40:58] would be fairly drivable all the time, [41:00] but it's not turning out that way. So [41:03] but we've had great residents. I haven't [41:05] heard only a couple have called just [41:07] asking, you know, you know what so I [41:10] don't get blocked my driveway or do I [41:11] need to move my car? A few things like [41:12] that. But everyone's been great about [41:14] it. They're turning away. They've got [41:15] Eagle Nest done and Grizzly done uh as [41:19] much as they're doing there. So, they're [41:21] turning away up there, they will start [41:23] paving Eagle Nest on Monday, I believe. [41:26] So, they told me and then within two [41:28] weeks they'll have all of that up done. We had talked about [47:13] staggering the snow plows, maybe sending [47:15] one back and leasing the new one and [47:18] then trying to extend one for another [47:20] year so we get off years. So we're [47:23] replacing one of the plows each year. I [47:25] had another thought that I want to bring [47:27] to the council and that is uh one I uh [47:30] the company we're going through right [47:31] now I'm not totally enamored with just [47:34] because they're not really responsive. [47:36] Um one and two I'm the international [47:40] snow plows are not probably the top of [47:42] the I don't know a while about the [47:45] international snow plows. So I reached [47:47] out to a company that we lease our other [47:49] vehicles through United Fleet Services. [47:51] These guys are local. uh their rep just [47:54] lives right here in Utah County in um [47:56] East Mona. Um and we lease a couple of [48:00] our vehicles through through them. [48:01] Really good to work with. So I asked [48:03] them about getting some um snow piles [48:07] through them. [48:09] And uh and we would change the chassis. [48:11] Ford doesn't make a chassis big enough [48:13] yet with a good good motor, but Chevy [48:15] does. Uh so we look at maybe getting a [48:18] couple Chevys. [48:20] um that would be the equivalent of the [48:21] internationals. [48:23] And um so I had them put together kind [48:25] of some lease costs for us. And what I [48:27] looked at was either a three-year lease [48:28] and then either a four or five, either [48:30] one. And so my thought was we send the [48:33] two back we have the internationals in [48:35] June because they're due. And then we [48:37] lease two new ones on a staggered lease. [48:40] So we'd get two new ones this summer [48:43] uh on a lease, but the lease would be [48:45] staggered. So we'd have a three-year [48:46] lease and then either a four or five [48:48] depending what we want to do. They're [48:49] pretty flexible. Uh, so I had him put [48:51] together a cost to do that for us [48:53] because if we wanted to, we could start [48:54] building them now because it'll take [48:57] probably three months to get the [48:58] chassis, then another three months or so [49:00] to get them built. Um, and they're [49:04] actually slightly cheaper than the lease [49:07] cost we have now through the other [49:08] company, but I'll just say it's a wash. [49:10] It's close enough it's probably a wash, [49:11] but I guess thing is it doesn't go up in [49:14] cost. [49:16] Uh we pay about 30 something,000 now for [49:18] leasing these. 33 I think it is a year. [49:20] Um the new ones would be about 30. So [49:22] we'd actually be saving a little bit [49:23] money. And that's a kind of an estimate [49:24] because the full buildout we don't we [49:26] estimated a cost for the buildout but I [49:28] think we've overestimated and he also [49:31] projected a little high. So it could [49:32] even come better not knowing the timing [49:35] of this. Uh I think his [1:00:04] list of 20 got limited to four coming [1:00:06] out of appropriations committee. Luckily [1:00:09] we were one of those four. [1:00:10] >> Oh wow. [1:00:11] >> Our money got cut a little bit. So we're [1:00:13] uh we got recommended from the [1:00:15] appropriations committee [1:00:18] to for $850,000. I said, well, if [1:00:36] we did 2.9 million, that would get most [1:00:37] of our project done um [1:00:40] >> and then they said, "Well, how about [1:00:41] less than that?" So we we eventually we [1:00:44] got down to about a million I think was [1:00:45] the least amount we and then we have to [1:00:47] do a match of that of about a half [1:00:49] million which we've been saving for but [1:00:51] so I went in with the lowest that we [1:00:53] would accept would be or we would want [1:00:55] not accept but we would want is a [1:00:57] million dollars with our match dollars [1:00:58] so be a million half dollar project. Um [1:01:01] they uh it got cut to $850 [1:01:06] was the bad news. The good news is we we [1:01:08] made it through 16 others obviously got [1:01:10] cut. [1:01:12] >> So it's made it through the [1:01:13] appropriations committee. However, it's [1:01:15] now at Congress and probably won't I [1:01:19] don't know that we'll hear anything [1:01:20] going through Congress for the next [1:01:21] year. He said it's basically a bill they [1:01:23] got to pass, right? All these projects [1:01:25] and I think there was some multi-million [1:01:28] dollars of projects. It's all through [1:01:29] the United States. And I think I counted [1:01:33] how many hundreds of projects, but [1:01:35] anyway, it's one bill, but that bill [1:01:37] probably will make it through Congress [1:01:38] at best by the end of the year, he said. [1:01:40] So, [1:01:42] >> maybe if pending with elections, they [1:01:44] might be able to get it through. [1:01:46] >> Yeah. [1:01:46] >> End. If you [1:02:31] can use federal funding to leverage [1:02:32] state funding, it goes it weighs a lot [1:02:36] better with the state and you'll likely [1:02:37] get better funding through the state. [1:02:40] So, um I want to start let's start the [1:02:43] application process with the state uh [1:02:45] because they have four funding meetings [1:02:47] a year, I think it is. Um, not sure when [1:02:51] the next one is, but start the [1:02:53] application process with the state in [1:02:56] hopes that this has made it through by [1:02:58] the time we hit the state and that we [1:03:00] can leverage this money into state [1:03:02] funding. The bottom line is though, [1:03:04] we're going to have to go through some [1:03:05] public hearings because it's going to [1:03:07] have to be a water rate. [1:03:08] >> Yeah. And and that's what I'm saying. [1:03:09] >> So, it's going to take a little time. [1:03:10] I've already done a water rate analysis. [1:03:13] >> I think we need to move. Uh, pick a [1:09:07] contractor and just let them kind of [1:09:09] determine the timing, uh, based on the [1:09:11] weather, if we can do concrete, whether [1:09:12] they get part of it done this fall and [1:09:14] then come back next spring or how we do [1:09:15] that. But, so, it's in the works. uh we [1:09:18] should have design done by the end of [1:09:20] this 1 of September. Um, when I talked with Utopia [1:11:19] about that, they called me right away, [1:11:22] sent me some pictures and just so that [1:11:24] our residents who also called all of us [1:11:27] um that it it did have the blue stakes [1:11:30] and they know what the regulations are [1:11:32] on that, but um it appears that as I [1:11:35] talked with other cities too, um [1:11:37] sometimes contractors realize that [1:11:39] August are getting close to projects [1:11:42] needing to be finished, so they don't [1:11:43] always do um everything they're supposed [1:11:46] to like dig by hand within so many feet [1:11:48] of that blue blue stake line etc. [1:11:51] >> This one actually the contractor was [1:11:53] SCSD. [1:11:54] >> Mhm. [1:11:55] >> And Utopia [1:11:58] incorrectly marked the line. [1:12:00] >> Oh. [1:12:01] >> So there was no violation beyond the [1:12:04] fact that the blue stakes was marked [1:12:06] incorrectly. So thus when they dug there [1:12:09] was not supposed to be anything there. So [1:12:17] it was just explaining to our residents [1:12:21] that [1:12:22] the hard part is is that whoever digs it [1:12:25] up has to pay for it. But um not in this [1:12:29] case now, yes, but typically but there [1:12:33] are no punitive damages. So if a if a [1:12:36] contractor does do it wrong, [1:12:39] all they have to do is pay for the the [1:12:42] um the damage and to get it fixed which [1:12:45] you know to our city being out of the [1:12:47] internet all day long that affected a [1:12:49] lot of people in their business and [1:12:51] schooling and whatever right and so [1:12:53] there's there's nothing that is [1:12:55] currently done but I think there is some [1:12:58] legislation being proposed so whichever [1:13:00] site is at fault has to pay some [1:13:04] damages to the municipality [1:13:05] >> sometimes proving fault right so I've [1:13:08] done millions and millions of dollars [1:13:10] worth projects [1:13:12] and I probably have seen I have not yet [1:13:14] seen a project where they don't get [1:13:16] utilities [1:13:17] >> right. Um it is it is tough because [1:13:20] utility companies one always don't mark. [1:13:23] So utility companies hire third party [1:13:26] >> blue stickers usually market. Now we do [1:13:27] our own but other hire third party [1:13:30] utility companies. So and I actually sat [1:13:32] in a meeting where a contractor hit [1:13:36] >> 500 homes out of power in the winter a [1:13:38] hospital three intersections and blew a [1:13:41] water line apart. And this was major [1:13:44] like tens of thousands of dollars worth [1:13:46] of damage because a blue stagger didn't [1:13:49] mark a power line correct and the [1:13:50] contractor hit it. It was a main power [1:13:51] feed for this whole 600. It was up in uh [1:13:54] east Salt Lake area. Um and so there [1:13:59] were meeting after meeting after meeting [1:14:00] who was at fault here. Was it the Blue [1:14:03] State company? Was it the utility [1:14:04] company? Was it the contractor? And [1:14:07] obviously then you get attorneys [1:14:08] involved and everything like that. Um, [1:14:11] so it is tough and I think that's why [1:14:13] they they don't because you you would [1:14:15] probably spend this just personal [1:14:18] opinion of mine. You you spend more [1:14:19] money on attorneys and fighting these in [1:14:20] court than you would just telling the [1:14:22] company, listen, you got to pay for our [1:14:25] company to fix it. And that's going to [1:14:27] be your damage. And that's the way it is [1:14:28] now. Um, now they couldn't fight them [1:14:30] out, but I think it's it's because [1:14:32] sometimes it's tough to prove, too, [1:14:34] because utility says if you their their [1:14:37] marks are within three feet, [1:14:39] >> right? So they say if it's if it's [1:14:40] within three feet then it's good mark. [1:14:43] >> Um but then you've got to prove was it [1:14:45] within three feet? Was it 3 feet one [1:14:46] inch? Was it two feet 11 inch? You know [1:14:48] and when it's dug up the mark's gone. [1:14:50] >> So how do you prove that? So those [1:14:51] things are really tough. So, we put [1:15:37] something out and I think that helped [1:15:39] people right away. And then having that [1:15:42] timetable that said they're hoping the [1:15:44] estimation time, of course, they all it [1:15:47] did help when you put the thing out that [1:15:49] said, um, hey, call your own utility [1:15:52] comp, you know, the utility company and they or look on their website [1:15:56] because they're putting things out. That [1:15:58] also helps people to alleviate the panic [1:16:01] of is it just a temporary thing? Is it [1:16:03] an all day thing? Was it somebody in our [1:16:06] city? Was it outside of our city? All [1:16:07] those things help deescalate the tension [1:16:10] that can come from these kinds of [1:16:12] things. So, I thought we did a good job [1:16:14] in in at least communicating that out um [1:16:18] and and recognizing and I think that [1:16:21] helped a lot on the people who were who [1:16:23] were upset because they then knew drive [1:16:26] to Provo or drive to Starbucks or [1:16:28] wherever they were going to get their [1:16:29] internet that day. [1:16:33] If that happens again on a workday week, [1:16:36] like I have Starlink and [1:16:39] >> and you know what I [1:16:40] >> and nobody at my house is home in the [1:16:42] middle of the day. [1:17:49] When the [1:17:52] city council got out of the subdivision [1:17:55] business, I told you I'd periodically [1:17:56] give you some updates and things on [1:17:59] subdivisions and particularly maybe some [1:18:02] nuances that were uh experiencing with [1:18:05] them a little bit. So, uh I wanted to [1:18:07] talk to you a little bit about two [1:18:09] different subdivision [1:18:11] um issues. I sent you all a couple of [1:18:15] pictures of Belle View subdivision. [1:18:19] Uh they finished all all their [1:18:23] infrastructure work um many months ago [1:18:27] and made no effort to record. [1:18:32] And so um I should record phase B. They [1:18:37] have two lots that were recorded a long [1:18:39] time ago. Um but the other lots uh are [1:18:44] not recorded yet so they can't sell [1:18:48] those lots. Um some subdivision [1:18:54] um developers are taking [1:18:59] reservation money and things like that [1:19:02] which uh [1:19:05] we're not concerned with. But the bottom [1:19:09] line is the lots aren't recorded and so [1:19:11] we don't issue a building permit for [1:19:13] those lots until there's a recording [1:19:15] done. We uh have tried uh for many [1:19:20] months to try to get uh the developers [1:19:25] of [1:19:27] Belleview to record. there was some information [1:19:33] that needed to be added to the myar and [1:19:36] um [1:19:38] they for one reason or another were [1:19:41] haven't done it. So our ordinance it [1:19:45] gives them 365 days from when they start [1:19:50] infrastructure work all recording. [1:19:54] If it's not if the if the recording is [1:19:57] not done within 365 days they lose all [1:20:01] of vesting that they've they've done. [1:20:05] It's like they're going to have to start [1:20:07] over again. [1:20:09] We've communicated that to them that [1:20:11] they've lost. they've lost that. So, [1:20:14] we're trying to set up with them a uh a [1:20:18] shortened version of [1:20:21] reactivating the subdivision. Now, [1:20:26] they can get an extension if they ask 60 [1:20:29] days before it's due to expire, and they [1:20:32] didn't do that. Um, so we've given them [1:20:36] a number of things that we want updates [1:20:38] on uh in order to [1:20:42] go forward with uh [1:20:45] a request now to the city to uh [1:20:50] reestablish that subdivision process for [1:20:53] them. One of the concerns that uh [1:20:58] I have planning commission has is when [1:21:03] the original approval was under the [1:21:05] previous owner of the plants [1:21:09] >> and [1:21:13] the the other developer um [1:21:17] came in and purchased the property then [1:21:20] and continue to go forward with that [1:21:22] development plan for the the subdivision [1:21:25] and they're the ones who have done all [1:21:27] the work associated with it. Um [1:21:32] when we approved us planning commission [1:21:35] and you all uh for that development of [1:21:39] that um subdivision, [1:21:42] we gave the then developer who was Carol [1:21:45] Bell uh some approvals [1:21:49] to do some grading on that property to [1:21:54] facilitate [1:21:56] uh placement of of homes and making lots [1:22:00] of [1:22:01] It was of such a design that uh was [1:22:04] going to be extremely hard to do. So we [1:22:08] gave them those allowances at the [1:22:10] beginning and there was a commitment [1:22:12] from Carol Bell's group that they would [1:22:15] do as minimum as possible in order to [1:22:19] get the grading that was necessary to [1:22:22] allow homes and structures to be built [1:22:27] space. [1:22:27] >> Correct. [1:22:28] >> Yeah. Yeah. Okay. [1:22:29] >> So, um we're assuming that got [1:22:33] transmitted to the new developers and [1:22:36] it's our understanding that the civil [1:22:38] engineer stayed the same, but I don't [1:22:41] know how much checking that was done [1:22:43] during the process. My concern is they [1:22:47] may not have done enough rating to [1:22:51] facilitate having less than 35% slopes [1:22:56] in that area. those pictures that I sent [1:22:59] you. [1:22:59] >> Yeah, [1:23:00] >> there were two lots the back side of the [1:23:03] culde-sac. [1:23:05] And when you look at those and you look [1:23:07] at the drop off in front coming down to [1:23:09] the the property line, they're just to [1:23:13] me eyeballing it, it seems like it's [1:23:17] going to be problematic. [1:23:20] What we want what we don't want to be in [1:23:22] a situation is is we go ahead and [1:23:24] approve that subdivision, approve those [1:23:27] lots and then somebody comes back to us [1:23:29] and says we can't build on it. Your [1:23:32] slope is too great and by ordinance they [1:23:34] can't. So then they have to potentially [1:23:37] go through the variance process and pay [1:23:39] come in and appeal their case. So [1:23:42] there's there's provisions that we can [1:23:44] do that if we planning commission now [1:23:49] and give them um variances in the [1:23:53] beginning of the uh infrastructure work. [1:23:57] So that's we've asked them to provide us [1:24:02] basically a uh grading survey so that we [1:24:07] can see what what grades are [1:24:10] particularly in these two lots that I [1:24:11] took pictures of and sent to you. So [1:24:14] that if if if they don't qualify [1:24:19] going through a new subdivision process [1:24:21] now and they can get in there and make [1:24:23] and do some more grading to accommodate [1:24:26] uh the law [1:24:28] >> if they've already gone through and and [1:24:30] it has expired the 365 days. So they [1:24:33] have to start over. But wouldn't the [1:24:35] original approval that's conditioned on [1:24:38] them making those lots buildable with [1:24:41] the new grading that would still be [1:24:43] enforced? So could it would not be [1:24:45] enforced. [1:24:46] >> It lose all vesting that they had. [1:24:48] >> So it would have to be reapproved by us [1:24:50] and then we could put that statement [1:24:52] back in. [1:24:53] >> We can [1:24:54] >> and then that's what [1:24:55] >> yeah instead of variance to the new [1:24:57] people buying it just if they are going [1:24:59] to go through the process all over we [1:25:01] just put that back into the whole [1:25:03] development agreement. [1:25:04] >> Yes. I think that would be better for [1:25:06] the [1:25:08] >> for the developer to have to be [1:25:09] responsible for that, not the homeowner [1:25:11] responsible for a variance. Because a [1:25:12] variance, although it's nice, it also [1:25:15] increases the price of your home to have [1:25:18] to build. I mean, we can build anywhere, [1:25:19] but increases the price when it's on a slope that is not really meant to [1:25:25] be buildable. [1:25:26] >> Correct. So, that's our plan going [1:25:28] forward, what we're going to do, and [1:25:30] we'll see what the engineer comes back [1:25:32] with as far as the slopes that are in [1:25:34] there now. But eyeballing it, I I just [1:25:37] have reservations that and they have [1:25:41] that causes problems with septic. [1:25:43] They're not on sewer. that potentially [1:25:46] causes problems with septic because [1:25:48] public health has requirements that they [1:25:51] have to be so far away for [1:25:54] >> and we slopes force [1:25:56] >> alternate um [1:25:58] >> they may there's two lots that do [1:26:00] require and we have we're getting a new [1:26:02] letter [1:26:03] >> because that letter expired in three [1:26:05] years it's passed now [1:26:07] >> so they're going to have to get us a new [1:26:08] public health letter regarding their [1:26:10] septic systems. So, there's quite a few [1:26:12] things that they're they're going to [1:26:14] have to do a new [1:26:16] and we're still having we're having [1:26:19] difficulties getting a hold of [1:26:20] responsible parties uh in this process [1:26:24] with that group that get somebody who's [1:26:27] willing to [1:26:30] >> but they won't be able to sell them [1:26:31] because even though they've been [1:26:34] technically approved, they haven't been [1:26:37] recorded. So, they can't sell them [1:26:38] anyways. [1:26:39] >> That's correct. Other than the two, the [1:26:41] first two they did, they could they [1:26:43] could sell those, but the rest they [1:26:44] can't they can't sell. [1:26:46] >> Well, one of these was they were pushing [1:26:49] to buy one of the second phase lots to [1:26:52] merge it with the first phase lot, if [1:26:54] you remember. Um, and that obviously [1:26:56] didn't happen because we never got that [1:26:59] recorded. So, apparently, I'm guessing [1:27:02] those those buyers have have backed out [1:27:04] completely. So, but septic was an issue [1:27:08] with these. And I appreciate that you [1:27:10] staying on top of that because that was one of the things that we [1:27:13] looked at when when they brought that [1:27:15] because that was still under the council [1:27:17] at the time [1:27:19] >> and and so it was kind of a dual [1:27:22] planning planning commission and [1:27:23] council. Um, but they still [1:29:28] got some infrastructure work that they [1:29:30] need to do. [1:29:31] >> So with the phase A and B when they [1:29:35] connected that didn't stop phase A. Do we put a lean on the property so [1:30:41] that the new homeowners know it's [1:30:42] there's not it's not in compliance. What [1:30:45] do we do? Because there is a home that's [1:30:46] for sale on Maple right now, but has a [1:30:49] lot of issues and [1:30:51] >> I've gotten some calls from the [1:30:52] neighbors asking about that. Um, [1:31:05] about 60 days or so ago, [1:31:09] they got another letter uh advising them [1:31:13] to clean the property up. They haven't t [1:31:16] make made any effort to do that. Uh, [1:31:20] starting around 30 days ago, it was a [1:31:23] deadline given to them and for that from [1:31:26] that point they are incurring $500 a day [1:31:32] in [1:31:34] fines. So [1:32:10] the first I let it go for 30 days and [1:32:13] then we took and filed a notice of lean [1:32:17] with the county [1:32:19] uh to inform them and it's recorded [1:32:21] against that property and I sent a copy [1:32:24] to them as well. Now we'll wait another [1:32:29] 30 days and we'll add to that then the [1:32:32] continued $500 a day fine. [1:32:36] So right now I think it was around [1:32:39] $13,000 [1:32:41] something like that for for fine for [1:32:44] these and they I'm a little surprised [1:32:47] they haven't talked to me about that. We [1:32:49] we've had we have pretty good open [1:32:52] communication with things. Um but I if [1:32:56] they clear one thing up then it'll be [1:32:59] $100 a day less [1:33:01] >> and as time goes on but they're still [1:33:04] obligated for what they recruit up to [1:33:07] that point. Uh, though we had a fabulous month [1:37:07] last month with uh SCSD. The electric [1:37:12] came in at like Usually we're paying [1:37:15] around 10 to 15 cents per kilowatt. Um [1:37:20] and we were down to like seven. Um which [1:37:23] really helps. So Jody, when we get the [1:37:25] bill for the water pump, there won't be [1:37:28] the AP whatever e on it. So that will [1:37:32] help also with city costs and in that [1:37:35] front. So, [1:37:37] uh, the dry tree trans the dry creek [1:37:40] transfer station also, um, nothing [1:37:42] really to report there beyond the fact [1:37:45] that we did get the full fire report in [1:37:47] my last board meeting there. So they put a a virtual meeting together. [1:43:14] Um and just for everybody's [1:43:17] thought, we we they voted on our our [1:43:21] contributions to SUVA. Um basically [1:43:23] we're if I remember right, I was going [1:43:25] to bring it, but didn't have time to go [1:43:27] home. Um I believe we're about 1.25%. [1:43:30] Um and we've stayed there. It's it's [1:43:32] exactly the same that it was last year. [1:43:34] I checked that. Um, but they're looking [1:43:38] and and we've talked about it before, [1:43:40] but now it's getting a little bit more [1:43:42] serious um at dissolving SUMA [1:43:48] um and rolling those possibly rolling [1:43:52] this the stuff that Suma does into Mount [1:43:55] Nebo and Central. [1:43:57] There are a few [1:43:59] things that they have to look at. So, [1:44:01] they're going to be relying on the [1:44:02] technical committee, which Ted is on [1:44:03] that technical committee. Um, so they're [1:44:05] going to be pulling that in our next [1:44:07] meeting and and officially setting that [1:44:09] up to to have the technical committee [1:44:11] start working on can we still cover [1:44:15] everything in Sumba [1:44:18] through Mount Nebo. Um, and the the [1:44:22] outlier is Springville. Springville is [1:44:24] not in Mount Nebo. Um and then there are [1:44:27] some you know selling of water is one of [1:44:30] the reasons we we've got suma is selling [1:44:32] those water shares to each other [1:44:35] basically trading not making money on [1:44:36] them. Nobody's making money on them but [1:44:38] being able to to do that and we needed a [1:44:41] legal way to do that and central is [1:44:42] happy to help work with us on that is [1:44:45] one of the things that we talked about. That's [1:46:12] kind of what the the push is for [1:46:15] constantly. So are they so these two [1:46:19] organizations are pushing they're one of [1:46:22] the big ones pushing for the state to [1:46:25] >> zoning [1:46:25] >> take everything away from us correct [1:46:28] >> and are you to sit there and push [1:46:30] against them [1:46:33] both sides fully that way but it's it's [1:46:36] more committee meetings I I serve on the [1:46:38] government affairs side which is totally [1:46:40] appropriate so um Salem actually has [1:46:44] representation there vineyard [1:46:46] Um so yeah there are a lot of cities [1:46:48] that are there saying hey this is what [1:46:50] we can do. What I feel there's more an [1:46:53] air of during those is uh collaboration [1:46:55] and hey this is why we do what we do. [1:46:58] This is what our threats are and so we [1:47:00] kind of come to the point during those [1:47:02] meetings of hey this isn't a problem we [1:47:06] need to worry about putting our time [1:47:08] into. [1:47:09] >> If you ever perceive or hear anything [1:47:11] there you're like that's a really good [1:47:12] idea and it's different than what we're [1:47:14] doing. [1:47:15] let us know. And that can be, you know, [1:47:17] on the staff side or that can be in this [1:47:20] meeting, whichever works. [1:47:21] >> It's kind of similar what Carrie does [1:47:23] with the legislator. I mean, I think the [1:47:39] biggest topics of all continue to be [1:47:41] housing shortages and affordability and [1:47:45] so there's just a lot of pushes from [1:47:47] every angle to get um more housing and [1:47:50] more affordable housing. [1:47:51] >> Are they pushing then for higher [1:47:53] density? You say affordable. [1:47:55] >> Yeah. [1:47:56] >> Uh yeah, I mean that that's definitely one of the pieces [1:47:59] because if you look at development land [1:48:02] is by by far the largest percent cost of [1:48:08] So, [1:48:09] of a new home. Um, and land sellers are [1:48:14] getting what they want out of it. They [1:48:15] can still keep doing it. But, uh, I I [1:48:18] think that, you know, there are a couple [1:48:20] cities where permit fees, impact fees, [1:48:23] those are all being evaluated constantly [1:48:25] by the state, which is which is good [1:48:27] because there are some cities [1:48:28] >> you have to go through that. And that's [1:48:30] when a lot of times builders will say, [1:48:31] "Well, this city has such high impact [1:48:33] fees, but by law, we have to go through [1:48:35] that process and we can't charge more [1:48:37] than than um we need." And so although [1:48:42] it it's different for each city, it does [1:48:44] go through the process. One of the [1:48:46] things that I think is interesting is [1:48:48] that they say they want um that there's [1:48:51] a housing shortage and they want more [1:48:52] affordable housing, but they're not [1:48:54] building that. [1:48:55] >> That's not what they're building, no [1:48:55] matter what the lot size is. the um a [1:48:58] study just came out. Utah has the second [1:49:01] um largest homes in the nation. [1:49:04] Wyoming's first and we're second. And [1:49:06] so, um, is there really a demand for [1:49:09] that or is it just that, oh, we want the [1:49:13] high density or we want these large [1:49:15] homes and there's no middle ground. That [1:49:17] missing middle is what really what we [1:49:19] talk about a lot at the league meetings [1:49:22] and um if are are developers willing to [1:49:25] look at that missing middle? [1:49:28] >> Yeah. Yeah. Developers absolutely are. [1:49:30] In fact, as a developer, I prefer [1:49:33] the more affordable. I prefer smaller, [1:49:35] more volume because that's it's it's the [1:49:38] Walmart philosophy. I want to build more [1:49:41] um less cost rather than huge. Now there [1:49:44] are the customs that want to do the big [1:49:46] huge stuff, but most of the production [1:49:49] builders, the Dr. Horts, the Lenards, [1:49:51] the David Weeklys, um those are all [1:49:54] looking at the same format. If they can [1:49:56] get density, they will take that all day [1:49:58] long. That density is what provides them [1:50:00] the affordability. Because again, if I [1:50:03] buy um an acre for 500,000 [1:50:07] and I can only put two houses on that, [1:50:10] then it's a very different cost analysis [1:50:13] than if I can put six to eight on it, [1:50:15] same acre, right? And so I can't absorb [1:50:18] that same 500,000 across six to eight, [1:50:21] I'm now absorbing that across [1:50:23] >> one or two. [1:50:24] >> So, so, so there's two sides of it. And I understand that a lot of that [1:50:28] comes from, hey, we we want to protect [1:50:31] our density. We want to protect our open [1:50:32] space. It's how do we do that [1:50:34] strategically? And we're going to be [1:50:36] having a lot of those discussions as [1:50:38] more and more eyeballs hit this [1:50:40] flatlands down at the the base where [1:50:42] we're going to have to be ready to say, [1:50:44] "No, this isn't functional for our [1:50:46] city." [1:50:46] >> And that's one thing that I hear from [1:50:47] legislators. Oh, you're from Woodland [1:50:49] Hills. um you're not even trying to help [1:50:52] with this problem because your zoning [1:50:55] remains large lots and that's one of the [1:50:58] things that then the developers will [1:51:00] keep pushing for statewide zoning so [1:51:03] that we would have no control over what [1:51:05] our lot sizes are. [1:51:06] >> Guess we better get them all built first [1:51:08] and then [1:51:10] >> out of room. [1:51:11] >> Yeah. Out of land. [1:51:12] >> Out of land. Well, even if they did [1:51:14] that, if somebody has has an acre and [1:51:17] they've built on one side of their acre, [1:51:19] then they would be able to subdivide and [1:51:21] build on the other half with this new [1:51:23] law if it came to be. Um, and we don't want to [1:55:24] overburden the city pages, but it's our [1:55:28] big event, so you're going to probably [1:55:29] as we roll up to it, it'll get more and [1:55:31] more. Lots lots [2:04:54] went on. Um, I did send a flyer to Janet [2:04:58] and Jody about putting um something in [2:05:01] the newsletter. They're having a big [2:05:03] event on September 24th. Um it always is [2:05:07] um a lot of people come can adopt pets, [2:05:09] etc. Um the other things that we talked [2:05:12] about was um we approved um an agreement [2:05:17] with Utah County for legal services. [2:05:19] There's been an increase in legal [2:05:21] services. Um and so we've done that and that was good. Um, also Spring Lake, [2:05:28] as you know, just incorporated um and [2:05:30] has a new mayor and council and they've [2:05:32] asked to join. So, they're going to be [2:05:34] joining soon there. And because of that, [2:05:37] then we're going to update the existing [2:05:40] interlocal agreements with all the [2:05:41] participating partners. Probably won't [2:05:43] change much, but since now we have some [2:05:45] legal counsel, they can look that over, [2:05:47] make sure everything's in compliance [2:05:48] with state law, etc. Um, [2:05:52] the other thing is, um, [2:05:56] got to look through my notes here. Um, [2:05:58] we had a 95% save rate for dogs and 87% [2:06:02] save rate for cats for the month of [2:06:04] July. Um, those that are not saved are [2:06:08] mostly those who have been injured or [2:06:10] who are really sick. If an animal comes [2:06:12] in that is aggressive and is in there [2:06:14] because they've been biting people, they [2:06:17] can't um, adopt them out. Um and so [2:06:20] there are some other issues. Um we're [2:06:23] also working on um [2:06:27] there's a big issue that's happening [2:06:29] right now and it's kind of like the [2:06:31] equivalent to human trafficking but with [2:06:33] animals from other states that are [2:06:35] coming through and Department of [2:06:37] Agriculture is supposed to be stopping [2:06:39] them at the border and they're supposed [2:06:41] to be showing the paperwork that they [2:06:42] have their shots and they have [2:06:43] everything and and it's good and they [2:06:45] can come to our state. The problem is is [2:06:47] that we don't know where they go and a [2:06:50] lot of them don't stop. And so there was [2:06:52] a big influx of of animals that came [2:06:55] from Texas after a disaster down there. [2:06:58] And it was found that they had screworm [2:07:00] and heartworm which are both [2:07:02] transferable to humans and to other [2:07:04] animals. And so the vets have seen an [2:07:07] increase in um in having to euthanize [2:07:11] some some pets. We haven't got any stats [2:07:14] on if it's been transferred to people [2:07:16] yet. Of course, we have medical things [2:07:18] that can help us get through them. And [2:07:20] the medical community might not even [2:07:22] know that it might be because of this. [2:07:24] There might there'sn't been a [2:07:25] correlation yet, but um there's no [2:07:28] accountability right now. And a lot of [2:07:30] times um the catch and release, they'll [2:07:34] they stay in neuterm but they don't [2:07:36] treat their disease. And so they're [2:07:38] letting them go into the communities. [2:07:40] And so some of our communities around us [2:07:43] are noticing an increase in in this um [2:07:47] this issue. So we're supposed to notice [2:07:50] if any of our residents call and say my [2:07:53] dog or my cat's throwing up blood or [2:07:55] something like that so that um so that [2:07:58] they the shelter is aware of where this [2:08:01] might have been spread to. And then um [2:08:04] working with department of agriculture [2:08:07] to have some accountability there um [2:08:10] because it does can affect humans and [2:08:13] livestock. So some of the livestock out [2:08:15] on the west side has been affected by [2:08:18] this. So that's those are the things [2:08:21] that we talked about. There was an art [2:08:23] there was um something done by Alex [2:08:26] Carrero uh a news report about this [2:08:28] recently and so it's kind of been more [2:08:31] in the news lately but some people just [2:08:34] haven't uh noticed but um the animal [2:08:37] shelter we're doing some some good [2:08:39] things. We're going to also oh one thing [2:08:41] I forgot they updated their website and [2:08:43] they also have a new license website. [2:08:46] So, if you have licensed your animal [2:08:48] like you're supposed to and your animal [2:08:50] is lost, in addition to our Woodland [2:08:52] Hills page where you can put your [2:08:54] picture and say, "Has anybody seen my [2:08:56] dog or my cat?" Um, you can go on there [2:08:58] and they'll they'll put pictures of [2:09:00] animals that have been brought in in [2:09:02] case it's yours. You can just go on that [2:09:04] website and see the picture and say, [2:09:06] "Ah, get down there. It's there." And [2:09:09] so, because not everybody who license [2:09:11] their cat or dog gets it chipped. If [2:09:14] it's chipped, they can call you. If it's [2:09:15] not, then you just have to look.
