[0:10] Good evening. It's called to order for the Barrow Planning Commission meeting. Thursday, September 17th, 2026. Just a reminder, all of the items that are heard tonight will be heard at the Board of Commissioners meeting, which will be held in the same room on October 13th at 6 o'clock.
[0:30] Tommy, will you do the invocation? Let's pray. Father, I thank you for the opportunity to serve in our great community, our great county.
[0:39] May I ask your blessings on the decisions they're made here tonight, guide and lead us.
[0:45] We pray for our military, all of our service workers in our county, our teachers, our
[0:55] students in this year.
[0:57] Bless them all, Father, as we give you thanks for it all, and Christ, name our pray, amen.
[1:03] You please stand for the Pledge of Allegiance.
[1:05] I
[1:08] pledge allegiance to the flag of the United States of America and to the Republic for which
[1:14] it stands, one nation under God, indivisible, with liberty and justice for all.
[1:25] At this time we'll have a roll call and we'll start on our right.
[1:29] I'm Joe Van District 1.
[1:32] Hill Caulvin District 2.
[1:34] David Dyer at large.
[1:36] Jimmy Abdu District 4.
[1:37] of Tommy Slapy district five.
[1:41] This time we will have approval of the minutes
[1:43] if everyone has looked at the minutes,
[1:45] any additions or corrections that should be made.
[1:48] I make a motion that we approve the minutes
[1:50] from the August 20th, 2026 meeting.
[1:53] I'll suck at that.
[1:55] We have a motion by one, a second, by five.
[1:58] Any discussion?
[1:59] All those in favor raise your hand.
[2:02] And we'll move on to the public hearing procedures.
[2:05] Thank you, sir.
[2:05] So when you come to the podium, please state your name and address for the record.
[2:10] Each side will have 10 minutes.
[2:11] The applicant will go first and follow by those in favor of the request.
[2:18] And then after that, those in opposition will be given an opportunity to go.
[2:21] Again, 10 minutes per side, any time not used by the applicant's side can be reserved for a rebuttal.
[2:30] Thank you. At this time we will go to the public hearing agenda.
[2:37] Our first case before you tonight is VOC 2026-007-5. This is Mac and parcel number XX029-090,
[2:47] also known as 615 Blackstock Road. Key engineering solutions is the applicant,
[2:52] billed-wise enterprise LLC is owner. This is a request to rezone plus or minus six
[2:58] acres from agricultural to R1, low-density single-family residential along
[3:04] with a variance request UDC section 89402 for minimum road frontage for a
[3:09] minor subdivision and UDC section 891186 for share driveway length exceeding
[3:15] 100 feet. At this time we will open the public hearing for this request. Anyone in
[3:20] favor of this request.
[3:26] Good evening. I'm the applicant, David Saunders 2847 North
[3:30] Bogan Road in Buford. I just wanted to say that I had a chance to review all the recommended
[3:38] conditions and we don't have any issues with that but I wanted to present myself to answer
[3:43] any questions that you might have and available.
[3:52] Thank you. Anyone else to speak in favor of this
[3:55] request.
[3:59] Anyone to speak in opposition?
[4:07] Hearing none, we'll close the public game for this request, and we'll move to the commissioners
[4:10] for comments or questions.
[4:20] So I just have one question that we're going from agriculture to R1 low density, and one
[4:28] of the requirements from the staff is that each property shall have a minimum of 3,000 square
[4:36] feet of heated, gross floor space.
[4:38] Is that understood and okayed?
[4:39] That is understood.
[4:40] Yes, okay.
[4:45] You know the questions I'll make a motion to approve it based on staff recommendations with the eight conditions and
[4:58] I and I would add to that approval
[5:00] Of the variants to UDC Section 89-402 for a minimum road frontage for the proposed four-lot minor subdivision. Let me amend mine and say that it clues the variance. We have a motion for five from District five for approval of the rezone and the two variances. I second. We have a second by District one. Any discussion. All in favor of this, raise your hand. Anyone opposed? We'll move on to the next period.
[5:29] The next case before you join us BOC 2026-000080.
[5:37] This is map and parcel number X-052-106-113-114-115-116-116A-116B-116C and 118.
[5:53] Addresses are also 0, 726, 740, 790, 797, Hazel Moon Road, and 976 Carb Bethlehem Road.
[6:04] Republic Services is the applicant and owner.
[6:07] This is a special use request to UDC Section 8919D for a plus or minus 133.99 acre expansion
[6:17] of the existing landfill, along with the future land use map amendment to parcels XX
[6:22] 6-0-5-2-106 and 115 to rule neighborhood to allow for a rezoning consisting of plus or minus 5.18 acres from AR agricultural residential to agricultural for the expansion.
[6:39] At this time we will open the public hearing for this request. Anyone here to speak in favor?
[6:47] Good evening. My name is Brad Martin, 1042, Pathview Court, Mulberry, Georgia.
[6:54] I serve as a municipal services manager with Republic Services of Georgia and my role
[7:00] I work closely with municipalities and on infrastructure and community development initiatives.
[7:06] Republic Services is proudly partnered with Barrow County for more than 30 years, providing
[7:11] reliable solid waste management solutions and supporting the county's continued growth.
[7:16] I appreciate the opportunity to appear before you this evening and introduce our team as part
[7:20] of this public hearing regarding our application for rezoning, especially use approval for the
[7:25] Europe Grow Glantville. We believe that our application satisfies the applicable requirements
[7:31] of the Barrow County zoning ordinance and all relevant performance standards. As a long-time
[7:37] community partner in stewart of this facility we recognize the significance of the decision before
[7:42] you. We understand the impact it will have on local residents, businesses and the future growth of
[7:47] not only the county but the surrounding region.
[7:51] As an organization, we're committed to operating responsibly,
[7:55] transparently and in a manner that continues to serve
[7:57] the best interests of our community.
[8:00] At this time, I'd like to turn the podium over
[8:01] to Jeremiah Goodnight, who's our general manager
[8:04] for the Oakland Phil, and he's gonna provide
[8:07] a brief presentation on the project and our proposal.
[8:10] Again, thank you for your time, consideration,
[8:12] and thoughtful review of our application.
[8:15] Thank you.
[8:15] My
[8:19] name is Jeremiah Goodnight, I'm the general manager for Oak Grove Landfill at 967 Carl Bethlehem Road.
[8:25] One of the introduced responsible for all the operations and maintenance and upkeep of the site.
[8:31] I want to run through the quick PowerPoint presentation just to show what we're proposing.
[8:36] We are proposing an additional of this useful gain approximately 22 years of effective disposal capacity to the region.
[8:43] We're not proposing any changes to the height of the facility, we're not increasing the trucks that will be running into the site through the expansion, just maintaining what we have.
[8:53] We will continue to meet the strict environmental standards set forth by EPD and all the rules and regulations therewith, and then continue to support the counting in the community and host fees and various opportunities that we have in being good neighbors and good partners.
[9:08] Yes, so the O-grove, as it sits now, we currently have 102 acres permitted for disposal.
[9:13] Within there are 239 gas wells, 42 groundwater wells.
[9:18] We receive approximately 500,000 tons annually.
[9:22] As Brad mentioned, we've been in the community 30 years.
[9:25] As it sits currently without this expansion, we're five and a half years left of landfill capacity in the region.
[9:30] It is an important asset in disposal capacity throughout the region in Northeast Georgia.
[9:37] The 133 acres that we're proposing of that approximately 44 will be for disposal.
[9:43] The rest will be for relocation of a landfill gas to energy plant of which generates
[9:48] approximately 6.6 million, 6.6 megawatts that can power up to 4,200 homes.
[9:55] So we'll have to relocate some of that with the expansion.
[9:57] So, there's a map showing ...
[10:00] Where we're proposing to go and how the expansion will add on to the end of the landfill.
[10:06] You know, we're using the existing entrance. We're not proposing any additional traffic or any change in how the flow is now with the exception of Carl Bethlehem road, but plan on using Bill Retledge Winder bypass for any future truck traffic. We can go to the next one. So kind of, you know, summarize it here. The trucks will continue to use the traffic patterns they are with Carl Bethlehem pinchly closing. They'll then come off the Bill Retledge.
[10:31] wind or bypass to access the landfill. We're continuing to monitor and take our responsibility
[10:38] of stewards of the environment and the county and the region and the community we support
[10:42] very seriously and hold ourselves to a high standard. We're proposing that there will
[10:48] be no increase noise, no change in what we're doing. It's really maintaining an existence
[10:53] and extending that life of the site.
[10:58] All the anything that comes out of the landfill
[11:00] We'll continue to be managed as we're doing it now with EPD standards and treating it appropriately.
[11:05] In addition, at the end of the expansion project, we'll install a six foot security fence around the perimeter to separate the where we're at on the expansion.
[11:15] And make sure that we have a 200 foot buffer around all the property and adjacent parcels.
[11:19] So we just appreciate the opportunity and thank you for your time.
[11:24] We have it engineers, if we have any additional questions that come up.
[11:36] I have a couple questions.
[11:38] The gas is, that's methane, and how do you transport that to Georgia power?
[11:46] So on site, we have a landfill gas to energy plants, so we provide it to them, and then
[11:51] they use it to spend engines that create electricity and send it back to the grid.
[11:54] We have a partner that handles that part of the gas.
[11:56] That goes to the grid.
[11:58] Yeah, it's on the, yeah, the planet on the site, but it goes to the grid after that.
[12:01] And just another question that doesn't have a whole lot to do with your request or application,
[12:07] but a couple of years ago, the Southern Company discovered that there is a large cavern
[12:14] between Alabama and Mississippi that runs all the way to Florida, they named it the Tuscaloosa
[12:19] cavern, and their idea was they were going to take all this CO2 and pump it underground,
[12:25] so it wouldn't be a greenhouse gas. And my wife asks, well, what are we going to do
[12:30] at the end of 300 years because that's the capacity that Southern Company said that that Tuscaloosa cavern will last.
[12:38] So, I didn't answer a question, but you say this will last in 22 more years?
[12:45] That's correct. Is that on top of the five?
[12:47] That's right. Now? Yes. Okay. Thanks. Yes, sir.
[12:57] Thank you.
[12:58] Anybody else to speak in favor?
[13:04] Hearing none, anyone to speak in opposition?
[13:07] You have to come forward, name and address please.
[13:17] I'm a 681 Tucker Road, Winder, Georgia.
[13:20] I don't know if I'm really in opposition, but I have a lot of questions because my property
[13:25] backs up to the landfill.
[13:27] I need to understand what type of barrier there's going to be for noise, odor, pest control.
[13:37] I've had to deal with rats.
[13:40] that were really bad several years ago. I also had a business on Tucker Road
[13:45] and had to replace a great deal of the equipment in my business due to the
[13:48] rat investigation. I'd like to understand what type of visual impact it's
[13:53] going to be from my home and what it's going to do the value of my home. Is
[13:59] there going to be compensation for the value that I lose? Am I going to get a
[14:03] break on my taxes? And I think he said it's going to be for 27 more years that
[14:09] That's concerning as well.
[14:13] I think that's it.
[14:14] Okay, thank you.
[14:17] Any rebuttal, well, well, first of all,
[14:19] is there anyone else to speak in opposition?
[14:25] Hearing none, any rebuttal from,
[14:27] would you want to have a few minutes to address
[14:29] any of those concerns?
[14:31] Are you going to take that off grid?
[14:38] Is Daniel Cheek and our office is 39, 20,
[14:42] Arcrite Road in Macon, Georgia,
[14:44] and I work for Hodges Harbin, New Bury and Trouble,
[14:46] and we're the design and permitting engineer
[14:48] for Republic Services on Oak Grove Landfill
[14:50] and then we're sorry when it feels and I think I got everything that she
[14:54] mentioned so I'll touch on those and then if you'll have any other follow up
[14:57] questions on the property
[15:00] There was a separate independent land evaluation study that was done by Kirkland appraisals that is included in the application, and it concluded that there was no impact to adjacent property land values. On the noise a question, we did have another independent consultant, BBE engineering conduct a noise survey using eight, they deployed eight survey monitors, and essentially we're detecting operational equipment and operational
[15:29] activities of the landfill. Since this is just extending the life of the landfill, we don't
[15:34] really expect there to be any increase in noise. Obviously the landfill's expansion will
[15:38] be proposed to go to the southeast, but there should be no increase in noise and the noise
[15:44] study concluded that the operational sound levels were within acceptable limits, and there's
[15:49] no issue with that. In fact, it picked up more noise along Karl Bethlehem Road with traffic
[15:54] than it does from the landfill.
[15:57] On odor, the application also includes the Georgia EPD approved odor management plan.
[16:05] Some of the things that they've already touched on is the gas energy plant and the gas collection
[16:09] system that let landfills required to have in the expansion will also be required to have.
[16:15] Other other other mitigation tools are managing the size of the working base as well as daily
[16:22] cover and just, you know, operational, you know, good housekeeping practices that they
[16:26] currently employ.
[16:30] Buffers, there is a required natural undisturbed 200-foot buffer that goes around the entire
[16:36] property.
[16:37] I believe in the southeast early, south direction, the closest homes to the boundary were roughly
[16:47] 140 feet to the property, but then there would be another 200 feet, so 340 feet before
[16:54] you're outside the buffer, but to the landfill disposable, the proposed footprint, it would
[16:59] be 550 to 590 feet.
[17:02] So the current buffers and screening will be the natural areas, we're obviously bound
[17:08] to the east by the Georgia Transmission Line, to the south by the Colonial Pipeline, so
[17:14] we're not going to go beyond that.
[17:16] And is regarding the statics, the proposed expansion will not raise the height of the landfill.
[17:22] It will just lay up against an adjacent to it.
[17:26] So I'll stop there if there's any other questions.
[17:28] Save more time for rebuttal.
[17:31] Thank you.
[17:37] If there aren't any other questions, I'll close the public hearing on this request,
[17:41] and then open it up for comments or questions.
[17:43] And I have a quick question.
[17:45] I know this may be something you can't say on a brief basis.
[17:48] is what, how often is the EPD checking in?
[17:58] How often do they come and inspect?
[18:00] How often are their fails they've put in place?
[18:04] How often are you monitored?
[18:05] I guess it's a good way to put it.
[18:11] Kind of as needed, but it's at least semi-annually
[18:14] they perform inspections.
[18:15] They come in and check the site out.
[18:17] Additionally, if there were complaints or something
[18:19] serious of a nature, they would make unannounced visits
[18:22] that's in visit our site.
[18:23] We also have quarterly monitoring on all the gas wells
[18:26] and reporting that we're checking it monthly,
[18:28] but also then reporting it to the state quarterly
[18:31] and annually isn't needed.
[18:34] Oh, Europe, I've got a question.
[18:36] I understand there's not much you can do
[18:38] with the cleared area of the Georgia power easement
[18:41] or the gas easement, those are all just grass basically.
[18:46] Is any other thing that y'all are planning to do
[18:49] You own the part you can control as a buffer with planning.
[18:54] With planning?
[18:55] With planning of trees or?
[18:57] Like a vegetation.
[18:58] Yeah, I think vegetation.
[19:00] Yeah, what's existing will stay and not disturb that and leave it as it is.
[19:04] So if there's already a buffer there.
[19:07] We don't want what's there to disturb a bit of needed.
[19:10] We'd like to see some added if needed.
[19:12] Okay.
[19:13] Yeah, we'll see.
[19:14] Yeah, please.
[19:18] Can you get back to the site map on the screen?
[19:21] The area to the southeast on the other side of the Georgia transmission is a separate independent surface mine, and it's under reclamation and they planted pine trees there.
[19:30] So that whole stand will be full of pine trees, except for what area they might need for the gas energy or a sediment pond, but there are going to be planted ponds on that area.
[19:39] I have a question as well while you're up.
[19:41] You said you don't expect any extra additional noise during this expansion.
[19:46] What does construction of this landfill look like and what kind of noise could be expected
[19:50] as far as like getting it to the point of operational?
[19:54] It's just going to be heavy equipment that you used to handle the trash, whether it's
[19:58] That's it for us, compactors, bulldozers.
[20:00] But we're not increasing, we're not proposing to increase the tonage specific to the landfill footprint. So the same equipment that operates today will be the same equipment operating in this future area. And so, you know, it's mostly going to be backup alarms from what you hear if they're backing up. Okay. So if I understand you correctly, the equipment that's operating today is heavy equipment as in like, you know, excavators, bulldozers. Like you said, those equipments are an operation daily now. Correct. And nothing will change moving forward. If this is approved. Correct. Okay. Thank you.
[20:28] Any
[20:35] other questions?
[20:42] Any none.
[20:43] We'll call for a motion.
[20:52] So I don't know when this landfill was first established, but these are needed facilities.
[21:03] And it may not be a park or Disneyland or something that we want, but it's something that is necessary.
[21:14] And so I would make a motion that we would approve the rezoning, that we would approve the
[21:22] change of the future land use map amendment from suburban residential to rural neighborhood,
[21:29] also that we approve the request to rezone 5.18 plus or minus acres from AR to AG, comprised
[21:40] The rise of the parcels that Rebecca read early on.
[21:45] And I also recommend that we approve the special use request to UDC section 89190, sub paragraph D.
[21:57] Is that with the staff recommendations as well?
[22:01] We have a motion of a district one.
[22:06] I agree with you, Mr. Joe, it may not be something that you may want, but it's something that's necessary in order for us, so I will second that motion.
[22:12] You have a second by district four any discussion hearing
[22:19] none all in favor of the motion raise your hand
[22:22] Anyone in opposition
[22:24] The motion passes our next case tonight is our next case tonight is B.O.C.
[22:33] 2026
[22:34] 0 0 0 8 4
[22:36] mapping parcel number x x 125 0 7 4 and 0 7 5
[22:42] This is 2015 and 2021 TALICY RAID or Highway 82 in town homebuilders is the applicant Douglas
[22:51] and Don Cole or the owners.
[22:54] This is a request to re-zone plus or minus 4.41 acres from agricultural and agricultural
[22:59] residential to R1, low density single-family residential for a lot reconfiguration and
[23:06] split.
[23:08] This time we will open the public hearing for this request.
[23:11] Anyone here to speak in favor of this request?
[23:18] My name is Randy Wallace.
[23:19] I'm an address 506 carriage drive in Bethlehem.
[23:24] And I'm not sure what all is Rebecca.
[23:26] Yeah, I'm not sure what all is she just mentioned.
[23:29] It's kind of hard to hear out here.
[23:30] But I'm just going to reiterate that what we're doing here
[23:32] is done on the property.
[23:35] They own two lots here.
[23:36] And they've got their daughter living in the second lot.
[23:38] And then their other daughter wants to live on the third lot.
[23:42] And so that's what we're asking is that we rezone the second lot,
[23:45] which is two point something acres and we'll be able to divide it into two parcels by combining
[23:52] all three of the parcels we can have three virtually equal parcels side by side and then we're
[23:58] asking to rezone this to R1 and I don't know if it's been mentioned or noticed but there is actually
[24:04] a subdivision just to the right of what that map is to the to the left of what that map's showing
[24:10] and that subdivision is an R1 subdivision there's other R1 properties that are
[24:14] surrounding the property as well.
[24:16] In fact, the property just to the right, I believe,
[24:18] is all so zoned R1.
[24:19] And so we're asking if we can do that
[24:21] in order to be able to build the house
[24:24] for Cam and his wife,
[24:26] and then the family can be able
[24:29] to live together on this partial.
[24:32] Thank you.
[24:33] And we've also done the septic studies.
[24:35] We've gotten the approval,
[24:36] and we've gotten the soils
[24:39] so that we know that everything is going to be able
[24:41] to be done properly.
[24:43] Thank you.
[24:45] Anyone else to speak in favor of this request?
[24:51] Anyone to speak in opposition?
[24:57] No, now close the public hearing for this request.
[25:00] And we will move it to the commissioners for comments or questions.
[25:05] I'll make a motion that we approve it. Based on staff recommendations. I'll second that motion. Is that with the conditions? We've a motion by five and a second by district four. Any discussion?
[25:21] All those in favor of the motion raise your hand. Anyone in opposition? That motion passes.
[25:30] BSC 2026-00085 is the next case. Map and parcel number.
[25:36] for XX-121-064. This is 1534 Hogg Mountain Road. Carter Engineering is the applicant,
[25:45] Whitestone Stables are the owners. This is a special use request to allow for a special
[25:50] event's venue. This time we will open the public hearing for this request. Anyone to speak
[25:56] in favor?
[26:00] Good evening, I'm Jeff Carter with Carter Engineering Consultants 1010 Commerce
[26:04] drive in Bogart representing white stone stables tonight. This parcel is a larger
[26:10] parcel. It's been under the same ownership for many, many years off hog mountain road.
[26:16] Currently there's a horse stable that used to house horses. There's no horses
[26:23] there now, but as you can imagine with the larger parcel like this there's a lot
[26:28] of maintenance, a lot of things that go into it and so the family has decided that
[26:33] that they want to have, what I call a low-key event venue,
[26:37] primarily for weddings.
[26:39] And so that's what we're asking to do tonight.
[26:43] As far as just the layout of the property,
[26:47] the horse tables are pretty much in the middle
[26:49] of the property, far away from residential properties.
[26:54] I actually measured, did a little bit of measuring today,
[26:57] and it's about 1,800 feet to the nearest residential
[27:02] to proper to the east and about 1,300 feet to the west.
[27:07] So the actual place where the events will take place
[27:10] or right around the horse stables,
[27:12] they don't plan to use the building,
[27:14] but what they do plan to do is bring in temporary tents,
[27:18] pole tents, and put them in the front yard.
[27:21] And so they would have parking,
[27:23] a shuttle service from the parking area
[27:26] to the actual events.
[27:29] They're not planning on using any buildings,
[27:31] They're not planning on building any buildings and so when I say low key this is they really it's very important to the family to keep this an agricultural
[27:42] You know property and so they just want to be able to have some some events here
[27:48] the
[27:49] The proposed use does satisfy and at least in our opinion the special use permit criteria for Barrow County
[27:57] the scale and the intensity of the use we feel is very appropriate for 165 acre parcel.
[28:03] We are requesting and it is a condition but we brought the request to limit it to 300
[28:09] people.
[28:10] So that will be the maximum number that would be at this event, a wedding event.
[28:16] And it's really kind of limited in use.
[28:18] It's like 40 events per year and that's going to be the cap.
[28:24] It really minimizes the use of the property, again, not any land disturbance per se, other
[28:29] than a little bit of parking area.
[28:32] And so it's clearly an accessory use.
[28:36] It's more agritourism the way that we look at this.
[28:41] And so as far as the staff recommendations met with the owner, who by the way the owner
[28:46] is here tonight is very important to their family.
[28:51] We did look through the staff recommendations, don't have any issues with the recommendation.
[28:56] We agree with all of them.
[28:58] Just a point of clarification on the number four with all parking areas, including
[29:05] approving and appropriateness, paving materials.
[29:08] What we do want, what we don't want to do is build a large asphalt parking lot and an agricultural
[29:15] area like this.
[29:16] So we are planning to use previous materials, grass-paved, that type of thing is worked really well in situations like this, and so, but as far as we recommend recommendations go, we're good with those and appreciate your support.
[29:32] I think this would really mean a lot to the family, and be glad to try to answer any questions that you may have, so thank you for your time.
[29:40] Thank you.
[29:44] Anyone else to speak in favor?
[29:46] Good
[29:51] evening, I'm Brian Tyson, 119 South Roscoe, Boulevard, Panavidra, Beach, Florida.
[29:58] As Jeff said,
[30:00] I'm a family member and a member of the LLC that owns the property. Just to give a little history,
[30:11] my father-in-law built it in, actually he swapped land for around 1990 and built the
[30:17] stables and was very successful breeding horses there. But post his device and then my mother
[30:25] lost the lives. My wife was able to get the land in trust and about three years ago we had
[30:33] reception there for our son and daughter-in-law they got married and some of the pictures you saw
[30:38] were from that event and it was a very successful no complaints no issues we employed off-duty deputies
[30:46] the managed traffic on Highway 53, Hogg Mountain Road. And again, it came off without a hitch.
[30:55] That's the tent that we used. If you look at that tent, you'll see why we want to host farm
[31:01] litings there.
[31:05] You know, as Jeff said, it's zoned agricultural. We have no intent of doing anything
[31:10] differently. We run cows, we lease the pasture there, and we cut hay there. Those operations
[31:18] will continue for the foreseeable future.
[31:21] My wife and I were speaking about it today and we don't see us doing anything differently
[31:26] than including these events if we're out of the rest of our lives.
[31:32] So it's our intent for it to stay its own ag and continue to operate it as a working
[31:37] farm.
[31:38] Thank you.
[31:39] Yes, that you're using the same footprint that's currently on the site.
[31:43] You're not using the building, you're using the same footprint, I mean it's in the same
[31:45] area of the property.
[31:46] Yes.
[31:47] So, if we go back to the, that's the stables, the tent that we used was that drive, you see
[31:56] the asphalt drive, it was just to the, to the right as we're facing the building.
[32:01] I cannot remember the dimensions of that tent, but it was huge.
[32:06] And it worked again, it worked out very well.
[32:09] We would put the size tents as required by the fire marshal to comply with life safety regulations.
[32:18] Again, we'll employ deputies for every event that we do off duty deputies to manage traffic.
[32:25] When we did it, we also used Midway Church, which is just down the road for people to park,
[32:32] and we understand all the parking will be on site going forward.
[32:36] Thank
[32:39] you.
[32:40] I have a question.
[32:42] You guys have seen a list of all the staff recommendations if it were to be approved, including number six with the talk of the environmental health issue with the on-site sewage management.
[32:53] And you guys are cool with that.
[32:54] Yes, we are.
[32:56] We don't, to be candid with you, we don't necessarily like it because the plan is to have really nice,
[33:03] It's a risk in facilities brought in with the storage tanks and then hauled off property.
[33:09] But in talking with the health department, that is not a possibility.
[33:13] And so yeah, we're okay with it.
[33:15] If you don't mind me asking, what is the plan for the sewage management?
[33:20] So we will have to get a health department permit and we will have to put a on-site septic system there.
[33:27] We've talked to the health department and that's just something that we'll have to do.
[33:32] You post, my understanding is hopefully we get the species permit, and then we'll go into
[33:38] permitting and deal with that at that time.
[33:41] Okay.
[33:41] Thank you.
[33:42] Is there, will there be a building built for this facility, or will you use the rolling
[33:47] trainers?
[33:49] So the plan right now, and of course we've got to get it from me with the health department,
[33:53] but the plan right now is there is a restroom in the horse stables, and so we don't want
[33:59] to use that necessarily, but that will be our on-site septic system there.
[34:05] And anything in excess of that, the health department has tentatively said the plan will
[34:10] be to use that restroom, but if you have a larger event to 300 people, you can use the
[34:15] temporary holding tanks that come with the restroom.
[34:18] So it's kind of a plan that we got to work out with the health department, but that's kind
[34:23] of what we're looking at.
[34:25] So yes, there will be a restroom there.
[34:27] Another question or two more, one has been in any discussion with the GDOT about turn lanes or any access to getting in and out of this property during 300 guests.
[34:41] So GDOT has been consulted about the project. We understand that we will have to get a GDOT permit.
[34:47] But what that entails, we're not sure yet, but we know we've got to work that out with them.
[34:53] So that will be kind of our next step after we get the, hopefully get the specials for now.
[34:57] Other question, there's a silent question from Mr.
[35:09] It's my understanding that the noise ordinance requires us to stop the music at 10.30, which is what we complied with when we did our event there three years ago. And I asked the sheriff post event if there were any complaints, he said no. And the subdivision that was referenced, Jeff referenced, which would be to the east. It was there then, fully occupied.
[35:33] as well as the other homes off to the west.
[35:36] So no complaints.
[35:37] Thank you.
[35:38] Thank you.
[35:39] So I have a couple questions.
[35:41] And with respect to noise, the Georgia Club, for example,
[35:44] which is right around the corner from this piece of property,
[35:46] they have weddings and venues in their houses that surround it.
[35:50] And that's all in Barrow County as well.
[35:53] So there doesn't seem to be a problem.
[35:57] This will remain zoned AG agriculture.
[36:00] but the events that you have there, will that be taxed as a business? Do you know the answer to that?
[36:08] So they will have to have a business license for the special for the wedding venue and I believe correct me if I'm wrong.
[36:15] I'm not in the tax assessor's office, but the weddings are the only events that do not risk the conservation use of the property.
[36:25] So under the tax assessor's office, they can have waiting events under the agricultural
[36:32] and still have their conservation use, but only waiting events.
[36:37] The term that I was given about two and a half years ago was farm weddings, so I asked
[36:44] what that meant, and it means you can have the rehearsal, the ceremony and the reception
[36:51] on site.
[36:52] And that's it.
[36:54] I do know that area pretty well and there is a lot of development with regard to homes
[37:00] in that area, which in my opinion and in talking to Matt at the school board, I think that
[37:09] the saturation with regard to the houses that are already there on the old McLaughlin property
[37:15] and across the street are going to be enough for them to handle as far as the school is concerned.
[37:22] and so I would think that they would be in favor of this.
[37:26] Also with regard to DOT, if you're going to have deputies there, they're going to have traffic directing.
[37:33] But you're probably going to just have you put in deceleration and acceleration lanes,
[37:39] which will help the cars if they're turning in, they don't have to hold traffic in one direction.
[37:45] But also on Hawkebatten Road, is it there also down the road a venue where they have rodeos or was there was but they don't have that anymore?
[37:57] Okay, all right, well I think I think you have a good idea.
[38:03] Anyone to speak in opposition to this request?
[38:10] Here in animal closely public hearing and we'll go to the commissioner's comments question.
[38:14] That's a quick question.
[38:16] You said it's limited to 40 events.
[38:18] Who monitors that?
[38:19] How's that monitored?
[38:25] So they will have to be limited that if there is a complaint
[38:29] and we realize that there are more than 40,
[38:32] then we'll basically, we could even come back to the board
[38:36] and have their license revoked for their special use
[38:39] revoked.
[38:40] OK, so you take the number of weddings
[38:42] and you subtract the number of divorces
[38:44] and you come up with 40. No, I'm teasing.
[38:47] I make a motion that, have we closed the public meeting?
[38:51] We closed.
[38:52] I make a motion that we approve the special use permit with regard to staff recommendations
[38:57] and especially the septic tank system that these guys already know about, and they're going
[39:02] to get some DOT input. So I think they're well on their way, and I like the idea of using
[39:08] the impervious materials and not putting a bunch of asphalt down.
[39:11] We have a motion from a district one.
[39:14] Second.
[39:15] Second by district two. Any discussion?
[39:19] All those in favor of the motion raise your hand.
[39:22] Anyone in opposition?
[39:24] That motion passes.
[39:26] The next case before you is BOC 2026-008007.
[39:32] This is my proposal number XX050C011.
[39:37] also known as 135 manufacturer's court.
[39:41] Madden next firm is the applicant,
[39:44] ADE 1, 2, 5, 0, LLC is the owner.
[39:48] This is a special use request to UDC section 89, 9, 9, 9
[39:52] to exceed the maximum of 25% in part of the service.
[39:56] This time, we will open the public hearing for this request.
[39:59] Anyone in favor?
[40:00] In favor of this request? Good evening, John Necks, Conor's Georgia. First time here, I will say this even might hurt me. This is the most efficient planning commission meeting I've been to in a decade. And he had a lot of topics, but not only were the people presenting really have their act together, but just really well conducted. This site, as you know, an office industrial park, it's 2.57 acres.
[40:29] It's situated in such a way on the property that sits in a bowl where they'll be doing
[40:34] the development because of the topography.
[40:37] So a lot of it that goes on here is not even going to be visually able to be seen from
[40:43] the road.
[40:44] They need the variance.
[40:47] As staff has recommended it in order to complete the site in the way they've planted on the
[40:52] conceptual plan.
[40:53] The user of this property is going to be dusty, grear, roofing.
[40:57] It's a commercial company that operates throughout the Southeastern United States.
[41:01] They're going to put an office on there and a warehouse and it's going to be their corporate headquarters.
[41:07] Most of the activity that comes out of this company is where their workers go all over the place in the country of Southeast to do the work.
[41:15] So the activity here is really going to be limited to their office operations and vehicles coming in out providing supplies that will get sent to projects but also supplies on site.
[41:27] They're going to have 18 parking spaces. It won't create a lot of traffic. We think it fits into the park and
[41:34] We'd appreciate you accepting the recommendation of staff.
[41:41] Any questions.
[41:44] Thank you. Thank you
[41:45] Anyone else to speak in favor of this request?
[41:52] Here you none anyone to speak in opposition here
[41:58] you none. We'll close the public hearing for its request
[42:00] Commissioner's comments questions.
[42:03] I've got a question. It's manufacturers court
[42:07] Does it dump out into
[42:10] 316. It dumps out into a four lane. The street does. It appears. It's it's
[42:17] off of highway. Atlanta highway. Is Atlanta highway. Okay. North of the
[42:22] photograph. It's the highway. Yes. All right. The entrance. I'm just I'm
[42:25] pulling our point out by God and I saw four lane out there.
[42:30] Divided highway.
[42:33] I'll make a motion. Thank you. I'll make a motion to approve the special use
[42:37] request and with the one single step condition.
[42:43] We have motion registrard four, seconded.
[42:46] Seconded, the district one.
[42:47] Any discussion?
[42:50] All those in favor of the motion raise your hand.
[42:53] Anyone in opposition?
[42:56] Motion passes.
[42:57] Do you have one right and three подпис the unorgated ?
[43:00] Well We are going to go to the motion row and props.
[43:04] Yeah.
[43:04] I will be on one could forget the politics whether or not you
[43:09] If we are ready that's the last that's the last item on the agenda and I'm ready to go home
[43:14] So I'm going to ask for a motion to adjourn
[43:17] I'll second motion but one second before all in favor
[43:22] Allie opposed
[43:24] Thank you
