And so, kind of wanted to just have a discussion with this more today on that, and, you know, perhaps,

And big and good enough to share some of their deal with us as we've looked at this and we've spent time with the division of drinking water

as well, and as we look at these numbers, I think our feeling is that in our concerns, when
[41:12]
you're talking about a project of this size, and this is really why we're here to not just
[41:18]
going through the process of, like, okay, here's our application analytics, let's go, because
[41:23]
for us, this isn't, you know, a hundred anchor, or a hundred units subdivision, where you kind of
[41:37]
water rights and of course, frankly, the wet water as well as well as represents millions of dollars.
[41:44]
So it's not a decision that we take lightly, which is why we're here wanting to discuss that with you.
[41:51]
And so as we've looked at the diversion ride for the dedication ride, as we've reviewed,
[41:56]
kind of where things are at it, it's our understanding and things may have changed by now again.
[42:00]
we don't have insight into everything that the goings on at the sport that our understanding
[42:07]
is that the last time that your system sizing was done with a specific drinking water was
[42:14]
in 2023 and every three years. Yeah, so it's about every three years that that comes
[42:20]
too with the division of drinking water. So it would be roughly time to update that again,
[42:25]
regardless of what is happening with us. And so as we've looked at your data and we've looked at
[42:34]
you know the amount of water that is giving to the meters of the youth factor in
[42:40]
you know source water, it's system loss. We understand that that's usually about a 10-15 percent
[42:46]
addition on top of what's going to the meters. What we would want to ask for as you think about
[42:53]
that system sizing is to look at your data
[42:57]
and revise that back down to what we feel
[43:02]
is a more appropriate dedication rate, that's 0.25.
[43:07]
And if you look at the next slide,
[43:10]
that's kind of where I'm getting that information.
[43:12]
That's basically your source water numbers
[43:17]
for glass two years.
[43:19]
And as we've understood it, the way that the current dedication rate of 0.34 is figured
[43:27]
is kind of based on how two things, the year 2020 was chosen as kind of the year that was
[43:35]
used to kind of develop the standard as we talked about this with the state, with the division
[43:40]
of drinking water, what they recommend is at least a three year kind of an average of years,
[43:46]
So that you don't get one year to sort of an anomaly.
[43:49]
And the year that the view is 2020, which happens to be
[43:53]
the highest year of usage over the last several years.
[43:59]
So if you look at kind of the graph right here,
[44:01]
you can see how much higher 2020 is than any of those other years.
[44:07]
The second piece of that is, as we understand it,
[44:10]
you have a 19% variability rate in terms of how
[44:14]
4.34 dedication rate is calculated in talking to the state position of drinking water, they've
[44:22]
actually done a way with variability rates. They're not, they're not something that they require cities
[44:27]
and water districts to add.
[44:32]
Well, okay, that's, that's not what we understand that we can, we can
[44:44]
I think our concern and then I'm trying to get to the punch line there guys because I know you're probably just being down there.

If you look at this page right here, I think our concern is as we think about, so I get it.

Back up here for a minute, I get a bit of district, as you've said, you know, needs to protect itself, needs to make sure that it has enough resources to serve its customers.

I guess as we've thought about this and we've looked at the data, it feels that to us that the diversion rate is a bit high.

And so as we, as from the outside of looking at these, we're not annexed yet, we, you know, we think of my faith that makes sense to do that.

But as from the outside of looking at, we're saying, is this a district that we want to be a part of, given what it would require in terms of, you know, paper water, investment in all of the infrastructure, whether that's well,

So we're a transmission all of that if the diversion rate is as high as it is, and so as we look at some of these numbers, the system loss rate that, you know, is how you get from your meter rate to your source rate is also quite high.

So we have some concerns, right?

any water district's going to have different things about

different situations that are going to make it tough.

I think our annexation would be contingent upon whatever sort of an agreement we can get with

board and with the district, I think we want to find a good agreement and a good way to work
[47:57]
with you all that works. And then the thought would be as we once were annexed, you know, so
[48:04]
it would be like let's have an agreement about what annexation looks like in terms of infrastructure
[48:10]
in terms of dedication rate. And then in terms of actually dedicating those paper water rights
[48:16]
to the districts, our plan that we would dedicate them
[48:20]
with each clap, with each residential clap.

And then I think this was something you brought
[48:25]
of actually what are our meetings,
[48:26]
when it comes to commercial.
[48:28]
What makes the most sense there, to us,
[48:31]
is a site of plant evaluation, because I think it was you
[48:34]
that made the point that, hey, a car wash
[48:37]
is going to use a whole heck of a lot more water
[48:40]
than a baby gap.
[48:42]
They're both commercial, but they're water
[48:44]
and usage is very, very different.

And so it likely makes sense on a site plan specific basis to look at commercial dedications that way.

Residential is a little more predictable, right?

You just do the math on the law side of the number of units and how large the whole summer and what your dedication needs to be.

And so that's a maybe perhaps another way that we could help you is how we, how do we want to look at how we want to look at commercial together.

hey, is there an opportunity either through, is that every three years, as you said,

through an adjustment to your system specific sizing or through perhaps given the size and scope of

this development, a separate agreement that we could strive with the district to do, you know,

I just want to ask one quick question and then I have a comment, if my understanding is correct, you're under contract to purchase the property and so you're hoping to have as many of these questions answered ahead of time before that sale actually goes through, right?

Sure. Yeah. I completely respect that. I think what you're going to run into is it's far
[50:43]
too speculative for the board to entertain right now in this format. And I don't have
[50:48]
your sheet in front of me, so you may have already done this already. But I would suggest
[50:54]
to written proposal for the board to consider separately from this meeting. It probably
[50:59]
have to go into close session to discuss it. But I think you're going to run into some issues
[51:05]
that you're going to have to deal with in the future, which is you're asking the district
[51:09]
to adjust their overall resolution with regards to exactions in the future. And we have developers
[51:17]
in line already waiting and wondering what's going to happen with this. And so unless we can
[51:23]
show some parameters, put on this, I don't think the board is going to just modify its resolution
[51:32]
based on this one development. And so I guess the biggest question would be is when the board
[51:37]
goes back and looks at all of the issues, are they going to want to even modify the resolution?

And if they don't, that send you your answer. I mean, there's a process to challenge the
[51:46]
But the thing is is this is way too premature for us to even evaluate because that's based off an application
[51:55]
And so I get that it's

You want to have as much information as you can ahead of time

But there's only so much you can do until somebody moves forward with an application or some has more concrete

We know how the property is on, and this is what we want, but we want to do with the property, and what can we provide the city to get the agreement to do that, and, you know,

As we've talked with City Council, we've been very clear that this has got to be a two-way
[53:04]
beneficial situation, our particular benefit for Midwest is obvious, right?
[53:09]
And so how do we make the benefits of the city as it trails, is it parks, how do we make
[53:14]
sure that we're doing our due diligence to make sure that we don't have a lot of the roads, just
[53:18]
to all of those things. And so some of what we're doing here is a very similar concept for us,
[53:24]
right? And we're saying we can understand why you would want to have over all your entire
[53:28]
dedication grant, regardless of debates about what their greatest set is, and we understand
[53:35]
the point that was just made like there's other developers seeing that we would have
[53:38]
success. Our approach is basically this is such a large development. Can we do a one-off
[53:44]
agreement with the districts where I, we set forth, and I don't know that you're going to be able
[53:49]
to have a hard coat one number for 20 years, but perhaps you can be in our coat of formula
[53:54]
or a way of doing this and as part of the least this is a work session as opposed to us having
[53:59]
drafted something up is we don't know enough to start drafting something like that but
[54:04]
it's actually we've put together a process where we determine for our development what the
[54:10]
dedication and process with look life and for you guys for example why we do that as what we're saying
[54:16]
yeah let's what do you need why would you do that how can we make it beneficial just like any
[54:21]
right so that there's a plus for the district and a plus for progress or when when
[54:27]
process. That's the idea that's a concept that we're kind of throwing
[54:30]
account here. That's why he's led with what's going to be right is it if we could
[54:35]
find the well that's above him beyond the source water that we need. Does that
[54:39]
helpful? If we define plan high enough for a treatment plan. Is that helpful?

But we don't know, right? So we're going to ask him. One question is what do you

even have legs to this group, where we could determine a dedication, right?
