I'm going to call to order the Brentwood Stormwater Authority meeting of August 17, 2026. Please stand for the Pudge of Allegiance. I pledge allegiance to the flag of the United States of America and to the Republic for which stands one nation under not.
[3:16]
Mr. Schubert, Mr. Smith, President, Ms. Traut, Ms. Montgomery,
[3:23]
Solicitor Rob, and Executive Director Bioski.
[3:26]
Thank you very much. At this time, we will have comments on agenda action items only.
[3:33]
please limit your remarks to three minutes and this is on agenda action items
[3:38]
only. Mr. President. You hear for Jean Warner?
[3:42]
Proxy. Hearing nothing. We will now move on to our first agenda item which is
[3:50]
a review of the meeting minutes. I would like to entertain a motion to approve
[3:56]
the minutes of May 11th and June 22nd stormwater authority board meetings.
[4:01]
So moved second there's a motion and a second any comments or questions on the minutes from May 11th and or June 22nd
[4:12]
Hearing none all in favor. I
[4:16]
Unimposed none motion carries. I like to stop them. We don't do it enough in the regular council
[4:24]
Next we will move on to the executive director's report, but first I just want to clarify that Mr. Schubert is now here
[4:31]
If we can amend a roll call, Mr. President.
[4:34]
Yes.
[4:34]
Thank you.
[4:35]
Thank you, Madam President.
[4:38]
No worries.
[4:39]
Would the executive director please present his report?
[4:42]
Thank you, Madam President.
[4:43]
Members of the authority, I would like
[4:45]
to provide a brief or the update on the authority's
[4:49]
finances, infrastructure initiatives, MS4 compliance,
[4:53]
and several other matters since our last meeting.
[4:56]
as of July 31st, 2026.
[5:00]
The stormwater fund revenues total approximately $868,000, already exceeding the annual revenue budgeted, which was approximately $795,000. Expanditure's total approximately $520,000, or 65 and a half percent of the budget leaving a current revenue over expenditure position of approximately $347,000.
[5:29]
The fund remains in a strong position, although additional engineering, some mapping, CCTV projects and MS-4 maintenance and a capital expenditure are still anticipated during the remainder of the year.
[5:45]
Staff is already preparing the 2027 Stormwater Authority budget, and it will be available for review and action at the next quarterly meeting which will be in November 16th.
[5:59]
but I'll forward copies in the interim, the email.
[6:07]
Some of you are already aware that there has been
[6:10]
an important legal development since our last meeting,
[6:14]
following the Pennsylvania Supreme Court's
[6:16]
Westchester Stormwater fee decision.
[6:19]
A proposed class action lawsuit was filed on August 12th
[6:23]
against the Pittsburgh water and sewer authority,
[6:26]
challenging its stormwater fee.
[6:28]
The plaintiffs alleged that the PWSA stormwater charge should be considered a tax rather than a fee.
[6:35]
And further contend that, as a municipal authority, PWSA lacks the authority to impose such a tax.
[6:43]
The lawsuit seeks among other relief repayment of previously collected stormwater charges.
[6:49]
And an injunction against continued collection.
[6:52]
It is important to emphasize that these are allegations and the newly filed lawsuit, not a court decision.
[7:01]
And the filing does not invalidate Brentwood's stormwater fee.
[7:07]
Nevertheless, Brentwood, because Brentwood also operates a municipal stormwater authority with a EAU base fee staff.
[7:16]
With our solicitor, we'll closely monitor the litigation and report any developments that potentially affect the authority.
[7:27]
Want to sum projects, MS4 mapping and CCTV.
[7:31]
We continue to make good progress with our MS4 program and stormwater infrastructure management.
[7:37]
Public works personnel have now been trained to conduct routine stormwater outfall inspections in-house.
[7:45]
Initial inspections have been completed with only three outfalls requiring follow-up investigation.
[7:52]
Phase one of Gateway Engineer Storm, SOAR mapping project is approximately 97% complete.
[8:00]
The mapping provides the authority with increasingly accurate information regarding the location,
[8:06]
condition, and connectivity of our stormwater infrastructure throughout the borough.
[8:11]
We are establishing a five-year CCTV inspection program, similar to our sanitary system program.
[8:24]
The borough has been divided into five inspection zones with the goal of inspecting.
[8:29]
Approximately 20% in the system were roughly 20,000 linear feet each year.
[8:35]
Together, these programs will allow us to identify maintenance and capital needs earlier rather
[8:42]
than simply reacting when a problem occurs.
[8:49]
Speaking of potential problems, well, no, actually, yeah, not a problem, this is good news.
[8:55]
The Wienley Road culvert is actually considered a bridge which needs to be inspected by
[9:01]
Penn got periodically and they conducted their inspection in April. The
[9:09]
covert remains in very good condition with a rating of eight unchanged from
[9:13]
its previous inspection. Scour was rated insignificant. The existing load
[9:19]
ratings remains valid and the structure remains open without any restrictions.
[9:26]
Several routine maintenance items were identified for future consideration but no
[9:31]
immediate structural deficiencies were identified and the next inspection is scheduled for April of
[9:37]
2028.
[9:40]
Council knows in the authority that the DeWalt Avenue Street skate project is now moving
[9:47]
into pre-construction following Council's award at the last meeting. The $717,000 construction
[9:55]
contract was awarded to a Moronte contracting.
[10:00]
In July. And if you recall, this is being funded by a $191,000 pent up multilateral grant, but since there is some stormwater work associated with it, $100,000 was approved from the stormwater fund. Construction is anticipated to begin in September with completion. It's still targeted by the end of the year, whether permitting. And looking ahead between now and our November meeting, staff working with
[10:31]
our engineers will continue working on stormwater mapping, the outfall follow-up inspections,
[10:38]
MS4 compliance, CCTV inspections, and DEWALT Avenue stormwater improvements, routine maintenance,
[10:46]
and identification of future capital projects. And preparing which were being included in the 2027
[10:53]
operating capital budget for the stormwater authority. So overall, I believe the
[11:01]
authority continues to make good progress.
[11:03]
We're beginning to see the pieces of the program come together,
[11:07]
dedicated funding, approved mapping,
[11:10]
trained borrow personnel, inspections, compliance,
[11:15]
preventive maintenance, and capital investment.
[11:17]
Our goal is to move from a reactive approach to planned
[11:20]
and preventative storm water management program
[11:24]
that allows us to identify problems early,
[11:28]
prioritize investments and make the best use
[11:30]
of the authorities' resources. That concludes my report. There are any questions?
[11:37]
Quick questions, George. You had mentioned that Laney Road Colder was
[11:41]
considered a bridge now, but there are multiple culverts on it, right? So are
[11:46]
they saying all the culverts look good? Okay. You had mentioned one. I'm like
[11:50]
that was the one that was just them. Yeah, they're being inspected and
[11:52]
according to their time, but just, you know, people just think of a bridge as being
[11:57]
like, you know, the Fort Pit bridge and the one that was just slid over. But yeah, these little
[12:03]
culverts are also classified as bridges by Penn Doe. Thank you very much. So that's all
[12:12]
yeah. Thanks for the report. Very detail. I appreciate it. Other questions? Thank you, George.
[12:19]
I would like to entertain a motion to accept the Executive Director's report for the period of May
[12:23]
first 2026 through July 31st, 2026.
[12:26]
So moved.
[12:27]
Second.
[12:28]
You have a motion and a second.
[12:30]
All those in favor?
[12:31]
Hi.
[12:33]
Motion carries.
[12:37]
No old business to discuss today unless anyone has anything
[12:41]
they would like to address from prior meetings.
[12:43]
I was just curious how the new street sweepers
[12:46]
working out with cleaning out stormwater stuff.
[12:50]
Remember how we, I don't know your public today,
[12:52]
But when we originally got the street sweeper, there was an attachment or something that could go into storm art. Has that been I mean, we had a ton of rain.
[13:02]
I'm hoping it's working out.
[13:03]
I have to talk to our public works director, but this way you usually will come to me with problems.
[13:09]
But I can give update on that.
[13:12]
I've seen the cruising around a bit.
[13:13]
They do catch basin clean outs, usually in the fall when the leaves are relating.
[13:18]
Okay, so we may not even know.
[13:19]
I'm sure he brought me tested it here and there, but I saw it up and down
[13:24]
browns a couple times already. Yeah, today it went down my street, so yeah, so you
[13:28]
and Madam Chair, it should be referred to as Sir Sweep's a lot. Sir Sweep's a lot. Yes.
[13:34]
Yes, it's great.
[13:40]
Okay, moving into new business, I would like to entertain a
[13:46]
motion to approve the Treasurer's report for the period ending July 31st, 2026.
[13:52]
So moved.
[13:53]
Second.
[13:54]
Is there any comments or questions on the Treasurer's report for that time period?
[13:58]
Hearing none.
[13:59]
All those in favor?
[14:01]
Aye.
[14:02]
Any opposed?
[14:04]
None.
[14:04]
Motion carries.
[14:08]
I understand now why Mike did it more than probably was needed.
[14:15]
Next action item, I would like to entertain a motion to authorize the borough to accept a proposal from WA Patricus contracting to Mill and pave a section of Brentwood Avenue from East Feltcrest Avenue to Brent Shireway and to install related drainage improvements in the not-to-excit amount of $15,000 and which is to be paid from Stormwater Fund Budget Line Item 09-446.370 and have the stormwater budget
[14:43]
order authority executive director process and execute all documents.
[14:47]
So moved second.
[14:50]
There's a motion and a second.
[14:51]
Any comments or questions on that?
[14:54]
I do have one.
[14:55]
So the portion that the stormwater authority is covering the not-to- exceed amount-
[15:00]
Does that include the paving or is the paving itself coming from another line, aye?
[15:09]
Or is it? Madam Chair. Glad that question was brought up. I was going to mention. So our public works supervisor should be commended. This is a utility project. But we've had some minor flooding in that area. So while they were down there doing their utility work.
[15:29]
the borough ordinance requires that they restore it and pave in kind what was
[15:35]
disturbed but what he saw was and while they're down they're doing it we can
[15:41]
possibly alleviate some of the flooding and the water that's it's addressing
[15:47]
that the residents by raising the road and having it slope away from the
[15:53]
properties. Now that's going to require some additional asphalt and some
[15:58]
work from the water company's contractor Petraikas, but they were willing to do it.
[16:04]
We asked them for this quote, and it looks very reasonable for that portion in hopefully
[16:09]
it works.
[16:10]
Yeah.
[16:11]
That's a great thank you.
[16:12]
Thank you to use the utility contractor to assist us with additional stormwater runoff
[16:17]
issues.
[16:18]
That's from our public's works.
[16:20]
Yeah.
[16:20]
That's great.
[16:21]
That's awesome.
[16:22]
Yeah.
[16:22]
And along the same line as part of the CCTV program that we're doing, even though the
[16:26]
The borough was broken up in quadrants.
[16:28]
We're also trying the best that we can to get some idea
[16:33]
of what future work from the utilities.
[16:36]
So if they're going to work on a project
[16:38]
that's in one of these other quadrants,
[16:40]
then we'll just make sure that any stormwater is televised.
[16:44]
Since we know they're going to be in there,
[16:45]
just in case something like this might occur,
[16:47]
and we have to get in there while the roads got by them anyways.
[16:51]
I am sure our residents will be grateful
[16:54]
for not having to have their roads dug up more than once.
[17:00]
Is that why there's, excuse me,
[17:02]
is that why there's construction vehicles down there?
[17:06]
Is that from the utility?
[17:07]
They kind of have located upon the old garage down there
[17:12]
and things like that, have you seen that?
[17:13]
Right, right.
[17:14]
Is that them?
[17:15]
Yeah, because at one time, they were up here in the empty lot
[17:17]
where they're former bourbon.
[17:18]
That's OK.
[17:19]
Yeah, we asked them to just relocate.
[17:21]
around this was just over the parade and they made a deal with the owner of that property.
[17:28]
Okay. Okay. Thank you.
[17:32]
Any other comments or questions? Hearing none. All those in favor?
[17:37]
Aye. Aye. Any opposed? None? Motion carries.
[17:42]
Sure.
[17:44]
Next, I would like to entertain a motion to approve the work authorization from the Gateway
[17:50]
engineers to perform a stream bank stabilization study for an eroded section along Wainley Road
[17:56]
in an amount not to exceed $12,500 to be paid from stormwater fun line item 09-408.313
[18:05]
and to authorize the stormwater authority executive director to execute the work authorization
[18:09]
on behalf of the authority. So move. Any comments or questions regarding that work authorization?
[18:21]
Yeah, one item on the scope is there's been talk of, you know, if it's going to continue
[18:27]
to convey traffic or if it's going to be shut down and just convey alternative pedestrian
[18:33]
pathway.
[18:34]
So they'll analyze both options and then report back to the council or to the authority
[18:42]
and then when we're working on next year's projects decide what can or should be done
[18:47]
with that.
[18:48]
Okay. Excuse me. Is Wayne Lee Road down by the hollow? Yes. Okay. There's no plans in the
[18:56]
hollow work for the walking trail to support any of this either. So it's interesting you
[19:02]
mentioned that though, right? Because we have made discussions. The walking trail comes down
[19:06]
in the far end of Wayne Lee Road. Right. And I was going to ask him which part of Wayne Lee Road
[19:12]
is this? You know, I know it says Wayne Lee Road, but I don't know exactly. Is it? There's a residence
[19:16]
house down there. Is it for the long goes or after the long goes if you're coming from this side?
[19:22]
Yes. From the public works facility all the way over to the first residence house.
[19:29]
All the entire roadway to where it ties into Baldwin. Oh, okay. So this is for the whole road. Yeah.
[19:36]
Okay. Where there's three culverts, bridges or. Right. Right. Right. Right. Because I have mentioned to George
[19:40]
similar, similar to you is if we make it into a pedestrian walkway, it could just
[19:45]
easily just turn into an extension of the trail, right? You know what I mean?
[19:50]
Because it isn't highly used, right? It's a terrible road, right? You know? And the
[19:58]
you pass the make it into a 1.
[20:00]
Proper road would be astronomical for the 40-mile traffic it gets. So would we better be hoved at some point, you know, making it a road to a, for the only resident lives there, right? You know, and then the rest of it turned into a trail. But these are just hypotheticals. Nothing I'm saying is etch and stone, but they are questions that I was going to ask, but George had already brought up just now, and you had also brought up there. So we need to figure out what is the best economical way.
[20:29]
to use that road and what's it going to be used for and things like that.
[20:35]
Well, and our plan with the LSSE has nothing to do with storm water or fixing it because
[20:41]
there's a lot of storm water that comes down through that hollow.
[20:44]
Right, but it is currently not part of that trail.
[20:48]
That, sure.
[20:49]
Okay.
[20:49]
Not the section we're talking about.
[20:50]
Yeah, no section of that wangley road is part other than the termination of the trail
[20:56]
Yeah, it is down there and it has nothing to do with that storm water down there, you know what I mean so yeah fixing storm water up here has nothing
[21:04]
Wasn't I mean the just any water runs down all those hills like that so I yes and no to that question, but at the same time
[21:15]
LSE is not addressing any storm water correct
[21:19]
regarding the trail is strictly a trail other than maybe a bridge that goes over a
[21:25]
stream or something like that but it isn't going to redirect any streams or
[21:29]
anything. Thank you. There's no other comments or questions all those in
[21:38]
favor. Any opposed? Oh yeah motion carries.
[21:46]
At this point we're going to move
[21:48]
in the public comment section of the meeting. Please limit your remarks to three minutes.
[21:55]
Anyone, anyone? You'll hear? You'll hear? Okay, hearing none. I will entertain a motion to adjourn.
[22:03]
Motion to adjourn. Second. All those in favor? Aye. Motion carries. I remember the motion.
