additional comments or questions
[3:33]
regarding this evening's events
[3:37]

[3:40]
i propose to move items 11c and item
[3:43]
11d to the consent agenda for tonight's
[3:46]
uh meeting
[3:48]
okay is there any objection now i'll
[3:50]
note law evans uh has
[3:51]
is attended she needs to be moved to the
[3:53]
uh to the panelists
[3:54]
um is there any objections to moving 11c
[3:57]
and 11d to the uh to the consent agenda
[4:02]
accounts member grown
[4:05]
yes i would like to leave them both on
[4:12]
so i'm not exactly sure what the rule is
[4:15]
when there's objection to do we then
[4:16]
leave them on
[4:17]
uh yeah we leave them on we leave them
[4:19]
on okay we will leave 11c
[4:21]
and 11d uh where they're at and
[4:24]
uh and act accordingly uh this evening
[4:27]
we have uh
[4:28]
two items that are petitioned in
[4:30]
communications uh before council's
[4:32]
review of the first item
[4:33]
i did want to take a few moments in
[4:35]
honor of martin luther king jr day this
[4:37]
coming monday
[4:38]
january 18th and on behalf of the city
[4:40]
council i wanted to take a moment
[4:42]
to recognize the significance of this
[4:43]
day especially during a year of
[4:45]
extraordinary and
[4:46]
overdue conversations about around
[4:49]
social justice
[4:50]
it is important that we acknowledge uh
[4:52]
dr king and his unparalleled impact on
[4:54]
our trajectory as a nation
[4:56]
and as a people among dr king's greatest
[4:59]
contributions was his ability to embark
[5:01]
on hit this journey on this mountain
[5:04]
in steps with compassion and
[5:05]
understanding how can we seek change in
[5:08]
our world through non-violent methods
[5:10]
and to do so in a way with compassion
[5:12]
and understanding broomfield is a city
[5:14]
county
[5:15]
and community has advanced evidence
[5:17]
neighbors helping neighbors
[5:18]
and a spirit of engaged cooperation and
[5:20]
we look forward to our journey
[5:22]
ahead together uh we're not going to
[5:25]
continue with this evening's agenda i
[5:26]
will be reading a proclamation
[5:28]
uh after we meet with the coroner um
[5:31]
i want to make that comment to me to
[5:33]
make another couple comments about
[5:34]
what's going on in
[5:35]
the country right now so however we're
[5:38]
going to start out with uh
[5:39]
a follow up discussion to the corner
[5:41]
intergovernmental agreement
[5:42]
which was approved by council at the uh
[5:44]
december 10th
[5:46]
2020 council meeting on december
[5:49]
16 2020. monica brancusia jordan and
[5:52]
former council that although council had
[5:54]
approved the agreement
[5:55]
with her office uh for 2020 when her
[5:58]
office was elected not to renew the 2021
[6:01]
agreement
[6:02]
uh after the 2020 manches agreement
[6:04]
expired on january first
[6:06]
twenty twenty one i reached out uh to
[6:08]
miss
[6:09]
bronchusia jordan as mayor on december
[6:12]
17th and i apologized
[6:14]
for the timeline as it did not provide
[6:16]
adequate time for council to review the
[6:18]
contract and ask questions
[6:19]
nor adequate time for her office to
[6:21]
respond
[6:22]
broomfield the police department the
[6:24]
district attorney
[6:26]
mrs marcusia jordan and her office have
[6:28]
had a successful and positive
[6:30]
relationship for many years
[6:31]
due to the challenge with the process
[6:33]
and in the end of your timeline
[6:35]
uh we invited miss bronkusha jordan
[6:38]
to join council this evening to provide
[6:40]
an opportunity for her
[6:42]
council and the public to provide any
[6:44]
additional comments questions and
[6:45]
response responses
[6:47]
we will start with the coroner's uh
[6:48]
making her comments following
[6:50]
all of my public comments and council
[6:52]
member comments and questions
[6:53]
items on this agenda are typically five
[6:56]
minutes i'm requesting
[6:57]
additional time under petitions and
[6:59]
communications from council this evening
[7:01]
to ensure
[7:02]
a productive discussion and i'm looking
[7:05]
up to see if there's any objections
[7:07]
if we remove the five-minute time limit
[7:09]
uh i'm not seeing any
[7:11]
so uh so seeing no concerns with the
[7:14]
quest for additional time
[7:15]
uh miss marcus jordan please introduce
[7:17]
yourself myself and share your comments
[7:21]
good evening mayor clinton council
[7:22]
members i'm monica brancucci jordan i'm
[7:25]
the current coroner for adams and
[7:27]
broomfield counties
[7:29]
i am here tonight to further discuss the
[7:31]
iga
[7:33]
i think that it is important to recap
[7:35]
for the public
[7:36]
what has transpired and why i am here
[7:39]
as you are aware despite your council's
[7:41]
unanimous decision to approve the 2021
[7:43]
iga for coroner services
[7:46]
on december 10th i initially elected not
[7:49]
to renew the 2021 iga
[7:51]
following the council's concerns
[7:53]
expressed at the december 10th council
[7:54]
meeting
[7:56]
toward the end of december it became
[7:57]
apparent that it would be unlikely for
[7:59]
broomfield council to replace my
[8:01]
services
[8:02]
by january 1st 2021 so following contact
[8:06]
by numerous stakeholders urging me to
[8:08]
reconsider
[8:09]
along with a lengthy conversation and an
[8:11]
apology for mayor quinn
[8:14]
as an act of goodwill i agreed to sign
[8:16]
the 2021 iga
[8:18]
with the assurance that i would have
[8:19]
this opportunity to address springfield
[8:21]
council in a public forum
[8:23]
as you are aware the executed iga has a
[8:26]
120-day termination notice available to
[8:29]
both parties
[8:30]
while i have signed the iga and have
[8:32]
agreed to further discussions with your
[8:34]
council
[8:34]
my previous assertions have not changed
[8:37]
if the broomfield council members lack
[8:39]
confidence in the services that my
[8:41]
office provides
[8:42]
then you need to find a new coroner for
[8:44]
your community
[8:45]
the adams county coroner's office serves
[8:47]
eight cities in addition to the city and
[8:49]
county of broomfield
[8:50]
along with all of the unincorporated
[8:52]
areas covering a geographic area of
[8:54]
approximately 1200 square miles
[8:58]
my first priority is and always will be
[9:00]
serving the citizens of adams county
[9:02]
serving such a large population
[9:04]
generates approximately five thousand
[9:06]
reported deaths per year
[9:08]
of which broomfield comprises less than
[9:10]
400.
[9:12]
the adams county coroner's office has
[9:14]
provided coroner services to broomfield
[9:16]
for 20 years 10 of which have been under
[9:19]
my leadership
[9:21]
there appears to be a significant
[9:22]
misunderstanding by members of this
[9:24]
council about who derives benefit from
[9:27]
this arrangement
[9:28]
i am not here to earn the business of
[9:30]
your community i
[9:31]
my staff in my office benefit in no way
[9:34]
from this agreement
[9:36]
i have maintained this agreement merely
[9:38]
as a good neighbor and to support the
[9:39]
17th judicial district
[9:41]
which the two counties comprise this
[9:45]
agreement was never intended to be a
[9:46]
revenue generating arrangement
[9:48]
i have always been extremely fair in
[9:50]
what i have charged broomfield for
[9:52]
coroner services
[9:53]
the revenue generated by this agreement
[9:55]
for adams county is insignificant
[9:58]
this agreement not only provides your
[10:01]
community with a vital public service
[10:02]
and supports broomfield's judicial
[10:04]
district
[10:05]
but it also saves your county the
[10:07]
millions of dollars it would cost for
[10:08]
the infrastructure and ongoing budget to
[10:11]
support your own coroner's office
[10:13]
now obviously i'm not the only coroner
[10:15]
that you can contract with
[10:17]
there are 63 other coroners in the state
[10:19]
of colorado that you can try to do
[10:20]
business with
[10:22]
however if you have confidence in the
[10:24]
services my office provides
[10:26]
and wish to continue to utilize these
[10:28]
services then i think it is important
[10:30]
for the council to understand what this
[10:32]
arrangement will look like going forward
[10:36]
mr elijah mcclain's death is tragic in
[10:38]
every way
[10:39]
and i certainly understand the questions
[10:41]
surrounding his death
[10:42]
having questions is not the issue at
[10:45]
this
[10:46]
at the december 10th council meeting
[10:48]
broomfield council member devin schaff
[10:50]
voiced concerns that i had committed
[10:52]
official misconduct related to the
[10:54]
mclean death investigation
[10:57]
he then directed a litany of questions
[10:58]
to me at a meeting that i was clearly
[11:01]
not at
[11:02]
the broom the majority of broomfield
[11:04]
council present then followed in suit
[11:06]
expressing similar sentiments
[11:08]
then despite such serious concerns and
[11:11]
having no answer to these questions
[11:13]
the broomfield council unanimously
[11:15]
approved contracting with my office for
[11:17]
yet another year
[11:19]
i find approving a new contract on the
[11:22]
heels of expressing
[11:23]
such serious concerns illogical it gives
[11:26]
the appearance
[11:28]
that these concerns were disingenuous
[11:30]
and nothing more than devin's shaft
[11:32]
and council members public pandering
[11:35]
virtue signaling
[11:36]
and utilizing this extremely tragic
[11:39]
death
[11:39]
for their own political aggrandizement
[11:42]
mr mcclain's death occurred nearly 17
[11:46]
months ago
[11:47]
in those 17 months not a single one of
[11:49]
you has contacted me to ask questions
[11:52]
or express concerns about his case or to
[11:55]
merely learn
[11:56]
the general standards of practice my
[11:57]
office uses to investigate police
[11:59]
involved deaths
[12:01]
instead you chose to use this tragedy as
[12:03]
an opportunity to grandstand
[12:06]
in the ten years that i have served your
[12:08]
community i have never witnessed or
[12:10]
experienced
[12:11]
the lack of professionalism lack of
[12:14]
communication
[12:15]
and dysfunction that i have seen over
[12:16]
the past few weeks
[12:18]
so if this is indicative of what it will
[12:20]
continue to be like to serve your
[12:22]
community
[12:23]
then it is important for you to know
[12:25]
that i will terminate our agreement
[12:28]
going forward if you have questions or
[12:30]
concerns
[12:31]
like any other stakeholder i expect you
[12:34]
to communicate them to me
[12:36]
you also need to understand that there
[12:37]
are limitations surrounding what i can
[12:39]
discuss
[12:41]
so i'm here tonight to address this
[12:42]
council and i am open to having dialogue
[12:45]
so how would you like to proceed
[12:48]
oh monica we're going to follow our uh
[12:51]
our normal process on this and so what
[12:53]
uh what we do is we allow public
[12:55]
comments so there are there are two
[12:57]
comments
[12:57]
from the public um and i and then i'm
[13:00]
gonna turn it over to city council
[13:02]
uh you know have a discussion on how
[13:04]
they would like to proceed
[13:06]
their comments and you know and uh and
[13:08]
so uh
[13:09]
we're gonna follow a normal process
[13:10]
which which i'll let you know so let me
[13:12]
go ahead and go to
[13:13]
is that finished the comments you want
[13:14]
to make right now monica yes
[13:17]
okay so let me let me go into the public
[13:19]
we do have two
[13:20]
members of the public that want to speak
[13:22]
uh they each get to speak for three
[13:23]
minutes
[13:24]
uh and we will start with with with rick
[13:27]
identify yourself uh your your full name
[13:30]
and your neighborhood
[13:31]
and you have three minutes to speak
[13:36]
thank you mayor quinn my name is rick
[13:38]
fernandez i'm in the broomfield heights
[13:41]
division here in broomfield and i would
[13:43]
like to thank you and the city council
[13:46]
for the opportunity to speak with you
[13:47]
this evening
[13:49]
i'm here to offer up some comments on
[13:51]
the events
[13:52]
related to the renewal of the iga
[13:54]
between the city and county of
[13:56]
broomfield
[13:57]
and the adams county coroner's office
[13:58]
and to make three requests
[14:00]
of the city council and the city staff
[14:03]
i would like to say that while i have
[14:06]
expected i would have expected this
[14:07]
agreement
[14:08]
when it came up for renewal to really as
[14:12]
it provides a city
[14:13]
service to our community would have been
[14:15]
renewed without any concern from the
[14:16]
city council
[14:18]
what occurred in december was disturbing
[14:20]
and it was concerning
[14:22]
it was disturbing to hear that rather
[14:24]
than acting in a civil
[14:25]
civically and physically responsible
[14:28]
manner
[14:29]
the tenor and discussion by the city
[14:30]
council led by council member shaft
[14:32]
was to isolate the conversation around a
[14:36]
contrived assertion regarding the adams
[14:38]
county coroner's office role in the
[14:39]
tragic death of elijah
[14:41]
mclean why was the race at that time
[14:45]
to the public it appears that there is
[14:47]
more interest in grinding in acts
[14:48]
and opening wounds in the name of social
[14:50]
justice
[14:52]
on top of that the questions were raised
[14:55]
and were done
[14:55]
in a setting where the very office that
[14:57]
council member shaft questioned
[14:59]
was not available to discuss or respond
[15:02]
it's concerning that based on the tact
[15:04]
taken by the city council on this topic
[15:06]
turned
[15:07]
into from being irresponsible to being negligent when
[15:11]
the adams county coroner's office
[15:13]
declined to renew the agreement
[15:15]
shortly after the comments were made the
[15:17]
negligence caused the city and county
[15:18]
and broomfield to be at risk
[15:20]
for not having a corner for the
[15:22]
community and was a significant mistake
[15:25]
that mayor quinn acknowledged when he
[15:27]
said
[15:27]
that the agreement was quote not handled
[15:29]
properly
[15:31]
and was followed by an apology by the
[15:32]
mayor now mayor quinn
[15:34]
i want to give you credit for being the
[15:36]
adult in the room
[15:38]
and working to ultimately get the
[15:39]
agreement with the adams county coroner
[15:41]
in place
[15:41]
in spite of this major misstep and
[15:44]
embarrassment
[15:45]
to our city and community so as i
[15:47]
mentioned i have three
[15:48]
requests number one i would like to
[15:52]
understand if the renewed agreement
[15:54]
with the adams county coroner's office
[15:55]
is coming at an increased cost to the
[15:57]
city and county of broomfield
[15:59]
as compared to the original agreement
[16:00]
that was to be renewed
[16:02]
number two i'd like to hear from the
[16:05]
city manager's office
[16:06]
and their perspective as to the state of
[16:08]
the relationship
[16:10]
between the city and county of
[16:11]
broomfield and the adam county coroner
[16:13]
office
[16:14]
i'm concerned that the city is now in a
[16:16]
tenuous relationship with them with
[16:18]
adams county
[16:19]
and i hope that this is not the case
[16:22]
thank you i number three i would ask the
[16:24]
council member shaft
[16:25]
provide a public apology for causing the
[16:28]
city and county and broomfield to be in
[16:30]
a position that it finds itself in
[16:32]
mayor quinn you demonstrate a huge
[16:34]
amount of responsibility by apology
[16:36]
different situations
[16:37]
i appreciate that yeah thank rick your
[16:40]
time's up thank you
[16:41]
um let's go to elizabeth elizabeth
[16:45]
state your full name in your
[16:46]
neighborhood for the record and you have
[16:47]
three minutes
[16:51]
good evening thank you all so much
[16:53]
elizabeth mora north moore estates
[16:55]
and i'm just calling in to actually
[16:57]
thank council member staff
[16:59]
for having the courage to ask these
[17:01]
questions and especially now that this
[17:03]
case is going to a grand jury
[17:05]
it is more important than ever that we
[17:07]
know who we're
[17:08]
working with and that everything was
[17:11]
handled correctly in this case
[17:13]
i think it takes a lot of courage to
[17:15]
bring these questions up and i commend
[17:18]
consul members shaft and it's quite
[17:21]
obvious that the coroner's office
[17:22]
doesn't want to work with broomfield
[17:24]
so i would actually like to recommend
[17:27]
that
[17:28]
we find a different county to work with
[17:31]
but thank you so much council member
[17:33]
staff for doing what it takes and
[17:35]
for standing up um and asking the tough
[17:38]
questions i appreciate it
[17:39]
have a great night
[17:43]
hey i don't know i know any other
[17:45]
questions or comments
[17:46]
um i will uh
[17:49]
from the public i will go to uh
[17:53]
you know i will go oh i do have i do
[17:55]
have one more called
[17:56]
james um state your full name for the
[18:00]
record uh
[18:00]
in your neighborhood and you have three
[18:02]
minutes
[18:06]
uh thank you mayor um thank you mayor
[18:08]
and council
[18:09]
james marsh holston i live in brandywine
[18:12]
i'm also calling in to
[18:13]
express my gratitude for council member
[18:15]
shaft and the other council members for
[18:17]
having the courage to raise this issue
[18:20]
um
[18:21]
the tragic death of this young man
[18:25]
has been obviously they've been in the
[18:27]
news a lot and
[18:28]
anybody who's paying attention knows
[18:30]
this was mishandled
[18:32]
on all levels um this man's death was a
[18:35]
murder
[18:36]
and it should have been treated as such
[18:39]
furthermore if these questions are
[18:41]
perfectly appropriate for council member
[18:42]
staff to be answered
[18:43]
asking and they should be treated with
[18:48]
dignity and courteous response
[18:52]
rather than also if anybody's
[18:55]
politically grandstanding it would be
[18:56]
the um
[18:57]
coroner's office in my opinion and i
[19:00]
believe that this
[19:01]
these questions should be asked and
[19:02]
should be answered and broomfield should
[19:04]
move on
[19:05]
and should do what we need to do to move
[19:08]
our community forward and to keep our
[19:09]
citizens safe
[19:10]
thank you
[19:17]
um i i don't think there's any there's
[19:21]
nobody else in the queue if they're
[19:22]
going
[19:23]
there's somebody being screened again
[19:25]
right now mayor
[19:36]
okay
[19:51]
it appears the screen call dropped mayor
[19:53]
so if you want to move on
[19:54]
so i i will go ahead and move on and uh
[19:57]
we go to council comments um
[19:58]
i'm going to uh um
[20:02]
well he raised his hand i was going to
[20:03]
let the council member shaft go first
[20:05]
and uh and i'm going to give him just so
[20:08]
everybody knows a little bit of latitude
[20:09]
with time tonight
[20:10]
so uh um so councilmember chef
[20:15]
great thank you mr mayor um and uh thank
[20:18]
you miss uh
[20:19]
bronco jordan for being here with us
[20:21]
tonight
[20:22]
um you know my first question is what
[20:24]
was your involvement
[20:26]
in the top in the autopsy regarding
[20:28]
elijah mclean
[20:41]
i'm sorry did you ask what was my
[20:43]
involvement in the autopsy of the elijah
[20:45]
mclean
[20:45]
correct so i believe that's an autopsy
[20:48]
that i assisted on
[20:49]
that was that would be on the autopsy
[20:51]
report if it was
[20:58]
um and you know we learned recently
[21:00]
there is going to be a grand jury
[21:02]
investigation
[21:03]
into the death of elijah mclean along
[21:05]
with this there's
[21:06]
other investigations um so i i just
[21:09]
wanted to ask in general
[21:10]
are you able to comment or answer
[21:12]
questions related to the death of elijah
[21:14]
mclean at this point
[21:20]
due to the multiple entities
[21:21]
investigating this case and the
[21:24]
initiation of the grand jury it's not
[21:26]
appropriate for me to discuss this case
[21:28]
at this time i look forward to having the opportunity to
[21:32]
answer questions and discuss it in the
[21:34]
future
[21:36]
my hope is also that many of these
[21:37]
questions will be answered at the
[21:39]
conclusion of these investigations
[21:41]
but no it is not appropriate for me to
[21:42]
discuss this case further
[21:45]
great thank you i'll keep my questions
[21:46]
in general then
[21:48]
if you or someone else in your office is
[21:50]
in a situation that presents itself as a
[21:52]
possible conflict to interest
[21:54]
how is that handled in your office
[21:58]
i and my staff would recuse ourselves
[22:00]
from the case
[22:07]
uh when there is a case uh how is
[22:09]
yourself as a coroner interact with a
[22:11]
forensic pathologist before
[22:13]
during and after the autopsy report is
[22:15]
completed
[22:19]
um i interact closely with the forensic
[22:21]
pathologist
[22:22]
it really depends on the nature of the
[22:24]
case as to how
[22:26]
involved that interaction is but there
[22:28]
are frequent conversations about the
[22:30]
case
[22:31]
and questions
[22:37]
great um when there is a death case
[22:39]
involving a police officer or a police
[22:41]
department
[22:42]
uh what interaction exists before and
[22:44]
during the autopsy and before the
[22:46]
autopsy report is completed
[22:50]
interaction with who the police
[22:54]
when there is a death involving a police
[22:56]
and
[22:57]
when there is a a non-police officer
[23:01]
death
[23:02]
uh that involves uh that there is a
[23:04]
possible connection to a death by a
[23:06]
police officer or involving a police
[23:08]
department what is the interaction
[23:11]
what is the further interaction with
[23:12]
that police officer or that police
[23:14]
department
[23:15]
in the investigation of that death
[23:20]
i think i understand what you're asking
[23:23]
so
[23:24]
the investigating agency might be the
[23:27]
police department that was involved
[23:29]
or it might be another investigating
[23:32]
agency
[23:33]
that is not something that eyes the
[23:34]
coroner get to decide i don't get to
[23:36]
pick
[23:37]
which agency is investigating the
[23:40]
criminal aspect of a case
[23:43]
but whatever agency is investigating the
[23:46]
criminal aspect of the case
[23:47]
i am required by law to interact with
[23:58]
great is it common practice to have the
[24:01]
police department around while
[24:03]
conducting the autopsy
[24:04]
of someone potentially killed at the
[24:06]
hands of a said police
[24:08]
department like i said
[24:11]
i am required by law to interact with
[24:13]
whatever agency is investigating the
[24:16]
criminal aspects of the case
[24:18]
if that happens to be the same agency
[24:21]
that was involved in the case
[24:23]
then i am required to interact with them
[24:25]
and they routinely come to autopsies as
[24:28]
does
[24:28]
the public defender if they're involved
[24:30]
in the case or the d.a if they're
[24:31]
involved in the case
[24:35]
uh when a when the death is reported as
[24:37]
a as undetermined
[24:39]
or maybe undetermined what is the policy
[24:41]
and practice in your office for seeking
[24:43]
a second opinion
[24:46]
it is not common practice or policy in
[24:48]
my office to seek a second opinion
[24:50]
nor is that standard of practice in the
[24:52]
united states
[24:53]
however all cases can be reviewed at any
[24:56]
point in time
[24:57]
by any other professional
[25:02]
what what would be the uh the factor
[25:05]
that you would need
[25:06]
in order to seek a second opinion on a
[25:08]
deaf case where it's undetermined
[25:12]
um that is too vague to answer it really
[25:15]
is case specific
[25:21]
you don't have any metrics for when that second opinion would be seeked
[25:26]
no if there were questions about the
[25:28]
interpretation of the medical findings
[25:31]
and that is an instance where i would
[25:32]
seek a second opinion
[25:34]
um if the medical findings seem clear
[25:36]
and are easily interpretable
[25:38]
then that is not a case that i would
[25:40]
commonly seek a second opinion on
[25:42]
but it's really case specific right i
[25:45]
appreciate that
[25:46]
at what point in the autopsy process are
[25:48]
witness statements police reports and
[25:50]
video of the incident gathered in order
[25:52]
to complete the autopsy report
[25:56]
those are gathered throughout the
[25:57]
process so it just depends on
[26:01]
how quickly we can get the information
[26:03]
what it is we're attempting to gather
[26:05]
but they are gathered throughout the
[26:06]
entire process so some of those may come
[26:08]
in before the autopsy
[26:10]
some of them may come in after the
[26:11]
autopsy is done
[26:13]
but they would all theoretically come in
[26:15]
before the autopsy report was completed
[26:18]
not necessarily the autopsy report draft
[26:20]
is done immediately after the autopsy
[26:22]
and then the final report
[26:24]
is put out after all the information is
[26:27]
obtained
[26:30]
mayor can i interrupt and call uh the
[26:32]
meeting to order for a second
[26:34]
i've got a i've got a question
[26:37]
the intent of this i i believe is um
[26:42]
maybe not appropriate where it's going
[26:44]
for for online
[26:45]
stream of questioning it's more
[26:47]
informational and i think devin can
[26:49]
or council member shop give a call
[26:52]
to um miss bruce jordan
[26:56]
i i think we've already put her through
[26:58]
enough she's a professional
[27:01]
and i would i would want to make sure
[27:03]
that she's welcome to
[27:05]
continue with it but i i do think that
[27:07]
the intent of this
[27:09]
was to give her a chance to talk to us
[27:11]
publicly
[27:12]
but not to be grilled again in public
[27:16]
so um i'd like the council to consider
[27:19]
not uh taking this line of questioning
[27:22]
and
[27:22]
maybe council member chef you can take
[27:25]
that offline
[27:31]
i appreciate that you know council
[27:33]
member shop obviously
[27:34]
um hold on hold on mayor uh so i believe
[27:37]
that the the motion was a point of order
[27:40]
uh she said that she would like to call
[27:41]
the meeting to order which is which is
[27:43]
not correct
[27:44]
it is a point of order so could you rule
[27:46]
on that point of order mayor
[27:49]
what i'm going to say is first of all
[27:52]
i'm going to go ahead and recognize uh
[27:54]
you know
[27:54]
the because monica and i and jennifer
[27:57]
had a lot of discussions about tonight
[27:59]
and part of the point about tonight was
[28:00]
to give to give miss barakushia jordan
[28:03]
the chance to to respond in public to
[28:05]
the questions
[28:05]
that had been made in public you know in
[28:07]
public and so
[28:08]
my point is that was the point of
[28:10]
tonight's meeting but monica if you want
[28:12]
to add
[28:13]
if you want to make a comment on on
[28:15]
because
[28:17]
this isn't in our book anywhere meaning
[28:20]
that we we're you know
[28:21]
we're trying to give you uh a chance to
[28:23]
respond back to things that concerned you uh that were said on december
[28:29]
i appreciate that i think that it's
[28:31]
pretty clear about um how i feel about
[28:33]
devin schaff and his comments
[28:35]
um educating the council on the office
[28:37]
of the coroner specifically the
[28:39]
standards of practice for police
[28:40]
involved deaths is
[28:42]
far too lengthy of a discussion for this
[28:43]
evening if there is a genuine interest i
[28:46]
am happy to host the council at my
[28:48]
facility
[28:49]
and arrange and arrange a presentation
[28:51]
on this topic
[28:52]
i also teach every year at the 17th
[28:54]
judicial
[28:55]
district citizens academy and one and
[28:58]
would encourage you all to attend
[29:00]
um this academy for a better
[29:01]
understanding of the coroner's role as
[29:02]
well as the entire judicial system
[29:05]
um mr schaff i think needs a an
[29:07]
understanding a basic rudimentary
[29:08]
understanding of the system
[29:10]
before um asking these types of
[29:12]
questions
[29:15]
not having a uh not having a script for
[29:19]
tonight
[29:19]
i think you're offered to invite those
[29:22]
who are interested
[29:23]
to participate as a very genuine offer
[29:26]
uh that that perhaps several of the
[29:28]
council members should take advantage of um and uh
[29:38]
it
[29:41]
so i want to god's offer i want us to
[29:44]
consider taking up that offer before you
[29:46]
know
[29:46]
we we do anything tonight so devin how
[29:49]
many more questions
[29:50]
you want to i mean if you do want to get
[29:51]
into the details or office and what she
[29:52]
does
[29:53]
i do think it might be appropriate to uh
[29:57]
to go ahead and meet with her directly
[30:00]
in her office and understand the
[30:01]
procedures that she has
[30:03]
otherwise tonight's gonna be cursory and uh
[30:07]
and probably not as meaningful as it
[30:08]
could be if we if we could have a
[30:10]
detailed meeting with her uh say
[30:12]
sometime in the next
[30:14]
few weeks
[30:18]
thanks mayor um so my understanding
[30:20]
tonight was that uh i would have a
[30:22]
chance to
[30:22]
ask the questions uh that i brought up
[30:25]
uh regarding the
[30:26]
continuant uh the agreement for the iga
[30:29]
um
[30:29]
and uh i understood from my first
[30:32]
actually my second question uh to miss
[30:35]
bronco
[30:36]
jordan that uh she could not comment or
[30:39]
answer questions regarding
[30:40]
elijah mclean i have made these more
[30:42]
general uh to uh
[30:44]
find out more about her office and the
[30:46]
practices her office
[30:47]
and those have been my questions tonight
[30:49]
um i do still have uh concerns
[30:52]
um but uh you know perhaps i'm not going
[30:54]
to be able to answer
[30:56]
ask the rest of my questions tonight and
[30:57]
won't be able to get the answers that i
[30:59]
need so
[31:00]
uh i'll leave it at that and those are
[31:01]
my questions for tonight thank you yeah
[31:02]
councilmember chef i think what's being
[31:04]
offered here though is
[31:05]
something that uh what's being offered
[31:07]
here is the opportunity to uh to meet in our office you know and
[31:11]
have an in-depth discussion where we're
[31:12]
not limited by you know
[31:13]
we do have a pretty big big big agenda
[31:16]
tonight uh
[31:17]
would you be willing to participate in
[31:19]
that meeting
[31:22]
of course mayor if the invites is there
[31:24]
i i definitely will
[31:25]
attend that meeting okay so i'm gonna go
[31:27]
ahead and call on some of the members of
[31:28]
the uh
[31:29]
of the because i frankly i really do
[31:33]
appreciate the opportunity to go meet in
[31:35]
your office and uh
[31:36]
not that my comment should be said at
[31:37]
the beginning but i did
[31:39]
so let me go ahead and go to
[31:41]
councilmember tessier
[31:45]
thank you mr mayor um i just wanted
[31:48]
i'm really grateful for this opportunity
[31:51]
thank you
[31:51]
um miss bronconcia jordan for
[31:55]
um for being here um
[31:58]
and and i uh i want to add my apology
[32:02]
and i want to let you know that i do
[32:04]
have the utmost respect for you and all that you do um for our community you
[32:09]
apparently um work endlessly and
[32:12]
tirelessly
[32:14]
and on on the other hand i do also think
[32:16]
that council member shafts questions
[32:19]
um are um in this day and age i think
[32:22]
times have changed and we need to ask
[32:24]
some tough questions and
[32:26]
um recognizing that this case is um in you know litigation or going to
[32:34]
the supreme court we we need to
[32:36]
um back off on that um so i do
[32:39]
appreciate your invite and i and i
[32:42]
accept i look forward
[32:43]
to it and um just wanted to put it
[32:46]
put that out there that like and and
[32:49]
with regard to the community as well
[32:51]
this is this is not about
[32:53]
hitting one against the other this is
[32:55]
about us as a council
[32:57]
learning and learning together and
[33:00]
trying to understand
[33:01]
um everything so i don't i don't want to
[33:05]
make this a political thing
[33:06]
um i do want to make this a an opportunity where we learn and that
[33:13]
we can
[33:14]
apologize and and grow from from
[33:18]
miscommunications and mistakes and
[33:21]
i hope that we can move forward and
[33:25]
create a better relationship and
[33:29]
just wanted to put that out there so i
[33:31]
appreciate your time thank you
[33:34]
mayor tim thank you mayor
[33:38]
well um i just want to say that i i i
[33:41]
think that council member staff should
[33:42]
have the opportunity
[33:44]
to ask the questions as that's what i
[33:46]
understood this evening was about
[33:48]
and i do object to council member grooms
[33:51]
misuse of robert's rules of order
[33:54]
and the chair not correcting it it's
[33:56]
called a point of order
[33:58]
and if you want to make it you say point
[34:00]
of order
[34:01]
not call the meeting to order um
[34:05]
and i do believe that this was the
[34:06]
purpose of this night
[34:09]
um so to cut him off is
[34:12]
something i don't agree with but i do
[34:14]
appreciate the offer to have a meeting
[34:16]
i don't think we've ever had a meeting
[34:18]
with the coroner in the many
[34:20]
years we've had this contract so i
[34:22]
welcome the opportunity to have
[34:24]
regular meetings dialogue and to build
[34:27]
that relationship
[34:28]
thank you councilmember law evans
[34:35]
thank you mr mayor and i apologize first
[34:37]
of all can you hear me
[34:38]
i can okay very good my computer's
[34:41]
having some
[34:41]
issues tonight but um i uh
[34:45]
i appreciate this opportunity
[34:49]
to try and clear the air a little bit
[34:52]
i don't know if air has been cleared at
[34:54]
all but i appreciate the effort
[34:56]
that's gone behind it to set this up i
[34:59]
do
[35:00]
think that in the seven years that i've
[35:02]
been on council
[35:03]
um we have never gone through and looked
[35:07]
at the contract from a financial point
[35:09]
of view
[35:11]
and i am happy to do that however i do
[35:13]
feel that it is
[35:14]
inappropriate for this body to
[35:18]
um try and try and analyze the situation
[35:22]
this tragic
[35:23]
event that happened uh and and try and
[35:26]
investigate it and that was what um what i objected to
[35:30]
earlier
[35:32]
when we had the meeting some some weeks
[35:33]
ago where we approved this is
[35:36]
the process i want to make this point
[35:38]
that the process
[35:40]
investigating mr mclean's death
[35:43]
is working the attorney general has
[35:46]
called for a grand jury
[35:48]
and that's the way the process is
[35:50]
supposed to work
[35:51]
for us as a body who has
[35:56]
no formal responsibility in this case
[35:59]
for us to insinuate ourselves in that
[36:01]
process
[36:02]
is is quite frankly inappropriate and i understand
[36:06]
we're all concerned about the tragic
[36:10]
aspect of this case but
[36:13]
it seems to me that my responsibility to
[36:15]
the community
[36:17]
is to follow the process if if we
[36:19]
disregard the process
[36:21]
then suddenly we we are only a few short
[36:25]
steps from
[36:26]
um some sort of mob rule the likes of
[36:30]
which the country has seen
[36:32]
far too much of in the last uh year on
[36:35]
both
[36:36]
the extreme political right and the
[36:38]
extreme political left so so i feel that
[36:41]
um i would i would like to get more
[36:44]
information on this and i think
[36:45]
council member shafts procedural
[36:47]
questions in general understanding the
[36:49]
role of the coroner
[36:50]
and the procedures of the coroner's
[36:52]
office are appropriate
[36:54]
um ms bronkucci-jordan has to my
[36:57]
recollection has appeared before council
[36:59]
every single year when we have renewed
[37:02]
this contract
[37:03]
and i recall that she made the
[37:05]
invitation to us
[37:06]
every single year i do not know how many
[37:09]
council members have taken her up on it
[37:11]
to my regret i have not but i shall uh
[37:14]
now in the future
[37:15]
and i appreciate her making that that
[37:18]
gracious invitation so
[37:21]
um at this point i i am pleased that we
[37:24]
are moving forward
[37:26]
with um trying to understand this
[37:29]
the the big picture situation as regards
[37:32]
to
[37:32]
the responsibilities of the coroner
[37:36]
in broomfield and i hope that we can
[37:38]
strengthen this relationship going
[37:40]
forward
[37:41]
because again in my time on council ms
[37:43]
bronkucci jordan
[37:44]
and her office have done uh a stellar
[37:47]
job
[37:48]
there have never i there has never been
[37:51]
any complaint
[37:52]
that i recall about a case in broomfield
[37:55]
that that office has handled so
[37:57]
on that basis i appreciate the
[38:00]
opportunity to move forward and i very
[38:02]
much appreciate
[38:05]
the invitation from ms brancusha jordan
[38:07]
to
[38:08]
get more information on the process so
[38:11]
thank you mr mayor i appreciate the
[38:12]
opportunity to speak
[38:14]
councilmember grow
[38:18]
yes i would um like to take the
[38:21]
opportunity to publicly apologize to
[38:23]
council member shop
[38:24]
if i had upset him and the rest of
[38:25]
councils with using the wrong
[38:27]
terminology um at the beginning of the
[38:30]
meeting
[38:31]
it was said that um it was the
[38:34]
opportunity for miss bronkusha jordan to
[38:37]
come back
[38:38]
based on the terms of her accepting the
[38:40]
contract
[38:41]
so my bad interpretation but i do think
[38:44]
it is
[38:45]
a line of questioning that um we could
[38:47]
definitely take up
[38:48]
uh with additional training i too have
[38:51]
been here
[38:51]
um what three years now going on my
[38:54]
fourth
[38:54]
and always felt very comfortable with um
[38:57]
reaching out to the coroner's office if
[38:59]
needed
[39:00]
and i haven't needed to um and i really
[39:02]
respect you professionally
[39:04]
and i thank you for accepting the
[39:06]
contract and
[39:08]
please keep an open communication line
[39:11]
of communication with us so we can
[39:13]
all learn and move forward i i
[39:14]
appreciate it thank you very much
[39:17]
councilmember lim as
[39:20]
a new member of council i was actually
[39:22]
surprised
[39:23]
that we didn't have the opportunity to
[39:25]
ask questions about this important
[39:27]
contract
[39:28]
with the coroner especially given the
[39:34]
recent national events concerning racial
[39:38]
justice
[39:39]
i in general no matter what the
[39:43]
particulars of what the coroner was
[39:46]
involved in i would have expected to be
[39:48]
able to ask questions um about how
[39:51]
the coroner would investigate
[39:54]
deaths that were um a high profile
[39:59]
in the public um the agenda item was
[40:03]
uh about the coroner's contract was
[40:07]
at the end of the year we were
[40:10]
backed into a corner at a time when we
[40:13]
could hardly spend any time asking
[40:15]
questions
[40:16]
anymore so i feel like we were put in a
[40:19]
situation
[40:20]
which was very different from the
[40:22]
situation
[40:23]
um where the police department responded
[40:26]
after we
[40:27]
were asked
[40:30]
the public was asking questions about
[40:32]
how the police department handled racial
[40:34]
justice issues
[40:35]
the whole council was allowed to spend
[40:38]
an extensive amount of time
[40:40]
interacting with the police department
[40:42]
and how
[40:43]
they handle different situations so i
[40:46]
appreciated
[40:47]
that effort uh by the police department
[40:50]
to engage counsel in in their activities
[40:53]
so we could understand them better
[40:55]
and i also appreciate now that offer
[40:57]
from the coroner
[40:59]
um to have us
[41:02]
meet with her to understand her
[41:05]
efforts better but you know i was in the
[41:08]
situation where
[41:10]
i thought we would have been able to ask
[41:13]
questions of the coroner
[41:15]
um since it does seem to me to be an
[41:17]
important contract for the city
[41:19]
thank you i'm sorry i have a question um
[41:21]
council member
[41:25]
lim can you hear me yes yeah
[41:28]
you're saying that you didn't have an
[41:29]
opportunity i i just don't understand
[41:31]
that when you can pick up the phone and
[41:33]
call my office
[41:34]
if you have a question can i clarify
[41:37]
that comment because it was all part of
[41:38]
my letter my letter comment that uh
[41:41]
it it was the way it got put on the the
[41:43]
agenda
[41:44]
and and i think the mayor pro tem will
[41:46]
admit when we talked about the agenda
[41:47]
item before it went up
[41:48]
we didn't think there would be anything
[41:50]
controversial and so so
[41:52]
it just didn't get put on the agenda
[41:54]
when it should have it should have been
[41:55]
put on at a time in a way that there could have been questions and
[41:58]
i don't think that was the coroner's
[42:00]
fault i think it was uh
[42:01]
as i said in my letter there were a
[42:03]
whole bunch of things that happened but
[42:04]
now we have an opportunity to ask
[42:06]
questions
[42:06]
and go in depth
[42:11]
i think it's also important to
[42:13]
understand that um
[42:15]
you know i am not one of your staffers
[42:17]
so while i'm happy to have you out to my
[42:19]
facility to answer
[42:20]
questions i'm not going to come to every
[42:22]
council meeting
[42:23]
where there is a high profile case or um
[42:26]
something that you want to ask questions
[42:27]
about that's not
[42:28]
an arrangement i'm interested in and
[42:30]
maybe you need to explore options of
[42:32]
having a different coroner or your own
[42:33]
coroner's office
[42:35]
if that's something that you're looking
[42:36]
for
[42:40]
councilmember zazerski thank
[42:47]
yes i just re i appreciate um the
[42:50]
coroner's
[42:50]
efforts now to invite us ask questions
[42:54]
okay okay yeah i do want to thank um
[42:57]
miss brown cuccio jordan um
[43:00]
uh being here tonight and answering the
[43:02]
questions and also inviting us to her facility um to to discuss this
[43:08]
more i think that
[43:09]
i do appreciate that but i do want to
[43:12]
express that i was very disappointed um
[43:14]
earlier today um with the statements uh
[43:17]
that that was made
[43:18]
where you were really implying they're
[43:20]
doing broomfield a favor and
[43:22]
with these services and that really put
[43:23]
me off a bit um
[43:25]
so it's leaving a bad taste in my mouth
[43:27]
i could say that uh
[43:29]
just for some background the the
[43:31]
questions by devin that were raised here tonight
[43:34]
really aren't unusual for for this matter or any matter before
[43:37]
council i mean
[43:39]
he typically has questions on everything
[43:40]
that that we uh
[43:42]
um that that would be for us and we all
[43:44]
do i mean that's sort of our duty as council members is to ask
[43:47]
questions um when we have contracts that are you know
[43:51]
that we're supposed to approve so you
[43:54]
know
[43:54]
that shouldn't have been something that
[43:55]
was offensive to your office
[43:58]
um and yeah ultimately you know as you
[44:01]
mentioned we did unanimously
[44:02]
approve the the contract so um
[44:05]
there really um wasn't any distrust
[44:08]
there so i'm a little
[44:09]
concerned with uh the sort of
[44:11]
antagonistic position that
[44:13]
i'm sort of hearing here tonight and um
[44:15]
you know if this level of animosity does
[44:17]
continue i think it's gonna be
[44:18]
troublesome for the parties to move forward and we
[44:22]
may have to explore
[44:23]
um other options so i'd be open to that
[44:27]
you know if it has to go to that level
[44:32]
so you know
[44:35]
so there's no other comment so i'm going
[44:37]
to try to summarize where i think we're
[44:38]
at
[44:38]
and see if i can get work councils
[44:40]
headed um
[44:41]
the uh and councilmember shaft you know
[44:44]
and as i've said
[44:45]
and i and i said to uh miss broncia
[44:47]
jordan
[44:48]
that you have the right to ask the
[44:50]
questions and i'm not trying to stop you
[44:51]
from asking the questions tonight she
[44:53]
offered a forum uh that i thought might be more
[44:57]
you know more meaningful if we would
[44:59]
meet with her and you know in her
[45:01]
corner's office to talk about
[45:02]
talk talk about that that doesn't change
[45:05]
the fact
[45:06]
of the the fact that we as a council
[45:09]
should discuss continue with 120 days
[45:13]
the continuation i mean i'm not taking
[45:15]
that off the table what i think we need
[45:16]
to understand what she does and how she
[45:17]
doesn't
[45:18]
does she want to continue as
[45:20]
councilmember jasersky brought up
[45:22]
uh you know i don't think we're gonna
[45:23]
get all those answers tonight but i
[45:24]
think the really good way to start
[45:26]
would be for council to to do a site
[45:28]
visit
[45:29]
to the coroner's office and understand i think
[45:33]
frankly all of us well maybe i
[45:36]
understood
[45:37]
uh from my previous bill but i i think
[45:40]
quite a few of us didn't fully
[45:40]
understand how important these services
[45:42]
are
[45:42]
and how important they need to be done
[45:44]
and and i'm going to repeat what i said
[45:47]
in my my letter and that in my six years
[45:49]
as mayor and since then i'm not aware of
[45:51]
any complaints there's ever been
[45:53]
made against the coroner's office i
[45:55]
guess i don't think we understood the
[45:56]
fragile
[45:57]
relationship we had and i think it's a
[45:59]
fair way to state that right now
[46:01]
i would you know if the offer you know
[46:04]
i'd like to you know
[46:05]
i see enough heads nodding uh uh miss
[46:07]
brancusi jordan if you could work with staff uh
[46:11]
specifically jennifer to try to set up a
[46:13]
time
[46:13]
that that's convenient you know two
[46:16]
three weeks out so we can't have a a you
[46:19]
know a more meaningful dialogue
[46:22]
understand a little bit more about what
[46:23]
services you provide and how important
[46:24]
they are you know are you wanting to continue you
[46:28]
know can we develop a relationship on
[46:30]
which both sides are willing to continue
[46:32]
uh you know and then have council
[46:33]
discuss what is its obligations uh i
[46:36]
know you're not an employee
[46:37]
uh but but when we you know when we do
[46:40]
approve contracts with
[46:41]
you know with contractors council does
[46:43]
have a has an obligation to uh
[46:45]
to ask questions and do due diligence
[46:48]
and so uh
[46:49]
and i'll repeat my issue was never that
[46:50]
it was we just didn't set it up in a way
[46:52]
that it could be meaningful
[46:54]
uh we meaning uh uh staff and and
[46:57]
in in the mayor and we're but we learn
[47:00]
every day and so
[47:02]
i'm gonna trip so miss jordan would you
[47:04]
be willing to set up that meeting uh or
[47:05]
that uh
[47:06]
that time so we could meet with you at
[47:08]
your offices in the near future
[47:11]
of course that is a invitation that i've
[47:14]
extended
[47:14]
every year to this council for the last
[47:16]
10 years
[47:18]
i'm happy to set that up um and
[47:20]
obviously i signed the iga i'm willing
[47:23]
to continue this arrangement
[47:25]
but i think there needs to be an
[47:26]
understanding about what i'm willing to
[47:28]
um do and what i'm not and um
[47:32]
if you would like to go with a different
[47:33]
coroner's office that is
[47:35]
you know that is fine with me also
[47:37]
you've made that point very clear
[47:39]
several times tonight and which is why i
[47:41]
use the word the fragility of our
[47:42]
relationship
[47:43]
uh to be quite candid the uh uh
[47:46]
so i mean i don't want our relationship
[47:48]
to be fragile i want us to come to an
[47:49]
agreement
[47:50]
on where you understand what we want
[47:52]
from you and and we understand what
[47:54]
you're going to provide and and i think
[47:56]
meeting your offer is something the
[47:58]
council will not take up i categorically say in
[48:02]
the six years i was mayor before
[48:03]
i never took you up in the offer uh well
[48:06]
for some of those years you were at the
[48:07]
corner
[48:08]
and uh and uh but you work for a couple
[48:10]
of them and uh and so i appreciate the
[48:12]
offer
[48:12]
and i'm gonna leave it there uh
[48:15]
and uh and and move on that we will have
[48:18]
a meeting and council will have
[48:20]
discussions
[48:21]
uh about you know you know about the
[48:23]
coroner's office what what the coroner
[48:24]
does for us
[48:25]
what uh what we need and what and are
[48:27]
there options and hopefully you know
[48:29]
come to terms uh
[48:30]
but but uh um so i'm gonna leave it
[48:34]
there
[48:35]
and uh we're gonna move on to
[48:40]
my proclamation thank you uh
[48:43]
she's gone so thank you thank you very
[48:45]
much so
[48:48]
um so
[48:52]
let's move on to proclamations my
[48:55]
proclamation
[48:56]
uh the second item under under petitions
[48:59]
to communications this evening is a
[49:00]
proclamation condemning the riots on
[49:03]
january 6th at the u.s capitol
[49:04]
and a moment of silence to honor the
[49:06]
fallen u.s capitol of police officers
[49:08]
i will first read the proclamation and
[49:11]
then i'm going to ask for
[49:12]
a moment of silence on january 6
[49:15]
2021 congress was scheduled to certify
[49:18]
the presidential election after the
[49:19]
process of talitaline
[49:21]
the electoral college votes a mob stored
[49:24]
the
[49:24]
u.s capital in a chaotic riot disrupting
[49:28]
the final electoral account in a
[49:29]
shocking display of violence
[49:31]
that shook the core of amer american
[49:33]
democracy whereas within minutes of
[49:35]
breaching the capital complex
[49:37]
ahmad was pounding on the doors of the
[49:39]
house gallery where a group of lawmakers
[49:41]
were trapped including colored
[49:42]
representative jason crowe
[49:44]
for over 15 minutes those lawmakers were
[49:46]
seeking shelter
[49:48]
in the upper gallery in fear for their
[49:49]
safety before being moved to a secure
[49:51]
shelter
[49:52]
whereas the riots led to deaths of two
[49:54]
capitol police officers brian siknik
[49:57]
and howard liebengood and multiple
[49:59]
reported engine
[50:00]
injuries to other courageous police
[50:02]
officers whereas we condemned the acts
[50:04]
of the writers breaching the most
[50:06]
sacrosanct institution in the united
[50:07]
states
[50:08]
and the violence that ensued whereas one
[50:11]
of the most polarizing moments in our
[50:12]
nation's history should compel
[50:14]
republicans and democrats to lock arms
[50:17]
in solidarity to denounce the violence
[50:19]
and express their determination to carry
[50:21]
out
[50:22]
the will of the people the acts of these
[50:24]
rioters
[50:25]
compromise their safety as well as the
[50:28]
safety of many others
[50:29]
whereas is it is incumbent on all
[50:31]
elected officials to promote a calm
[50:33]
and thoughtful dialogue for disagreement
[50:35]
to be aired whereas there is no place
[50:37]
for divisive
[50:38]
rhetoric in a public forum as a city
[50:41]
council body and as individuals we must
[50:43]
promote healing
[50:44]
and stop utilizing social media
[50:46]
platforms to incite
[50:48]
and promote further attacks on personal
[50:49]
beliefs
[50:51]
and whereas the city and county of
[50:52]
brookville joins communities
[50:54]
across the nation and condemning the
[50:56]
deadly violence
[50:57]
honoring the fallen us capital of police
[50:59]
officers
[51:00]
and demanding those responsible are
[51:02]
brought to justice for their actions now
[51:04]
therefore i
[51:05]
patrick quinn mayor of the city and
[51:06]
county of bromfield do hereby declare
[51:09]
and proclaim condemning of the riots on
[51:12]
january 6
[51:13]
2021 at the u.s capitol and a moment
[51:16]
of silence to honor the fallen capital
[51:19]
police officers
[51:20]
let's have a moment of silence
[51:46]
we will now proceed with public comments
[51:47]
if there's any public comments uh on you
[51:50]
know
[51:50]
on my proclamation uh you will have
[51:53]
three minutes
[51:54]
recognize yours will recognize you for
[51:55]
the record
[51:58]
i'm not seeing any public comments uh
[52:00]
guilin
[52:01]
or mayor pro tem uh and uh again castle
[52:05]
remember does any member council
[52:06]
remember wanna offer any comments or
[52:08]
questions uh now would be the time to do it
[52:13]
councilmember law evans thank you mr
[52:15]
mayor
[52:16]
i uh i was pleased to see your
[52:18]
proclamation come across
[52:20]
email uh earlier and i completely agree that that uh the
[52:26]
actions by just a really a handful of
[52:32]
well i can't really say what i think of
[52:34]
them so i'll just call them jerks
[52:36]
um is despicable and and i completely agree that um that should
[52:42]
be condemned
[52:43]
there is no place as we talked about as
[52:46]
i talked about a few moments ago with
[52:48]
regards to
[52:49]
the process regarding the the
[52:51]
investigation of the death of elijah
[52:52]
mclean
[52:54]
that's what our our
[52:57]
laws and and civilization is built on
[53:00]
is is the process and in this case
[53:04]
um for whatever reason there's a lot of
[53:06]
process processes that have failed
[53:09]
and that's happened um all across the
[53:12]
political spectrum recently and
[53:14]
i condemn all all use of violence
[53:17]
as a tool to achieve one's ends so
[53:21]
uh thank you for this proclamation i
[53:22]
appreciate it thank you councilmember
[53:24]
ankle
[53:27]
thank you mayor i prepared something
[53:29]
that's about three minutes may i speak
[53:30]
to that
[53:32]
yes thank you let me close out
[53:37]
and this has just been on my heart um
[53:40]
just want to add some thoughts to our
[53:41]
proclamation based on the violence at
[53:43]
our capital last week
[53:45]
the feelings that we're all feeling
[53:46]
despair confusion
[53:48]
hurt being overwhelmed frustrated
[53:51]
trapped anxious dissatisfied protective
[53:55]
uncertain of our future these are just
[53:57]
what the tip of the iceberg and
[53:59]
what we're all feeling but pain is
[54:00]
something that we're all feeling too
[54:02]
and we can't move this through this pain
[54:04]
without naming it
[54:06]
so i will say and i walk aside alongside
[54:08]
my other council members and our
[54:09]
proclamation against the violence we all
[54:11]
witnessed
[54:12]
the police killings and the attack in
[54:14]
our democracy on sacred ground
[54:16]
perhaps broomfield can coalesce around a
[54:18]
deep-seated wound
[54:19]
we could all see with our own eyes
[54:21]
through the eyes of what it must feel
[54:22]
like to not be white
[54:24]
because our whiteness has been a numbing
[54:25]
agent from feeling what our bipod
[54:28]
population
[54:29]
feels every day a good friend of mine
[54:31]
who wanted to speak at the solidarity
[54:33]
march
[54:34]
last year told me that her 15 year old
[54:35]
black son saw what was happening last
[54:37]
week on tv and
[54:39]
he said he was too afraid to leave the
[54:40]
house for fear he may be killed by
[54:42]
someone who felt emboldened by
[54:44]
the insurrection but this isn't the
[54:46]
first time he's felt this
[54:48]
so we have to think about what this
[54:49]
means for our broomfield bi-pop
[54:51]
neighbors
[54:52]
and this isn't blame and shame but i do
[54:53]
think it's important to name
[54:55]
exactly what we witnessed as a christian
[54:58]
it broke me to see a cross
[54:59]
being erected alongside a noose a white
[55:02]
supremacist that wore a shirt that says
[55:04]
jesus saves
[55:05]
it broke me further to see anti-semitic
[55:07]
t-shirts that read camp auschwitz
[55:10]
and on the back staff another one that
[55:12]
said six nwe
[55:13]
which means that when hitler and the
[55:14]
nazis killed millions of jews
[55:17]
six million wasn't enough they flew an
[55:19]
enemy flag at the capitol
[55:20]
they desecrated monuments and urinated
[55:22]
on carpets
[55:24]
there were bombs at both the dnc and rnc
[55:26]
police officers were killed
[55:28]
so it's apparent this tack isn't
[55:29]
political um and me and my husband both
[55:32]
voted for bush
[55:33]
and has broken his conservative heart to
[55:35]
hear
[55:36]
our one leader of the united states
[55:38]
called the charlotteville nazis very
[55:39]
fine people
[55:40]
the proud boys stand by these
[55:42]
insurrectionists and bombers we love you
[55:45]
mexican immigrants rapists and muslims
[55:48]
terrorists
[55:49]
i'm thankful to hear that our colorado
[55:50]
republican chapter condemned the attack
[55:53]
but this isn't republican versus
[55:54]
democrat issue this is deeper
[55:56]
and we have to wonder what we are
[55:58]
letting a political
[56:00]
how we are letting political party be
[56:01]
ensnared by our biggest demons
[56:03]
that we need to address which is racism
[56:05]
and bigotry
[56:07]
thankfully we can land on the
[56:08]
gratefulness of the unsung heroes
[56:10]
quick thinking aides who protected the
[56:12]
electoral college votes and boxes that
[56:13]
contain the songs of the will of the
[56:15]
american people
[56:16]
and our protected democracy the black
[56:19]
police officer eugene goodman who lured
[56:21]
the mob away from the unprotected
[56:23]
senate floor and even our known
[56:25]
congressman jason crowe who helped
[56:27]
others as his only weapon was a pen i
[56:30]
can even see bright stars among some of
[56:32]
my voting
[56:32]
family and friends who are on the other
[56:34]
side who openly denounce
[56:36]
the president's leadership of this
[56:37]
attack and on the attackers themselves
[56:39]
so i stand unified against racism and
[56:41]
bigotry the violence on our capital
[56:44]
and i stand for our democracy she is our
[56:46]
ultimate hero
[56:47]
and she's going to need all of us
[56:49]
republicans democrats
[56:50]
and more to see that her great nation
[56:52]
can heal as we all stand together
[56:54]
against our greatest demons
[56:56]
to let our bipark neighbors feel safer
[56:57]
and broomfield thank you um i'm not noting any other comments so i'm going to move
[57:09]
on to
[57:10]
councilmember groan
[57:14]
sorry about that i thought my hand was
[57:15]
raised um
[57:17]
yeah i i really just wanted to comment
[57:19]
on this
[57:20]
and it's very disheartening it's very
[57:22]
upsetting to see what's happening
[57:24]
in our country and the fact that we're
[57:27]
letting
[57:27]
you know five percent or not one percent
[57:30]
of
[57:31]
the people um divide us and make this a
[57:34]
republican versus democrat we all um i
[57:38]
have not met
[57:38]
anyone anyone in my life or or anyone
[57:41]
has commented
[57:42]
that they support violence in any means
[57:45]
any way shape or form um no matter no
[57:48]
matter what the cost
[57:50]
um is so i i just want to
[57:54]
say to everyone on this council i am
[57:58]
thankful that we as republicans
[58:01]
democrats unaffiliated as independents
[58:04]
can still move forward and talk and have
[58:08]
open dialogue
[58:09]
and have empathy and listen to both
[58:11]
sides because
[58:13]
that's what's going to move us together
[58:14]
as a country and
[58:16]
that's what they need to learn from us
[58:19]
at the very top
[58:20]
levels so thank you
[58:26]
i'm gonna move on to uh public comments
[58:29]
for items not on the agenda next
[58:32]
um we will move to public comments next
[58:34]
this is an opportunity for the public
[58:36]
to comment on matters other than the
[58:38]
items already listed on this evening's
[58:40]
agenda
[58:40]
to be placed in the queue for comment
[58:42]
please call 855-6953-744
[58:46]
and press star 3 public comments will be
[58:49]
limited to three minutes
[58:52]
i'm not seeing anybody uh mayor for them
[58:56]
um so council's community and event updates are next does any member
[59:01]
of council have an update this evening
[59:03]
please raise your hand
[59:06]
councilwoman tessier
[59:10]
thank you mr mayor um so
[59:13]
i was at the housing advisory committee
[59:15]
meeting on monday
[59:17]
and i just wanted to
[59:20]
they asked me to kind of let you know to
[59:23]
that they're coming uh they're gonna be
[59:26]
speaking in front of council
[59:27]
and um so call front and nancy rogers
[59:31]
are in discussion
[59:32]
on looking at attorneys um as we
[59:35]
transition to be an
[59:37]
independent housing authority um and
[59:39]
they're also
[59:40]
looking specifically to look at
[59:42]
relations with council
[59:45]
and how the the independent housing
[59:48]
authority
[59:49]
would relate to the city and county of
[59:51]
broomfield and the community at large
[59:53]
so if you have questions or want to
[59:55]
contact them now
[59:57]
please feel free to reach out to them
[59:59]
the communications subcommittee
[1:00:01]
is looking at new ways to access the
[1:00:04]
silent majority
[1:00:06]
and our most vulnerable so if any of you
[1:00:10]
have any ideas on how to do that we're
[1:00:12]
welcoming
[1:00:13]
that um also the
[1:00:16]
council when we approved the matrix for
[1:00:19]
the inclusionary housing
[1:00:21]
uh zoning
[1:00:24]
believe it or not that was in march of
[1:00:28]
uh 2019 so we are taking a look
[1:00:31]
at that um again
[1:00:35]
this march to review whether or not it
[1:00:38]
is
[1:00:38]
um you know to determine the cash in
[1:00:42]
lieu and wondering if we need to either up the cash in lieu
[1:00:46]
um
[1:00:46]
so it's not um because we want we want
[1:00:49]
bricks and mortar
[1:00:50]
more than the cash in lieu um so i want
[1:00:53]
you to start thinking about that
[1:00:55]
and then um be hack
[1:00:58]
is also getting ready to look at the
[1:01:00]
program finance formula
[1:01:02]
um so just wanted to throw that out
[1:01:05]
there
[1:01:05]
and they are excited to come before you
[1:01:09]
all and
[1:01:10]
if you had questions around anything
[1:01:12]
that i said please
[1:01:13]
don't hesitate to reach out to the the
[1:01:16]
housing author
[1:01:17]
advisory committee thank you mayor i just wanted to let
[1:01:29]
everybody know that we
[1:01:30]
are accepting applications for our
[1:01:33]
boards and commissions
[1:01:35]
until january 24th i don't have the
[1:01:38]
website
[1:01:39]
at the top of my mind but if somebody
[1:01:40]
from staff wants to chime in
[1:01:42]
and i think it's broomfield.org b and c
[1:01:46]
to get more information but please
[1:01:48]
correct me if
[1:01:50]
i'm wrong
[1:01:53]
city manager give us
[1:01:57]
eight seconds i didn't mean to stump
[1:02:00]
y'all i'm so sorry
[1:02:02]
oh no you're fine i'm sure it's all
[1:02:04]
there and uh we would love to have as
[1:02:06]
many people as we can apply
[1:02:08]
we have over 30 openings
[1:02:13]
broomfield.org boards and commissions
[1:02:17]
thank you spelled out boards and
[1:02:19]
commissions
[1:02:21]
right okay all right
[1:02:25]
and i'll also point out americorps tim
[1:02:26]
that uh it's something i guess
[1:02:28]
i think i knew it but i'd forgotten that
[1:02:32]
the plan planning and zoning and the
[1:02:35]
plan for bifurcating planting and zoning
[1:02:37]
into two different commissions so we're
[1:02:38]
not going to be filling those positions
[1:02:40]
right now
[1:02:41]
um we had we had some members of the
[1:02:42]
community that had questions on it and
[1:02:44]
so
[1:02:44]
uh so i just wanted to point that out
[1:02:47]
that that we weren't
[1:02:48]
we will be asking for uh people to apply
[1:02:51]
and 11 members to reapply
[1:02:52]
for planning and zoning and miss hoffman
[1:02:55]
what do you think that will be
[1:03:02]
um bifurcating it is coming back to
[1:03:04]
council for a second reading because we
[1:03:06]
need to
[1:03:06]
modify that ordinance so we're unable to
[1:03:09]
recruit until that occurs so we believe
[1:03:12]
that recruit
[1:03:13]
not we believe recruitment begins um
[1:03:16]
for boards i'm i'm looking over at um
[1:03:20]
for social distancing so abby's way at
[1:03:22]
the other end of the diocese so
[1:03:24]
the tentative schedule i believe is
[1:03:26]
february 24th
[1:03:28]
that the applications will open with a
[1:03:29]
closure date of march 12th that's the
[1:03:31]
tentative schedule right
[1:03:33]
february 24th to march 14th
[1:03:37]
okay make the comment mirror program
[1:03:40]
and see that board administration okay
[1:03:44]
any other uh comments
[1:03:47]
from council or you know announcements
[1:03:50]
we will move on to the consent agenda
[1:03:53]
uh council's consideration of the
[1:03:55]
consent agenda is next
[1:03:56]
before the clerk reads the consented jet
[1:03:58]
items by title
[1:04:00]
items 7 i and 15
[1:04:03]
b includes both an intergovernment
[1:04:05]
agreement as well as a resolution
[1:04:06]
needing review and approval
[1:04:08]
by the broomfield urban renewal
[1:04:09]
authority intergovernmental
[1:04:11]
agreements require affirmative votes of
[1:04:13]
two-thirds of the entire council
[1:04:15]
so for the purpose of the coordination
[1:04:16]
and in the interest of time
[1:04:18]
i will convene the broomfield urban
[1:04:20]
renewal authority so that we may review
[1:04:21]
this item
[1:04:22]
as part of the consent agenda the
[1:04:24]
meeting of the broomfield urban revival
[1:04:26]
authority is called to order
[1:04:27]
and i will ask the clerk to call the

[1:09:21]

[1:09:34]

[1:09:41]

[1:09:55]
uh well is there any further disguise or
[1:09:57]

[1:10:45]
uh well there is no business before the
[1:10:48]
board of social services this evening
[1:10:51]
um we will convene as the board of
[1:10:53]
health that we have one item for the
[1:10:54]
board of health
[1:10:55]
uh which is staff will provide an update
[1:10:58]
on cobia 19.
[1:10:59]
uh yesterday public health staff hosted
[1:11:01]
a q a
[1:11:02]
with city council to provide additional
[1:11:04]
time for council to ask questions
[1:11:06]
pertaining to copa 19 and the impact on broomfield i'll also point out there
[1:11:10]
was a fair amount of discussion on vast
[1:11:12]
vaccinations uh the recording of the
[1:11:14]
live stream as well as the presentation
[1:11:16]
slides
[1:11:16]
are available on this evening's agenda
[1:11:19]
items linked under item 9a
[1:11:21]
staff will continue to offer these q a
[1:11:24]
sessions with council weekly from
[1:11:27]
it says 3 30 to 4 30 p.m aren't we doing
[1:11:30]
it at four o'clock
[1:11:30]

[1:11:42]

[1:12:32]
we have a copy the board members have a
[1:12:33]
copy of the agenda memorandum
[1:12:35]
which staff will summarize
[1:12:38]
thank you mayor and council good evening
[1:12:40]
jason balling director of public health
[1:12:43]
will walk us through this slide and he
[1:12:45]
and deb fetterspiel will be available
[1:12:47]
for questions jason
[1:12:50]
uh yeah thank you uh mayor mayor pretend
[1:12:53]
and council members as was mentioned we
[1:12:55]
did we provided an
[1:12:57]
in-depth uh presentation yesterday so
[1:13:00]
i'm gonna
[1:13:01]
hit some of the key highlights
[1:13:04]
and then save time for questions
[1:13:08]
one thing is specifically what's
[1:13:09]
happening around epi trends
[1:13:12]
and we're still monitoring the effect of
[1:13:15]
the holidays
[1:13:17]
we're seeing uh we're moving past
[1:13:20]
the um christmas holidays to stop
[1:13:24]
now start to understand the impact of
[1:13:26]
the
[1:13:27]
new year's holidays right now we're just
[1:13:29]
seeing slight increases
[1:13:31]
built in colorado and broomfield
[1:13:34]
we'll have to see if that's a trend that
[1:13:37]
continues or plateaus
[1:13:39]
and moves down so we'll continue to
[1:13:42]
monitor that
[1:13:44]
other good news is that uh
[1:13:46]
hospitalizations continue to decline
[1:13:49]
um in the states uh region
[1:13:52]
uh and in broomfield um although the
[1:13:56]
pace of the decrease slowed uh
[1:13:59]
specifically over the
[1:14:01]
uh holiday season so we'll see if that
[1:14:04]
decrease um begins to
[1:14:08]
uh pick up again everybody has heard
[1:14:11]
about
[1:14:11]
the variant that is out there
[1:14:15]
the state lab continues to
[1:14:19]
test for that variant they've identified
[1:14:22]
type cases in colorado
[1:14:27]
at this point uh those cases were not
[1:14:29]
traveling
[1:14:30]
so we suspect that there may be
[1:14:33]
additional cases that could be
[1:14:35]
identified
[1:14:36]
um in colorado um so we'll continue to
[1:14:39]
monitor that the reason the variant is
[1:14:43]
important is because its
[1:14:45]
transmissibility is much more
[1:14:47]
higher than the the current some of the
[1:14:50]
current strains of covid19
[1:14:53]
and if it starts to become one of the
[1:14:56]
dominant
[1:14:56]
variants we could see transmissibility
[1:14:59]
increase
[1:15:00]
in the state and in the region we spent
[1:15:03]
fair amount of our time discussing
[1:15:06]
vaccine
[1:15:07]
distribution yesterday and
[1:15:11]
really walking through with the recent
[1:15:14]
changes
[1:15:15]
from the um federal government and
[1:15:18]
the state government the impact
[1:15:22]
to broomfield one thing that we did
[1:15:25]
clarify is how the vaccine is actually
[1:15:29]
allocated and distributed so each week
[1:15:33]
the colorado department of public health
[1:15:35]
and environment
[1:15:37]
is alerted to what their vaccine
[1:15:40]
allocation
[1:15:41]
will be and just to provide some context
[1:15:45]
is
[1:15:47]
in order for us to vaccinate everybody
[1:15:50]
in
[1:15:50]
phase 1a and phase 1b we're looking at
[1:15:55]
a total of 1 million 219 people that
[1:16:00]
need to be vaccinated
[1:16:02]
and currently the state as of january
[1:16:06]
7th had received 282
[1:16:10]
000 uh doses um and 217 000 of those had
[1:16:14]
been
[1:16:15]
um administered to get shots in people's
[1:16:18]
arms
[1:16:20]
the other thing is over 50 percent of
[1:16:23]
vaccines are being distributed to
[1:16:27]
hospitals to vaccinate the 70 plus
[1:16:30]
population
[1:16:33]
10 percent is being um delivered to
[1:16:36]
retail pharmacies to vaccinate the 70
[1:16:39]
plus population
[1:16:41]
uh another 20 going to federally
[1:16:44]
qualified health centers
[1:16:45]
and then 20 coming to local public
[1:16:48]
health agencies
[1:16:49]
and our community partners
[1:16:53]
and the other thing i think that is
[1:16:55]
important for us to realize is
[1:16:58]
broomfield has moved fairly quickly
[1:17:01]
through
[1:17:02]
uh vaccinating uh our phase one
[1:17:05]
providers those
[1:17:06]
in the hospital system and also our
[1:17:09]
first responders
[1:17:11]
um broomfield public health is now
[1:17:13]
focusing our energy and efforts on
[1:17:15]
vaccinating those
[1:17:16]
other health care providers that
[1:17:20]
have interactions with those that
[1:17:23]
may have covid and so
[1:17:27]
we're going through that process of
[1:17:30]
making sure those individuals are
[1:17:32]
getting vaccinated
[1:17:34]
another thing that is a success for
[1:17:36]
broomfield is
[1:17:38]
about 10 of our brimfield residents 70
[1:17:41]
plus
[1:17:42]
have received at least one dose of the
[1:17:45]
vaccine
[1:17:46]
um and we're one of the counties that
[1:17:48]
have moved quickly into that 70 plus
[1:17:51]
age group and then lastly
[1:17:55]
we have two long-term care facilities
[1:17:58]
that have started been vaccinated
[1:18:00]
started that started on monday and we
[1:18:03]
have a third scheduled
[1:18:04]
for january 23rd
[1:18:07]
um another thing i just want to
[1:18:09]
emphasize is we fully acknowledge
[1:18:12]
the challenges with
[1:18:15]
the 70 plus population and receiving the
[1:18:19]
vaccine
[1:18:21]
part of this is that the hospital
[1:18:23]
systems are
[1:18:24]
developing their systems for
[1:18:28]
people to receive the vaccine
[1:18:32]
that means that somebody that has had a
[1:18:34]
touch with a hospital system
[1:18:38]
potentially they should receive um
[1:18:41]
information from that hospital system of
[1:18:44]
how to
[1:18:45]
um get an appointment the second thing
[1:18:48]
is they're setting up online portals
[1:18:52]
with all of that we know that our 70
[1:18:54]
plus uh
[1:18:55]
population will not be vaccinated in the
[1:18:57]
next week or the next
[1:18:59]
two weeks so we just ask for patients as
[1:19:01]
we go through this process
[1:19:03]
and then finally ending with some of the
[1:19:05]
policy updates
[1:19:06]
we continue to partner with atoms12
[1:19:10]
on their plans for potentially returning
[1:19:14]
to
[1:19:14]
in-person learning they plan to make a
[1:19:17]
decision by
[1:19:18]
january 25th right now they're
[1:19:22]
considering
[1:19:23]
elementary school in person and
[1:19:25]
potentially hybrid for middle school and
[1:19:27]
high school
[1:19:29]
boulder valley school district has
[1:19:31]
started in person learning for
[1:19:32]
elementary
[1:19:34]
and middle school and high school have
[1:19:36]
started hybrid
[1:19:37]
uh we've been in uh conversations with
[1:19:40]
the local districts that are making
[1:19:42]
decisions regarding
[1:19:44]
the season b chassis sports
[1:19:47]
obviously there's some concerns about
[1:19:49]
specific sporting activities such as
[1:19:51]
wrestling
[1:19:52]
where you can't wear a mask so we're
[1:19:54]
trying to problem solve with those
[1:19:56]
districts since it's ultimately their
[1:19:58]
decisions on some of the ways they can
[1:20:00]
mitigate that
[1:20:01]
such as testing wrestlers potentially
[1:20:05]
holding wrestlers out
[1:20:08]
from school from a period of time after
[1:20:11]
meets
[1:20:13]
or even the possibility of looking to
[1:20:16]
delay
[1:20:17]
the season until we get more vaccines
[1:20:21]
out there but ultimately it's the
[1:20:23]
decision
[1:20:23]
of the districts uh the governor's
[1:20:26]
office
[1:20:27]
and chasseum and then lastly
[1:20:30]
great success with our back to business
[1:20:32]
certification program
[1:20:34]
22 businesses have been certified by our
[1:20:37]
administrative committee
[1:20:38]
as of uh january 11th
[1:20:42]
and with that that concludes my
[1:20:44]
presentation and i'd be happy to answer
[1:20:46]
any questions we didn't answer yesterday
[1:20:52]
okay we'll go to uh we'll go to public
[1:20:55]
comments next
[1:20:58]
um if there's anybody here that wants to
[1:21:06]
comment uh um
[1:21:11]
so we have somebody wants to come on 11
[1:21:13]
a um i'm just saying this is item nine
[1:21:16]
um i don't see anybody who who wants to
[1:21:18]
comment on uh
[1:21:20]
our ask questions on this uh so i'll go
[1:21:22]
to council uh and start with
[1:21:23]
councilmember tessier
[1:21:26]
thank you mr mayor um thanks for that
[1:21:28]
presentation jason
[1:21:30]
um i'm sorry i couldn't make it uh
[1:21:33]
to the to the presentation you gave yes
[1:21:36]
uh on monday
[1:21:37]
i uh i can't i can't make those
[1:21:40]
typically due to work but i just had one quick question i know you guys are
[1:21:46]
doing everything you can to get the
[1:21:47]
seniors
[1:21:48]
um their vaccinations and i wasn't sure
[1:21:52]
if um like a mobile
[1:21:55]
vaccination is there any
[1:21:58]
discussion if a mobile vaccination kind
[1:22:01]
of
[1:22:02]
process would would work i think our
[1:22:05]
seniors are
[1:22:06]
a little confused they have to kind of
[1:22:09]
you know go to their provider's website
[1:22:11]
you know check hour by hour sometimes i
[1:22:13]
got a letter from a particular senior
[1:22:16]
and then some of the seniors are calling
[1:22:18]
fish and
[1:22:20]
you know they're just there's a there's
[1:22:22]
a lot of confusion if they're not
[1:22:23]
technologically
[1:22:24]
savvy um there's there's that too
[1:22:28]
so i don't know um maybe you could talk
[1:22:31]
a little bit about that or like how you plan on
[1:22:36]
maybe the process to vaccinate the
[1:22:39]
remaining seniors
[1:22:41]
that would be most helpful thank you
[1:22:45]
councilmember tessier and i i appreciate
[1:22:47]
the uh that question
[1:22:49]
um a couple things to keep in mind as
[1:22:53]
far as the specific allocations that are
[1:22:56]
coming to brimfield public health um you
[1:22:59]
know we
[1:23:00]
right now have a very limited supply so
[1:23:02]
as we start to think about
[1:23:04]
mobile vaccination clinics we want to be
[1:23:07]
very
[1:23:08]
thoughtful and targeted in the approach
[1:23:11]
not to create a
[1:23:13]
expectation out in the community and
[1:23:15]
you're seeing some of this in other
[1:23:17]
states where they're doing
[1:23:19]
large or even mid-sized
[1:23:22]
drive-through clinics and people waiting
[1:23:24]
in line for
[1:23:26]
a full day and then ultimately not being
[1:23:28]
able to get their vaccine
[1:23:30]
so what we've been doing with my
[1:23:34]
leadership team is
[1:23:35]
really focusing our energy and efforts
[1:23:38]
now that we understand fully the state's
[1:23:42]
plan
[1:23:43]
of how do we equitably get the vaccine
[1:23:46]
out
[1:23:47]
to brimfield residents that are 70 plus
[1:23:51]
and what that involves is
[1:23:54]
the partnership that we have with the
[1:23:57]
hospital system so we've spent the
[1:23:59]
day today on the phone with all of our
[1:24:02]
hospital systems to figure out
[1:24:04]
specifically what are they doing to
[1:24:05]
reach our broomfield residents as part
[1:24:07]
of their catchment areas
[1:24:09]
uh the second thing that we're doing is
[1:24:12]
um
[1:24:12]
reaching out to our culturally qualified
[1:24:14]
health centers
[1:24:15]
and better understanding their plans and
[1:24:18]
then the third thing we are doing
[1:24:20]
is we're specifically identifying those
[1:24:22]
areas where
[1:24:23]
we do believe there could potentially be
[1:24:25]
gaps um
[1:24:27]
and not being able to get the vaccine
[1:24:29]
and how can we
[1:24:31]
directly administer that and get the
[1:24:34]
vaccine out to those individuals and
[1:24:36]
groups and we've started that outreach
[1:24:38]
already our team identifying specific
[1:24:42]
neighborhoods and some of the
[1:24:46]
ambassadors within those neighborhoods
[1:24:48]
to make sure it can happen
[1:24:50]
as we get that flushed out we plan
[1:24:54]
to execute on it
[1:24:57]
um and then the next step of that
[1:25:00]
is we're already doing two things one is
[1:25:04]
planning for this immediate 70 plus but
[1:25:07]
also planning for
[1:25:08]
where do we need to go in the future so
[1:25:10]
as we talk about
[1:25:12]
uh moving further on down the list we're
[1:25:14]
going to get to 65
[1:25:16]
and and then we're going to get down to
[1:25:18]
our phase 2 group
[1:25:20]
and we want to be really well positioned
[1:25:22]
to be able to execute on all of that
[1:25:24]
and i shared yesterday our strategy
[1:25:28]
is to make sure as many of our providers
[1:25:31]
in broomfield are
[1:25:32]
enrolled as providers because that's the
[1:25:35]
natural network for people to go and get
[1:25:37]
vaccines either their pharmacy
[1:25:39]
or their provider if they can't do that
[1:25:42]
that's the gap-filling role that public
[1:25:44]
health will step in
[1:25:45]
and fulfill some more information to
[1:25:48]
come on that as our plans get flushed
[1:25:50]
out but the outreach is happening right
[1:25:51]
now
[1:25:53]
thank you so much and just again
[1:25:55]
gratitude much gratitude to you and your
[1:25:57]
team
[1:25:58]
you have been working just phenomenal
[1:26:02]
amounts
[1:26:02]
and um we appreciate you and i just want
[1:26:05]
to make sure that you have all the team
[1:26:07]
members that you need in order to make this successful and to not
[1:26:12]
uh wear yourselves too thin or out
[1:26:16]
completely
[1:26:17]
burnout is so real right now and
[1:26:21]
you know i care deeply about the health
[1:26:24]
and and wellness of of you all as much
[1:26:27]
you know and just really want to make
[1:26:30]
that clear
[1:26:31]
i'm going to start crying but like i
[1:26:32]
know how much you guys do so
[1:26:35]
um it's much appreciated and i just want
[1:26:38]
to
[1:26:38]
just make sure you're taking care of
[1:26:40]
yourselves and uh in this in this process too thank
[1:26:44]
you so much
[1:26:45]
thank you matt councilmember tessier i
[1:26:47]
appreciate that and i can tell you we
[1:26:49]
have the full support when we go to
[1:26:51]
the city and county manager's office on
[1:26:55]
additional resources that we need in the
[1:26:57]
timing of that to have those
[1:26:58]
conversations
[1:27:00]
and so if that ever gets to the point
[1:27:02]
where we know that we need to
[1:27:04]
make that ask we're ready to go and our
[1:27:07]
county
[1:27:08]
city and county manager is always
[1:27:10]
willing to hear
[1:27:12]
what we need any other questions or
[1:27:16]
comments
[1:27:19]
uh you know i already repeat something i
[1:27:21]
said yesterday
[1:27:22]
uh you know there are a couple of things
[1:27:24]
uh jason on your staff
[1:27:26]
i'd ask questions about some of you know
[1:27:28]
some of the numbers you know to be more
[1:27:30]
clear
[1:27:30]
so you can see the weekly totals and i
[1:27:32]
was i mean
[1:27:34]
i'm unbelievably impressed on how those
[1:27:36]
numbers popped out and i just want to
[1:27:37]
thank everybody for that
[1:27:38]
and i also want to just say that it and
[1:27:41]
it's kind of a strange night to say the
[1:27:42]
least so i'm going to be careful of my
[1:27:44]
wording here but it's almost at times
[1:27:45]
embarrassing how
[1:27:46]
nimble brookfield is uh we were so quick
[1:27:49]
out of the gate to get the business
[1:27:51]
you know it became clear that you know
[1:27:53]
it became pretty clear over christmas
[1:27:55]
and i think jennifer and i first talked
[1:27:56]
about it the tuesday before christmas
[1:27:59]
that you know it's pretty clear that
[1:28:00]
that's what the city wanted and that's
[1:28:02]
what the council wanted
[1:28:03]
and we moved with lightning speed you
[1:28:05]
know you guys
[1:28:06]
23 inspections and i guess i haven't
[1:28:09]
asked you what happened to the 23rd one
[1:28:10]
but we approved 22 last week
[1:28:13]
you know that uh i just i just want to
[1:28:15]
say
[1:28:16]
for the record and i said you know i was
[1:28:18]
interviewed a few times this week
[1:28:19]
you know just because that's i guess
[1:28:20]
that's what mayors get to do and uh
[1:28:22]
but uh but how the staff moved you know
[1:28:24]
from jennifer on down to
[1:28:26]
chief krieger because i know i think
[1:28:28]
what makes it so impressive was how
[1:28:30]
multi-discipline
[1:28:31]
you know the the response was and the
[1:28:33]
businesses obviously responded
[1:28:35]
i mean i think i read today was it's 45
[1:28:38]
applications now
[1:28:41]
so and so for everybody to know you know
[1:28:43]
on the business you know we will uh
[1:28:45]
we have an administrative committee and it's it's required by you know
[1:28:49]
by ever how we got enabled by cdphe
[1:28:52]
that we'll meet every friday morning at
[1:28:54]
10 a.m
[1:28:55]
uh you know just so so so there's no
[1:28:57]
disruptions and i want to give jennifer and you credit
[1:29:00]
for that making that a standing meeting
[1:29:02]
so you don't have to worry about
[1:29:03]
scheduling each time
[1:29:04]
so i suspect there'll be a more
[1:29:06]
approvals on friday is that correct
[1:29:08]
jason that's my understanding and
[1:29:12]
jen you you agree but i i mean i i mean
[1:29:14]
it's
[1:29:15]
you know once again when you're sitting
[1:29:16]
and talking to other mayors
[1:29:18]
you know like you take the mayor went
[1:29:19]
smithson he's in jefferson and he's in
[1:29:21]
adams county
[1:29:22]
and then if you add adams county then
[1:29:23]
you have the tri-county's health and uh
[1:29:26]
they feel so far removed uh and you know
[1:29:29]
and and they care as much as we do to have
[1:29:31]
their businesses up and operating that
[1:29:32]
uh
[1:29:33]
it's a just it's a little it's
[1:29:35]
embarrassing because we're just we're
[1:29:36]
able to leap out ahead about everybody
[1:29:38]
else but i'm glad we can do that for our
[1:29:40]
businesses so
[1:29:41]
thank you jason and uh and we will move
[1:29:43]
on uh
[1:29:45]
to uh well i'll start with there's no
[1:29:47]
business before the broomfield housing
[1:29:48]
authority this evening
[1:29:50]
um um
[1:29:58]
so we'll move on to council business at
[1:30:00]
7 30
[1:30:02]
so our first item under council business
[1:30:04]
evening is the public hearing
[1:30:05]
and council's consideration of proposed
[1:30:07]
ordinance number 2146
[1:30:09]
ex stating the prohibition of mayor
[1:30:11]
certain marijuana establishments
[1:30:13]
in brookfield i will declare the public
[1:30:15]
carrying open
[1:30:16]
we will follow the city's standard
[1:30:17]
public hearing procedures first staff
[1:30:19]
will present a summary of the proposal
[1:30:21]
next we will have the applicant's
[1:30:23]
presentation if applicable
[1:30:25]
then we will ask for public comments and
[1:30:27]
final comments
[1:30:29]
uh you know there's no applicant here
[1:30:31]
and uh
[1:30:32]
and finally questions the comments from
[1:30:33]
the city council so council
[1:30:35]
has a copy of the agenda memorandum
[1:30:37]
which staff will summarize
[1:30:41]
thank you mayor and council christine
[1:30:43]
francis connie
[1:30:44]
will walk us through this second reading
[1:30:47]
you will
[1:30:48]
notice that the date has been extended
[1:30:50]
from
[1:30:51]
april to may 1st that is a buffer
[1:30:55]
we will talk more about that staff is
[1:30:57]
intending to meet
[1:30:58]
that april 1st guideline but it's really
[1:31:01]
dependent on
[1:31:04]
how well staff captured the first
[1:31:06]
go-around
[1:31:07]
from council and resident comments we
[1:31:10]
just want to be sure that staff had
[1:31:12]
enough time that if there's fundamental
[1:31:14]
changes
[1:31:15]
after the second round that we have time
[1:31:16]
to incorporate them
[1:31:18]
to ensure that the final product is
[1:31:21]
exactly what
[1:31:22]
council and and the community wants and is expecting
[1:31:26]
uh christine good evening
[1:31:30]
this is the second reading of ordinance
[1:31:32]
number 2146.
[1:31:34]
uh the moratorium on marijuana
[1:31:36]
establishments in broomfield currently
[1:31:38]
expires on january 30th
[1:31:41]
2021. uh next slide please
[1:31:46]
as currently drafted the ordinance will
[1:31:48]
allow the prohibition
[1:31:50]
on retail marijuana sales to expire on
[1:31:52]
april 1
[1:31:53]
2021 while the prohibition on
[1:31:55]
cultivation and manufacturing
[1:31:57]
will stay in place through april 1st
[1:31:59]
2025
[1:32:01]
on december 8th 2020 council approved
[1:32:03]
the ordinance on first reading
[1:32:05]
which was followed by a study session to
[1:32:08]
discuss marijuana regulation on december
[1:32:10]
15
[1:32:10]
2020. next slide please
[1:32:14]
while staff does remain confident that
[1:32:16]
the april first date remains achievable
[1:32:19]
staff wants to ensure that if at the
[1:32:21]
next council meeting
[1:32:22]
which is the first reading of the
[1:32:24]
marijuana regulation ordinance
[1:32:26]
and is set for february 23 2021
[1:32:30]
council identifies additional
[1:32:32]
fundamental modifications that require
[1:32:33]
significant changes
[1:32:35]
staff has the time to go back and update
[1:32:37]
the regulations
[1:32:39]
staff would thus like to build in the
[1:32:41]
buffer
[1:32:42]
that miss hoffman referenced
[1:32:46]
and is requesting and recommending that
[1:32:47]
the ordinance be amended at this second
[1:32:49]
reading
[1:32:50]
to extend the moratorium an additional
[1:32:53]
month until may third twenty twenty one
[1:32:56]
if council approves the amendment to the
[1:32:58]
ordinance to change april first
[1:33:00]
to may third which is the only change
[1:33:02]
proposed it will need to
[1:33:04]
adopt the ordinance as amended if the
[1:33:06]
ordinance is adopted
[1:33:08]
it will go into effect on february 1st
[1:33:10]
2021
[1:33:12]
that ends my presentation thank you
[1:33:18]
we will not proceed with public comments
[1:33:19]
and we've got a couple uh so we'll
[1:33:22]
start with jan jan please state your uh
[1:33:24]
your full name for the record and your
[1:33:25]
neighborhood
[1:33:26]
and uh keep your comments the three
[1:33:28]
minutes please
[1:33:32]
hello this is jan bill sparrow i'm a
[1:33:36]
resident
[1:33:36]
in the red leaf neighborhood thank you
[1:33:39]
mayor quinn
[1:33:40]
and members of the council for your
[1:33:43]
interest in developing
[1:33:44]
thoughtful regulations regarding
[1:33:47]
marijuana retail sales
[1:33:49]
i appreciate the staff recommendation
[1:33:52]
to extend the moratorium to may 3rd
[1:33:56]
and the work that the staff is doing
[1:33:59]
finalizing regulations with only one
[1:34:02]
additional
[1:34:02]
study session and two council agenda
[1:34:05]
items
[1:34:06]
is not providing enough time to consider
[1:34:09]
all the
[1:34:10]
issues related to regulating this
[1:34:12]
industry
[1:34:13]
in our community you have committed to
[1:34:16]
ensuring the health
[1:34:18]
safety and welfare of the community the
[1:34:21]
council
[1:34:22]
needs to devote the same amount of time
[1:34:24]
and energy
[1:34:25]
to marijuana regulations as you did in
[1:34:28]
addressing oil and gas regulations
[1:34:31]
those regulations have been called a
[1:34:32]
gold standard
[1:34:34]
and the best regulations in the country
[1:34:37]
the citizens
[1:34:38]
and youth of our community deserve no
[1:34:41]
less
[1:34:42]
we need to develop regulations that are
[1:34:44]
better than the state
[1:34:46]
which are just a basis for municipal
[1:34:48]
decision making
[1:34:50]
at the december study session it was
[1:34:52]
mentioned that marijuana
[1:34:54]
is very regulated because of the number
[1:34:56]
of pages of regulations
[1:34:59]
the quantity of pages does not indicate
[1:35:02]
the level of
[1:35:03]
quality of the regulations just
[1:35:06]
one example is that the state limits
[1:35:09]
three shapes
[1:35:10]
of marijuana edibles but there are many
[1:35:13]
other shapes that appear
[1:35:15]
like candy to children also the science
[1:35:19]
related to the effect of increased thc
[1:35:23]
concentrations has not kept up with
[1:35:26]
the regulations
[1:35:29]
i should say the regulations have not
[1:35:32]
tipped up with the science
[1:35:34]
the substance abuse and mental health
[1:35:36]
services
[1:35:37]
administration in a december
[1:35:39]
presentation
[1:35:40]
indicated that a key issue downplayed by
[1:35:43]
the industry and ignored by the states
[1:35:46]
is the risk of adverse outcomes to our
[1:35:48]
children and young adults
[1:35:50]
it included the fact that marijuana's
[1:35:53]
mental health
[1:35:54]
and related outcomes in colorado are
[1:35:56]
worse
[1:35:57]
than the nation it shows that colorado
[1:36:01]
marijuana use has increased
[1:36:03]
for all age groups from 2016 to 2019
[1:36:07]
and marijuana youth disorder
[1:36:10]
in colorado 12 to 17 year olds
[1:36:14]
is twice the national average
[1:36:18]
please do not rush develop the best
[1:36:22]
possible regulations protecting children
[1:36:25]
and young adults and straightened the
[1:36:28]
community health improvement plan
[1:36:30]
to address the significant mental health
[1:36:33]
issues
[1:36:33]
resulting from increased access to
[1:36:36]
marijuana
[1:36:37]
these steps need to occur before the
[1:36:40]
moratorium
[1:36:41]
ends thank you for your consideration
[1:36:46]
uh and we'll move on then to james uh
[1:36:48]
james state your uh your full name and
[1:36:50]
uh
[1:36:51]
in neighborhood and you have three
[1:36:53]
minutes
[1:36:56]
thank you marion uh city council this is
[1:36:58]
james marsh holston uh living
[1:37:00]
brandywine i want to thank council for
[1:37:03]
their leadership on this issue and the
[1:37:06]
i'm very excited to see this issue go
[1:37:08]
forward
[1:37:09]
the tax revenues that we will be able to
[1:37:11]
realize from this industry
[1:37:13]
um that are currently going to other
[1:37:15]
localities
[1:37:17]
will help this community pay for
[1:37:20]
everything that we need to especially
[1:37:21]
given the kovid restrict uh the
[1:37:23]
you know downturns that we're currently
[1:37:24]
in um i am curious on the
[1:37:27]
decision to extend the moratorium on
[1:37:31]
production another four years um i'd be
[1:37:34]
i understand the desire to go slow and
[1:37:37]
to
[1:37:38]
take this in steps um but i would be
[1:37:40]
curious to know how much revenue we were
[1:37:42]
giving up in
[1:37:43]
that issue and what the regulations
[1:37:45]
would have looked like if we had decided
[1:37:47]
to go forward with that
[1:37:49]
i appreciate the previous caller and the
[1:37:51]
need to
[1:37:52]
regulate thoughtfully and to do it well
[1:37:56]
however i do believe that we have many
[1:37:58]
examples from other communities
[1:38:00]
surrounding us of how they have
[1:38:04]
worked with this industry to protect our
[1:38:06]
children and protect the health and
[1:38:07]
safety of the community
[1:38:08]
i do not believe that it is a danger
[1:38:10]
like it is put forth
[1:38:12]
at times to the two children um having
[1:38:15]
gone to a marijuana shop once or twice
[1:38:16]
um i can tell you that the
[1:38:18]
level of security and um
[1:38:22]
difficulty in getting in is much higher
[1:38:24]
than that of a liquor store and
[1:38:26]
the dangerous aspects of alcohol are
[1:38:29]
significantly more than that of
[1:38:30]
marijuana so
[1:38:32]
i do believe that that it is worth going
[1:38:34]
forward with this and i'm i'm looking
[1:38:35]
forward to
[1:38:36]
it to seeing this these small businesses
[1:38:38]
in our community
[1:38:40]
um and i appreciate what council's doing
[1:38:42]
thank you good night
[1:38:44]
thank you james uh i'm not knowing
[1:38:46]
anybody else in the queue
[1:38:48]
um so we will move to uh
[1:38:53]
city council comments or questions city
[1:38:56]
council
[1:39:03]
councilmember lindstedt
[1:39:06]
thank you mayor um i'll keep it very brief um
[1:39:09]
i'll just say that you know i'm i'm very
[1:39:12]
grateful to staff for working so hard on
[1:39:14]
these regulations and i look forward to
[1:39:15]
having
[1:39:16]
um a thoughtful discussion next week um
[1:39:19]
and until then you know i know there was
[1:39:21]
one resident who emailed in
[1:39:22]
about these about the moratorium um just
[1:39:25]
to
[1:39:26]
inform um the community you know this
[1:39:28]
moratorium um
[1:39:29]
is meant to exist while we craft these
[1:39:32]
regulations so that we can
[1:39:33]
um you know create a a thriving you know
[1:39:36]
industry that we can benefit from with
[1:39:38]
new jobs and tax revenue um
[1:39:40]
while keeping our community safe so um
[1:39:43]
that's our intent
[1:39:44]
and i look forward to having a a strong
[1:39:46]
discussion
[1:39:47]
uh next week councilmember girl
[1:39:51]
uh yeah thank you very much i just
[1:39:53]
wanted to
[1:39:55]
make sure there's a couple things one um
[1:39:58]
our discussion on the mental health plan
[1:40:00]
that
[1:40:02]
should go along with these ordinances
[1:40:04]
i'm hoping to see that
[1:40:06]
also with with the dates on this
[1:40:08]
moratorium
[1:40:09]
um extension
[1:40:12]
what are what i would be asking for i
[1:40:14]
guess i'm not
[1:40:15]
formulating my words very well right now
[1:40:17]
is what are the dates for that mental
[1:40:19]
health plan that
[1:40:20]
um couple and in in parallel we approve
[1:40:25]
for release on april 1st or or in may
[1:40:28]
whenever um this is approved and then secondly um
[1:40:35]
the the date of may
[1:40:39]
what what was that based on again just
[1:40:41]
to give us elbow room
[1:40:44]
or was there any
[1:40:47]
we're still shooting for may first but
[1:40:49]
we're extending it to
[1:40:52]
may yes council
[1:40:55]
member groom we're shooting for april
[1:40:57]
1st which was the date that we initially
[1:40:59]
proposed
[1:41:00]
but in order to give the staff some
[1:41:02]
breathing room if it ends up being
[1:41:04]
necessary in particular
[1:41:06]
after we see what happens at the meeting
[1:41:08]
next week
[1:41:09]
that's why we're requesting the
[1:41:10]
amendment to may 3rd
[1:41:12]
i just find it odd because i would think
[1:41:14]
that we would wait um
[1:41:16]
to to extend it once we understood the
[1:41:19]
level of comments that were given
[1:41:21]
because it could be may it could be june
[1:41:24]
so i'm trying to understand why we're
[1:41:26]
doing this now and not
[1:41:28]
when we get the comments i think it's
[1:41:31]
the two readings part
[1:41:33]
that it's not like you know so the breathing room was requested by
[1:41:39]
staff
[1:41:40]
uh and didn't want to go through two
[1:41:41]
separate readings if we had to extend it
[1:41:43]
for a month
[1:41:45]
got it thank you very much that's all i
[1:41:47]
have
[1:41:48]
okay uh councilmember i mean uh city
[1:41:50]
manager often do you want to address the question of the mental health plan
[1:41:56]
jennifer oh yes thank you mayor
[1:42:00]
um and council so like it like anything
[1:42:04]
else that we're doing right now it is in conjunction there aren't any um
[1:42:09]
stand-alone discussions with regards to
[1:42:11]
the marijuana
[1:42:13]
rules and regulations public health is
[1:42:15]
an intimate part
[1:42:16]
of that so our chip
[1:42:19]
program we've been sending some
[1:42:21]
information out
[1:42:24]
to council that process will pick up as
[1:42:27]
we begin to integrate
[1:42:29]
what that support system looks like so
[1:42:31]
again it's it's an
[1:42:32]
it's a very integrated model council
[1:42:35]
member groom
[1:42:36]
that um we'll we'll continue as we move
[1:42:39]
through on these regulations to
[1:42:41]
ensure a strong communication with
[1:42:45]
our mental health partners and
[1:42:48]
the state capabilities that they have
[1:42:51]
found
[1:42:52]
from that support network um again
[1:42:56]
there's a lot of comprehensive
[1:43:00]
deeper dives with regards to mental
[1:43:01]
health that
[1:43:03]
covid has uh has really provided and
[1:43:06]
prompted
[1:43:07]
so when we're when we're looking at the
[1:43:09]
impact of
[1:43:11]
covid and increased substance abuse
[1:43:14]
and the suicides all of those components
[1:43:17]
are really
[1:43:18]
reducing that stigma which overall is a
[1:43:21]
really wonderful thing with regards to
[1:43:23]
mental health
[1:43:24]
but it's also a wonderful thing because
[1:43:26]
with timing of our marijuana regulations
[1:43:28]
those support capabilities are are are
[1:43:31]
even more established than they were
[1:43:33]
before
[1:43:33]
so it's more or less kind of threading
[1:43:35]
that needle
[1:43:36]
to ensure that there really isn't any
[1:43:38]
stone unturned
[1:43:39]
as we move forward
[1:43:44]
thank you i'm looking for more though i understand our programs and we've got
[1:43:48]
great ones but
[1:43:49]
with with the marijuana i'm looking at a
[1:43:53]
significant
[1:43:54]
uh increase in our health our mental
[1:43:57]
health services
[1:43:59]
not just existing programs thank you for
[1:44:02]
your
[1:44:02]
life yeah councilmember law evans
[1:44:06]
thank you mr mayor so i would like to
[1:44:09]
echo
[1:44:10]
uh council member groom's comments
[1:44:12]
concerning
[1:44:13]
um we absolutely need to
[1:44:16]
provide more mental health support uh
[1:44:20]
and as uh
[1:44:20]
our study manager noted uh the mental
[1:44:23]
health toll the last year on
[1:44:25]
from the pandemic has been terrible
[1:44:28]
really terrible but um
[1:44:32]
i i anyone who thinks that there will
[1:44:35]
not be
[1:44:36]
mental health fallout from having
[1:44:40]
more marijuana available in our city
[1:44:43]
i believe is kidding themselves this is
[1:44:45]
not
[1:44:47]
the comparison that's always made is
[1:44:49]
well it's not as bad as alcohol
[1:44:51]
um and that's a terrible comparison
[1:44:53]
simply because
[1:44:55]
um it it doesn't matter if it's as bad
[1:44:59]
as alcohol it's bad enough on its own
[1:45:01]
and this
[1:45:02]
does it will have mental health
[1:45:05]
repercussions
[1:45:06]
uh and the repercussions can be i have family members who have been
[1:45:15]
addicted
[1:45:16]
to marijuana for many years
[1:45:19]
i don't want to go into that right now
[1:45:21]
but don't kid yourself there are
[1:45:23]
long-term
[1:45:24]
mental health effects from this and i
[1:45:26]
want to make sure that
[1:45:28]
as much mental health support as we can
[1:45:31]
put in place
[1:45:32]
um as councilmember groom has said we
[1:45:35]
need
[1:45:35]
all we'll need all of it all of it so i agree with councilmember groom
[1:45:41]
um i'm looking for a significant uptick
[1:45:44]
in mental health services offered and
[1:45:47]
provided
[1:45:48]
with this thank you mayor councilmember
[1:45:50]
lim
[1:45:51]
um i had a question for staff um
[1:45:54]
the study session next week
[1:45:59]
what will we see come forward are we
[1:46:01]
going to see revised regulations
[1:46:04]
based on public comments and then
[1:46:07]
some of us perhaps i know i did submit
[1:46:11]
follow-up um written see uh questions
[1:46:14]
suggestions
[1:46:16]
uh will we s what are we going to see at
[1:46:18]
the study session next tuesday are we
[1:46:20]
going to see
[1:46:21]
a response yes we already
[1:46:24]
um revise this regula these regulations
[1:46:27]
reflect this
[1:46:29]
we haven't thought about this yet or see
[1:46:32]
we haven't you know no we're not going
[1:46:34]
to include this at all
[1:46:35]
what what kind of feedback are we going
[1:46:37]
to get to our comments that already occurred
[1:46:42]
there has been
[1:46:43]
a great deal of revision to the
[1:46:45]
regulations
[1:46:46]
and we are still doing some work to that will absolutely continue um there
[1:46:53]
are questions
[1:46:54]
that we are aware of from the past study
[1:46:57]
session
[1:46:58]
that we have not been able to uh
[1:47:01]
get answered yet but a great number of
[1:47:04]
the questions
[1:47:05]
um are in the draft council memo
[1:47:08]
right now with uh answers to them
[1:47:12]
okay thanks uh mayor potem
[1:47:18]
thank you mayor um i'll support the one
[1:47:20]
month extension
[1:47:22]
of the moratorium as padding i really
[1:47:24]
don't want to
[1:47:25]
kick it down the road as it has been
[1:47:27]
mentioned that this is
[1:47:29]
every month we wait that's one last
[1:47:31]
month we get the revenue and the
[1:47:32]
benefits
[1:47:33]
i also want to address the the mental
[1:47:36]
health uh concerns that have been
[1:47:37]
brought up
[1:47:38]
uh it has been proven that medicinal
[1:47:42]
marijuana
[1:47:42]
has helped people with trauma to get off
[1:47:45]
of opioids
[1:47:46]
it helps with pain inflammation
[1:47:50]
all sorts of medical uses children use
[1:47:53]
it
[1:47:54]
but with their parents because it stops
[1:47:56]
seizures i have a constituent whose
[1:47:58]
family
[1:47:59]
would would have to drive very far to
[1:48:02]
get this medicine for their child and it
[1:48:03]
is life-saving
[1:48:05]
so we need to balance some of the myths
[1:48:07]
and the facts
[1:48:08]
and back up these these allegations with
[1:48:11]
actual medical research
[1:48:13]
before going off the deep end um but
[1:48:16]
thank you
[1:48:19]
any other questions or comments from
[1:48:20]
city council
[1:48:25]
there being no further comment oh
[1:48:27]
councilmember link lindstadt oh i was just going to
[1:48:31]

[1:48:33]

[1:48:34]

[1:49:54]

[1:49:59]
um so uh city manager hoffman
[1:50:03]

[2:00:12]
public hearing and council consideration
[2:00:13]
of proposed regulation number 20
[2:00:16]
21-13 approving the site development
[2:00:19]
plan
[2:00:19]
an improvement agreement for a gallery
[2:00:21]
park a 1.99 acre
[2:00:23]
public park within broomfield urban
[2:00:25]
transit village
[2:00:27]
this item also includes proposed
[2:00:28]
resolution number 20 21-14-ur
[2:00:32]
for the broomfield urban renewal
[2:00:34]
authorities review
[2:00:36]
we previously convened the broomfield
[2:00:38]
urban renewal authority and will review
[2:00:40]
both
[2:00:41]
resolutions concur concurrently
[2:00:45]
i will now declare the public hearing
[2:00:46]
open we will follow the city standard
[2:00:48]
public hearing procedures
[2:00:49]
as previously outlined uh council has a
[2:00:52]
copy of the agenda
[2:00:53]
memorandum which i'll ask stuff staff to
[2:00:56]

[2:00:58]
thank you mayor and council anna burton
[2:01:00]
zetty will walk us through this item and
[2:01:02]
of course the applicants are here to
[2:01:04]
field
[2:01:04]
any additional questions after their
[2:01:06]
presentation anna
[2:01:10]
thank you miss hoffman mayor city
[2:01:13]
council
[2:01:14]
anna burton's eddie planning director we
[2:01:16]
could have the next slide please
[2:01:18]
the applicant this evening is requesting
[2:01:20]
consideration of a development proposal
[2:01:22]
for a park that's just under two acres
[2:01:25]
in size
[2:01:26]
within the arista neighborhood the
[2:01:27]
property is located south of arista
[2:01:29]
place
[2:01:30]
west of destination drive north of the
[2:01:32]
future extension of parkland street
[2:01:34]
and adjacent to and east of a recently
[2:01:37]
approved multi-family project called the
[2:01:39]
steadfast development
[2:01:40]
next slide please the land use
[2:01:43]
designation on our comprehensive plan
[2:01:46]
is open lands which is consistent with a
[2:01:48]
public park
[2:01:50]
next slide please the
[2:01:53]
original 2006 site development plan for
[2:01:56]
this property
[2:01:57]
was designed to be of a passive style
[2:01:59]
park space
[2:02:00]
with very few amenities and dense
[2:02:02]
landscaping
[2:02:03]
in addition there were also easements
[2:02:05]
across the site that limited the layout
[2:02:07]
of the park design
[2:02:08]
those easements have since been removed
[2:02:10]
and are no longer necessary
[2:02:12]
uh based on the development to the west
[2:02:14]
and surrounding properties
[2:02:16]
next slide please the revised park site
[2:02:20]
is laid out with a circular gathering
[2:02:22]
area that they're calling the council
[2:02:24]
ring
[2:02:24]
as a common term used for a circular
[2:02:26]
seating area
[2:02:27]
separating the primary play lawn on the
[2:02:30]
southern side of the site from the dog
[2:02:31]
park
[2:02:32]
amenity that's on the northern end of
[2:02:34]
the site landscaping beds are used to
[2:02:36]
shape the park site and separate the
[2:02:38]
various amenities
[2:02:40]
areas from the public streets there are
[2:02:42]
shades trees located throughout
[2:02:44]
and the plans incorporate three
[2:02:46]
locations the northeast corner the
[2:02:48]
southeast corner
[2:02:49]
and the center of the council ring for
[2:02:51]
public art displays in the future
[2:02:53]
if the city desires two public parks
[2:02:57]
uh excuse me two public dog parks are
[2:02:59]
incorporated
[2:03:01]
to separate the larger dogs from smaller
[2:03:04]
dogs
[2:03:04]
and the dog parks feature overhead
[2:03:06]
lighting that's placed on a timer
[2:03:08]
to go off in the late evening to ensure
[2:03:11]
or due to the proximity of residential
[2:03:13]
in the area
[2:03:15]
there are 30 angled parking spaces
[2:03:17]
incorporated along the western edge of
[2:03:18]
destination drive
[2:03:20]
and there's sidewalks leading from the
[2:03:21]
parkside to the adjacent properties
[2:03:24]
there are no play structures proposed
[2:03:26]
since
[2:03:27]
two additional parks within the arista
[2:03:29]
neighborhood both sensory and chefs
[2:03:30]
field
[2:03:31]
have play structures in the immediate
[2:03:33]
area
[2:03:34]
next slide please all of the parks
[2:03:37]
within the arista neighborhood are
[2:03:39]
uniquely designed by the developer to
[2:03:41]
provide different amenities
[2:03:42]
gallery park is the last public park to
[2:03:44]
be constructed within the arista
[2:03:46]
neighborhood
[2:03:47]
under the existing pud plan next slide
[2:03:51]
a concept review was initially held for
[2:03:54]
a public park
[2:03:55]
along with the steadfast development in
[2:03:57]
2019.
[2:03:59]
with based on that concept review there
[2:04:01]
were concerns expressed regarding a
[2:04:03]
potential relocation of the park
[2:04:06]
and their potential noise air quality
[2:04:09]
concerns
[2:04:10]
with that relocation therefore the
[2:04:12]
applicant has
[2:04:14]
made the location of the park consistent
[2:04:17]
adjacent to destination drive as
[2:04:18]
proposed this evening
[2:04:20]
in 2019 the applicant also held a
[2:04:22]
neighborhood meeting
[2:04:23]
with the homeowners associations for
[2:04:26]
both the kb home and century communities
[2:04:28]
projects they discussed the park
[2:04:30]
placement traffic parking and concerns
[2:04:33]
with increasing number of dogs in the
[2:04:34]
community
[2:04:36]
the public hearing notification
[2:04:38]
requirements were met
[2:04:39]
for this property and there is an
[2:04:41]
improvement agreement along with the
[2:04:43]
site development plan
[2:04:45]
urban renewal site plan this evening the
[2:04:47]
improvement agreement outlines the
[2:04:48]
developers obligations and triggers for
[2:04:51]
completing the improvements associated
[2:04:52]
with this particular park
[2:04:54]
the improvement agreement requires
[2:04:56]
completion of this park
[2:04:58]
excuse me concurrent with the adjacent
[2:05:00]
residential development which is the
[2:05:02]
steadfast development to the west
[2:05:04]
the developer has completed one part per
[2:05:06]
year for the last few years as
[2:05:08]
previously mentioned this is
[2:05:09]
the last park to be developed and
[2:05:11]
steadfast is
[2:05:12]
scheduled to begin construction
[2:05:14]
hopefully this year
[2:05:15]
which would ensure uh compliance with
[2:05:18]
again the developer's intent to complete
[2:05:21]
all of the parks by the end of this year
[2:05:23]
next slide please
[2:05:26]
staff has identified no key issues with
[2:05:28]
this proposal
[2:05:30]
on november 23rd of 2020 the planning
[2:05:32]
and zoning commission did consider
[2:05:34]
the site development plan urban renewal
[2:05:37]
site plan
[2:05:38]
during the meeting there were some
[2:05:39]
concerns expressed by the commissioners
[2:05:41]
including the inclusion of a dog park
[2:05:43]
since there are is another dog park
[2:05:44]
available within arista
[2:05:46]
the use of crusher fines pathways the
[2:05:48]
lack of shade areas to sit
[2:05:50]
and how the plane whether the play lawns
[2:05:53]
could be usable with the trails
[2:05:54]
bisecting
[2:05:55]
the trail or the the play lawn a motion
[2:05:58]
for approval was made by
[2:06:00]
one of the commissioners but failed by a
[2:06:02]
vote of three to three
[2:06:03]
and the commission ultimately voted six
[2:06:05]
to zero to recommend denial of the
[2:06:07]
proposal with the findings listed on the
[2:06:09]
screen
[2:06:12]
the applicant has provided a response
[2:06:14]
included as attachment one to the staff
[2:06:16]
memorandum
[2:06:18]
the applicant removed all crusher fines
[2:06:20]
pathways that bisected the site
[2:06:22]
changed the remaining crusher fines to
[2:06:24]
pathways to concrete
[2:06:26]
they added three locations for the
[2:06:28]
public art displays expanded the turf
[2:06:30]
lawn
[2:06:31]
added shade trees and evergreen trees
[2:06:34]
and shifted the walkways within the park
[2:06:36]
to maximize the uninterrupted
[2:06:38]
area for the the turf play lawn the one
[2:06:41]
item that the applicant did not address
[2:06:43]
was the dog amenity the dog park is
[2:06:46]
still
[2:06:47]
included in the plans since the
[2:06:48]
applicant felt that this
[2:06:50]
amenity had been requested by residents
[2:06:53]
in the previous home
[2:06:54]
homeowners association meeting and felt
[2:06:57]
that it was appropriate to keep this
[2:06:58]
amenity
[2:06:59]
moving forward to the city council for
[2:07:01]
consideration
[2:07:03]
and thank you mayor and members of the
[2:07:04]
council that concludes my staff
[2:07:06]
presentation
[2:07:07]
and as mentioned the applicant is here
[2:07:08]
this evening for a brief presentation
[2:07:10]
and to answer any questions
[2:07:12]
okay so we'll go to the presentation by
[2:07:15]
the applicant uh just as we encourage
[2:07:17]
staff to keep their presentations brief
[2:07:19]
i asked the applicant to be concise in
[2:07:21]
the presentation as well
[2:07:23]
will the applicant's representative
[2:07:24]
please identify themselves for the
[2:07:26]
record
[2:07:26]
prior to beginning their brief
[2:07:28]
presentation this evening
[2:07:31]
yes good evening uh mr mayor council and
[2:07:34]
staff
[2:07:35]
my name is joe zapped i'm representing
[2:07:37]
the arrest of development this evening
[2:07:38]
my address is 555 el dorado boulevard
[2:07:41]
and broomfield 80021.
[2:07:44]
as uh previously mentioned a moment ago
[2:07:47]
tonight we're present
[2:07:48]
presenting to you what will be the final
[2:07:52]
part to be constructed at the aristo
[2:07:54]
development
[2:07:55]
and also as just mentioned the past
[2:07:58]
three years we've completed a park
[2:07:59]
each year starting with uptown park in
[2:08:02]
2018
[2:08:04]
in shefsville park in 2019 and this past
[2:08:08]
year in 2020 terrace ponds park
[2:08:12]
uh there are just a couple of site
[2:08:14]
amenities at terrace ponds
[2:08:17]
uh such as benches and tables that have
[2:08:19]
to be installed those are on delayed
[2:08:22]
delivery due to covet but essentially
[2:08:25]
the park is complete if you've not
[2:08:26]
driven by that park lately
[2:08:29]
i would encourage you to do so and take
[2:08:31]
a look at it
[2:08:32]
i think you will be impressed on how
[2:08:34]
well it came out
[2:08:36]
so with the completion of terrace ponds
[2:08:38]
park that we just
[2:08:39]
did last year that brings the total
[2:08:41]
number
[2:08:42]
of parks at the arista development
[2:08:46]
uh for a total of seven seven parks
[2:08:49]
are now complete and so when we complete
[2:08:53]
gallery park which we're discussing this
[2:08:56]
evening
[2:08:57]
that will conclude the park commitment
[2:08:59]
and that will total a total of
[2:09:01]
eight parks at the arista development
[2:09:05]
so here tonight to supplement the staff
[2:09:07]
report is our consultant leanne blair
[2:09:10]
with norris design thank you
[2:09:15]
good evening um mayor can hear me okay
[2:09:18]
yes great thank you so much um my name
[2:09:21]
is leanne valliere with norris design at
[2:09:23]
1101 bannock street
[2:09:25]
denver colorado thank you anna for your
[2:09:28]
thorough presentation
[2:09:30]
mayor council members and staff for your
[2:09:32]
evening tonight for your time excuse me
[2:09:34]
this evening tonight
[2:09:35]
we're very excited to be here to talk
[2:09:38]
about the um
[2:09:39]
last piece of the open lands puzzle at
[2:09:41]
um arista
[2:09:43]
next slide please
[2:09:47]
in an effort to avoid repeating um or at
[2:09:50]
least minimizing the
[2:09:52]
repetition with anna's presentation
[2:09:55]
i do want to mention that in gallery
[2:09:58]
park
[2:09:58]
as a rinder was approved back in 2006
[2:10:02]
and it was originally designed as a
[2:10:04]
passive collection of outdoor rooms and
[2:10:06]
that was inspired by
[2:10:08]
the prairie style of the late 19th
[2:10:10]
century
[2:10:12]
in early early 20th century um
[2:10:15]
and the opportunity to take a fresh look
[2:10:17]
at the park's design
[2:10:19]
has provided the opportunity to update
[2:10:22]
it not only to respond to
[2:10:24]
um the needs of the residents but then
[2:10:26]
also to
[2:10:28]
make sure we're being mindful of the
[2:10:30]
maintenance
[2:10:32]
capabilities and desires of the parks
[2:10:35]
department
[2:10:37]
the overall design of gallery park
[2:10:39]
remains intact
[2:10:41]
but has been greatly updated in terms of
[2:10:44]
function
[2:10:45]
for all the tour fairies have been
[2:10:48]
expanded to meet the edge of the park
[2:10:50]
creating easy access from all directions
[2:10:53]
and the variety of turf sizes provide
[2:10:55]
flexibility
[2:10:56]
and opportunity for both small intimate
[2:10:59]
gatherings as well as larger
[2:11:00]
more active activities
[2:11:04]
as was mentioned we've added three
[2:11:06]
locations for
[2:11:08]
potential future art those are the blue
[2:11:11]
stars
[2:11:12]
on your screen
[2:11:16]
next slide please
[2:11:20]
the park features the central council
[2:11:22]
ring
[2:11:24]
which is our gathering plaza with
[2:11:26]
seating lighted bollards
[2:11:28]
and the future art location
[2:11:31]
this council ring is an element commonly
[2:11:33]
found in the prairie style parks
[2:11:35]
and the prairie style influenced the
[2:11:37]
overall arista landscape
[2:11:40]
and circular elements of the council
[2:11:42]
ring can be seen in design elements both
[2:11:44]
at arista park and
[2:11:46]
its entry park next slide please
[2:11:51]
um anna did a great job summarizing the
[2:11:53]
concept hearing that we had back in
[2:11:55]
march of 2019
[2:11:57]
the only thing that i'll expand on is
[2:11:59]
that um
[2:12:01]
in converting the on-street
[2:12:05]
parking the parallel parking along
[2:12:07]
destination way to angled parking
[2:12:09]
that's resulted in a net increase
[2:12:12]
of approximately 10 spaces
[2:12:16]
a planning and zoning commission hearing
[2:12:18]
on november 23rd
[2:12:20]
commissioners had concerns over a few
[2:12:22]
design elements within the park
[2:12:24]
their first concern was that the dog
[2:12:26]
park was unnecessary given the proximity
[2:12:29]
to sheps field
[2:12:31]
as mentioned there was a meeting last
[2:12:33]
year with
[2:12:34]
community members and the neighbors
[2:12:37]
raised concerns about the existing dog
[2:12:40]
waste problem
[2:12:41]
and the impacts of the addition of
[2:12:43]
steadfast residents
[2:12:45]
and how that would impact the current
[2:12:48]
dog park
[2:12:50]
you know arista is a very dog-friendly
[2:12:52]
community and so we anticipate that the
[2:12:54]
number of dog owners will continue to
[2:12:56]
increase
[2:12:57]
not only with the addition of steadfast
[2:13:00]
departments but as future developments
[2:13:02]
within arista
[2:13:04]
begin to fill in as well and we believe
[2:13:07]
that this
[2:13:07]
additional dog area will not only be an
[2:13:10]
asset to the existing
[2:13:12]
residents but future residents as well
[2:13:14]
and
[2:13:15]
will hope hopefully help to reduce any
[2:13:18]
um
[2:13:19]
future dog related complaints
[2:13:22]
and for that reason we thought it was
[2:13:25]
important to keep it
[2:13:26]
in the overall design next slide please
[2:13:31]
in addition the second concerns um
[2:13:34]
from the uh planning and zoning
[2:13:37]
commission was centered around the
[2:13:38]
usefulness and maintenance of the
[2:13:40]
internal crusher fines trail
[2:13:42]
what's in front of you right now is a
[2:13:44]
comparison between
[2:13:46]
the um design that we brought in front
[2:13:48]
of the p and z
[2:13:50]
um and then the updated design
[2:13:53]
in front of you tonight um
[2:13:57]
they the commissioners um you know felt
[2:13:59]
that the walkway through the middle of
[2:14:01]
the turf limited the usefulness
[2:14:03]
of the grass area and so in response to
[2:14:05]
that and those
[2:14:06]
concerns we've removed the portion of
[2:14:08]
trail along the south of the council
[2:14:11]
ring
[2:14:11]
to provide that un interrupted turf area
[2:14:15]
and the turf also has been expanded to
[2:14:17]
the sidewalks to
[2:14:18]
greater create access to the park and
[2:14:21]
eliminate the need for the trail
[2:14:24]
finally all remaining trails were
[2:14:26]
converted to concrete
[2:14:28]
for ease of maintenance and usability um
[2:14:31]
all year long
[2:14:33]
lastly the commissioners felt that the
[2:14:35]
park lacked shade trees
[2:14:37]
and greenery so the park design has been
[2:14:39]
revised to address this concern with
[2:14:41]
addition
[2:14:42]
of more deciduous shade trees and
[2:14:45]
evergreen trees the shade trees have
[2:14:47]
also been located
[2:14:49]
around the edge of the turf providing
[2:14:51]
opportunity for
[2:14:52]
shade while providing or excuse me while
[2:14:55]
maintaining
[2:14:56]
the open turf for flexible use and ease
[2:14:59]
of maintenance
[2:15:00]
some of the ornamental trees were
[2:15:02]
switched to
[2:15:03]
evergreen trees to provide that
[2:15:05]
year-round color
[2:15:06]
and greenery and the expanded tarf area
[2:15:10]
has re resulted in less native seed
[2:15:13]
areas
[2:15:13]
and strategically placed planting beds
[2:15:18]
the planning and zoning commission chose
[2:15:21]
to make a recommendation of
[2:15:22]
denial rather than approval with
[2:15:25]
conditions
[2:15:26]
because they wanted to put teeth
[2:15:30]
as they stated it behind their
[2:15:31]
conditions they asked that we work with
[2:15:33]
staff to address their concerns prior to
[2:15:35]
coming before you tonight
[2:15:37]
which we were happy to do so our team is
[2:15:40]
here and available to answer any
[2:15:42]
questions thank you very much
[2:15:50]
so that concludes the applicant's
[2:15:51]
presentation it does
[2:15:53]
okay um so we'll go to public comments
[2:15:57]
next um
[2:15:58]
uh we do uh you know anybody who's on
[2:16:01]
the line uh please press start three to go into
[2:16:04]
the queue
[2:16:05]
we do have jake uh uh
[2:16:08]
on the line jake i need you to state
[2:16:10]
both your first and last name for the
[2:16:12]
record
[2:16:13]
uh and then the neighborhood that you
[2:16:15]
live in and then you have three minutes
[2:16:19]
uh my name is jake cool hi my name is
[2:16:22]
jake s
[2:16:23]
i live in the arista apartments uh
[2:16:25]
actually within directline a site
[2:16:27]
of what is i guess currently the dirt
[2:16:29]
pile and will be that
[2:16:30]
nice looking park that we received in
[2:16:33]
the envelope i was
[2:16:34]
just wondering uh this park and um the
[2:16:37]
surrounding ones there's been
[2:16:39]
a lot of geese around and they poop
[2:16:42]
everywhere
[2:16:42]
and you step in it and sometimes you're
[2:16:45]
just like playing hopscotch with his
[2:16:46]
poop and i i'm just wondering if there
[2:16:48]
are
[2:16:48]
plans to to clean this poop up or or deal with the geese in general i mean
[2:16:53]
they're lovely but you know come on the
[2:16:55]
poop
[2:16:55]
all right well thank you so much
[2:16:57]
appreciate it
[2:17:00]
uh i don't
[2:17:03]
you know i i guess normally i do allow
[2:17:04]
the applicant uh i don't see any other
[2:17:06]
questions from the public uh so i guess i'll give
[2:17:09]
the applicant the chance to uh
[2:17:11]
to respond to that is there anybody from
[2:17:13]
the applicant that wants to respond
[2:17:14]
on the issue of uh waste from geese
[2:17:19]
mr joseph this is josephina
[2:17:23]
okay i'll just respond to that
[2:17:26]
you know there's a couple of elements
[2:17:28]
within a rest of one is the public parks
[2:17:30]
that are
[2:17:31]
maintained by the city and county so if
[2:17:33]
there's poop
[2:17:34]
in those parks then this responsibility
[2:17:36]
of the cities is part of that
[2:17:37]
maintenance
[2:17:38]
to do that secondly within the the
[2:17:41]
individual
[2:17:42]
communities uh itself uh
[2:17:45]
they're you know they should be
[2:17:46]
self-policing on how they handle that
[2:17:51]
yeah you know fair enough we do have one
[2:17:53]
other comment uh
[2:17:54]
you know person that wants to uh give
[2:17:56]
public comments sheila
[2:17:58]
uh please state your full name and your
[2:18:00]
neighborhood for the record and then you
[2:18:02]
have three minutes
[2:18:05]
hello my name is sheila higgins and i
[2:18:08]
live in the kb home
[2:18:10]
community in arista i'm also the vice
[2:18:12]
president of the hoa board
[2:18:14]
for the arista community and i would
[2:18:17]
just like to state my support for the
[2:18:19]
park and the proposal as presented
[2:18:23]
as noted uh wayne's capital and the
[2:18:27]
aristo urban development has worked
[2:18:29]
closely with the hoa for both the two
[2:18:31]
communities here
[2:18:33]
in the arista development and the park
[2:18:36]
design reflects the
[2:18:37]
key items we wanted additional parking
[2:18:40]
and the dog park the dog park is
[2:18:42]
extremely important and i will echo what
[2:18:44]
joe
[2:18:44]
said there are a lot of dogs in the dog
[2:18:47]
park is extremely important
[2:18:50]
i guess that's all i wanted to say as i
[2:18:52]
support the park plan
[2:18:53]
as is and would really like to see the
[2:18:55]
park built as soon as possible thank you sheila um and so then uh i'll you know one last chance for the
[2:19:04]
applicant if there's any responses they
[2:19:05]
want to make
[2:19:06]
i think you commented we'll have the
[2:19:08]
city maybe address the geese
[2:19:09]
issue maybe city-wide but uh they may
[2:19:12]
want to wait until they have a chance to
[2:19:14]
respond to that
[2:19:15]
gather their response um if there's if
[2:19:18]
they're
[2:19:19]
i think uh i think the applicant has
[2:19:21]
indicated they've responded so we'll
[2:19:22]
move on to city council and authority
[2:19:24]
members
[2:19:25]
uh any questions or comments from the
[2:19:27]
city council or the uh
[2:19:29]
profile urban renewal authority members
[2:19:31]
uh please raise your hand and you'll be
[2:19:33]
uh
[2:19:34]
called on
[2:19:37]
council over tessier thanks mr mayor i
[2:19:41]
just um
[2:19:41]
it's a long time coming joe yay it's uh looks really good i'm excited
[2:19:48]
and
[2:19:49]
just looking forward to arista residents
[2:19:51]
getting
[2:19:53]
what they wanted it was nice to hear and
[2:19:56]
i don't know
[2:19:56]
if if there's any sort of communication
[2:20:00]
between um
[2:20:03]
the the management at um
[2:20:07]
arista and between the city and county
[2:20:10]
of broomfield
[2:20:11]
because i'm sure there's you know it's
[2:20:13]
easy to point fingers it belongs to this
[2:20:15]
person belongs to that person and i
[2:20:17]
didn't know if there's an
[2:20:18]
opportunity here to work with
[2:20:22]
um different either hoas or
[2:20:26]
metro districts to to figure out ways in
[2:20:28]
which we can clear
[2:20:30]
like health hazards out like if if
[2:20:33]
there's a group of people that are
[2:20:35]
can can do it at the par at arista
[2:20:38]
to clear the poop at their um at arista
[2:20:41]
is there a way that or can can
[2:20:44]
arista if they get complaints call the
[2:20:47]
city and county of broomfield in a
[2:20:48]
timely manner
[2:20:50]
um i i don't know how this would work
[2:20:52]
but it seems to me that there's an opportunity here that could
[2:20:56]
help a lot of residents
[2:20:58]
out because i'm sure arista is not the
[2:21:00]
only place that has a lot of
[2:21:02]
uh geese uh poop and um i know by
[2:21:05]
the the library and stuff it's cleared
[2:21:09]
off
[2:21:09]
regularly and and i and it's wonderful
[2:21:12]
um so i i can i can hear
[2:21:16]
i feel for the the caller's uh plea
[2:21:19]
to to remove that um so hopefully we get
[2:21:23]
a good response from our staff and and
[2:21:26]
we can figure out a way to clear that up
[2:21:30]
hey councilmember law evans thank you mr
[2:21:34]
mayor so
[2:21:35]
uh council member tessier if you figure
[2:21:37]
out a way to deal with goose poop that's
[2:21:39]
easy and cost effective you can make
[2:21:43]
so much money doing that my friend
[2:21:45]
because i agree down by the library
[2:21:47]
especially
[2:21:48]
it's um it's insane but um i also agree with the the caller and i
[2:21:54]
don't know what to do with it um
[2:21:56]
uh miss hoffman who do this is a strange
[2:21:59]
question
[2:22:00]
to to talk about goose poop at a city
[2:22:02]
council meeting but whatever
[2:22:04]
do we still have well okay so it's what
[2:22:07]
we do thank you mr mayor for that
[2:22:08]
validation i appreciate that
[2:22:10]
do we still have a contract with the guy
[2:22:13]
who had the sheepdog
[2:22:15]
converted to a goose dog to chase them
[2:22:20]
off
[2:22:24]
council member law evans um so so we're
[2:22:27]
all
[2:22:28]
um reminiscing about the number
[2:22:32]
of options we have exhausted
[2:22:35]
over the years um one of the excite and
[2:22:39]
that is that's the 64 thousand dollar
[2:22:41]
question i can tell you though that some
[2:22:44]
of our young folks
[2:22:46]
who come up with the the best ideas
[2:22:51]
over at the stem school
[2:22:54]
that is one that's one of the problems
[2:22:57]
that they are solving
[2:22:59]
uh sixth seventh and eighth graders have
[2:23:02]
taken it under advisement
[2:23:04]
what to do how to do it from a
[2:23:07]
preventative perspective
[2:23:09]
once it happens perspective a cleanup
[2:23:11]
perspective and then
[2:23:13]
a composting perspective so i venture to
[2:23:16]
guess
[2:23:16]
those though that mindset will will come
[2:23:19]
up with
[2:23:20]
something pretty exciting well i uh i
[2:23:23]
wish them all the best
[2:23:24]
um we'll keep you posted yeah yeah um
[2:23:28]
joking aside this this it is a a you
[2:23:31]
know a public health
[2:23:32]
issue it is an issue and i do recall not
[2:23:36]
to
[2:23:36]
switch topics on everyone but um there
[2:23:39]
have been concerns
[2:23:40]
with the um the new civic center the
[2:23:43]
town town center project
[2:23:45]
with as much lawn as we're going to have
[2:23:47]
there and somebody
[2:23:48]
somewhere years ago said that there was
[2:23:50]
actually a type of grass you could plant
[2:23:53]
that the geese were not in favor of or
[2:23:55]
didn't like or
[2:23:57]
i i don't know um so i i would i think that maybe we can maybe the
[2:24:03]
developer can look into that and go talk
[2:24:05]
to the sixth seventh and eighth graders
[2:24:06]
so
[2:24:07]
joe we'll put that on your plate you can
[2:24:10]
go talk to the sixth seventh and eighth
[2:24:11]
graders
[2:24:13]
and see see what they have coming along
[2:24:15]
but
[2:24:16]
um it is it is an issue so i i
[2:24:18]
appreciate that and
[2:24:19]
let's keep working on it um also uh
[2:24:22]
i i would echo council member tessier's
[2:24:24]
comments in another
[2:24:26]
way in that this has been a long time
[2:24:28]
coming for those of you who've been
[2:24:29]
around a while
[2:24:30]
um there was i won't say a problem
[2:24:33]
getting the parks done that's a little
[2:24:34]
too strong
[2:24:35]
but it did seem like the timeline became
[2:24:39]
clutchy how's that for a phrase and so
[2:24:43]
it's it's very exciting to see this uh
[2:24:46]
to see this last park and arista come to
[2:24:49]
fruition so
[2:24:50]
i support this i i appreciate the
[2:24:52]
developers thoughtful changes to the
[2:24:54]
plan
[2:24:55]
and in response to planning and zoning's
[2:24:58]
comments so um i think that's all i have
[2:25:02]
just go sixth seventh and eighth graders
[2:25:05]
thank you
[2:25:09]
council member councilman i'll ask you
[2:25:11]
is my daughter coordinates a lot of this
[2:25:13]
stuff leslie have you been to one of
[2:25:14]
those uh stem deals
[2:25:15]
where they tackle the projects no i have
[2:25:19]
not
[2:25:19]
i didn't know such a thing existed my
[2:25:21]
daughter's been doing this for 10 years
[2:25:23]
those kids are pretty darn amazing i
[2:25:25]
i'll just make a um
[2:25:27]
a peach for problem-based learning and
[2:25:29]
middle middle-aged students on behalf of
[2:25:31]
my
[2:25:31]
daughter leslie so councilmember they're
[2:25:33]
certainly tackling a real world problem
[2:25:36]
with this one
[2:25:37]
yep councilmember groom
[2:25:42]
certainly give me one second i'm i was
[2:25:46]
off doing uh
[2:25:47]
a few emails here i gotta get to my
[2:25:49]
notes sorry
[2:25:52]
you'd like to go to somebody else um
[2:25:54]
i'll go with councilmember
[2:25:56]
thanks uh thanks mayor
[2:25:59]
um so uh you know getting back to the
[2:26:02]
development at hand you know i'm glad to
[2:26:04]
see the park has moved away from
[2:26:06]
wattsworth boulevard
[2:26:08]
and to the east along destination drive
[2:26:10]
and parkland street
[2:26:11]
this is a much better location for this
[2:26:13]
park and i'm and i'm
[2:26:15]
appreciative for the thoughtful design
[2:26:17]
by the applicant
[2:26:18]
i do appreciate the work by the uh uh by
[2:26:22]
the applicant following the planning and
[2:26:23]
zoning hearing
[2:26:24]
i think these changes were necessary for
[2:26:27]
my consideration
[2:26:28]
for approval tonight so i'm glad to see
[2:26:30]
the applicant worked
[2:26:31]
uh with those suggestions uh by the
[2:26:33]
planning and zoning and made those
[2:26:35]
updates
[2:26:36]
um the one concern i have on this
[2:26:39]
uh and and i'm hoping that we'll be um
[2:26:42]
answered by our our staff is on those
[2:26:45]
turf areas
[2:26:46]
uh will parks and recreation be
[2:26:47]
utilizing these large turf areas that
[2:26:50]
are on this park
[2:26:55]
thank you council member shaft um i
[2:26:57]
don't believe
[2:26:59]
um that this is going to be used for
[2:27:01]
programming and
[2:27:02]
uh planner joshua olhava has just
[2:27:04]
confirmed that for me that
[2:27:05]
um yes our our parks department does not
[2:27:08]
intend to use this for programming
[2:27:10]
okay so i'll ask the developers do you
[2:27:12]
have any uh planned programming for
[2:27:14]
these large
[2:27:15]
turf areas on this park
[2:27:18]
no so uh they're just they're just
[2:27:22]
passive turf areas
[2:27:23]
is the primary purpose yes okay
[2:27:27]
all right well i i sorry i could add one
[2:27:30]
thing
[2:27:30]
they are available if um the neighboring
[2:27:34]
communities
[2:27:34]
you know want to organize something or
[2:27:37]
um
[2:27:38]
you know they're they're available for
[2:27:40]
all to use and to program as as to their individual
[2:27:45]
needs i guess on the unofficially
[2:27:47]
program
[2:27:48]
okay all right well i i i hope they're
[2:27:51]
utilized i hope that turf doesn't just
[2:27:53]
sit there and collect uh
[2:27:54]
irrigation water um i hope they are
[2:27:57]
utilized um
[2:27:58]
and i guess we'll see as as the uh park
[2:28:01]
um
[2:28:01]
is built and and is utilized in the
[2:28:03]
future so thank you
[2:28:05]
yeah uh mr mayor can i respond to that
[2:28:09]
yes you may yeah i hope so too uh
[2:28:12]
council member shout because uh this was
[2:28:14]
a change
[2:28:15]
that was requested plenty of zoning they
[2:28:17]
wanted to
[2:28:18]
see the large turf we felt like
[2:28:21]
the trail going through would be a
[2:28:23]
better use
[2:28:25]
but they wanted to see it so i'm in
[2:28:27]
agreement i hope it gets used as well
[2:28:29]
because i wasn't in favor of this change
[2:28:31]
well and and and i don't know if our
[2:28:33]
staff can answer that um
[2:28:35]
but usually the reason that we don't
[2:28:37]
have trails go through the middle of a
[2:28:38]
large turf area is because
[2:28:40]
of fields and the ability for our
[2:28:41]
recreation staff to utilize those fields
[2:28:43]
so
[2:28:44]
it's it's surprising to me that planning
[2:28:45]
and zoning our staff would request
[2:28:47]
uh trails not to intersect that large
[2:28:49]
turf area and then not be able to
[2:28:51]
program those areas
[2:29:00]
i think that was a comment so i'll go to
[2:29:02]
councilmember groom
[2:29:04]
thank you i'm sorry for the delay mayor
[2:29:06]
um i just had a couple comments
[2:29:08]
a compliment on the design i really like
[2:29:11]
it
[2:29:12]
i have spent a significant amount of
[2:29:15]
time in that area walking my dogs with
[2:29:16]
my son
[2:29:17]
um since he lived up there for a while
[2:29:20]
and an extra dog park is definitely
[2:29:23]
needed
[2:29:23]
uh there's there's a lot of um
[2:29:26]
pet friendly residents and a high
[2:29:29]
population high density in that area so
[2:29:32]
i am very excited to see even the two
[2:29:34]
separate dog parks
[2:29:36]
between the small dog and and the larger
[2:29:38]
dog
[2:29:39]
um and the only upgrade or comment i
[2:29:42]
would like to see
[2:29:43]
is some more seating um one of the
[2:29:45]
things i find
[2:29:46]
when i go to um a lot of the parks even
[2:29:49]
in the rest of broomfield and i know
[2:29:51]
um city manager hoffman and i have
[2:29:53]
talked about it before
[2:29:54]
is is really just enhancing seating area
[2:29:58]
all across broomfield
[2:29:59]
um and and not just little uh park
[2:30:02]
benches but those
[2:30:04]
face-to-face kind of chairs that that
[2:30:06]
sit next to each other or even
[2:30:08]
incorporating
[2:30:09]
um art or arc or design
[2:30:13]
into that that seating to enhance the
[2:30:15]
area
[2:30:16]
so um love the design that's the only
[2:30:18]
comment i have thank you very much
[2:30:24]
okay um so um you know i was just thinking about the
[2:30:29]
grass area you know the uh
[2:30:31]
i guess what i envisioned because
[2:30:32]
they're the people there don't have
[2:30:33]
yards
[2:30:35]
and i you know i don't have a yard you
[2:30:37]
know and and so i pictured
[2:30:40]
you know moms and daughters and dads and
[2:30:42]
sons out there
[2:30:43]
throwing the ball unprogrammed stuff on
[2:30:45]
you know park type land and then
[2:30:46]
wiffle ball does p do people play wiffle
[2:30:48]
ball anymore
[2:30:50]
my kids and i used to play wiffle ball a
[2:30:51]
lot and it seems having a grass so i kind of like the unprogrammed grass
[2:30:56]
area for uh particularly because the the
[2:30:59]
people don't have don't have yards so
[2:31:00]
we'll move into uh we will move into
[2:31:06]
uh we'll close out the public hearing uh
[2:31:08]
there be no further comments the public
[2:31:10]
hearing
[2:31:11]
the four
[2:31:14]
make sure i'm at the right place here i
[2:31:16]
was there be no further comments the
[2:31:18]

[2:34:20]
so that's correct thank you very much
[2:34:23]
good night thank you very much our next
[2:34:26]
item under
[2:34:27]
council business this evening is
[2:34:28]
castle's consideration of proposed
[2:34:30]
resolution
[2:34:31]
number 2021-3 approving an
[2:34:34]
intergovernmental agreement between
[2:34:35]
broomfield and the colorado energy
[2:34:37]
office
[2:34:38]
for the energy performance contract
[2:34:40]
program council has a copy
[2:34:42]
of the agenda memorandum which staff
[2:34:44]
will summarize
[2:34:46]
thank you mayor and council dan casey uh
[2:34:50]
director of health and human services
[2:34:52]
will walk us through this item dan
[2:34:57]
oh it's tammy oh my gosh
[2:35:01]
my apologies i'm i'm out of order um
[2:35:06]
out of logistical order tammy please
[2:35:09]
walk us through
[2:35:10]
thank you good evening uh andrew valdez
[2:35:13]
from our
[2:35:14]
department is going to present this item
[2:35:16]
andrew are you
[2:35:18]
i am and thank you i thought i was off
[2:35:20]
the hook for a second there
[2:35:24]
good evening mayor and council so i want
[2:35:26]
to speak briefly
[2:35:27]
on the energy performance contracting or
[2:35:30]
epc
[2:35:31]
program and clarify any remaining
[2:35:32]
questions on how the program works
[2:35:35]
and why this was a priority for the ac
[2:35:37]
sustainability committee
[2:35:39]
uh next slice please
[2:35:42]
so the ultimate purpose of the program
[2:35:44]
is to reduce
[2:35:45]
broomfield's overall municipal energy
[2:35:47]
load
[2:35:48]
and by by extension our utility bills
[2:35:51]
right
[2:35:52]
so by auditing and upgrading systems
[2:35:55]
and uh boom field buildings
[2:35:59]
the investment grade audit will reveal
[2:36:02]
upgrades and retrofits
[2:36:03]
that will have impact on our energy
[2:36:05]
loads so at this point
[2:36:07]
we have looked at broomfield buildings
[2:36:10]
with public works and our facility staff
[2:36:12]
and identified 10 potential candidates
[2:36:15]
that are ripe for this for this audit
[2:36:19]
this is based on age and energy use
[2:36:22]
intensity as a function of how big the
[2:36:24]
buildings actually are
[2:36:26]
so why did we choose epc
[2:36:29]
first because brimfield has committed to
[2:36:31]
lead by example
[2:36:32]
in the sustainability space and what
[2:36:35]
better way to showcase
[2:36:36]
leadership than doing high visibility
[2:36:37]
projects in public buildings
[2:36:39]
second the program will make substantial
[2:36:41]
progress towards our adopted greenhouse
[2:36:43]
gas reduction goals
[2:36:45]
as a municipal government just to remind
[2:36:48]
everyone our first goal year our first
[2:36:50]
benchmark is 2025
[2:36:51]
we have committed to a 30 reduction from
[2:36:54]
our 2017 baseline
[2:36:57]
and third long term the program is
[2:36:59]
revenue positive
[2:37:01]
so the graphic on this slide uh
[2:37:03]
illustrates this point on the left we have
[2:37:07]
broomfield's full energy load and
[2:37:10]
associated costs
[2:37:12]
the audit then helps identify projects
[2:37:14]
that will lead to savings
[2:37:16]
those savings are then used to finance
[2:37:18]
the debt
[2:37:20]
once the finance period is over we are
[2:37:22]
actually able to keep the savings right
[2:37:25]
so i do want to point out that we are
[2:37:27]
under no obligation to use the finance
[2:37:29]
mechanism
[2:37:30]
we can simply procure the audit and fund
[2:37:32]
the upgrades to regular
[2:37:33]
through our regular capital improvement
[2:37:35]
programs
[2:37:36]
uh we can go as fast as slow as we want
[2:37:38]
with this with the recommended upgrades
[2:37:40]
obviously the higher impact uh upgrades
[2:37:43]
will be prioritized
[2:37:44]
and all of this is a council's
[2:37:46]
discretion and then finally the cost of
[2:37:48]
the audit can be rolled into the finance
[2:37:50]
package
[2:37:51]
so the upfront outlay that we're
[2:37:52]
committing to tonight
[2:37:55]
can also be offset
[2:37:58]
uh next slide please so
[2:38:01]
uh this is just a timeline slide uh
[2:38:04]
currently we're at step one
[2:38:05]
where we would make the client
[2:38:07]
commitment through the iga proposed in
[2:38:09]
front of you with the state
[2:38:11]
then we procure a qualified esco
[2:38:14]
or energy services company through a
[2:38:16]
competitive rfp process
[2:38:20]
and they help us through the audit
[2:38:23]
identify projects and savings
[2:38:25]
and then there's the implementation
[2:38:28]
phase
[2:38:29]
again these are all account council's
[2:38:32]
discretion
[2:38:33]
so ongoing throughout the lifetime of
[2:38:35]
the project is measurement
[2:38:36]
and verification of the savings this is
[2:38:38]
actually key to the success of the
[2:38:40]
program
[2:38:41]
since the esco has to guarantee us the
[2:38:43]
savings for at least three years
[2:38:45]
they are bound to ensure the projects
[2:38:47]
accomplish their intended savings
[2:38:49]
this also helps with reporting and
[2:38:51]
tracking our municipal goals
[2:38:53]
so staff's recommendation and conclusion
[2:38:55]
is that we proceed with this program and
[2:38:57]
sign the iga with the state
[2:38:59]
to begin the process we're also
[2:39:02]
available for any questions and i
[2:39:03]
believe some members of aces are also
[2:39:06]
on the line to answer some questions
[2:39:11]
okay we'll go to uh public comments next
[2:39:15]
um i lost that screen uh if there's uh
[2:39:20]
if there's anybody that wants to make
[2:39:21]
public comments uh please press star three and state
[2:39:26]
your name first last name and
[2:39:28]
neighborhood for the record
[2:39:29]
um i'm not seeing anybody that's uh
[2:39:32]
that's on the queue so we will uh
[2:39:35]
we'll move then to questions from
[2:39:37]
council members are there comments or
[2:39:39]
questions from city council
[2:39:41]
please raise your hand and you'll be
[2:39:43]
identified
[2:39:47]
councilmember groom hi thank you
[2:39:51]
um great presentation i'll make it super
[2:39:53]
quick
[2:39:54]
um one of the things that i wanted to do
[2:39:57]
is ask a question and make a statement
[2:39:59]
about this
[2:40:00]
um i know the state has
[2:40:04]
i believe it's called ee3
[2:40:07]
or e3 eee they hired
[2:40:11]
to do a lot of the road mapping is that
[2:40:14]
something that we should
[2:40:15]
also tap into as would we be looking at
[2:40:19]
them
[2:40:19]
as our road mapping consultant or is
[2:40:22]
this something completely different than
[2:40:23]
what that e3 consulting does for the
[2:40:25]
state
[2:40:27]
that's that's a good question uh so
[2:40:31]
this is in relationship to the the state
[2:40:34]
road map
[2:40:35]
document right so we want to
[2:40:39]
develop internally uh
[2:40:43]
unless you guys want to give us more
[2:40:44]
money uh
[2:40:46]
a greenhouse gas uh road map
[2:40:49]
with specific uh recommendations
[2:40:52]
specific policy recommendations
[2:40:54]
with the return on environment and
[2:40:55]
return on investment
[2:40:57]
vetted uh in that in that document and
[2:41:00]
that was something that we had uh
[2:41:02]
envisioned
[2:41:02]
as developing internally with our new
[2:41:05]
sustainability manager camille pollan
[2:41:07]
um this is a
[2:41:10]
uh so this energy performance
[2:41:13]
contracting
[2:41:14]
proposal uh and and resolution
[2:41:17]
is sort of the lowest of the low hanging
[2:41:19]
fruit uh
[2:41:20]
it's the easiest win that we can get
[2:41:23]
it offsets our greenhouse gas uh
[2:41:27]
footprint and it's also revenue positive
[2:41:29]
in the long term
[2:41:30]
so this is kind of the no-brainer in the full
[2:41:34]
spectrum of the menu of options we do
[2:41:37]
have
[2:41:38]
um the idea going forward with our
[2:41:41]
greenhouse gas
[2:41:42]
roadmap and plan is that we would have a
[2:41:44]
document
[2:41:45]
um prioritizing short-term and long-term
[2:41:48]
goals
[2:41:49]
for uh city and county of broomfield to
[2:41:52]
pursue
[2:41:53]
um and again i think this was something
[2:41:56]
that we had intended to do
[2:41:58]
internally uh but but again like i said
[2:42:01]
if you want
[2:42:02]
uh to fund to fund a consultant we would
[2:42:06]
not turn down the money
[2:42:08]
there's two more no i was i was hoping
[2:42:11]
to get synergy and pay less
[2:42:14]
but um no that was just a question thank
[2:42:17]
you mr valdez
[2:42:19]
for the answer and um just a comment i
[2:42:21]
would have to say back in
[2:42:24]
2016 i believe we paid for a similar
[2:42:28]
study for
[2:42:29]
housing and i'm not quite sure if we got
[2:42:32]
the full
[2:42:33]
we implemented the full value of that
[2:42:36]
housing
[2:42:37]
um the gap study that we did and i and i
[2:42:39]
want to make sure
[2:42:41]
that when we pay this 95 000 for this
[2:42:44]
program that it is for
[2:42:46]
like you were saying those multiple
[2:42:47]
years that strategic
[2:42:49]
plan um that will guide us all the way
[2:42:52]
through because i believe what happened and i'm sure
[2:42:54]
council member tessier can correct me
[2:42:56]
but
[2:42:56]
things move so quickly after we got done
[2:42:59]
with that
[2:43:00]
um study that it i wouldn't say it
[2:43:02]
became obsolete but we just didn't get
[2:43:04]
the meat for it that we paid
[2:43:06]
so i want to make sure that this one we
[2:43:08]
do have that strategic plan coming out
[2:43:11]
of it
[2:43:12]
that multi-year strategic plan so that's
[2:43:14]
just a comment and something i'll be watching out for
[2:43:17]
thank you mr valdez for the question or
[2:43:19]
the answer and
[2:43:20]
that's all i had mayor councilmember law
[2:43:23]
evans
[2:43:24]
yes staff can you put the graphic of the timeline back up that lovely diagram
[2:43:31]
those flight two uh i don't know
[2:43:35]
maybe no it was i was telling i see
[2:43:37]
sorry oh okay all right fair enough
[2:43:39]
yes wow
[2:43:42]
uh if we can get that back up i um
[2:43:48]
okay here it comes uh no next one i
[2:43:51]
think it was
[2:43:53]
yes that's the one the energy
[2:43:54]
performance contracting timeline yes
[2:43:57]
that's the one and i and i have to say i
[2:44:00]
um i
[2:44:01]
really appreciate this process the way
[2:44:04]
it's
[2:44:04]
outlined because it is it there are
[2:44:07]
discrete
[2:44:08]
ete not eet discrete
[2:44:11]
steps separate steps um and at each
[2:44:15]
step the public has hasn't will have i
[2:44:18]
assume
[2:44:18]
an opportunity to comment on the
[2:44:22]
uh the the implementation or the next step basically how what comes
[2:44:29]
out of it and how we move along
[2:44:31]
one of the one of my very large
[2:44:35]
fears with this entire program
[2:44:39]
has always been that we have never
[2:44:42]
done we've never gotten an estimate of
[2:44:44]
how much this is
[2:44:45]
ultimately going to cost taxpayers
[2:44:48]
um and i uh i
[2:44:51]
am of the opinion that um
[2:44:53]
[Music]
[2:44:56]
i i'm i'm unwilling to commit
[2:44:59]
a lot of taxpayer money any taxpayer
[2:45:01]
money without an idea of how much it is
[2:45:05]
along along the way and i think that
[2:45:06]
this step-by-step framework
[2:45:08]
this timeline that you all have laid out
[2:45:10]
is very very helpful
[2:45:12]
in in going going through that so um
[2:45:16]
even though i did not receive what i
[2:45:18]
asked for when we originally adopted the
[2:45:19]
goals some time ago
[2:45:21]
or a year ago or whatever it was uh i
[2:45:23]
didn't i never did receive any kind of a financial estimate
[2:45:29]
a ballpark of are we talking millions
[2:45:32]
are we talking tens of millions
[2:45:34]
are we talking hundreds of millions um
[2:45:37]
that
[2:45:38]
answer or maybe plural those
[2:45:42]
answers are built into this timeline and
[2:45:45]
this framework that you put together
[2:45:47]
so i very much appreciate that um and i do want to make sure that as as we go
[2:45:53]
through this
[2:45:54]
that the public has an op we'll have an
[2:45:56]
opportunity to comment
[2:45:58]
on what could be some very large ticket
[2:46:02]
items especially once we once we grab
[2:46:05]
that low hanging fruit so
[2:46:07]
um i guess i guess that's that's a
[2:46:10]
question
[2:46:11]
where at what steps
[2:46:15]
will decisions be required by city
[2:46:17]
council that will come
[2:46:19]
um and be available for public comment
[2:46:21]
where
[2:46:23]
thank you for that so so the audit is
[2:46:25]
sort of
[2:46:26]
the first step as you can see so we
[2:46:29]
would do this
[2:46:30]
uh solicitation for the uh energy
[2:46:33]
service company
[2:46:34]
and then the the audit is really where
[2:46:38]
we get to the nuts and bolts
[2:46:40]
of what are the recommendations how much
[2:46:42]
do they cost
[2:46:43]
and what does the financial package look
[2:46:45]
like
[2:46:46]
um and you know again i'll
[2:46:50]
reiterate all the projects uh
[2:46:53]
i mean we are not bound by by any
[2:46:56]
agreement
[2:46:57]
uh to use to do any of the projects to
[2:47:01]
use a financing mechanism to do anything
[2:47:04]
beyond the audit at this point the audit
[2:47:07]
just identifies
[2:47:09]
where we where the savings could be
[2:47:11]
right and then it's council's
[2:47:12]
prerogative and we can also integrate i
[2:47:15]
think a public engagement component here
[2:47:17]
uh to um look at where those targeted
[2:47:21]
investments could be
[2:47:23]
and then what the liabilities would look
[2:47:26]
like
[2:47:26]
for the taxpayer yes i would i would
[2:47:30]
appreciate that
[2:47:31]
um yes i vote for
[2:47:34]
public engagement and public comment as
[2:47:37]
we move through this process so
[2:47:39]
uh thank you very much for bringing this
[2:47:41]
framework forward i appreciate it very
[2:47:43]
much
[2:47:44]
i think that's all i've got mr mayor
[2:47:53]
um aaron did you want to respond back to
[2:47:57]
a comment or
[2:47:58]
question yeah i was just hoping to have
[2:48:01]
the opportunity to
[2:48:02]
uh to reply to councilmember law evans
[2:48:05]
real quick
[2:48:06]
that's okay it's okay go ahead
[2:48:10]
yeah um so first of all i'm glad you're
[2:48:12]
happy with this process
[2:48:13]
i'm happy with this process and i know
[2:48:15]
you are not uh
[2:48:16]
able to attend the meeting when we when
[2:48:19]
we pass the goals
[2:48:21]
and i just kind of wanted to let you
[2:48:23]
know that your your concerns were were
[2:48:25]
not ignored we chose to pass
[2:48:27]
aspirational goals and bring each
[2:48:30]
individual project
[2:48:31]
before council so that we we have the
[2:48:34]
opportunity to get council feedback
[2:48:36]
before
[2:48:37]
we spend any money um and and we pass
[2:48:40]
those goals as aspirational goals
[2:48:43]
so i just kind of wanted wanted to
[2:48:44]
reassure you that you know we we are
[2:48:46]
taking those concerns
[2:48:48]
uh to heart on on the committee and i'm
[2:48:51]
glad that the process that we're
[2:48:52]
bringing before you
[2:48:54]
uh is is sufficient and that you like it
[2:48:57]
i hope this is a good opportunity to
[2:48:59]
continue to work together
[2:49:02]
i appreciate that thank you very much
[2:49:05]
councilmember lim um i just wanted to
[2:49:07]
take a second to thank
[2:49:09]
our aces staff for their research
[2:49:13]
on the epc program and also the aces
[2:49:17]
committee
[2:49:18]
having been in most of those meetings
[2:49:21]
where we have discussed the epc process
[2:49:25]
the the committee and staff have done a
[2:49:28]
significant amount of background
[2:49:30]
research
[2:49:31]
talking to communities who have
[2:49:33]
implemented this
[2:49:34]
talking to previous state officials who
[2:49:37]
have worked with this program
[2:49:39]
so we really have vetted this epc
[2:49:42]
program
[2:49:43]
quite a bit before it was brought to
[2:49:46]
council and there was also
[2:49:48]
interfacing with other staff in other
[2:49:51]
departments
[2:49:52]
to make sure that the 10 buildings that
[2:49:54]
were being identified
[2:49:56]
as most likely to re be you know
[2:50:00]
to benefit from the um the program
[2:50:04]
were identified clearly so there was a
[2:50:06]
lot a lot of background work and i wanted to thank everyone for that
[2:50:11]
thank you councilmember tessier
[2:50:15]
thanks um ditto on what councilmember
[2:50:18]
lim just shared and just wanted to
[2:50:21]
reiterate that this is also an
[2:50:23]
investment in our community this is
[2:50:25]
something that we've been talking about
[2:50:27]
for decades and it's really nice to see
[2:50:30]
this come to fruition
[2:50:32]
we had the the aces team the right
[2:50:35]
people at the right
[2:50:36]
place at the right time and so grateful
[2:50:38]
for their hard work i also wanted to
[2:50:42]
mention that you know there's
[2:50:44]
opportunities for a lot of grants
[2:50:46]
and that andrew
[2:50:50]
and tammy are go-getters and they're looking for all the grant
[2:50:54]
opportunities that they can get
[2:50:56]
and also looking at um
[2:50:59]
you know just how quickly technology
[2:51:01]
changes
[2:51:03]
and so having it this way we
[2:51:06]
you know the aces team and staff were
[2:51:09]
are very aware of
[2:51:10]
you know what we put in place today may
[2:51:12]
not you know necessarily work in five
[2:51:14]
years and to have that flexibility with
[2:51:16]
the technology is is super
[2:51:19]
important so
[2:51:21]
um kudos and way to go
[2:51:26]
councilmember anderson thank you yeah i
[2:51:29]
assure that appreciation for
[2:51:30]
aces and um this was brought forward
[2:51:33]
[2:51:34]
so um i i was not involved in all steps
[2:51:37]
that councilmember lim
[2:51:38]
was referring to but i very much
[2:51:40]
appreciate those efforts and i'm also
[2:51:41]
wondering
[2:51:42]
if um aaron or you could speak a little
[2:51:45]
bit to
[2:51:46]
this program as i understood it um at
[2:51:49]
the first meeting back in 2019 i think
[2:51:52]
it was like
[2:51:53]
february 2019 it's actually a
[2:51:56]
revenue neutral program or can be a
[2:51:58]
revenue neutral program
[2:52:00]
where you um some of the changes are
[2:52:02]
going to
[2:52:03]
the energy offsets are going to uh
[2:52:05]
create
[2:52:06]
more revenue or additional savings more
[2:52:08]
um that can be then used for
[2:52:11]
some of the more expensive changes like
[2:52:12]
a boiler or something is that
[2:52:16]
perhaps andrew could address that yeah
[2:52:18]
so could we go to slide two
[2:52:26]
uh
[2:52:30]
perfect okay so um
[2:52:32]
[Music]
[2:52:33]
the the so you see the chart on the left
[2:52:37]
that bar chart represents essentially
[2:52:39]
our total energy load or our total
[2:52:41]
energy cost
[2:52:42]
the the audit helps identify that kind
[2:52:45]
of first
[2:52:46]
box on the top there so unidentified
[2:52:48]
savings potential
[2:52:51]
so so again the audit is the first step
[2:52:54]
then we do
[2:52:55]
then we agree upon a ultimately this
[2:52:58]
program
[2:52:59]
uh councilmember anderson is a it's a
[2:53:01]
finance
[2:53:02]
mechanism and the debt is serviced
[2:53:06]
through the savings that are identified
[2:53:09]
in the audit so we we determine
[2:53:12]
how long that finance period actually is
[2:53:16]
some communities do 10 years we can make
[2:53:18]
it all the way out to 25 years if we
[2:53:20]
want
[2:53:21]
and throughout that that finance
[2:53:23]
increment those savings
[2:53:25]
actually go to service the debt so
[2:53:26]
there's no money there's no
[2:53:28]
extra money that broomfield spending
[2:53:31]
during that finance increment
[2:53:33]
at the end when our finance increment
[2:53:36]
ends our debt services
[2:53:38]
is totally satisfied whatever savings
[2:53:41]
that we have those those
[2:53:45]
just accrue to broomfield so we just
[2:53:47]
keep
[2:53:48]
what whatever efficiencies and reduced
[2:53:51]
liability that we have
[2:53:53]
for our for our uh utility bills
[2:53:57]
and and again i'll reiterate the the
[2:54:00]
upfront costs
[2:54:01]
of uh paying for the audit
[2:54:05]
and also actually be rolled into the
[2:54:08]
finance
[2:54:09]
vehicle for this entire thing and
[2:54:12]
you know i i i hope that's clear but
[2:54:15]
what we're going to do as we continue to
[2:54:17]
engage with the state energy office on
[2:54:19]
this program
[2:54:20]
so we'll do constant updates and checks
[2:54:23]
about
[2:54:24]
how this actually impacts broomfield but
[2:54:27]
for now for the short term the only
[2:54:29]
budgetary impact is the outlay for
[2:54:31]
the uh for the audit
[2:54:35]
does that uh does that answer your
[2:54:37]
question councilmember
[2:54:38]
uh anderson yes thank you and i just
[2:54:40]
want to i
[2:54:41]
also want to make sure that um everyone
[2:54:43]
console understands that this isn't going to the way that
[2:54:48]
this
[2:54:49]
program is laid out it's not going to
[2:54:51]
cost us all that money and while we're doing this financing
[2:54:55]
mechanism as you described it and making
[2:54:57]
all these energy improvements we're
[2:54:58]
reducing our greenhouse gas emissions
[2:55:00]
and making
[2:55:01]
improvements that you know come they're
[2:55:03]
kind of coming for free alongside this
[2:55:05]
program
[2:55:06]
so i i very much support this and i am
[2:55:09]
so happy that it's moving forward thank
[2:55:11]
you for everyone's efforts
[2:55:17]
and i think aaron wants to come out
[2:55:19]
again
[2:55:21]
yeah um i also just kind of want to
[2:55:24]
reiterate something and also extend my
[2:55:26]
thank you to tammy and andrew and
[2:55:29]
camille and eileen and all the staff
[2:55:31]
help on this
[2:55:32]
one of the other things that's really
[2:55:34]
important is that we're only going to
[2:55:37]
lose the 95 000
[2:55:40]
in the event that they
[2:55:43]
identify 95 000 worth of savings and we
[2:55:47]
choose not to take it
[2:55:49]
um so the initial outlay is the cost of
[2:55:52]
the audit
[2:55:53]
but the cost of the audit actually gets
[2:55:55]
rolled into the cost it gets deducted
[2:55:57]
from the costs of the upgrades
[2:55:59]
as long as we choose to go forward with
[2:56:02]
economic upgrades
[2:56:03]
so i think it's important to recognize
[2:56:06]
that this
[2:56:07]
is is revenue neutral even
[2:56:10]
including the 95 000 that we're asking
[2:56:13]
for
[2:56:14]
today
[2:56:18]
thank you for that clarification uh
[2:56:21]
um is there any other questions or
[2:56:24]
comments from uh
[2:56:26]
council otherwise we'll go to our
[2:56:28]
consideration of proposed resolution
[2:56:30]
number 20 21-3
[2:56:32]
intergovernmental agreements require
[2:56:34]
affirmative votes of two-thirds of the
[2:56:36]
entire council

will the kirk please read proposed

broomfield
[2:56:54]

[2:56:57]
energy performance contract
[2:56:58]

[2:57:04]

about that tonight local non-profit
[2:59:01]
agencies that wish to receive grant from
[2:59:03]
grant funds from the city and county for
[2:59:06]
public purchase
[2:59:07]
public purposes of supporting the health
[2:59:09]
welfare
[2:59:12]
and human services of broomfield
[2:59:14]
residents must apply through the health
[2:59:15]
and human services department
[2:59:17]
uh city council for the 2021 budget
[2:59:20]
approved our grant in the amount of
[2:59:22]
1.5 million dollars we had 33 non-profit
[2:59:26]
agencies submit grant applications
[2:59:28]
requesting a total of just
[2:59:29]
over 2.2 million dollars for this year
[2:59:32]
that includes imagine's request of 948
[2:59:35]
000
[2:59:36]
and i'll reference that here in a second
[2:59:39]
uh
[2:59:39]
it's recommended that imagine be awarded
[2:59:41]
five hundred and forty one thousand
[2:59:42]
three hundred and fifty eight dollars
[2:59:44]
and twenty cents
[2:59:45]
mental health partners be awarded two
[2:59:47]
hundred and ten thousand dollars
[2:59:49]
and broomfield fish be awarded one
[2:59:51]
hundred and thirteen thousand four
[2:59:52]
hundred dollars for twenty twenty one
[2:59:55]
uh just so you know the the process
[2:59:58]
uh once we received the applications
[3:00:00]
those were submitted in september
[3:00:02]
they were received by our department in
[3:00:04]
the middle of october
[3:00:05]
and then we have a review committee that
[3:00:07]
scores all 32 of those miscellaneous
[3:00:10]
grant applications the reason that
[3:00:12]
imagine
[3:00:13]
is called out separately on this
[3:00:15]
particular presentation is that
[3:00:17]
they are not subject to the same
[3:00:19]
application process as our other
[3:00:20]
non-profits
[3:00:22]
and that's because imagine serves as
[3:00:23]
broomfield's community center board
[3:00:26]
and they serve they're contracted by the
[3:00:28]
state to provide that service and they
[3:00:29]
serve
[3:00:30]
uh individuals with intellectual and
[3:00:32]
disavow mental disabilities
[3:00:34]
i'm sorry developmental disabilities
[3:00:36]
it's easier to say before 9 pm i think
[3:00:40]
so they're not subject to this
[3:00:41]
application review their request and their dollar amount is
[3:00:47]
to be reviewed by council so
[3:00:49]
that concludes my quick presentation and
[3:00:52]
i'm happy to answer any questions
[3:00:56]
we'll go to public comments
[3:00:59]
um if there's anybody for the public uh
[3:01:02]
i would like to be heard
[3:01:04]
please press three uh and state your
[3:01:08]
full name and uh and uh neighborhood uh
[3:01:11]
for the record
[3:01:12]
i'm not seeing anybody in the queue
[3:01:15]
there is someone mayor being screened
[3:01:17]
right now sam taylor okay
[3:01:21]
well tell him to hurry i'm kidding
[3:01:24]
sam's a friend sam without sam we don't
[3:01:28]
need to wait for him
[3:01:30]
he'll be okay training
[3:01:39]
uh sam uh please state your full name
[3:01:43]
and your neighborhood for the record and
[3:01:45]
you have three minutes
[3:01:48]
i i apologize i was listening to it on
[3:01:50]
the computer
[3:01:51]
uh this is sam taylor with first filing
[3:01:54]
i was listening to
[3:01:55]
11d and i want to thank um
[3:01:58]
mr casey for the presentation these
[3:02:01]
three organizations
[3:02:03]
imagine mental health partners and fish
[3:02:06]
had
[3:02:06]
impacted our family in many ways
[3:02:09]
everybody in my immediate family has
[3:02:11]
either been an employee
[3:02:12]
a volunteer um or
[3:02:17]
even a client of one of these
[3:02:18]
organizations they're all fantastic
[3:02:21]
organizations
[3:02:22]
and i really appreciate you supporting
[3:02:24]
them tonight thank you very much
[3:02:29]
thank you sam um
[3:02:32]
i'm not noting anybody else uh uh you
[3:02:35]
know
[3:02:35]
not knowing anybody else in the queue so
[3:02:37]
i will go to council uh uh comments or
[3:02:39]
questions are any questions or comments
[3:02:40]
from council um
[3:02:44]
i'll go with councilmember tessier and
[3:02:46]
then councilmember grown councilmember
[3:02:48]
tessier
[3:02:50]
um do i need to recuse myself at all
[3:02:53]
you do um you know i it just crossed my
[3:02:56]
mind when i saw that fish is one of them
[3:02:57]
so
[3:02:58]
whatever the resolution is for fish uh
[3:03:01]
well let's go and do which one is a
[3:03:03]
resolution for fish so uh
[3:03:04]
we can have uh because i presume you can
[3:03:06]
vote on the other two uh
[3:03:08]
mayor that's resolution 20-21-10
[3:03:12]
10. so so when it comes to 20 21-10
[3:03:16]
uh sharon will ask you to recuse
[3:03:18]
yourself
[3:03:20]
the mayor that's the third one so we can
[3:03:22]
go through the first two
[3:03:23]
no i get it i get it i get it i'm i'm on
[3:03:27]
the same page with you uh
[3:03:28]
so i'm we'll just we'll have her vote on
[3:03:30]
nine on eight nine
[3:03:32]
and then uh and then uh and then we'll
[3:03:34]
ask her to recuse herself on ten
[3:03:36]
so so casper ever grown
[3:03:40]
certainly thank you thank you mr casey
[3:03:42]
for a great presentation
[3:03:44]
i really wanted to focus in on the uh
[3:03:47]
deficit for imagine so with that kind of
[3:03:50]
money
[3:03:51]
um well all of them are taking a cut
[3:03:54]
in the funding request but with that
[3:03:56]
kind of budget
[3:03:57]
um fund request what kind of services
[3:04:01]
um will be reduced and and why why was it and i know you said it
[3:04:10]
was a cover
[3:04:11]
related thing but a half million dollars
[3:04:14]
i'm really concerned about that yeah so
[3:04:17]
and thank you for the question
[3:04:19]
councilmember groom uh
[3:04:20]
the the request for funds that we
[3:04:23]
received from imagine included a lot of
[3:04:25]
things that
[3:04:26]
were covet related things like
[3:04:28]
individual counseling sessions and
[3:04:30]
zoom counseling sessions and kind of
[3:04:32]
telehealth work and
[3:04:34]
setting up um you know ppe for their
[3:04:38]
staff and
[3:04:39]
um there were a number of different
[3:04:41]
things in there that weren't necessarily
[3:04:43]
all service related also uh we had to
[3:04:46]
make some tough decisions we had 32
[3:04:48]
applications that were also requesting
[3:04:51]
funds
[3:04:52]
and right now imagine
[3:04:56]
actually our budget for last year and
[3:04:59]
our budget for this year
[3:05:00]
increased by about thousand dollars
[3:05:05]
about fifty six of that seventy three
[3:05:07]
thousand dollars to imagine this year
[3:05:09]
and
[3:05:10]
uh that represented about an eleven and
[3:05:12]
a half percent increase for them
[3:05:14]
um it just it really came down to how
[3:05:17]
much money we had
[3:05:18]
in the pot for all of the services that
[3:05:20]
we had applications for
[3:05:22]
and also um their their request for
[3:05:25]
funds from the year prior doubled
[3:05:27]
there was no way that we could increase
[3:05:30]
their funds by twice the amount that
[3:05:32]
they had asked for that previous year
[3:05:34]
um and i would i would have to go back
[3:05:36]
to their actual
[3:05:38]
um document that that breaks down
[3:05:40]
exactly what they're requesting but i
[3:05:42]
think
[3:05:42]
every service line that they had
[3:05:44]
increased
[3:05:46]
we we asked them to re um kind of
[3:05:48]
resubmit some of their numbers
[3:05:50]
there were a couple of discrepancies and
[3:05:52]
some of the numbers about number of
[3:05:54]
clients that they would be serving
[3:05:55]
but when those came back it wasn't too
[3:05:57]
far below their original request and so
[3:06:00]
you know that's uh the amount of money
[3:06:03]
that we give imagine
[3:06:04]
in this grant application is is pretty
[3:06:08]
small in comparison to what they receive
[3:06:10]
from other communities and also from
[3:06:12]
their ability to draw down on medicaid
[3:06:14]
and those type of things so
[3:06:16]
i don't i don't have really a better
[3:06:18]
answer for you than
[3:06:20]
we really had to figure out and make
[3:06:21]
some critical decisions on how we were
[3:06:23]
going to divide the 1.5 million between
[3:06:25]
32 agencies
[3:06:27]
sure and then another question with
[3:06:29]
imagine
[3:06:30]
um since they serve a lot of different
[3:06:32]
communities
[3:06:33]
is it prorated um by a percentage of
[3:06:37]
clients or
[3:06:38]
is it just um kind of a how do they know how much to ask for by
[3:06:43]
for each community
[3:06:46]
year after year yes and has our
[3:06:48]
percentage grown
[3:06:51]
um our percentage has increased slightly
[3:06:53]
it hasn't grown tremendously with them
[3:06:56]
it's based on the number of clients that
[3:06:58]
they serve from those communities so
[3:06:59]
obviously boulder county is a lot larger than we
[3:07:02]
are so a lot more folks from boulder
[3:07:04]
county are being served by that
[3:07:07]
i would say that it really comes down to
[3:07:09]
that kind of per capita right how many
[3:07:11]
clients they have for each community um
[3:07:14]
and then the different services that
[3:07:15]
they offer
[3:07:16]
so thank you
[3:07:19]
and then um oh sorry i didn't mean to
[3:07:21]
cut you off i just need to hurry i know
[3:07:24]
my minutes are counting down
[3:07:26]
i'm moving to the mental health partners
[3:07:28]
um
[3:07:29]
do they serve 100 100 of their services
[3:07:32]
are here in broomfield right it's not
[3:07:34]
like imagine
[3:07:35]
uh no they actually serve multiple
[3:07:37]
counties but our dollars only go
[3:07:39]
towards broomfield residents okay but
[3:07:42]
they're located here in broomfield
[3:07:44]
uh they do have a location in broomfield
[3:07:46]
yes and they have a oh okay
[3:07:48]
they're they're located in all and not
[3:07:50]
just broomfield okay because i know
[3:07:51]
their location but i just didn't know
[3:07:54]
makes sense and same question for them
[3:07:57]
have they indicated
[3:07:58]
any kind of service reduction
[3:08:02]
um based on the the funding reduction
[3:08:05]
for the broomfield facility um
[3:08:09]
no so actually mental health partners
[3:08:12]
received an increase over what they
[3:08:13]
received last year
[3:08:16]
by about 10 but a decreased to their
[3:08:20]
request a decrease to their request yes
[3:08:23]
and the name
[3:08:24]
to what they uh asked for last year but
[3:08:26]
yeah we again we gave them an increase
[3:08:28]
over
[3:08:28]
their 2020 funding but we could not
[3:08:31]
match the
[3:08:32]
total amount of requests that they had
[3:08:33]
for 21.
[3:08:35]
okay perfect thank you that's all i had
[3:08:38]
i appreciate your presentation mr casey
[3:08:41]
candy council over testing
[3:08:45]
i just wanted to uh thank mandy walke
[3:08:48]

[3:08:52]

[3:09:01]

[3:09:07]

[3:09:08]

[3:09:10]

[3:09:11]

[3:15:53]
regarding the freiko
[3:15:54]
ditch update uh david do you want to
[3:15:57]
walk us through this real quick
[3:15:59]
sir thank you miss hoffman uh good
[3:16:01]
evening mayor city council david allen
[3:16:02]
director of public works
[3:16:05]
i just wanted to give you an update real
[3:16:06]
quickly and as a follow-up to the email
[3:16:09]
i sent to city council right at the end
[3:16:12]
of the year that we had
[3:16:13]
filed a water rights change application
[3:16:16]
to the water court
[3:16:17]
this this effort is in line with
[3:16:20]
promoting
[3:16:21]
council's priority related to water and
[3:16:24]
specifically or just briefly what we did
[3:16:27]
is we filed a change of use application
[3:16:29]
for the 150
[3:16:31]
franco marshall shares that we own and
[3:16:34]
we've acquired those shares over the
[3:16:35]
course of about 25 years and most would be familiar with the
[3:16:40]
water that's associated with a community
[3:16:42]
ditch
[3:16:42]
and historically we have used that water
[3:16:46]
to maintain pond levels throughout the
[3:16:48]
community and
[3:16:49]
recent changes in state law have
[3:16:51]
precluded us from being able to continue
[3:16:53]
to do that
[3:16:54]
so that prompted us to go ahead and file
[3:16:56]
for
[3:16:57]
a change of use because these water
[3:16:59]
shares were historically used for
[3:17:01]
primarily for irrigation purposes
[3:17:04]
as i indicated in that email i listed
[3:17:06]
all the uses
[3:17:08]
some of those include commercial
[3:17:10]
industrial residential domestic
[3:17:12]
as well as the pond level maintenance
[3:17:14]
that we've historically been using
[3:17:15]
but since we were going through the
[3:17:17]
process we just wanted to make sure that
[3:17:18]
we included
[3:17:20]
all of those types of uses in the change
[3:17:23]
of use application
[3:17:26]
the the proceedings themselves will
[3:17:28]
probably take about
[3:17:30]
upwards of several years to complete i
[3:17:32]
think on the outside
[3:17:33]
um time frame probably up to upwards of
[3:17:35]
two years
[3:17:36]
and because of the nature of that that
[3:17:39]
process
[3:17:40]
a lot of it will just depend on the
[3:17:41]
number of opposers that we get
[3:17:43]
so i just wanted to you know formally
[3:17:47]
update council on that action
[3:17:50]
and we will continue to keep council
[3:17:52]
apprised of any significant developments
[3:17:54]
as we move through this process
[3:17:56]
thank you
[3:18:00]
uh mayor and then just the last piece um
[3:18:04]
for for council's uh information which
[3:18:08]
leads to
[3:18:08]
number 14 which is the legislative
[3:18:10]
update which we don't have one tonight
[3:18:12]
but
[3:18:13]
um they are coming back into session the
[3:18:17]
lobbying groups are rallying the troops
[3:18:20]
there has been a movement already on
[3:18:23]
many fronts so denay will continue to be
[3:18:27]
the point of contact as we move through
[3:18:30]
for lobbying we have posted the
[3:18:34]
city county clerk position danae
[3:18:37]
has thoughtfully
[3:18:40]
agreed to continue in the acting
[3:18:42]
capacity until that position has been
[3:18:45]
filled so she continues to work
[3:18:48]
uh with the staff and we feel confident
[3:18:52]
that by shoring up some other support
[3:18:55]
services
[3:18:56]
she will continue to be council's point
[3:18:58]
person for legislation
[3:18:59]
continuing to be out of the cmo and we
[3:19:02]
look forward to hiring that position so
[3:19:04]
we can get her back up in the cmo
[3:19:07]
with that mayor that concludes the
[3:19:08]
manager's report and look forward to um
[3:19:11]
additional legislative updates moving
[3:19:12]
forward okay and i'll just
[3:19:14]
give a chance for council members if
[3:19:16]
they have any questions or comments uh you know on now would be the time to
[3:19:21]
raise your hand and ask
[3:19:24]
i don't see any so uh as jennifer just
[3:19:26]
mentioned or
[3:19:27]
mrs hoffman uh there are no uh
[3:19:30]
legislative update right now
[3:19:32]
uh so um we'll close out uh
[3:19:35]
the urban renewal authority the
[3:19:37]
bromfield
[3:19:39]
urban renewal authority was previously
[3:19:40]
convened in items 15a and 15b
[3:19:43]
where were reviewed currently with item
[3:19:47]
7i and 11b under the consent agenda
[3:19:49]
council business there
[3:19:50]
be no further business before the urban
[3:19:52]
renewal authority the meeting is
[3:19:54]
adjourned
[3:19:55]
there is no business before the aristo
[3:19:56]
local improvement district board of
[3:19:58]
directors
[3:19:59]
or special reports this evening and we
[3:20:01]
actually have
[3:20:02]
two requests from city council members
[3:20:06]
under sections 18. the first request is
[3:20:09]
for council's consideration
[3:20:10]
relating to western leaders network 30
[3:20:13]
times 30 pledge
[3:20:14]
council member anderson would you like
[3:20:15]
to begin tonight's discussion
[3:20:19]
uh yes thank you um
[3:20:22]
this is my first section 18 request so
[3:20:24]
hopefully i do this right
[3:20:25]
um i would like to request that council
[3:20:27]
consider a resolution supporting the 30
[3:20:29]
by 30 campaign to protect 30 percent of
[3:20:32]
lands
[3:20:32]
and oceans by 2030 i'll just give you a
[3:20:36]
take about two or three minutes to go
[3:20:37]
through um
[3:20:38]
a few notes i have here the 35 30
[3:20:40]
campaign is a worldwide science-based
[3:20:42]
initiative to conserve at least
[3:20:44]
30 percent of earth's lands and oceans
[3:20:47]
by the year 2030
[3:20:48]
and was launched to address our climate
[3:20:50]
crisis and reverse the destruction of
[3:20:52]
our wildlife
[3:20:52]
waters and natural places in our region
[3:20:55]
western leaders network is sponsoring
[3:20:57]
the 30 by 30 pledge which
[3:20:59]
asks local and tribal governments to
[3:21:01]
pledge to preserve 30 percent of our
[3:21:02]
lands and waters by 2030.
[3:21:05]
this pledge is in line with the and
[3:21:07]
supports the efforts by congress to
[3:21:09]
champion this goal
[3:21:10]
such as the 30 by 30 resolution led by
[3:21:12]
senators udall
[3:21:13]
and bennett and several representatives
[3:21:15]
including our own representative joe
[3:21:17]
nagoose
[3:21:19]
this uh this um pledge seemed quite
[3:21:22]
fitting because broomfield as we all
[3:21:24]
know has already established a goal of
[3:21:26]
maintaining 40
[3:21:27]
open space um and we are already uh
[3:21:34]
kristin prince shared some numbers with
[3:21:35]
me that we're currently at 34.9
[3:21:38]
percent and on our way to that 40 so
[3:21:41]
we're above the 30 percent there
[3:21:42]
and we received um
[3:21:45]
also an update from david allen that
[3:21:48]
regarding the water that one of the main
[3:21:49]
components of broomfield's
[3:21:51]
2020 water efficiency plan includes the
[3:21:53]
continued use and expansion of the
[3:21:54]
non-public irrigation water system along
[3:21:57]
with the gave some other
[3:21:58]
areas where broomfield is striving for
[3:22:01]
water conservation
[3:22:02]
and that is uh in places where we don't
[3:22:06]
have large amounts of water it's just
[3:22:07]
that support and that um commitment to
[3:22:10]
what we can do is all um all that is
[3:22:13]
really required
[3:22:15]
um and the um uh
[3:22:19]
councilmember lim did we talk to the
[3:22:20]
aces committee
[3:22:22]
and i think it may have been tammy um
[3:22:24]
they did not make a formal
[3:22:25]
recommendation but several the members
[3:22:27]
were generally supportive
[3:22:29]
um and if there is a council agreement
[3:22:31]
on the campaign we could model this
[3:22:33]
approach similar to boulder county who
[3:22:35]
adopted a
[3:22:36]
proclamation in support of the
[3:22:37]
congressional resolutions um
[3:22:39]
just a couple months ago and i'm
[3:22:42]
happy to try to answer questions but
[3:22:45]
that is um
[3:22:46]
i guess the overview thank you good job
[3:22:49]
thank you councilmember anderson uh
[3:22:51]
we'll proceed with public comments if
[3:22:53]
there's anyone who'd like to be heard
[3:22:55]
please press star 3 state your first and
[3:22:57]
last name and neighborhood for the
[3:22:58]
record
[3:22:59]
um i'm not seeing anybody in the queue
[3:23:04]
mayor pro temp um
[3:23:08]
so we will go to council comments or
[3:23:10]
next uh anybody from council would like
[3:23:12]
to address this
[3:23:13]
issue or uh or raise your hand or we can just kind of indicate that
[3:23:19]
we're all in agreement to move forward
[3:23:21]
mayor pro tem agreement to move forward
[3:23:24]
and thank you council member anderson
[3:23:26]
for bringing this forward
[3:23:27]
thanks i see most people nodding their
[3:23:31]
heads so we i don't think we need to
[3:23:32]
have in fact i see everybody not there
[3:23:34]
except maybe councilmember law evans but
[3:23:36]
uh but uh
[3:23:37]
but she's she i'm trying to be funny
[3:23:41]
tonight
[3:23:42]
so the uh the uh so i
[3:23:45]
it looks to me like the consensus is the
[3:23:47]
move forward uh jennifer and uh
[3:23:49]
councilmember anderson and uh and this
[3:23:51]
certainly got vetted so
[3:23:53]
customer shaft did you want to say
[3:23:54]
something yeah thank you i just wanted
[3:23:56]
to clarify the next step so the
[3:23:57]
suggestion by uh councilmember anderson
[3:24:00]
was to
[3:24:00]
put forth a proclamation to officially
[3:24:03]
have council weigh in on this
[3:24:05]
uh this goal of the 30 by 30. is that
[3:24:08]
the intent is that
[3:24:09]
council member anderson will work with
[3:24:11]
staff to put forward a proclamation for
[3:24:12]
council to see in the coming
[3:24:14]
weeks to months council members anderson
[3:24:18]
i believe that's a yes right
[3:24:20]
oh if that was a question for me um yes
[3:24:22]
i can work with um staff
[3:24:23]
too uh on that proclamation so okay
[3:24:26]
thank you yes the answer is yes thank
[3:24:29]
you
[3:24:30]
okay and i think that we can close that
[3:24:32]
out i mean i think uh
[3:24:33]
i mean i i think you have your direction
[3:24:35]
and thank you for bringing it up and it was seemed to be well received by
[3:24:38]
um both kristin and i think david allen
[3:24:41]
so thank you councilmember anderson um
[3:24:44]
so we will move to
[3:24:46]
uh the second request which is from
[3:24:47]
councilmember lim
[3:24:49]
um would you like to begin tonight's
[3:24:51]
discussion on your 18a
[3:24:53]
item i'm requesting that council begin
[3:24:56]
to consider an ordinance
[3:24:58]
to extend reverse setbacks reverse
[3:25:02]
setbacks regulate the distance with
[3:25:04]
which
[3:25:04]
a residential developer may construct a
[3:25:08]
new home
[3:25:09]
near an existing oil and gas facility
[3:25:12]
we have had recent development projects
[3:25:16]
where reverse setbacks have been
[3:25:18]
pertinent to the discussion and we will
[3:25:21]
continue
[3:25:22]
to encounter these development
[3:25:23]
situations
[3:25:25]
in the coming months it will be more efficient i would think
[3:25:30]
to have the reverse
[3:25:31]
setback regulations in place and not
[3:25:35]
continue to handle them on an ad hoc
[3:25:38]
basis
[3:25:40]
i suggest that staff draft an ordinance
[3:25:43]
that
[3:25:44]
would include a scientific basis for
[3:25:47]
reverse setbacks
[3:25:48]
similar to what was already set forth in
[3:25:51]
ordinance number 2123
[3:25:54]
revising the broomfield municipal code
[3:25:56]
regarding zoning for oil and gas
[3:25:58]
development
[3:26:00]
background currently regarding reverse
[3:26:02]
setbacks broomfield regulations state
[3:26:04]
in title 16 that no residential lots
[3:26:08]
in any subdivision shall be platted any
[3:26:11]
closer than 200 feet
[3:26:13]
from an oil and gas facility
[3:26:16]
and no public or private school building
[3:26:19]
and any subdivisions shall be located
[3:26:21]
any closer than
[3:26:22]
500 feet so as
[3:26:25]
we probably recall in may of 20
[3:26:28]
when we passed ordinance number 21 2123
[3:26:34]
in the use by special review it we said
[3:26:36]
that no oil and gas location containing
[3:26:39]
an oil and gas well
[3:26:41]
uh shall be located any closer than 2000
[3:26:43]
feet from the nearest parcel lot line
[3:26:46]
under certain uses so
[3:26:49]
um i'm asking for staff
[3:26:53]
to bring cons right draft the ordinance
[3:26:58]
with hopefully these the scientific
[3:27:00]
basis
[3:27:01]
um in our original ordinance for the
[3:27:03]
setbacks we cited the cdphe study
[3:27:06]
we cited our own health impacts um
[3:27:09]
and then i would also propose that we
[3:27:11]
might want to
[3:27:13]
excuse me discuss the reverse setback
[3:27:15]
regulations in a tiered approach
[3:27:18]
so we might have tiers for a large scale
[3:27:21]
site under development in production a
[3:27:24]
different tier
[3:27:25]
for a single producing well and a
[3:27:27]
different tier
[3:27:28]
for plug and abandoned wells with
[3:27:30]
reverse setbacks
[3:27:32]
so that's some um basic ideas that i
[3:27:36]
wanted to put forward
[3:27:37]
and if there's any questions please let
[3:27:39]
me know
[3:27:42]
we'll not proceed with public comments
[3:27:45]
if there's anyone from the public that
[3:27:46]
would like to speak on this
[3:27:48]
issue please state your full name and
[3:27:51]
your neighborhood and you you'd have
[3:27:53]
three minutes to make your comments
[3:27:54]
i don't see anybody in the queue so i'll
[3:27:57]
go to council member comments next
[3:27:59]
council members
[3:28:03]
councilman anderson thank you um
[3:28:06]
you know as someone living in anthem
[3:28:08]
highlands and in ward 4
[3:28:10]
um as part of my constituents with the
[3:28:12]
davis sport three six well
[3:28:14]
um we've definitely seen that need for
[3:28:16]
reverse setbacks and also
[3:28:18]
with the um and in the beginning it was
[3:28:21]
a concern about you know
[3:28:22]
wells are under development but when you
[3:28:23]
see these large-scale facilities
[3:28:25]
you realize that um those emissions
[3:28:27]
we're realizing those emissions continue
[3:28:29]
we can continue to see uh spikes with b
[3:28:32]
techs and other chemicals and that becomes a very serious concern
[3:28:36]
um then we must consider when
[3:28:38]
thinking we're going to build next to
[3:28:39]
them so i definitely support um
[3:28:41]
councilmember lim's
[3:28:42]
request for uh ordinance regarding
[3:28:45]
reaper setbacks thank you
[3:28:48]
catherine reliance thank you mr mayor i
[3:28:51]
appreciate the opportunity
[3:28:53]
um it it seems to me
[3:28:56]
that we have discussed this before
[3:29:01]
and sort of where we landed several
[3:29:04]
years ago
[3:29:04]
if i recall correctly was on
[3:29:09]
that there's a fundamental difference
[3:29:11]
between
[3:29:13]
owning a home living in a home and
[3:29:15]
having
[3:29:16]
oil and gas development come to you
[3:29:19]
versus
[3:29:21]
having an oil and gas facility
[3:29:24]
um plug and abandon plugged in abandoned
[3:29:27]
well
[3:29:28]
operated well what have you
[3:29:31]
and having uh
[3:29:35]
a a home built nearby where the home
[3:29:38]
buyer has the opportunity to
[3:29:42]
understand the proximity of the facility
[3:29:46]
under do their own um investigation and
[3:29:49]
education with regard to risks and make
[3:29:51]
their own
[3:29:52]
edge hopefully educated decision
[3:29:55]
and i've actually shown homes as a real
[3:29:59]
estate broker not many because i don't
[3:30:00]
do much residential
[3:30:03]
where where it was part of the
[3:30:05]
disclosure documents
[3:30:06]
that hey this is within a certain
[3:30:09]
distance of
[3:30:11]
whatever facility um and and that
[3:30:14]
became the basis for starting a
[3:30:16]
conversation
[3:30:18]
so i um i think that the
[3:30:25]
i'm willing to discuss this more i'm not
[3:30:28]
willing
[3:30:29]
to go straight from
[3:30:30]
[Music]
[3:30:32]
a section 18 request to an ordinance but
[3:30:34]
i am willing to have
[3:30:37]
conversations on this issue and and see
[3:30:40]
if there are better ways to
[3:30:43]
um to work on this because frankly the
[3:30:44]
other thing is if we were to put in
[3:30:47]
if we were to make identical setbacks
[3:30:50]
where the setback
[3:30:51]
was 2000 feet for new construction new
[3:30:54]
residential construction from
[3:30:56]
a um a an existing
[3:30:59]
facility or plugged in abandoned well or
[3:31:01]
whatever i would think among other
[3:31:03]
things
[3:31:03]
that up in the northern part of
[3:31:05]
broomfield at in the baseline
[3:31:06]
development
[3:31:07]
i would think that those people would be
[3:31:09]
just completely shut down
[3:31:11]
and then in in terms of what they what
[3:31:13]
their current plans are
[3:31:15]
and then we get into a sticky situation
[3:31:19]
again this is all conjecture on my part
[3:31:21]
having done this now for seven years
[3:31:24]
um i would think that we'd get into a
[3:31:25]
situation of a discussion
[3:31:27]
as to whether or not this becomes a
[3:31:29]
taking with some of the entitlements at
[3:31:33]
baseline and i'm just using baseline
[3:31:35]
as a as an example some of the
[3:31:37]
entitlements in place some of them not
[3:31:38]
and here we come and we change it at
[3:31:41]
this point
[3:31:42]
so i think this could get i appreciate
[3:31:46]
the intent
[3:31:46]
which is to protect health and safety
[3:31:49]
absolutely
[3:31:50]
appreciate the intent but i think this
[3:31:52]
has the potential to blow up and be
[3:31:54]
a much stickier situation than
[3:31:58]
um anything relatively
[3:32:01]
straightforward as to as to what's been discussed so
[3:32:05]
i'm absolutely willing to discuss it
[3:32:07]
more but i'm
[3:32:08]
very much unwilling to go straight to
[3:32:11]
ordinance um from here so
[3:32:15]
i'd like to honestly what i'd like to do
[3:32:17]
is have discussions with all the
[3:32:20]
stakeholders in broomfield
[3:32:22]
as well as the health and safety people
[3:32:24]
gather the scientific rationale for
[3:32:27]
a specific setback and see if we can um
[3:32:31]
a reverse setback see what sort of a discussion falls out to
[3:32:36]
where
[3:32:37]
people feel heard people feel valued in
[3:32:40]
their current entitlements their current
[3:32:42]
situation
[3:32:43]
and yet we do our due diligence and our
[3:32:47]
complete our responsibility to
[3:32:48]
protecting human health and safety i'd
[3:32:50]
like to see this be an extended process
[3:32:52]
i guess is what i'm saying so
[3:32:53]
i hope that makes sense i do appreciate
[3:32:55]
council member lim
[3:32:56]
bringing this forward um it is a
[3:32:59]
discussion that's
[3:33:00]
certainly timely so those are my
[3:33:02]
comments mr mayor thank you
[3:33:04]
councilmember groom
[3:33:07]
uh yes thanks mayor um i i do agree
[3:33:10]
i'm okay moving this forward into a
[3:33:12]
discussion i have a lot of concerns
[3:33:15]
associated around the impacts and
[3:33:18]
intents i do recall that even since
[3:33:22]
we had the concept of reverse setbacks
[3:33:24]
we've approved developments
[3:33:27]
that have been next to an oil and gas
[3:33:31]
facility and an active and expected to
[3:33:35]
be abandoned
[3:33:36]
so i do think that there is we need to
[3:33:39]
really understand and what i would like
[3:33:41]
to know in the discussion
[3:33:42]
is where we are technically with
[3:33:44]
abandoning them plugging
[3:33:46]
and i know that we've had the one issue
[3:33:48]
in broomfield
[3:33:49]
um it was old old
[3:33:53]
plug-in and abandoned technology but
[3:33:54]
what can we do to enhance that so we can
[3:33:57]
still
[3:33:58]
develop our lands and then also one
[3:34:01]
thing i would be looking at
[3:34:03]
from a legal standpoint is
[3:34:06]
there's a lot of people that's put a lot
[3:34:08]
of money in developing broomfield
[3:34:10]
and what would be those implications for
[3:34:13]
us if
[3:34:14]
we now deem their land undevelopable um anyway and i would also um suggest this be
[3:34:23]
more of an executive session discussion
[3:34:26]
um
[3:34:26]
and then and then move out into a study
[3:34:29]
session if we could
[3:34:34]
yeah and i'll make a comment on that if
[3:34:35]
mayor pro tem does it because there has
[3:34:37]
been some discussion on the mayor for
[3:34:40]
them
[3:34:42]
thank you mayor i'll let you talk about
[3:34:44]
that but um
[3:34:46]
i just wanted to to say it kind of goes
[3:34:48]
in the category of when
[3:34:50]
you know we know better we do better and
[3:34:53]
the 200-foot setback that is currently
[3:34:56]
on the books the hard setback was not
[3:34:58]
based on any
[3:34:59]
science or health and safety data
[3:35:02]
and with regards to developers not being
[3:35:05]
able to develop well the
[3:35:07]
methane leak in anthem in the anthem
[3:35:10]
area
[3:35:11]
is preventing a developer from moving
[3:35:13]
forward
[3:35:14]
because um of its proximity to this
[3:35:18]
old plugged and abandoned well that
[3:35:20]
keeps leaking
[3:35:22]
there's the carlson well that's next to
[3:35:24]
the school
[3:35:25]
where where you live mayor i mean these
[3:35:28]
things inevitably leak
[3:35:30]
with time and every time they go to do a
[3:35:33]
pna it
[3:35:34]
seems like there's remediation needed so
[3:35:36]
those volatile vulnerable
[3:35:57]
[Music]
[3:36:04]
i support moving forward with this uh in
[3:36:08]
a study session or
[3:36:09]
um other venues executive session but i
[3:36:12]
definitely support
[3:36:13]
re revisiting this topic yeah let me
[3:36:16]
make a couple comments
[3:36:17]
in a specific on the executive session
[3:36:19]
about what both
[3:36:20]
councilmember law evans groom said i'll
[3:36:22]
just say from my perspective
[3:36:24]
i've been attending the wednesday
[3:36:25]
afternoon meetings which i found
[3:36:26]
productive
[3:36:27]
and the uh the davis 43.6 which as methane lakes is in the middle
[3:36:32]
of a development
[3:36:33]
and we've been holding up permits uh
[3:36:36]
there was a discussion about reverse
[3:36:37]
setbacks at one of those meetings
[3:36:39]
and i guess i was really pleased to see
[3:36:41]
that gene put this forward
[3:36:43]
because it because there's an issue
[3:36:45]
there uh that needs to be addressed by
[3:36:47]
council
[3:36:48]
uh and i think it was taken seriously
[3:36:50]
enough by um by
[3:36:51]
the city staff when uh when gene raised
[3:36:53]
it that they're looking into it and they
[3:36:55]
want to add this
[3:36:56]
to the uh the 26th uh uh executive
[3:37:00]
session we're set right now to have a
[3:37:01]
five o'clock
[3:37:02]
executive session on oil and gas matters
[3:37:04]
my understanding is that this can be
[3:37:06]
added to that session
[3:37:07]
because it is about oil and gas
[3:37:08]
regulations and so an answer
[3:37:10]
you know so we will have an executive
[3:37:12]
session i think out of that executive
[3:37:14]
session
[3:37:15]
we'll probably have a study session come
[3:37:16]
out of that as you know come out of that
[3:37:18]
as well that's you know
[3:37:19]
that's that's public and so so so my
[3:37:22]
comment is
[3:37:23]
uh i think it's absolutely necessary to
[3:37:25]
move forward
[3:37:26]
for all the reasons everybody said
[3:37:28]
tonight and the legal implications
[3:37:30]
are very significant and uh and so so uh so we'll address that on the 26th and
[3:37:36]
once again i'm seeing everybody so once again staff and and i think
[3:37:40]
nancy had chimed in as well
[3:37:42]
you know that uh they're they're
[3:37:44]
prepared to address this issue
[3:37:46]
in our study session on the 26th um you
[3:37:49]
know
[3:37:49]
i will i pointed out today when we were
[3:37:51]
talking about it
[3:37:52]
or maybe it was last wednesday the uh we
[3:37:55]
do have the the dylan point on the 26th
[3:37:58]
so we can't go much past six o'clock so
[3:38:00]
we'll need to keep it
[3:38:02]
fairly concise uh because i think we're
[3:38:04]
all anticipating i think
[3:38:05]
council set aside or excuse me denae and
[3:38:08]
others have set aside uh
[3:38:09]
a few hours for the dillon point so uh so
[3:38:13]
anyway uh councilmember lim thanks for
[3:38:15]
bringing it forward and uh
[3:38:17]
it's a discussion we just have to have
[3:38:19]
and so uh i am going to
[3:38:21]
uh move towards uh i'm not aware of any
[3:38:25]
other business
[3:38:27]
uh is there any other business to come
[3:38:28]
before council
[3:38:32]
yeah and thank you council once again a
[3:38:34]
really good meeting
[3:38:36]
very thoughtful uh and uh and uh
[3:38:40]
thank you and the meeting is adjourned
