[0:21]
right, just a reminder to silence
[0:23]
your cell phones
[0:28]
and we'll start with roll call.
[0:31]
>> Sherman
[0:31]
>> here.
[0:32]
>> Councelor Horton
[0:33]
>> here.
[0:34]
>> Councelor Quinnland
[0:35]
>> here.
[0:35]
>> Councelor Scizy
[0:37]
>> here.
[0:37]
>> Councelor Styles here.
[0:39]
>> Councelor Stradlin here. Councelor Tyrie
[0:42]
>> here.
[0:44]
>> Did you call me [snorts] and I not
[0:45]
answer?
[0:47]
>> Did I answer? Oh, good for me.
[0:49]
[laughter]
[0:51]
>> I believe I did. I'm here. Okay, we do
[0:55]
have a quorum. So, that's good. Approval
[0:58]
of the agenda. Does anybody have any
[1:00]
changes to the agenda today?
[1:02]
>> I have one.
[1:02]
>> Okay.
[1:03]
>> Um the final item in work session for
[1:06]
comp study. We're going to move that to
[1:08]
Monday night's meeting and it's actually
[1:09]
for the 2027 employee compensation
[1:12]
study.
[1:12]
>> Okay. Very good. Would anybody like to
[1:15]
make a motion on the agenda?
[1:17]
>> I move that we approve the agenda for
[1:19]
the special meeting of September 9th,
[1:21]
2026 with the revision of the comp study
[1:24]
being moved to the next regular meeting.
[1:27]
>> Second.
[1:28]
>> Any discussion? We'll call vote.
[1:32]
>> Councelor [snorts] Tyrie,
[1:33]
>> yes.
[1:33]
>> Councelor Horton,
[1:34]
>> yes.
[1:35]
>> Councelor Scazy,
[1:36]
>> yes.
[1:37]
>> Councelor Quinnland,
[1:38]
>> yes.
[1:39]
>> Mayor Sherman,
[1:40]
>> yes. All right, that motion passes.
[1:43]
Visitors and delegations. Um, we'll
[1:45]
start with citizen comments. Citizens
[1:48]
are invited to speak to council on any
[1:50]
item that does not have a public hearing
[1:52]
scheduled. There's a 5-minute time limit
[1:54]
per person unless otherwise noted by the
[1:56]
mayor. Please note that no formal action
[1:58]
will be taken on any item that is not on
[2:00]
the posted agenda due to the open
[2:02]
meeting law provision. However, they may
[2:04]
be placed on a future posted agenda if
[2:07]
action is required. to better assist you
[2:09]
with questions, please submit them in
[2:10]
writing to the city clerk and someone
[2:12]
with from staff will respond. Do we have
[2:14]
anybody here that wants to um uh for
[2:18]
citizen comments?
[2:20]
>> Does anybody want to speak to council?
[2:22]
>> I'm just curious.
[2:28]
» Yes. Do you want if you want to address
[2:30]
council
[2:35]
» can I address that for just a moment?
[2:37]
>> If there's anyone in the audience who is
[2:39]
having trouble hearing um please let me
[2:41]
know. We do have some hearing devices
[2:44]
that we are happy to offer you. Would
[2:46]
you like one?
[2:49]
>> You have a hearing device. Do you want
[2:50]
hearing device?
[2:52]
>> Okay.
[2:55]
>> And as far as the [laughter]
[2:58]
If you have data center questions, you
[3:00]
can tell us any comments that you want.
[3:03]
If you want to address, we can't really
[3:05]
speak. We if we we have a pending
[3:08]
application, so we can't really talk
[3:10]
respond to you, but if you want to
[3:14]
>> So there is possation.
[3:17]
Okay. I was just told that we could
[3:19]
listen, but we can't respond.
[3:22]
>> So, and our go ahead, Dan.
[3:26]
>> Oh, I'm sorry. Yeah, I was just going to
[3:27]
say it's it's not out of lack of
[3:30]
respect. Just the open meetings law um
[3:32]
require us to not address from the dis
[3:35]
uh things that aren't on the agenda. So
[3:37]
feel free to uh address the council and
[3:40]
we're happy to listen to you. Um I
[3:42]
believe the mayor usually has a uh staff
[3:45]
will get back to you uh within I forget
[3:48]
which how many hours, but um we just
[3:51]
can't respond from the dis tonight.
[3:53]
>> Correct. Yes. Yeah. If you have concerns
[3:55]
about anything, you're welcome to
[3:56]
address us, but we can't. Um, so, okay.
[4:02]
Does anybody else want to speak to
[4:04]
council? Okay. So, we'll move on. Um, we
[4:07]
have an executive session that we have
[4:09]
to do before we come back and go into
[4:12]
our work session. Um, so if you are
[4:16]
wanting to listen to the work session or
[4:17]
something, we have to do our executive
[4:19]
session first.
[4:21]
So, um, I would look for a motion to go
[4:26]
into executive session.
[4:32]
I move that we go into executive session
[4:34]
pursuant to Colorado Revised Statute
[4:35]
246424E
[4:38]
for determining positions relative to
[4:40]
matters that may be subject to
[4:41]
negotiations, developing strategy for
[4:43]
negotiations, and instructing
[4:44]
negotiators. The matter to be discussed
[4:47]
is incentives for new business.
[4:51]
Um,
[4:52]
>> second.
[4:54]
>> Any discussion? Roll call.
[4:57]
>> Councelor Skezy.
[4:58]
>> Yes.
[4:59]
>> Councelor Quinnland.
[5:00]
>> Yes.
[5:01]
>> Councelor Horton.
[5:02]
>> Yes.
[5:03]
>> Councelor Tyne.
[5:04]
>> Yes.
[5:04]
>> Mayor Sherman.
[5:05]
>> Yes.
[5:06]
>> Would you mind explaining a little bit
[5:08]
about the difference between the two
[5:09]
meetings?
[5:10]
>> Yes. So, for an executive session is
[5:13]
where we talk about
[5:16]
um
[5:19]
I'm going to let the attorney describe
[5:21]
explain the difference. [laughter]
[5:23]
>> Go ahead, D.
[5:24]
>> Sure. Thank you, mayor. Uh, so during
[5:26]
executive session, it's we first of all,
[5:29]
we conduct as much business as we
[5:31]
possibly can out in the open so that
[5:33]
everyone's aware so the public knows and
[5:35]
has input. Uh but there's certain times
[5:38]
that are spelled out in the Colorado
[5:40]
Revised Statutes in 24442
[5:43]
SE subsection
[5:45]
4 uh that say hey this is a matter that
[5:49]
if it gets out um you know and it needs
[5:52]
to be described or discussed in public
[5:54]
in private. Um some of these items are
[5:58]
you know if there's a personnel matter
[6:00]
and you uh just want really a candy
[6:03]
conversation. Another item is say the
[6:06]
town or the city wants to buy a certain
[6:08]
property. If they say, "Hey, here's our
[6:10]
top dollar limit in open session,
[6:13]
someone can go out there and under bid
[6:15]
them." So, it's a matter that needs to
[6:16]
be discussed in private. The statute is
[6:19]
very limited. There's no decisions made,
[6:22]
no action taken. Uh it's usually just to
[6:25]
discuss and and get information and form
[6:27]
opinions. Um and then any action that
[6:30]
was is taken on what's discussed in
[6:34]
executive session will be done in open
[6:36]
session in front of everyone on the
[6:38]
record. So um we invite you to stay.
[6:42]
There will be no decisions made in this
[6:44]
meeting and I I'm looking [laughter] at
[6:45]
the agenda. I believe I heard the
[6:47]
amendments correct. So the only thing
[6:50]
that's going to follow is the work
[6:51]
session. Um I think I covered the bases.
[6:55]
If you guys have any questions, let me
[6:56]
know.
[6:57]
>> Yes. So um but the work session is
[7:01]
public correct?
[7:02]
>> Yeah. Yeah. So the work session is
[7:05]
public but we our executive session like
[7:09]
you said is stuff we discuss in private.
[7:11]
So we will close the close the room for
[7:14]
our executive session and then we'll
[7:16]
open it back up when we're through and
[7:19]
it shouldn't take too long. But yeah, so
[7:23]
we'll close close the room for our
[7:26]
executive session, but then we will open
[7:28]
it up again and you can be here for the discussion items in the work session
[7:34]
if that makes sense. So
[7:37]
>> yeah,
[7:40]
y
[7:42]
thank you. Sorry about that.
[7:51]
Yeah, we will talk about it and you're
[7:52]
welcome to listen to your work session.
[7:56]
>> You guys are going to put one in and
[7:58]
>> have an executive session.
[8:05]
» Thank you.
[8:26]
I don't know if we're still recording.
[8:34]
» I'm not saying
[8:40]
[clears throat]
[8:43]
anyway.
[51:20]
I'll let you
[51:30]
church.
[51:33]
>> You're back. Okay.
[51:35]
So, um to start, Dan Cobra has an
[51:39]
announcement.
[51:42]
>> Thank you, Mayor. Uh my name is Dan
[51:44]
Crob. I'm the city attorney. I'll note
[51:46]
for the record the time is 651. We've
[51:48]
just exited an executive session. I was
[51:50]
present throughout. The scope of the
[51:52]
conversation was consistent with the
[51:54]
scope of the statute. And as the city
[51:56]
attorney, the attorney claim privilege
[51:58]
attaches. Thank you, mayors.
[52:00]
>> Thank you, Dan. And we don't have
[52:02]
anything to vote on. So I will look for
[52:04]
a motion to adjourn this meeting and
[52:06]
move into our work session.
[52:08]
>> I move to adjurnn.
[52:09]
>> Second.
[52:11]
>> Um any more discussion?
[52:14]
>> Uh all in favor say I.
[52:16]
>> I.
[52:17]
>> Any opposed?
[52:18]
>> All right. And we'll go into our work
[52:20]
session.
[52:21]
>> All right. Well, thank you everybody for
[52:23]
sticking around. Those executive
[52:24]
sessions are always a big unknown how
[52:26]
long they're going to take. Sometimes
[52:27]
it's five minutes, sometimes it's much
[52:29]
longer. All right. All right. Well,
[52:30]
let's talk about data center standards.
[52:36]
So,
[52:37]
thank you. that I'm passing out to
[52:39]
council right
