[43:33] So, where we were seeing a history, in fact, the Rivera's just received as we all did
[43:42] the latest tax statement.
[43:46] And Butler County has apparently decided that property is a commercial property.

[43:58] the tax statement for this year for the Rivera increase 500 and 22% so the county
[44:12] appraisers office has made a determination that this is a commercial property however, at this
[44:20] point they are not allowed to utilize it as such so there needs to be some we need to figure out
[44:28] consistency there, whether those kind of assessments are a fair assessment of what's happening on this property.
[44:39] Because if they're not allowed to use this, we'll go deal with that.
[44:49] And they are very well aware of the zoning regulations and zoning requirements in 2014.
[44:57] They were here in front of this board regard.
[45:00] Being able to operate their trucking business on this property, which was not approved. So they immediately
[45:09] made other arrangements. They moved that business. It's now in Sejwik County. So Sejwik County is reaping the benefits of those taxes and income or the trucking business. So they are aware of zoning requirements and restrictions identified by them.
[45:30] So there was never a set of rules or conditions that was established for the radio or outdoor entertainment thing.
[45:43] It was discussed in this form but it was not approved or quantified.
[45:49] So with this action, it provides Butler County with a legally enforceable set of defined conditions.

[1:50:36] The operational plan notes the following that they wish to construct a 5,000 square foot barn or rustic style building that could host up to 350 guests.
[1:50:47] They covered outside area which could host up to 300 guests. They will host weddings, retreats, functions, private celebrations such as anniversaries and reunions.
[1:50:58] The plan notes that the building would have a state-of-the-art sound system, a dance floor catering kitchen,
[1:51:06] the property owners plan to live on the property, or on one of the parcels.
[1:51:13] The hours of operation are Sunday through Thursday, 9 a.m. to 9 p.m., Friday and Saturday, 8 a.m. to 11 p.m.
[1:51:23] The property is currently zoned to AG-40, as mentioned, the board is considering a current
[1:51:29] application again to rezone the property to residential states.
[1:51:34] The property is located inside the urban growth area of the county property is surrounded
[1:51:39] by AG-40 and RR zone properties.
[1:51:42] Because particular conditions associated with the venue activities might have an adverse
[1:51:46] effect on nearby properties, conditional uses are not permitted outright, but are allowed
[1:51:52] as conditional uses, because of the nature of activities associated with an event, then you

[1:51:58] The board should consider whether the proposed use is appropriate for the area.

[1:52:57] The owner is willing to make improvements to the roadway if necessary and has met with
[1:53:02] the township to discuss those improvements.

[1:53:08] The township did express two staff that they would prefer the road to remain gravel at
[1:53:14] the time.

[2:59:29] So yes, we are considering, I guess, Mr. Hurley's plans are the new or what plans that we
[2:59:36] have to reconsider.
