[6:54]
» Thank you. We will start with an
[6:54]
invocation by Elder Mark Wells from the
[6:57]
Church of Jesus Christ of Latterday
[6:59]
Saints after which we'll remain standing
[7:01]
for the pledge of allegiance. Elder
[7:03]
Wells, please.
[7:11]
Our kind and gracious eternal heavenly
[7:13]
father, we give thee thanks this evening
[7:17]
for this opportunity we have to
[7:21]
attend this city council meeting. We're
[7:23]
grateful for our mayor and our city
[7:26]
council individuals and for the Boulder
[7:30]
City administrative staff for their
[7:32]
dedication, integrity, and hard work on
[7:35]
our behalf. We give thee thanks for our
[7:38]
freedoms we enjoy in this country.
[7:40]
especially the right to express
[7:43]
ourselves
[7:45]
in voice and in religious
[7:49]
celebration. We're grateful for the
[7:52]
other
[7:54]
freedoms we enjoy and grateful for our
[7:56]
military and pray for them wherever they
[7:58]
may be.
[8:00]
We give thee thanks again for the
[8:02]
opportunity we have to live in this city
[8:05]
and to enjoy the comfort and the
[8:08]
blessings afforded to us.
[8:11]
We're mindful of many throughout this
[8:13]
community and throughout our nation that
[8:16]
are struggling and need of temporal and
[8:19]
emotional and physical or spiritual
[8:22]
blessings at this time. We pray for
[8:24]
them. We again give thee thanks for what
[8:26]
we have and offer this invocation
[8:30]
humbly and in the name of Jesus Christ
[8:32]
our savior. Amen.
[8:34]
>> Amen.
[8:35]
» Amen.
[8:35]
>> Thank you wells. You can remain with us
[8:39]
» Thank you wells. You can remain with us
[8:39]
then. I pledge algiance to the flag of
[8:43]
the United States of America and to the
[8:46]
republic for which it stands. One nation
[8:49]
under God, indivisible with liberty and
[8:52]
justice for all.
[9:00]
Thank you all.
[9:03]
Do we have any public announcements?
[9:04]
Madam City Clerk, we'll open the uh
[9:08]
meeting for public comment at this time.
[9:10]
Those of you who are in the chambers,
[9:13]
welcome to come forward and speak. Uh,
[9:18]
and if there is anybody on the phone
[9:20]
line, it's 7025899629.
[9:25]
And while we're waiting for someone to
[9:27]
call if they are going to, if anyone's
[9:29]
here in the chambers like to say
[9:31]
something, you're more than welcome to
[9:35]
at this time.
[9:43]
My name is Robin Baker. I'm a Boulder
[9:45]
City resident and first I would just
[9:48]
like to thank everyone who's up here and
[9:51]
everyone who works so hard um to keep
[9:55]
things moving forward in a positive way.
[9:57]
I I'm very appreciative of that. I'd
[10:00]
like to speak to I think it's item 21,
[10:03]
the historic preservation choosing
[10:05]
selecting a new commissioner. And I just
[10:08]
have a few things to say. Um,
[10:11]
number one, I'm hoping that you choose a
[10:14]
commissioner who advocates for historic
[10:16]
preservation,
[10:18]
someone who actually, and I, it's
[10:20]
nothing against anyone who's already
[10:22]
been on the commission. I think it's a
[10:24]
very difficult position to be in. Um,
[10:28]
but I would like to have someone who
[10:30]
advocates for the historic district and
[10:33]
actually challenges the status quo. We
[10:37]
don't know how many houses are
[10:38]
contributing at this time because we
[10:40]
don't collect data. So, how can we move
[10:44]
forward and move toward where we have a
[10:48]
sense of place that actually we know
[10:50]
we're enhancing the historic district
[10:53]
rather than diminishing it.
[10:55]
I know that the individuals who are on
[11:00]
the commission are dedicated and they
[11:03]
give their time freely and that I
[11:06]
appreciate it very much. On the other
[11:08]
hand, um I have very high expectations
[11:12]
not only for the historic district for
[11:14]
but for the city because it's my home
[11:16]
and I want it to thrive. I want it to be
[11:19]
better. And so, um, I'm trying not to
[11:23]
ask for too much, but for those people
[11:26]
that I speak with regularly, they know
[11:28]
that I have very high expectations.
[11:31]
And so, I will continue to try to be a
[11:34]
voice, but I do appreciate um the amount
[11:37]
of time and energy you put into it and
[11:39]
hope you have a good night tonight.
[11:40]
Thank you.

Anyone else on 7025899629?
[12:56]
Go ahead. Brandon Smith for the record.
[12:59]
Good evening, Mayor, council, staff,
[13:01]
ladies and gentlemen. Uh, happy new
[13:03]
year. Welcome to 2026.
[13:06]
Um, just wanted to throw my two cents in
[13:10]
for agenda item number 21. um your
[13:14]
selection of appointments for the HPC
[13:18]
um committee tonight. Um I would just
[13:20]
like to
[13:22]
uh beg you all to please remember that
[13:27]
um our current committee uh isn't yet
[13:31]
made up of um 50%
[13:35]
of um historic homeowners here in the
[13:38]
district. And um I would love for the
[13:43]
people of the historic district that own
[13:45]
the historic district and live in the
[13:47]
historic district are fairly represented
[13:50]
by that committee. Um so I would uh
[13:54]
again politely beg you guys to consider
[13:57]
that when you're making your selections
[13:58]
for tonight. Um uh it's it only makes
[14:02]
sense for uh that committee to be fairly
[14:06]
represented by people actually in the
[14:08]
historic district. Thank you so much for
[14:10]
all you guys do and hope you had a good
[14:12]
holiday. Thank you. Appreciate it.
[14:26]
7025899629
[14:30]
is the number to call in if you have
[14:32]
something that you'd like to add on
[14:35]
public comment the initial public
[14:36]
comments and if there's anyone here in
[14:39]
the chambers who would like to come
[14:42]
forward at this time that would be they
[14:44]
would be welcome
[14:48]
anyone on 7025899
[14:50]
9629.
[14:54]
Seeing no one on the phone line, no one
[14:57]
here in chambers, we will close public
[14:59]
comment
[15:00]
and move to
[15:06]
items for action
[15:10]
on the consent agenda. Do I have a
[15:13]
motion to approve the regular agenda
[15:16]
first?
[15:17]
Mayor staff is requesting that item
[15:19]
number 13 be removed from the regular
[15:21]
agenda. We didn't have an audit review
[15:24]
committee meeting prior the council
[15:27]
meeting. So there's no recommendation at
[15:29]
this time.
[15:30]
>> Okay. We will remove 13 from the regular
[15:32]
» Okay. We will remove 13 from the regular
[15:32]
agenda and then I'll still take a motion
[15:35]
to approve the regular agenda but with
[15:37]
removal of item 13.
[15:39]
>> I move to approve the regular agenda.
[15:42]

» All those in favor say I.
[15:45]
>> I. Thank you. It's unanimous. And then
[15:48]
» I. Thank you. It's unanimous. And then
[15:48]
the consent agenda. Do I have a motion
[15:50]
to approve the second agenda? The
[15:53]
consent agenda.
[15:54]
>> I move to approve the consent agenda.
[15:57]

[15:57]

[16:00]
» All those in favor say I.
[16:00]
>> I. Thank you. That's approved. We'll
[16:02]
» I. Thank you. That's approved. We'll
[16:02]
move to the regular agenda now. And
[16:05]
we'll have a presentation under number
[16:08]
11.
[16:09]
Um
[16:11]
and our finance director.
[16:17]
» You're welcome.
[16:22]
» Good evening, mayor and council. I am
[16:24]
Cynthia Snee, your finance director, and
[16:26]
I'm very happy to be here tonight and
[16:28]
give you an update on the finance
[16:30]
department. It's our our annual update.
[16:37]
Okay. Finance divisions include a
[16:39]
significant number of years of public
[16:42]
and governmental service and we're very
[16:43]
proud of that. And our five divisions uh
[16:46]
in in the department are accounting,
[16:49]
budget, purchase, purchasing, grants,
[16:51]
risk management uh and contracts, real
[16:54]
estate and utility billing.
[16:57]
That's the same as it has been for a
[16:58]
long time. That hasn't really changed.
[17:01]
Okay. So, a little bit more about
[17:02]
accounting. Um that includes accounts
[17:05]
receivable where we bill out
[17:06]
particularly the uh for airport leases
[17:08]
and the and the land leases out in the
[17:10]
valley. We've got about 230 accounts
[17:13]
that we maintain with that accounts
[17:15]
payables when where we pay our bills
[17:17]
from from vendors uh invoicing and
[17:20]
employee uh reimbursement expense
[17:22]
reimbursements. And that totals about
[17:25]
almost 8,500 invoices every year that
[17:28]
that we're processing. So it's a lot. In
[17:32]
general accounting, we reconcile and
[17:34]
maintain over 8,000 general ledger
[17:36]
accounts. And in that includes financial
[17:39]
reporting. We have 20 standard reports
[17:42]
that we put out. And I know you're
[17:43]
familiar with with many of those.
[17:49]
All right. In specific in accounting,
[17:51]
we've got payroll, and we we pay about
[17:54]
320 employees every bi-weekly. That
[17:56]
varies a little bit because we have a
[17:58]
lot of part-time, seasonal employees. So
[18:00]
it it kind of goes up and down. We
[18:02]
process all the W2s for all the
[18:04]
employees. Um all of the related
[18:07]
payments and reporting that goes along
[18:09]
with with processing payroll.
[18:13]
The budget division
[18:15]
budget develops the the both the
[18:17]
operating budget and the capital
[18:19]
improvement plan. Um they monitor the
[18:22]
budget both of those budgets throughout
[18:23]
the year and and provide some research
[18:26]
and analysis. Um, largely I say,
[18:29]
"Angela, I need you to look at this."
[18:31]
And and there it is. Um, they also do
[18:35]
the five-year capital improvement plan,
[18:36]
which you'll hear from Angela in a
[18:38]
little bit for the upcoming five-year
[18:40]
plan. And we are responsible for
[18:43]
monitoring and and complying with the
[18:45]
regulations um state and federal
[18:48]
regulations.
[18:51]
Okay. A little bit more about the
[18:52]
budget. Uh we pro last year we prepared
[18:55]
the award-winning annual city budget.
[18:58]
That's the same one same award that
[19:00]
we've been receiving for the last many
[19:02]
years. We're very proud of that. That's
[19:04]
we'll talk a little bit more about that
[19:05]
in a second. They prepared last year's
[19:08]
CIP and we improved our budget process
[19:12]
last year. We're trying looking for
[19:14]
continuous improvement. Last year we had
[19:17]
a little bit different process where uh
[19:19]
we presented the draft budget to the
[19:20]
directors and said help us to reduce
[19:25]
because we knew we needed to come with
[19:26]
an operating budget. That's part of your
[19:28]
your mandate and uh we needed help from
[19:31]
all the department directors to get
[19:32]
there and and we did that and so very
[19:35]
proud of that.
[19:39]
the purchasing division.
[19:42]
Um, this is, let me go back for a
[19:45]
second. Angela, you all know Angela, but
[19:47]
Angela's our budget manager, okay? And
[19:49]
Paul is our purchasing division head,
[19:52]
and it's includes so much more than just
[19:54]
purchasing. Um, he works on expense
[19:57]
contracts and risk management and
[19:59]
insurance claims and grants and grant
[20:02]
coordination. So, he definitely gets the
[20:04]
prize for the most hats to wear in the
[20:07]
the department.
[20:09]
So, a little more detail about his
[20:11]
workload. Um, he completed 25 formal
[20:14]
solicitations, RFPs, which saved the
[20:17]
city $2.6 million. Um, the the purpose
[20:21]
of that is to get the best um not only
[20:24]
the lowest price, but the best product
[20:26]
for the price um for the city, what's in
[20:29]
the best interest of the city. uh 266
[20:32]
contracts that he wrote and uh
[20:35]
administered and negotiated along with
[20:37]
the city attorney on most of those.
[20:40]
Completed a lot uh 17 claims and and
[20:42]
nine subregation actions where we were
[20:44]
able to recover money from from
[20:46]
different um claims against the city
[20:50]
and managed 19 different grant programs
[20:52]
valued at 17 million. Want to go into a
[20:55]
little more detail about that. Most of
[20:57]
that, well, about half of it, um, over 9
[21:00]
million is specific to the airport and
[21:03]
FAA grants for a lot of the capital
[21:05]
projects that are going on out there.
[21:08]
And it's historic preservation
[21:10]
grants, CDBG, the um,
[21:15]
for lend a hand and and emergency aid,
[21:18]
uh, Clark County emergency operations,
[21:20]
our dark dark skies retrofitting with
[21:23]
the the street lights.
[21:26]
We've got some police grants joining
[21:29]
forces was about 50,000 and a water
[21:33]
smart grant which is uh about water
[21:36]
meters um replacing with a radio reads
[21:39]
which makes it more more accurate and
[21:41]
more efficient for our meter meters to
[21:43]
be out there. Um and another
[21:45]
infrastructure upgrade for the water
[21:47]
wastewater treatment plant. So there we
[21:51]
go. Lots of lots of grant activity on
[21:53]
top of everything else that that comes
[21:54]
out of the purchasing division
[21:57]
contracts and real estate. That's Brock
[22:00]
back. Um he works with land sales, land
[22:03]
leases, research and analysis, and he's
[22:06]
my special projects guy and and he does
[22:09]
all those beautiful brochures that you
[22:11]
see with all the financial data bringing
[22:13]
it down to a a more attractive document.
[22:17]
So some special things that he has done
[22:19]
this year. uh prepared an enhanced and
[22:22]
expanded online budget summary. So
[22:24]
that's one of those beautiful
[22:25]
publications that we see at the budget
[22:27]
and summary. Um he really uh beefed that
[22:31]
one up so it's a lot lot nicer. Um not
[22:34]
that it wasn't nice before Brock
[22:37]
and he assists me with the financial
[22:39]
forecasts and the other transparency
[22:41]
improvements. We the software that we
[22:43]
used to produce the budget book went
[22:45]
through a major upgrade and he was part
[22:47]
of that. he was part of the beta testing
[22:49]
to to get that, you know, up and going
[22:51]
and and so we'll greatly benefit from
[22:53]
that. It'll be a much more attractive
[22:55]
document in the future.
[22:58]
Okay. Utility billing. Is Brady here? I
[23:00]
didn't see Brady. No. Oh, you know
[23:02]
Brady? Um his group provides all the
[23:06]
utility billing. So that's reading the
[23:08]
meters, generating the bills, sending
[23:10]
the bills out, collecting the payments.
[23:13]
Um they also do the business licensing
[23:15]
for the for the city.
[23:18]
And this graph is really just to show
[23:21]
that how stable our utility accounts
[23:23]
have been year-over-year. Um, not much
[23:26]
has changed, but that's not surprising
[23:27]
given the the uh growth control
[23:31]
situation that we're in. Things are
[23:32]
pretty pretty constant there, pretty
[23:34]
consistent.
[23:37]
And then for our financial reports, um,
[23:39]
I had hoped to be able to bring to you
[23:41]
the fiscal year 25 report, but um, we're
[23:44]
not quite there yet. So we prepare that
[23:46]
annual document that goes through the
[23:48]
audit and that was um independently
[23:51]
audited and for fiscal year 24 which you
[23:55]
see the cover here that did win the the
[23:57]
GFOA award again and we will be
[24:00]
submitting the fiscal year 25 for that
[24:02]
same award. So speaking of the GFOA
[24:05]
awards, um this is the certificate of
[24:08]
achievement is the one for the financial
[24:11]
statements for the AER and we've uh been
[24:13]
awarded that um for 33 years consecutive
[24:17]
years. So we're very proud of that.
[24:20]
And is Amara here?
[24:21]
>> How many people get that award?
[24:25]
» How many people get that award?
[24:25]
>> A lot of G a lot of people get that
[24:27]
» A lot of G a lot of people get that
[24:27]
individual award. I don't know the
[24:29]
number, but it's it's many many where
[24:31]
it's a very small population is when you
[24:33]
get all three awards. But this one by
[24:35]
itself is the one that's been um in
[24:38]
existence the longest. And so there's a
[24:40]
lot lot of governments that receive that
[24:42]
one.
[24:42]
>> So do we know anybody that gets all
[24:44]
» So do we know anybody that gets all
[24:44]
three?
[24:45]
>> Well, we do.
[24:47]
» Well, we do.
[24:47]
>> I'm getting there. You beat me to it,
[24:49]
» I'm getting there. You beat me to it,
[24:49]
mayor.
[24:50]
>> Um yes, and there's only a couple in the
[24:52]
» Um yes, and there's only a couple in the
[24:52]
state of Nevada that that do for our
[24:56]
again more GFO awards. the budget award.
[24:58]
We received that again for fiscal year
[25:00]
26. They had a real fast turnaround with
[25:02]
this one, which was nice. Um, we've
[25:04]
already been awarded for the most recent
[25:06]
budget document we've done.
[25:10]
And this is the newest award that they
[25:12]
have, um, the popular annual financial
[25:14]
report. We call that the paffer. um
[25:17]
that's a basically a a regurgitation of
[25:19]
what's in the big financial document but
[25:22]
in a only a few pages and it's got some
[25:25]
cute graphics and it's a lot easier um
[25:28]
to digest that data. You don't have to
[25:30]
be an accounting expert to to get to
[25:32]
what what it's after. Um we've been
[25:35]
producing that for a few years and we
[25:36]
did in fact win that one award as well
[25:39]
which does qualify us for the triple
[25:42]
crown.
[25:43]
Um we're very very very pleased to have
[25:46]
to have won that again for all of our
[25:47]
reports that we produced last year and
[25:50]
we are submitting them as we prepare
[25:52]
them this year and with the expectation
[25:54]
that we'll meet all the criteria to to
[25:56]
qualify for that again. And this one uh
[25:59]
to your point mayor is only se several
[26:01]
hundred governments in the entire nation
[26:04]
that are awarded that one.
[26:08]
Another award that we're happy to talk
[26:09]
about is last year, this time last year,
[26:11]
we submitted um a proposal application
[26:14]
to the Cashman good governance award and
[26:17]
we did uh win for we're in first place
[26:20]
for the small city. They have different
[26:22]
categories and for the small city we we
[26:25]
did win that one which then qualified us
[26:27]
to be a finalist for the the big overall
[26:29]
award. We I guess we were runner up. We
[26:33]
didn't did not get the overall award,
[26:34]
but we did win the the small city one
[26:36]
that and the the topic of that was the
[26:39]
solar or the land leases and how that
[26:41]
has been, you know, our our lifeline um
[26:45]
since we don't have the other types of
[26:46]
revenues that the other cities do.
[26:50]
And we're very pleased that Paul um our
[26:53]
mini hat man was elected chairman of the
[26:57]
poolacted um organization. So he's he's
[27:02]
a we have a a strong voice there. He
[27:05]
does a great job
[27:08]
and that's
[27:09]
that's it. Happy to answer any
[27:11]
questions.
[27:12]
>> Any questions or comments?
[27:16]
» Okay.
[27:17]
>> I don't have any questions. Just a few
[27:19]
» I don't have any questions. Just a few
[27:19]
comments. Um it seemed like best
[27:21]
practice when you said that you meet
[27:22]
with the other offices. Did um directors
[27:26]
of the departments to find out where
[27:29]
best monies can be spent? That seems
[27:31]
unusual that a government would do that
[27:34]
um being that things tend to be
[27:36]
earmarked, but you found a way to save
[27:38]
money by working together to see where
[27:40]
things could be moved. So that's a a big
[27:42]
plus. Thank you for sharing that. Thank
[27:45]
you also for breaking down the grants. I
[27:46]
think it was Councilwoman Jurgensson who
[27:48]
asked for that breakdown um at your last
[27:51]
annual meeting and it's good to know
[27:53]
that the public would know where a lot
[27:55]
of our funds come from. So the grants
[27:57]
somebody's doing some kind of grant
[27:59]
writing. I imagine that's Paul and uh
[28:01]
you know who does grants
[28:03]
>> that typically comes from the individual
[28:05]
» that typically comes from the individual
[28:05]
departments. Okay.
[28:06]
>> Um he may polish it up but the you know
[28:08]
» Um he may polish it up but the you know
[28:08]
the meat of it comes from the
[28:10]
departments as they identify grant
[28:11]
opportunity.
[28:12]
>> It's a big deal either way. grants are
[28:14]
» It's a big deal either way. grants are
[28:14]
hard to get and uh we have so many of
[28:16]
them which is good. I do actually have
[28:17]
one question on the utility bills. Um
[28:20]
online versus mailin
[28:23]
um what's the equation on those a
[28:25]
percentage and does it save any money if
[28:28]
you go online? So currently it's about a
[28:32]
7525%
[28:33]
split. 25 being where we send out an
[28:36]
email to to the customers and then they
[28:39]
have the opportunity to to pay online or
[28:42]
do a like a direct um payment, you know,
[28:46]
right direct debit out of their checking
[28:48]
account. So that's 25%. The other 75% we
[28:52]
actually mail a physical bill to. Um and
[28:55]
so those either come back in the mail or
[28:57]
you know might come back in person to to
[29:00]
pay those.
[29:00]
>> Okay.
[29:01]
» Okay.
[29:01]
>> Um and it definitely is more cost
[29:03]
» Um and it definitely is more cost
[29:03]
effective for the electronic that if
[29:06]
people include the email and then just
[29:09]
pay the fee um online. It is much more
[29:12]
cost effective than the snail mail.
[29:14]
>> I bet stamps are going up.
[29:16]
» I bet stamps are going up.
[29:16]
>> St. Yes, they are. It's about 80 cents I
[29:19]
» St. Yes, they are. It's about 80 cents I
[29:19]
think.
[29:19]
>> And congratulations on the triple crown
[29:21]
» And congratulations on the triple crown
[29:21]
award.
[29:22]
>> Thank you.
[29:22]
» Thank you.
[29:22]
>> Thank you to you and the staff. That is
[29:25]
» Thank you to you and the staff. That is
[29:25]
that is all these guys that is under
[29:27]
>> Thank you all you guys.
[29:30]
» Thank you all you guys.
[29:30]
>> Thank you. Go ahead.
[29:33]
» Thank you. Go ahead.
[29:33]
>> Maybe for a point of clarification if
[29:35]
» Maybe for a point of clarification if
[29:35]
there's anyone listening who would like
[29:37]
to receive an electronic bill now, what
[29:40]
would the process be for them to be able
[29:42]
to do that?
[29:43]
>> They can contact the utility billing
[29:46]
» They can contact the utility billing
[29:46]
department um or division.
[29:49]
I I don't have their phone number off
[29:50]
top of my head, but yeah. So contact
[29:53]
them and then set that up and they could
[29:55]
also be part of that and maybe by this
[29:57]
time next year we could have 35%.
[29:59]
>> Right. Right.
[29:59]
» Right. Right.
[29:59]
>> And there may I don't want to speak out
[30:01]
» And there may I don't want to speak out
[30:01]
of line but there may be an opportunity
[30:03]
to make that election through our um
[30:06]
website if you navigate to where the
[30:09]
utility billing area is. I think you can
[30:11]
opt in that way.
[30:12]
>> Okay. So you can talk to a real person.
[30:14]
» Okay. So you can talk to a real person.
[30:14]
>> You can
[30:15]
» You can
[30:15]
>> if you need to or want to or you could
[30:17]
» if you need to or want to or you could
[30:17]
go online and navigate and try to do it
[30:19]
possibly,
[30:20]
>> I believe. We'll check on that so that
[30:23]
» I believe. We'll check on that so that
[30:23]
we know um 221 years experience and I
[30:27]
think that that says a lot and I think
[30:30]
it also says a lot about why we are
[30:33]
Triple Crown winners and um the things
[30:36]
that aren't said a lot of times are the
[30:39]
ways that you listen to us when we ask
[30:42]
for things and respond um as a staff as
[30:46]
a whole staff and as a budgeting and um
[30:49]
finance uh committee. or group. Uh we
[30:53]
have asked the hard ask of a nearly as
[30:57]
close as you can balanced budget for
[31:00]
each year and I know that that is
[31:02]
stressful at a government level and I
[31:04]
appreciated the respect that you had for
[31:07]
us up here that you could understand how
[31:10]
hard it would be for us to vote on
[31:11]
something that had a $10 million
[31:14]
um discrepancy, right? It didn't seem
[31:17]
like being wise stewards over the monies
[31:19]
that were there. So, I want to say and I
[31:22]
I'm sure all of the council thank you
[31:24]
for that um for helping us and uh the
[31:28]
numbers indicate that you did very well
[31:30]
with that budgeting and I know that that
[31:32]
took staff members in other areas too to
[31:36]
come to the conclusions like council
[31:38]
member Asher said of how that budget
[31:40]
would come together and and how they
[31:42]
could get their numbers closer and and
[31:46]
reflect what was going to happen. So,
[31:48]
thank you um to all of you that um do
[31:52]
what you do for our city to make sure
[31:54]
that we stay uh fiscally responsible and
[31:58]
shine even. So, thank you very much.
[32:01]
>> Thank you.
[32:02]
» Thank you.
[32:02]
>> Thank you,
[32:03]
» Thank you,
[32:03]

» Mayor. If I may just interject to in
[32:06]
response to Council Member Jorgensson's
[32:07]
question.
[32:09]
>> Um I I was able to look up online pretty
[32:12]
» Um I I was able to look up online pretty
[32:12]
quickly. So yes, it's on our website as
[32:14]
uh uh director Sneed has said, there is
[32:17]
a separate page that's paying your bill
[32:19]
online. It describes the new online bill
[32:22]
uh payment system is now available and
[32:24]
if you scroll down there's a a click to
[32:26]
begin here. Oh yeah, they've got it
[32:28]
shown right up there on the screen. So
[32:30]
excellent. So it's available.
[32:32]
>> Look at these people.

[32:52]
Need a introduction of bill number 2092.
[32:59]

[33:46]
be considered at the January 27th, 2026
[33:50]
council meeting.
[33:51]
>> Thank you.
[33:54]
» Thank you.
[33:54]
That brings us to number 13 on the
[33:56]
regular business that we have removed.
[33:59]
And
[34:02]
>> and that brings us to number 14.
[34:06]
» and that brings us to number 14.
[34:06]
Thank you, mayor. I'm uh city manager
[34:08]
Ned Thomas. Item number 14 is a um
[34:13]
public hearing on there two parts.
[34:15]
There's a public hearing on the
[34:16]
collective bargaining agreement for the
[34:18]
Teamsters Local 14 clerical bargaining
[34:20]
unit and also a resolution approving uh
[34:23]
that uh bargaining agreement between the
[34:25]
city and Teamsters Local 14 clerical. Uh
[34:28]
just by way quickly by way of background
[34:31]
uh over the past uh since July, well
[34:34]
yeah over the past year really the city
[34:37]
staff and outside council have engaged
[34:39]
in good faith negotiations with
[34:41]
representatives of the clerical
[34:43]
bargaining unit to negotiate a new
[34:45]
collective bargaining agreement. Their
[34:47]
previous agreement expired on June 30th,
[34:51]
2025.
[34:52]
Um the city and the unit and the union
[34:54]
have tenatively agreed on a proposal to
[34:56]
extend their uh agreement for three
[34:59]
years with increases in the city's
[35:01]
contribution toward healthcare insurance
[35:03]
and wages. Um under NRS288.153,
[35:08]
any new extended or modified uh
[35:10]
bargaining agreement between the local
[35:12]
government as employer and the union
[35:14]
must be approved uh by this public in a
[35:17]
public hearing. That's why we're here
[35:18]
tonight and um provide you with a quick
[35:20]
report. The total fiscal impact of this
[35:22]
agreement would be an increase over the
[35:24]
three years of 1.145
[35:30]
584.21.
[35:31]
So a little a little over 1.145
[35:34]
million. Uh there would be wage
[35:37]
increases of approximately $229,000
[35:40]
in the first year including the medical
[35:43]
insurance contributions. In um fiscal
[35:47]
year 23, they would total up to 38 an
[35:50]
additional an increase um of 384 just
[35:54]
over 384,000
[35:56]
uh with benefits and then in fiscal year
[35:59]
28 a little over $532,000.
[36:03]
When we come back uh next week with the
[36:05]
five or ne in two weeks with the
[36:08]
five-year financial forecast, we will
[36:10]
provide some more additional information
[36:12]
so that you can see how all of that fits
[36:14]
in with the other um unions that we're
[36:16]
negotiating with with an overall picture
[36:18]
of that. But for tonight, we're just
[36:20]
here for the clerical bargaining unit
[36:22]
and um happy to answer any additional
[36:25]
questions you might have.
[36:29]
I just have one. Um
[36:33]
is I know there's been a lot of uh
[36:35]
movement and various topics. Is this um
[36:42]
effective with all the changes July 1 or
[36:46]
when ratified?
[36:48]
>> Yes, it will be retroactive to the start
[36:49]
» Yes, it will be retroactive to the start
[36:49]
of the new fiscal year.
[36:50]
>> Thank you.
[36:51]
» Thank you.
[36:51]
>> And the start of the new of this
[36:53]
» And the start of the new of this
[36:53]
agreement.
[36:57]
And that uh if there's no other
[36:59]
questions, we'll open this up for public
[37:01]
hearing.
[37:03]
Anyone like to come forward or on the
[37:05]
line uh for a public hearing on this
[37:08]
item if you were on the line?
[37:10]
7025899629.
[37:14]
That's 7025899629.
[37:17]
This is a public hearing. If there's
[37:19]
anyone like to come forward at this
[37:21]
time, use the microphone here in
[37:23]
chambers, you're welcome to do so.
[37:27]
If not, we'll wait a little bit.
[37:31]
7025899629.
[37:34]
This is a public hearing on the
[37:36]
collective bargaining agreement with the
[37:38]
Teamsters Local 14 Clerical Bargaining
[37:41]
Unit.
[37:45]
No one on the phone line. Uh that leads
[37:48]
us to uh the resolution number 8085
[37:53]
for approval. Do I have a motion? I move
[37:56]
to approve resolution 8085.
[37:59]
>> Is there a second?
[38:01]
» Is there a second?
[38:01]
>> Second.
[38:02]
» Second.
[38:02]
>> Any discussion?
[38:05]
» Any discussion?
[38:05]
>> All those in favor say I. I. Any of
[38:08]
» All those in favor say I. I. Any of
[38:08]
those say nay. It was unanimous. Thank
[38:09]
you.
[38:12]
We'll move to item 15. Mr. City Manager.
[38:20]
Thank you. U. This item is a collective
[38:24]
uh bargaining agreement.
[38:27]
Excuse me. This item is a resolution u
[38:31]
approving an amended and restated
[38:33]
collective bargaining agreement between
[38:34]
the city and team's local 14 fire
[38:37]
captain's bargaining unit. uh the
[38:39]
collective bargaining agreement for this
[38:41]
uh union uh again team's 14 fire
[38:44]
captains uh expired in June 30th and the
[38:47]
city and the fire captains entered into
[38:49]
a new agreement effective August 25. Uh
[38:52]
this they were the first group in this
[38:54]
round of negotiations to conclude their
[38:56]
uh agreement which we um we were very
[38:58]
pleased to do that. However, during the
[39:01]
negotiations uh or after the agreement
[39:04]
was approved, it was discovered that we
[39:06]
had uh differing interpretations of the
[39:08]
reserve program that's part of article
[39:10]
one of the the new agreement. And it's
[39:12]
regarding how and when reserves are
[39:15]
used. And so to clarify that language,
[39:18]
the city and the union held uh
[39:20]
additional discussions to settle the
[39:21]
agree disagreement. and we uh happily we
[39:25]
agreed to modify the language as set
[39:26]
forth in the amended and restated
[39:28]
collective bargain agreement that's
[39:30]
before you tonight. So there's no fiscal
[39:32]
impact with this change. It's just a
[39:34]
clarification of the language that was
[39:36]
there. And uh so NRS requires that this
[39:40]
type of a modified agreement come back
[39:42]
to you for approval in a public hearing.
[39:45]
Happy to answer any questions.
[39:46]
>> Thank you. Any questions?
[39:48]
» Thank you. Any questions?
[39:48]
>> I have a disclosure.
[39:50]
» I have a disclosure.
[39:50]
>> Okay.
[39:51]
» Okay.
[39:51]
I would like to disclose pursuant to
[39:53]
NRS281A that my son Nigel Walton is a
[39:56]
fire captain for Boulder City Fire and
[39:59]
this matter concerns the collective
[40:01]
bargaining agreement for the captain's
[40:03]
bargaining unit of which he is a member.
[40:05]
Because this is a relationship under
[40:07]
Nevada ethics law that would likely

[41:38]
And that brings us to item 16, approval
[41:42]
of the tenative capital improvement plan
[41:44]
for fiscal years 27 through 31.
[41:52]
Hello, Angela Manin, budget manager. So
[41:56]
today we're looking for tenative
[41:57]
approval on the 5-year CIP plan. And the
[42:00]
reason we look for tenative approval for
[42:02]
the CIP is we're about to go into the
[42:05]
operating budget. And so having
[42:08]
a starting point, knowing what we're
[42:10]
going to do with CIB really helps that
[42:12]
process. And also occasionally um some
[42:15]
capital projects have operating costs.
[42:17]
So to know about those costs before we
[42:18]
go into the operating budget.
[42:23]
So
[42:24]
our 5-year plan has 54 projects with a
[42:27]
combined cost of $134.5 million. Fiscal
[42:31]
year 27 has 35 projects with a combined
[42:35]
cost of $35.1 million.
[42:39]
This chart is showing the funding
[42:41]
sources for our 5-year plan. It's a
[42:44]
total of $134.5 million.
[42:47]
Um 40% of this is coming from the
[42:49]
enterprise funds which is $53.7 million.
[42:53]
That's $3 million coming from our
[42:54]
airport. 26.6 million coming from our
[42:57]
electric fund. 14 million coming from
[43:00]
wastewater and 10 million coming from
[43:02]
our water fund. Outside funding is 24%
[43:05]
or $32.8 million. And that's 27.2
[43:09]
million coming from the FAA to support
[43:11]
our airport and also 5.6 million coming
[43:13]
from RTC to support our streets. The
[43:16]
government fund is 19% or 25 million and
[43:20]
this includes 8.6 million coming from
[43:22]
our acquisitions and improvements fund,
[43:24]
12.5 million coming from our pool fund,
[43:27]
and 3.8 8 million coming from our
[43:29]
redevelopment fund. The voter approved
[43:33]
is 17% or $22.5 million and that's $3.5
[43:38]
million of the annual approved um
[43:39]
spending from that fund and also $18.9
[43:43]
million from the sale of Track 350, also
[43:45]
known as Liberty Rich. And then our golf
[43:48]
course search charge funds is less than
[43:49]
1% at $415,000 for equipment at our golf
[43:54]
courses.
[43:57]
This ne next chart is just uh funding
[43:59]
sources for fiscal year 27. It's a total
[44:02]
of $35.1 million.
[44:05]
So the largest portion is governmental
[44:08]
at 44% or $15.5 million. This includes
[44:12]
$1.8 million coming from acquisitions
[44:14]
and improvements, 11.8 from our pool
[44:17]
fund, and $1.9 million from our
[44:19]
redevelopment fund. This is unusual for
[44:22]
our CIP graph where our funding sources
[44:24]
are for government to be so high and
[44:26]
it's because we have that really large
[44:28]
pool project coming up in 27. And so if
[44:31]
we were to take out the pool project, it
[44:32]
would be 25% for the government funds.
[44:36]
The next one is voter approved is 27% or
[44:39]
9.5 million and that's the $1 million
[44:42]
that is approved annually to spend and
[44:44]
also 8.5 million from the sale of track
[44:46]
350.
[44:48]
And then the enterprise funds is 20% or
[44:51]
$6.9 million which is $140,000 coming
[44:55]
from our airport. 5 million coming from
[44:57]
our electric fund, $400,000 coming from
[45:00]
our wastewater fund and 1.4 million
[45:03]
coming from our water fund. Outside
[45:05]
funding is $2.6 million or 8% and that
[45:10]
is 1.2 million coming from FA to support
[45:12]
our airport and 1.4 coming from RTC to
[45:15]
support our streets. And again, this is
[45:18]
very unique because of our very large
[45:19]
pool project. And so our breakdown is
[45:21]
not typical. If we were to take out the
[45:23]
pool project, uh maybe 25% governmental,
[45:27]
7% voter approved, 47% enterprise fund,
[45:31]
and 18% outside funding. And that'd be
[45:33]
more in the norm on spending.
[45:39]
So, our fun our governmental funding
[45:41]
sources for fiscal year 27 include um a
[45:44]
transfer from the general fund to
[45:45]
acquisitions to improvements of up to $
[45:47]
1.5 million. Also, the swimming pool
[45:50]
fund resources of $20.3 million include
[45:53]
11.8 million in fund balance from
[45:56]
donations, voter approved funding, and
[45:57]
investment revenue. It also has that
[45:59]
additional 8.5 in voter approved um
[46:03]
spending from the sale of track 350. The
[46:06]
redevelopment fund is will use the
[46:08]
resources of $ 1.9 million to promote
[46:11]
businesses in the RDA district.
[46:15]
So again, so voter approved um spending
[46:17]
in fiscal year 27 will be $9.5 million.
[46:21]
And so with the sale of track 350, also
[46:25]
known as Liberty Ridge, it was approved
[46:27]
by the voters voters. That 90% will go
[46:29]
to the pool and 10% will go to public
[46:31]
safety. So in fiscal year 27, $8.5
[46:34]
million will go to the pool from that
[46:36]
sale. And then also for fiscal year 27,
[46:39]
we have that annual spending of $1
[46:41]
million. So that spending of voter
[46:44]
approved funding of $1 million is for
[46:46]
governmental projects, so it's not to be
[46:48]
used for utilities or airport. Um it was
[46:51]
approved back in 2015.
[46:53]
This year, fiscal year 26, our lease
[46:55]
revenue going into voter approved
[46:56]
funding or voter approved fund is 4.6
[46:59]
million. So we're only allowed to spend
[47:01]
1 million. So that fund grows at about
[47:03]
$3.6 million annually. So at the end of
[47:06]
fiscal year 26, it'll have a fund
[47:08]
balance of about $11 million.
[47:13]
So another funding source for CIP for
[47:16]
fiscal year 27 is our golf course search
[47:18]
charges. So these funds come from a
[47:21]
percentage of the green piece. Both
[47:23]
Boulder Creek and New Golf Course both
[47:25]
have a search charge fund and they grow
[47:27]
at about $150,000 annually. So, Boulder
[47:30]
Creek will use this money for about
[47:32]
$126,000 to purchase equipment and MUN
[47:35]
golf course will use $290,000 to
[47:38]
purchase equipment.
[47:42]
So, our proposed enterprise fund
[47:44]
spending for fiscal year 27 hasn't
[47:46]
changed since we met back in December.
[47:48]
The airport fund will be $140,000.
[47:51]
The electric fund will be $5 million.
[47:53]
The wastewater fund will be $400,000.
[47:56]
And the water fund will be 1.4 million.
[48:01]
So, our outside funding for fiscal year
[48:03]
27 um includes the regional
[48:06]
transportation commission of $1.4
[48:08]
million and again this supports our
[48:09]
roads and also the federal aviation
[48:11]
administration of 1.2 which supports our
[48:15]
airport.
[48:18]
So, there's only been one change since
[48:19]
we met in December with the CIP, and
[48:23]
that includes adding the project of the
[48:25]
pavilion at the Boulder Creek Golf
[48:26]
Course of converting the 7,400 ft²
[48:30]
canvas pavilion into a 10,000 ft²
[48:33]
permanent building that would include
[48:35]
restrooms, a warming kitchen, and bars.
[48:39]
So, this cost this project would cost
[48:41]
$8.5 million. It would be 100% funded
[48:44]
with the redevelopment district funding.
[48:47]
So, we would use the current funding of
[48:49]
$5 million that's in the RDA and then um
[48:52]
2027 it'd be an additional $1.7 million
[48:55]
and then in 287 $750,000 and then in
[48:58]
fiscal year 29 when the RDA sunsets
[49:00]
there'd be an additional million
[49:01]
dollars. So for a total project cost of
[49:04]
8.5 million
[49:07]
and the 10,000 footprint
[49:10]
um we used
[49:13]
the Clark County not oh my gosh Boulder
[49:16]
the Boulder Dam Credit Union Gala which
[49:18]
is about 400 people and so that's how we
[49:20]
um determined that 10,000 square
[49:21]
footprint to make sure it could host
[49:23]
something like that.
[49:26]
» Can I interrupt here mayor and ask a
[49:28]
question? Have we talked with our public
[49:31]
works department to see if that amount
[49:33]
is going to be about the right amount
[49:35]
come 2028?
[49:37]
>> We have we have a little bit of
[49:41]
» We have we have a little bit of
[49:41]
inflation put into this for with our
[49:42]
current calculations that they have
[49:44]
made. But
[49:46]
>> if the public works director would like
[49:47]
» if the public works director would like
[49:47]
to come up, they have definitely been
[49:49]
working on this.
[49:50]
>> Yeah, I mean that's what we do. We set
[49:51]
» Yeah, I mean that's what we do. We set
[49:51]
aside money today and realize it's not
[49:53]
sufficient in two years, right? So we
[49:54]
want to make sure we don't get caught
[49:56]
with that. So thank you.
[49:59]
>> Thank you.
[50:01]
» Thank you.
[50:01]
>> Okay. So this is the timeline for our
[50:03]
» Okay. So this is the timeline for our
[50:03]
capital improvement plan. Today's the
[50:05]
13th and we are looking for tenative
[50:07]
approval so we can move forward with our
[50:09]
operating budget. Um the CIP plan could
[50:12]
come forth any time before final
[50:14]
approval of the budget in May. Um but if
[50:17]
there's no changes, you won't see it
[50:19]
again until final budget approval on May
[50:22]
26th.
[50:24]
And I know um
[50:28]
in the packet there is a PDF of our
[50:30]
digital budget book. If you go to our
[50:32]
website bcnv.org/cip2027,
[50:37]
there is the digital um CIP book. It's
[50:40]
much more user friendly and easier to
[50:41]
navigate. And if you want to u look in
[50:43]
deeper into any of the projects or
[50:45]
funding sources, it's a great resource.
[50:48]
And also if there's ever any questions
[50:49]
on CIP, uh, anyone can email cipbcnv.org
[50:55]
and I'm happy to answer any questions.
[50:57]
>> Questions?
[51:00]
» Questions?
[51:00]
>> Thank you for all that. I think I was
[51:02]
» Thank you for all that. I think I was
[51:02]
keeping up with you, but I do have um
[51:04]
just a clarification if you could
[51:06]
between the CIP and the voter approval
[51:09]
fund and you mentioned $11 million. Can
[51:13]
you put those three into context?
[51:16]
So,
[51:18]
the charter states we have to put 20% of
[51:20]
all lease revenue into a CIP fund. That
[51:24]
CIP fund, we've named it the voter
[51:26]
approved capital improvement fund. So,
[51:27]
it grows at the $3.6 million annually.
[51:30]
And so, at the end of this year, it'll
[51:31]
be $11 million. We also have an
[51:33]
acquisitions and improvement fund, which
[51:35]
is our working um capital improvement
[51:38]
fund really where all the CIP
[51:39]
governmental CIP projects happen. And
[51:42]
then of course with the utilities and
[51:43]
airport those would all occur in their
[51:46]
own individual funds.
[51:47]
>> So the 11 million that would have any of
[51:49]
» So the 11 million that would have any of
[51:49]
that money that would be spent from that
[51:51]
is that something that has to go to the
[51:52]
voters?
[51:53]
>> Yes.
[51:54]
» Yes.
[51:54]
>> Okay.
[51:54]
» Okay.
[51:54]
>> So none of that money can be spent
[51:55]
» So none of that money can be spent
[51:55]
without voter approval.
[51:57]
>> Okay. Can you give me um an idea of what
[52:01]
» Okay. Can you give me um an idea of what
[52:01]
that a project that could be used?
[52:04]
>> So a recent one was the pool. We had two
[52:07]
» So a recent one was the pool. We had two
[52:07]
questions go out um to the voters. one
[52:08]
was for $7 million to assist with
[52:11]
building the pool and then there was
[52:12]
additional um question of up to $9
[52:14]
million. So that's um a great project
[52:17]
for we let can let those fun um funds
[52:20]
build until we have a large project like
[52:21]
that.
[52:22]
>> Okay. Thank you.
[52:23]
» Okay. Thank you.
[52:23]
>> Mhm.
[52:28]
» I want to clarify if I could my I'm
[52:30]
sorry. Were you going to ask a question?
[52:31]
Right.
[52:32]
>> I was No, I will defer. I'm blurted out.
[52:34]
» I was No, I will defer. I'm blurted out.
[52:34]
Sorry.
[52:34]
>> I just was going to say thank you. Thank
[52:36]
» I just was going to say thank you. Thank
[52:36]
you for all the hard work. Great job.
[52:38]
Thank you. Thanks.
[52:39]
>> That's it. I'm done.
[52:41]
» That's it. I'm done.
[52:41]
>> If I may. Sorry, there was a long pause.
[52:44]
» If I may. Sorry, there was a long pause.
[52:44]
I thought there was no more. Um, did I
[52:46]
hear you say then that this that the CIP
[52:51]
U plan uh will not be brought in a
[52:54]
public meeting again until the approval
[52:57]
date in May
[52:58]
>> unless there's any request for changes.
[53:01]
» unless there's any request for changes.
[53:01]
as we go through the operating budget,
[53:03]
there's always that opportunity,
[53:04]
especially if there's a change on any of
[53:06]
our projects or a request to change
[53:07]
anything because also during that our
[53:09]
operating budget will request to make
[53:11]
the transfers to pay for the CIP
[53:13]
projects. So, it won't maybe not its own
[53:17]
individual meeting, but the topic will
[53:20]
there'll be opportunity to make changes.
[53:21]
>> Okay. Thanks.
[53:22]
» Okay. Thanks.
[53:22]
>> Yes.
[53:22]
» Yes.
[53:22]
>> Thanks, Mayor.
[53:23]
» Thanks, Mayor.
[53:23]
>> Mayor, may I also comment on council
[53:25]
» Mayor, may I also comment on council
[53:25]
member Balton's question? uh what I
[53:28]
might offer to this this question has
[53:30]
come up a couple times. So um there
[53:32]
several months between now and then. So
[53:34]
what I I could offer is in our monthly
[53:36]
one-on-one my monthly monthly one-on-one
[53:39]
meetings with you, I can put this as an
[53:41]
item and we can talk through those
[53:43]
projects again and then if you have
[53:44]
additional things then uh we we we would
[53:47]
like to give the I guess what I'm saying
[53:48]
is I'd like to give the council an
[53:50]
opportunity for a more in-depth
[53:51]
discussion on those CIP projects. If you
[53:53]
would like to do that, we can do that in
[53:55]
the our meetings.
[53:57]
What he's trying to say is that can
[53:59]
happen individually, not as a group,
[54:01]
because otherwise we would have to
[54:03]
agendaize it.
[54:05]
And go ahead,
[54:08]
>> though. I can ask this in the meeting. I
[54:10]
» though. I can ask this in the meeting. I
[54:10]
I will ask it here. With the pavilion
[54:12]
being um the new thing that's funded
[54:15]
through the RDA monies um up to 2029,
[54:18]
are we seeing that as the projected
[54:20]
completion is 2029 or are we planning on
[54:23]
starting that prior to that? How does
[54:25]
that look?
[54:26]
>> It would depend with RFPs like the Well,
[54:30]
» It would depend with RFPs like the Well,
[54:30]
the $5 million that would be in fiscal
[54:32]
year 26
[54:33]
>> has not been approved by the RDA board.
[54:35]
» has not been approved by the RDA board.
[54:35]
Like we're giving asking for tenative
[54:38]
approval here, but we that would have to
[54:40]
be a first step before any of those um
[54:43]
funding could be spent. And I mean
[54:45]
there's a long process like we'd like to
[54:47]
have it done by 2029, but there's
[54:51]
many things that would have to happen
[54:53]
before.
[54:54]
>> Okay. Thank you.
[54:55]
» Okay. Thank you.
[54:55]
>> What he's trying to say, what she's
[54:57]
» What he's trying to say, what she's
[54:57]
trying to say is we won't get a bathroom
[55:00]
there for three years.
[55:06]
» All right. Go ahead.
[55:08]
>> Anyone else?
[55:09]
» Anyone else?
[55:09]
>> No, sir.
[55:10]
» No, sir.
[55:10]
>> Mr. City,
[55:11]
» Mr. City,
[55:12]
>> just really quickly just to clarify so
[55:13]
» just really quickly just to clarify so
[55:14]
that there's no misunderstanding on the
[55:16]
the the conversation that I just had
[55:18]
with you. Uh yes, I will I I will be
[55:21]
happy to speak with you on the CIP
[55:22]
projects one-on-one. However, no
[55:25]
decisions will be made. So um if there
[55:27]
are any that um uh sound good, then I
[55:30]
can always bring those back to a meeting
[55:32]
uh for a full full disclosure to the
[55:35]
other council members. But I just wanted
[55:37]
to be I I wanted to be careful that we
[55:40]
were not suggesting that I was going to
[55:41]
talk to you about other projects and not
[55:43]
have them in a public meeting.
[55:44]
>> All right. Appreciate it. Thank you. Any
[55:46]
» All right. Appreciate it. Thank you. Any
[55:46]
other questions?
[55:48]
All right. Um,
[55:51]
so on that one, do we need anything
[55:53]
other than to have a motion to approve
[55:56]
the tenative capital improvement plan?
[56:00]
>> That's it.
[56:01]
» That's it.
[56:01]
>> I would accept that motion.
[56:03]
» I would accept that motion.
[56:03]
>> Move to approve.
[56:05]
» Move to approve.
[56:05]
>> Second.
[56:06]
» Second.
[56:06]
>> Seconded. Although any discussion,
[56:10]
» Seconded. Although any discussion,
[56:10]
all those in favor say I. I. Any oppose?
[56:14]
>> That's unanimous. Thank you.
[56:15]
» That's unanimous. Thank you.
[56:15]
>> Thank you. Thank you.
[56:18]
» Thank you. Thank you.
[56:18]
That brings us to item 17.
[56:32]
» Good evening, mayor and council. Uh
[56:34]
Britney Walker, your city attorney here.
[56:36]
before you this evening. Item 17 is a
[56:39]
resolution approving an agreement
[56:41]
between the city of Boulder City and the
[56:43]
law firm of Cox and Wilson for
[56:46]
prosecutor services. Since 2005, the
[56:49]
city has contracted with private law
[56:51]
firms to provide the prosecution
[56:52]
services.
[56:54]
Mr. Gary Booker was our uh prosecutor
[56:57]
for 18 years and retired in 2023. Our
[57:01]
current prosecutor is Thomas Moscll who
[57:03]
has served in this role since June of 23
[57:06]
and he was a chief deputy district
[57:08]
attorney for Clark County from August 23
[57:11]
2014 through 2021.
[57:15]
In August of 2025, Mr. Moscow began
[57:18]
working with Justin Wilson of Cox and
[57:20]
Wilson Law. And as an aside, Mr. Wilson
[57:22]
and his partner Shane Cox are here today
[57:24]
if there's any questions for them. Um,
[57:27]
and they subcontracted with Mr. Moscow
[57:30]
to provide prosecution services. Um, Mr.
[57:33]
Moscow does wish to terminate his
[57:34]
contract to pursue other endeavors. Um,
[57:37]
since the city has been working with Mr.
[57:38]
Wilson, who is also an experienced
[57:40]
criminal attorney with, um, over 5 years
[57:43]
of criminal experience. Uh, he also
[57:45]
worked for the Clark County DA's office
[57:46]
early in his career, and his resume is
[57:49]
provided as a handout tonight. Um he
[57:52]
over the past few months has worked uh
[57:54]
providing our prosecution services and
[57:56]
in that time has processed uh 88 cases
[57:59]
resulting in 70 convictions for the
[58:01]
city. Uh Mr. Wilson is comfortable in a
[58:04]
courtroom and wellversed in criminal
[58:05]
procedure investigation, substantive
[58:08]
criminal law and roles of evidence. Mr.
[58:10]
Wilson's partner Shane Cox is also
[58:12]
available to serve in Mr. Wilson'sstead
[58:14]
should he be unavailable. Uh Mr. Cox is
[58:17]
also an experienced criminal attorney
[58:18]
and it will benefit the city to have the
[58:20]
additional support of a law firm uh to
[58:23]
provide these services. The term of the
[58:25]
agreement is two years and additional
[58:27]
two additional one-year renewal periods.
[58:29]
Um and so before you this agreement and
[58:32]
I'm available for any questions and
[58:34]
again Mr. Wilson and Mr. Cox are also
[58:36]
here if the council has questions for
[58:38]
them.
[58:40]
>> Any questions that were attorney Denise
[58:43]
» Any questions that were attorney Denise
[58:43]
can go first?
[58:44]
>> Just a clarification. So it's 25 hours
[58:48]
» Just a clarification. So it's 25 hours
[58:48]
basically for the year.
[58:50]
>> No, no, a week.
[58:51]
» No, no, a week.
[58:52]

[58:54]
» Yes, it's up to 25 hours a week.
[58:54]
>> Okay. So insurance and all that kind of
[58:56]
» Okay. So insurance and all that kind of
[58:56]
stuff is still under the umbrella of uh
[59:00]
Cox and Wilson.
[59:01]
>> Yes, they they provide uh malpractice
[59:04]
» Yes, they they provide uh malpractice
[59:04]
insurance for the services.
[59:05]
>> Okay. Thank you.
[59:08]
» Okay. Thank you.
[59:08]
>> I would like Mr. Cox and Mr. Wilson to
[59:11]
» I would like Mr. Cox and Mr. Wilson to
[59:11]
come up forward and introduce
[59:12]
themselves.
[59:15]
And then I have one question for you
[59:17]
each.
[59:18]
>> Good morning. Justin W. Wilson, Nevada
[59:20]
» Good morning. Justin W. Wilson, Nevada
[59:20]
Bar number 14646. Shane Cox, Nevada bar
[59:23]
number 13852 for those curious.
[59:26]
>> Okay. So, you're both attorneys and
[59:28]
» Okay. So, you're both attorneys and
[59:28]
going to work for us. What is your best
[59:31]
attribute
[59:32]
>> as an attorney?
[59:33]
» as an attorney?
[59:33]
>> As an attorney, I think
[59:34]
» As an attorney, I think
[59:34]
>> not real long, just real quick.
[59:36]
» not real long, just real quick.
[59:36]
>> I think it's the same as as uh me
[59:38]
» I think it's the same as as uh me
[59:38]
individually. Um, tenacity. I don't
[59:40]
really give up on anything. If I set a
[59:43]
goal, I get it.
[59:44]
>> Okay. Thank you. And you, sir?
[59:46]
» Okay. Thank you. And you, sir?
[59:46]
>> We're a good pair because I'm more
[59:48]
» We're a good pair because I'm more
[59:48]
thoughtful and want to analyze things a
[59:50]
little bit longer. U Justin is
[59:52]
tenacious. I can say that. And so we
[59:54]
balance each other out that way.
[59:56]
>> Great answer. Thank you very much.
[59:58]
» Great answer. Thank you very much.
[59:58]
>> Thank you.
[1:00:00]
» Thank you.
[1:00:00]
>> Any questions of the two?
[1:00:04]
» Any questions of the two?
[1:00:04]
>> Perfect.
[1:00:04]
» Perfect.
[1:00:04]
>> I I can't resist. So, what is your worst
[1:00:07]
» I I can't resist. So, what is your worst
[1:00:07]
asset?
[1:00:08]
>> Oh, man. Um,
[1:00:11]
» Oh, man. Um,
[1:00:12]
>> okay. I retract that question. It's kind
[1:00:13]
» okay. I retract that question. It's kind
[1:00:14]
of the same.
[1:00:14]
>> Thank you for hesitating.
[1:00:17]
» Thank you for hesitating.
[1:00:17]
Appreciate it. Any other questions that
[1:00:19]
are
[1:00:20]

[1:00:22]
» pertinent? I'll call them. If not, thank
[1:00:22]
you very much.
[1:00:24]
>> Thank you.
[1:00:25]
» Thank you.
[1:00:25]
>> And so that brings us up to us uh and
[1:00:30]
» And so that brings us up to us uh and
[1:00:30]
the resolution of 80087. Do I have a
[1:00:33]
motion?
[1:00:34]
>> I move to approve resolution 8087.
[1:00:38]
» I move to approve resolution 8087.
[1:00:38]
Is there a second?
[1:00:40]
>> I'll second it.
[1:00:41]
» I'll second it.
[1:00:41]
>> And is there discussion?
[1:00:44]
» And is there discussion?
[1:00:44]
Seeing no discussion, all those in favor
[1:00:46]
say I.
[1:00:48]
>> Any oppose say nay. It's unanimous.
[1:00:50]
» Any oppose say nay. It's unanimous.
[1:00:50]
Thank you. Thank you.
[1:00:54]
And then that brings us to item 18,
[1:00:58]
matters pertaining to the 2026
[1:01:01]
elections.
[1:01:04]
>> Yes. Thank you. The first matter before
[1:01:07]
» Yes. Thank you. The first matter before
[1:01:07]
you is resolution number 80088.
[1:01:10]
This is declaring a municipal primary
[1:01:12]
election will be held on the 9th day of
[1:01:14]
June 2026 and a municipal general
[1:01:17]
election will be held on the 3rd day of
[1:01:19]
November 2026 in Boulder City. And um as
[1:01:24]
a point of reference, we do have to um
[1:01:26]
notice this legally notice this prior to
[1:01:29]
February 15th. This has already been
[1:01:32]
done by the Clark County Election
[1:01:33]
Department on behalf of the
[1:01:35]
municipalities. It's attached and
[1:01:37]
included in the packet.
[1:01:40]
And just for the sake of anybody
[1:01:43]
watching, um candidate filing
[1:01:46]
uh filing fees are set at $25. And our
[1:01:49]
filing hours will be uh Monday through
[1:01:52]
Thursday 8:00 a.m. to 5:00 p.m.
[1:01:54]
beginning March 2nd through March 13th
[1:01:58]
and Fridays by appointment.
[1:02:02]
And so I would ask the council to please
[1:02:04]
um approve resolution number 80088.
[1:02:08]
>> Any questions?
[1:02:10]
» Any questions?
[1:02:10]
I'll accept a motion.
[1:02:13]
Move to approve 8088.

[1:02:18]
All those in favor say I. I. Any oppose
[1:02:21]

[1:02:23]
>> The second matter is um per city council
[1:02:27]
» The second matter is um per city council
[1:02:27]
rules section 3.1 the council can make a
[1:02:30]
motion to reschedu a regularly scheduled
[1:02:33]
council meeting. And this year Tuesday,
[1:02:36]
June 9th, which would be a regular
[1:02:38]
meeting, is also the primary election
[1:02:40]
day. So, I am requesting that a motion
[1:02:44]
be made to move the council meeting to
[1:02:46]
June 8th, 2026.
[1:02:49]
>> Is there a motion?

[1:03:04]
>> Thank you. Thank you. And that brings us

» Thank you. Thank you. And that brings us
[1:03:07]
to number 19. Appointment of the mayor
[1:03:11]

[1:03:13]
>> Can I nominate Sherry Jorgensson?
[1:03:17]

[1:03:24]
Is there any other NE nomination or can

I just say all those in favor?
[1:03:31]
>> All those in all those in favor say I.
[1:03:33]
» All those in all those in favor say I.
[1:03:33]
I.
[1:03:34]
>> Any opposed? And I'm glad there's nobody
[1:03:36]
» Any opposed? And I'm glad there's nobody
[1:03:36]
opposed. It's so done unanimously. Thank
[1:03:39]
you. Thank you, Councilwoman Jorgensson.
[1:03:43]
For those of you who haven't noticed,
[1:03:45]
she keeps me straight or at least tries
[1:03:48]
to. So, I appreciate what you do. Thank
[1:03:51]
you.
[1:03:52]
Um, that brings us to number 20.
[1:03:56]
>> Yes. So, this matter is um an
[1:03:59]
» Yes. So, this matter is um an
[1:03:59]
appointment to the Southern Nevada
[1:04:01]
Council of Governments. A couple months
[1:04:03]
back, the council um approved an
[1:04:05]
agreement with them. And the purpose of
[1:04:08]
the Southern Nevada Council of
[1:04:09]
Governments is to cooperatively address
[1:04:11]
regional issues, identify common needs,
[1:04:14]
coordinate government services and
[1:04:16]
responsibilities, engage in
[1:04:18]
comprehensive regional policy planning,
[1:04:20]
and to assist members in the conduct of
[1:04:22]
their affairs. This council um is
[1:04:26]
co-terminus which means whoever is
[1:04:29]
appointed and
[1:04:31]
to this particular committee they will
[1:04:33]
serve on this board for the remaining
[1:04:36]
term of their their membership as as a
[1:04:39]
council member and Boulder City has one
[1:04:42]
representative and that is in their
[1:04:45]
rules for governing board. So one
[1:04:46]
representative of each member whose
[1:04:49]
population is less than 200,000. At this
[1:04:52]
time, the meetings haven't actually been
[1:04:54]
set, but they're waiting until um April
[1:04:57]
when this actual board will take effect,
[1:04:59]
and then they'll have a meeting to set
[1:05:01]
up regularly scheduled meetings. So, at
[1:05:04]
this time, it's unknown.
[1:05:05]
>> Thank you. Uh is there anyone on council
[1:05:09]
» Thank you. Uh is there anyone on council
[1:05:09]
who would like to do this?
[1:05:11]
>> Can I nominate Denise?
[1:05:14]
» Can I nominate Denise?
[1:05:14]
>> I'll second it.
[1:05:15]
» I'll second it.
[1:05:15]
>> So, it's been it's been moved and
[1:05:18]
» So, it's been it's been moved and
[1:05:18]
seconded to nominate. I don't think I
[1:05:21]
could second myself, but
[1:05:23]
>> I will.
[1:05:23]
» I will.
[1:05:23]
>> You're seconding a motion? Yes, you can.
[1:05:25]
» You're seconding a motion? Yes, you can.
[1:05:25]
>> Oh, good. Okay.
[1:05:26]
» Oh, good. Okay.
[1:05:26]
>> So, we will uh we have a nomination and
[1:05:29]
» So, we will uh we have a nomination and
[1:05:29]
a second to nominate Councilwoman Ashers
[1:05:32]
to that uh board. Those in favor or is
[1:05:36]
there any discussion?
[1:05:38]
Those in favor say I. I.
[1:05:40]
>> I.
[1:05:41]
» I.
[1:05:41]
>> Any opposed? It's unanimous again. Thank
[1:05:43]
» Any opposed? It's unanimous again. Thank
[1:05:43]
you.
[1:05:45]
And that brings us to
[1:05:48]
number 21.
[1:05:50]
Um, city council appointments for first
[1:05:54]
uh historic preservation commission.
[1:05:56]
Madame city clerk.
[1:05:58]
>> Yes. Thank you. So the first um item on
[1:06:00]
» Yes. Thank you. So the first um item on
[1:06:00]
here is the appointment to historic
[1:06:02]
preservation. There's two appointments
[1:06:04]
needed. Uh one is to serve a remaining
[1:06:08]
term which expires August 31st, 2027.
[1:06:12]
And then we have a second term which
[1:06:14]
would expire 8312028
[1:06:21]
» of the same historic preservation.
[1:06:23]
>> Correct. Both.
[1:06:23]
» Correct. Both.
[1:06:24]
>> So we need two
[1:06:25]
» So we need two
[1:06:25]
>> two. They would just serve different
[1:06:26]
» two. They would just serve different
[1:06:26]
terms.
[1:06:27]
>> Okay.
[1:06:27]
» Okay.
[1:06:27]
>> So we could start out if you wanted um
[1:06:30]
» So we could start out if you wanted um
[1:06:30]
with the first one which would would be
[1:06:31]
appointing somebody to the term which
[1:06:33]
would expire 8:31 2027.
[1:06:38]
» And so is there a nomination? We have a
[1:06:43]
bunch of people who have been willing to
[1:06:47]
do that. Is there a nomination from that
[1:06:49]
group or any other person that someone
[1:06:52]
would not like to nominate for the first
[1:06:55]
one that will uh serve until 2027?
[1:06:59]
>> I'd like to nominate Don Johnson because
[1:07:01]
» I'd like to nominate Don Johnson because
[1:07:01]
he has a bachelor's in city planning and
[1:07:03]
master in historic preservation and
[1:07:06]
planning. And I thought that speaks to
[1:07:08]
what the lady that was here said today.
[1:07:10]
So, I'd like to nominate uh Don Johnson.
[1:07:13]
>> Is there a second?
[1:07:15]
» Is there a second?
[1:07:15]
>> There's I have a nominee.
[1:07:17]
» There's I have a nominee.
[1:07:17]
>> Could I Could I put another name in the
[1:07:19]
» Could I Could I put another name in the
[1:07:19]
hat?
[1:07:20]
>> Is there a second to the nomination?
[1:07:21]
» Is there a second to the nomination?
[1:07:22]
>> We don't need a second. If nominations
[1:07:23]
» We don't need a second. If nominations
[1:07:23]
are open, we can wait until all the
[1:07:25]
nominations are.
[1:07:26]
>> So, yes, you can nominate another
[1:07:27]
» So, yes, you can nominate another
[1:07:27]
person.
[1:07:27]
>> Okay. I'd like to uh nominate Bren
[1:07:29]
» Okay. I'd like to uh nominate Bren
[1:07:29]
Deloreer for the
[1:07:32]
two I think it's a year you said or
[1:07:34]
follow carry out the last until 2027.
[1:07:38]
>> Correct. Okay.
[1:07:40]
» Correct. Okay.
[1:07:40]
So, we have two nominations. Uh, Don
[1:07:42]
Johnson and Brenda Morier. Is there any
[1:07:46]
other nomination?
[1:07:48]
John David Hancock.
[1:07:52]
>> Pardon?
[1:07:52]
» Pardon?
[1:07:52]
>> John David Hancock. I'm nominating him.
[1:08:00]
» All for the same one.
[1:08:03]
And so we have three nominations for
[1:08:06]
that particular uh position that goes
[1:08:09]
until 2027.
[1:08:12]
And now you'll talk me through how I do
[1:08:14]
that.
[1:08:15]
>> Just if no other nominations are
[1:08:17]
» Just if no other nominations are
[1:08:18]
offered, you can just close the
[1:08:19]
nominations and then we'll just you'll
[1:08:20]
have to take a vote on each of the three
[1:08:22]
members.
[1:08:23]
>> Okay.
[1:08:24]
» Okay.
[1:08:24]
>> Remembering that you can only vote once.
[1:08:26]
» Remembering that you can only vote once.
[1:08:26]
>> So the uh we if there are no other
[1:08:29]
» So the uh we if there are no other
[1:08:29]
nominations, we'll close the nominations
[1:08:31]
for that. And we will now uh vote uh for
[1:08:36]
in order uh those in favor of Don
[1:08:40]
Johnson. And we can only vote once.
[1:08:43]
>> I
[1:08:44]
» I
[1:08:44]
>> I
[1:08:45]
» I
[1:08:45]
>> I
[1:08:47]
» I
[1:08:47]
And so that is three.
[1:08:49]
>> Three.
[1:08:50]
» Three.
[1:08:50]
>> We used to call that a majority.
[1:08:54]
» Can I say then it's done because we can
[1:08:57]
only vote once, right?
[1:08:58]
>> You can if it's a majority. Yes.
[1:09:00]
» You can if it's a majority. Yes.
[1:09:00]
>> So we'll close that. Don Johnson has
[1:09:02]
» So we'll close that. Don Johnson has
[1:09:02]
thus been duly elected. Um, and then
[1:09:07]
we'll open the nominations for
[1:09:12]
what's the other one till
[1:09:16]
for the
[1:09:16]
>> 2028.
[1:09:17]
» 2028.
[1:09:17]
>> 2028.
[1:09:20]
» 2028.
[1:09:20]
And so we would have nominations open
[1:09:23]
for someone to serve until 2028.
[1:09:27]
Uh, is there any nomination for that?
[1:09:30]
I'd like to nominate uh David Engelman.
[1:09:34]
Uh he's an anthropologist
[1:09:36]
and I think that again adds experience
[1:09:38]
of aging for the historic committee.
[1:09:42]
>> Okay. Are there other nominations?
[1:09:45]
» Okay. Are there other nominations?
[1:09:45]
>> I'd like to nominate Norma Valley.
[1:09:50]
» Any other nominations? And I'll nominate
[1:09:53]
uh Dave Hancock again.
[1:10:02]
And are there any other nominations? We
[1:10:04]
have three nominations.
[1:10:06]
Um, and in order to do that, we'll uh
[1:10:11]
all those in favor of
[1:10:14]
um Engelman,
[1:10:16]
uh, say I.
[1:10:18]
>> I.
[1:10:21]
» I.
[1:10:21]
>> All those in favor of Norma Valley say
[1:10:24]
» All those in favor of Norma Valley say
[1:10:24]
I.
[1:10:25]
>> I.
[1:10:25]
» I.
[1:10:25]
>> I.
[1:10:27]
» I.
[1:10:27]
That's two. And all those in favor of
[1:10:31]
Dave,
[1:10:35]
» Hancock,
[1:10:36]
>> Hancock,
[1:10:39]
say I.
[1:10:40]
>> I.
[1:10:41]
» I.
[1:10:41]
>> That is two.
[1:10:44]
» That is two.
[1:10:44]
>> Yeah. So, they're got to do it over
[1:10:46]
» Yeah. So, they're got to do it over
[1:10:46]
again.
[1:10:47]
>> We have a tie uh between Norma Valley
[1:10:50]
» We have a tie uh between Norma Valley
[1:10:50]
and Dave Hancock. Um, and we will do
[1:10:55]
this again. Uh, all those I'll take uh
[1:10:58]
in reverse order Dave Hancock. All those
[1:11:02]
in favor of Dave Hancock say I
[1:11:04]
>> I I
[1:11:08]
» I I
[1:11:08]
that was enough.
[1:11:09]
>> I have Walton. Did somebody else say I?
[1:11:11]
» I have Walton. Did somebody else say I?
[1:11:11]
>> I did.
[1:11:12]
» I did.
[1:11:12]
>> I did.
[1:11:12]
» I did.
[1:11:12]
>> Yeah.
[1:11:13]
» Yeah.
[1:11:13]
>> Okay.
[1:11:14]
» Okay.
[1:11:14]
>> And I did too.
[1:11:15]
» And I did too.
[1:11:15]
>> So we had four say for Dave Hancock and
[1:11:20]
» So we had four say for Dave Hancock and
[1:11:20]
that is resolved. that is he is
[1:11:23]
nominated
[1:11:25]
and he will serve till the or the 28th
[1:11:30]
uh time frame.
[1:11:35]
And then that brings us to the regional
[1:11:38]
flood districts
[1:11:40]
uh citizen advisory committee.
[1:11:45]
Do we have
[1:11:49]
a flood person? There's yeah there
[1:11:51]
there's one person and he currently
[1:11:53]
serves on the board um Jason Gross and
[1:11:57]
it's been requested by the board that he
[1:11:58]
remain on it. He's a contributing member
[1:12:01]
to their board and we have no other
[1:12:02]
applications.
[1:12:04]
>> So is somebody nominating Jason?
[1:12:06]
» So is somebody nominating Jason?
[1:12:06]
>> I nominate Jason Gross.
[1:12:09]
» I nominate Jason Gross.
[1:12:09]
>> And is any other nominations?
[1:12:13]
» And is any other nominations?
[1:12:13]
If there are no other nominations then
[1:12:15]
it's de facto.
[1:12:18]
So he has been reappointed. Thank you.
[1:12:22]
>> And that brings us to the city manager's
[1:12:24]
» And that brings us to the city manager's
[1:12:24]
report.
[1:12:28]
» Or somebody's
[1:12:29]
>> item 22.
[1:12:30]
» item 22.
[1:12:30]
>> Yeah, the city manager's report on
[1:12:33]
» Yeah, the city manager's report on
[1:12:33]
there.
[1:12:33]
>> Oh, it does say city manager report. So,
[1:12:36]
» Oh, it does say city manager report. So,
[1:12:36]
there's multiple city managers reports
[1:12:38]
on this one.
[1:12:39]
>> I'm going to round us out with reports.
[1:12:43]
» I'm going to round us out with reports.
[1:12:43]
>> I can only read three words at a time.
[1:12:47]
» I can only read three words at a time.
[1:12:47]
>> Thank you, mayor. Again, I'm city
[1:12:49]
» Thank you, mayor. Again, I'm city
[1:12:49]
manager Ned Thomas. Item number 22,
[1:12:52]
agenda item 22 is noted in the agenda is
[1:12:55]
my report as city manager on the
[1:12:58]
non-binding factfinders report including
[1:13:00]
findings and recommendations and
[1:13:02]
associated fiscal impacts related to the
[1:13:05]
collective bargaining agreement or
[1:13:06]
collective bargaining negotiations and
[1:13:09]
then impass between the city and the
[1:13:11]
international association of
[1:13:12]
firefighters local 5073. Uh this report
[1:13:16]
to you is required under NRS 20 uh
[1:13:19]
288.2000
[1:13:22]
subsection 8. Um as noted in the staff
[1:13:25]
report uh just a little bit of
[1:13:26]
background the collective bargaining
[1:13:28]
agreement between the city and IAFF
[1:13:31]
local 5073 expired on June 30th 2025.
[1:13:35]
The parties unfortunately were unable to
[1:13:37]
negotiate a successor agreement and uh
[1:13:40]
we mutually agreed to go to non-binding
[1:13:42]
factf finding to seek third an
[1:13:44]
independent review and third party input
[1:13:47]
on resolving the areas of disagreement
[1:13:50]
and we received this factfinders report
[1:13:52]
on December 23rd 2025 under NRSU uh 288.
[1:13:58]
uh the city council must hold a um there
[1:14:01]
must hold a public meeting and for the
[1:14:04]
within 45 days of receiving that report.
[1:14:06]
So we're here before you tonight to
[1:14:08]
present the report and that would
[1:14:10]
include a discussion of three different
[1:14:12]
items. First item is uh what are the
[1:14:15]
issues uh of disagreement and uh between
[1:14:19]
the two parties. The second item is a
[1:14:21]
report of the findings and the
[1:14:23]
recommendations of the factfinder. And
[1:14:25]
then third uh the overall fiscal impact
[1:14:28]
of the findings and the recommendation.
[1:14:30]
But in in talking about those uh the
[1:14:33]
fiscal impact the council uh the statute
[1:14:36]
does not allow the council to dis
[1:14:38]
discuss additional details about the
[1:14:40]
report in relation to fiscal. It's a
[1:14:42]
little bit confusing but essentially I'm
[1:14:45]
here to provide you with this is these
[1:14:46]
were the issues that we talked about.
[1:14:49]
This these are the recommendations and
[1:14:50]
findings of the factfinder and these are
[1:14:52]
the fiscal impacts. So I'll go through
[1:14:54]
each one of those in just a little bit
[1:14:56]
of detail. So first the first first item
[1:14:58]
the the issues submitted to the
[1:15:00]
arbitrator. Uh first one is regarding
[1:15:03]
wage increases. The second one was
[1:15:05]
related to pay for what is called a
[1:15:07]
preceptor or mentor pay. This is when
[1:15:09]
one of our full-time firefighters steps
[1:15:11]
in or is given an additional assignment
[1:15:13]
to mentor one of the the junior or cadet
[1:15:16]
uh firefighters. I don't know if that's
[1:15:18]
the exactly the correct term. And then
[1:15:21]
third uh what type of revolved around
[1:15:24]
incentive pay for both hazmat additional
[1:15:26]
certifications that the firefighters
[1:15:28]
receive for uh hazardous materials
[1:15:30]
training as well as what is called a
[1:15:32]
technical rescue training certification
[1:15:35]
and I'll I'll talk about each of those
[1:15:37]
in just a moment. So those were the
[1:15:39]
three issues. uh and now I'll the next
[1:15:42]
part I'll tell you about the findings
[1:15:44]
and the recommendation of the factfinder
[1:15:46]
um
[1:15:49]
under wage increases uh in addition to
[1:15:52]
the wage itself there were some issues
[1:15:55]
around the term of the agreement how
[1:15:57]
many years would the agreement be and
[1:15:59]
also retroactivity so we're past the
[1:16:02]
time when the the old uh collective
[1:16:04]
bargaining agreement expired we're into
[1:16:06]
the new one but we haven't reached an
[1:16:08]
agreement so um what uh when do the new
[1:16:11]
when will the new terms start? So um on
[1:16:14]
that regard uh the factfinder found that
[1:16:17]
there a term of 3 years as proposed by
[1:16:20]
the city would be appropriate. So uh
[1:16:23]
factfinder's recommendation that we um
[1:16:25]
consider a non-binding uh factf finding
[1:16:28]
but we would consider 3 years the uh the
[1:16:32]
new agreement then would be effective
[1:16:34]
from July 31st 2025 through June 30th
[1:16:37]
2028.
[1:16:38]
On the next item related to wages
[1:16:40]
themselves, uh in year 1 there would be
[1:16:43]
a wage increase of 4.375%.
[1:16:47]
In year two and in year three, the w any
[1:16:50]
wage increase would be based upon the
[1:16:52]
consumer price index or CPI. And uh but
[1:16:56]
we would uh the proposal included both a
[1:16:59]
floor and a ceiling or a minimum uh cola
[1:17:03]
and a maximum cola and uh minimum would
[1:17:07]
be 2.25. 25%. So if it happen if it
[1:17:10]
happened that we had a very low CPI that
[1:17:13]
year it was only 1.6 they would be
[1:17:15]
guaranteed at least 2.25%.
[1:17:17]
Likewise like in the in the past year if
[1:17:20]
there was a very large increase in the
[1:17:22]
CPI uh it would be capped at 3.25%.
[1:17:27]
And that would be for year two and
[1:17:28]
three. So there would be a wage increase
[1:17:30]
in both of those but this gives us the
[1:17:33]
uh boundaries of in which that increase
[1:17:36]
would fall.
[1:17:38]
Uh with regard to retroactivity, the
[1:17:40]
factfinder recommended as proposed by
[1:17:44]
the IAFF that it be retroactive to July
[1:17:47]
30, July 1st, 2025. So the beginning of
[1:17:50]
the contract, the the new contract
[1:17:52]
retroactivity. And then with regard to
[1:17:55]
preceptor and mentor compensation, uh it
[1:17:59]
the factfinder recommended it to be $50
[1:18:02]
per shift for the duration of the
[1:18:04]
assignment. And again, that would be
[1:18:06]
effective during the term of this
[1:18:08]
agreement. So, $50 per shift if you're
[1:18:11]
serving as a mentor. And then, uh,
[1:18:13]
finally, with regard to the incentive
[1:18:16]
pay that I mentioned related to
[1:18:17]
hazardous
[1:18:20]
additional certifications, uh, for
[1:18:22]
handling or addressing, uh, emergencies
[1:18:24]
related to hazardous materials and
[1:18:26]
technical rescue training. Um it uh
[1:18:30]
FactFinder recommended that the
[1:18:32]
employees who have obtained and
[1:18:34]
maintained certification in hazardous
[1:18:36]
material technician and so there uh you
[1:18:39]
had to do these together uh a technical
[1:18:42]
rescue certification uh related to
[1:18:45]
vehicle and machinery um technician that
[1:18:48]
would be paid an additional 2% above
[1:18:51]
their um hourly rate. And then in
[1:18:55]
addition to that there are other type
[1:18:57]
there three other types of technical
[1:18:59]
rescue uh certification. Those are
[1:19:03]
swiftwater rescue, high low angle rope
[1:19:06]
rescue and wilderness rescue. All of
[1:19:08]
those uh which are appropriate to our
[1:19:11]
geography here and the special needs of
[1:19:14]
Boulder City. And so if uh the the
[1:19:17]
factfinder recommended that if the
[1:19:19]
employees receive those any of those
[1:19:21]
additional certifications that in
[1:19:24]
addition to the 2% for hazmat and
[1:19:26]
vehicle machinery rescue they would
[1:19:28]
receive one an additional 1% for up to
[1:19:31]
three other uh three other TRT or
[1:19:35]
technical rescue certifications for a
[1:19:37]
total of 5%.
[1:19:41]
A potential uh total of 5%. And then
[1:19:43]
finally, the third item in the fiscal
[1:19:45]
impact of this um for the overall
[1:19:48]
three-year contract would be 1 point uh
[1:19:51]
well, excuse me, 1,483,84349.
[1:19:56]
That would be total in both wages and
[1:19:59]
benefits based on the conditions that I
[1:20:02]
just described to you with regard to
[1:20:04]
wage increases and hazmat and and the
[1:20:08]
other special compensations for
[1:20:09]
mentoring or or preceptor pay.
[1:20:13]
So uh again un uh my report and the
[1:20:17]
structure of that information I've
[1:20:18]
shared with you is outlined or given in
[1:20:21]
the NRS. Um I'm happy and so this is
[1:20:24]
more of an information for the council
[1:20:26]
of um how the factfinder uh factf
[1:20:29]
finding process worked what the results
[1:20:32]
were and I'm happy to answer any
[1:20:33]
questions. However, no action is needed
[1:20:35]
on this item.
[1:20:37]
>> So the factf finder we know what it is.
[1:20:41]
» So the factf finder we know what it is.
[1:20:41]
We know what it is. Now it's up to you
[1:20:45]
or the team to figure out if they want
[1:20:49]
to just accept this or go forward with
[1:20:52]
looking at some other option.
[1:20:55]
>> That's correct. It it came back uh
[1:20:57]
» That's correct. It it came back uh
[1:20:57]
non-binding factf finding and it came
[1:20:59]
back to us and that gives us now a
[1:21:01]
framework to continue to the
[1:21:02]
negotiations which we will do.
[1:21:05]
>> And you're not looking for us to say
[1:21:08]
» And you're not looking for us to say
[1:21:08]
anything?
[1:21:09]
>> No. just answer any questions you might
[1:21:11]
» No. just answer any questions you might
[1:21:11]
have or it's it's for a discussion among
[1:21:13]
the council if you have discussion among
[1:21:15]
yourselves as well.
[1:21:17]
>> So do we have discussion?
[1:21:19]
» So do we have discussion?
[1:21:19]
>> No.
[1:21:23]
» Okay.
[1:21:24]
>> I don't hear anybody saying he wants to
[1:21:26]
» I don't hear anybody saying he wants to
[1:21:26]
or she wants to say anything.
[1:21:30]
>> I will add I think it's approp because I
[1:21:32]
» I will add I think it's approp because I
[1:21:32]
always like to share positive
[1:21:33]
information without going into a lot of
[1:21:35]
detail. This has been very helpful to us
[1:21:37]
and we appreciate the work of both the
[1:21:39]
factfinder and um the response from the
[1:21:42]
IFFF members and we look forward to
[1:21:44]
hopefully concluding a uh fair and uh
[1:21:48]
reasonable solution with a bargaining
[1:21:51]
agreement with them very soon.
[1:21:53]
>> So unless we say otherwise this is the
[1:21:56]
» So unless we say otherwise this is the
[1:21:56]
kind of thing that you will present to
[1:21:58]
the other party.
[1:22:00]
>> Correct.
[1:22:02]
» Correct.
[1:22:02]
>> Yeah.
[1:22:02]
» Yeah.
[1:22:02]
>> Any other things that I need to say or
[1:22:04]
» Any other things that I need to say or
[1:22:04]
do?
[1:22:06]
Thank you.
[1:22:06]
>> Thank you.
[1:22:10]
» That brings us to the city manager
[1:22:12]
report.
[1:22:15]
» Should have just stayed up there, I
[1:22:16]
guess. Yeah,
[1:22:18]
>> I can do three words again.
[1:22:20]
» I can do three words again.
[1:22:20]
>> Yeah, the first one is the report uh
[1:22:21]
» Yeah, the first one is the report uh
[1:22:22]
claims paid report. Uh this is available
[1:22:24]
online and there is no nothing unusual
[1:22:25]
in the report.
[1:22:27]
>> And any questions?
[1:22:30]
» And any questions?
[1:22:30]
And that brings us to number 24, city
[1:22:32]
manager report. And also the same for
[1:22:35]
this, it's the monthly uh financial
[1:22:37]
report. You will notice on the agenda,
[1:22:39]
it's unodudited. Tonight you receive the
[1:22:41]
full audited report. Once we close the
[1:22:42]
books, next year will audit. But on a
[1:22:44]
monthly basis, we provide that report to
[1:22:46]
the council and to the public in an
[1:22:49]
unodudited form.
[1:22:50]
>> Any questions?
[1:22:53]
» Any questions?
[1:22:53]
>> Seeing none, that will bring us to
[1:22:55]
» Seeing none, that will bring us to
[1:22:55]
public comment. Open up public comment.
[1:22:57]
Anyone here in chambers welcome to come
[1:23:00]
forward. And is there anyone on the
[1:23:03]
line? If there are, come at 7025899629.
[1:23:11]
Go ahead.
[1:23:13]
Good evening again, council, mayor,
[1:23:15]
staff, ladies and gentlemen. Um,
[1:23:20]
just kind of furthering my comment from
[1:23:22]
earlier in regards to the HPC committee.
[1:23:25]
Um, I just kind of want to hit it over
[1:23:29]
the head with a hammer again that
[1:23:31]
unfortunately um the committee members
[1:23:34]
that now make up the the new committee
[1:23:38]
still don't represent even 50% um
[1:23:43]
being seated at the historic table from
[1:23:47]
um either a resident or ownership
[1:23:49]
standard. Um and I I really kind of feel
[1:23:53]
like
[1:23:55]
I've been up here over the last couple
[1:23:58]
years advocating that that committee be
[1:24:01]
made up of at least 50% uh voting
[1:24:03]
members that actually represent the
[1:24:06]
historic district. And I think it's um
[1:24:09]
uh while I can, you know, Dave is is an
[1:24:12]
incredible um asset to the historic
[1:24:16]
district um living at the fringe and in
[1:24:18]
a very historic home. Um I I I still
[1:24:22]
feel like we're really falling short on
[1:24:24]
representing your constituents that
[1:24:25]
actually make up the historic district
[1:24:29]
um in in such a capacity and that their
[1:24:32]
voices are heard. I mean, the the
[1:24:34]
committee and and this council um
[1:24:37]
continue to um
[1:24:39]
form obviously opinions and um
[1:24:43]
designations and and and plans for what
[1:24:47]
the historic district is and should be
[1:24:49]
and how to preserve it. Um and yet there
[1:24:52]
still isn't uh uh two voting members on
[1:24:55]
the committee that um
[1:24:58]
that are part of that decision making.
[1:25:01]
So, I just want to remind you guys and
[1:25:03]
and the rest of everybody who's watching
[1:25:06]
um that that should really be something
[1:25:08]
that you guys should try be trying to
[1:25:10]
achieve and um bring a little more of
[1:25:13]
the voice of the actual historic
[1:25:15]
district to the historic committee.
[1:25:18]
Thank you so much.
[1:25:20]
>> Thank you.
[1:25:22]
» Thank you.
[1:25:22]
If anyone's going to call in 7025899629
[1:25:27]
and if no one's calling in, we'll still
[1:25:30]
invite other people to come up if they'd
[1:25:32]
like to say something in the public
[1:25:34]
comment which is open to anything. Um,
[1:25:39]
we had somebody earlier who was here but
[1:25:43]
didn't get the chance. So, we're going
[1:25:45]
to wait a little longer. uh see if he
[1:25:50]
can call in at 7025899629.
[1:25:56]
There is a little bit of a delay. So
[1:25:59]
there um we'll continue to wait.
[1:26:03]
7025899629.
[1:26:21]
And this public comment can be about
[1:26:23]
anything.
[1:26:25]
Doesn't have to be related to the uh
[1:26:28]
things that are on the agenda.
[1:26:30]
7025899629
[1:26:37]
and that phone number is picked up by
[1:26:39]
our city clerk and then is broadcast to
[1:26:42]
the chambers
[1:26:45]
so we all would hear it. 7025899629.
[1:26:52]
No one on the phone.
[1:26:59]
See, no one on the phone and no one here
[1:27:02]
in chambers. We will close public
[1:27:04]
comment and go to city council's report
[1:27:08]
and we'll start at my far right.
[1:27:11]
Councilman Walton.
[1:27:15]
Thank you. Um
[1:27:18]
on the uh convention and visitors
[1:27:21]
authority front, there's been a massive
[1:27:24]
renovation
[1:27:26]
u at the uh convention and visitors
[1:27:28]
authority over the last few years and it
[1:27:31]
was completed and ribbons cut uh just in
[1:27:35]
time for uh the largest or one of
[1:27:39]
certainly the largest uh conventions we
[1:27:41]
have here, CES, Consumer Electronic
[1:27:43]
Show. And so the uh the product the the
[1:27:48]
um the renovations turned out fantastic
[1:27:51]
and high marks from attendees
[1:27:54]
and it really uh continues to place Las
[1:27:58]
Vegas as a premier destination for
[1:28:01]
leisure sports and conventions. And of
[1:28:06]
course CES uh was here recently and very
[1:28:09]
successful. Uh that's all I have there.
[1:28:12]
And then as far as the uh water
[1:28:14]
authority report um by mid
[1:28:19]
February the states
[1:28:22]
are supposed to get together and come up
[1:28:24]
with a new plan the basin states and
[1:28:26]
that there's really not been any
[1:28:29]
reported progress in that. So, uh the uh
[1:28:33]
federal government has said if if you
[1:28:35]
don't come to an agreement, now they
[1:28:37]
have pushed off the time frame for that
[1:28:40]
a couple of times already. We don't know
[1:28:42]
if they'll hold to this middle of
[1:28:44]
February firmly or loosely, but um in
[1:28:48]
any case, we expect there will likely be
[1:28:51]
uh requests for additional cuts amongst
[1:28:55]
all of the basin states.
[1:28:58]
Uh Nevada receives roughly 2% of the
[1:29:03]
entire allocation of the Colorado River
[1:29:06]
flow.
[1:29:07]
Um and of our 2%
[1:29:11]
I'm going to switch to a fraction now.
[1:29:13]
We consumed or are expecting to consume
[1:29:17]
2/3 of our allocation. So we have a
[1:29:20]
cushion. It's not a large cushion, but
[1:29:23]
um we expect to be able to um continue
[1:29:28]
to uh survive and thrive if uh if and
[1:29:31]
when additional cuts might be made to
[1:29:33]
the larger picture. Um, we are part of
[1:29:38]
the lower basin states. Um, and Arizona
[1:29:42]
and Mexico, not a basin state, but a
[1:29:46]
certainly a part a participant and a
[1:29:48]
partner in the Colorado River decisions.
[1:29:51]
Um, between their cuts and our cuts,
[1:29:55]
there's going to be 600 roughly 630,000
[1:29:59]
acre feet. Now, that's double of what
[1:30:02]
our entire allocation is. So that
[1:30:05]
indicates Arizona and Mexico are going
[1:30:08]
to cut a whole lot more than we already
[1:30:10]
are, which is 21,000 acre feet off of
[1:30:13]
our 300,000. So anyway, um the bottom
[1:30:16]
line is we're um we're still um
[1:30:20]
operating with high return flow credits,
[1:30:23]
which allows us to draw out more than
[1:30:26]
our actual allocation. But since we're
[1:30:28]
returning it, we can continue to keep
[1:30:30]
that closed loop cycle and our actual
[1:30:33]
consumption is still only about
[1:30:35]
twothirds of our allocation. So that's
[1:30:37]
my report. Thanks
[1:30:39]
>> you. Appreciate it.
[1:30:42]
» you. Appreciate it.

uh council because they trying to get
[1:30:50]
into the new year. So hopefully next
[1:30:53]
month.
[1:30:59]
» I I just wanted to thank Boulder City. I
[1:31:01]
basically every year you make a New
[1:31:04]
Year's resolution and I've never kept
[1:31:06]
one yet, but I feel so blessed living
[1:31:08]
here in Boulder City and that's I just
[1:31:11]
want to reach out and say how thankful I
[1:31:14]
am that I have a small business that's
[1:31:16]
all family and I have wonderful friends
[1:31:19]
in Boulder City and everybody on the
[1:31:21]
city council. It's been great and the
[1:31:24]
staff down here I feel like I've they're
[1:31:26]
family to me. So, I am so blessed to be
[1:31:30]
in Boulder City and I'm just looking
[1:31:32]
forward to working with everybody and
[1:31:35]
especially everybody in Boulder City and
[1:31:37]
how I appreciate them and appreciate all
[1:31:40]
you guys. Thank you. That's what I had
[1:31:41]
to report.
[1:31:45]
» So, uh most of Americans were tuned in
[1:31:47]
today to the Supreme Court hearing um
[1:31:50]
which is the highest court in the land.
[1:31:52]
And I'd like to point out that the same
[1:31:54]
integrity and desire for right to be
[1:31:56]
done, I believe, is is on its dis. Uh we
[1:32:00]
can't compare obviously to the Supreme
[1:32:02]
Court, but we try to strive for the
[1:32:04]
truth in what we do and to get a a fair
[1:32:08]
um and equitable decision and everything
[1:32:10]
that we do. And I I know I speak for
[1:32:12]
myself and the other four members. Um
[1:32:14]
it's always my honor to serve in any
[1:32:16]
capacity that I find myself in,
[1:32:18]
especially here in Boulder City. Um, but
[1:32:21]
specifically, I I want to thank uh
[1:32:23]
everyone for selecting me as the um
[1:32:26]
Southern Nevada uh Council of Government
[1:32:28]
Representative for Boulder City. I I I
[1:32:32]
think that's really important. I'm also
[1:32:34]
on the uh civilian military council
[1:32:36]
executive committee and this year
[1:32:38]
Boulder City, we are the elected chairs
[1:32:42]
for that committee. We meet quarterly
[1:32:44]
and uh we talk about different issues
[1:32:46]
with the military and military families.
[1:32:49]
Um I'm also on the Nevada Legal Cities
[1:32:52]
and so these are three um boards that
[1:32:56]
have a lot of input and a lot of say. So
[1:32:58]
even though we're small, we give our
[1:33:00]
input from Boulder City and we have a
[1:33:02]
seat at the table to make a difference
[1:33:04]
in Southern Nevada, all of Nevada, I
[1:33:06]
would say. So I just want to thank you
[1:33:08]
again for electing me uh for the uh COG
[1:33:12]
and I look forward always uh with the
[1:33:14]
military council. Um it's it's it's my
[1:33:17]
goal to lean into current and future
[1:33:21]
pressing issues, issues that will be
[1:33:22]
addressed with the military civil and
[1:33:24]
civilian communities. Um like attaining
[1:33:28]
housing uh attainable housing, drone
[1:33:31]
incursions. The military uh has a
[1:33:34]
somewhat of a cclick fix like we have
[1:33:36]
see something, say something. They have
[1:33:38]
a lot of drone in uh incursions. Those
[1:33:41]
are um the drones are mostly the
[1:33:43]
recreational ones that people use, but
[1:33:46]
they're asking our uh help for that.
[1:33:48]
Obviously, we know AI and data centers
[1:33:50]
are on the docket of everyone in
[1:33:53]
government across the nation. So, we'll
[1:33:55]
be talking about things like that. And
[1:33:58]
um if there's any questions or issues on
[1:34:00]
these boards or any local issues, please
[1:34:03]
uh reach out to me. I'm available. I
[1:34:06]
also uh want to remind everyone that uh
[1:34:08]
talk about historic preservation that
[1:34:11]
Boulder City's historic preservation
[1:34:13]
popup ask the expert meeting is on
[1:34:15]
January 20th. Good opportunity to meet
[1:34:18]
with this residents that live in that
[1:34:20]
area and their concerns. Um I I know um
[1:34:24]
there may not be that proportion of
[1:34:27]
representative on the commission, but I
[1:34:29]
hope they have these maybe quarterly
[1:34:31]
meetings so that at least the voices can
[1:34:34]
be heard. And so everybody who's going
[1:34:35]
to be involved in that or who can make
[1:34:37]
it on January 20th at one o'clock, uh,
[1:34:40]
please show up. And I just want to say
[1:34:42]
happy New Year's to everyone. We have an
[1:34:45]
exciting 2026 that's coming our way. And
[1:34:47]
I hope we enjoy it.

[1:34:58]
state of the school district, state of

with everything that you all do and how
[1:35:10]
you are so involved in so many different
[1:35:13]
ways, not just with the city of Boulder
[1:35:16]
City, but everywhere you go. Uh we truly
[1:35:19]
have a wonderful team here and
[1:35:22]
recognizing that the state of our city,
[1:35:25]
the state of Boulder City address is
[1:35:28]
more than an address and it will be
[1:35:30]
happening on Thursday, this Thursday the
[1:35:33]
15th, uh 3:00 start mingling and 4:00 uh
[1:35:38]
have the actual state of the city
[1:35:40]
happen. Uh, in as much as we have a
[1:35:43]
theme of the of a team, which is what we
[1:35:46]
are, uh, I thought, so how do you
[1:35:49]
identify yourself as a team, uh,
[1:35:52]
Councilwoman Booth refuses to wear a
[1:35:55]
t-shirt, so we'll have to do it with
[1:35:57]
hats, but she refuses that, too. So,
[1:36:00]
she's part of the team no matter what.
[1:36:04]
Beautiful things that she wears. Uh, but
[1:36:07]
I would be curious of how many people
[1:36:09]
are going to come to the state of the
[1:36:11]
city with their favorite team hat. Um,

are actually now TV stars. Uh, I've
[1:36:32]
viewed their presentations and they're
[1:36:34]
wonderful and uh, I think people are
[1:36:37]
going to enjoy the state of the city.
[1:36:39]
Uh, you get a little feel for how we do
[1:36:42]
it here, but this will actually be fun
[1:36:46]
and we'll enjoy having everybody here.
[1:36:49]
So, I have nothing else to report. If no

one else has anything, the meeting's
