[3:04] Without objection or approve those, are there any announcements to place upon the record at this time?
[3:10] Yes, you are. We'd like to withdraw DEL26052.

[5:13] All right, thank you, may be seated. And with those preliminary matters out of the way, we can begin calling individual cases.
[5:25] John our first case will be DEL26010 and that's 1432 Tivoli Drive,
[5:38] I'm sorry DEL26016
[5:44] All
[5:47] right, this likes it.
[5:54] And do we have anyone here for the proper yards?
[5:59] No, not at this time. You might proceed that.
[6:06] Good afternoon. I am Code Compliance Officer Tom Ruddy. This is the city of Daltona versus Elgardo Rios Negron and Petronila Cruz.
[6:17] The parcel ID number is 813007811500. It was ruled on March 25th, 2026 that the property owner was given 90 days to come into compliance.
[6:34] The property owner did not come into compliance within those 90 days and the property has been receiving a fine of $25 per day since June 24, 2026.
[6:47] As of today, the property has not reached compliance and has accrued a total fine of $1,600 over 64 days.
[6:56] The City requests the fine to continue at $25 per day until the property has been brought into compliance and the compliance has been verified by the Code Compliance Officer.
[7:11] Thank you.
[7:14] All right.
[7:26] Thank you.
[7:28] We'll, in order to pose in the fine hand, the lean, the fine has run for 60, 40 days and
[7:34] improve to the sum of $1,600 dollars.
[7:38] So that amount will be imposed for the accrued amount, and it will continue to amount of $25 a day.
[7:43] Until this property has been brought fully into compliance and compliance have been verified.
[7:49] Is there anything else to see needs in this case?
[7:51] Look, that would be all.
[7:52] Thank you.
[7:54] Thank you.
[7:57] You know, in our next case will be DEL 2660 that's 595 Tyler Avenue.
[8:19] Good evening, Your Honor.
[8:21] My name?
[8:23] Sorry.
[8:24] I'm co-compliance officer Janice Polesic.
[8:27] This is the City of Deltona versus Felicita Roch EST.
[8:32] The parcel ID number is 813005240020.
[8:39] This is a violation of the City of Deltona Ordnance Section 38-73C5, which states thus the following acts among other are declared to be loud disturbing and unnecessary noises and violation of this article.
[8:55] But this enumeration shall not be deemed to be exclusive.
[8:58] The using operating or permitting to be played used or operated of any radio, television,
[9:05] tape, or record player, amplifier, musical instrument or other machine or device used
[9:10] for the production, reproduction or a mission of sound.
[9:15] Directive action for said violation is to 24 hour notice to discontinue loud and disturbing
[9:20] noise in the neighborhood. Any future violations can lead to a special magistrate hearing.
[9:26] This case began based on a complaint from a neighboring residence due to previous history,
[9:33] a notice of violation was posted to the garage door on June 2nd, 2026, requesting that
[9:38] the noise music being played cease.
[9:42] On June 3rd, 2026 an officer went to reinspect the property and heard no music being played.
[9:50] Since then, the complainant, Chris Ando, came in to provide an affidavit of witness stating
[9:55] that the music playing has continued and has not stopped.
[10:00] Per his affidavit, he states that the music was being blasted on the following dates and time. July 31, first, 2026, from 830am, past 6pm. August 1, 2026, from 8am, past 4pm, and on August 2, 2026, from 830am, past 530pm. The complainant also provided video of music being played.
[10:25] Notice of hearing was posted on June 11, 2026 at which time I heard no music coming from the property.
[10:34] The city requests that if the property is found to be in violation and a violation occurs again after this hearing,
[10:40] that the property will be treated as a repeat offender,
[10:43] and citations will be issued based off affidavit stating that a violation has again occurred.
[10:57] Anything else?
[10:59] No, you're on.
[11:01] All right.
[11:01] Do we have anyone here for the property owner?
[11:04] We have the property owner as well as the component out here.
[11:08] But at the stand right now, or the property owners?
[11:13] One may ask the property owner first to feed an introduce yourself.
[11:18] And let me ask you if you have any questions for the officer.
[11:24] My name is Evelyn Rosalie, I'm the daughter.
[11:28] My name is Maria Rodriguez.
[11:32] What's your name, First Lady Evelyn?
[11:35] Yes, Evelyn Rosalie.
[11:38] I used to be a lesson, Rosalie.
[11:40] Yeah, R.O.S.A.L.Y.
[11:45] Okay.
[11:46] And he's with me?
[11:47] My mother Maria Rodriguez.
[11:55] And which one of you is the property on?
[11:58] That's my grandma, but she passed away, so it's my mother.
[12:02] Maria Rodriguez.
[12:07] Did you have any questions for
[12:11] No, I know when she came, my mom explained to me that they didn't hear music.
[12:16] My mother does play music, but at the times that they took all compliance, people came,
[12:22] they said that it didn't reach the decimal for it to be loud, it just echoed.
[12:28] She doesn't play until she does play, like if she's doing yard work or cleaning the back,
[12:34] which is like a Bluetooth speaker.
[12:39] but all day she does not play it all day.
[12:48] All right.
[12:48] Let me ask the city then.
[12:50] Do you have any other evidence to present?
[12:53] No.
[12:53] This is based off of an affidavit.
[12:55] So it's going to be based off of Christopher
[12:59] Andos.
[13:00] Affidavit that he wrote.
[13:04] And if I may.
[13:06] Your honor.
[13:07] I believe the complain is there.
[13:09] And we'll test if I answer.
[13:12] That evidence.
[13:13] All right.
[13:14] Would you like to present the complain it now?
[13:19] If the resounding is finished your honor, then yes.
[13:23] Well, let's finish with the, we'll go ahead and finish with the city's case.
[13:26] If you can wait around and then we'll see if the respondent has, as evidence as well.
[13:32] But when we screen, we'll go through the city's, you know,
[13:37] with.
[13:37] My name is Chris Ando.
[13:44] Good evening. Hello. Hello.
[13:45] You stay in an employee place, Chris.
[13:48] Yes, CH, R-I-S, O-N-D-O.
[13:54] O-N-D-O, O-N-D-O, O-N-D-O, O-N-D-O.
[13:56] Yes.
[13:57] All right, let's start on a quick.
[13:59] I was started on Christmas Eve.
[14:05] Woken up to loud, something music, early in the morning,
[14:10] same thing, Christmas, called the Sheriff's Department,
[14:12] called Code Compliance, Kansas getting kicked in the circles over and over again,
[14:16] Nothing's getting done, we finally went to court, a week or two ago, the judge cited them a fine for
[14:25] that.
[14:25] That has to do with the word that was being aggravated by music.
[14:29] Yeah, no.
[14:30] When we would call the sheriff's department, they would either not respond or they would respond
[14:35] hours later, same thing with code compliance.
[14:38] So we started taking videos and I have videos of this loud obnoxious music.
[14:42] And a lot of times I'm working in my garden, when they see us,
[14:45] Music suddenly gets cranked up even louder and it's absolutely absurd and ridiculous and I have videos
[14:51] And I would like to play for you guys
[15:00] There's a lot more, but, yes, I have videos of the most recent occurrence.
[15:08] All right.
[15:08] We try talking to them.
[15:10] No, if it's old for the window.
[15:12] It's speaking, then you call the cops and the cops even said it's louder.
[15:15] One at a time, please. One at a time.
[15:17] I'll let you go.
[15:18] Let you ask questions.
[15:20] Yeah, let me let me let them answer on the test.
[15:22] Okay.
[15:25] And I love music.
[15:27] I'm a musician.
[15:29] But there's a time and a place for things.
[15:32] Eight, nine o'clock in the morning is that when you crank the music like a smarter garage and have in the speakers facing my house, that's not okay
[15:39] And that's why I have all these videos where I think any reasonable person would look at these and say this is not okay
[15:46] They wouldn't tolerate it and that this is escalated, and that's why we're here today
[15:54] And tell me again the hours that you've had this issue early in the morning
[16:00] It's random. I can't predict one. It's gonna happen next
[16:03] It hasn't happened in about two weeks, but it's occurred in the morning, just afternoon.
[16:10] It's happened late at night.
[16:12] It's extended hours.
[16:14] But usually most times I experience this is early in the morning.
[16:18] You don't play music.
[16:20] Okay.
[16:21] For now, until we play music.
[16:22] All right.
[16:23] Yeah.
[16:24] Did you want to play or just the city want to play the videos?
[16:28] I think you're included in the exhibit.
[16:30] Yeah.
[16:31] Okay.
[16:31] They're not up for the law.
[16:36] Yes, Your Honor, I think it would be helpful.
[16:38] All right.
[16:38] Why don't you play them with them, Mr. Under?
[16:39] If you want to narrow it, it gets to test me about the circumstances.
[16:43] Okay, so here, this is me.
[16:45] I'm sitting outside of my patio trying to read
[16:48] which is something I like to do.
[16:51] And this is what I'm met with.
[16:57] I'd like to enjoy some peace and quiet in my backyard.
[17:02] But I can't because the neighbors
[17:06] Okay, did that five, nine, five, Tyler Avenue?
[17:10] What a blast for music again.
[17:31] Would you like another one, or?
[17:34] I mean, but I couldn't hear the music.
[17:36] Yeah, I couldn't hear the music on that one.
[17:37] Here, your voice.
[17:38] Thank you.
[17:39] You're talking on the video.
[17:42] Here we go again.
[17:44] Namers, blasting music.
[17:49] This prevents me from being able to enjoy peace and quiet on my own patio.
[17:53] And
[18:00] I've reported this to the City of Delphano Cowboys Times, I've provided videos, audio recordings,
[18:10] witness statements, appicabets, Cowboys compliance in the City of Delphano.
[18:18] Does it enforce the only room regarding this?
[18:25] And these are the same videos that are in your separate videos.
[18:30] Right, these are the ones that the city provided.
[18:33] Yes, those are up there.
[18:35] I give them the one moment. I'm going to play the club.
[18:38] Yeah, I have here because I think I'm not hearing everything through the transmissions.
[18:43] I'm just here directly to a moment.
[19:15] All right, see, is this representative of the kind of music that you've heard that you've been tested by about?
[19:21] Yes.
[19:21] I don't care what kind of music it is playing at that loud facing my house is not okay
[19:28] I don't care if it's rock country Chinese music. I don't care it's too loud
[19:38] All right, I can hear it. I can hear it. I can hear it on the videos
[19:41] He don't want to play it locally supposed to open the and other neighbors play music and I love it when people play music around me
[19:48] And I want people around me to play music and be happy and positive
[19:54] But the cranket like that is ridiculous
[20:00] Anything else? Do you have any questions for Mr. Toronto?
[20:07] No, you're on it.
[20:08] Does rustle do you have any questions from Mr. Toronto?
[20:12] No, I do not. I mean, I know every time the police come, they tell us that we could play the music.
[20:20] My mother plays it, and it's not a everyday thing. He may have videos, and it's not a whole day thing.
[20:27] I mean, I work most of the days of the music is being played as my mom, but you know, I'm just here, of course, to, you know, be her witness and stuff like that.
[20:40] It's not all they think.
[20:43] So are we not allowed to play, you know, she's not allowed to play music, because every time she plays, it's going to bother her more, you know.
[20:51] Well, that's what we're going to determine.
[20:55] All right.
[20:56] Does the city have any other witnesses?
[20:59] No, you're on or no other neighbors have come forward.
[21:04] So I'll receive that city.
[21:06] See what we did.
[21:06] I'm going to let me turn to you, Mr. Rosalie.
[21:08] Mr. Rodriguez.
[21:10] Do you really have a seat?
[21:10] Do you like to present or test a lot?
[21:14] No.
[21:15] Can you repeat yourself here, please?
[21:19] Yeah.
[21:19] Do you like to testify about what the circumstances
[21:22] on the situation is?
[21:23] If you testify, that's you can do that.
[21:26] my mom. You don't want to be. Oh, no, I'm just speaking. Yeah, no, that she just basically
[21:35] with that with the music part. Like, what is the how many times are they going to call
[21:38] the shift department? Because we do get the knocks on the door, but they do tell us, like, play
[21:43] the music and the times that the co-compliance came. They tested the decimal and they even told
[21:50] us clearly that it's not reaching the decimal for it to be a nuisance or to be loud or disturbing.
[21:56] So I'm confused.
[22:00] All right. Well, let me just, because I'm looking here, just like, is there a decimal threshold in the ordinance?
[22:08] One minute you are.
[22:10] There is your owner. It's Section 38-71.
[22:17] For residential, the sound level is 60 between the hours of 7 a.m. to 10 p.m. and 55 after 10 p.m. to 659 a.m.
[22:30] Do we have any any evidence of the actual decimal levels?
[22:34] I mean, they can't tell from the videos.
[22:37] I can certainly hear the music, but I don't have any way, you know, I can't tell from hearing
[22:42] what the festival was, is there any evidence of that?
[22:48] I have not gone, every time I've gone out there, I've not heard music being played, I think
[22:52] prior to, with other cases, there were the decibel meters were brought out with the dogs
[22:59] in the bird chirping and I believe the music as well so that's that was a case that's
[23:06] already been closed and it was found all within within the range.
[23:13] Just so I'm clearly
[23:14] the decision 38 when someone requires a decimal measurement in order to find the violation.
[23:20] There's no other way. I wish that let's you find that it says if the noise is based on other
[23:25] testimony remains. Your Honor, it doesn't require that that is found.
[23:40] Tell me what
[23:41] I just don't have the right front of me.
[23:42] What is it require regarding the decibel level?
[23:48] It is, so it says maximum permissible sound levels
[23:50] by use occupancy, no-person shall operate.
[23:53] And this is for the record, 38-71 sound limitations
[23:57] established, applicability, C.
[24:01] No-person shall operate or cause to be operated.
[24:03] Any source of sound from any occupancy
[24:06] and such a manner as to create a sound level
[24:08] which exceeds the limit set forth
[24:10] for the use occupancy category in table one,
[24:14] more than 10% of any measurement period,
[24:16] which will not be less than 10 minutes
[24:17] when measured at or beyond the property boundary
[24:20] of the land use from which the sound emanates.
[24:22] For residential, which is the area that they're in,
[24:26] the 7am to 10pm, the sound level is 60,
[24:29] and after 10pm to 659am, it's 55,
[24:33] or the decibel levels.
[24:37] But looking at Section 38.73 it appears that a code violation can be found to exist when
[24:47] disturbing loud or unnecessary noises are such that even though not measurable, it may not
[24:55] actually be the limit set up.
[24:56] or maybe it says it's a financial unusual,
[24:59] so I rather watch it down.
[25:01] It looks like it's not required under that provision. Am I reading that correctly? I just want confirmation. I don't have the whole article in the moment.
[25:09] Your Honor, I think you're reading it correctly. I don't think you have to actually measure the decibel to make a finding.
[25:20] All right. That's very good. All right. Ms. Rosalie of Ms. Rodriguez, do you have any else?
[25:25] No, so basically, that doesn't matter, right?
[25:28] But that's the move, so we were misinformed then.
[25:31] OK, that's.
[25:33] I'm not saying that it doesn't matter because the code does set
[25:37] with maximum decibel level.
[25:39] So if you exceed the maximum decibel levels, undoubtedly,
[25:43] there are consequences to the biology.
[25:45] Maybe other consequences, I don't have the order to confirm it.
[25:49] But under this section, that this violation would fall out,
[25:53] It's not necessary that there'll be proof of a particular decimal level.
[25:57] If there's other evidence that the noise was excessive on natural problem, unusual or otherwise detrimental.
[26:07] So the way the code provision is written,
[26:11] I'm much discharges found that finding a violation can be made without a measure decimal.
[26:19] But that isn't just a noticeable level as a relevant because there are probably other things that can happen.
[26:28] But anyway, did you have any other tests or other evidence you'd like to present?
[26:33] No.
[26:35] And does the city have any questions for the property owner?
[26:40] The property owner has someone here with him that lives at the same residence as him that would like to speak.
[26:48] This is a complaining or someone on the defense side.
[26:54] Complain it. Complain it, but no, but no affidavit has been put in from her.
[27:00] All right. Go ahead. Have you been sworn in?
[27:02] Yes, sir.
[27:04] All right. If he's giving you full name, please.
[27:06] My name is Sandra Carlibitch.
[27:09] You spray your last name?
[27:11] K-A-R-L-O-V-I-C-H.
[27:16] All right. He was pleased.
[27:16] I have lived at this residence for over five years and in the last year, it has become miserable to live there.
[27:24] Between the noise, the birds and whatnot.
[27:28] A couple weeks ago, we were out smoking a pork buck in our smoker on the porch.
[27:34] It started before 8 a.m. in the morning.
[27:37] It lasted until well in the afternoon on a Sunday.
[27:41] This is getting ridiculous.
[27:43] We can't enjoy outside. We can't go out in our garden without being assaulted by loud music.
[27:50] And it happens as soon as we walk outside. So it's not a coincidence. This is ongoing.
[27:58] No one should have to live like this.
[28:02] We've tried talking to them. We've made complaints.
[28:05] We have talked to the police who have continually ignore us and no one should have to live where you have to live like a Hermit, which is where we're at
[28:17] That's natural
[28:21] All right
[28:22] Um
[28:23] Miss Rose, did you have any questions for this witness?
[28:26] No, I don't because they make a seem like if my mom stands back there and wait until they go outside to start playing music
[28:32] I mean, I'm at work, so, you know, it's like if, I guess my mom has to stay in the back and wait until she sees them and start blasting music, that's something she wouldn't do, so I don't know where they're getting that from, and all honesty.
[28:49] All right.
[28:50] All right.
[28:52] Ms. Rose, would you have anything else you'd like to offer?
[28:54] No.
[28:55] Any other testimony?
[28:56] Any other evidence?
[28:57] No, you're on there.
[28:59] There's the city, everything else.
[29:01] No, sir.
[29:02] All right, from what the city is looking for, just so I can confirm this is a finding
[29:07] of violation that would trigger a repeat of thefts, a repeat violation if this occurs
[29:15] again in the future.
[29:17] Yes, Your Honor.
[29:18] They would have to be based off the site, an affidavit again.
[29:23] All right, so at this time that the city is not seeking to impose any sort of fine.
[29:33] All right. All right, very good. Well, based on the record evidence, including the exhibits,
[29:40] which we've reviewed, which include those videos that Mr. Honda submitted to the city,
[29:47] the testimony from both sides, I do find a violation of section 30, when 73 has charged
[29:52] given that a decimal reading is not a prerequisite to the violation. I think the evidence persuades
[30:00] Excuse me, that what is occurring here is prolonged and excessive, and it's certainly causing
[30:06] discomfort to residents of the city to open the testifying and it's testimony. I find to be
[30:13] credible and corroborated by the video that have also been submitted. Again, it may be a situation
[30:23] where if this took place over a brief period of time, it would be one thing that the
[30:28] thrill of this is ongoing and in the last or lengthy periods of time on given days from early hours,
[30:38] as the testimony has established throughout the day through the afternoon, and sometimes into the
[30:44] evening as well. So I will make a finding of violation as to the charge stated in the notice of
[30:53] in form of a fine, but this fine it does create a predicate for a repeat effects in the future
[31:01] which could include a more severe penalties. Is there anything else that the city needs
[31:07] in this case? No, you're honoured.
[31:13] All right, this resident is front race. I appreciate you coming in.
[31:16] You're free to go. You do need to be careful about this noise so that you're not back in here on repeat
[31:22] events. I will encourage you to be courteous and listen to your neighbors if they do ask you
[31:30] to turn the sound down so we can avoid this ongoing problem. But you do have a finding now
[31:35] and a repeat of events could result in, again, in more serious penalty. So I do encourage
[31:43] it urge you to try to be courteous and watch that sound. Also, we don't have this ongoing
[31:51] All right. Thank you, Your Honor. All right. Thanks for coming.
[32:00] Your Honor, next case will be D-E-L-2-6-0-3-2-A-N-B-1630 Westway Cross Circle.
[32:27] Good evening, Your Honor.
[32:29] Good evening.
[32:30] I'm Code Compliance Officer Janice Plasik. This is a
[32:38] Personal ID number is 813, 055, 010, 050.
[32:45] It was ruled on June 24th, 2026 that the property owner was given 30 days to come into compliance.
[32:51] The property owner did not come into compliance within those 30 days, and the property has
[32:56] been receiving a fine of $250 for violation A, and $100 for violation B, for a total
[33:03] of $350 per day since July 25th.
[33:07] As of today, the property has not reached compliance and has accrued a total fine of $11,000 to $200 over 32 days.
[33:16] The city requests that the fines continue at $250 a day for violation A.
[33:22] $100 for violation B for a total of $350 per day until the property has been brought into compliance.
[33:29] And that compliance has been verified by the code compliance officer.
[33:34] Thank you.
[33:34] Do we have anyone here for the property?
[33:36] No sir.
[33:39] All right. So I'll receive the city's
[33:40] Exhibition at this base on the testimony and the
[33:43] Exhibition but I will find the property remains
[33:47] and I can plan it. It's entering order and
[33:50] closing the finally amount of food amount to date of
[33:54] 11,200 dollars. And then if I will continue to
[33:57] run at the rate of 250 dollars per day
[34:00] violation.
[34:01] A, $100, the A for violation B, break the cumulative total of $300 per day that will run until this property has been brought into compliance with compliance has to be provided by the city.
[34:14] Is there anything else you need in this case?
[34:15] No sir.
[34:21] Yeah, on our next case will be DEL 260034 that's 1570 Puritans Street.
[34:39] Good evening again. I am Code Compliance Officer Janice Polasic. This is a massive case city of Deltona versus Charlene Williams.
[34:49] The parcel ID number is 813-021-220-090.
[34:55] It was ruled on June 24th, 2026, that the property owner was given 30 days to-
[35:01] The property owner did not come into compliance within those 30 days and the property has been receiving a fine of $100 per day since July 25th.
[35:10] As of today, the property has not reached compliance and has accrued a total fine of $3,200 over 32 days.
[35:18] The city requests that the fines continue at $100 per day until the property has been brought into compliance and that compliance has been verified by the Code Compliance Officer.
[35:27] Do we have anyone here for the property owner?
[35:32] No, you're on.
[35:34] All right, so to see the city exhibits in Amazon.
[35:36] It's based on the test one.
[35:37] The exhibits, uh, I find the property remains not compliant.
[35:41] It has a crude, uh, fines of $3,200 at $100 a day.
[35:46] For 30 days, be in a July 25th.
[35:49] So the overall reposing file will, uh, we'll set that amount.
[35:53] $3,000 plus, uh, the ongoing file of $100 per day will continue to
[35:58] run until this property has been brought fully in finance and from points to
[36:03] under a fight by the city.
[36:05] Trying to help the city needs in this case.
[36:06] No, you're on her. Thank you.
[36:12] Yeah, on our next case will be D.E.L.26-038.
[36:19] That's 1968 South O. Mill Drive.
[36:41] Good evening, Yana.
[36:44] I am co-compliance office at Tina Pagan.
[36:46] The city of the tone of verses,
[36:48] Burntala and Burnt jodiji. The parcel ID number is 813-00915-0160.
[36:58] It was ruled on July 22nd, 2026, that the property owner was given 30 days to come into compliance.
[37:07] In store the secondary drive we have crushed rocks without a permit, no permit obtained,
[37:11] sod has not been placed on the right away. The property owner did not come into compliance
[37:16] within those 30 days. And the property has been receiving a fine of 100 days. I mean, $100 per
[37:22] day since July 22nd, 2026.
[37:28] I'm sorry, this regard that. As of August 21st, 2026. As of today,
[37:39] the property has not been reached. It has not been reached compliance and has occurred a total fine
[37:46] of $500 over the last five days.
[37:50] The city will, the city request the fine continues
[37:52] at 100 per day until the property has been brought into compliance
[37:56] and the compliance has been verified
[37:58] by the co-compliance officer.
[38:04] All right, are you good?
[38:05] Do we have the property owner here?
[38:09] Yes,
[38:13] sir.
[38:13] Yes, sir, honor.
[38:14] I'm the property owner in Tyler Bern.
[38:17] Mr. Martin, do you have any questions for good officers?
[38:20] No questions at this time.
[38:23] Does the city have anything else to present in its case?
[38:27] No, just photos up to date.
[38:32] Those are in the exhibits.
[38:34] Correct.
[38:34] Once you show it.
[38:36] We're seeing the city's exhibits in evidence and Mr. Brownleman here from you.
[38:42] It was to my knowledge that I had up to today's date to get the issue corrected.
[38:49] I contacted a couple companies about getting sawed and I wasn't able to get the sawed due to it being out of season.
[38:56] And they said that given in a couple weeks I would be able to get the sod and have that
[39:01] replaced.
[39:02] But at this time I was able to get the top soil and I have a receipt with today's date
[39:06] for the top soil as well as photos.
[39:09] And I was also, yeah, that was that I'm sorry.
[39:15] I tell you what it is that you've got here.
[39:18] I have a receipt for the top soil mixed to replace the crushed rock.
[39:25] Because in that picture, the crushed rock from the front of the property has been removed.
[39:30] And then I have a receipt with today's date for the topsoil that has been replaced with it, as well as pictures with today's date.
[39:44] I'm looking at this sort of graph is from today, the one that's up on the screen now.
[39:50] Yes, that is correct.
[39:52] So that's not showing any topsoil.
[39:55] My pictures are at five o'clock this afternoon.
[40:00] It is evening? Yes. Your test, your test find that you've got top soil in the end, on that driveway, you just don't have the sign? Yes, and I have the receipt. The time for the receipt was today. You know what? It doesn't have an exact time, but my pictures have a time of about 5 o'clock PM.
[40:27] What is the size supposed to be installed? It's installed currently.
[40:31] What's currently installed?
[40:37] I can't see your photograph there, but why don't you show it to the officer?
[40:42] I'm not exactly sure how to input it.
[40:43] I'm sorry, I was attempting to print it.
[40:46] This is the only way I was able to provide it with a timestamp.
[41:10] It shows that five zero one PM today.
[41:15] Does it appear in the photograph to be compliant?
[41:19] The shot is there.
[41:23] Now we're just going to need to wait for the grass to grow.
[41:32] So, yeah, I can't see the photographs,
[41:37] but asking an option to go on.
[41:41] Does it, does it appear to be satisfactory
[41:43] as soon as the grass takes?
[41:46] Apparently, no, not at the moment.
[41:53] I just don't know if I don't work.
[41:56] Sir, give me a second.
[41:57] Yeah, give me a second.
[41:58] Surveys are looking over the photo also.
[42:01] Okay.
[42:10] The level down and it starts right at the front of the house.
[42:14] And I have this.
[42:16] This is the soil.
[42:17] This is the soil.
[42:21] Yeah.
[42:21] This is the soil.
[42:22] This is the soil.
[42:25] You know, Averquires is back to the angle.
[42:29] He just laid down the soil.
[42:33] There's no side currently at the moment.
[42:37] There's no side, Mr. Brown.
[42:39] No, there was I was unable to acquire any unfortunately.
[42:44] What's your plan with respect to the site?
[42:47] I was going to, I was, I contacted a couple of companies.
[42:51] They advised me to contact within a few weeks when it starts getting out of,
[42:56] they said the hot season and that I can get roles a little bit more readily available.
[43:04] And I laid seed for the meantime.
[43:05] I know that I don't know if that's an exact remedy, but I'm making every attempt I'm currently able to.
[43:11] All
[43:21] right, does city have any questions from Mr. Brown?
[43:25] Not at the moment.
[43:31] Did you say six weeks?
[43:34] They advised me.
[43:35] I was told a couple of weeks as in from my understanding about two to three weeks.
[43:47] Let me get a clarification from the city.
[43:50] I know a special time on this case last month.
[43:53] Just to get the opportunity to ask the details.
[43:57] If and when he lays down the side on that topsoil, assuming it's watered in and it grows,
[44:05] is he thening compliance?
[44:07] You start remembering what it is he needs to do.
[44:11] Okay.
[44:15] And you're saying, you've got a couple weeks to go.
[44:20] I actually have a question if I may for the city.
[44:24] If I didn't want side at all, if I wanted, as I've seen some properties,
[44:29] If I want to do my entire from property in a crushed material, how would I go about that?
[44:38] It will have to be the way is always currently done with a driveway expansion.
[44:43] That will have to be connected to the driveway and spread it on out.
[44:48] However, the right away is not allowed to be touched unless you have a right away permit.
[44:54] But my question is not to use as a driveway extension just for appearance purposes.
[44:59] this.
[45:00] I've seen many properties not have any grass or sod at all. They just have rock material.
[45:06] Yeah, that is correct. You could get a permit to get crosswalks in the area you want to put it on.
[45:11] Bring your survey to city hall, retrieve the permit, and then you show them where you want to put the crosswalks.
[45:17] However, it needs to be attached to us to drive way, even though you're not going to use it as a driveway expansion.
[45:23] But you can't do parts, broken parts like that.
[45:26] Okay.
[45:28] That answers my question.
[45:32] Then what you're asking Mr. Burr?
[45:35] Yes, it does.
[45:37] Based on that, what would be,
[45:39] at least if the moment you're attempting to lay the side?
[45:43] I think currently, it may be to lay the side until I can figure out exactly what I want my plan to be.
[45:49] At this time, I'm just trying to bring the property up to code, so that way we don't have to continue with everything we're doing today.
[45:58] I just want to bring the property up to code and then on my own time be able to take the necessary steps that I need to to make any changes that I want
[46:13] Can you get that sign laid down in the next 30 days?
[46:16] I think that should be possible.
[46:20] Water in?
[46:22] Would you say?
[46:24] Get it, get it, get it, get it, get it, get it, get it, water in and so then it will take and everything.
[46:27] So in three days we could look at a picture of grass.
[46:30] Yeah, that should seem a little bit a little bit more realistic.
[46:33] But
[46:37] here's what I'm going to do, then I do appreciate the fact that you've taken steps towards
[46:43] the plants.
[46:44] I'll be kind of skitted over the deadline by a few days and maybe a few more weeks based
[46:51] on the issue of the side.
[46:54] I accept your testimony about the timing issues and what you've been told by the landscape
[46:59] or the nursery folks, but nevertheless, there's still some work to do to bring this property into compliance.
[47:09] What I'm going to do is reserve ruling on the acquisition of the fines and lean today.
[47:16] I'm going to continue the case for 30 days to the next hearing that the one in September, whatever the day is.
[47:23] And have you come back in here and I'll decide then what to do, but at that time, I want to see pictures of
[47:30] sod on the driveway and hopefully be able to hear that you're in compliance, and then we'll decide what to do about the fine.
[47:41] That began to run on the 21st and $100 per day.
[47:47] I don't necessarily want to punish you excessively if you're working diligently to get this done,
[47:51] But we do need to bring in for landing and bring you into compliance, but based on your
[47:56] testimony about being able to get this completed in the next couple of weeks, I'll give
[48:01] you that additional time and as I have said, continue this for the next month and reserve
[48:07] growing and we'll take this up again next month and decide what to do based on the circumstances.
[48:12] But it looks like if it's not in compliance and you do have a plan that is running and
[48:20] If not to modify at some point, like at the next hearing, it's going to become a much bigger
[48:28] number.
[48:28] Understood.
[48:29] All right.
[48:29] This is Mark.
[48:31] All right.
[48:32] So again, it's be clear.
[48:33] I'll reserve on the merits here on the fine and I'll continue this until the next, until the next
[48:42] stock.
[48:42] And at that time, I'll hear the circumstances and say what they do.
[48:47] Again, my hope is that when we hear this case again next month, there will be pictures of grass on that driveway, and you'll be sitting and telling me you're in compliance, all right, Mr. Brown?
[49:00] Okay, thank you, Your Honor.
[49:02] All right, is there anything else you need on this one?
[49:05] No, that is what, thank you, Sir.
[49:07] All right, Mr. Brown, you're free to go, and we'll see you again next month, hopefully with good news.
[49:13] Thank you.
[49:17] Yeah, on our next case, we'll be fire 0, 3, 2, 2, 0, 2, 6, that's 12, 51, Providence Boulevard, Sweet 100.

[56:09] on July 22nd, 2026 for home owners son Kevin Kirch is to provide documents on the progress
[56:18] of the insurance claim, including probate case status. As of today, I have not received any documents
[56:24] from Kevin Kerch, nor any claims from a company. When I went today, out of three of the violations,
[56:32] one of the more fixed, which was the window, however, the garage door and the interior walls
[56:39] are still damaged.
[56:46] The city request a daily fine in the amount of $100 per day for each violation
[56:52] pass the information data totaling 200 a day.
[57:01] We've got two violations.
[57:02] Two violations.
[57:03] 100 dollars for violation.
[57:09] One.
[57:10] One violation.
[57:11] It's two separate violations, right?
[57:14] It's together as one.
[57:17] But it is separate.
[57:20] You're asking for a hundred dollars per day on two separate issues for a couple.
[57:26] Two hundred dollars.
[57:30] So, it's going to be for more, you know, we're going to combine it all on the one case,
[57:36] so we 100,000 per, you know, this case.
[57:42] That's a total of $100 fine there.
[57:44] For both violations, I guess, $100 a day.
[58:06] Do we have the property on here, and if he was here last time, or the representative was?
[58:15] No, no one's here.
[58:22] and you have a spoken and a secret?
[58:24] I spoke to him on Saturday, past Saturday, and I informed him that no one is reached out to me.
[58:34] No, that I received any emails because he stated that there was going to email me some information,
[58:38] but did not receive any.
[58:42] Why does the city ask me these files to be what's the compliance data that they want to buy?
[58:47] It's a command to get us home to the school here.
[58:49] Starting today?
[59:07] So he hasn't given any of the information that was provided in the water.
[59:11] No documents whatsoever.
[59:17] So we've received the city's exhibits and evidence of making finding
[59:20] violation as the charges in the notice.
[59:25] We're going to start the daily client running today.
[59:29] And just so I'm clear the city's asking for a total of $100 per day.
[59:33] That is correct. $100 per day.
[59:36] So we'll start to find a daily fine of $100 beginning today or rather we'll
[59:48] start to find, let me back, let's start to find beginning to run on August 27th, so we'll start to find tomorrow and that.
[1:00:00] Finally, we'll run at $100 per day until the property has been brought fully into compliance and compliance has been verified by the city.
[1:00:10] Is there anything else that the city needs on this case?
[1:00:13] No, that'll be all. Thank you, sir.

[1:04:31] And you understand the city's asking for a compliance statement of October 26?
[1:04:37] City.
[1:04:39] The city is asking for it's asking the even given 60 days to bring the property in the

[1:04:48] Yes, I understand.
[1:04:50] All right, did you have any response to that?
[1:04:53] Uh, right now I'm just currently working on, like I said, the AC and hopefully everything is good.
[1:05:02] Okay. All right. So based on the testimony of Bernie and the Exhibity Amments, I defined the violations.
[1:05:16] A set of orders are established, so I'll make my violation.
[1:05:19] We're going to set the compliance data as recommended to October 26th to May 26th, if you've
[1:05:25] about 60 days, you're still gathered to get this prior pre-indic compliance in a
[1:05:30] point and create it fine. If the property remains not compliant, beyond that date, we'll
[1:05:36] start running a daily $250 per day on October 27th and that plan will continue to prove until
[1:05:41] the property is brought fully into compliance with plans that have been verified by the city. Does

[1:06:03] So, you can avoid the penalty, all right? All right. Thank you.
[1:06:07] All right. Thanks for coming in. Pretty good.
[1:06:12] John, our next case will be DEL26049, A&B, 1149, Lyric Drive.
[1:06:48] Good evening, yonder.
[1:06:50] Good evening.
[1:06:51] My name is Enrique Rios.
[1:06:52] I'm a employed by the City of Delton as a co-compliance officer.
[1:06:56] This will be case number DEL26049, A&B.
[1:07:01] City of Deltono versus Victor Modelline and Gen. T. Prisindo.
[1:07:06] The parcel ID is 813-040-310-160. Again, that's 1149-leric draft. Deltono Florida 32738.
[1:07:17] The violations are as follows.
[1:07:20] Violation A, this is a violation of the City of Deltono Ordnance Section 185,
[1:07:25] which adopted the latest edition of the International Property Maintenance Code.
[1:07:28] Section 305.3, which states interior surfaces, including windows, and doors shall be maintained
[1:07:34] in good clean and sensory conditions.
[1:07:38] Peeling, chipping, flaking, or a bread pane shall be repaired, removed, or covered, cracked,
[1:07:45] or loosened plastic, decayed wood and other defective service conditions shall be repaired.
[1:07:50] Corrective acts of separation is to repair and replace interior service to include holes
[1:07:55] the ceiling in the kitchen and or living room area on the fence. Excuse me. The repairs must be
[1:08:03] must meet all requirements of sea ordinance and be approved on final inspection.
[1:08:11] Files should be, this is a violation of the City Delta Award in section 185 adopting the latest
[1:08:16] edition of the International Property Maintenance Code section 504.1, which states that all plumbing
[1:08:22] fixture shall be properly installed and maintained and in working order.
[1:08:26] And shall be kept free from obstructions, lease and defects, and be capable of performing
[1:08:31] the function for which such plumbing fixtures are designed, corrective action for said violation
[1:08:36] is to repair or replace the damaged plumbing.
[1:08:40] Statutory requirements for notification of the hearing have been met by the notice of hearing,
[1:08:44] and notice of co-violence were censored by most of the property owner, at the address listed
[1:08:48] with the property operator's records.
[1:08:49] In addition, both notices were posted on the property and that city hall at least 10 days prior to the year.
[1:08:57] All of the evidence in this case, including photographs, have been marked as exhibits and submitted to the special magistrate clerk.
[1:09:05] I certify any and all photographs to be true and accurate portrayals of what I observed on the days they were taken.
[1:09:15] As it pertains to violation A, on July 1st, 2026, I arrived at the property in response to a complaint for unresolved plumbing issues.
[1:09:29] During the inspection, I met the complainant and primary tenant of the home Tiffany Alfred, who stated plumbing issues have existed for several months.
[1:09:38] And contact with the homeowner was limited in pretty much non-existent, including up to and
[1:09:46] including the repairs and overpares were being performed at that time.
[1:09:51] There were plumbing issues for existing plumbing issues from January 26 and which one of
[1:09:58] two bathrooms.
[1:10:00] One of two bathrooms were repaired. And one repair remained present. And so the leaking was occurring through the ceiling in the kitchen from the upstairs, one of the upstairs bathrooms.
[1:10:16] And this was, again, violation A is for the interior surface. You can see there are holes in the ceiling there. And that is where the repairs began, but are still incomplete and those holes still exist.
[1:10:30] And if he was posted to the property on July 3rd, 2026, and notice of hearing was posted,
[1:10:43] excuse me,
[1:10:47] I noticed a hearing was posted on August 12th, 2026.
[1:10:54] As it pertains to violation B, for damage plumbing, this violation is consistent with violation A, and subsequently a notice of violation was posted on August 4th.
[1:11:03] in the 2026 and on excuse me on July 4th, 2026 my apologies to not to lie
[1:11:12] 9. When the leaking pipes were first observed and NOH were notice if hearing
[1:11:18] was posted on August 8th as well, 2026 on August 19th, 3 inspection or the latest
[1:11:26] physical inspection was found that the leaking has extended to the kitchen area and
[1:11:33] There's a small or short video of the kitchen leaking,
[1:11:37] and let's see if we can pull that up right here.
[1:11:40] This is pretty significant leak.
[1:11:43] Whereas leaking in the ceiling was much slower
[1:11:45] and harder to capture on film, but still present.
[1:11:51] So let's go
[1:11:56] here.
[1:11:56] Currently, the property remains in violation,
[1:11:59] and is therefore being brought to magistrate, of course,
[1:12:02] here.
[1:12:02] In closing, the city would like to request $50 per day
[1:12:06] per violation for a total of $100 per day until the property for the property coming to compliance
[1:12:14] Until the property coming to compliance until such a time that the property owner
[1:12:18] Notifies the city of compliance. Excuse me.
[1:12:25] What's the supply say you recommend it? Excuse me one day
[1:12:31] August 31st
[1:12:31] This coming Monday.
[1:12:36] All right. Do you have anyone here on behalf of the you have the property owner?
[1:12:40] We do not have the property owner contact has not been
[1:12:44] made whatsoever between the tenant or the officer with the property owner we've tried to do
[1:12:50] people searches and make contact and no contact has been successful. We do have the tenant or the
[1:12:58] complainant present. They have not been sworn in. I'll say that.
[1:13:04] Did they want to speak? Does
[1:13:05] they want to speak?
[1:13:09] Yes, she does. If she would have a moment to make her wait. All right.
[1:13:21] and let me get your name please. Tiffany Alfred.
[1:13:26] Tiffany Alfred? Yes.
[1:13:29] All right, uh, uh, we use form in previously? No.
[1:13:34] Right, once you raise your right hand for it, please. You swim more from the test when you're
[1:13:37] about to give me the truth, all truth, and nothing but the truth. I do.
[1:13:41] And just Tiffany, would you say the last name for us in spelling please? You've got a correct
[1:13:44] in the record you? Alfred, A, L, F, R, E, D. All right, I just don't need sounds. Very good. Go ahead.
[1:13:50] We obtained the property. We originally had a property management company that we went through.
[1:13:57] This leaking actually has started occurring November 22nd and our rent was paid in full all the way up to February.
[1:14:04] So when we started getting the backlash of why the repairs weren't done,
[1:14:08] but we had given a substantial amount of money out front to move in the home over $17,000 substantial amount.
[1:14:13] Um, the AC had went, that got fixed, and then I was told that a death certificate needed to be got on the house because the wife had passed away.
[1:14:21] So we couldn't take out a loan to fix it. I have never to this day met the landlord.
[1:14:26] I've never had a verbal conversation with him. It went through the property manager.
[1:14:30] And when the, I sent a notice of intent to withhold rent in January due to the plumbing still not being fixed.
[1:14:36] She then, I guess, fired him as a client. So she wouldn't even maintain the home anymore.
[1:14:41] So when that happened in February, we have our lease was coming up in June and we were supposed
[1:14:49] to renew our lease.
[1:14:50] When I stated to a family friend that I wasn't paying for the plumbing repairs out of my own
[1:14:54] pocket, I then was told that the lease won't be renewed and I'll be addicted.
[1:15:00] So it's been a pretty eventful task here.
[1:15:06] Yeah, I can tell. All right. Well, let's see what we can do here to get this straightened out.
[1:15:16] Does the city have anything else?
[1:15:21] No, y'all.
[1:15:23] All right. So I'll receive the cities in September to November. So based on the testimony in the exhibits,
[1:15:29] I would like to find a violation as to these charges stated in the A and B in the
[1:15:37] in those violation.
[1:15:40] We're going to set for compliance day two, August 31, 2021, 2016, I'd recommend
[1:15:44] the different compliance.
[1:15:45] It's not achieved by that day.
[1:15:47] Then we're going to start running a daily fine of $50 per day per charge, A and B per
[1:15:52] total of $100 per day.
[1:15:54] That will begin running the day after, August 31, and we'll run until the property is fully
[1:15:58] to buy and compliance has been verified by the city. Is there anything else to see
[1:16:04] you need to in this case? No, thank you, honor. Thank you. Thanks for coming in.
[1:16:11] So, Alfred, you're free to go.
[1:16:14] Good luck to you.
[1:16:17] Your honor, next case will be D-L-2-6-0-5-0. That's 3-0-3-L-Nora Avenue,
[1:16:28] You
[1:16:58] are maybe I can make this short.
[1:17:01] There was appeal requested on a vehicle abatement at this location.
[1:17:06] The requester is not here.
[1:17:08] If you allow us, please continue.
[1:17:10] We continue the abatement process starting tomorrow morning.
[1:17:16] All right.
[1:17:16] You want to continue this next month?
[1:17:19] No.
[1:17:19] If you allow us to continue the abatement process in our end,
[1:17:22] we can tow the vehicles tomorrow.
[1:17:25] Oh, oh, oh, oh.
[1:17:26] Yes.
[1:17:27] The request is not here and if we don't need to present this case, you'll allow us to move forward on the
[1:17:34] abatement on our end.
[1:17:39] You just need a unit order of that fact to authorize the city to move.
[1:17:47] Correct.
[1:17:47] If you could give us an order to continue and we could bait it tomorrow.
[1:17:53] I'll order that order.
[1:17:55] I'll receive the cities.
[1:17:56] If it's a Japanese one, I'll order that order of abatement.
[1:17:59] Yana, do we need to read this there?
[1:18:02] Yeah, I would go ahead and read it in so that it's a record clear, but
[1:18:10] just the moment you're on
[1:18:34] it.
[1:18:35] You can do it abbreviated and read it.
[1:18:39] All right, bear with me just a moment.
[1:19:03] I'm going to go compliance officer and re-careos once again.
[1:19:05] I'm going to play by city of Deltona.
[1:19:08] City of Deltona versus John Baker staff, partial ID is 813, 063, 190, 010.
[1:19:16] This is a violation of the City of Dalton Award in 1666-56, a violation of the
[1:19:22] ordinance, which states that all of the vehicles that are inoperative, wrecked partially
[1:19:28] dismantled or otherwise mechanical and capable of being operated in their present condition
[1:19:32] or without a current state license tag of a required or a current state of a required
[1:19:37] to be prohibited on any public right away or under any circumstances or on public property,
[1:19:42] except within a completely enclosed garage, or when such vehicles are permitted,
[1:19:48] are permitted principle use or special exception in any zoning classification.
[1:19:54] Corrective action for said violation is to obtain a tag and or repair an operative vehicles
[1:19:58] or stored in enclosed garage.
[1:20:02] Essentially, the case began on June 26, 26, 26, as a result of proactive inspections in the area in conjunction with other violations that property was observed to have several vehicles missing license plates and or an operable.
[1:20:17] But door hanger was left describing the violation and corrective action on July 8th and 9th,
[1:20:23] a statement notices were posted and censored a five mail.
[1:20:27] First contact was made on July 9th as well with the homeowner John Baker's staff,
[1:20:33] where we're an ordnance information and corrective action we're clarified.
[1:20:36] His appeal was submitted on the 15th of July 26th,
[1:20:45] And that essentially is where we stand today.
[1:20:49] It appears based upon inspection, as well actually,
[1:20:52] today that the violation of the abandoned vehicles has been resolved
[1:20:58] and other violations exist.
[1:21:00] In cases will continue on the property for a proper parking,
[1:21:04] as he continues to resolve his parking situation,
[1:21:07] where he still has several vehicles and a proper parking
[1:21:12] continues to be a problem for him, so if he or if he is the comeback out of compliance with the
[1:21:18] event of vehicles, we do seek, again, a repeat,
[1:21:26] to answer the question.
[1:21:29] So, as I said, obviously this city is in the city of Barcelona, it's based on the testimony
[1:21:33] of the exhibits I'm going to find that there is a new sense on the property based on the
[1:21:41] because of the abandoned or on license to be able to show in the photograph.
[1:21:46] So, a citizen of question order, allowing the, the
[1:21:51] the movement of this uses by the city against to, to remove those vehicles.
[1:21:56] So, I'll enter that order.
[1:21:59] Thank you, honor.
[1:22:16] You're on our next case will be DEL 26051.

[1:45:42] Were you sworn in?
[1:45:43] No.
[1:45:44] You're on a, she's going to need to swear.
[1:45:48] Who do we have?
[1:45:49] My name's Lauren Hendry, H.E. N. D. R. Y.
[1:45:52] I'm the regional manager for Integralist.
[1:45:56] All right.
[1:45:56] I'll make it.
[1:45:57] Swarin, would you raise your right hand phone please?
[1:46:01] Is swear or from?
[1:46:02] That's why you're brought together.
[1:46:03] Will be the truth, the whole truth, and nothing but the truth?

[1:46:10] Swarin, Henry.
[1:46:11] Swarin, Henry.
[1:46:11] H-E-N-D-R-I.
[1:46:14] First of all, do you have any questions for me?
[1:46:17] I've pretty expectance, the option.
[1:46:19] I don't think so.
[1:46:21] I was told though by the staff that...
[1:46:28] That A was completed?
[1:46:31] No, you're not.
[1:46:32] The backflow?
[1:46:34] No, that was not completed.
[1:46:36] If it was, we didn't get anything on it.
[1:46:38] So from dynafire.
[1:46:39] Okay.
[1:46:39] So let me get with dynafire then because that's what...
[1:46:43] Okay.
[1:46:44] That was my only question.
[1:46:47] All right.
[1:46:48] Do you have any testimony you'd like to give?
[1:46:50] I will say that, yes,
[1:46:55] we've had a management change there over this past month,
[1:47:01] so what we have signed the contract for B for the fire extinguisher, not extinguisher, but the sprinkler, all the sprinkler stuff, and they did, or we paid the deposit.
[1:47:17] that I have the proof that we paid the deposit to get the parts ordered, I guess they needed
[1:47:21] the deposit, half of it, to get the parts ordered.
[1:47:24] So we sent them that, then we're told by Dynafire that it took a while to get the parts.
[1:47:30] We wouldn't have them right away.
[1:47:33] So he sourced them out through someone else, I guess, but he was able, we don't have them
[1:47:38] yet, but they did anticipate them getting them soon and he said he has scheduled it to
[1:47:45] on September 2nd, and it would take three days, so September 2nd, to September 4th, he said it would be done.
[1:47:54] As long as they got the parts right before then, which he didn't think they would have an issue getting them before then.
[1:48:03] That was for B, I guess, and for C,
[1:48:10] the copies of the fire sprinkler inspections.
[1:48:15] So, I guess my question there would be we were requesting them on site when you were there and we did not have them, or
[1:48:22] Yes, ma'am, and it was sent through all the inspection reports we've been sending.
[1:48:26] Okay, and then does dinifier provide you those or we provide you those?
[1:48:30] You, you general will get them from your contractor and then provide them to us.
[1:48:34] Okay, so I did are currently our new manager started last week and I do have some that dinifier provided for us.
[1:48:40] I don't know if that's what you were looking for.
[1:48:42] I'd be happy to provide them for you.
[1:48:44] Just the interest ever is time.
[1:48:45] I don't want to have to go through all of them.
[1:48:47] That's fine.
[1:48:47] You need to email them to me.
[1:48:48] Okay, perfect.
[1:48:49] Thank you.
[1:48:49] Can I get your email address before we go then?
[1:48:52] Yeah, that's it.
[1:48:54] I guess that was it.
[1:48:56] So I would request that you give us a little bit of extra time
[1:49:01] because we do have it scheduled.
[1:49:03] And I can double check in the morning
[1:49:06] the violation A for that backflow and everything
[1:49:09] because I was told that was fixed.
[1:49:11] So I can check with Dynafire on that.
[1:49:15] Well, we're going to set it to five states thirty eights out so that should be plenty of time given what you just told me.
[1:49:21] Correct.
[1:49:22] The princess act as September flight there.
[1:49:25] Okay.
[1:49:26] All right.
[1:49:27] So anything else, Ms. Henry?
[1:49:30] No.
[1:49:30] Do we get charged fines though?
[1:49:31] Or only if we don't do that by the 25th of September.
[1:49:36] If only if you don't do that as September flight there.
[1:49:38] Perfect. Thank you.
[1:49:40] All right, so I'm going to receive the city's exhibit today. I'm going to space down the testimony and the exhibits I'm going to make the final violation as to the charge.
[1:49:47] It's important to notice and identify as A, B, and C.
[1:49:54] And we're going to set the compliance date with the correction of these violations out 30 days to September 20.
[1:50:00] 25, 2026, if these violations continue past that date, we start learning a daily $200 per day for a count.
[1:50:08] I'm sorry, on September 26, 2026, I'm learning until the point has been achieved in a verify by the city.
[1:50:15] If the assembly have these cleared up and corrected in verify prior to that, the blind state, then you will not incur that daily fine.
[1:50:23] So, you are encouraged to get that done with that penalty. Is there anything else that city needs on this one?
[1:50:28] No, you're on it. Thank you.
[1:50:31] Thank you sir.
[1:50:32] Henry, I think that's all right.
[1:50:33] Thanks for coming in.

[1:53:03] the property from the airs was agreed upon. The current owner brought the property into compliance
[1:53:09] on June 23rd, 2026.
[1:53:15] The city's operational cost for the case number DEL24-067 is $3,550 in 50 cents, reflecting the
[1:53:29] administrative and operational expenses occurring in-curring, excuse me, by the city,
[1:53:38] including but not limited to code, office hours, administrative staff, processing time, and
[1:53:48] city's vehicle time.
[1:53:51] The city does not have any recommendations at this time to request full recovery of the
[1:53:58] 17,250 dollars and outstanding fines owed by the property owner.
[1:54:04] The property owner is requesting a reduction from $17,250 to $1,500.
[1:54:14] That's it.
[1:54:18] All right.
[1:54:18] Thank you, Officer Taylor.
[1:54:21] And I see Brendan Schwam here.
[1:54:25] And I see the production request.
[1:54:28] And I don't know if you heard earlier.
[1:54:29] Did we get you sworn in?
[1:54:31] Yeah, I was here at the beginning.
[1:54:33] Okay.
[1:54:36] And so you've got the floor, why don't you walk me through your request?
[1:54:44] Yes, so obviously he passed away in the beginning of 2024.
[1:54:52] He was estranged from his two daughters.
[1:54:56] They did not even know that he had passed away.
[1:54:58] we ended up tracking.
[1:55:00] Taking them down through genealogy work, we purchased the property, got the property right into compliance
[1:55:10] the second. We had ownership of it. Ironically, the fence was not even the fence of the
[1:55:20] owners. It was the neighbor's fence, and so we had to get their permission to take it down. And
[1:55:27] it was just on our line, or a lot of line.
[1:55:32] So we got the permission of the neighbors to take it down.
[1:55:35] And that was how we got into the compliance.
[1:55:38] The neighbors got the neighbors and put the fence up,
[1:55:40] but it was encroaching on what had not been locked.
[1:55:44] Mm-hmm.
[1:55:46] And yeah, I mean, that's the, you know,
[1:55:49] obviously we've bought in dozens of property
[1:55:51] and city of Dalton over the years.
[1:55:53] We've always played by the rules.
[1:55:54] we always did and acted as fast as you guys requested and you know I don't want to be punished
[1:56:00] in order to want the airs to be punished for you know doing something we didn't do and wasn't
[1:56:06] really even on our you know it's not even really ours let me just to understand the chronology here
[1:56:18] the owner of the property at the time of the violation.
[1:56:23] It was David Price.
[1:56:26] He passed away in February 2024, according to your request.
[1:56:31] I guess it was later that year that the violation was found.
[1:56:35] It finds we began to run and they ran a long time.
[1:56:41] Because what you're saying is you discovered the errors in Pennsylvania,
[1:56:45] it, assembly years later.
[1:56:48] Come right here, we obviously, our model as we track down properties that are
[1:56:55] delinquent on property taxes that the errors are unaware that they, you know, are the beneficiaries
[1:57:02] of the estate and so we saw that it was going to go to auction at some point the end of
[1:57:08] this year and so we found them and notified them with their dad's passing and then obviously
[1:57:14] we paid for the probate to get into their name and kind of handled everything from there.
[1:57:21] Okay, this was really going to be the next question is that how you can get involved in this
[1:57:25] just a part of a business that you like a property acquisition, a business that you're all
[1:57:31] in, I'd say, there's a virtual operation you look for properties that have difficulties and you've
[1:57:39] been okay got it. So so that's how you found the property. Realizing that was why I don't
[1:57:45] want to like taxes or for this lean that was approved or both. Yeah. And then let's see
[1:57:52] track down the others. And then you purchased the property. That's correct. So who owns the property
[1:57:58] now? Is it in your name? I'll see.
[1:58:05] So what's your LLC call? I'm solution investment LLC.
[1:58:11] solution,
[1:58:14] specimens,
[1:58:16] LLCs,
[1:58:17] the home solution,
[1:58:18] investment LLC,
[1:58:20] and then you're the
[1:58:22] the managing agent or the LLC.
[1:58:25] Correct.
[1:58:29] And when did the LLC and why the property?
[1:58:35] June 28,
[1:58:37] I believe,
[1:58:37] the 26th,
[1:58:38] what's in there on then?
[1:58:40] of this year,
[1:58:45] and in the time between that acquisition in June, and today you brought the property into clients, and you're top of it.
[1:58:57] Yeah, I think we had it done under a week. It was really just trying to get a hold of the neighbors to, you know, I'll just say they want to, you know, start a war when I bought a property, so we need to get there, okay on it.
[1:59:10] right. But and against a player until June of 26th or thereabouts on about that day,
[1:59:20] you, you didn't have the authority to go on the property correctly.
[1:59:25] That's right.
[1:59:27] All right.
[1:59:30] And you're seeking a reduction of the fine to $1,500.
[1:59:35] Right. Yeah, I mean, I didn't realize the cost of the county was $3,500, so I don't think
[1:59:42] it's fair for you all to, you know, take a loss on it. So I'm fine with paying what your cost was.
[1:59:50] Yeah, unfortunately, the cost would be non-reducible to find, you know.
[2:00:01] Now, as you know, or may now, in this jurisdiction, I, as a special magistrate, make a recommendation to the city commission.
[2:00:11] when you retain the plenary authority over the
[2:00:16] the ultimate or final decision of the reduction.
[2:00:18] So my report and recommendation will be
[2:00:23] a little bit sent to the City Commission to take
[2:00:26] final action since I don't have a final
[2:00:28] or authority in this matter.
[2:00:32] But is there, I've got your documentation,
[2:00:35] I've got an exhibit packet that was submitted.
[2:00:38] Is there anything else you want to tell me,
[2:00:41] or anything else you want to present?
[2:00:44] Not there.
[2:00:45] All right.
[2:00:46] So what I do in Greenhouse Republic is I'm going to take the matter
[2:00:51] under advisement, so I can look at the paperwork, you know,
[2:00:54] or carefully, there are factors spelled out in the
[2:00:58] ordinances to take in the accounting, deciding whether
[2:01:00] to what extent the monthly amount should be adjusted.
[2:01:04] I mean, just on the surface of your situation is favorable for reduction, because you came
[2:01:14] into the process, didn't create the violation, but I wanted to acquire the violation
[2:01:19] after a significant amount of finance at a crew and then brought the property into compliance
[2:01:24] in any rapid fashion.
[2:01:28] So, I'd have to look at everything, give us some fun,
[2:01:32] according to what I think the reasonable amount should be.
[2:01:37] But I can say that I will recommend a reduction.
[2:01:41] I can make some of these facts, but as I say,
[2:01:45] I have to spend a little time looking at all the documentation here
[2:01:49] and going back to the original case file,
[2:01:51] which I haven't had chance to do, but I should be able to get it
[2:01:54] or recommendation of all of the next 10 days or so, and again, that will
[2:02:02] provide a final action.
[2:02:05] Anything else?
[2:02:05] One of the, one do they make a decision on that roughly, is that next month?
[2:02:12] That, and then I can't tell you what we can ask.
[2:02:14] We can ask a city.
[2:02:16] You do it.
[2:02:17] Can you tell me?
[2:02:18] Somebody there, but it's not worth the time for me.
[2:02:22] All right, administrative supervisor, be in touch with him.
[2:02:27] Okay.
[2:02:28] I'm guessing it's not going to be months, I don't know if it'll be next month, but probably.
[2:02:33] No, first of all.
[2:02:34] Won't be that long.
[2:02:36] All right.
[2:02:37] Does the city have anything else?
[2:02:41] No, sir.
[2:02:43] And Mr. Schwam, do you have any any other questions or anything else you'd like to say?
[2:02:48] No, sir, I just appreciate the time.
[2:02:50] All right.
[2:02:51] As I say, I'll get to get out of report on this in the near future.
[2:02:55] It won't take me too long to do, but I will live in a week.
[2:03:01] All right.
[2:03:03] Very good.
[2:03:03] Thank you, Mr. Schwab.
[2:03:04] Thank you.
[2:03:05] You are free to hear us.
[2:03:14] I think that was the last case.
[2:03:15] Is that any else on the agenda?
[2:03:17] No, sir.
[2:03:19] Anything else to take up for the good of the order?
[2:03:22] No, sir.
[2:03:24] All right.
[2:03:25] I will be able to turn these orders around.
[2:03:30] quickly once said you've got some proposed orders up in the fall. For me to review on these cases
[2:03:37] I'll write the off-take-is-production in the next few days. Proposed order on that, but the
[2:03:44] rest of you could put something up. I'll think I'm going to get those turned around. And if there's
[2:03:51] no other business to attend to, we'll be adjourned until next month. Thank you, sir. Thank you, sir.
[2:03:57] I'll see you all again.
