[1:01:12] Memphis council, we have before you this evening your quarterly white elimination
[1:01:18] program update. Want to give you a few highlights from this program, how we
[1:01:23] have progressed since quarter one, your last update in March. Want to This
[1:01:28] presentation with a look at residential growth. Uh I want to present this to you
[1:01:32] with each one of our black presentations to give you an idea of what growth is
[1:01:35] doing right now as far as residential is concerned within the community. Um we
[1:01:40] started this year on a on a record pace. Last year was a record pace and the year
[1:01:44] before that was a record pace. Uh you can see the uh light blue uh line. You
[1:01:51] see we had a bit of a down month in the month of May. We didn't issue a ton of
[1:01:54] permits and so actually we got a little bit behind the pace of where last year
[1:01:58] is. Expect that's probably a bit of an anomaly but expect that will probably
[1:02:04] resume the pace that has been going on. Uh but nonetheless keep in mind we're
[1:02:10] still at a record pace growth u all the way up until the end of last month this
[1:02:16] month. Like I said, we anticipate that that
[1:02:20] line moving direction has you can see even last year there were there were a
[1:02:26] few months in June and July that uh that leveled off. So that's not unexpected.
[1:02:32] Um but nonetheless, just want to give you an idea of what growth is looking
[1:02:35] like as of beginning of this month. So why elimination program just to give you
[1:02:42] a little little bit of review, we do have an ordinance that um that deals
[1:02:45] with dangerous buildings in the and establishes them as public nuisances
[1:02:50] requires abatement. Um, of course, the intent is to create a safer and more
[1:02:56] pleasing community through the remediation and demolition of these
[1:03:00] unsafe structures in the community. So, the objective of the program objective
[1:03:05] is to eliminate white in the community. Uh, we also through eliminating white
[1:03:10] look to ensure structural stability and integrity of all of our structures that
[1:03:15] we have within the community whether res commercial or industrial. And through
[1:03:19] this program, we do hope to establish and cultivate a healthy relationship
[1:03:23] with public, not just with those owners that we are dealing with uh who have
[1:03:27] these dangerous buildings, but also with those other property owners within the
[1:03:32] community who invest so much on a daily basis in this community and in their
[1:03:36] property.

[1:03:51] from your first quarter here and you can see the uh the kind of teal color shows
[1:03:56] the number of properties that we have within the city initiative itself. You
[1:04:01] can see from first quarter second quarter we went from 77 units down to 68
[1:04:06] units. But if you look at the orange there, you see that 53 units in reme in
[1:04:12] the remediated category increased to 61 units in the second quarter. So we have
[1:04:18] uh we have remediate remediated some of the structures and I'll go through with
[1:04:22] you some of those properties that specifically have been remediated in
[1:04:25] second quarter of this year.
[1:04:30] All right. So uh go back Jonathan um
[1:04:36] two programs that we use to demolish structures. One's city initiative and
[1:04:42] the second is CDBG. CDBG is a voluntary program uh requires owners to give us
[1:04:48] the right of access and um allows us to be able to dedicate uh those funds that
[1:04:55] are designated by the state to demolish those properties and ultimately bring
[1:05:00] those properties into compliance. Uh you can see on here the CDBG program phase
[1:05:06] one uh nine properties phase two 10 properties. We updated you in the first
[1:05:11] quarter on some of those properties that had have been demolished uh in or
[1:05:16] through that particular program. You can see phase three is developing. We're
[1:05:19] close to close to being able to allocate funds
[1:05:30] of the CDBG program, the voluntary program that designates the state funds
[1:05:35] to properties. But the other is the city initiative. That's the program that is
[1:05:40] supported by the ordinance that you all have adopted to establish those
[1:05:45] dangerous buildings and establish the process for abading them. So, city
[1:05:50] initiative phases one and two. Um, I'm happy to report to you tonight that
[1:05:55] these are some of the first buildings that have been demolished as a part of
[1:06:00] the city initiative program. So phases one and two uh we have um I believe it's
[1:06:07] eight seven or eight structures that specifically have been demolished. So
[1:06:10] I'll start with here 07 drive 100 Dixie Drive apartment 73 through 80.
[1:06:18] Some of you will be familiar with these properties specifically, but these are
[1:06:21] before and after photos that that we have for each. 204 West Adam Street,
[1:06:31] 208 Wilkerson Street,
[1:06:37] 402 Geneva Highway. You can see that's the same building on the far left of the
[1:06:43] before photo and then the building that you can see clearly in the after photo.
[1:06:47] Um those are that's the same building but uh obviously the building in front
[1:06:52] of the four of the foroto you can see where it used to be
[1:06:57] 501 West Adam Street
[1:07:04] 430 Daleville Avenue
[1:07:09] and that's that's actually the conclusion of the city initiative
[1:07:13] properties that were removed. The last one that I wanted to show to you is 143
[1:07:18] South Carol. That is one that uh we missed in the last presentation to you,
[1:07:24] but wanted to make sure you were aware that that one had been remediated as
[1:07:27] well as a part of the CBG program uh in phase two of that program.
[1:07:38] All right. So current statuses, city demo initiative phase one. The
[1:07:43] anticipated completion of the project is July 2026. We've got one property left
[1:07:49] in that particular phase that we're um that we are looking to move forward with
[1:07:54] demolition on. Uh and that project will be complete or that phase will be
[1:07:58] complete. Phase two, we have uh one or two properties there that still need to
[1:08:04] be uh fully demolished before that is complete. We would anticipate
[1:08:08] participate uh that will be completed soon as well. Uh phase three, you can
[1:08:14] see 15 units haven't been identified as dilapidated. Uh only one has been
[1:08:19] demolished. Uh as best as testing has been completed and I can tell you as
[1:08:24] well that we are looking to put those properties out for bid for demolition
[1:08:29] here within the next week or two. Uh phase four you're all familiar with. At
[1:08:34] your last meeting, you actually identified all of those properties as
[1:08:38] being dilapidated. It um impacted 16 different buildings and specifically 42
[1:08:46] different residential units. So, those were all declared as nuisances on um at
[1:08:52] your last meeting on June 2nd. We are in a bit of a 20-day period which
[1:08:57] we're not taking any action but we will be uh coming back to those within the
[1:09:01] next week or two to keep those properties moving forward as well. We
[1:09:06] are anticipating remediation plans on some of those uh partic particular
[1:09:12] properties. Uh but we are continuous communication with those property owners
[1:09:18] on uh some of those issues that they have. And then finally phase five You've
[1:09:23] not seen this before. Uh we are currently in the process of of
[1:09:28] identifying a list probably around 15 structures is what we will end up coming
[1:09:33] up with uh to implement phase five of the city's demo initiative program. And
[1:09:39] we are looking at beginning the beginning that particular phase in third
[1:09:45] quarter. So we will be bringing some of that information back to you as soon as
[1:09:48] we can.

[1:11:10] This is a request by Cynthy Cington Scott. We're re looking to reszone from
[1:11:15] R2 medium density uh single family residential to B1 uh business district
[1:11:21] on this location.
[1:11:25] Subject property map. You can see where this is. It's on the eastern portion of
[1:11:30] the city limits along US 84. You can see the um the top left portion of that map.
[1:11:36] You can see where Cottonville Road comes in. So you have some of that commercial
[1:11:40] area that's right there at that intersection like Copper and I believe
[1:11:44] there's a uh antique store there as well if I remember correctly. Um so there is
[1:11:49] some commercial businesses but this would be directly across the street
[1:11:52] where Cington Street is. Everybody know where we're talking about?
[1:12:03] moving forward. So, our current zoning is R2. Proposed zoning is B1. And we do
[1:12:09] have B1 and A2 and R2 immediately to the north. We have R2 to the west and south
[1:12:15] and then R2 in Coffee County, specifically to the east. Uh we did send
[1:12:21] out four letters to adjacent property owners. Uh we did receive one comment
[1:12:25] from a property owner from a neighboring property owner who was in support of
[1:12:29] this particular request. Uh use of the property uh is a residential building at
[1:12:35] this time. You can see the zoning map and what the zoning looks like here. You
[1:12:39] can see this adjacent to US84 and you can see some of that B1 zoning that's
[1:12:43] across US84, but this is very close to the city boundary line itself.
[1:12:50] So if we're reszoning from R2 to B1, you need to know what the intents of each
[1:12:55] zoning district are. Uh purpose of this district of R2 is to provide
[1:15:08] USA is a target area for future annation
[1:15:12] including future businesses along the highway corridor itself. And the comp
[1:15:17] plan also does anticipate business growth along those major corridors
[1:15:23] within the city limits itself. not just circle but also 84 east and some of the
[1:15:27] other major corridors outside the circle. Uh existing commercial across
[1:15:32] US84 acts as a small commercial hub that allows for future growth immediately
[1:15:37] along the corridor. We have quite a number of those kind of uh hubs within
[1:15:42] the community that have been identified by our comprehensive plan or are already
[1:15:47] in existence at this time. So as a result of those particular compliance
[1:15:53] um portions of the comprehensive plan or areas of comprehensive plan which this
[1:15:58] resoning request complies. Staff is recommending that um that the council
[1:16:04] approved the resoning request here from R2 to B1 subject to the provisions of
[1:16:11] the zoning ordinance. Uh planning commission also unanimously recommended
[1:16:15] approval of this result. questions

[1:17:24] Senator Elizabeth Hutchinson Charles Vickers Eel Jr. from a Agriculture
[1:17:30] District and R2 medium density single family district to R3 high density
[1:17:35] single family residential district located along the north side of Old
[1:17:40] Salem Road and east side of US 84.

[1:17:49] particular request involves two different properties. Uh, one property
[1:17:54] is around 40 acres and involves entire is entirely zoned as agriculture. The
[1:18:00] second property is just over 40 acres and involves um two different zoning
[1:18:05] districts R2 and a as well. Applicant is wanting to reszone both of those
[1:18:10] properties to R3. So going from agriculture and medium density
[1:18:16] residential to R3 which is high density single family residential.
[1:18:21] So here's the subject property US 84 uh heading west towards New Broxton and
[1:18:28] Ela. This is also very close to the city boundary line on the opposite end of
[1:18:32] US84 um near Old Salem Road. Old you can see
[1:18:36] Salem Road and Old Salem Road down at the bottom of the screen there. This
[1:18:40] also has close proximity to Highway 51. You can see there to the north and east
[1:18:47] of this property. So the zoning map, you can see the um
[1:18:53] the light yellow color that's at the bottom of this proposed property being
[1:18:58] reszone. That's your R2 district. And then the bulk of the property uh that
[1:19:03] remains to the north is all agriculture in green there. And all that's proposed
[1:19:08] to go to R3 R2 to R3. We do have M2 industrial
[1:19:14] zoning to the north of this property, agriculture to the east, R2 medium
[1:19:20] density residential to the south, and then uh Coffee County is immediately
[1:19:24] adjacent to this property to the west. We did send out letters to eight
[1:19:29] property owners and the current use of this property is vacant.
[1:19:33] So if you're if should you decide to reszone this property, what are the
[1:19:37] intents of the district? I want to point out something specific within this
[1:19:40] agriculture zoning district. It is designed to provide space within the
[1:19:44] city to continue agriculture in forestry operations preserve and to preserve land
[1:19:50] also for future urban use when the demand for land for such development and
[1:19:55] availability of services warrant such development. Uh, in that case,
[1:20:00] the code specifically says that the property could be reszoned for a more
[1:20:05] intensive use. It's a district that's designed to invite a reszone to a more
[1:20:11] intensive use. That's about the only district with that the city has in which
[1:20:16] you'll find that particular language. So allowable uses with the within the a
[1:20:22] zoning district are are what you would expect does allow for single family
[1:20:26] homes but also farming forestry uses livestock sales those are the uses that
[1:20:32] are allowed right now on the bulk of this property
[1:20:37] should you decide to re okay and also R2 I'll hit that as well we've already hit
[1:20:42] that with your last one medium residential mostly allows for single
[1:20:46] family residential uses So should you decide to reszone our
[1:20:52] three districts purpose is to provide preserved land for high density single
[1:20:56] family glowing units in other compatible uses in areas that are geographically
[1:21:01] defined and protected from the encroachment of incompatible uses. Um
[1:21:07] only difference with this is within R3s it does allow for cottage developments
[1:21:13] but otherwise it's still mostly single family dwellings that are allowed within
[1:21:17] this district
[1:21:22] future land use map. You can see similar to your last request that came before
[1:21:26] you. This mostly uh calls for agriculture and single family or medium
[1:21:33] density residential.
[1:21:37] We have received a concept plan for this particular request. They are proposing a
[1:21:44] 256 block subdivision to cover this 80 acres of land. And you can see the
[1:21:49] preliminary plat that has been already reviewed and approved by the planning
[1:21:55] commission subject to your review here this evening. But this is a copy of the
[1:22:02] PL of the most recent flat that staff has received and has on file for this
[1:22:06] particular development. So how does this apply to the comp plan?
[1:22:11] Uh, this development would provide a smoother transition from that industrial
[1:22:15] zoning that I showed you to the north um to the low dens to the low inensity
[1:22:20] residential that is on the other sides and also within Coffee County and higher
[1:22:25] density residential areas should have access to major roadways. This does have
[1:22:30] a frontage on US84. They are not proposing to tie in to US84, but they
[1:22:36] are proposing two separate entrances. one entrance on Old Salem Road and the
[1:22:41] other entrance to the north and east of this property to connect into Alabama
[1:22:46] State Highway 54. That is their proposal at this time.
[1:22:52] So, just a picture of the public notice signs that were um that were put out for
[1:22:56] this property. And then staff recommendation is that
[1:23:00] the council approve the reszoning for the 82.02 2 acres uh located on the east
[1:23:06] side of US 84 and north side of Old Salem Road from A and R2 to R3
[1:23:13] uh with a couple of contending subject to the provision of two access points to
[1:23:19] public streets for the subdivision itself. The planning commission also
[1:23:24] recommends approval of the request. They actually had a few more contingencies
[1:23:28] that they uh recommended as a part of their approval of the preliminary flat,
[1:23:34] which included the two access points that I mentioned to you, but also the
[1:23:40] upgrade of Old Salem Road, which is not in real good shape right now, but also
[1:23:46] it's subject to your approval here this evening.

[1:29:37] existing vegetation that we can especially those are
[1:29:44] happy to answer any
[1:29:56] members.

[1:30:07] road. I live on the northeastern most portion of this request. I don't have
[1:30:13] any opposition to this. not super happy about it, but people need homes and we
[1:30:18] understand that. Um, obviously there's a big need for smaller
[1:30:25] homes. I think it's problem across the country. Our ask is that the city help
[1:30:30] us maintain the natural existing on this side and really around the whole
[1:30:35] thing. And we have been working with the planning commission and with Stanford
[1:30:39] group. So, I want to thank everybody so far that has taken interest in this.
[1:30:45] You know, it's our forever home. We don't plan on leaving it, but one day
[1:30:49] the property value could be seriously negative be affected if that natural
[1:30:53] existing buffer is. And then for our quality of life while we're there, we
[1:30:58] just want some noise pollution, light pollution protection. And this existing
[1:31:03] buffer, myself and my neighbor, these are 25, 30 foot tall trees. I mean,
[1:31:09] there's there's no way I can replace it. What group has that approval shows that
[1:31:16] existing buffer. Um, I'm not sure they've made a real firm commitment on
[1:31:21] that, but I do ask the city that if they change that that they justify it. I
[1:31:27] don't think it's going to come to that. They know that we want to eventually own
[1:31:30] that tree line and we're working toward that and they're being very cooperative
[1:31:35] of that. The follow through is the most important
[1:31:39] part. Approved, it's going to get final approved. So, here and there. Let's just
[1:31:44] try to protect as much as the existing citizens
[1:31:53] work for university. I drive that road every single day. Which home is yours?

[1:33:16] county is basically uh grass land. It's uh
[1:33:21] crop pay off it and that's about the end of spend some time out there. But along
[1:33:25] with the the concerns that have been uh been voiced. We had an opportunity to
[1:33:30] look at the map where the wetland is from there to the west. And at the last
[1:33:33] meeting, the representative that was there from Sanford indicated to me there
[1:33:37] was no plans to develop the um the property from the wetland between the
[1:33:42] wetland and my property line. Is that still the same judge? Okay. Yeah. I
[1:33:46] guess along with the that finally I want to go on record too is asking that as
[1:33:50] much of that buffer that that natural buffer those pine trees and the the
[1:33:54] green space that is there be retained for the mutual benefit of both parties.

[1:35:00] forward. But the approval of a preliminary plately
[1:35:04] locks in the developer to the plan that they submitted. So any any major changes
[1:35:11] to the preliminary plat as far as the design are concerned would have to come
[1:35:15] back before the planning commission for review would require us to notify those
[1:35:19] property owners all all over again. So the design the general design that you
[1:35:23] see that you saw here this evening they would largely be locked in. They've made
[1:35:28] some um um some arrangements as far as that buffer is concerned. That wouldn't
[1:35:33] be a major change to the flat. Uh we can continue to move that project forward,
[1:35:39] but developing across the wetlands across that main stream would in my mind
[1:35:44] be a different issue.
