[6:35] opportunity to rediscover her
[6:35] extraordinary legacy. It is my

[6:40] Janet Flanders. Remarkable
[6:43] life and contributions. A

[6:46] the life legacy in
[6:48] Indianapolis roots of Janet

[6:54] and cultural correspondent,
[6:55] whereas Janet Flare was born

[10:31] celebrating the remarkable
[10:33] legacy of one of Indianapolis

[10:36] daughters, Jennifer and her.

[10:48] recognizing the extraordinary
[10:49] legacy. Jane Atlanta, on

[10:54] counsel Scott Keller, the

[10:55] honored that Indianapolis is
[10:57] taking this opportunity to
[10:58] celebrate one of its most
[11:01] remarkable native daughters,
[11:02] the District Theater believes
[11:04] that these that great theater
[11:05] does more than just entertain.
[11:07] It shines a light on voices
[11:08] that history has too often
[11:10] overlooked or forgotten. 2 new

[11:15] a and through our incubators
[11:16] for African-American and
[11:17] Latino Arts communities
[11:19] designed specifically for and
[11:21] buy those members of the
[11:22] community. We strive to tell
[11:23] stories that reflect the full
[11:26] richness of our city. So thank
[11:27] you for helping to ensure that
[11:28] Jeff Linder story and so many
[11:31] others continue to be sold.

[24:52] deserve far public scrutiny

[24:58] repair program is one example.
[25:01] It is already funded with 3.6
[25:02] million dollars in cdbg,
[25:06] federal funding. Proposal. One
[25:08] 63, would add another $500,000
[25:11] in local taxpayer dollars.
[25:12] Helping your neighbors over to
[25:15] you. Compelling your neighbors
[25:16] to pay to help others through
[25:20] taxation is not. Not every
[25:20] need requires a government
[25:24] solution. Indianapolis as one
[25:25] of the largest church
[25:28] communities in the Midwest.
[25:28] Church is a voluntary
[25:29] association groups have long
[25:31] to help people in need. And I
[25:32] don't understand why we're
[25:32] forgetting the ability to do
[25:37] so. If dpw numbers are
[25:40] correct. That's a $500,000.
[25:41] Could proximity 7 lanes of
[25:46] roadway? That's enough to
[25:47] repave north down even Emerson
[25:48] Avenue from Southeastern
[25:48] Avenue all the way to 46
[25:52] street. I mentioning roads
[25:53] because certainly you will
[25:54] vote to increase my will tax
[25:59] by 400%. If we're truly facing
[25:59] a road funding crisis than
[26:01] every available dollar should
[26:02] be directed there before
[26:04] expanding spending elsewhere.

[26:06] road funding formula needs to
[26:10] work better for us. And I did
[26:10] not come here to dispute that,
[26:14] by the way. But the way the
[26:15] city continues to spend
[26:17] taxpayer dollars is not going
[26:17] to strengthen our case. We
[26:18] asked the state to do more for
[26:21] us. Taxpayers work hard for
[26:24] every dollar they earn. They
[26:24] expect the city government to
[26:25] provide just the essential
[26:31] services and a quick at this.
[26:32] The city council keeps
[26:34] expanding government into
[26:35] areas beyond its core
[26:35] responsibilities when working
[26:37] families have to tighten their
[26:38] budget, they expect the same
[26:39] thing to come from the council
[26:40] and prioritize you. Thank you.

[27:07] shed light on that. One of the
[27:11] things that I and you know is
[27:11] going through this just been a
[27:12] lot more time in spring fiscal
[27:15] added this year. I did send
[27:16] some things over through the
[27:18] office, but I just want at
[27:19] least verbally acknowledge
[27:20] some of the things that I've
[27:21] heard. Constituents asked me
[27:22] for that I think are very
[27:22] prudent or things that I've
[27:25] seen that need even have a
[27:26] tension in the city that I
[27:28] don't. The city has brought us
[27:30] this year. There is an issue
[27:31] that we have with duplicative
[27:32] data storage or even
[27:33] triplicate data storage across
[27:36] the city enterprise in which
[27:38] we are overpaying for data
[27:38] storage and a lot of our
[27:40] public safety's and it's
[27:42] causing both redundancies as
[27:44] well as efficiency issues when
[27:44] trying to share that
[27:48] information between agencies I
[27:49] say has done it does have
[27:50] information to run a pilot on
[27:52] this and have looked into it.
[27:53] So we wouldn't be starting
[27:54] from scratch. So just
[27:55] something for this body to be
[27:56] aware of when, you know, I
[27:57] know there are some additional
[27:58] funds that were parked because
[28:00] of this. Whether we get into
[28:02] that or not, but ideas for the
[28:04] future as well as police
[28:04] recruitment. This was
[28:05] something that I've had a lot
[28:05] of conversations with the
[28:09] chief of police, our office as
[28:11] well. We have to, you know,
[28:12] get some more focus on that. I
[28:13] know we're working on the
[28:15] vehicles with this as well.
[28:18] But down in Fort Worth, they
[28:19] did some really, really cool,
[28:20] innovative ideas that was able
[28:24] to net them. 3400 new police
[28:26] applications as soon as they
[28:27] had a new police chief. We
[28:28] have very similar activities
[28:30] going on it wasn't causing ton
[28:31] of money. Additional things
[28:32] that I think could be
[28:33] beneficial to us is the
[28:34] council. Our constituent
[28:37] management software where, you
[28:37] know, we don't have that. I'm
[28:38] using an Excel spreadsheet to
[28:42] manage things inside and and
[28:42] then trying to share them with
[28:43] my liaison, who imagine has
[28:46] probably 25 of those. And last
[28:47] thing which is very important,
[28:50] which is talks drops across
[28:52] the city. We have got to come
[28:55] up with a solution on that
[28:57] where we while lost mine 2
[28:58] years ago. Some of these are
[28:59] the council says says town is
[29:02] me and we lost And these are
[29:03] these are things that impact
[29:04] daily lives efficiencies, the
[29:06] quality life for people,
[29:07] environmental, all of these
[29:10] fall within these buckets you
[29:11] know, I I bring him up as want
[29:12] to make sure do it publicly so
[29:13] we can hear about it. Talk
[29:14] about These are important to
[29:16] me important to community and
[29:17] I think Indianapolis want to
[29:18] see more of with that. I knew

[29:41] governor made the decision to
[29:43] suspend the gas tax at that
[29:43] time. We were looking at about
[29:48] a $400,000 a month losses city
[29:50] that when I was extended a
[29:51] second time, it was even more
[29:51] robust that extended to about
[29:55] 3.4 million a month. And so in
[29:56] those conversations, we worked
[29:58] with the administration to
[30:01] this big prior the council to
[30:02] fence off a large
[30:03] appropriation of the
[30:03] supplemental up just a little
[30:05] over 15 million dollars to be
[30:09] able to backfill the current
[30:10] 2026 capital plan. The
[30:11] governor has since announced
[30:14] that he's going to be pushing
[30:16] state finance board to
[30:18] reimburse the state. City for
[30:21] any lost gas tax revenues. I'm
[30:22] hopeful that goes through. But
[30:24] I just want as we're having a
[30:26] conversation about fiscal
[30:27] discipline and ensuring are
[30:28] putting money towards roads,
[30:29] we free fence off almost 50%
[30:32] of the supplemental in order
[30:33] to prepare for just that. So
[30:35] we'll as we go into the
[30:36] budget. We'll be looking to
[30:37] appropriate those for
[30:38] hopefully some other one time
[30:39] spends. But just want the
[30:44] public to be aware that that
[30:44] we that we were taking
[30:45] precautionary measures. We
[30:46] have better news now, but
[30:47] nothing is set in Stone. So

[31:08] reason for that is because if
[31:09] you don't do that kind of
[31:11] preventative up in it from the
[31:13] government. What happens is
[31:15] people just dump toxic
[31:16] chemicals and then across far,
[31:17] far more to end up cleaning up
[31:19] later. And I think the same
[31:20] can be true if we could spend
[31:22] $500,000 and keep people in
[31:23] their homes to prevent them
[31:24] from becoming homeless, which
[31:25] is where a lot of folks would
[31:27] go otherwise. Think about how
[31:29] expensive emergency services
[31:30] calls our when dealing with
[31:31] our homeless. The situation. I
[31:34] think he's actually situation
[31:38] where ounce of prevention is
[31:39] than a pound of care. And it
[31:40] just saves taxpayers in the
[31:41] long run. So I encourage all
[31:42] colleagues to vote yes for

[32:44] contentious and unpopular
[32:46] comments here. But this
[32:48] proposal would give almost
[32:49] $900,000 additional in
[32:52] taxpayer funding for police
[32:53] vehicles. And we had some
[32:53] great commentary in committee
[32:56] that I was able to review that
[32:57] mentioned that the main one
[32:59] main reason for this is
[33:01] because apparently car
[33:03] manufacturers are not
[33:04] producing pursuit rated sedans
[33:06] anymore. And so that Durango
[33:07] suv is about the most
[33:08] affordable police vehicle that
[33:12] we can purchase right now. You
[33:12] know, here's what else out a
[33:13] little bit more like a
[33:14] conservative that I normally
[33:17] do when. Only government
[33:19] entities are purchasing from
[33:21] car companies and we just
[33:23] automatically will spend more
[33:24] money and just pay for a more
[33:25] expensive vehicle. What
[33:27] incentive are we giving the
[33:27] car manufacturers to actually
[33:28] produce the police to dance
[33:30] the way that they used to? As
[33:30] long as we just keep showing
[33:32] the market that we will pay
[33:36] any cost. And there's bounds
[33:37] around any police pending. I
[33:38] don't see how that will ever
[33:40] end. And so in the context of
[33:42] 4% budget cuts for almost
[33:46] every other department. In the
[33:47] context of a situation where
[33:49] 300 officers down. But but are
[33:51] still funding to the tune of
[33:52] 17, 43 officers, even though
[33:53] we we know we're not going to
[33:54] hire those officers in the
[33:57] short term in the context of
[33:58] and over 100% raise for first
[34:00] year. Officers in the last 8
[34:02] years. I don't see how we can
[34:02] continue to keep throwing
[34:04] money at the police
[34:05] department. You know, some
[34:06] officers could use a bike.
[34:07] Some officers could walk
[34:10] around on foot. Morale is
[34:12] important. I think that being
[34:13] around constituents and not
[34:15] always behind the wheel of an
[34:16] suv separated from them is a
[34:18] good way of increasing police
[34:20] relationships with the
[34:22] community. And so I just can't
[34:25] vote for this in good
[34:25] conscience. You know what?
[34:26] Officers to be safe, want them
[34:27] to have all the equipment they
[34:29] need. How many of us and only
[34:30] 40 years old, but every movie
[34:34] from the 80's and 90's showed
[34:35] 2 police officer sitting a
[34:36] vehicle together. When you
[34:37] watch anybody being pulled
[34:39] over to the average U.S. And
[34:40] one police cruiser know for
[34:41] officer safety will send
[34:42] multiple police cruisers. So
[34:44] we have multiple vehicles
[34:45] going to the site at the same
[34:46] scene of a crime
[34:47] investigation. To me, it's a
[34:48] no-brainer that we need to be
[34:49] saving money. We need to be
[34:50] treating our taxpayers with
[34:51] respect. As I urge my
[34:52] colleagues about now. Thank

[35:21] conversation in our caucus for
[35:23] impd to provide us some
[35:24] clarity around their budgetary
[35:25] needs as we're entering into
[35:28] the budget season. My concern
[35:35] continues to be impd to as an
[35:35] entity of the largest
[35:38] percentage and the overall
[35:42] city budget. And it seems to
[35:44] that is a consistent request.
[35:45] Whenever there's a fiscal from
[35:47] impd for something additional
[35:51] and we don't have clear
[35:52] picture off the scope and need
[35:55] from the department and what
[35:56] that means for us as we are
[35:59] going in the budget process,
[36:00] we will start the public
[36:01] budget process next month. And
[36:05] what would what I've
[36:08] requested? I McCall,
[36:09] colleagues of joining along
[36:09] that is to say to impd, we
[36:11] need a full picture of your
[36:12] needs and requests as we're
[36:14] going into this fiscal year.
[36:17] And so I just want call on the
[36:18] leadership of impd along as
[36:20] well as administration to make
[36:22] sure that you're providing
[36:22] that to the council's main
[36:24] gauge in this conversation.
[36:26] Run-up to the support of
[36:27] tonight, one, a police
[36:29] department to know that we
[36:31] want the best for our city,
[36:33] but we also need to be
[36:35] fiscally responsible. And this
[36:37] keeps coming up police
[36:37] department. And so we just

[36:55] out of One of the reasons that

[36:59] of us today is essentially
[37:01] these are on a leasing model
[37:02] that they're paying least
[37:04] lingo, renewing get the new
[37:05] vehicles. The problem, one of
[37:06] the problems behind that is
[37:07] that the bond rates now are
[37:08] higher than what they were
[37:11] originally. So it's more
[37:12] expensive to borrow money to
[37:13] go buy the vehicles to pay
[37:15] them off for years. One of the
[37:16] things that we've learned even
[37:17] from the fire department of
[37:20] this year's is that it is more
[37:24] fiscally responsible
[37:25] essentially use the leasing
[37:26] model because we don't pay all
[37:27] the deferred maintenance. If
[37:28] we don't do this, we're going
[37:31] to end up with more costs and
[37:32] paying maintenance on
[37:33] vehicles. We learned that the
[37:34] certain vehicles aren't as
[37:35] reliable and efficient.
[37:38] Effective Lee is if their
[37:40] direct then that's it. They're
[37:40] total, whereas older vehicles
[37:42] that they had the ability to
[37:43] be repaired. We're not in that
[37:44] position anymore. And we need
[37:46] to keep these vehicles and a
[37:47] newer position. But we also
[37:48] have to keep a certain number
[37:49] of them. We learned that
[37:52] evening essentially to make
[37:52] sure that we had a stock for
[37:53] when are getting
[37:54] repaired. Vehicles are getting
[37:58] prepared for that rotation. So
[38:01] I think that this is fiscally
[38:03] responsible, responsible thing
[38:06] to do. I think it both from
[38:07] the finance point, but also
[38:08] from the part of trying to
[38:09] make sure that we're showing
[38:09] officers that we do care about
[38:11] their needs and that this is
[38:12] this is their office, right? I
[38:16] do think that we are gonna
[38:17] have to have this conversation
[38:18] again because it was made
[38:20] clear in committee. My change
[38:21] to this is that we need to do
[38:23] the full thing, not just a
[38:23] piece of it. So I do expect to
[38:27] see it again in the fall. But
[38:28] hopefully that gets a street
[38:30] up for adequate rotation. But

[46:56] Shook wonder saying he was by
[47:00] Sunday and he owns 49% of a
[47:02] family in Amman and his wife
[47:08] owns 51%. We are here is legal
[47:11] counsel pursuant to one 51
[47:12] day. 79 other revised code of
[47:14] the consolidated City County
[47:16] special procedures rezoning.
[47:21] Ordinances. And which from
[47:23] center ic 3, 6, dash, 7 dash 4
[47:25] 608 to change the current
[47:30] restrictions to sell gas. Its
[47:33] location at 4, 0, 0, 1, south
[47:35] to stone. And it's about to
[47:41] one point '07 acres. Mr,
[47:42] saying he's been in this
[47:46] business for quite a while.
[47:47] His story is I think you have
[47:49] to talk about him and what
[47:49] he's accomplished since season
[47:51] one driving the the ship on
[47:56] this project. He came
[47:57] immigrate. It's the United
[48:00] States with basically nothing.
[48:00] He's originally from the
[48:01] northern area of India called
[48:04] Putin job. Very, very poor
[48:08] area of India. He worked in
[48:10] New York City as a taxi driver
[48:15] and 2004, he arrived in
[48:17] Indianapolis and least a gas
[48:20] station to support his wife.
[48:24] And their family. From those
[48:25] humble beginnings. They worked
[48:26] hires Lee to create
[48:29] opportunities for their family
[48:32] following the American dream.
[48:33] Over the past 20 years, they
[48:33] have dedicated their company,
[48:36] the building and operating
[48:38] successful businesses with
[48:39] particular expertise in the
[48:40] gas station, convenience store
[48:43] industry. Today. They oversee
[48:46] more than 100 properties
[48:47] throughout the Midwest,
[48:48] including approximately 30
[48:49] stations located in the
[48:53] Indianapolis area. Sony has
[48:58] wife 3 children. One Med
[48:58] school wins a doctor or any
[49:03] other civil student. Sony's
[49:03] family develops developments
[49:05] provide more than just of fuel
[49:08] and convenience items. They
[49:11] create jobs, tax revenue,
[49:12] increased commercial activity
[49:14] and provide essential goods
[49:16] and services to the local
[49:18] communities and what he's been
[49:19] able to do as he goes into the
[49:21] site's a are like this site.
[49:23] We're totally devastated. And
[49:25] Hoyer is pretty devastated.
[49:28] And he's able to go in. Put in
[49:30] a gas station, convenience
[49:34] stores and then build from
[49:36] that and bring in businesses.
[49:36] And exactly what trying to do
[49:43] here. So they also provide
[49:47] contribute to local charities
[49:47] in support. Local activity not
[49:48] only here in Indianapolis
[49:49] area, but all throughout the
[49:54] state of Indiana. They now
[49:57] approval for the project at 4,
[49:58] 0, 0, 1, South Keystone Avenue
[50:01] to continue that same kind of
[50:03] work by investing in the local
[50:04] community. From Tribune,
[50:05] long-term value to the
[50:10] surrounding area. Ironically,
[50:10] son his family have a long
[50:13] relationship to this area. And
[50:16] that's why he's there. There
[50:17] were long-term residents of
[50:18] the south side of Indianapolis
[50:21] and resided on South Houston.
[50:22] Just a few blocks away from
[50:25] where site is. So they've seen
[50:26] everything that's happened in
[50:30] the community down there.
[50:31] Their daughters graduate from
[50:33] wrong, calling high school in
[50:35] his first gas station that
[50:37] owned his own south Times.
[50:39] Thompson Road. So they've been
[50:40] very vested in this area and
[50:42] want to take it forward. You
[50:45] know, just a little going back
[50:46] to what transpired. In
[50:47] addition, I could spend all
[50:50] day doing that they bought the
[50:55] property in 2000. 22, it had
[50:58] been abandoned since 2017. It
[51:01] was owned by company in
[51:03] Muncie. And they just
[51:05] basically let it and abandoned
[51:07] it. When I first went down or
[51:08] to see the property and for
[51:09] him to talk to me and we but
[51:13] with the counselor, the scary
[51:16] it was nothing but trash.
[51:17] Heaps of trace people are just
[51:22] dumping stuff there all the
[51:23] time. The buildings were
[51:24] uninhabited infected are being
[51:28] used by Grinch drug dealing
[51:28] council miscarried received
[51:30] numerous complaints about this
[51:32] site in what what they should
[51:35] could they do about it? And
[51:38] Sonny and his company stepped
[51:38] up. They bought the property
[51:40] and then they tried to go in
[51:46] and get. Permission to gas.
[51:47] Now, there was there was
[51:48] agreement signed by the
[51:51] previous owner. To do about
[51:53] everything he wanted to do
[51:56] there except so gas because
[51:57] they had were to deal with the
[51:59] property next door to bring in
[52:01] a 21st Amendment liquor store.
[52:04] And so that had been excluded.
[52:04] What at the time about the
[52:06] property? And he knew But he
[52:09] wanted to try go forward
[52:11] remedy the situation and see
[52:12] if he could make it work and
[52:14] then. There's enough property
[52:15] done or he could do many other
[52:17] things. Unfortunately, nobody
[52:20] else has ever approached him
[52:21] and nothing else has ever
[52:22] happened to it because you've
[52:25] got to have gas fueling
[52:26] decision to make to make it
[52:30] work. 3 different times we
[52:36] have been before the planning
[52:37] commission in 3 different
[52:40] times. We have been denied
[52:41] because they keep saying,
[52:42] well, there's no need for
[52:47] another gas station. Which to
[52:47] Is it accurate if you go
[52:48] around and talk to the
[52:49] neighbors like we did and I'll
[52:53] go into that in more detail in
[52:53] a minute. Every one of the
[52:57] neighborhood of presidents and
[52:57] people are surrounding an area
[53:02] which will elderly. Begging
[53:03] for gas to come in there. So
[53:05] you don't have to try to
[53:05] cross. He's showing all the
[53:08] time, which is a really,
[53:10] really a dangerous place to
[53:12] cross Youve got Keystone. A
[53:14] new Hannah and Walker coming
[53:19] in there. And each the board
[53:20] zoning board would say, well,
[53:24] if you do this, then we'll try
[53:24] to help you the next time
[53:27] around. Well, the first thing
[53:29] was to build a fence week. We
[53:30] build a fence all the way
[53:35] around this property. Almost
[53:37] 1.1 acres and cleaned it all
[53:37] up. Got all that. Got rid of
[53:40] all the trash tore the
[53:41] building down to get rid of
[53:42] all the things that were going
[53:45] on on the site. We came back
[53:46] in and were denied again. This
[53:48] time they said, want look at
[53:49] putting a convenience store by
[53:53] itself about and see if that
[53:57] works. And sunny turned to me,
[53:58] should the I've never seen
[53:59] that work ever. But he said,
[54:00] let me think about it. So we
[54:03] told the board he didn't think
[54:04] he wanted to do that. And then
[54:06] a few months later, he decided
[54:07] to go forward because we
[54:09] really want to clean this area
[54:12] and he did build a convenience
[54:13] store. You'll there's pictures
[54:17] in materials of what the
[54:19] property looked like before
[54:20] and then after. So there is a
[54:21] convenience store at that
[54:24] site. The bad part about it is
[54:26] set. It will support. Could
[54:31] mean the not profitable season
[54:33] have to subsidizing the store.
[54:34] She is. We just to keep it
[54:40] open. So then the next time we
[54:41] went in was just this last
[54:44] time in MARCH of 26 and we
[54:46] done everything. They ask us
[54:46] to do. We told them about the
[54:50] fact that he was offering the
[54:51] convenience store and we lost
[54:55] again at all. 3 hearings.
[54:59] COUNCILMAN Scary was there. He
[54:59] explained to him a lot of
[55:03] things I'm saying to you told
[55:04] him it extremely important for
[55:08] him in his district to get
[55:10] this so they could provide
[55:14] gassed and make this work. The
[55:15] other interesting thing that
[55:18] happened it the only remind us
[55:18] traitors who showed up at any
[55:19] of this is only board of
[55:23] appeals. People just that live
[55:28] around there all. Owners of 5
[55:29] other gas stations that are in
[55:31] the area. They're the only
[55:32] ones that never showed up for
[55:36] to Raymond Street. And the
[55:37] reason they were showing up
[55:38] because they didn't want to
[55:39] kill competition because Sony
[55:41] has a reputation of running a
[55:46] very good business. Very clean
[55:47] buildings, cetera. And they
[55:49] don't they didn't want it. And
[55:50] they try to say, well, there's
[55:51] already all these gas stations
[55:52] and there's no need for
[55:55] another one. Well, in the
[55:56] meantime, these guys are
[55:59] building gas stations all
[55:59] around. South side of
[56:06] Indianapolis. In 2, 2 families
[56:07] basically. And if they're the
[56:09] ones that right close to this
[56:12] site, should Colin British
[56:16] Petroleum. In the MAY also
[56:17] supposedly have interest in
[56:18] the liquor store. That's next
[56:22] door. In addition, they have
[56:24] stations ship Brookville,
[56:26] Road. 34 1 with Students
[56:28] Street 54 60 east, 21st
[56:32] Street. 57 96 with smaller
[56:33] street in 50 to 52 was Troy
[56:37] Avenue. Obviously for them to
[56:37] say that there's no need for
[56:39] additional gas stations.
[56:45] That's just not correct. And
[56:49] what what we see is that the
[56:49] competitors down there aren't
[56:52] really interested in a
[56:54] district 19 or anything else
[56:55] down there. They're just there
[56:56] to run the gas stations. They
[56:59] have. They do nothing for the
[57:02] community. If you if if you
[57:03] are seeing the stations are
[57:04] run down, the quality of
[57:07] things they serve. He's very
[57:12] meager whereas at convenience
[57:12] store that they have fresh
[57:17] meet. Milk and a lot of other
[57:19] products that the people in
[57:20] that area needing can't get to
[57:21] without trying to cross
[57:29] Keystone. We believe that to
[57:29] the competition down or would
[57:34] be. Very good for the 19th
[57:35] district because everybody's
[57:35] going to have to up their
[57:40] game. In charge. Ferry gas
[57:41] prices. We're not gonna have a
[57:45] monopoly. Basically. So the
[57:47] next thing I want address is
[57:48] exhibit 7 and then runs
[57:50] traders. Filings. Sure they
[57:53] had 190 signatories on their
[57:58] petition opposing on. Well,
[58:00] we've went through those
[58:01] signatures and found that many
[58:03] of them had the same
[58:04] handwriting, hardly any of
[58:08] them had to address listed.
[58:09] And we found that almost the
[58:09] phone numbers that were
[58:12] listed. Legitimate. They were
[58:16] nonexistent. And then the ones
[58:19] that we do talk to about 10 of
[58:20] them said they didn't even
[58:22] accept for 2 people. They
[58:23] didn't even remember every
[58:27] signing a petition and they
[58:31] were for the gas station for a
[58:31] being sore one too soon. The
[58:32] one we're talking about
[58:35] getting gas so they could
[58:40] continues stand business. In
[58:41] fact, one lady that we talked
[58:45] to. Just like us. We're all
[58:47] said she once against to be
[58:50] built at a convenience store.
[58:51] She lives closely by and him
[58:54] to cross the street. It's such
[58:55] a busy intersection is
[58:57] inconvenient and dangerous.
[58:59] There's also a mental health
[59:00] facility nearby. And those
[59:01] folks have to do the same
[59:02] thing. These are all people
[59:06] that live east of Keystone.
[59:06] And that's where there's a big
[59:09] residential area back there.
[59:09] She's worried about the
[59:10] patients who would have to
[59:14] cross the street. She can walk
[59:14] to going to be new storm back
[59:15] to the routes within 10
[59:19] minutes. She likes How it all
[59:20] in one stop shop and makes it
[59:22] very convenient or well.
[59:23] That's a person they had
[59:23] listed that signed the
[59:27] petition against. Putting gas
[59:29] that this location. And we
[59:32] found that with a number of
[59:34] people think 42.6, 3% had
[59:35] phone numbers that don't even
[59:41] work. I would say that that
[59:42] the those petitioners
[59:43] shouldn't have any relevance
[59:51] at all today. In or even upset
[59:52] that they were, it was
[59:53] representations that they had
[59:55] signed it. We on the other
[59:56] hand, got 108 signatures all
[59:58] from the neighbors around the
[1:00:03] neighborhood. We filed those
[1:00:05] in all of them have the names,
[1:00:07] addresses, phone numbers in
[1:00:10] all of them were very
[1:00:11] supportive and several. Those
[1:00:13] were the PRESIDENT's of
[1:00:13] neighborhood associations.
[1:00:19] Specter. Well, next, we saw a
[1:00:23] letter from McKenna which MR.
[1:00:28] Burton's has sent every time,
[1:00:28] we have never had any contact
[1:00:31] with contractor, the
[1:00:33] neighborhood associations of
[1:00:35] contacted her. There was no
[1:00:37] meeting, nothing. She
[1:00:37] basically just sent us letter
[1:00:40] she sent to last 3 times
[1:00:43] because we want to explain to
[1:00:44] her that whole situation and
[1:00:45] change your the benefit of the
[1:00:48] doubt from 2022. And we also
[1:00:51] had a traffic study. But we
[1:00:52] want to assure that shows that
[1:00:55] there's no. Increase in
[1:00:56] traffic traffic that's going
[1:00:58] to be done or no question
[1:00:59] about it. So wasn't going to
[1:01:00] add any more traffic to the
[1:01:12] area. So I I would close with
[1:01:17] Tony of that. You know, the
[1:01:19] city have the plan. And in
[1:01:21] that point municipal plan and
[1:01:22] they didn't want any more gas
[1:01:25] stations. Well. There's many
[1:01:26] gas stations going up
[1:01:28] everywhere. Law, mean, you
[1:01:30] name going up every place. And
[1:01:32] here's a place that can really
[1:01:35] use it. And it helps develop a
[1:01:35] piece of property that set
[1:01:40] almost 10 years. And all they
[1:01:40] want to do is be able to
[1:01:43] compete with. The other with
[1:01:45] the other stores. And that's
[1:01:47] you know, that's somebody
[1:01:51] said, congratulations, sir.
[1:01:51] United States for 250
[1:01:52] th-anniversary and that's what
[1:01:55] we're built on capitalism. In
[1:01:55] the ability to compete and
[1:02:03] compete fairly. We believe
[1:02:11] that this is a very positive.
[1:02:12] To bring the equal competition
[1:02:14] and they'll help cancel the
[1:02:18] district. 19. COUNCILMAN, the
[1:02:21] scare is already the stab wish
[1:02:23] that it been the owner many
[1:02:24] times to see all the things

[1:03:33] represent the Keystone Food
[1:03:37] Mart which operates a bp
[1:03:37] fueling station and
[1:03:38] convenience store located at
[1:03:41] 39 50 South Keystone, which is
[1:03:43] located catty corner from the
[1:03:45] subject property. My client
[1:03:48] has been in the operation of
[1:03:49] its since the subject property
[1:03:52] currently owned On llc was
[1:03:57] rezoned in 2017. C 4 with a
[1:04:00] lot of commitments saying what
[1:04:03] uses could not be made. Before
[1:04:07] I get into the specifics of
[1:04:08] say there are 2 sides to every
[1:04:09] pancake, no matter how thin it
[1:04:09] is. And I'm going to give you
[1:04:10] the other side in this case. I
[1:04:16] hope. Prior to 2016, the
[1:04:17] subject property was zone c 3
[1:04:21] and in 2016, a petition was
[1:04:21] filed to rezone a to c 4 by
[1:04:25] the then property owner. The
[1:04:26] rezoning was granted. But with
[1:04:29] a list of commitments that
[1:04:29] prohibit a variety of certain
[1:04:30] uses a whole laundry list of
[1:04:34] things. My client. At that
[1:04:36] time long on came along in
[1:04:40] this matter. My client was one
[1:04:42] of the entities that was
[1:04:43] involved in those matters in
[1:04:46] 2016 before the Metropolitan
[1:04:47] Development Commission. All of
[1:04:48] these commitments were
[1:04:52] generated and one of the
[1:04:53] commitments stated that the
[1:04:55] following uses as defined by
[1:04:56] zoning ordinance for Marion
[1:04:57] County, Indiana shall be
[1:04:59] prohibited as permitted uses.
[1:05:01] One was automobile fueling
[1:05:04] station. This property was not
[1:05:07] zoned for an automobile
[1:05:07] fueling station. It was
[1:05:09] rezoned to see for with the
[1:05:10] commitment that it would not
[1:05:11] be used for an automobile
[1:05:13] feeling station on that basis.
[1:05:15] My client did not remind
[1:05:16] straight there was settlement
[1:05:19] back in 2016, those
[1:05:22] commitments recorded in 2070.
[1:05:24] So my point was there long
[1:05:25] before that was involved what
[1:05:25] was happening at this
[1:05:32] location. The this is our 7th
[1:05:32] hearing on this matter. 7
[1:05:37] Terry. We had a hearing in
[1:05:39] 2002 in front of the hearing
[1:05:42] examiner to modify the
[1:05:43] commitments, takeout. They
[1:05:44] want to do it they wanted to
[1:05:45] have a few links. This
[1:05:45] prohibition against a fueling
[1:05:49] station taken out. We did that
[1:05:52] and they they lost that the
[1:05:53] hearing and you have this in
[1:05:55] your path that the hearing
[1:05:57] examiner Judy Works held duty
[1:06:00] awards hall had a substantial
[1:06:02] hearing. There on straight
[1:06:03] ers. The record. We had all
[1:06:04] kinds of signatures from
[1:06:06] people that didn't want hurt
[1:06:07] MISTER, MR. Khan, talk about
[1:06:08] some of those signatures in
[1:06:11] the most recent hearing. They
[1:06:13] had no support in that hearing
[1:06:15] from anybody that appear
[1:06:16] before Judy for the hearing
[1:06:20] examiner. I think that
[1:06:22] representative or of
[1:06:23] commission COUNCILMAN Else get
[1:06:26] it right here. Council mass
[1:06:27] Kerry had been indicated to be
[1:06:30] in favor of this along council
[1:06:33] COUNCILMAN Bill. But in 2002,
[1:06:38] the hearing examiner deny,
[1:06:38] made a negative
[1:06:40] recommendation. It went in
[1:06:41] front of a full Metropolitan
[1:06:42] Development Commission in 2002
[1:06:46] to remove this staff was
[1:06:47] against it. Staff said staff
[1:06:48] said that this is not a proper
[1:06:51] use at this location. You have
[1:06:53] I hope a copy of the staff
[1:06:55] report which is substantial.
[1:06:57] It's basically been the same
[1:07:04] report 3 times in 2022 2024
[1:07:05] 2026 saying that this is not
[1:07:10] an appropriate use McCAnn, a
[1:07:11] which counsels critical love.
[1:07:16] Sounds to me the the Marion
[1:07:17] County Alliance of
[1:07:19] Neighborhood Associations
[1:07:22] saying Iit's PRESIDENT Wrote a
[1:07:25] letter and 2022 saying that
[1:07:27] that zoning didn't provide
[1:07:29] Fort. The comp plan didn't
[1:07:30] provide for, you know, the
[1:07:32] comp plan's not some ancient
[1:07:34] document that was done in
[1:07:34] 2016, 2017 approved by the
[1:07:35] Metropolitan Development
[1:07:37] Commission. And and approved
[1:07:39] by the council. What is the
[1:07:41] comp plan say about this? It's
[1:07:44] not supposed to be c for you
[1:07:45] says and I'll get into that
[1:07:48] typology as to what's
[1:07:49] proposed. So Mike Hanna wrote
[1:07:51] a letter and I I guess I
[1:07:55] thought that McKenna has it's
[1:07:58] as as the whole Marion County
[1:08:00] Alliance, the the umbrella
[1:08:02] Group had some understanding
[1:08:06] of what could and should be
[1:08:07] billed. And staff rode a
[1:08:08] report that said that the
[1:08:10] property should not be rezone.
[1:08:11] Let me go back to the
[1:08:14] purchase. You know, this was
[1:08:17] vacant and it was in bad
[1:08:20] shape. In 19. I'm sorry in
[1:08:24] 2022. On llc bought the
[1:08:26] subject property for $199,999.
[1:08:28] You should have the sales
[1:08:29] report. Whether you've looked
[1:08:31] at or not. I don't that
[1:08:31] there's a dispute it was in
[1:08:35] bad shape it was purchased.
[1:08:38] Had an assessed value at the
[1:08:39] time of 188,500 for the
[1:08:41] disclosure document that was
[1:08:44] signed by. So wind are saying
[1:08:51] for on llc and the address
[1:08:52] given for that entity. Amadeo
[1:08:56] Elsie was 1, 3, 1, ditch road
[1:08:57] Carmel, Indiana, which turns
[1:08:58] out to be the residents of
[1:09:00] South Wind are saying and his
[1:09:04] wife, cower, which Carmel
[1:09:07] shown that be 3.9 one acres
[1:09:08] with an assessed value of 3.6,
[1:09:09] 5 million dollars. They did.
[1:09:11] Well, the U.S. Couple did
[1:09:12] well. Lot of gas stations
[1:09:15] through a lot of places. They
[1:09:16] bought this property. This
[1:09:17] property was purchased. This
[1:09:20] property was purchased with
[1:09:23] knowledge that there was a
[1:09:24] commitment and this puts the
[1:09:27] first petition 2022 was filed
[1:09:29] 4 months after it was
[1:09:30] purchased for $199,000. Hardly
[1:09:33] ink was dry on the sales
[1:09:37] disclosure document. The
[1:09:38] hearing examiner at one of the
[1:09:38] hearings. I've been at all 6
[1:09:39] hearings, the hearing examiner
[1:09:40] at one of the hearings asked.
[1:09:45] MR. Wind are saying were you
[1:09:47] aware that there was this
[1:09:47] commitment on the property
[1:09:49] when you bought when I'm on
[1:09:49] board? The answer was yes. So
[1:09:53] we have a savvy businessman

[1:10:40] Commission in 2022. Did not
[1:10:42] give relief from the from the
[1:10:43] commitment that there should
[1:10:45] not be a gas station on here
[1:10:46] on the basis that it wasn't
[1:10:49] zone for it. The comprehensive
[1:10:50] plan certainly didn't call for
[1:10:52] As a matter of fact, the
[1:10:53] comprehensive plan, which I
[1:10:55] expect you all are familiar
[1:10:57] with, provides that there's
[1:10:59] not even to be a auto fueling
[1:11:03] facility in. This is in the in
[1:11:05] in the comprehensive plan for
[1:11:06] this property. So there are
[1:11:08] way outside the comp plan. Can
[1:11:11] I see going to can I see that
[1:11:12] map? We can you put that up
[1:11:14] there? I don't know whether
[1:11:15] you love seeing all the
[1:11:18] exhibits or not. Are several
[1:11:21] gas stations in this area. As
[1:11:22] a matter of fact, there are 5

[1:11:33] the different gas stations
[1:11:34] between between the
[1:11:35] interchange at Keystone

[1:11:45] and this property of 4,000
[1:11:46] South Keystone, there are 5
[1:11:49] gas stations, one of which is
[1:11:54] owned by g GOD llc or thank a
[1:11:58] principle of which is MR. Wind
[1:11:59] are saying and for Paul cars,
[1:12:01] the resident agent that 1, 3,
[1:12:02] 1, Carmel, Indiana, one of
[1:12:04] their other gas stations. So
[1:12:06] they've got 1, 7, tenths of a
[1:12:07] mile within 7 tenths of a mile
[1:12:10] of this station. There are 5
[1:12:12] other of this location. There
[1:12:16] are 5 other gas stations and
[1:12:17] there and I might add that in
[1:12:21] 2026. You rezoned after a
[1:12:22] hearing in front of the
[1:12:23] Metropolitan Development
[1:12:26] Commission, another parcel
[1:12:30] that is that is in 0, 7 acre
[1:12:32] stretch 2 c 4, which would
[1:12:34] allow for yet another gas
[1:12:36] station and plans were even 5
[1:12:37] with the Metropolitan
[1:12:37] Development Commission for
[1:12:40] that other So there are lots
[1:12:42] of gas stations in here. So so
[1:12:48] we don't have we have this
[1:12:51] attempt to to take up the
[1:12:52] modification the 2022, we come
[1:12:53] back and try the same thing in
[1:12:59] 2024. Same thing. In 2023. The
[1:13:03] financial report of
[1:13:03] representative of Scary and
[1:13:08] COUNCILMAN Dealt show $1100
[1:13:09] contribution to their
[1:13:11] campaigns or their their funds
[1:13:13] from South Wind are saying
[1:13:16] $1100 each and then in 2024,
[1:13:18] when we come back for the
[1:13:19] second time we have we have a
[1:13:21] letter of support that
[1:13:23] COUNCILMAN Matt Scary. He's
[1:13:26] written saying they ought to
[1:13:30] get gas by that time in 2024,
[1:13:31] there is a convenience store
[1:13:32] bill and it is nice. I can
[1:13:33] tell you it is nice. Brick
[1:13:34] looks good. Counsel's told
[1:13:37] about the pictures. It looks
[1:13:39] really good. No gas station,
[1:13:41] south wind or sing comes to
[1:13:42] the hearing in 2024. Before
[1:13:43] the Metropolitan Development
[1:13:44] Commission. And this asked by
[1:13:47] one of the commissioners, if
[1:13:48] you don't get this reason, if
[1:13:50] you don't get this relief from
[1:13:51] this commitment for hitting
[1:13:52] you from selling gas, are you
[1:13:56] going to open it? And he says
[1:13:56] I'm not going open that. We
[1:13:57] can play the tape. If you need
[1:13:58] to lights part of the pack
[1:14:00] that that we that we submitted
[1:14:02] to you. And if you want to see

[1:14:36] is not appealable. So they
[1:14:38] come back and file acs
[1:14:38] rezoning. They want to have
[1:14:41] commercial special use and
[1:14:43] guess what the special uses on
[1:14:44] this property, a gas station.
[1:14:48] So now we're back for the 5th
[1:14:49] time on a gas station in for a
[1:14:51] the Metropolitan front of the
[1:14:53] hearing examiner who once
[1:14:55] again rules that there
[1:14:55] shouldn't be a gas station at
[1:14:57] this location. Recommended
[1:15:00] recommendation of denial. And
[1:15:02] then we go to the Metropolitan
[1:15:03] Development Commission earlier
[1:15:07] this year. Councils there. I'm
[1:15:11] there. The parties are there.
[1:15:11] And again, the Metropolitan
[1:15:13] Development Commission rules
[1:15:14] that the property should not
[1:15:16] be re-zoned for a gas station.
[1:15:17] Every one of these times it
[1:15:19] every one of these cases, the
[1:15:21] staff has written a report
[1:15:23] that is basically the same
[1:15:27] saying this doesn't belong
[1:15:28] here. The comprehensive plan
[1:15:29] doesn't contemplate it. The
[1:15:32] zoning doesn't contemplate it.
[1:15:34] A gas station doesn't belong
[1:15:35] at this location. We don't
[1:15:36] need another gas station.
[1:15:37] That's what mechanics. That's
[1:15:39] what my client negotiated for
[1:15:44] way. Back in 2022 in this map,
[1:15:45] you'll see that there are 5
[1:15:46] other gas stations. We've just
[1:15:47] had a rezoning that would
[1:15:49] allow for a 6th and now they
[1:15:50] want to have another gas
[1:15:52] station. Let me say. When the
[1:15:54] when I'm on bought this
[1:15:56] property, a man who headed up
[1:16:00] by MR. Supporters say. And the
[1:16:01] original hearing, he said he
[1:16:07] said. Want to get this wrong.
[1:16:08] Online. Llc owns and operates
[1:16:10] a total of 40 filling stations
[1:16:11] and convenience stores
[1:16:13] Indianapolis Metro area. No
[1:16:13] complaints or violations from
[1:16:15] local, state or federal
[1:16:17] government has been in
[1:16:17] business many years. Well,
[1:16:18] that's true. He's been very
[1:16:20] successful. I don't know about
[1:16:21] the complaint because in this
[1:16:23] case we've got a lot of
[1:16:26] complaints. We've got zoning
[1:16:26] violations since this since
[1:16:29] convenience store opened in
[1:16:31] 2024, we've got we've got
[1:16:32] violations from the Marion
[1:16:35] County Health Department,
[1:16:36] which you have in the packet
[1:16:37] that was given you and I can
[1:16:38] go through the specifics of
[1:16:41] them. If you want. Time is
[1:16:42] limited here. And so I'm not
[1:16:44] sure there's been such good
[1:16:45] vetting of the operations that
[1:16:50] are conducted by on llc or
[1:16:52] other or related entities. Him
[1:16:55] to say that there haven't been
[1:16:56] violations at this location
[1:16:58] since it opened in 2024. Is
[1:16:59] not right. There have been
[1:17:01] violations and it's in your
[1:17:02] packet. We can we can go
[1:17:03] through them specifically if
[1:17:07] you want signage violations,
[1:17:10] there's somebody by the name
[1:17:11] will Mahar llc. That's also
[1:17:15] cited as a violator in 2025.
[1:17:17] 2026 after the stores open in
[1:17:22] your pack. Mahar llc, uproar
[1:17:23] Mahar is apparently operator.
[1:17:24] I guess a tenant. There's
[1:17:26] referenced in the report from
[1:17:27] the this is a neighborhood
[1:17:29] services department. The
[1:17:31] inspector that Mahar as a
[1:17:33] tenant and there are
[1:17:35] violations of zoning
[1:17:36] ordinances, signage. And then
[1:17:38] the Marin County Health
[1:17:40] Department apparently got a
[1:17:42] bounced check from the Har llc
[1:17:43] for its license. I don't even
[1:17:44] know that's licensed. My point
[1:17:46] of all, this is well council
[1:17:51] wants to make MR. Some wonder
[1:17:58] saying our online llc, gist of
[1:17:58] just an absolute Abbott Haro
[1:17:59] of performance. I'm telling
[1:18:00] you that at this station, if
[1:18:02] you look at the documents that
[1:18:04] we've submitted, the owner of
[1:18:04] this property MAY not be the
[1:18:08] operator MAY be Mahar llc is
[1:18:10] in fact the operator or the
[1:18:12] tenant there have been several
[1:18:16] violations at this location.
[1:18:17] So now that that that doesn't
[1:18:19] reflect well upon an extension
[1:18:22] of the of the other use.
[1:18:23] Council's asked for her. I'm
[1:18:29] going to say. In conclusion is
[1:18:30] appreciated. That zoning is a
[1:18:32] legislative function made by
[1:18:32] the body politic. And that is
[1:18:35] you, however, the record in
[1:18:38] this case does not support the
[1:18:39] rezoning army to allow this
[1:18:40] property have a fueling
[1:18:42] station. With all due respect
[1:18:42] to the counselors who have
[1:18:45] supported that. Calling up of
[1:18:48] this matter and with
[1:18:48] recognition of the
[1:18:50] relationship of Wind are
[1:18:50] saying they've won 3, 1, ditch
[1:18:53] road in Carmel as a supporter
[1:18:54] of them in with the
[1:18:55] recognition of the new
[1:18:56] convenience store at the site
[1:18:57] being an improvement over
[1:19:00] previous structure. So the
[1:19:00] site there is nothing
[1:19:04] substantive to support this
[1:19:06] rezoning on bought the
[1:19:09] property for almost $200,000
[1:19:11] in 2022. Bill to permit a
[1:19:12] convenience store was well
[1:19:15] aware of the commitments there
[1:19:17] on received the benefit of its
[1:19:18] bargain. That exactly where
[1:19:20] part floor and then decided to
[1:19:22] go ahead. And I let me say
[1:19:24] that I have never heard
[1:19:25] anything about all this
[1:19:25] negotiation, but well, we'll
[1:19:26] go ahead and build a
[1:19:27] convenience store to see how
[1:19:28] it goes. We've got a guy that
[1:19:32] we have an entity, a principal
[1:19:34] of that entity who has I think
[1:19:35] I thought I heard council said
[1:19:38] maybe 100 locations, 100
[1:19:40] businesses and and went ahead
[1:19:42] and built this convenience
[1:19:43] store without gas. And now
[1:19:45] comes in now for the 7th time
[1:19:47] after 6, the Niles by the
[1:19:51] hearing examiner, the mdc
[1:19:51] seeking a gas station. I want
[1:19:52] to talk a little bit about
[1:19:56] about the of the staff report.
[1:19:59] For a run out of time. The
[1:20:06] staffer for provided in part
[1:20:07] The request would rezone the
[1:20:08] site to siesta provide for c 3
[1:20:11] uses automobile fueling
[1:20:13] station. The cs designed is
[1:20:14] designed to permit within a
[1:20:17] single zoning district. Multi
[1:20:18] use commercial complexes or
[1:20:21] land use combinations of
[1:20:22] commercial and non-commercial
[1:20:24] uses for single use commercial
[1:20:25] projects. Then the staff
[1:20:26] report goes on to say the
[1:20:30] special commercial district is
[1:20:32] that is established for the
[1:20:33] following purposes. One to
[1:20:35] encourage a more creative
[1:20:36] approach in land, planning
[1:20:37] superior site and structural
[1:20:38] design and development to to
[1:20:39] provide for use of land with a
[1:20:42] highly functional news. 3 to
[1:20:43] ensure compatibility with land
[1:20:45] uses both within cs and
[1:20:49] adjacent areas for to permit
[1:20:51] special consideration of
[1:20:51] property with outstanding
[1:20:52] features, including but not
[1:20:53] limited to store or potential
[1:20:57] or social significance. To
[1:20:58] provide maximum adaptability
[1:20:59] and flexibility in zoning and
[1:21:02] development controls to meet
[1:21:03] the changing and diverse needs
[1:21:04] of metropolitan area. Here's
[1:21:10] what staff concludes in 2026.
[1:21:11] Staff believes that the
[1:21:14] development of this site with
[1:21:15] a gasoline station does not
[1:21:16] align with any of the above
[1:21:17] purposes that the ordinance
[1:21:20] outlines for the cs District.
[1:21:22] It is already zoned c 4, which
[1:21:25] permits 59 primary land uses.
[1:21:29] An additional. Specific I'm
[1:21:32] sorry land uses and 26
[1:21:32] accessory uses. Furthermore,
[1:21:35] many of those land, land
[1:21:36] categories identify additional
[1:21:38] specific uses within the Cold
[1:21:41] War in staff's opinion. The
[1:21:42] site as many permitted uses
[1:21:43] that would serve the
[1:21:43] surrounding neighborhood and
[1:21:46] support the plan. The other
[1:21:48] thing I want to talk about the
[1:21:50] comp plan. Staff believes that
[1:21:52] the convenience stores
[1:21:53] improvement of the site that
[1:21:54] fallen into Disrepair, and
[1:21:56] supports the plan.
[1:21:57] Recommendations of village
[1:22:01] mixed use. However. Further
[1:22:02] development of the site for an
[1:22:03] automobile feeling station
[1:22:04] would increase the commercial
[1:22:06] intensity and encroachments
[1:22:06] that would be detrimental to
[1:22:10] the surrounding land uses. But
[1:22:11] introducing increased traffic
[1:22:13] noise, lighting trash into the
[1:22:14] area council talked about a
[1:22:16] traffic study. There is no
[1:22:18] traffic study. I haven't seen
[1:22:19] a traffic study. There was no
[1:22:20] traffic's that there were some
[1:22:21] traffic counts that were put
[1:22:24] in a traffic study as you I'm
[1:22:26] sure know. It's something that
[1:22:27] either Dmd can request or
[1:22:29] individual can voluntarily do.
[1:22:31] That was not done in this
[1:22:33] case. They're going to be more
[1:22:34] stops in and out of the
[1:22:36] station if going to be gas
[1:22:41] there, there's a residential
[1:22:43] zoning as as the staff report
[1:22:48] points out to the East d 3
[1:22:48] single-family dwelling zoning.
[1:22:49] So now we're going to put it.
[1:22:51] They want to put a gas station
[1:22:54] that's going to operate. 24 7
[1:22:56] next to dwellings. 3
[1:22:57] incompatible use. And the comp
[1:22:58] plan says it shouldn't.
[1:23:00] Shouldn't be used to. The last
[1:23:01] thing I want to talk about in
[1:23:04] the comp plan is the specifics
[1:23:05] of the village mixed use
[1:23:08] Typology, which is what this
[1:23:10] is. And then in in their their
[1:23:12] is a specific statement in the
[1:23:14] comp plan approved by. The
[1:23:16] commission and and and I
[1:23:22] council. No fueling stations.
[1:23:22] So the comp plan expressly
[1:23:26] calls us out. Based upon this.
[1:23:29] We respectfully request come
[1:23:33] that the council go along with
[1:23:37] the past 6 recommendations.
[1:23:39] From the mdc and that hearing
[1:23:40] examiner and not allow fueling

[1:25:40] Petitioner said. He said one
[1:25:42] that I bring in this gas
[1:25:44] station that it will attract
[1:25:45] new business is right. It's
[1:25:47] going to bring more people to
[1:25:48] the area, more shopping, more
[1:25:50] businesses. That sounds great.
[1:25:51] And then it goes to contradict
[1:25:54] himself by saying that the
[1:25:55] traffic study there will be no
[1:25:56] more traffic. Actually, it's
[1:25:57] going to be exactly the same.
[1:25:59] So which is it? And then he
[1:26:00] goes on to talk about
[1:26:04] capitalism and how despite
[1:26:04] selling, you know, great
[1:26:05] goods, fresh foods, fresh

[1:32:40] it in end of the month.

[1:32:46] gas war simple as that. The
[1:32:47] only re monsters we have is
[1:32:47] the other gas stations
[1:32:51] counseling. Additional

[1:33:12] the street in Roselle Hills. I
[1:33:13] have heard that for as long as
[1:33:16] been going on. I've heard from
[1:33:17] in particular Rosedale Hills,
[1:33:20] but I from from some people in
[1:33:21] University Heights that are
[1:33:22] both adjacent neighborhoods
[1:33:25] that they are in favor of
[1:33:26] this. That the it really
[1:33:30] didn't get discussed here. But
[1:33:31] the property across the street
[1:33:32] that's in my district is
[1:33:33] almost completely abandoned
[1:33:35] strip mall. As a result, we
[1:33:37] have a lot of crime occurring
[1:33:39] there. To your point, there is
[1:33:40] additional housing being built
[1:33:44] my district the residents are
[1:33:45] senior citizens that have
[1:33:47] expressed an interest to this
[1:33:51] new location as well. And I
[1:33:52] can say that I've worked much
[1:33:52] of my career in the
[1:33:55] convenience store industry and
[1:33:57] the reality is this is a
[1:33:58] suburban environment and
[1:34:00] making non gas convenience
[1:34:02] store is it's just almost
[1:34:04] impossible. There was one in
[1:34:07] your district. For 31. It just
[1:34:08] closed a couple weeks ago. I
[1:34:08] never knew how they were going
[1:34:11] to make it without gas and
[1:34:12] they did. And so the neighbors
[1:34:16] have communicated to me
[1:34:17] repeatedly that they are
[1:34:18] supportive of this because it
[1:34:19] is some kind of development
[1:34:20] here. Comment. There isn't any
[1:34:22] other interest. I wish there
[1:34:24] was because I'd love for
[1:34:25] something to be built on my
[1:34:27] side of the street. But this
[1:34:28] is the best thing that has
[1:34:30] come along and so on. I'm

[1:35:04] it's a rare person who lives
[1:35:06] in Carmel, Indiana, who feel
[1:35:07] so strongly about Indianapolis
[1:35:08] politics that they want to
[1:35:09] both help a Republican and a
[1:35:10] Democrat win on the south side
[1:35:13] of town. It's probably not
[1:35:14] being motivated by their
[1:35:15] sincerely held beliefs. It's
[1:35:16] probably being motivated by
[1:35:17] who they think could scratch
[1:35:19] their back a little bit later.

[1:35:20] ridiculous thing to state. It
[1:35:23] seems comes it suggests that
[1:35:25] as as Mr Khan mentioned, there
[1:35:27] are many other people in the
[1:35:29] room, you know, that's Gave

[1:35:35] get engaged in this type of

[1:36:00] when shootings happened a gas
[1:36:04] station near my house. You
[1:36:07] heard one of my constituents

[1:36:08] I've heard consistently, which
[1:36:09] is we do not need any more gas
[1:36:11] stations in the city and most
[1:36:12] constituents feel the way most
[1:36:13] people don't want to live near
[1:36:15] a gas station, which is why
[1:36:16] MISTER Doesn't live near a gas
[1:36:18] station. He lives up Carmel,
[1:36:19] not here in Indianapolis,
[1:36:21] close to the 6 gas stations
[1:36:22] owned sites that we're talking
[1:36:23] about. Finally, I just want to
[1:36:26] point out that this room, at
[1:36:28] least this half of the room is
[1:36:29] filled with people who have
[1:36:29] been participating and hearing
[1:36:31] examiner hearings and hearings
[1:36:35] in front of mdc. And they've
[1:36:36] had very, very little ability
[1:36:39] to hold developers
[1:36:39] accountable, very little
[1:36:40] ability. The one thing they
[1:36:42] can do is with commitments.
[1:36:43] And right now was watching a
[1:36:44] developer just wanting to
[1:36:45] throw commitments in the trash
[1:36:47] for business sense. What
[1:36:48] message are we sending in
[1:36:49] terms of corruption and in
[1:36:51] terms of accountability of
[1:36:51] vote for this tonight is right

[1:42:00] part of a massive
[1:42:02] redevelopment on the east side
[1:42:04] of Indianapolis. So
[1:42:07] historically, there was a this
[1:42:08] the site that used to have
[1:42:08] 6,000 employees on the east
[1:42:10] side of Indianapolis that shut
[1:42:14] down in 2011 and then years
[1:42:16] later, a developer loud came
[1:42:18] in and started cleaning site.
[1:42:22] They divided it into 4
[1:42:24] quadrants. This is statement
[1:42:26] benefits for the northeast
[1:42:26] quadrant for an organization
[1:42:29] that is a manufacturing
[1:42:30] facility. What's really cool
[1:42:32] to talk about this, the site
[1:42:34] and he's been able to do and
[1:42:36] bring in folks like this is
[1:42:36] the lot of jobs or they're
[1:42:37] bringing back to the side.
[1:42:39] It's not as impactful as what
[1:42:43] once was with for. That's very
[1:42:44] tough bench to hit the head
[1:42:48] 6,000 employees that time.
[1:42:48] When we left, the originally
[1:42:49] came in that that they're
[1:42:53] going to be around 2.50, 300.
[1:42:54] They're now closer to 1000 the
[1:42:54] full build out of this entire
[1:42:57] site was actually amazing
[1:42:59] thing in this job or
[1:43:00] development itself is around
[1:43:02] 350 of that. And those are
[1:43:03] manufacturing jobs, which of
[1:43:07] those things we don't see very
[1:43:09] often and so I'm very
[1:43:11] supportive of this proposal
[1:43:11] because it is helping out the
[1:43:12] residents and on the side
[1:43:13] helping out the things that we
[1:43:15] need to do and redevelop some
[1:43:19] of these old brownfield sites
[1:43:20] from my understanding, you
[1:43:22] know, watching back the video
[1:43:23] just going through some points
[1:43:26] that I wish I could have to
[1:43:28] explain the commitments of
[1:43:29] benefits and where this is
[1:43:31] impactful for. And so, you
[1:43:34] know, that's it's split into 2
[1:43:34] buckets of where those dollars
[1:43:35] to go in. One bucket is the
[1:43:37] pending trail. So the site
[1:43:38] essentially sits on top right
[1:43:43] below the pens, the trail 90
[1:43:44] percent of the dollars go
[1:43:45] towards the Penske trail
[1:43:47] towards improvements and
[1:43:48] infrastructure. There. And
[1:43:50] then there's $10,000 that I
[1:43:55] asked sent to the Cumberland.
[1:43:59] Cdc and why that is is because
[1:43:59] earlier with the same site
[1:44:03] with the Thunderbirds site, we
[1:44:04] appropriated $50,000 to the
[1:44:08] Cumberland cdc to help with a
[1:44:08] design plan and market
[1:44:09] analysis. Study on the
[1:44:13] Washington Square Mall. So
[1:44:13] you'll heard me talk a million
[1:44:16] times about how Washington on
[1:44:17] my district. We've got to do
[1:44:17] something about it. And so
[1:44:20] since MARCH of this year,
[1:44:21] we've been doing redevelopment
[1:44:24] plan on that mall with
[1:44:27] partners from Louth as the
[1:44:31] sponsors Far East Side
[1:44:32] Community Council. My so
[1:44:33] Cumberland Schmidt Associates
[1:44:36] is the architect firm on it.
[1:44:37] And then you ally approached
[1:44:38] me and said, hey, we would
[1:44:39] love to be a part of this. And
[1:44:40] we have this thing that's
[1:44:43] called a tap program and which
[1:44:44] they bring experts in the
[1:44:47] field into a two-day study.
[1:44:48] And recently the Grassy Creek
[1:44:50] trail was opened up just north
[1:44:53] of my district. And that is
[1:44:56] slated to head head straight
[1:44:57] down to the pens, a trail with
[1:45:01] intially over the years. And
[1:45:02] what the you ally and what
[1:45:04] we've been talking about is
[1:45:07] how can we actually create a
[1:45:08] bridge over Washington Street
[1:45:09] and show what that development
[1:45:10] would look like? The cost of
[1:45:12] that development to have plans
[1:45:13] through you ally. And that's
[1:45:16] what that $10,000 intended for
[1:45:18] from this. And so that that is
[1:45:20] a big part of the vision for
[1:45:21] the east side of Indianapolis
[1:45:24] to help with the connectivity.
[1:45:26] This makes that possible with
[1:45:27] the community impact payment
[1:45:28] majority that stays right
[1:45:29] there on the trail that exist.
[1:45:30] But we do want to try and do
[1:45:32] some future planning to help
[1:45:33] make that site more
[1:45:35] attractive. That so much on.

[1:45:40] I believe that the concerns
[1:45:42] expressed at the committee
[1:45:43] meeting by my fellow
[1:45:45] councilors have been

[1:45:50] whole lot more detail, as I

[1:46:58] this. I want to make sure that
[1:46:59] the benefits that are being
[1:47:00] generated at the sites are
[1:47:02] seen in the neighborhoods
[1:47:04] where the development is
[1:47:05] actually happening. And so I
[1:47:06] think we're able to achieve
[1:47:06] that goal. But I think as we
[1:47:09] look to the future, we seem to
[1:47:10] continue to be mindful,
[1:47:12] obviously, we're respecting
[1:47:14] counselor discretion, but also
[1:47:15] just continue to collaborate
[1:47:16] work on that. I do appreciate

[1:53:28] to me by by the public. They
[1:53:30] raised awareness after we had

[1:53:35] essentially just bring it
[1:53:37] back. And they brought to my
[1:53:39] attention that 17 year-olds
[1:53:39] were concluded. And so I went
[1:53:43] I looked at the at the
[1:53:44] ordinance and sure it was it
[1:53:45] was true, right? They were not
[1:53:47] included. And so as I got to
[1:53:47] looking doing more research,
[1:53:48] one of the things that I
[1:53:51] discovered is that the first
[1:53:52] homicide victim of the year
[1:53:58] was a juvenile aged 17 past
[1:53:59] curfew hours. And, you know, I
[1:54:01] thought the argument that
[1:54:02] given to me is that, you know,
[1:54:03] a very good one that juveniles
[1:54:06] at the age of 17 are still
[1:54:08] juveniles right? The point of
[1:54:09] this proposal, even with the
[1:54:10] public's a few hours or any
[1:54:12] group curfew hours given that
[1:54:13] isn't just start going and
[1:54:15] taking kids off the street. We
[1:54:18] heard a lot of I think good
[1:54:19] arguments that evening, one of
[1:54:19] which from was the chief of
[1:54:23] police telling us how just by
[1:54:24] proposing this and having the
[1:54:25] conversation and maybe there's
[1:54:25] one or 2 or more conversations
[1:54:27] that happened that evening at
[1:54:29] home would be a positive
[1:54:31] thing. So even if we get that
[1:54:31] minimum accomplished that
[1:54:33] tonight, that's a good thing.
[1:54:36] But it's also about the
[1:54:38] protections that are already
[1:54:39] afforded juveniles are doing
[1:54:40] the right thing, right? Folks
[1:54:42] that are going to work doing
[1:54:43] activities. This doesn't apply
[1:54:46] to them right. This is
[1:54:46] effectively given the tools to
[1:54:48] the officers and making sure
[1:54:49] that we're we're we're given
[1:54:52] that ability to have that
[1:54:54] level accountability. I still
[1:54:58] think we have work to do is on
[1:55:00] proposals that we still have
[1:55:02] table here. I don't think this
[1:55:02] is going to solve the problem
[1:55:04] of crime in Indianapolis by
[1:55:07] itself. I think there's a big
[1:55:08] accountability problem a lot
[1:55:09] of different areas. I think
[1:55:10] Preble County ability is one
[1:55:12] of those. And I think the
[1:55:13] biggest opportunity we have at
[1:55:14] this is if there are juveniles
[1:55:17] that end up being picked up by
[1:55:18] the police and they are
[1:55:19] brought together with their
[1:55:20] parent that there is a serious
[1:55:22] conversation that happens at
[1:55:23] the time that they are united.
[1:55:24] I think that's the most
[1:55:25] powerful thing that could come
[1:55:28] out of this passing. We've got
[1:55:29] a look at this as an
[1:55:30] opportunity where we just came
[1:55:31] off a weekend of the 4th of
[1:55:34] JULY. Beach Cove just south of
[1:55:37] my district, juvenile shooting
[1:55:37] guns, right? I mean, I'm not
[1:55:38] here to have a debate on gun,
[1:55:41] we're here to have a debate on
[1:55:43] on curfew and we are having a
[1:55:44] lack of accountability for
[1:55:45] those kids in those parents.
[1:55:49] And this is one step that at a
[1:55:50] minimum, at least connect
[1:55:52] those in that give an
[1:55:53] opportunity. With that, MADAM

[1:56:14] curfew. And yet as soon as
[1:56:16] these kids turn 18, they're
[1:56:19] able to carry ridiculous
[1:56:20] levels of weaponry around
[1:56:21] openly on our streets. Thanks

[1:56:25] I'm in favor of the Second
[1:56:27] Amendment. I'm a pacifist
[1:56:28] personally but think that
[1:56:28] people should have the right
[1:56:31] to bear arms. But when we
[1:56:33] arbitrarily choose someone's
[1:56:34] birthday as the time when all
[1:56:36] the sudden they just have all
[1:56:36] the rights of the world's only
[1:56:39] available to them. I don't
[1:56:40] think that's that's our kids
[1:56:40] up for success. I do think
[1:56:43] that's that's parents up for
[1:56:44] success. No one proposal is
[1:56:45] going to solve every problem
[1:56:48] in the world. I get that. But
[1:56:48] when I'm looking at
[1:56:51] constituents of mine who've
[1:56:52] sat here for hours to make
[1:56:54] sure that there's someone
[1:56:54] looking at our eyes who works
[1:56:56] with children who works with
[1:56:58] the youth, who has told us and
[1:56:59] has testified before when we
[1:57:01] did a public comment that this
[1:57:01] is not the way to go. This is
[1:57:04] not going to help. I think
[1:57:05] someone has to listen to that
[1:57:06] and speak up side. Debra about

[1:57:22] to be empowered impd with to
[1:57:24] keep our city safe because for
[1:57:25] all of this really for the
[1:57:27] safety of the kids. Obviously,
[1:57:31] we do not want anybody you
[1:57:31] know, unsafe situation
[1:57:33] downtown, where there could be
[1:57:35] potential use guns. And I
[1:57:36] think, you know, you
[1:57:38] highlighted wealth. We could
[1:57:40] be and forcing different
[1:57:40] things will be different
[1:57:41] conversation. But the reality
[1:57:44] is it's not the that things
[1:57:45] were empowered by the state
[1:57:47] house to actually change. Also
[1:57:49] one point that think about a
[1:57:50] lot is how complex our current
[1:57:53] curfew laws are. They're
[1:57:55] different for people under 14
[1:57:56] different people are 15 16
[1:57:59] different for 17 18. Plus,
[1:58:01] obviously that for weekdays
[1:58:01] and weekends and if some
[1:58:02] making up to me and asked me
[1:58:04] to explain the intricacies of
[1:58:06] the days that we can ages, I
[1:58:07] cannot give them the real
[1:58:08] answer little on. I'm sure an
[1:58:09] officer little a child as
[1:58:11] trying to figure it out. So to
[1:58:12] me I trust impd officers will
[1:58:18] have some level of situational
[1:58:19] understanding of of the youth
[1:58:21] and the not try to enforce in
[1:58:21] a bad way. But you think this
[1:58:23] is a step and I do give credit
[1:58:24] for people have worked on this
[1:58:25] because I did check him out on
[1:58:26] a from last year after really
[1:58:27] considering that intricacies
[1:58:28] of the law. Thank you. Thank

[2:04:08] was campaign contributions and
[2:04:11] how those impact policy. I
[2:04:12] just find it really noteworthy

[2:07:53] This has been a robust
[2:07:55] process. The council took that
[2:07:55] proposal for different
[2:07:58] locations and around our city
[2:07:59] constituents, leaders and
[2:07:59] counselors have been able to
[2:08:01] engage in thoughtful
[2:08:04] discussions about how we fully
[2:08:05] recognize the generational
[2:08:05] 50 million dollar annual
[2:08:06] infrastructure investment
[2:08:10] investment for our city. This
[2:08:10] funding was made available in
[2:08:12] 2025. To House wrote the role
[2:08:13] 14 61 after years of hard work
[2:08:18] by many in this room. And in
[2:08:18] this building, appealing to
[2:08:19] state leaders on the need to
[2:08:20] provide fairness and how the
[2:08:22] capital City receives road
[2:08:23] funding and recognizing that
[2:08:23] no level of government is
[2:08:27] doing enough. Earlier this
[2:08:28] year. Senate Rolex one 79 made
[2:08:30] several changes to the
[2:08:31] eligibility and timeline for
[2:08:31] the 50 million that created
[2:08:34] the present reality. To
[2:08:35] receive the investment. The
[2:08:36] city must progressively
[2:08:37] contribute additional new
[2:08:39] revenue toward infrastructure
[2:08:40] next year. We need to find
[2:08:41] 50 million to receive
[2:08:43] 50 million rising to
[2:08:44] 100 million for 50 million
[2:08:46] beginning in 2031. And after
[2:08:47] the provision is all or
[2:08:48] nothing, there's no there are
[2:08:51] no partial matches. We receive
[2:08:54] 50 million or $0 and there are
[2:08:55] no mulligans. The first year
[2:08:56] we cannot match the funds. We
[2:08:56] are no longer eligible in the
[2:08:59] future. There's also very
[2:09:00] important deadline and that's
[2:09:02] the end of this calendar year
[2:09:03] DECEMBER 31st. This is when we
[2:09:04] must communicate of the state.
[2:09:05] We have the funding and
[2:09:06] identify where the funding is
[2:09:09] coming from. As we discussed
[2:09:10] at length in our 4 community
[2:09:11] meetings, our options are
[2:09:13] limited. There was thorough
[2:09:13] discussion on several
[2:09:16] potential new revenue sources.
[2:09:17] Marijuana, a commuter tax
[2:09:20] vehicle miles traveled model a
[2:09:21] convention tax for roads. All
[2:09:22] of these are not legal in the
[2:09:24] state. The state would need to
[2:09:25] legalize and create a taxing
[2:09:26] structure for local
[2:09:28] governments. The city County
[2:09:31] Council cannot legislate this
[2:09:32] at this time. But many of us
[2:09:34] have advocated for each of
[2:09:36] these our plan recognize that
[2:09:37] growth alone cannot solve this
[2:09:39] problem but should be part of
[2:09:40] the equation. And while we can
[2:09:41] set specific income and
[2:09:43] property tax rates, the
[2:09:44] parameters that those rates
[2:09:47] are also set by the state and
[2:09:48] for both revenue sources. We
[2:09:50] either need to raise them. Or
[2:09:52] take away revenue think other
[2:09:54] taxing units like the library
[2:09:56] towns like Beech Grove
[2:09:58] Speedway in Southport. We also
[2:10:01] discussed budget cuts which we
[2:10:02] MAY need to turn to eventually
[2:10:03] if we are unsuccessful with
[2:10:06] this proposal. But let me be
[2:10:08] perfectly clear. We are not
[2:10:10] cutting from a 1.7 billion
[2:10:11] dollar budget. So a one or 2%
[2:10:14] trim won't cut it because only
[2:10:15] around a quarter of that
[2:10:18] revenue is eligible to be used
[2:10:19] for infrastructure. So that
[2:10:21] kind of closer to 10%. And we
[2:10:22] talk about cuts. We're cutting
[2:10:24] from eligible funding that is
[2:10:25] already being used for public
[2:10:28] safety to build fire stations
[2:10:29] ensures pools are open. Grass
[2:10:30] gets cut at parks and we pick
[2:10:34] up the dang trash. That's not
[2:10:35] fiscal discipline. It shifting
[2:10:37] the cost elsewhere. This is
[2:10:38] not to say that we do not need

[2:10:43] Senator rollback one is
[2:10:43] forcing us to do just that to
[2:10:45] the tune of 50 million dollars
[2:10:45] last year. We are already
[2:10:50] doing the work. The idea that
[2:10:51] there's this annual amount of
[2:10:53] 50, 7000 million dollars
[2:10:54] annually laying around that
[2:10:57] doesn't include cutting from
[2:10:57] basic services and core
[2:11:01] operations is untrue period.
[2:11:01] And like many other
[2:11:02] communities around our state.
[2:11:05] And in this moment, we are
[2:11:07] being forced to rely more on
[2:11:08] income taxes and user fees
[2:11:09] like the wheel tax in the
[2:11:10] surtax to meet basic
[2:11:13] operations for our city. So
[2:11:13] this leads us to the pro
[2:11:15] proposed before the council
[2:11:17] this evening, raising an
[2:11:19] existing user fee that must be
[2:11:20] used exclusively for
[2:11:22] infrastructure. Ensures the
[2:11:22] heaviest vehicles pay as much
[2:11:25] as legally possible and
[2:11:26] provides predictable,
[2:11:26] sustainable funding next year
[2:11:29] and every year after as we
[2:11:30] have discussed publicly for
[2:11:32] hours. So I won't fully rehash
[2:11:33] proposal. One 92 is part of a
[2:11:36] five-year plus council plan to
[2:11:37] ensure the city can leverage
[2:11:40] the state's investment by
[2:11:42] 2031. More than 200 million
[2:11:43] dollars annually in new and
[2:11:44] permanent infrastructure
[2:11:47] funding in the budget. And
[2:11:48] it's not just a city of
[2:11:50] Indianapolis. The benefits
[2:11:51] owed to 15 excluded cities and
[2:11:54] included towns. Some examples
[2:11:54] Beech Grove receive an
[2:11:56] additional 1.0 2, 2 million
[2:12:00] Speedway. 1.0 9 million. In
[2:12:01] closing. I fully recognize and
[2:12:02] appreciate the weight of the
[2:12:03] vote this evening. I don't
[2:12:06] want to dismiss it and it does
[2:12:07] not mean we have to like the
[2:12:09] challenge in front of us and
[2:12:10] the pain of picking from a set
[2:12:11] of suboptimal options. But
[2:12:14] choosing to do nothing are
[2:12:15] choosing to kick the can down
[2:12:16] the road again won't solve our
[2:12:18] city's infrastructure
[2:12:19] challenges. I fear we kick the
[2:12:20] can one more time and MAY very
[2:12:23] well disintegrate. For all the
[2:12:24] progress we have on this issue
[2:12:27] for the past decade, we have
[2:12:29] not received reach
[2:12:30] sustainability because people
[2:12:34] in our positions. In the past
[2:12:36] over decades have found
[2:12:37] convenient arguments that
[2:12:40] quote now is not the time
[2:12:41] without a permit permanent
[2:12:42] budgetary solution to satisfy
[2:12:43] the 50 million dollar State
[2:12:44] contribution. We cannot say we
[2:12:46] have the funds available. We
[2:12:48] just cannot. That MAY be a
[2:12:49] tough reality for for for some
[2:12:51] to fully grasp or accept, but
[2:12:52] it doesn't make it any less
[2:12:54] true. So when faced with
[2:12:58] reality, what we do. Let's
[2:12:59] ourselves to do the right
[2:12:59] thing to face reality and
[2:13:02] leave the city with that
[2:13:03] colleagues extra vote this
[2:13:03] evening. Thank you, MADAM

[2:13:13] give me a little bit of grace,
[2:13:14] I know everybody probably
[2:13:15] wants an opportunity speak. I

[2:13:23] just want to rub out a few
[2:13:23] things. The council Nielsen
[2:13:24] said because I think these are
[2:13:28] just truly differences of how
[2:13:30] to approach the problem. I
[2:13:33] certainly believe that we
[2:13:35] absolutely should increase the
[2:13:37] funding. We've already for
[2:13:39] that for years, I argued in
[2:13:40] budget hearings last year, the
[2:13:42] mayor said that would have no
[2:13:43] problem coming up with the
[2:13:45] 50 million I actually said,
[2:13:46] why don't come up with in
[2:13:48] 2026, which we heard last
[2:13:52] year? I think that much.
[2:13:56] Possibly even all of the
[2:13:57] needed 50 million can come
[2:13:57] from organic tax without even
[2:13:59] actually cut here because I
[2:14:02] agree with the council
[2:14:03] Nielsen's that if really went
[2:14:04] after cut and use the 2026
[2:14:07] budget, that's one thing. But
[2:14:09] I think that we have the
[2:14:11] ability through organic tax
[2:14:12] everybody. When people get
[2:14:13] raises, we get 2 point o 2% of
[2:14:16] every year we can use those
[2:14:22] spots. I also have a we heard
[2:14:22] the other comment about the
[2:14:23] excluded cities include towns.
[2:14:26] I have one of each in my
[2:14:27] district and I reached out
[2:14:30] each of them and they chose to
[2:14:32] not request the money they do.
[2:14:33] In fact, they are. So Ford is
[2:14:34] the only one that does not
[2:14:38] have the population to vote
[2:14:38] for their own. So it is
[2:14:40] possible, for example, for
[2:14:41] Beech Grove, 2, they've been
[2:14:45] talking about $25 tax that
[2:14:45] they we can vote one way or
[2:14:47] another. Here they have that
[2:14:49] tool themselves. Southport
[2:14:51] does not, but they chose to
[2:14:55] ask for that money here. And
[2:14:56] one of the biggest problems I
[2:14:59] really struggle with on is
[2:15:01] that the flat tax approach and
[2:15:01] the dollar amount that we're
[2:15:05] talking $600 at the low end.
[2:15:06] If you have a low value
[2:15:07] vehicle under the current
[2:15:10] model, it I heard a lot of
[2:15:12] senior citizens tell me I have
[2:15:13] an old car. I'm paying $7.50
[2:15:15] because I drive a 20 year-old
[2:15:18] Toyota. But at the same time,
[2:15:21] if you drive a brand new
[2:15:22] Ferrari brand new Bentley,
[2:15:24] you're actually paying 106. 25
[2:15:25] today. So you get a little bit
[2:15:26] of a tax break in I just
[2:15:30] can't. I just cannot reconcile
[2:15:31] that. And so for those
[2:15:33] reasons, I I'm not gonna be
[2:15:33] able to support this.
[2:15:34] Certainly urge my colleagues
[2:15:37] to do the same thing. Council
[2:15:44] miscarry. Thank you, MADAM,

[2:15:48] equity. And I've said caucus.
[2:15:50] I think the 25 districts
[2:15:51] should get decent amount of
[2:15:56] money return. It's a tough to
[2:15:56] swallow to. I have one

[2:16:00] daughters man and wife. This
[2:16:04] is 5 cars as $500 but unless
[2:16:05] we get equity, I really cannot
[2:16:06] support this right now. Thank

[2:16:18] to reiterate what I said
[2:16:18] during one of our public
[2:16:21] hearings on this, which is
[2:16:21] that this is political
[2:16:25] oppression. When you heard
[2:16:26] council Nielsen accurately
[2:16:27] describe what's going on here.
[2:16:30] This is the state house coming
[2:16:31] to us with the political
[2:16:33] equivalent of a gun to our
[2:16:35] head saying that we have to
[2:16:38] raise money even though we're
[2:16:38] already a donor county in
[2:16:40] terms of how we fund the
[2:16:42] state, we have to raise
[2:16:43] additional money, not from the
[2:16:45] people who live in Hamilton in
[2:16:46] Johnson, County of the Donut
[2:16:46] counties that use our roads
[2:16:48] without paying us for it. We
[2:16:49] have to raise it from our
[2:16:50] working class residents who
[2:16:53] can't afford it. Under
[2:16:54] Republican rule in this state.
[2:16:55] The rich have gotten far
[2:16:58] richer. The rest of us have
[2:16:59] not. And that's very, very
[2:17:03] obvious because $80 over a
[2:17:04] year should not be a make or
[2:17:08] break amount of money. And yet
[2:17:09] it we're hearing from our
[2:17:11] constituents. We understand,
[2:17:12] you know, the elderly people,
[2:17:13] the people on fixed incomes
[2:17:14] are really struggling. The
[2:17:15] cost of living is going up.
[2:17:18] Wages are not. Property. Taxes
[2:17:21] are still incredibly high. The
[2:17:22] rate to rise by the bus just
[2:17:25] went up a dollar this year. So
[2:17:26] while everybody else seems to
[2:17:28] be getting tax cuts, while
[2:17:30] everybody else seems to be
[2:17:30] able to make political
[2:17:31] donations that then make sure
[2:17:32] the tax policy favors them.
[2:17:33] The rest of us don't have that
[2:17:37] opportunity. So look, the
[2:17:39] council cannot do what we
[2:17:40] should be doing here, which is
[2:17:43] tax the rich. When Herb Simon,
[2:17:44] Ys net worth has tripled in
[2:17:47] the last 6 years. So that now
[2:17:47] he's an upwards of 6 billion
[2:17:50] dollars in net worth. It's
[2:17:53] ridiculous that we are asking
[2:17:54] little old ladies to pay 80
[2:17:55] extra dollars a year to drive
[2:17:57] the 20 year-old car that we
[2:17:58] just heard. That is
[2:18:00] ridiculous. And yet our state
[2:18:01] house does not give us the
[2:18:02] legal authority to ask the
[2:18:03] people who can afford it to
[2:18:05] pay what they ought to pay.
[2:18:11] And I would urge you all to go
[2:18:13] back and read a recent op ed
[2:18:14] that was written by Republican
[2:18:15] friend of mine from Shepherd
[2:18:19] Community Center. Jay Height.
[2:18:20] Here's pithy phrase. Was that
[2:18:21] potholes are a tax on the
[2:18:24] poor. As a person currently
[2:18:25] living close to poverty. I can
[2:18:30] attest to this. When you lose
[2:18:31] a tire when you lose a ram
[2:18:32] that when you have to get your
[2:18:34] car towed to get it repaired,
[2:18:35] you could MISS Work. You can
[2:18:36] get laid off. This is far more
[2:18:37] devastating to your finances
[2:18:40] and hard to predict. Then a
[2:18:44] dollar fee. One time of year.
[2:18:45] We need, although I'm
[2:18:46] reluctant we need to vote yes
[2:18:47] on this proposal tonight. And
[2:18:50] then even more importantly,
[2:18:52] all of us need to get busy
[2:18:54] electing new outsiders to the
[2:18:55] state house who are not part
[2:18:57] of this corrupt political
[2:18:59] establishment who could put an
[2:19:00] end to this by the Israel
[2:19:01] lobby, the slum lords and the
[2:19:02] data center developers and
[2:19:04] instead create a government by
[2:19:04] of and for the people. Thank

[2:19:21] brief. I certainly don't have
[2:19:22] political wherewithal to
[2:19:22] connect Israel to potholes in
[2:19:28] Indianapolis, but some of us

[2:19:30] this proposal in tax increases
[2:19:31] and of itself, I think there's
[2:19:33] just a phenomenal disagreement
[2:19:37] about how we get there. For
[2:19:38] me. I look at any tax increase
[2:19:39] as the government saying we
[2:19:40] know how to spend your
[2:19:41] hard-earned money better than
[2:19:47] you do. And to some extent we
[2:19:47] all we all know that taxes are
[2:19:49] necessary evil. You have to
[2:19:52] have police have to fire have
[2:19:52] to have emergency response. We
[2:19:55] have to public infrastructure
[2:19:56] like roads. I've long said
[2:19:59] that infrastructures. Over 90%
[2:20:01] of my constituent
[2:20:03] correspondents. That's why
[2:20:03] over the past couple years,
[2:20:05] I've what efforts to amend our
[2:20:07] budget. You know, I've never
[2:20:09] seen council in the
[2:20:10] infrastructure budget and the
[2:20:11] roughly 10 years that they've
[2:20:13] been in majority here.
[2:20:14] Potholes are not a partisan
[2:20:16] issue, which is why 2 years
[2:20:18] ago I went over to the state
[2:20:20] legislature asked for this
[2:20:21] very opportunity for us to get
[2:20:24] this 50 million dollar match.
[2:20:26] That will be a historic
[2:20:28] investment in city rivets.
[2:20:29] Keep in mind, that's the
[2:20:30] Republican super majority.
[2:20:30] They don't have a gun to your
[2:20:32] head because you can walk away
[2:20:33] at any point in time that you
[2:20:35] want people Julie, gun your
[2:20:36] head do well, that is an
[2:20:40] option but don't let anyone
[2:20:41] tell you that the only way we
[2:20:44] get to this 50 million dollar
[2:20:44] match, it's through a tax
[2:20:45] increase. I think council
[2:20:47] Calle said it perfectly. Our
[2:20:48] budget just grows organically
[2:20:51] every year. We just have to
[2:20:52] have the courage to flat line.
[2:20:55] Some of these existing. Well,
[2:20:56] the calmer accouterments of
[2:21:00] city government, things that
[2:21:00] can be nice to I disagree with
[2:21:04] a lot of them. So it is a dei
[2:21:05] office that we spend over a
[2:21:05] million dollars a year on.
[2:21:10] That's on top of the offices
[2:21:11] of minority and women business
[2:21:12] development. So technically we
[2:21:15] have to get officers here and
[2:21:15] Indianapolis that we spend
[2:21:17] millions of dollars a year on
[2:21:18] that. We could easily put that
[2:21:20] money towards roads. It's a
[2:21:23] choice that we're making. The
[2:21:25] question is we do we have the
[2:21:30] courage to fund the necessary
[2:21:32] the necessary departments in
[2:21:34] Indianapolis. For me, that's
[2:21:35] public safety and that's
[2:21:36] infrastructure. Those should
[2:21:38] be fully funded and everything
[2:21:38] that's left over that can be
[2:21:39] divvied up among the remaining
[2:21:42] departments. Set up the
[2:21:45] courage to say these are our
[2:21:49] priorities and these are not.

[2:21:58] acknowledge that no one in
[2:22:01] this chamber. It's put us in
[2:22:05] this undesirable position. 3,

[2:22:06] direction that we as a council
[2:22:10] would have taken. We are here
[2:22:12] because it is the sole option
[2:22:14] finally offered by the General
[2:22:16] Assembly to repair our decades
[2:22:20] of crumbling streets. And as
[2:22:21] elected representatives, we
[2:22:23] have responsibility. To act
[2:22:28] now on this. So election. With
[2:22:29] an affirmative vote. The
[2:22:30] council has ability to raise
[2:22:31] more than 70 million dollars
[2:22:34] in new revenue. And put it
[2:22:35] towards the most critical
[2:22:36] issues facing our neighborhood
[2:22:40] streets. Yeah, I worry the
[2:22:41] plan currently on the table
[2:22:42] does not do enough fast
[2:22:46] enough. I believe that we
[2:22:46] move. We need to move and we
[2:22:48] must move faster. And be
[2:22:52] bolder. Because if we're
[2:22:53] asking the citizens of week
[2:22:56] that we represent to pay more,
[2:22:57] we must ensure their hard
[2:22:59] earned dollars are spent
[2:23:01] fairly quickly and where they
[2:23:02] will see the most immediate
[2:23:07] benefit. We must leverage. The
[2:23:09] revenue raised from tonight's
[2:23:10] vote to create a once in a
[2:23:11] generation neighborhood road
[2:23:14] funding program. That can
[2:23:15] sustain Indianapolis is road
[2:23:18] maintenance for years to come.
[2:23:21] This is not an easy vote.
[2:23:22] Asking people to pay more,
[2:23:27] never should be. But we must
[2:23:28] fix the issues our city is
[2:23:33] facing, especially. Those as
[2:23:34] important as the state of our
[2:23:39] roads and infrastructure. So
[2:23:39] tonight we move forward, let
[2:23:40] do it with our eyes. Open with
[2:23:43] our responsibility is clear.
[2:23:44] And with a firm commitment to
[2:23:49] fixing the roads of our city.
[2:23:50] And finally, I am committed to

[2:23:51] Assembly alongside my
[2:23:55] colleagues. To improve the
[2:23:55] options available to
[2:23:58] Indianapolis. And a funding
[2:24:01] model that is fair. More

[2:24:08] value of our vehicles as it is

[2:24:29] potholes are the number one
[2:24:30] issue that face Arkansas are
[2:24:32] constituencies. If that was
[2:24:33] the question board tonight, we
[2:24:37] have 25 and we it's that. But
[2:24:37] that's on the questions. I
[2:24:41] tell you how fix that problem.
[2:24:42] What they have continually
[2:24:43] through all the meetings we've
[2:24:49] sat through for this is. Knows
[2:24:50] from almost everyone it's
[2:24:51] attended the meeting and
[2:24:54] that's that stuck out to me.
[2:24:55] There's been very few. Yes,
[2:24:56] people one. The only people
[2:24:56] hurt. Remember hearing say
[2:24:58] yes, doesn't even live in the
[2:25:02] county. That's the case, then
[2:25:02] if he's going to, you know,
[2:25:04] have us all paid of our fair
[2:25:06] share. Where's the option for
[2:25:08] him to donate to This proposal
[2:25:10] for these donut counties to
[2:25:11] then kick their fair share
[2:25:11] because they're using our

[2:25:20] such as this was indigo, they
[2:25:21] now receive over 81 million

[2:25:30] they told us what they what
[2:25:32] they wanted us to do. I don't
[2:25:35] see what I can beast the same
[2:25:36] situation here. We're going
[2:25:37] take a tax hike. Let's let
[2:25:39] this community vote on it. If
[2:25:40] they want to do that and get
[2:25:42] the street roads repaved that
[2:25:44] way, let's do it. If they
[2:25:44] don't agree with that, let's
[2:25:45] go back to the drawing board.

[2:26:30] this has been around. So why
[2:26:31] wasn't this put out well
[2:26:32] before this? So we can have
[2:26:33] time to talk to the community
[2:26:36] about this. We had that time,
[2:26:37] maybe we could get to
[2:26:38] somewhere we can support this
[2:26:39] book doing on a month is not

[2:27:08] done it right. Use car paid
[2:27:09] off early. As a matter of
[2:27:10] fact, not to have those high
[2:27:14] prices. But I couldn't put up
[2:27:16] with the ignorance that's
[2:27:18] being preached over here about
[2:27:18] some of this and trying to
[2:27:22] mislead the public. 2019 rtv,
[2:27:25] 6 Hawk said. Proposes regional
[2:27:29] Infrastructure Fund. 2023 id
[2:27:30] plans to push state to change
[2:27:33] road funding formula. That's
[2:27:35] just 2 articles. A quick
[2:27:36] Google search. We have been
[2:27:39] talking about this for years.
[2:27:39] This is not new. This didn't
[2:27:43] come out of nowhere. And when
[2:27:46] you look at council Dems. When
[2:27:48] I joined this council, we
[2:27:50] receive off the heels of a
[2:27:51] Republican administration. We
[2:27:52] were spending 50 million
[2:27:54] dollars a year on roads. We've
[2:27:56] had multiple years of
[2:27:57] 250 million, 300 million-plus
[2:28:00] without any increases. You now
[2:28:04] have a state that is cutting.
[2:28:05] Revenue from the city of
[2:28:06] Indianapolis. I think 40,
[2:28:07] 50 million last year.
[2:28:09] Understand the governor has
[2:28:11] some plans for next year.
[2:28:12] Money just doesn't come off
[2:28:16] trees. You're literally the
[2:28:16] other side of Market Street is
[2:28:18] putting us in a in a very
[2:28:19] extreme financial, difficult
[2:28:23] position. There's no doubt
[2:28:24] that there are more cuts to be
[2:28:25] made. And there's no doubt
[2:28:26] that those cuts are probably
[2:28:27] going to be happening as we
[2:28:32] move forward with the budget.
[2:28:32] The other thing I want to say,
[2:28:34] I want to highlight one win.
[2:28:36] When folks sit here and talk
[2:28:37] about how unfair this this
[2:28:38] will taxes and it absolutely
[2:28:41] is. It's ridiculous. Why
[2:28:42] should I have to pay more
[2:28:44] while people making $20300,000
[2:28:45] are actually going last or not
[2:28:47] even pay what I pay because
[2:28:48] they're driving Cadillacs.

[2:28:53] sense. But did any of them go
[2:28:54] over there and testify on the
[2:28:55] other side of Market Street
[2:28:56] when they were putting this
[2:28:58] proposal together. I don't
[2:29:02] think so. People behind doors,
[2:29:03] they came up with the the
[2:29:08] match. They act like this was
[2:29:10] not meant to be. There's a
[2:29:12] reason why all the regional
[2:29:13] place municipalities around
[2:29:15] state of Indiana are
[2:29:15] increasing the real tax. It is
[2:29:17] the expectation of the General
[2:29:20] Assembly. That is why they
[2:29:21] change the wheel tax and made
[2:29:23] it $100 straight feet. Not
[2:29:25] fair, not equitable. So

[2:30:02] things tonight. One thing I
[2:30:03] just recently heard was quote
[2:30:05] from Mayor Hogsett the most
[2:30:06] recent. What we have for Mayor
[2:30:08] Hogsett is that he does not
[2:30:08] think we need to raise the
[2:30:12] will tax. And if I want to
[2:30:15] look at this chamber, I would
[2:30:15] look at this chambers who's
[2:30:16] had a super majority since
[2:30:19] 2020. Look at chamber who's
[2:30:25] had a majority since 2015. I'm
[2:30:26] not gonna use the phrase that
[2:30:29] keeps being used. But when we
[2:30:29] talk about what the Republican
[2:30:33] legislature did, what they did
[2:30:34] is they looked at the spending
[2:30:36] of this council and they gave
[2:30:39] an opportunity to get a match.
[2:30:41] They gave an opportunity to
[2:30:45] get its priorities straight.
[2:30:46] Because clearly we have a
[2:30:47] majority since 2015 and a
[2:30:49] super majority since 2020 and
[2:30:52] you still can't get the
[2:30:53] funding right. And the state
[2:30:54] still comes to save you and
[2:30:54] gives you an opportunity. But
[2:30:56] another 50 million dollars by
[2:30:57] just matching that and getting
[2:30:59] more year year. That's a great
[2:31:00] opportunity. And we don't talk
[2:31:05] about. Misleading the public.
[2:31:07] I went to a handful of
[2:31:08] committee meetings. I've seen
[2:31:10] multiple press conference or
[2:31:11] press releases that we're
[2:31:13] telling the public that this
[2:31:13] has to be a new tax that has
[2:31:15] to be a new tax. This is not
[2:31:17] have to be a new tax. I've
[2:31:18] talked with the Legislature.
[2:31:19] It just means come up with the
[2:31:23] money. The mayor knows that.
[2:31:23] That's why said he's not
[2:31:26] raising these. So we talk
[2:31:30] about timeline. The same
[2:31:32] council myself included on
[2:31:34] this one, spent more time.
[2:31:36] Putting together a snow
[2:31:37] policy. Then we did take in
[2:31:39] consideration. From the
[2:31:42] public. We did some good
[2:31:46] public hearings give you that.
[2:31:47] What we're going to do to
[2:31:47] raise their taxes, something
[2:31:48] that in 7 years I've never
[2:31:51] done this council. It's it's a
[2:31:52] pretty big deal. But he's been
[2:31:53] more to you at how we're going
[2:31:54] to remove their snow. That to
[2:31:58] me. Are not street priorities.
[2:32:00] Going back to what our state
[2:32:00] legislatures giving the
[2:32:02] opportunity to do here. So.
[2:32:05] Let's be very clear that.
[2:32:06] There is no time rush. We do
[2:32:07] have the money. The mayors
[2:32:07] telling us the controller's
[2:32:09] office telling us who's had
[2:32:11] studies had consultants we can
[2:32:12] get to next year. You've got
[2:32:13] the time to look at. He's even
[2:32:14] tells get past one more year.
[2:32:16] You can still look at it. We
[2:32:18] have these opportunities to
[2:32:19] look at the natural
[2:32:19] appreciation of the covid
[2:32:21] that's going to come in. And
[2:32:24] we have the opportunity cut.
[2:32:25] I've been here year like last
[2:32:26] year. Spent a ridiculous
[2:32:28] amount time looking at
[2:32:29] Supplemental County Income Tax
[2:32:33] and giving amendments on that.
[2:32:34] Those were dollars, right? We
[2:32:35] did a good job dollars this
[2:32:36] year. Last year put 10 million
[2:32:39] in the budget for next year.
[2:32:40] So will have to come up
[2:32:44] 40 Million. So I think there's
[2:32:44] a lot of opportunity. We have
[2:32:45] one of those biggest
[2:32:47] opportunities as we don't have
[2:32:48] to raise the wheel tax on
[2:32:51] people this evening,
[2:32:51] especially when the thing I
[2:32:53] hear the most in my email is
[2:32:57] don't raise the tax. So.
[2:32:57] That's the word I'm going to
[2:32:59] be asking tonight is a no
[2:33:00] towards raising taxes for all
[2:33:01] those various reasons. I just
[2:33:04] said today that PRESIDENT.
[2:33:09] Vice PRESIDENT Barth. Thank
[2:33:10] you, MADAM PRESIDENT, let me
[2:33:15] start. Just by thinking cancer
[2:33:18] Nielsen for digging in on this
[2:33:19] and for his leadership in my
[2:33:20] time in the council has seen
[2:33:21] few people who have dug into
[2:33:23] the budget. It with such
[2:33:27] detail and precision as he
[2:33:29] has. He doing yeoman's job to
[2:33:30] get in on this, preparing this
[2:33:31] working with the General
[2:33:32] Assembly and getting out in
[2:33:32] the community and explaining
[2:33:35] what we're doing. So thanks.

[2:33:37] deserve a lot of credit
[2:33:39] forgetting here tonight. My
[2:33:42] comments are that the poor
[2:33:43] condition of Indianapolis
[2:33:43] roads is not a matter of
[2:33:44] opinion. It's a matter of
[2:33:47] record years of chronic
[2:33:49] underinvestment have left our
[2:33:50] infrastructure and the state
[2:33:52] of serious deterioration,
[2:33:53] imposing real costs on
[2:33:54] residents, businesses and
[2:33:54] long-term competitiveness of
[2:33:58] our city. The question before
[2:33:58] this council is not whether
[2:33:59] action is needed. It's whether
[2:34:02] we have the will to act. The
[2:34:03] state of Indiana has answer
[2:34:04] that question with the
[2:34:06] commitment of its own 50
[2:34:08] manual and 50 million annually
[2:34:10] in matching funds available to
[2:34:13] Indianapolis. But only if the
[2:34:14] city demonstrates a sustained
[2:34:16] credible local funding match.
[2:34:17] That requirement goes year
[2:34:19] every year through 2031, a
[2:34:21] short term fix will not
[2:34:23] satisfied a short term fix
[2:34:24] will not satisfy. Let's not
[2:34:27] pretend that it well, only a
[2:34:28] durable long-term funding
[2:34:30] structure. Well. Proposal, one
[2:34:33] 92 provides exactly that. And
[2:34:34] I want to place this proposal
[2:34:36] and its proper historical
[2:34:38] context in the decade since,
[2:34:39] you know, got unified the city
[2:34:41] and county governments in
[2:34:43] 1970, no administration and no
[2:34:44] council has put forward a
[2:34:46] comprehensive long-term road
[2:34:48] funding plan. We've had
[2:34:49] studies we've had short term
[2:34:50] appropriations. We've had good
[2:34:51] intentions, but we've never
[2:34:55] had until now a sustainable
[2:34:56] framework for addressing road
[2:34:58] infrastructure as a
[2:34:59] generational obligation rather
[2:35:00] than an agile annual budget.
[2:35:03] Problem. I recognize that
[2:35:05] asking Indianapolis residents
[2:35:06] to contribute more at a time
[2:35:08] when household budgets are
[2:35:08] already under pressure
[2:35:10] requires justification. The
[2:35:13] justification is this the cost
[2:35:17] of inaction is not 0. It has
[2:35:19] paid every day by residents
[2:35:19] whose vehicle sustained damage
[2:35:23] and deteriorating roads by
[2:35:23] neighborhoods that bear the
[2:35:26] burden of deferred maintenance
[2:35:26] and by a city that contributes
[2:35:28] that continues to fall further
[2:35:30] behind the proposed fees
[2:35:32] represent an investment one
[2:35:34] that combined with the state
[2:35:36] match will generate a
[2:35:37] projected 856 million in road
[2:35:41] improvements over 5 years.
[2:35:41] That is a dramatic
[2:35:42] improvement. And what we can
[2:35:44] expect in our roads in the
[2:35:46] coming years. That's council
[2:35:47] has before an opportunity that
[2:35:49] no previous council has
[2:35:51] ceased. The state has provided
[2:35:52] a mechanism. The funding is
[2:35:54] available. That deadline is
[2:35:56] real. I support proposal one
[2:35:59] 92 and I'm confident that when
[2:36:00] Indianapolis looks back on
[2:36:01] this moment, it will be
[2:36:02] remembered at that point in
[2:36:03] which we finally chose to lead
[2:36:04] on a critical issue that
[2:36:09] affects everyone. Thank you,

[2:36:12] Council Roberts, thank you.
[2:36:14] MADAM PRESIDENT, I come here
[2:36:15] today with, you know, the
[2:36:17] clearly this is a very, very
[2:36:19] hard vote. Think this MAY be
[2:36:20] the heart. So we are taken as
[2:36:21] a body. My years on the
[2:36:23] council. But honestly,
[2:36:24] simultaneously, I had the most
[2:36:25] clearly on this. But I think
[2:36:26] any vote I've ever cast as a
[2:36:28] counselor. I just start off
[2:36:31] saying in JANUARY when we were
[2:36:31] starting to think about this,
[2:36:32] I had a survey of my
[2:36:34] constituents that 500 people
[2:36:35] took Democrats, Republicans,
[2:36:39] independents multi knisley and
[2:36:40] 81% of people support of this.
[2:36:41] Now, a few weeks ago, ida
[2:36:42] follow-up survey which 300
[2:36:44] people responded to and still
[2:36:46] 63%. People responded to. And
[2:36:48] the feedback on that was
[2:36:50] amazing. They will also
[2:36:51] mention going door to door.
[2:36:52] When I talk to people about
[2:36:53] people that are posed to me
[2:36:54] about this a lot of times by
[2:36:55] the end of it, we're able to
[2:36:56] have a really good
[2:36:58] conversation because I think
[2:36:59] they're able to realize a lot
[2:37:00] of things that we all wish
[2:37:01] that we could do. We all wish
[2:37:03] we could change the road for
[2:37:05] funding formula. We wish we
[2:37:06] could tax marijuana. We should
[2:37:06] get tax data centers. We wish
[2:37:07] there were things the we could
[2:37:09] do simultaneously on this that
[2:37:12] we're just not able to do. I
[2:37:13] do truly believe this is the
[2:37:13] best tool in our toolbox to
[2:37:15] work on these road funding
[2:37:17] issues. This is by far the
[2:37:18] biggest issue we face as a
[2:37:19] city. And the reality is like
[2:37:22] has been highlighted. People
[2:37:23] are already paying every
[2:37:24] single year for bad roads and
[2:37:27] people. Pothole. That is an
[2:37:28] unpredicted outcome they'll
[2:37:31] have in their budget. I also
[2:37:34] disagree with counselor band
[2:37:38] his point. I am very much an
[2:37:38] advocate. There are definitely
[2:37:39] some agencies. Look at the
[2:37:40] budgets. Very tough and tough
[2:37:42] way to cut things. And they're
[2:37:44] definitely, you know, probably
[2:37:46] 10's of million dollars we can
[2:37:48] cut. But 1 million dollars
[2:37:49] here. 1 million dollars. There
[2:37:52] is very hard way to get
[2:37:53] 100 million dollars and also
[2:37:54] give example, you know, a lot
[2:37:55] of the agency we have impd
[2:37:57] parks, Fire Department, the
[2:37:59] reality of cutting agencies
[2:38:00] like that is having parks like
[2:38:01] in my district, some park
[2:38:03] where able to open the summer
[2:38:06] because we can't staff the
[2:38:07] park manager and the people
[2:38:08] that are there. And the
[2:38:09] reality is, I think a lot of
[2:38:10] times the study, there's
[2:38:10] millions and millions of
[2:38:11] dollars to cut. It is very,
[2:38:15] very hard to do. And I would
[2:38:15] love it if we could have some
[2:38:17] kind of interactive to Shore
[2:38:18] City budget, let people cut
[2:38:19] themselves. Look at individual
[2:38:21] programs. A lot harder
[2:38:23] actually do yourself. And yes,
[2:38:23] there's still things we
[2:38:26] absolutely should be doing,
[2:38:27] but really, truly to dedicate
[2:38:28] the money. We need to have
[2:38:29] better roads in our city. It
[2:38:30] will take courage. It will
[2:38:32] take a leadership and they
[2:38:33] really do give credit councils
[2:38:35] and forth on this said, you
[2:38:36] truly think it be a
[2:38:37] generational mistake. We
[2:38:37] passed on this investment for
[2:38:39] better roads. Thank you.

[2:38:46] PRESIDENT, if you don't mind
[2:38:50] me, I look to bring in the
[2:38:52] voice particular constituents
[2:38:56] that I spoke spoke with a few
[2:38:56] months ago. And I share with
[2:38:58] my colleagues and are in our
[2:39:00] caucus. But it was a standard
[2:39:04] call about a pothole client,
[2:39:05] student constituent upset.
[2:39:08] Initially I thought it was
[2:39:10] routine. But as as I listened
[2:39:12] to her share her story, looks
[2:39:15] like not only did it damage or
[2:39:17] tire, but it sure electronic
[2:39:20] sensor and her alignment. So
[2:39:22] this bill was ultimately
[2:39:26] $1400. And what struck me was
[2:39:26] she shared that she didn't
[2:39:27] really know how she was going
[2:39:29] to repair that. And she was a
[2:39:33] mother children. So MADAM
[2:39:34] PRESIDENT, its constituents
[2:39:36] like her that I want to
[2:39:37] acknowledge and that is why
[2:39:40] I'm supporting this proposal.
[2:39:43] This will Texas or Texas. The
[2:39:43] only way for us to meet the
[2:39:44] requirements established by
[2:39:46] the state legislature and
[2:39:47] received that state matching
[2:39:50] funds that necessary to make
[2:39:51] meaningful investments in our
[2:39:54] roads. But also, MADAM
[2:39:55] PRESIDENT, want to be clear
[2:39:58] about my expectations. I do
[2:40:00] know that and I want those who
[2:40:01] don't know to understand that
[2:40:03] every dollar that we receive
[2:40:04] for one purpose and that's our
[2:40:06] roads. No other projects. With
[2:40:09] that being said, I want to
[2:40:11] make sure MADAM PRESIDENT that
[2:40:11] the East side received the
[2:40:14] attention it deserves.
[2:40:15] Residents have waited far too
[2:40:16] long for better streets on the
[2:40:19] east side. We fought. We
[2:40:20] continue to 5 will continue
[2:40:25] that. Everyone in this process
[2:40:26] accountable for delivering the
[2:40:29] results. We see. Indianapolis
[2:40:32] is a world-class city in the
[2:40:33] east side is on the rise. I
[2:40:35] encourage all come visit.
[2:40:36] We've got some great, great
[2:40:37] things on the side. Our
[2:40:42] streets, though. They're
[2:40:43] they're lacking. We've got 4
[2:40:48] parks in my specific district.
[2:40:48] The streets that access each
[2:40:50] of those parks or in the worst
[2:40:51] conditions that you can
[2:41:00] imagine. We need this funding.
[2:41:01] Our residents deserve roads
[2:41:02] that are safe, reliable and
[2:41:03] worthy of the city that we're
[2:41:06] building. So for that reason,
[2:41:07] I'll be voting support. This

[2:41:22] discussion over the pass 30,
[2:41:25] 40 days. And I think out said
[2:41:30] enough. But I feel compelled
[2:41:31] tonight just to make a general
[2:41:34] statement. If it wasn't 9.41,
[2:41:39] I would dress. This
[2:41:40] conversation around the way to
[2:41:42] address issue of
[2:41:43] infrastructure is attack
[2:41:47] equity and diversity. And its
[2:41:55] interest and from home that k.
[2:42:03] But it's 9.41 Leaders lead.
[2:42:07] You elected us. To lead in
[2:42:10] difficult situations. This is
[2:42:14] a difficult situation. I spent
[2:42:16] a lot of time traveling across
[2:42:23] this country. In cities.
[2:42:23] Similar smaller than
[2:42:24] Indianapolis. And every time I
[2:42:28] fly back home, I draw home.
[2:42:29] I'm reminded off the condition
[2:42:34] of for infrastructure. I
[2:42:36] wonder as the council can we
[2:42:40] imagine a better Indianapolis?
[2:42:42] i wonder if we can imagine.
[2:42:46] City county. Where we are
[2:42:49] proud to live here. But we are
[2:42:49] also proud to welcome people
[2:42:53] here to visit. Infrastructure
[2:42:58] needs work. And I encourage us
[2:42:58] as I'm supporting this
[2:43:00] proposal tonight. To consider
[2:43:03] what it looks like. For us to
[2:43:06] have a better Indianapolis.
[2:43:06] I'm also going challenge the
[2:43:11] administration. Because we
[2:43:11] have engage in this discussion
[2:43:14] over the last 40 days. And
[2:43:16] publicly. The administration
[2:43:19] is shared. Unwillingness to
[2:43:22] raise taxes. But have not
[2:43:24] given a clear plan as to how
[2:43:29] we get the match. Infants. As
[2:43:29] a council. This proposal going
[2:43:34] forward. To the people that
[2:43:35] elected us give elected us to
[2:43:37] make difficult decisions. And
[2:43:39] tonight as one of those, thank
[2:43:44] you. MADAM PRESIDENT,
[2:43:48] CHAIRWOMAN Brown. Thank you,
[2:43:50] MADAM PRESIDENT, I just want
[2:43:51] to I ripped my colleagues have
[2:43:52] said a lot. The one thing I do
[2:43:54] want to say as somebody whose
[2:43:56] district is entirely excluded
[2:43:58] city. I live in, Lawrence, my
[2:43:59] whole district is the city of
[2:44:01] Lawrence. I can tell you I
[2:44:02] know exactly how much money is
[2:44:04] going. Go back to my district
[2:44:05] City of Orange is going to
[2:44:07] receive 3.8 million dollars
[2:44:09] from this. And in
[2:44:10] Indianapolis, that doesn't
[2:44:10] sound like a lot. That's more
[2:44:11] than 10% of the city's current
[2:44:14] budget. That's gonna make a
[2:44:15] heck of a different speech.
[2:44:17] Grove is going to get over a
[2:44:20] million dollars. Warren says
[2:44:21] 50,000 people beach Groves got
[2:44:23] up about 8,000. I believe so.
[2:44:25] That's quite a difference for
[2:44:26] excluded. I'm not sure of the
[2:44:27] numbers, a speedway or
[2:44:28] Southport off the top. My
[2:44:30] head. But this just doesn't
[2:44:31] affect Indianapolis. It
[2:44:32] affects all these other cities
[2:44:34] who have been so hard by sb
[2:44:38] One. And if what's being
[2:44:39] talked about by people who are
[2:44:41] entering the state house this
[2:44:42] next session about cutting
[2:44:44] property taxes or even
[2:44:47] eliminating them excludes are
[2:44:47] going to disappear in
[2:44:48] Indianapolis is going to be
[2:44:50] crippled. We can't cut our way
[2:44:51] out if we end up with no
[2:44:54] money. We have to do this.
[2:44:56] It's terrible. It's horrible.
[2:44:57] It's what we're being fed. And
[2:45:00] I don't know. I've talked to
[2:45:01] Republican leaders at the
[2:45:02] state House and they have told
[2:45:04] me this is what this was set
[2:45:05] up for was for you to raise
[2:45:06] taxes. This is what we're
[2:45:10] doing with. It's what we have
[2:45:12] to do. None of us want to do
[2:45:14] this. It's terrible that we
[2:45:17] have to. But if we don't,
[2:45:17] generation going to destroy.

[2:45:42] this topic, not just for the
[2:45:43] last few months, but for for
[2:45:44] years before this and
[2:45:46] advocating on this and for our
[2:45:47] residents for coming out to
[2:45:48] the committee meetings and to
[2:45:49] the public meetings for your
[2:45:52] voices to be heard. One point,
[2:45:53] I do want to make that your
[2:45:56] voices were heard and for the
[2:46:00] colleagues that have alleys we
[2:46:02] advocated for Ali funding in
[2:46:03] this proposal because we have
[2:46:05] districts that have alleys
[2:46:08] that do not get funding are
[2:46:09] very much funding. And so that
[2:46:11] was something that we out
[2:46:13] advocated heavily for to a
[2:46:16] tool to have some resources
[2:46:18] put into alleys for those
[2:46:19] districts. So we have listened
[2:46:21] to our residents and as tough
[2:46:24] as this is, this is something
[2:46:30] that we must must do. And also
[2:46:32] for our ask me 7.25 workers.
[2:46:33] This is dedicated work. This
[2:46:37] is guaranteed work. This is a
[2:46:39] fiscal injection into our
[2:46:40] residential streets. This will
[2:46:44] guarantee them work as well.
[2:46:45] And one thing that we hear
[2:46:46] about as counselor being
[2:46:47] talked about, he said, I think
[2:46:49] he's a 9% of his constituent
[2:46:52] correspondents is
[2:46:53] infrastructure. So as tough
[2:46:54] this is and like you said, you
[2:46:58] don't want to raise taxes. Our
[2:46:59] residents are depending on us
[2:47:00] to fix the future of the city
[2:47:02] and to fix a future of our
[2:47:03] infrastructure. I'm just at
[2:47:04] thank you. My colleagues
[2:47:07] thanking the constituents,
[2:47:08] whether you agree with us and
[2:47:09] not for writing in for coming
[2:47:12] to this committee meetings
[2:47:14] thinking department public
[2:47:14] works. Workers also for the
[2:47:15] future work that is in your
[2:47:16] future. If we can get this
[2:47:18] across the finish line. And I
[2:47:19] think my colleagues for
[2:47:19] sharing the stories of their
[2:47:20] constituents as well. Thank

[2:48:04] make sure that you answered
[2:48:06] every question that every
[2:48:09] constituent showed up to every
[2:48:10] meeting. So I commend you for
[2:48:13] all the work that you put into
[2:48:14] this. Also with that being
[2:48:18] said, also, MADAM PRESIDENT.
[2:48:19] As you said in each meeting,
[2:48:23] we haven't got another plane.
[2:48:24] And this is the only plan that
[2:48:26] has been presented to the
[2:48:27] council and in leadership,
[2:48:32] leadership is hard and
[2:48:32] councilor robbers. I have to
[2:48:33] say this is probably one of
[2:48:36] the hardest decisions since
[2:48:37] week can't became account so
[2:48:40] that I have had because I too
[2:48:44] have a mom. That is a senior
[2:48:46] citizen. Am I gonna have to
[2:48:47] help her probably pay for her
[2:48:47] registration for a license
[2:48:49] plate. Yes, I am. But at the
[2:48:52] same time I receive those
[2:48:57] emails even just last week I
[2:48:58] did a press release point
[2:49:01] Greenway Trail, which I was
[2:49:02] gonna be good for the Far East
[2:49:04] Side because oftentimes people
[2:49:05] think I have felt that the far
[2:49:10] East side of that said has got
[2:49:11] left out and we're doing
[2:49:13] having economic development
[2:49:16] happen on the But when posted
[2:49:19] about the Greenway Trail. I
[2:49:21] get negative feedback and said
[2:49:23] it. This is what choose to do
[2:49:26] with that money. We need pa,
[2:49:27] we need our potholes. We MAY
[2:49:31] stir up. We need strip patchy.
[2:49:33] Also another subdivision in my
[2:49:35] history. They've been waiting
[2:49:41] for years to and new strip
[2:49:42] patching and there's history
[2:49:45] took and put that as apply or
[2:49:48] and to get that phone call,
