around 30 kids and then the first season we had 57 registered at the high school level graduated

12 or 13 seniors and this year even after graduating that many seniors we had 56 players on
[40:38]
roster. So we made to the state championship last year. Unfortunately, we lost, but then
[40:44]
even after graduating, nine out of ten starters, we made it again to the state championship,
[40:50]
and our hope is that third time's the trend, and we'll make it again next year and win
[40:54]
it next year. So we're proud to be part of this community and grateful for all of these players,
[40:59]
but also the families who do so much to support all of these young men. So thank you for having
[41:05]

It's good to see you, sir. Thank you very much for the opportunity to talk to you to see me. Mr. Mayor, my name is Ed Erry Sury Jr., I live at 1445 Melody Lane, where as a tax paying citizen, I have lived there for the last 35 years or so. Mr. Mayor, I come here this evening with a heavy heart.

My concern is for the patriotic soul of our country.

I am a decorated combat veteran of the Korean War,
[45:38]
where I served three combat deployments,
[45:41]
having lost a number of my high school friends there.

This came that I use as a momentum of one of those deployments.

In the early every morning, my friends and I, some of who are also veterans, enjoy coffee
[45:58]
and camaraderie at the summer moon coffee club here in color.
[46:04]
One of them, Louis Seldon, also a veteran, usually displays a small flag posted on our small
[46:14]
table. The average size of that flag is about no larger than a 3x5 index card. I would
[46:26]
like Lewis seldom hear the chambers to stand up and hold that flag in question.

it's a very small flag. This simple display is going on for a number of years in the past.
[46:45]
One morning, last week, at a summer moon manager, Ms. Basel Casper, Greene, sent one of them
[46:52]
employees to our table, demanding, take down that flag it has no place here. Without

shouting or making any gestures, Mr. Seldon rolled up his manager flag and said to the
[47:07]
employee in to us at the table that he would be leaving and he would not come back.
[47:13]
Mr. Mayor, I, too, left, as well as some of our friends valing to boycott the summer
[47:20]
moon coffee shop until the issue of formal apology on their website, and I've asked
[47:28]
me and my veteran friends, and also those within the year shop tonight, to also boycott
[47:35]
the same coffee shop.

It's an un-American enterprise.
[47:40]
Made a manager in the corporation hang their heads at shame.
[47:45]
We as combat veterans silently mourn the sacrifice that our brother combatants made as we
[47:52]
watch the world's spectacle of perishable riches, fame, glory, and power that they paid

so dearly for, and let's say decimate our good earth.

We have spent many hours there with our friends.

I'd like to call him Yeserri, Mike Ero, Korean War veteran. What he didn't tell you was,

he was three combat tours off the coast of Korea, one destroyers in destroyer escorts.

He volunteered to go ashore and raiding parties with rock troops for public of Korea,
[50:10]
Military Army Marines, whatever, some of the hardest fighting ground troops in the world.
[50:17]
I'd put them up against the French Foreign Legion.
[50:20]
And he went on night rating parties, approximately 13 times carrying a 21 pound B.A.R.
[50:26]
Browning automatic rifle, which I've never understood in night rating parties.
[50:30]
I would have thought they equipped him with a six pound carbine, short range, but a very effective weapon.
[50:37]
But he looked at it around with 10 magazines of ammunition and 10 hand grenades.
[50:45]
It's probably doubled his weight.
[50:47]
When he got out of the Navy, he tried to apply to the Navy Academy and turned out because
[50:53]
he was too short, but he went too short to enlist.
[50:56]
Anyway, he gets out of the Navy, he gets the engineering degrees involved with this space
[51:01]
program and developing the atomic clock, which is very accurate time and very important
[51:09]
navigation, which I've done a lot of, had done a flight navigation. It's very important
[51:16]
to time be accurate.
[51:21]
And you need to read his bio, but after he retired, volunteered to be
[51:30]
He a minister in the prisons, and he drove an O-Dark 30 in the morning to break and reach many
[51:39]
hours, many times, you know, in danger himself, and had some rewarding experiences doing
[51:47]
that.
[51:49]
I have considered Ed my hero, and I'd like to ask you to consider making a color day for
[51:59]

I think he had eight Navy and 22 rocks and they go ashore and he, so at the time he catching

for a couple of coffee, they get him to chat with you about his experience, but he went

on to become an engineer and he's a very smart man, so I mean I just hope you will seriously
[53:21]
consider making one day of the year, Ed, yesterday day in Keller. He's been a resident, I say again 35 years.

and I'm a resident of Keller and local business owner.
[58:10]
Tonight I'm here to speak about transparency, governance, and public trust,
[58:14]
specifically as it relates to appointments
[58:15]
to some of our city's most influential boards and commissions.
[58:19]
The planning and zoning commission holds significant influence over Keller's future.
[58:23]
It impacts land use, development, zoning, and the overall footprint of our community.
[58:27]
Because these positions are pointed rather than elected, residents rely on this council to serve as an independent and objective filter when making those appointments.
[58:38]
I say this is someone who also serves in an appointed capacity with the City of Keller.
[58:43]
Appointed positions require a higher level of transparency because residents are trusting council to choose people who can serve the broader community fairly and independently.
[58:53]
That responsibility matters.
[58:55]
Public records now raise legitimate concerns about overlapping relationships between elected
[59:00]
officials, appointed board members, campaign finance activity, and private interests connected
[59:05]
to local, real estate, and property management.
[59:07]
According to city, appointment records November 19, 2024, Greg Willis present when the council
[59:13]
unanimously appointed Deborah Johnson to the Planning and Zoning Commission as well as Erick
[59:18]
A. According to campaign finance violence, Councilman Will, Planning and Zoning Commissioner
[59:23]
Deborah Johnson, and Planning and Zoning Commissioner Eric Lies, are all listed in
[59:29]
connection with funding or managing a local political action committee tied to conservative
[59:33]
voter guide.
[59:35]
Ms. Johnson is listed as treasurer.
[59:38]
Those same filings also show financial involvement in two local residents that are involved
[59:43]
in real estate, one of which is a local real estate broker, investor, and property manager
[59:48]
whose business interests may be affected by city policies related to land use, development,
[59:54]
rental property, zoning, and local regulation.
[59:57]
To be clear, I am not standing.
[1:00:00]
Standing here tonight to accuse anyone of legal violation. This is not my role. What I am saying is that it creates a serious appearance of conflict of interest.
[1:00:11]
When an elected council member votes on appointment to planning and zoning, while also being financially connected through political activity, with appointed commissioners and individuals connected to local, real estate interests, residents deserve clarity.
[1:00:22]
The issue is not only whether something technically violates a statute, the issues whether the public can clearly trust that city appointments and land use decisions are being made independently, transparently, and in the best interest of color residents as a whole.
[1:00:37]
Keller residences of confidence that appointments are not influenced by political alliances,
[1:00:43]
campaign activity, private donor networks, or relationships that may create perceived
[1:00:47]
conflicts of interest.
[1:00:49]
So tonight, I respectfully ask this council to review these overlapping relationships and consider
[1:00:55]
whether stronger transparency standards are needed for appointed board and commission members,
[1:01:00]
especially those serving on planning and zoning.
[1:01:01]
At minimum, residents deserve disclosure when individuals involved in appointments, campaign finance
[1:01:07]
activity, political committees, and regulated local business interests are connected to one another.
[1:01:14]
Transparency protects the public.
[1:01:16]
It also protects the integrity of this council.
[1:01:19]
Our appointed boards and the residents who are trusting this process.
[1:01:23]
I understand that council may not be able to respond tonight during public comments.
[1:01:26]
My request is simply that this concern will be reviewed and placed on a future agenda for discussion regarding disclosure standards for appointed boards and committees.

to progress. It's about a quarter of the way through in terms of which you can see on

street, excuse me. But we are about halfway through in terms of the three years that we

started down. So just a reminder, we expect the end of 27th is to, because when this will be

substantially complete, but we're no longer headlong into that. Speaking about Gilliac,

going back to that, there's the waterline has been replaced. You know, you may have received an email

earlier today asking about its status, the bottom line is last week. It was pressure tested

to make sure that there were no leaks that it was connected correctly that hold the scenes work.

This week is a chlorination and bacterial testing, and that will take two days of stagnant water

of nothing happening. And that's the flag that I think that some residents have seen. It's a beautiful

day, how come there's no work happening? That's because we're in the middle of testing.

because of the definition in our code.

So we'll talk about some of those concerns we've had reported to co-compliance.

I've got the current definition that's in the UVC right now for home occupations,
[1:33:55]
which is really all the regulation we have.
[1:33:56]
We don't have a separate section of the code or anything else that regulates home occupations.

We did put together a draft red line with some help from Stan.

This is just an example for discussion purposes.

We could certainly modify a change as throw it out.

whatever counts of once, and then in terms of next steps, we talked about this last
[1:34:16]
time, one of the options is to do nothing, is to just affirm what's in the
[1:34:20]
code, is satisfactory for color and keep going. We can certainly do some
[1:34:25]
additional research after their discussion, or if we felt like the red line was
[1:34:30]
pretty close to what council wanted, we could move forward with P&D
[1:34:34]
consideration like Langeal Eye, and then that would be back on a council agenda in
[1:34:41]
So, this is probably ticked up just a little bit.

We've actually had a few other complaints over the last couple of weeks on.
[1:34:48]
Occupations of these are 36 separate properties.
[1:34:50]
So this is not some huge issue that we're dealing with on a daily basis.
[1:34:56]
But for the residents that are reporting it,
[1:34:58]
it's really affecting the enjoyment of their home.
[1:35:00]
They feel like it's really impacting the quality of their lives
[1:35:05]
because the things that are often going on next door across the street are occurring,
[1:35:10]
and that's other regular basis that they feel like it's starting to make their neighborhood
[1:35:15]
feel not so much like a single family neighborhood anymore.
[1:35:19]
So some of those common complaints are really related to traffic and vehicles on the street.
[1:35:25]
Sometimes there are company vehicles or vehicles that are wrapped, sometimes their vehicles
[1:35:31]
with creditors attached, some sort of work materials or heavy equipment on a lot, probably
[1:35:39]
one of the biggest complaints is employees that don't live at the home, don't even live
[1:35:44]
at the neighborhood reporting to work at the home, which kind of compounds the problems with
[1:35:50]
traffic and any obstacles on the street, and then oftentimes some of the businesses that
[1:35:57]
that we hear some frustration over our auto repair
[1:36:00]
businesses and 20 lessons,
[1:36:01]
and we've also had issues with landscape companies,
[1:36:04]
pool companies, with that a plumbing company
[1:36:07]
where they were storing all their PVC
[1:36:08]
and everything in their home, personal trainers operating
[1:36:13]
out of their garage, just found music,
[1:36:16]
just all sorts of things.
[1:36:18]
But if you're living right next door to that,
[1:36:20]
again, an experiencing at on a day-to-day basis,
[1:36:23]
the residents are often failing,
[1:36:24]
like this, this doesn't really feel like it's been a family neighborhood anymore.
[1:36:28]
So, here's what we have right now in the EDC in terms of definition.
[1:36:32]
I've bolded that language about the Home Occupation, not changing the neighborhood character
[1:36:37]
or substantially increasing traffic to and from the dwelling, oftentimes when residents
[1:36:44]
do their own research, they'll come to this and say, well, clearly this is changing
[1:36:48]
the neighborhood character and clearly they're increasing the traffic to and from the dwelling.
[1:36:51]
There's a really difficult thing to enforce and might mean something different, you know, changing the neighborhood character can mean something to every, you know, something different to everyone.
[1:37:03]
So, we have very few cases where it seems, obviously, in violation of the store nets, you know, usually, you know, the ones that are easy is like, they're working, you know, they are operating, you know, a salon and they put a sign in their front yard, what just happened?
[1:37:19]
because that's the easy one.
[1:37:20]
Like, no, we can't do that whole website, but most of the time they're not doing things
[1:37:25]
or that obvious.
[1:37:26]
It's the little things that you don't notice unless you live in the neighborhood.
[1:37:30]
So, this is the red line that, like I said, we put together with some assistance from
[1:37:36]
sand.
[1:37:39]
It would require the people involved in a home occupation to be inhabitants of that particular
[1:37:46]
dwelling so that would address the concern of employees that don't don't live in the
[1:37:53]
neighborhood reporting to work there on a regular basis. So we allow them to do
[1:37:56]
home businesses, even other not, don't do that, and say a lot of require a look.
[1:38:03]
I don't know that we have the option to completely prohibit them. That's not
[1:38:07]
asking. I'm just saying I want to, you know, in the last legislation say
[1:38:11]
locking and it said you have to allow home business. You can regulate it in this form,
[1:38:15]
You can't, yes, you can use what you can't, how right then.

You know, we did leave the language in there for now, in terms of not changing the neighborhood

That's another complaint that we get sometimes with the employees arriving at the home.
[1:38:42]
They're not actually going into the home.
[1:38:44]
They're stealing at the end of the driveway.
[1:38:46]
You know, maybe they'll drive up in their personal vehicle,
[1:38:48]
park it on the street, and then they'll wait for someone else to come
[1:38:52]
and they'll get in the landscape truck, or the full truck, or whatever it is.
[1:38:58]
So the off street park, and they would just go park
[1:39:00]
in front of somebody else's house,
[1:39:04]
and that's kind of...
[1:39:05]
I'm just kind of pushing it to somebody else's.

I think certainly, all of the different points about parking
[1:39:13]
and trap-based are difficult to enforce unless there is an actual violation, you know,
[1:39:19]
they've got a car parked on the street the wrong way with two flat tires or something else
[1:39:24]
that chief folks could enforce, it's going to be, it's going to be difficult.
[1:39:30]
And what is enforcement look like right now is that just somebody somebody makes a complaint
[1:39:35]
that's a kind of the enforcement mechanism in terms of how folks identify.
[1:39:40]
So, any time we get a complaint about a home occupation, we'll typically check out the property.
[1:39:46]
Sometimes we'll just, we don't need to get a sticker.
[1:39:53]
Sometimes, if we're not quite sure what's going on, we'll send, not even like a violation notice or anything
[1:39:59]
that the property owner will just send in something.
[1:40:01]
It's like, hey, can you contact our office and have a conversation about this?
[1:40:07]
And just so we can understand what they're doing on the property,
[1:40:13]
occasionally we'll have a case like I said with the beauty salon with the sign in the yard and that's a pretty easy case to send it and usually takes a letter or two and they'll stop doing that.
[1:40:24]
Other times when it's not as clear like some of the examples I've given in terms of the full company in the landscape company will go over whatever we've received from the surrounding residents.
[1:40:36]
whatever, co-compliance has been able to observe and then visit with Aaron, Stan, and then
[1:40:43]
sometimes a prosecutor to see if this even works.
[1:40:47]
You know, we can pursue a case, but ultimately if it's not going to go anywhere, if we
[1:40:52]
get only the court, should we even continue it?
[1:40:59]
So those, the 36, that you listed, is that like 36 complaints, or is that 36 homes?

What did I just try that that's 36 individual properties some of those have double digit complaints on
[1:41:11]

How much of a relationship businesses, we felt like it was worth at least bringing the council for discussion,
[1:41:42]
understanding that the end result may change. We leave everything alone. We say,
[1:41:46]
we're just going to leave a definition as this. We're comfortable with it.
[1:41:51]
What's the councilman, including his point? Because I can't remember, say we get a really bad situation.
[1:41:57]
They leave it out there. Is it end up in fines or, you know, they go to court or what's the...

Yeah, so it's stage time and I want to very say something to you.

We follow our normal compliance process, which involves several different stages of violation.
[1:42:16]
In that application, we're able to send a notice.
[1:42:18]
You've got 10 days, either come into compliance, contact us, for an extension, or to have a conversation,
[1:42:24]
and then we re-inspect.
[1:42:26]
And then, you know, assuming that we still find the violation, we've got another 10 days.
[1:42:29]
So it's good for that entire process, it usually sort of occurred to see notice, notice the violation,
[1:42:35]
final notice, and then citation.
[1:42:37]
And once it gets the citation, it's really in the prosecutor in the municipal court of hands.
[1:42:42]
So no one on staff can go out and issue a fine.
