pray that
[1:43]
, thank you for life in the precious

[1:47]

[1:50]
>>
[1:52]
thank you, council member breitenbucher.
[1:59]
now we will go ahead
[2:00]
and continue to agenda review and
[2:01]
supplemental reports.
[2:02]
>> mayor, we
[2:03]
have the following supplemental
[2:04]
reports. Item d1. We have a powerpoint
[2:05]
update by city staff
[2:08]
. As far as agenda review,
[2:10]
all city council meetings shall be
[2:11]
conducted in orderly and efficient
[2:12]
manner without willful disruption
[2:14]
by any person or persons in attendance.
[2:16]
the city has also adopted a decorum
[2:17]
policy that governs
[2:20]
meetings, which states that all city
[2:21]
council
[2:23]
meeting attendees shall refrain from
[2:24]
behavior that
[2:26]
disrupts or threatens to disrupt
[2:37]
city government operations. This includes
[2:38]
but not limited to harassment and/or
[2:39]
intimidation of
[2:40]
city staff, elected officials, or members of
[2:41]
the public. Please be advised should
[2:42]
disruption
[2:43]
occur, a member of the city council
[2:44]
shall issue the person or persons
[2:45]
an initial warning. Should a second
[2:47]
disruption occur by the same person
[2:48]
or persons, a
[2:49]
member of the city council shall ask
[2:50]
the person or persons to leave the
[2:52]
meeting. That is all I have for you
[2:53]
tonight.
[2:54]
>> okay.
[2:59]
let's go ahead and move on to disclosure
[3:00]
of ex parte
[3:02]
communications. Anything?
[3:13]
okay. Seeing none from the council,
[3:14]
we will go ahead and go to presentations.
[3:16]
the council can join me up in the
[3:17]
front.
[3:18]
>> presentations. A1. Present
[3:19]
a proclamation
[3:20]
proclaiming february 4th, 2025. And
[3:21]
tonight we have dr.
[3:26]
singh to accept the proclamation.
[4:06]
>>
[4:08]
whereas, on february 4, 1986, four unarmed and peaceful sikh
[4:17]
students, baldhir singh, jhilman singh,
[4:18]
and harminder singh were killed
[4:19]
by state police in punjab, india, in an
[4:21]
unprovoked firing, while
[4:23]
participating in protest against the desecration of sikh
[4:27]
scripture "sri guru granth
[4:29]
sahib" considered by all sikhs to be the final, supreme and
[4:31]
living guru after the lineage of 10 sikh gurus;
[4:35]
and whereas, the state government
[4:36]
constituted a commission of
[4:38]
judicial inquiry headed by a renowned
[4:41]
jurist on this incident of extra-judicial killings.
[4:48]
>> the justice gurnam singh
[4:51]
commission of inquiry submitted
[4:53]
and not even a single perpetrator
[4:54]
has been brought to justice today.
[4:57]
families
[4:58]
have been fighting for the truth --
[5:00]
[ inaudible ]
[5:02]
accountability and closure for over
[5:03]
39 years. And --
[5:07]
>> whereas, this incident has now
[5:09]
also received international
[5:11]
attention as dr. Cheema, member of
[5:13]
united nations global steering committee of osapg, has raised
[5:18]
it on various international
[5:21]
forums; and
[5:22]
>> now therefore I, gary singh, mayor
[5:23]
of the
[5:26]
city
[5:27]
of manteca on behalf of the city council
[5:28]
stand in solidarity and empathy with
[5:29]
the
[5:32]
families and victims
[5:33]
in their pursuit of justice. I do
[5:34]
hereby proclaim february 4th, 2025
[5:35]
as saka
[5:38]
nakodar day.
[5:47]
>>
[5:50]
sir?
[5:53]
>> I didn't want to get
[5:56]
in his way.
[6:04]
>> thank you, mayor. Thank you, city
[6:05]
council. I'm going to
[6:08]
start with greetings.
[6:11]
we are
[6:14]
extremely grateful to
[6:17]
mayor mayor singh and the city council
[6:20]
to recognize the very fourth
[6:23]
as saka nakodar day
[6:26]
. Why? Why it
[6:28]
is important to remember these atrocities
[6:32]
? It is black awareness
[6:35]
month too.
[6:41]
you know, our pains are the same.
[6:42]
our circumstances might be different.
[6:44]
my brother
[6:51]
, who was a pre-engineering student
[6:52]
who wanted
[6:55]
to be an electrical engineer
[6:58]
--he was 19
[7:01]
.
[7:04]
and they were completely unarmed
[7:07]
doing a peaceful protest
[7:10]
. And there are rules
[7:13]
and regulations to open
[7:16]
the live fire .
[7:19]
you need a judicial permission . You
[7:22]
need to give a verbal warning
[7:25]
. You need to start
[7:27]
with a minimum amount of force. You
[7:28]
need to declare
[7:31]
the assembly unlawful. Nothing
[7:34]
was done. They
[7:37]
opened live fire , and my brother
[7:40]
, who was
[7:42]
in the five up front --he was the
[7:43]
first one who got martyred
[7:46]
that day for doing a
[7:48]
peaceful protest against the sacrilege
[7:52]
. It did not
[7:55]
end there.
[7:58]
the other two
[8:01]
--he was uncle of this
[8:04]
girl who is standing next to me
[8:07]
. And
[8:10]
singh. They were not shot at the same
[8:13]
point . They were shot
[8:16]
more than a kilometer away
[8:19]
. And
[8:22]
the farm where they were taking refuge
[8:25]
. Didn't end there.
[8:31]
a second year student.
[8:34]
he was --
[8:37]
they challenge him by name.
[8:40]
the station
[8:43]
house officer and
[8:49]
--in his mouth and shot him
[8:52]
at point-blank. All four were brought
[8:53]
to
[8:55]
the hospital for autopsies
[8:58]
. They
[8:59]
date of their autopsies in the dark
[9:01]
of the night. And when the doctors
[9:02]
went to do
[9:04]
the autopsies , you will be
[9:07]
shocked to know that
[9:13]
ravinder was still alive. He
[9:15]
was still alive, so the doctors took
[9:16]
him to the hospital , tried to
[9:19]
treat him, but the police took over
[9:22]
, and they took him to another hospital
[9:25]
. If it
[9:27]
happened in tracy, we will take them
[9:28]
to sacramento
[9:31]
to a different hospital.
[9:33]
and when they went to the other hospital,
[9:34]
the doctors
[9:37]
--the
[9:39]
police made sure while they were taking
[9:40]
him to the other hospital that he
[9:41]
is
[9:43]
dead. It didn't end there.
[9:46]
next morning, my father , who was 39
[9:50]
--only one from the
[9:53]
four families was
[9:54]
able to get into the city while the
[9:55]
city was under curfew. He went to
[9:59]
the hospital
[10:00]
, identified his son, asked for his
[10:02]
body for his
[10:04]
permission. He was told to go to the
[10:05]
police station . In the meantime,
[10:08]
police took all four bodies
[10:13]
. Kerosene fuel to burn them all.
[10:17]
my dad
[10:18]
sat in front of the police station,
[10:20]
started a
[10:23]
protest
[10:26]
. A commission
[10:29]
was constituted.
[10:31]
it was a retired high court justice
[10:33]
who gave his report to the state government
[10:39]
on the 31st of october, 1986. And
[10:41]
the rule of law states
[10:42]
once a report is submitted to the state,
[10:44]
and needs to be played
[10:46]
in the state assembly within six months
[10:50]
of submission .
[10:53]
and a report needs to
[10:56]
be issued. 39
[10:59]
years. 39 years till this day
[11:02]
that report
[11:05]
hasn't been acted upon.
[11:08]
that is why it
[11:10]
is important to remember these days
[11:15]
. And then when my father applied underwriting
[11:16]
information for the report, guess
[11:17]
what
[11:20]
they told.
[11:22]
this never happened. We never killed anyone.
[11:26]
this has been brought
[11:28]
into both houses of the parliament
[11:29]
in india
[11:34]
. Upper and lower. The state assembly.
[11:35]
the governor
[11:36]
of the state. The president of india.
[11:40]
we went to the high court. Nothing.
[11:44]
so
[11:45]
that is when we came to the global
[11:47]
communities to raise the global awareness.
[11:48]
our
[11:50]
case --
[11:53]
in 2022. U.s. Congress
[11:56]
declared february as
[12:01]
saka nakodar debuted on june 13th
[12:02]
of last year, california
[12:04]
state assembly recognized saka nakodar
[12:05]
day for the fourth of
[12:07]
february. And I am so , so thankful
[12:08]
to
[12:11]
you all to shed the light
[12:14]
on this atrocity.
[12:16]
declare itself as the biggest democracy.
[12:20]
but they don't follow
[12:22]
the rule of law. Thank you so much
[12:23]
for listening. I
[12:26]
appreciate you.
[12:35]
>> I would like everyone to come here
[12:36]
in
[12:37]
the picture. Whoever is sitting. [
[12:38]
inaudible
[12:41]
]
[13:30]
>> I just want to briefly think everyone, the
[13:31]
citizens of manteca,
[13:32]
for your patience and for your love
[13:34]
for everyone . Just a couple years
[13:38]
ago
[13:40]
city councilmember singh got together
[13:43]
. Sharon washington. She came.
[13:46]
and the key
[13:49]
feeling then was
[13:52]
we can breathe. Talking
[13:55]
with
[13:57]
george floyd and the very sad killing
[13:58]
of him
[14:01]
by the police by sitting on his neck. Although
[14:03]
these incidents are very far apart
[14:07]
, the floyd incident is
[14:09]
no less important, but it is nothing
[14:10]
compared to being shot
[14:16]
in
[14:18]
your mouth and being dragged to a
[14:19]
hospital miles and miles away so you
[14:20]
could
[14:21]
die. I believe today our city spoke
[14:28]
. America spoke.
[14:30]
and as long as we continue to speak
[14:31]
and recognize each other's pain and
[14:33]
love, no one can fail us and we will
[14:34]
never fail.
[14:37]
>> [ applause
[14:40]
]
[15:01]
>>
[15:02]
okay, mayor and council. That will bring
[15:04]
us to item a2.
[15:07]
black history month. Today we have
[15:12]
gwen from the senior center along
[15:13]
with tyler from the recreation services
[15:14]
department
[15:17]
to accept.
[15:35]
she
[15:37]
just lost 30 seconds.
[15:38]
>> whereas, national black history
[15:40]
month in february affords special opportunity to become
[15:41]
more
[15:42]
knowledgeable about black heritage and to honor the many
[15:44]
black leaders who have
[15:45]
contributed to the progress of our nation.
[15:49]
african americans have played a significant role in the history
[15:51]
of our nation and california's economic,
[15:53]
cultural, spiritual, and
[15:56]
political development while
[15:58]
working tirelessly to promote their culture and history; and
[16:03]
>> whereas, black history month is
[16:05]
an occasion to rediscover the
[16:06]
enduring stories of african americans and the gifts of
[16:08]
freedom, purpose and
[16:09]
opportunity they have bestowed on future generations,
[16:11]
black history month is american
[16:14]
history; and
[16:17]
>>
[16:18]
whereas, black history month reminds us to continue to fight
[16:19]
for justice and equality and should be
[16:22]
a uniting call to our nation to continue to work for a more
[16:26]
diverse, supportive, inclusive, and protective
[16:29]
union; and
[16:31]
>> whereas, black history month is
[16:33]
a call to each and every citizen of our great community
[16:35]
to reflect
[16:36]
on the cultural, scientific, political, and economic
[16:41]
contributions of african
[16:44]
americans, which are woven
[16:45]
throughout american society. We remember, learn from, and
[16:47]
build on the past, so that,
[16:48]
together, we can build a better and more
[16:49]
prosperous future for all americans; and
[16:52]
now, therefore, I, gary singh, mayor of the city of manteca,
[16:56]
on behalf of city council, do hereby proclaim february 2025,
[17:00]
as black history month. We call upon public officials,
[17:04]
educators,
[17:06]
librarians, and all the residents to take part in
[17:08]
programs, ceremonies, and
[17:10]
activities to enrich this shared
[17:12]
american history.
[17:19]
>> [ applause ]
[17:30]
>> hello, everyone.
[17:39]
my name is tyler, and I am
[17:40]
a recreation supervisor for the recreation
[17:41]
community services department. I work
[17:42]
at the senior center,
[17:43]
and we have worked with grace on a
[17:45]
variety of programs at our
[17:48]
senior center
[17:53]
, and so she is going to now bring
[17:54]
us black history month celebration.
[17:55]
in
[17:56]
recognition of february's black history month
[18:00]
, she is
[18:01]
going to give you a little more details about
[18:03]
what will be going on. But we
[18:04]
have flyers here. It will be on tuesday,
[18:06]
fibber 25th, at the
[18:07]
senior center, so we welcome you all
[18:09]
to join us.
[18:10]
>> thank you,
[18:15]
tyler.
[18:16]
my name is gwendolyn grace, and this
[18:18]
is the second year we will
[18:19]
be celebrating black history at the
[18:20]
senior center this year. We invite
[18:21]
you all to come
[18:22]
out. We're going to have music, dancing, food,
[18:24]
trivia, giveaways
[18:30]
, and biographies and some videos.
[18:31]
so it
[18:32]
should be a good time. We invite you
[18:33]
all to come out.
[18:36]
thank you.
[18:41]
>> [ applause ]
[18:51]
>> okay. That will bring us our last
[18:52]
presentation item, a3, certificate
[18:55]
of recognition to
[18:58]
robert
[19:01]
desruisseau
[19:07]
.
[19:19]
>> right in front.
[19:22]
right here.
[19:28]
look
[19:31]
at that.
[19:34]
[ inaudible ]
[19:40]
>> top 10 in the country.
[19:43]
this one is for
[19:45]
winning the national [ inaudible ]
[19:49]
>>
[19:52]
[ laughter ]
[19:55]
>> all right. So we want
[19:56]
to
[19:57]
give this certificate of recognition
[19:58]
presented to robert desruissea
[20:00]
. For your outstanding
[20:13]
achievement in bmx racing. Your hard
[20:14]
work and commitment to
[20:16]
excellence have not only brought you
[20:19]
personal success but have also inspired
[20:22]
those around you. We honor
[20:23]
your accomplishments and celebrate
[20:25]
your passion. Thank you.
[20:28]
everybody, round of applause.
[20:29]
>> [
[20:30]
applause
[20:31]
]
[20:34]
champion. Got more
[20:37]
than me.
[20:40]
[ inaudible ] come on. You got
[20:43]
to.
[20:46]
>> tell me how you got there.
[20:52]
>> it is all thanks to my coach,
[20:54]
rick. He has been training me for
[20:55]
the past three years. I would
[20:57]
be like this right now if it wasn't
[20:58]
for him.
[20:59]
>> nice.
[21:01]
how hard was it?
[21:04]
>> [ applause ]
[21:07]
>> it was hard getting to
[21:09]
maines. I had to race about 50 people
[21:10]
.
[21:16]
>>
[21:19]
where was it
[21:22]
?
[21:23]
>> oklahoma. >> wow. All right.
[21:28]
did you have fun?
[21:29]
>> yeah.
[21:33]
>> all right. Well, congratulations,
[21:35]
and thank you for doing this. Do
[21:36]
you want to say a few words? You can
[21:38]
probably tell us a
[21:41]
lot more.
[21:43]
>> you know, robert started off a
[21:44]
little rough this season. He
[21:45]
had a really bad crash at the beginning
[21:47]
of the year, and then he just
[21:48]
kind of picked it up and he did not
[21:50]
lose after that. He
[21:53]
just won, won, and won
[21:54]
and then it came to the northern california
[21:56]
series. You can see he won
[21:59]
it all. And this
[22:00]
is the state trophy for the finals
[22:03]
where he ended up finishing first
[22:05]
overall at the finals.
[22:07]
and then they take the top 10 from
[22:08]
each
[22:10]
state and they take him to, to race
[22:11]
a race
[22:14]
called race of champions, which
[22:17]
he won
[22:19]
the race of champions. And he got
[22:20]
really lucky because
[22:21]
the girl from columbia was right behind
[22:23]
him. Right behind him.
[22:25]
and she was right behind him again
[22:26]
over
[22:29]
in grands.
[22:32]
and that was the race
[22:33]
for four days. The first two days
[22:35]
is roc and the next two days
[22:36]
is grants. He had a very unfortunate
[22:38]
accident when he went for the west
[22:39]
coast finals. He crashed. And he was
[22:41]
overall had to finish
[22:44]
fifth. He would have been
[22:45]
first overall. But because of the
[22:47]
crash, he finished
[22:48]
third overall in the west coast gold
[22:50]
cup finals.
[22:53]
but other than that, he won everything.
[22:56]
just amazing. As a dad, that is,
[22:58]
like, the rockstar win.
[22:59]
>> [ applause
[23:02]
]
[23:05]
>> I
[23:06]
just want to thank you for reaching
[23:08]
out. I'm glad we were able to give
[23:11]
you a little bit today
[23:14]
. We have a champion among us. Congratulations
[23:15]
for all of your efforts and bringing
[23:16]
the trophy home to manteca. Thank
[23:20]
you again.
[23:22]
you have a lot of bling, but I will
[23:23]
give you another one
[23:24]
here. It is one of our official pens.
[23:26]
take over now. Sure.
[23:28]
>> another kid too that is being looked
[23:29]
at.
[23:32]
he is a kid with
[23:35]
autism. And he is
[23:36]
verbal, but he is eight or nine years
[23:38]
old. He basically trains with robert
[23:39]
all
[23:40]
the time, and he finished exactly
[23:41]
as robert
[23:44]
. And his name is alejandra.
[23:47]
and he definitely deserves to
[23:50]
be up here too.
[23:52]
and I know I did not mention him before,
[23:53]
but I just thought of
[23:55]
it right now. This little kid with autism
[23:59]
. It was crazy.
[24:00]
from his first straight race, john
[24:02]
anderson was setting up cones to make
[24:03]
sure
[24:04]
he could follow the straight line
[24:05]
and not crash into people. Two years,
[24:07]
three years later , he is winning
[24:11]
it all.
[24:53]
[ inaudible
[24:56]
]
[25:35]
>> all right.
[25:38]
that was good. Congratulations to everyone.
[25:41]
and we
[25:44]
will go on to
[25:47]
public comments.
[25:50]
>> mayor, at this time, you may call
[25:53]
for public
[25:56]
comment for items not listed on the
[25:58]
agenda via zoom webinar or in person.
[25:59]
public comment is limited to three
[26:00]
minutes per
[26:02]
person.
[26:03]
>> okay.
[26:05]
are there any
[26:06]
comments on items that are not listed
[26:08]
on the agenda tonight?
[26:11]
anybody on zoom?
[26:17]
>> I have no hands raised. >> okay.
[26:20]
and anybody
[26:22]
in public like to speak on any items
[26:23]
that are not on
[26:26]
the agenda?
[26:29]
all right. Here is your
[26:32]
final chance.
[26:34]
see nine, we will go ahead and move
[26:35]
onto the next item. Consent.
[26:41]
councilmember lackey .
[26:44]
>>
[26:47]
c 7.
[26:50]
>> councilmember
[26:53]
breitenbucher.
[26:54]
>> nothing. >> councilmember
[26:56]
morowit.
[26:57]
>>
[26:59]
c 7.
[27:00]
>> okay. And vice mayor.
[27:02]
>> let's do
[27:05]
c
[27:08]
8.
[27:09]
>> I think you just wanted to do it.
[27:17]
>> all right. Okay. If I can
[27:19]
have --I don't have anything. If I
[27:21]
can have a motion for
[27:22]
items not pulled. Okay. I have a motion
[27:24]
from vice mayor halford. All in
[27:27]
favor
[27:30]
. Motion carries. 5-0.
[27:33]
>> adopt a
[27:34]
resolution approving a budget appropriation
[27:36]
for major equipment
[27:37]
purchase fee fund for the purchase
[27:39]
of five
[27:41]
new fully outfitted marked patrol
[27:42]
vehicles
[27:43]
for an amount not to exceed $510,000
[27:45]
and authorizing
[27:50]
city manager or designee to sign all necessary
[27:52]
documents to effectuate the agreement.
[27:54]
we have chief of police stephen
[27:57]
.
[27:58]
>>
[27:59]
do you want to present something or do
[28:00]
you want me to see if
[28:02]
councilmember lackey has a question?
[28:03]
>> we will go
[28:06]
with the question.
[28:07]
>> council
[28:08]
member lackey .
[28:09]
>> so my question
[28:10]
is , we are going to
[28:12]
be purchasing
[28:17]
five new fully outfitted patrol vehicles.
[28:18]
can
[28:19]
you just kind of give us an idea?
[28:21]
I know it says the equipment purchase
[28:22]
fee fund. A little bit about the acquisition
[28:24]
of these vehicles?
[28:25]
>> sure. What they
[28:27]
are using right now is the
[28:30]
vehicle fee fund
[28:32]
, however, without measure q being passed
[28:35]
, we would usually wait until the
[28:36]
beginning of
[28:38]
the budget season, but due to measure
[28:39]
q passing
[28:43]
and projected revenues for that and
[28:45]
the immediate need for the vehicles today
[28:48]
, we are putting it on
[28:51]
the agenda . It takes quite
[28:54]
some time to get a vehicle
[29:00]
. And it goes by purchase order date.
[29:01]
you
[29:02]
cannot get a purchase order date until it
[29:03]
passes. So if you're looking at
[29:04]
getting a vehicle through the regular
[29:05]
budget cycle, once a budget passes
[29:09]
, then we would be able to
[29:17]
put in a purchase order and get those
[29:18]
vehicles. And a lot of
[29:19]
the time there's --everyone is around
[29:21]
the same time trying to get vehicles.
[29:23]
and so that pushes out with who we
[29:24]
get
[29:25]
the vehicles from. And so being able
[29:27]
to do it now kind of puts us in
[29:28]
front of the eight ball instead of
[29:30]
behind it.
[29:33]
thank you.
[29:34]
>> any
[29:36]
other questions? Councilmember
[29:42]
morowit.
[29:43]
>> I don't
[29:44]
have much to add from what council
[29:45]
member lackey has said. I will just
[29:46]
say that
[29:47]
I want to emphasize that this is one
[29:48]
of the things we talked
[29:49]
about with the passing of measure
[29:51]
q for the
[29:52]
additional sales tax even though we
[29:53]
are not collecting it yet. We are
[29:54]
able to
[29:57]
get these vehicles on the ground
[29:59]
and into the police station as the
[30:00]
chief has said.
[30:02]
it takes a long time to get these
[30:03]
ordered and we are usually constrained
[30:04]
by
[30:06]
budget times.
[30:08]
so this was a great win for the city,
[30:09]
and we wanted
[30:11]
to show you that we needed this immediately. I
[30:12]
know there's been some accidents and
[30:13]
some things that happened with vehicles
[30:15]
and we have mishaps and worn out parts.
[30:16]
so
[30:17]
to be able to purchase when we actually
[30:18]
need them
[30:20]
immediately and not wait until a budget
[30:21]
cycle is very important. It
[30:23]
is not uncommon for an officer to arrive
[30:24]
in a
[30:25]
vehicle and that is only because there
[30:27]
is not a vehicle for the second
[30:29]
officer. So this is much better for
[30:30]
the city to get these
[30:33]
vehicles purchased and with the measure
[30:34]
q
[30:35]
funds coming sometime next year or
[30:36]
this year
[30:42]
--later in the year --we are able
[30:43]
to do
[30:44]
this. It's great. Thank you.
[30:45]
>> okay.
[30:46]
anybody else in the council want
[30:47]
to say anything? Councilmember halford?
[30:48]
or vice mayor. Sorry.
[30:51]
>> I will just say it
[30:52]
is good to be able to do this early.
[30:54]
the lead time on units
[30:57]
and equipment --you'll be lucky if
[30:58]
you have them
[30:59]
on the road in six months. The lead
[31:00]
time is incredible.
[31:06]
needless to say, they are not cheap.
[31:07]
they
[31:08]
never were, but they have gotten really expensive
[31:11]
. The last few years. Good move. Good
[31:12]
use of the money.
[31:15]
I would just reiterate what council
[31:16]
said
[31:18]
already.
[31:20]
thank you to chief and the staff to
[31:21]
proactively look into
[31:24]
purchasing these
[31:26]
and kind of getting ahead of the curve.
[31:27]
with
[31:30]
that, I will entertain a motion.
[31:33]
>> second.
[31:39]
>> okay. I have a motion from vice
[31:41]
mayor halford and a second from councilmember
[31:42]
morowit. All in favor. Motion
[31:45]
carries, 5-0. C 8.
[31:46]
>> adopt
[31:48]
a resolution , one, changing the name
[31:49]

two, amending the fiscal year
[32:03]

[32:07]

[32:23]

[32:25]

[32:27]
an amount not to exceed $4,600,000
[32:30]
. Four, update the location from
[32:32]

[32:35]

[32:36]
ad hoc committee
[32:39]
and authorize the city manager
[32:42]
to sign the agreement and any
[32:43]
associated documents. We have chief
[32:45]
of police stephen.
[32:46]
>> all right. I
[32:47]
will
[32:48]
start with
[32:50]
--
[32:51]
>> he doesn't need to do a report.
[32:52]
>> I just pulled it
[32:54]
to say
[32:56]
it is very gratifying to see we are
[32:57]
making positive, concrete progress
[32:59]
on building a new police department.
[33:02]
we moved into this one here in july
[33:03]
of 1976.
[33:06]
yes, I was there.
[33:07]
>> I wasn't
[33:09]
on earth.
[33:10]
>> we have added to it
[33:12]
three times .
[33:15]
we are overcrowded again.
[33:17]
and so it is not probably the best
[33:18]
design in the world.
[33:21]
honestly, it wasn't when they built it
[33:24]
the first time because they had
[33:26]
waist high windows facing the parking lot.
[33:34]
so,
[33:35]
thank you to the public for passing
[33:36]
measure q, which will help fund this,
[33:37]
as
[33:40]
will the
[33:42]
fees and other revenue sources. I'm
[33:43]
thankful we
[33:44]
are making concrete progress and getting
[33:46]
it done while I'm still on
[33:49]
the city council
[33:52]
hopefully.
[33:53]
>> we're going to go for
[33:54]
it. Anybody else on the council?
[33:55]
>>
[33:56]
I just want to
[33:58]
reiterate what the
[34:00]
vice mayor just said. It is a great accompaniment.
[34:03]
once again, this only can happen because of
[34:04]
measure
[34:07]
q because we are able to get
[34:09]
the funds to be able to start the
[34:10]
work. So once again,
[34:11]
this is your tax dollars at work.
[34:13]
and I appreciate the ad hoc
[34:15]
committee's work . And we will see
[34:16]
what
[34:18]
they come up with as a location. Stay
[34:19]
tuned.
[34:20]
>> yeah. I'm
[34:21]
very excited to get this moving and
[34:22]
hopefully see this place built
[34:25]
. And I know the ad hoc
[34:29]
with me and vice mayor will be busy
[34:31]
for the next few months to
[34:33]
get this going with the chief. Thank
[34:34]
you to get to
[34:36]
this point. I will open it up for
[34:37]
public comment.
[34:38]
sorry I did not do that in the last
[34:40]
one. Anybody wanting to
[34:43]
tell us anything about
[34:46]
--this item.
[34:52]
all right.
[34:55]
okay. With
[34:56]
that, I will go ahead and bring it
[34:57]
back to council. I will entertain
[34:58]
a motion.
[35:01]
>> second.
[35:03]
>> okay. A motion from vice mayor
[35:04]
and a second from
[35:07]
council member
[35:10]
breitenbucher.
[35:11]
all in favor, say aye. Motion passes,
[35:13]
5-0.
[35:18]
d 1.
[35:19]
>> conduct a public hearing and
[35:20]

[35:21]

[35:22]

[35:23]

[35:57]
and regulations. We have deputy director
[35:58]
of
[36:00]
engineering for you.
[36:01]
>> good evening
[36:02]
,
[36:04]
mayor, to the council members.
[36:07]
let me just start
[36:10]
off with deputy director of engineering.
[36:11]
let
[36:13]
me just start off to get this off
[36:14]
the
[36:15]
plate. These are not the user rates.
[36:19]
these are developer fees that developers
[36:22]
will be paying. So
[36:23]
the items I'm bringing forth tonight
[36:25]
do not impact
[36:28]
regular users.
[36:34]
so with that cleared, I will go ahead
[36:35]
and
[36:37]
get started.
[36:42]
so as you guys are aware, these are
[36:43]
capacity fees. Any type of
[36:44]
fee structure that we put together require
[36:46]
a lot of data
[36:51]
. It feels like these are all kind of
[36:52]
coming in together around the
[36:54]
same time. But we have been working
[36:55]
on these for a long time.
[36:57]
it all started with the 2023 general plan
[37:01]
. The last time these capacity fees
[37:02]
were
[37:03]
looked at was back in 2008. So we
[37:04]
had to wait for the general plan
[37:06]
to tell us what the future growth
[37:07]
projections were.
[37:10]
the general plan for
[37:13]
2043 was
[37:15]
approved back in july 2023 with the
[37:16]
general
[37:19]
plan approved
[37:21]
within started working on the master
[37:22]
plan. So the master plans for
[37:25]
the water system was approved on march 2024
[37:28]
,
[37:30]
and with that, we then had to make
[37:31]
sure we had the most
[37:33]
recent and up-to-date information.
[37:34]
so we had to wait for a
[37:37]
lot of audit to be
[37:40]
caught up. So those are kind of the
[37:42]
data sources we got all the information
[37:43]
to plug into these rates. It wasn't
[37:44]
like
[37:46]
we were just waiting around
[37:48]
. There were lots of data. Lots of
[37:49]
reports. Lots of
[37:51]
studies that had to be before we could
[37:52]
move forward with these
[37:55]
capacity fee calculations
[37:58]
[ inaudible ] developers.
[38:01]
so there is
[38:03]
typically three different types of approaches
[38:04]
for putting together
[38:07]
a capacity
[38:10]
fee. There is a buy in
[38:11]
approach. There is an incremental
[38:12]
and there is a hybrid approach. For
[38:13]
the water system, because
[38:16]
we do have access
[38:19]
available capacity , the best
[38:22]
approach to
[38:25]
was the buy in approach.
[38:30]
when you're looking at an incremental
[38:31]
approach, that is where your system
[38:33]
is kind of maxed out. There is no
[38:34]
additional access
[38:39]
capacity. Then you would be looking
[38:40]
at an incremental approach. A hybrid
[38:41]
approach
[38:42]
would be you have some excess capacity.
[38:43]
you could be in trouble in the next
[38:45]
five years or so. Looking at our water
[38:46]
system, this was
[38:54]
feedback from our water master plan,
[38:55]
which showed we do have excess capacity,
[38:56]
and therefore the buy in approaches
[38:58]
the most accurate way to do it. I
[38:59]
do have
[39:00]
a little bit of math just to show
[39:01]
that a lot of numbers
[39:04]
went into this.
[39:07]
so just to kind of make it very simple,
[39:10]
it really comes down to what because
[39:11]
we
[39:12]
are using the buy in approach --it
[39:13]
comes down to what the value
[39:15]
of your system is divided by your
[39:16]
actual max
[39:21]
. So just a quick calculation to show
[39:22]
how some of these numbers are
[39:24]
put together. I'm not going to bore
[39:25]
you guys with it, but
[39:27]
the maxed demand is pulled directly
[39:28]
from our master plan.
[39:31]
the peak
[39:34]
factor was also derived from our master plan,
[39:35]
so we couldn't have
[39:36]
actually put these studies together
[39:37]
until we completed our master plan.
[39:41]
this is a typical
[39:46]
revised, updated cost for the capacity
[39:47]
fee for
[39:50]
a single-family home.
[39:55]
I just have a total current fee here
[39:56]
and
[39:57]
the proposed fee. So these fees are
[39:58]
meant to ensure that developers are
[39:59]
paying their
[40:02]
fair share
[40:04]
so that as we are looking at all of
[40:05]
our
[40:07]
user rates , developers are being
[40:08]
required to pay
[40:11]
their fair share. And if
[40:14]
you look at further down
[40:17]
had an eight
[40:18]
inch line, it is quite a significant
[40:20]
increase. But for the most part
[40:21]
single-family residential are going
[40:23]
to be another
[40:24]
three-quarter inch meter. That is
[40:26]
going up roughly $310
[40:29]
, and I do want to
[40:33]
kind of stress that because these
[40:35]
fees were last looked at in 2008
[40:39]
. They have been continually escalated
[40:41]
based on cpi. So being off
[40:43]
by $310 actually is very, very good
[40:44]
for
[40:46]
a great study that was looked at 15
[40:47]
plus
[40:50]
years ago.
[40:55]
we are also adding a discount fee.
[40:56]
this is
[40:59]
a new fee we have been
[41:02]
looking at . And the whole idea
[41:04]
is that we do have some large estate lots.
[41:08]
they are inside the city limits.
[41:11]
but they may be on a well
[41:14]
, and if the well
[41:17]
goes bad , it is
[41:19]
really not fair to have those folks also
[41:23]
pay the same development fees as a
[41:24]
developer who is going to be going
[41:25]
in and purchasing large tracts of
[41:26]
land and
[41:27]
then putting undue stress on our system.
[41:29]
so we would still
[41:32]
recover those costs
[41:34]
when that land develops in the future,
[41:35]
but this would
[41:36]
be mainly for emergency -- emergencies
[41:38]
. There is very few
[41:41]
of these properties
[41:42]
that fall into this category. So we
[41:44]
do have some requirements
[41:46]
. First is that it does have to be
[41:47]
a
[41:50]
single-family residential
[41:52]
built prior to march 2024. That is when
[41:53]
the master plan
[41:56]
was adopted.
[42:01]
you must be within the city limits.
[42:02]
you also must have no
[42:03]
prior water connections. So if you
[42:05]
are a business and you want to put
[42:06]
in a car wash or a laundromat, this
[42:08]
would not apply to you. We would still
[42:10]
charge them the meter installation
[42:11]
fee. And then there
[42:12]
is a $500 administration fee just
[42:14]
for the city to track all of those
[42:17]
types of customers .
[42:20]
with that --
[42:21]
>>
[42:22]
and you go back to that real quick? Can
[42:23]
you tell us what
[42:28]
those fees are currently if somebody
[42:29]
wanted to do that?
[42:30]
>> so those fees right now currently
[42:32]
if you wanted to do that you
[42:33]
would fall under the single-family
[42:35]
residential. And so they
[42:38]
would be paying roughly
[42:41]
--if
[42:42]
the proposed fees are in place, that
[42:44]
would be roughly $6000.
[42:46]
now that is just for capacity fees.
[42:47]
there
[42:49]
are other fees that would also apply
[42:53]
. And so some of those costs
[42:55]
would actually be north of $15,000
[42:59]
.
[43:00]
>> all in it could be
[43:01]
15,000 to connect to the city currently.
[43:02]
>>
[43:05]
currently. Correct.
[43:08]
so that is why you are not --these
[43:09]
properties are
[43:11]
very few and far in between.
[43:17]
and a lot of times folks are not
[43:18]
going to want to connect unless they
[43:20]
have to. So we do want to be
[43:21]
good neighbors if our neighbors are
[43:23]
struggling with their wells and they
[43:24]
have --they
[43:25]
don't have potable drinking water,
[43:26]
we should try to come up with a mechanism
[43:28]
for them to connect to the city system.
[43:29]
so that was kind of the idea
[43:31]
with this new connection fee.
[43:32]
>> awesome.
[43:33]
>> yeah.
[43:41]
do you guys want to make a comment before
[43:42]
I
[43:43]
open it up?
[43:44]
>> I just got a quick
[43:45]
question. On the fee --went
[43:46]
back again. That only applies to the
[43:47]
existing dwelling.
[43:50]
so if it is
[43:52]
in the state lot and they did us lot
[43:53]
split for the
[43:56]
put an adu on, it would
[43:59]
be the regular fee?
[44:01]
>> so the way it is worded right now
[44:02]
is existing
[44:05]
single-family residential built prior to
[44:11]
march 2024. And they
[44:13]
also must be within city limits. If
[44:14]
they annex
[44:20]
--technically if they are outside
[44:21]
and annexed and it was an existing
[44:23]
property, they would
[44:26]
fall under
[44:28]
this. But if it is a new state lot
[44:29]
and they are splitting it
[44:31]
off, that would not fall under this
[44:32]
now.
[44:33]
>> but would it still
[44:35]
apply?
[44:36]
>>
[44:38]
adus are an interesting one. Right now
[44:41]
we do have it written in the current ordinance
[44:44]
that
[44:46]
adus would not be subject to these
[44:47]
fees , and
[44:50]
the thought is, if you put
[44:56]
an adu, you are
[44:58]
being fed off of the same line. You
[44:59]
are not going to run a new
[45:01]
line to tap into the city system.
[45:02]
>> split your existing --[ inaudible
[45:04]
] any other questions from council
[45:05]
before I open it up
[45:08]
? Okay. We will go ahead and open
[45:09]
up the public hearing
[45:11]
at 6:48: 37. City clerk
[45:14]
, anybody on zoom?
[45:17]
>> I do have a
[45:20]
hand raised .
[45:21]
>> okay.
[45:26]
>> okay. Can you
[45:29]
hear us? You will
[45:31]
have three minutes. We will start
[45:32]
the time now.
[45:35]
>> okay. Thank you very much.
[45:38]
thank you very much for
[45:44]
the city residents. I really
[45:47]
appreciate for some good causes.
[45:50]
one question I have
[45:53]
not specific to the fee structure
[45:54]
but regarding
[45:55]
the water impurities, which has been
[45:57]
circulated quite a few times.
[46:00]
the last one year we
[46:02]
received notice 2 to 3 times. Just
[46:03]
wanted to
[46:05]
check if we bring anything on that front
[46:09]
to not get
[46:10]
into that very often. I know it is
[46:12]
one well [ inaudible
[46:15]
] circulation. So just wanted
[46:17]
to check what city is doing in order
[46:20]
to produce those impurities.
[46:21]
>> hello. Sorry.
[46:24]
this does not pertain to
[46:27]
our normal fees for water rates
[46:29]
. This is just for new development
[46:34]
connection fees. So that would be
[46:35]
may be a leader on agenda item on
[46:39]
another day.
[46:40]
>> sounds good.
[46:42]
>> okay?
[46:45]
anybody else on zoom?
[46:54]
>> I have no other hands raised. >>
[46:55]
okay. Anybody in the audience would
[46:57]
like to speak on this item?
[47:08]
>> okay. Zenon, we will go ahead and
[47:09]
close the
[47:12]
public hearing at 6:50:36. We will
[47:13]
bring it back to council for discussion.
[47:15]
councilmember
[47:18]
lackey .
[47:21]
>> I don't have
[47:24]
any comment.
[47:25]
>> okay.
[47:26]
council member morowit.
[47:27]
>> nine. >>
[47:28]
council member
[47:30]
breitenbucher.
[47:32]
>> no comment. >> vice mayor. >> ditto.
[47:36]
>> I would just like
[47:39]
to say , good
[47:40]
call on as far as the city looking
[47:42]
at these rates. You are correct
[47:45]
seeing that there hasn't been significant
[47:46]
changes.
[47:48]
that means
[47:49]
at least this is one of those fees
[47:51]
we have been staying
[47:52]
up on and making sure development
[47:54]
is made for those connections. I did
[47:56]
see some of the fees were going down
[48:00]
. Can you kind of elaborate why?
[48:03]
>> yeah. I think there was
[48:05]
--it did slightly go down if you separate
[48:06]
the actual
[48:08]
connection fees and some of the other
[48:09]
fees we
[48:12]
put together , but when
[48:13]
you total it altogether in terms of
[48:15]
the overall capacity , it does
[48:18]
go up. But if you look at
[48:21]
the individual components , yes,
[48:23]
some of those dated very slightly.
[48:27]
so the original fee that was
[48:30]
encompassed
[48:31]
in the actual capacity fees were the
[48:33]
service water
[48:34]
service fee. Service water capital fee
[48:36]
, and then
[48:38]
you had the meter installation fee.
[48:39]
so it was
[48:42]
just how they priced out the
[48:44]
actual fee structure previously versus
[48:45]
how we are
[48:48]
doing it now.
[48:49]
>> okay.
[48:51]
and I do want to give kudos to staff
[48:52]
on basically creating that new connection
[48:54]
fee for existing residents. I know
[48:55]
there's
[48:57]
a lot of individuals that may
[48:58]
be were in the country or the county
[49:00]
at one time
[49:02]
or in the city and they have been
[49:03]
sitting on wells
[49:05]
or septic and they just don't really
[49:06]
want to come into
[49:09]
the city . And
[49:10]
one of the standouts usually is the
[49:12]
fees and the process to get that
[49:15]
done. Seeing the significance
[49:18]
reduction I
[49:20]
think will help a lot of those individuals
[49:21]
on the cusp to come into the
[49:24]
city and also bring out some of those
[49:27]
individual lots that are sitting in
[49:28]
our city
[49:29]
that should be on the city system.
[49:33]
great job on that also. With that
[49:36]
, I will entertain a motion.
[49:51]
>> so moved. >> second. >> all right.
[49:52]
I have a motion from councilmember breitenbucher
[49:53]
and a second from councilmember lackey to
[49:54]
adopt a
[49:55]
resolution approving the water capacity
[49:57]
fee nexus study setting charges
[49:58]
for water capacity fee updating water
[49:59]
meter installation fee and interim
[50:00]
residential new
[50:02]
connection fee and authorizing the
[50:03]
city manager or designee to take
[50:05]
all appropriate actions necessary
[50:06]
to carry out the proposed
[50:08]
and intent of the resolution, wave
[50:09]
the first reading
[50:12]
a substitution of the title
[50:13]
and introduce an ordinance of the
[50:15]
city council
[50:18]
for the city of manteca state of california
[50:19]
repealing and
[50:20]
replacing chapter 13.04 .01 meters required
[50:24]
and 13.0 4.020 rules
[50:27]
and regulations.
[50:30]
all in favor, say aye.
[50:36]
motion carries, 5-0. And we are
[50:38]
on to d 2.
[50:39]
>> conducted a public hearing
[50:40]
and adopt resolution capacity fee
[50:42]
nexus study
[50:48]
setting charges for the sewer capacity
[50:49]
fee and the interim
[50:50]

[50:51]

[50:52]
to take all
[50:54]
appropriate actions necessary
[50:57]
to carry out the purpose
[50:59]
and intent of the resolution. We have
[51:00]
the first reading by substitution
[51:01]
of the title
[51:02]
and introduce an ordinance of the
[51:03]
city of manteca, state of california
[51:06]
, repealing and replacing chapter
[51:07]
13.12 sewer
[51:09]
connection fees.
[51:10]
>> already.
[51:12]
>> good evening again, mayor
[51:15]
, city council. Thank you
[51:17]
. Deputy director of engineering.
[51:18]
again,
[51:21]
just wanted to stress that
[51:24]
this is the
[51:26]
capacity that is charged to developers.
[51:27]
this is not the user rates.
[51:30]
so none of this information that we
[51:32]
are presenting here affects the current users.
[51:40]
so again
[51:43]
, the last time these
[51:44]
fees were looked at was back in 2008
[51:48]
. I think a lot of utility fees kind
[51:49]
of
[51:51]
go together because there is lots
[51:52]
of
[51:53]
crossover in terms of the documentation
[51:55]
that is needed.
[51:57]
I skipped over some of the other documentation
[51:58]
that is referenced
[52:00]
on the waterside, but there's typically
[52:03]
three different types of approaches
[52:09]
. We did take a different approach
[52:10]
on the
[52:11]
sewer side than we did on the waterside
[52:13]
because right now
[52:16]
we do --we don't have any excess capacity
[52:19]
in our sewer system.
[52:22]
so what we did
[52:24]
was we included all of the costs associated
[52:25]
with providing service to
[52:28]
future customers
[52:30]
. Rolled that all into an incremental
[52:31]
capacity increase.
[52:33]
so anything that is associated with
[52:34]
future development
[52:37]
and future growth
[52:40]
--they are paying their fair share.
[52:41]
nothing more. Nothing less. That is
[52:43]
what these fees are designed to do.
[52:48]
so this table I have here with all
[52:49]
of the
[52:52]
cost down took a lot of time
[52:53]
for consultants to go through and
[52:55]
figure out how
[52:58]
and what treatment process
[53:01]
is designed to address each
[53:04]
component. So whether it be the
[53:07]
flow, nitrogen , you have to
[53:10]
study the improvements
[53:17]
--what the improvements are intended
[53:19]
to do, and attribute those costs to
[53:20]
just those individual components.
[53:21]
so that took quite a bit of time.
[53:22]
and we couldn't do
[53:24]
it without having a plan in place.
[53:28]
once
[53:31]
we got all that information
[53:32]
, the calculation actually ends up
[53:34]
being pretty simple
[53:40]
. Just based on the amount
[53:41]
of contribution for each single family
[53:43]
home, we are able to calculate the
[53:45]
unit cost for each component. So if
[53:46]
you look at
[53:49]
the highlight in red here
[53:52]
, because the bulk of our needs
[53:53]
right now are at the treatment plant,
[53:55]
flow is really your
[53:58]
cheapest component
[54:04]
. We are struggling with nutrient
[54:05]
removal. So as you move to the left,
[54:07]
nitrogen is the most expensive component.
[54:09]
so just to kind of give you an idea
[54:10]
of how the different
[54:13]
needs have
[54:14]
grown. And nitrogen really is a new
[54:16]
requirement for us
[54:17]
that wasn't accounted for in the original
[54:19]
study back in 2008.
[54:25]
so taking all of that
[54:28]
, we are changing
[54:31]
the fee structure for the
[54:34]
sewer side.
[54:36]
so I can't give you a comparable between
[54:37]
existing and proposed.
[54:40]
but one that I can give you
[54:42]
comparable four is the single-family home
[54:51]
. Currently for a single-family home,
[54:52]
the capacity is $5964. That
[54:53]
is going to be going up roughly $1000.
[54:55]
$947 if you are counting it.
[54:57]
we have sat down and reviewed this
[55:01]
with the bia
[55:07]
. They didn't have any comments. They
[55:08]
did
[55:09]
ask some questions about why and how.
[55:10]
we went through the calculations with
[55:11]
them. I don't see them here tonight.
[55:13]
I don't know if they are
[55:15]
online, but it has been more or less
[55:16]
vetted through
[55:19]
the bia .
[55:22]
we are adding
[55:28]
--sorry.
[55:29]
go back. We do have the single-family.
[55:31]
we are also adding a category for
[55:32]
multifamily and
[55:34]
also mobile homes.
[55:37]
this is lining up with exactly how
[55:38]
we have
[55:39]
our user rates structured so that
[55:40]
way we are consistent throughout the
[55:41]
whole capacity
[55:43]
system charging to the
[55:46]
developers and also when those folks
[55:48]
become users , everything is seamless
[55:52]
and as straightforward as can be.
[55:58]
for commercial low strength,
[56:04]
we do have that calculated. It is
[56:05]
based on
[56:06]
their projected loading. So depending on
[56:07]
how much flow they are predicted to
[56:08]
use
[56:10]
to assess nitrogen, these are
[56:13]
the total costs. The
[56:16]
meter size is based on their water meter.
[56:25]
the reason for that is there is
[56:26]
no good way to measure wastewater
[56:28]
at those lower levels, so you use
[56:29]
the meter sizes
[56:30]
as a gauge for how much water they
[56:31]
are going to use, which means
[56:33]
a portion of that is going to be generating
[56:34]
your wastewater.
[56:36]
so that is the cost for promotional
[56:42]
strength. And the cost for medium strength
[56:46]
sewer capacity fees. Then we also have
[56:49]
the commercial high-strength
[56:52]
.
[56:55]
and we also added the discount fee
[56:58]
for our
[57:01]
friends who are inside the
[57:04]
city limits existing single-family homes
[57:07]
constructed prior to
[57:10]
march 2024. No prior
[57:12]
sewer connections . So this would
[57:13]
be folks
[57:18]
put on septic that their septic may
[57:19]
have gone bad and they cannot get
[57:22]
a permit because there is a separation
[57:23]
issue between their septic and
[57:26]
their well. There is
[57:27]
just a straight administration fee
[57:29]
of $500 for a
[57:32]
sewer connection. With that
[57:35]
, I will be happy to
[57:38]
answer any questions.

it is all good

[59:08]
entertain a motion.
[59:09]
>> motion to approve.
[59:11]
>>
[59:12]
okay. I have a motion from councilmember
[59:14]
morowit. Second from
[59:17]
vice mayor halford
[59:18]
to adopt a resolution approving the
[59:26]
sewer capacity fee nexus study setting
[59:27]
charges for this work best if he and
[59:28]
interim residential new connection and
[59:29]
authorizing the city
[59:30]
manager designee to take all appropriate
[59:31]
actions necessary to carry out the
[59:32]
proposed intent of
[59:35]
the resolution
[59:40]
, wave the first reading by substitution
[59:41]
of the title, and introduce
[59:42]
an ordinance of the city council of
[59:44]
the city of manteca, state of california,
[59:45]
billing and replacing chapter 13.12
[59:46]
sewer connection charges. All in favor,
[59:47]
say aye.
[59:50]
opposed motion carries, 5-0.
[59:53]
thank you. Appreciate it.
[59:56]
with that
[59:59]
--
[1:00:01]
we will head to city manager comments.
[1:00:05]
>> thank you.

[1:02:38]
last announcement.
[1:02:41]
the water and wastewater meetings
[1:02:45]
you're probably asking yourself why
[1:02:47]
is the city of manteca proposing to
[1:02:51]
raise water and sewer rates?
[1:02:53]
we get it. No one wants to pay more
[1:02:54]
for the truth is
[1:02:56]
that the city could have and should
[1:02:57]
have
[1:03:00]
adjusted rate
[1:03:03]
. Incrementally years ago,
[1:03:04]
but because increases were put off
[1:03:05]
for so long, we are now at a point
[1:03:07]
where we have to act. Our utility
[1:03:09]
funds can no longer keep up with
[1:03:11]
the cost of maintaining our aging system
[1:03:12]
, keeping
[1:03:15]
up with services
[1:03:18]
, demands, and making critical infrastructure upgrades
[1:03:21]
. It has been nearly
[1:03:22]
15 years since the last adjustment.
[1:03:28]
and in that time, costs have gone
[1:03:30]
up while parts of our system
[1:03:33]
have aged past
[1:03:36]
their
[1:03:37]
lifespan. To make sure we're making
[1:03:38]
the right decision, we brought an
[1:03:39]
independent consultant to
[1:03:40]
assess what is needed to keep things
[1:03:41]
running safely and efficiently. While
[1:03:42]
these improvements we
[1:03:45]
risk breakdowns --without these
[1:03:46]
improvements we risk breakdowns. We do
[1:03:54]
reduce service and higher costs
[1:03:55]
down the road. Because customer rates
[1:03:56]
are what fund local and sewer projects,
[1:03:57]
we have
[1:03:58]
to propose these adjustments to ensure
[1:04:00]
we can continue providing safe,
[1:04:01]
reliable service, not just today but
[1:04:03]
for the years to come.
[1:04:09]
we have some
[1:04:10]
upcoming community meetings on rate
[1:04:11]
increases and handouts are available
[1:04:12]
at the back table for
[1:04:13]
more information. Residents are encouraged
[1:04:15]
to learn more about the proposed rate adjustments
[1:04:17]
and ask questions at upcoming community meetings
[1:04:19]
. There is a virtual facebook live
[1:04:21]
on saturday,
[1:04:23]
february 22nd, at 2:00 p.m. There
[1:04:24]
is also
[1:04:27]
a wednesday february 26
[1:04:30]
at 2:00 p.m. And then a
[1:04:33]
wednesday march 5th
[1:04:35]
at 6:00 p.m. Details on the proposed
[1:04:36]
rates can be found at
[1:04:38]
manteca water rates.org , and manteca
[1:04:42]
wastewater.org . One last
[1:04:45]
notable item is there is also
[1:04:48]
a discount program coming in march
[1:04:52]
. So stay tuned for that. More information
[1:04:54]
will come out on that.
[1:04:56]
mayor, that concludes the city manager
[1:04:57]
report.
[1:05:00]
>> thank you. Appreciate it.
[1:05:03]
with that, we will go to council comments.
[1:05:06]
start with
[1:05:09]
council member breitenbucher.
[1:05:12]
>> okay. I wanted to
[1:05:15]
bring forward an item to look at
[1:05:17]
putting onto next meeting's agenda
[1:05:21]
. It is laura's
[1:05:24]
law. 2021 we sent a letter to the supervisors
[1:05:27]
asking to implement that
[1:05:30]
. It is a state law that
[1:05:33]
helps people
[1:05:38]
mental health. Enhances public safety
[1:05:39]
, reduces the
[1:05:42]
need for inpatient
[1:05:43]
commitment and incarceration. It is
[1:05:45]
known as aot
[1:05:51]
. It is a california law that allows
[1:05:52]
courts
[1:05:53]
to order community treatment for people
[1:05:54]
with severe
[1:05:57]
mental illness. A law was named after
[1:05:58]
laura wilcox, who was killed by person
[1:06:00]
with mental illness in 2001. Today
[1:06:01]
the
[1:06:03]
navigation center we had
[1:06:06]
--I was there when they took a call
[1:06:09]
from kaiser. They had a patient
[1:06:12]
that they were going to discharge.
[1:06:14]
they were asking 555 to take them.
[1:06:21]
there is an
[1:06:24]
issue there. And because we
[1:06:27]
don't have
[1:06:30]
the ability --
[1:06:31]
if the person refuses, you cannot
[1:06:33]
force them. This
[1:06:35]
puts a tool in the box that allows
[1:06:36]
the court
[1:06:38]
to say, yes, this person needs help,
[1:06:39]
and it gets them help. Otherwise
[1:06:41]
these people get lost in the weeds.
[1:06:45]
so did you
[1:06:47]
have something?
[1:06:48]
>> yeah, mayor and
[1:06:51]
council. I wanted to add to that.
[1:06:52]
assisted outpatient treatment. What
[1:06:54]
makes it
[1:06:57]
unique is counties have to opt into
[1:06:58]
it. Cities cannot.
[1:07:00]
the county has to do it. So each
[1:07:02]
--all 58 counties in the state and
[1:07:03]
each one individually has to
[1:07:06]
do it. In 2021, the
[1:07:08]
council did send a letter to the board
[1:07:09]
of supervisors requesting that they
[1:07:10]
do
[1:07:11]
it. They decided not to and instead
[1:07:14]
stick with what is called their inspire
[1:07:15]
program, which is
[1:07:18]
voluntary treatment
[1:07:24]
. I know at the time they said that
[1:07:25]
they
[1:07:26]
would update us. We have not received
[1:07:27]
an update. I just wanted to give some
[1:07:28]
more background on what laura's law
[1:07:30]
is in case you may want to know.
[1:07:31]
>>
[1:07:33]
thank you.
[1:07:34]
>> anything else, council
[1:07:35]
member?
[1:07:36]
>> asking for that -->> I'm
[1:07:37]
asking for that to be.
[1:07:39]
>> I would just like
[1:07:41]
to add I think we need to give it
[1:07:42]
another shot. I think it would
[1:07:44]
be helpful for our community. I think
[1:07:45]
we need to prepare some changes on
[1:07:46]
our supervisors. Hopefully they will
[1:07:47]
relook at this and understand the
[1:07:48]
importance and benefits
[1:07:51]
of this. I will be supportive
[1:07:54]
of it.
[1:07:57]
>>
[1:07:59]
I am seeing five head nods, so I will
[1:08:00]
prepare a letter to bring forward
[1:08:01]
to
[1:08:03]
the next meeting for council approval.
[1:08:04]
>> anything else?
[1:08:05]
>> yeah. Welcome, chief. Welcome to
[1:08:06]
your first meeting. It
[1:08:10]
was a fun one. And those
[1:08:11]
employees. We had about three employees
[1:08:13]
that were
[1:08:16]
sworn in . Or more.
[1:08:17]
>>
[1:08:19]
just yesterday we had three .
[1:08:21]
>> will come to those. I'm excited
[1:08:22]
about the
[1:08:24]
community garden coming downtown.
[1:08:25]
we
[1:08:26]
had looked at another location. Excited
[1:08:28]
about this one.
[1:08:30]
it gives people another reason to
[1:08:33]
come downtown . So pretty stoked about this.
[1:08:34]
that is
[1:08:36]
it for me. Thank you. Councilmember
[1:08:40]
morowit.
[1:08:41]
>>
[1:08:43]
good evening. I attended the
[1:08:45]
union booster crab feed saturday.
[1:08:47]
well attended. Good group of folks.
[1:08:49]
made some money
[1:08:52]
for the cause. Sports.
[1:08:55]
I would just like to reiterate
[1:08:56]
a couple of things we mentioned tonight
[1:09:00]
. We mentioned some tonight. We had
[1:09:01]
purchased a
[1:09:03]
fire engine last month. Went to direct
[1:09:04]
result again of
[1:09:05]
measure q. Being able to purchase something
[1:09:07]
had a
[1:09:08]
budget cycle that was an opportunity
[1:09:13]
of a demo type fire engine in
[1:09:16]
the bay area where if we did
[1:09:17]
not move on that engine, we wouldn't
[1:09:19]
have been able to purchase it. Because
[1:09:20]
there
[1:09:21]
were other cities that really liked
[1:09:22]
it and wanted it, but we were
[1:09:25]
able to do that and
[1:09:27]
pd vehicles tonight. We used funds
[1:09:34]
to outfit the equipment with radios
[1:09:35]
and sirens and all of that good stuff
[1:09:37]
that goes with the public safety
[1:09:38]
equipment. Putting that on hold to
[1:09:40]
add to this
[1:09:45]
. Those will be fully outfitted. And
[1:09:46]
then of course the police
[1:09:47]
department. I cannot say enough. Years
[1:09:49]
and years.
[1:09:50]
if we pass measure
[1:09:52]
q. We are on track to do that. I appreciate
[1:09:53]
that. I would also like to
[1:09:57]
welcome the new interim fire chief,
[1:09:59]
dave. Thank you, sir.
[1:10:05]
that is what wisdom and experience brings
[1:10:08]
. Great to have him. Thank you.
[1:10:11]
>>
[1:10:17]
you wanted to add anything?
[1:10:18]
>>
[1:10:19]
I was just going to thank you for
[1:10:20]
the honor and privilege of being able
[1:10:21]
to serve the community. I'm happy
[1:10:23]
to be here.
[1:10:24]
>> welcome, sir. Councilmember
[1:10:29]
lackey .
[1:10:30]
>> all right. Just a few
[1:10:31]
things. Welcome,
[1:10:32]
chief. Glad to have you aboard. Last week
[1:10:33]
councilmember
[1:10:34]
breitenbucher and I went to the water
[1:10:35]
sewer town hall meeting . It was
[1:10:38]
really informative
[1:10:40]
. It was a great meeting. Unfortunately
[1:10:41]
we only had
[1:10:42]
about 10 people from the public attend,
[1:10:44]
so I really encourage everybody
[1:10:50]
to go and
[1:10:51]
get informed and see what is going
[1:10:53]
on. See why these rates are having
[1:10:54]
to
[1:10:55]
be increased and how dire the situation
[1:10:56]
actually is.
[1:11:02]
there are a lot of different opportunities
[1:11:03]
to attend, and we have actually been
[1:11:05]
able to extend that so that there
[1:11:08]
is the facebook live
[1:11:10]
. There are evenings. There are weekends.
[1:11:11]
so there is
[1:11:12]
a timeframe that should work for just
[1:11:14]
about everybody
[1:11:16]
. So please get out there. I'm really
[1:11:17]
encouraged to know there is
[1:11:19]
a discount program that is being implemented
[1:11:22]
. When we first talked about this,
[1:11:23]
I did ask
[1:11:24]
if there was going to be something
[1:11:26]
to help, and so I'm glad to
[1:11:28]
see that that is being worked on.
[1:11:29]
also
[1:11:32]
grateful to see that we are seeing
[1:11:35]
the
[1:11:38]
benefits of measure q .
[1:11:40]
as you know, I was not a fan of the
[1:11:41]
measure, but
[1:11:43]
we are putting the money where we
[1:11:44]
said we would
[1:11:50]
. So we are seeing the benefits. We
[1:11:52]
are seeing a new fire truck. We are
[1:11:53]
seeing police vehicles. So I am encouraged
[1:11:56]
by that . To say the least.
[1:11:59]
so I went to
[1:12:05]
paint and
[1:12:07]
sip this past week at our new thomas
[1:12:08]
toy community center. If you have
[1:12:09]
not
[1:12:10]
seen the center, please go check it
[1:12:11]
out. I love community projects. So
[1:12:12]
this is
[1:12:13]
one of those that gets teens involved.
[1:12:14]
we will have the community
[1:12:17]
garden, which
[1:12:21]
with the youth leader background I
[1:12:23]
think this is an amazing opportunity
[1:12:24]
for people
[1:12:25]
of all ages, but especially our youth
[1:12:29]
to be able to come in, work together,
[1:12:30]
do something good for the community,
[1:12:32]
and maybe even collaborate with different organizations
[1:12:34]
. Other than that, I hope everybody
[1:12:35]
has a wonderful night.
[1:12:38]
>> all right. Thank you, councilmember
[1:12:41]
lackey . Vice
[1:12:43]
mayor.
[1:12:44]
>> welcome, chief. I'm sure
[1:12:45]
you'll do a
[1:12:47]
great job and be here for
[1:12:50]
a few months. Or longer. Who knows?
[1:12:56]
>> I was out of
[1:12:58]
the area for about 2 1/2 weeks. I
[1:12:59]
don't have a lot to say.
[1:13:02]
>> all right.
[1:13:05]
>> he is doing great tonight.
[1:13:08]
>>
[1:13:11]
welcome, chief.
[1:13:17]
I am
[1:13:19]
hoping --doing pretty good so far
[1:13:20]
this week. Looks like you brought
[1:13:21]
the rain. So that is great. Great
[1:13:23]
for all of the fires out there.
[1:13:26]
I know this past week we have had
[1:13:32]
done a lot of the
[1:13:34]
interviews for boards and commissions,
[1:13:35]
so one of the things I wanted to do
[1:13:37]
was ask for council successes for our
[1:13:39]
city clerk to go
[1:13:41]
back out . We are recruiting under
[1:13:42]
the recreation and
[1:13:46]
park commission in the public oversight committee
[1:13:50]
because we have not had
[1:13:52]
enough applicants for all districts.
[1:13:53]
and
[1:13:55]
I believe counsel number breitenbucher
[1:13:56]
you
[1:13:57]
wanted to also add a portion of that
[1:13:59]
on measure
[1:14:02]
q.
[1:14:14]
>> I would like to see
[1:14:15]
if you guys are agreeing with that.
[1:14:17]
we can see the
[1:14:26]
>> I think we
[1:14:27]
should probably go out and give it
[1:14:29]
a month.
[1:14:32]
>> we can definitely
[1:14:33]
do about a month recruitment. 3 to
[1:14:35]
4 weeks . And then we
[1:14:36]
can have something back to you guys
[1:14:38]
for appointments
[1:14:43]
after the 3 to 4 weeks. You guys would
[1:14:44]
do the
[1:14:45]
interviews. And then a week after
[1:14:46]
that in mid-march we can have the
[1:14:50]
appointments made.
[1:14:51]
>> last time it
[1:14:52]
was kind of during the holiday season.
[1:14:53]
so maybe a lot of people did not
[1:14:56]
get the information and did not
[1:14:59]
apply. And also I think it gives an
[1:15:00]
opportunity. I will say the people
[1:15:01]
that already applied and that already
[1:15:02]
interviewed do not
[1:15:03]
need to reapply. Or they do not need
[1:15:05]
to be reinterviewed.
[1:15:07]
we will still retain your information
[1:15:08]
and just wait
[1:15:10]
for new applicants. Are we good on
[1:15:11]
that?
[1:15:12]
>> I am
[1:15:13]
supportive of that. We want to reiterate
[1:15:15]
though, that one of the reasons we
[1:15:17]
are extending it is there were not
[1:15:20]
enough applicants
[1:15:22]
for the mayor in particular to appoint
[1:15:23]
the number
[1:15:25]
of people that he needed to appoint .
[1:15:28]
on parks and rec, the numbers just
[1:15:29]
were not there. Not
[1:15:31]
enough applied to fill the position.
[1:15:35]
>> all right.
[1:15:44]
if I ask for
[1:15:45]
one, I guess I will ask for another
[1:15:47]
one. I would also like to see a
[1:15:48]
council consensus to look into whether
[1:15:50]
maybe we can do an expedited process
[1:15:51]
or grandfather in. I have seen a lot
[1:15:53]
of this stem from the city of
[1:15:54]
berkeley on affordable housing or
[1:15:56]
housing options. Looking at
[1:16:02]
adu
[1:16:04]
s or converted spaces through an amnesty
[1:16:08]
program or fee deferral process.
[1:16:11]
people may already
[1:16:12]
have those. And they have done it
[1:16:13]
without permits allowing them to come
[1:16:14]
up
[1:16:17]
to code and actually bring it
[1:16:18]
to light instead of continuing to
[1:16:20]
being under the
[1:16:23]
radar there.
[1:16:29]
if we can start
[1:16:31]
a program I would like to see the
[1:16:32]
city attorney and city manager's office
[1:16:33]
kind of work together on some kind
[1:16:35]
of program that can work with the
[1:16:36]
rest of the staff and bring back to
[1:16:38]
us to kind of help get some of
[1:16:41]
these unpermitted adus
[1:16:43]
or whatever they may be in the city
[1:16:44]
running. And
[1:16:47]
so I think with that , maybe also
[1:16:48]
not
[1:16:50]
something that
[1:16:51]
I know government already starts dragging
[1:16:53]
and making it very difficult
[1:16:56]
with the process. I think it should
[1:16:57]
be
[1:16:58]
something that could be efficiently done.
[1:17:03]
just to get these individuals and
[1:17:05]
for us also as the safety purposes
[1:17:06]
and
[1:17:07]
code enforcement. To make sure everybody is
[1:17:11]
legal and everything is done appropriately.
[1:17:13]
don't know your thoughts on that.
[1:17:14]
>>
[1:17:16]
I'm supportive of taking a look at
[1:17:17]
it. I think it is
[1:17:19]
going to be pretty complicated. There's
[1:17:20]
lots of variations
[1:17:23]
of what has been done
[1:17:27]
>> correct.
[1:17:29]
>> a
[1:17:31]
lot of years. Dating back to the 20s
[1:17:32]
and 30s. Some of the
[1:17:35]
downtown areas . There's two or three
[1:17:41]
>> there's a lot of them. >> dwelling
[1:17:42]
units on a single lot.
[1:17:44]
so it is not going to happen
[1:17:56]
in a week.
[1:17:57]
>> I know.
[1:17:58]
and I think it could be some kind
[1:17:59]
of base process on different types.
[1:18:00]
>> it
[1:18:01]
is going to be complicated. They probably
[1:18:02]
don't even know what is out there.
[1:18:03]
>>
[1:18:04]
correct. But at least allows residents
[1:18:05]
to come forward if they want to
[1:18:06]
actually make everything permitted
[1:18:08]
and legal. Instead of us --a lot of
[1:18:09]
times we
[1:18:10]
may see things and we just ignore
[1:18:11]
them. So I thought, here is an
[1:18:13]
opportunity if we were willing to
[1:18:14]
do it to go forward.
[1:18:20]
>> I agree. I think
[1:18:22]
it sounds like it is going to be a
[1:18:23]
complicated process. And so
[1:18:25]
I just need a little more time to
[1:18:26]
wrap my head around
[1:18:28]
it.
[1:18:29]
>> I just want to caution everyone
[1:18:30]
could we are doing
[1:18:31]
an in consensus to look into. We are
[1:18:32]
not necessarily
[1:18:38]
approving anything this evening.
[1:18:40]
>> yeah. We are just having staff
[1:18:41]
look at it. We are not creating the
[1:18:43]
process right now.
[1:18:44]
>> okay. Okay.
[1:18:45]
>> no one is being bound by anything
[1:18:46]
you
[1:18:47]
say.
[1:18:48]
>> I am not forcing you.
[1:18:49]
>> there is no comment to be said.
[1:18:50]
it is basically
[1:18:53]
look into it or we don't. I'm supportive
[1:18:55]
of looking into anything that would
[1:18:57]
help folks become existing
[1:18:59]
nonconforming structure. Or something
[1:19:00]
to
[1:19:03]
that effect.
[1:19:08]
thank you.
[1:19:09]
>> all right. I think you
[1:19:10]
have got some consensus there. We're
[1:19:11]
good with that one too. With that, I
[1:19:13]
also wanted to reiterate the super
[1:19:14]
bowl is this weekend, which means
[1:19:15]
also the rotary
[1:19:16]
omelette pancake breakfast. If you
[1:19:18]
haven't been there
[1:19:19]
, please try to make it this sunday.
[1:19:21]
7:30 a.m. To
[1:19:24]
11:30 a.m. . And please make
[1:19:27]
it out to him rps
[1:19:30]
held by the
[1:19:33]
manteca rotary club. It is always
[1:19:35]
a full house. And you will see councilmember
[1:19:39]
morowit hopefully will be
[1:19:42]
there. We
[1:19:43]
were thinking we were going to get
[1:19:45]
you in the kitchen this year
[1:19:48]
and maybe cooking.
[1:19:49]
>> no, no.
[1:19:51]
>> the fire department. >> I think
[1:19:52]
that would require council consensus
[1:19:54]
to get him into the
[1:19:57]
kitchen.
[1:20:00]
>> gabbard >> do we have council
[1:20:01]
consensus to get him in the kitchen?
[1:20:03]
>> no. >> no, we
[1:20:04]
don't. As you can see, everybody knows
[1:20:06]
morowit's cooking skills. But
[1:20:09]
with that, I know vice mayor
[1:20:10]
halford is usually on the microphone.
[1:20:12]
>> there's going to
[1:20:15]
be 100
[1:20:16]
plus raffle prizes and five raffles
[1:20:17]
during the day so everybody has an
[1:20:18]
opportunity. It
[1:20:21]
is a good time. Money goes to a
[1:20:24]
good cause.
[1:20:27]
fun scholarships. Donations. Other
[1:20:28]
nonprofits. Projects both here in
[1:20:30]
manteca and internationally.
[1:20:32]
so it supports a lot of good stuff.
[1:20:36]
>> $15. And you can get them from
[1:20:39]
a rotarian or also buy them.
[1:20:40]
>>
[1:20:41]
and you cannot get that kind of breakfast
[1:20:42]
for $15 anyway.
[1:20:43]
>> they are usually
[1:20:45]
more if
[1:20:48]
--
[1:20:51]
>> no. They are a lot less. >>
[1:20:53]
I will adjourn this meeting at 7:24.
