[0:17] Cold in here.
[0:25] Me?
[0:27] I scram one.
[1:10] I am.
[1:13] Can't you tell?
[1:16] So,
[1:17] all right. It's
[1:19] Monday, August 3rd at 6:30. I'll call
[1:21] the
[1:22] the
[1:23] council meeting to order.
[1:25] Um
[1:28] uh
[1:30] Let's see.
[1:32] All right. So, as far as the agenda,
[1:34] there's a couple items that the council
[1:36] can choose to add. Um
[1:39] um there's on the in the mayor's section
[1:42] or the mayor's report, there's [snorts]
[1:44] two liquor store employees that we would
[1:47] like to to add. Um Jayden Payne um is
[1:52] planning on being a stocker at the
[1:54] liquor store earning $16 per hour.
[1:57] Um Cayden Woerner
[1:59] w o e r n e r is going to be security at
[2:03] the liquor store during the rally at $18
[2:05] per hour.
[2:06] So, um if the council whoever makes the
[2:09] motion if those two could be added to
[2:11] the mayor's report, that would be good.
[2:14] Um today we also got a
[2:17] um request for an SEL. Um
[2:21] so last year the Gas Monkey did an SEL
[2:25] on the first Sunday of the rally at
[2:28] Indian Motorcycle.
[2:30] And somewhere along the line the
[2:31] paperwork didn't get submitted until
[2:33] today.
[2:34] And so if the council chooses we could
[2:36] add that to the agenda
[2:39] and uh approve it or not approve it
[2:41] depending on what you guys want to do.
[2:43] Um Robin has received the application
[2:47] and the uh the payment for the SEL.
[2:50] And uh and I think everybody's got a
[2:52] copy of the
[2:54] of the staff report that that shows
[2:56] that. So,
[2:58] with that is there a motion to approve
[3:00] the agenda?
[3:01] » Motion to approve the agenda with the
[3:02] two added employees in the mayor's
[3:04] [clears throat] report and the SEL in
[3:06] the consent agenda.
[3:08] » I'll second.
[3:11] » All right. First by Alex, second by Jim.
[3:13] All in favor?
[3:14] » Yes.
[3:15] » I.
[3:15] » Opposed?
[3:17] All right. We have an agenda. So, item
[3:20] three pledge of allegiance.
[3:26] » I pledge allegiance to the flag of the
[3:28] United States of America and to the
[3:31] republic for which it stands, one nation
[3:34] under God, indivisible, with liberty and
[3:37] justice for all.
[3:42] » [snorts]
[3:45] » All right. Pray.
[3:47] Thanks.
[3:51] » All right, let's pray.
[3:53] Father, the rally's here and um
[3:56] Lord, I thank you for all the people
[3:57] that work so hard to keep
[4:00] order, keep things going and um really
[4:02] the citizens of the town don't even
[4:05] really know all that goes on and um
[4:07] because it's so smooth and we just thank
[4:09] you for that. I just pray your safety
[4:11] and your help with these all these folks
[4:13] and we thank you for this evening. Just
[4:14] please guide and lead the council. In
[4:16] Jesus' name. Amen.
[4:17] » Amen.
[4:19] » Thank you.
[4:20] » All right.
[4:22] Jim, I think we should note that uh
[4:24] Terry
[4:25] read the announcements and praise in
[4:27] your absence last time.
[4:28] » Was he adequate?
[4:29] » Oh, boy.
[4:31] » [laughter]
[4:35] [laughter]
[4:37] » So,
[4:38] but we're glad you're back to do it.
[4:40] Let's just say that, okay?
[4:41] » [laughter]
[4:42] » Oh.
[4:44] Thank you.
[4:45] Are we ready?
[4:48] » We are.
[4:49] » Okay.
[4:50] Uh here and again, thanks to Deb for
[4:52] keeping track of all of this. Uh
[4:55] it's not taken for granted, Deb. Thank
[4:57] you.
[4:58] Uh some of the happenings this week, uh
[5:01] Wednesday, August 5th,
[5:03] the po-
[5:04] stands up at 9:00 a.m. and there's still
[5:07] time to register if you'd like online,
[5:09] sturgismotorcyclerally.com.
[5:13] Also this week, Thursday, August 6th
[5:15] through the 14th, rally headquarters
[5:17] with vendors will open at the Sturgis
[5:19] Armory
[5:20] uh from 9:00 in the morning till 8:00 in
[5:23] the evening.
[5:24] There's still some room, isn't there,
[5:25] Deb, for help if somebody wishes to
[5:28] assist?
[5:29] Okay, I did that last year for the first
[5:31] time and will again. It's uh an amazing
[5:34] experience to greet people as they come
[5:36] in.
[5:37] Then Friday, August 7th is the opening
[5:40] as Brian noted, this is the rally week,
[5:43] so there's a lot happening. Opening
[5:44] ceremony day at the Sturgis Motorcycle
[5:47] The opening ceremony parade will come
[5:49] through downtown about 2:45 and the
[5:52] opening ceremony is at 3:00 at the
[5:55] Harley-Davidson Rally Point. That's this
[5:57] Friday, August 7th. On the 8th is the
[6:00] mayor's ride.
[6:02] Ooh.
[6:03] Uh kickstands up at 9:00.
[6:05] Still time to register online. Again,
[6:07] sturgismotorcyclerally.com.
[6:10] And Mr. Mayor, are you uh leading that?
[6:13] » I haven't got all the instructions yet,
[6:15] but I'll be there.
[6:16] » Okay.
[6:19] Saturday, August 8th, the Sturgis Public
[6:21] Library is going to be closed from this
[6:24] Saturday to the next Saturday, the 8th
[6:26] to the 15th. Uh curbside book pickup
[6:29] will be available from the 10th through
[6:30] the 14th from 9:00 until 3:00.
[6:33] And you can call the library to schedule
[6:35] curbside service, 605-347-
[6:40] 26-
[6:41] 24. If anybody uh reads, I've taken
[6:43] advantage of that. That's a great
[6:45] opportunity if you have not done that.
[6:47] 347-2624
[6:50] and uh you can pick up your books.
[6:54] Tuesday, August 11th.
[6:56] Bill, the 11th on Tuesday.
[6:59] Military Appreciation Day.
[7:02] Brought to you by Harley-Davidson and
[7:03] the City of Sturgis. And it's going to
[7:06] be a good deal. We're honoring
[7:08] posthumously Charlie Gray and Craig
[7:10] Sanderson. That's on the 11th. And at
[7:13] 9:00 to noon on that day, they'll have
[7:15] the pancake breakfast. It's a free
[7:17] breakfast for veterans and active
[7:19] military as well as first responders.
[7:22] Then from 9:00 to 3:00, veteran resource
[7:24] displays and exhibitors. B-1 flyover at
[7:27] 2:00 p.m.
[7:29] And following the flyover, the City of
[7:31] Sturgis program.
[7:33] And then Friday s- uh through Sunday,
[7:36] August 21st through the 23rd,
[7:40] Black Hills Steam and Gas Threshing Bee.
[7:42] Gates open at 7:00, parade at 1:30.
[7:46] Western Dakota Antique Club, that's 13
[7:49] 380 Alkali Road. That's 10 mi east of
[7:52] Sturgis near the Sturgis Airport.
[7:55] I've not attended that, but many people
[7:57] have. They come from all over for the
[7:59] Blackhills Steam and Gas Threshing Bee,
[8:01] and that's the 21st, 2nd, and 3rd. So,
[8:06] Tony, a chance for you to again to get
[8:07] back out and drive that combine.
[8:09] » Yeah. Been there, done that. It's a
[8:10] great event.
[8:11] » I'm sure you have.
[8:13] Mr. Mayor, that's all that I have made
[8:17] note of.
[8:17] » Right. Thanks, Jim.
[8:19] All right. Moving on to item five,
[8:21] non-agenda items that that come before
[8:23] the council.
[8:25] Does council have anything they wish to
[8:27] discuss?
[8:30] All right. Any from the public?
[8:35] All right.
[8:38] There is.
[8:41] » We here at
[8:43] Sturgis Black Hills LLC,
[8:46] Monster Biker LLC, has been in
[8:48] communication. I've been trying to find
[8:50] it, I couldn't find it for you guys.
[8:53] The LLC has been in communications with
[8:56] the Department of Transportation.
[8:58] » Give us your name.
[9:00] » Michael Galante, the owner of Black
[9:02] Hills Private Radio and Sturgis Private
[9:04] Radio.
[9:04] » Okay.
[9:05] » We
[9:06] We have been trying to pull everything
[9:08] out, and also Mr. Mayor, I'd like to
[9:10] have time to get your feedback.
[9:13] Mayor Sam Mayor of Rapid City has given
[9:17] us an official statement about the 86th
[9:22] Sturgis Rally
[9:24] about from his angle, from the city of
[9:27] Rapid City, and it was asked to him to
[9:29] do that because
[9:31] when the DOT numbers from last year were
[9:35] pulled up and looked at,
[9:37] and the news was and the news from the
[9:40] local news vendors were pulled up. It
[9:42] was a It was noticed that they did not
[9:46] seem to have as much care for the
[9:48] motorcycle riders as they did their
[9:51] cars. Because they were five They were
[9:54] five to five at five deaths to one of
[9:57] our deaths. So, that rendered the mayor
[10:00] of Mayor Solomon to render us a
[10:03] statement that we're going to be
[10:06] hopefully putting out as a PSA and if I
[10:08] can I I was in one of my pieces in my
[10:10] phone, I will send that on the Deb when
[10:13] I find that to talk about the safety of
[10:16] the riders, the cars, the riders, and
[10:19] the and the thing is the walkers and the
[10:21] bicyclists to help bring the to bring
[10:24] attention to the rally and how everybody
[10:27] should work as one because like I
[10:29] pointed out to him, I said, "You know,
[10:31] if all we're hearing is wrecks and
[10:33] hospitals, we're damaging the history of
[10:36] this motorcycle rally. We need to try to
[10:39] work on the safety so when riders come
[10:43] to your town and they come to our town,
[10:46] meaning Sturgis at the time, and Deb was
[10:49] emailed the whole transactions of that
[10:51] statements that we we we would like them
[10:54] to come to say this is a beautiful
[10:56] experience. I'd like to come back, not
[10:59] the experience to say, "Well, I wrecked
[11:01] my bike and I got to get a new bike."
[11:02] So, that So, that and we and we're in
[11:05] the middle of trying to figure out to
[11:06] get the DOT stuff kicked out about to
[11:09] get these riders so they can understand
[11:11] what what what what we did not get
[11:13] correct what was not sent correct to us
[11:15] correctly
[11:17] was the reduction of speeds on the
[11:19] highway.
[11:21] The The postings of those The markers to
[11:23] the town was
[11:25] The station Well, how it it started out
[11:27] originally had a very jaded history. And
[11:30] I do say I understand that.
[11:32] But at the same time, I would love to
[11:35] see everybody understand when Pete
[11:38] started it, he started it for the
[11:39] writers and he started it for the people
[11:41] to have fun. And at the end, I'd like to
[11:43] get you see if you wouldn't give us a
[11:45] statement because Mayor Solomon and his
[11:48] staff worked with worked with me via
[11:51] email to make that statement. It's a
[11:53] real short statement, but it's to the
[11:55] point. Everybody is to be courteous to
[11:58] each other on the road and also to hit
[12:01] to watch out for pedestrians and
[12:03] bicyclists, which I thought was
[12:04] interesting considering the K-12 here.
[12:06] Thank you for your time.
[12:07] » You bet. All right, we'll work with you.
[12:09] Just
[12:10] submit a request to Deb if you would,
[12:12] please.
[12:14] So, anybody else?
[12:26] » My name's Daryl Van Dunker and I just
[12:29] have
[12:31] a simple request. I have municipal codes
[12:34] you guys can look at from other places
[12:37] um that I can hand somebody.
[12:46] And nowhere have I found a way to set up
[12:49] a pop-up vending
[12:53] mechanism that's free for information.
[12:56] Um I've looked through all your codes
[12:59] and I just haven't found it. Uh
[13:02] so, my recommendation is just a simple
[13:05] statement. Sturgis should consider
[13:07] creating a free easy sign-up rule for
[13:10] small schools and information tables
[13:13] just like Berkeley, Boulder, and
[13:15] Madison. Who could use it? Local
[13:18] Catholic Chesterton School is authorized
[13:22] to go into the local Catholic church
[13:24] school, um but they've had no community
[13:27] support and they've had no way to
[13:29] outreach to people.
[13:31] Um,
[13:32] I have a Mars colony prep lab that I've
[13:36] been working on. I have no way to
[13:37] promote it as well. Um, and local teams
[13:41] have no way to seek donations during the
[13:45] rally or let people know that they're
[13:47] there.
[13:48] » So, have you have you contacted our
[13:50] planning
[13:51] office, planning and permitting office?
[13:56] Um, that would be a good place to start
[13:58] to see if there is an avenue and then
[14:00] they could bring it back through me and
[14:02] the council, okay?
[14:03] » Okay, because you guys don't have any
[14:06] codes for the pop-ups and I've asked
[14:08] multiple times at the office.
[14:11] It was something that was going to be
[14:12] considered.
[14:13] » Don't know which office you're pointing
[14:14] to. If you're pointing towards the
[14:16] finest office, yeah, and I'm I'm saying
[14:18] you probably should go to the planning
[14:20] and permitting.
[14:22] Have them
[14:23] look look at your request would be my
[14:25] suggestion.
[14:27] » Okay. Um, but there'd be no way to get
[14:30] that done this week.
[14:33] Right?
[14:33] » Well, I don't know what the code says.
[14:35] You're saying there's not in there, but
[14:37] let's just verify with them and then
[14:39] then get with me and we'll come up with
[14:40] a plan, okay?
[14:42] » Okay. Um, can I at least say what these
[14:44] pop-ups would look like?
[14:46] » You can, but it'd be more efficient if
[14:47] you work through them. So.
[14:49] » Okay.
[14:50] Well, they're 2x2 tables. They're not
[14:52] very big and they'd be placed against
[14:55] the uh, public property lines, not in
[14:58] the sidewalks. Um, but they would allow
[15:01] the soccer team, the football team, and
[15:03] local schools to do outreach during
[15:07] rally and let people, you know, they're
[15:10] there.
[15:11] And take donations.
[15:13] » Great. Thank you.
[15:17] Anybody else?
[15:20] Any other non-agenda items?
[15:25] All right.
[15:26] All right. Moving on to the mayor's
[15:28] report. Um,
[15:29] let me know if you got any questions on
[15:31] any of these items.
[15:33] Um, there's some uh listing for workers
[15:36] comp coverage, um, police department.
[15:39] There's a couple uh
[15:41] um, parks employees on it. Um, some
[15:44] rally temp hires at the
[15:47] at the ambulance,
[15:49] » [snorts]
[15:49] » Um
[15:50] uh
[15:51] item 6.4 has the has a uh sales clerk,
[15:55] um, and that's probably where we'll add
[15:57] the two additions, the
[15:59] the liquor store stocker and uh and the
[16:02] uh security at the liquor store.
[16:05] Um, a couple water operators,
[16:08] um,
[16:09] another volunteer for workers comp
[16:11] coverage.
[16:13] Uh, actually a couple more of those,
[16:15] three.
[16:16] And then, um,
[16:18] an important one here on 6.9.
[16:21] Um, it's appointing uh Bryson Cool as
[16:25] the ambulance director.
[16:27] Um, so we look forward to working with
[16:29] Bryson going forward.
[16:32] And so, um
[16:35] Bryson uh
[16:37] uh when he was promoted it left an
[16:39] opening for a full-time EMT or paramedic
[16:44] in the staff, so Cody's backfilling
[16:47] Bryson's spot, um as uh as a paramedic.
[16:52] And then, um, item 6.11
[16:55] is uh a letter of support that we put
[16:58] together for Neighborhood Works. Um,
[17:02] uh Mayor Forrester did the same thing,
[17:04] um, last year, so they've asked for it
[17:06] again, and um, that letter letter's
[17:09] ready for me to sign if you guys are
[17:11] okay with that.
[17:12] And then, item 6.12, um, citizen
[17:16] agenda. Uh, the Freedom Biker's
[17:19] submitted this um, and then decided not
[17:21] to come to council.
[17:23] Um, I know they've been in contact with
[17:25] uh, at least one council member
[17:28] and me as far as trying to keep us
[17:30] updated on their progress.
[17:32] And so, um, you know, they got a long
[17:35] ways to go in
[17:36] in uh, a short period of time, but um,
[17:39] [snorts]
[17:40] we'll see where they can get this week
[17:41] on that. So.
[17:43] Is that work?
[17:45] All right. Any questions from the public
[17:47] on the mayor's report?
[17:53] Okay.
[17:54] Moving on to the consent calendar.
[17:57] Um,
[18:00] » [clears throat]
[18:01] » Uh,
[18:02] we got the minutes from the last
[18:04] meeting.
[18:05] Um, an SEO for Sturgis Brewing Company.
[18:09] Uh, setting a public hearing for an
[18:11] in-home business.
[18:13] Uh,
[18:15] final plat for the industrial park.
[18:19] Um, actually two of those. Um,
[18:22] oh, three final plats.
[18:24] One at uh,
[18:26] Yeah, so.
[18:29] Four with with Harvest Meadows and uh,
[18:32] Valley View subdivision.
[18:34] Um,
[18:35] the two big ones on the on the west end
[18:37] of town.
[18:38] So, those are all on the consent
[18:39] calendar.
[18:41] Does uh, council have any questions or
[18:43] items they want to discuss on the
[18:44] consent calendar?
[18:49] All right.
[18:50] Any items from the public?
[18:54] » I do, honorable your president.
[18:57] » Cool. You bet.
[19:02] » You have the Indian one, too.
[19:04] » The what?
[19:04] » Indian.
[19:05] » Yeah.
[19:08] » Good evening.
[19:09] Jay Tukawsky.
[19:10] Proud citizen of the city of Sturgis
[19:12] here tonight. Um,
[19:16] First and foremost
[19:19] I want to give you guys great thanks for
[19:20] giving us the opportunity and the
[19:22] ability to build Freedom Barn Main
[19:24] Street.
[19:26] As you know, we're working hard
[19:28] » Jay, are we moving back to other items
[19:31] or we coming back to the citizen request
[19:34] to be on the agenda?
[19:35] » Yes.
[19:36] I just need a few minutes of your time
[19:38] now.
[19:38] » Things.
[19:39] » Right.
[19:39] » Which one is it?
[19:40] » Just giving you a quick introduction.
[19:42] Okay.
[19:43] And um
[19:43] » Wait a minute. So, like on the agenda,
[19:47] we were on the consent calendar.
[19:49] Are you saying you want to back up to
[19:51] your citizens request to be on the
[19:53] agenda?
[19:53] » Yes, sir.
[19:55] » So,
[19:57] » [clears throat]
[19:58] » I didn't mean to interrupt this
[19:59] proceeding of the
[20:00] » Already passed that.
[20:02] So,
[20:07] we've already passed the
[20:11] the other matters that come before the
[20:13] council, right?
[20:15] So,
[20:16] » I didn't mean to get passed up, but if I
[20:18] could just speak for a couple of
[20:19] minutes, I'd
[20:21] That's all I need to say.
[20:22] Couple things to say, so.
[20:25] But again, I'm not here to interrupt the
[20:26] proceedings of this of the council
[20:28] meeting.
[20:29] Sir.
[20:30] » All right.
[20:32] » [clears throat]
[20:35] » So again, thank you for giving me the
[20:36] ability to do this.
[20:38] Um
[20:47] If
[20:48] during this project, if anybody
[20:52] Um again, the city,
[20:54] everybody that on all levels has been
[20:56] nothing but
[20:58] helpful and generous on all aspects of
[21:01] this project.
[21:02] Thank you very much.
[21:05] They've gone above and beyond to help us
[21:07] get this project completed.
[21:12] If anybody
[21:15] has been
[21:18] I apologize for any miscommunication,
[21:20] any misunderstanding
[21:23] any
[21:27] any
[21:30] misinterpretation
[21:31] of from me or any of my team
[21:35] I personally apologize for that. And if
[21:40] if I know about that, I can address it.
[21:44] Okay?
[21:51] We're planning to have the connexes set
[21:53] by Thursday.
[22:00] We may not have the bathrooms 100%
[22:02] functional before rally time on Friday,
[22:05] but we have a solution for that as well.
[22:13] That's it.
[22:14] » Okay.
[22:15] » Thank you.
[22:16] » You're welcome.
[22:20] » Any questions from the public on the
[22:23] consent calendar?
[22:26] The consent calendar also includes the
[22:29] addition of the SEL for Gas Monkey at
[22:31] Indian Motorcycle.
[22:36] So,
[22:39] is there a motion?
[22:40] » I'll make the motion.
[22:42] » Second.
[22:44] » And that includes the addition, right?
[22:46] » Include the Gas Monkey.
[22:47] » Okay. Great.
[22:49] First by Jim, second by Alex. All in
[22:52] favor?
[22:52] » Yes.
[22:53] » Yes.
[22:53] » Opposed?
[22:58] Motion
[22:59] consent calendar passes. All all
[23:01] The claims, Does the council have any
[23:03] questions on the claims?
[23:17] All right. Any questions from the public
[23:19] on the claims?
[23:27] All right. None being seen, is there a
[23:29] motion?
[23:31] » I'll make a motion to approve.
[23:33] » Okay.
[23:33] » I'll second it.
[23:34] » First by Terry, second by Tony. All in
[23:36] favor?
[23:37] » Yes.
[23:38] » Yes.
[23:38] » Opposed?
[23:40] Claims are approved.
[23:42] All right. Um
[23:46] So, we'll adjourn the council meeting to
[23:48] meet as the Board of Adjustments.
[23:50] Um
[23:52] Does anybody have a conflict on the
[23:53] items on the
[23:55] agenda for the Board of Adjustments?
[24:02] All right.
[24:04] First item is
[24:07] um
[24:08] 9.3 consideration for a use on review at
[24:11] 1325 1325 Nellie Street
[24:15] um to operate a home-based foundation
[24:17] repair business.
[24:19] Um Casey's got the report on that.
[24:21] » Good evening. The use on review
[24:24] applicant for 1325 Nellie Street is
[24:26] Billy Schlosser. He's also here for
[24:27] questions afterwards.
[24:29] Um the application is for a home-based
[24:31] foundation repair business. The proposed
[24:33] use is to utilize the property as a base
[24:35] camp, basically parking his businesses
[24:38] vehicles, trailers in his property while
[24:40] they're not in use and at a job site.
[24:43] The at-home business is permitted in
[24:45] residential districts subject to the
[24:47] approval of the use on review through
[24:49] the Board of Adjustment following the
[24:50] recommendation of the Planning
[24:52] Commission, which was approved
[24:53] previously.
[24:54] Um the property has ample space for this
[24:57] this parking um
[24:59] and all business deliveries are sent
[25:02] offsite. They are not sent to the
[25:03] property and the property does not have
[25:05] any customers stopping by as well.
[25:08] In reviewing the use on review
[25:09] application, the planning commission and
[25:11] board of adjustment should consider the
[25:12] proposed use is consistent with the
[25:14] surrounding neighborhood which is
[25:15] primarily residential, will not be a
[25:18] detriment to public health, safety, or
[25:20] welfare, and will not create excessive
[25:21] traffic, noise, or parking issues, is
[25:24] consistent with the intent of the zoning
[25:26] district and can be conditioned if
[25:28] necessary.
[25:30] Staff has reviewed the application and
[25:31] finds that the
[25:33] an in-home or an at-home business is
[25:36] compatible with residential
[25:37] neighborhoods when properly regulated.
[25:39] Uh no significant traffic impacts are
[25:42] expected and no signage or exterior
[25:44] changes are proposed that would alter
[25:46] the residential appearance of the
[25:47] property. Staff finds that the request
[25:49] as proposed meets the general intent of
[25:51] the use on review criteria provided the
[25:54] operation remains consistent with the
[25:56] submitted application information. Staff
[25:59] suggests the following conditions be
[26:00] considered by the board of adjustment.
[26:02] No signage related to the business be
[26:04] permitted on the property. The use shall
[26:06] remain secondary to the residential use
[26:08] of the property. And any expansion or
[26:10] change in the scope of the business
[26:12] shall require additional review and
[26:14] approval.
[26:15] Based on the information provided us
[26:17] provided, staff recommends approval of
[26:19] the home-based foundation repair at 1325
[26:22] Nellie Street subject to the recommended
[26:24] conditions or any additional conditions
[26:26] deemed necessary.
[26:28] I will
[26:29] answer any questions or Billy can answer
[26:31] questions as well.
[26:32] » Okay.
[26:33] I think we'll have you come up, Billy.
[26:43] So
[26:45] I went up there last week and and walked
[26:48] the property with Billy and we talked
[26:50] about some different things um
[26:53] as far as what he's done with the
[26:54] property and what his plans are, you
[26:57] know, going forward as
[27:00] you know, as far as, you know, how much,
[27:04] you know, that area will be used or, you
[27:06] know, how many vehicles they'll have and
[27:08] that type of thing. Um,
[27:10] you know, one thing, uh,
[27:12] we talked about is, you know, at a
[27:14] certain point in in his business growth,
[27:17] it, you know, it's going to make sense
[27:19] for him to have,
[27:21] you know, a different location than
[27:23] this.
[27:24] Um,
[27:26] you know, he's not in a position to do
[27:28] that now.
[27:29] Um, so, um, cuz at a certain point, you
[27:33] know, a size of this type of business,
[27:37] you know, outgrows a residential area.
[27:40] And so,
[27:42] um,
[27:43] you know,
[27:44] now is the time we can
[27:46] talk more about that or or get council's
[27:49] input on on your thoughts and and take
[27:52] on on what's going on up there and
[27:55] what's been done so far.
[27:58] And so, um,
[28:01] what
[28:03] » Really, what is your like timeline? Are
[28:05] you Is this like a for sure 10 years out
[28:08] you're going to keep the business and
[28:10] the equipment at the residence or are
[28:12] you looking
[28:14] down the road? I understand you're just
[28:15] starting out and whatnot, so.
[28:18] Because like I said, if it gets bigger,
[28:20] it'd be nice to see it in more of an
[28:21] industrial, I would say more industrial,
[28:23] but for now.
[28:24] » Yeah.
[28:25] » So.
[28:27] » We never
[28:28] planned on anything else. I mean, we
[28:30] love the house.
[28:33] We we really like We really love the
[28:35] house, you know, and it had it has
[28:37] foundation issues and that's why we
[28:38] bought it.
[28:39] Never expected this to ever come up.
[28:42] I never expected me to grow like I have.
[28:45] It just It's all came so fast.
[28:48] Um
[28:50] So, I I
[28:51] have not thought about it.
[28:52] » Okay.
[28:53] » You know, we just moved in in October.
[28:56] And this has come up just out of
[28:58] nowhere. So.
[29:00] » How it usually works.
[29:01] » Yeah.
[29:02] Yeah.
[29:02] » Okay.
[29:04] Well, you've thought about it since last
[29:05] week.
[29:06] » Oh, I I have.
[29:07] » Right. So.
[29:09] Um
[29:11] So, with your operation now, and I know
[29:14] you have you know, you just acquired the
[29:16] mud jacking business and the way you're
[29:18] set up now,
[29:20] you know, how many parking spaces do you
[29:22] need?
[29:28] » Quite a few. You know, I don't know. I
[29:30] It So, I have a a foreman who takes a
[29:33] truck home every day.
[29:35] I have another guy that I you know, I
[29:37] don't I would call him Jathan. Um
[29:39] is like a foreman. He takes another
[29:40] truck home every day.
[29:42] So, there's really only two commercial
[29:44] vehicles and one of them is just an old
[29:46] F-150 I got from my grandpa. I don't use
[29:49] I don't ever drive the thing. So,
[29:50] there's only one
[29:51] commercial
[29:53] pickup truck that's there full-time and
[29:55] that's my personal.
[29:56] » Yeah.
[29:56] » Um the semi truck, it's I'm trying to
[29:59] get rid of it. It is The motor's blown.
[30:00] I'm trying to get rid of it. So. Um
[30:04] and then the rest are just trailers.
[30:07] I've got an enclosed trailer, two dump
[30:09] trailers, and a car trailer, and a
[30:11] concrete pump which is
[30:13] a trailer.
[30:14] It's on a trailer, you know.
[30:16] » And that's the new one you put together?
[30:18] » No. No, that That's a dump trailer.
[30:21] » Okay.
[30:22] » Yep. Cuz that's where I took everything
[30:24] off the big semi truck and I put it on
[30:25] set it up on do that new dump trailer.
[30:28] You know.
[30:29] » So.
[30:30] Just going through what you just
[30:32] described,
[30:33] you know, would six parking spots be
[30:36] enough or do you need eight?
[30:39] Um cuz it'd be good if we could
[30:42] kind of define some specifics of
[30:45] you know
[30:46] what you need for
[30:48] for uh you know, your business as it is.
[30:52] These these use on reviews are annual.
[30:55] Right? Like this this discussion or this
[30:59] this will be an agenda item
[31:01] every year.
[31:02] » Yeah.
[31:03] » And so
[31:04] » Well, I mean after after all of this, I
[31:05] mean I definitely don't want to
[31:07] you know, live live there anymore. It's
[31:09] kind of ruined the the whole life of the
[31:11] whole house, you know.
[31:13] It doesn't even, you know, makes us feel
[31:15] like
[31:16] you know
[31:17] definitely not a forever home. We
[31:18] thought it would be. It's big house. We
[31:20] love it.
[31:21] I love the spot, but you know, I
[31:24] I It's definitely the next plan is to
[31:27] try to find something else.
[31:28] » Right.
[31:29] » Yeah.
[31:29] » And so um
[31:31] you know, depending on what the council
[31:32] decides tonight um
[31:35] you know, if we can
[31:37] define some specifics of how it could be
[31:40] used, you know
[31:43] for the next year or until you're up
[31:46] again, that'll give you some time to put
[31:50] your plan together for your
[31:52] for where you head with your business,
[31:54] right?
[31:55] And so
[31:57] um
[31:58] you know, it'd be helpful if you could
[31:59] say how many parking spots you needed
[32:01] and then that'll give us some specifics
[32:03] to to go off of.
[32:13] Does anybody else have any comments
[32:15] here?
[32:16] » No.
[32:19] Well, I think the the basis for the
[32:22] business is good and it's something that
[32:24] could be used without any question.
[32:27] Um
[32:30] you've just begun. I mean,
[32:32] so you have you done an assessment of
[32:34] how far
[32:35] you could go to work or
[32:38] » Well, I had started my business when I
[32:40] was 20 years old. So, it's been It's
[32:41] going on 8 years now.
[32:44] I rented a house on Hill Street uh for 5
[32:47] years
[32:48] and I ran my business out of there.
[32:50] I've had multiple trucks, multiple
[32:53] trailers. Nothing's changed besides
[32:55] buying Baker Mud Jacking, which only
[32:57] added
[32:58] two trucks and a trailer.
[33:00] But, I never had any issues where we
[33:02] were at.
[33:03] So, we didn't expect to have issues
[33:05] where we're at now and we did I never
[33:08] really thought of it.
[33:10] I've never thought about buying a shop
[33:11] and running the business out of a shop.
[33:13] I've always just I started my business
[33:14] with nothing and I've worked my way up
[33:17] to what I have now
[33:18] and just working out of my house. Just
[33:21] what I'm used to, I guess.
[33:24] » So, the issue really is
[33:26] it's not Is it on-street parking that
[33:28] we're thinking about or it's It sounds
[33:30] like the parking is on his property.
[33:33] » It is.
[33:36] But, it's a use on review for operating
[33:39] a home-based business
[33:41] out of residential. And so, um I'm sure
[33:45] you're familiar with the Clevin house.
[33:48] That's it.
[33:49] And so, um
[33:52] some of the lawn on the south side has
[33:54] been graveled for a driveway.
[33:57] Um
[33:58] there's a big gravel spot in the back
[34:00] for parking.
[34:01] Um the
[34:03] the driveway wraps around the garage.
[34:06] Um
[34:07] it's a bit much for a residential area.
[34:09] » Is there an issue with with the people
[34:12] around you, the other neighbors?
[34:14] Or have you done any
[34:15] » The closest neighbors I've talked to
[34:16] every one of them. I
[34:18] I don't think there's any issue at all.
[34:20] They're all very nice.
[34:22] I've talked to every one of them.
[34:23] » There's There's one letter in the in the
[34:25] council packet that
[34:27] that uh
[34:28] um
[34:30] you know,
[34:32] is all is good with it.
[34:34] Um
[34:36] So
[34:38] » So if the use and review is also, I mean
[34:40] we have a year essentially
[34:42] I think that
[34:44] that's nice. That's good to be able to
[34:47] it gives him a also an opportunity to
[34:49] improve on it if he needs to.
[34:51] » I agree.
[34:52] » I agree. Cuz
[34:53] » Well, I have the I mean, what could I do
[34:56] to improve it to
[34:59] stay where we're at for now so we don't
[35:01] have to worry about it cuz a year is not
[35:02] enough time.
[35:04] You know, I just bought the house. I
[35:06] just bought the this other business.
[35:09] I'm just wondering
[35:12] what you'd like me to do, what could
[35:14] make this better. You know
[35:18] What would you like to see?
[35:20] » And And that's where we're trying to
[35:23] talk about specifics of you know, what
[35:26] all's going to go down there. Is it Is
[35:28] it parking for this number of spots?
[35:31] So, you know, we know if if your
[35:34] business is growing and you're taking
[35:35] more spots
[35:37] um you know, a lot of it's going to be
[35:40] you know, what what kind of feedback the
[35:41] council gets from the from your
[35:43] neighbors and stuff in the next year.
[35:45] So, you know, if you can tread lightly
[35:48] and you know, and
[35:50] and
[35:51] and you know, but at some point, you
[35:54] know, generally we like hard surface for
[35:58] parking
[36:00] rather than gravel.
[36:02] Um you know, there's just some different
[36:04] things that
[36:06] go along with
[36:09] you know
[36:12] doing this, but
[36:14] you know
[36:16] whether the council decides this or not,
[36:18] in general
[36:20] you know [clears throat]
[36:21] there's a point where that's too much
[36:23] for a residential location in my
[36:26] opinion.
[36:27] » Well, that's kind of the that's kind of
[36:30] why you're here, right? I mean,
[36:32] to figure out and for us to decide. Um
[36:36] as I hear you talk, I'm not quite sure
[36:38] this will even be long-term. It sounds
[36:40] like this is something that's kind of
[36:43] tipped you over a little bit. And I
[36:45] understand that. One of the thoughts
[36:48] that I would have um
[36:50] is that have you ever entertained the
[36:53] thought of a of some sort of a privacy
[36:55] fence, or would that be workable in this
[36:57] situation?
[37:00] » That
[37:01] Yeah, I'm open for suggestions.
[37:05] » It may assist you in some way
[37:08] um down the road. And as far as the hard
[37:11] surface there, um that's going to be
[37:14] something probably down the line, too,
[37:15] and then
[37:17] in fact, I think
[37:18] your garage that sits here,
[37:21] I think should be hard surface now,
[37:24] probably.
[37:25] » I It was when we bought it, but
[37:28] everything from Weber
[37:30] poured into the garage.
[37:32] The garage floor is is destroyed,
[37:35] cracked up. It's really bad.
[37:37] And the
[37:38] you know, asphalt was sticking 3 in
[37:40] higher than the garage floor. Everything
[37:43] was pouring in there when it rained. I I
[37:45] had to tear it out. I had to create a
[37:46] swale, push it away.
[37:49] Yeah.
[37:49] I I mean, I I had to do something.
[37:51] » I'm just saying that's kind of the one
[37:53] of the requirements, so.
[37:54] » Yeah.
[37:55] I I understand.
[37:56] » Yeah.
[37:59] But that'd be a suggestion of mine would
[38:02] be this privacy fence
[38:05] if you decide to stay there long-term.
[38:11] » I was going to ask you in the months
[38:12] that you are able to work
[38:18] Do we have I mean, do you Is there
[38:20] months that you're going to have
[38:21] probably more
[38:23] more uh trailers sitting around than
[38:25] probably the dead of the winter. You
[38:27] probably have more trailers.
[38:28] » Usually stay very busy during the
[38:30] winter.
[38:31] » Okay.
[38:31] » I mean, we
[38:32] work out of town, and come wintertime we
[38:34] work out of town a lot for some reason.
[38:36] Seems to be.
[38:38] Um
[38:39] but it's just in between jobs.
[38:41] Uh we just started a big peering job
[38:43] today, and it's like everything is just
[38:45] almost gone, you know, out of the lot.
[38:48] And it will be that way for the next 3
[38:49] weeks.
[38:51] You know, and then
[38:52] everything will be will come back for a
[38:54] little bit. It's just in between jobs.
[38:57] » So, very rarely you have all of it there
[39:00] at the same time.
[39:01] » I don't ever foresee me having
[39:03] everything of mine there at one time.
[39:06] I mean, with
[39:07] with both of my guys taking trucks home
[39:11] and trailers on the job, I don't ever
[39:14] foresee them ever being there besides in
[39:15] the morning maybe when they all show up.
[39:18] Everyone shows up, you know, and then we
[39:20] leave.
[39:21] I mean, that's about it.
[39:22] » Yeah.
[39:22] » It's the only time, but they would never
[39:24] stay there. Yes. I think I would need
[39:26] seven parking lots seven parking spots.
[39:28] I I'm not considering that F-150 that I
[39:30] got. It's It's an old F-150. It ain't It
[39:33] just has commercial plates on it. That's
[39:35] all.
[39:36] Cuz the only I got to have commercial
[39:37] plates to pull any of my trailers cuz I
[39:39] got permanent plates on there.
[39:41] » Well, just looking I mean, looks like
[39:42] you keep your property pretty nice.
[39:44] » I I try to. I try to. I'm very OCD. I
[39:47] try to keep things very clean and
[39:49] organized.
[39:50] » Well, with knowing
[39:51] we'll see I guess
[39:53] how your business grows in the next
[39:55] year,
[39:56] but I'd be willing to make a motion to
[39:58] approve this
[39:59] for a year, you know, and then when it
[40:02] comes up for a re
[40:03] review again if we have uh
[40:06] some situations that the neighbors are
[40:08] upset, then we're probably going to have
[40:10] to take a look at it next year, but I
[40:13] would make that motion to approve it for
[40:15] now.
[40:17] » I'd second that.
[40:19] » Yeah.
[40:21] » First by Terry, second by Ruth.
[40:25] Any other comments
[40:28] from the public?
[40:31] All right. All in favor?
[40:33] » Aye.
[40:33] » Yes.
[40:34] » Post?
[40:35] All right. Motion passes.
[40:38] » Thank you.
[40:40] » All right.
[40:41] Um
[40:43] continuing on with the Board of
[40:44] Adjustments.
[40:45] Um item 9.4 consideration
[40:49] for setback variances at 2750 Whitewood
[40:52] Service Road.
[40:56] » The applicant for the variance requested
[40:58] at 2750 Whitewood Service Road is Ronald
[41:00] AD. The applicant is requesting
[41:02] variances to the zoning setback
[41:03] requirements due to the property's very
[41:05] irregular and narrow shape. Um can you
[41:08] pull up a picture of that lot, please?
[41:10] Thank you.
[41:11] Uh the required setbacks are impractical
[41:13] for the reasonable use of the lot. The
[41:15] surrounding area mainly consists of
[41:17] commercial use over there.
[41:19] Um
[41:20] the requested variance specifically are
[41:21] for the front and the rear setbacks. So,
[41:24] if you're looking at the picture, the
[41:25] little dash triangle is where he's
[41:27] technically allowed to build a building
[41:29] for the setbacks. So, the requested
[41:30] variance is for a zero to lot line on
[41:33] the backside, which backs up to the
[41:35] railroad. So, the railroad already has a
[41:36] 50-ft right-of-way back there.
[41:38] The front is for a 21
[41:41] .4 uh requested setback at the front.
[41:45] It's usually 35. Um in front of his lot
[41:48] line is already a 22-ft right-of-way
[41:51] plus an 8-ft uh walkway to the service
[41:54] road. So, there's a lot of space up
[41:56] front there. Um all other conditions of
[41:58] the property have been met.
[42:00] The subject property is a very irregular
[42:02] and narrow-shaped lot that is only 71.49
[42:06] at the widest width on the east side and
[42:08] 36.88 on the west line.
[42:12] Uh
[42:14] You're good.
[42:15] Due to the physical characteristics and
[42:17] irregular
[42:18] size and shape of the subject property,
[42:20] staff does support the requested
[42:22] variances as proposed for 2750 Whitewood
[42:25] Service Road. All future building
[42:27] construction and site improvements will
[42:28] need to be completed per current city
[42:31] building codes and ordinances at that
[42:32] time when that comes about.
[42:35] Do you have any questions?
[42:40] » [snorts]
[42:43] » Any questions for Casey from council?
[42:48] From the public?
[42:52] All right. Is there a motion?
[42:54] » Motion to approve.
[42:55] » Second.
[42:56] » First by Tony, second by Alex. All in
[42:58] favor?
[42:59] » Yes.
[42:59] » Yes.
[43:00] » Opposed?
[43:01] Motion passes.
[43:03] All right.
[43:04] On to 9.5, consideration of variances
[43:08] for lot A-2-1 through lot A-2-7
[43:13] of Hurley subdivision.
[43:16] » The applicant for the variance requested
[43:17] at 2171 Moose Drive is Dallen Creek
[43:20] Apartments LLC. These properties are
[43:22] part of the final plat that will follow
[43:24] this as well. Um that and this property
[43:26] contains the Dallen Creek Assisted
[43:28] Living Complex. This property is part of
[43:30] the previously approved planned unit
[43:32] development and tax increment finance um
[43:35] improvement district. The final plat
[43:37] will follow this variance approval.
[43:40] The applicant is requesting variances to
[43:42] the zoning requirements associated with
[43:43] the minimum frontage and setbacks.
[43:46] Specifically, uh
[43:48] 2-1, 2-2, 2- 5, 2-6, and 2-7 all will
[43:54] have less than 100 ft, which is the
[43:56] required uh front width of the lots.
[44:01] And then 2-4,
[44:03] rear setback will only be 7.19
[44:06] ft. The requirement is typically 10.
[44:09] And then 2-7 will have less than 100 ft
[44:13] frontage and less than the required
[44:15] corner cuz it's on the side of the
[44:17] corner of the two streets. Um setback
[44:19] which will be 11.39.
[44:21] Requirement is usually 18 ft.
[44:26] Staff notes that all interior side yard
[44:28] setbacks, front yard setbacks, and
[44:30] minimal lot requirements are properly
[44:31] met otherwise. The staff supports the
[44:34] requested variance associated with the
[44:35] minimum lot width, frontage, and related
[44:37] dimensional standards as noted in the
[44:39] information provided and recommends
[44:42] approval of the variances for lots A-2-1
[44:46] through A-2-7 in the Hurley subdivision
[44:49] with the final plat to follow this
[44:50] approval.
[44:58] » This is all townhouses, right?
[45:00] » Yes.
[45:00] » Okay.
[45:05] » [snorts]
[45:07] » I'll make a motion to approve.
[45:08] » I second.
[45:09] » Okay, first by Terry.
[45:12] » [clears throat]
[45:14] » Second by Jim.
[45:16] Any other questions from council?
[45:20] Okay, any questions from the public?
[45:25] All right, all in favor?
[45:27] » Yes.
[45:27] » Yes.
[45:27] » Opposed?
[45:30] Motion passes.
[45:32] All right.
[45:33] We'll leave this to uh
[45:35] adjournment of the Board of Adjustments
[45:37] and we'll reconvene the council meeting.
[45:40] Uh
[45:41] on the 10.1, um public hearings,
[45:45] consideration of option and lease
[45:46] agreement with Vertical Bridge.
[45:49] Um is Eric on the line?
[45:51] » Yes.
[45:52] » Yes.
[45:53] » He's still there.
[45:56] » Yeah.
[45:57] » Okay, Eric, do you want to take this
[45:58] one? Or Rick, are you taking it?
[46:01] » I either.
[46:02] » Okay.
[46:04] » [snorts]
[46:04] » Good evening, Mayor members of the
[46:05] council. Tonight's item is the public
[46:07] hearing consideration of an option and
[46:10] lease agreement with Vertical Bridge uh
[46:13] doing business as the Towers LLC. At the
[46:16] July 20th meeting, the council adopted a
[46:18] resolution 26-32
[46:22] declaring its intent to lease the
[46:23] property and set this public hearing in
[46:25] accordance with South Dakota codified
[46:27] law.
[46:28] The proposed location is adjacent to the
[46:30] Exit 32 Recycling Center on Dickson
[46:33] Drive.
[46:35] Uh it is important to understand that
[46:37] the approval of this agreement does not
[46:38] approve construction of a cell tower.
[46:41] This agreement simply grants the company
[46:43] the option to evaluate the site and if
[46:46] they decide to move forward enter into a
[46:48] lease.
[46:49] If the option is exercised, the project
[46:51] would still be
[46:52] uh required to comply with all the city
[46:54] zoning, building, flood plain
[46:57] applicable approval processes before any
[47:00] construction could occur.
[47:02] Uh some of the agreements highlights in
[47:04] this is the company would pay the city a
[47:06] $1,050
[47:08] option payment upon execution. Uh this
[47:11] option period is for 4 years, allowing
[47:14] the company to compete uh complete the
[47:16] due diligence and determine whether or
[47:18] not the site is actually suitable uh for
[47:20] their needs. If the option is never
[47:23] exercised, the agreement terminates with
[47:25] no further obligation.
[47:27] Uh if exercised, the lease begins with
[47:29] an initial 5-year term and up to seven
[47:32] additional 5-year renewals.
[47:34] Uh the lease also requires that the
[47:36] tenant remove uh its improvements and
[47:39] restore the property when the lease
[47:40] ends.
[47:42] Uh this proposed facility is expected to
[47:44] improve wireless coverage in the Exit 32
[47:46] area and the entire I-90 corridor.
[47:50] Uh benefits include improved service for
[47:52] residents, business, visitors, emergency
[47:55] responders, and travelers along that
[47:57] corridor.
[47:59] Uh
[48:01] the lease area would be located in a
[48:04] future utility lot. A preliminary plat
[48:07] has been approved by the planning
[48:08] commission and the final exhibit and
[48:11] legal description updates will occur
[48:12] after that plat is finalized and
[48:15] recorded with the register of deeds. Uh
[48:17] with that, I'd be happy to answer any
[48:19] questions you may have on this.
[48:21] And I I believe Vertical Bridge
[48:23] representatives are here as well.
[48:26] » All right.
[48:27] Any questions from council?
[48:31] All right.
[48:32] From the public?
[48:36] All right. Is there a motion?
[48:37] » I'd motion to approve.
[48:39] » I'll second.
[48:40] » First by Tony, second by Alex. All in
[48:42] favor?
[48:42] » Yes.
[48:43] » Yes.
[48:43] » Opposed?
[48:44] Motion passes.
[48:45] » Thank you.
[48:46] » Thanks, Rick.
[48:47] All right. On to reports. 11.1,
[48:51] uh resolution 2026-42,
[48:53] approval of the final plat for lots
[48:56] uh A-2-1 through A-2-7 of Hurley
[49:00] subdivision. So, this [snorts] one goes
[49:03] back to
[49:04] um approval of the variances in 9-5 and
[49:07] now we can approve the final plat if you
[49:09] guys so choose.
[49:12] So,
[49:13] any questions or comments from council
[49:15] on it?
[49:19] All right. From the public?
[49:22] Is there a motion?
[49:24] » I'll make make a motion to approve.
[49:25] » First by Terry.
[49:27] » Second.
[49:28] » Second by Alex. All in favor?
[49:30] » Yes.
[49:31] » Yes.
[49:32] » Opposed?
[49:33] Motion passes.
[49:35] » Thanks, Casey.
[49:38] » So,
[49:39] uh 11.2, consideration to approve the
[49:41] 2026 Tom Tease Inc. retail licensing
[49:45] amendment.
[49:47] » Thank you, Mayor and Council.
[49:50] Yes, this is an amendment that extends
[49:52] uh essentially renews
[49:54] the 2025 Tom Tease Tom's Tease license
[49:58] the merchandise trademark and content
[50:00] license
[50:02] with the Sturgis Motorcycle Rally
[50:05] providing
[50:06] one portion of the Heritage Mark
[50:08] collection in the portfolio. It is a
[50:11] one-year extension. Tom's Tease has been
[50:16] a partner of the city since I've been
[50:18] with the city
[50:20] for more than 10 years now. I've they've
[50:23] been partners in terms of sponsors.
[50:26] They've been exhibitors and licensees as
[50:29] they currently are.
[50:31] A few people know, but Tom's Tease was
[50:34] actually the very first licensee of the
[50:37] official Winged Icon brand marks. So,
[50:41] staff is requesting council's approval
[50:44] to proceed with the signing of this
[50:45] amendment
[50:46] to extend their agreement through the
[50:48] 2026
[50:50] Sturgis Motorcycle Rally.
[50:52] » All right. Any questions from council?
[50:56] From the public?
[50:58] Is there a motion?
[50:59] » Move to approve.
[51:00] » A second.
[51:02] » First by Terry Kastner.
[51:04] Second by Ruth.
[51:06] So, all in favor?
[51:07] » Yes. Yes.
[51:08] » Opposed? Motion passes. On to 11.3.
[51:12] » Thank you.
[51:13] 11.3
[51:16] is the consideration to approve a 2026
[51:19] exhibitor license agreement with Patch
[51:22] Stop Road Shows LLC.
[51:25] This is a short-term exhibit space lease
[51:28] a license that accommodates the
[51:30] exhibitors retail activities
[51:33] on the
[51:34] Sturgis liquor store property. This will
[51:37] mark the sixth year
[51:40] that Patch Stop Road Shows has activated
[51:43] on the liquor store property.
[51:45] They've always been a a very good
[51:47] exhibitor and partner.
[51:51] They are currently
[51:53] uh
[51:54] ready to begin activating
[51:57] and set up.
[52:00] Staff is requesting council's approval
[52:02] to proceed with signing.
[52:05] » Any questions?
[52:08] From the public?
[52:11] Is there a motion?
[52:12] » Motion to approve.
[52:13] » Second.
[52:14] » First by Alex, second by Terry Kessler.
[52:17] All in favor?
[52:18] » Yes.
[52:19] » Yes.
[52:19] » Opposed?
[52:21] All right. Motion passes.
[52:22] » Thank you.
[52:36] » All right.
[52:37] Uh item 12 is a
[52:40] um
[52:45] We have con-
[52:47] um there's a need for executive session.
[52:49] We have contracts
[52:51] um
[52:52] and personnel.
[52:54] As far as I know.
[52:56] Anything else, Eric?
[53:02] » No, not for me.
[53:03] » Okay.
[53:04] Is there a motion to go to exec?
[53:07] » Motion to go to exec for contracts and
[53:09] personnel.
[53:10] » Second.
[53:11] » First by Alex, second by Terry.
[53:13] Um all in favor?
[53:15] » Yes.
[53:15] » Yes.
[53:16] » Opposed?
[53:17] All right.
[53:18] We'll be back.
[1:16:09] » All right, it's 7:45 and we're out of
[1:16:11] exact.
[1:16:15] All right.
[1:16:16] What's that?
[1:16:18] Okay.
[1:16:19] All right, item 14-1. Consideration to
[1:16:23] approve the 2026 Amsoil Inc. Sponsorship
[1:16:26] Agreement.
[1:16:27] Lance has a staff report.
[1:16:29] » Thank you, Mayor and Council.
[1:16:31] Yes, this is a one-year renewal
[1:16:33] accommodating Amsoil
[1:16:35] Incorporated's official marketing
[1:16:37] activities during the
[1:16:39] 2026
[1:16:41] City of Sturgis Motorcycle Rally.
[1:16:44] Amsoil, a long-term partner.
[1:16:47] They've been a very good partner.
[1:16:48] They're anxious to get back again this
[1:16:50] year.
[1:16:52] 964 Main Street, you're probably all
[1:16:54] used to seeing them down there.
[1:16:56] And uh
[1:16:58] obviously, uh the city is is very
[1:17:00] appreciative of their sponsorship. Uh in
[1:17:03] asking the council's approval
[1:17:05] of the mayor signing this agreement.
[1:17:08] » So, how many years have they been
[1:17:11] in that spot?
[1:17:12] » Since I've been here, uh in 20
[1:17:15] uh 6 or I'm sorry, 2016, the first year
[1:17:17] I was here, they were were on that spot
[1:17:19] and they had been for several years
[1:17:21] prior to that.
[1:17:22] So, quite a while.
[1:17:23] » All right. Any questions from council?
[1:17:26] All right. From the public?
[1:17:30] All right. Is there a motion?
[1:17:32] » Motion to approve.
[1:17:34] » First by Alex, second by Jim. All in
[1:17:36] favor?
[1:17:36] » Yes.
[1:17:37] » Opposed?
[1:17:38] Motion passes.
[1:17:41] » Thank you.
[1:17:41] » Item 14.2,
[1:17:43] um Lance got a staff report.
[1:17:45] » Yes, this is uh consideration to approve
[1:17:48] the 2026 Harley-Davidson Motor Company
[1:17:51] advertising and sponsorship amendment.
[1:17:54] Uh this is a one-year amendment to their
[1:17:57] existing sponsorship.
[1:17:59] Uh Harley-Davidson, of course, needs no
[1:18:01] introduction in Sturgis.
[1:18:03] It's a world's most iconic motorcycle
[1:18:05] manufacturer.
[1:18:07] Harley-Davidson Motor Company is closely
[1:18:10] and endearingly associated with the City
[1:18:12] of Sturgis Motorcycle Rally
[1:18:14] and serves as a prominent rally sponsor.
[1:18:18] In 2020 In 2015, to commemorate the 75th
[1:18:22] rally, the city and Harley-Davidson
[1:18:25] formalized their long-term partnership
[1:18:28] through an agreement naming
[1:18:29] Harley-Davidson the official motorcycle
[1:18:31] of the City of Sturgis Motorcycle Rally.
[1:18:34] The agreement celebrated the motor
[1:18:36] company's decades long association with
[1:18:39] Sturgis while looking forward to the
[1:18:41] next 75 years of that relationship. It
[1:18:44] also resulted in the creation of
[1:18:46] Harley-Davidson Rally Point which has
[1:18:49] become a valued and bustling permanent
[1:18:52] community gathering place and visible
[1:18:54] symbol of our partnership.
[1:18:58] The proposed 2026 sponsorship amendment
[1:19:01] extends the preliminary term of the
[1:19:04] legacy agreement
[1:19:06] for the 86th motorcycle rally
[1:19:09] and continues Harley-Davidson's
[1:19:11] long-standing commitment to the rally
[1:19:13] and the Sturgis community.
[1:19:15] During the 86th rally, Harley-Davidson
[1:19:17] will occupy designated city-owned and
[1:19:20] controlled property
[1:19:22] including the Sturgis Community Center
[1:19:24] and Rally Point and will receive
[1:19:26] promotional opportunities
[1:19:29] and other rights and privileges
[1:19:30] associated with the sponsorship.
[1:19:32] Accordingly, over the next few weeks,
[1:19:35] Harley-Davidson will act as a sponsor of
[1:19:37] the 24th annual Mayor's Ride
[1:19:40] and as a presenting sponsor at Military
[1:19:42] Appreciation Day to help honor all who
[1:19:45] have served.
[1:19:46] The city is proud to welcome
[1:19:48] Harley-Davidson back to Sturgis for the
[1:19:50] 86th rally
[1:19:52] and to continue a partnership that is
[1:19:53] important to the rally
[1:19:56] the Harley-Davidson community and the
[1:19:58] city of Sturgis.
[1:20:00] With that, staff is requesting council's
[1:20:02] approval to proceed with the mayor's
[1:20:04] signing of this amendment.
[1:20:08] » Any questions from council?
[1:20:12] All right, from the public?
[1:20:15] All right, is there a motion?
[1:20:17] » I'll motion to approve.
[1:20:19] » First by Ruth.
[1:20:19] » Second.
[1:20:21] » Second by Terry.
[1:20:22] All in favor?
[1:20:23] » Yes.
[1:20:25] » Opposed?
[1:20:26] All right, motion passes.
[1:20:28] » Thank you.
[1:20:30] » All right.
[1:20:32] Is there a motion to adjourn?
[1:20:33] » Motion to adjourn.
[1:20:35] » Second.
[1:20:35] » First by Tony, second by Ruth. All in
[1:20:37] favor?
[1:20:38] » Yes.
[1:20:38] » Yes.
[1:20:39] » We're adjourned.
[1:20:41] Thanks, everybody.
