[10:32] know that our residents have a live person to call like Jacqueline and talk

[10:37] to her and and probably about some of the most difficult things that they're

[10:41] going through in their life that's a that's an invaluable resource for this

[10:44] community and that could be the first step in the process of healing their

[12:13] how's everybody this evening great looks like we got a lot of good

[12:18] things going on in our little Community

[12:22] um one touch base um since uh since we had spoken last uh

[12:27] here at the at the last meeting Steve appreciate the caller uh make sure

[12:33] I call earlier today that looks like I have a meeting here and a few short

[12:36] weeks so appreciate everyone's time to make that happen

[12:41] but also since uh since I was here in Spoke Class A few other members of our

[12:47] neighborhoods actually reached out to me and shared some of their stories and

[12:51] some of the issues that they've been having since the the storm drain system

[12:55] was was put in place there's some other residents that's also

[12:59] been experiencing flooding one of which has been experiencing flooding within

[13:03] their basement uh as a result from it um

[13:07] so I've been I've met with a few of them look some of the sides

[13:11] reviewed to my wedding I'm gonna try and put together as much information I can

[13:15] to be able to bring to the meeting to share and review that with everybody

[13:21] um that being said uh notice something in the newspaper there earlier this week

[13:26] it's probably a larger issue than the uh than the issue we're having over at

[13:31] Spring and it's um well actually it's also an

[13:34] issue we're having in Spring is some of the lead water lines and the city's uh

[13:38] and the water boards plan to replace lead water lines in our community

[13:43] it's my understanding that this evening there's there's a resolution to amend

[13:47] sections 5 25 and 38 of the city Charter uh on the on the agenda this evening to

[13:56] address issues that could potentially prevent that Water Project from from

[14:00] executing um I haven't did a whole lot of research

[14:03] on it I just just seen this a couple days ago so I've put together a little

[14:09] bit since then but you know some of my concerns being a resident over there you

[14:15] know having small children lead lines is not desirable to have have my water

[14:21] source come from would like to see see the project come

[14:26] to fruition understands a large project I think 80

[14:29] some plus million dollars is being spent on it and I believe there is you know

[14:34] rate adjustments that was already approved and passed where you know we

[14:38] are or will be paying higher water rates to help support the project and I'm fine

[14:43] with doing that to be able to have safer water lines

[14:48] my understanding the the issue right there goes circles around to the Charter

[14:54] change that was voted on in 21. um and I vaguely recall the charter

[14:59] change whenever it was put up the boat just to

[15:02] make things more convenient for voters to be able to come out and vote on City

[15:07] elections along with County elections so I think it's a really good idea

[15:11] to streamline things make it happen quicker more efficient and more

[15:16] Consolidated places um

[15:19] my concern is that uh oh after reviewing it and reviewing what information I

[15:25] could find on it you know it it appears that the the term length for Council

[15:30] Members elected in 2019 was extended for a year

[15:34] and on in the newspaper article that I read earlier this week you know it it

[15:39] quoted uh quote the mayor saying that people voted for the charter change in

[15:43] 2021 and that was so uh right down here

[15:50] two that was intended to get more people

[15:53] involved with the election I agree with that Fair statement I

[15:58] have to see elections with the county elections would get a lot more people

[16:01] involved more voters involved and would help the overall process

[16:16] you know the one concern I had with the quote

[16:21] quote mentioned the right here it's quoted says the

[16:26] context of it is so you cannot extend your term to office once you're in

[16:29] office but in order to realign the terms to get them to even years the people are

[16:34] elected in 2019 were given an additional year

[16:36] that's the only way we knew how to align it with the county

[16:42] so my understanding that the only way to align it with an even year would be to

[16:45] extend it for a year um at least that's the way I'm reading

[16:50] the quote and I'm not

[16:53] expert in elections not like expert in government but Common Sense tells me

[16:58] another way to align it with even years would be to shorten it a year as opposed

[17:04] to extending it so I think that might have been a potential potential solution

[17:09] available at the time that wasn't executed

[17:13] the larger concern that I have with the extension of the terms

[17:19] is that uh you know West Virginia Constitution

[17:24] I believe it's uh article 6 section 37 provides that no law shall be passed

[17:31] after the election of any public office but shall operate to extend the term of

[17:37] this office

[17:39] so I think that's that particular section right there is probably

[17:44] my opinion my knowledge of bonds and the the issuing of bonds and the

[17:49] security and the validity of bonds is if there's an issue raised about the

[17:55] constitutional right of the amendment to begin with whether it was literature

[18:00] meant to be passed or legitimate to be put before the voters

[18:04] you know that would make it challenging for any bond Council or anybody looking

[18:08] to assist with issue of the bond help that Bond go through

[18:12] it's my understanding that if the Bond's not received then the lead line project

[18:17] might not happen which would be very detrimental I

[18:21] believe me my family and the overall Community

[18:26] um so I would would encourage and would hope

[18:30] that the resolutions put before Council this evening looking to address and

[18:35] correct the the amendment that was put in place

[18:40] um would be passed and that would correct

[18:44] all the issues to hopefully allow Ford for the bond to be issued and Ford

[18:49] that project to move forward I think our projects a big assets for the city

[18:54] it's a big asset to the residents I think it'll it'll be very helpful

[19:00] um in the event though that it's it's not

[19:03] um not passed

[19:07] um I would be curious to learn more about the original Amendment

[19:12] um like I said I haven't had much time to research it nor have I had much

[19:15] material to research on so with that in mind would like if I can

[19:20] miss that here um

[19:30] concerns around the bonds that may have been already discussed

[19:35] thank you Tim stranco our water wishes to address

[19:41] cancer concerning the bond issue and wonderful project good evening Mr Mayor

[19:45] counselors my name is Tim stranco I'm a member of the West Virginia bar and

[19:49] happy and proud to serve as general counsel for the water board Clarksburg

[19:52] water board our general managers here tonight Jason Myers and also a bond

[19:56] counselor from Steptoe and Johnson Tom Heyman is is here tonight as well

[20:01] I won't elaborate much on the prior speaker and we've already talked about

[20:05] this in work session but this is a 90 million dollar project that will re

[20:10] reinvigorate of our infrastructure here in Clarksburg

[20:14] and and bring that money into in economic activity into town so it is a

[20:20] remarkable project I served as a public member of the infrastructure Council for

[20:25] a number of years so I've seen projects from all over the state this is a this

[20:29] is a landmark in the history of West Virginia

[20:32] infrastructure funding and my compliments to Jason for putting

[20:35] together a funding package that really is a remarkable in its generosity and

[20:40] low interest rates and grants that will help us

[20:44] remake our water infrastructure and to do that we need your help with the the

[20:50] charter amendments I'm happy to report we discussed after your work session we

[20:54] discussed with Bond Council the Amendments that Council are worth uh

[20:58] mentioned and bond Council finds those to be appropriate

[21:02] um so we have the water board has no objections not the bond counts also

[21:05] endorses those and there's also a a typo I know your City attorney is aware of as

[21:10] well and I would I would like to say in conclusion that Thank The City attorney

[21:13] for his hard work on this as a team the water board in the city are going to go

[21:19] forward and and rebuild our water infrastructure and we're very excited

[21:22] about that so I thank you for your time Mr Mayor subject any questions

[21:36] city managers report February 2nd 2023. from the manager's office I would like

[21:42] to thank all department heads for their hard work and dedication submitting a

[21:45] conservative budget proposals Economic Development completed its first Ura

[21:49] Workshop meeting January 31st Economic Development would also like to

[21:54] announce the city of Clark river Clarksburg has been awarded a U.S

[21:58] Department of Transportation Safe Streets and grants for all roads for all

[22:02] grants in the amount of two hundred thousand dollars this grant has a twenty

[22:06] percent or fifty thousand dollar match and we'll address a two-way traffic

[22:10] study and bicycle pedestrian infrastructure planning job well done to

[22:15] Brittany and her co-workers from the police department four new

[22:19] officers started the West Virginia State Police Academy on January 30th with a

[22:24] tentative graduation date of May the police department responded to 1 596

[22:30] calls for service in the month of January

[22:32] officers Jason Bartlett and Brett Levine were promoted to the rank of Sergeant

[22:37] and Sergeant Chad Travis was promoted to the rank of Lieutenant on February 1st

[22:43] from the city parks the National Park Service still has our grand application

[22:47] for the pickleball courts and will continue to process it we hope to have a

[22:51] decision within the next few weeks the AMP step lights have been delivered

[22:56] and will be installed as weather permits and the city parks assisted the town

[23:01] remember for with a repair of a catch Basin at the Clarksburg City Park

[23:06] North Water Treatment Plant the discharge monitor report was submitted

[23:23] planning for phase five of long-term control plan is still ongoing and then

[23:37] department responded to 249 calls for service for the month of January

[28:11] thank you very much for the time this evening as part of the public hearing I

[28:16] just wanted to introduce us a few things about this project the first being my

[28:21] name is Carolyn yagel I'm with environmental planning and design and

[28:24] over the course of the last year been working with

[28:28] John and all of the stakeholders throughout this process that have

[28:33] participated and we have had quite an opportunity to hear from hundreds of

[28:40] residents and business owners and as part of the public hearing record

[28:45] would like to identify there have been quite a number of points of Outreach and

[28:51] drafts that have been developed as part of this work there have been a series of

[28:56] neighborhood workshops this was sort of the core element from the public

[29:00] Outreach and one of the ones that sort of kicked this off was actually back in

[29:07] December of 2021 where we started to distribute all the information and the

[29:13] way in which people could participate we were part of the Winter Fest activities

[29:18] and then geared up so that we could start this series in May of 2022. we

[29:25] also then met with folks in July as part of the second series of neighborhood

[29:31] workshops and is from taking the information that we had in May started

[29:36] to conceptualize really what the areas of focus of the plan

[29:41] would possibly be and where the areas of interest from the residents and the

[29:46] business owners were and we'll get to those very soon

[29:49] the last round of Outreach was in September and we were part of things

[29:55] happening right here right nearby and again being able to reach out to people

[30:02] so of all of the things that were discussed if they could pick one and

[30:06] identify that there was a particular Focus area or project within that Focus

[30:11] area what would it be so as we pulled all of those ideas together uh there

[30:16] have been a series of four drafts that have been available to the public as

[30:20] part of this fall late summer and fall and the approach was to do four things

[30:26] one build on the character and the assets that you have secondly we're

[30:32] trying to consider really what are the top priorities of the many things that

[30:37] people have an idea about doing and how can they collectively come together I

[30:41] think a few of the things earlier on the agenda this evening are even

[30:44] highlighting how there is the focus to come into think about different areas of

[30:50] connectivity Mobility infrastructure and all those kinds of things the plan

[30:55] looks at certain items of those and even more so the third component of that is

[31:02] what is realistic in terms of the set of four goals that ultimately have come out

[31:07] of the plan and then how through the next 10 years as this plan will be

[31:13] moving forward that actionable step set of steps

[31:18] so from those four areas of focus there are I would say

[31:23] four simple verbs but these verbs mean quite a bit the first one is to reclaim

[31:30] Vitality reclaim the second one is to embrace in the

[31:35] terms of the resources that are here within Clarksburg

[31:39] the third is looking at nurturing again

[31:44] bringing together people the neighborhoods all of the physical

[31:48] improvements that you all have a component of caring for and being part

[31:53] of those decisions day after day and year after year and then fourthly

[31:58] thinking about how to strengthen the abilities of all the elements of

[32:04] communication and those lines of communication so that as you move

[32:08] forward with your actions you're able to get the kind of feedback that you desire

[32:13] and people are able to participate in that process as well

[32:19] so each of these four goals then identifies within the plan a series of

[32:25] broad actions and then those actions are further identified some of the ones that

[32:30] moved up to the top based upon all of the feedback that we received did focus

[32:35] on looking at again that Vitality piece both from a physical planning

[32:40] perspective and probably more along that element of a Baseline and to support the

[32:46] physical aspect is looking at what the policies are so actually considering

[32:51] some of a rehaul of the ordinances that guide the scale and the character of

[32:57] development so that you can Embrace again

[33:00] all of the assets and highlight the things that you like to highlight

[33:05] looking into also the second action there were things uh here that consider

[33:11] again what are your existing resources and the ways in which those resources

[33:16] actually are a component of Economic Development

[33:21] so well beyond just downtown you have lots of things happening from whether

[33:26] it's a Parks and Recreation or an open space perspective how does that network

[33:30] of natural resource serve as a large asset to the people here and visiting

[33:37] and what does that mean in terms of actually furthering your Economic

[33:42] Development opportunities

[33:45] thirdly in terms of considering elements of Maintenance or mitigations and then

[33:52] also the complement to that the code enforcement piece

[33:58] and lastly again thinking about all of this coming together and again the words

[34:04] that is getting out and the work the feedback that is coming in so that is

[34:09] something that moves everyone together in a positive and forward moving step

[34:15] so with that there is one Element within the comprehensive plan that sort of

[34:21] takes these ideas and starts to highlight the possibilities of how and

[34:26] to what extent these actions can come into play some of them are city-wide

[34:31] some of them have a particular Focus there are certain areas or certain

[34:35] neighborhoods and when we were considering each of these areas of the

[34:40] neighborhoods coming together there are certain ones that different areas

[34:45] different neighborhoods have an interest in highlighting

[34:49] different points of the plan so while there is one plan for the city-wide

[34:54] there are almost subsets to this so as you all have the opportunity to be in

[35:00] parts of the neighborhoods or those neighborhoods coming together the kinds

[35:03] of funding that you would ultimately be pursuing or considering in the ways in

[35:08] which they could affect different neighborhoods and even

[35:11] you're adjoining I think areas right Beyond you know the city boundaries

[35:18] so quite a number of Partners some of those Partners even the United Way right

[35:22] was here this evening doing different things sort of on that daily level and

[35:27] the ways in which a number of people can come together the component of this

[35:32] comprehensive plan in terms of its actions and the potential Partners is

[35:37] definitely a blend of both public and private Partnerships and being able

[35:41] again to strengthen those kinds of relationships and those kinds of actions

[35:46] so that you can again move forward through the coming decade so this is a

[35:51] quick overview for the matter of the public Hearing in terms of the things

[35:56] explored within the comprehensive plan and I do want to ensure that there is

[36:00] other time for others to ask questions or participate as part of this so you

[36:06] want me to I can put the mic back and offer anyone else out an opportunity to

[36:11] speak on it or if you have other questions I can get to that after

[36:15] Heathers have had a chance

[36:18] is there anyone in the public that would like to speak on this uh comprehensive

[36:24] plan with not a council of open it up

[36:30] anybody on Council have any questions I think we we decided that we would have

[36:37] a work session for the council at a later point where you if you could come

[36:43] back and we could go and and real depth with this uh to update Council it's kind

[36:49] of you know we we haven't seen anything up until this point I think we'd like to

[36:54] have a more in-depth look at it if that's possible thank you very much

[37:01] I do want to say I mean I was I've been to several meetings and I want to thank

[37:05] you for you know putting all your time in this and I think it's going to be

[37:09] good to give us a roadmap for our city um I think a lot of things that we are

[37:12] already kind of doing but now I think it it will show get more evidence for the

[37:17] community to support some third certain things that we already have and uh

[37:21] so I mean I look forward to trying to fulfill this and and following it and uh

[37:25] I expect good things to come out of it so thank you for all your time thank you

[37:38] city the offices and the other committees in order to be able to get

[39:12] but uh you know there was obviously some glaring omissions from the original

[39:15] charter limit failed to include the water board and uh here we are here's

[39:20] here's what we need to fix it so uh I'll let other people discuss what they want

[39:24] to discuss but I'm offering I'm going to offer an amendment at least to uh fix

[39:28] the one type so okay Jared

[40:18] the procedures set forth in this Charter such members elected in June of 2025

[40:24] will serve for a one-year term at that time the four membership

[40:29] positions will be reduced to three and only three members will be elected in

[40:35] the May 2026 in subsequent elections such a members elected in May 2026 or

[40:43] subsequent elections will serve a term of four years

[40:48] and that's that's a motion further discussion on we need a second

[40:54] if there's going to be further discussion

[40:57] okay discussion on the amendment um I'd like to add uh if that's the

[41:01] route uh we want to take I'd just like to

[41:04] remind this body that and the people who are here that uh that'll Force us to

[41:09] have four elections in a row two will be head bought held by the city and two

[41:13] will be held by the county uh you know I personally feel that that's a little

[41:18] much uh I feel that the the original uh ordinance proposed

[41:25] meets the requirements of the bond Council and again

[41:30] you're going to have four elections in a row two immigrants are one-year terms

[41:33] that'll be held by the city and two of them will be held by the county and you

[41:37] know I'm looking at that you know from what Annette tells me the cost of the

[41:41] municipal election here is twenty thousand dollars a piece so here we're

[41:45] going to add forty thousand dollars uh to the elections we you know don't

[41:49] really need to have uh personally I feel that the ordinance meets the

[41:53] requirements from the bond Council and you know I again I know we've discussed

[41:57] it Ad nauseam at this point but you know

[42:02] we need to do what's right and uh and we're here to fix it and I believe that

[42:06] since it meets the requirements the black Council we need to move on and if

[42:10] if the Secretary of State or the Attorney General says no the 2021

[42:13] candidates can't do it either I'm willing to sit down and rehash it again

[42:16] and then that and that way we could have a three-year term like Mr Lane has

[42:21] mentioned and what the water board will be doing

[42:23] uh you know in their election to have a three-year term to meet it up with the

[42:27] even years I think there's better ways to go about it than to you know shovel

[42:31] money into a furnace uh for having these one-year terms you know I don't like the

[42:36] one-year terms I don't but if that's what we need to do to meet the

[42:38] requirements of long Council I'm okay with it they've put forward an idea that

[42:42] we'll have one year term this you know as bad as it sounds to have a one-year

[42:45] term this time around and then and you know and the 2021 members will get that

[42:49] five-year term which I'm not going to sit here and argue about but you know

[42:52] going this route is going to be confusion it's going to be costly and I

[42:56] just don't think it's the right direction for the city thanks thank you

[42:59] um yeah I had a discussion um

[43:03] the reason for this amendment is because the you know the original language

[43:07] in this uh in this measure is for the the four members in the June elected

[43:13] June of 2021 to serve a term of five years

[43:17] um I just feel and you know based upon

[43:21] discussions that you know we had even in the um in the work session prior to

[43:27] um this amendment right here will not only

[43:31] satisfies the bond Council but also will satisfy you know um the Secretary of

[43:37] States you know would also be proper you know for the secretary of state

[43:42] Secretary of State's office my thing is I rather just you know um

[43:48] satisfy the bond Council so we could move on with this water project and

[43:52] satisfy you know what is proper within the Secretary of State now we could

[43:56] either do this tonight you know or we could do this later on

[44:00] you know but I've you know I've you know I um I feel like we should we should do

[44:06] this tonight just you know clean all this up and and and move on so

[44:12] thank you thank you uh Gary I mean I don't really have much uh

[44:19] I was pretty strongly against this I'd actually hired an attorney and was ready

[44:55] I feel kind of bad that we're about to go against what the voters voted for

[45:00] but looking at it trying to go up and look at it from 32

[45:05] 000 feet here and look at 96 million dollars

[45:09] it's just not worth the fight I don't think so I will support this and I I do

[45:13] agree with Wayne if we're going to fix it we just need to go ahead and fix it

[45:16] all because you know maybe that this pleases the bond Council right now but

[45:21] we've had other discussions about other bodies not being pleased with this

[45:24] possibly or laws not being able to pass or people being able to sue us over

[45:29] things we change I mean it's just it's it's not worth the hassle uh I think

[45:34] what we came in and changed these Charter amendments we had very good

[45:37] intentions um

[45:40] and we're still going to achieve those things it's just maybe we uh approached

[45:45] it a little too Brazen not thinking about the Water

[45:48] Board election was not very smart I'm not sure how we missed that uh but

[45:53] anyway that's really all I have to say thank you

[45:57] vice mayor well I think it's kind of ironic that we

[46:01] say that we trust our city attorney's judgment on this

[46:06] and he's the one that wrote the charter change

[46:11] correct you're the one that drafted the change correct in association with the

[46:20] so we were advised by our legal counsel

[46:27] correct just like the waterford's being advised by their legal council this

[46:31] Council was advised by you

[46:35] on that change Richards also said that that was not that was not my decision

[46:40] that was not my decision that was not my um proposal I did not write that Charter

[46:47] change you also said you would defend that correct

[46:50] that it was something that you feel is in good standing and that you would

[46:54] defend it now here's the thing I don't have a problem correcting it

[46:58] that's fine not a problem we can do that

[47:03] do what we need to I mean I'll vote against it but we we can do that because

[47:07] I went off of what you advised me as advising counselor

[47:12] not my own decision and then 70 percent of the voters said

[47:17] what's going on here needs change the stuff that's occurring with the

[47:24] election is hogwash

[47:27] and it needs changed they they disagreed with I mean we had

[47:33] total chaos with our elections people want on drawing footballs

[47:39] that's a problem and the people in our city had an issue

[47:43] with that so they went out and voted

[47:47] for the charter change because they believed in it

[47:51] 70 percent voted for that and if I wanted to benefit myself

[47:59] I wouldn't have referendum recall where we can

[48:07] if we do something egregious on this Council like

[48:11] you know appoint people to jobs they don't earn

[48:15] or they're not qualified for you know make rooms in the back

[48:20] for

[48:24] a specially created position like Deputy OEM

[48:30] at the county then the people within our city can say

[48:34] what you're doing isn't correct and I will

[48:39] with 10 percent

[48:42] signature of the voters the registered voters in this city

[48:47] I will come in and do something about it because the people that have sat in

[48:52] these seats have done some really dirty things and nobody's patrolling it

[48:58] and that was why I was for the charter change

[49:02] and also I

[49:06] my time that I that I've sat and he sees for 20 some

[49:10] years

[49:14] so that was why I was for the charter change not for my own personal

[49:19] gain so just so we're clear on that and that

[49:23] you advised me as counsel and I took that as word because that's what we're

[49:30] doing tonight we're taking council's word that this is

[49:34] what we should be doing

[49:38] I mean we have to make it right even though you know

[49:43] we split hairs on what's right and wrong up here

[49:47] we split hairs on that but hopefully the people in this city

[49:51] will stay woke they'll stay awoke

[49:57] to what some of the council members here want to do

[50:01] that's all I have to say well I usually don't have much to say

[50:07] but I have I have a lot to say about this issue

[50:11] um first of all why this came about wasn't to extend

[50:16] council's terms because getting in another year is not my plan not my goal

[50:22] that's the way it came up with our City attorney drafted it up that's how it

[50:28] came out it just you had to do something and

[50:32] uh Chris said maybe we should have taken one year less that might even been a

[50:36] better one I I don't know we're going on the advice of this journey so he he

[50:41] drafted it up and and that's that's what we went with

[50:45] and the reason why is that when I ran in 2019

[50:52] you talk about a debacle of election there was a 38 vote uh vote difference

[50:59] between the number three guy and the number six or seven guy was 38 votes

[51:05] down I asked the uh the clerk at that time uh

[51:09] can he make up a 38 but I I don't think so so we went to the uh canvassing in

[51:16] the canvassing they found 30 votes 30 votes

[51:21] so this puts this guy that was six that puts him into uh fourth place so we have

[51:27] a recount again I went to the clerk eight votes only 1700 people voted out

[51:34] of ten thousand we only had a 17 percent turnout not many you shouldn't have that

[51:40] kind of mistakes but you know what it ended up you had to pick a football out

[51:46] of a uh basket to to win thinking the voters came to me and said

[51:52] what in the world is going on out there not to mention that we got paper ballots

[51:58] that are animated back in the 50s we still do the paper ballots people you

[52:04] vote for three they vote for four or five they Mark out and I we have to have

[52:09] an old person like me determine who did they really want to vote for

[52:14] ridiculous you get electronic ballot and you can only vote for three I'm not

[52:20] saying that thing's perfect I'm sure there's mistakes there but it's not a

[52:24] debacle like we're doing at City Hall and the people said we don't want that

[52:29] as Lily said 70 percent of people came out and said we don't want that in City

[52:35] Hall anymore but yet the charter the charter is our Constitution of the

[52:41] United States the city Charter is our constitution

[52:45] we are going to let four people on this Council change what

[52:51] the voters the 1700 or how many came the last time we're going to change by these

[52:58] four votes on this Council and I I want the people to to watch as closely we're

[53:03] going to change what the voters in Clarksburg I don't care about the bond

[53:07] count the secretaries this all started with a letter from the Secretary of

[53:11] State it was an opinion an opinion not fact if it's wrong change it take us to

[53:19] court and change it tell us what we need to do not let us decide we can do X Y

[53:24] and Z some people yeah the 201 should have their five years with no

[53:30] maybe they shouldn't we're picking and choosing what we want now if you want to

[53:34] pick what the secretary of state says they said do one and one but no that

[53:39] would put me to have to run another year so I don't want to do that but it's okay

[53:43] for the the 2019 people to do it but I'm not going to do it it's just it's kind

[53:50] of we're starting we're going to change the charter by vote up here

[53:55] what's next the charts put in in the 50s it's our law I don't it's what we go by

[54:01] it's it's what we have to go by that's what the people said back in the 50s

[54:06] when they drafted this Charter we've tried to update it make changes but when

[54:10] we try to update it we did it the right way we put it out to the people to vote

[1:14:17] there's a sweet tart Dance for kids 12 and under it's actually the kid's a DJ

[1:14:22] djp Hoss he's gonna be like 11 he's 11 years old he's gonna be DJing so we're

[1:14:27] continuing to be unique and change things up and just um continue to bring

[1:14:31] entertainment and spread it through downtown I want to thank everybody on

[1:14:34] the committee First Fridays to continuing this I think Public Works and

[1:14:38] all the city that helped make this happen I'm looking forward to it and

[1:14:42] tomorrow night we have um you know at the Robinson Grand Anthony nunziato uh

[1:14:47] is going to I think I might have said his name wrong but

[1:14:50] he's a great talent but really the thing is that we're gonna have some local

[1:14:53] talents Benjamin DeFazio and Marissa Bailey are going to be there opening up

[1:14:57] for them so it's always great for our local talent to be on that stage that

[1:15:02] building was is for our community I mean it's great it's great to give our people

[1:15:08] an opportunity to get up there and and show their talents and those two are

[1:15:13] amazing and not to forget Amici which is everybody's local favorite band um so

[1:15:18] anytime you get them a state you get the people in the park where you decide if

[1:15:21] you get them all out there and and uh our community comes together

[1:15:26] so that's and you know that's a segue until I'm glad that we're getting these

[1:15:30] things done um and uh I'm glad we work work with the

[1:15:34] water board and get this project happening and uh

[1:15:37] you know just just want to come together everybody

[1:15:40] that's how we're going to move forward everybody's got to come together and do

[1:15:42] this and I think that's what we're doing and um excited to get back to work on

[1:15:47] real things the city needs rather than just you know cleaning up things and

[1:15:51] just you know I really want to get back to work uh

[1:15:54] men as chief police has noticed I've been in his office about five times this

[1:15:58] week about other things and just uh you know I'll slow down a little bit but you

[1:16:03] know ready to get back to work and I hope the rest of the council is too

[1:16:06] we gotta give up get a lot of things done and um as soon as they're counting

[1:16:10] on us to do that so that's that's all I got have a good

[1:16:13] weekend councilman work

[1:16:16] yeah I just wanna I appreciate everyone coming out and um we definitely had a um

[1:16:23] very full agenda and you know very spirited debate

[1:16:27] and um and I guess that's you know that's that's part of the process part

[1:16:32] of the government process um

[1:16:34] and you know when it comes to relations to you know the the charter amendments

[1:16:40] and you know especially section five which seems to be the you know the big

[1:16:45] thing uh you know I you know I posed an amendment

[1:16:48] because you know I've felt that you know constitutionally you know

[1:16:54] through the Secretary of State it was just proper to uh you know to not extend

[1:16:59] my term you know another year um now that failed and that's okay

[1:17:05] that's that's part of the process and um in down the road we may have to clean

[1:17:10] that up but um but I you know I um you know I do like the fact that we're

[1:17:17] taking the right steps you know to the first step to start cleaning some of

[1:17:22] that up and um and I do like the fact that you know we're taking the right

[1:17:27] steps now to make sure this water project you know

[1:17:31] um you know happens because that's really amazing

[1:17:35] you know that's that's really important you know 98 million dollars

[1:17:39] um you know to fix our lead water lines is extremely important and um we just

[1:17:45] want to make sure that you know um that what we do you know um you know in our

[1:17:51] terms up here you know when it comes to elections um

[1:17:55] are legitimate so these projects can happen

[1:17:58] and um and that's you know that's just that

[1:18:03] um have a happy first Friday and um

[1:18:06] we'll see you see the next going around Council okay

[1:18:13] I don't think there's anything else to be said by me for the election thing

[1:18:18] but I'm pretty angry right this second I was planning on coming here and being

[1:18:21] professional and not saying too much we have a lot of stuff going on behind the

[1:18:25] scenes here uh a lot of things I'm angry about advice mayor kind of already took

[1:18:29] a pot shot at me for no reason so it's kind of on

[1:18:34] um you know I did something I feel like was

[1:18:37] very above the board in my personal life nothing to do with the city a while back

[1:18:41] and now that they're mad at me they try to

[1:18:45] turn that around and retell the story not how it happened now if anybody's

[1:18:49] interested in hearing that story I'd be glad to tell it to you I already put it

[1:18:52] in writing put it out on the internet and send it to the ethics board but you

[1:18:58] know it still likes to try to be turned around uh and unfortunately with the

[1:19:02] order of council comments here I don't get to uh speak last so instead I'm just

[1:19:07] going to say that and now I'm going to get up and walk out of here and I'm not

[1:19:10] going to pay these fools the respect of sitting there listening to them and next

[1:19:14] week I'm going to introduce a resolution to remove the mayor because I along with

[1:19:19] the rest of these guys I'm pretty sure are pretty much tired of the way we're

[1:19:23] being treated here yeah that's it a resolution thank you

[1:20:05] tonight but uh yeah it was uh it was a great experience great to see these guys

[1:20:09] uh get promoted and and keep Clarksburg safe

[1:20:13] uh I don't remember hearing about uh Lieutenant Jeff Rogers retirement so

[1:20:17] congratulations 25 years of service with the fire

[1:20:20] department uh that's that's great news

[1:20:22] congratulations to him uh looking forward to first Friday and

[1:20:25] the dance at the senior center I know that sounds kind of hooky but I'll be

[1:20:29] there with the kid uh dancing the night away uh you know going back to what I

[1:20:35] said earlier about the charter amendments and and the uh

[1:20:43] again I'm going to be the first to say it or second to six I already did say

[1:20:47] you know we sometimes mistakes are made and uh regardless of who sits up here we

[1:20:53] have to fix them and it made maybe uh quick and painless or maybe

[1:20:59] ugly and you know and uh painful but uh you know I think

[1:21:04] we did the right thing uh

[1:21:07] if the company becomes an issue regarding Mr Ward's comments if it

[1:21:12] becomes an issue I'm happy to revisit it and move with three-year terms like the

[1:21:16] water board did I don't see why that's uh and Mr Lane suggested I don't see why

[1:21:20] that's uh can't work for us if it comes down to

[1:21:24] it but uh you know again I think it's you

[1:21:28] know so learning Learning lesson that we you know we just had to experience the

[1:21:31] hard way but uh I'm glad we I'm glad we can move

[1:21:50] lot of things going on behind the scenes

[1:22:07] I I'm here for the people of Clarksburg that's why I'm here I'm not here for me

[1:22:12] my own personal gain and you know when things occurred that are corrupt

[1:22:22] I mean I don't know what else you call it

[1:22:26] you know when you're making deals with Patsy tree

[1:22:30] cost about a job he's creating for you and I mean you're you're even going as

[1:22:37] far as to say that um I had a long-standing request to Patsy

[1:22:42] that he helped me find another position in the county if something became

[1:22:46] available that I was qualified for because

[1:22:50] I was burned out with working at 9-1-1 we agreed that this job would be perfect

[1:22:55] for me we even discussed that he would try to make the pay scale for the

[1:23:00] position at or near what I make currently to

[1:23:04] deter some of the people above me from applying

[1:23:08] for it because they would have to take a pay cut so this would make it a little

[1:23:13] easier for me to get the promotion with less competition

[1:23:17] those are his words not mine he put them out on everywhere Facebook

[1:23:22] everywhere corrupt

[1:23:27] three just like wanting to

[1:23:30] give your friend a job that they're not qualified for

[1:23:35] that they don't even meet the minimum requirements for that's dirty

[1:23:39] and I'm against that kind of stuff it's wrong

[1:23:43] and if this Council was for it then do it

[1:23:47] for dirty things if they're for that then do it

[1:23:53] and do that but I will call you out every time

[1:23:58] I'm not afraid Not Afraid no my time is enough

[1:24:02] sadly mistaken you can keep trying it's not up I'll sit here all day and talk if

[1:24:12] the things like that that have occurred in this city have killed this city

[1:24:18] for years it's occurred in this city these kinds of things you give me a job

[1:24:38] I'm not splitting hairs with whether it's corrupt or not corrupt it is and

[1:24:43] the people of this city know it that's why they voted for us

[1:24:48] because they wanted the people that were doing those disgustingly corrupt things

[1:24:51] out they wanted them out

[1:24:54] and and I knew this would be a hard fight

[1:24:57] and that people would ride on coattails to come in and act like that they agreed

[1:25:03] with your way of thinking until they got here

[1:25:05] and then they would continue the corruption

[1:25:08] well I'm not gonna sit back and let you get

[1:25:12] away with it without people knowing so that's all I have to say

[1:25:17] well this has been a highly debated meeting uh I've said enough I think

[1:25:23] people out there hopefully this hopefully this sounds good and the

[1:25:27] people watch us and I want to share it with a lot of people because it you know

[1:25:32] it's it is what it is I just want to do right and do the right thing and it's

[1:25:40] it's hard as Lily said you know when we came into this in 2019 nobody said it

[1:25:45] would be easy and and it certainly wasn't

[1:25:48] I I would think we we're trying to change a culture that had been around

[1:25:53] for a long time and when you try and change a culture you're you're stepping

[1:25:57] on people's toes no question about it and and we have done that but really

[1:26:03] to be an elected if you you just try to do the right thing when you do that you

[1:26:09] go out with your head up high all I know is when we came in here three and a half

[1:26:13] years ago this city was a mess the police department The Code Department

[1:26:18] from the top down we promised change and we did that and we did that and and

[1:26:24] that's that's all I could say if I left today I'm happy with what we've

[1:26:29] accomplished uh with that being said I'm going to

[1:26:32] keep going on and on we're doing what we're trying to do and do the right

[1:26:36] thing I thank everybody for coming out tonight and uh this is what government

[1:26:41] does we have agreements and disagreements and at the end of the day

[1:26:45] you know four votes win and that's that's fine that's how it is I I walk

[1:26:51] out with my head high even though I'm on the losing side that's that's fine I'm

[1:26:55] for the people people say so that's the main thing but thanks everybody for

[1:27:00] coming out and I got to take an entertaining motion oh no let's just
