zone appeals for Langston County.

» Got it first and probably I got a
[2:58]
second. Any other discussion? All in
[3:01]
favor? All right. Thank you. And I see
[3:05]
we have just one public hearing today.
[3:07]
And uh as far
[3:12]
right here,
[3:15]
is it Mr. Zakur?
[3:17]
>> Zucker.

[3:20]

[3:20]
>> Glad you're here, sir.
[3:21]
» Glad you're here, sir.
[3:21]
>> Thank you.
[3:22]
» Thank you.
[3:22]
>> Thank you. uh looking for a uh a
[3:26]
» Thank you. uh looking for a uh a
[3:26]
variance on setback regulation for to
[3:29]
put a pickle ball court here and pro.
[3:32]
>> Thank you, Mr. Chairman. Um Mr. Zeckert
[3:36]
» Thank you, Mr. Chairman. Um Mr. Zeckert
[3:36]
um requests a variance from u article
[3:39]
5-3 the setback regulations um from the
[3:42]
setback distance requirement of 75 ft
[3:44]
from the center line of the street or
[3:46]
road rightway. The owner requests a 20ft
[3:49]
setback distance from the center line of
[3:51]
Belmont Creek Road in order to construct
[3:54]
a private residential pickupball court
[3:56]
on his property known as 925 Belmont
[3:59]
Creek Road in Lancaster which is located
[4:01]
off um route 692 which is Belmont Creek
[4:05]
Road. Tax map number is 25A-1-4
[4:09]
in district 1. The subject parcel was
[4:12]
originally created by a division plat of
[4:14]
Belmont acres which was recorded in 1947
[4:17]
and therefore predates the zoning
[4:19]
ordinance and the Chesapeake Bay
[4:21]
preservation ordinance. The majority of
[4:23]
the lots in the subdivision are roughly
[4:25]
an acre or less. The access road Belmont
[4:28]
Creek Road is a private 20 foot wide
[4:30]
gravel drive.
[4:32]
The [clears throat]
[4:33]
applicant's property is approximately
[4:35]
1.1 acres in fronts on the westerly side
[4:38]
of Belmont Creek Road and on the
[4:39]
easterly bank of the Rapahhanic River.
[4:42]
Subdivision subdivision lots on the
[4:44]
easterly side of Belmont Creek Road have
[4:46]
not been developed and are currently
[4:47]
being farmed. The applicant desires to
[4:50]
build a residential pickleball court
[4:52]
using a 30 foot by 60 foot slab, which
[4:55]
is 1,800 square ft placed in the front
[4:58]
yard of the property outside of the
[5:00]
utility easement. The pickleball court
[5:02]
will be unlit and unfenced with the
[5:06]
surface being built at grade. The
[5:09]
requested location puts the edge of the
[5:11]
pickleball court 10 ft from the property
[5:14]
line along Belmont Creek Road. The
[5:16]
applicant believes the setback distance
[5:18]
requirement of 75 ft from the center
[5:20]
line of the road unreasonably restricts
[5:22]
the property and a variant should be
[5:24]
considered for the following reasons.
[5:27]
The existing location of the septic
[5:28]
system and drainfield on the northerly
[5:31]
side of the property prevents use of the
[5:33]
area. A large magnolia tree in the front
[5:36]
yard prevents the pickle ball court from
[5:37]
meeting the required road setback.
[5:40]
Removing the tree is undesirable and
[5:42]
potentially cost prohibitive. The 100
[5:45]
foot RPA buffer from the Rapahhanic
[5:47]
River on the westerly side of the
[5:48]
property further restricts the property
[5:50]
and the applicant does not believe that
[5:52]
the proposed location of the pickle ball
[5:54]
court would impede traffic visibility or
[5:57]
raise any other safety concerns.
[6:00]
Um,
[6:03]
as part of the memo, there were certain
[6:05]
exhibits that were um added to that. So,
[6:07]
you have a copy of the subdivision plat,
[6:10]
the specific survey for the subject
[6:12]
property. I put in there the septic
[6:15]
permit that shows where that septic
[6:17]
system is. Um, the pickle ball pickle
[6:20]
ball court sketch that was provided by
[6:22]
the applicant, some site pictures, and
[6:25]
just a comparison of the sizes. If
[6:27]
you're unfamiliar with pickle ball and
[6:29]
what the size of that kind of court is,
[6:31]
there's kind of a a a simple comparison
[6:34]
of sizes um in that. Um,
[6:38]
as uh if depending on how you all uh
[6:43]
vote on this, we would uh the staff
[6:46]
would recommend that any approval
[6:48]
clearly state that the variance applies
[6:50]
solely to the use of the area as a
[6:53]
pickup court or some sort of
[6:54]
recreational
[6:56]
uh court. The slab shall not
[6:59]
subsequently be used in whole or in part
[7:02]
as a foundation for any rod or enclosed
[7:06]
structure without obtaining a
[7:08]
modification to the variance and all
[7:10]
other required county approvals. So the
[7:13]
idea is that we don't want it to set a
[7:15]
precedent to be used to create something
[7:18]
that would be more non-conforming or
[7:22]
than than it already would be basically.
[7:24]
Um that is it. Um, if unless you have
[7:28]
any questions for me, Mr. Zero is here,
[7:30]
of course. So,
[7:31]
>> you have any questions for Miss Prudin?
[7:33]
» you have any questions for Miss Prudin?
[7:33]
Well, Miss I don't have anything.
[7:35]
>> Nope.
[7:35]
» Nope.
[7:35]
>> All right. Then I guess we'll open up a
[7:37]
» All right. Then I guess we'll open up a
[7:37]
public hearing. Excuse me. Would you
[7:40]
care to come up and speak? And if
[7:43]
[clears throat] you have something, you
[7:44]
don't have to, but
[7:45]
>> Well, Miss Puit did an excellent job
[7:47]
» Well, Miss Puit did an excellent job
[7:47]
explaining the vision. And again, thank
[7:50]
you. You're
[7:51]
>> welcome.
[7:53]
» welcome.
[7:53]
Questions. Does the board have any
[7:55]
questions?
[8:00]
» Right.
[8:08]
» No, I'm good, too.
[8:09]
>> All right. Anybody online?
[8:15]
» No, sir. One person that's attending,
[8:18]
but they're not raising their hands.
[8:19]
>> All right. Thank you, sir.
[8:21]
» All right. Thank you, sir.
[8:21]
>> I I do have I do have one question.
[8:23]
» I I do have I do have one question.
[8:23]
Neighbors,
[8:24]
>> you mind coming up to the podium,
[8:25]
» you mind coming up to the podium,
[8:25]
please? Yes, sir.
[8:27]
>> Oh, I thought it was.
[8:28]
» Oh, I thought it was.
[8:28]
>> Sorry about that.
[8:30]
» Sorry about that.
[8:30]
>> Neighbors, have they had any complaints?
[8:33]
» Neighbors, have they had any complaints?
[8:33]
Have they raised any concerns?
[8:35]
>> No. No, sir.
[8:36]
» No. No, sir.
[8:36]
>> Okay,
[8:38]
» Okay,
[8:38]
>> that's all I
[8:39]
» that's all I
[8:39]
>> Yeah, we have not received any um any uh
[8:42]
» Yeah, we have not received any um any uh
[8:42]
comments or complaints or about this
[8:44]
application.
[8:46]
>> All right, I thank you. Okay,
[8:49]
» All right, I thank you. Okay,
[8:49]
>> I'll close this uh session
[8:50]
» I'll close this uh session
[8:50]
[clears throat] of the open session and
[8:52]
I guess we'll you have questions. We'll
[8:55]
discuss it. Motion.
[8:58]
>> Yeah. My only concern was the um septic
[9:03]
» Yeah. My only concern was the um septic
[9:03]
area in Greenfield, but I don't think
[9:04]
it's going to inhibit that at all.
[9:07]
>> So,
[9:11]
I don't I don't see an issue.
[9:15]
>> And I guess you did understand. Yeah, I
[9:17]
» And I guess you did understand. Yeah, I
[9:17]
I did an added survey on my septic tank
[9:20]
on my septic system and and and outline
[9:24]
where this where my endpoint is because
[9:26]
certainly I don't want my septic tank be
[9:28]
compromised and I got that from WC Lowry
[9:32]
and that will be my guidance on that. So
[9:35]
make sure that does not impede my septic
[9:38]
because that impacts [clears throat] me
[9:40]
as well.
[9:40]
>> Right.
[9:42]
» Right.
[9:42]
>> I just that's my biggest fear,
[9:45]
» I just that's my biggest fear,
[9:45]
>> right? And this will not go forward
[9:47]
» right? And this will not go forward
[9:47]
until you know re recheck it again and
[9:51]
again again.
[9:53]
>> Understood.
[9:54]
» Understood.
[9:54]
>> Because I can't afford that.
[9:58]
» I have one thing to add if you don't
[9:59]
mind, Mr. Chairman. Um just for your
[10:03]
information as well. So when I was doing
[10:05]
some of the research, there is of course
[10:07]
you've got a utility line that's going
[10:09]
across the front.
[10:10]
>> Yes.
[10:10]
» Yes.
[10:10]
>> Um it's an older utility easement. Um,
[10:14]
» Um it's an older utility easement. Um,
[10:14]
so in some of those older documents,
[10:16]
they don't really specify a width. It
[10:19]
just says that, you know, where the line
[10:21]
is. Um, since we're really tight, just
[10:24]
for, you know, just make sure that
[10:26]
you're back far enough. I I don't think
[10:28]
there's a specific width that it it is,
[10:31]
but just in case if you know, I don't
[10:34]
know if it's Northern Neck Electric or
[10:36]
>> It's Northern Neck Electric and my goal
[10:38]
» It's Northern Neck Electric and my goal
[10:38]
is the inside of that.
[10:39]
>> Okay. Yeah. just in case they have to
[10:41]
» Okay. Yeah. just in case they have to
[10:41]
come back.
[10:42]
>> I don't want any electrical issues,
[10:43]
» I don't want any electrical issues,
[10:43]
>> right? Yeah.
[10:44]
» right? Yeah.
[10:44]
>> Be inside of that.
[10:45]
» Be inside of that.
[10:45]
>> Be aware of that.
[10:45]
» Be aware of that.
[10:46]
>> Mhm.
[10:46]
» Mhm.
[10:46]
>> Most definitely.
[10:47]
» Most definitely.
[10:48]
>> If there's nothing else, I entertain a
[10:49]
» If there's nothing else, I entertain a
[10:49]
motion.
[10:55]
» May I make a motion to approve?
[10:56]
>> It's a motion floor to approve. Is there
[10:58]
» It's a motion floor to approve. Is there
[10:58]
a second?
[10:59]
>> I second.
[11:00]
» I second.
[11:00]
>> Any further discussion?
[11:02]
» Any further discussion?
[11:02]
>> I'm going to
[11:05]
post.
[11:06]
>> I'm opposed.
[11:07]
» I'm opposed.
[11:07]
>> You're opposed?
[11:08]
» You're opposed?
[11:08]
>> Yes. How' you vote in favor?
[11:11]
» Yes. How' you vote in favor?
[11:11]
>> So 3 to one.
[11:16]
» Sorry.
[11:17]
>> I guess it's got it then.
[11:19]
» I guess it's got it then.
[11:19]
>> Okay. Thank you for the feedback.
[11:19]
» Okay. Thank you for the feedback.
[11:20]
>> You were aware of what Miss Puit had
[11:21]
» You were aware of what Miss Puit had
[11:21]
read that it's just to be used as
[11:23]
>> Yes, sir. No doubt.
[11:25]
» Yes, sir. No doubt.
[11:25]
>> There's no
[11:26]
» There's no
[11:26]
>> unless you come back to the county and
[11:27]
» unless you come back to the county and
[11:27]
ask me to do something.
[11:28]
>> I don't need any more. Yeah. No more
[11:29]
» I don't need any more. Yeah. No more
[11:29]
buildings. No, sir. I don't No
[11:31]
intention.
[11:32]
>> All right. Thank you.
[11:33]
» All right. Thank you.
[11:33]
>> Appreciate the feedback. Thank you.
[11:35]
» Appreciate the feedback. Thank you.
[11:35]
>> Thank you.
[11:44]
There's not anything else coming up.
[11:46]
>> Um, BCA wise, no. Um, we don't have
[11:51]
» Um, BCA wise, no. Um, we don't have
[11:51]
anything on the horizon.
[11:52]
>> Okay. And as far as the planning
[11:54]
» Okay. And as far as the planning
[11:54]
commission, there was no meeting last
[11:56]
month, but this meeting is still on the
[11:57]

[12:01]
