[2:59] » So, thank you for the warm welcome. Um before I get into my other comments, I

[3:03] just wanted to take a moment just to thank the board, county staff, and

[3:07] everyone in the community um for such a warm welcome. Um, last Monday was my

[3:11] first day, so um, just getting full into the swing of it. And I just thank you

[3:16] for the warm welcome. Um, for those that may not know me or haven't gotten the

[3:20] chance to meet me in person yet, um, I grew up just next door um, in Palatine

[3:25] County on the western side um, on a farm. Um, so very used to the rural

[3:30] lifestyle. Um, and I have a background in local government administration and

[3:34] community development. Um, so I'm just grateful for the opportunity to now

[3:38] serve in Forley County, um, and serve, um, the community as county

[3:43] administrator. So, um, I'm excited to be here and I look forward to working with

[3:47] the board, our staff, and the community. So, thank you. Um,

[3:54] okay. Um, so I would like to congratulate Sierra Morris, um, our

[3:58] chief deputy clerk of the circuit court, on being our August employee of the

[4:03] month. Uh Sierra has served in the clerk's office since 2021 and was

[4:08] promoted to chief deputy clerk in December 2025. She is recognized for her

[4:15] strong work ethic, extensive knowledge, and willingness to assist both her

[4:18] co-workers and the citizens of Cumberland County. So, congratulations,

[4:22] Sierra, and thank you for all that you do for Cumberland County. Um, next I

[4:28] have the Cumberland County uh animal control team has received the Nokill

[4:32] Award from the Best Friends Animal Society. This recognization reflects the

[4:38] dedication, compassion, and the tireless work of our shelter staff, volunteers,

[4:42] and community partners that we have. um receiving this designation and

[4:47] maintaining that no kill status means that 90% or at least 90% of the animals

[4:53] entering the shelter are saved and placed into loving homes. So great work

[4:58] to our animal control team and partners on that. Um and the next update that I

[5:03] have is for the um stars project. I have an update on that. So the Virginia State

[5:10] Police representatives met with county staff to discuss the stars project. the

[5:15] radio communications tower um behind dispatch is scheduled to be assembled

[5:20] next week. Um so st stood up with um the VSSP installers on site and a crane

[5:28] arriving August 18th through the 19th. They're just pinpointing that um

[5:31] specific date. So um you can expect to see that tower going up. Um VSSP is

[5:36] hopeful that Cumberland County will be fully transitioned to the system by the

[5:41] end of the calendar year. So that's exciting news. Um over the coming n

[5:45] months we will be working with VSSP to equip our vehicles and apparatuses as

[5:50] well as dispatch with any um necessary radio equipment and training will also

[5:55] be provided during that um part of the transition. So and then lastly um we

[6:00] have Darren Hurley our coordinator of emergency services and he has an update

[6:04] on the Persville Fire Department he held Darren come up.

[6:12] Thank you. I just wanted to update the board real

[6:17] quick about the helipad location at Carsville Volunteer Fire Station. You

[6:22] got a slide for me, please. >> Oh, sorry.

[6:25] » Just to be mindful that September 12th is the ribbon cutting ceremony for that.

[6:30] I feel like this is a um a milestone achievement for Cumberland County having

[6:34] this as the first helipad location is safe for medevac services to respond to

[6:39] the county. It's going to be stationed right behind the Carsville Fire Station

[6:44] and um no taxpayer money was involved in any of this project. It was all private

[6:48] donorship um from people participating uh to coordinate all this. A lot of

[6:54] volunteer work. So I just had a couple slides here real quick just to show you

[6:58] drone footage of what um it looks like as you approach it. It's 50 by 50 cement

[7:04] pad. There'll be some markers for it. the top right of the screen, the red top

[7:08] is the fire station. The road that you see in the middle of the screen is route

[7:13] 45 cars road. And then you see the cement pad there. So [clears throat]

[7:18] here's a zoomed in picture overhead.

[7:24] This is as of last week.

[7:30] And there will be also be some approaches to it for our ambulances to

[7:34] pull up to offload the patient into the helicopter. Then the helicopter leaves

[7:40] the scene. It'll be GPS marked so that the helicopter knows where we're going

[7:45] ahead of time. And again, that's going to be a ribbon cutting ceremony is going

[7:49] to be on September 12th at 11:00 a.m. We would ask that as many of you could

[7:54] attend that. It'll be brief. There'll be some late refreshments afterwards.

[7:59] If we're lucky, we can get the state police helicopter to land there as a

[8:03] demo. I've already asked them to come, provided that they're not going to be

[8:06] committed to another call. They have a 70 mile radius response based out of

[8:10] Chesfield County. Their plan will be in there. That's pretty impressive to see

[11:13] Thank you. Next is state and local department agencies community service

[11:18] provider reports starting with Dr. Shores County Public Schools.

[11:27] » Good evening. Um thank you for the opportunity to share what's been going

[11:31] on in the schools. Um the first slide I have for you is band. So our band

[11:36] students came in for one week in that awful heat. Um and from 9 9:00 am to

[11:42] 5:00 pm they worked every day getting prepared for the upcoming school year.

[11:46] So band camp was a tremendous success this year. Uh we are also excited to

[11:51] kick off fall sports. Um we have a new coaching staff this year at the high

[11:54] school and the pictures you see there are of the camp that they held for the

[11:58] Cumberland Youth League Association uh football players. So that was a great

[12:03] time. But we have um football, volleyball, cross country, golf, and

[12:07] cheerleading are all started right now. Um and we're really excited about the

[12:11] upcoming season. There's a renewed energy among our students. And then of

[12:15] course, first day of school, but leading up to that, we had convocation on July

[12:19] 29th. Um this year's theme for our school division is write your own story.

[12:24] It's a new chapter in Cumberland County Public Schools. And for each of those

[12:28] students who are pursuing the skills that they need to be successful, our

[12:32] convocation speaker this year was Mr. Larry Pew from Newcastle, Pennsylvania.

[12:37] Um he shared his personal story. He spoke about um his education and as he

[12:43] described it, he had five elementary teachers who saved him. He is a third

[12:48] generation removed from slavery. He moved to Pennsylvania as part of the

[12:52] great migration and would travel back to Georgia every summer to visit his

[12:56] grandfather who was a sharecropper. So it was a conversation about how

[13:01] education saved him from from the plight that a lot of students faced at that

[13:06] time um and how they motivated him and that's what I wanted the teachers to

[13:10] hear was how what we do impacts our students every day. Um he's a 19 in

[13:17] addition to all of that so overcoming everything in 1998 inductee into the

[13:21] college football hall of fame and was drafted by the Cleveland Browns after an

[13:25] injury ended his football career um he chose to pursue a career in education

[13:29] and did that for almost 30 years. So it's a powerful reminder of the lasting

[13:34] impact that education can have on our students whether it's directly or

[13:39] indirectly. So that was an important thing and I've gotten a lot of positive

[13:42] feedback from the teachers. They said, "Don't spend a lot of money on a

[13:45] motivational speaker. We'd rather hear someone that keeps it real." And so,

[13:49] that's what we're going to take forward from that. Um, we [snorts] had open

[13:53] house that Monday. Um, it went really well. We had a lot of people show up,

[13:58] probably more than I've seen in the past. Um, it was standing room only in

[14:02] the hallways in the parking lot of the school. So, a lot of community

[14:06] outpouring and a lot of community participation. And I just hit something.

[14:10] So, I don't know what I did. Go ahead and fix that. Tiana, sorry.

[14:15] But the first day of school, um, we had a real smooth transition. We are working

[14:19] on some traffic flow concerns down at the elementary school. That just seems

[14:22] to always be a trouble spot, but we have a lot of parents that drop off their

[14:25] kids the first day. Um, and at the end of this school year, we're going to be

[14:29] looking at a potential solution to that problem. I spoke with Sheriff Hodes the

[14:33] other day, and he gave me a couple of suggestions we're going to look at. Um,

[14:37] we have some campus improvements going on. um the elementary school roof. We

[14:42] are excited to say that the estimates that we had been given of 450,000 or 1.4

[14:50] million to put metal on were inaccurate or at least not even close to what it

[14:54] was going to cost. So the contractor that won the bid said about 289,000 to

[15:00] reshingle the roof um to do metal was 625,000.

[15:05] um that we reached out to Miss Cruz and of course the county budgeted 500,000

[15:09] for that um the school we are going to work and rearrange our budget to put

[15:14] metal in that roof. It's an investment in longevity and it will prolong the

[15:19] life of that building so that we are not so close to having to replace a building

[15:24] as we would potentially be otherwise. So um that is we're excited to have that

[15:29] start. Unfortunately, it will be taking place during um instruction. And so

[15:34] we're going to phase it in a section of the front at a time. So we'll start at

[15:37] the far end towards the practice football field and as we complete one

[15:41] section move to the next. Um you know and that is with replacing some damaged

[15:46] roofing material under those shingles from the years that we've been waiting

[15:50] to replace that roof. Some of the the materials under there had rotted. So so

[15:54] they're having to replace a lot of that plywood stuff too. So but that will be

[15:58] starting in the near future. Um, also we've put um some smaller bleacher

[16:05] sections over on the visiting side of the football field because we've

[16:08] typically have to move them from baseball, softball to football or back

[16:11] again. Um, and with that new track surface, that's not good for that

[16:15] surface. So, we've purchased bleachers to put on the visitor side of the

[16:18] football field. Um, our maintenance staff is putting those together this

[16:22] week. um an exciting um well for me exciting uh new program we're doing at

[16:29] the schools. I have asked our central office staff to spend 20% of our time in

[16:34] schools. So um for instance today Dr. Jameson went down and read to students

[16:39] at the elementary school. Um yesterday I subbed in a classroom. Today I went in

[16:44] and helped administration with some classroom observations. I know m Dr. Hoy

[16:48] is going to be going in and covering some classes and doing some things. So,

[16:51] we're all going to spend some time and support our staff and our students

[16:54] because if we're not their sleeves rolled up and in the trenches with them,

[16:59] we're not relevant to what's happening in our schools. So, that's a real big

[17:02] focus for us this year. Um, I have monthly radio spots coming up. I just

[17:08] wanted to make you aware. Um, the third Tuesday of every month at 9:00 a.m. I'll

[17:12] be on WBHL and the third Wednesday of every month at 8 a.m. I'll be on WFO.

[17:17] So, just tune in and you can hear what's going on in the schools. Um, we had our

[17:22] first meeting to plan our 911 remembrance ceremony. I think the

[17:25] meeting went really well. We're going to revisit that about two weeks

[17:28] [clears throat] prior to that event. Um, and Mr. Early has sent some information

[17:32] about, you know, maybe potential lineup setup so that it can be um not only

[17:38] aesthetically pleasing for our drone person that's going to take pictures,

[17:41] but also practical in case there's an emergency and our our first responders

[17:45] need to need to get out of there. So, I hope you all will mark your calendars

[17:49] and plan to attend. That'll start about 9:00 on the 11th of September. We'll see

[18:11] Brian would be here. He's uh doing an acting role in Halifax. So he'll be back

[18:16] in about 90 days. So until that time, you're stuck with me. Um but I'll try my

[18:22] best to take good care of you. Serve you well. Um, I wanted to start off my

[18:28] presentation. Hopefully I hit the right button. There we go.

[18:32] Uh, by saying thank you, uh, the Cumberland County School Board. I don't

[18:36] know if they're still here. They recognized our area headquarters in

[18:39] Cumberland this last week. Uh, with a certificate of appreciation, I think you

[18:45] call it. U, they recognized the headquarters. Uh, it said on the comm

[18:51] said on the certificate, I put it on the screen here. uh for demonstrating

[18:56] commitment to safety by ensuring roads remain clear and passive throughout the

[19:00] winter, enabling students and staff to travel safely to and from school. Uh so

[19:05] that meant a lot to the area headquarters. Last winter was a hard

[19:08] winter. Um and they did a great job keeping the roads clear, but everybody

[19:12] was looking forward to spring. So [laughter]

[19:15] uh but that meant a lot to them and and us as well. Thank you to the school

[19:19] board and all our county partners for for that.

[19:23] Um, as far as general maintenance goes, uh, we've been focused on asphalt

[19:28] patching, uh, throughout the county. Um, which I, to me, patching can I consider

[19:34] that filling with your average pothole, but we did a lot of work with the PA

[19:38] specifically on route 600, 620, and 641, which is River Road, Stone, and Point

[19:44] Mill Lanes, and then Sims Road. Put down approximately 2,000 tons of asphalt on

[19:49] those three roads. Um, so that's kind of in addition to our normal pothole

[19:54] patches. Um, we've been mowing continuously. It seems like the rain and

[20:00] the sunshine has made the grass uh start to take off and really thrive later in

[20:05] the year. This spring was pretty easy to handle, but we had to just keep our

[20:08] mowers going to keep slight distance, especially in the secondary. So, watch

[20:13] out for our mowers. Um, but then also fallen trees. A lot of these storms have

[20:19] uh had a lot of straight line winds with them this year. Um, just yesterday we

[20:24] had a pretty heavy storm come through about 5:00 and the headquarters worked

[20:29] into the night. I have on here that they handled three and it turns out that was

[20:33] three work orders, but our call center actually got uh like kind of overwhelmed

[20:38] with calls. So, there was a lot more than three trees that they took care of.

[20:41] So, I don't want to short change them by saying that they just did three uh

[20:45] yesterday. As far as plan work goes, our paving schedules, our surface treatment

[20:50] schedules wrapped up, but we still have the plant mix resurfacing to do. Uh

[20:55] there's three sections on Route 45. One of them down in the town of Farmville

[21:00] head north and then we got two more sections on 45 uh between Route 60 and

[21:05] the roundabout. We're going to catch some of those bad areas with the stream

[21:08] schedule work and then also some plant mix resurfacing on Route 600 plank

[21:13] route. to just as far as miscellaneous items

[21:18] goes, there's been some speed studies requested in the county. One of them was

[21:23] Route 45 from [snorts] 4/10 of a mile south of Morgan Road to about a/4 mile

[21:29] north of Perkins Road. Uh it was requested by a citizen. Study is

[21:34] complete and traffic engineering did not end up making any recommended changes to

[21:38] the speed limits there. Uh there's a second study that's been requested um on

[21:44] 45 as well from Davenport to road to Route 60. That one's still under review.

[21:49] I don't have that effect. So when it comes back, I'll let you but I'll wrap

[21:53] up just by seeing if the board has any questions.

[21:56] » I just have to comment and I was fortunate to comment on your last study

[22:01] that you listed u there was an accident with a death there within the last

[22:06] couple of weeks. Yeah, that one was very tragic.

[22:11] I just know it's a timing issue when it gets into your database, but very

[22:36] Forestry. Uh good evening. My name is Todd Sty. I

[22:41] work at Virginia Department of Forest and I'm I'm the forest manager here at

[22:45] Conland State Forest and that's the reason visit this evening. Uh I'll try

[22:49] to keep my comments fair and brief. U the Cland State Forest is about 16,000

[22:55] acres. That's all of it except about 200 acres is located in Carlin County. And

[23:01] I'm sure you're aware being that it's state land, we're not subject to real

[23:04] estate taxes. But the state code does provide that 25% of the timber sales,

[23:11] the the money that we receive from timber sales turn back to the county

[23:14] that the timber is growing in. There is an exception with Buckingham Mathematics

[23:18] and Cumberland counties. There's an agreement that 12% of that 25% would

[23:24] come back to the Department of Forestry to be used for recreation purposes or

[23:29] those sports. Uh so the purpose of my visit tonight is to give you the county

[23:34] uh check in the total of $24,46327

[23:39] for that 12.5% for fiscal year 2025 2026. So with that

[23:50] and if you have any questions I'll be glad to answer those.

[23:54] Do >> you have an update on uh swinging bridge

[23:57] when that might restart? So yes, uh that's that's on Warner Road

[24:02] and we are in the process of going through the approvals. Uh as far as we

[24:07] can tell, we have all the permits as you can imagine fair commerce process to get

[24:11] all the permits and plans and so we hope to have contractors working on that

[24:17] sometime this fall. So >> Okay, good.

[24:19] » We're closer than what we were, but still undetermined exactly when the

[24:23] finish line is is going to be passed. >> Okay, good. Thank you.

[24:26] » We are working on it and it's and been in talks with contract

[24:40] Department

[24:43] remodel campsites. [clears throat] That's on my list.

[24:47] » Good evening. >> So, in front of you, I just uh gave you

[24:51] a park sheet. You want to give some some rough numbers of what we do at the park.

[24:56] Um questions you have with those. But um as a board member mentioned uh the last

[25:02] few years have been or you know with the park has been construction and

[25:06] renovation. Um in the last five years I'd estimate that um BCR has invested

[25:13] about $4 million into the park in infrastructure improvements. Um starting

[25:18] with [snorts] you know Chestnut bath house renovation

[25:21] was pretty old bath house. Um they they've totally redone that. It's pretty

[25:25] nice. uh facility now and as you mentioned last year our campground was

[25:30] closed. We had all the utilities in the campground replaced and upgraded. Uh we

[25:34] had a old water system, an old electrical system serving the

[25:37] campground. Now we have large RV utilize 50 amp service which prior to that we

[25:44] only had the 30 amps available for for the bigger new and also a new dome

[25:49] station which we're pretty happy because our old dome station was in a very bad

[25:53] spot right beside the contact station and the smell of Sunday was uh very

[25:58] pungent check. So we're glad to have that. Uh it's very nice facility and um

[26:04] should serve you know citizens and guests coming very well. And recently

[26:09] we've repaved our campground roads. Another great project. Uh those roads

[26:14] needed repaving a long time ago and get that done. So and lastly we also

[26:20] had a bunch of cabin renovations. Uh new flooring uh kitchen and countertops and

[26:25] sinks. We put marble on the kitchen countertops and sinks. It really looks

[26:29] nice and should last a long time with, you know, less maintenance costs.

[26:35] And next, uh, coming up, we're getting ready to re remodel our other bath house

[26:40] in the campground uh over in Acorn Loop, which is next to the office. Uh, so

[26:44] that'll be two two, you know, pretty much brand new bath houses for our

[26:48] campground. And so, we're really looking forward to that.

[27:42] 27. That's just due to the transition in budget years. So, next month in your

[27:48] budget, in your board packet, you will see two reports um that will include um

[27:53] July and August, and they will be your low numbers. But if you have any

[28:28] Virginia Code section 15.2-2506 does require a local governing body to

[28:35] rate funds prior to any expenditures being paid. At the April 21st Board of

[28:40] Supervisors meeting, the school for year 27 budget was adopted in the amount of

[28:45] 44,56,651.

[28:50] At the June 9th Board of Supervisors meeting, the board approved the 2027

[28:54] appropriations totaling 42,851,658. [clears throat]

[30:46] have revenue that will be coming in that will reimburse the general fund for

[30:50] those funds. It's just the timing of that revenue actually coming in. So

[30:54] you'll see those during the approval process and then in the financial

[30:58] statements that Robinson farmer tax presents to you uh in December.

[31:45] report for the month of July, which can be found on pages 36 through 41 of your

[31:51] board packet. I also provided a copy of the PowerPoint

[31:56] from the planning commission meeting last night. It's just kind of a summary

[32:00] of the report that's in your packet. So, for the planning department for July,

[32:05] there were four subdivisions approved with 52 pending, six um plats that were

[32:11] approved with 47 pending, a total of 27 zoning permits that were approved, six

[32:18] residential land disturbance permits, zero commercial ENS, and zero

[32:23] conditional use permits or resonings that were approved. However, we do have

[32:28] a public hearing for you tonight for a conditional use permit. So that will

[32:32] change next month. On the back side of that, I do also

[32:36] provide the planning permission. Um so I will provide that also for you guys. The

[32:40] copy of the building inspections department monthly report. Um they

[32:45] approved, I'm sorry, permitted 16 new homes, seven commercial permits, 94

[32:50] other permits, and issued six certificates of occupancy. There were

[32:54] total fees collected over $19,000 with a total estimated value of the new

[33:00] construction of over $4 million. Also

[33:04] wanted to let the board know that at the July meeting um at the end of the

[33:11] meeting there was one resident who spoke to the commission and suggested that the

[33:17] two minimum 2 acre minimum lot size in the agricultural zoning district plays a

[33:23] large role in the overdevelopment of the county. and one of the commissioners

[33:27] made a motion to make a recommendation to the board that you consider

[33:32] increasing that minimum lot size in the A2 zoning district from 2 acres to 5

[33:37] acres. Um I did miss the deadline to include that memo in your packet this

[33:42] evening. So I did want to bring that up to you and let you know that that will

[33:44] be forthcoming. I do plan to have a memo in your packet next month. However, I

[33:50] did want to also suggest the potential for a joint workshop between the board

[33:55] and the planning commission. That way, we can all gather around and discuss

[33:59] this. I know that this topic has been brought up um a few different times by a

[34:05] handful of people. Um so, I feel like a workshop would be beneficial for

[34:10] everybody to get around the table, [clears throat] discuss the concerns and

[34:14] the potential for ways to potentially mitigate that. Um, as staff, my concern

[34:21] with that would be the issue of family subdivisions and the ability of

[34:26] residents to be able to provide their family members with land um at their

[34:32] homestead. Uh we do have a resoning request that will be coming to the

[34:37] planning commission soon for a property owner in Carterville who has just over 9

[34:41] acres and his property is zoned R3 where the minimum lot size is 5 acres. And so

[34:48] currently he cannot give his grandchild a 2acre tract of land. So he is

[34:53] requesting a reszoning from the RH reszoning district 2A2 to allow him to

[34:59] give his family member 2 acres of land to be stay close to home. So that is the

[35:04] concern that staff has with this potential. I do feel like there may be a

[35:09] way to work through this together with both groups and to find common ground,

[35:15] but I feel like that would be best suited with a workshop. So, the planning

[35:20] commission does have a workshop schedule for November 9th [clears throat]

[35:24] of this year. So, I'm hoping that maybe we can work together and potentially

[35:29] have a joint workshop that day um to discuss this potential um code amendment

[35:35] as well as any other items that may come up.

[38:59] the end of this calendar year. Staff is requesting that the board appoint Mr.

[39:03] Meadows to a three-year term to the commission as the district 5

[39:08] representative with a term commencing September 1st and expiring August 31st.

[39:14] If the board does agree and appoint Mr. Meadows as the district 5

[39:18] representative, then the vacancy on the commission will now become an atlarge.

[39:23] Staff has received numerous volunteer applications and the commission has

[39:27] vetted those applications. Based on the feedback from the

[39:31] commission, staff recommends that the boy board appoint Shawn Michael Reed to

[39:35] the commission to serve the unexpired term of Mr. Meadows, which is set to

[39:40] expire December 31st of this year. And staff will also request a reappoint of

[39:45] Mr. to read at the December 2026 meeting of the board. So, it's two twoprong

[39:52] request. We do want to request that the board appoint Mr. Meadows to a

[39:58] three-year term as the district 5 representative. And then, if that motion

[40:03] passes, then staff would request the board appoint Mr. Michael Reed to the

[40:08] commission to serve the unexpired term of Mr. Meadows, which would expire

[40:13] December 31st of this year.

[41:59] » Next item. M is the RFP for emergency services staff and Miss M. Cruz.

[42:03] » Yes. So on March 20th, the board of supervisors approved a short-term

[42:07] contract with Emergency Services Solutions for staffing of their rescue

[42:11] supplies. This contract did allow staff time to issue a request for proposals

[42:16] for long-term services. On June 9th, the RFP was released. The solicitation

[42:22] required offerers to provide two staffing scenarios. The first one was

[42:27] for one 24-hour crew that would be staffed at station one along with one

[42:33] 12-hour crew that would rotate between stations three and four. This scenario

[42:38] is our current staffing model as you all know. Alternatively, the offer was to

[42:43] include staffing costs for two 24-hour crews with one crew remaining at station

[42:48] one and the other 24-hour crew would rotate between stations three and four.

[42:54] The proposals were due on July the 23rd and there were two responsive proposals

[42:59] received. The first was from emergency services solution. It's for scenario one

[43:05] which was the 24hour plus the 12-hour crew. It was $1,182,600

[43:12] annually. For the two 24hour crews the cost was $1,576,800.

[43:20] The second proposal for the 12-h hour and the 24h hour was $1,419,120.

[43:29] For the two 24hour cruise, it was $1,892,160.

[43:38] Emergency services solution also provided an optional service pricing for

[43:43] their staff to assist Mr. Hurley with managing the drug boxes. As previously

[43:48] discussed, the unfunded mandate for requiring local governments to absorb

[43:53] the cost and responsibility of the drug boxes has had a significant impact on

[43:58] staff time and budgets. ESS has priced this service at $1,000 per month,

[44:05] $12,000 in ESS has previously contracted with the

[44:11] county for emergency services staffing and has been our contractor since March

[44:15] of this year. staff has been pleased with their level of service. Therefore,

[44:20] Mr. Hurley and I recommend the board to approve the contract with Emergency

[44:24] Services Solution for an annual amount of 1,194,600.

[44:30] This would include the staffing of ASL ALS providers for one 24-hour crew and

[44:37] one 12-hour crew, as well as the add-on cost for the drug box management

[44:42] services. staff is working to provide the board with the data support to

[44:47] 24-hour crews and the ability to offset some of that expense with cost recovery

[44:53] measures. We will report back to the board in the next few months with that

[44:57] information.

[45:00] I'll be glad to answer any questions that you have. You do have a copy of

[45:05] that contract. There is one change under the term of the contract and that's

[45:11] found um on page five um under term of contract um and we have agreed along

[45:19] with ESS that that agreement will renew automatically without an additional

[45:26] written agreement needed and that will be at a max of 5 years. That will not

[45:31] change.

[48:05] adopted by the governing body, it shall control the general or approximate

[48:10] location, character, and extent of each feature shown on the plan. Thereafter,

[48:16] unless a feature is already shown on the adopted master plan or part thereof, or

[48:21] is deemed so under subsection D, no street or connection to an existing

[48:26] street, park, or other public area, public building, or public structure,

[48:30] public utility facility, or public service corporation facility other than

[48:35] a railroad facility, or an underground natural gas or underground electric

[48:38] distribution facility of a public utility is defined in subsection B of

[48:43] 56- 265.1

[48:46] within its certified service territory whether publicly or privately owned

[48:51] shall be constructed, established, or authorized unless and until the general

[48:57] location or approximate location, character and extent thereof has been

[49:01] submitted to and approved by the commission as being substantially in

[49:05] accord with the adopted comprehensive plan or part thereof. um part of the

[49:12] Dominion um proposed Dominion uh Cumberland uh

[49:19] energy center project uh part of their cup application um asked that the plan

[49:24] committ or that the county um basically says that it's substantially in accord

[49:31] uh with that area when it comes to comprehensive plans. So when they

[49:34] submitted their application um that gets to part B and why I feel that we should

[49:40] adopt this resolution. Um they submitted their application on uh I believe it was

[49:46] June 26th that we received the application. Um staff reviewed it and

[49:52] deemed it complete on July 7th. Um but the the verbiage in the code is a little

[49:59] am there's a little ambiguity there um because it states in section B the

[50:05] commission shall communicate its findings to the governing body

[50:08] indicating its approval or disapproval with written reasons. Uh therefore the

[50:13] governing body may overrule the action of the commission by a vote of majority

[50:17] of its membership. I'm sorry I read the the wrong section. Um the the code

[50:22] states that that um oh I'm sorry yes the governing body

[50:27] may overrule the action of the commission by a vote of the majority of

[50:30] its membership. Failure of the commission to act within 60 days of a

[50:34] submission unless the time is extended by the governing body shall be deemed

[50:39] approval. So what's a little uh ambiguous is

[50:45] when does the clock start? Does it start the moment that they submit the

[50:49] application or does it start when the county has deemed it a complete

[50:54] application and the code is not specific in that regard. So I feel to be safe to

[50:59] allow uh the commission since they set their public hearing for August 31st

[51:06] if you go about 60 days from the date of the application being submitted that

[51:12] expires August 25th. So, the public hearing would take place after the 60

[51:17] days if you weren't to interpret it that way. And I just feel that uh to make

[51:22] sure there's there's uh no discrepancies there and to safeguard the county to

[51:27] make sure that our planning commission is actually um voting with substance and

[51:33] not a de facto approval because they didn't act in time. There's a legal um

[51:40] loophole there or something. I feel that we should adopt this resolution

[51:43] extending uh the commission's time which the statute authorizes the local

[51:48] governing body to do until September 30th to give them time to have their

[51:52] public hearing. If they're uh need time to set a a follow-up hearing or

[51:57] something, they they would still fall within that September 30th deadline that

[52:00] we can set. >> Okay.

[52:03] Um, District One supervisor, I'm going to ask that you read the resolution

[52:38] CUP26-03 concerning the proposed Cumberland

[52:43] Energy Center, a proposed public utility generating facility in Cumberland

[52:48] County, Virginia. And whereas Virginia Code 15.2-2232 2-2232

[52:53] requires the construction or establishment of public utility

[52:57] facilities or public service corporation facilities to be submitted to the local

[53:01] planning commission for a determination as to whether the general or approximate

[53:06] location character and extent of the proposed facility are substantially in

[53:10] accord with locality's adopted comprehensive plan. And whereas Virginia

[53:15] code 15.2-2232 2-2232 section B provides that the planning

[53:20] commission shall communicate its findings to the governing body

[53:24] indicating its approval or disapproval with written reasons therefore and

[53:29] further provides that failure of the planning commission to act within 60

[53:33] days of a submission unless the time is extended by the governing body shall be

[53:38] deemed approval. And whereas the Cumberland County Planning Commission is

[53:42] presently scheduled to conduct a public hearing concerning CUP 26-03

[53:48] and the associated review under Virginia Code 15.2-2232

[53:54] on August 31st, 2026. And whereas the board of supervisors

[53:59] believes that a project of the size, scope, and potential impact upon

[54:03] Cumberland County should receive full and deliberate consideration by the

[54:07] planning commission, and that the commission's determination should be

[54:12] made affirmatively upon consideration of the evidence and public input rather

[54:17] than be expedited by operation of a statutory time period. And whereas the

[54:23] board desires to ensure that the planning commission has sufficient time

[54:26] to conduct its public hearing, consider information submitted by the applicant,

[54:31] county staff, consultants, governmental agencies, and members of

[54:35] the public deliberate upon the matter and make an affirmative determination

[54:40] pursuant to Virginia Code 15.2-2232. And [clears throat] whereas by adopting

[54:46] this resolution, the board makes no determination regarding the date upon

[54:51] which the application or or request for review was legally submitted to the

[54:56] planning commission for purposes of Virginia code 15.2-2232

[55:01] and expressly reserves all positions of the county concerning the com

[55:05] commencement or calculation of any statutory review period. Now therefore,

[55:11] be it resolved by the Board of Supervisors of Cumberland County,

[55:14] Virginia, that pursuant to Virginia Code 15.2-2232B,

[55:19] the time within which the Cumberland County Planning Commission may consider

[55:23] and act upon the substantial accord termination associated with CUP 26-03,

[55:31] Cumberland Energy Center, is hereby extended through September 30th, 2026.

[55:37] Be it further resolved that this extension is procedural in nature and is

[55:42] intended solely to preserve adequate time for the planning commission to

[55:46] conduct its review and make an affirmative determination under Virginia

[55:50] code 15.2-2232. Be it further resolved that nothing in

[55:55] this resolution shall be construed as a determination that the 60-day period

[56:00] prescribed by Virginia Code 15.2-2232B 2-2232B

[56:04] has commenced or as an admission regarding the date of submission or

[56:09] completeness of any application or re request for review. The board expressly

[56:15] reserves the county's position that the statutory review period does not

[56:19] commence until a submission sufficient to permit the review required by 15.22

[56:25] 15.2-2232 has been made. Be it further resolved

[56:29] that nothing in this resolution shall constitute approval or disapproval of

[56:33] CUP26-03, constitute a determination that the

[56:38] proposed Cumberland Energy Center is or is not substantially in accord with the

[56:43] Cumberland County uh comprehensive plan, constitute approval or disapproval of a

[56:48] location, character, or extent of the proposed Cland Energy Center. constitute

[56:54] a finding or admission regarding the date on which the application or

[56:57] substantial accord request was legally submitted to the planning commission or

[57:02] limit or prejudice the authority, discretion, rights, arguments or

[57:07] positions of the Cumberland County Planning Commission or Cumberland County

[57:10] Board of Supervisors in any subsequent [clears throat] consideration of

[57:13] CUP26-03 or the proposed Cumberland Energy

[57:17] Center. Be it further resolved that county staff and the county attorney are

[58:58] Freriedman for a conditional use permit at on Firefly Point which is just off of

[59:05] Columbia Road. The property is zoned A2. use is currently residential, although

[59:12] it is zoned agricultural. Um, they have three parcels that are on the property

[59:17] there. One has a house, one is a smaller lot that is vacant, and then we have the

[59:23] subject parcel for this conditional use permit application, which has an

[59:27] existing barn that is on the property. Here we have the vicinity map showing by

[59:32] the red star where the approximate property location is. We have the zoning

[59:38] map showing that it is zoned to A2 agricultural,

[59:44] the comprehensive plan map from the 2023 comp plan, and then here we have the

[59:50] zoomed in version of that map showing the Cobs Creek Reservoir Village Center.

[59:56] And again, the property is designated by the red star.

[1:00:01] Here we have an aerial map of their three tracks. You see the long skinny

[1:00:06] parcel is the subject parcel for this application. And we see the barn on the

[1:00:12] top left corner of the image here. We do have a current survey that was

[1:00:18] done in February of 2024.

[1:00:23] And we also have the preliminary site plan that was submitted with the

[1:00:27] application as well. The site plan does um indicate potential parking areas as

[1:00:33] well as the existing barn and the water water protection area for the Cops Creek

[1:00:42] Reservoir. The owners purchased the property

[1:00:46] between Columbia Road and the reservoir from Henriiko County in 2023.

[1:00:51] They have since renovated the existing dwelling that's on the property and

[1:00:55] hosted family and friends. In 2024, the Freedom subdivided tract into three

[1:01:01] separate parcels. The barn now sits on its own tract of land with 14 acres and

[1:01:06] is surrounded on three sides by reservoir.

[1:01:11] We have the current survey again here and it shows the existing house is on

[1:01:17] the 6 and 12 acre track which is on the south um sorry the bottom left hand

[1:01:22] portion of the map and then the 14 acre lot which is on the top section of the

[1:01:28] map here and you can see the the existing barn there on the top red star.

[1:01:35] The rural charm of the property along with the gorgeous views of the reservoir

[1:01:39] do provide for a beautiful backdrop for an event facility in this area and the

[1:01:43] Freriedins want to be able to share this site with others by way of having

[1:01:47] smaller events there. Here's a photo that was provided by the

[1:01:52] Freriedens. This shows um the barn in the background there. So this is taken

[1:01:57] down at almost at the entrance of Firefly Point in Columbia Road.

[1:02:04] And this photo, I believe, was taken from the existing house looking over

[1:02:08] across the reservoir at where the barn is located. Is that correct? Okay.

[1:02:15] And here we have a beautiful sunset photo showing the farm property as well.

[1:02:21] And then this these two photos show the renovations that were done to the

[1:02:25] existing barn where they will propose to have this event facility here.

[1:02:32] I think I already showed that photo. So for planning implications and

[1:02:37] consistency with the comprehensive plan, objective 5.1 of the comp plan is to

[1:02:42] maintain the rural character of the county through preservation of the

[1:02:46] scenic, agricultural, and natural resources for the optimal benefit of

[1:02:51] current and future residents. and approval of the CUP will preserve that

[1:02:56] rural character of that area of the county while simultaneously permitting a

[1:03:00] new small business and that will welcome visitors to the county and provide a

[1:03:05] positive economic benefit to existing county uh businesses

[1:03:10] for consistency with the zoning ordinance. Section 74-72

[1:03:15] provides for standards that shall be considered by the planning commission

[1:03:18] and the board of supervisors as part of reviewing any conditional use permit

[1:03:23] applications and all standards in this code section have been addressed

[1:03:27] satisfactorily by the applicant.

[1:03:32] Public engagement uh the notice of this public hearing was published in the

[1:03:36] Farmville Herald on July 29th and August 5th. Adjoining property owners were sent

[1:03:42] notice of this public hearing by first class mail on July 20th. And the notice

[1:03:46] was also posted on the public hearings web page of the county site and on the

[1:03:51] three bulletin boards in the county administration building on July 20th as

[1:03:55] well. Staff has received no comments for or

[1:04:00] against this application. The planning commission held its public hearing on

[1:04:05] June 15th and sends this application to the board. the unanimous recommendation

[1:04:10] of approval. It is the opinion of staff that the

[1:04:14] request promotes good zoning practice and that the location and intended use

[1:04:19] of the property are consistent with the zoning ordinance and comprehensive plan.

[1:04:24] Therefore, staff recommends approval of this conditional use permit with a few

[1:04:28] conditions.

[1:04:31] Most of these conditions are similar to every other event facility that we have

[1:04:36] or that we have permitted so far. So, I'll kind of just give a general

[1:04:39] overview. Number one, compliance with the plan is required. Um, every

[1:04:44] conditional use permit is required to submit a preliminary site plan. If this

[1:04:50] conditional use permit is approved, then a final site plan will be required to be

[1:04:54] submitted, reviewed, and approved by the office and that will um determine what

[1:05:00] exactly is to be located on the property. Now, with this location um or

[1:05:07] with the property location being so close to the reservoir, we do have a

[1:05:11] watershed protection ordinance and part of this property is located in that

[1:05:16] area. So, there can be no development um in that area of the property. The barn

[1:05:22] itself is located in that area. So, there can be no outside uh remodeling of

[1:05:29] that structure, but they were permitted to remodel obviously the inside. So the

[1:05:33] parking areas and any other um structures or or anything that goes on

[1:05:40] on the property can only happen outside of that watershed protection area which

[1:05:45] is um indicated on the site and the survey itself.

[1:05:50] The vegetative buffer there should be a natural vegetative buffer. What is there

[1:05:54] shall be maintained at all property lines and they must comply with the

[1:05:58] class creek reservoir wershed protection plan ordinance.

[1:06:04] septic water and electrical connections. They shall comply with all federal,

[1:06:08] state, and local regulations regarding the use of water, sewer, electricity.

[1:06:13] They will also provide notice or the applicable permit from the health

[1:06:17] department indicating compliance with their codes for the use.

[1:06:21] Refuge disposal. A container of adequate size shall be provided for refuge

[1:06:26] disposal and emptied when full, but in no event shall be it be emptied less

[1:06:31] than 48 hours after each event. And all refues shall be screened from public

[1:06:36] view. Hours of operation shall be limited

[1:06:39] between shall be limited to 8:00 a.m. to 11:00 p.m. daily.

[1:06:45] Noise shall be restricted between the hours of [snorts] 11:00 p.m. and 7:00

[1:06:49] a.m. Monday through Friday and 11:00 p.m. and 8:00 a.m. on Saturday and

[1:06:54] Sunday. The lighting shall not constitute a nuisance and shall not

[1:06:58] produce glare or spillover. Ingress and egress to the property. They

[1:07:04] do currently have a private road which is Firefly Point that they use to access

[1:07:10] all three of their tracks of land from Columbia Road. but they will also be

[1:07:15] required to provide a written statement from VOTE indicating their compliance

[1:07:19] with uh the applicant's compliance with VOTE's regulations. So even though there

[1:07:24] is an existing driveway there, if VOTE looks at what they're planning to have

[1:07:29] there based on the number of people they're planning to have, if says we

[1:07:33] need you to upgrade this entrance or maybe there's a concern with um sight

[1:07:38] distance and they need to clear some trees maybe at the road, then they would

[1:07:41] be required to do that.

[1:07:45] The next few are again general uh template uh conditions that we have with

[1:07:50] every conditional use permit application. The next is for community

[1:07:54] safety. If county or state law enforcement is required to respond and

[1:07:58] restore order and violations are confirmed or citations are issued more

[1:08:03] than twice in 30 days, the CV shall be reviewed by the board and can be revoked

[1:08:08] at the board's discretion. >> [snorts]

[1:08:10] » The applicant at all times shall comply with applicable federal, state, and

[1:08:14] local statutes, codes, regulations, and ordinance. confirmed violation at any

[1:08:20] time of any federal state code statute code regulation ordinance shall

[1:08:26] constitute a violation of the CP and it shall terminate immediately upon the

[1:08:31] violation subject to the conditions I'm sorry the condition number 12 which is

[1:08:38] non-compliance it does give the opportunity to the applicant to remedy

[1:08:43] the violation and if it is not remedied then it goes to the board for

[1:08:47] consideration

[1:08:50] If any condition in the C is determined to be invalid or uninforceable or

[1:08:54] unlawful would not affect the other conditions and they will remain and

[1:08:58] continue in full force in effect. And then there is a renewal clause here

[1:09:04] which means that the applicant is required to request a renewal of staff

[1:09:08] who can approve that administratively and that would be one year after

[1:09:12] approval, two years after the last renewal, five years and then every 5

[1:09:17] years thereafter or if there's a change in property ownership program provider

[1:09:23] licensing type or management. When it comes to renewals, the applicant will

[1:09:28] can just submit an email, but they will be required to submit some form of

[1:09:33] documentation from VOT, the health department, and the sheriff's office.

[1:09:37] Sheriff's office can just state that there have been no calls for service to

[1:09:41] that location. in that time frame that they're requesting the renewal. Um,

[1:09:45] health department can provide some form of written documentation that if there

[1:09:50] were if there was a well permit um, issued for the property that it was

[1:09:55] installed adequately. Um, and then of course VOTE would maybe give us a copy

[1:10:00] of the driveway entrance permit or any kind of permit or approval that they had

[1:10:06] issued for the property and showing that they were in compliance with that

[1:10:09] regulation. And that is all that I have for you this

[1:10:13] evening. Um, the applicants are here, so if you have any questions that I'm

[1:10:18] unable to answer or questions for them directly, I'm sure they'd be happy to

[1:11:17] ordinance protection ordinance. Um, I notice there's not going to be any of

[1:11:22] these structures built because that's part of the organs. That doesn't pertain

[1:11:26] to a temporary structure, does it? Like for instance, you know, got chairs

[1:11:33] outside on the lawn. Um, a couple wants a wooden cross in the background of

[1:11:40] their wedding, you know, a temporary wooden cross or an archway uh to get

[1:11:45] married under. the the ordinance does not forbid a temporary

[1:11:50] um structure to be put in place as long as it's not a permanent structure. Am I

[1:11:54] correct? >> Yes. I would however point out that some

[1:11:58] people consider like buggy top sheds and barns to be temporary structures and

[1:12:03] those do require permit. So those would not be permitted. But the suggestions or

[1:12:08] the options that you um made right now, I would agree those would not I just

[1:12:13] want to make sure violations. We wouldn't nitpick when, you know,

[1:12:16] [clears throat] they're having a an event there and there's something

[1:12:20] temporary that's not going to be permanent. That's that was just

[1:15:58] adjustment to this agenda tonight is again another one of your acts of

[1:16:03] non-transparency not giving us sufficient time to look at

[1:16:13] understand that this CU603 is still in negotiations.

[1:16:18] So how can the planning commission be looking at something that is not

[1:16:23] complete? And then the question comes up, how does this CU distribute it to

[1:16:30] the planning commission? By just saying here it is, it's been posted on the

[1:16:34] website. I don't think that's appropriate.

[1:24:50] from Dominion. Uh and I want to invite you uh board of supervisors members to

[1:24:57] please view last night's planning commission meeting and uh listen to the

[1:25:04] friends of Chesterfield presentation. They came last night uh to kind of in

[1:25:10] the spirit of being a neighboring county uh to share their experience with

[1:25:15] Dominion which is different from what Dominion

[1:25:21] uh is offering. Uh so I encourage you to just view that part of of the meeting

[1:25:28] last night and take a listen to what they said. I think it's important

[1:25:31] information for us to have as these kinds of decisions move forward.

[1:25:36] and uh I appreciate being able to stand up and talk to you and offer my

[1:26:30] out of when a project comes in this county

[1:26:42] different with the Dominion project. Um, we asked Mr. I'm sure it wasn't the J to

[1:26:50] arrange a meeting with the lawyers or with y'all before this cup was approved

[1:26:58] so we could have a voice in getting site tours and different things throughout

[1:27:04] the process and it's gone ignored. Um so we would

[1:27:10] very the chiefs and all would very much like to be heard um because we get left

[1:27:17] out very often. Thanks.

[1:27:42] had some new, uh, came in last week. Um, the building that we were looking at to

[1:27:56] actively looking to work building again. Just wanted to give you all an update.

[1:28:01] Um, I think we've got a meeting with the

[1:28:06] Miss Medina soon. Uh, so hopefully we can discuss some options. But, um, just

[1:28:11] [snorts] wanted to let y'all know we are working on it. We're trying to find a

[1:28:14] place. Um, BDH or Department of Health doesn't actually negotiate directly with

[1:28:21] the leases. We have to go through the Department of General Services. Um,

[1:28:25] which can be difficult sometimes. Um cuz a lot of times landlords will want to

[1:28:30] reach out directly to us and we have to get them to go through DGS and um I'm

[1:28:35] not sure whether something got lost in translation in there but um that's

[1:29:24] Steel and I am the officer specialist for Cumberland Health Department. Um, we

[1:29:30] are temporarily located at Prince Edward Health

[1:29:34] Department, which we've been there for a little over a year and it's a hardship

[1:29:41] on the citizens of Cumberland. they're having

[1:29:46] to drive a distance to do health department business.

[1:29:50] Um, I try to keep them from driving um, do whatever they can do over the

[1:29:56] internet. Um, payments over the phone. Some of the um, citizens do not desire

[1:30:03] to do that. So, they have to make a trip to Farmville. Once they get to

[1:30:07] Farmville, they have to pay the park. So, I had an elderly couple come in

[1:30:15] and Stephanie has been wonderful. Stephanie works so wonderful with me. We

[1:30:20] work together to try to save the the um citizens a trip from going back and

[1:30:26] forth county to county. Um the elderly couple that came in, they did not have

[1:30:32] all the paperwork they needed. So, they had drove to Prince Edward.

[1:30:38] I in turn had to send them back to Cumberland.

[1:30:42] They came back to Cumberland and then they had to drive back to Farmville.

[1:30:48] I completed their business with them. They paid for their application.

[1:30:54] And as they were about to leave, the elder gentleman said, "Here, here's

[1:30:58] this." And I said, "Well, what is this?" And he says, "This is my parking

[1:31:02] ticket." And I I just felt so bad for him. I said, "I'm sorry. I can't

[1:31:07] validate it. So, he not only had to drive to the barn, he had to be. So,

[1:31:13] we're hoping that the board can get us back in the county as quickly and

[1:31:19] promptly as possible. Thank you.

[1:32:09] tank situation. Um, yeah, it was uh it was funny because

[1:32:15] that Saturday was the coldest day this summer. I think the good Lord might have

[1:32:19] been testing my perseverance, but um my fingers did end up getting shriveled

[1:32:24] during that event. But, you know, just reflecting on it, it was a day out of my

[1:32:30] schedule, a little inconvenience, but to uh to to pay honor and and

[1:32:37] respect to what our volunteers do day in and day out, and it was just, you know,

[1:32:43] the basically the least I could have done was to help them raise the funds.

[1:32:48] Um, you know, I won't post and say I raised the most funds in the tank, but

[1:32:52] uh I think that [clears throat] we had a little side effect when that did happen.

[1:32:56] And you didn't mention uh April, I think, uh the event in total, I want to

[1:33:01] say, brought in about $1,500 after expenses were paid. Um is the number I

[1:33:06] heard uh for the bond for cars, the volunteer fire department. So, it was a

[1:33:10] very successful day. I was glad to be a part of it. Um likewise with this past

[1:33:15] Saturday uh being at the truck and tractor pull the third annual one. I'm

[1:33:20] glad to to take my family and and show our support uh for our volunteers. Um

[1:33:26] but um thank everyone for being here. Uh please drive safe going home. God bless

[1:33:49] board members. Um, that being said, it's we have a lot

[1:34:00] going to be very, very busy. special projects that we have. And we're going

[1:34:05] to do everything possible to make sure that any proposed uh energy center,

[1:34:14] anything else in this county is vetted as not only as well as we can, but also

[1:34:21] with outside consultants, uh outside attorneys.

[1:34:26] No offense. Um but we we will look at everything

[1:34:32] possible. Uh uh three of the board members were

[1:34:37] able to go down and look at a very similar facility in Brunswick County

[1:34:42] roughly about a week ago. Um that was a good trip. I've never seen one myself

[1:34:48] and it was uh it it was amazing technology. Just absolutely amazing.
