Kennel Club Dog Show will be held

Wednesday, August 12th, 9:00 a.m. to
6:00 p.m.

and Thursday through Sunday, August
13th to the 16th, 9:00 a.m. through
[2:04]
5:00 p.m. at the Enumclaw Expo
Center.
[2:06]
There is also the Adventure Event
Expo, which will be Saturday, August
22nd,
[2:10]
10:00 a.m. to 5:00 p.m. and Sunday,
[2:13]
August 23rd, 10:00 a.m. to 3:00 p.m.
at the Eamclaw Expo Center.

We know that we have some comments
for the audience.
[2:19]
So before we begin, this is an
informal opportunity for the public
to address
[2:22]
city administration, the council on
problems, issues or items of concern.
[2:26]
This is one way communication.
[2:28]
To provide an orally process during
the comments from the audience time,
we
[2:32]
request that if you wish to speak,
wait to be recognized, come to the
[2:35]
podium, speak into the microphone and
state your name and if you reside
[2:38]
inside city limits or outside of city
limits.
[2:41]
Statements shall not exceed three
minutes in duration.
[2:43]
After you have finished speaking,
please write your name and address on
the
[2:45]
sign-in sheet in front of the police
chief. Right there.

Uh, also just to note, if you do go
over three minutes, council can elect
to give
[2:53]
you more time, but if they give you
more time then they have to give
[2:56]
another person more time as well, so
just please take that into
consideration.

Hi. Um, my name is Jenna Decker and I
am part of our Guide Dog group in
Enumclaw.
[3:17]
We wanted to bring Milwaukee, who is
my 29th dog of raising in the club.
[3:24]
We have a 40th anniversary in
Enumclaw.
[3:27]
Our Guide Dog group has been here for
40 years since 86, 87, or yeah, 85,
86.
[3:33]
We had our first dog come into
Enumclaw.
[3:37]
And so far we have raised, Enumclaw
has raised 308 dogs.
[3:42]
Of those 308 dogs, um, about 131 of
them have become guide dogs for the
blind.
[3:47]
We are having our celebration of 40
years, August 22nd, 1:00 to 4:00 p.m.
[3:52]
at Trinity Lutheran.
[3:55]
And we would love anybody to come.
[3:57]
We do have a puppy truck coming.
[3:58]
There's a truck that's bringing in on
six, eight week old puppies to our um
celebration.
[4:05]
The razors will get dogs, um, six,
six families will get our dogs.
[4:10]
In Enumclaw, you guys have raised,
had 80 over 88 families that have
done raising.
[4:17]
School district has been amazing for
us.
[4:20]
The businesses have been amazing for
us.
[4:22]
This is one community that accepts
our dogs coming in for training.
[4:26]
The restaurants are very good about
it.
[4:29]
Um, everything in Enumclaw with us
having our dogs there for 40 years
has been amazing.
[4:35]
So we thank you. We're here just to
thank you guys
[4:37]
for allowing this to happen.

40 years is a big deal.
[4:41]
We have a lot of people and
communities that we've impacted by
doing this.

Um, the people that we've impacted
have been amazing.

I know there's some concerned
citizens of my neighborhood,
[5:24]
so my name's Greg Adams.

I live at
[5:26]
24611 Southeast 448th Street
[5:30]
or Roosevelt.
[5:34]

I've lived in Enumclaw for all my
life.
[5:39]
I was born and raised here.
[5:41]
I've seen many changes in this town.
[5:44]
I haven't opposed many.
[5:46]
This one is one I'm going to oppose
[5:49]
and I'm talking about the, um,
[5:51]
building convenience store/nightclub.
[5:56]
The biggest part of this is the,
[5:58]
the nightclub.
[6:01]
Big problems for the neighborhood.
[6:04]
Noise, garbage, more traffic.
[6:09]
[tapping]
[6:10]
I take my life in my own hands every
time I try to back up my
[6:14]
trucks or exit my driveway
[6:18]
on 240 or, uh, 448th
[6:20]
or Roosevelt.
[6:23]
The traffic is more and more
[6:24]
all the time.
[6:27]
The last few years, we've had two new
developments pushed into
[6:30]
our neighborhood.
[6:32]
built around my, my house
[6:34]
and in our area.
[6:37]
Now we have another one.
[6:39]
85 homes.
[6:42]
That's 85 more cars
[6:44]
going up and down the road.
[6:47]
More traffic, more speeding,
[6:49]
more problems.
[6:53]
I and many others do not want our
road, 448th,
[6:56]
or Roosevelt, to be like the Auburn
Enumclaw Highway
[7:01]
or 410.
[7:04]
More homes, more stores,
[7:06]
nightclubs, people.
[7:09]
This all means more police, fire,
[7:12]
EMS.
[7:15]
We struggle with speeders all the
time on our road.
[7:19]
and it's getting worse.
[7:20]
I say no to the convenience store and
I say no to the gas station
[7:25]
and definitely no to a nightclub in
our area.

I have always had tremendous respect
for everyone in this room
[7:52]
as well as staff and members not in
attendance. These comments
[7:57]
will not be personal.
[7:59]
Landmark Nightclub.
[8:01]
The dictionary defines nightclub as a
place of entertainment,
[8:03]
open at night, usually serving food
and liquor and providing music
[8:06]
and space for dancing
[8:08]
and offing having a floor show.
[8:11]
EMC 1820010, the neighborhood
business district, which this is in,
[8:14]
is intended to create, preserve and
enhance areas of retail establishment
[8:19]
serving frequently recurring needs
and convenient close locations
[8:23]
to neighborhoods.
[8:25]
The intent of this district is to
have a small shopping area,
[8:29]
which will be compatible with the
character of the neighborhood.
[8:32]
EMC Chapter 820 Noise Control. Public
nuisance and disturbance
[8:35]
noise is under 820060.
[8:39]
It is unlawful for any person to
cause or for any person
[8:41]
in possession of property to allow
[8:44]
to originate from said property sound
that is a public nuisance.
[8:48]
The following sources of sound are
defined to be public nuisance.
[8:52]
Section F, the creation of use of a
musical instrument, whistle,
[8:54]
sound amplifier, stereo, juke box,
[8:58]
Radio, television or other device
capable of reproducing loud
[9:00]
and raucous noises which emanate
[9:03]
frequently, repetitively or
continuously from any building
[9:06]
structure or property such as sound
originating from a band
[9:10]
session, tavern operation or social
gathering.
[9:15]
City of Enumclaw adopted Washington
State's environmental
[9:18]
noise Wack 17360040.
[9:22]
maximum permissible environmental
noise levels which the following
[9:24]
is stated.
[9:26]
No person shall cause or permit noise
to intrude into the property
[9:29]
of another person which exceeds
[9:32]
the maximum permissible level set
forth in below.
[9:36]
Receiving property means real
property within which the maximum
[9:39]
permissible noise level specified
herein shall not be exceeded
[9:42]
from sources outside such property.
[9:46]
My understanding is that this
nightclub property falls in the
[9:48]
Class B EDNA environmental
designation for noise abatement
[9:51]
category.
[9:53]
per Wack 17360040.
[9:56]
the noise limit limitations to
receiving property
[10:00]
in class B our 50 DBA meaning a
weighted decimal from 10 p.m. to 7
a.m.
[10:06]
60 DBA during the hours. The decimal
level of a live band typically ranges
[10:12]
from 90 to 100. 30 seconds.
[10:14]
Depending on the music genre venue,
etc.
[10:16]
Based on this, will the nightclub
owner be required to erect sound
barriers
[10:20]
similar to what is proposed for
pickleball courts in Ranier Trails?
[10:25]
Penalties, section B, other noise
offenses. All other noise offenses
[10:30]
defined in this chapter shall
constitute misdemeanors and be
punishable set forth
[10:36]
Separate offenses. Each day for which
a violation continues or is repeated
[10:41]
shall constitute a separate offense.
[10:43]
Has the nightclub owner been made
aware of these? I ask counsel for
additional time.

the nightclub owner provided an
answer to a question
[11:04]
and how they will comply with the
noise control 8.20.
[11:08]
Any seating, outside seating or
activity, shall be terminated at 10
p.m. every night.
[11:14]
In EMC 1820-090, neighborhood
business district, section A,
[11:19]
all uses shall be conducted wholly
within a completely enclosed building
[11:25]
except for service stations,
off-street parking loading
facilities.
[11:27]
Why is it referenced here that any
outside seating or activity shall be
[11:32]
terminated at 10 when this code code
clearly states all uses shall be
conducted
[11:36]
wholly within enclosed building.
[11:38]
Outdoor seating is not in the
building.
[11:40]
I respectfully ask counsel to assure
that outdoor seating and or patio is
not
[11:44]
allowed. This was discussed with city
staff.
[11:47]
The architectural plan submitted and
resubmitted, I did not see any inside
[11:52]
construction plans that include
equipment layout, no bar, no walk-in,
[11:56]
no coolers, no refrigeration, no
kitchen improvements, no tables and
chairs for customers,
[12:00]
and other items of that that would
show in a normal equipment layout for
a nightclub build out.
[12:06]
Why is that? How can a potential
permit be issued for a remodel on a
building
[12:10]
if they do not show the intent of
what the permit is asking or stating?
[12:14]
Will more detailed plans be required
from the nightclub owner?
[12:18]
Is this a bait and switch design in
which the nightclub owner will um
[12:22]
submit a nightclub permit, will be
operating an event venue like
weddings,
[12:28]
birthdays, which is not allowed in
the NBD district.
[12:32]
Is the nightclub owner not wanting to
trigger more expensive improvements
[12:36]
and code requirements if showing work
inside?
[12:39]
Other concerns under the General NB
[12:42]
All sites have a common boundary with
the with the residential classified
property
[12:47]
shall have erected and maintained
walls, hedges, within the the
property.
[12:52]
Nothing is shown on the permit or on
the permit or on the drawings that
were submitted. This was
[12:58]
discussed again in a meeting with
city staff. We hope that both the
fence and sound
[13:03]
barrier landscaping are placed here.
Also center lane on 244th.
[13:06]
will one be required for the gas
station?
[13:09]
Stonebrook, Alderbrook housing
developments required these.
[13:13]
I'm guessing the gas station will
have more left turns than these two
neighborhoods
[13:17]
combined. Last if I may,
[13:19]
why is there on the land use action
2026018 listed on the land use action
sign
[13:26]
posted on the property, but there are
two separate permits 016018
[13:32]
and the documents for the nightclub
and another for the gas station.
[13:35]
Also the sign states, and I quote,
that's posted,
[13:38]
Application to remodel the existing
building previously known as Moose
Lodge.
[13:43]
Remodel, what is it going to remodel
into? A daycare, a dry cleaner, a
nightclub?
[13:48]
I respectfully ask that this posted
sign be reposted
[13:52]
with the correct permit information
on both the nightclub and all the
different
[13:57]
permits for this build out.
[13:58]
Council, you have a very tough
decision ahead.

Yes, this neighborhood business is
zoned for the nightclub. However,
[14:05]
moving forward with this project will
violate several city ordinances.
[14:09]
It's not if, but when these will be
violated.
[14:12]
Do I need to mention ski in, Cedars,
Four Seasons?
[14:15]
If not, I'm sure we can find these
incident reports in police past
[14:21]
police reports. Thank you very much

My name is Jay Moore and I live
within the city limits.
[14:37]
I'm here to express my concerns about
the nightclub that is planned under
[14:40]
LUA 2026/16, also known as the
Landmark Station project.
[14:46]
My primary concern is the noise that
will be associated with live and or
recorded music,
[14:52]
as well as late night, vociferous
patrons in the parking lot
[14:55]
and the surrounding areas who've been
over served.
[14:57]
If outdoor seating is offered, this
annoyance will
[15:00]
be more pronounced.
[15:02]
Within a radius of 200 yards, there
are approximately 24
[15:05]
single family residences.
[15:07]
Within 300 yards, there are or will
soon be 85 single
[15:10]
family residences.
[15:13]
To give some perspective,
[15:15]
it's approximately 150 yards from the
stage at White River
[15:18]
Amphitheater to the top of the grass
seating area.
[15:21]
And remember, we go there because we
want to hear loud music.
[15:25]
Some of these homes have had recent
experience with late
[15:27]
night noise.
[15:29]
The VFW hall located 300 yards to the
north of the proposed venue
[15:33]
has had a history of noise complaints
from live music,
[15:36]
and they were forced to scale back
the scope of their events.
[15:40]
The landmark station project property
owner needs to
[15:42]
understand the current city and state
noise restrictions
[15:45]
and include the proper mitigation in
their remodel.
[15:49]
such as installation of sound
barriers at the side perimeter
[15:52]
or retrofitting the building with
sound deadening material.
[15:55]
If noise mitigation steps are not
taken, there will be noise
[15:58]
complaints.
[16:00]
Additional concerns include the
restaurant resulting
[16:03]
increase in police and aid car
customers.
[16:06]
The city should plan accordingly.
[16:09]
I'm surprised that a no adverse
impact disposition was
[16:11]
determined as a result of the
separate review.
[16:16]
Enumclaw is a wonderful downtown
business area and this type
[16:19]
of establishment should be limited to
its core downtown
[16:21]
and Highway 410 business strip and
away from residential areas.
[16:26]
Please don't let the city's
residential West side become
[16:29]
the city's wild West side.
[16:31]

Good evening. My name is Jack Baker.
[16:42]
I live at 24503 Southeast 448 Street.
[16:46]
directly across the street from the
old Moose Lodge.
[16:50]
I'm also going to make comments
concerning the landmark
[16:52]
station property.
[16:54]
and how the owners are not going to
be meeting the neighborhood
[16:57]
business zoning, the intent.
[17:01]
The zoning should be to meet the
needs of the nearby residents.
[17:04]
This proposal is really only viable
because of the large
[17:07]
number of communities using 204th
Avenue as they come over
[17:10]
the bridge from Pierce County heading
north to Renton,
[17:12]
Issaquah, Bellevue and other cities
north.
[17:15]
In doing so, they bypass Enumclaw's
commercial area.
[17:19]
This project is not being built for
nearby neighbors.
[17:22]
Intent should be to limit the scale
and type of uses to small
[17:25]
service-oriented retail.
[17:27]
For example, the 7-Eleven on 164th,
the mobile station
[17:30]
on 169th as you leave town,
[17:32]
they provide two to three pumps and a
small retail convenience store.
[17:36]
I propose they meet the intent of
neighborhood business zone.
[17:39]
Limited in scale and meeting the
needs of nearby residents.
[17:42]
Contrast that to the proposed
landmark station.
[17:44]
with 12 fuel pumps and approximate
11,000 square foot
[17:47]
convenience store.
[17:50]
11,000 square feet per their plan.
[17:54]
I would propose that this is not a
small service-oriented retail
[17:57]
establishment, but would be better
described as a travel
[18:00]
center, such as you would find off of
a major highway.
[18:04]
Intent of the zoning should be to
maintain a small retail
[18:07]
area that is harmonious with the
neighborhood's set character.
[18:11]
The proposed remodel of the Moose
Lodge into a night club will not
[18:14]
be harmonious to the neighborhood
character.
[18:17]
Please do not think that the Moose
Lodge and night club is synonymous.
[18:22]
Having lived 10 years across the
street from the Moose Lodge,
[18:24]
I can tell you they were good
neighbors.
[18:26]
They had quiet, timely, small
gatherings that were
[18:29]
copacetic to the neighborhood.
[18:31]
A night club will not be so.
[18:34]
I have some additional comments. I'm
going to forgo those.
[18:36]
I brought my granddaughters with me
today.
[18:39]
Laney Baker and Kobe Baker. They are
fourth generation
[18:41]
Enumclaw residents.
[18:43]
Uh,
[18:45]
They come to our home. We are their
grandparents.
[18:47]
They come to our home Fridays and
Saturdays, just spend
[18:49]
the evenings with us.
[18:51]
They help us cook dinner, they work
with my wife
[18:53]
in her garden, they help feed my
cows, they play with my cat.
[18:57]
Oftentimes we set up a large
volleyball net in our front yard.
[19:01]
They bring their friends.
[19:02]
And the girls play volleyball in the
evening as grandpa makes
[19:04]
smash burgers in our front yard.
[19:08]
They will be 20 feet from the night
club when they do this.
[19:12]
How can I ask families to bring their
allow their daughters to
[19:14]
come and participate at my home?
[19:19]
20 feet from a night club.
[19:21]
I hope that you will consider the
business license for this night
[19:23]
club and squash it immediately.
[19:25]

I'm Cindy Baker.

I live across the street from the
Moose Lodge.
[19:44]
10 years ago, when my husband and I
were trying to find a home
[19:47]
in Enumclaw so we could live closer
to our grand kids,
[19:49]
we found the home on 448th, we
thought it would be our
[19:52]
grandma and grandpa home that we
would have with the children.
[19:56]
We did our due diligence. We came
down to the city. We asked what was
[20:00]
owned around it. We looked at the
maps.
[20:02]
We asked what is a neighborhood
business, what could be built on
this.
[20:08]
We were told maybe an auto shop,
something like that, legal offices.
[20:13]
Not a nightclub.
[20:19]
When I was looking around, I found
the mission statement or purpose of
the Moose Lodge. It follows:
[20:26]
To provide a family environment for
the education of children in need of
Moose Heart
[20:30]
and the needs of senior members at
Moose Haven.
[20:33]
To provide an atmosphere that will
enhance unity and growth
[20:35]
through social and recreational
activities for the membership.
[20:39]
Unite its members in the bonds of
fraternal benevolence and charity
[20:43]
through year-round social and
recreational activities for the
members and their families.
[20:48]
Now, please contrast this with the
purpose or mission statement of a
nightclub.
[20:54]
To provide an adult-oriented
environment for the consumption
[20:57]
of high markup alcohol beverages by
any paying patron
[21:01]
and the maximization of profit for
owners.
[21:04]
To provide an atmosphere which will
enhance sensory stimulation and
social competition
[21:10]
through loud music, dancing, alcohol,
and nightlife.
[21:15]
Allow for the distribution of illicit
substances where the sole and use
[21:19]
necessitates frequent police and fire
dispatches
[21:22]
to manage medical emergencies,
overdoses, and criminal activity.
[21:28]
Allow for a constant flow of people
with a degree of anonymity to become
a hub
[21:33]
for criminal networks, human
trafficking, and sexual violations.
[21:38]
Is a nightclub really the venue that
will increase the quality of life
[21:40]
for surrounding residences?
[21:43]
I respect each one of you for running
for this, for council
[21:47]
and know that you do want to make a
change.
[21:51]
I looked over the voters pamphlets
and found some of the statements that
you made
[21:54]
when you were running for office.
[21:57]
You wanted to advocate for the safety
and support of our community.
[22:01]
I desire to be part of the local
decision- making process to ensure
[22:05]
our community will grow and prosper
while still maintaining the charm
[22:08]
and character Enumclaw's known for.
[22:11]
I'm passionate about public safety
and responsible growth.
[22:15]
If elected, I'll work diligently to
preserve Enumclaw's unique charm.
[22:20]
Would like to preserve Enumclaw's
rural sensibilities.
[22:24]
I'll bring a strong focus on public
safety and on retaining the vibrancy
of Enumclaw,
[22:28]
both essential to keeping Enumclaw
the city we love.
[22:32]
And this statement is from the city
of Enumclaw's website.

The quality of life is the main
reason given by local business owners
and the
[22:39]
community alike for maintaining their
residence in Enumclaw.
[22:44]

I would ask that you immediately
impose a moratorium on allowing any
night clubs
[22:57]
in neighborhoods and direct the city
to change its code.

These types of establishment belong
in business districts, not
neighborhoods.

I thought we'd found our retirement
home.

My husband built his shop.
[23:16]
He is retired, and now I have to
move.
[23:21]
Please, I beg, don't impose this
duress on any other city residents
[23:25]
and retain the charm and family
character of Enumclaw.

I am also a school teacher at
Enumclaw Middle School.
[23:34]
There are five schools within one
mile and one pub
[23:38]
private school within one mile of
this night club.
[23:46]
Um, just one more thing.
[23:48]
Oh, what about the observ overserved
patrons leaving the property
[23:51]
and wandering into our yard or house?
[23:56]
No, it's not a product of my
overactive imagination.

I wish council member Le Fleur was
here tonight. This actually happened
to his sister.
[24:06]
When an overserved patron made their
way into their home,
[24:10]
which is closer to the downtown
district,
[24:12]
and woke up their young son who fell
asleep on the couch.
[24:17]
It was terrifying.
[24:20]
And I will not be able to have my
grandchildren or any of their friends
in my home.
[24:25]

Ordinance 2842 would adopt a
permanent co-living housing
[29:26]
allowances within the Municipal Code.
[29:31]
Um, I'll try to keep it brief since
um, nothing has changed
[29:35]
since the public hearing, which was
at our last council meeting.
[29:39]
Um, the City Council adopted the
regulations back in December and
[29:42]
through an interim ordinance and
reaffirmed that in February.
[29:46]
Uh, this ordinance this evening would
adopt the regulations permanently.
[29:50]
The only difference between uh the
regulations proposed and the ones
that were adopted back in December
[29:57]
is we included a couple couple
additional definitions for
[30:00]
for a kitchen, one for a kitchenette.
[30:02]
And um, as part of this
[30:05]
ordinance and part of the planning
[30:07]
commission's recommendation was to
[30:09]
include a requirement that each
co-living unit
[30:12]
includes a kitchenette and a
bathroom.
[30:15]
With that, staff is recommending to
[30:17]
to pass ordinance 2842.
