Next up is a public hearing, a
[4:30]
series of public hearings. The
[4:33]
first one is a
[4:38]
hearing on the Capitol
[4:39]
Improvement Plan where we will
[4:43]
review
[4:49]
proposed capital improvement
[4:52]
plan for 2022, 2023 fiscal
[4:58]
year, and how it relates to the
[5:04]
comprehensive plan. Whatever
[5:06]
you say or I'm going to go
[5:07]
ahead. Alright.

our capital budget. So, What
[5:24]
I'm going to do is talk about
[5:27]
fiscal year 23 and again, this
[5:34]
is just proposed. This is not
[5:37]
going to council yet. I'll go
[5:43]
over that with you and then,
[5:45]
I'm going to turn it over to
[5:48]
Shay so that he can speak about
[5:56]
how some of the things that we
[6:00]
are proposing relates to our
[6:05]
comprehensive claim. You think
[6:06]
it would be okay if I took this

fire station.
[6:19]
So, the debt service, annual
[6:23]
debt service for the Public
[6:28]
Safety Building is a
[6:33]
hundred and seventy-six
[6:34]
thousand three hundred
[6:35]
seventy-six dollars.
[6:42]
The debt service on the parking
[6:46]
garage on I should say that one goes through December
[6:56]
of twenty thirty-three. I I I'm
[6:59]
I I don't want to give a date
[7:03]
but I but it is it is coming
[7:07]
soon. So, we will have a grand
[7:11]
opening when we move into the
[7:16]
new fire station.
[7:21]
So, what we do in the process,
[7:26]
the finance director and I, we
[7:29]
go and meet with all of the
[7:33]
department heads. We review
[7:38]
what they're requesting for the
[7:42]
year and then, normally,
[7:48]
there's a series of discussions
[7:53]
and cuts because we just can't
[8:02]
find all the things that we
[8:04]
would like to fund in anyone
[8:08]
fiscal year. So, for co
[8:10]
department. We have a request
[8:11]
for vehicle and computers and
[8:11]
software that total thirty-two
[8:12]
thousand five hundred dollars.
[8:12]
The planning department, I will
[8:13]
note that the planning
[8:14]
department requests and later
[8:14]
on, the parks request are some
[8:20]
of the items that really really
[8:28]
tie into our comprehensive
[8:31]
plan.
[8:35]
So, the planning department, we
[8:38]
have Downtown Beautification at
[8:42]
twenty 000 city entryway at
[8:49]
twenty 000 and some weight
[8:52]
finding signage for the
[8:52]
community at 5, 000. That total
[8:53]
4-five, 000 dollars. At
[8:53]
4thousand five hundred and city
[8:54]
hall computer server at 30000.
[8:55]
Those total, one hundred
[8:55]
ninety-nine thousand
[8:58]
five 00 for city
[9:04]
hall.

For the police department,
[9:09]
we're looking at cruisers, four
[9:14]
of them,
[9:20]
I will note that we are still
[9:24]
having difficulties getting
[9:30]
vehicles in. So, what has
[9:34]
happened is we're looking at
[9:39]
what we didn't get in prior
[9:43]
physical years and having to
[9:49]
carry this over. And I told
[9:53]
we're going to get to a point
[9:54]
we're going to have to have
[9:55]
eight in one year. So we're hoping to avoid that. But
[9:56]
we do still have some cruisers
[9:57]
that we just we can't get the
[9:57]
vehicles. We just have the same
[9:58]
situation in public works with
[9:59]
some of our trucks. The the
[9:59]
crew groups they were already
[10:03]
approved for prior years. Is
[10:07]
that money also carry over?
[10:11]
Yeah we gotta carry that over
[10:15]
especially if we feel somewhat
[10:23]
confident that the order is
[10:27]
going to be fulfilled. Um we
[10:32]
will actually encumber that and
[10:36]
say okay Right. We don't
[10:36]
want to we don't want to do
[10:37]
that. We want to try to avoid
[10:38]
that but I, you know, it it's
[10:38]
kind of scary when you see that
[10:39]
they just keep saying, you
[10:40]
know, 12 months, 18 months Um
[10:40]
so, it's it's really difficult
[10:41]
for us. So, the four cruisers,
[10:42]
about 45, 000 piece at 1 80,
[10:42]
000. We need radar units, three
[10:43]
thousand, 13 new PCs,
[10:44]
eleven thousand seven hundred
[10:47]
You're going to see a lot of
[10:55]
computers
[10:59]
and I will say over the years,

we haven't done that great of a

job. Uh budgeting, you know,

how many we need in each year.

So, we're getting to a point

now where so many of them don't

have the upgrades that are
[11:09]
needed and we're having to do a
[11:10]
lot at once. Um we're going to
[11:10]
still try to give it back on a
[11:14]
more even situation where we're
[11:23]
only getting maybe three or
[11:26]
four for a department and not
[11:33]
13 all at one time.

But that's what we're looking
[11:44]
at for this year for the police
[11:48]
department Three, best and
[11:51]
carriers at $3000 dollars
[11:51]
Refrigerator for the kitchen
[11:52]
1500, and a place computer
[11:53]
server at twenty thousand. So,
[11:53]
this police items add up to two
[11:54]
hundred nineteen thousand two
[11:55]
hundred dollars So, in the fire
[11:55]
department we're looking at a
[11:56]
backup generator from Watson
[11:57]
Station at sixty thousand Every
[11:57]
year, you'll see replacement of
[11:58]
fire hose and bumper gear.
[11:58]
That's just something we have
[11:59]
to do on a yearly basis. The
[12:00]
fire hose is 7000 and the
[12:00]
bumper gear is twenty-one
[12:01]
thousand six hundred. We have
[12:02]
rescue cribbing at three
[12:02]
thousand and four new PCs at
[12:03]
thirty-six In the streets
[12:03]
department, we're looking at
[12:04]
replacing three snowplow trucks
[12:05]
at 150thousand
[12:08]
A new loader at ninety,
[12:14]
2 new spreaders at sixteen
[12:18]
thousand,
[12:22]
for a total of two hundred and
[12:26]
000 in our streets department.
[12:31]
The street lighting department,
[12:31]
we want to replace streetlight
[12:32]
poles on Rivercrest and Massey
[12:32]
Boulevard. Those will total
[12:33]
thirteen five hundred dollars.
[12:34]
The City Garage is looking at a
[12:41]
ultrasonic tablet and advanced
[12:50]
tool kit for them to use to
[12:56]
assess the vehicles. At five
[13:03]
thousand dollars.
[13:06]
Then in the parks department,
[13:12]
we're really trying to put some
[13:14]
money towards parks because
[13:18]
again, we believe that was an
[13:21]
area that we were lacking in
[13:21]
funding and this council and
[13:22]
the council before have been
[13:22]
very supportive of getting our
[13:23]
parts back to where we need to
[13:24]
be, having outdoor spaces for
[13:24]
folks to go to and just making
[13:25]
sure that we have upgrades and the facilities. So, you
[13:26]
will see that we are spending a
[13:29]
good bit or is that proposing
[13:34]
the council spend some money in
[13:38]
our parks?
[13:42]
So, we're looking at Morris
[13:46]
Park to repair the steps and
[13:51]
railing which truly needs done
[13:55]
at ten thousand dollars.
[13:56]
Windmill Park, we have fencing
[13:56]
around field two, at 7-five
[13:57]
thousand a metal roof on the
[13:58]
pavilion, and the restroom at
[13:58]
eight thousand, Windmill Park
[13:59]
playground equipment at five,
[13:59]
and Windmill Park basketball
[14:00]
court sports coding at 15, 000.
[14:01]
And I will note that that
[14:03]
fifteen thousand does not
[14:09]
completely cover the cost, but
[14:14]
we've had some generous
[14:18]
donators, and I don't have
[14:21]
their names, but if you have
[14:25]
that information, we do have
[14:27]
some folks that donated for the
[14:28]
basketball courts, sports
[14:28]
coding, and that will help us
[14:29]
to bring that project to
[14:29]
fruition. Morgantown Avenue
[14:30]
Mini Park, we want to put a new
[14:31]
sign there at five thousand and
[14:31]
we need a back mid-size backhoe
[14:32]
at sixty-five 000. So, that
[14:33]
comes to a hundred and
[14:33]
eighty-three thousand.
[14:34]
And then we did put on here the
[14:37]
parking fund which is again not
[14:40]
our general fund capital fund
[14:45]
but it's a separate fund. That
[14:48]
the parking garage needs
[14:52]
elevator replacement
[14:53]
unfortunately. Forty-five
[14:55]
thousand eight hundred dollars
[14:55]
and also the entry pay station
[14:56]
is in not in very good shape at
[14:57]
all and we're looking at
[14:57]
replacing that at fifty-three
[14:58]
thousand dollars. So, that
[14:58]
would total $98, 800 for the
[14:59]
parking garage. For grand
[15:00]
total, proposed. This will be
[15:00]
your 23 capital project of 1
[15:04]
million 6 13 thousand one
[15:08]
hundred fifteen dollars So, you
[15:09]
have the rest the other four
[15:09]
years in your pocket. I'm not
[15:10]
going to read through each item
[15:11]
there. Again, these are
[15:11]
proposed for future years
[15:12]
Change significantly almost
[15:12]
every year when we go back
[15:13]
through or adding items for our
[15:14]
New Year. We always look at
[15:14]
those out years as well. And
[15:16]
see what are what are the
[15:18]
changes we need to make. Um but
[15:21]
if you have any questions

specifically on any of the
[15:24]
items that I mentioned. I got

about spending the arc of money

on capital. They do have some

new rules in the final rule

that do allow more freedom in
[15:57]
the capital expenditures but we
[15:59]
still have to look at what the,
[16:00]
you know, what those
[16:01]
requirements would be. Then,
[16:02]
the last comment I got, you had
[16:03]
mentioned how long it takes to
[16:04]
get police proof. A lot of
[16:08]
people know that that's not
[16:09]
uncommon with anything. Uh
[16:11]
myself, I've ordered two semi
[16:13]
traps that I can't get for 11
[16:15]
months. Right. I can't get at
[16:16]
all.
[16:19]
Through for band traders. Tried
[16:20]
to order a half-million-dollar
[16:22]
piece of equipment couple weeks
[16:23]
ago. They said, yeah, you can
[16:25]
get it in November Um and and I
[16:28]
don't care if we're looking for
[16:28]
it. It it took me six weeks to
[16:30]
get it started. Right. For for
[16:32]
a big. Oh no, it is your grade.

So. Just the. Okay. All that to
[16:35]
say this. Is there a thing? Are

there things that we need to

maybe start looking at? And

maybe we need to order now.

even though we thought we could

get it we needed next year. And

then in most cases, like with

us, we ordered a Water 25, 000

don't want it till July and

they started to revive

September anyway but if it

comes in earlier, there's so

many people wanting them. We

can say, hey, give em our spot

and we'll take it, you know,
[17:06]
then, maybe city can do that so
[17:09]
that if we're looking at 14 of
[17:11]
us to get something and it's
[17:13]
dated 14 months, we get up when
[17:14]
we want it in the right budget
[17:15]
year but we had to order early.
[17:17]
The difficulty is in in the
[17:21]
government spending, we're not
[17:22]
allowed to order because that
[17:24]
come becomes an encumbrance and
[17:27]
we're not allowed that council
[17:28]
is not allowed to do that for
[17:31]
most items and capital to say
[17:33]
that that's ordered now but
[17:34]
we're not going to pay for it
[17:35]
till fiscal year 24, 25. We're
[17:37]
not allowed to do that. Okay.
[17:38]
We can do certain things like
[17:40]
debt service and bonds for
[17:41]
certain requirements but not
[17:43]
just for normal capital. Okay.

But I hear exactly what you're
[17:46]
saying And that's what we're
[17:49]
struggling with, right?

the profession and as well we

are just wrapping up a few

loose ends to make sure that we

have all the areas secured and

needed in order to accomplish
[19:01]
the park as intended. Um and so
[19:04]
we are still working with the
[19:06]
NC to get that completed. So we
[19:08]
should have large updates on
[19:09]
that for the public very soon.
[19:10]
And CEC is hard to work on the
[19:12]
design process. But it's
[19:13]
definitely a project that is
[19:15]
moving forward. Yes. I'm very

to add how happy I am to see

parks have always been special

maintain them. You have to make

sure that folks are going there
[19:49]
and they've got equipment
[19:51]
that's fun and and safe to play
[19:52]
on and so we're really happy
[19:54]
that council has been willing
[19:55]
to put money towards this and I
[19:58]
would imagine they will, you
[20:00]
know, they may make some tweaks
[20:02]
but I would imagine that they
[20:03]
will continue to do that. Cuz
[20:06]
that was part of council's goal
[20:08]
with their demolitions is the
[20:10]
one, is there one company doing
[20:11]
the complete all the
[20:13]
demolitions of the city or did
[20:14]
you have to get them out the
[20:16]
different way? Well, right now,
[20:17]
we do have one company that we
[20:19]
did a bid and they have the
[20:22]
twenty-four properties that
[20:24]
they're currently working on.

Whoever it is, they did a
[20:28]
wonderful job before they now
[20:29]
have to do their It is
[20:32]
reclaimed and they are doing a
[20:32]
very good job. A lot better
[20:36]
than Amazon knew the one I
[20:37]
brought up to you that the the
[20:38]
day without money. Right. And
[20:41]
when he left it. Yeah, we
[20:42]
want to make sure that it's a
[20:43]
complete demolition. Uh they're
[20:45]
not just walking away and
[20:47]
leaving a mess. So, they're
[20:49]
doing a very good job. Anything

how some of the specific

projects do tie in with the
[21:01]
comprehensive plan. Yes, thank

from the planning and
[21:07]
development department's
[21:08]
perspective as the advisory
[21:10]
staff, review all the paying
[21:12]
commission Um just to summarize
[21:16]
and to put in the context, of
[21:18]
course, when bringing this up
[21:20]
before you all, we're only
[21:21]
talking about the capital
[21:22]
budget. This does not include
[21:24]
all the other budgets and the
[21:26]
other financing options we have
[21:28]
for our comprehensive plan
[21:30]
projects which may include the
[21:32]
general fund, the tip funds or
[21:33]
grant funding that we may
[21:35]
receive. So, our staff report
[21:39]
and the information tonight,
[21:40]
mostly pertaining just to the
[21:41]
capital fund there. So, with
[21:44]
that, this year, four of the 27
[21:47]
goals from the comprehensive
[21:48]
plan that were identified as
[21:50]
needy, thankful capital funding
[21:52]
are being funded. Those four
[21:54]
goals are implementing the
[21:55]
weight finding program,
[21:58]
identifying new opportunities
[21:59]
to expand public art which we
[22:02]
consider part of the downtown
[22:03]
beautification line
[22:04]
essentially. The land taping
[22:06]
along key corridors. Once
[22:08]
again, downtown beautification
[22:10]
budget and then they continue
[22:12]
to improve city parks and
[22:13]
recreation areas. I just
[22:16]
want to talk about that last
[22:16]
one there for a moment since
[22:17]
that is that is receiving a
[22:20]
substantial increase in
[22:21]
funding. Um and I believe this
[22:23]
is an example of where the
[22:25]
leadership of the city is
[22:27]
aiming for quality over
[22:29]
quantity and we are definitely
[22:32]
going to make some substantial
[22:33]
improvements for our public
[22:34]
parks that have been much
[22:35]
needed for some time as the and
[22:38]
the city manager have posted
[22:39]
you all mentioned as well. So,
[22:41]
we were very excited even to
[22:43]
see the couple of the items
[22:45]
maybe didn't make the list and
[22:45]
we were quite okay with that
[22:47]
because we are achieving
[22:49]
quality goals at a very good
[22:51]
level just like going forward
[22:53]
with this proposed plan. One of
[22:55]
the items that was removed was
[22:57]
our rail trail funding but
[22:59]
projected to return in the
[23:01]
following year. That was
[23:03]
previously funded. I think
[23:04]
about 20 000 dollars but the
[23:06]
planning exultant perspective,
[23:09]
we're not concerned with that
[23:10]
at this moment because we are
[23:12]
intending to use the tax
[23:13]
increment finance district
[23:14]
funding for several aspects of
[23:17]
that during this calendar year.
[23:19]
So, we are not concerned if we
[23:21]
don't have the $20, 000 and we
[23:24]
think we're still going to get
[23:26]
a lot done on those rail trail
[23:28]
projects. Um so, we can see
[23:31]
that here and if you look
[23:32]
through the list, there's 27
[23:34]
items and I think if We look to
[23:38]
those. Some of these may not end up requiring any
[23:41]
capital funding. once it's said
[23:43]
and done. That's another thing
[23:44]
to consider is not all these
[23:45]
actually may or may not require
[23:48]
funding in the end. And we are
[23:51]
our departments continue to
[23:52]
work to make substantial
[23:53]
progress in completion on these
[23:55]
items. Um and to report that
[23:58]
out to you all. Uh annually as
[24:00]
we're going to discuss here at
[24:01]
the end of meeting tonight. On
[24:03]
a later agenda. So overall the
[24:05]
staff does recommend the
[24:07]
proposed capital improvement
[24:09]
plan for the city of Fairmont
[24:11]
and we find it more than
[24:12]
sufficient to obtain our goals
[24:14]
that city council has set forth
[24:15]
for us and you all as well. And
[24:16]
our comprehensive
[24:26]

summary, this is one of three
[25:55]
proposed text amendments to the
[25:58]
zoning code. We decided to
[25:59]
start out the calendar year
[26:01]
with one that has been out
[26:04]
substantial interest to our
[26:07]
citizens over the last couple
[26:07]
of years even before I was
[26:11]
hired home for the city and I
[26:11]
spent home occupations
[26:12]
especially with the pandemic.
[26:14]
Uh so, that's what the majority
[26:15]
of us pertains to but in
[26:17]
summary I'm going to skip over
[26:21]
home occupation We're proposing
[26:23]
to remove the multi-family
[26:26]
residence use standards as
[26:26]
those are now covered within
[26:28]
the individual zoning district
[26:29]
and these are duplicative or
[26:32]
additional standards that no
[26:33]
longer need to be applied to
[26:36]
those types of uses. Uh thanks
[26:38]
to the amendments that were
[26:39]
passed earlier in 2021. We're
[26:42]
also proposing to do two things
[26:44]
to restaurant lounges for
[26:46]
proposing to retitle it to
[26:48]
restaurant with alcohol sales.
[26:49]
Leaving that maybe more obvious
[26:53]
to folks reading the same code
[26:54]
about what we're talking about
[26:56]
there. Um as in our dialogue
[26:59]
with our stakeholders, business
[27:01]
owners, and citizens, we've
[27:02]
seen restaurant now kind of
[27:04]
generate some confusion about
[27:05]
what that really means when
[27:06]
they don't read the legal
[27:07]
definition of COVID. Um the
[27:10]
other thing we're doing is
[27:11]
restaurant lounges for some odd
[27:14]
reason is currently regulated
[27:15]
in two sections of youth
[27:17]
standards, right? One right
[27:18]
after the other and we're just
[27:19]
going to merge the too. Um to
[27:22]
combine them into a single
[27:23]
standard and then do some minor
[27:26]
adjustments to those
[27:27]
regulations in regards to
[27:28]
alcohol sales. But other than
[27:30]
that is primarily staying the
[27:32]
same. Then we're also proposing
[27:36]
to replace one of the sections
[27:38]
we just eliminated for
[27:40]
restaurants down all sales. Uh
[27:42]
with a new huge standard
[27:43]
section for manufactured home
[27:44]
sales and services. This will
[27:47]
simply require that there be
[27:48]
upper yards for manufacture
[27:51]
home sale. Um but when you put
[27:53]
mobile homes and stuff on a
[27:54]
large lot to sell those, you
[27:56]
have to have nice buffer yard
[27:58]
requirements around it so you
[27:58]
don't negatively impact the
[28:00]
adjacent properties. This is
[28:01]
especially pertinent with these
[28:02]
uses typically have very large
[28:05]
gravel or asphalt covered lots
[28:07]
and can tend to have skin 10
[28:09]
tend to have sport of water or
[28:10]
other types of land maintenance
[28:12]
issues that may impact adjacent
[28:14]
property owners. So our
[28:16]
findings, buffery yards, we
[28:17]
intend to hopefully mitigate
[28:18]
some of those potential
[28:21]
nuisances to those of others
[28:23]
Then, back to the bulk of it
[28:25]
though. Uh we are proposing
[28:28]
some substantial amendments to
[28:29]
the whole occupation
[28:32]
regulations. As they currently
[28:34]
stand, we classify home
[28:36]
occupations into two
[28:37]
categories. Minor and major. We
[28:41]
also then limit home occupation
[28:43]
based upon various general
[28:45]
descriptions of a list of types
[28:46]
of businesses and then it's up
[28:48]
to myself as a zoning
[28:50]
administrator to determine
[28:51]
which of the two categories
[28:53]
your proposed home business may
[28:55]
fall into. Whether that minor
[28:56]
or major. When it comes to
[28:58]
actually where this is allowed
[29:00]
currently. Minor is allowed
[29:02]
everywhere that you can have a
[29:03]
home. So as long as you're
[29:04]
living somewhere, you can have
[29:05]
a minor home occupation but
[29:06]
major home occupations are
[29:08]
prohibited from the general
[29:11]
residential district. If we can
[29:13]
recall from some of our
[29:15]
previous discussions in 2021,
[29:16]
general residential encompasses
[29:18]
about two thirds of the single
[29:19]
family housing within our city.
[29:21]
So, by that, we have barred two
[29:24]
thirds of single-family
[29:26]
homeowners and renters from
[29:28]
being able to have the majority
[29:30]
pole occupation by businesses
[29:33]
that they tend to run
[29:34]
especially now with online
[29:36]
sales and personal services and
[29:38]
the way those things have
[29:39]
changed over the over the last
[29:41]
few decades and the pandemic
[29:43]
exacerbated that. Um SAF has
[29:45]
found that to be a concern. So,
[29:47]
what we are proposing is a set
[29:51]
of home occupation regulations
[29:53]
that are even across the board
[29:55]
that generate the same
[29:57]
standards for all home
[29:58]
businesses to create clarity
[30:01]
for all home businesses so that
[30:02]
they understand exactly what
[30:04]
rules apply to them and what
[30:06]
may not and so, as an example
[30:08]
of what can generate confusion
[30:10]
currently, if you have a home
[30:12]
tutoring business, you may have
[30:14]
one client at your home.
[30:16]
However, there is no stated
[30:18]
limit for lawyers, architecture
[30:21]
firms, engineering, or other
[30:22]
types of office professional
[30:24]
businesses. They may be
[30:26]
conducting from your home. So,
[30:29]
with that, you can
[30:30]
theoretically have an entire
[30:30]
family over as your clients for
[30:33]
your architecture firm but you
[30:35]
can only have one violin
[30:37]
scooted over for your music
[30:39]
tutoring. What we're proposing
[30:41]
is that regardless of the type
[30:42]
of home business you have, you
[30:44]
may never have more than two
[30:46]
clients present. And this
[30:48]
would, we believe, accommodate
[30:50]
a wide range of full occupation
[30:51]
businesses, while also
[30:54]
respecting and maintaining the
[30:55]
residential quality of our
[30:56]
neighborhoods. For example if
[30:59]
you run a home salon, you can
[31:00]
have one person in the chair
[31:02]
and one person waiting. You can
[31:04]
have two pints over for your
[31:06]
law firm. You can have two
[31:07]
music students over for
[31:09]
tutoring. If you want to have a
[31:11]
Pilates studio, you can have
[31:13]
maybe a couple clients, a
[31:14]
couple, show up or maybe two
[31:17]
pints there and we take that
[31:18]
sufficient. Um so, that's a few
[31:22]
examples of how that two limit
[31:24]
can apply broadly to a lot of
[31:24]
businesses and hopefully still
[31:26]
limit the traffic and occupancy
[31:27]
and other things that are
[31:29]
happening there in our homes
[31:31]
and in our residential
[31:32]
neighborhoods. To continue, we
[31:34]
are setting nuisance standards
[31:37]
that you can't have any light
[31:40]
noise above ambient levels,
[31:43]
odors, or other nuisances that
[31:44]
could be generated because of
[31:46]
your business. Be perceivable
[31:48]
from beyond the property line.
[31:50]
So, if you're conducting a
[31:52]
whole business, we shouldn't be
[31:55]
able to notice. That's got
[31:56]
general guidelines. If you, if
[31:57]
you're doing it we shouldn't
[31:59]
even be able to tell except
[32:00]
for, as a note, we're also
[32:03]
proposing that all home
[32:04]
businesses will qualify for a
[32:08]
two-square-foot-sized sun. A
[32:09]
very quaint and small sign in
[32:12]
which they can advertise your
[32:13]
business. That sound would be
[32:14]
subject to all other
[32:15]
regulations for its sign code
[32:18]
including setbacks and also
[32:20]
would be prohibited for being
[32:21]
illuminated in any sense,
[32:22]
internally, externally, neon
[32:25]
signing, all of that would be
[32:26]
prohibited. Um so, thank out
[32:28]
just a small little yard sign
[32:30]
or small little sign hanging
[32:30]
off your porch just to at least
[32:32]
help guide people to your
[32:34]
home-based business. We're also
[32:37]
continuing to ban any outdoor
[32:39]
storage related to your
[32:40]
home-based business. No
[32:42]
materials, no goods can be
[32:44]
stored in the exterior of your
[32:45]
property regardless of fencing
[32:47]
or other types of landscaping
[32:50]
or physical barriers. You
[32:52]
cannot do anything related to
[32:53]
vehicle repair or sales in
[32:56]
order to prevent those
[32:57]
nuisances and prevent the
[32:59]
accumulation of vehicles that
[33:01]
junk parts and chemicals on
[33:03]
properties. Uh they all be
[33:05]
typically present. and there
[33:09]
was one other change and then I
[33:11]
forgot in my long speech here
[33:13]
that you all have put up with.
[33:19]
and then as well, we would make
[33:21]
sure that it is clear to them
[33:25]
about hours of operation. We'll
[33:26]
be between 7 AM and seven PM.
[33:29]
And that they are applicable to
[33:31]
all other building codes that
[33:34]
they have to sign an affidavit
[33:35]
acknowledging all of these
[33:37]
rules as currently stands. They
[33:38]
have to have a city business
[33:40]
license and maintain that
[33:41]
business license which also
[33:42]
requires the Secretary of State
[33:43]
Business License. That still
[33:46]
has the same size restriction
[33:47]
of no more than 25%. The gross
[33:49]
floor area of year quality
[33:50]
unit. Um and we usually use tax
[33:53]
assessors office data to
[33:55]
determine that and that the
[33:58]
vehicle, if there is a vehicle
[34:00]
related to the whole
[34:01]
occupation, it may not be above
[34:03]
a 10, 000-pound gross vehicle
[34:05]
mass rating and that would be
[34:08]
the essential, essentially a
[34:10]
full-size pickup truck. You
[34:11]
couldn't be any larger than
[34:12]
that. So, no large box trucks,
[34:14]
no super duty trucks, nothing
[34:16]
that, you know, what, then,
[34:18]
maybe a change, the residential
[34:20]
nature and your use of your
[34:21]
property. So, it would be be
[34:24]
observed maybe a small food
[34:24]
truck at the largest you could
[34:27]
get in that 10, 000 pound
[34:28]
category. those are our
[34:31]
proposals there and with this,
[34:33]
like I said, the elimination of
[34:34]
the minor major categories and
[34:36]
bringing it down to just a one
[34:38]
single category of home
[34:40]
occupation at the same
[34:42]
standards applied to across the
[34:43]
board. We believe that this
[34:46]
would increase confidence in
[34:47]
home business owners. This will
[34:49]
help foster small business and
[34:51]
hopefully make it easier for
[34:52]
folks to come forward and be
[34:55]
honest about running our own
[34:56]
business. Uh this is one of
[34:57]
those things that are sometimes
[34:58]
tricky to regulate. Um because
[35:01]
they're doing it right, we
[35:03]
shouldn't know they're there
[35:03]
anyways and so it's hard for us
[35:05]
to maybe know unless we see
[35:07]
them advertising their
[35:07]
business. So, so with that, we
[35:11]
believe that this will have a
[35:14]
positive impact as we recover
[35:15]
from the pandemic and allow for
[35:18]
greater flexibility in our
[35:20]
neighborhoods. There were many
[35:21]
other considerations that we
[35:23]
had regarding this. Um so, I'd
[35:25]
be happy that there came any
[35:26]
questions or comments from the
[35:27]
commissioners or the governor.

neighborhood. All all

residential areas? Yes,
[35:39]
Commission Ann is correct. They
[35:40]
would apply equally to all
[35:42]
districts. So, it would go. You
[35:45]
mentioned about vehicles. You
[35:47]
can understand about parking
[35:48]
that would be limited. But This
[35:52]
is an example which which
[36:00]
Selling snacks.

huge truck outside but
[36:08]
according to the statue, they
[36:09]
couldn't get rid of it because
[36:10]
the truck as big as it was, the
[36:11]
did not exceed the weight of
[36:14]
parking in a residential area.
[36:15]
There's what you, you said on
[36:17]
the having these vehicles
[36:23]
It depends on what you get on
[36:25]
the vehicle classification. If
[36:26]
we look at the staff report at
[36:28]
the beginning of this, we've
[36:30]
included a diagram from the US
[36:31]
Department of Transportation.
[36:34]
That kind of shows that and we
[36:36]
can see 10000 gross vehicle
[36:40]
weight is equivalent to a
[36:42]
full-size pickup truck, a cargo
[36:43]
van, a step van, so a very
[36:45]
security time food truck, or a
[36:47]
mini van. So, minivan is also
[36:49]
class 2 people. It to go above
[36:52]
that, you have to look at
[36:54]
walk-in van or a delivery a box
[37:01]
Yes, so a box truck would do,
[37:03]
therefore, be brave. As a, as a
[37:06]
class-free vehicle that would
[37:07]
not be permitted.
[37:10]
Nothing has come out of power
[37:16]
Uh we actually get support from
[37:18]
200, two other departments to
[37:20]
regulate home occupations. Code
[37:22]
enforcement is a very wonderful
[37:24]
development department helps us
[37:26]
out. Um they drive our
[37:28]
neighborhoods quite often and
[37:30]
usually report anything that
[37:34]
they notice and and same with
[37:35]
the finance office who is
[37:37]
constantly vigilant to make
[37:39]
sure that every business
[37:40]
operating in the city is
[37:41]
licensed. So, we have those two
[37:43]
departments who assist us. As
[37:44]
well, we are looking into with
[37:48]
our hopeful increase in
[37:49]
staffing in the very near
[37:50]
future. Uh we are looking to as
[37:53]
a department be out and the
[37:56]
neighborhoods more often
[37:57]
ourselves. So, why all three
[37:59]
departments trying to be
[38:00]
vigilant to make sure that
[38:01]
these are being adhered to as
[38:03]
well. We do find our citizens
[38:05]
be vigilant and usually come to
[38:08]
us with any concerns or issues
[38:10]
regularly. So, we've had
[38:12]
success with them so far.
[38:17]
the vigilance of the at least
[38:19]
in in my in and we've discussed
[38:23]
this. They won't come forward.
[38:25]
The gentleman we talked to him again. And he
[38:29]
will not come forward on it. He
[38:31]
said I don't want
[38:32]
repercussions. We then come
[38:34]
back to me. And he said this is
[38:37]
the code's joint. When you said
[38:38]
the code comes through it. I
[38:39]
said the code comes through. He
[38:41]
said if they come through. How
[38:43]
come I know it? And I see the
[38:44]
signs of it. But the code
[38:46]
doesn't. He told me this
[38:47]
yesterday. And he told me what
[38:49]
he sees. He said why can't the
[38:49]
code see them. And I said, I
[38:53]
don't know. I said, Paul,
[38:55]
Shane, tell him. He said, no,
[38:55]
I'm not going to call. And you tried to get a hold of me,
[38:59]
right? If you credited me, you
[39:01]
returned these calls but he is
[39:05]
he's a, he's an old enough, and
[39:07]
has ill, illness in the family,
[39:11]
and he doesn't want any hassle.
[39:13]
But he's concerned that the
[39:13]
neighborhood has this problem.
[39:15]
And the covid's not picking up
[39:17]
on. My kids say, without
[39:19]
particular instance, there's
[39:21]
noone contacts without saving
[39:21]
the addresses or names, code
[39:24]
enforcement did follow up, and
[39:25]
was able to make a
[39:26]
determination about, it's not
[39:27]
all for
[39:30]
adjustments to the property and
[39:32]
enhancements. He was correct?
[39:34]
Yeah, that's correct and we
[39:35]
were able to follow up with
[39:36]
that and they are working to
[39:39]
get that in compliance. Um so,
[39:43]
we and especially that
[39:44]
particular your neighborhood,
[39:47]
we have a very good vote
[39:48]
enforcement officer there. Who
[39:50]
I can pass on the area and it's
[39:52]
being stopped or it's I, the
[39:56]
exact context I don't want to
[39:58]
discuss openly just because it
[40:00]
is a, it is an open violation
[40:01]
for one of our citizens. Um,
[40:03]
but I can say that they are
[40:04]
working with them, and we are
[40:05]
addressing it. They are working
[40:08]
on it. They are. And, and that, particular code
[40:11]
enforcement official has been
[40:13]
so vigilant that it has caused
[40:14]
some issues as he's found
[40:16]
things that were maybe missed
[40:17]
for several years. And he's
[40:20]
forward to us. And which caused
[40:22]
some heartburn for a few of our
[40:23]
citizens. But, he's been pretty
[40:25]
good and I hope we maintain
[40:28]
that level of quality and and
[40:29]
can who's in charge of that
[40:32]
department seems to be hiring
[40:34]
individuals who have that
[40:37]
penalty level and that skill
[40:38]
level. So, I'm hoping we can
[40:40]
maintain that. That's that's
[40:42]
going to be what we have to do
[40:43]
with staff is we're going to
[40:44]
have to make sure everyone's
[40:46]
trained and they're being
[40:47]
vigilant and they're even if
[40:48]
it's uncomfortable at times, we
[40:50]
do need to ask our citizens to
[40:52]
follow the regulations passed
[40:53]
by council. Well, there was a
[40:56]
safety issue. I think we
[40:58]
discussed that it had been and
[41:00]
he was willing or not. If it
[41:02]
was being done, it was the
[41:03]
safety of the person who's
[41:04]
going to give them
[41:08]
Now, let me ask you this with
[41:10]
these little places dark felt
[41:14]
popping up all over the city.
[41:23]
day after meet the
[41:30]
ability to their life, they
[41:33]
would generally not in my
[41:34]
experience. And the reason
[41:35]
being is because of the degree
[41:37]
in business in which they're
[41:39]
conducting. So we are still
[41:40]
prohibiting like window display
[41:42]
and retail cell product and and
[41:44]
things like that. And so when
[41:47]
they conduct these small
[41:48]
home-based businesses and
[41:50]
because of the way they're
[41:51]
classified by building those.
[41:53]
They're not required to update
[41:56]
for the Americans with
[41:58]
Disability Act. Uh for their
[42:01]
clientele unfortunately. So
[42:03]
Now, however, as a business
[42:04]
owner, there are many things
[42:05]
that can apply to that such as
[42:06]
they need to make sure they
[42:08]
accommodate anybody who
[42:10]
requests services and and make
[42:12]
sure that they are being
[42:15]
compliant with civil rights
[42:16]
laws as they are applicable to
[42:17]
this businesses. When they and
[42:20]
this is what we hope for that
[42:22]
they are so successful and that
[42:24]
does become an issue that they
[42:25]
will move into a commercial
[42:26]
space and they will get a
[42:28]
proper space where it's more
[42:29]
accessible to the public. If
[42:31]
they are getting maybe a decent
[42:32]
number of books racket that
[42:33]
becomes less convenient to try
[42:34]
to accommodate those
[42:35]
individuals by meeting them at
[42:36]
a maybe a local restaurant, a
[42:38]
coffee shop that is accessible
[42:41]
to provide services. Um so,
[42:43]
that's where we hope that goes
[42:46]
in that direction because of
[42:46]
course, we don't want any
[42:47]
citizen left out of any
[42:49]
services or goods that may be
[42:50]
provided. Now, if a, if a
[42:53]
homeowner does want to update
[42:55]
on optionally, they are
[42:57]
permitted to do so and we do
[42:58]
have special exceptions for
[43:00]
handicap rents and
[43:02]
accessibility ramps to get in
[43:03]
and out of residences within
[43:05]
our zoning code to make sure we
[43:06]
can accommodate everybody the
[43:07]
best we can. So, we do at least
[43:10]
give them the option to do so.
[43:15]
with the residents of the area
[43:17]
still have the opportunity to
[43:20]
contest of go before the
[43:23]
billboard, the stop that they
[43:25]
feel that they're being a
[43:26]
nuisance. At this point in
[43:27]
time, no home occupation goes
[43:31]
up for a conditional use
[43:32]
permit. Um they're either
[43:33]
outright allowed or they're not
[43:34]
or they're prohibited. So, we
[43:37]
have not handled. They're not prohibited. They're
[43:39]
in there but they're causing a
[43:41]
nuisance. Do the neighbors have
[43:42]
the opportunity to to get them
[43:44]
out? Yeah, I did especially if
[43:46]
they violate any standard
[43:49]
currently written or as
[43:51]
proposed, then, of course, the
[43:52]
city has the right to go and
[43:54]
request that they cease
[43:56]
operation of the business. Uh
[43:57]
hopefully, it never goes that
[43:59]
far. Hopefully, we just get it
[44:00]
created. Um we get them
[44:02]
compliant but yes, they they
[44:04]
have that right to report that
[44:05]
to us and we have the right to
[44:07]
follow up and make sure that
[44:08]
they are compliant. So, because
[44:10]
we don't want any negative
[44:12]
impact from this right? We
[44:14]
don't anyway making a lot of
[44:16]
noise or creating much voter or
[44:18]
smoke or or junk in their yard,
[44:22]
eating a waste that started
[44:23]
from the business. We don't
[44:24]
want things like that
[44:25]
happening. So, we will make
[44:27]
sure all of that in the
[44:28]
neighborhood sector is going to
[44:28]
report name them and and to
[44:31]
from my perception, unless
[44:34]
there's extremely special
[44:36]
circumstances, there won't be
[44:37]
variances considered for that.
[44:38]
I mean, you you really have to
[44:40]
have some very unique
[44:42]
circumstances to your property
[44:44]
to make you qualify for
[44:45]
fairness to these types of
[44:47]
regulations. So, that would
[44:48]
need to be entertained. It's
[44:49]
either comply or don't. Or do
[44:53]
not conduct a business at your
[44:53]
home. Maybe because I'm a law
[44:56]
molder. Sort of congested area
[45:00]
over each side that I've seen a
[45:01]
lot of in my general
[45:05]
residential area has been in
[45:07]
problems with that type of
[45:08]
mental enrollment Uh had been
[45:11]
cleared up in past by the past
[45:11]
city council. So,
[45:15]
It's not a, it's not a being
[45:17]
antagonistic. I'm trying to see
[45:20]
what may come from You know, my
[45:23]
staff and I and I just want to
[45:24]
express it. I greatly
[45:26]
appreciate that because the
[45:27]
protection of our residential
[45:28]
neighborhood characteristics
[45:29]
and peace and enjoyment and the
[45:31]
welfare of those neighborhoods
[45:32]
is very important to us and we
[45:34]
don't want to we don't want to
[45:36]
jeopardize you either. We've
[45:37]
had several homes in our area
[45:38]
that have been flipped that
[45:39]
they're really nice. If you've
[45:41]
seen before, they're really
[45:42]
junky. They're really nice
[45:43]
homes now. And I can imagine
[45:45]
someone that wanted to buy one
[45:46]
of those now and finds this out
[45:48]
and says, well, wait a minute,
[45:49]
I mean, because our homes are
[45:51]
close together. I have when
[45:54]
they're parked in the front and
[45:55]
I'm going to have this lawyer
[45:56]
next to me. I I just can see
[45:59]
where I would be hesitant
[46:00]
moving into the city. I think
[46:03]
our brutalism now or maybe
[46:07]
I I can say that is the
[46:08]
opposite of being a positive
[46:10]
for the general presidential
[46:12]
aid. I don't know if that's
[46:13]

think manufactured home sales

and services are. Then, we are

proposing an amendment to
[48:43]
manufactured sales,
[48:45]
manufacturing sales artisan and
[48:47]
which we state that these uses
[48:50]
are subject to the same use
[48:52]
standards and size limitations
[48:53]
as retail and service uses. Uh
[48:56]
and our zone code which is a
[48:58]
unique approach for most cities
[48:59]
in West Virginia. We regulate
[49:01]
several business types by
[49:03]
square footage and so, Given
[49:05]
that these are similar in
[49:07]
nature because they are
[49:08]
generally a retail business.
[49:09]
They will be subject to the
[49:11]
same use restrictions and size
[49:12]
restrictions. As retail
[49:15]
services. Um we just want to
[49:17]
make sure that language is
[49:18]
clear. There's not a loophole
[49:20]
there. As well we are changing
[49:22]
the name of restaurant slash
[49:24]
lounge to restaurant without
[49:25]
public sales. And that is the
[49:28]
total of those proposed
[49:29]
amendments. Commission ers have

says, these are amendments, the

table three A. This dictates

where you can. perform a land
[51:56]
used conditionally perform a
[51:57]
land use Fort Worth prohibited.

Um so, we are proposing several
[52:02]
amendments to this. want to
[52:04]
throw at the earlier stuff we
[52:06]
just discussed with two prior
[52:09]
petitions. Um but also to
[52:11]
adjust some Well, we believe
[52:15]
we're inconsistencies that were
[52:19]
left over from the previous
[52:21]
version of the permitted uses
[52:23]
where they were right now in
[52:24]
each district and before we
[52:26]
amended the zoning code last
[52:28]
year because we just
[52:32]
essentially copy and pasted
[52:32]
them over into this chart but
[52:34]
there were odd things. Um but
[52:37]
I'll get the couple of those
[52:39]
examples in a moment. So, we
[52:40]
are proposing for example, we
[52:43]
are eliminating the two types
[52:44]
of home occupations eventually.
[52:46]
So, we're bringing that down to
[52:48]
one line and you can see the
[52:49]
strike through there for full
[52:50]
occupation we are limiting the
[52:52]
tax to bring down just one line
[52:54]
of within the table Um we are
[52:58]
looking at some changes to how
[53:01]
we regulate cemeteries. This is
[53:05]
there's just some odd ways that
[53:08]
we currently permit cemeteries
[53:11]
in the city where they're
[53:12]
outright allowed in some
[53:13]
districts. They're
[53:14]
conditionally parade of others
[53:15]
are banned and others and it's
[53:17]
in my profession preventing
[53:19]
sorry. it's inconsistent. It's
[53:23]
when looking at how we would
[53:24]
think where sofaries belong in
[53:26]
our community or when we should
[53:28]
allow for them or not. Um it
[53:31]
didn't make much sense in terms
[53:32]
of how they would impact the
[53:33]
case of hand uses or our
[53:35]
infrastructure and so forth. Uh
[53:37]
for example, we are proposing
[53:39]
to add them to the recreation
[53:41]
district which might seem a bit
[53:43]
odd but when you think about
[53:47]
cemeteries in the long run,
[53:49]
historically, they wore green
[53:51]
spaces for public use and Quite
[53:53]
frankly, when they get full,
[53:55]
when they are dying and and the
[53:58]
Muslims and and the plaques are
[54:00]
all used up, they typically
[54:03]
revert public green space and
[54:05]
so looking at that and how they
[54:07]
choose in that way, we are
[54:09]
proposing to have them
[54:11]
initially permitted for
[54:11]
recreational pre-zoned areas.
[54:13]
Um which will still give the
[54:15]
public input about whether we
[54:16]
should or should not allow
[54:18]
them. Um because once you have
[54:20]
a cemetery, it typically
[54:21]
doesn't go away. So, it's
[54:22]
definitely something I want to
[54:23]
talk about before we just allow
[54:25]
for cemeteries anywhere and
[54:27]
everywhere Um we're also
[54:31]
expanding institutional uses to
[54:33]
the technology district. That's
[54:35]
important because it covers
[54:36]
hospitals and we just had lawn
[54:38]
health open a small facility
[54:40]
there which qualified under a
[54:42]
different legal definition. But
[54:44]
just to make sure in case they
[54:45]
change their business approach,
[54:47]
those uses are covered and can
[54:48]
be permitted going forward. We
[54:52]
adjusted animal grooming
[54:52]
boarding to kind of match up
[54:54]
with animal care facilities in
[54:56]
a way that made sense. Um
[55:00]
We adjusted one small
[55:03]
adjustment, the bars and
[55:04]
nightclubs make them
[55:05]
conditionally permitted in main
[55:06]
corridor commercial as we
[55:08]
already have a few in those
[55:10]
districts. Um and the and that
[55:12]
is a higher intensity
[55:14]
commercial district. They will
[55:16]
remain prohibited and the
[55:17]
neighborhood mischief district.
[55:21]
Five. and you can see how
[55:23]
there's a highlight of them in
[55:25]
yellow as we've made
[55:25]
adjustments to this. Um there
[55:27]
is a correction that for we
[55:31]
made a typo in our earlier. Um
[55:35]
so many code and didn't catch
[55:36]
it but convenient stores with
[55:38]
fuel sales should always have
[55:39]
been prohibited for
[55:40]
neighborhood mixed use and we
[55:42]
just made a type out of an
[55:44]
accidentally put a conditional
[55:46]
use allowance there so we're
[55:48]
proposing to strike back and
[55:49]
remove that. Then for example
[55:52]
where some of the older
[55:55]
regulations that we're
[55:57]
proposing to address it makes
[55:58]
sense to get on the restaurants
[56:00]
and restaurant lounges. Uh you
[56:01]
can have a restaurant with
[56:02]
alcohol sales in the technology
[56:04]
district but you get to have a
[56:05]
restaurant.
[56:08]
and there were items like this
[56:10]
that were very nonsensical. So,
[56:13]
we're proposing to adjust that.
[56:14]
Um hopefully bring that in line
[56:19]
with what we believe is a
[56:20]
reasonable and fair and just
[56:22]
use of land. Then I think
[56:27]
that's it for the most part
[56:28]
other than the minor vessels
[56:29]
but few other definitions. This
[56:30]
is something that the staff is
[56:32]
also looking for input input
[56:34]
from you all as the
[56:35]
commissioners. I think the more
[56:37]
tans we have on, where we allow
[56:40]
for uses and don't allow for
[56:41]
uses is important. Um so, if
[56:43]
there is a discussion on this
[56:44]
or comment to the public, I
[56:46]
would be happy to hear about
[56:48]
from you all or if there's any
[56:50]
concerns with some of these
[56:51]

planning and development annual
[1:01:51]
report which is
[1:01:55]

[1:01:58]

you Mister President. I I'm not
[1:02:08]
going to go through this annual
[1:02:09]
report in detail. Um but I do
[1:02:11]
just want to make a couple
[1:02:13]
notes. This is a requirement
[1:02:15]
from the state government.
[1:02:16]
However, not to this degree. We
[1:02:19]
are required to report to you
[1:02:20]
all as the Planning Commission,
[1:02:22]
the city's progress on anything
[1:02:24]
related to your curfew. So,
[1:02:25]
whether that's improvement
[1:02:28]
plan, our comprehensive plan,
[1:02:30]
and anything else related to
[1:02:31]
the work that you all do. Um
[1:02:34]
but the Satan a step further
[1:02:35]
and I although she's not here
[1:02:38]
at the moment, I want to thank
[1:02:39]
the city manager, Valerie
[1:02:42]
Means, because she had brought
[1:02:43]
forward to our departments that
[1:02:45]
she wanted to do what's called
[1:02:47]
KPIs, key performance
[1:02:49]
indicators for each department
[1:02:50]
and the year twenty twenty-two,
[1:02:53]
and planning development
[1:02:54]
decided to get ahead of summer,
[1:02:55]
because we already had report
[1:02:56]
out to you annually, even
[1:02:58]
though we might not have done
[1:02:59]
it in the past, we are making
[1:03:00]
sure that this gets done going
[1:03:01]
forward, and so, We have put
[1:03:05]
together a more more
[1:03:07]
comprehensive review of all the
[1:03:10]
work our department has done
[1:03:11]
and the city has done related
[1:03:13]
to Ural's work and you're
[1:03:16]
advising of us as a city. So,
[1:03:18]
if we go to the first KPI chart
[1:03:21]
here, just want to touch on a
[1:03:24]
couple things that we're
[1:03:24]
looking forward to. We did only
[1:03:27]
have three additional use
[1:03:31]
permits within twenty
[1:03:32]
twenty-one So we did see a
[1:03:34]
decline to 2019 and potentially
[1:03:36]
earlier years in those. Those
[1:03:38]
can say to you as a staff
[1:03:40]
member for the BZA We're
[1:03:41]
primarily around non-conforming
[1:03:44]
uses and where businesses will
[1:03:47]
change their non-conforming use
[1:03:49]
status. So, one example was we
[1:03:53]
had a printing company go out
[1:03:53]
of business and a very large
[1:03:56]
retailer got approved to move
[1:03:59]
into their old building which
[1:04:00]
was much larger than what's
[1:04:02]
permitted in that zoning
[1:04:03]
district but because it was a
[1:04:05]
printing business before. Uh
[1:04:08]
it's a very large building and
[1:04:11]
they got approved to move into
[1:04:12]
that following they had to meet
[1:04:15]
several conditions. Uh in order
[1:04:19]
to get that approval. We had
[1:04:21]
nine variants requests
[1:04:27]
which
[1:04:30]
our target and why we've been
[1:04:34]
working so aggressively with
[1:04:39]
some zoning code
[1:04:42]
updates is zero. We would
[1:04:51]
ideally, in an ideal year,
[1:04:55]
never have a variance need. If
[1:05:01]
we have a zone to code that's
[1:05:06]
written well enough, there
[1:05:08]
should not be a need for
[1:05:12]
variants. We should have office
[1:05:16]
durations built in to hopefully
[1:05:23]
create fair, just use of land
[1:05:29]
for all of our citizens and
[1:05:33]
businesses.
[1:05:37]
We had no appeals, which is
[1:05:43]
always good too. Um, and then,
[1:05:47]
of course, as you all know, we
[1:05:48]
did thirteen zoning code text
[1:05:48]
amendments last year which is
[1:05:49]
very substantial. Um so, we did
[1:05:50]
a lot of work last year.
[1:05:50]
Everyone together to get that
[1:05:51]
through and we appreciate that.
[1:05:52]
We did We did nine minor
[1:05:52]
subdivisions. So, not as many
[1:05:53]
as we think we had anticipated
[1:05:53]
even but we'll see how that
[1:05:54]
goes moving forward and just
[1:05:55]
because we're development has
[1:05:55]
been slowed down because of the
[1:05:56]
pandemic. So, we do expect an
[1:06:00]
uptake as people merge and
[1:06:04]
divide their property. So,
[1:06:08]
that's what that covers mostly.
[1:06:13]
Uh we had no major
[1:06:17]
subdivisions for the third year
[1:06:19]
in a row. Um we had several
[1:06:23]
that were pending and we're
[1:06:27]
wanting to apply when they did
[1:06:29]
not come forward. So, we'll see
[1:06:33]
twenty twenty-two holds any of
[1:06:34]
those because those directly
[1:06:35]
come to you all. Uh we have
[1:06:35]
initial review in our office
[1:06:36]
and run through some either
[1:06:37]
concerns or comments with them
[1:06:37]
and then but ultimately, you
[1:06:38]
all make the recommendation for
[1:06:39]
their approval or disapproval.
[1:06:39]
So, if we do have any, they'll
[1:06:40]
be coming before you. We have
[1:06:41]
no abandonments last year which
[1:06:42]
was a significant decrease from
[1:06:45]
the prior year where we had
[1:06:51]
seven applications for rideway
[1:06:55]
managements and we did no
[1:06:59]
annexations in 2021 a year. Uh
[1:07:03]
the APRC was a little busier
[1:07:04]
than normal. We had a lot of signs going up in
[1:07:05]
downtown. That's mostly what
[1:07:05]
they covered but also a couple
[1:07:06]
of renovations and some hopeful
[1:07:07]
additions to new businesses. We
[1:07:07]
hope to see you in the coming
[1:07:08]
future. Um so, the king one, we
[1:07:09]
continue to see an increase in
[1:07:09]
time and death permits because
[1:07:10]
of pandemic. Um and our office
[1:07:12]
has also been vigilant about
[1:07:13]
issuing what we call a zoning
[1:07:13]
verification letter where that
[1:07:14]
is something we give to
[1:07:14]
realtors or property buyers or
[1:07:15]
potential business owners to
[1:07:17]
let them know what the zoning
[1:07:23]
regulations are for particular
[1:07:27]
property within the city. So, I
[1:07:31]
mean, either gives them peace
[1:07:33]
of mind or clarification that
[1:07:38]
what they're proposing is a
[1:07:42]
conditional use or prohibited.
[1:07:48]
Um so, we issued a lot of those
[1:07:52]
last years. Our department is
[1:07:56]
do grants. Um applying for 1. 9
[1:07:56]
million. Two of those which is
[1:07:57]
a substantial part of that
[1:07:58]
amount will not be announced or
[1:07:58]
awarded until this calendar
[1:07:59]
year. But we did receive a
[1:08:00]
hundred and sixty-nine thousand
[1:08:00]
five dollars in grants. Um in
[1:08:01]
2021. So we are and the city
[1:08:02]
chartered our department is
[1:08:02]
primarily responsible for grant
[1:08:06]
writing and management for the
[1:08:09]
city. So and well it usually
[1:08:14]
impacts the stuff you all
[1:08:17]
approved in confidence plank.
[1:08:19]
And then, we also had a a
[1:08:19]
increase in our marketing
[1:08:20]
communications efforts. Um we
[1:08:21]
have increased usage of
[1:08:21]
multiple platforms and even
[1:08:22]
started a podcast to help get
[1:08:22]
information out about how
[1:08:23]
Search City Services work and
[1:08:28]
certain departments or our
[1:08:34]
partnering organizations as
[1:08:36]
well. Such as today, an episode
[1:08:44]
was released about the Fairmont
[1:08:48]
Community Development
[1:08:51]
Partnership. And the work that
[1:08:56]
they do as a nonprofit for the
[1:09:00]
city to advance affordable
[1:09:05]
business space and housing for
[1:09:08]
our citizen So, you can see
[1:09:09]
those numbers there and as was
[1:09:09]
already in the works, we are
[1:09:10]
expanding our social media work
[1:09:11]
for the year of twenty
[1:09:11]
twenty-two The report then goes
[1:09:12]
into individual projects. Um I
[1:09:13]
won't go with them item by item
[1:09:13]
but I just want to touch on a
[1:09:14]
couple real quick and primarily
[1:09:15]
around the rail trail. Our
[1:09:15]
department did a lot of work to
[1:09:18]
prepare the city for some major
[1:09:20]
investment and the rail to
[1:09:24]
trail connector through the
[1:09:26]
city very long ago. Four and a
[1:09:26]
half mile gap and we believe in
[1:09:27]
the year of twenty twenty-2, we
[1:09:28]
may begin to close up to one to
[1:09:28]
two miles of that four and a
[1:09:29]
half mile gap. So, we're just
[1:09:30]
waiting for a few Few things in
[1:09:30]
the works to be finished up and
[1:09:31]
then we'll make official
[1:09:32]
announcements on exactly where
[1:09:32]
and how that's occurring. Um
[1:09:33]
design has not been completed
[1:09:33]
or anything. We're still at the
[1:09:34]
phase of negotiating the
[1:09:35]
property for that program.
[1:09:35]
Which is the biggest hurdle for
[1:09:36]
constructing this project. Um
[1:09:37]
but we've done a lot related to
[1:09:37]
that as well including giving
[1:09:38]
out sharers on the road. We
[1:09:39]
have new way finding signage
[1:09:39]
that public works department's
[1:09:40]
going to be putting up here in
[1:09:41]
the spring which will help you
[1:09:41]
find the rail trail much easier
[1:09:42]
and navigate your way now and
[1:09:43]
ideally, we hope to get people
[1:09:43]
to our commercial corridors.
[1:09:44]
Paramount Avenue, downtown,
[1:09:44]
Merchant Street, Morgantown
[1:09:45]
Avenue, and we want people like
[1:09:46]
him. We want them to see our
[1:09:46]
businesses, our shops, and the amenities and opportunities
[1:09:48]
that Fairmont offers to them.
[1:09:48]
So, hopefully they keep coming
[1:09:50]
back and visiting if they're
[1:09:50]
not from here and just as a
[1:09:52]
great point about that, the
[1:09:54]
last time I went out for my own
[1:09:56]
trail ride as National Cyclist,
[1:09:58]
I met a group of five people
[1:09:59]

time. So, this happens on a and
[1:10:08]
that's what Long River Trail
[1:10:09]
Conservancy who manages the
[1:10:10]
Trail Pass Perfect Sport will
[1:10:12]
report to. We see a lot of
[1:10:13]
tourists that often go
[1:10:15]
unnoticed by our businesses and
[1:10:17]
citizens and so we're trying to
[1:10:20]
make it even better for them to
[1:10:21]
get into the city and find
[1:10:22]
their businesses and to
[1:10:24]
hopefully come back and visit
[1:10:25]
and maybe even stay here. Um or
[1:10:28]
move here or work here
[1:10:29]
eventually. So, we're going to
[1:10:30]
continue to work on that. The
[1:10:31]
other thing online just now is
[1:10:35]
the expansion of our GIS and
[1:10:37]
mapping. We're trying to get as
[1:10:39]
much information off the public
[1:10:40]
as we can and the city expanded
[1:10:44]
our online mapping so much that
[1:10:46]
the company we do this through
[1:10:48]
gives us credits for the data
[1:10:51]
that we have to host on their
[1:10:53]
servers and we exceeded our
[1:10:56]
limit by about four 00 percent.
[1:10:59]
This calendar year. Uh we were
[1:11:00]
just have as much information
[1:11:03]
as we could. Um so, we had to
[1:11:05]
actually put a stop on at the
[1:11:07]
end of 2021. They have been
[1:11:08]
here in 2022. We will wrap that
[1:11:10]
up again and continue to get
[1:11:12]
more stuff out. With population
[1:11:13]
density maps, zoning maps,
[1:11:14]
urologist positions, and so we
[1:11:16]
brings a major subdivision, a
[1:11:18]
map event to you all, also get
[1:11:19]
close to the line for folks to
[1:11:20]
see. Um you can see the NBA
[1:11:23]
one, the recent one we did is
[1:11:24]
on my Invisible Forever One. Um
[1:11:28]
same of course, any appeals.
[1:11:28]
So, in our most used map and I
[1:11:29]
think it's because Election
[1:11:32]
season's oncoming Is the city
[1:11:35]
council's man. actually getting
[1:11:38]
a lot of use as of recently. We
[1:11:41]
go in to each of the different
[1:11:43]
boards and commissions in
[1:11:45]
detail. I just want to make one
[1:11:47]
note and that's about the Board
[1:11:49]
of Zoning Appeals and that when
[1:11:52]
they were hearing variances,
[1:11:54]
the majority of them had
[1:11:57]
conditions placed upon them
[1:11:58]
which I think from most legal
[1:12:03]
recommendations is a good
[1:12:04]
thing. That means more zoning
[1:12:05]
fields is a working as intended
[1:12:08]
and are holding these propertys
[1:12:09]
accountable and trying to set
[1:12:11]
the minimum standard required
[1:12:15]
when a grant of variance. So,
[1:12:16]
they're trying to make sure
[1:12:18]
that that when they set these
[1:12:19]
conditions, it's usually things
[1:12:21]
to try to prevent it like the
[1:12:23]
exception to the rule from
[1:12:24]
having negative impact on
[1:12:25]
someone. So, they have been
[1:12:26]
very vigilant about that. I
[1:12:28]
think the last time we approved
[1:12:29]
anything was a driveway issue
[1:12:31]
and I think they put four to
[1:12:32]
five conditions on that
[1:12:33]
approval that the homeowner had
[1:12:36]
to meet just to get the lung
[1:12:37]
variants. So, they are doing a
[1:12:40]
very good job and are
[1:12:42]
respecting the rules that you
[1:12:43]
all recommend the city council
[1:12:44]
approves. Uh so, I just want to
[1:12:46]
shout out to our other
[1:12:48]
volunteers who work on the BCA
[1:12:52]
There's a target here for the
[1:12:54]
summary of the grants that you
[1:12:55]
can see we applied for National
[1:12:58]
second to last page. or sorry
[1:13:00]
third to last page of this
[1:13:02]
annual report and as you can
[1:13:04]
see, we are trying to obtain
[1:13:07]
more grant funding. The
[1:13:09]
abandoned nine lambs grant
[1:13:10]
relates to rail trails. Um if
[1:13:12]
we can secure that from the
[1:13:14]
state, we are optimistic and we
[1:13:16]
should hear an announcement
[1:13:17]
about that spring. It'll be $1.
[1:13:19]
4 million dollars for that. He
[1:13:23]
has made enough money to build
[1:13:25]
the Royal Trail connector
[1:13:27]
extension all the way to the
[1:13:29]
Kerr Trailhead at the Edgemont
[1:13:31]
neighborhood edge, the city
[1:13:32]
limits, that makes industrial
[1:13:34]
resources, all the way to
[1:13:35]
downtown as an independent
[1:13:37]
trail. Down one street,
[1:13:38]
Roswell. So, that's very
[1:13:41]
exciting. if we can obtain that
[1:13:42]
funding. It'll also cover for
[1:13:44]
the study and the planning of
[1:13:45]
Eastside. Uh we're not
[1:13:47]
forgetting Eastside. They are a
[1:13:49]
critical part of that. We have
[1:13:49]
other things in the works too
[1:13:50]
on each side where we're trying
[1:13:51]
to get that kind
[1:13:55]
have that problem but that one
[1:13:58]
section of East Side Trail.
[1:14:00]
containing the property we are
[1:14:03]
working with a multitude of
[1:14:04]
partnerships at this moment
[1:14:05]
that have come through and are
[1:14:07]
assisting the city and trying
[1:14:08]
to get that resolved. So, I'm
[1:14:10]
very happy to say that. Uh I
[1:14:12]
can't because of the
[1:14:13]
sensitivity of property
[1:14:15]
negotiations on on how to or or
[1:14:18]
what is exactly going on in
[1:14:19]
that detail but we have we have
[1:14:21]
had a lot of people step up to
[1:14:23]
the plate to help the city to
[1:14:25]
hopefully get that resolved and
[1:14:27]
get that quality in trouble.
[1:14:39]
it's it's been difficult. We we
[1:14:40]
also believe in and this is
[1:14:41]
what our department's done. An
[1:14:44]
event that we would be
[1:14:45]
roadblocked in one particular
[1:14:46]
location. We have identified
[1:14:47]
two to three alternate routes
[1:14:48]
for every section of route
[1:14:49]
throughout the city. So, even
[1:14:50]
if we get stopped at one place,
[1:14:53]
that's fine. We're going to go
[1:14:54]
with plan B and then fantasy.
[1:14:56]
So, we're not going to let this
[1:14:57]
project come to a ground call
[1:14:59]
anymore. Um we're also applying
[1:15:01]
for another half a million
[1:15:02]
dollars in EPA Brownfield
[1:15:04]
Assessment Money. Um this can
[1:15:06]
be used in a broad array of
[1:15:10]
land areas but primarily
[1:15:13]
identifymental property made
[1:15:14]
the whole buildings to identify
[1:15:16]
the asbestos and lead to actual
[1:15:18]
like industrial sites to
[1:15:20]
identify contaminants and be
[1:15:21]
able to identify good and
[1:15:22]
healthy reuse of that property.
[1:15:25]
Um we had a $400, 000 grant
[1:15:28]
before that were just now
[1:15:29]
completing and so we're looking
[1:15:31]
forward to hopefully being
[1:15:32]
awarded this
[1:15:32]
half-million-dollar loan which
[1:15:33]
has made a substantial impact
[1:15:35]
on our community especially on
[1:15:38]
commercial properties and then,
[1:15:39]
some other smaller grants
[1:15:41]
there. You can see some smaller
[1:15:42]
dollar amounts but just to
[1:15:44]
mention the Bowers, Grant is
[1:15:46]
part of what's helping us with
[1:15:47]
the playground equipment that
[1:15:50]
Valerie had mentioned earlier.
[1:15:51]
So, the Bowers organization out
[1:15:54]
of Mannington grant us twenty
[1:15:55]
000, our playground equipment
[1:15:58]
Uh Mick Park had granted us
[1:15:59]
about 9 000 to do basketball
[1:16:01]
hoops. That's going to go up
[1:16:02]
soon at Windmill Rail Trail
[1:16:04]
Conservancy gave us two grants
[1:16:06]
last year. So, thank you to
[1:16:07]
them. Both related to rail
[1:16:08]
trail work. We're going
[1:16:10]
promotional video and the other
[1:16:12]
one is assisting with those
[1:16:14]
current property negotiations I
[1:16:16]
was mentioning earlier. We're
[1:16:17]
trying to acquire the land
[1:16:18]
either to build the trail. And
[1:16:20]
then we had Cares Act coming
[1:16:21]
that the city gave to United
[1:16:23]
Way to assist citizens in need
[1:16:25]
to prevent their utilities from
[1:16:27]
being shut off or from being
[1:16:28]
evicted due to not being able
[1:16:30]
to make rent during the
[1:16:32]
pandemic. Um so that was a
[1:16:34]
great thing that God may assist
[1:16:36]
us with. I just want to give
[1:16:37]
them a thank you as well. Then
[1:16:39]
there's a quick overview of
[1:16:41]

see our demographics and our
[1:16:45]
outreach on Facebook in
[1:16:47]
particular. Uh we didn't we

couldn't generate the data on

way the Facebook business suite

works. We were only able to
[1:16:56]
generate the Facebook
[1:16:58]
information so we listed that
[1:16:59]
here for you all. Um Facebook's

still approving that. So we're
[1:17:02]
hoping we have better crafts
[1:17:04]
and things to show you in the
[1:17:05]
following year. Um but we've
[1:17:07]
given that there just you some
[1:17:10]
insight on where people are and
[1:17:14]
this is an example 43. 8% of
[1:17:17]
people are residents of the
[1:17:19]
city of Paramount and we know
[1:17:21]
of and so that means through
[1:17:22]
social media, we're reaching a
[1:17:23]
lot of people outside of our
[1:17:25]
corporate limits. Which is a
[1:17:28]
good thing. We're growing the
[1:17:29]
city and and the things
[1:17:30]
happening here. So in
[1:17:31]
conclusion, I believe that we
[1:17:34]
were able to accomplish much
[1:17:35]
related to year-old purview and
[1:17:37]
the comprehensive plan and
[1:17:40]
we're going to continue to
[1:17:41]
strive to get all of those
[1:17:42]
goals met that you all set for
[1:17:43]
the city by 2018. so if there's
[1:17:46]
anything in particular that you
[1:17:49]
think is a higher priority and
[1:17:51]
we need to address in the near
[1:17:53]
future. I'd be happy to hear.

hoping to accomplish. We are

hoping to completely revise the
[1:18:53]
city sign regulations. Um most
[1:18:56]
businesses do not find the way
[1:18:57]
the rules are currently
[1:18:58]
written, conducive, and easy to
[1:19:00]
understand. Um that's usually
[1:19:01]
one voice contentious point
[1:19:03]
when I help a new business
[1:19:05]
owner open their business is
[1:19:07]
trying to understand and
[1:19:09]
navigate our sign regulations.
[1:19:10]
So, we'd to revise those and
[1:19:13]
format them in a way that's
[1:19:15]
easier and tell you what we're considering what we have
[1:19:18]
a draft form of already but
[1:19:20]
it's not vitalized.
[1:19:21]
Essentially, if you want to
[1:19:22]
sign, it'll be a one-page of
[1:19:24]
information. If you want a wall
[1:19:25]
sign, you'll print off one
[1:19:27]
sheet of paper that will tell
[1:19:28]
you everything you need to know
[1:19:29]
about Wallside. If you want a
[1:19:30]
free standing sign, you
[1:19:32]
prevent, you print one sheet of
[1:19:33]
paper about that or projecting
[1:19:35]
someone or illuminative sign.
[1:19:37]
So, we can say, hey, what type
[1:19:38]
of signs you're interested as a
[1:19:39]
business center? We can just
[1:19:41]
print you off a little one
[1:19:41]
pages and hand them to those
[1:19:42]
business owners so they can
[1:19:44]
easily make the best decisions
[1:19:46]
for their business and and feel
[1:19:48]
like they understand what we're
[1:19:51]
asking them what they can and
[1:19:51]
cannot do. So, we're hoping to

get to that. Um as well, some

of our sign standards are out
[1:19:56]
of date based upon US Supreme
[1:19:58]
Court decisions recently. So,
[1:20:00]
we are looking to get those
[1:20:01]
updated to be in line with
[1:20:03]
those Supreme Court decisions.

So, does not invalidate our
[1:20:05]
current sign code. It just
[1:20:07]
means we have to be extra
[1:20:08]
concerned in the way we address
[1:20:09]
certain types of defined signs
[1:20:12]
at this point in time. So, are
[1:20:12]
you looking make making the
[1:20:15]
codes just easier to understand
[1:20:17]
or he's looking at other than
[1:20:18]
the Supreme Court is used. Are
[1:20:20]
you looking at changing any of
[1:20:21]
these regulations because I I
[1:20:24]
think we've got some really
[1:20:26]
restrictive side ordinances in
[1:20:28]
Fairmont. They really prohibit
[1:20:30]
business from being able to
[1:20:33]
make their own business visible
[1:20:34]
and advertise. I mean, I'm not
[1:20:36]
looking at Las Vegas but I
[1:20:39]
think our side movements is a
[1:20:39]
really We are looking to change
[1:20:42]
some regulations and not just
[1:20:44]
to make it more readable and
[1:20:45]
user friendly but we are
[1:20:47]
looking to amend some standards
[1:20:48]
and I can't say at this point
[1:20:49]
in time whether I believe that
[1:20:51]
will be more permissive or less
[1:20:52]
permissive. I think it will be
[1:20:54]
immense. Um as the way I
[1:20:55]
brought the amendments to you
[1:20:56]
all so far. It's been a bit of
[1:20:58]
a mix where we regulate some
[1:20:59]
things more, some things less.
[1:21:01]
I think that's probably how
[1:21:02]
it's going to end up with sound
[1:21:04]
code. Um I have some ideas
[1:21:06]
personally as a professional
[1:21:08]
about what I think should be
[1:21:09]
less. But We'll wait after I
[1:21:12]
finish doing some more research
[1:21:13]
and verify that that's a good
[1:21:14]
idea or not. Um with some other
[1:21:17]
professional opinions on that.

So, well, I I think that's what

we're going to do, Commissioner

look at developing the right of

Wayne Street Standards. That's

that we're trying to accomplish

this hybrid zoning code where
[1:21:34]
we actually regulate the design
[1:21:36]
of streets. So we tell you what
[1:21:39]
you should have sidewalks or
[1:21:40]
shouldn't or how big they are
[1:21:40]
or street lighting or no street
[1:21:42]
lighting or how should they be
[1:21:44]
parking lanes or no parking
[1:21:46]
lanes and this also will help
[1:21:48]
guide the major subdivisions
[1:21:48]
and new housing developments
[1:21:50]
and or or an accident areas in
[1:21:52]
those corporate developments.
[1:21:53]
So we have a standard of what
[1:21:56]
we expect out of the streets.
[1:21:57]
With a multitude of options for
[1:21:58]
some flexibility. Especially
[1:22:01]
given the photography in
[1:22:02]
Fairmont. Um the challenges
[1:22:04]
faced with that. So we hope to
[1:22:05]
get those written up. Those
[1:22:07]
will be in our development
[1:22:08]
section. And then we hope to
[1:22:10]
improve the development and
[1:22:12]
major subdivision standards. Um
[1:22:14]
there are requests for that and
[1:22:16]
with an account plan I have not
[1:22:18]
identified exact changes at
[1:22:19]
this time. But we hope to
[1:22:21]
address that later this year.

Improved historic historic
[1:22:24]
design standards. Another thing
[1:22:25]
that contentious sometimes with
[1:22:29]
new business owners is what the
[1:22:30]
historic design review

commission regulates and

doesn't so we're hoping to have

we hope to have just as a

user's standpoint, improve

graphics across the entire

zoning building. Um modern
[1:22:47]
zoning codes are usually very
[1:22:49]
picture oriented and that has
[1:22:51]
proved to be more beneficial
[1:22:53]
for the public. Um noone likes
[1:22:55]
to read paragraph upon
[1:22:57]
paragraph of regulations and
[1:22:58]
sometimes we have a nice simple
[1:22:59]
graphic that summarizes our
[1:23:01]
intent or or how to read and
[1:23:04]
understand what the code is
[1:23:04]
written out. that will often
[1:23:06]
help them with our with
[1:23:09]
navigating and feeling
[1:23:12]
comfortable with our zen code.
[1:23:13]
So, this way, they can own a
[1:23:14]
home or a business and family
[1:23:16]
plan here in the city of
[1:23:17]
