» Thank you.
[4:52]
» Um, can everybody hear us out there? It
[4:55]
just sounds weird up here with the air
[4:57]
conditioning running as all. So, as long
[4:58]
as you guys can hear, that's fine. Okay.
[5:01]
I have a proclamation this evening um
[5:05]
for the 100th anniversary of St.
[5:07]
Michael's uh building and the historic
[5:10]
and the Hilddtergard Historic Building.
[5:13]
So, whereas in 1926, the people of
[5:15]
Fairport Harbor witnessed the
[5:17]
construction and dedication of St.
[5:18]
Michael's Greek Catholic Church, a place
[5:20]
of worship established to serve the
[5:22]
spiritual needs of generations of
[5:23]
faithful parishioners. And whereas for
[5:26]
86 years from 1926 to n to 2012, St.
[5:30]
Michael's Church stood as a cornerstone
[5:32]
of faith, fellowship, culture, and
[5:33]
community life um enriching the village
[5:36]
and preserving the traditions of his
[5:38]
congregation. Whereas the following
[5:41]
as sorry whereas following the closure
[5:43]
of St. Michael's Church in 2012. The
[5:45]
church building remained vacant until
[5:47]
2016 when it was purchased and renovated
[5:49]
by the Steringer family whose dedication
[5:52]
preserved this landmark for future
[5:54]
generations. Whereas in 2016 the
[5:56]
building entered a new chapter as the
[5:58]
Hilder Garden Retreat Center providing a
[6:01]
welcoming space for spiritual renewal,
[6:03]
reflection, hospitality, and community
[6:05]
gathering. And whereas in 2018 the
[6:07]
retreat center was transformed into
[6:09]
Hildergard House, becoming home of the
[6:11]
community of St. Hildergard, an
[6:13]
independent Christian community rooted
[6:15]
in Catholic tradition and composed of
[6:16]
worshipers both local and afar. And
[6:20]
whereas in 2021, the community of St.
[6:22]
Hildgard entered into a contract to deed
[6:25]
agreement to purchase the building,
[6:26]
thereby securing the property's future
[6:28]
as a place of worship and faithful
[6:30]
service in the village of Fairport
[6:31]
Harbor. And whereas Hillgard House
[6:33]
stands as a shrine dedicated to St.
[6:35]
Hilaring
[6:37]
uh the renowned 12th century German
[6:39]
visionary, composer, theologian,
[6:41]
herbalist and doctor of the church whose
[6:43]
legacy inspires a holistic appreciation
[6:46]
of faith, creation, healing, art and
[6:48]
music. And whereas 2026 marks the
[6:51]
centennial anniversary of this
[6:53]
remarkable building, celebrating a
[6:54]
century of faith, renewal, and community
[6:57]
life. Now therefore, I, Timothy S. Mayor
[6:59]
Ross, mayor of the village of Fairport
[7:00]
Harbor, Ohio, do hereby proclaim our
[7:02]
heartfelt congratulations to the
[7:04]
community of St. Hildigard on the
[7:06]
occasion of the 100th anniversary of
[7:08]
this historic church building and extend
[7:11]
sincere appreciation for its faithful
[7:13]
stewardship, preservation, and continued
[7:15]
service to the spiritual, cultural, and
[7:17]
community life of our our village. Um, I
[7:20]
think there's going to be a um I think
[7:22]
it's September 13th. Don't quote me on
[7:25]
the date. I know it's in September that
[7:26]
is when they're actually going to be
[7:28]
having their service and I'm sure I'll
[7:30]
be reading this proclamation there. Uh
[7:32]
but very happy to do it and very happy
[7:34]
to have um
[7:36]
yeah it is it's on se September 13th is
[7:40]
the um event at 2 p.m. So anyway, good
[7:44]
to have him in town. Uh Rick and Shannon
[7:46]
have done a wonderful job with the
[7:47]
building. So that's for me this evening
[7:51]
um from our solicitor, Mr. Jim Lions. No
[7:54]
report tonight, Mr. Mayor.
[7:57]
» Thank you, sir. From our administrator,
[8:00]
Mr. Darling.
[8:01]
» Uh, my full report is in your packets,
[8:04]
but do have a few notes. Uh, contractors
[8:09]
were out today and will be on site
[8:10]
throughout the week at 625 East Street,
[8:14]
uh, the former Denoritech building. They
[8:17]
are doing an environmental assessment.
[8:19]
Uh this is vital for the Lake County
[8:21]
Land Bank to be able to apply for
[8:22]
demolition funding. Uh they are working
[8:25]
on a very tight timeline. Uh their goal
[8:27]
is to be able to apply for this current
[8:29]
round of state brownfield remediation
[8:32]
funding that I believe closes
[8:35]
on September 11th.
[8:38]
Uh the new Fort Street project will
[8:40]
start the week of September 7th. Uh
[8:42]
Enbridge has already started their gas
[8:44]
line replacement in the 500 block.
[8:48]
» [clears throat]
[8:48]
» Uh the additional electric line to the
[8:51]
gazebo at Veterans Memorial Park has
[8:53]
been installed. Uh they have their final
[8:56]
electric inspection at the end of this
[8:58]
week. Uh the service department will
[9:00]
begin to cover that trench and replace
[9:02]
the two sidewalk pads and reinstall that
[9:05]
brick walkway. Uh we would like to thank
[9:08]
the Arts and Culture Alliance for their
[9:10]
collaboration with us on this project.
[9:12]
Um would definitely be great to have
[9:14]
have additional electric capacity at the
[9:16]
gazebo.
[9:18]
Uh on July 31st, the International City
[9:22]
County Management Association approved
[9:24]
our application and we are now listed on
[9:27]
the
[9:28]
directory of recognized local
[9:30]
governments. We are the third community
[9:34]
in Lake County behind Payneesville and
[9:36]
Menor uh and the first in Ohio since
[9:39]
2009 to get to get on that list. Uh and
[9:42]
that is a list of communities that have
[9:44]
established a professional management
[9:46]
position.
[9:47]
Um, and then as of last night, we were
[9:51]
informed by ODNR that we have received a
[9:55]
30 a $30,000 grant for geotechnical work
[10:00]
at the Prospect Street Hillside. That's
[10:02]
the 600 block of Prospect Street. Uh,
[10:05]
this is the CMAG grant that appears in
[10:08]
your packet. Uh, as of right now, we
[10:10]
don't have a grant agreement or anything
[10:12]
more from ODNR. uh just that letter
[10:15]
notifying us that we have been awarded
[10:17]
this grant. Um this is also the grant
[10:19]
that West Creek Consery has committed to
[10:22]
providing a $30,000 match for.
[10:26]
And finally, the demolition of the
[10:28]
former Lighthouse Grill started today.
[10:31]
Uh the water service line was cut and
[10:34]
capped and they should be getting um the
[10:37]
actual building demolition shortly.
[10:40]
» Nice.
[10:41]
» Okay. Um, I know I think Mr. Beron asked
[10:45]
at the last meeting about the water
[10:48]
going down the hill there at the end of
[10:50]
East Street into Prospect and I know we
[10:53]
had or um Pat Pat was there. That's
[10:56]
actually a sanitary line that's leaking.
[10:58]
So, so they ran some dye through that.
[11:00]
So, I know we're in contact with the
[11:02]
homeowner there to get to to get that
[11:04]
addressed.
[11:05]
» So, that's what that water is there.
[11:06]
There it isn't it isn't coming out of
[11:08]
the water system.
[11:10]
» Um,
[11:12]
Go ahead.
[11:13]
» It's worst water system,
[11:15]
» You know. Yeah, it is what it is. So,
[11:18]
yeah. So, the die the die was bright
[11:21]
green and that's what we saw coming out
[11:22]
the other end. So, yeah. Um All right,
[11:26]
Lucas, I don't have anything else for
[11:27]
you this evening. Um does council have
[11:29]
anything for for Lucas?
[11:32]
» They the trees that were cut down, those
[11:34]
are getting completely removed and the
[11:37]
stumps ground out, right?
[11:38]
» Yes. Yeah. So, they're not done yet. Um
[11:42]
they they ended up responding to a few
[11:44]
different emergencies uh this week. So
[11:46]
our project got pushed back a bit, but
[11:48]
the um independent tree is working in
[11:50]
three different groups. So their first
[11:52]
team will remove all the limbs and leave
[11:54]
the stump or leave the trunks and then
[11:57]
the second team [snorts] will remove the
[11:58]
trunks and then their last team will
[12:01]
bring their stump grinder through.
[12:02]
» Any idea when that'll happen?
[12:05]
» Soon, I hope. Um,
[12:08]
one of the benefits of us being very
[12:09]
flexible is we got considerably better
[12:11]
pricing. That's fine.
[12:15]
Quick quick question back on the
[12:17]
sanitary system.
[12:19]
Um,
[12:21]
I would imagine that proposes a health
[12:24]
risk.
[12:25]
We have we contacted the health
[12:26]
department to to help facilitate
[12:30]
» The health control of that. No, but we
[12:32]
reached out to the um Lake County
[12:35]
Department of Utilities that owns the
[12:36]
system.
[12:37]
» Okay.
[12:37]
» And informed them.
[12:39]
» Okay. Does the metrop parks know about
[12:41]
this? It's leaking down on their
[12:42]
property.
[12:43]
» I
[12:45]
did not inform them, but
[12:47]
» Yeah, we have a number of people that
[12:48]
are walking up and down that area and
[12:50]
with pets and such. So, you know, you're
[12:52]
dragging sanitary water around.
[12:57]
» Thank you, Lucas, and thanks for finding
[13:00]
that out.
[13:05]
» [snorts]
[13:12]
» Okay, very good. Uh, the engineer is not
[13:15]
here this evening. His he did submit his
[13:17]
report. Does council have any questions
[13:19]
for the engineer that we could relay?
[13:24]
Okay. Fiscal officer report.
[13:27]
» Okay.
[13:28]
The financial report is in your package.
[13:31]
For the month of July, we received
[13:33]
$258,35410.
[13:37]
Part of that is um the advance on real
[13:40]
property uh real property revenue.
[13:43]
Expenditures for the month of July were
[13:45]
$575,258.30.
[13:50]
Um, the reconciled balance. Let me flip
[13:53]
here. [clears throat]
[13:59]
Oh, these back and forth pages. I'm
[14:01]
sorry.
[14:03]
There it is. Your reconciled balance for
[14:05]
the month of July um is 4,654,84544
[14:14]
year to date. Since January, we've
[14:17]
received 3,200,746.37.
[14:23]
Expenditures to date are $2,671,53457.
[14:31]
Uh, let's see. Interest for the month of
[14:33]
July, I'm sorry, was $14,828.
[14:38]
Year to date, we've collected $97,14023.
[14:43]
the um the remainder the reconciliation
[14:47]
your fund status is included in the
[14:48]
package and I'd appreciate it if you
[14:51]
would consider a motion to approve the
[14:53]
payment register which are the last
[14:55]
couple pages in um the financial report.
[15:01]
» So moved.
[15:02]
» Thank you.
[15:03]
» Second.
[15:04]
» I'm sorry. Thanks
[15:07]
» For
[15:08]
» I
[15:08]
» Hez. I
[15:10]
» Becknik.
[15:10]
» Hi
[15:11]
» Shaver.
[15:11]
» Hi
[15:12]
» Horton. Hi.
[15:13]
» Okay. Um, as of yesterday, we completed
[15:16]
our obligations for the budget process
[15:19]
with the county. Um, we met with the
[15:22]
county budget commission and, um,
[15:25]
answered whatever questions they had on
[15:27]
the budget as it was filed and the next
[15:29]
thing they will send us is the um,
[15:31]
approval of levy rates. So, that is
[15:34]
forthcoming, but we're done with our
[15:36]
conversations with them. So, those are
[15:38]
done. That's all I got.
[15:41]
» Okay. Thanks, Chris. Any questions?
[15:43]
» I got one. Chris, can you let us know
[15:46]
like next month where we are with
[15:48]
interest before you got here as opposed
[15:50]
to the last couple years?
[15:53]
» I can tell you it is actually um I think
[15:56]
when I looked at it last, it was about
[15:59]
maybe $1,500 for the entire year. And
[16:04]
from the moment I walked in, we started
[16:06]
making money. So yeah, it was about
[16:09]
$1,500 a year, if that. He he kept all
[16:12]
of the money local. It was all in the
[16:14]
checking account. It was all in the
[16:16]
bank. And and to me, that puts all of
[16:19]
that money at risk because you've we
[16:21]
have only FDIC coverage for the first
[16:23]
250,000. I about stroked out. There was
[16:26]
a I don't know a little more than a
[16:28]
million dollars in the checking account
[16:29]
when I started.
[16:31]
» So
[16:33]
» That's awesome.
[16:34]
» Thanks. Thank you. Oh, you're welcome.
[16:36]
Thank you.
[16:38]
Okay, reports of the standing
[16:40]
committees, uh, police and fire are in
[16:42]
the packet. Anyone got any questions
[16:44]
from the chiefs?
[16:47]
I know, uh, we're gearing up for the
[16:50]
start of school around the new school
[16:51]
building. I would, um, ask for patience
[16:57]
and continued patience of those in that
[16:59]
area, but also the parents that are
[17:02]
going to be dropping off students for
[17:04]
the first time. this, you know, this
[17:06]
goaround,
[17:08]
I would imagine, what is it, Thursday, I
[17:10]
think, is first day of school, right?
[17:12]
So, I'm sure to be a bit of chaos or
[17:14]
look like a bit of chaos, but um the
[17:17]
school is is as willing to be a good
[17:20]
partner as they always are and we'll get
[17:21]
the communication out and whatever we
[17:23]
think we have for a traffic plan, I'm
[17:25]
sure, is going to look a little
[17:26]
different after the first couple of days
[17:28]
and maybe even the first week of school.
[17:31]
Um, we do know and are very aware of the
[17:34]
condition of Vine Street in front of the
[17:36]
school. Um, we're working diligently to
[17:39]
try to at least get a temporary. I don't
[17:42]
know if we're going to grind it down or
[17:44]
or if we're going to try to patch some
[17:46]
more spots there, but um, we know it's
[17:48]
degraded pretty bad there. So, and you
[17:51]
know, it's not in the budget this year,
[17:53]
this go go around to pay pave that
[17:55]
street. Even if it was, it wouldn't be
[17:57]
done. It wouldn't have been awarded by
[17:59]
now to have it done. So, and you know,
[18:01]
new new New Four Street, Lucas, when is
[18:03]
New Four Street going to start?
[18:05]
» New Forest starts on September 7th.
[18:07]
» So, September 7th is when that's going
[18:09]
to start getting paved and and probably
[18:11]
not even paved at that point, right?
[18:12]
Don't we have some digging to do?
[18:13]
» Yeah, they won't pave until probably
[18:15]
November,
[18:16]
» Right? So, there's still a little bit of
[18:17]
work to do there. So, again, the area
[18:20]
around the school for pickup and drop
[18:22]
off, again, I encourage everyone to to
[18:26]
use their patience there. So, it's going
[18:28]
to be different and we and we will get
[18:30]
through it. Chief, anything to add?
[18:34]
» Uh, just just for the uh Vine Street um
[18:37]
where the road is deteriorated, uh we're
[18:40]
going to barricade that off starting
[18:42]
tomorrow, make that a oneway temporarily
[18:45]
uh for the time being. And uh we're
[18:47]
going to have to curtail some parking
[18:49]
right there to make way for any type of
[18:52]
emergency vehicles uh or anything that
[18:55]
uh basically is going to have to make
[18:56]
their way up there. Um it's going to be
[18:59]
kind of narrow in there if we had
[19:01]
parking on that one side. So uh today I
[19:05]
delivered some uh notices out to some of
[19:07]
the residents there just informing them.
[19:09]
I was focusing more on the parking
[19:11]
itself so that they're they're aware
[19:13]
that the signs are going to go up just
[19:15]
in that area. Got it. And that and we're
[19:17]
only restricting that during the school
[19:19]
hours and that's so we can make sure we
[19:21]
can get emergency vehicles in in and out
[19:23]
of there when we need to do so. Um so
[19:27]
again, thanks thanks to the chiefs,
[19:29]
thanks thanks to the school uh for their
[19:32]
involvement and their participation in
[19:34]
this too. We have a new super this year.
[19:36]
Um, so let's give him a warm a warm
[19:39]
welcome to Fairport and try to put our
[19:41]
best foot forward there for him and and
[19:43]
understanding that he's walking into a
[19:45]
pretty big uh transition period here.
[19:48]
Okay. Um, goods, grants, welfare, tree
[19:52]
commission.
[19:53]
» Yeah. Um, so just to kind of piggyback
[19:55]
on what you're saying, um, doesn't
[19:58]
really fall under goods and grants, but
[20:00]
we had a school safety committing
[20:02]
committee meeting last week where, um,
[20:05]
new super principal,
[20:08]
Lucas, myself, the chiefs, the SRO, um,
[20:13]
and a few other people were there and we
[20:17]
talked about everything that you, you
[20:19]
just went over, all the road
[20:20]
construction,
[20:21]
um, the building has even changed.
[20:23]
changed since we left last year. Um, so
[20:28]
fire exits, I mean, they were, it was a
[20:31]
great conversation. It was an hour long.
[20:34]
It was very productive. I left feeling
[20:36]
like everybody in that room is trying
[20:38]
their absolute best. So, um, to your
[20:41]
point, if we can all just give each
[20:43]
other a little grace and understand that
[20:45]
it will likely change several times, but
[20:49]
we're turning a corner and it's almost
[20:51]
done. [snorts] So, um just just want to
[20:55]
make everyone aware that everyone is
[20:57]
working very well together. Um
[21:01]
for the fall, we have property
[21:04]
maintenance code updates on our list of
[21:06]
things to tackle next. Just ongoing
[21:08]
effort to update our code.
[21:11]
And um tree commission Lucas mentioned
[21:14]
that the 37 trees are actively coming
[21:17]
down.
[21:19]
We have plans to plant 15 trees this
[21:22]
fall. We'll do another planting in the
[21:25]
spring. Um the tree commission will be
[21:28]
at the community day with some more
[21:32]
specific information on our village, our
[21:35]
plans for urban forestry. So if you're
[21:39]
out and about that day, please stop by
[21:41]
and learn a little more about that.
[21:45]
» That's what I have.
[21:46]
» Okay. Thank you, Christina. So then, uh,
[21:49]
the planning commission, um, we voted to
[21:52]
move the comprehensive plan before
[21:54]
council. Um, I know Lucas, you didn't
[21:57]
you didn't address it in yours. Do you
[21:59]
want to give us the adoption process
[22:01]
here? I know it's going to go on for
[22:02]
three reads. Council, you just got the
[22:04]
plan before you this evening. Do
[22:07]
apologize if that wasn't in your packets
[22:08]
beforehand, but they just weren't
[22:10]
printed off yet. So, there is a printed
[22:12]
version. Read it at your leisure.
[22:14]
There's a lot of good stuff in there. Uh
[22:16]
there will be a test at the next
[22:18]
meeting.
[22:19]
» Okay.
[22:21]
But anyway, uh Lucas, you want to walk
[22:23]
through the adoption process?
[22:25]
» Sure. Um so the short version [snorts]
[22:27]
of it is there isn't one. Um OC does not
[22:32]
provide us with a required means to
[22:36]
adopt a comprehensive plan. Uh so our
[22:39]
plan is three reads with a public
[22:41]
hearing and a presentation by Verdantis
[22:44]
at the September meeting.
[22:46]
um
[22:48]
that that that way the public has the
[22:49]
opportunity to do a deep dive, look at
[22:52]
it, read it, embrace it, have
[22:54]
comprehensive plan reading parties if
[22:56]
they are so inclined. Um
[23:00]
but we're treating it sort of like we
[23:02]
would a zoning text amendment with the
[23:04]
full three reads. Um there's also a
[23:07]
digital copy online at fairport
[23:09]
harbor.orgpl /pl
[23:11]
um as well as copies of all of the
[23:14]
documents that that the comprehensive
[23:16]
plan steering committee access um their
[23:19]
presentations and the reports that came
[23:20]
out of that.
[23:22]
» Mayor, I think that's pretty consistent
[23:24]
with what we did 25 years ago as well.
[23:26]
Almost exactly except for the digital
[23:28]
copy.
[23:29]
» Okay.
[23:30]
» I only have one question about that.
[23:33]
» Sure. because we had a public meeting
[23:37]
at the BFW,
[23:38]
» The comprehensive plan committee.
[23:41]
» Uh,
[23:45]
so opening up another can of worms at a
[23:48]
public meeting
[23:50]
when we've already agreed on a plan.
[23:54]
» Yeah. I don't know that I look at it as
[23:56]
opening up a can of worms because it's
[23:59]
pretty much a done plan. It's again it's
[24:01]
just a it's a chance to showcase the
[24:04]
work that got done and to invite the
[24:07]
comprehensive plan committee members
[24:09]
back to another meeting. So you know
[24:11]
what I mean to recognize their efforts
[24:13]
in what was put here. There's a lot of a
[24:16]
lot of work a lot of conversation went
[24:18]
into this. Um, and again, the three
[24:21]
reads is there there's no hurry to adopt
[24:24]
it. And we wanted to give Arantis the
[24:26]
chance to present at at the next meeting
[24:28]
and again and invite those folks back
[24:30]
that spent time putting this together.
[24:33]
At least that's that that's how we're
[24:35]
viewing it here. And then nothing again,
[24:38]
someone's going to tell tell us we did
[24:40]
something that we shouldn't have done or
[24:41]
we rushed it or this that or the other,
[24:43]
but we got public input. We gave the
[24:46]
public plenty of chances here.
[24:49]
You know, I've been very open and I know
[24:50]
most of anybody that's been involved in
[24:52]
a comprehensive plan, we have been very
[24:55]
willing to seek what do you want your
[24:57]
village to look like? You know what I
[24:59]
mean? So, um they people can still give
[25:02]
us the opinion, but to to your point,
[25:04]
Mr. Horton, this is a done plan and it's
[25:07]
before council now. And if council wants
[25:09]
to change something there, you know,
[25:10]
they certainly can, but um I think it's
[25:13]
a pretty good comprehensive plan here
[25:15]
for our future.
[25:16]
» [snorts]
[25:17]
» So
[25:18]
» And I'm with you. A lot of work went
[25:19]
into it.
[25:20]
» Yeah.
[25:21]
» And a lot
[25:21]
» I appreciate your concern. Yeah.
[25:24]
» Okay.
[25:29]
Well, that's all I have for that. Um,
[25:33]
so 2025-44
[25:35]
has been tabled. 2026-44
[25:38]
has been tabled. Resolution uh 2026-55.
[25:44]
This is for third read and and we can
[25:46]
vote on this this evening. Ordinance
[25:49]
2026-55, an ordinance by the council of
[25:52]
the village of Fairport Harbor Lake
[25:53]
County, Ohio to levy assessments for the
[25:55]
improvement of various streets in the
[25:57]
village by supplying said streets with
[25:59]
electric street lighting.
[26:01]
» Move to adopt.
[26:02]
» Second.
[26:03]
» And Jim, I believe I still need to move

Um, resolution number 2026-69, a
[28:15]
resolution adopting the Fairport Harbor
[28:16]
comprehensive plan 2026 as the official
[28:20]
comprehensive plan for the village of
[28:21]
Fairport Harbor and not declaring an
[28:23]
emergency. That's on first read.
[28:29]
Resolution
[28:36]
2026-70,
[28:38]
a resolution to support submission of a
[28:41]
state of Ohio brownfield remediation
[28:43]

[29:14]
» Let me recall that. I'm sorry. Um, all
[29:17]
right. Let's start over. Heights.
[29:18]
» Hi,
[29:19]

[29:21]
» Hi,
[29:22]

[29:23]

[29:28]
All right. I'm I'm looking.
[29:30]
» You're trying to make me vote no, aren't
[29:31]
you?
[29:32]
» No.
[29:33]
» Hi.
[29:33]
» Thank you. [laughter]
[29:36]
» Sorry.
[29:37]
» That's okay.
[29:40]
» Resolution number 2026-072,
[29:43]
a resolution to approve amend 2026
[29:45]
permanent appropriations in the total
[29:47]
amount of $1,14747
[29:51]
for the expenses and declaring an
[29:53]
emergency.
[29:54]
» Move to adopt. Second.
[29:56]
» Move to suspend the rules.
[29:58]
» Second.
[29:59]
» I got this.
[30:01]
» Horton. There's suspend. Horton.
[30:04]

[30:05]
» I.
[30:05]
» Shaver.
[30:06]
» Hi.
[30:06]
» Berton.
[30:07]
» Hi.
[30:07]
» Heights.
[30:08]
» I.
[30:09]
» Adopt. Horton.
[30:10]
» I.
[30:11]
» Backnik.
[30:11]
» I.
[30:12]
» Shaver.
[30:12]
» Hi.
[30:13]
» Berton.
[30:13]
» Hi.
[30:14]
» Heights.
[30:14]
» I.
[30:15]
» Thanks.
[30:16]
» Okay. So, resolution number 2026-73.
[30:19]
I'm going to ask that we put this on
[30:21]
first read. And the reason for that is
[30:23]
is the senior center has the funds to
[30:25]
buy this. They just have not been
[30:27]
appropriated and we need to have those
[30:29]
appropriated. We didn't get the
[30:30]
requested in time before the council
[30:32]
packets went out, etc. Chris, I know
[30:35]
you're here this evening. Do we need is
[30:36]
there any timeliness to this? Can it
[30:38]
wait till September? Do we need a
[30:40]
special council meeting after the
[30:43]
appropriation is done?
[30:44]
» You know what? I have to call the
[30:45]
company and see how long it takes to get
[30:47]
these items in. That was my only thing.
[30:50]
» Okay.
[30:50]
» I'd like to just get those old machines
[30:53]
out.
[30:54]
» Understood.
[30:54]
» They're so bad.
[30:55]
» So, if you if you'd work with Chris, get
[30:57]
it appropriated. If you need a special
[31:00]
between se between now and September,
[31:03]
let us know and we'll try to pull pull
[31:04]
something together for you.
[31:05]
» Okay.
[31:06]
» Okay. But if not, it'll it'll probably
[31:08]
I'm I'm sure it'll pass at the next
[31:09]
council meeting.
[31:10]
» Okay.
[31:11]
» Okay.
[31:11]
» Okay.
[31:12]
» Thank you. So, resolution number
[31:13]
2026-73,
[31:15]
a resolution authorizing the Fairport
[31:17]
Harbor Senior Center to purchase fitness
[31:19]
center equipment and declaring an
[31:21]
emergency. That's on first read.
[31:34]
Okay, I think I'm good there. Um,
[31:39]
council have anything this evening? U
[31:41]
just quickly and I don't know maybe this
[31:43]
has already been taken care of. I'll put
[31:46]
on my civic club hat for a minute. U the
[31:49]
civic club has planned their event for
[31:51]
the 30th. Have they asked for permission
[31:53]
to use park?
[31:55]
» I think so.
[31:57]
» Have we asked for a variance to the
[31:59]
noise ordinance?
[32:00]
» That's not a thing anymore.
[32:02]
» Okay.
[32:04]
» Yeah, I'm I'm pretty sure that they sent
[32:05]
in a form or at least it's on all of my
[32:09]
calendars. Okay. thing.
[32:11]
» What are the times? What's going on on
[32:13]
the 30th? Vern, tell us all about it.
[32:16]
» Community days.
[32:17]
» Noon to 4.
[32:18]
» What do we do every year?
[32:20]
» Community day, I should say.
[32:23]
» Noon to four, right?
[32:24]
» Noon to 4 in Veterans Park.
[32:27]
» Okay.
[32:29]
» Quack race this year.
[32:32]
» I haven't heard anything about the quack
[32:33]
race.
[32:33]
» I haven't either. I I hope I didn't just
[32:35]
speak it into existence. [laughter] So,
[32:38]
normally normally I get asked to set it
[32:39]
up or or or blow blow the ducks around
[32:42]
» And I was going to see if Mike was in
[32:44]
town if you know if if if that were the
[32:46]
case and your father-in-law and get his
[32:48]
leaf blower. So,
[32:49]
» All right. Very very good. Hope to see
[32:52]
everybody there. Uh before I go to the
[32:56]
uh public this evening, um
[33:01]
I I guess I do the executive session
[33:03]
piece now or no, we'll do that at the
[33:05]
end. Okay. So that'll be after the
[33:07]
public session, but at the end of last
[33:10]
meeting, um I need to extend an apology
[33:13]
to Elizabeth Shaver. Uh there were some
[33:15]
words expressed by myself to you and um
[33:19]
you and I have spoke since and um I
[33:22]
certainly didn't mean to make you feel
[33:23]
the way I made you feel. That
[33:25]
conversation should have been had in
[33:26]
private. It was it was after the meeting
[33:28]
but it was done within the the earshot
[33:31]
of public. So I so I do apologize for
[33:32]
that.
[33:33]
» Thank you. I appreciate you bringing
[33:34]
that up.
[33:34]
» Yeah. Yeah. So um so nothing else from
[33:38]
us here this evening. Does the public
[33:40]
have anything?
[33:46]
Okay. Thank you, public. So, I I move
[33:50]
that council enter into executive s
[33:52]
executive session pursuant to Ohio
[33:55]
revised code section 121.22 22
[33:59]
G3 for conferences with the village
[34:01]
attorney concerning disputes involving
[34:03]
the village that are subject to pending
[34:05]
or imminent court action and to include
[34:07]
the administrator and fiscal officer.
[34:10]
And I do believe we will be taking
[34:11]
action coming out. Correct. We will be
[34:13]
taking some some form of action coming
[34:15]
out out of executive session.
[34:17]
» So, mayor, since you can't make the
[34:18]
motion, I'll make it for you.
[34:19]
» I was going to say I'll second that.
[34:21]
» I ask I I just read what Lucas put in
[34:24]
front of me. Thank you. I ask that
[34:26]
council move
[34:28]
what the mayor said.
[34:29]

[48:56]
[music]
[49:04]
» Third,
[49:05]
» Berton.
[49:06]
» I Heights
[49:07]
» I.
[49:08]
» Thank you.
[49:10]
» Okay, we need a motion. Uh, Mr. Lions,
[49:12]
will you uh give us the words for the
[49:14]
motion, please?
[49:15]
» Yes. Coming out of executive session.
[49:18]
Uh, this is a followup to
[49:21]
a motion that was made uh back in the at
[49:24]
the April meeting uh to ratify and
[49:28]
accept the settlement with Great Lakes
[49:30]
Crushing. in terms of uh the project uh
[49:34]
on St. Clair Street, the waterline,
[49:36]
where they had filed a lawsuit and then
[49:38]
that turned into an arbitration case.
[49:40]
And after much back and forth, as we
[49:42]
discussed back in April, uh a settlement
[49:45]
amount was reached of $200,000.
[49:49]
Uh and uh out of that $200,000,
[49:53]
Verdantis has agreed to contribute uh
[49:56]
$50,000 towards that settlement amount
[49:59]
so that the net amount to the village is
[50:02]
$150,000.
[50:04]
And uh I thought it would be a good idea
[50:06]
if council uh even though we did it at
[50:10]
the April meeting if they just ratified
[50:12]
and confirmed because finally after this
[50:15]
fourmonth period it appears that Great
[50:17]
Lakes Crushing is ready to sign the
[50:20]
final documents and uh get this chapter
[50:22]
over with here. So
[50:24]
» I'll make a motion to echo Mr. Lion's
[50:27]
statement.
[50:28]
» Second.
[50:31]
» Bton. I
[50:33]
» Horton.
[50:33]
» Hi
[50:34]

» Hi
[50:36]
» Heights.
[50:37]
» Hi.
[50:37]
» Thank you.
[50:38]
» And just one additional motion for
[50:40]
Lucas's benefit.
[50:42]
» Uh that Lucas is the one who's
[50:44]
authorized to sign uh the documents with
[50:48]
Verdantis and also Great Lakes Pres to
[50:50]
affect the settlement.
[50:56]
» Second
[50:57]
» Horton.
[50:58]

[51:03]
» Thank you.
[51:05]
» Okay. I don't think there's anything
[51:06]
else this evening. I need a motion to
[51:08]
adjurnn.
[51:09]
» So move.
[51:10]
» Second.
[51:12]
