[6:14] authorizing requests for RFPs for design

[6:18] services for the Lorraine Road project.

[6:20] Ms. Otter explained the city has $1.4

[6:22] million in CMAX funding to update the

[6:25] lighting system and $1.8 million for

[6:28] urban paving.

[6:29] And this legislation will tie those

[6:31] design elements together to begin the

[6:33] process of improving Lorraine Road. This

[6:36] design will move daily traffic as well

[6:38] as emergency services more efficiently

[6:40] for improved air quality. This phase of

[6:43] work, which will be similar to the

[6:44] ongoing Center Ridge construction, will

[6:47] integrate with the long-term redesign of

[6:49] Lorraine Road. Previous studies for the

[6:52] Lorraine Road corridor yielded different

[6:53] results, so the city will be moving in a

[6:55] new direction and a preliminary

[6:57] engineering study conducted by American

[6:59] Structure Point will be presented to

[7:01] Council on June 8th.

[7:03] This initial phase of construction is

[7:06] expected to begin in 2028 and continue

[7:09] into 2029. Ms. Mann moved to put the

[7:12] ordinance up for second read and return

[7:13] to committee. The motion passed

[7:15] unanimously.

[7:16] Ordinance 26-27 authorizing a

[7:19] cooperative service agreement with the

[7:20] APHIS Wildlife Services for deer

[7:23] management.

[7:25] This agreement would authorize the city

[7:26] to contract for services under this USDA

[7:29] program to cull up to 100 deer beginning

[7:32] in October 2026 through March 2027. Mr.

[7:36] Chaski explained that the USDA was the

[7:38] only responsive contractor. He said the

[7:41] USDA used heat mapping to estimate our

[7:43] herd size as at a minimum of 25.8 deer

[7:47] per square mile. The agency will work

[7:50] with the Division of Wildlife to create

[7:52] our deer management plan, including

[7:54] designating bait and shoot sites,

[7:56] locating a central processing site in

[7:58] the city, and plans for disposal of the

[8:00] deer. If the city donates the meat to

[8:03] the Cleveland Food Bank, there will be

[8:04] additional expense for processing.

[8:06] Legislation permitting hunting in the

[8:08] city will have to be passed proceed with

[8:10] a program. Ms. Wearing asked if there

[8:12] was a if there was leeway to cull more

[8:13] than 100 deer if necessary. Mr. Chasky

[8:16] said the city will continue to monitor

[8:18] deer interactions and surveys of herd

[8:20] size to determine the effectiveness of

[8:23] the program. Ms. Mann moved to place the

[8:25] ordinance up for second subsequent third

[8:27] reading. The motion passed unanimously.

[8:30] Resolution 26-08

[8:32] prohibiting construction of a salt dome

[8:34] or fuel tank at 22100 Mastick Road. The

[8:37] property in question was not purchased

[8:39] so Ms. Mann moved that this legislation

[8:41] be removed and tabled from further

[8:43] consideration. The motion passed

[9:41] Matt stated that the issuance and sale

[11:32] Councilwoman Mann asked if the $300,000

[11:35] cost for the city street lighting was

[11:38] just for the residents. Director Pace

[11:40] said no, it is for all parcels in the

[11:42] city.

[11:43] This ordinance

[11:45] was placed on second and subsequent

[11:47] third read and passed 7 to 0. Ordinance

[11:50] 2633 authorizing the contract with Smith

[11:53] and Obie for boiler replacements. Henry

[11:56] Chaski provided additional details about

[11:59] this ordinance. The boilers at City Hall

[12:02] and Gemini Center are at the end of

[12:04] their lives.

[12:06] Councilwoman Mann asked if the boilers

[12:09] were properly installed. And Henry

[12:12] Chaski provided feedback that the

[12:14] boilers had been abused and were

[12:17] properly installed but have met the end

[12:20] of their lifespan.

[12:23] Waring inquired about the boilers

[12:26] and the renovation project and Smith and

[12:29] Obie being under contract by the state

[12:31] of Ohio and they did provide the best

[12:33] price for the state for the RFP process,

[12:37] which is which which did go out to bid

[12:40] and they were selected for the project.

[12:42] Councilwoman Minnick asked about the

[12:45] warranty on the boilers and boilers do

[12:47] typically last 10 to 15 years. This

[12:51] ordinance was placed on second and

[12:52] subsequent third read and passed 7 to 0.

[12:56] Ordinance 2634 authorizing owner's rep

[12:59] for the fire department coed facilities.

[13:02] Chief Ruffin was present to answer

[13:04] questions. He stated that this was an

[13:07] urgency

[13:09] because the fire station needs coed

[13:11] facilities and that he is very

[13:13] comfortable with Arnie Warner doing the

[13:15] project. Councilwoman Waring asked if

[13:18] this was a conflict of interest to have

[13:20] Obie to have

[13:23] Arnie Warner as the owner's rep and the

[13:25] architect for the same project. And

[13:28] Megan Otter stated that it's a separate

[13:30] project. It's not part of the city hall

[13:32] project. Um and the coed facilities is

[13:36] the only part of the project that Arnie Warner is um contracted for.

[13:42] This was placed on second and subsequent

[13:44] third read and passed 7 to 0.

[13:47] Ordinance 2635 authorizing the purchase

[13:50] of vehicles for the service department.

[13:52] Director Hitch stated that two new

[13:55] vehicles, a truck and an SUV, were will

[13:58] be purchased and were approved in the

[14:00] budget. They will replace a 2014 GMC

[14:04] truck and two police vehicles. This was

[14:08] placed on second and subsequent third

[14:10] read and passed 7 to 0.

[14:12] Ordinance 2636

[14:14] authorizing the sale of city-owned

[14:16] football equipment requested for

[14:18] emergency passage.

[14:21] Director Kent provided additional

[14:22] context

[14:24] um and this piece of legislation

[14:27] was passed and placed on emergency um

[14:31] pass a pace on second read with

[14:33] emergency passage and passed zero 7 to

[14:36] 0. Resolution 2610, the donation of

[14:40] football equipment from GCFF

[14:44] requested on emergency passage. Director

[14:46] Kent provided additional context on this

[14:48] ordinance and Fairview Park received a a

[14:51] donation for new football equipment for

[14:54] G from GCFF and it will replace the

[14:57] current football equipment. This was

[15:00] placed on second read and passed and

[15:03] requested for emergency passage and

[15:05] passed 7 to 0. Resolution 2611, county

[15:09] fiscal officer to advance taxes on 2020

[15:12] for 2027. Director Pay provided

[15:15] additional information on this

[15:17] ordinance, the changes, and the delays

[15:19] to advance the property taxes by the

[15:21] state will not impact Fairview Park

[15:23] because we have reserves in the city

[15:25] budget. This resolution was placed on

[15:38] additional information on this

[15:40] ordinance. City Council will have an

[16:12] The committee discussed the issue Gemini

[16:14] Center. Present were members of the Rec

[16:16] Department including Director Kemp.

[16:19] gave Council an

[16:20] operational update and owners

[16:22] representative Roger Riachi provided

[16:24] Council a construction update.

[16:26] Director Kemp indicated that the

[16:27] Recreation Department is essentially

[16:29] building an aquatics division from

[16:31] scratch. As we open the natatorium, it

[16:33] will be made up of all new staff, new

[16:35] building structures, new supplies, new

[16:37] equipment, and new procedures. There is

[16:39] a lot that needs to be done to make the

[16:41] natatorium operational again over the

[16:43] next several weeks while construction is

[16:45] reaching completion.

[16:46] This work includes training staff on the

[16:48] pool systems, mechanicals, and

[16:49] equipment, and training lifeguards. The

[16:52] city is hoping to hire 50

[16:54] lifeguards and currently have trained

[16:56] 28. The city must also set up workspaces

[16:59] and break rooms for the aquatic staff.

[17:02] Director Kemp wanted to set the

[17:03] expectation that though the pool will be

[17:05] opening, that doesn't mean that all

[17:06] areas of the pool will be open at all

[17:08] times in the beginning. The number of

[17:10] areas open will be subject to the amount

[17:12] of staff that we are able to put in the

[17:13] facility to maintain and

[17:16] For example, the slide may not be open

[17:18] at all hours or the children's area may

[17:20] not be open during the early morning

[17:22] hours. The goal is to maintain at least

[17:24] two lap lanes at any given time.

[17:27] In preparation for opening, the

[17:28] recreation department is working to

[17:29] maximize the opportunities for birthday

[17:31] parties, lane rentals, and other

[17:33] monetization of the natatorium.

[17:35] Additionally, a membership drive will be

[17:37] held June 15th through July 15th. Any

[17:40] new members who join the Gemini Center

[17:41] during that time will receive two free

[17:43] months on top of their membership. A

[17:45] postcard will be sent to residents with

[17:47] this information.

[17:49] There will be an opening celebration for

[17:51] the natatorium. Wave Fest, a three-day

[17:53] event, will be held June 26th through

[17:55] 29th and will feature a ribbon cutting,

[17:58] first splash, dive-in movie, and more.

[18:00] This event will be for residents and

[18:02] members only.

[18:03] Once open, Westlake and Rocky River both

[18:06] have pool rehabilitation projects going

[18:08] on and will be using the Gemini Center

[18:10] for reciprocity when it opens up.

[18:13] As a measure of goodwill, both cities

[18:15] offered memberships to their outdoor

[18:16] pools to Fairview Park residents this

[18:18] summer. There is a limited number of

[18:20] memberships available. Westlake has

[18:22] already sold out and Rocky River still

[18:24] has some availability as of this time.

[18:27] Construction is wrapping up. In the

[18:29] leisure pool, the new play feature,

[18:30] slide, and liner have been installed.

[18:33] The leisure pool is likely to be filled

[18:35] with water this week to begin further

[18:36] operational adjustments. The competition

[18:39] pool has already been filled with water.

[18:41] The wave room repairs are complete. Tile

[18:44] is in final completion and final

[18:45] inspections are being lined up.

[18:47] It is It is expected that the Ohio

[18:50] Department of Health will do its final

[18:51] inspection in the next week or so.

[18:54] Final inspections are the last barrier

[18:55] before substantial completion.

[18:57] Construction should be finalized in the

[18:59] next 2 weeks and closeout documents,

[19:01] such as operations manuals and as-built

[19:04] drawings, will be completed by the end

[19:05] of June.

[38:15] long-winded uh statement here about the

[38:18] splash pad at the Gemini just so that we

[38:21] put this to bed. I know the councilwoman

[38:23] wearing has some questions about it.

[38:25] I've spoken to other members of council

[38:27] and the rec commission about it well

[38:29] before construction started and uh want

[38:31] to make sure that we

[38:33] kind of put this to bed for the time

[38:34] being.

[38:37] As we all know, the splash pad is now

[38:39] roughly 20 years old and at the end of

[38:41] its operational life.

[38:43] It has not been in operation since 2021.

[38:47] During the long debate in 2023 on the

[38:49] future of the natatorium, it was

[38:51] determined that many of the envelope

[38:52] environmental issues in the pool area

[38:54] were exacerbated by the exit doors

[38:56] leading to the splash pad.

[38:59] Temperature differences as well as

[39:00] chemical imbalances

[39:02] caused by the regular opening and

[39:03] closing of the exterior doors were

[39:05] mentioned.

[39:06] To date, I have received no indication

[39:08] from reputable and knowledgeable sources

[39:11] that any changes in the HVAC system have

[39:14] remedied these problems.

[39:16] When the budget for the natatorium

[39:17] rebuild was discussed in council and

[39:19] then put forward to voters in 2023, an

[39:22] exterior door rethink and a remodel of

[39:24] the splash pad was not included.

[39:31] Operationally, the original decision to

[39:33] allow for patron movement to and from

[39:35] the pad and the natatorium was poor.

[39:38] It was hard to get to and not very

[39:39] functional during the few months of the

[39:41] year that it was in operation.

[39:43] Entry to the pad area would require a

[39:44] separate entrance and exit.

[39:46] Operationally, something we are not

[39:48] prepared to initiate at this time.

[39:51] More so, as construction on the interior

[39:53] was discussed with our current

[39:54] contractors,

[39:56] it became apparent that egress points

[39:57] for your interior construction

[40:00] would demand that heavy machinery drive

[40:02] over the splash pad leading to questions

[40:04] of pad integrity and eventual repair.

[40:07] Any full assessment of pad integrity

[40:09] needs to wait until natatorium

[40:10] construction is complete.

[40:14] We know now at this point in time that

[40:16] there are that there are several broken

[40:19] pipes in the ground owing to either

[40:21] construction travel or the 5 years of

[40:23] downtime.

[40:26] Lastly is the problem of adherence to

[40:28] McKenna's Law.

[40:30] known also as House Bill

[40:32] 179, was passed on April 3rd, 2023 by

[40:35] the state of Ohio.

[40:37] It mandates pressure testing and

[40:38] velocity control of spray nozzles in all

[40:40] splash pad recreation areas. It's named

[40:43] after a little girl who died after a

[40:45] spray nozzle caused irreparable harm to

[40:47] her abdomen.

[40:49] Our splash pad system at the Gemini was

[40:51] not designed with the demands of

[40:52] McKenna's Law in mind

[40:54] and will require lengthy future

[40:56] engineering, construction, and

[40:58] inspection by the state before opening

[40:59] again.

[41:01] Should have brought water.

[41:03] Our number one goal is the success of

[41:05] the $14.7 million natatorium remodel.

[41:10] As I've mentioned in discussions with

[41:12] Director Kemp, council members,

[41:13] recreation commission members,

[41:15] contractors, and residents, we expected

[41:17] that the splash pad would not be

[41:19] available after construction completion.

[41:21] In the future, we hope to reimagine the

[41:23] area into a non-water related recreation

[41:26] space, such as sand volleyball, bocce

[41:28] ball, and even a fireplace patio

[41:31] relaxation area.

[41:33] If we are to invest in a future splash

[41:35] budget,

[41:36] splash pad budget, I would suggest

[41:38] focusing on the Morton Park splash pad

[41:40] where the problems presented by the

[41:41] natatorium proximity do not exist. We

[41:44] cannot afford another environmental

[41:45] envelope problem.

[41:48] So, to wrap this very lengthy speech up,

[41:51] without a budget for a remodel,

[41:53] the age of the splash pad, possible

[41:55] structural issues from natatorium

[41:57] construction, environmental envelope

[41:59] problems, state law changes, and

[42:02] operational challenges, the splash pad

[42:04] at the Gemini will not be open with the

[42:06] natatorium this June.

[42:42] had 159 applicants, and we've begun uh

[42:45] interviews. So, hopefully we'll start uh

[42:47] staffing those departments

[42:49] um and to assist with all the the needs

[42:52] around the uh community. Uh we also have

[42:54] had a long-standing open um auto

[42:57] mechanic position um open within the

[42:59] service department. And with the passage

[43:02] um hopefully or the eventual hopefully

[43:03] passage of the AFSCME agreement, uh we

[43:06] could have a much better wage. Um that

[43:08] was part of the uh negotiations uh for

[43:11] that position.

[43:12] Uh we also have um

[43:15] police lateral position open. Uh so, we

[43:45] Kathleen Fean uh retired and will be

[43:48] going to part-time um to assist uh law

[43:51] director Dever. Uh Caitlin Fitzgerald,

[43:54] who has been a part-time employee um and

[43:57] assisting Megan Otter with development

[43:59] issues, will now become the executive

[44:01] assistant to the mayor and continue to

[44:03] assist uh Megan Otter. And then uh

[44:08] Um we have posted a part-time position

[44:11] for an administrative support uh for

[44:13] service and development, and that

[44:15] position will uh assist uh Director

[44:17] Hitch.

[44:18] Uh

[44:19] in the finance world with auditing. Uh

[44:22] oh, excuse me. And then, also part-time

[44:25] lifeguards. We need lifeguards. Um so,

[44:28] continue to spread the word and uh lots

[44:31] of information and about that in

[44:33] training and incentives uh because

[44:36] everyone is hiring lifeguards at this

[44:37] time.

[44:38] Uh on the finance side of things, the uh

[44:41] 2025 budget is or excuse me, the audit

[44:45] is wrapping up. Uh we finalized our

[44:47] annual um

[44:49] uh our our basic financial statements

[44:52] were filed this evening uh to meet the

[44:55] compliance deadline, and we are working

[44:58] with uh our auditor and our GAAP

[45:01] conversion folks uh for our annual

[45:03] comprehensive financial report to get

[45:06] that done, and hopefully that will be

[45:07] done by the end of June. Knock on wood.

[45:28] uh I know that the families are trying

[45:30] to get as much attention to the fact

[45:32] that it is unsolved. And if anybody has

[45:35] any information to forward that on to

[45:37] the Metro Parks because they

[45:39] it may be, although you might think it's

[45:41] not uh of any relevance, it might be

[45:42] helpful.

[45:44] And then, the other thing is just to

[45:45] cover um

[45:47] I've concluded all of the work that I've

[45:49] done on the Mastick Road lawsuit, but it

[45:51] would be

[45:52] um in in investigating that and looking

[45:55] into that matter, I just wanted to

[45:56] address the issue that was an allegation

[45:59] concerning the mayor

[46:01] as far as making some uh um um

[46:04] incorrect statements before the County

[46:06] Council. I've looked at that evidence,

[46:09] and I've also looked at the timeline,

[46:10] and I can assure the Council and the

[46:12] public

[46:13] that uh those allegations are untrue,

[46:16] and they're not uh supported in any way

[46:18] by what the evidence is. I will be

[46:20] notifying the attorneys who filed that

[46:22] lawsuit as to the fact of what I've

[46:25] uncovered so that uh we can put that to rest. At the time

[46:29] that the mayor appeared before County

[46:30] Council and made certain comments

[46:33] uh in order to secure that uh that grant

[46:35] or transfer the grant to uh the ARPA

[46:38] funds for the purchase of Mastick Road,

[46:40] uh I believe that he was completely

[46:42] truthful. So, I wanted to make sure that

[46:44] that's on the record. Thank you.

[47:23] not sewer water main um down the street.
