claim that came in and it's somewhat convoluted, but initially we were requesting a temporary
[7:09]
limited easement to do some of the work along that quarter on Pioneer Road and this resident
[7:17]
was objecting to that and also in the process there was the removal of a tree.
[7:25]
So in essence we tendered what was initially some correspondence from their council
[7:33]
to our liability carrier who indicated that they would decline this claim.
[7:38]
These parties actually have sued the city of Final Act.
[7:43]
We're not part of that suit, but in conjunction with that,
[7:48]
we have been looped in in the correspondence,
[7:51]
and essentially are being treated as if we are a party to some degree.

So to deal with part of their claim amount for the removal of a tree,

we're asking that the board to allow that claim.

They haven't followed the statute for tundering claims against the county, and so that is why we are also asking that this claim be disallowed.

county is that the DA's office had authority to veto participants in the program. I attempted to
[26:52]
renegotiate the agreement between the parties. They could not come to an agreement when the DA's
[26:57]
us finally, did agree. The public's front is office, wouldn't agree. So because of that, when
[27:02]
I spoke to the judges, we realized the best opportunity would be just to go ahead and end
[27:08]
the program. But the same time, the judges still have the abilities, part of their sentencing,
[27:13]
to go ahead, have a person completed treatment program through department human services, that
[27:18]
could they could factor into part of their sentencing till. So we thought that that was the best way
[27:21]
around it at this point. I'm open to it to come back again someday, but unfortunately, we were only
[27:26]
graduating to the two or three, two or three people out of the program, and it just wasn't
[27:31]
and we're spending six figures on this, and it just wasn't worth it for that amount of money.

We'd rather spend the money instead of the programs to directly help them.

because I have a very fundamental disagreement

with a piece of the Veterans Park Special Events Policy.

I think the vast majority of the policy is excellent.

There was so much work done in its thank you to county staff, committee members, veterans

groups.

There were so many people that had a hand in creating this policy, but the piece that I find a
[38:50]
bit troubling is on page six to have a special event at the park.

this is in the Special Events Policy, somebody would need to get endorsement from a nationally
[39:02]
recognized Veterans Organization located in Finalite County in order to have an event that's
[39:08]
not hosted by the county. Because of some of our concerns about that, they did add the caveat in
[39:15]
this piece of the policy that if a Veterans Organization is not able to endorse and otherwise appropriate
[39:20]
event, the county executive or land information director, reserve the right to approve the permit application.
[39:27]
But I just have a philosophical disagreement with this that because Veterans Park is still a county park.
[39:36]
By having a requirement of an endorsement by an outside group, even though I support the idea of wanting to make sure that our veterans groups are.
[39:47]
comfortable with any events that are happening in the park. I just don't agree with the
[39:53]
endorsement process. I had asked if perhaps we could have just had a representative from
[39:59]
our veteran service.
[40:00]
This is office on the team that would look at the special events permit requests. And I was told
[40:08]
that it was seen that perhaps that office doesn't really hold on.
[40:16]
It is unclear whether the veteran
[40:19]
service's office formally reflects the collective position of the veteran groups themselves. And so
[40:25]
I also found that a little troubling that we're not trusting our own county department to have
[40:29]
hand in what's happened what's going on with our veteran's groups. I would feel much more comfortable
[40:34]
if we had a county employee that was part of the review process rather than outside groups
[40:41]
because we have the oversight over what happens within the county and our county employees. So
[40:47]
because of that difference despite there being a lot of really good work that happened on this I'm
[40:51]
voting no on the resolution.

I have a few things just to say about this.

First of all, the purpose of this ordinance is for us to have a standing set of rules governing the daily public use of all the county parks and
[41:16]
So that would be all of the 20 parks.

So if we don't vote on this tonight,

like if we don't pass this,
[41:26]
this affects all of our county parks.
[41:29]
Also, the purpose of the special events policy
[41:33]
is developed implemented by land information,
[41:37]
the department, the land information department of veterans park.
[41:43]
It is a, it's basically a framework for managing temporary organized activities that require additional oversight, for example, events that go beyond normal park use.
[41:56]
In summary, this ordinance regulates daily normal park use while the special events policy governance, the exceptions such as organized activities that require additional oversight beyond the park rules.

I mean people have been working on this since this run of a, since the renovation of this park
[42:19]
began like a Vatchron's park in particular, and we've stuck $1.2 million, $1.2 million
[42:28]
million was invested into this park by the county and the donors.
[42:33]
The park is ideally located in the downtown, as everyone knows, it's an asset to our downtown
[42:42]
here in the city of Fondalac and to our its an asset to our businesses. Some of those business
[42:49]
owners have donated and hopes that we begin using the park and the stage and drop people in.
[42:58]
The stage in this park is currently mainly used at a minimum two times per year,
[43:04]
Memorial Day and Veterans Day, it would make sense for more events to be able to occur in this
[43:11]
park. And again, remember, this is a change to the ordinance and not the policy. This can
[43:18]
always be modified in the future if it's necessary. And like with all things, I think it's a given
[43:29]
take in negotiations, so when people bring something controversial the way to get things done
[43:38]
or moving to benefit everyone is a given take, because we want to respect our veterans and
[43:46]
I think that this is a good idea.

A couple of reasons for that. Let me explain that. We are going to the reason for the closed session

is for security purposes. We can't release the pictures or several of those things of the design part
[53:10]
of it to the public for security reasons and the sheriff would probably echo that in the back of the room.

So we have decided to do that in closed session at 430 on October 27th, as the night of the public hearing for the budget.

So we are going to have the meeting, we'll call the meeting to order at 430, go directly into closed session.

They will have board set up around this room, they'll do their presentation, but you'll be able to look at things on boards, ask questions,

things like that, we will call the meeting, we'll come out of closed session, go into our regular meeting,

have our regular meeting at 6 o'clock and have the, I believe the public hearing is going to be at 630 that night.
