[22:08] residents and structures within the city. And whereas Arkansas code

[22:12] annotated 8-4-306 authorizes political subdivisions to

[22:18] enact and enforce ordinances for the purpose of prohibiting burning in the

[22:23] open or receptifying

[22:27] controlling the fuel air ratio. And whereas the city council desires to

[22:32] regulate the burning of fire within the city of Fort. Now therefore be resolved

[22:37] by the city council of the city of Fort Arkansas that section one. It shall be

[22:42] unlawful for any person to have and maintain a fire within the city of Fort

[22:47] without first obtaining a burning permit from the city from the Fort Department.

[22:52] Section two, the force fire department may issue a residential burning permit

[22:56] after review subject to the following rules. A burning permits may be issued

[23:00] for a period up to one month. B the permit is issued to an individual not in

[23:06] location. If there is a change in residency at location, the new resident

[23:10] must request a new permit. C. Burning of unenclosed yard debris may be conducted

[23:18] between sunrise to sunset. D. Burning after sunset must be done in a burn

[23:24] barrel or a fire pit the size at least 12 in high. E yard waste materials to be

[23:30] burned located on parcels of less than 1 acre shall be placed into a pile no

[23:35] longer no larger than 5 ft in diameter and 2 ft in height. Pile shall

[23:41] be no less than 25 ft from the structure of the property line. No more than two

[23:46] piles may be burned at any given time by individual resident or property owners.

[23:50] On parcels of more than 1 acre, the number of piles will not be restricted.

[23:56] F responsible a responsible party shall continually attend the fire. G a garden

[24:04] hose or other cable fire extinguisher shall be kept in readiness and attached

[24:10] to a water supply. The hose shall be charged meaning that the water supply

[24:15] turned on and water is ready to be released by the valve at the end of the

[24:18] hose. H. All combustible shall be clear from for a space 20 ft on all sides of

[24:26] the fire area. I All fires not contained in a burn barrel or burning wood must be

[24:32] extinguished at sunset. J. Only yard debris such as leaves and limbs shall be

[24:38] burned. Building material, paper, or trash may not be burned even with

[24:43] burning permit. K. Burning is prohibited if winds are excess of 10 miles per

[24:49] hour. L burning shall not be permitted with or without permit during a burn

[24:56] declared by the governor, county judge, or for ice marchie. Section three, the

[25:01] forest fire department may issue a permit

[25:04] for development for

[25:13] or construction burning subject to fire subject to the following rules for

[25:18] burning of trees, limbs or vegetation removed during the process of site

[25:24] improvement shall not be allowed unless following conditions are met.

[25:31] All surface vegetation must be removed adjacent from the burning materials for

[25:35] a distance of no less than 20 ft in all directions.

[25:39] The approved materials to be burned shall be placed in a pile

[25:44] no larger than 25 ft in diameter and 10 ft in height. No more than one pile per

[25:50] acre on the site may be burned at any given time up to 10 acres. For sites

[25:56] over 10 acres, the number and arrangement of files must be approved by

[25:59] the forest fire department. B. The fire must be checked

[26:04] periodically. Sufficient extinguishing equipment shall be on site and available

[26:11] to completely contain the fire. D. The burning is to occur at least 100 ft from

[26:17] all combustible material. E. A burning permit must be obtained prior to burning

[26:22] from the house fire department. The permit will be bid for 30

[26:27] for a 30 calendar day $150. A site inspection shall be performed by

[26:33] the fire chief to or designate at least one week prior

[26:39] to burning. The material shall be sufficiently seasoned and dried to

[26:44] expedite burning and reduce smoke. A fan or other device to assist burning is

[26:49] highly recommended. F. Notification must be given to the

[26:53] Ford eyes fire department if the Fort Police Department dispatched at least 24

[26:57] hours prior to the intended burning of state tree limbs or registration.

[27:02] Section four. The following types of burning are permitted according to the

[27:07] circumstances listed herein. Eight. Fires allowed by the Florida Fire

[27:12] Department for the purpose of lead abatement, prevention, and or

[27:16] elimination of fire hazards and burning of storm debris following a disaster as

[27:21] declared by an appropriate governmental authority with burning of such a debris

[27:26] at the sole direction of the fire chief or his design depending on weather

[27:31] safety and environmental concerns. B. instruction of the department employees

[27:37] and methods of firefighting and for for and under

[27:42] the direct supervision of the force fire department for authorized fire training

[27:47] instructor. C fires that are associated with

[27:51] ceremonial or recreational purposes. One, the location of ceremonial fire

[27:58] shall be a minimum of 50 ft from a structure. Approved materials to be

[28:02] burned shall be placed in a pot no larger than 15 ft and 9 10 ft high. Only

[28:07] the burning of dry and season wood is permitted. The Cordes fire department

[28:10] shall inspect and approve the burn site. No permit is required. Two, the location

[28:16] of recreational fire shall be a minimal of 20 ft from the structure. Approved

[28:20] materials to be burned and shall be placed on a in a pile no larger than 3

[28:25] ft under or 2 ft in height. Only burning of dry season wood is permitted

[28:30] permitted. No permit is required. Section five.

[28:36] The following open burning practices shall be prohibited

[28:39] within the corporate boundaries of the city of Fort Arkansas. A open burning of

[28:44] trash, garbage, and or rubbish by any resident or business for purpose of

[28:50] incineration. B. Open burning of construction waste of

[28:54] any kind on the premises of construction site. Small warming fires are allowed in

[29:00] approved container utilizing dry and seasonal wood only. C. Open burning of

[29:06] materials resulting from remodeling dismantling and or demolition of

[29:12] structures building. D. Open burning of trees, limbs, and vegetation clippings

[29:18] generated by or resulting from commercial activities or establishments

[29:22] that provide lawmak or ground services through the course of normal business

[29:28] activities. Section six,

[29:33] burn bands may be issued by the governor, county judge, or for ice fire

[29:37] chief when any of the following or similar circumstances are present. A.

[29:42] Atmospheric conditions that prevent smoke from rising freely. D. Excessively

[29:47] dry conditions exist. C. Sustained winds are greater than 10 mph. D. Frequently

[29:54] frequent peak wind gust are greater than 20 mph.

[30:00] Section seven. Persons seeking and burning a burning permit shall provide a

[30:05] copy of this ordinance. When a burning permit is issued, the individual shall

[30:10] sign at the bottom stating that he or she understands and agrees with the term

[30:16] and conditions of the permit issued under this ordinance. The fire

[30:20] department shall retain a copy of the ordinance signed by the permanity.

[30:24] Section 8. Violations of this ordinance shall be prosecuted in the Fort Division

[30:31] of the Dallas County District Court. Citations may be issued by the Fort

[30:35] House Police Department or the Fort Fire Department. Section 9. Persons convicted

[30:41] of violating this ordinance and allowing a fire to cross onto another person's

[30:46] property shall be fined $1,000 plus court cost. Section 10. Persons

[30:51] convicted of violating this ordinance shall be fined $200 plus court cost at

[30:56] first offense. Section 11. Persons convicted of a second violation of this

[31:01] ordinance within a 5-year period shall be fined $500 plus court cost and will

[31:07] be ill ill ineligible to conduct any open burning of any type within the city

[31:12] of Fort period of 5 years.

[31:16] Section 12. Persons convicted of a second violation of this ordinance

[31:20] within 5year period shall be fined $1,000 plus cost will be ineligible to

[31:26] conduct any open burning of any type within the city of Rise for a period of

[31:30] 10 years. Section 13 all ordinances in conflict hearing here within and are

[31:38] hereby appealed repealed emergency clause. It is hereby

[31:44] determined that an emergency exists by reason of the danger posed by

[31:49] unregulated fires in the city of Forest. An emergency is hereby declared to exist

[55:02] my corner room for 16 sales tax. The sales tax will cover county roads and

[55:08] share and solid waste, which is the biggest thing that's helped. I mean, one

[55:13] of the biggest things is our own things. I don't know if y'all know or not, but

[55:17] from last year to this year, our provider, which we changed, two years

[55:21] ago, but our contract went up to $60,000 for 100,000 per year.

[55:29] Y'all split that a third with us to the hospital.

[55:34] And that's going up $40,000. We we're just crushing trying. I know y'all are

[55:39] too. So this sales tax would, you know, get passed, it would pull the burden off

[55:46] of y'all from having to pay your part, the hospital, and the county cuz the

[55:51] sales tax will take care of this pay for this ambulance service. Also, I talked

[55:57] to the ambulance service and we're borderline having to add another

[56:00] ambulance. Um, we have a lot of transports now, especially with county

[56:05] hospital being down. We're getting a lot of lot of stuff at our hospital which is

[56:10] great for us. Joe can tell you more about that. But

[56:15] just talking to the administrator and

[56:21] it's really increased our volume going up. And with this ambulance service, I

[56:25] know y'all y'all remember before this company Valer before Valor came in, we

[56:30] was lucky to get them to show up for a call.

[56:33] And I'm all about my the people of this county, this city. When they need an

[56:38] ambulance, it's there in a timely manner and then take care of the issue. We've

[56:42] heard nothing but good things on this company. They're doing, as far as I

[56:45] know, a fantastic job. I guess my thing is is, you know, I'm here to kind of let

[56:52] you know that tax will take the burden off of those three entities that pass to

[56:57] take care of our family service. And just just I I talked to Lauren over at

[57:03] 911 today and she got me some numbers. From June 1st to August 1st, the county

[57:09] had 38 calls. The city of Fort had 91 calls.

[57:14] Um totaling 129 calls. So they're pretty busy. I mean, they're

[57:22] daily they're making calls in the city and in the county. So, I guess I'm just

[57:28] here to kind of explain that part to you and hope y'all support it because we

[57:33] really need that to continue on. All three entities are struggling as

[57:37] everyone knows. So, we put some sets on the 1% sales tax countywide

[57:48] um 70% going to the road, 30% going to the other will be more than enough to

[57:54] cover them. I get that question asking, "Well, the contract's $100,000.

[58:00] Um, this will bring in roughly $350, $360,000 a year." And the other two

[58:06] entities, this is not in any financial at all. So, that should more than enough

[58:12] cover it, which where if I go buy a new today, it's $340,000,

[58:20] which once y'all live in the city limits, so that really doesn't won't

[58:24] affect you. That's a new truck down the road

[58:27] and we'll fix the pay river and I know you go there. You deserve

[58:33] we're buying for sale

[58:37] if it's going for ammo service sheriff department and sol

[58:42] sheriff department is financially good. >> I've been doing

[59:34] Some y'all think we pay a lot of money. We pay nothing for just Calvin County. I

[59:40] believe it's 130 20,000 a year and they have a glorified tax. They can't even

[59:47] start out. All they can do is teach you the option. I mean they and that's what

[59:52] we were getting before we had this company out because the company we had

[59:56] before would do transports out of Elorado to Little Rock or wherever and

[1:00:00] they called in Ken County if we needed one. Now we have an ambulance in Dallas

[1:00:04] County at all times unless it does a transport for Dallas County and if it

[1:00:09] does they send a backup and normally if it don't come to a Dallas County medical

[1:00:14] center it's station. So there may be and usually if it's a

[1:00:19] transport they don't even it's not critical they don't leave the hospital

[1:00:24] until that ambulance is in the county and things have picked up picked up

[1:00:30] tremendous you know the hospital I noticed Kim did last week they laid off

[1:00:35] they over 40 employees and they're doing pretty bad so we're receiving patients

[1:00:41] from there people are coming to our hospital rather than going away so

[1:00:45] things have picked That's good for us. >> It's a good thing for us, you know,

[1:00:50] picked up a lot.

[1:04:21] never left my property when I was released. When I was released, I lost my

[1:04:26] property. That's what tape off both places. Remind you the 15th of July. My

[1:04:33] Brian over there take on the jail. I'm telling you, get out and stuff take up

[1:04:42] my property. People was coming through getting my stuff. You know, they was

[1:04:47] passing on passing on like this cherry, but I couldn't pay bill.

[1:04:54] So, I'm working. I have means funds to correct everything that's coming up on

[1:05:02] College Street. Me and my daughter, we're homeless cuz I can't go to my

[1:05:09] resident or my property cuz I I bought material. I've been to homes. I spent

[1:05:14] over $3,000 to remodel this house and fix some houses which I was not able to

[1:05:20] for. So I'm like I'm back up against the wall and I'm asking God to release the

[1:05:28] condemning and let it go every so that we can go home.
