[2:50] And, uh, unfortunately, in this case, we unfortunately, in this case, we have a property owner that has have a property owner that has allowed his property to become allowed his property to become subjected to public health and subjected to public health and safety hazards that extend well safety hazards that extend well beyond their property lines.

[7:09] Um, just to give a sense of the just to give a sense of the area that will be evaluating area that will be evaluating the red, uh, bounded area in the red, uh, bounded area in this map is the current this map is the current boundary of the Drake and boundary of the Drake and College plan area, and the College plan area, and the yellow bounded area is the area yellow bounded area is the area that will be evaluated for its that will be evaluated for its existing conditions and existing conditions and compliance with the statutes of

It's important to stress that It's important to stress that just because we are looking at just because we are looking at property bounded by the yellow property bounded by the yellow boundary does not mean that boundary does not mean that that property will actually be
[7:31] that property will actually be recommended for inclusion in recommended for inclusion in any plan, amendment and any any plan, amendment and any plan amendment will ultimately plan amendment will ultimately be a decision of City Council. be a decision of City Council.
[7:42] We are intentionally casting We are intentionally casting our net wide to evaluate the our net wide to evaluate the existing conditions so that we existing conditions so that we can bring in the correct sort can bring in the correct sort of properties that can be of properties that can be complementary to the current complementary to the current plan area, if that's the
[7:52] plan area, if that's the direction we go. Um, and allow direction we go. Um, and allow for us to, you know, look at for us to, you know, look at and build sort of the best and build sort of the best potential public benefit, um, potential public benefit, um, that aligns with all of our
[8:02] that aligns with all of our taxing entity's objectives. Um, taxing entity's objectives. Um, at the beginning of this year, at the beginning of this year, the balance for the budget the balance for the budget within the College and Drake within the College and Drake plan area was pretty modest.
[8:12] plan area was pretty modest. Uh, only about $4,600 in Uh, only about $4,600 in previously collected property previously collected property tax increment. We are going to tax increment.
[8:22] We are going to be remitted a significant be remitted a significant amount of both property tax amount of both property tax increment and sales tax increment and sales tax increment this year, anywhere increment this year, anywhere between a quarter of between a quarter of 1,000,000.5 million. Um, and 1,000,000.5 million.
[8:38] Um, and you have previously authorized you have previously authorized an expenditure of $25,000 an expenditure of $25,000 towards local matching funds towards local matching funds for a grant to support transit for a grant to support transit oriented development and oriented development and planning in and around the planning in and around the area. Um, that would be area. Um, that would be combined with about $25,000 of combined with about $25,000 of funding for Prospect South. funding for Prospect South.
[8:49] That leaves us a balance of, That leaves us a balance of, you know, just a little bit you know, just a little bit under that quarter million to a under that quarter million to a half million. And this half million. And this additional expenditure as well, additional expenditure as well, within our projected revenues within our projected revenues for this year.
[8:57] This for this year. This appropriation would allow for appropriation would allow for us to spend the funds to us to spend the funds to achieve this particular achieve this particular purpose. Uh, we have an on call purpose.

And and brings in all of the And and brings in all of the rest of the commercial between rest of the commercial between the existing plan area and that the existing plan area and that one.

[11:16] Um, and if you take a closer look at that take a closer look at that particular southern boundary, particular southern boundary, um, in, say, Google Maps or um, in, say, Google Maps or something, you'll notice that something, you'll notice that there are a number of vacant there are a number of vacant parcels. Um, underutilized parcels. Um, underutilized parcels, particularly along parcels, particularly along McClelland.
[11:26] Uh, which is on the McClelland. Uh, which is on the west side there, that that more west side there, that that more or less extend to kind of that or less extend to kind of that southern boundary. Um, which southern boundary.
[11:35] Um, which sort of splits? Um, it sort of splits? Um, it basically ends just north of basically ends just north of the shopping center and the shopping center and associated parking and parcel, associated parking and parcel, uh, that, uh, Cafe Mexicali is uh, that, uh, Cafe Mexicali is probably the easiest landmark probably the easiest landmark for all of us to, to pull up in
[11:45] for all of us to, to pull up in our heads. Um, that is just our heads. Um, that is just outside of that proposed outside of that proposed boundary. And then east of boundary.
[11:53] And then east of college, there is basically college, there is basically just picking up the associated just picking up the associated commercial that faces college. commercial that faces college. So the probably the most So the probably the most interesting part is the area interesting part is the area that extends west along Drake that extends west along Drake and does pick up some Colorado and does pick up some Colorado State, property.
[12:06] Uh, and part State, property. Uh, and part of that is we've had some of that is we've had some conversations with CSU and conversations with CSU and Strada about potential changes Strada about potential changes for ownership in those areas. for ownership in those areas.
[12:16] And so if the foundation, which And so if the foundation, which is called strata, uh, were to is called strata, uh, were to be the owner, there could be a be the owner, there could be a possibility to create possibility to create partnership, right? Uh, that partnership, right? Uh, that could encourage some could encourage some redevelopment over there.
[12:25] And redevelopment over there. And so we are looking at some so we are looking at some property that's currently, you property that's currently, you know, sort of within the state know, sort of within the state ownership. But there's the ownership.
[12:33] But there's the possibility, like I said, for possibility, like I said, for it to potentially move around it to potentially move around again, just because we're again, just because we're looking at it for conditions looking at it for conditions does by no means say it'll even does by no means say it'll even qualify. Again, an western boundary. Again, an area that, um, has some, you area that, um, has some, you know, some properties and some, know, some properties and some, some lots that are in a variety some lots that are in a variety of states.

[16:17] And, um, as you all know, we are, um, as you all know, we are, uh, Ura is currently in the, uh, Ura is currently in the, um, eminent domain process. Uh, um, eminent domain process. Uh, we're seeking to acquire this we're seeking to acquire this property. Our our negotiations, property.
[16:29] Our our negotiations, as you recall, between a as you recall, between a willing seller and a willing willing seller and a willing buyer didn't go well. It didn't buyer didn't go well. It didn't weren't successful. And the weren't successful.
[16:38] And the condition of the property is, condition of the property is, um, far worse than anybody had um, far worse than anybody had anticipated. So we are pursuing anticipated. So we are pursuing eminent domain right now. And eminent domain right now. And as part of that process. Um, we as part of that process.
[16:52] Um, we are pursuing, um, immediate are pursuing, um, immediate possession of the property, possession of the property, especially as we start to especially as we start to approach winter. We would like approach winter. We would like to secure the property. Um, as to secure the property. Um, as you all know, it's in, uh, you all know, it's in, uh, pretty bad condition.

[17:11] And so, um, as we've learned with um, as we've learned with another motel just north that another motel just north that we own, uh, it's good to get it we own, uh, it's good to get it fenced and boarded up and fenced and boarded up and secured and patrolled, secured and patrolled, especially before we hit the especially before we hit the winter months. And so we have winter months.
[17:20] And so we have asked the court for immediate asked the court for immediate possession of the property. Um, possession of the property. Um, as part of that immediate as part of that immediate possession, um, process. Um, we possession, um, process.
[17:34] Um, we have had conversations, uh, have had conversations, uh, actually, uh, really our actually, uh, really our attorney, uh, your attorney, attorney, uh, your attorney, um, and uh, the has been in um, and uh, the has been in conversations with the property conversations with the property owners attorney to come to some owners attorney to come to some type of a stipulation agreement. type of a stipulation agreement.
[17:46] And that stipulation agreement, And that stipulation agreement, we believe is imminent. Uh, the we believe is imminent. Uh, the terms have been essentially terms have been essentially agreed upon. Um, and that agreed upon.
