Thank you. >> so small citizens for anyone would like to address council please step up to the podium. State your name and address for the record. >> good evening, council. Thank you for allowing me the opportunity to introduce myself to you for a couple of minutes. I am judge nicholas lane, montgomery county juvenile court touring essentially montgomery county and I'm finding out just how big it is. Introducing myself to councils and boards and everyone so that we can at least get to see each other face to face. A little bit of background about myself. I started out after I graduated from the university of dayton with my engineering degree. After I went to law school I came back and was an assistant prosecutor for montgomery county for about nine years doing criminal trial work. And for the past 23 years I've been in domestic relations court as a magistrate dealing with families custody and parenting time and everything that families can have a dispute about. And that's certainly quite a bit. And I'm now bringing that focus on family experience to juvenile court. I'm here because juvenile court has many partners on juvenile justice issues your schools, your police department and obviously this council and the citizens that you represent. I'm here to begin the process of listening. I'm bringing fresh eyes to juvenile court. I want to hear people's concerns about juvenile justice issues. I want to hear about people and their interactions with the court. I want to hear what we're doing good and if there are things we can improve on. I want to hear about those too. And I'm hoping with some in this kind of communication and introduction we can have communications and cooperation down the road so that the shared issues on >> juvenile justice we can make some progress >> on. This is obviously my first time addressing you but I certainly hope during my last. So just thank you for the opportunity to spend a couple of minutes and introduce myself to you. ? >> good evening. My name is diane jensen and I am a resident at 23 place. I have lived there don adams for 25 years and I've been a resident at germantown for over 30. I'm here tonight to formally address the ongoing and serious concerns associated with the property located at 21 prairie place including persistent property maintenance issues, safety concerns, incidences involving an unleashed dog and what my family believes has become a pattern of targeted harassment and retaliation. These issues have continued for several years despite repeated attempts to address them through appropriate channels. For approximately four years we have contacted the city regarding ongoing concerns involving trash, miscellaneous items, vehicles and other property maintenance issues at 21. I want to acknowledge mike roseberry who has worked very diligently over the past two years to address some of these concerns. Despite those efforts, the property at 21 continues to experience reoccurring maintenance problems. Following city action to mow the property last year, the resident has reportedly placed additional toys and miscellaneous items and other debris throughout the yard within approximately two days this year. Corn was planted in the front yard. The corn has since died and fallen onto our property. On sunday, september 6th my husband moved the fallen corn back onto the property. The residences then contacted the police resulting in my husband having to provide a report. We were advised of the matter would ultimately be referred to the prosecutor for a decision. The neighboring residences have continued mowing and areas extending onto our property in an apparent effort to get as close to the corn as possible. This is particularly concerning because there is an existing trespass order. Although the resident recently spent approximately three days cleaning the property, our experience over the past several years has been that improvements have not been maintained for an extended period and have historically deteriorated again within approximately six weeks. I did a little research this morning and I was able to find a codified ordinance 1130.03.2 that states that the premises and exterior property shall be maintained free from weeds or plant >> growth in excess of eight inches on noxious weeds shall be prohibited. Weeds shall be defined as grasses and plants and vegetation other than trees or shrubs provided however, this term shall not include cultivated flowers and gardens. The reoccurring nature of these conditions has negatively affected the appearance and quality of our neighborhood and has required continued involvement from city personnel and other authorities. In addition to the property maintenance issues there have been serious concerns involving one of the residents dogs. In april 2021 the resident's dog dug underneath my fence and entered our property where it bit my son. At the time the owners stated that they would pay the resulting hospital expenses but did not do so. The owner has since claimed that the incident was never reported. However I still have the case number provided by the hrc. Last year the same dog was again loose and roaming throughout our neighborhood. When concerns were raised in our neighborhood group the residences responded that we were lying and stated the dog was friendly. On july 7th of this year the same dog was again loose. When I attempted to close my garage door the dog approached my garage and began aggressively barking at me while coming farther into the garage area. The residents continued to allow one of their dogs to remain loose and unleashed in the front yard. Given the previous fire incident and subsequent instances involving the same dog, I am extremely concerned about the safety of my family and the other residents in the neighborhood. Our family >> believes that the many incidents directed toward us are connected to our efforts to report property maintenance and code enforcement concerns to the city. The situation has escalated to the point that we were required to retain an attorney to issue a cease and desist letter. Despite that effort, the behavior has continued. Examples. On june 12th, 2025, while my husband was outside shooting basketball, he was screamed out and falsely accused of serious criminal conduct including being called a pedophile. We have a recording of this incident on march 8th of this year. A resident yelled insults at my son. On march 12th the resident directed aggressive and offensive language toward both of my husband and my son. These incidences have contributed to an increasingly hostile environment for my family. Most recently the camera was directed toward directly toward a front window of our home creating a significant concern regarding our privacy. We contacted the police regarding this incident although I was advised that there would be a follow up. I have not received any further information regarding the matter. There's also frequent yelling and verbal hostility directed toward our family. These incidents occur on a reoccurring basis often at least once a week. We made every effort not to engage with these neighbors. We do not seek a confrontation and we generally ignore the comments and behavior directed toward >> us. The situation does not appear to be an isolated disagreement between neighboring households before our family became involved. The residents had reportedly targeted a previous neighbors at 13 prairie. I was informed that there had been multiple reports concerning their conduct but I cannot personally verify reports made by the previous residents. The histories concerning when considered alongside the repeated incidents our family has personally experienced. This is only a brief summary of what has been like for our family to live next to this property. For years we have attempted to address these matters through appropriate channels. We have contacted the city cooperating with law enforcement when incidences occurred and sought legal assistance when the harassment continued. However, the situation has gone beyond what I believe be considered an ordinary neighborhood dispute. We are dealing with reoccurring property maintenance concerns, safety issues, animal control concerns, repeated verbal incidents and conduct that we believe has been directed at our family in retaliation for reporting code violations. I'm asking the city to use every lawful tool and enforcement mechanism available to address the ongoing property maintenance and code violations to investigate the safety concerns and take appropriate action to help restore safety, peace and the quality of our neighborhood. Our family has lived here for 25 years and in germantown for more than 30. We care deeply about our home, our neighborhood and our community. We simply want the same basic considerations safety and quality of life that every resident should be able to expect. Thank you for your time. Thank you. Thank. Anyone else? Hello. My name is chelsea dunaway and I reside at 17 prairie place for nearly three years with my family. I live at the property with my two kids and my significant other. My kids are 16 and nine. One of my biggest concerns currently is a involves a skeleton decoration in the front yard at 21 prairie that appears to be making an obscene hand gesture towards the neighboring property at 20 prairie place. My understanding >> is that this gesture has specifically been directed towards the occupants of 20 prairie place and there is video video documentation available regarding this matter. As a parent I'm concerned about my children being exposed to this place on a daily basis. I also believe it is inappropriate for a residential neighborhood where children regularly walk and play. My most serious concern involves the dogs at 21 prairie place. My daughter was previously attacked by a dog not in this neighborhood and is still dealing with the aftermath of the incident. I am particularly concerned about the situation involving dogs that are repeatedly loose or unrestrained. I have contacted the germantown non-emergency line and the dog warden regarding the dogs most recently after the dog warden came to the property. I personally spoke with the dog warden about the situation about the dog being routinely kept unleashed in the front yard and roaming the neighborhood. What concerns me the most is shortly after the dog warden left the property, the daughter 21 prairie place brought the dog back outside unleashed. This made me concerned that the issue was continuing despite the recent involvement of the dog warden. I personally observed the dogs digging under the fence and getting out of the enclosed area. I have also observed the dogs outside in the front yard without being properly restrained. Additionally, I've been informed by diane that her son has been hit by one of their dogs which is what has raised more concern for me as well. My concern >> is not that the residents own dogs. My concern is that the potential safety risk created when the dogs are repeatedly available to leave the enclosed property or remain unleashed in the front yard. I regularly walk my dogs in the neighborhood and I do not want my children, my dogs or anyone else's children or pets to be injured. Given my daughter's prior experience with dog attacks, this is an issue that's caused significant concern in my family. I am also concerned about the current condition and appearance of the property and the potential it may have on surrounding property values. The condition of the neighboring properties has reached the point where I'm embarrassed to even have people come to my home. Host my kids soccer team or even have deliveries made because it's been brought up multiple times. This includes family members. I should be I should be able to feel comfortable inviting people to my home without feeling embarrassed or concerned about what they will say when they arrive. Our home is where we live raise our kids and spend our lives. The ongoing condition of the property has negatively affected our enjoyment and pride in our own home. I have also been advised of the current conditions and appearance of 21 prairie place could make it more difficult for me to sell my home. It could negatively and negatively affect its value. My family has discussed the possibility of moving although we've only been here three years. >> I do have pictures of the skulls and everybody would like it but I do appreciate your guys this time and listening to our concerns. Our law director has some comments on 21 prairie. We meet well we probably talk daily about this property as a staff and we met as recently as friday. On this it's incredibly frustrating in my 44 years of local government all of which have been involved with property maintenance this is the most frustrating case I have seen. So we share in your frustration. It's a blight on not only the street but the entire community. And hopefully we will be able to figure out a solution. And as I said, our law director will have some comments on this property during his report. Excuse me. On the agenda tonight we have the city manager's contract. In addition to the surplus sale of the fire truck and declaring police equipment surplus, there are emergency ordinances for assessments due >> to the county auditor's required submission date >> assessments for mowing and nuisance as well as street lighting. Pat shively will discuss the street lighting assessment ordinance under public hearings. We have a 24 month moratorium on data centers. We've we had the introduction of this ordinance at the last meeting. We also have appropriation amendments and we are finally accepting the right of way for east-west road lane. >> law director scott davies will also review the ordinances related to the valley view school system and germantown christian schools. We have an informative work session planned with our financial consultant to >> review our deep dive into capital planning budgets. Now is budget season. We actually started budget season in june and we're in the final rounds of meetings now. We plan on having the city budget to council by the first meeting in october or the first week in october. But also in addition to that we've done a deep dive into the capital budgets so we will have that discussion during work session. In addition to the tennis court project at kershaw park. So I will now call on pat shively to >> review the street lighting assessment >> for the evening. And as the city manager was saying, the under intersection the legislation for the annual pat while it's an emergency ordinance is the annual street lighting assessment. We do this once a year this time of year so that it's assessed and then payments start for 2027. The information that I gather again is from the county on all of the parcels that's within the city limit if you will. And then from there to calculate out what would be needed for next year budget if you will. And so I don't get that information until july means august is when I'm calculating everything. So that's why we put it on as an emergency in september. So those costs have not increased the last three >> years for every one out there. So that's just pretty well holding its own. Well, directors and for thank you, mayor council. Obviously >> we're aware of the issue ongoing issues with 21 north prairie. To be clear we are exercising every possible thing that we can think of to try to get this property back in line including >> both a significant amount of civil fines. Criminal charges have been filed against the occupants of and convictions have been hard against the occupants of the property. It's obviously an ongoing issue but we are rest assured throwing everything at it to try and resolve it and get it back into compliance. There are two ordinances on the agenda tonight both for the purchase of 64 common stock a >> lease associated with that and then the sale of 64 common stock to germantown christian. The docket the the agreements are I thinking very close to final form with some dates to be recognized in the future but those we should be putting that to bed here shortly and the last thing is we we did get a sort of ones where we did get a public records request for related to the flock cameras that are in use on route four. We complied with that request and provided all the information that's subject to the public records request in the state of ohio and I think it's consistent with our neighboring jurisdictions and so we've provided all that information to anyone who's asked for it but specifically we signed the form so >> that's all I have. Thank you, sir. Move to the mayor's report. Bear with the meeting for the mayors and managers meeting. Start back up tomorrow night. This one is going to be held in my name is where I plan to attend when they start coming back into session. That means summer's ending in falls right around the corner. I attended the parks meeting last wednesday september 2nd municipal building and extensive discussion on the budget was >> the main task. I want to thank her manager and her finance director for coming and answering any questions that were had. There's a great discussion. I think the parks board has a better understanding of the budget process. One thing that was discussed is the future of capital improvement projects. All parks property is property of the city. There is a large project that's now moving forward and once it comes complete curb your community park may not be adequate in adding and we may be thinking of adding restroom concession building. So that's one thing that we need to think about and discuss over the next couple of years. I do believe when we do the budget we do a great job of looking down and in the future and five and ten year plans but this is something that's a little bit different and outside of what we normally look for. So in that meeting we discussed having some funds in the major budget in setting aside rainy day type money. We've got $1 million project coming to close here soon hopefully in the next couple of months for our covered bridge and I'd rather not let the next council have to wait to have to spend another million dollars to fix the bridge and I know that's been discussed and we are doing that. We're also doing that with twin creek erosion project out there so there's something for us to think about and when it comes to budget seasons, the traditional traditional christmas in the park will happen this year on saturday december 12th with a parade featuring santa mrs. Claus and skippy the elf. If you haven't seen that you need to come and see that I'll double check on times. I'm pretty sure >> we're going to do it like we had in the past. It's starting at 630 or 7. There will be a parade there was discussion about and wanting to have the horse parade again so we're going to look into that and when we have a contact terry johnson >> this morning the porter >> johnson that we're going to contact and he's going to be in charge of that. The mmi committee met on tuesday august 25th at the depot. Topics discussed were the completion of our five year plan and the budget and how mmi park will be incorporated into the parks system. The committee is planning >> a rededication of the park in either spring or fall of 27 and the reason being is we want to avoid any of that hot weather in the summer since there was no movie in the park night scheduled this year with the help of community event planner sherri henson and administer creative assistant will pozen worked on an alternate alternative event entitled movie with the mayor. Our historic landmark major theater has agreed to open for the city sponsored evening on wednesday, september 23rd. This will be during the week leading up to the pretzel festival so I wanted to say pretzel festival that weekend saturday and sunday september 2627. The movie to be shown is the elvis presley in concert movie which will set the stage for the entertainment that they have scheduled this year being ryan roth performing as elvis. If you've not seen him come out and see for yourself, he puts on a good show and his comeback special band really completes his act. I've heard that there may even be a special guest appearance for the movie. We won't know if you don't go the doors open at 630. This is a free event and concessions will be available for purchase so join me in supporting our hometown businesses. I've got a feeling the move the evening will be epic. If you're an elvis fan you understand how on friday september 25th at 5 p.m. In front of the city building I will proclaim the day dolly day to recognize the humanitarian efforts of dolly parton who passed away on august 25th no matter how big her claim to fame was, dolly never was ashamed of or forgot where she came from. I've got many reasons and I can say that and I want to do this for but show up that day and you can hear what I will say is dolly parton leaves behind a body of work and a legacy of compassion that will continue to inspire people throughout the world. Her music brought happiness to millions while her generosity changed countless lives. For anyone who's worried about their tax dollars being spent on two pink ribbons placed in front of the city building, I assure you that you have nothing to worry about the ribbons were purchased by an anonymous donor and myself in a world filled with jolene's we decided to be a dollar. I attended the open house at the village flower shop to celebrate roger's rogers retirement. Roger thank you for your loyal years of service to our community may be blessed and enjoy every minute of it. On thursday september 10th there will be a 25th anniversary stair climb at miami's byrd high school for 911. Registration can be done online. The sign in starts at 515. The climb will start at six. It will take place behind the high school on belville road at the football field. Participants only on the field it's so well attended that there is no spectator room. I will be there. I plan to attend according to the text I received from rob crump. He will be on a one day pickup delay due to yesterday's labor day holiday and I end my report with a heavy heart. >> my condolences to the family of charlie slinger, kyle, shelley, cole, kylie, collin, abby and the great grandkids. >> my parents have been gone for a while. My dad died in 1998. My mom died in 1999. Of my grandparents >> came like mine. It hurts me to see them go through now what I went through back then. The board of zoning appeals meeting last month but I had a work conflict and also planning to attend the miami valley regional planning commission meeting last thursday. But I was taking my first vacation at cedar point where I probably walked >> about 20 miles in three days and read about 100 roller coasters. It >> was very busy at the park. So anyway it was it was a great time. Spent a lot of time though this this past month with the what I call the silver swimmers. I appreciate all that will and the other staff at the park and the park deal in the past department deal with our pool. I made >> some friends swimming got a lot of good exercise. My wife normally doesn't talk a lot about government but she keeps talking about how how great it is that those of our age and older can go down and before the pool opens >> swim for an hour or more and take a shower and just I've met a lot of interesting people. The same time watching all the the new slide that was interesting and I didn't get hit by anything the pipes or anything when I was swimming so it was great >> but it was never really it's great and >> she keeps saying make. She mentioned that next year we want to have that again because it's a great way for older individuals to get exercise and also make friends. There was >> also it was brought up about property maintenance in a suit probably because in my five plus years on city four plus years on city council I've only done case work maybe three times. I want to thank the police department also kelly I have a neighbor and again as a city councilmember to be very careful how I interact dealing with issues but there was a property maintenance slash trespassing slash other type of legal issues and I'm not a lawyer. I don't play law on television. But as a former property maintenance zoning official and city planner I can tell you I've I had some advice for our neighbor and since it was across the street I got a lot more involved typical than I do. But the degree of professionalism especially by the police department in dealing I think we're on the road to getting that issue taken care of. So you never know about these issues until >> they come into your street, your neighborhood and it's glad to have the city there to help and I believe oh the data center. So the work I've done more research is interesting. You hear about a miami suburb and other cities now get talking about dealing with moratoriums on data centers and they do more work had questions last week and last month I was kind of confused about the approach that was taken on the ordinance but now it makes much more sense from a legal standpoint and whether the state of ohio decides to do anything. It's amazing just in the last month how much this issue has gotten has gotten traction like lots of traction. So I'm glad that we're despite what even with the state of ohio may have preemption in the future of this that we've got we've got we're ahead seem to be ahead of the game especially compared to many disparities in ohio. I will attend the cemetery board meeting next monday and at this time I'd like to just remind everyone as we know a lot of people change their decorations from summer to fall and then found the christmas decorations at the cemetery that if you will put your name on the bottom of it and it gets blown off or something happens to it and the workers there find that they will replace it to the proper place. Otherwise you're going to lose your decoration because they don't know where it goes. So I'd like to read a little information about our upcoming levy. The germantown senior center provides health education on immigration programs that assists seniors in maintaining vital independent lives as well as serves the community as an emergency shelter and polling location. This is pertaining to one not renewal levy that will be on the ballot in november. There are a wide variety of activities for our seniors such as physical fitness activities, lunch activities, social activities, bus trips, crafts, open computer and game activities. The center also hosts health screenings, health fairs, craft fairs, music events, community events, free tax service and in the seminars the center has become a very focal point for seniors and their families to find information concerning services available in montgomery county. The seniors also have numerous opportunities to volunteer their time and their talents there to continue operations center and assisting our community seniors germantown and german township officials have placed a one mill renewable levy on the november 3rd ballot. This issue is the continuation and the present one mill levy and it's not a new tax. So remember it's not going to raise your taxes. And with that I'd like to encourage everyone to attend a pretzel festival to one of our nicest activities all summer. One of our biggest activities all summer and we're going to all pray for good weather and that's all I had. World famous. Thank you, mr. Good. Yes. Mr.. Q thanks, mayor. There were quite a few things everybody else already touched on that I'll skip over but I do have to double do is I also went to roger's retirement open house. Congratulations to roger on his retirement and successfully running a business for half a century. The good news is that we are retaining the villar village flower shop in town. The new owner brook clark will be opening up across the street. I was just there today working on trying to get things ready for the cooler that shall install but >> we're excited to have her taking over the business and staying in town and roger will be if you're somebody who was in there talking to roger a lot you can catch him there till the end of the year. He's staying around to mentor brook >> and share some of his experience with us 50 years in the force. So also >> at that same address 40 north main the valley view performing arts boosters are running a fundraiser that all should start in the middle of this month run till the end of next. They >> are renting out costumes that they use to raise funds for the things they do in the building they're looking at trying to accomplish. So stop by and check that out and that's all I have. So it was very nice >> and I have to say I went on >> a sunday and he said he thought he'd worked harder recently than ever before. I don't have to tell you right now they're still running across the street, you know, and they need something because the cooler is not in and so yeah, but everybody's really happy roger's going to get to retire. Yeah, we get to retain the florist and we're going to have a new shop hopefully opening up here in the next few months and roger's building so >> it's all moving along pretty well. Thank >> you mayor. So the beautiful committee met back on august 13th. It was a short meeting and we looked into new yard signs for decoration, picks up awards, different awards, more friendly for the maintenance guys to put in the ground kind of signatures of the current ones. So hopefully we have some new yard signs here also look, the halloween coloring contest for kids coming out in third grade so hopefully that'll be something come to council after halloween and believe it or not next month. Let's do it in october. We'll start with the christmas tree baskets and start christmas decorations. So the little next meeting is set to the 14th at 6 p.m. To be in the city hall for more back on august 19th. Revenues down a little bit from last year. The weather hasn't been nearly what it was last year. Last year we just had a peak weather year but even though the revenue's down I think we're still in line with our financial goals so we'll wait and see how that plays out. Slides and that's an amazing, amazing feat. At the end of the year so I probably will get all year next year to enjoy the. And then we just discussed ways to increase poll pass as well as been on us he's increased quite a bit so kind of general discussion. I will say this past week I was out at marathon on west market getting gas in my car right when the random wall of wind appeared in town and the dust from the field across the street was so thick you couldn't see the cemetery. So I can't imagine how many things were blowing around over there. Probably very important to have your name on those things but on my way back into town there was a tree in west market and trying to get back to my house there was a tree across from all there was a tree across town the tree across main on the south side and I'm sure that repeated all over town but within probably five minutes to talk with julie and jonathan this gets to your back comes rolling down the street. The guys did an excellent job cleaning everything up so just thanks to them I know that was it was a friday afternoon after they had all gone home for labor day weekend and so I hate to hate to bring those guys out when they've started their weekend but they did a great job always quick to get things cleaned up.
