[2:34]

[2:36]
Item A is number two, six, dash, zero, zero, seven, zero.
[2:40]
I will read that in its entirety.
[2:43]
Proclamation, Special Recognition of Mental Illness Awareness Week, and World Mental Health Day.
[2:49]
Whereas mental health is an important part of our overall health and well-being.
[2:54]
And caring for our mental state is something that is important for people of all ages and backgrounds.
[3:00]
And whereas the pressures and demands of everyday life can affect our mental and emotional well-being,
[3:06]
making it important to take time to pause, recharge, and care for ourselves.
[3:10]
And whereas simple activities such as spending time with family and friends, enjoying the outdoors, exercising, pursuing a hobby, getting adequate rest, taking a break from technology, or simply taking a few quite moments to reset, can help us maintain balance and well-being.
[3:29]
And whereas mental illness awareness week observed October 5th through 11th, 2026, and
[3:36]
World Mental Health Day on October 10th, provide opportunities to raise awareness, reduce
[3:42]
stigma, encourage connection, and remind us that asking for support when needed is a sign
[3:48]
of strength.
[3:50]
And whereas caring for our mental well-being should not be limited to one week or one day,
[3:54]
but should be an ongoing part of how we care for ourselves and one another as members of a strong and compassionate community.
[4:04]
Now, therefore, I, Jeffrey Al-Ansvino, Mayor of the City of Hudson, Ohio,
[4:07]
do hereby recognize mental illness awareness week, October 5th through the 11th, 2026,
[4:13]
and World Mental Health Day, October 10th, 2026, and encourage all residents to take time to relax,
[4:20]
We charge, connect with others, and care for their mental well-being, not only during this week of awareness but throughout the year.
[4:28]
And furthermore, I wish to recognize state of mind Hudson, for its dedication to advancing mental health awareness through education and community engagement, including its sponsorship of mental health first aid training on October 3rd, 2026.
[4:45]
and witness where all of I have here on to set my hand and cause the seal of the city of Hudson to be
[4:49]
fixed on this first day of September, 2026.
[4:56]
With that, are there any comments from Council on our
[4:59]
Thank you.
[5:01]
Council against? Yes, being a child's psychiatrist. This is near and dear to my heart. I do want to say that that training by the state of my Hudson.
[5:14]
It was a project of leadership Hudson. It's 930 to 4 and it is no cost to anybody that registers.
[5:20]
And this is a great program to learn how you, the ordinary person, can help intervene in a way that really can help another person who's struggling.
[5:31]
So I would encourage as many people as could go to that would be a great thing.
[5:38]
Thank you, Councillor Gats. Any additional comments from Council tonight?
[5:41]
That's President Bird.
[5:45]
It just building off what Patricia said.
[5:47]
It's in a way a lot of us have taken a CPR training
[5:51]
to resuscitate somebody who's heart stopped
[5:54]
or they've stopped breathing and this training
[5:57]
really sounds like it will help us
[6:01]
kind of respond to those mental health emergencies
[6:05]
that happen not infrequently
[6:07]
and the better prepared we are, the better
[6:09]
that our friends and loved ones will be able to be helped and the community will benefit.
[6:17]
Thank you, Council President Bird. Additional comments from any council member?
[6:22]
Any comments from staff? I will just add myself. I know state of mind Hudson has recently
[6:28]
had several new board members join their organization so congratulations to those board members.
[6:33]
And I've seen their engagement within the community at events and their, you know, putting
[6:42]
them sounds out there and being visible to the community, offering their services and
[6:46]
assistance.
[6:47]
So I just want to thank state of mind Hudson for everything they do for our community.
[6:53]
Any additional comments from Council?
[6:56]
Seeing none, I believe there is somebody here from state of mind Hudson to accept the
[7:01]
or it
[7:06]
didn't make it this evening.
[7:08]
Okay, we will make sure they get a copy of this
[7:10]
and put this on file.
[7:14]
Thank you everyone, we'll close section five
[7:17]
and move on to section six for public comments.
[7:21]
Council on myself, value and respect comments from the public,
[7:24]
aligned with the City of Hudson codified ordinance
[7:26]
2-2-0.03 titled rules item G subtitle decorum.
[7:31]
I'm kindly asking everyone an attendance
[7:33]
to remain respectful of the process
[7:35]
and display courtesy, professionalism, and order at all times.
[7:39]
Please meet your electronics devices if you have not already done so.
[7:42]
If you must leave the room prior to the completion of our meeting,
[7:46]
please do so as quietly as possible.
[7:48]
Also, per ordinance 2-2-0.03 and sub item G,
[7:51]
public comments are to be kept within five minutes.
[7:54]
There is a device on the lectern that will turn green when the five minutes starts.
[7:58]
It will turn orange at one minute remaining.
[8:00]
It will begin flashing at 20 seconds and then turn red when that five minutes time period has come up
[8:08]
Therefore, we're per the city of Hudson Charter Article 3 section 3.02 if there is any resident of the
[8:13]
Municipality here tonight who would like to speak to city council regarding any topic that's relevant to the city of Hudson
[8:19]
Kindly raise your hand gain my attention and as you are called upon please approach the lectern
[8:24]
State your name and address and council will hear your remarks
[8:27]
Is there anyone here tonight who would like to speak to Council?
[8:31]
Sir in the green shirt.
[8:44]
Do you just state your name and address sir?
[8:47]
And then we'll begin your five-minute time period.
[8:49]
Richard Andrews, 2095 Revenest Street.
[8:57]
I'd like to thank you.
[8:58]
Thank you.
[9:01]
Is there any comment you'd like to make sir?
[9:03]
No, I'd just like my name reported.
[9:07]
And if I choose to do so, I'd like to do so during the meeting.
[9:12]
to have a public comment, sir?
[9:15]
At this stage, I do not.
[9:17]
Well, the only opportunity for you would be during this section of our agenda.
[9:21]
So, I can call you back up if you choose, sir.
[9:23]
Thank you.
[9:27]
There was a man back there in the wait.
[9:38]
Jessica Cleveland, 71, Kesswick.
[9:41]
Good evening, Council members.
[9:43]
Thank you for your time tonight.
[9:44]
Most of you have probably heard from my husband,
[9:46]
and we have been following the readings and workshops regarding low speed vehicles over the past several weeks.
[9:51]
several weeks so you have probably gotten many emails from us.
[9:56]
I watched last week's workshop and reviewed Mr. Sutton's proposed amendment.
[10:00]
Appreciate the time and effort that has gone into developing this ordinance. I'd like to start by highlighting what I believe is working well and then offer a few concerns for your consideration.
[10:09]
First, I'm pleased to see the provision that allows crossing a short distance to travel on 35-mile-hour roads in order to connect to another 25-mile-hour roadway.
[10:19]
That is a practical and reasonable solution. Without it, many residents would be unable to reach downtown, get fuel for their vehicles or even travel to the police station for the inspections.
[10:29]
The vehicles would essentially be trapped within their neighborhoods.
[10:32]
To put that in perspective, a half-mile stretch on a 35-minute road, traveled out of
[10:37]
vehicles, maximum speed of 25 miles an hour, takes approximately 72 seconds.
[10:42]
That is significantly less than a red light in the state of Ohio.
[10:46]
That is the amount of exposure we are really here discussing.
[10:49]
I would like to encourage Council to keep the exception in the final ordinance.
[10:53]
My primary concern is the broader prohibition on operating these vehicles on 35-mile and our roads all together.
[11:02]
These vehicles have been legally operating in our community for years.
[11:05]
During that time, there have been no reported accidents, no injuries and no formal complaints.
[11:10]
These are state-licensed vehicles that are inspected by the Police Department,
[11:14]
and even in prior meetings that you've described this proposal as a precautionary measure
[11:19]
rather than a response to any incidents that have occurred.
[11:21]
Given that history, I would encourage Council to focus on what really improved safety, requiring
[11:27]
proper equipment such as headlights, tail lights, turn signals, license plate illumination,
[11:31]
seat belts, and other visibility and safety features, rather than reshricting where these
[11:36]
vehicles may travel. I also have concerns about the proposed sunset restriction. If these vehicles
[11:41]
are limited to 25-mile-hour roads and required to carry a full package of safety equipment,
[11:46]
I struggle to see the justification from prohibiting them from operating on neighborhood streets after dark.
[11:53]
A license and properly equipped low-speed vehicle with headlights, tail lights, and turn signals is often more visible than a pedestrian or bicyclist.
[12:01]
Yeah, we routinely allow walking and biking at night through the community.
[12:05]
If we trust residents to walk and bike safely after dark, I believe that we should extend the same trust to properly equipped and legally operated low-speed vehicles.
[12:14]
Finally, I would ask Council to not treat this issue as an emergency.
[12:19]
The record before us shows no accidents, no injuries, and no complaints involving these
[12:23]
vehicles.
[12:24]
That simply does not suggest an urgent public safety crisis.
[12:28]
In fact, we have seen more real-world concerns involving bicycles and e-bikes, including recent
[12:33]
accidents that have generated actual complaints.
[12:36]
As a community, we rely largely on parents and individuals to make responsible decisions regarding
[12:42]
those activities.
[12:43]
Likewise, Ohio does not require motorcycle riders to wear helmet, despite the significantly greater risks involved.
[12:50]
My not-point is not to make those issues that they should be regulated more heavily.
[12:54]
Hevelate, rather, is that this ordinance deserve the same measured, thoughtful consideration.
[13:00]
We should take the time to get it right, instead of rushing to solve a problem that based on the available evidence does not currently exist.
[13:07]
I believe we're very close to a fair and workable ordinance, and I would simply ask that we focus on regulating safety and equipment
[13:13]
rather than reshricting access and allowing the process the time it deserves.
[13:17]
Thank you for your consideration.
[13:20]
One more.
[13:26]
Show me the picture.
[13:28]
We have a door of extra.
[13:29]
Thank you.
[13:30]
Thank you.
[13:36]
Is there any additional public comment tonight, ma'am in the back?
[13:50]
Good evening, Council.
[13:51]
My name is Melissa Jones.
[13:52]
I reside at 2, 2, 3, 3, Revena Street and I am here to bring some comments regarding my
[14:01]
significant concerns about the proposed settlement between the city and prestige homes regarding
[14:05]
the Canobary Crossing subdivision on Revena Street.
[14:10]
My property is Jason to that project on the Northwest Corner.
[14:15]
I have issues conceptually, legally, procedurally, but as I was preparing my notes here tonight,
[14:21]
And I thought, let's step back and take a look at the bigger picture.
[14:25]
This has been a long process.
[14:27]
We all know it's been a long process.
[14:29]
I think I can speak for everyone who says we want this to be resolved in some way.
[14:33]
My concern is the way it is being resolved.
[14:38]
There is mistrust on all sides.
[14:40]
There's frustration on all sides.
[14:42]
And in these types of situations, it's very easy to paint the sides in broad strokes.
[14:47]
We have prestige, the quote unquote evil corporation, and only cares about money.
[14:53]
We have city elected officials, the representatives, the corrupt politicians who are only doing favors.
[15:00]
For playing politics, or we have the crazy residents who don't like anything we have to say. It's very easy to put everybody into those categories. It's very easy to be black white.
[15:12]
That's just the way of the world these days. But in the reality is, everyone falls in the gray. All sides have valid points. And I am the first person to say, all sides absolutely have valid points.
[15:22]
And surely we can come to some sort of a agreement that makes everyone unhappy, which we all know that is the
[15:30]
hallmark of a perfect settlement is nobody walks away happy.
[15:35]
But that being said, let's talk about the quote unquote evil corporation prestige.
[15:39]
They are a business.
[15:41]
They are respected developer in this community.
[15:43]
They build nice homes.
[15:45]
I don't have an issue with prestige.
[15:46]
I also don't have an issue with that property being developed.
[15:50]
As I said, their business, their goal is to make money.
[15:53]
That's the American way.
[15:55]
If you're not in the business and making money, you're a nonprofit.
[15:58]
That is not them.
[15:59]
But with business comes risk.
[16:02]
This land is known to have many risks.
[16:05]
It's not a surprise to anybody.
[16:09]
And they purchase the land, knowing those risks.
[16:13]
And then in turn, they want to mitigate those risks by maximizing
[16:19]
the profit and that is where we are today and the question I have is what is the healthy
[16:24]
balance between it between those two concepts and also I question is the city helping them
[16:32]
mitigate their business decisions by entering to the settlement agreement that essentially gives
[16:38]
them essentially everything they want. That's where the quote unquote politicians. None of you
[16:45]
is anyone I would put into this category.
[16:48]
We are all citizens who love this town,
[16:51]
who are very dedicated to this town,
[16:53]
that what is best for the town.
[16:55]
And we might have differing opinions on what is best.
[16:57]
And that's okay.
[16:58]
It is okay to have differing opinions.
[17:01]
But at the end of the day, we all want to do
[17:03]
what is best for Hudson.
[17:04]
And all of us are putting in a tremendous amount of time
[17:08]
to do what we think is best for Hudson.
[17:12]
As for the quote, unquote, crazy residents,
[17:14]
which I suppose I would fall into that.
[17:16]
I can tell you the residents who have been involved,
[17:19]
they are very educated, intelligent,
[17:21]
and reasonable people.
[17:23]
We all work hard and care about our community.
[17:26]
Ward 3 is a special place, it has special zoning.
[17:29]
And all of us move toward 3 or had a home in this ward
[17:33]
because of that precise reason.
[17:37]
We choose to live there for that reason.
[17:39]
These are our homes.
[17:40]
I don't think anybody here with the exception
[17:42]
of Mr. Sutton who is our ward, we represented,
[17:45]
but I understand as we accused himself, due to conflicts,
[17:49]
you don't live in that area.
[17:51]
You don't live directly next door to the proposed development.
[17:55]
The city also recognizes how special the areas
[18:00]
are a land development code has a lot of regulations.
[18:03]
The comprehensive plan addresses it.
[18:05]
There were many surveys that were done.
[18:08]
And overwhelmingly, all city residents
[18:10]
supported, conserving the rural nature of the area that doesn't mean it can't be developed.
[18:15]
It just means there's such a provisions that need to be followed.
[18:20]
We all follow the laws, the codes, and the regulations.
[18:23]
And we expect others to do the same.
[18:26]
We, the crazy citizens, we've reviewed the land development code.
[18:30]
We've reviewed the land development code.
[18:30]
We've reviewed the country heads to end.
[18:32]
All right, very good.
[18:33]
Well, then I will just speed this up.
[18:35]
I can send this all in, but the main, well, there's many issues I have,
[18:39]
one of which is the water. Water is a significant concern. The settlement agreement includes a
[18:44]
clause for unforeseen conditions, the concern that I know I personally have is if the water
[18:50]
is an unforeseen condition if the conditions are different than what the plans anticipated,
[18:55]
what is my recourse. For example, the dry pond next door to me, the city built it. I had water
[19:01]
damning up on my property. I called the city, they came out and they took care of it, put in the
[19:09]
because the way the plans are proposed,
[19:11]
there is a very, very large retention point right on top of the slide.
[19:15]
It's not just happen.
[19:16]
Your time is up, but I'd like to let you finish that statement.
[19:18]
That's okay.
[19:20]
I just asked the city consider the impact to the residents
[19:23]
and take them into consideration.
[19:25]
Thank you, Ms. Jones.
[19:31]
Is there any additional public comment tonight?
[19:50]
But evening, Deborah Peter Silgead, Prescott Drive, Hudson, Ohio.
[19:55]
This statement is also directly connected to what.
[20:00]
The previous speaker just talked about the Canobiri Meadows Project. I just have a couple of questions for city council.
[20:08]
How and why are you considering voting on a resolution that appears to be in direct violation of clearly stated black and white rules and regulations found in the Hudson City Charter?
[20:20]
Specifically, I cite the fact that only the Planning Commission has the authority to approve subdivisions and streetplats.
[20:29]
They are on record.
[20:30]
The PC is on record as having turned this open space.
[20:35]
Conservation subdivision down.
[20:37]
Planning Commission rejected the open space.
[20:39]
Conservation subdivision and went on record with many suggestions.
[20:43]
Per the terms of the LDC that could have met requirements.
[20:46]
Your proposed settlement agreement would allow prestige to ignore the laws set forth in the LDC,
[20:55]
a very dangerous precedent. Additionally, I also would like to ask to those of you
[21:01]
who received 20-25 campaign contributions from this particular real estate developer. What justification
[21:09]
would you have to vote on this resolution instead of recusing yourself? Thank you.
[21:15]
Thank you, ma'am.
[21:24]
Is there any additional public comment tonight?
[21:32]
My name is Haley, Arnold, and I'm at 6378 Canterbury Drive.
[21:37]
I just want to echo the remarks of the previous two speakers.
[21:42]
I'm here in support of maintaining adherence to our land development code and our zoning.
[21:49]
And I want to just make sure that my concern and I think probably the concern of the city is further litigation from
[21:59]
Presti-Chones and although that is costly and that comes out of taxpayers' pockets, I think it's important that we, as a city, make a point that we're not going to be pushed around.
[22:15]
you know, we want to adhere to what the citizens said they wanted to do with the community
[22:22]
and it just concerns me. I think we know in Twinsburg, real estate developers have
[22:30]
bullied them into developing in ways that they didn't want to do. And so I'm hoping that in
[22:35]
Hudson we can sort of halt the line on that and maintain the beautiful community that we have. Thank you.
[22:42]
Thank you.
[22:48]
Additional public comment tonight.
[22:51]
I started to change your mind.
[22:53]
In the green shirt.
[22:57]
Anybody else?
[22:58]
Mr. Rivera.
[23:24]
Anthony Rivera, 1746, Edgar Drive.
[23:28]
I want to go back two weeks ago.
[23:32]
I said Mr. Bird wanted to resolve this situation.
[23:36]
That was his word.
[23:39]
I spoke to him.
[23:40]
And two weeks ago we did exactly the opposite.
[23:46]
And he handed it over to Mr. Pittsburgh,
[23:50]
which I read his statement last week.
[23:54]
He's more concerned about protecting himself,
[23:58]
Mr. Sheridan and Mr. Hannah.
[24:01]
I sent Mr. Bird a text afterwards.
[24:05]
I said, Mr. Bird, as you see the city of Hudson's official timeline,
[24:09]
There is no reference to my fence being in the easement.
[24:14]
Even Hannon's fake chronology doesn't have it.
[24:17]
My professional fence company Ohio State fence is 100% sure that they had followed the
[24:22]
guidelines set forth in the city of Hudson's staff.
[24:26]
A approval card reflects this.
[24:28]
The information that you received from Sheridan on the easement is a visit that Hannon did
[24:37]
six months later. When Hannon falsified the records, deleting the final inspection pass.
[24:45]
What I handed you guys today is Mr. Hannon's email and Mr. Hannon did not present himself
[24:54]
up until April 4th of 2024. Mr. Han and...
[25:00]
He had put in a false sight plan on October, I'm sorry, yeah, September 8th, 2023. So, in this email, you'll
[25:16]
see that he's introducing himself on April 4th. He says the right away, he's coming up for the right
[25:23]
way to be located are survey staff. He's not saying the survey. He's saying the survey staff
[25:30]
will flag the location of the right away. First of all, it's not a right away. It's the
[25:35]
easement. And everybody's using that term. It's an easement. That's most people know that except
[25:41]
the city of Mr. Sheridan, Mr. Han and Mr. Pitchford. Even on the card, the approval card
[25:50]
says and he easements.
[25:54]
So what I've basically saying is that this has been treated in a way that
[26:02]
is detrimental to the city, to myself. These guys are acted in bad faith. I've said about a month
[26:11]
and a half ago that these guys committed felonies. That's not going away. Your code, the city code,
[26:17]
The Ohio code shows that these guys broke the law.
[26:25]
But on another note, I pulled out Mr.
[26:31]
Foster's job that he had done.
[26:34]
Mr. Sheridan handled this in a whole different way.
[26:37]
I played the recording.
[26:39]
He lied eight times in 39 seconds.
[26:41]
He said, there was a sinkhole, a sinkhole was done in 2020.
[26:50]
Mr. Foster is allowed to say, why did concrete did the work and it was done on 318?
[26:57]
318, the work was completed. Mr. Sheridan knows that, the staff knew that.
[27:05]
Mr. Foster on 414, which is almost a month afterwards, I'm happy to apply for a permit to correct any problems.
[27:17]
If anything was done at Ronis or Ronis or I'm not a compliant manner, if you can walk me through the process,
[27:26]
Let's talk in a Mr. Hannon.
[27:29]
Good afternoon, Mr. Irvina.
[27:31]
Thank you.
[27:33]
After that statement,
[27:37]
Mr. Foster put out a note to the city to Jody Roberts.
[27:42]
I would like a timestamp of all calls placed on any city employee elected officials or their phone.
[27:49]
Be personal phone call and with my number on it.
[27:52]
So basically after making the statement, Mr. Foster saying that he wants to go after the guy
[27:57]
that told me that he'd put a driveway in without a permit.
[28:03]
This is handled in such a different way.
[28:05]
I've gone through three different cases,
[28:08]
which is just a malicious type attack on me and my family,
[28:18]
where Mr. Foster does a project
[28:21]
and nobody holds them accountable,
[28:23]
and that's the average thing that's going on.
[28:25]
You have to be something else other than a regular citizen,
[28:29]
to get a fair shake. Mr. Sheridan is to me the most of blatantly corrupt guy I know.
[28:38]
Thank you very much. Thank you, Mr. Rivera.
[28:45]
Is there any additional public comment tonight?
[28:51]
Seeing no further public comment, we will close section 6 and move on to section 7, which is
[28:58]
correspondence and council comment. If any council member has correspondence that has an already
[29:03]
have been generally distributed and or council comments. We will hear those now. Please gain my attention and allow me to verbally recognize you and assign you the floor.
[29:12]
Does council have any comments this evening?
[29:16]
Councillor Brosovic.
[29:18]
Thank you, Mayor.
[29:19]
A few comments.
[29:21]
First, the HCTV advisory committee met last week.
[29:25]
There wasn't much as far as new business.
[29:27]
The one item was that they are looking into technology and working with legal as far as the need to provide closed captioning in events.
[29:38]
There was an FCC regulation that requires community television provide closed captioning.
[29:43]
They already do most of the closed captioning and house the one kind of outstanding question is with the live broadcast because that's not something we can do in house
[29:51]
We have to wait 20 28 on that so it's it's not pressing, but it is being worked done
[29:58]
Next I do have
[30:00]
By message, I received that would be read into the record.
[30:06]
Members of Council, thank you for your service to our city and its residents.
[30:09]
I recognize that 2026 has been a demanding year, and I appreciate the time and effort you dedicate to these important decisions.
[30:17]
I am writing to express my concern regarding the proposed settlement related to the development on a rune van astrie.
[30:23]
My primary concern is that this development appears to be moving forward despite previous rejection,
[30:27]
We're opposition by the Planning Commission, City Council, the Board of Zoning Appeals, and the Summit County Court, and many neighboring residents.
[30:36]
If the revised plan now meets the standards and criteria required by the city, it should proceed through the same review process as any other development proposal.
[30:45]
The established process exists to ensure transparency, public input, and careful evaluation.
[30:50]
No applicants should be granted an exception to that process, regardless of how long a project has been under consideration.
[30:58]
In fact, if the city believes the proposal has been improved sufficiently, allowing it to return to the planning commission for review,
[31:04]
would seem to be the most appropriate course of action.
[31:07]
If the planning commission determines the plan meets then a necessarily requirements the project can then move forward
[31:12]
through the standard process with the public confidence that all procedures have been followed.
[31:17]
While I understand this has been a lengthy and costly matter for all parties involved, much
[31:21]
of that could have been avoided, had the developer address the concerns and recommendations
[31:25]
raised throughout the review process.
[31:27]
Following the established guidance provided by the city's boards and commissions from the
[31:31]
outset may have prevented years of litigation delays and expense.
[31:34]
I respectfully ask Council to uphold the integrity of the city's development review process
[31:38]
and ensure that this proposal is evaluated in the same manner as any other project
[31:42]
before it is approved.
[31:43]
Thank you for your time and consideration. Tony have like my last comment is simply that's I will be with holding any comment on this matter for those here today
[31:55]
Who also commented on it until after our public hearing next at the next regular council meeting on September 15th. I will then address. I will then make my comments
[32:05]
And I will withhold my comments on the low speed vehicles until that legislation item. That is all. Thank you
[32:11]
Thank you, Council Member Reservic.
[32:13]
Additional comments from Council?
[32:14]
Council against?
[32:16]
Yes, last evening, I had a forum on short-term rentals
[32:20]
and long-term rentals at Barlow Community Center.
[32:24]
And we actually had a full house.
[32:26]
And I want to thank Greg Hanin, Mary Roadack,
[32:30]
and Brian Griffith for their help in organizing
[32:34]
the whole thing.
[32:35]
There was really a very lively discussion for and against them.
[32:40]
people had a lot of good ideas and we're reviewing all the ideas that were presented.
[32:47]
We will be having another workshop on it at some point, so nothing has been decided yet.
[32:56]
But I want to thank all the residents who came out because it was really very, very helpful
[33:01]
that all of you were there.
[33:05]
Thank you, Councillor Gats, Councillor Weinstein.
[33:08]
Thank you, Mayor.
[33:09]
I just want to start off by thinking all the residents who showed up to write input, I appreciate hearing the input from residents, and we take note of that input.
[33:19]
I was at a planning commission meeting, a special executive meeting that was held last night with the city.
[33:26]
It was with the planning commission members and the city solicitor to be briefed on the Revena development settlement.
[33:33]
I am the liaison for the planning commission and I would just like to say I will
[33:38]
held comments until we discuss this more officially but I would just like to say that
[33:41]
it is an a priority for me to make sure that our land development code is fairly applied
[33:47]
and procedures are followed and that is something that we are trying to I think is important
[33:53]
for us to make sure that we follow and do.
[33:57]
And on a lighter note, we had Grease on the green, the food trucks today for lunch, I heard a lot of good feedback from residents. It was nice to go meet up with residents and have lunch and chat with residents on the green. So appreciate all the conversations that happened and food is great and thank you for everyone who put that on. Thank you to the city staff and I think it was the fun of it.
[34:21]
Thank you Councillor Weinstein, additional comments from council members.
[34:28]
Seeing none.
[34:30]
I will add just a few quick updates and reminders from my side.
[34:34]
We do have a home meeting tomorrow.
[34:36]
That's the Hudson officials for mutual endeavors.
[34:41]
Several council members myself, city staff, school board members,
[34:45]
member from the library and the park board is on there as well.
[34:51]
we talk about items that are mutually beneficial between our different organizations.
[34:57]
The public art mural is being...
[35:00]
Officially unveiled on September 3rd in the first and main area. I believe that is. I didn't write it down. I believe that starts in mid-afternoon. Mr. Scherdinand, if you could look that up while I'm going on with my other additional units comments.
[35:14]
The first home Hudson City School District football game is this Friday, September 4th in the evening. Also, the community picnic, which is the first time that we believe we've done this type of a community picnic.
[35:27]
It is rolled into the celebrate the America 250 that is on Sunday, September 6.
[35:35]
It is from 5 to 8 p.m. and that is here on the Clock Tower and Gazebo Greens in downtown.
[35:40]
Look out to the city's information.
[35:42]
There's all type of games and activities and organizations who will be there as well and it's
[35:48]
just a way for the community to gather on our Greens and have some time and celebrate
[35:53]
our community as well as America 250. I've already heard that people want this to maybe be considered as an annual event,
[36:00]
which I would support that at this time of the year. It feels like a great place to do something like that on a continual basis.
[36:08]
And then Labor Day is coming up September 7. City offices will be officially closed, so just please note that.
[36:13]
Mr. Sheridan, did you find the time for the first main unveiling of that art mural?
[36:19]
I did. It's September 3 from 430 to 7 p.m.
[36:22]
Correct. Okay, perfect. Thank you. Those are the only brief comments I had just wanted to give
[36:28]
Council on the additional opportunity to speak if they had something else.
[36:33]
Seeing nothing else, we will close section seven and move on to section eight report of the manager,
[36:40]
Mr. Sheridan, I'd like to sign you the floor if there's anything you'd like to update council on.
[36:44]
Just to add to some of the items the mayor mentioned, the America 250 at the community picnic,
[36:50]
We will be collecting items for a time capsule that will be open in 2076.
[36:57]
Four inches are smaller, and he resident is allowed to bring anything that they have that they would like to put in the capsule.
[37:04]
It has to be a flat item, and the rest of the description is available on our website.
[37:08]
So that time capsule will be made available here outside the visitor center.
[37:12]
And then just while I have the floor for today, the 9-11 stair climb and remember in
[37:19]
Ceremony is going to be coming up on Friday 9-11, starting at 8 a.m., the Ceremony
[37:24]
will begin.
[37:26]
There will be also an include a moment of silence, and you do not need to have a sign up for
[37:32]
the stair climb to attend the Ceremony, so that's all I had in there.
[37:36]
Happen the answer any questions.
[37:38]
Thank you, Mr. Sheridan.
[37:39]
Councillor, are there any comments or questions for our city manager?
[37:46]
Seeing none, we will close out section eight and move on to section nine for appointments.
[37:52]
Councillor President Bird, do we have any appointments tonight?
[37:56]
There are no appointments, but the clerk, a part a nicely listed a bunch of a number of boards
[38:03]
and commissions that we are interviewing for.
[38:06]
And I'll read that.
[38:07]
Council is accepting applicants for Cemetery Board, Environmental Awareness Committee, Planning
[38:11]
Commission Board of Zoning and Building Appeals and the HCTV Advisory Committee, the deadline
[38:17]
for accepting applications is Friday, September 11th, 2026.
[38:24]
Thank you, Councillor President Burden.
[38:26]
We will close section 9 and move on to section 10, which is our consent agenda.
[38:31]
Council members, if there are any items on the consent agenda that you wish to have considered
[38:35]
separately, please allow me to read the item gain my attention and state your wishes.
[38:39]
Item A on consent is number 26-0071, a motion directing the clerk to send notice to the
[38:47]
Ohio division of liquor control, indicating no request for a hearing, regarding a new permit
[38:52]
to sell alcoholic beverages for Ohio CVS stores, LLC, CVS pharmacy, 4359 and 577-83-Dero Road Hudson.
[39:06]
Item B on consent is number 26-116, this is a resolution accepting the amounts in rate
[39:12]
as determined by the Budget Commission and authorizing the necessary tax levies and certifying
[39:18]
them to the county fiscal officer and declaring an emergency.
[39:26]
Item C on consent is number 26-117, a Resolution Amending Resolution 25-182, an authorizing
[39:34]
the City Manager to increase an existing purchase order for superior beverage.
[39:41]
those are the items on consent with that. Do we have a motion to suspend the rules to consider
[39:49]
passage of the items on the consent agenda? I'm just suspend the rules. Thank you Councillor
[39:56]
the bros of it, do we have a second to that motion?
[39:59]
Second.
[40:00]
I'll take that as Council President Burton. Mrs. Wheeler, we please roll call the vote on the motion to suspend the three reading rule for the consent agenda tonight.
[40:09]
Mr. President? Yes. Mr. Rainbow? Yes. Dr. Gets? Yes. Mr. Sutton? Yes. Dr. Weinstein? Yes. Mr. White? Yes.
[40:17]
Yes. Dr. Bird? Yes. Thank you, Mrs. Wheeler. The three reading rule has officially been suspended by vote of seven in favor to zero against.
[40:25]
Therefore, we will move on to asking Council if they would like to enter a motion to approve the consent agenda.
[40:35]
Do we have a motion from Council?
[40:36]
We will approve the consent agenda.
[40:39]
Thank you, Council President Burr.
[40:40]
Do we have a second to that motion?
[40:43]
Thank you, Councillor Gats.
[40:44]
Is there any comment or discussion?
[40:48]
Seeing none, Mrs. Wheeler, we please roll call a vote on the motion to pass the items on the consent agenda.
[40:55]
Yes, Dr. Guetz. Yes, Mr. Sutton.
[40:59]
Dr. Weinstein. Yes, Mr. White.
[41:01]
Yes. Dr. Bird. Yes. Mr. President.
[41:04]
Yes.
[41:05]
Thank you, Mrs. Wheeler. The consent agenda has been approved by vote of seven in favor to zero against.
[41:12]
That will close our consent agenda item number 10 on the agenda and move to the agenda item number 11, which is legislation.
[41:22]
the first item on the legislative agenda is item A number 26-113. This is an ordinance
[41:29]
amending chapter 478 of the codified ordinances and declaring an emergency. This is a third
[41:36]
reading this evening and actionable by council. Does council wish to enter a motion on legislation
[41:44]
1, 2, 6, 4, 1, 1, 3.
[41:47]
Councilor Gats.
[41:47]
I would ask that we move this ordinance
[41:51]
a pending chapter for 7, 8 to a date certain of October 6.
[41:56]
So we can have a chance to talk about this more fully in a workshop.
[42:01]
Thank you, Councillor Gats.
[42:01]
And just for clarification for everyone in the audience.
[42:04]
We can't accept the motion to postpone to a date certain
[42:06]
without suspending the rules or emotion to pass,
[42:09]
which is in our codified ordinance 2, 2, 0, 0, 0, 0, 3 and item 0.
[42:13]
Therefore, the motion on the floor from Councillor Gats is to postpone legislation 26-113 to a date certain of October 6.
[42:23]
Do we have a second to that motion?
[42:26]
Thank you, Councillor Brisbane.
[42:31]
Are there any comments or discussion on the motion to postpone?
[42:38]
Do I have to say I'm fine with moving it to give us more time to discuss what we want to do going forward?
[42:46]
I think the discussion we've had at the workshop was pretty productive so far, and I think
[42:50]
we're pretty close.
[42:51]
I think we just need a little bit more discussion and we can, I think, come to a compromise
[42:54]
that works for residents and kind of balances allowing residents to use the golf carts
[43:00]
that they have and that they enjoy and also making sure that our city is safe for those residents.
[43:06]
Thank you Councillor Weinstein, additional discussion on the motion to postpone, Councillor
[43:14]
I agree, I think with there's been a number of amendments put forward in the last several
[43:21]
days.
[43:22]
I'm good idea to take more time to discuss.
[43:26]
Thank you, Council President Bird, any additional comment or discussion before we move
[43:29]
to a vote on the motion on the floor?
[43:33]
Seeing none, Mrs. Wheeler, we please roll call a vote on the motion to postpone legislation
[43:38]
to 6-113 to a date certain of October 6, 2020.
[43:46]
Dr. Weinstein, Mr. White.
[43:51]
Dr. Bird.
[43:52]
Yes.
[43:53]
Mr. President.
[43:55]
Mr. Irma.
[43:58]
Thank you, Mrs. Wheeler.
[43:59]
That motion to postpone legislation to
[44:01]
6-1-1-1-3 does pass by vote of six in favor to one against.
[44:07]
We'll move on to item B on legislation,
[44:12]
which is number two-6-1-1-5,
[44:14]
An ordinance enacting section 11 of chapter 1149 engineering standards and infrastructure construction and amending section 1016.04P and section 1 of chapter 1419 of the codified ordinances.
[44:31]
This is a second reading tonight. Councillor Brezovick.
[44:37]
I would like to make a motion to suspend the three reading rule.
[44:41]
Thank you, Councillor Breservick.
[44:43]
Is there a second to that motion to suspend the rules on legislation item 26-115?
[44:51]
I will take that as council president bird.
[44:56]
The motion to suspend the rules is not debatable, therefore we will move straight.
[45:00]
Thank you, Mrs. Wheeler, we roll call a vote on the motion to suspend the rules, which is the three reading rule on legislation 26-115.
[45:09]
Mr. Sutton? Dr. Weinstein?
[45:12]
Yes. Mr. White?
[45:14]
Yes.
[45:14]
Dr. Bird?
[45:15]
Yes.
[45:16]
Mr. President?
[45:16]
Yes.
[45:17]
Mr. Durymo? Yes.
[45:18]
Dr. Gates? Yes.
[45:21]
Thank you, Mrs. Wheeler.
[45:22]
That motion to suspend the rules on legislation item 26-115
[45:26]
Does pass by vote of six in favor to one against.
[45:30]
And just for everybody's input, suspension of the rules does require a
[45:35]
from majority of affirmative votes, and the way our codified ordinance on rules is stated
[45:40]
with seven members of Council President.
[45:43]
We do require six affirmative votes, which we did receive this evening.
[45:47]
Therefore, the rules are so suspended on legislation 26-115, which is a second reading this
[45:53]
evening, and that does open it up for additional action.
[45:58]
Councillor Breswick, thank you, pursuant to codified ordinance to 220.030E, I move to
[46:05]
adapt and amend the item 26-115 as follows. That the title be amended to include the words
[46:13]
and declaring an emergency and that the language of Section 6 be replaced with the words,
[46:19]
this ordinance is declared to be an emergency measure necessary for the immediate preservation
[46:23]
of the public peace, health, safety, and or welfare of, excuse me, welfare of and within
[46:29]
the city because the city and the city manager must be able to immediately protect and preserve
[46:34]
life, safety, health, property, public peace and general welfare of those within the city,
[46:40]
though the proper and balanced through the proper and balanced regulation of contractors and
[46:44]
construction crews performing excavation, underground drilling, boring, trenching, and related
[46:49]
activities. And to allow current and or plan projects to be completed yet this year during
[46:55]
good weather, and shall therefore be in full force and effectively upon its passage, provided
[47:00]
it receives an affirmative vote of at least six members of the Council for its enactment
[47:05]
and if seven are present. Excuse me, if seven are present. Or an affirmative vote of at least five
[47:10]
members if only five or six members are present at the meeting, at which it is passed. Otherwise,
[47:15]
it shall take effect and be enforced from and after the earliest period allowed by law.
[47:22]
Thank you, Councillor Brezzlevic. Is there a second to that motion to adopt an amend legislation
[47:28]
26-115 which has stated by Councillor Brezzlevic does also add emergency language.
[47:37]
Is there
[47:42]
any comment or discussion from council on the motion to adopt an amend
[47:48]
to 6-1-1-5 to add emergency language.
[47:52]
Comment or discussion from council members on the motion.
[47:56]
Councillor Weinstein?
[47:59]
I'll just say that I appreciate the work that the staff did to get these standards out
[48:05]
to make sure that the drilling processes that we use for velocity and other drilling is safe
[48:12]
so that we can help prevent what the incident that happened in Twinsburg.
[48:16]
And I know residents are also looking forward to
[48:22]
resuming activities safely, and I think this gets us there.
[48:27]
Thank you, Councillor Weinstein.
[48:28]
Any additional comment from council members?
[48:30]
Councillor White?
[48:32]
We'll just echo Dr. Weinstein just said.
[48:35]
And any residents that have spoken to that were
[48:38]
concerned about our previous rules.
[48:41]
I appreciate the work that staff put into this.
[48:44]
I feel this is a much safer way to go, and I think we've given this the opportunity to
[48:50]
breathe the opportunity for a comment, I think it's great to move forward.
[48:55]
Thank you Councillor White, additional comment from council members.
[48:59]
Councillor Brisbane.
[49:03]
Agreed.
[49:04]
Thank you staff for all the work you've done on this.
[49:06]
It was the right call to postpone safety as paramount, but I do feel we're at a place now where it's
[49:14]
I don't know if this is a point of information, but would we be able to direct the city manager
[49:22]
as we would maybe in a workshop that were comfortable with removing the directional drilling
[49:28]
hold at this if this were to pass?
[49:33]
Mr. Sheridan, is there something you can add for that question?
[49:36]
As soon as this goes into effect, if it's tonight, we will begin tomorrow.
[49:42]
Thanks.
[49:42]
Thank you.
[49:43]
Thank you.
[49:44]
Thank you.
[49:46]
Additional comment or discussion from council members?
[49:49]
Councillor President Burke?
[49:50]
Yeah, I think the feedback that we have gotten has not been, we have not had concerns
[49:56]
about this legislation and the process that we're going through.
[49:59]
I think.
[50:00]
People are very comfortable with the amount of work and analysis that is going into these new
[50:07]
wrecks. The other thing that is potentially out there, though very unlikely, we still have
[50:14]
the current standards in place. Somebody from outside the city could perhaps submit for a permit
[50:23]
and be held under these current rules unless we pass the new one tonight.
[50:29]
And so that's why I think I'm supportive of this and Kyle, thank you for the work that
[50:35]
you did and be in the the plow horse on this one.
[50:40]
Thank you, Council President Verde, additional comment from any council member who has not spoken.
[50:47]
Seeing no additional comment from Council, the motion on the floor is to adopt and amend legislation
[50:52]
in 26-115 to add emergency language.
[50:56]
And I'll reiterate what Council Brasovic did mention
[50:59]
and read briefly just so the audience as well as Council
[51:03]
as aware, adding emergency language will hold
[51:06]
if we have six affirmative votes out of the seven council members.
[51:10]
If it receives four or five votes in the affirmative,
[51:14]
it will still pass, but that emergency language
[51:16]
would not apply and pitch for that as correct.
[51:20]
just clarifying that with our city solicitor. Therefore with no further comments or discussions
[51:26]
on the motion on the floor, Mrs. Wheeler, will you please roll call a vote on the motion
[51:31]
to amend legislation 26-115 to pass that legislation as well as add emergency language as stated
[51:39]
by Councillor Brezzellvic.
[51:41]
Dr. Weinstein? Yes. Mr. White?
[51:45]
Yes. Dr. Bird? Yes.
[51:46]
Mr. President? Yes.
[51:48]
Ms. Duramo? Yes. Dr. Gets? Yes. Mr. Sutton? Yes.
[51:53]
Thank you, Mrs. Wheeler.
[51:54]
The motion to adopt and amend legislation 26-115 with emergency language
[52:00]
does pass unanimously by vote of seven in favor to zero against.
[52:05]
We'll move on to the last excuse me. The second to last item on legislation
[52:10]
which is item C number 26-118.
[52:14]
This is a resolution authorizing a settlement
[52:16]
of the Prestige Builder Group LLC versus the City
[52:19]
of Hudson lawsuit and related claims
[52:21]
surrounding the Canterbury Meadows development.
[52:24]
This is a first reading this evening.
[52:31]
Moving on to the last item on the legislative agenda
[52:34]
is item D number 26-119.
[52:38]
This is a resolution,
[52:39]
the Mending Resolution number 25-182
[52:42]
to increase funding for the snow and ice control program, contract for road salt and conveying
[52:49]
and declaring an emergency. This is a first of three readings tonight. There is a note from
[52:55]
staff requesting cement suspension of the rules and passage tonight on the first reading.
[53:00]
Therefore, it is council wish to enter a motion.
[53:03]
This has been the rules. Thank you, council President Bird. Do we have a second to the motion
[53:07]
This has been the rules on 26-119.
[53:11]
Thank you, Councillor Duramo.
[53:14]
Again, the motion to suspend the rules is not debatable.
[53:17]
Therefore, Mrs. Wheeler, we please roll call of vote on the motion to suspend the rules
[53:21]
on legislation 26-119.
[53:25]
Mr. White?
[53:26]
Dr. Bird?
[53:27]
Yes.
[53:27]
Mr. President?
[53:28]
Yes.
[53:28]
Mr. President?
[53:31]
Yes.
[53:32]
Dr. Weinstein?
[53:34]
Thank you, Mrs. Wheeler.
[53:35]
That motion to suspend the three reading rule on
[53:37]
legislation 26-119 does pass by a vote of seven in favour to zero against. That does make
[53:45]
this legislation actionable tonight. Does Council wish to enter a further motion.
[53:52]
Move to pass 26-119. Thank you, Councillor President. Do we have a second?
[53:57]
Second. Thank you, Councillor White. Is there any discussion on the motion to pass
[54:02]
legislation 26-119?
[54:07]
There is an amendment.
[54:13]
I did believe it back dates to yesterday.
[54:19]
I did overlook that.
[54:22]
Therefore, might I suggest an amended motion
[54:27]
from Dr. Bird to move adoption
[54:31]
with the amended version dated 9, 126?
[54:37]
Correct.
[54:37]
if you would agree to amend your motion to pass with the amended language, then we can ask
[54:44]
Councillor White if you would agree on the second.
[54:48]
Move to pass.
[54:50]
Resolution 26119 with the 9126 amendment.
[54:56]
Thank you, Council President.
[54:57]
for clarifying your motion, Councilor White Team.
[55:00]
To agree with the second that was on record already.
[55:03]
Okay, great. Thank you, my apologies for overlooking that amended an updated language to the legislation.
[55:11]
Therefore, is there any discussion on the motion to approve 26-119 with the updated and substituted language dated September 1, 2021?
[55:25]
Seeing no discussion, we will move to a vote. This is Wheeler.
[55:28]
We please roll call a vote on the motion to pass 26-119 with the substituted language
[55:34]
dated September 1st, 2020.
[55:38]
Dr. Bird?
[55:39]
Mr. President?
[55:41]
Yes.
[55:43]
Dr. Weinstein?
[55:44]
Yes.
[55:45]
Mr. White?
[55:46]
Yes.
[55:47]
Thank you, Mrs. Wheeler.
[55:49]
Legislation 26-119 as amended with the language dated September 1st,
[55:53]
2026 does pass by a vote of seven in favor to zero against that concludes our legislative agenda.
[56:03]
We'll move on to Section 12 on the agenda with an executive session in talking to city staff and our solicitor.
[56:11]
We do not have any topic that is required to be discussed this evening.
[56:17]
Therefore, if Council is okay with that, I can't ask, is there anyone who does want to enter a motion to enter into executive session otherwise we will move to close section 12.
[56:28]
But I want to give Council the opportunity if they were not all made aware of that detail.
[56:35]
So again, staff and the city solicitor does not have anything to discuss this evening.
[56:40]
and less Council would like to enter into executive session to discuss pending litigation.
[56:47]
I know that's an open topic that is the only thing we could talk about since it's
[56:51]
on the agenda is written that way.
[56:54]
So if Council wishes to make a motion, we can consider that if not, we will close section
[56:58]
12.
[56:59]
So I'll give Council the opportunity to make a motion to enter executive session if they so
[57:04]
choose noting that staff in the solicitor has stated we do not have any updated information.
[57:11]
Nothing from council.
[57:13]
Thank you.
[57:13]
We will close section 12 and then move on to section 13 for adjournment.
[57:18]
As we are, there is no further public business covered by this regular city council meeting.
[57:22]
Do we have a motion to adjourn?
[57:25]
I'm going to adjourn.
[57:26]
Thank you council and brezific.
[57:27]
Do we have a second?
[57:28]
Thank you, Councillor Gats.
[57:29]
All in favour of adjourning.
[57:31]
Please say aye.
[57:32]
Any opposed?
[57:34]
Seeing none, this regular city council meeting is so adjourned at 827 p.m.
[57:38]
on September 1st, 2026. Thank you.
