[0:54] Everyone put their phones down. Good
[0:56] evening. Uh, call to order the October
[0:58] 1st planning commission meeting. And if
[1:00] you could all rise for pledge of
[1:02] allegiance,
[1:14] indivisibley
[1:16] andice for all.
[1:23] Thank you so much, Miss Ericson. Uh, if
[1:26] you could call the role, please.
[1:28] >> Tinsley
[1:29] >> here.
[1:29] >> Travis
[1:30] >> here.
[1:31] >> Zimmer
[1:32] >> here.
[1:32] >> Ike
[1:33] >> here.
[1:37] >> Thank you so much. Uh, next on the list
[1:40] is, uh, approval of the minutes.
[1:44] Everyone have a chance to review them
[1:45] and do we have any changes?
[1:48] No changes. We'll let them stand as uh
[1:52] presented. Uh and next on to
[1:55] announcements. Do we have any
[1:56] announcements, Miss Johnson?
[1:59] >> Uh thank you, Chair Zimmer. The only
[2:00] announcement I have is that our next
[2:02] planning commission uh the planning
[2:03] commission meeting scheduled for October
[2:05] 15th is cancelled. So it will be the
[2:07] November
[2:09] 5th.
[2:10] >> The 5th, thank you. Will be our next uh
[2:12] scheduled meeting.
[2:15] >> Okay. Mark your calendars. show up and
[2:17] there's no movie. That's good. And we'll
[2:21] move on to our public hearings. We have
[2:23] three of them tonight. If you would like
[2:24] to speak, you can sign up at the back.
[2:27] Although it doesn't appear that there
[2:28] will be a mad brush. So, you can just
[2:30] come up to the table when it's your turn
[2:32] when you're ready. Um,
[2:35] first item is uh agenda item 5A, public
[2:38] hearing to consider the application of
[2:40] Gabriel Hoffening on behalf of
[2:43] Christopher and Jennifer Blackburn for a
[2:45] conditional use permit for an accessory
[2:48] structure to exceed 15 feet in height in
[2:51] the RS3 single family residential
[2:53] district. And we have Mr. Huff running
[2:56] here uh to introduce the project. if you
[2:59] could come forward that would be great
[3:00] and introduce yourself and your uh
[3:04] helper.
[3:05] >> Yes. My name is Gabe with Offering
[3:07] Construction. Uh this is my client uh
[3:09] Chris Blackburn.
[3:10] >> Excellent.
[3:10] >> Um so we're just asking for height
[3:12] variance uh for basketball court, not
[3:15] commercial use, just strictly
[3:16] residential. Um we're going to be going
[3:18] to 20 ft instead of you know the typical
[3:21] 15 uh just for the directory of the
[3:23] basketball. That's why we're asking for
[3:25] that. um matching the exterior
[3:27] conditions of the current house just to
[3:29] make sure that uh you know everything
[3:30] stays cohesive in the neighborhood. Um I
[3:33] think you know they have you know young
[3:35] kids that would be using it neighborhood
[3:37] kids. Um but like I said no commercial
[3:39] use just making sure that everybody can
[3:41] kind of have a family basketball court
[3:42] in the in their house.
[3:44] >> Excellent.
[3:45] >> Yes ma'am.
[3:46] >> Thank you so much. We'll have staff
[3:47] present and then if we have questions
[3:49] we'll call you back up. Yes ma'am.
[3:50] >> Thank you
[3:52] Miss Barton.
[3:57] Good evening, chair, commission members.
[4:03] This request
[4:05] is located along 170th Street. Can you
[4:08] hear me? Okay,
[4:09] >> I could hear Mr. Huffing. I can't hear
[4:11] you very well.
[4:14] >> Feel like it's echoey, but the property
[4:17] is about 47 acres in size. It is zoned
[4:21] RS3 in a developed neighborhood. There
[4:24] are other RS3 single family zone lots
[4:27] around this property and then about one
[4:30] lot over to the west there zone RM1
[4:33] which is our medium density residential
[4:35] district.
[4:37] So the applicant is proposing a 150
[4:40] square foot accessory building. As I
[4:43] mentioned that would be 20 feet in
[4:45] height. It would be located in the
[4:46] northwest corner of the property. So the
[4:49] maximum height allowed without a
[4:52] conditional use permit in the RS3
[4:53] district is 15 feet. So as they
[4:56] mentioned, the additional height is
[4:58] being requested to accommodate a sport
[5:00] court. Um and the building would not be
[5:02] able to be used for a home occupation or
[5:05] storage of a commercial vehicles or
[5:07] equipment. So the property currently has
[5:10] a single family house located on located
[5:12] on it towards the front of the property
[5:14] with a twocar garage. There are no other
[5:17] detached structures currently on the
[5:18] property. Uh the proposed building would
[5:21] comply with the maximum size allowances
[5:24] that are allowed for accessory buildings
[5:26] and they would meet the minimum required
[5:28] setbacks uh in the RS3 district. So, a
[5:32] driveway is not permitted or not
[5:35] required, I'm sorry, it's not required
[5:36] to go to the structure at this time, but
[5:39] in the future, if the design of the
[5:42] building would change and if there was
[5:44] an an opening that was installed 8 feet
[5:47] or greater, then a driveway would be
[5:50] required, but at this time, it's not
[5:51] required because of the design of the
[5:53] building.
[5:56] So staff is recommending approval of the
[5:58] conditional use permit with the five
[6:00] stipulations that were listed in your
[6:01] staff report and the findings of fact
[6:04] that were emailed to you as well and
[6:06] this is expected to go to the October
[6:08] 19th city council meeting. Uh we have
[6:11] not heard from any of the surrounding
[6:13] property owners and I stand for
[6:15] questions. Thank you.
[6:17] >> Thank you very much.
[6:19] This is a public hearing and we'll take
[6:22] anyone who would like to speak or
[6:24] address this issue free to come forward.
[6:29] And if we don't have anyone then I'm
[6:31] ready to entertain.
[6:38] » Second.
[6:40] >> There's a motion and a second. All those
[6:41] in favor signify by saying I.
[6:43] >> I.
[6:45] Sorry. Motion prevails. the public
[6:48] hearing. [snorts]
[6:50] [clears throat] Uh and uh now we're open
[6:52] for questions from commissioners to the
[6:55] uh staff or to the applicant.
[7:00] >> Madam Chair,
[7:01] >> Commissioner Travis.
[7:02] >> Um question for Mr. Blackburn. Um
[7:08] » when I um drove by the the property,
[7:12] >> yes,
[7:12] >> uh I was I was really unable to see the
[7:14] backyard. So uh so that's why But, uh,
[7:18] you know, 20 ft big building or high
[7:21] building. Uh, are the neighbors
[7:23] prepared? Have you like prepared the
[7:25] neighbors, told them you were going to
[7:27] get this, uh, get this going?
[7:29] >> I' I've lived in the house for 18 years.
[7:30] So, I regularly talk to my neighbors,
[7:32] see my neighbors, uh, spend time with my
[7:34] neighbors, and so they've been well
[7:36] aware, even before the construction
[7:38] started that this was going to happen to
[7:40] bring more space to our house. Uh,
[7:42] unfortunately, I only have a two-car
[7:44] garage, and about 80% of my neighbors
[7:46] have a three-car garage. Uh, and they
[7:48] probably don't have as many kids as I
[7:49] do. So, uh, in terms of space, this is a
[7:51] much needed space, not only for our kids
[7:53] to congregate, but as for also to, uh,
[7:56] have a little bit of extra breathing
[7:57] room inside of our property as well.
[7:59] >> Sounds good. Thank you.
[8:00] >> Thank you.
[8:02] >> We probably can't ask this question, but
[8:04] are you fielding a full team? Are we
[8:05] going to have like a championship team
[8:07] here in Lakeville in a few years? You
[8:09] never know what uh kids growing up in
[8:11] Lakevilles and 194 196 school districts
[8:14] could come through and actually play in
[8:15] that building at some point uh go into
[8:17] the college or NBA. So
[8:20] >> maybe the Olympics
[8:21] >> or the Olympics. Hey, that's even more
[8:23] attainable goal.
[8:26] >> All right. Do we have any other
[8:27] questions?
[8:29] >> Thank you so much.
[8:30] >> Thank you. I
[8:31] >> think we're ready for a motion then.
[8:34] Madam Chair,
[8:35] >> Commissioner Swansson
[8:36] >> move to recommend a city council
[8:38] approval of the conditional use permit
[8:39] to allow a detached accessory structure
[8:41] to exceed 15 feet in height within the
[8:43] RS3 district and adoption of the
[8:45] findings of fact subject to the five
[8:47] stipulations noted in the planning
[8:49] report dated September 24, 2026.
[8:52] >> Second.
[8:53] >> We have a motion and a second. Miss
[8:55] Eric, we please call the role.
[8:57] >> Travis,
[8:58] >> IA,
[8:59] >> I. Zimmer
[9:01] >> I
[9:04] » Tinsley
[9:05] >> I
[9:07] >> motion prevails and I believe Miss Bton
[9:10] said that this will be going to city
[9:11] council on October 19th.
[9:14] >> Thank you so much. Good luck with the
[9:16] project.
[9:18] Uh the second hearing is agenda item 5B.
[9:22] public hearing to consider the
[9:23] application of Twin Cities land
[9:26] development for a conditional use permit
[9:28] for a private recreation building in the
[9:31] RST2 single and two family residential
[9:34] district. Mr. Schmidt uh with Twin
[9:37] Cities Land Development is here to
[9:39] introduce the project or maybe not. Yes,
[9:42] he is. Oh, excellent. Didn't see you
[9:44] back there.
[9:46] >> I was hiding. Uh yeah, Benchmouth Twin
[9:48] Cities Land Development. Appreciate the
[9:49] opportunity to speak. Not a lot to say.
[9:51] We um these little pool houses have
[9:53] gotten very popular. Um I'm not
[9:55] necessarily a fan all the time, but
[9:57] they've gotten very popular. So, we're
[9:59] kind of putting one in after the fact in
[10:01] this case as uh number of the residents
[10:03] or potential residents have expressed a
[10:05] desire for it. So, pretty simple pool
[10:07] house in terms of the house itself is
[10:09] just uh bathrooms and room for pool
[10:11] equipment, a little outdoor pavilion,
[10:13] and then uh a pool kind of all
[10:16] residential in nature in terms of how it
[10:18] feels. Not not very commercial. fits
[10:20] into the neighborhood. Um hopefully not
[10:21] super controversial.
[10:23] >> Thank you so much.
[10:24] >> Thank you.
[10:28] » Miss Jensen's coming forward to talk
[10:30] about this project.
[10:34] » Good evening, chair and commissioners.
[10:36] Uh yes, this is a public hearing for an
[10:39] amenity building which is a conditional
[10:41] use permit.
[10:43] Uh it is located west of Kakook Avenue
[10:46] at the southwest corner of Kirkovven Way
[10:49] and Kettle Pass. It is an area of
[10:51] detached town homes that are currently
[10:54] under construction. As you can see here,
[10:57] it is zoned RST2 and all those little
[11:00] boxes are future detached town home
[11:02] lots. So there, this area was slated for
[11:05] a detached town home. Uh but in this
[11:08] case, that unit and the surrounding area
[11:10] will be owned by the HOA. um for
[11:13] maintenance. If at some point in the
[11:15] future uh decision is made that they
[11:18] didn't want to have this pool and
[11:20] facility anymore, they could remove
[11:21] that. Then it would have a buildable
[11:23] area for another unit there.
[11:26] Um so here is a site plan. I can get
[11:30] again Kirkovven Way and Kettle Pass. Um
[11:35] just very simple pool area here
[11:37] surrounded by a six foot tall fence is
[11:40] shown here. It's a six-foot black
[11:42] aluminum fence. Uh sidewalk connection
[11:45] up to a a small pavilion area. Uh and
[11:49] the building, as Mr. Schmidt noted,
[11:51] there are three bathrooms and some
[11:53] storage area for pooling equipment. So,
[11:56] there is no gathering space within the
[11:58] building. It's about the size of a
[12:00] smaller twocar garage. Um access then is
[12:05] from the pavilion here.
[12:08] Um, and then this is a future home lot
[12:13] here. Uh, it does, uh, exceed the the
[12:16] location here with the and this is not a
[12:18] home that's yet been constructed. So,
[12:21] um, the one requirement, one of our
[12:23] stipulations is that the distance from
[12:26] the the pool building here to whatever
[12:28] future home is has to be at least 28
[12:30] feet to ensure that um, this building is
[12:34] in compliance with the sideyard setback
[12:36] requirements. So, Um, but I measured on
[12:39] a couple of different um, plans where
[12:43] they showed potential layouts and they
[12:45] were in the 30 to 31 ft. So, I I don't
[12:47] think it's um going to be an issue, but
[12:50] it is something we would check during
[12:51] the building permit review process.
[12:54] Uh, here is the landscape plan for it.
[12:57] Again, the buildings down here and the
[12:59] pool. Uh, the the site is surrounded um
[13:03] variety of of plantings. the Taylor
[13:06] Juniper North Pole arborite and the blue
[13:09] muffin arrowwood viburnum
[13:11] uh are the primary perimeter plants. Uh
[13:14] the city forester has reviewed this
[13:16] plan. The one uh modification he's
[13:19] requested and Mr. Schmidt has indicated
[13:21] that they are would make the changes.
[13:24] There's a Black Hills spruce in this
[13:26] location and due to the the corner here
[13:29] and potential driveway for this unit, um
[13:31] that would be swapped out to an
[13:33] overstory tree so that there's not a
[13:35] sight visibility issue for either the
[13:38] driveway or that intersection.
[13:41] Um the exterior materials is a white
[13:43] board and batten siding with black uh
[13:46] doors, windows, and trim consistent with
[13:48] the types of materials we do see uh
[13:50] within the neighborhood.
[13:53] So staff does recommend approval of the
[13:56] cup uh subject to the two stipulations
[13:59] within the staff report and adoption of
[14:01] the findings of fact. And I'll stand for
[14:04] any questions you may have.
[14:06] >> Thank you so much.
[14:10] This is a public hearing and we would
[14:12] have anybody that wanted to speak to
[14:14] come on forward and just identify
[14:16] yourself. Give us your address.
[14:20] Feel free.
[14:22] Hello, I'm Teresa Stokes. I live Kitty
[14:25] Corner from that proposed pool. Nice to
[14:28] meet you. Is it Mr. Schmidt?
[14:30] >> Okay, so I can't tell how big is that
[14:33] pool, how deep is that pool? Will the
[14:36] fence have a lock that only residents
[14:38] will have access for?
[14:41] >> Staff will try to take down all the
[14:42] questions. So, if you can just speak
[14:44] into the microphone, you said, "How big
[14:46] is the pool? How deep is the pool?" What
[14:48] was your third question? Will there be a
[14:49] lock on the door that only residents
[14:50] will have for access to that pool?
[14:55] Plan timing. When will it go in? Uh when
[14:58] will it will be available for use? And
[15:01] then of course it's an HOA. So what are
[15:03] the proposed costs for HOA? I was told
[15:06] as a homeowner that we because we're
[15:07] existing uh that we would have the
[15:09] option to opt out. I will say I think
[15:12] there's quite a few of us existing
[15:13] homeowners that will opt out.
[15:16] Um, but I'd like to we would like a say
[15:19] on what the proposed cost would be on
[15:20] the HOA uptick and how we would be
[15:24] insulated from future needs to support
[15:27] that structure if we didn't want to
[15:28] participate in its maintenance.
[15:31] Is it a freshwater pool, saltwater pool?
[15:35] Um, times of use. When will it be open?
[15:38] When will it be closed? And then the
[15:40] maintenance. Pools require daily
[15:42] chemical checks. So, who's doing that
[15:44] and what's What does that look like?
[15:49] >> I'll leave my questions there.
[15:51] >> Excellent. Thank you so much, Miss
[15:52] Stokes. And we'll be sure to have staff
[15:55] and or Mr. Schmidt address those.
[15:59] >> I don't know if I see others rushing to
[16:01] the podium.
[16:03] >> Madam Chair, seeing no one else come
[16:05] forward, I move to close the public
[16:06] hearing.
[16:07] >> Second. Okay,
[16:09] >> we have a motion and a second. All those
[16:11] in favor of closing the public hearing,
[16:13] please say I. I
[16:16] >> public hearing is now closed and um
[16:19] perhaps Mr. Schmidt you could address
[16:21] some of those questions and we can have
[16:23] staff answer as well.
[16:25] >> Yeah, for sure. Uh apologize
[16:28] kind of working with the builder out
[16:30] there. So apologize you didn't get the
[16:31] information directly from them. But
[16:33] yeah, in terms of one of the things I
[16:34] think is super important is we do have
[16:36] unlike a situation where be bringing a
[16:38] pool house in before anyone who lives
[16:39] out there. We've got people who live out
[16:40] there already. they absolutely love the
[16:42] right to either opt in or out. So,
[16:44] people already live there get to make
[16:45] that decision. Uh if they don't want to
[16:46] be a part of it, then they're truly not
[16:48] a part of it and um those costs aren't
[16:51] passed along to them. They're just not
[16:52] part of that portion of the HOA, if you
[16:54] will. Um so, it'll be ultimately up to
[16:56] them and all that information will be
[16:58] provided. We don't have all of it yet.
[16:59] We get through this step and then all
[17:01] that information will be provided for
[17:02] existing residents. Here's what it is.
[17:04] Here's what a cost optin. Here's what
[17:05] your cost will be u monthly. In terms of
[17:09] the pool itself, it will only be for
[17:11] residents of this neighborhood,
[17:13] including, you know, excluding those who
[17:14] opt out. But so, anyone who's a resident
[17:16] of the neighborhood who opts in, that's
[17:18] who's allowed there. Otherwise, yes,
[17:19] it'll be fenced and locked and only
[17:21] accessible by people who are part of the
[17:23] pool HOA. Um, and again, in terms of
[17:26] like the cost, that'll all get worked
[17:27] out and will be passed along to
[17:28] residents uh to make that choice to opt
[17:30] in or out. Uh, normal, what I'd call
[17:33] kind of normal pool hours, right? It'll
[17:34] be open during the day, closed in the
[17:36] evenings. Um obviously once it gets to
[17:39] be fall time closed again. Um pool
[17:41] maintenance we've got when we've done
[17:43] this in other neighborhoods we hire a
[17:44] service that they take care of
[17:45] everything relative to the pool. So they
[17:47] come there daily do the pool tests need
[17:49] to be done clean the bathrooms do
[17:50] everything that needs to be done handled
[17:52] by a service that does just that
[17:53] specifically for these types of pools um
[17:56] in a number of neighborhoods. Uh depth
[17:58] of the pool. It's not a big diving board
[18:01] pool. It's a little more of a waiting
[18:03] pool. So, I'd say we go from three feet
[18:05] to five or six feet on the other end.
[18:07] Um, I feel like I kind of covered
[18:10] everything. If not,
[18:12] >> fresh or saltwater pool?
[18:14] >> Salt water. So, well, I'll say normal
[18:17] pool. I don't know if I I'll be the
[18:19] first to admit I'm not a pool guy. So,
[18:21] >> regular water from your kitchen faucet.
[18:23] >> Yeah. That then has some chemicals in
[18:25] it, chlorine in it, whatever it's
[18:26] supposed to be. I'm not a pool guy, so
[18:29] I'd call it a normal backyard pool.
[18:34] Great. I
[18:34] >> think I covered everything. Happy to
[18:36] stand for any of the questions, but I'll
[18:37] sit down otherwise. Thank you.
[18:39] >> You miss Jensen. I think we covered
[18:42] those all the questions. Okay. So,
[18:45] >> Madam Chair, got a question. Um,
[18:50] this was a conditional use permit for
[18:53] the recreation building. I don't think
[18:57] it I don't read anything that it says
[18:59] the pool.
[19:01] Are we approving a pool or approving
[19:04] just the building.
[19:08] » The way the ordinance reads is that
[19:10] private recreation centers and amenities
[19:13] are a conditional use permit in
[19:14] residential districts. So, we have a
[19:16] number of these. There's, as Mr. Schmidt
[19:19] stated, there is one literally a year
[19:21] ago, we did this for the southern uh
[19:24] location. There's one in Summerland. Um
[19:29] there are uh Cedar Hills. I mean we've
[19:31] got these scattered all over. So and
[19:34] they've done we've done cups for pretty
[19:37] much all those unless they were a part
[19:38] of a PUB. So um the the ordinance is
[19:42] pretty general in just saying private
[19:44] recreation. So the pool we've kind of
[19:47] lumped that all together. It's part of
[19:49] that private recreation for those
[19:51] residents.
[19:52] >> Thank you.
[19:54] >> Good clarifying question. Anybody else
[19:57] have a question?
[19:59] >> Madam Chair,
[20:00] >> Commissioner Spencson,
[20:01] >> just just a point of clarification. I
[20:03] know a lot of the questions that we had
[20:04] here today were related to HOA and HOA
[20:07] regulations. Does the city really get
[20:09] involved in
[20:11] that portion of it?
[20:13] >> We do not we do not have uh control over
[20:16] the HOAs other than ensuring that units
[20:19] uh town home units are in an HOA. U but
[20:23] we do not have jurisdiction over what
[20:26] those HOAs say um unless they're trying
[20:30] to be less restrictive than city
[20:32] requirements. So
[20:34] >> So Madam Chair, safe to say we're we're
[20:36] voting on how this complies with city
[20:38] regulations.
[20:39] >> Yes. Excellent reminder, Commissioner
[20:42] Swinson. Thank you.
[20:46] » No other questions. I think we're ready
[20:48] for a motion.
[20:51] Madam chair, I had a motion to recommend
[20:53] to city council approval of the Ritter
[20:56] Meadows private recreation building
[20:58] conditional use permit and adoption of
[21:00] findings of facts subject to the two
[21:02] stipulations in the planning report
[21:03] dated September 23rd, 2026.
[21:07] >> Second.
[21:09] >> We have a motion and a second. Miss
[21:10] Ericen, will you take the role, please?
[21:14] >> Loa,
[21:14] >> I. Zimmer
[21:16] >> I
[21:17] >> Swaney
[21:18] >> I
[21:18] >> Swinson
[21:19] >> I
[21:19] >> Tinsley
[21:20] >> I
[21:21] >> Travis
[21:21] >> Hi.
[21:23] >> Motion prevails. I will ask when will
[21:26] this one come to plan to city council?
[21:30] >> October 19th.
[21:32] Okay. Thank you so much.
[21:34] Good luck with your plan and your both
[21:37] of you if I didn't tell say to you guys
[21:40] too. Good luck with both of those.
[21:43] Uh we have a third public hearing. Um
[21:47] public hearing to consider amendments to
[21:49] title 11 zoning of the city code. Miss
[21:52] Jensen is coming back for a repeat
[21:54] performance.
[21:55] >> Back
[21:56] try and keep this real brief. Uh members
[22:00] of our police department have been
[22:01] working with our code enforcement
[22:03] officer on a variety of issues related
[22:06] to parking and storage of commercial
[22:09] vehicles, recreation vehicles, trailers,
[22:12] etc. Uh at the September 21st city
[22:15] council work session, Chief uh Brad
[22:17] Pollson did provide some information
[22:20] about proposed amendments to title six
[22:24] uh which is motor vehicles and traffic
[22:26] of the city code. Those changes are not
[22:29] subject to the planning commission
[22:32] review. Uh but I'm summarizing them here
[22:34] because the changes we're proposing to
[22:36] title 11 are related to these. Um so
[22:40] these changes uh address parking
[22:43] restrictions for commercial and
[22:44] recreational vehicles. Um adding
[22:47] trailers within there as well. They
[22:49] previously just talked about commercial
[22:51] and recreational vehicles. So we're
[22:53] specifically adding trailers as well um
[22:56] about those parking on public streets
[22:58] and then updating some of the
[22:59] definitions so that we're consistent
[23:01] with MIDOT uh standards makes it easier
[23:04] to identify what is what. Uh so the city
[23:08] council did have a discussion on that
[23:10] and then express support for those
[23:13] proposed changes.
[23:15] So, as a part of that, there are some
[23:17] minor amendments we would like to make
[23:18] in title 11 to ensure that the zoning is
[23:21] in is consistent with those changes that
[23:24] would be proposed for title six. Um, so
[23:27] the two sections, uh, one is 11197,
[23:30] which is our parking chapter, and it
[23:34] pretty much just adds trailers to the
[23:36] text addressing, you know, parking of
[23:37] recreational vehicles and equipment. Um
[23:41] it does add language prohibiting the
[23:43] parking of commercial vehicles and
[23:45] equipment on public rideway. Previously
[23:47] it said simply on any property. Um so
[23:50] this confir clarifies that it that does
[23:52] also include any public streets. Um and
[23:56] then chapter 22 is our outdoor storage
[23:58] chapter. Um it also adds trailers in
[24:01] there for the requirements uh in
[24:03] addition to recreational vehicles and
[24:05] then clarifies where those items um can
[24:08] be parked. staff does recommend approval
[24:11] of these ordinance amendments. This is a
[24:14] public hearing and I will stand for any
[24:16] questions you may have.
[24:18] >> Thank you. As M said, this is public
[24:22] hearing if anyone wants to comment on
[24:25] title six amendments.
[24:30] I'm not seeing anyone rushing to the
[24:32] microphone.
[24:34] >> Chair, I'd move to close the public
[24:35] hearing.
[24:37] >> Second.
[24:38] >> Have a motion. A second. All those in
[24:39] favor of closing the public hearing,
[24:41] please say I.
[24:42] >> I.
[24:44] >> Motion prevails and the public hearing
[24:45] is now closed.
[24:48] Miss Jensen, I would have one question.
[24:51] When you said for the second bullet
[24:52] point that adds language prohibiting
[24:55] parking of commercial vehicles and
[24:57] equipment on public right of way, does
[25:00] it also say
[25:03] continue to say any property? I forgot
[25:05] to look that up.
[25:06] >> Yes.
[25:06] >> Okay. It's just an addition.
[25:09] >> Yes. So, uh, currently it says except
[25:13] where specifically allowed, contracting,
[25:15] excavating equipment or other commercial
[25:17] vehicles and equipment may not be parked
[25:19] or stored on any property in the city
[25:21] unless it's being used in conjunction
[25:23] with a temporary service benefiting the
[25:25] premises. So, the amendment would say uh
[25:28] may not be parked or stored on any
[25:30] property or public street rightway in
[25:32] the city. So, it's just the addition of
[25:34] that clarifying language. It's very
[25:37] helpful. Thank you.
[25:38] >> Any other questions for Miss Jensen?
[25:45] » No other questions? Then I think we're
[25:47] ready for a motion.
[25:52] Madam Chair, I'd make a motion to
[25:54] recommend a city council approval of the
[25:56] amendment to title 11 zoning the city
[25:59] code relating to the requirements for
[26:04] >> second. We have a motion and a second.
[26:07] Miss Ericson, will you please call the
[26:08] role?
[26:10] >> Zimmer.
[26:11] >> I
[26:12] >> Swain.
[26:13] >> I
[26:14] >> Tinsley
[26:15] >> I.
[26:15] >> Travis.
[26:16] >> I
[26:20] » The motion prevails.
[26:22] Um the next item on the agenda,
[26:27] uh staff notices. Um oh, I forgot to
[26:31] clarify. I assume the zoning issue will
[26:33] be addressed on October 19th as well.
[26:35] >> Yes, both the changes to title six and
[26:38] title 11 would go to council on October
[26:41] 19th.
[26:42] >> Okay. Uh the next planning commission
[26:45] meeting is scheduled not for October
[26:48] 15th. That one has been cancelled and it
[26:51] will be November 5th. And I think there
[26:54] was a memo from Miss Johnson.
[27:00] Maybe not.
[27:02] No memo.
[27:04] Okay, there is no memo. Then we don't
[27:07] have anything else on the agenda. We are
[27:09] adjourned.
[27:12] Thank you everybody.
[27:16] Oh, the only thing
