[6:47] And you're live. >> Uh it is after 6:30 so we'll get
[6:51] started. Uh
[6:54] This is the September 3rd, 2026 Town of Lapel Board of Zoning Appeals meeting.
[7:01] Uh
[7:04] My first one go around is in charge so if I'm messing anything up let me know
[7:09] but uh so opening a meeting uh for our
[7:12] agenda we have call to order.
[7:16] Is that you? >> No. That you just called it to order.
[7:19] » Okay. >> I'm doing the roll call.
[7:21] » Determination of quorum. There are three here so I think we're
[7:25] good. Do we need to do a roll call? >> Yeah, you can just all go down and say
[7:29] your names. >> Cam Padgett.
[7:31] » Andrea Baldwin. >> Brady Moore.
[7:35] » Okay. >> All right, first order of old business
[7:38] item number one vote on the rules and procedures amendments.
[7:43] Here to vote on an amendment to the rules and procedures to swap the order
[7:47] of the petitioner and staff presentations.
[7:50] Which was read at last month's meeting. >> Yes.
[7:54] So, that brief description is
[7:58] But it says on the 10, that is what this resolution number one {dash} 2026 is
[8:03] for. It amends the rule of procedures for the board of
[8:07] zoning appeals to make that swap in order.
[8:13] And yeah, we read that last month, and so now we can
[8:17] have a vote on it. >> Do I need to make a motion? Do I need to
[8:19] make a motion to vote? Right? >> Yep.
[8:22] » I make a motion for the resolution one {dash} 2026
[8:28] to approve the amending the rules and procedures
[8:32] for the town of Coppell board of zoning appeals.
[8:37] » Thank >> I'll second.
[8:38] » All right.
[8:41] » Cam? >> Yes.
[8:42] » Andrea? >> Yes.
[8:44] » Brandy? >> Yes.
[8:49] » All right. New business is a first reading for rules and procedures
[8:54] amendments. >> Yes.
[8:57] So, >> Go ahead.
[8:58] » last month I had intended to present two
[9:01] amendments, but I left an amendment off the list somehow.
[9:05] So, this other amendment is the one that comes from the state where they changed
[9:10] the rules for removal of board of zoning appeals members. Um,
[9:15] so this would amend the rules of procedures to reflect this
[9:21] change in the state code. Um,
[9:26] which would make it so that members serve at the pleasure of the members
[9:29] appointing authority. Um,
[9:33] provided that the >> Uh, if the appointing authority is an
[9:37] individual person, that person is still that the the the person in that office.
[9:42] And if the appointing authority is a board um or a committee, that all of the
[9:47] individuals who were part of that board at the time of the appointment remain on
[9:52] the board. In those two circumstances,
[9:55] that body can decide to remove the member that they appointed for
[10:00] any reason. If
[10:03] that's not true, if if you were appointed by the town council president
[10:06] and to the different president or if you were appointed by the planning
[10:09] commission um by both the planning commission or the
[10:12] town council and even one member on either of those two
[10:16] bodies is different, um then you cannot be removed uh unless
[10:20] uh except for except for cause. Um
[10:24] which the cause in the in the in the rules basically is uh missing three
[10:30] meetings in a row.
[10:37] So, that's the first reading.
[10:39] Okay. >> We'll vote on it next
[10:42] » Yeah, we'll vote on it next meeting, right?
[10:44] » Correct.
[10:47] » Uh I show no other business. Correct?
[10:52] Need a motion to adjourn. >> I make a motion to adjourn.
[10:57] » All in favor? >> I.
[11:02] » Meeting adjourned.
