[1:07] I would like to welcome everybody to the June 22nd um Lucent Town Board meeting.
[1:11] I ask everybody to please silence their cell phones. Ask everybody to please
[1:15] rise for the Pledge of Allegiance.
[1:20] I pledge allegiance to the flag of the United States of America.
[1:24] To the republic for which it stands, one nation under God, indivisible, with
[1:30] liberty and justice for all.
[1:36] So, before we have a moment of silent reflection, um the Sanborn community
[1:40] this past week lost a uh a a big part of their community. Um and
[1:46] Jason Myers would like to address it real quick.
[1:49] » On June 14th, Glenn Wingky staple
[1:54] everything Sanborn, co-founder of the art museum,
[1:58] author of the business association,
[2:02] Talked about the schools, community head.
[2:05] One of the passions was always tending the flowers around town, beautifying
[2:09] Sandborn. We lost a beautiful soul.
[2:13] A true servant of Sandborn. Take a moment of silence to remember
[2:16] him.
[2:29] » Thank you very much. That was a wonderful individual and
[2:33] he will be missed. For years, he
[2:36] even in his early 90s, late 80s, watered all the flowers in Sandborn.
[2:41] We took that over last year. It just got to be too much for him. He was a Yeah,
[2:45] he was a good man. Um
[2:47] I did agenda approval. Under old business, I need to add pickleball
[2:51] courts at the plateau. And I believe uh Councilwoman Morality,
[2:57] you need to add to the sewer forgiveness. Sewer forgiveness.
[3:02] Anybody else?
[3:06] I ask for the agenda to be approved as amended.
[3:09] » Make that motion. >> Second.
[3:10] » Motion second. All in favor? >> Aye.
[3:14] » Opposed? >> No.
[3:15] » Real quick, let me state that Councilwoman Councilwoman Rector is out
[3:19] of town. And she won't be back till tomorrow, so
[3:22] she cannot make the meeting. So, she's excused.
[3:25] Resident statements. Let's start with Janette Hanson.
[3:28] 768 Butcher Road. >> You always make me go first. I think I
[3:31] might have questions at the end. I thought that you had one model city.
[3:35] On your first night. >> You want to wait?
[3:37] » Yeah, I'll wait. >> Okay. Uh
[3:40] Kevin Mirabella. >> Hi. Um we were out of town for the
[3:45] winter. Uh we had a water line break right at the time we were gone.
[3:49] We're looking for a forgiveness on the sewer portion.
[3:53] So, I talked to Danny Zeno.
[3:56] Kevin and I had a meeting with Danny Zeno like a couple of weeks before the
[3:59] board. You get the bill on Friday. I make
[4:01] apologies. I didn't get the bill.
[4:10] Yes. It's going to span two quarters. You got
[4:13] to get that extra bill? Cuz it when I last talked to you, they
[4:16] hadn't gotten the extra bill. You thought there was going to be
[4:20] one more. No? >> No, there's just the
[4:23] » Okay. >> There's late charges. There'll be late
[4:25] charges on >> Yeah, they're not
[4:28] Yeah, we're not worried about the late charges. Um
[4:53] I I think it's the same as >> Oh, yeah. Yeah.
[5:00] » So, basically it's this bill and this bill?
[5:04] » It's the the total is the sewer increase from
[5:08] uh previous year.
[5:11] It's 344.18. And then
[5:14] there's late charges of 142.44. >> Right.
[5:18] » And the >> Yeah.
[5:19] » one bill. >> So, the sewer total increase was 344.18.
[5:26] Um and your normal bill
[5:29] This was higher than your normal bill. >> But, that's that's that's how much
[5:33] higher it was than the Normal bill was about 60 bucks.
[5:37] » So, I asked Mr. Mirabella to come. Um just so we're
[5:43] we're using round numbers. Um I would ask for a motion
[5:48] on my topic of Danny Zinger to give him a sewer relief in the total
[5:51] of $325. That way it favors us on any little
[5:56] area. So, $325. Does anybody else have a problem with that?
[6:01] Can I get a second? >> I'll second it.
[6:03] » Any questions?
[6:07] All in favor? I. Opposed? Motion carried. So, it'll be
[6:10] a sewer relief of $325. And then
[6:15] I'll work with the water department for the next few days.
[6:17] Okay? Yeah. Thank you.
[6:23] Timothy McKee.
[6:41] » Greetings. My name is Timothy McKee. I'm a member of the Deer Clan of the
[6:45] Tuscarora Nation.
[6:49] Tuscarora Nation, through its Council of Chiefs and the Clan Mothers, extends
[6:52] greetings to the Lewiston Town Board. Thanks that you're all enjoying good
[6:57] health. The purpose of the Tuscarora Nation's
[7:00] appearance at the Town Board meeting is to request public water supply from the
[7:05] Town of Lewiston. Tuscarora Nation is constructing a
[7:08] community water system on its territory to provide water to our residents.
[7:15] Tuscarora Nation shall own and operate its community water system.
[7:20] Tuscarora Nation requires a public water supply for its water system
[7:24] and requests the Town of Lewiston to provide the supply.
[7:29] Details of the proposed plan are stated in a memorandum of agreement prepared by
[7:34] the Tuscarora Nation and the Indian Health Service.
[7:38] Tuscarora Nation appreciates the opportunity to discuss its proposed MLA
[7:43] as soon as possible. >> So, Tim,
[7:48] this is the first I've heard of it. I've I've been working with Renee Rickard
[7:51] since 2016. Um is Renee part of this?
[7:55] » Yes. >> Okay. So, what I would ask you is give
[7:59] me a call and you and Renee are But like I said, this is the first I heard of it.
[8:03] Come down and talk because it sounds like it's a different plan than the way
[8:06] you were going before. >> It's the same plan.
[8:10] It's just that we visited many different ways
[8:15] and different people had different thoughts about it and uh
[8:21] you know, we're we're looking forward to moving forward with this plan.
[8:26] » Okay. Well, um please reach out to me or have Renee
[8:30] reach out to me and let's talk about it because like I said, I I was interested
[8:34] in 2016. I'm interested in 2026. And I know we had a couple of meetings
[8:40] up at the uh community center.
[8:43] » Yes. >> And there was a lot of issues that kind
[8:45] of need to be resolved and uh you know, I'll I'll be all ears. So, I I look
[8:50] forward to to meeting with you. >> Well, we're ironing all of that out
[8:54] right now and so we're at that stage where you know, we're looking
[8:58] looking forward to moving forward. >> Okay. I look forward to working with
[9:01] you. >> Okay.
[9:02] » Okay. Thank you.
[9:07] It seems you want to wait a little bit. >> I want to wait for the minutes.
[9:10] » Okay. >> I'll wait for the
[9:12] » Okay. Um
[9:15] Thank you very much. Our department head stated that he
[9:18] uh he said he couldn't make it tonight. Um Bridget, anything from the clerk's
[9:23] office? >> Nothing today.
[9:25] » Chief >> Nothing today.
[9:26] » I was called to cabinet. >> Chief
[9:28] » Are you here today? >> Yeah. It's year today. Congratulations.
[9:32] Things change fast in a year, right? Baby, new porch
[9:37] » Yeah. >> Right?
[9:40] Little Conrad, anything? Mike Whites, anything?
[9:44] » Um We did our first round of paving last
[9:47] week. We'll finish that off and we'll have a couple more rounds
[9:51] throughout the summer here. >> You want to talk about Bronson Drive and
[9:55] some of the roads you already got done? >> Yeah, Bronson Drive and University Drive
[9:58] are the two that we started with first. They went really well. They came out
[10:02] really nice. And
[10:05] Next on the agenda is the Hillside Orchard
[10:09] neighborhood. That will be
[10:11] starting July 14th for milling. We haven't set down a date for paving
[10:17] yet. Um
[10:20] Other than that, just uh drainage projects and
[10:24] so on. And then um
[10:28] Supervisor Broderick and I discussed up at the dog park uh making some
[10:33] improvements and doing some work up there.
[10:36] And uh You know, we came up with the idea to
[10:41] do some concrete work up there where the dogs can dig underneath the
[10:45] toys and what have you, but concrete underneath them so that they can do it.
[10:49] Uh so when we did get three bids for concrete
[10:53] Um our lowest bid came in at $13,600 and that would be through Henwood
[10:59] Construction. >> Through who, Henry?
[11:01] » Henwood. >> Henwood.
[11:02] » Yes. >> So
[11:04] » Where would the concrete >> It's going to
[11:05] » So around the entrance
[11:07] » Around the entranceway and then where the obstacles are and stuff like
[11:11] that, where the dogs are undermining them, digging them out, digging
[11:14] underneath those so that we can stop that from
[11:17] » So Mike and I went up there and it was I mean there's flooding. When it when it
[11:21] rains it's a muddy mess to get in.
[11:25] So we had met with the dog owners group and I think they had submitted some a
[11:29] list of certain things they would like to see them have up there and then they
[11:31] want When I went up there that's something we
[11:33] noticed right away. So, um >> Did Did you Did you talk to Jackie at
[11:38] all about it? >> I did not yet. No.
[11:41] » Each 97 or Parks and Recreation Department?
[11:45] What would you like to see
[11:51] » I would say probably the the fund balance where the parks
[11:56] » Okay. >> That would be
[11:57] » Okay. So, I I would ask for a motion to
[12:00] approve concrete in the amount of 13,600 for the dog park and both entrances and
[12:05] remove all the obstacles. >> Yes.
[12:07] » Um from the B fund. >> I'll make that motion.
[12:11] » I'll second. >> Motion and a second. All in favor? I. I.
[12:15] Opposed? Motion carried.
[12:18] Okay, that's it. >> Nothing else. And just before you leave
[12:21] the board, >> Do you have a fire alarm for the water?
[12:22] » I got it right here. >> So, um James Daniel couldn't make it. Um
[12:26] but, he uh he would like to hire uh summer help for the water department,
[12:32] Colin Cosgrove, in the amount of $18 an hour starting tomorrow, June 23rd.
[12:38] » I'll make a motion to hire Colin Cosgrove at $18 an hour starting
[12:42] tomorrow. >> Second.
[12:44] » Motion and a second. All in favor? I. I. Opposed?
[12:47] Motion carried. I called it to
[12:52] Um okay. Al, anything?
[12:54] » Nothing. >> Uh
[12:55] Al, fire. >> Jeff?
[12:57] » Um I'm on here for um declaration of excess equipment.
[13:01] We just have some uh refrigerators and incubators that we have that do not work
[13:07] anymore. And they're not worth putting
[13:11] on Auctions International. We just want to throw them out.
[13:15] » Okay. Um
[13:18] Did you get a chance to have a look at it?
[13:20] » I I have not, but the the They're they're
[13:25] completely effectively, they're not worth worth anything.
[13:27] » No, no, they're it. >> Do you have to do anything as far as the
[13:29] pre-arm etc. that's in it? >> Um probably have to uh
[13:34] remove the >> You're able to do that?
[13:36] » Yeah, we're we're able to do that. >> No problem.
[13:39] » She's got a connection with the moderns. >> Yeah.
[13:42] » Yeah, not a worry. >> Okay. So, I'd need a motion to declare
[13:46] this excess equipment to be disposed of.
[13:50] » I'll make the motion. >> I'll second it.
[13:53] » All in favor? >> Aye.
[13:54] » Aye. >> Opposed?
[13:56] Motion carried. Jeff, do you want to give a quick update
[13:59] on the sewer relief down there? >> Yeah, the guys are going pretty good
[14:03] putting the Morgan relief sewer in.
[14:08] It's going to take us a lot longer than we had expected, but the guys are making
[14:12] great progress and today's the only day that we haven't worked on
[14:17] it during the during the week because of
[14:20] the rain. Slow go, but going well.
[14:23] » Good.
[14:26] What's What's the expected completion date?
[14:29] » I wouldn't want to um venture a guess, but I would say by the
[14:35] end of next month.
[14:43] » Jim Smith. >> Uh just got a couple more weeks left in
[14:47] our baseball season. Camp season opens up next week with all three camps.
[14:53] We have our moms group and yoga going down to Riverfront.
[14:57] We also have our tai chi and cornhole league.
[15:00] It's right behind the senior center. Information on those activities are all
[15:04] on Facebook or our website. Check them out.
[15:07] » Okay, thank you. It's hard to believe that baseball's already
[15:13] » Yeah, it's a beast, but it's it's it's growing, so it's good.
[15:19] » How many total kids for your the camp, summer camp?
[15:23] » Summer camp, I don't know
[15:25] we have over 200. Over 200 and we had and that's all we
[15:30] could take because of how many counselors we have and we can't fit much
[15:33] more than 100 at Kiwanis. And we had over 300 that signed up.
[15:39] » And very successful. Melinda?
[15:42] » Yes, we're very busy at the senior center. Lots of stuff going on as
[15:45] always. Lots of new people coming in, lots of new van riders. So, yeah. Busy,
[15:50] busy, busy. >> Yeah. And and you got a new
[15:53] um vegetable market. >> Oh, yeah. Yeah. Yeah. Yeah.
[15:58] » And it starts in July. >> July 8th.
[16:00] » July 8th.
[16:04] Okay. >> James. James.
[16:08] Oh, 92. Sorry. >> Pardon?
[16:11] » 92. >> 92.
[16:13] » Voted by James. Yep. >> Okay. Excellent. Um
[16:18] And we'll do it. We need the approval of the minutes for the work session on May
[16:22] 11th and the regular town board meeting on May 25th.
[16:26] » I will review them both and make a motion to accept the minutes.
[16:30] » I'll second. >> The motion is second. All in favor?
[16:33] Aye. Opposed?
[16:34] Motion carried. Councilman Myers for the abstract of claims.
[16:42] » June 22nd, 2026. I move to approve the regular abstract of claims
[16:47] 26-01 616 to 26-
[16:53] 01771 and recommend total payment in the
[16:57] amount of $216,000 510 dollars and 17 cents. And the post
[17:04] audit payment in the amount of zero dollars.
[17:08] » I'll second. >> The motion is second. All in favor?
[17:10] » Aye. >> Opposed? Motion carried.
[17:14] Thank you very much. Under old business, the pickleball
[17:17] courts at the plateau. So, when we went to the Greenway Commission for approval,
[17:22] um the Greenway Commission's recommendation
[17:25] was to move them further. They're at the plateau pickleball. We're going to go
[17:28] with the plateau at the west end. They didn't like the fact that they're
[17:32] going to be that close to the bird sanctuary, so they wanted us to move
[17:36] them east.
[17:38] The football players play up there. We've had two meetings with the football
[17:42] players' parents. And we had the definite uh voicing of
[17:46] concern about losing territory. We were going to clear some more area out on the
[17:52] north end of the plateau. This is a project with the
[17:55] village. And right now it just seems like with
[17:58] the new administration that we need to take a step back. Um
[18:03] and put it kind of on the back burner and
[18:07] maybe revisit the plateau at another time. However,
[18:11] we still want to move forward with pickleball. So, I'm going to make a
[18:14] motion that we change the location from the plateau to Fletcher Park with the
[18:19] pickleball courts. And where that's going to save us a little
[18:23] bit of money is there's a pavilion at Fletcher Park. It's already there, so
[18:27] this would not include a new pavilion. We would utilize the pavilion that's
[18:31] there. So, it would still be listening to Fire Hall, and then it would be
[18:36] Fletcher Park. So, I will make a motion to move the location of our proposed
[18:40] pickleball courts to Fletcher Park, which is on the
[18:44] Greenway and is an appropriate um use of Greenway funds in this location.
[18:50] » I'll second that. >> We have a motion and a second. All in
[18:53] favor? I. I. Opposed? Motion carried.
[18:57] Excellent. Uh nothing under new business.
[19:00] My liaison report, um at a meeting a couple meetings ago, we approved a
[19:06] traffic study at Swatling Road City Road.
[19:10] I reached out to um Richard Hayes
[19:17] Yeah, Richard Hayes of Invictus Civil Engineering.
[19:21] They do this type of work. Um and we have a proposal in front of us. Um and I
[19:26] would ask for a motion to approve Invictus Civil Engineering to to do a
[19:30] traffic study. All their actual analysis and what they're going to do is listed
[19:34] in the estimate. Their total of $537 $5,375
[19:39] and 0 cents. Um and that's a motion to approve
[19:43] Invictus Civil Engineering. I'll take a motion.
[19:46] » Motion. >> Second. No, I'm I mean Go on. Sorry.
[19:49] Second. I'm sorry. >> So, we have a motion and a second.
[19:51] Anybody have any questions? Um
[19:55] All in favor? >> I.
[19:56] » Opposed? Motion carried. So, I will call um Rick and get that going.
[20:03] They will give me a time when it will be done, but it will be done.
[20:08] Hopefully soon. So, can I get you a copy of everything that is included as far as
[20:12] the traffic study? >> Yeah.
[20:15] » What's the problem with the funding with that?
[20:17] » Oh, it's H97. I'm sorry. >> That's the motion.
[20:20] » Yeah. That motion to approve that motion will be
[20:23] H97 funds. >> It's the desired infrastructure fund.
[20:29] » So, >> Second. I'll second it.
[20:31] » All in favor? >> I.
[20:32] » I. Motion carried.
[20:36] Thank you.
[20:56] Okay. And Upward Niagara Chamber of Commerce bill. So, we reached out to the
[21:02] chamber. Um when I was there the winter the year,
[21:06] there was snow coming in through the windows, snow coming underneath the
[21:09] door, and their roof you could actually see through the roof in small patches.
[21:14] So, we reached out to them They worked with uh the village
[21:18] engineer, Mike Marino. They put it out to a sealed bid um
[21:23] for the repairs. The repairs are going to be
[21:27] 1 26 by 32 window replacement. I'm sorry, seven
[21:32] 26 by 32 window replacements. Two 24 by 38 window replacements, 26 by
[21:38] 42 window replacements, two of them. An exterior door replacement and a roof
[21:44] replacement. And the total is from Walter Johnson
[21:47] Building Company of $167,905.
[21:52] The other bid was $243,500.
[21:56] So, I would ask for a motion to accept the bid from Walter Johnson Building
[22:00] Company in the amount of $167,000 and that $167,905
[22:07] from our page 97 energy fund.
[22:10] » 98. >> Oh, I'm sorry. Page 98
[22:14] energy fund. >> I'll second that.
[22:17] » There's a motion and a second.
[22:20] » That's all. >> Are there any questions?
[22:25] » What's In in my opinion, that's a lot of money
[22:30] to replace windows that are 20 years old.
[22:35] » Well, the roof The roof's a liability here.
[22:38] » Yeah, I understand. >> Roof's $111,000.
[22:42] » Yeah, I understand. The roof is 14 square at $3,000 a square.
[22:46] And uh $3,000 to $4,000 per square.
[22:50] And building prices are way above what the market generally
[22:54] bears for window replacements over
[23:00] They have to Um
[23:02] What's it called when it's a municipal prevailing prevailing wages and these
[23:07] prevailing wages and the roof is I think cedar shake.
[23:13] Are they replacing it with cedar? Yes.
[23:20] It's a historical building, isn't it? Yes. Yeah, they had to go to the
[23:23] historical preservation. They actually they wouldn't let them do
[23:26] the second door. There were two doors. They wouldn't let them do the second
[23:30] door. I think I think they believe some of the windows need to be wooden sashes
[23:35] etc. Bill's very familiar with the work with the
[23:38] he worked with the other building as well. So
[23:44] You're saying 167 is a lot? I'm saying I'm saying for a roof repair and for a
[23:50] replacement for windows that is way above market.
[23:54] 143. The
[23:56] problem is that our building inspector is not here or bad.
[24:00] We can't get anybody to do government municipal work.
[24:04] I mean I think Ed's working on the senior center which we put it out to bid
[24:10] and nobody bid. So
[24:13] that's that's the problem. He's he's hoping he's got somebody that's going to
[24:17] bid on it and it will go out again. I actually was at the water department
[24:21] meeting the other day and they had no bids on our matter county water
[24:25] department as well. So I mean
[24:28] we made a promise to the chamber that we're going to get them new
[24:31] windows doors and a roof. We have the money in the 898 account.
[24:38] I would like to move forward on it.
[24:44] Could I ask for an opportunity to review the bids?
[24:49] I'd like to review the specs. I've never seen any of them. Yes, we can
[24:52] table it if you want. We'll table it and have you looked at
[24:56] the the information?
[25:00] Okay. So, we'll table it we'll table it. We have a motion and a second. We'll
[25:03] table it till the next meeting in July.
[25:08] Okay.
[25:13] Nothing under legal, nothing under engineering. Budget revisions.
[25:19] » Previously I submitted to the board and to your package uh
[25:23] five budget revisions for the fiscal year
[25:26] 2026. And tonight I ask for your approval to
[25:30] process those. >> I reviewed them with Jackie today and
[25:34] I'll make a motion that we accept them as presented.
[25:38] We have a motion and a second. All in favor?
[25:40] » I. >> Opposed? Motion carried.
[25:44] » Thank you. >> Councilman Byrd?
[25:47] » Uh nothing at this time. >> Councilman Morial?
[25:50] » I have two sewer forgivenesses to go over. I guess
[25:55] they were both replacement liners in their pools.
