[2:58] so welcome everyone welcome to this the
[3:02] 58th session of council
[3:04] on monday november the 22nd it is now 7
[3:07] p.m i welcome everyone this is a virtual
[3:11] meeting so i remind everyone that
[3:13] even though it is a virtual meeting the
[3:15] municipal conflict of interest act the
[3:17] council's rules of procedures code of
[3:19] conduct and other pertinent legislation
[3:21] apply as if this were an in-person
[3:23] meeting
[3:24] as it is an in-person media virtual
[3:27] meeting
[3:28] if any member of council's connection to
[3:30] the internet or to this meeting is lost
[3:33] or disrupted
[3:34] we will pause for a few minutes to allow
[3:36] that member to connect and uh
[3:42] if they cannot connect within a few
[3:44] minutes
[3:45] assuming we still have quorum we will
[3:47] continue the meeting out anyways
[3:51] with that as i say the meeting has been
[3:52] called to order right there was no
[3:55] closed session today
[3:57] so we shall move into the playing of the
[3:59] national anthem i will ask everyone to
[4:00] turn off their screens while the clerk
[4:02] prepares that
[4:15] [Music]
[4:18] so

[6:08] the lands we are on today are recognized
[6:11] in the two row wampum ditched with one
[6:13] spoon treaty treaty 27 and the crawford
[6:16] purchase
[6:24] once again welcome ladies and gentlemen
[6:26] and
[6:27] i'm just a
[6:29] housekeeping item you'll note that we
[6:31] have an open forum and then two public
[6:34] meetings and i do note that we have
[6:35] quite a few attendees this evening i'm
[6:37] assuming those are for the public
[6:39] meetings uh so i would remind people
[6:42] that the first section is the open forum
[6:45] where we invite people
[6:47] to we all we set aside the first 15
[6:50] minutes for the open forum and any
[6:52] individual may address council to voice
[6:54] an opinion on subjects of municipal
[6:56] concern
[6:57] excluding matters subject to the public
[6:59] meeting which is the second piece
[7:02] and
[7:03] notices hereby provided that under the
[7:05] authority of the municipal act and in
[7:07] accordance with the munici ontario's
[7:08] municipal freedom of information and
[7:10] protection of privacy act all
[7:13] information provided for or at our open
[7:16] forum public meetings or other public
[7:18] process are considered part of the
[7:20] public record
[7:22] the list township meetings are being
[7:23] held virtually and anyone wishing to
[7:25] speak
[7:26] in this open forum
[7:28] is asked to contact the township clerk
[7:31] to register in advance to make those
[7:33] arrangements
[7:35] with that i will ask if there's anyone
[7:38] in the audience who wishes to speak in
[7:40] the open forum not with regard to the
[7:42] items coming shortly within the public
[7:45] meetings
[7:47] madam clerk do we have anyone that
[7:49] pre-registered
[7:50] uh no i don't believe we did uh your
[7:52] worship i see one hand up from uh jeanne
[7:56] hudasen
[7:57] i'm just not sure whether they wish to
[7:59] speak up so i'll just allow or to oops
[8:02] hold on here
[8:04] if this whodayson wishes there she is
[8:09] welcome mr jason can you hear me
[8:18] welcome mr jason if you if you may be
[8:21] able to hear me but you're currently
[8:22] muted so we can't hear you
[8:25] if you can unmute
[8:28] and i see
[8:29] joe and gene hudayson
[8:32] might be the same family hi joe hi gene
[8:36] if you can hear me and you can unmute
[8:39] you are welcome to speak to the open
[8:41] forum
[8:47] we can see your hands
[8:48] but we can't hear you at this point
[8:54] and now we have joe hudson
[8:57] also muted
[9:01] madame clerk is there something we can
[9:03] do to help them unmute
[9:05] um i've asked
[9:07] all i can do is ask for them to unmute
[9:09] i've allowed them to speak
[9:14] we appear to be having some technical
[9:16] glitch i'm sure the houdaisians are
[9:18] wishing to speak
[9:20] but at this point we can't hear them
[9:22] again i don't know if they can hear me
[9:24] at this point
[9:25] right
[9:27] uh if they would like to email i can try
[9:30] and set them up uh to see what the issue
[9:33] is if they'd like to uh email info at
[9:37] loyalist.ca
[9:38] we can try and get them working
[9:42] okay and
[9:44] again i'm not sure if mr and mrs hadeson
[9:47] were able to hear that message
[9:49] perhaps if we could get them to
[9:52] take down their raised hand
[9:55] it would indicate that they're hearing
[9:56] us
[9:58] and mr mrsudasan have taken down their
[10:00] raised hand which means i believe they
[10:02] are here and present and wishing to
[10:04] speak but unable to to unmute
[10:08] with that
[10:10] if they've
[10:11] and they're now turning off their uh
[10:13] their screens they're disconnecting
[10:17] so i'm assuming i'm going to have to
[10:19] assume that they're going to connect to
[10:22] the clerk through the info at
[10:24] loyalist.ca
[10:28] and i do see another hand here for mr
[10:30] peter field if you'd like to come on
[10:32] perhaps the huday sins that will be able
[10:34] to
[10:35] arrange their connection and we'll come
[10:37] to them secondly mr peter field like to
[10:39] come forward
[10:44] mr field can you hear us
[10:46] we can hear you can you hear us we can
[10:48] hear you thank you for the record can i
[10:50] get you to state your name and address
[10:52] please uh peter field one teagan court
[10:57] welcome sir ontario
[10:59] thank you welcome sir
[11:02] i'd like to say good to see you again
[11:03] but
[11:04] i can't see you right this moment uh but
[11:06] if you have something to uh bring to
[11:08] council we would um well i'm not sure
[11:10] when the clerk said that there was no um
[11:14] advanced
[11:15] people for the
[11:17] to speak i thought we were supposed to
[11:18] be on the agenda tonight as the
[11:20] agricultural society
[11:22] uh under delegations we do have ms
[11:25] kimberly representing the uh odessa
[11:28] agricultural society yes florence is
[11:30] here with me okay that's fine we can
[11:32] wait till then okay that is a formal
[11:34] delegation so she will be able to speak
[11:36] at that time okay thank you okay thank
[11:38] you
[11:39] and in the meantime
[11:41] has uh mr dason or mr hudayson been able
[11:45] to connect
[11:48] i can see gene hudayson's connecting
[11:52] if you're able to take it off mute we
[11:54] would be glad to hear what you've got to
[11:57] say
[12:03] unless we can find another way to do
[12:05] this i don't think we're going to be
[12:07] able to hear mr and mrs whodayson's
[12:10] comments this evening
[12:13] giving trying to give them a little more
[12:14] time to connect or to figure out how to
[12:17] unmute is there anyone else in the
[12:19] audience who wishes to speak during the
[12:21] open forum
[12:22] not regarding the items under the the
[12:25] public meetings
[12:29] i'm seeing no other hands
[12:36] and mr jason
[12:44] unfortunately i can't
[12:46] seem to connect with uh
[12:48] mr mrs davison right now
[12:51] and hopefully they will be able to
[12:53] connect with us
[12:54] and provide that information whatever
[12:56] they wish to to bring forward uh through
[12:58] the clerk madam clerk
[13:00] we are uh monitoring the info uh email
[13:03] so we'll just if we can connect we will
[13:06] try and get them on
[13:08] thank you
[13:09] if they are able to reconnect
[13:12] at that time i will ask council if uh
[13:14] depending on where we are in the council
[13:16] meeting if they will allow that to uh
[13:19] to you know suspend the rules of
[13:21] procedure to allow them to present
[13:23] because they have made an effort to
[13:24] present this evening
[13:26] with that we will move forward if
[13:28] there's no one else for the open forum
[13:31] i'm seeing no
[13:32] others
[13:34] oh
[13:35] and we are moving into the public
[13:38] meetings
[13:41] the first public meeting
[13:43] with regard to 1315 main street odessa
[13:46] from nrk development
[13:48] public meeting is being held in
[13:50] accordance with the provisions of
[13:51] section 1715 3412 and 5120 of the
[13:54] planning act rso 1990 to consider an
[13:58] amendment to the loyalist township
[13:59] official plan amendment to the
[14:01] comprehensive zoning bylaw
[14:04] 2001-38 as amended and the plan of
[14:08] subdivision
[14:11] proposed subdivision seeks approval for
[14:13] a draft plan
[14:14] draft plan of subdivision consisting of
[14:16] three
[14:17] i'm going to skip over that part you can
[14:20] all read that okay
[14:22] council shall hear in person or by his
[14:25] or her counsel solicitor or agent any
[14:27] person who who claims to be affected by
[14:30] this application
[14:32] all right i will first turn to the
[14:34] director
[14:36] the director does the staff have
[14:38] anything to add to the
[14:40] report that we have before us at the
[14:42] time at this time
[14:45] uh through you you worship uh there's
[14:47] nothing to add to the report no uh but i
[14:50] believe the applicant's consultant uh is
[14:53] presenting tonight so if your uh
[14:56] worship agrees uh it probably should be
[14:59] the next presentation
[15:01] absolutely the applicant's consultant
[15:03] for this is
[15:05] mr cunningham
[15:09] i don't know
[15:11] miss tucker
[15:16] is the is the applicant or the
[15:17] applicant's consultant available to
[15:19] speak to us
[15:20] and we have ms tucker yes
[15:25] good evening council marin council my
[15:28] name is tracy tucker i'm with ibi group
[15:30] and i'm going to
[15:32] present uh
[15:33] the
[15:34] application before you for 315 main
[15:36] street
[15:38] uh i just need to share my screen
[15:57] so we're here today about the proposed
[16:00] resident potential development at 315
[16:03] main street odessa
[16:14] there we go uh so it is located at the
[16:16] corner of county road to shane street
[16:19] and hensey street
[16:20] um with
[16:22] frontage on all three streets
[16:26] um right now the lands are currently
[16:28] vacant with residential on the
[16:32] east
[16:33] sorry the west south and
[16:36] vacant looks like farmland and
[16:37] agricultural on the north and
[16:40] north of the site
[16:43] so currently the lands have a low
[16:45] density residential designation on them
[16:48] and
[16:49] the proposal is to
[16:51] move them to a medium density
[16:53] residential designation to prevent the
[16:55] development as proposed
[16:58] so previously back in 2019 we had
[17:01] submitted an application for draft plan
[17:03] of subdivision
[17:05] which included medium density town
[17:07] houses in this area in this area a
[17:11] public right-of-way which would have
[17:13] gone from hensey street to shane street
[17:16] and a medium density apartment building
[17:18] once we received comments back from
[17:20] staff and feedback from the original
[17:23] public meetings
[17:24] we have revised the plan and we've
[17:28] put townhouse units fronting straight on
[17:31] to hensey and shane street
[17:34] there's 14
[17:36] town houses as well as a 22 unit
[17:38] apartment building which will have
[17:40] frontage on
[17:41] highway 2 as well as on
[17:45] shane street
[17:46] the there is no will be no access from
[17:49] highway 2 as
[17:50] uh it's not permitted at this time and
[17:52] then there's also a stormwater
[17:54] management pond proposed which will
[17:57] help with all the runoff
[17:59] or potential runoff from the site
[18:01] controlling it before it goes out into
[18:02] the existing ditch system
[18:07] so currently the low the official plan
[18:09] that
[18:10] permits low density residential which is
[18:12] single detached dwelling semi-detached
[18:14] dwellings
[18:15] with a total density of 31 units per
[18:18] hectare
[18:20] um and the
[18:22] medium density permits the low density
[18:24] uses triplexes cluster row housing
[18:28] street fronting townhouses low-rise
[18:30] apartments to a maximum
[18:31] 60 units per hectare with a maximum of
[18:34] four stories
[18:35] and we are proposing to put
[18:38] street fronting townhouses a low-rise
[18:40] apartment which is three stories in
[18:42] height and a
[18:44] total net density for the entire site of
[18:47] 48.4 units per net hectare
[18:49] which removes is
[18:51] basically the lands that are being
[18:53] developed with residential so doesn't
[18:55] include the lands of the storm water
[18:56] management pond
[18:58] in that calculation
[19:02] so originally this is what was proposed
[19:04] for the site there was 24
[19:08] units in the apartment building
[19:10] and there was
[19:11] 16 units with frontage onto the proposed
[19:15] public road
[19:17] so we are now proposing a 22 unit
[19:20] apartment building
[19:22] same footprint we're just reducing the
[19:24] number of units in it uh there's a lot
[19:26] more amenity space we've provided
[19:28] children's amenity space
[19:30] and we've also
[19:31] included 14 uh townhouses which are
[19:35] i believe they were approximately
[19:38] 2100 square feet in size
[19:41] two stories in height
[19:46] so the proposed
[19:49] apartment building hasn't changed in
[19:51] terms of the looks of it
[19:54] although this will all be dealt with the
[19:57] actual details of which will be dealt
[19:58] with through the site plan process in
[20:00] the future once
[20:02] approved
[20:05] so currently the lands are a residential
[20:07] type five zone
[20:09] which permits the existing
[20:11] which existing permissions permit street
[20:13] fronting townhouses and the low-rise
[20:15] apartment dwelling
[20:17] this doesn't align with the official
[20:18] plan um
[20:21] which
[20:22] doesn't permit these uses in the low
[20:23] density use but the zoning permits them
[20:25] as of right
[20:28] um so we were proposing to
[20:30] modify the existing zoning bylaw to
[20:33] permit these uses
[20:35] including some lot area
[20:37] uh reductions minor reductions are still
[20:40] meeting all the setbacks with exception
[20:44] of the exterior side yard on one unit
[20:47] and the front yards we've asked for it
[20:49] to be six meters which accommodates the
[20:51] driveway as well as four and a half
[20:52] meters to the house so your driveway
[20:54] your garage face is actually pushed back
[20:57] from the front of the house
[21:00] and then
[21:01] through staff we were asked to
[21:03] propose an amendment to the
[21:05] maximum
[21:06] lot coverage for the internal units to
[21:09] allow for future sheds to be placed in
[21:11] these rear yards
[21:13] um
[21:15] so we've gone up to 51 there the corner
[21:17] and end units would still comply with
[21:19] the additional five percent for the
[21:21] sheds
[21:22] and we've also provided additional rear
[21:24] yard space
[21:26] from what the current by-law proposes
[21:28] so because we were requesting amendments
[21:30] to the zoning bylaw that triggered the
[21:33] official plan amendment
[21:37] and the
[21:38] for the apartment building were
[21:40] requesting a reduction of the front yard
[21:42] from seven and a half meters to six
[21:44] meters
[21:45] and uh parking to be located 1.5 meters
[21:48] from the street line and this is to
[21:50] capture a pinch point at the north what
[21:54] northeast corner of the site
[21:56] most parking will be outside of the
[21:58] three meters with exception of the one
[22:00] pinch point on site
[22:04] so we have heard some public concerns
[22:07] about the
[22:08] about flooding the increases to density
[22:10] and the traffic that will be generated
[22:12] from this site
[22:14] um
[22:15] the flood
[22:16] flooding and drainage we do understand
[22:18] that is an existing ongoing issue in
[22:20] this area
[22:21] due to the bedrock and the
[22:24] lack of storm source so the ditches have
[22:26] been seen to overflow our site does have
[22:30] to implement a stormwater management
[22:32] pond which will
[22:34] address any flooding issues that would
[22:36] have resulted from this proposed
[22:37] development
[22:39] so
[22:40] we will be containing and we have to
[22:41] contain pre pre to post so we have to
[22:45] contain all flood
[22:47] and all water before it goes back into
[22:49] the into the municipal ditches
[22:51] to the same extent that it would be
[22:53] today and we've actually i believe
[22:56] made it better with because we've
[22:58] increased the size of the pond to allow
[22:59] for additional
[23:01] storage on site in those major events
[23:04] the increase in density on the site so
[23:07] as
[23:08] previously noted the zoning bylaw
[23:10] actually permitted the uses of the
[23:12] medium density
[23:14] and would have permitted
[23:16] the uses as of right
[23:18] it's a minor increase in density we're
[23:20] not actually asking for an amendment by
[23:22] going to the medium density
[23:25] um
[23:26] previously we had asked for an
[23:28] additional
[23:30] density increase but we've now reduced
[23:32] the number of units on site and we are
[23:36] were allocated previously to have 36
[23:39] units for servicing and that's what we
[23:41] have proposed on site now
[23:43] and the increase in traffic as a
[23:47] we have done a traffic study for this
[23:49] site
[23:51] and it found that the
[23:52] increase in traffic would be
[23:54] not
[23:55] negatively impacting the existing
[23:58] traffic flows in the area
[24:03] so again this is our revised plan so we
[24:05] did the storm water management pond is
[24:07] here and it is approximately
[24:10] uh 1200 square meters and
[24:14] the amount so we have amenity space now
[24:16] across the entire
[24:18] frontage here as well as each of these
[24:20] townhouses have a significantly
[24:23] large backyard
[24:25] for
[24:26] what a townhouse would normally have
[24:30] and the this is for the proposed draft
[24:32] plan of subdivision
[24:35] uh so there's three blocks which would
[24:36] include the three the three townhouses
[24:38] as well as the
[24:40] block for the
[24:42] um
[24:43] apartment building and there's also a
[24:45] road widening of three meters and
[24:49] about three meters on both shane street
[24:50] and hensey street which is part of why
[24:53] we've asked for the additional
[24:55] setback to six meters from seven and a
[24:57] half for the apartment building because
[24:59] we have given a three meter widening so
[25:01] we are
[25:02] significantly set back we're still nine
[25:04] meters from where the road currently is
[25:06] today and that road widening
[25:08] will likely just be grass in this area
[25:14] in the future if the city or the
[25:15] township does choose to actually widen
[25:18] this road or urbanize this road
[25:20] there may be sidewalks located within
[25:22] that area but for now it would just
[25:23] remain as is today
[25:28] and that's our presentation thank you
[25:32] thank you very much miss tucker
[25:34] and if i can get you to stop sharing
[25:35] your screen first
[25:37] yep i'm just trying to find the button
[25:38] to do that
[25:51] why is it not
[25:59] there we go
[26:00] thank you very much
[26:01] and so thank you for that presentation
[26:04] and uh before i go to the public i will
[26:06] ask council if they have any questions
[26:08] of you at this time
[26:10] council any questions for the consultant
[26:13] for this project
[26:17] i'm seeing none
[26:19] then we'll move to the the open part
[26:22] this is a public meeting we would ask
[26:24] any attendees who wish to speak to the
[26:27] 315 main street odessa application uh to
[26:31] please use the raise hand signal
[26:34] and the clerk will
[26:36] in some sequence invite you in and ask
[26:39] you to speak
[26:43] hey mr cunningham i will allow to speak
[26:51] welcome mr cunningham if you can hear me
[26:53] i would ask that you unmute and then
[26:55] give us your full name and address and
[26:58] then uh tell us your thoughts
[27:01] uh doug cunningham i live a country club
[27:04] drive in bath ontario
[27:07] and i'm here regarding the 496 main
[27:09] street that's what i would like to talk
[27:11] about
[27:12] okay that that will be the second public
[27:14] meeting so i'll ask the clerk to uh
[27:16] let you back into the uh the waiting
[27:18] area if you will okay thanks and we'll
[27:21] bring you in at that time
[27:24] adam clerk are there others here to
[27:26] speak specifically to the 315 main
[27:29] street odessa application
[27:35] let's see mr hilson
[27:48] and i see that bob hilson has come in
[27:51] again mr hilson welcome and we ask that
[27:53] you uh unmute i think you have already
[27:55] and uh tell us your your name and
[27:58] address and then share your thoughts
[27:59] with us
[28:00] name is robert hillson
[28:03] address is one five one manor road bath
[28:06] ontario
[28:08] my question for the present presentation
[28:12] person is
[28:14] not uh with regard to the storm water uh
[28:19] management pond
[28:21] is
[28:22] i think
[28:23] something that was lacking is
[28:26] not necessarily the area of the pond but
[28:30] the volume of the pond that's what i
[28:33] would like to have answered
[28:35] okay mr are you able to provide that
[28:38] information
[28:41] if you give me one second i can pull up
[28:44] the report to get that information
[28:48] hold on for one moment mr hilson
[28:51] that's fine
[28:52] do you have any other questions while
[28:54] miss tucker is pulling that information
[28:55] out no i do not okay
[28:58] uh i do note that there are a couple
[29:00] other people that are have their hands
[29:02] up we will get to uh i believe it's mr
[29:04] kowalski and mr peacock uh in a moment
[29:07] as soon as we've completed with mr
[29:09] hillson
[29:49] i just need to look
[29:51] i am still looking for it
[29:54] again perhaps you can share that in a
[29:56] few moments if you're still looking for
[29:57] it and mr hilson if you have no other
[30:00] questions i will move forward and ask
[30:02] miss tucker to answer that question uh
[30:04] in a few moments when she's able to but
[30:07] that would allow us to move on to uh the
[30:09] other people who wish to speak to that
[30:11] is that all right with you mr hilson oh
[30:13] yes that's fine in fact uh i think it's
[30:15] important for the council to know not
[30:18] necessarily for me to know
[30:20] absolutely thank you very much
[30:22] with that i will move on to
[30:25] adam clerk is it mr kowalski this next
[30:31] yes
[30:38] welcome mr kowalski
[30:40] hello i hope you can hear me we can if i
[30:43] get you to state your full name and
[30:44] address and then tell us your thoughts
[30:46] on this project
[30:47] uh gord kowalski
[30:49] exchange street odessa
[30:52] okay
[30:54] i have a few comments uh
[30:57] the first one i want to start out with
[30:59] is the uh notice of the public meeting
[31:01] this one here
[31:02] i noticed on the township website there
[31:05] that uh the bath meetings are all
[31:08] published on the township website and
[31:10] this meeting
[31:12] you know it just isn't published and it
[31:14] kind of you know give back in the
[31:17] enhanced notice and uh
[31:19] you know it
[31:21] more public participation might be uh
[31:24] be held if this was a this was published
[31:27] along with the other meetings that's one
[31:30] thing
[31:31] i'm one of my comments if you under
[31:34] and i do understand i'm not sure that
[31:38] i would like our staff to comment on the
[31:41] uh the publication and the notifications
[31:43] uh but if you have another question
[31:45] we'll take that and then i'll all go to
[31:47] staff
[31:49] well i'm i i'm sure that that the
[31:51] regulations are met on this except uh
[31:54] the pub
[31:55] by not having this meeting publicized on
[31:58] the website there it's
[32:01] you don't get the participation so
[32:03] that's that's what i'm getting at
[32:05] okay
[32:07] my next question is is uh the allocation
[32:10] of sewer
[32:12] uh
[32:13] originally when this
[32:15] plan started out that was 2007 that uh
[32:18] they allocated 23 units of sewer
[32:22] and that
[32:23] there's a plan of a subdivision that
[32:25] went through well it didn't go through
[32:27] it got
[32:29] struck down and then it went to appeal
[32:32] the appeal was withdrawn in 2012.
[32:36] so for four years until 216
[32:39] there must be another extension in there
[32:41] and then
[32:42] there wasn't a lot
[32:44] there there were it was there was an
[32:46] allocation to uh another 13 units to
[32:49] make it 36.
[32:51] so we've had 218 in extension 219 an
[32:55] extension
[32:56] now we're coming to
[32:59] another extension how many extensions
[33:00] are we going to have and what's that
[33:02] going to do to set precedence for other
[33:04] developments is my question
[33:06] okay
[33:07] with that i will go to our director
[33:11] and madame are you able to answer the
[33:13] questions with regard to a the
[33:15] publication and notification for this
[33:17] meeting and b the sewage allocation
[33:24] unfortunately miss mary you're muted
[33:25] right now
[33:28] okay
[33:29] through you you worship uh i can
[33:31] definitely answer the sewer allocation
[33:33] uh question and miss furnace will have
[33:35] to uh to speak to the publication uh
[33:39] that was done for this uh for this
[33:41] application
[33:42] uh again at this time we're still doing
[33:44] a technical review for for this um
[33:48] for this development so uh as far as the
[33:52] number of units allocated for this
[33:54] development
[33:55] as you are aware we
[33:58] review our uncommitted reserve capacity
[34:00] on a yearly basis based on
[34:03] flows that reach our sewage treatment
[34:06] facility
[34:07] and
[34:08] this development has certainly been on
[34:09] our books for quite a few years
[34:12] and
[34:14] when we came to council asking for an
[34:17] extension
[34:19] you know the 36 units are being carried
[34:22] uh in our uncommitted reserve capacity
[34:25] so the plant is
[34:27] uh able to um handle the additional
[34:30] units
[34:32] okay thank you
[34:34] and miss furnace if you're available
[34:36] would you be able to speak to the
[34:38] notification process
[34:42] yes through through you mr mayor um in
[34:44] terms of the township's website it
[34:46] should have been posted on there if it
[34:48] we'd have to go back in and check to see
[34:50] what may have happened there if he's
[34:51] indicating that it that it hasn't been
[34:53] um so if that's the case then there
[34:55] could have been a potential oversight in
[34:57] that but i can confirm all additional
[35:00] posting requirements were met there's
[35:01] signage posted on the on the site um
[35:04] notice was mailed to all property owners
[35:05] within 120 meters of the site as well
[35:08] um and i'm going forward there's um
[35:12] there'll be an obviously this is just a
[35:14] public meeting so there'll be further
[35:15] meetings to this brought forward in
[35:17] council with an additional notice um and
[35:19] so we can definitely ensure that
[35:22] that it's included on the website
[35:24] thank you
[35:26] mr kowalski you've heard the answers do
[35:29] you have any further comment
[35:31] uh
[35:32] well i can go on about the drainage now
[35:35] go ahead
[35:37] back in
[35:38] i don't know 1991 as a public meeting
[35:41] and they're doing the odessa uh public
[35:43] housing stuff there
[35:45] and the property where the seniors uh
[35:48] residence is now
[35:50] uh there's concerns if they put the fill
[35:52] in there that was gonna cause problems
[35:54] with the drainage on shane street
[35:57] and uh that was brought up in the public
[35:59] meeting in 91
[36:01] came on 93 or 94 there's another public
[36:05] meeting and
[36:06] they waived the uh
[36:08] the water studies in the soil testing in
[36:12] a scramble to get the uh public funding
[36:14] and after that the next year after that
[36:17] we had a year and we had problems there
[36:20] so uh
[36:22] you know things happened uh
[36:25] there there were petitions to the to the
[36:28] earnest downtown council i guess back
[36:31] then and
[36:32] delegations and stuff and they ended up
[36:35] uh in improving the ditches on the north
[36:38] side of shane street and putting the
[36:41] fill in the backyards but we still
[36:43] haven't
[36:44] i guess i read in the port uh under
[36:46] functioning ditch on the on the north
[36:49] side
[36:50] we've uh
[36:51] now spent money in the last couple years
[36:53] improving uh the south side ditch
[36:56] so that's tax money spent there and uh
[36:59] i'm really concerned what's going to
[37:00] happen here and we've already spent what
[37:02] spent our tax dollars done on these
[37:04] improvements and it's natural drainage
[37:07] going down through there so i'm i'm not
[37:08] really too sure what's going to happen
[37:10] here i'm i'm concerned
[37:13] thank you ms merritt do you have comment
[37:15] with regard to the drainage
[37:18] again three year worship we're still
[37:19] doing this is only for an op not only
[37:22] this is for an opm admin and a reasoning
[37:24] amendment
[37:25] uh and
[37:27] we're still going through the detailed
[37:28] design
[37:29] uh we are aware that drainage is uh is a
[37:32] concern
[37:33] and we are um
[37:35] definitely
[37:36] uh paying close attention to that part
[37:38] of the design
[37:41] thank you mr kowalski just from my own
[37:43] perspective i can't speak to what
[37:45] happened in the 90s uh that was
[37:47] definitely before i came on council
[37:50] but
[37:51] i assure you that when we were reviewing
[37:53] this a few years ago
[37:55] drainage was brought very much to the
[37:57] forefront as a concern for that region
[38:00] and
[38:01] will continue to be something that we
[38:03] work to ensure as best as we possibly
[38:06] can as this moves forward
[38:08] yeah well i assumed that you know about
[38:10] the drainage because i read another
[38:12] report there the
[38:14] the property behind the council there
[38:16] has a stream and it's it's and stuff
[38:18] running through and it's unsuitable to
[38:20] put a new county a new
[38:23] public building on so i don't know i'm
[38:25] just really concerned
[38:27] i appreciate that
[38:30] council do we have any questions for mr
[38:32] kowalski
[38:35] i'm seeing no questions
[38:37] right i'll say thank you very much for
[38:39] your input mr kowalski we will continue
[38:41] to to move forward
[38:43] i believe uh madam clerk i believe the
[38:46] next up is mr peacock
[38:49] i'm allowed to
[38:51] speak i believe
[38:53] mr pika can you hear us
[38:56] hi am i muted
[38:59] we can hear you yes go ahead sir give us
[39:01] your full name and address please
[39:04] uh this is nathan peacock but uh rebecca
[39:06] brown lives with me as well
[39:08] at uh 311 main street
[39:10] um and she'll be speaking on my behalf
[39:13] it's just i have logged in on my tablet
[39:15] she's here with me
[39:17] fair enough and madam if you would give
[39:20] us your name and address then please
[39:22] uh my name is rebecca brown i live at
[39:24] 311 main street um i wrote some comments
[39:27] let me the agenda but i'm not sure if
[39:29] you're going to read those comments or
[39:31] not i just have some very concerning
[39:33] questions i'd like to ask miss tucker
[39:35] myself
[39:36] well if you could uh
[39:38] yeah tell us your questions and and
[39:40] we'll see what we can do for a response
[39:42] thank you
[39:44] um
[39:46] so i live at 311 main street which is a
[39:48] known um
[39:50] i guess watering hole of
[39:52] odessa
[39:53] um i was just wondering if um ibi group
[39:57] had an evaluation
[39:58] by career callaway group sorry if i say
[40:01] that wrong
[40:02] and it was commented during this
[40:05] [Music]
[40:07] this evaluation that it was not a four
[40:09] season water level that they only did
[40:11] the spring melt
[40:12] um there's an approximization
[40:15] uh completed and no allocations of where
[40:18] they actually took this data i find this
[40:21] concerning because the spring melt is
[40:23] not my highest water level of the year
[40:26] um i was just wondering
[40:28] why they thought that was sufficient
[40:29] because in previous meetings i have in
[40:32] fact sent
[40:33] council
[40:34] pictures of water levels in november
[40:37] which happened to be up to my waistline
[40:39] in my own basement i was just wondering
[40:42] if that fourth season was going to be
[40:44] completed and if council was aware of
[40:46] that
[40:48] thank you
[40:50] i will go to ms tucker for a response
[40:53] with regard to the studies that have
[40:54] been done
[41:02] miss tucker you muted right now
[41:04] sorry
[41:06] thank you miss brand so we did the
[41:08] studies as were required by the
[41:10] municipality and we have gone back and
[41:12] forth now several times
[41:14] with staff with the conservation
[41:16] authority as well as
[41:19] the peer reviewers on what was required
[41:21] and what we needed to do to move forward
[41:23] with this project
[41:25] um
[41:26] should the city or the municipality
[41:28] require a four season study that can be
[41:30] implemented as a draft plan condition
[41:32] that we would have be required to
[41:35] fulfill as part of the subdivision
[41:37] agreement
[41:40] so that it's not we weren't required to
[41:42] it these comments we've received have
[41:44] not said we need to do the four season
[41:46] study
[41:47] and that's part of why we have not
[41:49] proceeded with it at this point
[41:51] thank you
[41:53] i'll go to ms merritt did you have any
[41:55] comment with regard to the studies
[42:02] you may have lost oh there she is
[42:06] taking a little bit longer to
[42:08] turn this on um i don't have a further
[42:12] comment on this your worship uh again
[42:15] the technical review is not there yet
[42:18] this is just a public this is a public
[42:19] meeting for us to gather comments and
[42:22] when we come back to council with a
[42:23] report
[42:24] we will provide some answers
[42:27] thank you very much
[42:29] council do we have any questions for
[42:31] this uh delegate
[42:37] and i'm seeing none
[42:39] all right
[42:40] thank you very much for you for your
[42:41] comments did you have anything further
[42:43] to add then
[42:45] uh just one comment all those uh
[42:47] um all the comments were added to the
[42:50] agenda are you going to
[42:52] review them and get back to those
[42:55] people
[42:56] and
[42:57] council has all of these comments before
[42:59] us and the the commitment from this
[43:02] public meeting is that the comments will
[43:04] be addressed by our staff prior to
[43:07] any bylaw coming forward to council and
[43:09] i see ms merritt
[43:10] nodding then i got the process right
[43:14] and
[43:15] so yes the comments will be responded to
[43:18] uh into each of them
[43:21] thank you
[43:22] okay perfect thank you
[43:24] thank you is there anyone else in the
[43:27] audience who wishes to speak on the
[43:29] issue of 315 main street odessa
[43:35] and again i will ask if you
[43:37] are interested in speaking to it you use
[43:39] the raise hand feature
[43:45] madam clerk are you seeing anyone i'm
[43:47] not right now
[43:49] i'm not your worship
[43:52] nope oh mr
[43:55] kalowski
[43:59] mr kowalski
[44:01] and
[44:02] we typically only allows people to speak
[44:04] once but mr kowalski if you have a quick
[44:06] question i will
[44:08] allow it
[44:13] and we can't hear you yet you're still
[44:15] muted
[44:20] uh i just had a quick conversation with
[44:24] one of my neighbors today and they have
[44:26] a four generation
[44:28] farm there that
[44:30] they've been working on and they're
[44:32] quite concerned about this development
[44:33] and uh they're just very con just very
[44:36] very concerned about the green factor
[44:39] and the climate change aspects and what
[44:41] and how it would affect them that's
[44:43] that's about what i have to say about
[44:46] thanks
[44:47] greatly appreciate it and and if you
[44:49] could get them to put it send in their
[44:51] comments uh in writing or or phone the
[44:54] the office to provide those comments we
[44:56] can include those in the comments that
[44:58] will be addressed
[44:59] as this report moves further
[45:02] okay thank you mr kowalski
[45:09] any anyone else
[45:16] madam clerk are you seeing anyone
[45:24] yes your worship uh ann mcintosh i'll
[45:27] just allow to speak
[45:29] miss mcintosh i believe you come into
[45:31] the at the front
[45:33] if you can unmute can you tell us your
[45:35] name and address and then give us your
[45:37] thoughts on this please
[45:38] uh well my concern can you hear me we
[45:41] can hear you yes okay great i've never
[45:44] done this before so have an amateur at
[45:45] this
[45:46] um
[45:47] we're all learning
[45:50] okay well i'm not a property owner i'm a
[45:52] resident in the seniors resident around
[45:55] the corner
[45:56] and my concerns are
[45:59] um
[46:00] largely environmental and quality of
[46:02] life like i know mr klosky mentioned
[46:05] somebody who
[46:07] was concerned because they were a
[46:08] four-generation farmer
[46:10] um
[46:12] the thing is that once this starts
[46:15] the quality of life of the people who
[46:18] have lived here for generations
[46:20] and the people who have come here
[46:22] because this is what we like
[46:24] once again
[46:27] our quality of life is just being
[46:28] disregarded so that somebody can build a
[46:31] development
[46:32] like this is a rural area and it's quiet
[46:35] and it's the air is clean and we
[46:37] hear birds and trees and wind and we get
[46:40] the smell of the hay and the grass
[46:43] we get to look at the world the way it
[46:44] was supposed to be
[46:46] and it seems like for myself every time
[46:49] i found a place like this to live
[46:52] after a few years i've got to pull up
[46:54] and leave because well here comes the
[46:56] developer it's all gone again
[46:59] and
[47:00] all this
[47:02] discussion that's going on now in the
[47:03] world about global warming and climate
[47:06] change and so on this is relevant
[47:08] because every time you destroy something
[47:09] like this chop down trees pave over
[47:12] grass
[47:14] that's part of the world that's not
[47:15] getting cleaned again and you can't go
[47:17] back once you've dug it dug it up paved
[47:19] it over and built on it it's gone
[47:21] forever and ever you'll never get it
[47:23] back
[47:25] um if we're gonna try to do anything
[47:27] about preserving the world for
[47:29] people's children and grandchildren
[47:31] great-grandchildren i don't have any but
[47:33] probably most of you do
[47:36] it takes all of us and we have to start
[47:38] somewhere there's all the little people
[47:40] like us
[47:42] all working together that maybe can turn
[47:44] the tide and
[47:47] get the world back to where it's
[47:48] supposed to be
[47:49] there's social problems that come
[47:51] because people can't get away from each
[47:53] other because
[47:55] there's no place that they can go to
[47:57] stop trying to move at the speed of
[47:58] light and of the speed of light and go
[48:01] back to remembering that they're people
[48:02] but not machines
[48:04] you go out you walk in the woods you
[48:05] walk in the fields you listen to the
[48:07] birds you look around you
[48:09] and the stresses of the world disappear
[48:12] where do we go
[48:14] what do we do
[48:15] when that's gone
[48:16] and once you've done this
[48:18] that's the beginning somebody else comes
[48:21] in behind these guys who wants to
[48:22] develop something else before you don't
[48:24] work case them then before you know it
[48:26] we're toronto
[48:28] that's my concerns i mean i'll be dead
[48:29] and buried by the time that happens but
[48:32] in the meantime i'm going to lose
[48:34] something that
[48:35] means a great deal to me because
[48:37] i won't be able to enjoy this anymore
[48:39] either anyway that's my concerns
[48:42] and
[48:43] that's all i had to say about it and i
[48:45] appreciate you bringing it forward ms
[48:46] mcintosh thank you council do we have
[48:49] any questions from his macintosh
[48:53] and i'm seeing none i'll say thank you
[48:55] very much miss mcintosh and uh and say
[48:58] your comments will be added into the uh
[49:00] the report and addressed by staff
[49:05] is there anyone else who wishes to
[49:06] address the public meeting regarding 315
[49:09] main street odessa
[49:16] have mr cunningham i believe
[49:19] mr cunningham
[49:21] i think you were interested in the bath
[49:24] project not the odessa project but uh if
[49:27] you wish to comment on the the odessa
[49:29] project
[49:32] mr cunningham can you hear me
[49:36] see you in if you could unmute
[49:40] i can hear you i'm just going to wait
[49:42] till uh the bath
[49:43] the next next item
[49:45] okay thank you thank you and we'll call
[49:48] you in at that time great thanks thank
[49:52] is there anyone else with regard to
[49:55] the 315 main street odessa project
[49:59] application
[50:03] i see hands up from the same people that
[50:05] have already spoken to us
[50:07] again traditionally this is one person
[50:09] gets one shot at this is there anyone
[50:12] new
[50:17] i'm seeing no one knew
[50:21] mr cunningham still has his hand up but
[50:23] i'm again that that's for the next one
[50:25] we have mr peacock oh miss tucker do you
[50:29] have the numbers yeah i have the numbers
[50:31] and i also have an update on the four
[50:33] season hydrogeological study
[50:35] thank you go ahead so the swim pond has
[50:38] 308
[50:40] uh cubic meters of storage
[50:43] at the parking lot has
[50:46] about 130 cubic meters of storage
[50:49] for a total of 309 sorry 77 cubic meters
[50:53] of storage for a total of 395 cubic
[50:56] meters of storage on site
[50:59] based on the current flows today we are
[51:01] actually only required to have 131 cubic
[51:05] meters so we have
[51:06] close to three times the amount of
[51:08] storage that we need on site
[51:11] and with respect to the four season
[51:13] hydro geological in our second
[51:16] submission we did submit the four season
[51:18] hydrogeological for the
[51:20] site okay so it has been submitted is
[51:23] that a public document
[51:28] should be because it is part of the
[51:30] application
[51:31] this furnace
[51:34] yes through you mr mayor they're all
[51:36] public documents so if any member of
[51:38] council or any public member um wishes
[51:40] to receive copies of them they can
[51:42] definitely reach out to the playing
[51:43] division and we can provide those
[51:45] okay thank you very much
[51:48] with that
[51:50] again i'll come back to counsel any
[51:52] questions for miss tucker or staff
[51:56] seeing none
[51:58] i see mr peacock's hand is still up and
[52:01] i believe that's and i'll be honest i've
[52:03] forgotten the uh
[52:05] the lady who was speaking i will ask the
[52:07] clerk to bring her in very briefly
[52:10] for a follow-up comment and then we'll
[52:12] call this bring this to a close
[52:16] yes
[52:17] it's actually nathan is speaking this
[52:19] time uh it and it's more of a
[52:22] comment than a question
[52:23] um i know
[52:25] that there are at least two landowners
[52:27] adjacent to this property that have had
[52:29] difficulties with trying to get on the
[52:31] council
[52:32] trying to get onto the zoom meetings the
[52:34] technology what have you
[52:36] um
[52:37] i just
[52:38] i know that uh
[52:41] they would like to be here um but
[52:42] they're having
[52:43] some technical issues so i've received
[52:45] some messages from them that's all i
[52:47] just wanted to uh
[52:49] get that information
[52:51] through that's that's all i have
[52:53] thank you very much again i would ask
[52:55] anyone who wishes to make comment with
[52:57] regard to this application
[52:59] to uh the best way would be to provide
[53:01] it by email if that's possible provided
[53:04] in writing at the township office uh or
[53:07] at the very least phone the township
[53:09] office and provide comments that way and
[53:11] all comments will be addressed prior to
[53:14] this coming back to council or as this
[53:17] comes back to council
[53:18] before any decision is made
[53:23] with that i will say last call for
[53:27] the public meeting for 315 main street
[53:32] okay
[53:35] and we do have a recommendation
[53:38] right
[53:40] for the recommendation is that this be
[53:42] brought forward to council once the
[53:43] comments from the departments the
[53:45] agencies and the public have been
[53:46] addressed
[53:47] that the units of capacity previously
[53:50] allocated within the water and
[53:52] loyalistic sewage systems for the
[53:53] development of consent
[53:55] be extended to june 30th to allow for
[53:58] the comments to be addressed and the
[54:00] draft plan of subdivision to be granted
[54:02] and if the effective property receiving
[54:05] allocation has not obtained draft plan
[54:07] approval by june 30th then this
[54:09] allocation would be made available to
[54:11] other properties that is the
[54:12] recommendation before us council
[54:15] council do you have any questions with
[54:17] regard to the recommendations
[54:21] and i'm seeing no hands
[54:23] then i will ask if there's someone
[54:25] willing to make a motion
[54:35] counsel
[54:37] are we going to make promotion either on
[54:39] the recommendation or another motion
[54:46] anyone
[54:48] i'll go to the deputy thank you
[54:53] move to receive and adopt the
[54:54] recommendations
[54:56] to receive and adopt the recommendations
[54:58] do i have a seconder for that
[55:02] counselor parks the seconding thank you
[55:04] deputy any comment just very briefly um
[55:09] this motion is uh strictly for basically
[55:11] receiving the information that we've got
[55:13] tonight plus what will still come in
[55:15] so that it can be considered um during
[55:18] the review
[55:19] so um that's why
[55:21] it's this motion is needed to be able to
[55:23] be able to take all the comments and
[55:25] concerns and address them appropriately
[55:28] thank you secondary comment
[55:30] uh just to echo what the deputy had said
[55:33] yes this is just really to get all the
[55:35] information back before council so that
[55:37] a proper decision can be made so
[55:39] that's why i seconded the motion
[55:40] thank you
[55:42] anyone else wish to comment
[55:47] i'm seeing no further comments
[55:50] then i will call the question
[55:52] all those in favor please raise a hand
[55:56] any opposed
[55:58] motion is carried thank you and that
[56:00] brings us to the end of the public
[56:02] meeting for 315 main street
[56:05] we now move on to the public meeting
[56:07] regarding 496 main street bath
[56:11] and i turn to our director
[56:16] to introduce
[56:17] this oh before before i go to the
[56:20] director kelsey parks did you have
[56:21] something
[56:22] i just wanted to mention to the clerk
[56:24] that i did receive an email from mr hood
[56:27] jason as well as dave salter that they
[56:29] are trying to join the public meeting
[56:31] later on
[56:32] i just want to make sure she was aware
[56:33] of that yes thank you
[56:35] okay thank you
[56:38] ms merritt you would like to introduce
[56:39] this public meeting
[56:42] uh through
[56:43] uh yes so staff uh we don't have
[56:46] anything further to add to the report
[56:48] that's on the agenda but i believe the
[56:50] um
[56:51] the uh applicants consultant is here to
[56:55] uh make a presentation as well
[56:58] the applicant's consultant here to make
[57:00] a presentation do we know the name
[57:03] is that ms gilchrist yes
[57:06] and then as us
[57:08] staff to allow ms gilchrist to present
[57:11] believe them skillchrist is here and
[57:14] this
[57:15] is stuke stuck i'm not sure how to
[57:17] pronounce that
[57:19] hi i'm three mr chair it's uh miss
[57:21] stookie
[57:22] miss dookie welcome all right you're
[57:24] here to present on this application
[57:27] yes yes
[57:28] um council and
[57:31] mayor my name is emma stuki i'm a
[57:33] planner at ibi group while i'm set up to
[57:36] share my screen to start the
[57:38] presentation please go ahead
[57:44] is everyone able to see the slides
[57:47] not quite yet
[57:50] i'm seeing black screen right now other
[57:52] members of council
[57:58] anyone
[58:00] just showing black screen your worship
[58:05] something's not working properly
[58:07] okay here i'll stop and try again
[58:21] and
[58:22] i'm still getting black screen
[58:26] it says that you're sharing the screen
[58:27] but i'm not seeing any screens
[58:31] it does say double click to enter full
[58:32] screen mode that may be
[58:35] that it's off if you've got two screens
[58:36] it may be off on your other screen and
[58:38] just not showing up on the screen yet
[58:41] i'm still seeing black screen council
[58:43] the rest of council are you able to see
[58:45] the presentation
[58:47] i'm seeing heads shaking no no
[58:51] okay i'll try
[58:56] try one more time
[58:58] third time's the charm third time's the
[59:00] term
[59:12] and i'm not sure what's going on but i'm
[59:14] still getting black screen
[59:16] black screen
[59:17] um is it possible i did share the
[59:19] presentation via email to um miss
[59:22] furnace and mr casemore today
[59:24] is it possible for someone else to maybe
[59:27] pull up the slide um
[59:29] i'm not sure what's going on on my end
[59:32] okay if you could uh stop sharing for us
[59:34] so that we can come back to regular view
[59:36] i will turn to miss furnace
[59:39] do you have that presentation and are
[59:41] you able to pre to show it
[59:44] your worship i believe we have a pdf of
[59:46] it uh that i can put up on the screen
[59:49] now and they'll just have to let me know
[59:50] when to change
[59:52] and
[59:53] okay please do so
[1:00:02] okay i'm now seeing a uh a presentation
[1:00:05] on 496 main street bath council are you
[1:00:08] seeing the same
[1:00:10] i'm seeing nods so i'm hoping that the
[1:00:12] public can see this as well and with
[1:00:14] that ms stookie if you would like to uh
[1:00:17] go ahead and when you need the slide to
[1:00:19] change you can address that to the clerk
[1:00:22] great thank you thanks for your help
[1:00:24] with the technical difficulties so again
[1:00:26] my name is emma stuki i'm a planner at
[1:00:27] ibi group and we're the consultant
[1:00:30] planners for our y legacy contractor um
[1:00:32] so today we're here to discuss the
[1:00:34] applications for draft plan of
[1:00:36] subdivision for the property at 496 main
[1:00:39] street and bath
[1:00:40] so the purpose of the application is a
[1:00:42] draft plan of subdivision to create 10
[1:00:44] new residential blocks with 9 70
[1:00:46] detached blocks with 18 units and one 10
[1:00:49] s block with four units for a total of
[1:00:51] 22 units an official plan amendment is
[1:00:54] requested to change the designation from
[1:00:56] commercial to medium density residential
[1:00:58] this is required in order to permit
[1:01:01] townhouses and semi-detached dwellings
[1:01:03] on the subject lands
[1:01:04] and then a zoning bylaw amendment
[1:01:06] application is proposed in order to
[1:01:08] implement the proposed draft plan of
[1:01:10] subdivision and change the zone from a
[1:01:12] commercial zone to a residential zone
[1:01:15] next slide please
[1:01:17] so here's an image of the subject
[1:01:19] property which shows the surrounding
[1:01:20] fabric and location of the property
[1:01:23] in the village of bath
[1:01:26] next line please
[1:01:27] the area context to the north is bath
[1:01:30] creek loyalist golf and country club and
[1:01:32] low density residential development to
[1:01:34] the east is the village of bath various
[1:01:36] commercial uses low density residential
[1:01:38] uses the south
[1:01:40] and properties along main street bath
[1:01:42] low density residential uses in lake
[1:01:44] ontario
[1:01:45] west is
[1:01:46] low density residential uses country
[1:01:48] club drive and lands designated for
[1:01:51] aggregate
[1:01:52] at an extraction
[1:01:54] um so in the area context those of you
[1:01:57] familiar with bath primarily single
[1:01:58] detached homes one to two stories range
[1:02:01] of construction dates and range of
[1:02:02] architectural styles
[1:02:04] next slide please
[1:02:07] and the site has an area of 1.2 hectares
[1:02:09] with 93 meters of frontage on main
[1:02:11] street there's an existing commercial
[1:02:13] building on the site there's a u-shaped
[1:02:15] driveway with two entrances to main
[1:02:17] street the land is cleared and grassy
[1:02:19] and bath creek runs along the north of
[1:02:21] the property
[1:02:23] next slide please
[1:02:25] um so from these pictures we can see the
[1:02:27] view of the property from east to west
[1:02:29] and the existing conditions along the
[1:02:31] property
[1:02:32] lines next slide please
[1:02:35] um so again here's the proposed concept
[1:02:38] plan i'm proposing semi-detached
[1:02:40] residential blocks with 18 semi-detached
[1:02:44] units and four townhouse units all
[1:02:47] around cul-de-sac
[1:02:49] with an open space area
[1:02:52] at the rear of the property which will
[1:02:54] be designated to the township for
[1:02:56] conservation
[1:02:57] next slide please
[1:03:01] um so
[1:03:05] during the pre-consultation meeting with
[1:03:06] the township we had certain design
[1:03:08] considerations established to help guide
[1:03:11] the development of this subdivision
[1:03:13] including providing a mix of housing
[1:03:15] types being set back from the flood
[1:03:17] plain
[1:03:19] that's bath creek minimizing the number
[1:03:21] of entrances to main street providing a
[1:03:23] minimum of two parking spaces per unit
[1:03:26] next slide please
[1:03:28] the proposed development will be
[1:03:30] serviced by municipal water and sanitary
[1:03:32] services servicing will be confirmed as
[1:03:35] a condition of draft approval um block
[1:03:37] 11 which includes the lands along black
[1:03:39] creek and the flood plain is a natural
[1:03:41] open space block which will be dedicated
[1:03:43] to loyalist township for conservation
[1:03:46] and this dedication
[1:03:48] will occur in consultation with the
[1:03:50] conservation authority
[1:03:53] the owner will also be required to
[1:03:55] provide cash in lieu of parkland
[1:03:57] access to the site is a 18 meter wide
[1:04:00] public cul-de-sac connecting to main
[1:04:02] street and individual driveways are
[1:04:03] proposed for the four townhouse units
[1:04:07] next slide please
[1:04:09] here's an example built form
[1:04:11] renderings shown are
[1:04:13] conceptual at this point but show two to
[1:04:16] two and a half story buildings two to
[1:04:18] three bedroom units owner intends to
[1:04:20] build a high quality product based on
[1:04:22] feedback from the
[1:04:24] virtual open house took it back to the
[1:04:26] owner that had more traditional colonial
[1:04:28] design is preferred for the area
[1:04:31] buyers will be choosing floor plans and
[1:04:33] landscaping will be required
[1:04:35] next slide please
[1:04:38] and so in terms of going to the policy
[1:04:41] context so the proposed development
[1:04:43] is consistent with the intent of the
[1:04:45] provincial policy statement as it
[1:04:46] redevelopment redevelops and
[1:04:48] underutilized site in an area intended
[1:04:50] for development it's within the urban
[1:04:52] growth groundry efficiently uses land
[1:04:54] and resources does not result in the
[1:04:56] uneconomic extension of services
[1:04:59] the proposed residential use is
[1:05:01] compatible with the adjacent residential
[1:05:03] uses and no public health and safety
[1:05:05] issues are anticipated as the
[1:05:07] development setback
[1:05:08] far enough from box creek
[1:05:11] next slide please
[1:05:14] and here is an image of the current
[1:05:16] official plan designation so the
[1:05:19] existing designation is for commercial
[1:05:20] land uses and medium density residential
[1:05:24] is proposed the medium density
[1:05:26] residential is proposed in order to
[1:05:28] permit the townhouse use
[1:05:31] um we note that the proposed density is
[1:05:33] actually low density it's less than 31
[1:05:36] units per net hectare which is what's
[1:05:38] identified in the
[1:05:40] township's official plan
[1:05:42] as the threshold there so
[1:05:44] seeking to go into the medium density
[1:05:46] residential designation to permit the
[1:05:49] townhouse built form
[1:05:51] next slide please
[1:05:55] so residential uses on the subject lands
[1:05:58] are appropriately located it's within
[1:06:00] the settlement area of bath
[1:06:02] in an area that's within walking
[1:06:03] distance of parkland community
[1:06:05] facilities commercial uses
[1:06:07] it's compatible with adjacent uses the
[1:06:09] proposed residential use is more
[1:06:10] compatible with adjacent residential
[1:06:13] properties compared to a commercial use
[1:06:16] it meets the functional needs of site
[1:06:17] users parking and amenity space are
[1:06:19] provided on the site consistent with the
[1:06:21] township standards
[1:06:23] helps to achieve intensification targets
[1:06:26] supports residential intensification in
[1:06:28] the settlement area of bath and complies
[1:06:30] with division of land policies
[1:06:32] so engineering studies have been
[1:06:34] submitted which demonstrate that the
[1:06:35] development of the subject lands
[1:06:38] is orderly and logical meaning that
[1:06:40] servicing can be provided traffic can be
[1:06:43] accommodated and storm water management
[1:06:46] can be managed as well
[1:06:48] next slide please
[1:06:51] so the existing zoning is a commercial
[1:06:53] c2 zone and we're proposing to place
[1:06:57] the lands into residential zones and it
[1:07:00] will be a
[1:07:01] residential type 4 zone for the
[1:07:03] semi-detached dwellings and a
[1:07:05] residential
[1:07:07] type 5 zone for the townhouse units and
[1:07:10] we note that site-specific performance
[1:07:12] standards are proposed throughout to be
[1:07:14] able to implement the development as
[1:07:16] shown
[1:07:18] next slide please
[1:07:21] um so we have heard comments so far and
[1:07:23] we did host a virtual open house
[1:07:27] solicit feedback from the public and
[1:07:29] have a discussion about the proposed
[1:07:31] development
[1:07:32] we heard concerns with compatibility and
[1:07:34] scale concerns with potential traffic
[1:07:36] impact and access
[1:07:38] concerns with availability of water and
[1:07:39] waste water services concerns about the
[1:07:42] safety of the open space block in
[1:07:43] parkland and concerns with flooding and
[1:07:46] storm water management
[1:07:48] next slide please
[1:07:51] some concerns related to compatibility
[1:07:53] and heritage concerns about the density
[1:07:56] and the size of the lots
[1:07:58] compatibility specifically with the
[1:08:00] heritage character of bath preference
[1:08:02] for fewer single detached homes and need
[1:08:05] for greater setbacks and separation
[1:08:08] so we do note that we have heard all of
[1:08:10] these comments and taken them back to
[1:08:12] the developer
[1:08:13] and are awaiting township comments
[1:08:15] before
[1:08:17] making changes to the design
[1:08:20] but to summarize the
[1:08:22] proposed density is is considered low
[1:08:24] density in the official plan
[1:08:26] and the lot sizes and setbacks are
[1:08:28] consistent with modern construction
[1:08:30] standards again we note that
[1:08:32] pending township comments these can be
[1:08:36] reviewed final layout and building
[1:08:38] locations will be refined through this
[1:08:40] process
[1:08:41] and the buildings will comply with the
[1:08:43] maximum height of at 10 meters outlined
[1:08:46] in the zoning bylaw
[1:08:47] and
[1:08:48] supports
[1:08:49] the addition of semi-detached and
[1:08:52] townhouse dwellings on this site
[1:08:53] supports providing a range of mix and
[1:08:56] housing types in bath
[1:08:58] from a land use perspective supports
[1:09:02] the efficient use of land and settlement
[1:09:04] areas making use of existing services
[1:09:07] and
[1:09:08] the proposed built form is compatible
[1:09:10] with adjacent residential uses in terms
[1:09:12] of scale and bill form
[1:09:14] next slide please
[1:09:16] and so open space heard the concerns
[1:09:19] here that need for planning and
[1:09:20] landscape concerns with the safety of
[1:09:21] block 11 for parkland and concerned with
[1:09:24] access to open space for residents we
[1:09:26] know that landscaping will be required
[1:09:28] um the intention is to preserve trees
[1:09:30] wherever possible block 11 will be
[1:09:33] dedicated as open space for conservation
[1:09:35] use and it's not intended to be a park
[1:09:37] space or a public park space um it's
[1:09:40] intended to let the
[1:09:42] flood plane function um along the creek
[1:09:45] and cache and live with parkland will be
[1:09:47] provided to the township
[1:09:49] next slide please
[1:09:52] traffic access heard concerns about
[1:09:53] traffic frequency concerns with the
[1:09:55] amount of parking need for visitor
[1:09:56] parking concerns with entrances on the
[1:09:59] main street ability for trucks to turn
[1:10:00] around and the need for sidewalks so
[1:10:03] according to the traffic impact study
[1:10:06] forecasted traffic levels are
[1:10:07] anticipated to have negligible impact on
[1:10:09] surrounding roads the cul-de-sac meets
[1:10:12] the minimum turn radius required for
[1:10:13] single-unit trucks the proposal will be
[1:10:15] reviewed by the fire department
[1:10:17] in the technical comments and the
[1:10:19] proposed development meets the minimum
[1:10:21] parking requirements for residential
[1:10:22] uses
[1:10:24] next slide please
[1:10:28] um engineering again concerns with water
[1:10:31] and wastewater servicing concerns about
[1:10:33] capacity to support the development and
[1:10:35] concerns about storm water management
[1:10:37] flooding and water quality and runoff
[1:10:40] so preliminary calculations show there
[1:10:42] is capacity to service the proposed
[1:10:43] development
[1:10:45] these reports are available
[1:10:47] and are being reviewed by the township
[1:10:49] as part of their technical review
[1:10:52] capacity will be confirmed by the
[1:10:53] township as a condition of draft
[1:10:55] approval
[1:10:56] the storm sewer services will be
[1:10:58] installed with a connection to main
[1:10:59] street storm sewers
[1:11:01] and there is going to be an oil grit
[1:11:02] separator installed to mitigate any
[1:11:04] adverse water quality effects and more
[1:11:06] details on these measures are available
[1:11:08] in the accompanying report
[1:11:11] next slide please
[1:11:14] um so in conclusion and based on this
[1:11:17] the proposed residential uses on the
[1:11:19] site are consistent with the intent of
[1:11:21] the pps
[1:11:22] conform to the official plan policies
[1:11:25] and are compatible with surrounding uses
[1:11:29] next slide please
[1:11:31] um so thank you we welcome questions and
[1:11:32] discussion
[1:11:35] thank you very much miss dukey
[1:11:37] uh council do we have any questions
[1:11:40] with regard to the presentation just
[1:11:42] made
[1:11:46] i'm seeing no questions
[1:11:48] so i will turn this to the public
[1:11:51] okay and again this is a public meeting
[1:11:54] council shall hear in person or by his
[1:11:57] or her counsel solicitor agent any
[1:11:59] person who came to be affected by this
[1:12:01] application
[1:12:03] at this time i'll turn to the clerk and
[1:12:05] ask her to identify
[1:12:07] people that are wishing to
[1:12:10] attend
[1:12:11] okay after your worship uh mr cunningham
[1:12:15] has been allowed to speak
[1:12:17] go ahead mr cunningham you'll have to
[1:12:18] unmute
[1:12:20] and again
[1:12:22] name and address and
[1:12:24] also comments please cunningham uh one
[1:12:27] country club
[1:12:28] drive and pass just 150 meters away from
[1:12:32] this proposed subdivision
[1:12:35] many of the concerns that i have got are
[1:12:38] are the building of what is going into
[1:12:40] this place because of what's beside this
[1:12:42] project
[1:12:43] is uh a home that was built in 1850
[1:12:47] a home across the street which was 1850
[1:12:50] and you start going down that street and
[1:12:52] that's
[1:12:53] you're almost going back into the 1800s
[1:12:55] i think this will exactly take away from
[1:12:58] the heritage bit of bath ontario it'll
[1:13:01] become a just another little place
[1:13:04] like behind like amherst view where
[1:13:07] you're going to have all these
[1:13:08] different kinds of things in there
[1:13:11] we should be trying to keep this
[1:13:14] as a certain
[1:13:16] certain plate thing i could see if they
[1:13:18] wanted to develop this to put this into
[1:13:21] colonial style homes or period type
[1:13:24] homes which can be built very easily by
[1:13:26] a builder and i did check this builder
[1:13:29] out he looks like he is a is a quality
[1:13:31] builder
[1:13:32] i think this is something i don't know
[1:13:34] anything about the water plane but i
[1:13:35] know i when i walk there
[1:13:37] i'm in the last meeting a lot of people
[1:13:39] had concerns about
[1:13:41] runoff that where's it going to go
[1:13:44] is it going to run into the into the
[1:13:46] bath creek that's there and we have a
[1:13:48] few pollution problems along there and
[1:13:50] another thing was that
[1:13:52] i could see that if they could take
[1:13:53] those four townhouses out and make that
[1:13:56] all parkland the people who have
[1:13:58] children in that area but have a place
[1:14:01] to play now there's no place for them to
[1:14:03] go you can't take a three-year-old down
[1:14:05] to the park all the time
[1:14:07] and also with those four
[1:14:09] four
[1:14:10] townhouses there that's four extra
[1:14:12] driveways on that bath road and right
[1:14:15] now i call that the bath road speedway
[1:14:20] you can't believe how fast the cars are
[1:14:23] going on that even the trucks coming
[1:14:25] from
[1:14:26] coming from the
[1:14:28] the parge today most of the trucks were
[1:14:31] doing 65 to 70 k's completing with the
[1:14:35] cars also all you need is one little
[1:14:37] child to go out there and boom and it's
[1:14:39] council's responsibility to make sure
[1:14:42] that that speed limit is down but also
[1:14:44] there's just too much congestion on a
[1:14:46] weekend
[1:14:47] with a subdivision we've got behind us
[1:14:49] now
[1:14:50] with only one exit
[1:14:53] there could be a possibly 200 cars there
[1:14:55] you think on the holiday weekend
[1:14:58] and someone trying to turn left
[1:15:00] will never get out let alone going down
[1:15:03] the street again you're going to have
[1:15:05] you're just going to have one big
[1:15:06] bottleneck
[1:15:07] so i just think that if they could get
[1:15:11] could go back to the drawing board and
[1:15:12] maybe do a uh
[1:15:14] a single family development in there
[1:15:17] with colonial style homes that would
[1:15:20] match what's going on through there
[1:15:22] that's what a legacy i'm sure i hope
[1:15:24] someone else is here that knows more
[1:15:25] about the land the land development so
[1:15:27] forth around there with the streams and
[1:15:29] so forth
[1:15:31] is there anybody else here or not
[1:15:33] that's all i have to say
[1:15:36] thank you mr cunningham
[1:15:38] council do we have any questions for mr
[1:15:40] cunningham
[1:15:43] [Music]
[1:15:45] i we take we will take note of your
[1:15:47] concerns and staff are taking notes uh
[1:15:50] to address those concerns
[1:15:52] in the uh report that will come back to
[1:15:54] council okay thank you
[1:15:56] thank you
[1:15:58] i turned to the clerk for the next
[1:16:00] attendee for the public meeting with
[1:16:02] regard to
[1:16:04] 496 main street bath
[1:16:06] uh mr hilson
[1:16:08] mr hilson
[1:16:10] and come on in
[1:16:14] go ahead mr nelson uh my first question
[1:16:17] would be is there any
[1:16:19] allowance for low-income housing in this
[1:16:23] development and i would ask the same
[1:16:25] question of the previous presentation
[1:16:29] will there be any public access along
[1:16:32] the creek
[1:16:35] for anyone who wants to walk along the
[1:16:37] creek
[1:16:40] is done in new zealand
[1:16:43] where all waterways
[1:16:45] lakes rivers ocean
[1:16:48] nobody can build
[1:16:50] and prevent people from walking along
[1:16:53] the shoreline of any of those water
[1:16:55] features i think that's a wonderful
[1:16:57] thing
[1:16:58] and i've been there so i know what it's
[1:17:00] like those are my questions thank you
[1:17:03] very much
[1:17:04] okay thank you we have those questions
[1:17:07] uh miss furnace or miss uh merritt
[1:17:11] are you able to answer the question with
[1:17:13] regard to public access on the
[1:17:15] waterway
[1:17:16] or would that be something that would
[1:17:18] come forward in the later report
[1:17:25] 3d worship i see miss furness is on so
[1:17:27] she may correct me
[1:17:28] uh but as far as the development that
[1:17:31] might be and i i'm not sure that they're
[1:17:33] still able to talk but that might be the
[1:17:36] consultants might be able to propose to
[1:17:38] uh discuss a little bit more of what
[1:17:40] they have
[1:17:41] uh proposed uh as far as
[1:17:44] access to the creek
[1:17:47] ms stookie are you able to respond to
[1:17:49] that
[1:17:51] three and mr chair
[1:17:53] and the
[1:17:55] the proposal does include the dedication
[1:17:58] of block 11
[1:17:59] for conservation and this has been done
[1:18:02] in consultation with the conservation
[1:18:04] authority
[1:18:05] and given that it is a flood plain there
[1:18:07] were some potential safety concerns
[1:18:10] brought up with access but
[1:18:13] the
[1:18:14] owner and developer would be open to
[1:18:16] working with the township and
[1:18:18] conservation authority as the land is
[1:18:21] intended to be dedicated to the township
[1:18:23] for conservation in consultation with
[1:18:25] them
[1:18:27] thank you
[1:18:28] and is anyone able to address the
[1:18:30] question with regard to
[1:18:32] low income housing
[1:18:37] through you the
[1:18:38] they're not designated affordable units
[1:18:41] proposed at this time but 70 detached
[1:18:43] and townhouse dwellings are typically
[1:18:45] more affordable or more attainable
[1:18:47] compared to
[1:18:49] um if singles were developed on the same
[1:18:51] lot um so um no formal partnership with
[1:18:55] affordable housing but the proposed form
[1:18:57] is considered to be a more attainable
[1:18:59] form of housing
[1:19:01] thank you
[1:19:02] again your comments mr hilson will be uh
[1:19:05] recorded and brought forward back in the
[1:19:07] in the report coming back to council
[1:19:10] do you have anything further mr hillson
[1:19:13] no thank you very much
[1:19:15] thank you
[1:19:16] council any questions
[1:19:19] then i'll go to the clerk
[1:19:21] do we have another attendee yes mr
[1:19:24] salter
[1:19:25] mr salter
[1:19:27] welcome mr salter if you could unmute
[1:19:30] can you hear me okay
[1:19:32] yes i have on music can you hear me yes
[1:19:34] we can hear you now do you give us your
[1:19:36] name and address and uh tell us your
[1:19:37] thoughts
[1:19:39] uh david salter 130 factory lane and
[1:19:42] bath just to the south of this proposed
[1:19:44] development
[1:19:46] i've
[1:19:47] read through the
[1:19:49] the staff report sr 1890
[1:19:52] and the parts that struck me
[1:19:54] particularly where it says
[1:19:56] the
[1:19:57] municipality should provide an
[1:19:59] appropriate range and mix of housing
[1:20:01] options and densities
[1:20:03] i should say that in the municipality
[1:20:05] this is being provided
[1:20:07] in several other areas for example off
[1:20:10] highway 6 south of the taylor kid
[1:20:12] and also off spears road
[1:20:15] in all those areas there are multiple
[1:20:17] residential units and the semis
[1:20:20] i don't think it's at all appropriate in
[1:20:22] this particular area
[1:20:24] also
[1:20:26] which i i noticed that the staff report
[1:20:28] had included my comments as well as
[1:20:31] those of all the others who have
[1:20:32] commented however
[1:20:34] i should just like to emphasize again
[1:20:37] that
[1:20:37] there's a requirement
[1:20:39] in the official plan for buffering
[1:20:41] between medium and low density uses
[1:20:44] to minify min to minimize the adverse
[1:20:47] impacts
[1:20:48] and
[1:20:49] the plan as put out now shows no
[1:20:52] buffering at all
[1:20:54] the fire the third point i want to make
[1:20:56] is the
[1:20:57] request
[1:20:59] reduce the side yard front yard
[1:21:03] and
[1:21:04] the various other yards there's very
[1:21:05] large reductions required
[1:21:08] in the official plan
[1:21:09] yard designations and i think that also
[1:21:12] illustrates the fact that this is not a
[1:21:15] suitable
[1:21:16] development for this area as it's
[1:21:18] currently indicated
[1:21:20] thank you
[1:21:23] again i'll turn to staff is there any
[1:21:25] comments with with those particular
[1:21:27] points
[1:21:33] through your worship uh not particularly
[1:21:36] just that we've received the comments
[1:21:37] and all of these comments will be
[1:21:39] considered when we come back to council
[1:21:41] with a report
[1:21:42] thank you very much
[1:21:44] thank you mr salter
[1:21:46] okay
[1:21:47] and i will turn to the clerk for next up
[1:21:51] uh we have catherine murphy
[1:21:54] ms murphy
[1:21:57] can you hear me okay if you could unmute
[1:21:59] we'll find out if we can hear you
[1:22:05] this time you still appear to be muted
[1:22:22] if i can offer a suggestion
[1:22:26] if you have two systems running right
[1:22:28] now turn one of them off
[1:22:33] yes
[1:22:43] there's something your microphone is
[1:22:45] picking up your speakers
[1:22:49] you see
[1:22:55] [Music]
[1:23:05] i'll have to leave it for now
[1:23:07] okay
[1:23:08] if you can still hear me miss murphy we
[1:23:10] would really like you to put your uh
[1:23:12] comments in writing uh or if you can
[1:23:14] join back in a few moments uh with uh
[1:23:17] solving that technical issue thank you
[1:23:23] you've still got the echo
[1:23:29] it's a feedback loop
[1:23:36] okay now that you're muted we can
[1:23:38] hear each other
[1:23:42] again if you can solve the technical
[1:23:43] issue we would invite you back in to
[1:23:44] present but in the meantime we will move
[1:23:47] on to the next presenter and uh if
[1:23:49] you're not able to address that please
[1:23:51] provide it in writing uh through to the
[1:23:53] clerk
[1:23:55] can you hear me now
[1:23:56] we can and there's no echo
[1:23:59] well bev
[1:24:00] excellent go ahead it will be bad form
[1:24:03] and speaking because we're sharing
[1:24:09] hi this is beverly again
[1:24:11] this is beverly hallman
[1:24:14] i live at 483 main street
[1:24:17] okay
[1:24:20] now that i have had to move rooms
[1:24:23] i haven't got a late to show
[1:24:25] what i wanted to talk about
[1:24:28] however um
[1:24:31] the concern what concerns me is the
[1:24:33] historic value of bath
[1:24:35] this is one of the oldest communities
[1:24:38] in ontario
[1:24:39] we have heritage homes up and down the
[1:24:42] street
[1:24:45] and even though
[1:24:47] your consultant is only required to have
[1:24:50] blank blank blank
[1:24:51] and
[1:24:53] only required to
[1:24:55] be under 10 meters and
[1:24:57] i think those rules should be
[1:24:59] put aside because of the historic value
[1:25:02] of this of the town
[1:25:04] we have
[1:25:07] tried
[1:25:08] very hard in bath to keep it in its
[1:25:12] historic
[1:25:13] nature
[1:25:14] we had a lac la lac which was local
[1:25:18] historic conservation
[1:25:20] a lot of people aren't aware of that
[1:25:23] we had
[1:25:24] and we had an historic society we had
[1:25:26] the fairfield goodside house
[1:25:28] we have the
[1:25:30] masonic hall we have the town hall and
[1:25:33] when we resided the town hall there were
[1:25:35] a lot of complaints because we weren't
[1:25:38] staying to the historic nature of bath
[1:25:41] so there are many many people who need
[1:25:44] to have this town remain as it is
[1:25:48] now
[1:25:49] i invite people to take a drive
[1:25:52] into amherst view and particularly on
[1:25:56] walden pond it's called
[1:25:58] to have a look at the homes that are in
[1:26:00] there
[1:26:01] they are chock-a-block on top of each
[1:26:03] other
[1:26:04] they are incredibly tall because a
[1:26:06] walk-out basement evidently isn't a
[1:26:08] walk-out basement out the back a
[1:26:10] walk-out basement is a garage on the
[1:26:13] main floor and then
[1:26:16] above that the main floor of the house
[1:26:18] the living section of the house plus the
[1:26:20] bedrooms on the third floor
[1:26:22] this is taller than anything we have
[1:26:25] here in bass um and as i said
[1:26:28] they're allowed to do it the 10 meters
[1:26:31] is what they're allowed to do
[1:26:33] but we should consider
[1:26:35] that
[1:26:36] in bath we need to maintain the historic
[1:26:39] values
[1:26:43] the first comment or in the first
[1:26:45] comments
[1:26:47] they were talking about medium density
[1:26:49] housing
[1:26:51] and they made no mention whatsoever of
[1:26:53] the 130 homes that are
[1:26:56] going in directly behind here which are
[1:26:58] medium density so we are not lacking in
[1:27:01] medium density homes
[1:27:03] in bath
[1:27:06] plus there are many other subdivisions
[1:27:08] going in
[1:27:12] one other comment
[1:27:14] cash in lieu of parkland
[1:27:16] what's that going to do for the village
[1:27:18] what's that going to do for the the
[1:27:21] it's going to give you money in your
[1:27:22] pocket to do something but
[1:27:24] it's not going to give our children
[1:27:26] places to play i'm directly across the
[1:27:29] street from this place and um
[1:27:33] it's just uh
[1:27:35] amazing to me that they could consider
[1:27:38] putting
[1:27:39] such a
[1:27:41] i don't even know what to call it such
[1:27:44] so many
[1:27:45] houses
[1:27:46] on that tiny piece of land
[1:27:54] also when when we went in to have a look
[1:27:57] at walden pond
[1:27:59] which is um
[1:28:00] in amherst view as i said and it's
[1:28:03] walkout basements which are actually the
[1:28:06] main the
[1:28:07] floor on the ground floor is the walkout
[1:28:10] basement so then the living quarters are
[1:28:12] above that and above that again
[1:28:16] there was an incredible amount of
[1:28:18] parking
[1:28:20] on the street
[1:28:22] there were cars all over the street
[1:28:25] couldn't get down the street without
[1:28:27] swerving back and forth to go around
[1:28:29] cars that were parked there
[1:28:31] so um
[1:28:34] i think
[1:28:36] that you're dreaming if you think that
[1:28:38] there's not going to be a parking
[1:28:40] problem on this street especially with
[1:28:43] fire trucks
[1:28:44] and emergency vehicles getting in there
[1:28:49] and the every house has at least two
[1:28:52] cars if not three
[1:28:54] and there's just definitely not enough
[1:28:56] parking and they will park on the street
[1:28:58] and they will possibly park
[1:29:01] on other streets that are nearby
[1:29:03] and um
[1:29:04] this is a this is a problem in bath
[1:29:08] we're just an accident waiting to happen
[1:29:10] on that main street
[1:29:12] anyway that's my comments for now
[1:29:15] uh thank you very much for hearing me
[1:29:17] thank you very much ma'am
[1:29:18] and uh there's no other comments from
[1:29:21] questions from council and
[1:29:25] i'm seeing none i'll say thank you and
[1:29:27] we'll move to our next commenter
[1:29:31] madam clerk
[1:29:32] uh we have mr cunningham again
[1:29:36] before i return to mr cunningham
[1:29:39] i'm wondering that we do have a lot of
[1:29:40] people in attendance and in the audience
[1:29:43] uh is there anyone else who wishes to
[1:29:45] present a new person to present
[1:29:50] if there are no furthers oh
[1:29:53] i see a few coming in
[1:29:57] madam clerk if you could go to the next
[1:29:58] one
[1:30:01] uh well uh allowed to speak up
[1:30:08] hi this is uh
[1:30:10] hi this is mark kant uh i live at 335
[1:30:13] division street in kingston but
[1:30:16] i'm the estate trustee for the home of
[1:30:20] leon and teresa cant at 517 main street
[1:30:23] bath
[1:30:24] thank you where i grew up
[1:30:27] and
[1:30:30] my main concern
[1:30:32] is that i'm reading through the uh
[1:30:34] council report
[1:30:36] uh staff report
[1:30:38] and such
[1:30:40] a lot of people
[1:30:41] seem to be thinking of the site as
[1:30:44] having been a restaurant which yes it
[1:30:47] was for
[1:30:48] a good many years before it was a
[1:30:50] restaurant it was a fish cannery
[1:30:54] and uh the fish were dropped off at the
[1:30:58] wharf at the bottom of the factory lane
[1:31:00] uh taken from lake ontario
[1:31:03] back in the 40s and 50s and such
[1:31:06] brought up to the cannery for cleaning
[1:31:08] and
[1:31:10] packaging
[1:31:12] then there's
[1:31:13] fish waste coming from it uh parts that
[1:31:17] obviously you don't want to find on
[1:31:18] cattle fish
[1:31:22] back in summer of 1982 i worked for the
[1:31:25] village bath going through its back
[1:31:27] records
[1:31:29] basically
[1:31:30] helping to trim out stuff that was no
[1:31:32] longer needed i saw no records
[1:31:35] with respect to
[1:31:37] the fish cannery at the time
[1:31:39] but
[1:31:40] honestly
[1:31:42] back in the 40s the 50s the early 60s
[1:31:46] environmental stuff was not really a
[1:31:48] consideration
[1:31:49] and disposal of
[1:31:52] waste was not so much a consideration
[1:31:55] there's
[1:31:56] as well understanding of pollution in
[1:31:59] the fish
[1:32:00] particularly in the great lakes was
[1:32:02] definitely not a consideration yet
[1:32:04] i remember in the 70s when that started
[1:32:06] to be understood and
[1:32:08] was something of a surprise
[1:32:10] because i was a kid at the time had
[1:32:12] fishing on the
[1:32:15] dock
[1:32:16] out in front of the house
[1:32:19] the
[1:32:21] wastes from the fish
[1:32:25] i'm not sure where it was disposed but
[1:32:27] there is potential it was exposed on the
[1:32:29] site
[1:32:32] buried in the ground there
[1:32:34] from what i'm
[1:32:35] seeing in staff reports there was an
[1:32:37] understanding that there wasn't
[1:32:39] the potential of an environmental risk
[1:32:41] there
[1:32:42] my understanding is that if it was
[1:32:45] buried on the site or burnt on the site
[1:32:48] or whatever
[1:32:49] you're dealing with the pollutants the
[1:32:51] fish would have had
[1:32:53] including mercury
[1:32:55] which would be in the soil
[1:32:57] i would recommend before
[1:32:59] proceeding with housing development on
[1:33:02] that site
[1:33:03] to double check the soil
[1:33:06] if necessary
[1:33:07] some
[1:33:08] remediation happening
[1:33:10] obviously
[1:33:12] operating something like a restaurant
[1:33:14] where people are in and out quickly
[1:33:16] enough
[1:33:17] uh everything's contained within the
[1:33:19] building is a different thing from
[1:33:21] kids playing in the backyard
[1:33:24] and
[1:33:25] so that
[1:33:26] for all we know could be contaminated
[1:33:35] okay mr kent
[1:33:38] yeah
[1:33:39] thank you very much for those comments
[1:33:42] i will ask staff if they have any uh
[1:33:44] comments with regard to an environmental
[1:33:46] assessment on the property
[1:33:50] yes through you mr mayor i can confirm
[1:33:52] that one was required um any um and a
[1:33:56] record of site condition was submitted
[1:33:57] um as part of the application for this
[1:33:59] so which is currently being reviewed by
[1:34:01] staff as part of the technical review so
[1:34:04] record of site conditions are required
[1:34:05] and issued by the ministry of
[1:34:07] environment conservation and parks um to
[1:34:10] confirm that the analysis that was done
[1:34:12] and proper cleanup and everything was
[1:34:14] completed in order to change a
[1:34:17] non-residential use and and switch it to
[1:34:19] a more um residential one so we can't
[1:34:21] we're not permitted to um
[1:34:23] recommend approval for for changing the
[1:34:26] site to residential um unless that has
[1:34:28] been submitted and is satisfactory
[1:34:31] thank you
[1:34:32] and to your understanding it is
[1:34:34] satisfactory
[1:34:36] and that's what
[1:34:38] go ahead okay
[1:34:40] that's what it had that's what it had
[1:34:42] indicated but we're currently re
[1:34:44] reviewing it all and to ensure that our
[1:34:46] engineering team
[1:34:47] and the final comments from staff on
[1:34:49] that will be included in the final
[1:34:50] report
[1:34:52] yes that's correct yes okay thank you mr
[1:34:55] kent
[1:34:58] are there others in the audience who
[1:34:59] wish to present
[1:35:03] we have uh rick and ann myers
[1:35:07] welcome them in
[1:35:09] mr mr myers
[1:35:11] did we lose them
[1:35:16] they don't appear on my screen oh
[1:35:17] they're there
[1:35:20] i'm pushing the enemy
[1:35:23] and can
[1:35:24] can you hear me we can hear you yes okay
[1:35:27] excellent thank you give us your name
[1:35:28] and address make your comments please
[1:35:31] thank you it's uh rick myers 23 country
[1:35:34] club drive
[1:35:35] in bath and we back on to the bath creek
[1:35:39] along our south side
[1:35:41] just a couple of quick questions to
[1:35:44] ibi group
[1:35:46] number one they talked about she talked
[1:35:47] about
[1:35:50] not removing trees or
[1:35:52] trying to avoid to remove trees
[1:35:55] if necessary
[1:35:56] now they're along that property front
[1:35:58] there are a number of rather large trees
[1:36:00] that
[1:36:02] they're saying they can't don't have to
[1:36:04] remove but
[1:36:05] based on the plans that you currently
[1:36:07] have for for that density i'd be
[1:36:11] rather miffed at how you could possibly
[1:36:13] not remove those trees in order to get
[1:36:15] those houses in there that's number one
[1:36:18] number two you talk about two parking
[1:36:20] spots
[1:36:22] what are you considering two parking
[1:36:25] spots obviously the driveway
[1:36:27] are you considering the garage as
[1:36:28] another parking spot
[1:36:31] that's my second question
[1:36:33] my third question is to the
[1:36:36] council itself is the the water issue
[1:36:39] along there as you know you improved
[1:36:42] that area just recently
[1:36:44] but still
[1:36:45] if you've ever driven
[1:36:47] uh along main street
[1:36:49] during a rainstorm or shortly thereafter
[1:36:52] there are still a number of issues with
[1:36:54] water
[1:36:55] flooding the street
[1:36:58] also
[1:37:00] that's something to consider
[1:37:03] the traffic
[1:37:05] issue is going to be
[1:37:08] a major concern
[1:37:10] as council knows
[1:37:11] phase 8
[1:37:13] the caitlyn project is quickly coming to
[1:37:17] a point where they're going to be
[1:37:19] building homes
[1:37:20] now out of that subdivision there is
[1:37:23] only one exit
[1:37:25] and that is country club drive
[1:37:28] out onto main street
[1:37:30] so you're talking a substantial increase
[1:37:32] in traffic going
[1:37:35] east and west on main street
[1:37:38] and now you're going to add
[1:37:39] another
[1:37:40] 22 residents
[1:37:42] in a area that's low density and should
[1:37:46] remain low density
[1:37:49] my other concern is
[1:37:52] ibi talked about
[1:37:54] two to two and a half stories
[1:37:56] what are you putting in a half story
[1:37:59] on top of that house
[1:38:00] i can see a two-story i can see a
[1:38:02] three-story but what in tarnation is a
[1:38:04] half a story
[1:38:06] so i'd like that answered
[1:38:10] and finally uh the building that's there
[1:38:12] itself is obviously owned by
[1:38:18] ibm or whoever owns it
[1:38:20] has it been examined for asbestos and if
[1:38:23] it has been
[1:38:24] what were the results
[1:38:26] from that
[1:38:28] so those are my questions okay thank you
[1:38:31] sir there was a number of questions
[1:38:32] there and i see uh
[1:38:34] our representative from the ibi group
[1:38:36] has come on screen
[1:38:37] right
[1:38:38] stuki are you able to answer some of
[1:38:40] those i know that our staff have
[1:38:42] recorded all of those questions and it
[1:38:44] will be included in in the report but
[1:38:47] miss tooky if you have answers right
[1:38:49] this moment you can go ahead
[1:38:51] yes thank you i'm three year worship
[1:38:54] um i'll comment first on the comment
[1:38:56] about
[1:38:57] trees so the
[1:38:59] property will be subject to like a
[1:39:01] landscaping plan and tree removal and
[1:39:03] preservation plan intention would be to
[1:39:06] preserve trees where possible it is
[1:39:07] quite a large municipal
[1:39:09] right-of-way in front of the property so
[1:39:11] there may be instances where the trees
[1:39:13] are within the boulevard
[1:39:15] and can be preserved as well and new
[1:39:17] plantings will be provided so that
[1:39:19] detail is to follow
[1:39:22] but will be looked at as part of the
[1:39:23] townships review i can confirm that yes
[1:39:26] one of the two parking spaces is in the
[1:39:28] garage so there's a parking space in the
[1:39:29] garage and a parking space in the
[1:39:31] driveway
[1:39:32] and then in terms of the two and a half
[1:39:34] stories typically the half story would
[1:39:37] [Music]
[1:39:38] one with a peaked roof like a story with
[1:39:41] the peak roof and you see the um
[1:39:43] the one rendering show the dormer
[1:39:45] windows
[1:39:48] and in terms of asbestos testing
[1:39:53] i'll reiterate again the phase one
[1:39:55] environmental assessment was completed
[1:39:57] and any demolition
[1:39:59] of the existing building would be
[1:40:03] contained and done according to all
[1:40:04] regulations
[1:40:07] thank you
[1:40:11] mr myers
[1:40:13] you've heard the comments and again
[1:40:15] these these questions will be recorded
[1:40:17] and answered in the final report
[1:40:22] just just for council to consider uh
[1:40:25] if you
[1:40:26] have been into westbrook
[1:40:29] where they've built those uh row houses
[1:40:33] along highway two
[1:40:35] yeah highway two there
[1:40:38] again that's the type typical type of
[1:40:41] residence where they say there's two
[1:40:42] parking spots
[1:40:44] and
[1:40:45] as you can see they they are small uh
[1:40:47] townhouses and there's nothing wrong
[1:40:49] with townhouses
[1:40:50] [Music]
[1:40:52] the garage is full of everything but a
[1:40:54] car
[1:40:55] they have one car in the driveway
[1:40:58] and they have cars and trucks lining
[1:41:00] that
[1:41:00] little street there
[1:41:02] and that's exactly what's going to
[1:41:04] happen with the ibi group project in
[1:41:07] bath
[1:41:09] it's these things that they say oh well
[1:41:11] you've got two parking spots
[1:41:14] one in the garage yeah right
[1:41:16] i have a two-car garage and i have a
[1:41:17] hard time getting my one car
[1:41:20] uh with all the stuff one has and
[1:41:22] collects
[1:41:23] cooling lawnmowers and snowblowers and
[1:41:25] so forth
[1:41:26] but nevertheless i
[1:41:28] i'm certainly uh
[1:41:31] supportive of this type of group coming
[1:41:34] in and wanting to do something to for
[1:41:36] the betterment of bath and bringing new
[1:41:37] people to bath
[1:41:39] i just think that they're
[1:41:41] they're being
[1:41:42] overly
[1:41:45] optimistic and thinking that
[1:41:47] that many units could really have any
[1:41:52] any uh
[1:41:53] way it could uh
[1:41:55] make bath
[1:41:57] better
[1:41:58] we have lots of uh places that are being
[1:42:00] built as the former person spoke about
[1:42:03] uh phase eight for one uh the new
[1:42:06] subdivision that's going in beside fast
[1:42:08] freddy's in that mall area up there
[1:42:10] which is quite large as well
[1:42:13] we're not really hard-pressed for those
[1:42:16] types of
[1:42:19] dwellings
[1:42:20] being stuck in the middle of a
[1:42:22] low-density uh area such as
[1:42:26] what they're proposing now uh
[1:42:28] like i say i certainly propose the
[1:42:30] growth of bath and i'd like to see it
[1:42:33] grow but i think they're just being over
[1:42:35] optimistic in what they want the plan
[1:42:37] there and they should really consider
[1:42:39] about going back to the the drawing
[1:42:40] board on this one thank you
[1:42:43] thank you mr myers
[1:42:45] okay
[1:42:46] i come back to the clerk is there anyone
[1:42:48] anything further anyone else that wishes
[1:42:51] to speak
[1:42:52] uh i have mr cunningham with his hand up
[1:42:55] i'm not sure whether he's
[1:42:57] and
[1:42:58] i'll let's bring mr cunningham in verb a
[1:43:01] brief comment and i will reiterate brief
[1:43:05] he's removed his uh
[1:43:07] oh he's removed his hand yes okay
[1:43:11] thank you not seeing any uh nope nope
[1:43:13] it's back up again
[1:43:17] i'll give him one final option
[1:43:21] okay should be able to unmute mr
[1:43:23] cunningham if you can hear me you can
[1:43:25] unmute and give us your final cut
[1:43:26] thoughts oh i'm unmuted
[1:43:29] go ahead okay i i would i'm thinking
[1:43:32] that regarding the uh what mr meyer had
[1:43:35] said and i totally agree
[1:43:37] with them but it's
[1:43:38] if they decide to build something in
[1:43:40] there that's got to
[1:43:42] it's got to be like what's there now
[1:43:45] we're not i don't think we're already
[1:43:46] against them building it's just what
[1:43:49] they're going to build in there which
[1:43:51] was which which is the big question
[1:43:53] this is what all what i think
[1:43:56] and that's i know there's a couple and i
[1:43:58] think the environmental studies really
[1:44:00] got really got to be looked at before
[1:44:03] that that project goes
[1:44:06] that's all i have to say
[1:44:07] okay thank you very much mr cunningham
[1:44:10] and you're welcome okay
[1:44:13] anyone else
[1:44:14] look at the final call oh we i see mr
[1:44:17] hudayson's hand up again
[1:44:19] hopefully they'll be able to chime in
[1:44:32] are we able to bring them in madam clerk
[1:44:43] they have to accept to come over i'm
[1:44:45] trying to move them into the
[1:44:51] okay we can see mr hudayson in the main
[1:44:54] area
[1:44:56] if he is able to unmute
[1:45:00] he's welcome to provide us comments
[1:45:03] mr hudeisen are you able to unmute
[1:45:09] it might be gene as well mr dason
[1:45:14] i'm not seeing them being able to unmute
[1:45:17] we cannot hear you yet
[1:45:21] so there will be a button um i'm just
[1:45:24] asking them to unmute they should just
[1:45:26] be able to tap on that and then be able
[1:45:29] to speak
[1:45:34] it looks like a microphone
[1:45:36] on my screen anyway
[1:45:40] yeah
[1:45:41] there you are we can hear you joe
[1:45:43] hello
[1:45:44] can you hear me we can
[1:45:49] oh mr reeve deputy reid
[1:45:51] members of council
[1:45:56] it's really uh really a pleasure to
[1:45:58] address you again
[1:46:00] now uh what i understand is that there's
[1:46:02] been a lot of representation from
[1:46:05] people in the area
[1:46:08] and i haven't been able to speak to
[1:46:10] anyone in the area who
[1:46:12] really supports this this development
[1:46:15] there are a lot of concerns
[1:46:18] and as everybody stated
[1:46:20] earlier the concerns
[1:46:22] are about the quality of life in bath
[1:46:25] the uh
[1:46:26] the idea that it's a historical place
[1:46:29] and that it's a smaller place with a lot
[1:46:31] of uh memories
[1:46:34] we're we're concerned about the density
[1:46:37] even though
[1:46:38] on paper
[1:46:39] according to regulations
[1:46:41] it could be a classified as a lower
[1:46:43] density uh kind of a
[1:46:46] uh development but that's a number
[1:46:48] that's a matter of numbers not a matter
[1:46:51] of lifestyle
[1:46:53] i the other thing is the the whole
[1:46:55] traffic study i agree with the
[1:46:58] concerns that the other people have
[1:47:00] brought up as well
[1:47:02] in terms of other development of path
[1:47:04] that's that's affecting
[1:47:06] main street anybody coming out of
[1:47:09] uh loyalist estates
[1:47:11] turns east
[1:47:13] and that's across the lane of traffic
[1:47:15] that's going to be
[1:47:16] still just as
[1:47:18] awkward and prolific as it is now so it
[1:47:21] raises a a problem there
[1:47:23] i've been to other cul-de-sacs uh in
[1:47:26] bath
[1:47:27] and in atmosphere
[1:47:29] and they're
[1:47:31] they're cul-de-sacs that have single
[1:47:35] resident single family residence
[1:47:37] they have double driveways and still a
[1:47:40] problem with parking
[1:47:43] in this case
[1:47:45] what's proposed is
[1:47:47] two cars one under garage and one
[1:47:51] in the driveway
[1:47:52] but with the frontages such as they are
[1:47:55] so small
[1:47:56] there isn't a lot of room to park in a
[1:47:59] cul-de-sac like that
[1:48:00] and i've seen in cul-de-sacs here
[1:48:03] that people park right in the middle
[1:48:05] when they have company
[1:48:08] the kind of development that's being
[1:48:10] proposed here
[1:48:12] was
[1:48:14] idealized by the developer as something
[1:48:16] for seniors i don't think that's
[1:48:18] necessarily going to be the case i think
[1:48:20] the market if those houses are
[1:48:22] affordable we'll see young families with
[1:48:25] children
[1:48:26] and that cul-de-sac is going to turn
[1:48:29] into a
[1:48:30] playground the cul-de-sac the way it
[1:48:33] looks on the land on the uh dimensions
[1:48:36] opens up onto uh
[1:48:38] the bath road main street
[1:48:41] and there's no sidewalk leading to the
[1:48:43] to the main street
[1:48:44] that means that anybody coming out of
[1:48:46] there including smaller people
[1:48:49] uh just walk along the road
[1:48:51] uh onto the bathroom sidewalks that's
[1:48:54] that should be addressed
[1:48:57] there
[1:48:58] the number of other uh
[1:49:02] uh concerns that that i've heard
[1:49:04] are uh similar as well
[1:49:07] uh there's there's a question of parking
[1:49:10] that's the parking on main street the
[1:49:12] traffic on main street
[1:49:14] i don't know what
[1:49:17] the developers
[1:49:19] traffic study
[1:49:22] arrived at but
[1:49:24] i think and i think everybody that i've
[1:49:26] spoken to
[1:49:27] naturally see that there's going to be
[1:49:29] an impact on the traffic in the area
[1:49:33] and
[1:49:33] everybody that i've spoken to feels like
[1:49:36] a citizen of bat
[1:49:38] in the neighborhood that they live in
[1:49:40] and have enjoyed so much
[1:49:43] so uh just reflecting what people have
[1:49:46] told me here
[1:49:47] uh and i'm sure that uh
[1:49:49] all these
[1:49:51] concerns have been submitted in writing
[1:49:54] and uh and tabled at the open house so
[1:49:57] thank you very much for your support
[1:50:01] not support
[1:50:02] i thought i was canvassing again
[1:50:04] uh thank you very much for hearing me
[1:50:07] and
[1:50:08] i appreciate this opportunity to address
[1:50:10] council
[1:50:16] thank you mr judaism okay
[1:50:18] there's any other further comments
[1:50:23] madam clerk
[1:50:26] uh sorry we have uh two people who have
[1:50:29] uh spoken before uh the cunningham and
[1:50:32] catherine murphy or
[1:50:34] whoever
[1:50:36] murphy i appreciate the enthusiasm i
[1:50:39] will allow miss murphy to come back in
[1:50:41] but mr cunningham's already had a couple
[1:50:43] opportunities i think i'll cut it off
[1:50:45] there but please bring ms murphy back in
[1:50:47] for a final comment
[1:50:54] i'm hoping right now that you can hear
[1:50:56] me we can hear you
[1:50:58] good and it was not me speaking
[1:51:00] before
[1:51:02] um so i'm
[1:51:07] a lot of uh concerns
[1:51:10] um i read the 116 pages of
[1:51:15] of comments uh right at the very
[1:51:18] beginning it said something that may be
[1:51:21] really simple but it said that we have
[1:51:23] schools
[1:51:25] plural and really we don't we have one
[1:51:28] and so the buses for all the separate
[1:51:31] school kids and all the high school kids
[1:51:35] would be leaving the village so that's
[1:51:38] another concern about that area it's
[1:51:41] very very congested
[1:51:43] and you know i liked what i think was
[1:51:46] mrs mcintosh and odessa was talking
[1:51:50] about is
[1:51:51] is you know we moved to an area
[1:51:53] um so we can hear the birds well right
[1:51:56] now we hear traffic
[1:51:58] and i i really
[1:52:00] think that we would be making a huge
[1:52:03] mistake for the village bath for the
[1:52:05] historic
[1:52:06] uh village of bath and i was part of
[1:52:09] lockhack so i'm
[1:52:11] you know
[1:52:12] quite passionate about that is um we're
[1:52:15] making a very big mistake that we won't
[1:52:17] be able to undo
[1:52:22] and so all my further comments are
[1:52:24] written
[1:52:25] but i would also uh move that we
[1:52:28] are able to write in email in like the
[1:52:31] odesk people are
[1:52:33] for those that haven't been able to make
[1:52:35] contact
[1:52:36] absolutely miss murphy we would
[1:52:38] encourage everyone to communicate as
[1:52:41] much as possible uh as quickly as
[1:52:43] possible as well
[1:52:45] by email
[1:52:46] or obviously through this public forum
[1:52:51] thanks
[1:52:52] thank you
[1:52:54] what is the time frame um for this stuff
[1:52:58] and i will turn to the director or miss
[1:53:01] furnace
[1:53:02] for what's the time frame on comments
[1:53:14] yes through you mr mayor um the i mean
[1:53:17] the the the planning act timelines our
[1:53:19] comments can be submitted right up until
[1:53:21] council makes a decision and passes a
[1:53:23] bylaw um however um
[1:53:26] i would just um caution everybody that
[1:53:28] staff are currently in the technical
[1:53:30] review of the of these applications so
[1:53:32] um we would really like to be able to
[1:53:34] incorporate um any public feedback into
[1:53:37] consideration in our technical comments
[1:53:39] back to the applicant um which were
[1:53:41] which we're aiming to send back within
[1:53:43] the month so
[1:53:45] the sooner we can get those to um
[1:53:47] consider any additional comments um to
[1:53:49] our comments that are being currently
[1:53:51] drafted right now it would be um very
[1:53:53] helpful
[1:53:55] thank you and one one more comment is
[1:53:57] that um i understand that you send out
[1:54:00] notices
[1:54:01] and i was included in that because i'm
[1:54:03] part of a radius
[1:54:04] but i think in the village of
[1:54:07] the radius really needs to be a whole
[1:54:09] lot huger
[1:54:11] because it is a village about bath it's
[1:54:13] the historic village about it's not just
[1:54:16] x amount of meters from
[1:54:19] where the old anchor was
[1:54:22] so i really feel that we've left out a
[1:54:24] whole lot of people that have a whole
[1:54:26] lot of passion
[1:54:28] about this village
[1:54:31] thank you for your comments miss murphy
[1:54:36] and i will come back
[1:54:41] wait a moment
[1:54:43] council do we have any comments
[1:54:48] there mrs murphy is now muted so that
[1:54:50] should work better okay
[1:54:52] do we have any other comments
[1:54:55] and i'll turn to the clerk one last time
[1:54:57] is there anyone new wishing to speak
[1:55:00] to this public meeting
[1:55:04] uh not that i see your worship
[1:55:09] but that then i will move forward we
[1:55:11] have a recommendation before us that
[1:55:13] we'll receive all of these comments and
[1:55:15] that a recommendation be brought forward
[1:55:18] to council once the comments from the
[1:55:20] departments the agencies and the public
[1:55:22] have been addressed
[1:55:24] and there's a motion to their
[1:55:26] recommendation to that effect i would
[1:55:27] look to counsel for a motion
[1:55:30] i'll go to councillor budaric
[1:55:35] that's where booter excel moved
[1:55:38] okay do i have a seconder
[1:55:42] counselor garden thank you
[1:55:44] any comments
[1:55:49] seeing none i'll call the question
[1:55:51] all those in favor please raise a hand
[1:55:54] and he opposed motion is carried at this
[1:55:58] time that brings us to the end of the
[1:55:59] public meetings i would like to say
[1:56:01] thank you to the audience members and
[1:56:03] all of the speakers on on uh the various
[1:56:05] type of the two topics uh i appreciate
[1:56:08] your feedback they will be incorporated
[1:56:10] into the reports and those will be
[1:56:12] coming forward in a public manner before
[1:56:14] council at some date in the future i'm
[1:56:17] not sure exactly how long it will take
[1:56:19] uh but to that end i do appreciate your
[1:56:22] participation and fighting through the
[1:56:24] technology that we're dealing with with
[1:56:26] virtual meetings
[1:56:28] so we come to the end of the public
[1:56:30] meetings we move on to our agenda and
[1:56:33] item 7
[1:56:34] 7.1 is the motion to adopt the agenda as
[1:56:37] it's presented before us to the clerk is
[1:56:39] there anything to add to the agenda at
[1:56:41] this time
[1:56:42] not that i'm aware of your worship thank
[1:56:44] you council
[1:56:46] are we happy with the agenda can we get
[1:56:48] a motion to approve the agenda
[1:56:51] counselor talented second by deputy
[1:56:53] mayor
[1:56:54] any comment all those in favor please
[1:56:57] raise a hand
[1:56:59] any opposed
[1:57:01] motion is carried is there any
[1:57:03] declaration of binary interest in the
[1:57:05] general nature thereof
[1:57:08] and seeing
[1:57:10] none
[1:57:12] okay we'll move forward
[1:57:14] first up uh delegations we have uh miss
[1:57:17] kimberly with regard to the odessa
[1:57:19] fairgrounds do we have miss kimberly in
[1:57:22] the audience
[1:57:24] i see mr field he's also associated with
[1:57:27] the odessa egg society
[1:57:31] if miss kimberly's not here perhaps we
[1:57:33] can bring in mr field
[1:57:34] yeah i've switched over he should be
[1:57:37] able to speak now mr field we can see
[1:57:40] you but you're muted right now so we
[1:57:42] can't hear you
[1:57:44] bear can you hear us now we can hear you
[1:57:46] now is that florence
[1:57:47] it is
[1:57:49] welcome miss kimberly thank you
[1:57:51] so thank you for your time this is
[1:57:53] regarding um a call that we got from
[1:57:56] utilities about a huge water bill at the
[1:57:58] fairgrounds
[1:58:00] after the call we immediately checked to
[1:58:02] find no leaks no water damage so the
[1:58:05] consumption did not make sense to us
[1:58:09] we'd been closed since march of 220.
[1:58:13] we shut the water off and called our
[1:58:14] plumber mike carey who verified there
[1:58:16] was no leaks all outside tops and water
[1:58:19] lines to exterior buildings
[1:58:21] are controlled from inside and they were
[1:58:24] had been blown out and all shut off
[1:58:26] uh loyalist utilities came and did a
[1:58:29] download of the information from our
[1:58:31] meter and provided us with a graph of
[1:58:34] our usage which showed that we used in
[1:58:36] excess of 235 cubic meters in one day
[1:58:40] this translates to about four
[1:58:42] tractor-trailer loads of water
[1:58:45] which when you do the math that volume
[1:58:48] is not possible to go through the meter
[1:58:51] and water lines that we have
[1:58:54] we paid a portion of the bill which
[1:58:56] we believe was in keeping with our usual
[1:58:59] bill
[1:59:00] so we're asking council to forgive the
[1:59:02] remaining portion of the bill not
[1:59:04] because the oas cannot pay it but
[1:59:07] because we feel there was a problem and
[1:59:10] no one has been able to explain and we
[1:59:13] want to have suggestions on moving
[1:59:16] forward so it doesn't happen again
[1:59:19] and we sent a letter to the utilities
[1:59:24] saying that oh
[1:59:26] the odessa agriculture society received
[1:59:29] a bill of 2500 and 1845
[1:59:33] and from loyalist township examination
[1:59:36] of the fairgrounds water sewer system by
[1:59:38] both oas maintenance people licensed
[1:59:41] plumber and township workers
[1:59:43] has not rece revealed any reason for the
[1:59:46] puzzling huge increase in usage
[1:59:49] the puzzling is the operative word
[1:59:52] because due to cobid
[1:59:55] it has resulted in cancellation of all
[1:59:58] our scheduled events and activities at
[2:00:00] the fairgrounds including the fair
[2:00:03] since march of 220. even regular
[2:00:05] cleaning of the buildings was suspended
[2:00:09] the oas is managed by volunteers and are
[2:00:12] striving to preserve the fairgrounds
[2:00:14] into the future for the benefit of the
[2:00:16] community
[2:00:17] despite the lack of revenue from rentals
[2:00:20] in the fair the oas is still responsible
[2:00:22] for insurance maintenance and utility
[2:00:25] expenses
[2:00:26] based on the amount of our previous
[2:00:28] bills we send a check for 515.54
[2:00:33] to cover the
[2:00:34] march 16th to may 15th billing
[2:00:37] the oas respectfully asks that the
[2:00:39] loyalist township forgive
[2:00:41] the remainder of the
[2:00:43] 25-18-45 bill and worked with the oas to
[2:00:46] determine the cause of the improbable
[2:00:49] meter reading
[2:00:50] so we want to thank you for considering
[2:00:53] our request
[2:00:55] okay thank you very much ms kimberly
[2:00:58] and for the presentation i will turn to
[2:01:00] council for questions
[2:01:04] anyone on council wish to have
[2:01:06] any further information
[2:01:10] and i'm seeing none okay
[2:01:14] and i will say miss kimberly i
[2:01:15] appreciate that you have worked with our
[2:01:17] utilities uh staff
[2:01:19] to to attempt to resolve this puzzling
[2:01:22] situation and uh i can't
[2:01:26] agree that the
[2:01:27] the uh
[2:01:29] the ag society has been uh very
[2:01:31] beneficial to the township over the
[2:01:34] years council
[2:01:37] we have a presentation
[2:01:39] and what would you like to do with it
[2:01:42] i'll go to the deputy
[2:01:45] thank you
[2:01:46] um i'd like to make a motion
[2:01:49] to receive the delegation with thanks
[2:01:52] and request staff to determine the
[2:01:55] one-time unusual amount
[2:01:58] of this invoice
[2:02:00] and that the township provide relief of
[2:02:02] that amount and that staff continue to
[2:02:06] work with the agricultural society to
[2:02:08] determine
[2:02:09] the cause of
[2:02:11] this anomaly if if
[2:02:14] if it can be determined
[2:02:17] even up to um checking the water meter
[2:02:20] and replacing if
[2:02:22] needed
[2:02:24] does the clerk have clarity on that
[2:02:26] motion
[2:02:29] yes we can yes we will
[2:02:31] thank you and thank you deputy do i have
[2:02:33] a seconder
[2:02:36] i'll go to councillor budaric thank you
[2:02:39] deputy would you like to make comment
[2:02:42] yes um thank you um
[2:02:45] i just uh first off
[2:02:48] i appreciate the fact that the township
[2:02:50] staff and the agriculture society have
[2:02:52] worked together so well trying to
[2:02:54] determine what uh what did happen um
[2:02:57] with nothing
[2:02:58] solid
[2:02:59] [Music]
[2:03:01] i believe that this
[2:03:02] with the agricult cultural society as
[2:03:04] you say
[2:03:06] they've been a great partner for the
[2:03:08] community and for the township
[2:03:12] they're open to all community events and
[2:03:14] they're very
[2:03:17] open to
[2:03:19] um if there's a community event or or
[2:03:21] something is needed that's going to
[2:03:22] benefit the community
[2:03:24] um in the past they've even relaxed
[2:03:26] their fee schedule
[2:03:28] to make sure that it is taken care of
[2:03:33] i'd like to see it continue
[2:03:35] they've also as was mentioned they're
[2:03:37] going on two years with no income even
[2:03:39] though they may not be out of money i i
[2:03:42] think that this is uh
[2:03:46] a great way that we can assist them to
[2:03:48] make sure that they
[2:03:50] do are able to weather the rest of this
[2:03:52] closure and
[2:03:54] be able to be here when we need them and
[2:03:56] again i just thank i thank staff for
[2:03:58] working with them as well to make sure
[2:04:00] that
[2:04:00] um it got to this point to be able to be
[2:04:03] a delegation
[2:04:05] thank you secondary did you have comment
[2:04:07] uh just quickly i just uh would love the
[2:04:10] staff report uh as requested by the
[2:04:12] deputy just to
[2:04:14] see what
[2:04:15] might have triggered a one-time issue
[2:04:17] because this may come up elsewhere in
[2:04:19] the municipality if we can get ahead of
[2:04:21] it that would be a great thing
[2:04:23] thank you
[2:04:24] any and anyone else wish to comment
[2:04:30] anyone
[2:04:32] i'm seeing no further comment
[2:04:34] deputy do you want final
[2:04:38] i think i was long-winded and no thank
[2:04:40] you
[2:04:40] thank you and then i'll call the
[2:04:42] question all those in favor please raise
[2:04:45] a hand
[2:04:47] any opposed
[2:04:49] motion is carried
[2:04:51] thank you very much miss kimberly and mr
[2:04:53] field for facilitating the uh the
[2:04:55] technology
[2:04:56] thank you very much for your help with
[2:04:58] this
[2:04:59] and thank you
[2:05:00] and uh you have a good evening
[2:05:03] moving forward to item 9.2
[2:05:07] we have a presentation from
[2:05:09] i believe it's amy gagne from food cycle
[2:05:11] science to the clerk do we have ms gagne
[2:05:14] uh it will be alex heyman i believe
[2:05:16] that's doing the delegation
[2:05:19] okay
[2:05:21] mr hammond
[2:05:22] welcome sir
[2:05:25] hello
[2:05:28] i do have a presentation are you able to
[2:05:31] see it
[2:05:32] council can receive that presentation
[2:05:36] i'm seeing nods go ahead sir
[2:05:39] okay so hello my name is uh alex heyman
[2:05:42] i'm dialing in today from ottawa i'm
[2:05:45] here today to talk about food waste and
[2:05:49] how our company is piloting new
[2:05:51] technology with 19 municipalities around
[2:05:55] canada mostly in ontario and how we'd be
[2:05:59] interested in exploring a potential
[2:06:01] partnership with
[2:06:03] loyalist township
[2:06:05] uh we have connected with mayor bressi
[2:06:08] in the past at an fcm event and have
[2:06:10] been in contact with
[2:06:12] staff
[2:06:14] over the past year uh regarding several
[2:06:17] informal uh discussions of a pilot
[2:06:20] program and so we'd like to share more
[2:06:22] information with council tonight and our
[2:06:25] request at the end of this presentation
[2:06:27] will be that
[2:06:29] council asks staff to explore this
[2:06:32] further
[2:06:35] so food cycle science as i mentioned
[2:06:36] we're based out of ottawa and our
[2:06:39] company is focused on music technology
[2:06:42] to solve the problem of food waste
[2:06:46] recently we've started partnering with
[2:06:48] many municipalities in canada to offer a
[2:06:51] solution for food waste diversion
[2:06:55] in the storm on dundas and glengarry
[2:06:57] area you're now working with three
[2:06:59] municipalities there which are south
[2:07:01] stormont south dundas and south
[2:07:03] glengarry and those will be interesting
[2:07:06] references because they're fairly close
[2:07:09] to loyalists
[2:07:11] in the direct to consumer space we work
[2:07:13] with brands including vitamix breville
[2:07:15] and sage and we also have a line of
[2:07:18] commercial food cycler machines
[2:07:23] as you know food waste is a big problem
[2:07:25] today and anywhere from 25 to 50 percent
[2:07:29] of the waste our houses produce is
[2:07:31] organic waste food waste is very heavy
[2:07:35] and we spend a lot of money on food that
[2:07:37] is ultimately wasted
[2:07:39] it's a significant problem for
[2:07:41] greenhouse gas emissions because once
[2:07:43] food waste reaches the landfill it
[2:07:46] decomposes anaerobically and releases
[2:07:49] harmful methane gases methane was a big
[2:07:52] discussion at the recent cop26
[2:07:54] conference and so it's a very uh
[2:07:56] interesting topic right now
[2:07:59] municipalities spend a lot of money on
[2:08:02] landfills and waste management and as
[2:08:04] our landfills continue to fill up those
[2:08:07] costs will only continue to rise and
[2:08:09] thus
[2:08:10] it'd be good idea to investigate
[2:08:13] all methods available for diversion
[2:08:16] there's the environmental side
[2:08:19] again the methane gas being produced and
[2:08:21] finally there's the community aspect
[2:08:24] that having food waste in the garbage
[2:08:26] attracts animals creates odors and if we
[2:08:29] can get that out of the garbage and
[2:08:31] diverted
[2:08:32] you got less animals you have less waste
[2:08:35] you may even not have to collect the
[2:08:36] garbage as often
[2:08:40] a lot of people say to us haven't we
[2:08:42] solved this already can't we just get
[2:08:44] green bins like a city like kingston has
[2:08:47] well yes in a lot of communities are
[2:08:49] considering solutions such as green bins
[2:08:52] however they tend to work best in large
[2:08:54] cities with economies of scale and
[2:08:57] residents don't always like them for
[2:08:59] example sudbury recently implemented a
[2:09:01] green bin program in the participation
[2:09:03] rate was very very low
[2:09:06] contamination is an issue there's more
[2:09:08] trucks on the road for doing collection
[2:09:10] which leads to safety concerns and
[2:09:13] ultimately it's not something that
[2:09:14] everybody buys into
[2:09:16] it can work but it's expensive and not
[2:09:19] everybody likes it
[2:09:21] there's backyard composting which is
[2:09:22] great and i like to thank everybody who
[2:09:25] is backyard composting please continue
[2:09:27] to do so
[2:09:29] um it's a great option but again it's
[2:09:31] not for everybody and many of those at
[2:09:33] backyard compost aren't doing it during
[2:09:36] the winter
[2:09:37] and lastly there's a landfill that's not
[2:09:39] a great solution for a number of reasons
[2:09:43] so we've done at foodcycler is we've
[2:09:45] created a countertop appliance about the
[2:09:48] size of a bread machine
[2:09:50] and the way it works is you put your
[2:09:52] food waste into the bucket you put the
[2:09:54] bucket into the machine and a few hours
[2:09:57] later
[2:09:58] your food waste has been reduced in
[2:10:00] weight and volume by 90
[2:10:02] leaving you with a dry sterile and
[2:10:04] odorless soil amendment that many folks
[2:10:07] use for gardening
[2:10:09] landscaping can be composted or
[2:10:12] exploring pelletizing it into home
[2:10:14] heating fuel there's a lot of
[2:10:17] applications for this material but
[2:10:20] overall
[2:10:21] it's a very simple clean and easy
[2:10:24] process and we're learning in all our
[2:10:26] pilot programs with municipalities in
[2:10:28] canada that residents like it because
[2:10:31] it's super easy
[2:10:34] in terms of the environmental impact
[2:10:37] we're able to reduce our greenhouse gas
[2:10:39] emissions from food waste by upwards of
[2:10:43] versus sending it to landfill which is
[2:10:45] quite significant
[2:10:47] we're able to offer considerable cost
[2:10:50] savings versus sending
[2:10:52] our food waste to a municipal landfill
[2:10:55] or to private sector disposal
[2:10:58] and lastly we're helping municipalities
[2:11:00] comply with environmental regulations
[2:11:03] that
[2:11:04] are coming in the next few years
[2:11:07] the mystery of environment conservation
[2:11:09] and parks has listed a food waste policy
[2:11:13] statement that is
[2:11:15] asking more municipalities to have
[2:11:17] diversion systems for food waste in
[2:11:20] place over the next few years
[2:11:23] and we hear from residents that they're
[2:11:25] interested in being part of the solution
[2:11:28] they want their local government to come
[2:11:30] to them with solutions to help address
[2:11:33] this challenge
[2:11:36] a quick touch on a pilot project this is
[2:11:38] one of our older ones in the city of
[2:11:40] nelson in bc
[2:11:42] with 250 households we're able to divert
[2:11:45] 25 tons of food waste over a three-month
[2:11:48] period
[2:11:49] diversion continues to this day
[2:11:53] residents really liked it
[2:11:55] 4.5 at a 5-star rating with less than 1
[2:11:59] saying they would not recommend it to
[2:12:00] others
[2:12:01] lots of learnings from this pilot
[2:12:03] program as well that we've taken and
[2:12:05] adopted into our programs and i think
[2:12:07] the number of municipalities buying into
[2:12:10] this is evidence of that success
[2:12:14] recently from the federal government we
[2:12:16] were awarded a grant through the impact
[2:12:19] canada food waste reduction challenge
[2:12:21] it's a multi-stage project with these
[2:12:24] grants we're able to help offset the
[2:12:26] cost of pilot programs to municipalities
[2:12:29] that want to try out this technology
[2:12:32] and if we're successful in future stages
[2:12:34] of the challenge there will be funding
[2:12:36] to help scale up these projects so
[2:12:39] currently we're in stage one and there's
[2:12:41] two more stages to this program
[2:12:45] within our pilot program we have a
[2:12:47] 12-week program where residents purchase
[2:12:50] a food cycler from the municipality at a
[2:12:52] subsidized rate use the food cycler for
[2:12:55] 12 weeks and then report their usage and
[2:12:57] fill out a survey at the end it's a very
[2:13:00] quick
[2:13:01] process that allows the municipality to
[2:13:04] get data
[2:13:05] very quickly and with minimal staff time
[2:13:08] required
[2:13:09] for municipalities that started the
[2:13:12] program in august we're now reporting
[2:13:14] final data back to them and doing the
[2:13:16] final reports so it's a very
[2:13:18] quick process to get some good data
[2:13:21] about food waste generation in the
[2:13:23] community
[2:13:25] in terms of pilot size typically we
[2:13:28] recommend starting about 100 households
[2:13:31] and that comes with a cost municipality
[2:13:33] of about 10 thousand dollars
[2:13:36] and the way the pricing breaks down is
[2:13:38] in the chart on the right so the device
[2:13:40] has a 500
[2:13:42] retail price our company plus the
[2:13:45] federal grant cuts that in half
[2:13:47] we then look for the municipality to
[2:13:49] subsidize a hundred dollars which leaves
[2:13:51] the resident to cover 150 dollars to
[2:13:54] participate in the pilot program
[2:13:57] that seems to be the sweet spot between
[2:13:59] keeping it accessible to as many people
[2:14:01] as possible but not placing an undue
[2:14:03] burden on taxpayers to subsidize this
[2:14:07] we found it's worked very well with all
[2:14:09] of the other municipalities we work with
[2:14:12] now
[2:14:13] so thank you very much for your time and
[2:14:15] considering this idea our request would
[2:14:18] be that council refer this to staff for
[2:14:20] further consideration and i welcome any
[2:14:23] questions from you thank you
[2:14:27] thank you very much alex
[2:14:29] council do we have questions with regard
[2:14:30] to the presentation
[2:14:35] i'll go to the deputy
[2:14:37] thank you through you um
[2:14:41] you i know you presented it tonight as a
[2:14:44] municipal incentive um are these uh
[2:14:47] available to anyone if they wanted one
[2:14:49] outside of this program if just a
[2:14:51] resident wanted to buy one at full price
[2:14:55] they are they can be purchased through
[2:14:57] our partner in the direct-to-consumer
[2:14:58] market which is vitamix just through
[2:15:01] vitamix.com however by working with
[2:15:04] municipalities we're able to achieve
[2:15:06] significant economies of scale and bring
[2:15:08] the costs down to residents
[2:15:11] okay thank you
[2:15:13] thank you
[2:15:14] anyone else have comment or question
[2:15:16] counselor gordon go ahead
[2:15:21] um that
[2:15:23] hundred dollar cost
[2:15:25] uh to the homeowner is based on it was
[2:15:28] it 2500
[2:15:30] units or no how many families
[2:15:35] so that was based on a hundred
[2:15:37] households participating and the
[2:15:40] municipality subsidizing a hundred
[2:15:42] dollars per household
[2:15:44] so if if only uh if we get into serious
[2:15:47] numbers where
[2:15:49] we've got roughly seven thousand
[2:15:51] five hundred households i think
[2:15:53] if we get into four and five thousand
[2:15:56] uh numbers like uh
[2:15:58] does the cost go down even more
[2:16:02] so there's certainly around 100 bucks
[2:16:07] i'd say there's certainly further
[2:16:08] economies of scale that could be
[2:16:11] achieved what we found with the pilot
[2:16:13] programs we keep the size very low to
[2:16:16] test the concept directly in the
[2:16:19] community and if there is success we'd
[2:16:21] work with you to find grants that could
[2:16:23] fund the expansion there's a lot of
[2:16:26] money out there right now particularly
[2:16:28] from the federal government through the
[2:16:30] green municipal fund that supports this
[2:16:32] and as several of our communities are
[2:16:34] wrapping up pilots with positive results
[2:16:37] that's the angle we're taking to fund
[2:16:39] the expansion so that hopefully the cost
[2:16:42] to a resident to participate
[2:16:44] would eventually be zero and no out of
[2:16:47] pocket cost just like many would expect
[2:16:49] with a green vent type program
[2:16:52] okay
[2:16:54] thank you councillor parks go ahead
[2:16:58] who are you mr mayor um to the presenter
[2:17:01] just looking
[2:17:03] when you run the program how long does
[2:17:04] the program normally run for like the
[2:17:07] pilot program is i'm sorry if i missed
[2:17:08] that
[2:17:10] we recommend a 12-week pilot program
[2:17:14] and that's what we've done uh in the
[2:17:16] past though we're certainly open to
[2:17:19] exploring a longer or shorter program
[2:17:22] based on what staff would recommend for
[2:17:24] your community
[2:17:25] thank you
[2:17:26] can i follow up go ahead um to the
[2:17:29] director
[2:17:30] um i believe we're in the process of
[2:17:34] looking at all the options at this point
[2:17:36] and i just sort of wondered what that
[2:17:37] timeline was for looking at alternatives
[2:17:42] the garbage and recycling that's coming
[2:17:44] mrs mcfarlane are you able to comment
[2:17:47] there we are
[2:17:49] um through you mr mayor um
[2:17:52] we are as
[2:17:53] mr heyman
[2:17:55] spoke we have been in contact
[2:17:57] over the last year with um with this
[2:18:00] company
[2:18:02] we do have staff that are working to
[2:18:04] bring back
[2:18:06] the results of the actual surveys that
[2:18:08] were done and some different options for
[2:18:12] and when we were meeting today we
[2:18:15] we have to look at those contracts and
[2:18:16] probably in the summer we'll be looking
[2:18:19] at um
[2:18:21] redoing the the waste collection
[2:18:23] contracts and at that time or doing the
[2:18:25] tenders and at that time we um
[2:18:28] we will hope to have been able to do
[2:18:30] some more public consultation and come
[2:18:31] back with some different options
[2:18:34] okay
[2:18:36] thank you
[2:18:37] any other comments or questions
[2:18:42] i'm seeing no further questions
[2:18:44] mr hammond has
[2:18:46] posited a a recommendation if you will
[2:18:49] that uh this be
[2:18:50] we authorize staff to continue working
[2:18:53] with the organization
[2:18:55] uh to explore the the this pilot or or
[2:18:58] the options around this
[2:19:00] council would you like to make a motion
[2:19:02] i'll go to council parks
[2:19:05] moved
[2:19:06] so move does the clerk have clarity
[2:19:10] yes yes worship thank you and i believe
[2:19:13] i saw counselor buddha chan for
[2:19:15] seconding
[2:19:16] thank you movers you have to comment
[2:19:20] second or comment
[2:19:22] no anyone else have comment on this
[2:19:26] saying no further comment i'll call the
[2:19:28] question all those in favor please raise
[2:19:30] a hand
[2:19:32] any opposed
[2:19:34] motion is carried thank you
[2:19:37] and thank you mr hammond
[2:19:39] thank you very much mayor and council
[2:19:42] which brings us to the end of
[2:19:43] delegation's presentations
[2:19:46] we move to
[2:19:47] item 10 adoption of minutes
[2:19:50] confirmation of the minutes of the 57th
[2:19:52] session of council from november the 8th
[2:19:54] and are there any noted errors or
[2:19:56] remissions in these minutes
[2:20:00] i'm seeing none can i get a motion to
[2:20:01] approve
[2:20:04] counselor gordon seconded by the deputy
[2:20:07] any comments
[2:20:09] i'll call the question all those in
[2:20:10] favor please raise a hand
[2:20:12] any opposed
[2:20:14] motion is carried
[2:20:17] cancer attendant were you opposed to
[2:20:19] that
[2:20:20] sorry i'm just not trying to highlight
[2:20:22] i'm just

[2:20:26] the internet
[2:20:29] there there is a delay in your worship
[2:20:31] but i was in favor

[2:20:50] anything to highlight or or add to this
[2:20:52] report
[2:20:53] i don't have anything to add to worship
[2:20:56] and thank you council do we have any
[2:20:58] questions with regards to this
[2:21:02] i'm seeing no questions
[2:21:04] we have a recommendation in the report
[2:21:07] to accept the gift to agree to purchase
[2:21:10] and
[2:21:11] the staff you directed to begin the
[2:21:13] public consultation
[2:21:15] and
[2:21:16] that's the recommendation do we have

[2:21:32] councilor gordon thank you
[2:21:34] any comment from the mover
[2:21:38] uh only to uh to thank the cio for the
[2:21:40] report and that uh that islanders are uh
[2:21:43] are excited to uh to be engaged on uh
[2:21:47] and consulted on on what will uh will
[2:21:49] happen with both of those properties
[2:21:52] thank you secondary do you have comment
[2:21:56] anyone else have comment
[2:21:59] saying no further comments i will add
[2:22:02] our
[2:22:03] expression of thanks to uh
[2:22:06] the gowans for the donation of the
[2:22:07] property it is greatly appreciated they
[2:22:10] are great community members
[2:22:12] with that i will call the question
[2:22:14] all those in favor please raise a hand
[2:22:18] any opposed motion is carried
[2:22:21] we move to item 13
[2:22:24] business services treasury department
[2:22:26] 13.1 is the 2022 water sewer user rates
[2:22:31] we have a report before us and we have
[2:22:33] mr dickey before us mr dickey do you
[2:22:36] have anything you'd like to highlight in
[2:22:38] this report or add to it
[2:22:41] good evening nothing to add to it mr
[2:22:43] mayor through you um
[2:22:46] we do have the deputy treasurer and
[2:22:47] senior financial analyst available who
[2:22:49] did most of the analysis
[2:22:51] on the rates so there is a choice
[2:22:54] or a couple of options for counseling
[2:22:56] the motion but uh we'll be willing to
[2:22:58] receive any questions
[2:23:00] thank you
[2:23:01] council do we have questions
[2:23:04] for either the treasurer or the uh the
[2:23:07] deputy or the senior analyst
[2:23:11] i'm seeing no questions
[2:23:15] again as the treasurer highlighted we do
[2:23:17] have some options within the
[2:23:18] recommendations
[2:23:21] there's no questions i will look to
[2:23:22] council to make a motion to identify an
[2:23:25] option counselor budaric go ahead
[2:23:30] these are very welcoming uh options um
[2:23:33] and since they obviously make uh
[2:23:35] financial sin uh sense or they wouldn't
[2:23:38] be put before us i would love to go with
[2:23:40] option b
[2:23:41] um as uh
[2:23:44] that is one of the two hot topic buttons
[2:23:46] i hear the most from my constituents um
[2:23:49] that uh
[2:23:51] our water rates are increase
[2:23:54] crazy in comparison to uh other
[2:23:56] municipalities and uh
[2:23:59] like i said it wouldn't be an option if
[2:24:00] it wasn't in front of us and i'd like to
[2:24:02] take an opportunity to run with it thank
[2:24:04] you
[2:24:05] so your motion is to receive the report
[2:24:07] and adopt recommendation b no change in
[2:24:10] rates
[2:24:11] yes sir
[2:24:12] thank you do i have a second or for that
[2:24:14] councilor parks thank you
[2:24:17] mover any further comment
[2:24:21] uh like the deputy said earlier i was
[2:24:23] long-winded enough in the first time
[2:24:24] around thank you
[2:24:26] thank you councillor parks you're the
[2:24:27] secondary would you like to make comment
[2:24:29] uh i just wanted to reiterate what uh
[2:24:31] council broderick has said uh our rates
[2:24:33] are are
[2:24:35] extremely expensive so it's nice to see
[2:24:37] that we have this option
[2:24:39] thank you
[2:24:40] anyone else wish to make comment
[2:24:45] seeing no further comments oh sorry
[2:24:47] deputy go ahead thank you
[2:24:50] um the one thing that i want to point
[2:24:51] out and which causes me concern is that
[2:24:54] with with this uh
[2:24:58] the income has to come some from
[2:25:00] somewhere so in the report it says that
[2:25:02] there'll be a reduction in capital
[2:25:05] which means the maintenance and upkeep
[2:25:07] and
[2:25:08] advancements in our systems
[2:25:11] will lag behind
[2:25:13] this option is uh
[2:25:15] goes through
[2:25:18] thank you
[2:25:20] and
[2:25:21] any other comments
[2:25:24] and
[2:25:24] i'm seeing no comments no further
[2:25:26] comments
[2:25:28] right
[2:25:29] back to the mover
[2:25:32] uh yeah i'd just like to reiterate the
[2:25:34] fact that um i'm only bringing this
[2:25:37] forward because it was an option for us
[2:25:39] and and and i agree with the deputy on
[2:25:40] what he's saying um however uh
[2:25:44] it wouldn't be brought to us if it
[2:25:46] wasn't
[2:25:47] possible is all i'm trying to say that's
[2:25:49] why it was going with option b but that
[2:25:51] is it okay thank you
[2:25:54] with that i will call the question
[2:25:56] all those in favor please raise a hand
[2:26:02] and counselor gordon i can't see you
[2:26:04] right now okay hand is up okay thank you
[2:26:07] all right any opposed
[2:26:11] thank you motion is carried
[2:26:14] move forward to item 13.2
[2:26:18] 2022 escalation of frontage fees
[2:26:21] and we again we have the treasury with
[2:26:24] okay do you have anything to add or
[2:26:25] highlight in this report
[2:26:28] mr mayor nothing at this time
[2:26:30] it's time council do we have any
[2:26:32] questions
[2:26:36] seeing no questions
[2:26:38] i'll look for a motion
[2:26:44] deputy go ahead
[2:26:45] move to receive and adopt the
[2:26:46] recommendation
[2:26:48] receiving adopt do i have a second or
[2:26:50] for that
[2:26:54] counselor gordon seconds thank you
[2:26:56] deputy any comment
[2:26:59] second or any
[2:27:00] comment anyone else have comment on this
[2:27:04] motion
[2:27:06] seeing none i'll call the question all
[2:27:08] those in favor please raise a hand
[2:27:12] any opposed motion is carried we move to
[2:27:17] item 13.3 operating status is at
[2:27:20] september 30th
[2:27:22] year-end projections and capital works
[2:27:24] in progress in progress
[2:27:26] again mr
[2:27:28] mr dickey is here do you have anything
[2:27:31] to highlight within this report sir
[2:27:34] um through you mr merritt um
[2:27:36] just um
[2:27:38] we are projecting a bit of a surplus
[2:27:39] again this year so just really mainly
[2:27:41] the highlights in the report but
[2:27:43] um i think there have been
[2:27:46] with a pandemic and
[2:27:48] delay in getting hiring going over the
[2:27:50] last couple years we have been slow at
[2:27:51] filling some of the positions and
[2:27:52] replacing positions so
[2:27:54] that has created the bulk of the
[2:27:57] kind of the projected surplus for this
[2:27:58] year but
[2:27:59] um just for council's awareness we have
[2:28:02] been
[2:28:03] closing that gap and i think by the end
[2:28:04] of this year the
[2:28:05] virtually all those positions
[2:28:08] are will be filled so we'll be
[2:28:10] that um that gap should be there next
[2:28:13] year we are catching up with the hiring
[2:28:15] that needs to be done over the last
[2:28:16] couple years so that will
[2:28:17] um that will help without going forward
[2:28:21] thank you
[2:28:23] council do we have any questions with
[2:28:24] regards to this deputy go ahead
[2:28:28] just want to confirm um
[2:28:30] i believe if i read it correctly there's
[2:28:32] going to be some of the losses that are
[2:28:35] going to be reviewed for
[2:28:37] whether it can be funded through the
[2:28:38] reopening ontario funding
[2:28:41] am i correct that at the end of the year
[2:28:43] things like the fees
[2:28:46] the lost fees
[2:28:47] whether it's ferry transit recreation
[2:28:50] they'll all be reviewed for
[2:28:53] potential funding from the other levels
[2:28:54] of government
[2:28:58] through you mr mayor
[2:29:00] um yeah yeah so we we do um
[2:29:03] we do still have that we've been we've
[2:29:05] received funding that we're holding on
[2:29:06] to so we will
[2:29:09] be required to report back at the end of
[2:29:11] the year
[2:29:12] with um kind of results the extra costs
[2:29:14] the lost revenue according to the pen
[2:29:17] because of the pandemic
[2:29:18] the one thing we're not sure because we
[2:29:20] have surpluses in other areas
[2:29:22] the way the for funding has appeared to
[2:29:24] work so far is if you've offset some of
[2:29:26] your extra costs
[2:29:29] through other savings
[2:29:30] we're not sure how much of that funding
[2:29:32] will be eligible to receive
[2:29:35] last year we did we were able to take
[2:29:37] some of the money into offset ferry fees
[2:29:39] in 2020
[2:29:41] so we will look at that again
[2:29:43] so so that money is available to us if
[2:29:45] we need it we're just at this point
[2:29:46] until we do the year-end filing we're
[2:29:48] not sure exactly how much of it will be
[2:29:50] eligible for but it is there available
[2:29:52] for us if we need it
[2:29:54] thank you
[2:29:57] any other questions with regard to this
[2:29:59] report
[2:30:04] i'm seeing no further questions
[2:30:07] and do i have a motion
[2:30:12] anyone oh deputy go ahead
[2:30:15] move to receive and adopt the
[2:30:16] recommendation question to receive and
[2:30:18] adopt do i have a seconder

[2:30:23] yes okay
[2:30:25] so very quickly right any any comments
[2:30:28] mover seconder
[2:30:30] no anyone else have comment
[2:30:34] i'm seeing no comments
[2:30:36] i'll call the question
[2:30:37] all those in favor please raise a hand
[2:30:40] any opposed
[2:30:42] promotion is carried
[2:30:46] forward to
[2:30:49] 13.4
[2:30:51] 2022 escalation of imposed growth fees
[2:30:56] and you're really providing us with a
[2:30:58] lot of reports tonight mr dickey
[2:31:00] do you have anything to add or highlight
[2:31:02] all right
[2:31:03] it's okay
[2:31:05] um through you nothing in addition to
[2:31:08] what's in the report
[2:31:09] just if anyone has questions
[2:31:11] thank you council do you have questions

[2:31:41] i will call the question all those in
[2:31:43] favor please raise a hand
[2:31:47] any opposed
[2:31:48] motion is carried
[2:31:50] and we move to the america scholarship
[2:31:52] fund 2021.
[2:31:55] annual report
[2:31:57] we have a recommendation
[2:31:59] do i have any
[2:32:02] mr dickey do you have anything to add to
[2:32:03] it at this time
[2:32:05] now through you mr mayor nothing
[2:32:07] unfortunately the there have been a lot
[2:32:09] of donations this year and of course our
[2:32:10] investment income rate is
[2:32:12] as a historic low so we don't have as
[2:32:14] much to distribute unfortunately it is a
[2:32:16] nice program it's it's great for
[2:32:18] for students to be able to get a little
[2:32:20] bit of extra money so it's unfortunately
[2:32:21] not a lot this year but
[2:32:24] we are proposing to distribute as as per
[2:32:26] the intent of the trust
[2:32:28] absolutely thank you
[2:32:30] any questions

[2:35:17] the bath park's garage
[2:35:20] ms mcfarland do you have anything to uh
[2:35:22] comment on this report
[2:35:24] uh the only thing your worship that i'd
[2:35:27] like to uh point out is that
[2:35:29] unfortunately the uh
[2:35:31] through some staff turnover this uh
[2:35:33] issue wasn't um addressed and
[2:35:36] when our new parks and manager or parks
[2:35:39] and facilities manager started
[2:35:42] she
[2:35:43] worked to address it and meet with the
[2:35:46] resident and
[2:35:48] listen to the concerns and has tried to
[2:35:50] change some operating
[2:35:53] uh practices to see if we could
[2:35:55] alleviate the um
[2:35:57] some of the the concerns that were
[2:35:58] expressed
[2:36:00] so we i i'm just apologizing for it
[2:36:02] being so long coming back to council
[2:36:05] thank you very much
[2:36:07] council do i have any questions
[2:36:11] counselor parks go ahead
[2:36:13] through you mr mayor to the uh director
[2:36:15] um has the resident provided any
[2:36:18] feedback since you've made some of those
[2:36:19] amendments or changes to some of the
[2:36:23] processes or the operation just wondered
[2:36:25] if there'd been any feedback
[2:36:27] um through you mr mayor not to my
[2:36:29] knowledge
[2:36:32] they they have not provided feedback
[2:36:37] anyone else have a question
[2:36:41] i don't think so
[2:36:42] can i get a motion please
[2:36:46] council parks go ahead
[2:36:50] sorry um just to
[2:36:53] where are you going to find it
[2:36:56] to uh receive it and remain status quo
[2:36:59] thank you
[2:37:00] all of us do i have a secondary
[2:37:03] councilor buderic thank you any comments
[2:37:05] from the mover or seconder
[2:37:09] anyone else
[2:37:11] i'll call the question all those in
[2:37:12] favor please raise a hand
[2:37:15] any opposed motion not available
[2:37:32] to the clerk
[2:37:34] you missed the uh corporate services
[2:37:36] your worship oh
[2:37:38] my apologies i skipped over right
[2:37:41] happens to be the clerk's own items
[2:37:44] at item 15.1 before we get to ms merritt
[2:37:47] uh the pound services agreement renewal
[2:37:50] okay we have the report before us madam
[2:37:53] clerk do you have anything to highlight
[2:37:54] or to add to this report
[2:37:56] uh it's just it we did a pilot project
[2:37:59] on it last year you worship they've had
[2:38:01] some changes in greater napanee but we
[2:38:04] have reached out and and we're uh giving
[2:38:06] it another
[2:38:07] go for this year uh
[2:38:09] we haven't heard any negative from it so
[2:38:12] i think it's a win-win uh partnership
[2:38:14] with greater napanee on this
[2:38:16] thank you
[2:38:18] council do we have uh comments or
[2:38:19] questions
[2:38:22] i'm seeing none can i get a motion
[2:38:24] please
[2:38:28] deputy go ahead and receive and adopt
[2:38:30] the recommendation so i moved do i have
[2:38:32] a seconder
[2:38:33] counselor bootrick thank you
[2:38:35] any comments from the mover and seconder
[2:38:38] no anyone else
[2:38:41] saying none i'll call the question all
[2:38:43] those in favor please raise a hand
[2:38:46] any opposed
[2:38:48] motion is carried
[2:38:49] now we can come to economic growth and
[2:38:52] community development services
[2:38:54] as merit we have the crca lidar project
[2:38:58] partnership report before us
[2:39:00] do you have anything to add to it
[2:39:02] uh through you your worship actually i'd
[2:39:04] like to clarify i typically write um you
[2:39:07] know like not just the acronym but what
[2:39:09] it actually means
[2:39:10] so i've been asked that question today
[2:39:12] so lidar basically stands for light
[2:39:14] detection and ranging
[2:39:16] um processor that's a technology that
[2:39:18] gives us really high resolution models
[2:39:21] of ground elevation so we do have some
[2:39:24] lidar information for the township but
[2:39:27] it some of it is outdated
[2:39:29] the technology is a little bit better
[2:39:30] now
[2:39:31] and also it's going to help us fill some
[2:39:33] gaps in our data
[2:39:36] so now that i've said that actually i
[2:39:38] need to make a small uh update um
[2:39:43] i need to know that um in the attached
[2:39:45] agreement in the attached bylaw so it's
[2:39:48] page 640 of your of your agenda
[2:39:52] in item 3.2 it gives a
[2:39:56] the installment has to be paid by
[2:39:58] december 1st 2021
[2:40:01] staff actually requested crca to amend
[2:40:04] their agreement to say march 31st 2022
[2:40:08] to give us an opportunity to budget for
[2:40:11] it in 2022 if council supports
[2:40:15] this partnership with crca so that's a
[2:40:17] very small change i have the updated
[2:40:19] bylaw the updated agreement uh for the
[2:40:22] clerk
[2:40:23] i will send over but if if you're
[2:40:26] agreeing to the change we'll just
[2:40:29] send the revised bylaw
[2:40:31] okay thank you council do we have any
[2:40:33] questions from his merit
[2:40:38] doesn't look like it we all understood
[2:40:40] lidar
[2:40:42] right so we have a recommendation to uh
[2:40:45] you know enter into an agreement with
[2:40:47] the crca
[2:40:48] with the modification to the
[2:40:50] agreement as presented changing the date
[2:40:54] do i have a mover for that or any or
[2:40:56] however you'd like to make a motion
[2:40:58] deputy go ahead
[2:41:01] move to receive and adopt the
[2:41:02] recommendation with the bylaw as amended
[2:41:05] thank you councillor budrick your second
[2:41:09] any comment from the mover and seconder
[2:41:13] anyone else
[2:41:16] seeing none i will call the question all
[2:41:19] those in favor please raise a hand
[2:41:22] and the opposed
[2:41:24] motion is carried
[2:41:26] item 16.2 the development approval
[2:41:29] process project status
[2:41:31] we have a report
[2:41:33] before us i do note that the
[2:41:34] recommendation has an ore
[2:41:36] uh but i will go to the director
[2:41:38] anything to highlight
[2:41:41] uh no there's nothing to highlight uh
[2:41:44] your worship
[2:41:45] and thank you
[2:41:47] council
[2:41:49] and do we have any comments or questions
[2:41:51] with regards to this report
[2:41:56] seeing none right does anyone want to
[2:41:59] make the motion
[2:42:04] deputy go ahead
[2:42:07] move to receive and adopt the
[2:42:08] recommendation item two
[2:42:11] item two
[2:42:12] thank you
[2:42:13] do i have a seconder for that
[2:42:20] oh counselor gordon thank you
[2:42:23] all right
[2:42:24] move or comment just with the uh
[2:42:27] with with the partnering with the county
[2:42:29] moving forward i think it'll be really
[2:42:31] good for us to finish that process then
[2:42:33] we'll be able to move forward if we do
[2:42:34] need additional staffing or whatever it
[2:42:36] is required or whatever scope of uh
[2:42:39] work for
[2:42:40] additional staff or current staff that
[2:42:42] can all be determined once we have a
[2:42:44] good process in place
[2:42:46] you seconder comment
[2:42:48] no anyone else have comment
[2:42:53] i'm seeing none i'll call the question
[2:42:55] all those in favor please raise a hand
[2:42:58] and he opposed motion is carried
[2:43:01] we go to 16.3 request for road closing
[2:43:06] and uh i'm not gonna get into the
[2:43:08] details there we have the report before
[2:43:12] and we have ms merritt
[2:43:14] do you have a comment to make
[2:43:17] uh no no further comment to make your
[2:43:19] worship
[2:43:22] council do we have questions
[2:43:26] counselor budaric go ahead
[2:43:32] counselor bootrick did you have a
[2:43:33] question
[2:43:34] yeah i was just trying to meet my uh my
[2:43:36] apologies your worship um
[2:43:39] just a quick question on the option
[2:43:41] number three i know it's probably
[2:43:42] further down in the uh report and uh and
[2:43:46] i get that i read down to where it was
[2:43:48] but i was just curious to the uh
[2:43:51] reasoning from staff as why option three
[2:43:54] would be included in the recommendations
[2:43:57] um that the the one resident would not
[2:43:59] be allowed to purchase the property
[2:44:02] um just a little more rational than
[2:44:04] what's actually in writing that's all
[2:44:07] thank you ms merritt
[2:44:09] so through your worship actually uh
[2:44:11] because this is a technical planning
[2:44:13] question very good question by the way
[2:44:16] i'm gonna defer to i'm going to let our
[2:44:18] planning staff respond
[2:44:21] and i see him as both miss furnace and
[2:44:23] mr casemore in the audience who wants to
[2:44:25] take it thank you maddie
[2:44:28] sorry
[2:44:30] kessler parks
[2:44:31] oh sorry sorry
[2:44:34] okay i'll go to miss furnace
[2:44:37] yes uh through you mr mayor um
[2:44:40] so yeah essentially our road closing
[2:44:42] policy um currently right now which is
[2:44:45] outdated and doesn't comply with like
[2:44:47] current municipal act requirements um it
[2:44:50] does require the township to
[2:44:53] you know advise the any adjacent
[2:44:55] property owners to a road allowance
[2:44:56] that's going to be closed in order to
[2:44:58] make them aware so if they are
[2:45:00] interested then they they could make
[2:45:02] potentially their own applications so in
[2:45:04] this case we have received an
[2:45:05] application from the property owner on
[2:45:08] bath road um the rationale for staff not
[2:45:12] recommending that that portion um be
[2:45:15] sold to that property owner is because
[2:45:17] the entire
[2:45:18] um the entire
[2:45:20] area there is designated industrial in
[2:45:23] the official plan and it's also zoned
[2:45:25] general industrial um
[2:45:27] including the residential property um so
[2:45:30] essentially when we're reviewing the
[2:45:32] selling of township property um we're we
[2:45:35] are recommending it be given to the
[2:45:36] other property owner the entire piece
[2:45:39] and that um the other land holding isn't
[2:45:41] is also an industrial property and it's
[2:45:43] proposing industrial uses
[2:45:46] the other property is a residential
[2:45:48] property so it's it's a legal
[2:45:50] non-conforming use um our official plan
[2:45:53] speaks to any land use that doesn't
[2:45:55] conform to land use designations in in
[2:45:58] the official plan um in general should
[2:46:01] cease to exist over over time in the in
[2:46:04] the long term um however in special
[2:46:06] circumstances we can consider extension
[2:46:10] extending or enlarging these types of
[2:46:12] properties um specifically said to avoid
[2:46:15] unnecessary hardship um so where these
[2:46:18] have kind of typically been considered
[2:46:20] is for example if
[2:46:22] if a well is straddling lot lines
[2:46:25] or where we mostly see these is if
[2:46:27] someone has a legal non-conforming
[2:46:28] residential structure and they want to
[2:46:31] expand um you know have an accessory
[2:46:34] structure because they want to detach
[2:46:35] garage on it then you know we could
[2:46:37] entertain expanding the use that way but
[2:46:39] but typically not entertaining um
[2:46:42] expanding a residential property in an
[2:46:44] industrial area due to the conflicting
[2:46:47] land uses um so that's um the other
[2:46:50] thing to note as well is it wouldn't be
[2:46:52] permitted as of right so if council did
[2:46:55] choose to to want to
[2:46:57] proceed with offering on that portion of
[2:46:59] the road allowance um to this property
[2:47:01] owner it would have to be contingent
[2:47:02] upon getting committee of adjustment
[2:47:04] approval as a planning act application
[2:47:06] is required to enlarge
[2:47:08] a non-conforming use
[2:47:12] to provide your answer cancer booner
[2:47:15] it was fantastic answer thank you very
[2:47:17] much thank you
[2:47:19] any other questions with regard to this
[2:47:21] report
[2:47:24] i'm seeing no further questions do i
[2:47:26] have a mover
[2:47:29] we have a recommendation with uh
[2:47:31] four parts
[2:47:37] anyone
[2:47:41] counselor bootrick go ahead
[2:47:44] um i would uh with that great
[2:47:46] explanation except the recommendations
[2:47:49] so one through four
[2:47:51] thank you
[2:47:52] and so moved do i have a seconder
[2:47:56] counselor gordon thank you
[2:47:59] any comments from the mover and
[2:48:00] secondary
[2:48:03] anyone else have comment
[2:48:07] seeing none i will call the question all
[2:48:09] those in favor please raise a hand
[2:48:13] and he
[2:48:14] opposed motion is carried
[2:48:18] we move forward we get to
[2:48:21] something under emergency
[2:48:23] notices of motion or direct motion is
[2:48:25] there anyone on council that wishes to
[2:48:27] put forward a notice of motion or
[2:48:29] request a direct motion
[2:48:34] i'm seeing no such new hands
[2:48:38] so we come to the consent agenda for the
[2:48:40] purpose of convenience and for
[2:48:41] expediting meetings matters of business
[2:48:43] that are repetitive or routine in nature
[2:48:45] included in the consent agenda and all
[2:48:47] such matters
[2:48:49] of business contained in the consent
[2:48:51] agenda are voted on collectively a
[2:48:53] particular matter of business may be
[2:48:55] singled out from the consent agenda for
[2:48:56] debate or for separate vote upon the
[2:48:58] request of any member of council
[2:49:01] in the case of a separate vote the
[2:49:02] excluded matter of business is severed
[2:49:04] from the consent agenda each and every
[2:49:06] matter of business contained in the
[2:49:08] consent agenda is recorded separately in
[2:49:10] the minutes of the meeting is there
[2:49:12] anything that any member of council
[2:49:14] wishes to extract from the consent
[2:49:16] agenda
[2:49:19] deputy go ahead
[2:49:22] item 23.3 the province-wide property
[2:49:25] assessment update postponement
[2:49:27] 23.3
[2:49:29] anything else that anyone wishes to
[2:49:31] separate
[2:49:34] deputy eric councillor guard my
[2:49:35] counselor town sorry
[2:49:41] 22.4 your worship
[2:49:45] okay anything else from anyone
[2:49:50] i'm seeing no further
[2:49:52] extractions and i'll ask for a motion on
[2:49:55] the consent agenda without the
[2:49:56] extractions
[2:50:00] go to the deputy and counselor town and
[2:50:02] seconding
[2:50:03] and anything further any comments
[2:50:06] i'll call the question on the consent
[2:50:08] agenda all those in favor please raise a
[2:50:10] hand
[2:50:13] and the opposed motion is carried
[2:50:15] we move to 22.4
[2:50:19] which is the renewable energy fund grant
[2:50:22] review committee applications
[2:50:24] council 10 and you ask for that to be
[2:50:26] separated
[2:50:28] yes thank you worship i just have um a
[2:50:30] question uh
[2:50:32] to the author in the report
[2:50:36] it says
[2:50:37] applications for the first funding
[2:50:39] period of the renewable energy fund
[2:50:41] grant will be available january 3rd 2022
[2:50:44] and due no later than february 1st 2022
[2:50:49] elsewhere in the report it indicated
[2:50:52] that there
[2:50:54] had only been one application for the
[2:50:57] subcommittee for awards two and three
[2:51:00] uh and that uh it was going to be
[2:51:02] re-advertised so am i to understand
[2:51:05] based on the beginning of the
[2:51:06] application period in january
[2:51:09] that the applications will will be
[2:51:12] received and sort of essentially put
[2:51:16] on hold until uh until that subcommittee
[2:51:20] hopefully gets members that apply uh is
[2:51:22] that the correct understanding
[2:51:24] to the clerk uh through your worship uh
[2:51:27] yes so
[2:51:29] basically we have enough applications in
[2:51:31] for
[2:51:32] the award one uh committee subcommittee
[2:51:36] uh what we'll be doing is just
[2:51:38] re-advertising for award two uh three um
[2:51:44] um for the for the subcommittee uh we
[2:51:48] will be still proceeding with
[2:51:50] advertising again for the community
[2:51:52] grants uh we believe uh by the tie-in um
[2:51:56] from when the applications are done
[2:51:58] we'll be still proceeding through that
[2:52:00] with a closed session report with the
[2:52:02] applications going to council on
[2:52:04] december 13th hopefully we will
[2:52:08] get at least the minimum amount if not
[2:52:10] more for the other subcommittee that
[2:52:12] will go
[2:52:13] uh my understanding would be or the
[2:52:15] proposal would be if we don't we would
[2:52:18] still proceed with the uh the committee
[2:52:21] that has enough and then it would be a
[2:52:23] direction from council on how they want
[2:52:25] to proceed if we don't receive enough uh
[2:52:28] the applications for the grant would be
[2:52:30] coming in uh by the end um
[2:52:33] sorry by february first of the end of
[2:52:35] january and then they would be going to
[2:52:38] the subcommittee they'd be in play by
[2:52:40] then uh to do their review and coming to
[2:52:43] council for recommendations
[2:52:46] okay
[2:52:48] yes your worship i'm prepared to make a
[2:52:50] motion to
[2:52:52] did anyone else have a question with
[2:52:53] regard to that report
[2:52:56] saying none counselor town and go ahead
[2:52:58] with your motion
[2:52:59] i move to receive for information
[2:53:02] motion to receive for information do i
[2:53:04] have a seconder
[2:53:06] counselor broderick thank you
[2:53:08] any comments
[2:53:11] seeing none from anyone i'll call the
[2:53:13] question on 22.4 all those in favor
[2:53:16] please raise a hand
[2:53:18] any opposed motion is carried we move to
[2:53:21] 23.3
[2:53:25] property assessment update postponement
[2:53:28] and the deputy asked for this to be
[2:53:29] separated go ahead sir yes i'm prepared
[2:53:32] to make a motion to
[2:53:34] receive and support
[2:53:36] motion to receive and support and do i
[2:53:38] have a secondary for that
[2:53:42] counselor gordon thank you deputy would
[2:53:44] you like to make comment yeah this is
[2:53:46] just uh
[2:53:47] this is bothersome for me that uh
[2:53:49] it's just extended for an extra two
[2:53:52] years with really no explanation that
[2:53:53] the property assessments aren't going to
[2:53:56] be updated um
[2:53:58] it's going to make it that we're going
[2:53:59] to be working on
[2:54:00] valuations that are 8 years old
[2:54:03] which i realize as far as us setting a
[2:54:05] budget
[2:54:06] we we base we base our budgets on
[2:54:09] whatever we're provided with so that's
[2:54:11] all we can work with and we're that's
[2:54:12] defendable
[2:54:14] but um
[2:54:15] any potential impacts to residents is
[2:54:18] going to be compounded by the extended
[2:54:20] period of time
[2:54:22] i don't want to get back to the point
[2:54:23] where we're basically working with mill
[2:54:24] rates i'd like to stay current and be
[2:54:27] able to defend
[2:54:29] our actions by saying that we are
[2:54:31] dealing with current assessment values
[2:54:34] provincially as provided by the province
[2:54:36] and right now by the end of eight years
[2:54:38] that statement
[2:54:40] isn't really going to be able to be made
[2:54:41] anymore so if there's properties that
[2:54:43] have escalated in price and when it
[2:54:46] finally is evaluated um there's going to
[2:54:48] be some residents that are going to be
[2:54:50] very unhappy
[2:54:51] and i just i'd like to see it taken care
[2:54:53] of before then
[2:54:55] thank you
[2:54:56] so i can turn the other comment
[2:54:59] no anyone else have comment
[2:55:03] seeing no further comment the motion is
[2:55:05] to receive and support
[2:55:07] i will call the question all those in
[2:55:09] favor please raise a hand
[2:55:11] any opposed
[2:55:13] motion is carried
[2:55:14] thank you thank you both for pulling
[2:55:16] those out
[2:55:17] let me move forward to
[2:55:20] new business updates from members
[2:55:22] appointed to county council committees
[2:55:24] and their local boards is there anything
[2:55:26] that any member of council wishes to
[2:55:28] bring forward from one of their
[2:55:31] appointed board committees
[2:55:35] deputy go ahead
[2:55:37] if i may um
[2:55:39] i i attended
[2:55:41] this i actually attended on behalf of
[2:55:42] the county but i represented the county
[2:55:45] from the township so i'm going to bring
[2:55:46] it here as well because it it relates to
[2:55:48] our municipality i did a tour of the
[2:55:51] lafarge plant um
[2:55:53] with uh with some of the lafarge
[2:55:55] representatives from the committee um
[2:55:58] that we also have counselor parks sits
[2:56:00] on the committee as well and uh
[2:56:03] it was really impressive to see the
[2:56:05] amount of energy the money
[2:56:07] that's gone into that uh facility
[2:56:10] and
[2:56:12] for the betterment of our residents but
[2:56:14] also for the betterment of the
[2:56:15] environment some of the things that
[2:56:16] they've brought into place they're
[2:56:18] they're making use of uh material that
[2:56:20] would otherwise be in landfill
[2:56:22] um and making it a a viable fuel option
[2:56:27] and also using um ammonia to be able to
[2:56:30] basically reduce the greenhouse gas
[2:56:32] emissions
[2:56:34] then
[2:56:35] instead of putting out gases you're
[2:56:37] basically putting out moisture and to
[2:56:40] see the technology in place it's pretty
[2:56:42] uh for me with my background in
[2:56:44] engineering i mean
[2:56:46] i love it that's my thing is to to try
[2:56:49] and figure out how this stuff works and
[2:56:50] and be able to look at it
[2:56:52] that way so um it's not completed yet
[2:56:55] it's going to be going on for at least
[2:56:57] one more year because as the remainder
[2:56:59] has been done during shutdown um
[2:57:02] but uh they've put millions and millions
[2:57:04] of dollars into this and uh
[2:57:07] it's it's it's better for everyone when
[2:57:08] it's the environment and it's good for
[2:57:09] our township when it helps our residents
[2:57:13] thank you for bringing that forward
[2:57:14] is there anything else anyone wishes to
[2:57:16] bring forward from their committees or
[2:57:19] local boards
[2:57:22] i'm seeing none
[2:57:24] and
[2:57:25] we move to
[2:57:26] members privilege is there anything that
[2:57:28] we would like to bring forward under
[2:57:29] members privilege
[2:57:33] council
[2:57:35] none
[2:57:36] okay then we move to the confirmatory
[2:57:38] bylaw
[2:57:41] anyone wish to make that motion
[2:57:44] i'll take councillor buderick and the
[2:57:46] deputy
[2:57:47] any comment
[2:57:48] call the question all those in favor
[2:57:51] please raise a hand
[2:57:53] any opposed
[2:57:55] motion is carried
[2:57:57] okay
[2:57:58] upcoming meeting dates on december the
[2:58:00] 6th we are scheduled for committee the
[2:58:02] adjustment and community of the whole
[2:58:04] budget
[2:58:05] december the 9th we will have another
[2:58:06] community of the whole budget
[2:58:08] for a council meeting on december the
[2:58:10] 13th
[2:58:12] are there any other meetings to make
[2:58:13] note of
[2:58:17] i see none
[2:58:19] and we will call and then i will call
[2:58:20] for a motion to adjourn
[2:58:24] counselor budaric so move counselor town
[2:58:26] in seconds
[2:58:28] any comment
[2:58:29] i'll call the question all those in
[2:58:31] favor please raise a hand
[2:58:33] and the opposed motion is carried we are
[2:58:35] adjourned and we did get it in before 10
[2:58:38] o'clock we didn't have to make that
[2:58:39] special motion have a great evening
[2:58:41] folks i thank you all for sticking with
[2:58:43] it and to our audience we appreciate
[2:58:46] your attendance as well and have a great
[2:58:48] evening and the rest of your week
